noted for those in the audience that comments are to be addressed to the mayor and council as a whole comments heard under this item will be limited to three minutes per person and may pertain to matters both on and off the council's agenda please note that council may not take action upon any matter not agendized on today's agenda when you are called on for public comment please state your name for the record and begin speaking the timer will begin when you say your name and you will be afforded three minutes if you're an attendee in the zoo meeting and would like to make public comment please raise your hand at this time lastly while in this room please be respectful warnings will be issued by the presiding officer if there is disruptive behavior and you will be asked to leave chambers if the behavior continues our first public commenter today is farah downey followed by terry brooks followed by jerry miff said good morning good morning just putting that up so that uh that can be up so for the people at home too uh for the record my name is farah downey i'm the ceo of jf downey we're a realty consulting firm and i'm here on behalf of a program that we have developed and currently operate for the reno housing authority it's called the eviction emergency eviction prevention program of northern nevada let me say that again because it's long emergency eviction prevention program of northern nevada and what we predominantly specialize in under this program is eviction prevention crisis relocation and housing navigation i wanted to come and kind of alert everybody top down because we're already finding great success we're going into our second year and our third approval under the reno housing authority uh in our first year i think we did about 370 cases total uh and this year we're finding and most of you know that i was running that predominantly by myself but at our last approval we were able to expand and we're really excited about that we were able to bring on a um a beautiful bilingual intake specialist we have a junior advisor and we have now myself as the senior um the services that we're putting out there were actually on 2-1-1 now so a lot of a wide variety of resources out there and we're getting a lot of new referrals that we haven't seen before and i just want to say that the city arena we've partnered with the the courts were a proud um uh what is it called a community partner a provider over at community court so we're really happy about that and we're seeing our numbers over at ethan go anywhere from 100 to 150 per month now so again we've had about 350 370 all year we have about 150 per month and now exponentially we're growing so much for the community we're seeing most of our clients are out of reno um so we're very pleased to be able to keep people in their homes because as you know uh it costs anywhere from about fifty four thousand to seventy thousand dollars for between for a homeless individual um the government has to pay to uh house them and between jail stays and provide services and it's it's just a way easier to prevent the eviction and to do relocations and provide that supportive services under them rather than see them fall into homelessness uh so again we're really excited about this program we're seeing it grow i just got the data back from my intake specialist because we do monthly audits that just on the 12th we had 12 new referrals a day i'm not sure if you can see how much that that that is in in the quantity of it but 12 a day is going to turn out to be about oh geez if we had 300 you know in the first year and then we're doing 150 and then now that's gonna round up to about 300 a month that that's what about a hundred times what we saw last year completely so i just wanted to come let everybody know that the services are available to all of washoe county and that obviously includes reno um and the only criteria is that they need to fall under 80 ami of their area um they have to experience some sort of uh situation of that's going to lead them to homelessness and they must be a resident of washoe county so we pretty much cover a lot of area that gives us a lot of wiggle room to provide resources to individuals that are experiencing a situation so as i said with our flyer epin.com ee ppnn.com is where you can find us and we are looking forward to servicing in the case of homelessness some politicians have opposed federal funding for schools while other politicians have supported federal fundings for schools some schools are better in rich neighborhoods while some schools are not so good in poor neighborhoods some politicians supported the head start program for the poor to get an education saying it was a key to get out of poverty by receiving a better education some supported the upward bound program to improve education so that students even the poor would benefit from education but some say that it's an individual's intelligence that determines their success in life and that opportunity has nothing to do with someone's success in life others say that opportunity does affect success in life and that equality in opportunity does help success in life some politicians want to eliminate the effects of privilege while other politicians say there are no effects of privilege some say that personal development leads to good education so they're opposed to federal involvement when it comes to education others say that social inequality leads to deprivation which then leads to a lack of education some have said that the poor don't deserve education so why should the poor even receive an education others have said that the poor do deserve education so why should the poor be deprived of education some politicians say one thing some politicians say another if we would all just come together we might learn from one another i would like to thank you all for listening to me today and i look forward to coming back when i've learned what i should say oh by the way this is chapter 38. so i only got eight more to address you well keeping track and i came up with a title for my book it's going to be called my thoughts morning can you blow that up for me i mean in the march cool you make it any bigger look at that guy okay okay good morning uh madam mayor thank you grab all of your undivided attention the catholic school nuns used to tell me that vice mayor and a new person here my name is jerry the pizza man mifset my hobby is being a whistleblower i've done this since i was 19 years old when i was an apprentice in the union and me and my uncle who was a charter member that you we brought down a union president also i've been to the labor commission at least 10 times taking in the restaurant business taking crooked greedy restaurant owners to test they all lost so i don't lose i'm an investigative reporter i had my own tv show and um i also wrote in a major newspaper as an op-ed columnist i created asap here in town which means a senior area project that has now changed to able seniors after politicians politics is a blend of two words polyps and ticks one resides here and the other there i'm also a comedian okay i also have i have an unofficial group of people that give me inside information called insider out outsiders in and that's people who are willing to leak out information from city hall and your other agencies and departments so i know what's going on believe me um gee i wanted to say this right but i believe that in the works is a potential olive branch meetings that we'll i'll be able to have with a very generous vice mayor and uh two tall oscar delgado and then maybe just maybe we could get snow white and away from the seven dwarfs and i could have a meeting with her wherever she is today [Laughter] but aren't we having fun okay i know how serious this is i have a lot of work to still do in my neighborhood and i'll i'll speak to oscar about that who is very generous with his time we met one time for 45 minutes through lunch and oscar offered me a snicker bar that was half eaten um no he's very generous with his time and i'm sure as long as he squats down a little bit when he takes a picture with me i remember taking a picture with a very high authority here and she said to me don't squat down you're making me look too short well if i stood stood straight up how much shorter would this individual look i'm not going to mention her name because she's very self-conscious about her height though she is the highest most revered person in this town okay let's see uh and nominee patri etfidi espiri tui santi my oldest brother was a catholic priest he also gave me permission to hear confession anybody want to tell me their sins for a dollar to do for our city um and i appreciated the process of going through that with you and meeting with so many people um and learning from so many people including yourself so thank you and congratulations i'm very excited for you and thank you to all of you for having taken the time to meet with me talk with me and allow me to learn from you as well it was a very informative process informative month i think is a good way of putting that very fast paced but i appreciate it i appreciate the ability to have heard from so many people and learned from so many people i look forward to doing a lot of the things i talked about through that process which is one of the reasons i'm here today is i'm still dedicated to making reno as sustainable as possible and i i think that there's other ways or i'll find other ways to make that happen and to work with all of you to make that happen and accomplish that goal to protect the city and protect the city's revenue and i'm just excited to be here and excited to see the new council member and see a full council again so thank you um and i look forward to talking with all of you all right thank you elliot very classy i try sometimes thank you mark markell followed by kai plaskin followed by gordon gossage good morning madam mayor and city council member and city manager my name is mark markell and i'm a conserving concerned junior resident i don't talk well and old so while they come here for light years since 97 explained or 98 explaining my situation i i don't know but anyways i was in a murder week a drunk driving accident crashed on their crash back in october 12th of 89 when i was 24 and we were doing a hundred miles an hour and we rolled eight times and i was ejected and the car landed on my head pretty merely come out for a month and i was in the hospital for six and a half months anyways i i i just don't want you people to take the chance and drive with the drunk driver i i i was drunk so i got in the car the drink driver but there's got there's the bus system and i i forget what i'm saying all the time god well me alive to show people and warn people what can happen if you get in the car the front driver and i just wanted it's i was a back massive the day but i hopefully i'm doing good now by expressing my uh going ahead with my giving up my my uh know how my my my experiences were ex i just don't want people to get in the car throwing drivers there's a mistake i ruined my life and i there i keep going on on you got a pretty hair missing there okay god i told you okay i'll go well thank you don't try to don't drive with drunk drivers thank you mark such a good message hi plaskin followed by gordon gossage followed by carlos eliziondo good morning council kai plasticon with the chucky meadows bicycle alliance i told my daughters that they were going to come up today but they don't one of them is saying no dad yeah both of them are feeling that way they're morning it's nice to see you two i can't believe how much you've grown up since i saw them when you were there i am yeah uh they're out of school today uh anybody know why smoking smoke yes exactly why is it so smoky we know why uh yeah climate change it's hotter and drier right so how do we prevent that and keep kids in school we uh change our modes of transportation we we ride bikes more we use the micro modal path that uh reno has been so bold and brave to to implement uh these two children ride on it on a weekly basis um my oldest daughter rode to uh to work not using the micro modal path and it was she told me it was super dangerous and she felt really uncomfortable and they represent about 30 percent of uh nevada residents ndot just came out with some statistics that showed that 30 of nevada residents don't have a driver's license so we're only catering to about um 70 of the population with our roads currently and we need to change that uh those were statistics that the trucking meadows bicycle alliance requested uh and some of you uh devin reese and and mayor hillary cheeby you're aware that uh we've had the uh league of american bicyclists and uh dutch cycling embassy here just in the past month or so to come up with plans for how we can take that model and expand it uh my daughters think that uh that that uh um modal path the protected path should be expanded to schools for instance i mean how can we oppose safety for children at schools we don't want to lose all of the work that we've been doing at the dutch cycling embassy and the bicycle friendly america workshop we'd really like to see uh that implemented in the regional plan for washoe county and our transportation plan so here's our our general ask we we would like the the city's already been leading right in this effort and we would like the city to continue that leadership effort with a couple of asks here asking city staff to coordinate with regional planners the rtc uh ndot to report in a public meeting what was learned at these workshops because there's a ton there and we have like we have a map that we can stick right into the regional plan and uh and implement it for the benefit of uh 30 of all nevadans and children as well and then the second ask is to provide a plan a budget a timeline for how to implement these life-saving concepts we have a lot of conflict on our roads there are people in town right now who've been through this conflict before and avoided it and uh we need to learn from them and implement what uh what they're telling us to do or suggesting that we do yes aye thank you very much oh one last thing there there is a public presentation tonight at 6 p.m at mckinley arts and cultural center so we hope to see you there i think we'll have you there potentially that's fantastic i was really really impressed with the work that they've done since they've been here they've really just dived right in they'd like really just have done a phenomenal job i think um i thought we were getting a presentation no are we going well we're gonna get something back from the dutch cycling embassy uh that that is a report on everything that everyone has provided um and i believe carrie um has been there we'll get one yes okay kerry koski director of public works your sydney engineer um yes what we we decided here is um we'd go ahead and we'd get all the information back from the dutch cycling group and then we would bring that back to the city council at a later times make sure that we've got everything fully baked and we've got the mapping correctly it's been really a great three days here um but we we just need a little bit more time to do that okay all right um i i was just really impressed and carrie thank you so much for being there ndot was there rtc was there a whole bunch of different stakeholders bike washout you guys phenomenal work um i love the car free school zones i think some are just really easy to implement that we can do relatively quickly so um and then to your point the dedicated bike lanes for schools we should probably do a pilot like asap and think about which school might be the best location for that i love it it's fantastic reno high school yes okay you wanna go reno okay all right all right sounds good thank you so much we look forward to tonight thank you gossage followed by carlos elizondo followed by naomi dorr hi this is gordon gossage with regenesis reno and i just wanted to use this opportunity uh to welcome council member taylor to this organization uh it is a very good thing that we have seven members certainly makes it easier to have uh four to three votes um and i would like to also mention that i am a democrat um but that i really welcome people from your party to be involved in our government we have people from democrats republicans and nonpartisans involved in our government and it's very important that we work together on the issues we can and i believe housing is one of the issues that is truly nonpartisan so i welcome you council member taylor to work with all of us who are passionate about affordable and workforce housing i also believe that all of us know that we have free and fair elections so i hope that you could uh help uh along with everybody else to get rid of some of the poison that we have in our community um and only together can we counter the poison that operation sunlight has introduced into our community so these two issues maintain free and fair elections and make sure we have more affordable and workforce housing it's so great that we have seven people from very different political backgrounds who know how to cooperate thank you very much thank you so much gordon nice to see you carlos elizondo followed by naomi dorr good morning hi my name is carlos ferguson overall uh you know all the prices you know are increasing you know every time i go to the grocery store you know i like her from uh rooms for people is every time i come to the store and i see higher prices something is going on here and you know the configuration prices and um i was at the uh suse boutique at the union location a week ago from today and 11 55 west 4th street uh space 106. and i didn't say i i i i i suggest you keep the eye on them because i didn't really say anything and they told me that i had to leave because i'm making customers feel i feel uncomfortable and their previous location i was in the news several times a few times they were unwanted by the surrounding neighborhood thank you thank you naomi dore councilwoman good morning good morning madam mayor and colleagues i think this is the only time second time i've made public comment in eight years but i feel compelled because of some activities that happen this weekend to bring them to your attention and i know that you all care about this issue it affects every ward it affects our entire city and the topic is street racing and side shows we've had street racing and side shows for decades and most of us grew up with it it's considered so almost a rite of passage with kids today it is much different it has taken a whole different turn i want to first complement the police and the actions that they've already taken they have done a number of enforcement activities joint activities with the sheriff's office sparks nhp and others to really bring to bear resources that are needed when these things get out of control i first got involved this spring when i got a call from reno town mall old town mall there was a sideshow going on there that attracted hundreds of people and the merchants were terrified the entire parking lot was torn up i worked with our police then gave them the issue many people have written in to me since then posted on facebook i've sent all that information over to our police to help identify where is this happening and what can we do about it and again i have to give them kudos for the actions they've already taken the problem is i now see it in reno town mall the target mccarran trademark down in south reno the veterans roundabout the maverick down there and now this weekend in the middle of veterans parkway right at a residential street cesina right at kerdi ranch close the entire intersection which is one of the things that happens hundreds of people came prom was getting out from damani ranch high school other things were going on they shut down the streets entirely numerous people called our police officers who did respond and i'm here to report that several people were arrested and several people were cited and there's an ongoing investigation and again kudos to them but what has happened is that my residents in ward 2 and i am sure in other areas because i understand they went up to ward 4 after that were terrified absolutely terrified they were taking video from the second stories of their houses they were calling 9-1-1 not just the non-emergency number the emergency number i'm not i'm going to show the video that was posted to me which i sent to our staff because i think that is just one more thing it's an getting up obviously but in the back of a white truck that was doing about 25 donuts was a person hanging on for dear life that could have easily gotten thrown out and in fact we've already seen cars that are escaping spectators from this issue and they have gotten into accidents right on double r so i know i'm short on time and i'll ask you for another 30 seconds i do have some recommendations i've consulted with our senior leadership in rpd our manager our city attorney our police attorney brian suti and of course my residents i've received about 50 tech social media and emails into in just the last three days so i felt compelled to bring this to your attention so what i'd like to recommend and if i may met a mayor for another 30 seconds i'd like to recommend that we bring this back as an agenda item and get an update i know the city is doing important actions it would be good for the whole council to hear about them not just me i think we need to step up police patrolling and whatever that looks like if it's additional resources but one possibility is towing of the vehicles while investigations are underway i'm not recommending car crushing but i do think impoundment would be a deterrent physical changes to our road some of my residents have written in about bots dots and other kind of things that can be used in parking lots that would restrict activity we have some city ordinances that should be looked at but i want to draw your attention to two things one is state law as of january 1st all traffic offenses will become civil offenses no longer misdemeanors whether you have a tail light out or you are engaged in this reckless endangerment it's all a civil infraction i think that we should be talking about directing our policy folks to work with the legislature to make sure that is what they intended when they down regulated civil uh traffic infractions and most importantly i would recommend implementation of a raid team similar to the one they use in las vegas it's a special unit like we have for drugs sex trafficking and other things i think it would make it a lot easier to respond and deal with the the spectators license plate readers i've gotten all kind of recommendations so i'll just i'm going to send these to you i didn't want to send them to you without any warning and i'd just love to hear a current update um from our police chief about what they're doing and then later a workshop have you not spoken to um chief soto i have of course and uh ali miller and we we had an in-depth conversation you talked about this last week we had um we've kind of been following this yeah i want to make sure you're up to date i'm pretty up to date well it doesn't seem like you're getting all the information in the sense of what pd is doing because they have really put together a comprehensive well i'm recom i am complimenting them for what they're doing i'm pretty up to date i just think that it's not enough for me to be up to date a lot of our residents i think need to know what we're doing too i am up to date and i've shared it with them i've called them i've i've spent hours on the phone with them i responded to coming to an upcoming agenda too okay that part i didn't know if it's already coming to obtain okay thank you but um i'm just here on behalf of so many people have contacted me in the last five days so i appreciate your your time thank you thank you all right madam mayor and so with that we have no additional live public comment no attendees in the zoo meeting have raised their hand for the record i'd like to note that we did receive 10 comments which were general in nature or not directly associated with an agenda item prior to 4 pm yesterday september 13th these were received as written correspondence via our reno.gov online public comment form or by email to our office and copies of these comments have been distributed to the reno city council and available on thepublicportalreno.gov they were 10 correspondence items of various concerns additionally we will transition to voicemails now of which we have six yeah hi um i live over at virginia lake and uh me and a bunch of people were always walking around there and picking picking things up throwing away and you know cleaning the lake as best we can and it's got this giant algae bloom now and uh you know it's probably going to kill all the fish and the ducks and everything else and it start it's starting to smell i know it's probably uh you know getting towards fall the lake turns over and all that but i think there should be more of an investment in virginia lake to keep it clean because you know why can't like a dog take a swim in it you know and then that development across the street all those condos over there maybe that should have been part of the deal is you know yeah we'll let you build all these but you gotta invest some money in virginia lake because all those people are gonna be coming over when that thing's full and using using the lake too and uh it's getting thrashed i mean the homeless issue with i mean they leave their garbage everywhere they poop and piss some guy said he saw this homeless woman taking a dump in the lake which you know like using it for a toilet and it's just sad because it's such a nice spot in such a nice area and the density of the population in this area is huge so it would be really nice if there was instead of i mean keep maintaining all those parks on the river downtown but this should have priority just like they do and that's my opinion and be nice to see it happen clean up the water dredge it out make it deeper have the truckee river flow in and then it flows out you know kind of comes in and out so it keeps circulating for the ducks and the fish and the birds and all that that's all i got to say and have a nice day good morning today is wednesday august 31st of around uh 11 45 a.m i was the reason i was holding this about uh you know about 18 hours about you know moving the homeless away from downtown you know because you know las vegas there's a lot of bigger cities in reno and don't have this problem they have a good keep good track of that you know control of that you know the the the the mass force free station the where you know the season think it could have been could be one of the main reasons you know there's people that come across all over the country you know they they just go by stay for a few days so they get their teeth and they keep going so on and on you know people from all over the country just keep crossing and you know all people from all over the world and i said you know he's going and i just try to think about you know other diseases they've been going on there going on you know it could be one of our main reasons just a very impression you know very environment and very appreciative from from the tourist you know area keeper we've gone through this area like i said it's a lot of bigger cities than we know i mean you see a lot of bigger than arena and i don't have that problem that you could take control of that you know so thanks for i hope you do something about it hello i just was at the transfer station needing to get rid of a queen-size mattress and they told me that their base rate is 41 41 to get rid of a mattress you guys are looking at the wrong problems you wander around you wonder why there's trash everywhere oh that's part of because there's people walking around with bags everywhere y'all are looking at the wrong problems have a great day a shame on all of you what council people what are you doing to reno cities preserve historical buildings but not reno strip it up its history and charm and put up something modern and ugly save the sinai house please and that is the salvo house people care more about historical buildings than they do about an art museum years ago my parents said reno has the worst city fathers it still holds true please save these houses and keep reno charming don't let it go thank you bye uh yes i'm just making a comment how disgusting the renault city council is for not preserving historical houses the the nay house on hill street should have been preserved and reno does nothing to preserve historical sites and it's absolutely disgusting most towns that's why people come to the town for the historical sites and buildings and this town is just a bunch of cement it's disgusting and i'm sad that this city council unlike the old bennett's city council doesn't preserve and you're pathetic that's all i have to say bye all right mr vice mayor that is the end of public comment so bravo one from the consent agenda that needs a little bit more work before we bring it back to you okay thank you so much now i'll go to my colleagues foreign oh i'm sorry councilmember delgado is right uh you've moved to approve can i get a second okay have a motion a second all in favor please signify by saying aye aye any opposed motion carries unanimously well mr vice mayor i'm sorry were we supposed to pull our items not yet i was ahead of the game uh the consented consent agenda is item b so we're still on the a item so now a5 and i'll turn it back over to madame mayer a5 for approval minutes okay thank you so much at this time um i'm actually going to send it to city manager to talk about updating the agenda done oh you already did it perfect okay great madam clerk madam mayor we're moving on to item a5 approval of the minutes right may get a motion madame or may i speak on this item go ahead yeah um so in preparation for this meeting i reviewed some minutes from about 15 years ago for an item we'll discuss later and those minutes were very detailed about the substantive nature of comments both by members of the public and by members of this body and by staff detailing what is said and the substance of those i've reviewed nevada revised statute about the content of minutes and when i review these minutes for example on items that the council members pull i don't see questions i don't see from members who pull items what the substance of their issues are and for example um there's one um item pulled b8 through 12. item um item b8 was pulled by council member records for discussion norma santiago centolio presented the staff report and asked answer questions from council member reckons there's no no reference to what my questions were and that happens to the public and that happens to members of the body in strong contrast to how minutes were done previously and i was on this body when we changed and made these minutes less detailed and the the statement by staff at that time who's no longer here but it was multiple staff people was we'll always have the video well with this most recent update the video is not as easily connected and found to these minutes i have a meeting tomorrow with the clerk to train myself on where they can be found because i understand they can be found i've i've done it a search myself i can't find them um i think we have a real problem and with these minutes um in general i think that maybe that answer years ago that well we've always had the videos probably is not even meeting what the nevada revised statute says which is the substance of the memo and so if i don't see minutes start to go back to more detail nature or a brief on this that's public for everyone to understand how we're doing minutes i will be at every time i speak because there's it's you have to say it for the record or i will say i'd like to repeat council members talks for the record because i want a history of what goes on at this meeting and from what i see two decades worth of video were probably erased and then we had about a decade of very um annotated minutes that i don't think even comply with the nrs i'm not an attorney but i know as a user of a legislative history i'm not seeing what i would hope i could see and members of the public could see so um i want to bring that up right now i'll vote to support these but for this meeting and for others i'm going to ask for on the record and i hope that we will start to have better minutes and i hope also that that link can be restored because when i did the training and was considering approval of that contract to do our new system i was told that we would have the archives thank you all right thank you so much and i'm i would just ask our city attorney will you please meet with councilman ruckus thank you so much and actually as a point of clarity madam clerk the videos have not been erased right they've been moved to a different location as we convert from one system to another um so thank you for the question we actually were able to restore the same amount that we had on the portal previously so any records that were previously available are now back on the meeting portal and are are still accessible um we do also have the links available on youtube and um additionally the things that are prior to 2012 yes are accessible on um our website through reno.gov on a separate page thank you well like i said i'll be doing a training tomorrow i've already done my own which you know a member of the public would do and if they are so disconnected in the interface then we've taken a step backward in terms of providing a history of what goes on at this body and i don't think anyone wants that if anything with technology and the investments we're making there should be greater ease of interface to a historic record but at minimum i think that we need the written minutes that we adopt to comply with the nevada revised statue and i see when i ask a question and you know it stops answers the questions and there's no reverend reference to what the nature of those questions are i see non-compliance in my view thank you all morning and thank you for having me today my name is megan o'farrell for the record and i'm here on behalf of reno food systems to extend a warm thank you to councilmember delgado for considering us for a donation of item v26 at reno food systems our vision is our vision is a vibrant resilient and just local food system cultivated by an empowered community we believe that access to nutritious healthy food is a basic human right and we strive to build food equity and access for all according to feeding america's 2020 map the meal gap data washoe county had approximately 52 000 folks experiencing food insecurity and 15 000 of those people were children under the age of 18. we have the tools and resources to do better and we must due to the ongoing effects of the global pandemic and its constraints on resources and services we can only infer that those numbers have grown for our area this is a serious community problem and it will take our whole community to develop solutions to uplift our most vulnerable neighbors into a place of food safety we must all step up to this challenge and ensure that every person in our community has the basic resources they need to thrive so thank you again councilmember delgado for stepping up for this opportunity we're grateful to be able to show up for our community through this important food justice work and we know we cannot stop here we look forward to building more partnerships and collaborations such as the food for all program that we presented to city manager thornley last fall to ensure that food insecurity becomes a thing of the past we will hope that you will join us in this work thank you so much thank you madam mayor yes go ahead thank you thank you maker for all of your hard work and everyone associated with renal food systems uh they do amazing work um at times if you go through some of my war they do a tremendous amount of work uh providing healthy food and healthy options wonder what madam mayor is on top rada if you guys are still going there to the arena housing authority to the senior not not anymore yeah they they find those food deserts they go and give fresh produce options and as we know if you don't have a straight healthy diet it'll just adds on and overlaps in terms of overall chronic issues associated with kids from early on to your seniors so thank you for the amount of work i'm happy to support keep up the great work and i would just ask councilman delgado since we're on rha to put it on a future agenda yeah i mean partnerships all right absolutely thank you okay good thank you so much megan can i also ask that you get together with my liaison my staff so we can coordinate a time for me to come and learn more about the programming i follow what you do on social media it's very impressive but i have not been to any of the harvests or any of the work days so i would like to do that so um mr chicone is here i think or no amy we'll meet with you outside just to find a date thank you so much all right madame we have one voicemail all right thank you my name is steve van zee i'm a property owner in ward 5 within the north gate 19 landscape minutes district i oppose agenda item b17 these comments are being submitted at 3 26 p.m they are not after 4 p.m the rfp had material on missions during the big process a bidder commented some of the areas in the rfc could really use a one-time clean up prior to transitioning into the maintenance phase the city directed business to bury their costs for cleanup in the bid for overall routine maintenance the rfp did not define one time cleanup and did not include any specific measurable requirements for cleanup the rfp had a material error relevant to turtle creek civilization page 37 included a topographic map highlighting the landscape area stated the highlighted area totals approximately 70 thousand square feet however washable county assessor's records show that the highlighted area actually totals 107 000 square feet reason 3 the rfp did not include any provisions to return the landscape area to its original condition at time of dedication for north state lasalle the city approved landscape plans show the original improvements included 66 trees and 596 shrubs in the parkway strip however a recent unofficial survey identified just 42 trees and 152 shrubs in the parkway strip reason 4 the staff report is inaccurate stating that the 9 districts have common landscaping along sound walls however north state 19 lasalle heights and bagpipe circle districts have a significant amount of portion a portion of landscaping next to wood fences this is a material distinction because the landscape maintenance standards include fire safety requirements specific to landscape adjacent to residential wood fences requirements which the dpr has failed to enforce reason 5 the staff report is misleading the staff reports states that the previous contract totaled 196 560 but does not disclose that the approved contract included a 100 000 contingency that was never billed to the city the current proposed contract does not include any contingency amount so the true picture is a 96 000 prior expenditure that is suddenly exploding to 350 thousand dollars reason six the staff report is incomplete the staff report does not explain why contracted landscape maintenance costs will increase anywhere from 180 percent to 622 percent for the individual districts the rfp does not identify any change in landscape maintenance requirements nor does it add new tasks that the contractor is required to perform for far too long dpr has mismanaged the landscape nation maintenance districts the recent incomplete inaccurate copy and paste rfp and the resulting grossly inflated sold bid are disservice to the 832 affected property owners the city accepted certain land parcels that were fully landscaped in accordance with at that point it became dpr's responsibility to maintain the district landscape question is will the council recognize the missteps that have led to this point and support property owners who are actually paying for this proposed contract will council reject this proposal all right madam mayor with that we have no additional public comment and we're moving on to item b10 as pulled by council member breakfast how are you going to send it to councilman yeah i am going to request a staff report on this but before i'm going to read a disclosure in the interest of full transparency on item b10 i am disclosing the fact that my husband armando ornelas is the community service director for the city of sparks item b10 is a proposed professional services agreement between the cities arena sparks and carollo engineers incorporated related to the valuation pre-design of improvements to the truckee meadows water recreation directly reclamation facility the agreement cost is one million two hundred forty six thousand seven hundred sixty eight dollars based on the city's joint ownership of the facility an existing cost share agreement reno will pay 855 656 dollars and sparks will pay the remainder of the contract's total cost on this matter i've sought guidance from the city attorney's office here because reno and sparks have an existing cost share arrangement and the parties share the same public regional wastewater treatment goals and objectives my commitment and private capacity to the interest of my spouse as an employee of the city of sparks would not clearly and material affect the independence of a judgment of a reasonable person in my position to warrant abstention under nrs 281 a 420 sub 3. c in the matter of the commission opinion 12-15 a from 2012. a public officer has a responsibility to represent constituents that vote on matters of public importance unless a clear conflict outweighs that duty madam clerk please accept this disclosure and lodge it on the record for this meeting and subsequent meetings pertaining to this agenda item thank you here you guys go anna thank you would you like me to do this presentation yeah i would i have questions about this okay matt smith uh utility services department today i'll be talking about item b10 which is the tumor disinfection and filtration evaluation pre-design services agreement so this project will be taking place at tom wharf it's on the northern side of the plant we've done most of the water treatment at this point and these are last two processes before the water is discharged what is disinfection and filtration in tumor we have the water pre-filtered water it enters those 12 filter cells on the right you see and then it is percolated through those filter cells it enters the chlorine contact tank where we dose chemicals before sending it out so how it looks at tumor you have filtration coal sand and gravel if you're familiar with like a brita filter for instance that is very similar to this process what we're trying to remove is floating particles foam and suspended solids like algae what's being evaluated this technology it works it's this building and facility was built in 1985 the technology is even older than that this is a newer technology it's called cloth media filters um we know in the near term capacity is a concern with this process and so this is just an example of what we're going to be evaluating but these cloth filters can be placed inside the existing filter cells we want to retain the existing infrastructure that's in good condition and this is in good condition i've also highlighted four filter cells because one of the new red newly retrofitted basins could have up to four times the amount of capacity of a single filter cell which um footprint is invaluable at tumworff so disinfection this is how it looks at tom wharf the filtered water enters the chlorine contact tank we dose bleach and that filtered water has potentially could have viruses bacteria this is also a process that happens in normal water treatment so we dose that bleach those particles don't like that that water is then disinfected but we don't want to disinfect the creek so we add sps sodium bisulfite to dechlorinate that water prior to discharging into the truckee what's being evaluated is um uv disinfection as one potential path forward and so we have that filtered water again and then that water travels through these ultraviolet light banks that water is then subjected to the ultraviolet light those particles again do not like that it disinfects the water and the plus side is that we don't add any bleach or sodium bisulfite it goes directly to the truckee river important note is that we will have to continue using bleach for reuse just because that is in our permit but 85 percent of the bleach we use at the plant is used for river discharge and we would be eliminating that so this is why it's recommended it's every year i do a paired comparison risk ranking evaluation with plant staff and this ranked 4 out of 33 one being the highest rank so this is a very high highly ranked uh project capacity as i discussed in the near term it is a concern for filtration at 32.6 million gallons per day we're at about 29 and a half additionally every chemical that we put into the water accumulates as total dissolved solids so we would need to have alternative disinfection at 37 million gallons per day cost savings so when we had first started looking at uv disinfection that was in fiscal year 20 before covid we were spending about a dollar a gallon for bleach and at that time we estimated that we would save about 800 000 per year in annual operating costs through chemical savings govet did a lot of bad things especially for this uh the cost of chemicals we're looking at 2.64 cents a gallon this year a substantial increase in operating costs and potential if we were to implement uv at like tomorrow we would be saving an additional 2 million dollars per year in operating costs climate change and sustainability we have bleached trucks that arrive at the plant every day we use 2 300 gallons of bleach every day we would eliminate a large portion of the amount of trucks that would be showing up at the plant as well as eliminating sodium bisulfite completely safety every time that we have the opportunity to get rid of chemicals at the plants it makes this plant more safe for our plant staff and then additionally water quality so again less chemicals in the river is a good thing so our recommendation today is to approve the consultant agreement for the disinfection and filtration evaluation pre-design agreement thank you that was very thorough so a few questions the scope says the recently completed tumbler facility plan identified hydraulic and process deficiencies associated with existing tertiary filters and you talked about near-term capacity issues um i don't know anything about that i don't where's the facility plan and what is the capacity issue so the facility plan is posted on the city of spark's website as a public document as well so it is available there the as you had pointed out hydraulic capacity is one of the issues so we have those 12 filter cells that are existing and back when those were built they did not anticipate us getting to a higher flow capacity and so that's that's the main driver for the filtration and then on the process side is the um the disinfection portion because we're adding those chemicals into the water tds or total dissolved solids is directly tied to our permit it is a permit limitation and so when we pull those chemicals out of the water that does increase our capacity so here's the issue is i had a hold on my calendar back in the spring for a sewer workshop where i presumed i was going to get a copy of this facility plan to understand you know what's four what's five what's six how much and really a blend of what's capacity because i know you know bleach or not households right now they're being treated but if it's to hit the operational capacity um you know that's that's growth and i also know we all know that sewer rates are going to go up 8 next month for the fourth quarter but we also know that hookup costs for new growth have stayed flat since 2012. so if this is a capacity project i am reluctant to vote for capacity projects from our share without having a capacity revenue stream just it's problematic for me maybe i'm missing something because i haven't read the whole um facility plan so that's why you know where where and maintenance deficiencies and deterioration of okay but even if it's if it's capacity and we haven't set a revenue stream i'm not going to go there because i'm seeing inequities in the um and you're not the finance guy i know that but it would help me to have that facility plan here in a public setting to make these items are easier for me and then you mentioned the permit with bleach in the permit is the is the permit going to be changed so we're not allowed to use bleach what's what's going on with the permit there have been discussions of a draft permit but nothing's finalized yet um in in regards to what's within that permit we we really do not know what it's going to look like we're in discussions with the ndep regarding that um bleach is just a way of disinfecting so disinfection is going to be needed whether the permit changes or not um it's just the way that we do perform that disinfection okay that's what we're proposing okay well i will reiterate my interest in a workshop specific to tumworth master plan the sewer fund and this news about the permit under discussions because does if the permit goes a certain way does it mount costs onto the operations uh without knowing what the okay which way it's going to go i can't really answer that okay thank you any other questions from council go ahead councilman reece thank you madam mayor mr smith first of all thank you for the presentation outstanding work on your part um it's hard to distill the kind of science in a way that is understandable to the public just generally and especially when you're talking to me i'm not a scientist so all of the you know science behind the cleaning process and technology you made it understandable which i think is important because sometimes the decisions we make up here we get to spend a lot of time with you one-on-one talking about facility planning and going to the plant but the public doesn't necessarily do that so in your presentation i think it was a good mix of helping us to understand the request in front of us but also the science behind it so i appreciate you and that's not easy to do so congratulations for that the second thing i will say is that whether it's a capacity issue or not i think is not relevant there are capacity issues that we're describing and discussing through the expansion of our facilities there that is something that this body has largely supported nearly unanimously over the last several two years i think process and we do have some work to do on the rate side and some of the capacity issues about growth but this is a filtration question and i think that the technology has improved greatly since you know i suppose 1985 is where you pegged the moment of our use of it but at the end of the day you know a yes we should do the better technology which is what's being inquired of here and b we should seek to improve as an organization always right and so knowing that we have a system that is outdated but that there is the potential for other options for using or disinfecting i think is a good thing so i'm happy to support it i think it's a no-brainer and we'll look forward to understanding what comes out of the kind of the analysis that these experts will come back to because my guess is as even even today they're developing newer technologies right they're always developing newer technologies but appreciate the work that has gotten us to this point and will be supportive all right any other questions from council members seeing that there are none council on breakfast anymore i won't be supporting this this is 1.2 million dollars for design to uh improvements under master plan that has not come before this body to know the incredible scope of what we're looking at at time warp they just filter in in addition to the plan expansion where we've taken 65 million dollars of loan up in the north valleys when we've maintained connection fees flat for over a decade for all the growth that's come in and when the calls start coming in in october for people's sewer rates going up eight percent and the calls will come in at least they come in from ward one to me and then you know a lot of our tenants have it passed on to their housing costs i just cannot go there i cannot go there because i don't think that the revenues are being equitably distributed and so i won't be supporting a design for this project thank you move to impressed i am tell morph in particular is a particularly technical and difficult process to understand and you do an excellent job of explaining it thank you for the effort you put into these yeah thank you right madam mayor we're moving on to item b12 as pulled by council member delgado okay go right ahead councilman thank you madam mayor uh it's more than anything just want to highlight to the community the this has been under discussion for several years now we had an opportunity to support through cdbg funds to provide additional security at taglia park thank you to the cdbg subcommittee for supporting this there'll be three gates installed as we know at titlia park we've had some camping overnight at these few different parking lot areas so to allow for security in the evenings especially as kids are going to school this park is has so many families from from from cradle to to our seniors and so i just wanted to thank you and uh kind of marty anything to highlight to the community that these are coming here and they're in the near term so with with that being said no need for a presentation i just moved to a proof i have a motion i have a second all those in favor say aye all right all those opposed promotion carries all right madam clerk i believe we're going to go to council and breakfast um item b13 thank you yeah this is for a master plan uh in wingfield and barbara bennett parks um and it's timely and i've been you know looking forward to this and i appreciate it stop bringing it forward because the arlington bridge is going to be redone i just want to ask about the decision to contract directly with this company um stantec um does parks have a rotational consulting list like public works does for sole source do you have a list you i know public works goes out and for the record jamie schroeder director of parks and recreation we use the same list oh you use the same list okay so i think in my briefing i was told that you went with stan tech because they're also the consultant on the bridge design now i wanna i wanna understand um why you think there's an advantage to that to me sometimes you want division among consultants because you know if they're if they're on on contract to rtc and those rtc design you know say the slope or toe of the bridge is different than you know our interest for saving you know a plaque or a bench you know who are they serving who are they representing so um but you all found efficiency in that and i want to i want to understand that because it's sole source and then also um what's maybe what's the timing will the bridge design be done and so then they've closed up their work with rtc and then they can move on to to ours again for the record jamie schroeder director of parks and recreation so we spoke with the consultant to ensure that there was no conflict stantec specializes in those road projects as well as doing park master plans and so reiterating that this is the most efficient use of the dollars parks often has to ensure that we maximize the funding that we get we have seen an increased amount of funding from this body so we greatly appreciate that and then as far as the timing goes with the arlington bridge project the consultant has that capacity to be able to ensure that the master plan will be completed prior to the start of the construction of those bridges which gives us that opportunity should there be some improvements we can make while the water is being diverted it would allow us to be able to do that without having to go through a very rigorous permitting process and so by doing this bringing it forward now it really just capitalizes on a project that's being done and we can sort of ride those coattails if we have that opportunity okay so you believe there's financial efficiencies that they'll have the base maps and familiarity and not any issues you know coming in of competing interests between the two agencies okay um i can accept that um i just wanted to air it because i my preference would you know maybe be to have a different set of eyes on it on our behalf the other thing when when we spoke you mentioned the time that's another reason why obviously time is money correct uh stantec believes that they'll be able to get this master plan and approximately done in approximately 10 months and that will include stakeholder meetings with the area residents whitewater park users special event promoters so we're going to make sure that it's very inclusive okay great thank you all right count on breakfast go ahead oh oh go ahead oh thank you go ahead um i'm sorry we are back to our bottles um so i just wanted to ask actually either one of you um so i served for about six years on the art town board and one of their biggest issues in wingfield was a sound system the second biggest issue at wingfield was the the dressing area called the green room call it the whatever the get ready room you know so that axe can come on and off it was set up in such a way that there's just a really tiny space for maintenance equipment and that was to my knowledge emptied out and it became sort of the dressing room what i would love to see in this master plan i just wanted to mention while we're talking about it is both of those issues addressed if possible i know a third issue was that even when i was on our town board we talked about i guess you could call it security there is a brick wall visibility issues how to sort of contain the park sort of similar to mr delgado's point about teglia park you know in terms of being able to control access at certain times maybe not all the time but at certain times so i just want to make sure that security uh dressing room space and most particularly the sound system is identified and addressed during this master plan if possible i am not as knowledgeable about barbara bennett park and i'm sure others would have recommendations on that but there you go thank you for those comments councilmember dewer for the record karina mercier management analyst for parks and recreation uh the master plan scope does include potential upgrades or even replacement of the amphitheater and surrounding areas i have a brief presentation if you would like to go into the item but sure i'd love to see it but i don't know about everyone else okay let me take that for a yes all right um so as mentioned this is a professional services agreement um in the amount of 139 100 dollars funds have been identified in our capital project fund and this master plan will seek to address potential upgrades or even replacement of the amphitheater whitewater park assessment and recommendations upgrades to lighting furnishing play components upgrades to sport courts and other site amenities recommendations for pathway relocation as well as recommendations for turf rehabilitation and irrigation i'd like to give some brief context as councilmember breckis already mentioned about why we are working on this project now and the answer is we'd like to complete these master plans in conjunction with the arlington avenue bridge project that the rtc is working on the city of reno and the rotc are planning the rehabilitation and potential replacement of the two arlington avenue bridges at the truckee river in this project will improve safety and flood conveyance in downtown reno so the estimated construction timeline for this project extends between 2025 and 2026 during which time wingfield and whitewater park will be closed for public access to mitigate risks associated with public safety and stantec is working with the rtc on this project and has existing knowledge of the area and its needs so with that this is the recommended motion and i'm happy to answer any more questions you might have all right go ahead count councilman reese thank you madam mayor um miss mercier thank you for the presentation um i think it's very important that the public understands what we're about to go do what i want to just say is stantec is an outstanding community partner they have done incredible work over the years in this community so i am certainly happy with the choice although i don't get to make the the list or anything like that i still think you've chosen a great partner so i just want to say thank you to your team for evaluating the folks that could be involved and making the decision as you have i think it'll be a great community partner so thank you to them for engaging with our city and in this way so thank you thank you yeah just real quick you mentioned the amphitheater in your presentation i didn't hear anything about sound is that implied i believe uh the sound because you you listed all these things like lighting and this and that but i didn't see anything about sound and that has been they haven't complained to me about lighting even they're fine with the amphitheater you know but the sound has been a a really sore issue and i wanted to make sure it was included in the scope so that stantec doesn't say well that wasn't one of the things we're supposed to look at okay so i just okay and uh i'm just thrilled you're doing this though thank you and also your point about while the river is dry fixing the whitewater park i should have commented on that earlier this is the time i mean getting the water moved from one side of the river to the other is a huge undertaking we saw that with virginia street bridge and other improvements now is the time so thank you for the for the great foresight thank you now i'll make a motion and also by making the motion request that my comments miss doers and the presentation by staff be included in the record as i did for that previous item on b10 thank it's so nice to see you at the podium it's nice to see you too i love it all right good job all right madame we're moving on to item b17 as pulled by council member door i just wanted to pull this item because we got quite a few letters and we we heard even some comment about the increase in cost for the maintenance and there were two concerns it seemed like to me and i hope you could address these in a presentation one of the concerns seemed to be well the increase in cost and the fact that there was only one bidder so i know costs have increased obviously but these seem to be maybe tripling and it seemed to be implied that we were including cleanups big cleanups that need to be done before maintenance even begins so if you could address that and then the other issue seemed to be that i that i keyed in on was it looks like they've lost up to half of their their landscaping in terms of bushes trees that were supposed to be there and that almost seems like a code enforcement issue but i don't know who we're enforcing against is it these different subdivisions uh you know hoas is it ourselves because it's our landscaping i i don't if you could address that while you're doing your presentation that'd be great sure absolutely for the record matt brazina city of reno parks manager and today i'm bringing forward a contract for landscape maintenance at our landscape maintenance districts in the northwest instead areas of reno so i'll go through a brief uh presentation first council member doer and then i'll address your questions individually and i'll just reserve the rest of my time for a later question yes okay thanks so i think it's important first to identify what exactly a landscape maintenance district is i'll uh you'll commonly hear me abbreviate that with lmd it's a lot easier to say obviously but landscape maintenance districts are dedicated common areas in what people would typically assume are homeowners association maintained areas of a development in these instances the developer elected to turn over the maintenance to the city of reno the city of reno would either take it on themselves or contract the maintenance out and then assess the homeowners with the the cost of the maintenance these lmd's are governed by nrs and rmc and the city of reno currently maintains or oversees the maintenance of nine landscape maintenance districts instead and in northwest reno so here's a small map of the landscape maintenance districts in the northwest obviously highlighted in the bright pink and most of them are in the the major arterial roadway corridors of rob drive avenida delanda and west 7th street instead both landscape maintenance districts are along bagpipe circle and silver lake road so the city followed the staff followed the city standard rfp process for this we put it out to bid and receive one bid in return and that was from reliance home services the contract details will include an initial two-year contract with two one-year contract extensions the landscaper will provide weekly and monthly landscape schedules to staff and then staff will perform monthly inspections to make sure that the landscapers are compliant a list of the common services the contractor will be responsible for on the right including tree and shrub maintenance irrigation repair maintenance and testing and then a large one for us is snow removal in these areas it is important to note the increase in cost one important aspect of the cost is the amount of the two prior maintenance contracts were substantially lower however we haven't seen an increase in costs since 2013. as you all are well aware and we've seen 50 increases in supplies and labor just in the past two years let alone the past nine so the the proposed contract is not out of um it's not out of the ordinary it's it's not substantially larger than what we'd see as a landscape contract elsewhere reliance is a reputable local landscape company and they currently do service the entire somerset landscaped area so with that i uh i move for council to approve the pr the contract and i'll answer any questions councilmember dewer yeah thank you thank you just have some general questions um who insures the work product so they go out and do it do you guys inspect periodically how how do we keep the stuff alive because there there is this that the developers in these various places did a good job getting this stuff established the trees the bushes but they've died and so do we do we go back on the previous landscape maintenance i mean everything half of your stuff shouldn't die maybe ten percent i get it so what what do you think about that that's number one two then what's the accountability like what if we're not happy with what they're doing and then number three um you know a number of the people that wrote in said that there was a hundred thousand dollars in the contract that was for unforeseen and and you know they want to compare apples to apples make sure that the base contract to the base contract is compared not the contract with the with the overages but maybe the new contract also includes 100 grand for overages i don't know so if you could just speak to who insures the work product do you guys go out and inspect or do you wait for complaints how is the accountability um carried forward how are we going to get these trees replaced that we've lost a third of them it sounds like since 2013 half the bushes so how do we address those things yes thank you so as far as accountability our staff park maintenance staff does perform periodic inspections the the park supervisors analyze each landscape maintenance district and report those results to myself as far as replacement of trees and shrubs that falls on the city of reno to organize however the landscape maintenance districts or the homeowners in those districts would be assessed the the cost for replacement so it's not always it's not easy or routine for staff to replace one-off bushes and then issue those assessments i have surveyed the landscape districts in the past year and a half and have noticed that there is substantial die-off in a few of them not all of them but i think that that's something that this that park maintenance staff does need to implement in the next couple years and as far as a large overhaul of the the missing and dying trees and shrubs okay so do we um and like for example it's good in some areas not good in others so do you think that could be an irrigation issue um and then who pays for the irrigation in these landscape districts so this the the water meters are city of reno water meters so the city is paying the water for these districts um and then and then is it back build to the sad or something it is yes yes all landscape where all charges are billed back to the the homeowners in the districts um as far as the quality the irrigation these areas are tough to maintain um they're along roadways they're in very high visible and um and highly driven areas so we deal with a lot of accidents a lot of irrigation disruption staff are constantly monitoring the irrigation to make sure it's in compliance but the the drip emitters and and the fine tuning of the irrigation falls on the the landscape contractor well my time's up but i guess you'll hold reliance accountable for ensuring that the emitters work if they plant new trees or we plant new trees it sounds like that that they live and i'll perhaps have more questions after mr brazina i'll direct my comments to you i think councilmember dewer is um making an excellent point that if there is a landscape that we have set up the lmd's for and it is at a certain character or quality we want to ensure that in perpetuity right we don't want to see you know having installed beautiful landscaping on day one and coming back six years later and seeing it all dead right i think you don't want that either so i make an assumption that because there's a contract that there are obligations under the contract and we will use the contract to ensure accountability is that a fairer assessment absolutely okay so now that we've moved beyond that let me ask this question councilmember dewer held a really incredible tree planting this last weekend i was not able to be there but hundreds of people showed up i think one of the church stakes was very involved in it and there were trees planted i'm wondering if there are opportunities for us to you know partner with community groups or even the neighborhood we have a spring seedling sale we do some different things i'm just saying if there's a cost to be born in making sure that the landscape is up to a certain standard can't we spread that out by partnering with groups can't we through the parks department make sure that you know we're playing our own role only in as much as i want to make sure that again what was planted on day one is maintained in perpetuity and if there's a third dying off let's fix that whatever we have to do to fix it either that's us coming alongside and shoring it up through you know the helpful uh you know auspices of you know councilmember dewer who is very good about speaking for the trees so i just want to make sure that we're doing that is there are there opportunities like that there are opportunities for that um and you make a great point i i think it would there are also opportunities to involve the homeowners in the individual districts to volunteer their time and efforts into improving these areas i mean at the end of the day you've brought to us a contract we all know that contract prices have gone up you went through the normal rfp process the only qualified or there was only one bid i think that's the nature of the world we live in currently i live inside one of these areas too and there's both the hoa at times and then there's other uh there's lmds involved so understand how they work but um you know i'm happy to support the undertaking um and and we'll see where we get to here on a motion does anyone else have any questions on this item councilmember taylor it looks like you've got your thank you mr vice chair and thank you councilwonder for bringing this up i appreciate that um matt i just have a couple quick questions for you i i'm wondering if you looked at what this would look like financially if the city took on this responsibility instead of a consultant i did actually at a bare minimum the city would need to hire two park maintenance workers to cover the the maintenance challenges at these sites for those two maintenance workers the cost would be approximately 149 000 just with labor and benefits per year so with a yearly contract of 175 thousand dollars with a landscape contractor i've staff feels that there is much more um much more involvement much more labor to be used through a contracted service okay so there's a cost savings going with the consultant there would be yeah and uh and a level of service so with with a landscape contract um the crews would be larger the landscape would be more maybe more detailed a crew of two or even three park maintenance workers would struggle to keep up with with an average um an average quality at best okay thank you so much thank you for taking the time to explain the districts to me i appreciate that thank you let's remember breakfast yeah i feel um like weighing in on this because i have um probably the only person in the organization with jeff mangan who has the history on this detailed um these uh came on pursuant to a statute adopted 1998 session 2000 session by our local development community and they really wanted an ordinance for the city and city staff was very opposed to it did not want to take on this responsibility i um was tasked with writing the ordinance actually when it when it happened and um as you see we only have eight and so they only came on during a brief period of years mostly up related to the north gate uh subdivisions some were up instead and at one point i think staff got to the point of saying you know these are a big headache and we should go the hoa route and everything has been the hoa route since then in my world view of looking at the housing issues in the city of reno and how i wanted to see the master plan implemented we would have a very strong robust analysis on the hoa model because that's the only model in this in in nevada and i've talked to community managers about it in reno in the last 20 years four detached single-family homes you're in nha you're not and a city that's really trying to tackle housing is going to do analysis on that this was a model it was favored but maybe it has a future i don't know that's a side issue i want to go into a constituent issue if this was in ward 1 this item would have come forward for briefing to the council it would have gone to the ward one neighborhood advisory board each one say there's four in ward one would have shown you you know what your average cost is how much it's going off up and i also would require a capital needs assessment much like hoas do on you know what's what's the program for you know the faulty areas this area is going to get needed and so on um i i use my neighborhood advisory board like that and i would have done all of that before we know and out for bid um but it's not a wart one issue but when's your calendaring is it a july one assessment cycle yes july 1 and january 1. oh okay so it goes into effect okay because you hate to lose someone who went through good faith bidding i don't see any bidding irregularities but i do believe that something like this should have gone through a little more policy discussion and approach um in terms of you know a constituent issue in addition to and i don't lose the concept how we develop our community in hoas lmd's or models of design that don't involve any because these you know we these are interesting um i re i looked detailed over every single one of these i brought several to council i believe i looked at all the um improvements and and i think we need to rethink how we develop new communities but thank you councilmember weber thank you so much matt thank you and i know that we've had this discussion but i want to ask a question i heard public comment and someone mentioned bagpipe that's an area that i used to live in and one of the things that i've been concerned about over the years is because i believe it that this landscape was dedicated to the city of reno years ago as councilmember breckis said 96 97 maybe even earlier than that for this particular one on the turtle what you're calling turtle creek silver shores over the years have have constituents have people that are in that area there is no homeowners association for silver shores specifically but i know the city of reno i have had to call in and ask what we're doing there's a lot of dead trees sorry to say it hasn't been maintained uh but now are we just is it that we're just starting this again by making these groups have we been responsible up until now and if so what were we doing then and what are we doing now thank you for your questions um so we have these the area you referenced has been a part of the landscape maintenance district since its inception and i'm certain that the level of service at those sites are directly related to the cost of the contract contract prices will go up in this in or yeah assessment prices contract prices will go up in this assessment or this contract round um but we expect that the level of service will go up as well okay so they have been assessed already these people have already been assessed over these years yes each one of these areas including the areas you speak of are landscape maintenance districts which are similar to homeowners associations however the the city is the one responsible for organizing the maintenance okay i am concerned about this um i i did not understand um that they've already been assessed and that now we're going to increase the assessment for the work um i just think it's been negated all this time and i know for a fact that i've had to call in and ask when is it going to be cleaned up and that sort of thing and it hasn't been um so they're paying for something that hasn't been done and now they're going to be assessed more and hopefully it will be but i i just am concerned about this specific area i can't speak for anything else but i do i'm quite aware of what's gone on there and and i do appreciate the fact that we're talking about trying to get you know maybe volunteer groups and what have you to come out because i used to do that um so i i think it's important that we get the community involved but i'd like to know a little bit more about this and i guess i'll find out as we go council member breakfast did you have additional comments yeah what when's the bid um expire it is a two-year contract starting this year no no the solicitation bid when is it 60 days stale or something you know when does it no wonder you're bidding anyway i i think what has happened is that some of this is normal wear and tear of 20 year old landscaping i didn't go by as my field trip for this meeting and look but i would suspect having you know looked at the plans years ago that some of this is normal wear and tear they are high use areas you know um and we got cut short we got cut short because we didn't have capital plans for each one built in to do you know the what what an hoa would have been required to do with the reserve and all those other things and so shame on us we probably also just like the sewer connection fees let you know didn't build a reserve or didn't didn't escalate and so then you got a huge jump so i think it's you know you know i i don't know if it was in my ward i would probably want if the bid doesn't go stale to move it off a month to have some communication and i would send postcards to every single person in a landscape medium area to let them know what's going on what the concept is and everything i think that is a way to to do things but um but if your bid's gonna go stale i think you got a problem but maybe something like this should come you know a little bit more upstream okay any other additional comments or questions okay accounts member doer i just could you answer that question though when when is the bid um up just so we know the answer it's good for 60 days or something let me see if i have it in front of me if not okay i i think um i'm very moved by councilwoman weber's comments because what i hear her saying and what i'm concerned about i know you turn to me about planting trees well we plant trees in public spaces right away parks city-owned property what i don't know about these nine and i thought there were nine places is are they city-owned property can we legitimately use our resources if they are city-owned property then yes we could utilize our resources we could do volunteer efforts we could arrange a tree planting whatever but i was almost more concerned about the bushes only a third of the trees have died but it sounded like half the bush have died so we can help but i just don't know who owns a property can we legitimately work on that property with you know relief reno funds or anything and when is the bid to where we could work out some of those details so the time period is 90 days from the date of the bid opening which was in july oh july 12th so we have until october 12th not enough a lot of time so october 12th and we won't have or we will have a council meeting before then or not not i'm not suggesting pushing it off but i just want to understand sure um and then yes there are opportunities to improve the the quality of the maintenance there or the um the plant material as you're referencing however these these areas are individually assessed to the homeowners so they aren't common city of reno right of ways that's what i'm getting at which to use park maintenance funds would be um kind of out of the ordinary that's what i'm getting at is that i felt like it's not in it's not on our property so we wouldn't be using our staff to to the point before about could we do it internally because you wouldn't even be maintaining something we don't own right they are technically city right of way but oh they are but part of these yes more of an easement maybe yes well anyway i'm sure we can work through the details and i will pledge to help councilman weber if it's a volunteer effort needed or whatever but i really do think that replacing the trees working with our urban forester who can get them at lower cost in bulk might be a way to help you know work through some of these issues absolutely staff will pursue um obtaining a plan for some capital improvements at these landscape districts okay mr brazini we're to our last round of comments so councilmember weber thank you um mr vice mayor i just want to say i am supportive of moving forward i know we can work this out with the community i really want to be out there making sure that we do get the program so that they can be proud of with what we're doing for sure sorry thank you you're absolutely right i think councilmember dewer and councilmember weber both have spent a great deal of time in their awards personally cleaning up trash picking up weeds doing the work so it's very important that their you know voice is known on this issue i think it's important that you understand that these lmds are not in a vacuum because we have them all over the city right so i want to make sure that we're focusing your energy on understanding that today as we potentially move forward you'll be thinking through the process of when you are next in front of us on an lmd issue that we're having a like a deeper dive onto the i mean the structural issues that play with lmds because i think council member breckis also posits many good points about them and how they arose what their status is again i'll go back to what i said earlier we want the most beautiful city that we can be in and we trust you and this operator to work through the issues that maybe we're having a little squidginess about so that we can make sure that that is beautiful for our entire community i'm going to come to council member breakfast and then i'll come to you miss taylor i just want to say while these are on city right aways um and some of them particularly when they're on collectors or arterials you know are beautification for everyone even though they're behind someone's back fence but these are communities that got off the hook on having homeowners associations and i would strenuously object to the city taking on any responsibility without this funding revenue source i think there's a off the top admin that goes to the city and so that you know should work on the capital project or the urban forester area but while some of these are on collectors a lot are little entrance ways and those were you know those were sale points for you know those communities and they should not be passed on to the the park maintenance burden that means other parks don't get done so that so i just you know thank you councilmember i'm going to hold the item so should i make them well i'm going to see if council member taylor would like to make a motion as it's in her ward yes thank you very much council woman taylor i moved to council approve the contract for lmd member or sorry mayor sheevy we're moving on to item b18 as pulled by council member delgado all right take it away councilman thank you madam mayor um i stated in a last council meeting we talked about the the new playground going into paradise park which everyone is really excited about and this one was with uh an agreement with stantec i just wanted to ask about timelines uh just what the community is aware and we could let them know when we're breaking ground and when we expect to see restrooms and playgrounds uh in place sure um so given the cdbg funding that we were able to seize the day on uh the goal is to have everything often uh open for play and use uh no later than april 30th of 2023 april of next year awesome those are my only questions uh we want to get out as much information as possible to the community let them know and be aware of so thank you madame thank you jamie really quick question does part of that include cameras or anything like that i thought we were going to install cameras sure there's a broader initiative that we are working on to use arpa funding to install security cameras in a majority of the parks because it is proven that if the parks that do have cameras right now we see that reduction in calls for service okay thank you so much go ahead councilman reece thank you madam mayor um ms roeder i want to just sort of posit broadly paradise park so we've had meetings at cdbg we've had meetings here we have voted to approve playgrounds restrooms there's an ongoing discussion about the the building that's our community center there can you give us a maybe a broader step back and explain maybe so the public understands where we're headed with paradise park because there's also this park planner component um i find paradise park to be one of the under rated jewels of our area and so i just want to maybe see if you can't give us the broad picture about paradise park where it's headed absolutely so paradise park is our second largest park um it's approximately 34 acres um and we have again this body knows that funding for parks and recreation has been a challenge but in recent years we have been able to allocate more funding towards parks and recreation maintenance is always a challenge in all of our parks we have 22 people responsible for 87 parks to put that into perspective based on the average size of our parks and our entire park system one person is responsible for 33 acres 33 acres is equivalent to 33 football fields 33 football fields sounds simple but when you take into consideration what our parks have as far as amenities you have trash cans you have restrooms benches vegetation management trees irrigation systems so it is an incredible challenge to be able to maintain um our park system we are very fortunate to have a robust park system and i do want to take this time to always credit our park maintenance team for the amount of work that they are able to do given the resources they have so i am very proud of the team for being able to come forward come to work every day get everything done that needs to be done our parks are heavily used because everybody appreciates being able to have a park in their neighborhood so what we would like to do with paradise park is we are finally able to focus some time and attention uh with the cares act funding a couple years ago we were able to put in futsal courts that park has an overabundance of parking spaces so we put in that amenity and we are working on entering into an agreement with a consultant to do a master plan for paradise park that agreement um is under a hundred thousand dollars so it will not be coming before this body but we hope to have that contract signed in the next month or so same situation as barbara bennett and um uh wingfield park they will take approximately 10 months to complete but we will have lots of stakeholder meetings with the area the residents this there's an elementary school so we want to make sure that we take care of getting that perspective from the kids and there's that retail development that's going in across the street on audi rtc is doing the audi boulevard project so patience is what we are kindly asking for in grace as we get through making those improvements to the park because it will take some time but my hope is that in about five years that area is just going to be completely revitalized well ms shorter i thank you for the broader overview and part of it is to say thank you to you and your team because you are doing good work but also councilmember delgado is very quietly always behind the scenes working on this park and bringing others along in the process and he won't take credit for it so i'll just say thank you to him for believing in this park specifically and each time finding a couple hundred thousand here or a couple hundred thousand here you're cobbling it together over a a you know a ten or twelve year period on this council that's a legacy issue so he really deserves um a great deal of credit and my thanks so much all right councilwoman ruckus yeah two questions about this one and the other one for dick taylor how are we dealing with shade um over the structures it looked like they were just these small little uh above each piece we're not shading the whole area or the seating areas for people who accompany the young people so shade can be pricey uh thankfully there are companies out there that are recognizing that you know the the climate is getting hotter so we are looking at options they won't necessarily be the giant steel structures that people are used to seeing so the playground design does incorporate localized shade if you will i think is probably the best terminology to use and then yes we are looking at ensuring that we can do since parents don't necessarily always play on the equipment the benches that we put in will hopefully have localized shade over them as well and then if there's ability to do something similar to like shade sales we want to look at incorporating that when we can but it is it does come at a cost so we've got to balance that budget out to make sure that we we get the amenities that we're looking for and provide shade where we can thankfully dick taylor park has mature tree growth so that's not as important at dick taylor park paradise does not have that so we want to make sure that we try to include shade in the in the yeah i i really um want to advocate for shade at our parks as much as possible um there are some cities one city i saw has a whole shade plan we need to get there and you know not everyone's car has a car and everyone likes to walk to their neighborhood but i think we need if you know these cost concerns which i think are realistic we need to have a few highly amenitized shade parks in each quadrant um and you know trees maybe you know can get there i don't know i'm just really want to drive home that another thing is i see that this is a contract with stantec again we did the master plan sole source with stantec i think at our last meeting we just did the barbara bennett park sole source to stantec this is soul stories to stand i'm like tongue twister soul source to stan tech and then you said you're gonna be signing in another one under a hundred thousand is that what stan tech because they're doing the audio boulevard project okay when i start to see um and i keep an eye on this for public works they seem to rotate out but when i see a department more or less hiring a sole source of one firm i wonder what's going on within that discipline industry i wonder you know maybe it should be an overall contract rfp'd out i start to get concern and i'd just like to know why are you relying upon this firm so much off of the list for the most part it falls into alignment given again we're trying to make sure that we utilize our very limited dollars as appropriately as possible so with stantec being involved in audi that just made sense to us to be able to continue to enter into an agreement with them should we get funding for another master plan i don't know you know a different park master plan i'm not sure we would necessarily automatically go to stantec we would likely look at other firms as well but so far we're we're right in alignment with what nrs allows and all of our different professional services i understand that did you get different quotes from different landscape firms on this one though no you went straight to stantec okay i just you know i want to bring that up too because i nevada is unique in that you can sole source professional services and it's it's i always want to make sure that there's a fair and level playing field out there i haven't heard from anyone who's opposed to the reliance on stantec but it is raising flags to me thank you uh last question is uh and i appreciate my colleague councilman records questions uh more so respected to the uh shade structures uh and so it'd be cool it'd be great to just hear what that void is what that cost is associated with that um in terms of what that may look like in terms of larger sales across you know certain sections of the park um now that i'm taking my young kids to the park that much more you kind of start seeing it up front versus when you don't and then when you show up to some of these parks it gets hot pretty quick and during the summers it gets really hot um and so it's yeah it'd be great to just know what that cost looks like outside of saying that it's costly so something for snap to come back to yeah we will um when stantec finishes their designs we'll be able to know that answer awesome thank you it's gonna get worse what's that only gonna get yeah yeah absolutely second with my for this item and i was wondering if we don't need a i don't need a presentation i was wondering if you could just give us a brief description of what you and your team have been up to here because i think it's really exciting yes thank you councilmember taylor for the record jamie schroeder director of parks and recreation uh normally i would have april wolfe our therapeutic recreation specialist attend but she is currently in the middle of our military sports camp so they are learning how to fly fish up at mount rose at maryland's pond right now uh air quality thankfully was a little bit better up there so we were able to make that call to continue uh with that event this morning shout out to our municipal court system because our chief marshal is a fly fisher and she is teaching her veterans right now how to do fly fishing so i always love when we can do those partnerships and uh very exciting to see what the comments are going to be back from our veterans but a lot of our adaptive programs are grant funded april is amazing at securing all of these grants so you will often see these on the consent agenda item so this grant today that council is accepting is specific to our fit but not forgot program which if you are not familiar are the washer county area has approximately 120 000 veterans that live in our community and often they they get isolated if they have injuries whether it's physical or tbis and so the fitbit not for begotten program allows them to come into eveline mount northeast community center they get structured instruction by a certified fitness instructor on how to use fitness equipment so that they can stay in shape they take into consideration if you have injuries if you are missing a limb and we teach them how they are able to keep their physical fitness levels up after they get through i think it's about four weeks of instruction and they get a one year pass to our evelyn mountain northeast community center as well as our pools they have access to use all of our drop-in services the other section of this grant is for our military to the mountains program in which we partner with a organization in texas it's a 10-week fitness program that allows our veterans to learn how to ski or snowboard so we do a lot of dry land training we help them work out at a local fitness center in order to get the muscles in shape that they need to be able then transition to the mountain and they will then go to the mountain in the winter and learn how to ski and snowboard chief vine is also a navy veteran fantastic so on top of everything else you guys do you're doing this too so thank you very much um motion to approve all right i have a motion and a second all those in favor say aye aye all those opposed motion carries you know i do want to say there are some staff that actually and i don't i hate to call you staff but team members that live eat sleep and breathe what they do here at the city of reno jamie you're one of think we talk about that program enough but april truly phenomenal job that she's doing with our veterans and and um sort of all the accessibility stuff that she does she is phenomenal thank you so much thank you madam mayor can i just ask a quick question do we have the ability or do we already have the programs as described that you just described are they on our website um for the for folks that or just calling us thanks so much all right madam clerk sending it back to you thank you madam mayor moving on to item b-23 pulled by council member door yeah thank you and i i'm so excited about this item i thought we should at least have a brief presentation i think our employees staff team members i think they're all good words personally it's not no kind of pejorative i've been called staff for 40 years and i love it it makes me proud to be part of an organization but anyway i wondered if you could just tell us what this is about because we we all asked for this a way that we could extend the outdoor dining of the dining permits and so on with um waving the fee so could you just tell us about that sure just a little bit of history during covid we initiated the reignite reno program and that basically allowed the city to provide some flexibility to help businesses survive and really stay open during covet and all of the requirements with social distancing so now that covet is well not over but the the governor has declared we are no longer in a state of emergency those reignite reno initiatives are no longer in play those have expired so what this is today is a resolution that we will continue to waive temporarily waive the fees specific to outdoor dining and so this is anything in the public right away and as part of just overall downtown what we're trying to do is really invigorate our downtown and our midtown so this is one tool that we're hoping to use to encourage businesses to work with us to to have outdoor dining whether it's a bar or a restaurant any kind of sidewalk cafe so this is a resolution that gives us the ability to waive fees for the fiscal year 2023. all right thank you so much um i'll just add um i'm so glad you do this first of all covet or no i love outdoor dining and one of the reasons that we made the sidewalk so large in midtown was to enable these kind of activities to occur our sidewalks used to be one foot to four feet wide with often with poles in the middle of them and we not only got rid of the poles but we widen the sidewalks and when when you see a community that has outdoor dining whether it be new york city florida san francisco napa wherever it might be it creates a culture of a food culture it creates an excitement at street level and i am just so pleased that you guys have been able to figure this out now are we paying for the waiver with our arpa dollars or how are we handling that you know it for for the fees the the revenue that we generate is pretty small we're not talking uh thousands of dollars we're talking several thousand dollars good okay well kudos to you thank you for bringing this before us and i didn't want it to go um unacknowledged the work you've done thank councilwoman jordan this was a passion of hers this and other outreach activities related to cancer i wanted to acknowledge our council member reese he is able to donate council donation funds right now and um i just wanted to thank him for doing that i think it's an honor to our previous councilwoman um additionally because i couldn't just as a side note because i couldn't i went ahead and also made a contribution but from my own personal funds you know i do try to contribute to charities throughout the year and i thought this was a very deserving one and uh they did write us a letter and i was that was so sweet of them to do it was in our correspondence um you know thanking both of us but um councilwoman maurice has definitely made the bigger contributions through his funds but it's it's an important initiative i asked them are you going to be able to finish you know it's not enough to cover the entire cost and they thought they would be able to find the other funds to to do the um turn the arch pink so or paint the nevada pink excuse me on the arch so i just wanted to say that and just highlight it and move on so uh would you yeah okay i'll recommend approval of the item all much tracy wilson good afternoon at least i think it's afternoon now yes it is i'm tracy wilson as you know i represent american wild horse campaign and wild horse connection regarding mitigations for the wild horses currently residing in the area where this project's going to be i have met with jim dolan and his representatives quite a few times over the months as this project has been progressing um there are eight homes in this project which doesn't is not a huge increase 15 18. there were eight in canyons edge yes um specifically talking about canyons edge we have the eight houses that are going to sit above the canyons and that was the one we were most concerned with because those eight houses would be in the passageway to the horses getting to water we've done a lot of discussion a lot of consideration of options and i think after the last time we were here we actually came up with sort of a multi-pronged approach to address this one is grading a path on the hillside above the home sites to allow for safe passage of horses another is actually to try to continue to work towards an alternative water water source to the north east of this project to actually try to draw the horses up that way and keep them from wanting to come down to this area to begin with and then the other is being granted access for nda approved diversionary feeding to help draw the horses up the hill uh once the developer improves the grading on a dirt road that allows access to parcels farther up the hill i am confident that we're going to continue working on this and that we'll be working together to make sure that these things get done um while this project is required to have fencing in place to prevent horses from getting on roadways i want to give credit to mr dolan and to associate planner brooke oswald because we spent a lot of time discussing placement of gates types of gates where they should go what the best thing is going to be so that people have their access and are most likely to close the gates which is obviously a big one i guess what i want to say is at this time we look forward to continuing our work with mr dolan to continue to address these problems we have a written agreement between us to continue working on these um and that i you know appreciate everything that's gone into it thus far all right go ahead i'm clerk hello i am calling to submit oral testimony regarding the master plan youth change in sacramento [Music] in the hills above claim jump away case number lbt22-00048 and my comments are given increased problems in calperino with noise traffic crime and accidents it doesn't make sense to cram even more people into the hills a condo development project doesn't fit with all of the surrounding neighborhoods it is completely household this isn't what this land is known for it'll be visible to all of reno ruining a natural treasure in the hills for everyone right near cathedral canyon it'll contribute to extra road congestion versus if just houses were there there's already a huge bottleneck with damani ranch high school during start and end of day times which is particularly concerning given the historical large fire that happened in the area back in the 90s and that we may all have to evacuate at some time finally there's no justifiable reason to change this master plan except to pad someone's pockets brooklyn it's all you take it away nice to see you sorry always nice to see you uh city council madam mayor and a sincere welcome to you uh councilmember taylor my name is brook brooke oswald i'm an associate planner with uh development services uh the case before you today is case ldc220048 dp2 master plan and zoning amendment so we're looking at a master plan amendment and a zoning map amendment today to look uh specifically at the project site it's approximately eight acres and is in close proximity that is damani ranch high school so we're just to the east of damani ranch high school as i went over it is a request for a master plan amendment and zoning map amendment that i'll go into a little bit more in just a moment we do have an associated tentative map conditional use permit and minor deviation uh that uh associated tenant map is for uh 18 town homes the conditional use permit was for hillside development cluster development and cuts and fills and then we have a minor deviation that was applied 10 towards our development standards that allowed for additional density in that area this area was annexed in 2007 this was annexed at the same time that we're seeing that development just above there that is the palisades development and this was annexed at the same time things that we are looking for as we go through this we're looking at that compatibility with the surrounding zoning districts and uses that consumability with the master plan so we'll just come in a little closer on the site and a few other things so this is the canyons planned unit development that would have spent uh has been before this uh group and is continuing to move through our regional uh or sorry has gone through regional has improved and then the one that we just saw this is the canyons edge projects this is the eight homes on the 80 acres that we we spoke about about a month ago here and we have a associated uh some verbal agreements and other things associated with the virginia range and the horses associated on that range to come in just a little bit closer so we can see exactly where we are as you can see the road network above the red arrows indicating as this was developed and built out in the area we can see that stub up stub out so we have utilities and everything's in place of that area anticipating that we'd see development coming further into this area the area that they are going through is uh owned by the hoa or lennar development and that area they do have rightful easements to access their property through there this is the uh water tank that we're seeing on the hill here so this is just west to the water tank and i think one thing that we'll we'll notify is that uh large d on the hill that is known as a geoglyph just for a little fact there's approximately 500 those largely located in the western united states and they often signify civic pride so let's take a look at our master plan really quick this is our big overview of what we are big policies of what we want to do so this is currently you can see the yellow signifies single-family residential that lays largely over that established community of the palisades and we are looking at the green which is our unincorporated transition that is um when we bring that in or that annexation until um their time of development or looking at that we we applied this uh zoning to it until we see that transition and or request for future what they are requesting is to go to single family so this is uh compatible and conforming with what we have surrounding that we are not looking at any sort of uh thing that would not be compatible in that area additionally we have on our master plan we have our structure plan this is in the foothills structure plan we have several policies related to that foothill structure plan and how we develop and what we do as we reviewed that previous as i spoke about the other approval that went through planning commission has been approved by planning commission uh many of those policies were taken into time at that time of the master plan that includes preservation of open space clustering some of these other techniques hillside adaptable architecture some of these things techniques that we use as we start to develop in those hillside areas so let's look at our zoning our current zoning is ut40 that's uh unincorporated transitional 40. right above that we have sf3 that would be single family three units per acre as you can see what they have done in that palisades development is they've clustered those and then they've created larger portions of open space the pud that you see up in the top right corner there that's the canyons canyons development pud what they are asking to do is to go to sf eight that sf8 zoning that single family eight units per acre that is conforming under that single family neighborhood so we are seeing that sf3 to sf-8 which should be noted in with that sf 8 development so we have 8 acres we have 8 units per acre 64 acres or 64 units would be allowed because we're going into that hillside we have hillside calculations number of uh other things we're seeing the proposal that came in is 18 acres so that's roughly about uh one unit per half acre to three quarter acre and they have clustered those and preserved the open space the red line is indicating our current city boundary uh the nz is not zoning it is has a county zoning surrounding the county zoning that county zoning is um is within our sphere of influence so we're seeing our sphere of influence there so we do have jurisdictional control of those uh those could develop but we'd anticipate annexations tentative maps a number of other public hearings would have to happen before approval of those properties could develop additionally as we as we've stated very many times on the virginia range that virginia range is privately held properly for for the most part and especially as we see in the surrounding area it is all privately held property so as staff did the analysis on both our zoning map and our master plan amendment we look at that compatibility our compliance with our rules from our state law to our local on our master plan we're looking at we have those public services and utilities that i noticed noted on that stub out and that this is not detrimental to public health safety or welfare so with that um that concludes my presentation i can leave you with i leave you with two um recommendations or recommendations for motions uh one relates to the resolution and the master plan and the other to the zoning map amendment and i'm available for questions as needed thank you great job thank you excellent um i always think you do excellent presentations i appreciate that thank you um okay i'm gonna go to councilwoman door and then i'll go to council on breakfast sure um so for starts um could you put your map back to one of the last maps that shows palisades this one that one works and you had an earlier previous one that really worked uh way early that works very well um first of all i want to compliment the applicant because you heard the horse advocates get up and why did they not object to this permit or these motions these bundle of issues because the applicant and their consultants have made significant strides in understanding the issues and working to address the issues so i have to give them a shout out not only that they must have met with me five times i may be exaggerating but it was a lot and we went over a lot of the issues and one of the issues is do you actually have a site plan of this well well sorry stay back on the other one you can actually this is the site planner the development itself so that red ariel just so everyone can kind of orient that would be the palisades water tank that the red arrow is there so on this i think we could go with this for the moment um one thing that they did was address fire they have a vegetated area along the road they don't have two ways in and two ways out i want to come back to traffic probably my second comment because i'll probably run out of time but what they've done is cluster the development closely they do have basically a roundabout or hammerhead kind of thing at the end where the fire trucks can turn around they have limited parking but what they are going to do is put parking along that road that goes from uh lower to higher so that people can access this area so in lieu of say having a trailhead people will be able to park on the road and be able to access the second thing i like here and this is a good map to show it where there's two red trees there's a little road coming out and what a lot of people don't realize is a lot of people have land up behind these properties and they use the various roads to access those properties so what they've agreed to do is to have a gate with access for those people and this too would be available for pedestrian access as well and it would also be available so that if horses did get in this development they could be walked out through back in very quickly out in the open space the other thing i wanted to mention was if you could go back to that map i actually asked you earlier i want to explain a difference that i find with this project the yellow and look at the development next to it which is palisades it's essentially at the same elevation it it was always my understanding and mine was that we would basically stop at palisades in terms of working up the hill that this contour level would be sort of the end this was um annex back in 2007 15 years ago and i just want my colleagues understand that you know i look at these things as closely as i can and it doesn't matter about the applicant who they are i just try to apply the same lens and this is different for me now there is one issue i'm going to wait for my second round that i do want to talk about and that is a traffic issue down on rio wrankler okay so i'll see my time to others and come back to that council and ruckus yeah i i see it a little differently than the ward representative um and i was here in 2007 with that annexation occurred as a staff member and that annexation came in with some other zoning to single family residential this one was going to be in my recollection and i did do a review as best i could because our records have disappeared um to some degree uh that this was always going to stay urban transition and i'm actually curious why you're calling it ut 40. i showed it as ut5 on the um annexation ordinance did that change through the zoning ordinance that would be then that would be a uh issue within our zoning maps and i'll make sure that you know that that is correct did you i mean i have a copy of it right here um i have a copy right here of the exhibit to the cases and it was ut5 okay and and so you know i see that as the appropriate zoning and this was always going to be land that was going to service the water tower and at the time there was sf zoning that went up for palisades but this was the buffer to the water table and the buffer then off to an unincorporated and i you know haven't prepared a staff report but my analysis to the structure plan is that we were going to have transition areas in the foothill areas to um to the unincorporated and it just continues that march up to the county line which the next folks will be here next year i'm sure asking for those annexations asking for that sphere and i find it particularly problematic on a number of issues is one the the traffic loading down below because some of these streets that are collectors but locals dual characteristics driveway served you know these folks bought with ut5 up there and they're getting more and more units loaded on their streets and if the major street network plan showed that that'd be fine but it does not we've gone over this before there's the major road street network does not show these continued um uh connect expansions of these roads i don't see how we can make the master plan findings that it conforms to other regional plans when it doesn't conform to a proposed road network uh under the road plan so i completely dispute that number two is um you said it's town homes i looked in our new code i'm a little old on foggy on this but i don't see townhome as a defined term what what is the definition you're operating on for town homes and maybe i could be more respectful it's an attached product so it would be attached single family residence okay okay okay so um i i get that that's the term you used um i also have a problem with the patchwork nature of the you know dealing with the horse issue that's that's one it seems sometimes it's you know fencing here water here but we are doing a tremendous disservice to the resource and to the people down below because the horses come into the neighborhoods if we don't deal with this area through a planned approach rather than someone who bought a mine claim or you know a supporter section and wants to come through the development process we need to lead with public policy and i think the public policy very clearly in here is that we're going to manage resources so i'm not seeing that i'm seeing um there should be a regional road network identified or here and then also on some of the fiscal conditions related to the city's operations and maintenance are these private roads uh this would be anticipated that this roadway once built uh would be proposed to be dedicated to the city okay um those are more costly roads i have a problem with that also um and i don't think it's you know the right you know i i find it very problematic and i i also want to say that um we need to go a little more in detail on the analysis of why this was ut5 at the same time other land was zoned for palisades because to me it's an extra give me of density that isn't meeting our housing needs i won't go into a whole lot of detail but you know this is from the master plan where our housing needs are it ain't up here and i'm hearing of 200 000 per lot of prep site needs so it's not going to be an affordable property when it takes two hundred thousand dollars hold on you're over looking great just make sure someone else has a chance to ask questions and then i'll come back to you all right go ahead well i do have a second question but okay um first of all i think my colleague brings up really good points and i just want to say my understanding of what the points are and i think there's one outstanding point that isn't addressed so first of all i don't know the state passed a new law that requires a endow review when you're at the urban wildland interface which this is i don't know what time it came this project came in so i don't know if it came in before after january 1st so january 1st to my knowledge to my knowledge was the effective date but i want to make sure that they do submit that wildlife plan or that you check and make sure whether they're required to do it or not certainly you know and i've worked on a number of these hillside developments throughout this area and one of those conditions that has sort of become standard that i do is that they make sure they check in with endow and they provide wildlife management okay perfect so that's that's in within that tentative map will be conditioned and okay perfect secondly um my colleague brings up a good point that i was going to bring up about traffic and this is only 18 townhomes the canyon's edge was only eight houses the canyons itself was 68 so all together we're talking something like 94 90 to 95 units some of you may remember the doral academy project it was on these lower down on the same roads macaulay ranch road that these people have to travel and with doral academy what they were having to do was put in a traffic light million bucks put in a roundabout i don't even know how many bucks just to deal with the traffic twice a day out of the school at this exact location where these people will be coming so i don't think it should be on the backs of these residents or this project but where my issue is is the cumulative impacts as we add a project a project each one none of them have to do a road study or traffic study because they don't trip a threshold but all together they do trip a threshold and what i'm extremely concerned about is down here at de monte ranch look where the yellow is look where de monte ranch high school is that is a what standstill zone i mean tracy lives down there it's like a 30 minute you cannot pass zone and what i'm worried about we had comments about fire evacuation right now it's not working we add the more even one more home we add 94 more homes what are we going to do in terms of talking to rtc because i think this is a regional road issue uh talking to rtc about managing the traffic at these spots whether it's traffic lights whether it's roundabouts what today we have a problem we're exacerbating a problem it should not be on the backs of this one developer they'll pay impact fees but are those impact fees going to be used at the spaghetti bowl or to fix you know rio wrangler what what's your thought on that brook you know and obviously we we looked at this from our engineering our public works and those community impacts that you're speaking of um and and it should be noted when these are built there's a fee that is paid by these things to build that that will go to and what that what that fee does is look at those larger issues and how they start to uh mitigate or or improve those areas um we do have our public works is working with rtc and as our engineering and we do have members upon this that are with on that board of what that is and so i think really looking at that master plan is they have identified those areas of concern obviously bringing this area up as an area of concern and and what traffic is what what can be done to help mitigate the concerns is it you know and that could be uh down to programming of the school times and some of those other things right outside of the roadways so i think as we look at this it's it as you said it needs to be looked at holistically and i believe our staff public works and and our team here is working with rtc too i will follow up one minute but i can wait till councilwoman yes sorry did that wake you up it scared me actually i'm very weak any other questions from council members i'm going to hand it over to councilman breakfast go ahead no more okay okay all right then i'm gonna hand it back to you my one minute is that um what what i'm concerned about is um we talk about it and we're talking about it here right now but four of us serve on the chucky meadows regional planning and we were just looking at adding schools as requiring a project of regional significance primarily because of the traffic issue the traffic issues aggregate in these locations and then we build density around them and they they aren't addressed we just voted not to put in uh middle schools and and high schools at that that don't trip the thresholds as project's original significance but that doesn't mean it's not an issue right this isn't going to affect another region this is all in reno right now this is just a reno issue right now it's not a regional issue but i want to get some commitment i guess whether from our manager or our public works or somebody that that they will take on this issue because i can't solve it by myself you know i cannot and we will be hearing constant complaints from the residents about the congestion we're already hearing them so that's just my request to our staff um to look into it and actually advocate that this get addressed before it gets any worse okay thank you all right any other questions seeing that they're not okay yeah i wouldn't i would make a motion and i'll ask our attorney do you need separate motions or how would you i'm going to read the ordinance introduction and then [Music] [Music] bill number 7216 ordinance to amend title 18 chapter 18.02 of the reno municipal code entitled zoning rezoning a plus or minus 8.05 acre site located plus or minus a thousand feet south of the intersection of claim jumper way and hilarious mine drive from unincorporated transition 40 acres ut40 to single family eight dwellings units per acre sf8 together with matters which pertain to or are necessarily connected there with ward 2. what is that everything all right go ahead councilman do her now it's back to you okay i'm not sure how to style this do you need a separate motion okay all right so my recommended motion is based upon compliance with the applicable findings i moved to adopt amendment to the master plan by resolution subject to conformance review by the chucky meadows regional planning commission as an addendum they may bring up this issue i just brought up based upon compliance with the applicable findings i moved to adopt the zoning map amendment by ordinance and refer to a second reading all right i have a motion from councilwoman doerr i have a second from councilman reece go ahead councilwoman breckis yeah i won't be supporting the introduction of this ordinance i find it inconsistent with our master plan um i also you know in lieu of doing advanced planning policy planning for this part of the area and rather development driven whoever wants to come in and pay planning fees um it's inconsistent with that pre the previous actions i have a copy here of the resolution i'll give it to um staff i i think it's maybe not material i just i i was wondering if all the ut's rolled up you know we got rid of the 40s so they're all showing up but anyway i want to also highlight how i feel this is um one comment to make about the irresponsibility of this development associated with a tentative map of public roads and i brought it up on the canyon what uh whatever everyone that is this is incredibly high elevation um this is a tremendous burden to our public works staff for snow removal these should absolutely be um public roads private roads these people are going to have an expectation of snow removal you get a certain elevation point and they're the ones who have the hardest time and make the most calls when they can't get out of their out of their neighborhoods and these people will be in that category and uh they should absolutely have high uh private roads to do their own maintenance and know that that's their own responsibility because city staff will not be able to get there and i sit on the other side of the valley and i look at these snow-covered hills all the time so i'm very troubled about that and the burden to the city in our services it's applicable to a master plan policy and findings uh in addition to the other comments that i mentioned all of course were for the record thank you madam mayor all right thank you so much councilman records yeah hey councilman um i have a comment as well um i completely agree with councilmember breckis and that is why i strenuously requested private roads on the canyons on the canyon's edge they are above the elevation of palisades we have palisades are public roads this is at the same elevation so i was comfortable with it i was extremely uncomfortable with it on the other project not just because of snow but because of rock fall and i think it's going to be even bigger issue than snow snow is every so often rock fall is 365 days a year i just i didn't agree with public roads up there i am fine with public roads here again because it's at the same elevation so i just i just wanted to get on the record i guess um the way i look at it yeah i think it's a legitimate concern i think it's been addressed on this one but i'm still concerned about the others thank you so much all right i have a thank you once again brooke oswald associate planner for the record uh the case before you today is ldc220088 and nmc northwest extended care this is a request for a zoning map amendment just to go over the project site it's approximately 5 acres in size we are looking at a zoning map amendment similar to the previous case you saw there was a associated conditional use permit heard associated with the request for zoning for a hospital acute or overnight care in the public facility zoning district that was approved by planning commission and was not appealed uh the key issues that we looked at is compatibility with those surrounding zoning districts and uses and that compatibility with the master plan so to look at our project site here to go over quickly this is the on-ramp and exits of rob drive and interstate i-80 the circled area is charlon's drive and uh the intersection of robert and charlene's drive charlon's is the access to this property so your your access point will be off of charlon's there surrounding that area we see several uh retail commercial services including a gas station hotel uh personal services restaurants in that area we do have transit public transit in this area and the flex transit does run in this area as we come closer into the site as you can see there is an existing building on the site that site is being used as a assisted living facility currently directly to the west of the site we have a emergency medical center and clinic to the other side this is showing that the site is being prepared but if you've driven by that recently they are under construction of an assisted living facility on that site and then as we go to the north we see a predominance of single-family residential neighborhood uh to the north of this site to quickly go over our master plan and what we're looking at the current zone as we can see we have several different zonings along there uh the yellow indicating that residential development that we're seeing to the north the mf round to the right of our site is multi-family and then to the other side is under that sharland's pud and then our site is zoned mixed-use neighborhood a mixed-use neighborhood could provide for housing types multi-family housing but also provides for nodes of commercial and retail development as we look at our zoning our current zoning is mf14 that'd be multi-family 14 units per acre being allowed on that site as i said before they have come in and completed a sup previously because an assisted living does require an sup or what we call now a conditional use permit used to be a special use permit in in under that they they applied for that assisted living which is existing and happening with that we saw walls landscape other concerns of that impact on that neighborhood were really taken into account that time and that site has been built according to that previous sup to limit those those impacts on that additionally as we looked at that that cup and that change of use we applied additional conditions on that being related to hours of delivery that can be done we've also had several complaints about lighting and so they will be redoing their lighting with dimming more control of that and probably going to an led or other sort of less impactful lights on that so we are looking to go to a public facility public facilities can handle a variety of things from schools public sector buildings but we also have private in that and that private can often be uh medical uses hospitals and some of that so this this is it a appropriate use under under what they're they're proposing so this just kind of sums up sort of what we have going on now currently we have an assisted living facility that's allowed in that multi-family but is not permitted in the public facility we have a medical facility day use is not permitted but would be permitted on in the public facility and then what what our request was before that was approved by planning commissions that hospital acute and overnight care that is not permitted in that mf-14 and requires a conditional approval which they did go through get that approval from planning commission on so this is where where the uh approval that we have currently once again that this approval is contingent upon the the zoning approval so if the zoning does not go through that previous um condition the previous approval by the planning commission does not move forward to quickly go over our zoning map amendment findings once again going over that compatibility the consistency that our services and utilities are there it is an existing site those are all in place the characters are physical limitations and uh will not be detrimental to the public health um as we're looking at sort of that compatibility it is similar in use of the use that we have there we do have some more intensity of those uses we are applying those conditions on the site itself the building itself is not anticipated to be changed they will be using the existing building the existing parking and we're not anticipating development outside of internal reconfiguration with that staff could make all the findings and i leave you with a recommendation recommended motion thank you another great presentation good job okay i'm going to send it to councilwoman taylor if you have any questions before and then if not then i'm gonna go to council one breakfast madam mayor i just had a quick um comment or actually it will be a question okay uh brooklyn thank you very much at planning commission one of the things that we heard was the extensive outreach the neighborhood outreach this applicant did with this project and it was um in my mind pretty impressive would you mind just explaining a little bit what that was yeah they they have you know and continue to work with with those neighboring um properties there uh they um they'll continue to do that and they have dedicated themselves to continue to do that that was something we brought up very early in our initial staff meetings with them is that the importance that that as they come in that they they have that relationship with those neighbors we have have received comments um but they've been very few uh largely uh related to you know buffering landscape and some of that and as i as i stated before with with that previous approval we're seeing a solid wall go in there so we have a solid block wall and we're seeing a landscape a i can show you very quickly this is the previous landscape plan which is the landscape we now have in place up to the top there is that north where we're against the residents as you can see we have a quite a a dense planting a solid wall there we've uh they're related a lot of their they're they're more impactful they're parking and you know shorter term parking and stuff is located towards the front we are anticipating to see deliveries back there and as i stated we we do have a condition that limits them on on being able to drop up and pick off patients between 7 am and 9 pm so we're further eliminating any impacts that we'd see on that back side towards the residents thank you very much okay councilman breckus yeah thank you for the presentation i support but i do have a question the specialist permit going to the planning commission is for the use correct correct now um um and i used to this used to be ward one with that residential adjacency public facility so large so many things can come in this use goes away and another public facility wants to come in will it go through the special use permit process again for residential adjacency or have we gotten rid of residential adjacency no we would have residential adjacency in this situation and any anything that would require that conditional use and that change of use so if we saw a change of use going to another uh intensity that use would be analyzed related to the adjacent properties why aren't we doing residential adjacency species permit here uh that that was looked at through both that initial sup and then through the the use being conditional okay so there were two in the terminology that you know i think historically has been always gone there's two species permits correct one was for residential adjacency and one was for the use of a hospital correct okay so if the hospital goes away and someone wants to convert it to you know a waste transfer station you know something else public facility a charter school it would um go through a specialist permit for residential agencies okay thanks for reading um just really quickly what is the time frame on this uh i cannot speak to the uh time frame we do have the applicant and the representative here and i believe they could speak to that okay that would be great just really quickly um give us a time frame a little bit about good afternoon your side of things uh ken truman northern invited health system uh time frame uh following acquisition which we're expecting to be the next 30 to 45 days we're expecting uh seven to nine months to open the facility okay so you want to talk a little bit about what that is uh facility uh it'll be changing it from its present use of skilled nurse facility to uh some behavioral health about 60 beds at ltac which is long-term acute care so patients that are in an icu presently but will be in an icu setting a long time but can do some element of rehab so it may be that they can move one foot then we get them there and they start doing pt by moving one foot and that is to help speed up the recovery these patients will be in the healthcare system for a year or better from icu at a hospital through an l-tac to a rehab hospital to a skilled nursing facility and then hopefully back to a home and then the other the other element is our acute rehab hospital so following a stroke or an extensive surgery you're not as critical as an attack for your general care but you need dedicated physical therapy occupational therapy like kitchen how to use a kitchen yeah how to use a standard bathroom so this facility would have those three elements in different portions of it i just want to thank you so much on the behavioral health aspect side of this i mean this is so desperately needed in our community i can't tell you um the the biggest feature of this facility is it's gonna be behavioral health in a pre-it'll behavioral health facility in reno and it'll be a beautiful building yeah i know you guys are still making a bad building exceptional but i just want to say thank you because this is one of those projects that is that are very rare rarely do they come before us and it's very unfortunate and um i'm 150 supportive of what you're doing and i wish we had more people in the community willing to do you know mental health services but i want to say thank you so much oh thank you for all the support we're looking forward to doing this yeah a very similar comment that i was going to make is that i'm so excited um could you say again how many behavioral health units there will be maybe 60 behavioral health beds sixty six zero yeah to to the mayor's point i mean that is i think the largest you will be the largest provider in mental health right i mean when i got a briefing on this i was astonished by what they're doing here i thought it was very well cited in terms of being near major access arterial roads and the fact that unlike some others that have been proposed we're not going down one-way streets or in congested areas that there's a frontage road it's right near i-80 i mean it just seems like well positioned there was a comment during my briefing that one or two one i think only neighbor had a comment that the trees had grown up and they couldn't see the mountains anymore and um what i asked them to do was please please please do not go top that tree um topping trees essentially kills them it just takes longer than chopping them down i ask them to selectively go in if they want to and and trim out some branches it totally works but i mean those trees were planted to provide both a buffer with the residential area so one person may not like the tree but many of the other people's may other people living there may number two it was done long ago to um help offset you know this climate change even 10 years ago we knew we've known about climate change for you know almost 40 years but um and this is a city requirement and that's what happens you plant trees and people you know there is a downside sometimes that people's views get blocked but please be surgical if you do address the trees and do not just chop that one tree down or cut the top of it off okay thank you and the our city attorney carl hall to read the ordinance nope we're on item d1 sorry i'm on bear e1 nope d1 which is a title five um presentation hold on oh here we are sorry i couldn't i didn't hear you well i thought you said e1 okay um madam clerk any public comment on this item madam mayor we have no public comment registered additionally we did not receive any correspondence on this item oh i am mistaken we did receive one letter of correspondence received from council member breakfast on behalf of don mahan which has been submitted to the public record okay thank you so much okay go ahead take it away good afternoon madam mayor council members for the record lance verado business license manager so today i'll be presenting on the most current information regarding canada's consumption lounges in nevada and how that affects the city staff is asking for direction on council's desire to move forward with lounges and i'd also be sharing some information with regard to curbside pickup regulation drive-throughs and hours of operation as it relates to retail cannabis stores so the goal today is to get direction on two main topics with regard to cannabis consumption lounges should staff initiate outreach and stakeholder dialogue regarding cannabis consumption lounges and return with possible text amendments for discussion completely separate from lounges with regard to adult use cannabis retail stores should curbside pickup be legalized should drive-throughs be allowed in the city and should hours of operation be amended i want to remind everybody that decisions made today will not effectuate anything today we'll just dictate on how staff moves forward to refresh your memory in 2021 the state legislative legislature passed a b 341 which created lounges and directed the ccb to create a regulatory framework additionally they passed sb 168 which gives guidance on curbside pickup last october i was before you discussing these same items it was instructed to continue monitoring and participate in the state's efforts to create a framework staff was also directed to look into retail hours of operation drive-throughs and explain current code and what options might exist going forward so first lounges what is a consumption lounge as you can see the simple definition it allows a single-use cannabis products or ready-to-consume cannabis products to be consumed on the premises of the business by persons 21 years of age or older there are a couple other components to that definition just for full understanding single-use cannabis products are those to be used in one sitting and must meet the allowable serving sizes as defined by the ccv ready to consume are those products intended for immediate consumption presented in the form of food or beverage to give you a comparison of what a lounge might look like the most similar business type model is a bar where drinks would be served to patrons for legal on-site consumption so this last june the ccb approved a comprehensive set of requirements surrounding lounges the majority of which will be administered by the state adopted regulations include requirements as listed here including others physical location or retail lounges product procurement storage employee training and education product types serving sizes indoor air quality and standards consumption visibility health standards for food prep incident reporting impaired drive mitigation and sanitation as you can see there's a pretty robust robust oversight by the ccb in these lounges so statute authorizes two types of lounges retail and independent retail lounges are those that are attached to a retail store and independent are standalone the state also controls the number of licenses to be issued while each retail store may apply for a lounge only one license per set of common ownership is allowed for example if an entity owns five retail stores throughout the state there are only they are only allowed to operate one store regardless of location or type in terms of independent lounges legislatures initially authorized the issuance of 20 licenses statewide and lastly in terms of retail land lounges the state allows for them to be physically attached or on an adjacent parcel as for spacing all of the current state distancing requirements remain consistent for lounges so the city has the ability to limit the number of lounges issued that however comes with a few conditions per statute should city choose to limit the number not more than 50 percent of the licenses allocated by the board may be issued to retail lounges in the city secondly applications for all cannabis establishments are currently set at five thousand dollars in the city however we could choose to to raise the one-time application fee just as a reference the state charges one hundred thousand dollar application fee for a retail lounge and ten thousand dollars for an independent lounge keep in mind if the city were to change the price of the application fee that a business impact study would be necessary one last item that would require city regulation would be outdoor odor mitigation if outdoor smoking were to be allowed that said city could choose to prohibit this altogether so here's a familiar map that i've shown before it points out all current eight the eight current adult use retail stores that could conceivably apply for a lounge again with the rules restricting one lounge per ownership group the chances are minimal that all stores would apply so the second set of topics surrounding existing retail stores this is separate and apart from lounges as i mentioned the state has created regulation allowing curbside pickup and after the submission to and from the approval i'm sorry pick up after the submission to an approval by the ccb it isn't necessarily something new to the city as this was uh these practices were allowed during the heights of the pandemic but now the state requirements are clearly outlined and the city could choose to implement similar or much more restrictive processes as you can see here it's a fairly simple process it's an app it's an approval by the ccb and standard operating procedures must be must be submitted this is more of a method of convenience than anything but since the state has created regulation the city should address it in code so as far as drive-throughs are concerned i'd like to clear some clarify something in my staff report prior to regulation being created around curbside pickup it was thought that drive-throughs fit under the same requirements after further clarification drive-throughs are separate and distinct topics drive-throughs must be approved by the state to ensure proper security protocols and operating procedures but at a local level zoning restrictions and traffic considerations should be contemplated as you can see here for a non-cannabis establishment all but one of the current retail stores are zoned in such a way that a drive-thru could be considered whether by right or through conditional use permit if council wishes to treat cannabis retail stores similarly code could be amended to allow for these standards so hours of operation here currently title 18 allows retail stores to operate from 8 am to midnight 7 days a week regardless of the zoning at our last meeting this topic was discussed and it was noted that several business owners had expressed interest in expanding on their current hours so staff pulled this information together to show you how each retail store is currently zoned as you can see the top four locations are restricted more so than other non-cannabis businesses in their area and the bottom floor have the ability to operate slightly later than would be normally allowed in their zones after this presentation i think pd can share their perspective if council needs more color on that subject lastly if council chooses to move forward sections of title 8 will need to be amended to address public consumption however regardless of the lounges title 8 should be opened up and administratively updated to reflect the current state terminology so back to the decision points first of all lounges if staff is given direction to move forward today lounges will not be open that said the process of public outreach would begin and staff while staff continues to monitor the state and local jurisdictions for any new information staff would then begin to construct an ordinance and discuss options with stakeholders including council members alternatively if council moves to halt the process staff will direct will draft an ordinance prohibiting such business and again continue to monitor statewide activity so as for our second set of decision points these exist solely around the adult use cannabis retail stores again separate completely from lounges curbside pickup has been established at the state level and regardless of the council decision today a text amendment should be initiated to address it drive-throughs as far as drive-throughs are concerned current code is silent on the matter so again regardless of the decision an amendment should be should be made to clarify lastly hours of operation should council decide to extend the hours of operation a text amendment will need to be initiated so here's our recommendation staff recommends council provide direction to staff on applicable decision points in order to amend title 5 title 8 and title 18 is necessary again as separate topics should staff initiate the process of public outreach and begin fashioning a draft ordinance secondly how should staff proceed with curbside pickup drive throughs and hours of operation as it relates to the existing cannabis retail stores at this time i'm happy to answer any questions and also know that i have representatives from planning code enforcement and reno pd all right thank you so much lance great presentation so many questions right um maybe give us a little bit of background i would imagine you've been following what they're doing in las vegas so in las vegas right now they're still moving along with the same process they haven't made a formal decision they've been they've brought this forward to hearing and they're kind of at the wait and see moment the last time they had something scheduled the state wasn't actually ready with the final regulations so they've bumped it out a little bit okay yeah i can see you know both sides right like the concerns and the and actually why you would want to do it first of all like i don't want people smoking marijuana in their cars and also you know we're smoke free parks and those kinds of things and i mean i think we've all been at probably events where you can really smell it super offensive and those kinds of things but i think you know they're also i mean is this the safer way to go where it's much more contained and then people if they're going to use it because they're going to use it um and it's legal otherwise i think then you know it happens in places that um shouldn't be happening so anyway okay thanks i think you did a really good job okay council on breakfast go ahead yeah thank you thanks for the presentation it was um very clear so one question though is um this is i understood and it was actually one of the dispensary owners told me that um and maybe it's being done through code cleanup that some separation that we have got dropped out of when we did redid 2018 from different dispensaries that's correct so the state regulations are very similar our code but reno title 18 also had a 2500 foot separation between cannabis establishments that fell off um it has actually been already been through planning commission okay and you should be seeing okay so that's separated apart under the guise of cleanup and certainly under the guise of our authority to have added an above and beyond municipal law to state law so here's how i see this is um you know i'm very sensitive to staff's workload and what our priorities are uh whether it's 30 acres a person parks person to work on or you know you know snow shoveling you know snow removal in high elevations i don't see this as a priority at this point we're talking about eight uses eight businesses um if i wanted to send uh you know this staff and the title 18 staff which always comes forward with things they are not able to get to it would be a whole lot of other things namely short-term rentals um the accessory dwelling unit ordinance all the housing stuff we were going to do that hasn't shown up as a matter of fact last time i heard the housing workshop for later this month has been cancelled because staff doesn't have the bandwidth so i'm not going to be going out and telling the public that we're putting our time focus priority into introducing a new use of cannabis lounges into the zoning code when we are really falling behind on just basic things like regulating short-term rentals and i introduced this week's you know email from a constituent about the problems they're causing in their neighborhood we know they're causing uh housing supply issues or accessory dwelling units some of the other things it's just not tenable to me to go off into this area at this point you know for eight uses people aren't coming to me about it if i wanted to deal with drive-throughs our standard drive-through or ordinance is a mess an absolute mess and you just have to go down by the convention center and see what we've been permitting and the problems we have so a whole um you know look at that i think is needed and we do have a template for what we want to do in title 18 and i think i think that we need to to focus on those those things before something like this at this point in time that no one's really asking for and so that's where i stand and i'll i'll i have another comment but i'll just wait for others thanks all right go ahead councilman reece thank you madam mayor uh for my part um i'll disagree with the ward one representative i represent the entire city of reno and this is a topic of frequent conversation um i get asked about this topic from entire age range from 21 years old to 85 years old quite frankly and i'm not getting calls about short-term rentals so it's just one of those things where the ward 1 representative is sort of clutching pearls about a thing believing that the staff doesn't have the ability to do more than one thing at one time i think you do so i'm not worried about that i'm happy with the work that staff puts forward and i think that you're doing an excellent job of trying to navigate the complexities of a body that has different opinions on different things but i get asked about consumption lounge at least twice a week if not more sometimes twice a day so it is an issue for our community second is you know cannabis is a legal business in the state uh we are also a tourist destination so when people come here to enjoy the tourist industry that they're already enjoying this is another aspect of it so there's a cannabis tourism related component to it and then there are people who just want to be able to go into a social setting and not be in their hotel room for example where they're prohibited from using cannabis so it's one of those things where it's coming it's inevitability we should be ahead of it not behind the curve because i think you make better policy decisions when you're not always playing catch-up and so the state is highly regulating this area it is something that i think we're going to have to continue to move and react as the state moves and reacts i think the way you've broken this out in the staff recommendations is absolutely correct on the first jumping off point as this question about is the next step public outreach and engagement that may change our opinions on the topic i don't know but certainly that staff should initiate that public outreach and stakeholder dialogue so we can move forward on a reasonable timeline so as to point one that's my inflection point there again as a city we should be supporting all legal businesses in that city i think this is the way to do that with this particular use as to the questions you've asked in part two i think it's no surprise that i have indicated that i'm concerned about competition between our legal businesses the ones you've identified here and those now opening and soon to be open more retail establishments that are on tribal lands and so i don't want to see a tribal facility down south reno that has 24-hour access curbside pickup and drive-throughs when our other facilities and our other businesses that are lawfully here do not have the same so i think it is important that we allow each of those things i guess i'm agnostic about whether it should be 24 hours a day although i see story county has now gone to having the first 24-hour dispensary um and so again i think many of these things are inevitable let us be proactive and thoughtful about it as we evolve as a city those are my initial thoughts all right go ahead councilwoman yeah thank you um i think we will have to address this issue i mean it's it's coming down the pike at us right um i do disagree i'm sorry mr reese with the clutching pearls thing i have not been asked about lounges but i have been asked about short-term rentals i've been asked about airbnbs i've been asked about adus maybe at the ward level those are neighborhood issues that come to my attention maybe one person's asked about a lounge to me but i'm i agree that they're both issues and i think it's not a binary choice uh either or i think we have to work on both things so i just wanted to get that said on your first recommendation or a what i would like to see is let's go to the public outreach and stakeholder dialogue but i would not like you to return with text amendments what i'd like you to do is return with what you found in the outreach process before you spend time on drafting text moments so that's what i'd how i'd like to see the process i'd like to get the feedback hear it and then give you some direction on developing the text amendments from this body on item two the retail stores i think uh curbside is fine um i think drive-throughs are fine i'm not as keen as 24-hour operation why people can barely get people to staff regular hours we have a lot of places that are closing stores early because they can't even get someone to sell a dress never mind that the licensing or requirements required for dispensing marijuana okay so i'm not quite ready to go to 24-hour throughout the city myself and then the last piece is that back on number one is the location so i've had some briefings from you all about marijuana facilities in general it sounds like some of our code needs to be brought back up to where it was but when when we're doing this i want to make sure that we do address that issue of locating lounges now we're talking also having the distance requirements from schools from gaming and from i would include in that the drug rehab centers that we've discussed i don't know that all of those distances have to be the same i think it's 2500 feet from each other for cannabis dispensaries 1500 feet from a gaming and we have zero feet from a drug rehab facility i might recommend 500 because i think that that's the alcohol distance that we have from drug rehab type facilities it's 500 feet i believe it's 300 feet from community facilities for for cannabis so those are supposed to be included under 300 for that yeah it's 300 feet that's a thousand feet from schools okay i had the numbers wrong so a thousand feet from schools and it was 1500 i thought from gaming correct okay and 2500 from each other that's what our previous title 18 iteration said and that will be coming back forward yeah to you shortly but i'm just making sure that we add in that drug rehab portion because as you remember madam mayor we had huge discussions about this so i don't want to like have had that conversation and then kind of overlook it while we're doing the lounge conversation okay i think we should make sure we address it right right okay yeah thank you yeah good questions thank you so much um you know the cannabis industry is 11 billion dollars in the united states alone it's big it's big so the other really big industry is the tourism and travel industry and because nevada has approved cannabis legally that we get a lot of of questions about this can i in my room do you have consumption lounges i mean it's a real thing i'm really glad you're bringing it now because i think we've been wondering for a long time i mean it was been i would say what three or four years now when this was coming so i want to commend you but from the other aspect and i and i can't remember it i think i'm right did i see some correspondence about the state saying that they wanted to get these licenses going or you know correct what is it they yeah they want to know right exactly yes okay i thought i saw something letter of intent was sent from so when we talk about time i just want to be clear that this is something from the state so it is relevant and it is timely we should be hearing it now and we also have deputy chief tommy robinson i'd love to hear a little bit about your thoughts from the police department because i bet this is timely for you every day so thank you for being here so go ahead well i was just going to say on that uh on that note about the correspondence uh just today the ccb released their intent to release applications so there's a 30-day period that they're allowing to notify everyone that you can apply and then there will be a 10-day application period so it is it is coming down the down the pike and it um we were asked by the ccb if we were going to be interested in the process and moving forward um so yes it is it is very important i have an obligation to the state to hear this yes okay thank you so much i appreciate that and i'd love to know chief if you would like to tell us you know what your concerns are what do you i mean kind of what are you guys thinking when it comes to these consumption lounges well for the record tom robinson deputy chief of the royal police department good afternoon everybody you have a beard it looks like i fell into my eyes um so far the local industry has not caused a lot of concerns for us not a lot of calls for service it's been a well-run industry we have some concerns about our ability to police them 24 hours a day that's why we've always been supportive of limiting their hours of operation we have concerns with drive-throughs just because of some of the experience we have with coffee drive-throughs and the traffic jams they cause but other than that like i said they've been a very well self-policed industry so hours of operation are of concern yeah okay that makes sense and drive-throughs make sense yeah okay thank you really appreciate it okay council i'm gonna go to um councilman delgado thank you madam mayor um along those lines i yeah i think as you stated already madam mayor that i think it's an obligation that we see the item before us there's a timely manner and for our good staff to go out there and start uh hearing what's what's on the community to do that outreach with respect to the current adult uh existing cannabis retails i you know i i see at each location being its own special um when you look at them as their own individual we can't look at them with a wide brush and say all of them are 24 i love them our drive-thru doesn't it doesn't necessarily make sense to me as they come back to us on us on a case-by-case basis making sure they're appropriate and it's surrounding communities and neighborhoods but of course to go out and provide that information and come back to us and say here are the ones that potentially make sense is it's our due diligence and we owe it to the industry we will to our the the community to have clarity as to why they are and what's what's before us so thank you so much okay councilwoman taylor go ahead uh thank you madame my first question was regarding what uh law enforcement thought so thank you very much for bringing that up my second question is some clarification on the timing lance based on councilwoman doerr's request of having some outreach and then coming forward and writing some code i think i just heard you say something about a 30-day time frame does does that have any impact on the outreach and what you bring back to us and what we're required to do or are asked to do for the state lansfordo for the record so the the intent of the state is to get the information from the local jurisdictions to see if they are going to be moving forward so that they can put say reno on the application list if they're not on the application list then we then we're none of the independent lounges that could come through or the retail lounges that could come through will be able to apply until such a time if we were to go through and say yes it looks like we're gonna we're gonna be at least entertaining the idea and doing public outreach they would put reno on the list people could still apply but that doesn't necessarily mean anything comes into the city the city still has full control of allowing approving disapproving um and just we're silent on it now so if someone were to get a conditional license from ccv they can't necessarily just come and open they still have to get the city's approval so the timing of the whole like you asked uh it it's it's more of the timing it's going to take to get public outreach and come back to the body is going to take longer than that but the intent is to get an idea of what direction we want to go so we can do both yes okay thank you very much okay council on breakfast yeah i mean the point that it's not binary it really is i mean there only so much can be done by our staff you know and where's the stormwater utility where's the tree ordinance why do we counsel a how cancel a housing workshop and where the housing ordinance is there are limitations to capacity i want to let everyone know that when we did the zoning code we put a lot of things in the parking lot what is those was the sign code well i spent two hours yesterday at a sign contractor's facility at their request they made the request of all of us my question was is the sign ordinance more problems now than it was 20 years ago 10 years ago five years ago yes yes yes not standards but both the administrative difficulties that staff's having and the clunkiness of the code where's that why is that how many sign permits are done a year a lot versus eight uses so um i dispute this i think the state has enabled us to say if we want to go here and if we want to go here for these eight businesses that's fine but when people ask me about short-term rentals and sign problems that are you know city-wide problem to business or um where's an accessory dwelling in an ordinance i'll tell them go go to public input meetings on marijuana lounges but in terms of marijuana lounges i want to express my concern that i do not submit support additional smoke public places and businesses in the city of reno if anything i support smoke-free restrictions to bars and casinos that's in our lap i've had talks about the manager with it before he did not allow me to put it on an agenda at the request of a public health group about a year ago but i continue to stay focused on it our lungs are suffering every single day and we're gonna create a whole new swath of smoke businesses no that's a private indoor use in my world view it's a public health problem and i'm not willing to go there i will reference if the council is going to go there a recent la times article i can share that with you about marijuana consumption clubs which are um you know it's it's used in a cooking process for dining but there's also smoke inhalation issues that the cooks have to deal with too but probably no more than you know cooking a bunch of coriander or something so i absolutely oppose smoke uh whether it's through hookahs or bongs or joints i will not support that new use in the city of reno i want to go the other way with the city of reno and our local authority here to make smoke-free casinos smoke-free bars it should be in homes thank you thank you madam mayor um i just want to address a couple of my colleagues concerns i i'll sort of um put in the parking lot the concerns uh that councilmember breckus has raised but as to um the hours of operation again i'm somewhat agnostic about 24 hours but i do think they need to be expanded beyond where they were where they are currently in part because shift workers are denied access and there are people who work during the sort of hours that most of these folks would otherwise be closed so and again we already have 24-hour access here it's at tribal locations and it's in story county and so i think we could tweak the hours of operation and i think council member delgado said it right whether it's hours or drive through those are on an individual site-by-site basis right not every place can handle a drive-through obviously um chief robinson spoke to the fact that he's concerned about the traffic issues caused by drive-throughs i don't think it's quite the same as you know dutch brothers or chick-fil-a cueing out the uh you know parking lot i don't think the consumption of cannabis is quite at that level as say chicken or you know dutch brothers treats so i'm not worried as much about that but again those are site-by-site decisions i'm saying in my opinion as a policy maker we should allow curbside we should allow drive-throughs where appropriate under the same conditions that anyone would be required to provide information about them and the operation should be expanded i want to go back to something councilmember dewer talked about in the initial question about public outreach stakeholder dialogue and sort of parsing the concern about bringing back possible text amendments i don't know how you will go out to the public to seek input if you'll go out with like ideas about here or some possible text amendments now comment on them that seems to me it one way to do it and so i don't want to sort of handcuff you to not being able to do that as your method of outreach because i don't know how you'll do it if we're just going on a listening tour and we're going to just talk about cannabis we're at large you may have folks who show up and talk about you know the dangers of teenagers using cannabis or something i don't know it'll be dependent upon you to bring that back to us at the end of the day it's again a legal business highly regulated by the state the state has obviously asked us to engage in this iterative process and here we are doing that i continue to believe fundamentally that we can do lots of different things and as to the difference between how i prioritize this over other items i believe all of them are important and we're going to take them in the timing that we can and allocate to them i think it's less relevant than i mean i think it's more important and relevant given the time constraints the state is under and because of the nature of you know cannabis consumption and tourism related concerns and no i don't believe it should be that people must do it in their homes we're a tourist destination because their home for the weekend ends up being a hotel room and that's not really what we're looking for so we can do the right thing by this industry by moving the ball forward all right go ahead councilwoman door yeah thanks um let me just explain um and i appreciate it looks like you are trying to follow our three-step process to have a general conversation with us and then bring back on a second step an initiation of ordnance what on this particular one just like some some we've had you out there for two years getting i mean there's been so much contention and issues from the public that it's taken a long time for staff to work through it and what i what i'm concerned about is i have no idea how long this maybe it'll take 30 days and it would take three months but what i'm concerned about is when it starts getting too long we lose the threat it's happened to us over and over you know where we've initiated something you've gone out and done the process and we're kind of lost in the process right we haven't been at those workshops we don't know what people are saying we don't have feedback until you come back with a text amendment and it's been sometimes two years even so all i'm saying is please check in uh with us if you're starting to hear pro con issues um i think we need to know about that as you go along so we're not just faced with here's all the words on the page and you want to do an ordinance introduction and we're debating the words on the page sure that's what i don't want to get into so do you understand i do and just to comment on that i think that the the um the plan would be to go do public outreach gather information start to formulate a an ordinance do more public outreach to show this is what we're going at do you have comments on this have individual council briefings to say what do you like what do you not like and then once we can get that information together we have it then we can you're ready to roll only you can best decide that sure and all i was just i was just putting a caution node up here is i i've been through this for eight years and sometimes these things get protracted and we've lost our thread number two i too am concerned about smoking i'll be very very honest we're starting to have a proliferation of non-smoking establishments people are recognizing more than ever they recognize in the 60s the 70s 80s 90s the 2000s that smoking is harmful to you they're beginning to recognize that smoking no matter what the substance is is harmful to our lungs um i just had a friend die from you know stage four lung cancer last week or ten days ago and you know she found out and then she died the next week so it's they're finding out that these kind of issues are very challenging we have taken a strong stand on opioids you know in terms of just potential health impacts um i do not have a personal objection i've said this for years to marijuana to its distribution use sale etc including a lounge but what my concern is is a similar concern about the smoking component there's they're even worried about vaping but at least vaping isn't impacting others as much there's eating there's other ways to ingest marijuana so i would hope that you would get input on that issue when you come back to us because i too don't want more smoking establishments if we can avoid that thank you i just don't know how do you appreciate marijuana and then turn around and say but you can't smoke it but you could maybe vape it is what i just said but when you approve it you everyone knew on this body that you would smoke it well maybe at your house yeah i mean in personal no not at my house no okay i'm just saying you guys knew when you approved it that people were gonna smoke it so you have to well i'm not controlling their personal behavior but i am talking about public behavior in a lounge that's all it's just my i'm entitled i think i'm just saying this body approves dispensaries absolutely you have to be very careful when you say but this and i'm prepared to approve lounges okay i don't i mean honestly i i don't know how i feel about lounges until we know that that's what i'm saying yeah but but people can smoke it of course of course yeah i mean you yourself started with comments about smelling it and being exposed to it just even in our garage or wherever in public spaces and the need for some kind of regulation so i think lounges will help us get there yeah so i know that's all i'm saying is that we sat up here and approved all of us i think approved medical or marijuana dispensaries of course right and then in the same breath not the same breath this is a couple years later and we're now in lounges in the same breath basically you guys we've all approved marijuana dispensaries and then we have to realize that there's implications with that when we just they're going to smoke it absolutely i'm just i just i'm just noting a cautionary note on this topic which is two three years after we've approved medical marijuana and recreational marijuana distribution totally fine i'm just sounding a no to caution i haven't said yes no or maybe no i'm i'm understanding that i'm just saying you can't say yes in one breath and then say no on the other so you have to be very careful about what that looks like and i'll just make one more comment we we have been concerned about the distribution of bars and the lo the con localities of those bar distributions the localities of package liquor distribution so much so it's legal we don't want them to consume it on our streets we don't want them to consume it in their cars i mean we have controlled how they consume the alcohol and also the closeness of the distribution facilities and so much so we've had to go into 14 and we've spent enormous amount time on it i just want to make sure that the lounges are properly spaced and we don't get into like 25 lounges in downtown reno none in the out out areas those kind of issues just learning from our experiences i'm glad you brought that up especially being next to a drug rehab right which you didn't support i did not support that right i want to make sure that those that we do not put those types of things next to right reasonable regulation drug rehabs so right okay thank you especially free standing thank you thank you madam mayor i just want to say that i believe we need to be cautious i think we need to move forward so that the state knows then i think as we get more information having the the outreach with the public and with many of us i'm sure that that is the way to go we do need that input but i am very cautious and i'm not going to say now what i do support or don't support because i want to hear from the others so thank you all right go ahead councilman reece thank you madam mayor and i think i'll be brief um look we all want to be cautious because it's new territory and so i appreciate the concerns raised by all of my colleagues as to this issue about creating businesses where smoke is filling rooms and people are hot boxing like mad i suppose number one it's a choice right i think i am someone who believes that we should not have indoor smoking when i go to the casino or the supermarket or a restaurant that's not something that i want to encounter me personally but of course if i am going to a casino for a show or something sometimes i encounter it and it is something i don't care for but it's different whether you when you go to a hookah lounge you're going there because you want to be exposed to that when you go to a consumption lounge you are going there because that's what you are seeking it's not i don't think it's the same as comparing it to the folks who are looking to have this body adopt indoor smoking bans it's just not comparable those are not related concepts in my mind and so i'm interested again in continuing down the path um i think that your office and and also the state is looking very carefully at the way in which lounges must be created in such a way as to minimize the smoke impacts to sometimes it's the employees of those lounges it's people who are entering it so it's all these very technical things about how large a room can be and what kind of air filtration system they will have and it's it's on and on but that's not going to necessarily come out of our efforts the ccb will deal with that um and so um i think those questions that we have are a going to be answered by some sort of higher level authority at the state and b we'll work through them as a body again i don't think any of us today are saying they're coming and we're going to have 25 of them as councilmember do or sort of positive because the number is so limited and the cost is very high to even obtain a license i think even in the cannabis world those folks are asking themselves whether there's a really a viable business model for consumption lounges i think there's maybe one in vegas that'll be rather large they plan for it all along to be a lounge and maybe during super bowl will be packed or whatever but i'm not sure that that's what's going to happen here but we've got to make sure that businesses which are legally operated to or licensed to operate have the same playing field to do it as anybody else and so continue to believe that you're going to do an awesome job tommy robinson an expert in this area and really trust his judgment on it and so i'm you know continue to believe that we'll be okay thanks a lot all right um okay can i get uh any further discussion saying that there's none i'm going to send it to councilman reese since he is um the at large member go ahead i'm going to move to approve staff recommendations as to item one staff directed to initiate public outreach and stakeholder dialogue regarding cannabis consumption lounges consistent with our conversations here today and sub two would be the existing adult use canvas retail stores that we would continue to develop the necessary staff background to evaluate and allow curbside to pick up drive-throughs as appropriate and hours of operation potentially be amended all right i have a motion i have a second go ahead councilwoman breckis yeah i'm not going to support i um you know i i really wish we were willing to stand down and let other cities and counties go forward in the first grouping you know maybe those cities that you know don't have a sign ordinance that's gotten more terrible for that industry in the last 20 years there's regulating short-term rentals or doesn't have whole segments of the city uh coming unglued as unplanned growth goes up hillsides and loads traffic down into their neighborhoods but um i want to push back to a couple things one that you know while we and i have been very supportive of the cannabis industry but that somehow you know knew that they wouldn't be smoking now you know the voters said very clearly that they wanted a limitation to work place and i'll emphasize that again workplace smoking environments this is about employees and this is in my view going against that policy or at least that value and so we'll see what you know the council wants to go forward we'll see what people say but i am very uncomfortable with going in the different direction from what a statewide vote went a couple decades ago the public health officials who i talked to about clean air say it is really a step uh in the opposite way we should be making like many of the ga as gaming is proliferated through the country we should make gaming smoke free it hasn't hurt gaming operations in other states um so i want to push back to that we know people smoke but we don't have smoke work environments in cannabis environments so that's that um the one last comment i didn't get a chance to say and this is the 24 hour operation i am concerned about um if you're in a district where you have uh non 24 hours opening up this one of these particularly uses to 24 hours i do think there's concerns about those and if you are letting one of these and they do go to 24 hour then they're they're being inserted into area that has a very reduced level of activity um you know around and i think that does raise concerns and i've got two in my ward and one in particular i know pulled back on there is hours of operation that's the one in midtown and south virginia at one point so i hope you'd pay um attention to that and um i won't be supporting the motion but i do want to express the concern about the 24 hour and let's let's face it i am sensitive to ship workers but we also know there's delivery loud thank you all right um you know and i do i want to just say you know i i don't think we should act like we're concerned whenever we've approved marijuana dispensaries and when we've approved marijuana dispensaries next to drug rehabs so anyway thank you motion in a second all those in favor say aye aye all those opposed post motion carries thank you and support folks we had an amazing tree planting the best one ever over 100 people came they planted 60 trees in this park that virtually had no trees in two hours they were incredibly efficient and i just can't say enough about the mount rose steak of the lds church you partnered with us and the um double diamond hoa at least four of their board members were there as well as members of the neighborhood who came out there's also a um a young man who started a new tree nonprofit called trees are us and they're growing trees down in washoe valley and he and his father were there so people got to meet him and he's quite a character really awesome kid so anyway i just wanted to make a comment that it was really successful and i really appreciate the staff support thank you yeah that's good that's great love it okay councilman weber thank you i'd like to do the same i'd like to thank our team um the parks team as as well as our liaisons noemie and amy we're both at our ward 4 cleanup at dorothy macklinden park and it was awesome it was probably one of the best turnouts for the area and they did mail some to the surrounding community and a lot of folks showed up to help
