we'll go ahead and call the meeting to order start with a roll call mck here uh frederck here Baron Camp here Nichols here and councelor lanterman is tonight if You' like to stand and join me in the pledge Al to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and justice [Applause] for okay we will get going with um agenda approval looks like there's three revisions there's three revisions and and one of them I'm excited to highlight there Mr Mayor we have an update on the resolution for the 2025a bond sale happened this morning and uh we locked in uh the winning bid was at 3.69% % if you've looked at the market it's about 6.06 right now so we did really good uh in fact we got a $276,000 premium which then brought the bond from what was 3,960 th000 down to 3,695 th000 so great day for us in that regard uh update to item 6E uh there was just a a correction that needed to happen on the on the scale for the class and comp uh there was an identify correction that's on the dis uh one of the just fat finger uh one of the numbers was plugged in wrong and then uh item 12 updated uh city council schedule um I'm just going to that's going to continue to update as we're adding things and so there's been some additions and some subtractions from the last time that was published no other changes Mr Mayor perfect and I would like to um move uh my Council update mayor update up until uh just after cons sent before planning um I think there's some relevant information uh given the rest of the agenda and just in general and if anyone else would like to move theirs up or just keep it at the regular item 11 for their updates if you have any any feedback on that sounds fine keep it at 11 for you guys okay so I will move mine to there uh we have those revisions any other changes I'll entertain a motion to approve the agenda as amended so moved Nichols second friedrick all those in favor say I I no presentations today we have open forum for uh any items that are not on today's agenda and Jay will walk us through uh so in the audience anybody who would like to come and speak on something not on the agenda I ask you to fill out a card uh on that it would have your name your address uh and uh this is for something not on the agenda I have three cards that are on the agenda right now I had one email about uh someone who wanted to come and speak uh in the open Forum but I don't have a card on them so I don't know if they're here right now okay great uh so yeah if you could give me your card and then uh again you've got uh five minutes to speak on any topic please speak to the council uh and this is an opportunity for your name your address and any information that you have for the city council waiting for that one yeah well we'll just wait for that one um I don't have a really good joke right now I you don't ever a really good joke well thank you sir we don't pay it for that ouch it's a tough crowd today so uh Miss Christina Jensen don't worry please pardon my entire thank you Council memb for letting me speak your name and address please my name is Christina Jensen I reside at 7800 Maple Hill Road I have been a member of the Maple Hill Estates community for almost 25 years off and on um please excuse my attire um you'll understand why it is the way it is in a minute um good evening and thank you for letting me speak um the resident the reason I'm here tonight is the residents and myself we all have concerns we were all looking forward to this new transition with new ownership of our property management as a positive thing and when we heard some of the things that were going to be happening like cleaning it up holding people accountable to their property I know these are things that have been an issue with our community in the past we were all excited and we embraced it we were very excited and we embraced it because there's a lot of us homeowners and a lot of us that you know we do work hard and we do have what we have and we take care of what we have that being said our new management company has communicated with us via a little notice in the mail and that's it there's no course for reaction there's no answering questions there's no timelines for us definitively and it doesn't match up with the timelines that the state has given us in you know the general code um there's been an injustice I've watched multiple people in our community lose vehicles in the last 72 hours these people are losing Vehicles they're not illegally t not all of them they're not even there to dispute or to stop the taking of their vehicles because they've deceased and their families were not able to come get their vehicles that is wrong within 24 hours of a man dying his property was confiscated by a towing company that was ordered by our new management company and we would like to get the old russed out stuck cars in position out of our vicinity but at the same time we want it done peacefully we want it done transitionally we're all for the timelines that they give us but they're not communicating and they're not doing there's a way to do things and there's a way not to they're not willing to mediate they're not willing to discuss um on Tuesday March 25th 2025 I was leaving my home in the morning and I had noticed that a neighbor a few doors down from me vehicle was being connected to a tow truck I personally know this neighbor both of his were legally parked they both had current tags I knew that there was a backstory to one of the vehicles that was not tagged in the moment I went and I assumed you know standing up for my neighbor because I knew he was still asleep at that time I was told to remove myself from the vehicle with vulgar language because I approached the vehicle and I placed myself on top of it and I said no just please wait give him a minute he's in the house I'll have somebody get him upon that being stated I was told that I was going to be trespassed for challenging this the situation officers were called officers arrived the officers ruled in M my neighbor's favor the vehicle was currently tabed the DMV actually sent him out the door with the wrong tabs so he was waiting on them to be sent back um the manager that we have told me that I was going to be trespassed and if I didn't get off of this gentleman's car that he was going to be evicted as well because he could it is private property when you've lived in a place for 20 some years and now somebody new comes into the picture we're okay with change we're not okay with tyranny I was then on Wednesday the 26th at 11:00 a.m. corkran police responded to my address and they showed up to serve me with it no trespassing and I was told I had to immediately vacate the property whether on a lease or not so the residents have concerns we have leases for the properties and which our homes are sat on and our homes have been there for years what rights do our leases have when he when management can kick us off of our proper out of our homes our homes are ours we own them it just happens to be on their land but it's my understanding even though it's on their land their land is part of the city of Corin so if they're not willing to meet with the residents and come to a happy mediation or a medium we need the city's help we know we're not your favorite neighborhood or we're know we know you're not what not necessarily but we know we know we're not top of the top of the chain for bringing in you know the B box are doing the most upstanding things at all times but at the same time for many many many years we were the biggest neighborhood corkran had Mr Mayor yeah I yield a few more minutes now so she can you can keep going no Sor please and you are a critical part of our community don't thank you we don't think any less okay I don't believe it or not I spent the last 10 years plus in my time in my free time I have seven people in the park that I currently take care of Nursing and pcing for all of these people called on my behalf to management and management told them one by one to find a new PCA or to find a new nurse some of them didn't have time to find a new nurse or a PCA but they knew I was being vacated from the property some my mother started crying because she needs my help she has emphysema I take care of her and I take care of her property in which this property I live on my mom was told she can find somebody else another Resident was told that they can if they can't find somebody else then there's always Assisted Living that's not right in my opinion I think it's very unjust if you look at our state's code book in order to evict somebody it has to have a writ there has to be a writ served by police you will have your day in court that was not an option for me because I was on private property so there's got to be a definitive line because we don't have one in the state's codebook we can there's there's tenant law law there's renters laws there's homeowner laws foreclosures HUD housing there's all sorts of laws but when it comes to mobile home parks and if it is private property or if it is public property we have concerns and questions because otherwise what good is our leas is when they can at the drop of a hat tell us to vacate our home and that's all we have that's that's kind of a violation of our fourth amendment if I'm not mistaken and not only that but we are not trying to withhold corran's growth you don't understand how excited we were when we had a high ve it was really nice but there's people in this community that do build the homes that are going up around us that are helping this city grow that have been paying taxes for many many years and they are trying to grow with corkran but changing us overnight it may not happen as easily we're not against it but we needed to be fair we needed to be just and we needed to be legal I'm asking the council to please mediate for the residents of Maple Hill States please help us find a happy medium with this new management group I've tried to make peace with them myself even after the incident occurred and I was told the trespassing still stands I didn't even have time to pack my clothes so this is why my entire Reas I don't trust like this is not going um but I need help because I don't know what to do I don't know where to go and last night I wrote a note to put on my dash of my car because the only thing I could logically think of to do was to camp out in your guysa city Hall's parking lot and I was going to sleep in my car with my pet overnight because sers do not take animals with the person that they're taking in my animal is my emotional support pet I have depression this is not right and we want it to be fair we're all Americans we all have rights we all pay our taxes we all do the best we can on a daily basis I do believe I'd like to see the good and there's a lot of people in that area that do a lot of good and I noticed they are getting railroaded and when the management company is saying it's private property to trespass me but it's public property when they want to use everyone's taxpaying dollars to get the police to double down on Patrol in their area and they want you know they open their doors for some things but they close their doors for others and that shouldn't be allowed there should be you either are or you aren't and it should be delegated and I think the city would be the best people to do that and we have no problem following city code because we' we know the code and as it changes and Alters we're willing to comply thank you for your thank you thank you you anyone else you want to give us a in $2 can can you bring have it up so we can get it for the record uh please your name and address record into the microphones for the record my name is Francine Woodford I am also a resident of the Maple Hill estate's mobile home Community um yeah so she touched base on a few things um I believe that the so it was purchased by investor based out of California he is not in the state they hired a management company to manage the property the management company is not following current state laws and statutes surrounding the regulations and rules of mobile home parks and communities I strongly believe that they are operating in violation of multiple State statutes as described in chapters 32720 327 c015 327 C02 just 504b 178 there's multiple statutes that they're in violation of um so I told her I told the the manage the community manager Vicky Wilson I sent her a letter and she responded to my letter letter she sidestepped every single one of my concerns and and stated that you know the rules and regulations were not unreasonable and they weren't a substantial modification to the current terms well how is it reasonable to close down the storage that residents are allowed to use for extra item boats campers trailers Etc and then no no proper notice was given we we are supposed to give 60 days notice for this any type of change to our lease or rules we didn't give the proper we weren't given proper notice and then they started taking those things out of our hom sites after how is that reasonable how is it reasonable to close down the area that we're allowed to store things and then all of a sudden I mean they closed it down for maintenance no argument there but that's making us incur extra costs to either store our items elsewhere or lose them and have to get them back from the towing company they contracted with um I don't think that's reasonable um I'm sorry I'm just trying to gather my thoughts here um so they say that they do not have copies of leases for anybody but they're saying that we can come sign a new lease with them um which is absolutely unfair I think they do have those leases I think they're withholding them on purpose so that we don't have grounds to stand on um basically anybody who hasn't produced a lease for them is as um Christina said being trespassed in retaliation for standing up exercising their rights as residents of the community so I did speak with a housing litigation officer um through homeline and I asked him a bunch of questions about pertaining to the community rules that were not enforced such as you know decks must be skirted and dogs have to be under a certain weight limit and if we can Pro he told me that if we can prove that these things were not enforced ever then it's essentially loud um so I'm just trying to get the management company to acknowledge that we have rights and they can't just bully us and walk all over us I I have lived there for six years I've never been in violation of the community I've never gotten any type of citation relating to my home site I pay my rent on time all the time I I just don't understand how some big investor can come in and try and take people's thing illegally take people's things kick them out many people are facing homelessness uh because of the rent increase so they gave us proper notice increasing the rent because we need 60 days notice but they increased the rent 41.67% of what it was that's absurd there are new stipulations for people to move into the park you have to make four grand a month how is that loow income how is that affordable okay we corkran has the housing stock only 12% of corran's housing stock is considered affordable and about 80% of that housing stock is located at Maple Hill States how I just don't understand how something like this can happen it's it's unfair it's unreasonable they need to be held accountable I um the the property manager and I don't know the guy's name is Jeff somebody connected with her he was driving around um pointing Vehicles like take this one take that one same who gives him Authority for that oh continue sorry I just I don't I just don't understand how something like this can be allowed to happen and I am also asking for help from the city council to perhaps impose rent increased limits so only a certain percentage can be increased each year or something anything because a lot of people are facing losing their homes and I don't know if you guys are aware but it's not very easy to move a wellestablished mobile home it's very costly and it's really not practical for most most people um yeah I've already complained to the attorney general I I launched a formal complaint um I'm advising all of my neighbors to do the same yeah I don't I don't have much more to say it's it's it's unjust it's not right it's they're bullying people they are using they're bullying people they're trying to say hey if you don't do this this is what's going to happen it's it's it's unfathomable to think that people that have lived there 20 30 years are now being basically kicked out of their homes thank you guys for your time I don't I don't my thoughts are i' it's been hard to focus on anything else right now because of the watching watching our property and our in our yard hope hoping and praying that the tow truck's not going to come try and hook it up they first started coming in the middle of the night on Monday the 24th they were Towing Vehicles until 3:00 a.m. I spoke with Jeff I told him this is what state law says he said oh yeah you say that what do you mean I say that I'm not saying anything I'm telling you what the state law is and you're completely disregarding it you think you're above the law so thank you thanks please thank you very [Applause] much um hi my name is Diana lingren and I also reside in M Hill States um I know for a fact in two in two instances they extorted money out of us um they will hook our vehicles up but if we give them $100 cash they'll drop our vehicles um and I don't think that that's fair I am one of the people that were up until 3:00 the last three evenings trying to save my property and save my stuff um I have been violated um so I don't know if that means that I will be kicked out of the park or what but um I can't get my storage which which I've rented excuse me which I've rented at the first of the month um I have been putting stuff onto my trailer which was down below like they were talking there was free areas as long as we had our Lot number on it we could store our boats our trailers um and uh they told me that if I didn't have um legal the title to it I couldn't get any of my stuff from down below um and you know so I'm trying to get all of my stuff out of the house because I don't know if I'm going to be violated within seven days to um leave the property um and uh I have 30 days to sell my trailer to whoever they say is comparable to be able to buy my trailer um they have to accept them into the Park first um I've also had to take my animals which um some people have cats and some people have dogs and you know stuff like that that Berry had absolutely no problem with us with our animals as long as we keep them in our yards and leashed um and stuff like that um I have a black lab that is fairly large she's a she's a good eater um and I've been told that they that I had to get rid of her because she's over the weight limit um I have a dog that is uh he's Chihuahua and American Bulldog um but because He follows the family of a pitbull or Rottweiler that is not allowed in the park either um and he they never leave my yard so I don't understand why they can just come in and state that one dog is too big and I'm only allowed to have one dog as it is um thinking that with Chrissy being um excluded from the property um trying to save sassy her puppy I'm not able to take on her dog because I have to um I have to wait for both my dogs and this is what they said straight to my face that I have to wait for both of my dogs to die before I could have I could take on another animal so you know I mean they've extorted money out of people they've hooked up they've hooked up vehicles um I personally with my own two eyes watched him drop a vehicle off the backside of a um of a a tow truck and just rehook it up and drive off with it without informing the person that they just took the vehicle from that now that vehicle could be damaged you know but we're left at our own ordinance to try and get these vehicles back let alone if they're damaged or not I also watched the person that Chrissy was trying to save his vehicle they he smashed into another one of their vehicles and he tried to stand there and tell the police officers that he didn't do it but until somebody actually came up and said hold on a minute I watched this happen then he finally agreed that he did smash into it so our property is being damaged while they're Towing it out on us at 2:00 in the morning without really coming and talking to us you know so I guess that's really all that I've got to say but you know I just I think that extorting us out of $100 for us to drop our so that we can go to work the next day um instead of Towing it away to God knows where um I don't think that that's fair and I believe that it's extortion so thank you for hearing me thank you anyone else I'm no worries you're going to do great y I'm ch's mom and can can you please state your name and your address my name is Sandra Jensen I live at 7800 Maple Hill Road lot d29 thank you it is the third home that I have owned within this park I've lived there since the early 90s rais my children and my grandchildren and I'm being told that I cannot have my daughter at my home to help me I have emperra obviously I have Mobility problems I need her help I need this this no trespass order to be gone cuz I'm not the only one we also have a friend that has a lost half of his leg she helps him she cleans his house there's another guy in the Park she's the one that gets his meds and divides his medication up for him there's nobody else to do these things cuz she does them out of the goodness of her heart she doesn't ask for money from me she gets a home so I need my girl home I need that no trespass word of God not just for my sake but the other people that she helps she also helps me with my kids I have a 13-year-old mentally unstable child that's right now in a group home and he's been in and out of the hospital he's been in and out of treatment centers and she has a way with him that I don't the boy has tried to kill me three times she can stop him cuz he doesn't listen to me I'm no threat to these kids so please please have a pause thank you thank you is there anyone else that would like to speak on something not on the agenda thank you uh no other notes or emails we will go on Mr Mayor yes C can I ask for staff to prepare a memo or a brief presentation on what Avenues are available for the city to influence the situation and whether and staff's assessment any laws are being violated it might be worth getting um some members in the community in touch with some legislators on there's several committees that I think some of these issues would fall under the jurisdiction of if if laws are being violated I can touch base with you and come up with a list and get that up to you guys and and if you did want to check social media for those that just spoke there's legislation before the body right now that's in committee that are that is addressing some of the issues that you're raising uh because uh there's concerns exed put on no trespassing order for a quiet prot is basically wasle after the other haded as they were trying to hurry up and hook up the one vehicle and leave theic behind both I knew that it was wrong it it would have been a hit run and would have been an illegal step a vehicle and I stopped it I sat on the hood of a car and he told me I needed to get F off the car or I was going to be trespass and I said you can't do that I said what you're doing is wrong and he said then the person in whose car you're sitting on will be evicted retaliation it was clearly retali nothing but a lot a lot of us are on Social Security um I personally was in a car accident so that I I cannot you know there's a lot of things can't do and I have been written up and violated which I don't know if they're going to take my home away from me because I didn't do it within their 24 days that they gave us to to take care of these these items instead of the 60 which our rent our rent Le States so M Mr Mayor to address what what you're saying so so for your awareness too like uh some of the resources that are going to help you best we don't have in those Staffing at the city but we can definitely help you connect with some of those uh a lot of these are health health and human services we don't have any of those types of employees but uh the county does and we can we can help point you towards the direction there uh and so to to council member Nichols Point uh we'll we'll take a note on this and see what we can do uh we'll educate ourselves on what's available um I came from Scott County that's where I previously worked and so I was much more familiar it was the county seat uh and I was the Parks and Recreation director so I was working with them pretty pretty closely we had a lot of homeless folks in our parks and so I was working with health and human services in Scott County pretty regularly uh I'm not as familiar so I do have to get uh aware uh to to be able to better understand what resources are available that could help you this this Mr we could get someone from the neighborhood's uh email that can get word out to people so so we do have Chrissy's email right now when you sent us the email so uh we we've got her email as a contact point my email last got may just sorry you would this be a good application for the shared social worker we have with other cities I'm not sure i' I'd have to do a little bit better to look at what the scope of that is uh typically it's a different kind of crisis situation as I understand it right now but there are social workers at the county typically that can help with these types of issues specifically like housing related issues our ours are usually specific episodic issues uh not not uh some of the things that have been brought up here but I I will I will get smarter on this and we'll connect with you and get that information to you soon um how we go about the Tres order being dropped she's been banned from her home for retaliation son illegal my son has a tree in my mom's yard just just one person talking guys please go ahead keep going son pass away and hise is in with my brother's if I can't go back to my mom's house and I can't have another holiday with a little family I left I can't see so again Mr Mayor if I may Jay you can correct me um Matt I think we've got so so may Joe Murphy is a MREs is on a well I think I've seen him I think I've seen him once or twice in the few years I've been up here so again folks this is a private Community but there's a lot of things going going on and I think we all understand okay um I'm not sure there is no real how do I want to say it affiliation with the city involvement into this community and stuff it was Private those kind of things um I was on was on uh Facebook today looking at a lot of things going on and stuff because I knew you guys are coming and I know some people in there um Brian deusi and what he did to do what he's done fantastic person he's still him and his wife are still with the community or not anymore yes they are okay um so so I'm I'm actually meeting with Brian did next week okay it it just sounds like something that needs to go faster um I want to say this without getting or legal upset at me um so maybe not I you know how many times I've listened to y'all um there was a there was a there was something on uh Facebook from one of our local news stations that was advertising sign not advertising but did a story on the community um it is one of the three major stations in call letters end with an E there I didn't say it so um just something there and again if I'm in trouble I've been in trouble before but it it it is it is a difficult difficult situation I can't imagine I I don't know what else to say but uh it uh we will do things to point people in the right direction I think try to get you whatever resources we don't have those of resources but we'll try to connect you with the kind of resources that can help you those aren't the people that we have on our team but we have partners that do from the public safety side we've got our public safety director here and such there's things that he has to do or our department has to do but uh I'm I'm relatively certain it'll be done with as much respect as possible and understanding as much as possible so do you have a question I was just inv mying Can I submit the tesing order to the council could could someone that make a photo copy I'd like to take a look at it if if she's okay with that after the meeting okay you sure usually usually we are full of ideas and solutions and stuff has to try to take a look and Direction might be able to help I I feel of course we speak up if we don't then we're expected to out the rules and they want to go in free we like I said we we don't have Solutions but we've got a team that will do everything they can to help point you in the right direction with the some of the you're dealing with of course thanks for coming you guys you for bring attention really appreciate it the second safest city in Minnesota no we're actually the first the data was wrong yep and you you all are you all are part of that so please don't think any less we we that we we've heard y all and it's it's thank you very much it's disappointing what's going on yes thank you it's nice to be listen happy to have you here thanks Mr Mayor of course thank you guys okay think that we can give everyone a minute to trickle out and then we'll head into consent agenda um consisting of items 6 a through 6K is there anything that anyone would like to pull going on um I'll I I'd like to recognize uh 6K okay I'd like to pull six 6 e six e anything else nope okay I will entertain a motion to approve consent agenda items making me do alphabet and chunks you know I'm not good at that uh a through d F through J that one wasn't so bad I'll make a motion to approve that second I will second uh all those in favor say I I I will go alphabetically so Michelle uh you pull 6ie yeah thank you Mr Mayor um I just wanted to clarify or confirm I know we had chatted about this at our last council meeting but I just wanted to make sure that staff was talked with talked about with their new job descriptions and pay grades and that everyone understood where they landed and that was part of what we talked about doing and that was completed and okay yes yes that's all I wanted to pull okay I'll make a motion if I can ask one question on that yes everybody was pleased no okay uh you know it's it's disappointing if if if some if someone has an expectation that that maybe their position's not as valued but then the market says that it's here uh so I think there was some reality acceptance okay and we had some canid you know careful conversations also uh for for everyone's awareness uh we were coming forward with this in January and when we came forward there was expressed some concerns I hit pause on it so that we could pause and have a conversation with every employee and and those conversations went really well and what was brought to light was uh in talking with department heads in some cases unfortunately some some key duties and responsibilities were not included in the job description so that was a really helpful pause for us and then we collaborated with them uh for us uh for the audience's uh understanding in most cities it's the council or or the city administrator that are setting the job descriptions uh We've elected to our our no one knows what we need better than our department heads and so our department heads are determining what they need for their departments to function in collaboration from their employees so we started with what's called a jaq every employee f filled out a job assessment questionnaire so every employee said what they do and then that determined the Baseline for the job description and then it came forward in the process what we recognized is going forward in the process uh maybe some of the things that they did now as they're going they like oh wait a second and I I didn't emphasize that as much in the jaq that's that's what happened so it wasn't we were cutting things out it was like oh that's a pretty big chunk of my job uh and so we were able to make some corrections as a result there was a few modifications of a few positions in which they they were regraded uh and then we had affirmation of some other ones that yep we did change some of the language it didn't result in a regrading as we went to our experts uh but that was a really helpful pause in the process uh and uh I think it is kind of indicative of the culture we're trying to establish in terms of collaborative dialogue so employees spoke up we heard them we responded we collaborated and then we came forward but that doesn't mean everybody's super happy about it no I wouldn't expect the answer to be yes so that's a lot of work you guys to do it in a short period of time and and uh get us competitive in this if it's called a business what is it called I don't mpal Corporation Municipal Corporation whatever I can't make up words that anybody else would understand but great work Lear on this so this this is her baby everybody yeah there's a reason we she's here too so everybody thank you guys so much um and and the learning side of it was huge for everybody so thank you guys and thank all of our staff everybody on it appreciate uh their patience so did you start making a motion she did um yeah I did start to make a motion do you want to make that motion sure I'll make a motion to approve item 6 e right behind you Dino a second is that a second yep I assumed it was um all those in favor say I I poos no I'm good I I was an I too I just didn't hear just didn't say a loud um then 6K we had pulled by Dean yeah um huge uh huge deals the grants and everything that's being worked on to help us do what we want to do on our parks and such um thank all of the folks that are involved um Natalie is that that is uh your whole groupie and Steve Hein and milicia actually had a lot I would imagine you all got a whole bunch of people doing it so thank you guys very cool and it was literally submitted at 6:15 tonight Steve was in here so they got all the leg work done today and I was in here and uh for your awareness the drgr system is a 1990s Antiquated system and so staff spent all of today trying to get all the data in there and it and it kept kicking them out and this is the Absurd part finally learned that the city of corkran had to be in all capital letters Capital C Capital CIT capital c y didn't work couldn't figure out why had to get help Des support once we got in all capital letters city of corpin viory B everything worked so Antiquated system someday that'll go away so good with that um motion to approve 6K a second second Jeremy although all those in favor say I I Perfect all righty then we will go on to kind of uh 6.5 the added item I did which was the mayor report I moved up and Deb uh if you're able to pull up the it pulls I just wanted to bring this to everyone's attention mentioned at the last meeting we passed a resolution to the effect un last did we lose the TV meeting we have one out on this side lost two now you're going to turn one on and off I want them both dueling TVs just so everyone knows this is hosted on our City website if you if I could show them really so if you go to our government underneath Council it's at the bottom right there so if you click that it takes you to this portion of the website which is all current proposed bills uh this is being updated regularly and if you notice there's unfortunately a lot of them a lot of crazy going on there's a couple on the other tab too as well um but those are basically the bills that are currently in this session being introduced or have been introduced and are working their way through committee regarding new development housing uh increased density uh removing local control removing public hearings removing design requirements and um parking requirements and all sorts of stuff uh if you read through those bill tchs which I'd highly encourage you to do we also have the uh contact information for the bill authors and key committee members of the Committees that they're likely to go through um and then Jay if you could just click briefly on the uh lawmakers Advanced zoning reform bills that's a PDF from the league of Minnesota cities that kind of has a good overview of each of the bills at least as of the 17th of March um and kind of highlights what is being discussed uh there was supposed to be a hearing on most of these bills on the Senate side on Monday that ended up getting canceled at the last minute so it's not exactly clear what the next step forward is for those but I would anticipate there will be one it's just uh they're keeping their cards close on this one um making it maybe a little bit more difficult to follow but we will do our best to keep this page updated so that everyone's aware of it um and uh if you feel so inclined to reach out to legislators uh the contact that top link there with emails and uh phone numbers for the key keep people on these bills um but in short it would be these were all to pass or even a majority to pass drastic changes to how development works that would basically cut the council Planning Commission residents out of the process in terms of feedback and and decision- making Authority so um if it's not not a great package of bills in my opinion and our opinion um so yeah just wanted to keep you all aware of that and encourage you to take a look at that and uh reach out if you feel so inclined and share those concerns and that is all I have are we doing all Council updates right now or are we okay um I just wanted to give Council a quick update on the artwork for the side of that structure on the Domino's building I spoke with the high school art teacher and she's very interested and she's actually moving full-time to the high school so it's a perfect opportunity great so I just need to go about getting information about how big the structure is what the process would be and then I can relay that information to her so should I connect with someone on staff JCB and also if I could put a plugin if those of you who are here as you go out uh there's a really nice looks like a pizza slice right on the window it's got a QR code and you can do the survey in which we're trying to gather information for theming uh and it's also on our website um and so we're trying to get some data before we try and go forward to do a design what what should be the themes what should be the ideas uh for that and so that that survey is open right now and once we get that data then we'll be able to share that with that high school art teacher okay she was very excited she thought it would be a great program since a lot of the students she where she works with our from corkran they're Rockford students from Rockford high school so yeah and and just on top of that for everybody wondering what the heck we're talking about you get that little half BL it's partially black down there in the corner The Dominoes that's coming in they have a cooler on the far end and one of us or all of us came up with a crazy idea instead of painting it an odd color or doing something let's vinyl wrap it with something that is representative corkran um whether it be Parks whether it be farming whether it be hunting what something something that could turn into maybe we could change it every couple of years something fresh something new so that's what we're talking about is something different than just throwing paint on a building so bring some artwork cor yeah I think it's a cool idea and looking forward to seeing what comes with that the teacher um deer jerman did you have anything no I'm good okay then we will move on so we're actually all good with item 11 when we get back to it later on the agenda um we will go into item seven which is our planning items and we have two items uh we'll start with 7A the Brockton Business Park [Music] okay thank you this is a preliminary plot site plan for Brockton Lane Business Park like you supposed to say your name and address I know it's weird it's a whole new Vibe up here um this is a preliminary plat to create two lots and three out lots for two uh industrial buildings totaling a half a million square feet uh on the very Northeast part of town that's 101 on the uh right side or the east side of the lot there next slide this 80 acre property is guided in zone light industrial it has been as long as I can remember uh it is in the Musa and it is our our Northeast District meaning it's Musa meaning it's planning to get sewer and water an environmental assessment was worksheet was completed for this site and the notice of decision was adopted by the council in February uh Planning Commission held a public hearing on this item on March 6th and voted for zero to recommend approval next slide uh 101 is on the bottom here so North is to your right on this uh image and the two buildings are oriented towards each other with the um truck docks in the center uh parking on the outside or the fronts of those buildings and this development would result in construction of two new streets the street on the south has the turn lanes that were built as part of Nelson this is where Nelson Trucking driveway is so that will be upgraded to a City street and will continue to the West property line swooping around that Wetland and on the north is what is planned as our new East West collector Street uh that's a new public Street on the North side that would have uh as you can see on the plan turn lanes that would be constructed uh as part of that uh there's a large Wetland complex on the north side of the building in El lot sea and if you can point to the um water or the Well site there's a well site proposed on the northeast corner of the site you say Northwest no over this week I just want to point at the map oh that's right because nor down there okay that's what I thought okay the sideways and it's very confusing we look out Kendra Kendra's got a pointer yeah watch out for the reflection that's the Well site right there that would be deed to the city as part of the project next slide so it is planed for office warehouse uses it's a speculative building at this time meaning no tenants have been identified uh but uh lot standards and building setbacks have been met the architecture does generally comply however we do have a condition to address the um need to break up the wall the Northeast District says the wall needs to be broken every 80 ft or not more than not less than 80 ft meaning it has to have a change in color elevation or material we got an email where somebody said they thought the building was going to be 80 ft high can you clarify that yes the the uh building is an interior height clear height of 32 ft and the U Max Building height is 45 and I think it's just under that um um at at maybe 401 or 42 I don't know maybe Brandon can answer that but it's definitely not 80 feet high that's what I thought thank you um so a little bit of tweaking with that I have been working with the applicant they have added windows to the front it wasn't in your packet but we'll just continue to work through that with them to address that to make sure that those front elevations are interesting that's the reason for that so it doesn't look like it's really long building that helps break up the map Kendra real quick the windows and I'm talking faux or fake windows that kind of stuff is what I'm talking they don't need to be just against something to break it up but they're talking maybe windows they're talking this plan shows actual windows we do sometimes see spandrel glass which is fake Windows um uh off the top of my head I think I have the image on the next slide there um some of those tops above the first level might be SP glass and and the applicant is here and could could answer that this is an old image this is the image that the Planning Commission saw so the image that we received uh yesterday uh does add more glass along that um poter along the bottom part in this Zone here the tan part which is the ground level portion they've added more glass in that zone okay and as well as on the side elevation uh the parking with all ordinance standards and again in the Northeast District we do have higher standards for screening and Landscaping so the parking stalls are screened by a 3-ft landscape BM as required and the trailer stalls uh we don't have specific standards in the code but they are screened by an 8 foot high landscaped burm so there's an opening to get into the shared truck dock but there is a significant landscape burn to to to screen that area there's a zero setback on that shared lot line and as a condition in our code uh in the new Northeast District guidelines there needs to be a cross access agreement in place so we'll work to make sure that's there that manages maintenance between the two lots and then uh uh reduces the allowed impervious on site from 70 to 60% this is well below that the site of uh going off memory is I think 32% impervious total uh on this site in large par significant space and wetlands on the North and South sides of the new public streets parking Bays interior to the truck bay parking only uh can be eliminated if additional landscape islands are bigger landscape islands are added at the ends of the bays and additional Green Space uh added outside of the required setbacks and so the applicants working to get those calculations but the plans appear to comply with that is there anything in the resolution to ensure compliance with that correct perfect Yep this will be our first project uh under our new standards uh with EV charging stations so there's uh I believe six EV charging stations provided in this project that helps them meet some of our Northeast uh District guidelines resiliency requirements next Slide the Landscaping in the Northeast district has standards in addition to what we have in other districts we have trees uh specific native or um uh similar trees that are required here we have some additional landscape requirements and this does generally comply there are a couple of details that need to be addressed there are conditions in the resolution to address that we for example don't allow Rock mulch it has to be uh with chip mulch for example as one of the more sustainable tools um a buffer yard requirement in this case we did talk about this at the concept plan buffer yard D is required in the south west Corner which is where the circle is um and based on those discussions condition 26 of resolution 2528 does Grant the waiver from the buffer requirement finding that the distance and the existing vegetation shown in green will provide the buffer uh and that providing additional Landscaping in zone would actually require removal of existing vegetation but certainly that's something council could uh modify next slide uh this is the landscape uh plan you can see the significant Landscaping both in the front uh yard along 101 and just scattered through all the throughout the side it's a little hard to see the BMS because this isn't the grading plan but again along that shared truck bay uh that is a burm and then burms in front of the parking lot 3 ft in those areas and then along the streets we have a sidewalk and a trail on each side of the two new streets and so the landscap uh is coordinated with the landscaping or excuse me with those sidewalks and trails next slide if I could just real quick on that um I did a ride around with uh public works here a while back and the the goodness gracious the number of trees and stuff how beautiful is this going to be in 30 years when I'm not around anymore um the the the mindset that we've had or that cities have had is there a way to put the side not sidewalk next to the street instead of the street trees then sidewalk is there a way to get the trees on the other side of the sidewalk if that makes sense there is I'm I'm just asking I I'm not insisting I'm just the the the Public Works guys are right now they're experiencing the trees that are so close to the roads are slapping mirrors and doing all work guys I know they're tough but I'm I didn't promise anything I just I'm speaking up so they aren't here thank goodness we don't have to we have one put up with him but he's he's a water dude he don't he don't care don't care about trees so I'm I'm just you you understand what I'm saying it it it it is cuz they end up being Boulevard trees and they're maintained by us and such is there a way that they can end up not on the Boulevard and it's not our responsibility as such and just asking out front so yeah so a couple things um absolutely you can build sidewalks at the curb or trails at the curb as a pedestrian I would prefer you didn't I feel a little safer if I've got a little green space and I agree with that I agree I'm walking down it certainly has a different aesthetic if you do that there's no right or wrong cities doing different ways our Northeast design guidelines however do say we're going to have a green Boulevard with trees and then the sidewalk or Trail I just I'm I'm also worried in a few years Jeremy experienced this over in renia where all of a sudden the trees are starting to get big and it's cracking sidewalks it's tearing up tar it's doing all kinds of stuff and as close as it is is it going to end up tearing up our gutters and stuff I just is there a way to do something different there if not at least I said something for the public workers guys so one of the things that we're being more thoughtful about is we're sensitive to which trees are selected those areas and what their root pattern is right um because there are some trees with for example shallow roots that you wouldn't want up against the sidewalk that is going to create those cracks um so we think that for a lot of the reasons we talked about with the Northeast District that this aesthetic makes sense it's a more appealing pedestrian experience but it's also sort of a a nicer as the trees grow and and the branches are higher up it's less of an issue I think right now we're yeah they need to be trimmed we we need to do some trim all the trees are young it is a challenge for Public Works that is true but over time those trees will grow and it will be less and less of a problem but it is a uh like any um developed City it is a city responsibility over time it's something that the city of corkrin has decided though has is an important aesthetic that we understand I'm I'm speaking for so I I I this is wonderful good gosh I stopped counting the number of trees on the drawing because I don't have that many fingers in toes but it just it it it's a nice look so thank you for for entertaining it and public works I did what I could so how's that it's an ongoing discussion appreciate it appreciate for listening um uh but this image shows over time what that's sort of going to look like uh I would say to the applicant next time bring the tree up a little taller for this conversation but you can see they're above the trees uh above the the car there in terms of height so this this is showing looking from that large Wetland on the south towards the buildings and again this is a full growth of the trees but you could see it's very well screened next slide these were in your packet as well this is from the North End of the bellweather neighborhood the south end of the Wetland on this property looking towards that project and again given the distance and the Landscaping there it really becomes uh more difficult to see the building that does take time obviously these renderings always reflect the trees are fully grown but uh it does give you a sense of scale next slide uh parks and trails Park dedication in this case will be cash and L of land we did talk about this with the concept plan that there's a a onroad trail planned on County Road 101 when that gets done by the county that's not a city Trail and then the Three River Park District Diamond Lake Trail ised the west side of the Steep property so we met with Three Rivers as staff and talked about um you know should we move that trail now over towards the industrial park since they're in now uh are you interested in making a a a leg or a Spur coming out to 101 and really they were not they're happy where the trail is they're happy we're showing Trails on our streets to connect ultimately to the Three Rivers Trail on on the seed property but weren't interested in acquiring either land or Trail as part of this um so again as I said earlier there is a sidewalk on one side of the road and a trail on the other side of the road um on the County Road 101 and such Kendra where is that trail going is it on the east or the West Side M Grove or cor yeah we don't know that's the county will have to design that as part of their project but we are taking RightWay adequate right of way for both the road improvements and the trail okay do we want it do we want want the trail on our side one more up on Maple Grove or do we want them to have I digress I'm sorry depending on where you're looking there's Parts where it almost has to be on our side and parts that I don't know where it's going to go it's so tight when we need another tunnel no I didn't say that out loud yeah just for the public I mean to my knowledge uh hen county has no plans to improve 101 at this time um we certainly continue to talk with them we would like them to 101 but um that's just not on the program this time we had that conversation last meeting didn't we so streets uh this as I said does have two new streets uh this is our Northeast District plan the streets are generally with shown on that Northeast District plan um the existing Street connection at Nelson and this new Street on the North do comply with County spacing guidelines um the applicant has sub submitted an application for access to the county uh the county did not comment during the eaw and they did not comment uh within the 30-day statutory review period uh about this application they have commented that they think that Maple Grove and and corkran should meet in the middle with the accesses uh this is an industrial project this is the right place for this road and we recommend approval of the project and the plat where the road is shown um the northern Street should connect in the future with a street in Maple Grove it's possible the county could do right in right outs and not align the streets that's sort of outside of our they'll have to figure that work tonight uh we think this road is in the right place um the northern Street does have a large retaining wall uh so as you drive into corkran from Dayton uh you will see that the retaining wall is 15 ft at its highest point that's a pretty significant elevation change from the Wetland up to this right that's exactly right and so uh we just want to make sure that that's not I we are not recommending a design committee but we do think that the retaining wall should go through engineering and planning uh and make sure that it's an attractive design there are just a lot of different materials we can use for those types of walls we want to make sure it's attractive but we also have utility in there and different types of walls have different um tiebacks or different construction things we want to make sure that it's constructed in a manner uh that doesn't conflict with our utilities and streets now but also long term as we own that uh wall that street and those utilities so um we're very confident we can work through that it's just something I wanted to highlight then another condition yes do you know which one um no but I will look well wrap these up and tell you sounds good no just real quick too going back to last meeting and such our uh County Commissioner made a mention that he wasn't quite aware of the stuff that we've got going on in Parker and we need to talk better and such I I wanted to disagree really loudly with that that day but I didn't are you confident Natalie you guys are confident that we are giving them Dwight you're nodding your head yes they are quite aware of everything that everything that can and might be going in to this area along County Road 30 and 101 the somebody at the county knows and understands that there's things going on right so so having been in not all of those but a lot of those conversations if Kevin were here he'd be pounding the desk right now going absolutely you've been having those convers just if somebody can get back to our County Commissioner and tell him that we are very much informing them what's going on I'd appreciate that you can say you can say council member bar Camp said that so one one one of the most recent well recent conversation we had was a a question an appropriate question uh regarding their strategic planning for our corridors right uh and you know as as Domino's was coming in and they were making some suggestions that were making that more and more complicated we're saying you they don't have a strategic plan they didn't uh and that's when we got some clarification about their ideas for 10 but they they were changing their plan for 10 and they hadn't communicated that clearly to us I digress but I think it's app propose so as Kendra said there is no plan for 101 other than the fact that we're about to have 3,000 more vehicle cars a day coming off 610 into Corin going north on 101 going West on 30 going south on 101 and hitting shut Road that's going to be fantastic um so uh it's it's super frustrating because they do not have these roads in their CIP we brought that up when when uh commissioner Anderson was here uh and um we will continue to to bring that up uh and residents con contact your elected officials because hanpen county is not giving us our fair share of uh support in terms of dollars particularly on our transportation corers yeah for all all yall over here it was it was an interesting conversation with uh our County Commissioner last time so we are screaming pretty loudly but we hold back a little bit too so he knows crazy what's going on the retaining wall condition is number 12 in resolution 27 and uh we also have a condition um that uh I think it's in the engineers M might be in that in resolution 27 as well that the developers responsible for all improvements identified in both the feasibility study and the eaw um again those both assumed a full access that could get tweaked a little depending on what the County permit says next slide just real quick on that wall yeah yeah I'll see it my suggestion fieldstones and welcome to Corin sign like a boulder wall wall just don't know I know that's more expensive than Keystone and all the other stuff but I don't know if that's an appropriate place and I'm not sure I want to say welcome with an industrial building right there too but with the cover and the trees and everything it might be a good opportunity just saying it out loud no that's great feedback I think uh for the applicant to hear and and we'll work with again we have both the aesthetic as well as the functional nature of that wall also we'll work through that um utilities this is an area that has city sewer and water yay uh outlot B which we found on the screen early on in this presentation is a potential future Well site that'll be deed to the city with the plat uh the final location and access route still working through those details but generally we're shown on the plan um the applicant's been working with staff on the final uh storm water design uh FEMA flood plane as part of this project I just want to highlight that our engineering team worked uh with Elm Creek Watershed and Elm Creek Watershed as a result of their work did do a flood plane study uh that benefits all four of us cities in this corner and established once and for all the flood plane in this area so that was big and it helped this applicant finalize their plans uh there is some flood plane fill uh proposed in that that area where that retaining wall is but um uh there is some watland impact the wetlands are shown on the the plans and so both the Wetland and flood plane uh impacts require permitting from both the city as the lgu for the uh wetlands and the watershed this northeast District resiliency requirements requires the applicant meet three of them and what they've identified as the three that are being met with this plan are Landscaping with Native species bio retention systems again that is subject to the city in shed review but currently the plans do show that if if that doesn't work then alternative resiliency option uh would be required and then lastly the uh six electric vehicle charging stations that are proposed here next slide that was the site plan this is the plat which is for two lots and five out Lots one of those out Lots being deeded to the city uh there are two phases uh lot one is the one on 101 that would likely be built first and then in in 2026 and then building two on lot two would be built in 2027 next slide I don't know why I put that in there again but that's the building um uh next steps if approved the applicant would work through the conditions of approval and then come back to you for final plat and development contract uh approval so we do uh suggest the council move to adopt the two resolutions as recommended by the Planning Commission and Happ answer questions as I said the applicant and his engineer are here as well if there are questions for the development team perfect any questions for KRA any other ones I'm going to bring it up just because the um idle eagle nest is way far enough away from this it's well over 300 yards isn't it uh it's very very far away uh I don't know but it's been there's been nothing there for a while that is certainly one of those things that as we work through the precon that was identified in the eaw and we will be monitoring that and there are mitigation strategies in the eaw that be incorporated in the construction the Eagles have urbanized and they they have do you remember when we were young and it was such a big deal to see them I see them all the time in my place and I I wish I knew where the nest was but uh they are thriving and great but it is it has been there a long long time but I know it's been idle for uh a significant number of years so there's this going W set back on the Wetland yep Eagles are up over here yep so it just it I want everybody to know and understand i' like not to visit that down the road anything else Kendra anything for the developer or development team thanks thank you or would you guys like to speak all good thank you Mr mayor council members my name is Brandon champo I am Executive Vice President at hble real estate um the applicant obviously on the project and just wanted to thank city thank City staff uh it's been over a year that we've been working with you guys on this project now uh we're very excited about the outcome of where we're at excited to break ground hopefully this summer and um appreciate the input that we received throughout this process just uh a couple things I wanted to point out the uh the Eagles Nest 867 ft away only okay good guess right 300 yards yep the uh the boulder wall you know look into it I'm not an engineer there's a huge cost and a lot around the boulder wall and stuff I just quick snapshot and elevation and stuff just something or break it up between just tall bricks and the Keystone is that what it's called nowadays still is it something else or the yeah or the great big concrete blocks with the bubbles on and they're stackable a little bit more character than that what are they called there's different facades and things okay he'll he'll he'll Le in the right direction and the water guys they're helping you with it too so life is good um and then the only other thing too I want to mention we we are installing the six EV charging stations but uh we'll have conduit that'll run across the whole building so in the future it would be easy to convert every stall to EV charging if in fact we are all driving Electric vehicles in the future um I won't be around I'll move to Montana got do something different so um so it'll be it'll be set up for you know more um long-term resiliency resiliency strategies um in the future there but uh yeah again just appreciate everybody's feedback through this process and we're looking forward to investing in the city and getting this project U going if you guys approve it tonight so great thank you any questions I have a quick question it's not really pertinent to you but um the TAC fees are those assessed over the entire 80 acres or just over the Upland portion that is such a cev question are you sure it's the up portion it's the predevelopment area so we do take out wetlands in SL Lane okay thank you we're happy to take a bigger discount noted lot it great but for this application they wouldn't need to pay the Maple Grove fees as well right this is just new cor yes it's all us now so there's your discount the Corr discount maybe one thing though I mean I think we're willing to look into doing like a welcome to Corin sign on the wall I guess I would maybe ask that we'd be credited some of the part dedication fees for the cost of that sign I just suggested it I wasn't given anything up so something to a monument sign we can it we could evaluate it at final is that an option um I I don't I think Park dedication we probably should not negotiate with but maybe there's another fee that the city council would be able to negotiate with less legal constraints so we'll take a look at that with City and and it's uh appropo that uh later on item 8 a one of our strategic initiatives for 2025 is Monument size coming into the city so uh so it's a pretty timely suggestion to potentially dialogue about that I didn't mean to open a can it might be fine I just wanted to just throw that out there that it might not be best for Park dedication but we'll like take a look at that with City attorney sounds good anything else put a climbing wall there that sounds sorry right right next to unimproved 101 now yeah no yeah now is not time to breach all righty and then uh before Council discussion if there's any members of the public that wanted to speak on this item not all at once okay then on a council discussion um wants to lead us off I've talked yes you have thanks for letting me anytime um the only thing I had a note of to maybe bring up for you guys was uh uh that condition 26 I believe it was about the buffer I think we discussed it at concept that we thought the the size of that Wetland and the distance and and the existing vegetation was adequate to SK to uh wave the buffer additional buffer requirement on that South West corner I would agree I mean for the resident who misunderstood the packet if it was an 80 foot building I might feel differently but yeah I feel like we 65 from a resident yeah we doing that interesting how it's tep um but okay I I it is a big spacious Wetland expanse so I feel like that does satisfy the requirement I I agree you guys feel yeah I do and I I'll say one more thing the the Common Parking semi area and stuff the work that they did with the the screening and such they got entrances and such I hope that works out well in the process and like I said excited to be around if I'm still around in 30 years see what this looks like the forest they're planting it's a lot going in there appreciate it all right well if there's nothing else then I will entertain a motion to approve resolution 202527 approving the preliminary plat and resolution 202528 approving the site plan so I moved second be second Nichol and M Camp uh any further discussion all those in favor say hi perfect congratulations yeah congratulations on to 7B which is the loor comprehensive plan Amendment and Natalie K twice [Music] twice you guys got to stick around for this it's a condition We snuck it in there yeah if I can't leave they can't leave have a good one guys thank you Mr Mayor yeah item 7B tonight is the Lo comprehensive plan amendments uh this is an application from Brian and Jackie loother who are requesting approval of a comprehensive plan Amendment which would reu their property from existing residential to conservation residential the subject property itself is 10110 County Road 116 um this is a 9.87 acre property which is currently zoned single family residential and uh guided existing residential and is located within the first stage of the 2040 staging plan uh the current land use guidance uh of existing residential hasn't anticipated density of half a unit per acre however um it does not allow for subdivision of the parcel so the applicant is requesting that that land Ed to be um reged to conservation residential uh which would allow for an anticipated Den 2 to three units per acre which is the lowest anticipated density uh that would allow subdivision within the Musa um that's that's not the existing residential um the density calculations itself um currently within the Musa is 3353 units per acre um if approved that density would bump up to 3357 so not a huge jump but this is me to illustrate that this is one of the instances where ruing a property to conservation residential um does not have a major impact on the city's overall density calculations um and is something that the council may want to consider during the deliberations um since this is just the comprehensive plan Amendment um I can't get too deep into Transportation but um just want to point out that um the development well approval of this would allow for development on the site uh development of the site would allow for the installation of a public road which would allow um for a connection to the water treatment facility water treatment facility at its Southeastern Corner um this was something that was contemplated with the plat for Hunter Place second edition back in 2020 and uh with the final design of the water treatment water treatment facility it has been stubbed out uh the southeast corner for that future connection so um with a with a development of this site that's when that connection would um be rerouted um the city's overall discretion uh of this application the comprehensive plan amendment is a living document um so the council has a relatively high level of discretion when considering the comp plan Amendment um if the council finds evidence that supports the change in the in the plan uh it may make that change um but you may want to consider has the applicant provided evidence demonstrating demonstrating the reason for the plan change uh is the change needed to allow reasonable development of the site and does the requested change have Merit beyond the in interests of the proponent so at this point staff recommends approval of resolution 25-31 approving the comprehensive plan as drafted uh Planning Commission uh earlier this month voted 3 to one to recommend denial of the resolution and recommends the establishment of a residential land use category uh Within the Musa that would allow for development at less than two acres two units per acre um since this is a comprehensive plan Amendment it does require a four fths vote for approval um so with four council members tonight would require all four somebody sneeze I me I heard something come unplugged yeah there it is good job plugging it back in quick but happy happy to answer questions and I know the applicants are here and are um willing to answer some questions to the council may have perfect any questions for dght can you speak to the mechanics of what the Planning Commission recommended and how that would be more difficult than what the applicant is asking for us to do so with what the Planning Commission is recommending that would be um that would require denial of this application to since this is specifically for the conservation residential district um and with the 60-day limit it does expire on the 30th so um if that were a route that the council wanted to pursue youd have to deny the application before you um and staff would have to do some research on what those options are but it would um be a city- driven request for us or the applicant have to come in with that request to um establish that type of zoning district and then um category sorry yeah land use category it's very different very very different um and then that would come back to you and if approved then it would go to the Met Council for final approval and um there's some difficulties in that so what I can say in addition to that so a land use category of one to two uh units an acre is going to be difficult to implement because we are right on the hair of three units an acre especially with what we know is coming with 2050 con plan at 3.5 units an acre um I think it'd be a very limited use category I also think that it would be very difficult for development to be viable at that density with the infrastructure streets utilities that need to go in um I think what is what a two to three would still allow for that infrastructure to be in first constucted as well as maintained sufficiently by city or by the city long term whereas once we get to 1 to two that becomes very difficult especially for long-term maintenance and we already know that we have uh neighborhoods that are less than one unit an acre in the Musa that will be part of that that we have to maintain long term once they connect to city sewer and water decades from now at this point that's just something to keep in mind that 2 to three is already very low comparatively when we're talking about Urban Development um and so one to two I think would be very difficult for us to actually Implement across the board so and and if I could continue to speak on that I'd remind Council that it was about this time last year uh we did not have a conservation category which is currently our two to three units uh we spent about three months uh we worked very hard we brought met counsel here they were willing to come on site at that time uh our lowest level category was 3 to five and I it was only through dialogue in which we recognized how the algorithm Works in which we were able to demonstrate that without significant impact to our overall density we could implement this two to three density and so to Natalie's Point uh it's not really feasible that we could go two to three uh in terms of meeting our density requirements and two uh we would not get any favorable consideration from that Council in order to try and Implement uh a comp plan amendment that would create this new category it was very difficult uh and it was really that they' made the statement in a conversation with us and we got them in writing to stick to their statement in which we're allowed to create this new category uh none of our neighbors have a category of density like that uh it was through a lot of hard work and dialogue in which we were able to create this new category uh and so um while it would might be desirable to have a lower level of density it's not really feasible within the Musa with uh things that are going on I would also remind Council that uh the mayor brought up the legislation that's before uh the bodies right now they're in committees and um if they were to take our voice away like half of those uh bills suggest uh you could have a sstory apartment building with a density of 30 to 40 per acre on here without us being able to say no to it so that's that's just something contact your uh legislators that's we're not trying to scare anybody it's that goofy it is scares me it is yeah it scares all of us but that is uh so in terms of of what's feasible right now uh to develop this property this is the lowest level density that's feasible right now Mr Mayor can I make a motion sure I'd like to make a motion to approve resolution 2025 31 approving a comprehensive plan Amendment at the property of 10 1110 County Road 116 before before we go to a vote Mr Mayor y uh I do have a email comment and we do have three cards of residents that have requested to speak on this topic so yeah okay we'll hold we're hold y um are there any other questions for Dwight thank you for clarifying the process Brian did you want to speak uh well good evening mayor and members of the council my name is Brian lther and I am uh the applicant with my wife Jackie and we live at 10110 County Road 116 here in Coran and as I've been pondering the uh application that you're considering here tonight I believe that inherent within that application is a question that I believe needs answering and uh but before we before I talk about what that question is when the city purchased the three and a half acres for the water treatment plant and the well that's now on this north of this site the question that I would ask the council is this was it the intention that the remainder of this site could be uh developed Andor subdivided when sewer and water were available to this site and uh it's it's my opinion that that was the uh intent of the city council uh after the city acquired the acreage of the well and the water treatment plant in order to receive uh permission from the county for temporary access to that site uh the city had to uh show how and where a permanent access would be achieved and uh what what the city did in December of 2020 is they created a ghost plat that showed this new Street uh that would connect down to the uh water treatment plant and this was to be the the permanent uh access to this area uh what ended up happening is that the ghost plat does show this new Street running through um this property it's the only way to access the uh water treatment plant uh there's not another way to access the water treatment plant other than coming through this property and uh when this G plat was was done it not only showed a road coming through our property but it also clearly depicts the site being subdivided and or prepped for development uh and as you know the sewer trunk line and water main currently run through the site not only do they run through the site but there the manholes are already set in place uh ready for for use this particular site was in the 2020 to 2025 Phase 1 Musa designation and is now really ready to be developed and at the time that the ghost plat was drawn in 2020 the density calculations that we currently have in the city were not were not in inforce at that time obviously some of you on the council with the city staff have worked on those density designations since that GH plat was uh drawn out by the city and so what what has been uh finalized is obviously these different categories of dens but what the ghost plat did show was multiple Lots being foreseen to be used in the future although the density hadn't had actually been determined at that time so obviously we've had some discussion here tonight about our concern about densities obviously the legislation that is going on right now with the state uh even the me Council has come in and two years from now the densities are are going to be higher than what they currently are right now and so what our aspirations are to do is to basically for lack of a better word take advantage of the opportunity we have now to implement a lower density on this site than what not would not be afforded to us at some point in time in the future and so the conservation residential uh category is the lowest density that the city allows at the present time and I would recommend and would ask that you regu this site as conservation residential uh it's the lowest density that's available to the city at the present time uh I'm of the opinion that the gos plat that was done in 2020 uh for this site clearly indicates that the intent of the city was that at some point in time in the future when sewer water were available that this site would be developed that is clearly shown on the goals plat with the multiple lots that were designed within that go plat so I'm requesting tonight that you do approve uh the application that we brought before the city council and uh I I do think that U this is the this is the lowest density that will ever ever possibly be on this site uh if we wait it could be much higher and and by by state mandate rather than just what the city council do and I do think Josh has some comments Mr Mayor may I ask Brian a question quick Brian I was fortunate enough to become a council member back shortly before all of this happened and if I remember the conversation right and I know it's on tape I believe I said I absolutely hated ghost plots yeah because it just it drives everybody in that vinity to oh my God 38 homes are going to go in there because that's kind of if I remember the numbers that's about what it was I think I even asked you are there any plans to do anything and you said you really didn't have any plans you wanted to keep the barn the house I mean a couple of historical pieces and such and I'm like okay great but we had to ghost plat it we had to put the road in and those kind of things so I just I wanted to reminisce for just a little bit about that and I think I even said is anybody interested in buying this property you said I don't want to say no I hope not but you said something to the fact that you kind of like your little piece of of what you had there for as long as you could yes and this opportunity has come up yeah this opportunity whatever we might want to call it depending on who you are neighbors are going to say something different I'm quite certain and stuff but it I think I said it would be nice if we could keep Hunter Ridge the way it is for as long as possible um I think Jason you and I have had conversations at that time I said I think it'd be about a year and a half before anything would come from the East side and now all of a sudden this so I just I'm reminiscing I wanted to thank you you've you've spoken well and love to hear from what Josh has to say let me just respond to your comments U at the time you asked me that when the go PL came out in 2020 yeah obviously we had no plans because we didn't know what could be done with the site uh the acquisition of the property to the north for the water treatment plant as well as the um potential for something to happen on the site uh obviously uh got our our wheels turning Y and uh up until that point in time there was no reason for me to think otherwise that anything different would be done with our site uh but once everything got in motion with the water treatment plant yep and the sewer and water were available and this particular site was in phase one of the Musa obviously I started to receive calls from people who were interested I had a hunt you would yeah and so uh obviously our intent was to not put the most dense development that we could on this site but rather do something that would be the least in uh the original idea was three to five three to five and U jery did you come up with the I gave it the name he came up with the name what did you name it again conservation residential we can thank former council member B John was on that too B was the one that kind of started that whole did he have silos involved in that too or was that on there than you thank you very much mayor members of the council my name is Josh mckin I'm a consultant for the applicant um so I just had a couple of things to add bran did a good job of kind of outlining you know some questions that he has I think where what I want to do is just spend a little bit of time on in terms of the process on how we got here tonight because I think it is important and kind of paint a picture of you know where how we approached our options and what kind of how we landed on this so um we had came up with with a A Sketch plan that we brought to council uh I don't know must been two months ago or so with a density that was I think we were showing at three at that point in time because we were just going to try to hit the very bottom edge of the 3 to five um and we asked the council members at that point in time you know is this appropriate or is I think Dwight actually had done some research in terms of the ability for us to potentially consider conservation residential and the more that we started looking at it hearing some push back from the neighbor relative to the densities that we proposing and then also considering what we're trying to do ultimately with the subdivision which was to be as least impactful as possible while still allowing a subdivision uh conservation residential became kind of more kind of almost work better in a weird way in that where allows us to maintain um as many trees as we possibly can along a rear property line rather than just scrape the site fill it it allows us to maintain an existing home uh rather than scrape it and fill it up with additional lots and we could could easily hit three to five if we just scraped everything um and it allow us to avoid Wetland impacts on the North side um uh in a way that you know if we really had to maximize the density to 3 to five I think we'd be challenged to do so and so we're thinking hey conservation residential makes a bunch of sense um but also then you know how do we get from the existing residential guidance to this one and you know in looking at this the the ordinance the ordinance is clear in terms of the ability or the the process to do so which is you know should these properties be wanting to subdivide within the Musa that are guided for existing residential our option is simple it is a compline Amendment and so that's we don't have another a choice if we want to subdivide frankly so the question that I think Brian wanted to ask you is does he have the right to subdivis property and then if and then this question I have to add on top of that is if if it's not this now what is it when this is phase one of the M USA this is the lowest density possible we don't think density is going down in the future so what if it's not this what is it I would like some feedback if if it's if it's something that Council does not deem appropriate what is it um and so that's kind of the things that we've been wrestling with as we've been hearing some feedback from the neighbors um which is like I don't know what to tell you other than like if if he's allowed to subdivide his property which it seems like the city had intentions or at least an ankling was possible or feasible um this is our only route and so you know we're trying to put our best foot forward and I can tell you that you know should the council uh agree that conservation conservation residential is import uh important or appropriate it's incumbent Upon Us in terms of the next steps of uh preliminary plat uh to dictate how we could potentially you know use the buffers that are found within the ordinance or um you know provide additional space uh and considerations for these neighbors that are impacted across the street I we're not at that point yet because it's kind of a mood point just to have a discussion about what buffering and and these kind of things are until we get past this hurdle y um and so I guess those are my comments if you have any questions kind of on what our approach was I'd love to hear them perf appreciate it thank you thank you then J we have some comment cards uh so first I just point out on the Das for uh yourself Mr Mayor and the council members uh we did receive an email yes uh uh for Lindy Lynn um and uh it it echoes comments that she had made at the Planning Commission uh but it's it's just reiterated in a different way so I I draw your attention to that uh and then now we have uh three comment cards uh Mr Mayor so uh the first one would be Mr Jason Bartels and please uh name and address for the [Applause] record I don't need to detract from my own time but I I haven't started yet okay um do commissioner L thank you concerns questions to get read to the group or just I'm curious how that work we all have a copy y uh Jason Bartles 19795 Hunters Ridge um good evening Mr Mayor councel and staff thank you for the opportunity to speak tonight I live on the south side of Hunter Ridge my wife and I have property that will look directly across the street at the applicants proposed 22 home development in what is now a farmfield I passed out the plot map to each of you now I realized it's not the direct issue tonight but it is the applicants motivation for this change and they even addressed it themselves so obviously it Bears consideration I'm speaking tonight on behalf of several neighbors as I previously did earli this month at the Planning Commission meeting I decided to focus my comments on the decision criteria that is specifically outlined in the agenda packet the applicant needs to demonstrate the amendment has Merit beyond the interest of the proponent the agenda pack presented the Planning Commission stated safety on Highway 116 as the Merit for the change I expect the city can find a way to put a road from the water plant to Hunter Ridge for safety without having to surround it with 22 new homes they'll be a new road created oh this is incredibly similar to the Quick Trip proposal in Mama G's access to 101 there's going to be a new road created over there for safe access to 101 without a need to surround it with new homes after much discussion by the Planning Commission regarding Merit commissioner Lynn stated she saw limited value for the community and considerable value for the applicant commission chair Brahman questioned who was receiving the value the city as it pertains to Water and Sewer revenue and density calculations or the city as it pertains to Residents there's been a lot of speculation tonight as to what the council was thinking or what their intent was 5 years ago with the 2020 uh water treatment plant you know if it was going to get rezoned for subdivision which should have been done at that time obviously they didn't they had their reasons I don't know what they were but I'm just it it troubles me to hear people talk about the intent of the Once Upon a Time kind of Dreamland one of the most interesting lines of the applicant's narrative reads as follows expanding the municipal sewer Network helps to offset the city's fixed cost the city's fixed cost I thought this was a private property applicant for personal development consideration we understand the City built the water tower in the treatment plant in anticipation of new residential usage Bell weather and Hope Church development will certainly provide plenty of that this proposal needs to stand on its own Merit or lack thereof without consideration for extra Water and Sewer revenue for the city and I hate to differ or I hate I beg to differ with some comments made previously um there's no manhold cover in that field just so you know you know so don't don't think that it's a done deal and this is a slam dunk because that's completely not true the Planning Commission discussed this issue late into the night back on March 6th and concluded this request as written was not in the best interest of corkin chair brummond cautioned about using the conservation residential designation as a default Choice when it didn't really apply and also using it so frequently that it loses its intended use commissioner Lind want wanted to be sure that decisions made would promote and maintain the character of the city the applicants property is guided existing residential of course a property owner should have the right to sell their property nothing is preventing the applicant from doing this potential buyers for this type of property might include individuals with some rural values who want some Land open space or similar the applicants preferred option that being subdividing and developing isn't currently allowed so they want you to change the rules for their benefit the applicant should be held to compliance with the existing code density density it's been stated this change would result in a marginal density increase to the Musa and help contribute to the city's overall density goal it still baffles me that Corker needs to have a residential density goal when so many of us intentionally moved here for land and open space this area of corkrin is certainly dense enough already we've got bellweather directly to the East and Northeast already so dense it appears most neighbors can shake hands between homes simply by opening their windows The Hope Church development is projected for a density of 18.7 n with these developments in place or in the works the density in this area of corkin has to be considerably above the goal average we don't need another heavily populated subdivision in the applicants cornfield to drive that number even higher I've heard the Met council is in part to blame for the rising Cor density requirements uh the 18.7 N Hope Church density is a large step I would even say a leap in that direction isn't the Met council's plan a 2040 plan it's only 2025 we're clearly on our way to compliance but it doesn't need to happen overnight with every new development request and that was about five minutes if you could all right I I got like two lines left sounds good um again the applicant's preferred option that being subdivided and developing isn't allowed they want you to change I respectfully request Council follow the Planning Commission recommendation and determine that rezoning is not in the best interest of corporate and therefore deny the application the applicant has continually said what choice do I have this is the only way I can sell what you've got to do this for me so I can sell no that's not true leave it as rsf1 let him sell to a private single family homeowner you know don't Grant the subdivide plan just so they can maximize their profit thank you thank you uh Mr Mayor uh the next uh resident would be Mr David Thompson mayor and
