morning everyone the July 17 2019 meeting of the city council's called to order this meeting has been properly noticed and posted in compliance with the open meeting law these proceedings are being me capaci Shadow Hills Church remains standing for the Pledge of Allegiance good morning I'm sorry I did that most gracious and almighty God we come before you this morning with grateful hearts for how you have blessed not only our world and our nation but especially our state and our City Las Vegas Nevada the scripture comes to mind Psalm 27 1 the Lord is my light and my salvation Whom Shall I Fear the Lord is the strength of my life of whom shall I be afraid and so God this morning in this meeting we want to trust you we want to trust your sovereignty we want to trust your power to enable us to glorify you I thank you so much for these that serve our city that help lead our city that help to govern our city I pray that you would protect them that you would bless their families God that you would give them wisdom and discernment that they might act in a way that would honor you and God I thank you in a special way for the citizens of this city that even make it possible for those of us who serve to serve we thank you for the wonderful city of Las Vegas for all the things that we know about it sometimes that the world may not know but God we are grateful for the spirit of camaraderie the beauty of diversity and all of the wonderful things that you have bestowed upon us here so God in a special way I pray that this meeting would go in a way that would father honor you but also help to build our city to be even greater in the days ahead we trust you we ask again your blessing and we ask all these things in the name of the almighty God amen foreign thank you Pastor and now we will join you down by the podium there for our ceremonials somewhere else before we get to our ceremonials once again we've had a loss in our Las Vegas family and somebody's so dear and so special to so many of us that Metro Police Captain Larry Burns passed away as you know last week he had served 27 years protecting our community before retiring in 2013. and we got to know him as he served the captain at the Bolton area command and Ward 5 here in Las Vegas and for I know I can speak for all of you that all of our thoughts and prayers go out to the family his family he was a beautiful man and taken way too young so thank you and and Captain Burns you'll be missed we'll move forward with the rest of our items but I know what a special human being that we lost here recently and to take a moment to pray for him please okay this is a ceremonial portion of our agenda it's my pleasure my real pleasure to recognize our citizen of the month I'm proud to announce that our July citizen of the month is Rohit Joshi owner of neonopolis where are you Joshi oh my God come on here [Applause] this man has had more ribbon cuttings and more celebrations makes more phone calls tomorrow offices we have a new tenant please come down more celebrations more music oh is the beautiful smile and what a great guy how many years have you lived in Las Vegas 25 years so forever he's been bothering the mayor's office for 25 years all I can tell you but anyway I I kid because he's a great gentleman always with a perfect smile this man is a great example of dogged determination a resilient attitude and obviously that infectious smile as you know neonopolis opened at the famous intersection of Las Vegas Boulevard and Fremont Street in 2002 right during the boom years there were many issues at that time like no or faulty air conditioning and different tenants who came and left and had dining or entertainment complexes when Mr Joshi purchased the building I have no idea why it must have been a great price for him to do that in 2006 he bought neonopolis since that time he's been enthusiastically and most aggressively working to transform that facility into a development that's full of life and exciting interest businesses in each birth instead of empty store fronts it once held so today Joshi has accomplished his goal this is incredible by leasing nearly nearly all of the 240 000 square feet of space in the development and over the last few years it seems I can't go a month without finding myself at one of his grand openings ribbon cuttings at Indianapolis in fact so many of you are here because he twisted your arm too so in fact we have a short video we'd like to share with you that shows some of this fine man's accomplishments at neonopolis so please let's show the video can you see it over here [Music] [Applause] wow congratulations [Music] [Music] [Applause] as he said 10 years [Applause] [Music] now a couple of things the Metropolitan Museum of Art if you have not been in there the first time I was in there several years back I was so impressed with the quality of art that is shown in the Annapolis on the first floor you really should make it a point and I hope um Ali wherever are you here today Ali who's the director of our arts and no over at the city but over there at the Museum you're the director beautiful and so I encourage you all to really stop by but as you could tell that was just the synopsis a small synopsis of these ribbon cuttings and so um what came to mind the most probably beleaguered member of my staff who has to answer all the phone calls and all the requests it's none other than estefani Orochi and she was the one right here could you stand up please yes after she's known more easily to us was the one who said mayor this is the man that really should be the citizen of the month the tenacity that you have an Oscar when he was mayor for the 12 years all I would hear is he would come home it's Joshi again with another one of these crazy openings that would close and they'd move and we'd get more so anyway today is is for you and as you can see neonopolis is very busy place and no substitute for hard work and persistence and that is why Rohit Joshi is our citizen of the month and we want to present you with a plaque mayor Pro tem if you would I'm going to ask you to read what's on there please yes thank you this is the citizen of the month presented to Rahat Joshi on July 17 2019 signed by all of us okay I I think I'm going to ask you to say a few words and and do we have any space left and is anybody here interested in a special rate today for the special land space and then we're going to have a formal ribbon cutting if we have scissors are you serious well thank you mayor for your leadership and doing everything that you've done for our project at Nina please I appreciate it and the council members who has determined to make a successful I thank you very much also Scott Adams are you here he's my guy I tell you he is determined to make everything successful in downtown and I followed his lead and Bill Aaron are you here somewhere but but he is there always by the way I've got his cell phone number two so the so do I of uh Scott and I tell you anytime any day they are available for us and that's one of the unusual things in the city and Zach thank you for all that you do also I appreciate it my wife without her I couldn't have done all this she's the one that really deserves this uh definitely come on up here a little rain come here baby and it's her Museum that's right you better believe it [Applause] thank you and also all the first two rows are all my friends and my tenants are here today first one is Survivor of cancer Terry my sweetheart she's she can't even go out of the house but she has come here today to honor us all and of course Kirk is here so all the tenants are here that you should all meet one day I hope you can all meet them they're very very special people to us so thank you very much Mia thank you now if you'll go in front of the podium here and have the council come close so he can have this for and you'll face that way and Scott M's Bell aren't would you please come down come on Bill you have suffered through this through the years as well who else wait who else who else have you made suffer everybody in this crowd here come on Mr where are you doing okay so let's all get in really close come close close close how many spaces are left how much two small species of a thousand square feet each are still available we are working with atnt and Verizon oh how wonderful thank you okay so um okay and if you'll look at uh yes if you'll do that okay we'll count down okay yes three two one wow now wait a minute I may yes um Steph are we allowed to uh give him the scissors we are giving you the scissors we are also giving you the ribbon now if we had a lot of free money at the city which of course we don't because Scott watches us very carefully we would have put this already into a velvet frame and but I'm going to ask the council each if you could pull this off without and then ask everybody including yourself and Bill to sign it if we can get it and so that's for you but this woman has the patience uh of a saint and I just um but he does smile all the time and the museum is phenomenal so please go to the museum visit all the wonderful things now meow cats he's right here Larry Harry where are you please get up there he is hairy money this is opening when is that ribbon cutting tomorrow at four o'clock please all come to see the mayor and the council to be doing a ribbon cutting again for Harry Mooney who has invested tons of capital in our building in our downtown please support him on the second level yes thank you and the elf we wish you the best we'll be there and are you having music oh as a matter of fact we got a surprise for you mayor we're gonna do it today but we're going to do it tomorrow instead music and cookies or something uh champagne free by Harry money and desserts oh so come on down time to eat and again where do they Park they park in the parking garage under the Indianapolis building which is owned by the city wonderful so maybe it'll be free if we ask our parkings are can it be free parking Where Are You Brandi Randy she's not here no free no no no free parking we are a tight City well thank you congratulations now don't leave without the ribbon too we're gonna get it signed and you have met our new Council persons Victoria senior okay and Olivia you must know Olivia Diaz and of course our fabulous mayor Pro tem here and Brian Knutson everybody Knutson so and Brian's Ward one so you'd make sure you include Ward one right wonderful I just did the thank you okay wonderful exciting and we'll all sign that ribbon please and for our next item I want to invite our director of Public Safety Chief well actually a chief our chief chief Michelle Freeman to join us at the podium and it's my pleasure to recognize our Employee of the Month someone we all love because we love what he does Animal control officer Robert Aversa please would you join us Robert foreign strive to meet our city values of being kind committed and smart and Robert embodies these qualities he's known for always bringing kindness to his duties that include helping distressed animals and pet owners his passion and excitement for this are contagious he's committed not only to providing a great customer service but also to building a relationship within the community Robert attends community events and spends times in a time in our Parks so they didn't get to know the residents and neighbors and find ways to educate them about responsible pet ownership especially in this heat it's amazing how so many pet owners are really abusive to their animals leaving them out there without shelter or proper water he often Works to help injured animals and for example he responded to many calls at Floyd Lamb Park where all too often geese have been hooked by fishing equipment last fall he even joined forces with our Las Vegas fire and rescue and operations and maintenance departments to save the life of the cat that had been trapped in a pipe on a freeway overpass Robert we want to present you with this award and we thank you for all that you do for the city of Las Vegas do you want to read what that one says please Luke thank you this is our Employee of the Month Robert Aversa July 2019. thank you so before you get to say something gives you a few extra minutes thank you so much but I know our chief really wants to lay it on in truth everything that you mean to us thank you mayor mayor Pro tem Council so Robert Aversa is our Animal control officer that epitomizes our city values undoubtedly kind committed and smart is all he does and he's identified himself before as a simple man please don't allow that to fool you he is a man of many complexities but in simple State and he is very very very compassionate kind committed and smart he's empathetic and he's truly one of a kind he is humble so he'll probably only have a few words to say for himself but please don't mistake those either because this is a guy that we want in our community this is somebody that we want to be out there communicating with people helping people taking action with animals making sure that everybody's life in best interest is at stake and he's someone that truly truly truly does that and I'm so proud to be up here and I have to give a shout out to Jennifer Davies who I think is she here no she's not today she does so Jennifer Davies nominated him and what I know about Robert and how he sparkles Jen was able to see that unsolicited so when somebody in the in the environment sees that even though she's a city employee when she's able to unsolicit it see that and bring us here today so that we can honor Rob that's even more special for me so from the bottom of my heart I know what you do every single day and I know your compassion and how big and how gold your heart is and it Sparkles all the way through thank you so much for everything you do this is so deserving and I'm so proud to be on your team thank you say a few words under pretense first to my Lord and Savior Jesus Christ for without him nothing would be possible mayor Council women and men Chief Deputy Chiefs Lieutenant sergeants fellow co-workers my family everybody here I am truly blessed to get to do what I do um education is is the key these people don't know how to treat their animals it's up to us with the badge to help them and not only help them but to educate them as well thank you Jennifer Davies not here but thank you for watching thank you Rob we thank you and of course the sign at the corner of on Main right here on the corner in front of City Hall we'll have your name on it for the next month so we're just very excited and grateful to you and being animal lovers almost everybody on our Council we really appreciate what you do Jen of course we see your hand coming right through the camera who gave you the day off kidding she has two councilman Anthony oh my goodness how exciting and he has been in the spotlight if you have not been watching TV thank you good morning everyone it is uh my honor today to uh recognize and celebrate the collective collector car hobby as an industry in Las Vegas and the entire country and uh I hope all of you were able to enjoy the collector cars that were parked out in front of City Hall this morning I don't know if they're still there but there were some wonderful cars Las Vegas is home to many car enthusiasts and businesses that support them in the industry as you can see from the variety of cars in front of City Hall the interests and types of cars vary greatly and their passion is absolutely great this is an industry with sales of over 40 billion dollars annually SEMA which is the specialty equipment Market Association is the second largest trade show that comes to Las Vegas bringing over 140 000 visitors to our city and 207 million dollars in non-gaming Impact every year recently the House of Representatives passed a Congressional Record resolution 108 recognizing July 12 2019 as collector car Appreciation Day the collection and restoration of historical and classic cars is an important part of preserving the technological achievements in cultural heritage of the United States at this point I'd like to invite Skeeter Raider to come up to the podium representing all our car enthusiasts please give them a nice round of applause I do a skeeter Skeeter is a resident of the city of Las Vegas he started a collector car show which became what we now know as the national collector car appreciation day he helped SEMA to organize and is active in the SEMA Action Network to raise awareness in state legislatures about the collector car hobby so now I'd like to turn it over to Skeeter and apparently we have uh some video that we want to play um you want to walk us through this video here Skeeter and now let's try there you go totally unrehearsed yes well that's us at City Hall and that's some of the members that were here this morning at six o'clock you can see the diversity of the automobiles old and new all collector and I mean everything there you see a truck Pike actually that's quite a rig I know that's what you have Mercedes you have Corvettes you have Camaros some of them had the engines that are hopped up as you say but as you see on all these Automobiles of all ears you'll see that they have aftermarket parts and what collector car appreciation day is is our national holiday it's our opportunity to show everyone who is not a car Freak Like We Are the impact that we have on our economy nationally and actually internationally the car Hobby in this country and around the world brings in not millions and not billions but trillions of dollars to our United States economy therefore SEMA sand the SEMA Action Network we are the part of SEMA who deals with legislature legislators so that there are not laws that pre vent us from doing our hobby we don't have to smog cars that are over 25 years old those kinds of things and that's our purpose in order to show people how effective and how much we impact this country that's why this the United States Senate had this resolution and has had this resolution annually for the last 10 years we've celebrated this holiday and I would like to say with a lot of Pride this is the only resolution in two administrations that has passed the Senate both sides of the aisle unanimously so we're very proud of that we're also very proud that we can continue to have the SEMA show in Las Vegas and be welcome here and we hope that it goes on for many many years and I thank you for this recognition good job Skeeter and uh with all due respect to our Congressional Representatives I have an even better Proclamation for you this is from the city Las Vegas signed by the mayor and the entire city council proclaiming July 17th collector car Appreciation Day in the city of Las Vegas so thank you very much there you go thank you very much and uh if are the uh the owners of the cars are they still here would you mind standing would you stand up please if you own a car thank you very much for coming out this morning and uh as uh councilman Knutson has here I have a certificate of appreciation for every single one of you for taking the time to come down here at six in the this far and that my wife still loves me my kids love me and we've accomplished a lot in the first 50 years of our life and we've got a long way to go for the next 50 years of our life so thank you guys very much yeah so this morning I'd like to take this time to recognize Alpha Phi Fraternity Incorporated as we celebrate our 113th anniversary 95th General convention which will be taking place here in Las Vegas July the 24th to the 28th and I like to have the president of the Theta Pai Lambda local chapter here and all the brothers of alpha that are here to join me here to Podium come on up come on thank you brother Barlow come on up Alpha Phi Alpha was established as an Intercollegiate Greek letter fraternity on December 4th 1906 at Cornell University in Ithaca New York by seven young men known by the members as the jewels they led the way for the existence of the first African-American Collegiate fraternity some of the notable members include brother Dr Martin Luther King brother Justice Thurgood Marshall brother Jesse Owens brother Ambassador Andrew Young Brother Lionel Richie locally Chief Justice of the Nevada Supreme Court brother Michael Douglas Congressman Horsford is also a member of alpha alpha a former councilman Barlow who's here today with us Bob Bailey Charles Keller my father Dr John career and the list goes on and on as I mentioned is a local chapter in Las Vegas this chapter provides leadership to his members and respective residents in the Las Vegas Community this chapter also facilitates activities to benefit at risk and disadvantaged youth in southern Nevada throughout our mentoring group called Alpha Menon divas of tomorrow which was founded back in 1995. over the past three or four years we've given out over 145 000 worth of college scholarships to kids and we have 100 college going rate for our kids that are through our mentoring program which is awesome participants benefit from mentorships College Planning and visit Civic engagement and financial aid for college applications for six consecutive years like I said 100 of our amdot seniors graduated from high school and enrolled in college throughout the country Alpha Phi Alpha develops leaders promotes Brotherhood and academic Excellence while providing service and advocacy to our communities so in celebration of the 113th anniversary in 95th General Convention of Alpha Phi Alpha the fraternity would like to make a donation to Las Vegas mayor's fund and mayor I want you to come forward and we have something that our our president um Michael blow is going to present the kianga isoki Palacio baseball fields located on the grounds of the Doolittle Center complex and it's the home feel to the Bolden Little League teams and this Community Field is widely used in Ward 5 and resources of upgrades are few so today I'm going to pass the mic over to our president Michael baloney's going to make a presentation on behalf of the entire fraternity throughout the nation we have over 200 000 members of alpha alpha around the world and so this is on behalf of all of them president blue thank you councilman career good morning everyone mayor Goodman and distinguished members of the council it's our pleasure to be here this morning and one of the models of our great fraternity is service to all mankind and that of course extends to the little people the children and one of the things that we know throughout the years uh it's always been say no to this say no to that say no to the other well now there is something that they can say yes to and that is the Bolden area little league and one of the things that the that every ball player he or she likes is to be able to look up at the scoreboard see your number and all the information that is displayed on the board it's a great source of Pride not only for the for the participant but for the parents and Spectators as well so mayor Goodman today it is our pleasure to as as good partners in the city of Las Vegas that we would like to donate ten thousand dollars towards the purchase of the scoreboard at the Doolittle field [Applause] [Laughter] if I'm behind you come behind me okay let's go out and have a picture for everybody this is it's so outstanding I mean I think that inspires children so much when they get some type of recognition and they work so hard and parents support them so much this is just a beautiful beautiful expression of how you are involved in our community and especially for the Youth and the future of our city and the boulden area command goodness what a growing growing entity that is that is just so exciting to have a little league team I was so excited to hear that so we thank you on behalf of everybody in the city the mayor's fund which is supporting through the Nevada what is it called fat the Nevada oh isn't this great I'm having a senior moment on your birthday I'm having your senior moment the Nevada Community Foundation that may be it but anyway it's a 501c3 and you can give to different um projects and entities in the city and that you have chosen that particular support for our kids phenomenal thank you and I have a good luck good health mayor chip which mayor Pro tem has given to each of you may you be blessed with good health safety and the Lord's blessings on all of you that's not my role I can't do that but I'm doing it anyway so thank you this is beautiful back to you thank you thank you mayor I'm thankful that alpha alpha turn Incorporated chose to make a donation upgrade to fields in an area which I represent I also have to give a special thank you to our general president of alpha alpha brother ever B Ward Dr Ward is the general president of all of alpha he will be here this weekend and to all those at Alpha that have participated in this and have shown you know interest in our community as you know the Doolittle Center complex is a heartbeat of Ward five and this donation will help provide the much needed field enhancements and will be available at the start of the following 2020 bold and Little League season additionally Alpha Phi Alpha Incorporated a partnering with my office to host Alpha day this Saturday July the 20th their involvement would represent the Alpha's commitment to responding to issues affecting the African-American community Through collaborative efforts memorandum of understanding and outside financial assistance the day's events will begin with five activities both in Little League scoreboard donation ceremony which would be at the field at 9 00 A.M and then we have our strong start Go Mobile Pre-K academy tours would happen from 9 A.M to 12 p.m at Doolittle which is fantastic uh we have a Summer Splash party and you know according to the CDC our community has three times a higher rate of drownings for deaths for children from one to four so we're giving our free swim lessons as well from 10 a.m to noon and then we're having a Big Summer Splash party from noon to three one of our fraternity Brothers DJ Ibrahim Pedro is going to be there lunch will be served Refreshments for children will be provided while supplies last I have to thank our sponsors Anderson Dairy and also McDonald's who were providing little apple bags for us as well and then congressman horseford is hosting a health Symposium from 12 30 P.M to 3 P.M which will take place at Nevada Partners which is 710 West Las Vegas Boulevard so come out and enjoy a full day of family events it's free and for more information I always contact my office 702-229-5443 and also like to make uh we're going to present a proclamation to the alphas and this will happen as well on that Saturday but I'm not going to the whole thing but it'll say you know we recognize alpha alpha Fraternity Incorporated for a ten thousand dollar donation to the Las Vegas marriage fund earmarked for field enhancements and scoreboards your monetary donation provides two new scoreboards at the Doolittle Complex Center whereas we recognize Fraternity Incorporated partnering with Ward 5 councilman myself such a Creer and the City of alpha day on Saturday July 20 2018 and therefore in great recognition of alpha alpha training Incorporated his 113th anniversary 95th General convention an alpha day partnership with the city of Las Vegas we urge residents to join us as we do hereby proudly proclaimed July 24th through the 28th Alpha Phi opportunity Incorporated days thank you guys very much it's going to be great we will be around all week at the Bally's so it's going to be fantastic and thank you is it our director of cultural Affairs and you do know her don't stay of her though with those scissors and so um Ali if you would come down Lorraine really is the spearhead behind that wonderful Museum in its creation how many how old is the museum now all right we're adjourned we're gonna go ahead and we are not adjourned we are taking a recess and we're going to wait for our Tech to catch agenda item 55 I heard the comments before about the HOV lane and I totally support the fact that this thing should not be 24 hours we're forcing people into feeling like they're criminals because they're trying to use a lane that's totally open at 12 a.m the the enforcement action to to councilman's quotes it's not going to curb people's driving habits it's not going to add bodies in cars it's just going to flat out make good people possibly get a citation so we're in support of item 55 the other reason I'm here is we at the police protective Association know when that school is coming up we wanted to run a supply drive for the teachers a lot of times people do things for the kids but the teachers got to come out of pocket for a lot of money for a lot of items so what we're going to be doing up at our office up until the beginning of August or I think 31st maybe yeah Wednesday July 31st we're going to be accepting items for middle school high school and Elementary School jump flash drives reams of paper crayons all that if I could leave this year for you guys to maybe circulate I would be appreciated and then what our goal is is before school starts actually inviting CCSD teachers themselves up to pick out what they need for the school year and take it so we're working with as many people as we can and I hope you can circulate that thank you thank you man thank you very much thank you my name is Frank Bingham and I'm here to comment on item 79 and 81. uh 79 is a proposal of a three-story afternoon session will you be here after 11 at which point you would speak with legal do we have legal here yes um even though we have said there's no comment in this because he's leaving town councilman career would like to make a comment do we have to do anything special would pose the the three-story building in our neighborhood which is completely out of line with with the rest of the the uh the buildings there I noticed that the Planning Commission is recommending denial and I was certainly concur with that the other item on 18 is to really 1 or 18. what's that the other one being is 81 thank you 81. okay uh which really is a a recommendation to change the zoning from from low to a to medium back in 2014 we we fought this issue back then they wanted to change it uh to uh medium and and we went around and we got in fact I have copies of that of 146 people that that in our neighborhood that signed a petition to oppose that that to zoning change and if you'd like a copy of that I've got it here for you well we would like that submitted to the Cur the clerk and then also I'm going to have councilman career respond to you but I do think if you have not been into his office with your documentation as well it would be very worthwhile for you to make an appointment with councilman career when you come back to town okay so as I say we're opposed to that that's changing it from from low uh zoning to to medium zoning and and we opposed that in night in 2014 with this document that I gave her and so we're opposed to it now thank you very much and councilman career did want to respond which I will yeah thank him to do thank you mayor just through you I just want to point a clarification um they aren't going to build a three-story structure it's a two-story structure and um they were going to put balconies on the outside and they were going to take those away so it's not as intrusive to the neighbors that are right there along the border and I don't think we can go into conversation about it but I just wanted to let you know that okay so that's good news okay thank you thank you very much and any further questions please call councilman careers office good morning good morning my name is Cody Cunningham and I am here in support of 55 of removing the 24 7 restrictions on HOV lanes for the reason being that we are taking 20 percent of our lanes and dedicating them to about less than 12 percent of our daily traffic and so this isn't about convenience this isn't about a green initiative this is about a system of compliance a system of a compliance to write tickets to generate revenue for a state that has grown out of control thank you thank you Mr Cunningham appreciate it anyone else wishing to be heard okay we will now move on to agenda item number 10. for possible action these are business items any items from matter of course is the ongoing dispute over the Badlands Golf Course and the future of that property this dispute now entering its fifth year is impacting residents development and ultimately business in my ward My Hope and desire remains as I expressed during this past campaign for both sides of the dispute the property owner and the surrounding homeowners to come together compromise and reach a resolution that satisfies all parties I will do everything in my power as the representative of everyone in Ward 2 to help achieve such an outcome in the meantime I must also do what's best to defend the citizens of Las Vegas their tax dollars and the actions taken by the city council and sorry and City staff therefore I will support this additional funding request for our outside legal council who is defending the city in the Badlands litigation thank you very much um councilwoman and could I have a copy of your statement which I know I can get through the city clerk but at some point I would like to have that for my records please okay so items 12 through 50 on the consent agenda are considered to be routine or recommended for approval by the Departments and may be enacted belongs anywhere near Las Vegas wow my company is Tim said is a 7-5 brewing the number 75 holds a lot of meaning to me as the only number I've worn in my 10-year career in the NHL along with the two years with the golden knights we plan on brewing with Abel Baker who is here today who I'd like to thank for helping us launch this brand they've been really good to us you know I'd like to say that this company is not a celebrity endorsement this while it is about me it's also about the great people of Las Vegas I've only been here for two years and I've realized that the city has so much culture and so many stories to tell and through our branding and marketing we plan on telling a lot of those stories and bringing the city with this company so thank you for having me and uh look Canada icy cold City it gets to about minus 50 in the winters I play juniors in Brandon Manitoba which is about two hours West I was drafted by the St Louis Blues I made my wake up up in the ranks I played for St Louis for seven years I got traded to Pittsburgh and then made my way to Vegas fortunately which is uh the best thing that ever happened to me yeah into them let me tell you I would never leave anywhere else no no this is actually the first year that I haven't gone back to my hometown for the summer I call Vegas with your mother and father are there your mother either one of them or family go back home just briefly yeah but anyway councilwoman councilwoman Diaz please come here I just want to Echo the mayor's sentiments and welcoming you to ward 3 to the downtown area we're excited that you're part of the team that was born and raised here in Las Vegas because I'm born and raised I kind of have been cheering you guys on with your amazing seasons and I know that you've captured our hearts and you've brought us together as a city that's more united so I really feel that you'll bring that Spirit as well to your new establishment welcome and I wish you the best of luck and Ward 3 offices are here to help you thank you so much thank you and just know that we're here to help you along and all that you do and we cheer loudly and so thank you very much I do appreciate that thank you thank you thank you thank you I don't know as we move on to agenda item 51 um and I hopefully and I'm sure he will but Scott Adams I just want to make a comment we are having another retirement here in the city a good friend to Ops I think he's doing it I will shut my mouth because I was going right where you're going this lovely lady Karen duddleston who's been in government and family and everything and we cherish her so I will say no more and you've got gifts so what can we do Mr Scott Adams please sir good morning mayor members of city council Scott Adams city manager I hijacked my own agenda item today for an emerging issue which is very dear to the hearts of everybody at the city and in the city manager's office and that is the fact that tomorrow is Karen Donaldson's last full day in office before before she retires off into the sunset and I understand we'll do the world tour to or with her husband just like the Rolling Stones in YouTube as she described it I don't think there's going to be much of this planet that will be untouched after they get done but I I really wanted to take a moment to recognize the major contribution that Karen's made to this city and it has been substantial Karen started here in May of 2011 as our business planning manager she was later promoted in December of 14 as our Deputy planning director and then promoted in July of 2017 as Chief Community Services officer Karen truly changed the way business licensing is done in the city of Las Vegas by making it more customer friendly cutting down red tape and being more efficient when she started with the city there were over 460 business license categories in the city and a few years later she was able to cut that number in half and reduced the time it took to get a license from 20 business days to five business days just an incredible effort um and for the first time under her Administration applicants were able to apply for their business licenses online and was responsible for moving a large share of our business licensing activity to an online system which is really bringing it into today's way of doing business she also tackled one of the city's most challenging licensing issues which was the marijuana industry so as you know that's been a a difficult industry for us to deal with to license to manage and she oversaw that entire process as we worked through that but aside from those administrative accomplishments I think one of her most endearing things that she will leave behind in terms of her Legacy is the countless hours that she spent mentoring her team members and team members throughout the city she has spent a great deal of time and working her staff through challenging situations developing their talent setting examples for leadership and imparting strategic thinking to help them solve some of the big issues that we Face here at the city so I wanted to truly thank Karen for and recognize her for the contributions she's made here at the city I understand her husband and her family may be here in the audience and I wanted to present her with a token of our appreciation a city flag and it's very simple city of Las Vegas officer city manager Karen can you do it from the microphone please Chief Community Services officer eight years of service [Applause] and another bouquet to add to the mini that if you look at her desk it looks like the Winner's Circle at the Kentucky Derby I it's uh she uh she is a winner and deserves uh everything uh that she will get in retirement um she's worked hard you know the interesting thing about Karen because I was involved in interviewing her years ago when she started with the city her City tenure is the end of a very long and illustrious career in in public administration where prior to that she was with the state treasurer's office and then prior to that with Clark County and so she has a very long and distinguished career in public service Karen congratulations [Applause] your honor and city council thank you it's truly been an honor I was not going to let these flowers get to me today I've spent 22 years in the professional public administration I've got to serve at the county level at the state level and I saved the best for last um I owe you all a great debt for making my career um such a pleasure I can't tell you that I absolutely love coming to work every day to Scott thank you for giving me the chance to work with the most incredible professionals that I've ever worked with in 22 years and to my husband and my family my son is here Andrew we've raised three children here in Las Vegas together they're all graduates of The Meadows school I was a Meadows mom before I came here he's let me pursue my dreams whether those were in the boardrooms of the charities in this community whether they were in our government or whether they were raising our children he's been there for me every step of the way he now claims he can support me with the travel habit so I'm going to take him up on the offer thank you so much and to my family thank you all Karen No Way Karen I have to say something Karen and James and family um you know a lot today the whole world seems a little bit confused and we're hearing certainly an awful lot from the softer sex is being very strong and involved and there's an inference somehow you have to choose you're an example and a role model that you can have it all you can have it all you can have the family you can add the professional life you can make a difference and you have never been a blow hard you've never been somebody me I'm I James you are so lucky and your your family your daughter your sons I just if they knew you as long and as well as I have you're a woman to be admired for the goodness that you have done not only bringing up such a great family but for what you have done in in government um throughout our community and state I admire you I cherish the friendship that you have extended to us and to so many and for the accomplishments you've made the changes that have come about because of your tenacity but your sensitivity too in different phases that are too long to go into of government protocol and structure and how to follow through on things you're just a magnificent role model for women for moms for wives for individuals for an intellectual person and a very giving soul and so on behalf of I know I can speak for counsel and some who may not know you as well as I have grown to know you these past 20 some years years God bless you and may you have a wonderful wonderful retirement and I'm sure that Scott will always find a way when she gets bored James that to be you've been working all these years and taking care of children is no easy task you may get bored and we're here and I just want to stand personally and thank you very very much for all foreign [Applause] pretty close neighbors with uh Karen up in the Northwest area command and I saw Jim over there and every time I walked by their house walking my dog I see this massive barbecue complex that is going up in his backyard so uh when it's done I expect action regarding the neighborhood Partners Fund npf board recommendations to allocate 67 487.47 for 17 neighborhood projects this is general fund funding all Awards and so we have with us I will let you announce yourself good morning mayor mayor Pro tem and Council thank you for the opportunity to come before you today and if I may may or take a little prerogative and say publicly thank you Karen I am one of those staff people that she mentored and I have not had the privilege of knowing her as long as you have but I have had the privilege of being as influenced by her so I want to say publicly thank you very much for your mentorship for your leadership and for your friendship you will be missed thank you your name my name is Kathy Thomas Gibson I'm the director for the office of community services and I'm here today with Mr Greg Toussaint we are going to present the recommendations for the Neighbors partnership fund matching fund program in our neighborhoods and just a quick overview before I turn it over so this uh partnership fund encourages neighborhoods to take active roles in their communities and you have allocated dollars to support activities related to physical improvements Public Safety culture Recreation and educational programming tutoring that align with your strategic priorities for our community each neighborhood association or homeowners association is eligible to apply for up to five thousand dollars and they match that with either cash volunteer labor in-kind donations or Professional Services so uh with your support for over the past 20 years this program has created more than four million dollars of investment in our city neighborhoods a 1.3 million dollar investment from the city has yielded 3.3 million dollars in community matching investment and I think that's a good return on the dollar this year the board is recommending 17 neighborhood projects with over sixty seven thousand dollars in matching funds and I don't know if you all have this backup but I'll provide this to the clerk to ensure that you have the correct back up to match I'm going to turn it over to our board chair now and he will do the overview of the board and go through the recommendations that we are presenting to you today good morning good morning mayor City Council for the record I'm Greg Toussaint 2408 Sunset Beach Lane Las Vegas Nevada and I am the this year the chair of the this year's neighborhood partnership fund board commonly called npl it's been a really a great pleasure to serve on the mpf board and learn about these exciting programs in our city there are some very creative people community volunteers who have applied as they do every year for the neighborhood partnership fund uh grants I'd like to take a moment to recognize the my fellow npf board members and thank them for their participation the mpf board is comprised of six staff members and seven neighborhood volunteers appointed by the mayor and city council offices the members reviewed and evaluated a all the projects and that's a lot of paper not paper images on the screens over 200 pages of material we received from the applicants that had to be reviewed and and evaluated so they did a lot of work to start I'd like to thank our vice chair is Jordan sandecki for her contribution she's a former award to staff designee and she did a great job starting off with uh Ward one I'll introduce the board members by Ward staff designee was Ann kilponin the neighborhood representative Michelle Walters in Ward four staff designee Sally Christensen neighborhood representative Gail qualey ward 3 staff designee Ido interalde neighborhood representative Estella Silva in word two uh as I mentioned Jordan sandecky and as the staff designee neighborhood representative Charisse Holmes Ward 6 staff designee chance monteventura neighborhood representative Larry Schultz in Ward five staff designee Tonya Jackson renter neighborhood representative David Kress let's give them a big round of applause [Applause] they really did a great job I I have to thank mayor for your reappointing me to this board this is my seventh year of service on this particular board and uh certainly my community by participating this really gives me a sense of of making a contribution and it's a welcome and challenging experience every year so thank you thank you for serving appreciate it the sex the success of the mpf fund requires strong Outreach um hundreds of neighborhoods throughout Southern Nevada or Las Vegas city limits I should say um require uh to need to be contacted and encouraged to join this effort um this involves City staff Council Alma Estrada in particular to put together these promotions to to promote this program and what they did a great job and we uh we're very appreciative of what they they contributed but our board members also like to thank almond Estrada in the office of community service for her many things program coordination for the board patience which was the big thing for us we had she has patience of the all the people who apply she's got to deal with all those people and all the and all the people on our board asking questions and and getting answers so we thank her very much she's a real asset and critical to Our Success so the mbf npf board owners recommend 17 npf projects for fiscal 2019 2020 in the following categories one landscape Improvement project two security safety projects one Community Garden project one beautification project two mural projects seven social gatherings one doggy cleanup and uh doggy bag station project uh two sorry two Street signage projects let's look at each of the groups um Arville Oakey neighborhood watch Association Aurora top neighborhood association Buffalo Coalition neighborhood association El Camino Community Association James down Towers resident Council Las Vegas Meadows Limited resident community McNeil Estates neighborhood association and palomino Gardens HOA not and rainbow family Park neighborhood association Spanish Oaks HOA Beverly green neighborhood association Hunter Ridge Park neighborhood association Desert Shores Community Association Desert Shores Racquet Club HOA Turning Point Community Association cultural Corridor Coalition and the man monetta Lane HOA these are some really enthusiastic neighborhood leaders I have to tell you who really want to do something good for their communities with our help um this program creates a lot of different kinds of programs and very interesting as well designed to make a positive impact so every one of these projects impacts a community in a positive way my fellow board members and I recommend these projects for Council approval thank you very much and thank you Miss realized that I was way outside of my scope of experience and so my commitment to them was that I could uh that if the city did not or the npf board did not award them that I would personally help them with their requests so by passing this today it saves me a really awkward conversation at home so I'm very grateful for the decisions the board made so wise choices thank you yeah wonderful any has paid off in Spades wonderful thank you thank you very much Kerry okay we will move on to agenda item 53 discussion for possible action regarding a request for a massage establishment license for Yang Tang Hong Kong Lou DBA Sam spot 6340 West Charleston Boulevard Suite 130 this is in Ward one with councilman Knutson good morning good morning Mary McElhone Deputy planning director and I too would like to congratulate Karen duddelson I also received a lot of help from her I stepped into her shoes as a deputy planning director and she paved the way for my success so thank you Karen and congratulations so before you today we have item number 53 Sam Spa applicants Hong Fang wulu and yang Tang are here before you today to request a temporary massage establishment license they first appeared before City Council on January 16 2019 the background check had not yet been completed and staff could not verify the source of funding city council at that time denied the requested temporary establishment license in one of the Metro background check to be completed that background check has now been completed the Metro report was received on June 6 2019 with an area of concern both applicants do have clean criminal histories however the source of funding could not be verified with either applicant Miss Yang Tang had a friend in China borrow money from her and that friend wired the money back to her from China on October 2018 for 17 200 but it could not be verified Miss wulu had money given to her from a family member for seventy thousand dollars and that money could not be verified either on July 9th last Thursday Miss Tang provided wire information and the identification of the person who wired her the 17 200 from China Miss wulu provided the Charles Schwab account documents with a seventy thousand dollars with was withdrawn from she also provided a promissory note showing she had borrowed the money from her sister-in-law Miss Betty Wong when the intent to pay it back at three percent interest while the additional documentation given on July 9th still does not provide absolute varication it does provide a better understanding of where the money came from this location has been licensed as a previous massage establishment that operated without evidence of prostitution or human trafficking and operated with very little compliance issues the applicants are here today with their attorney Mr Mitchell Bisson if you need any assistance with the recommendation please let me know thank you thank you very much do you want to make a presentation or would you repeat your name for the record please yes it's Mitchell Bisson and I'm from the law firm of the Callister Law Group right downtown with Matthew collister and we represent the applicants here today Miss tang and Miss wulu whose son is here um he is going to be a key manager if this gets approved he's going to apply for a key manager and help run this business I mean it's correct they are seeking simply a six months can you speak closer to the microphone thank you please they're seeking a six-month temporary massage license for this location um they are here to answer any questions you may have as well as myself um during the lead up today is hearing there was an issue with potentially the source of funds but as Mary has stated we did provide some promissory notes and some wire transfers from a Charles Schwab account so we do believe we've satisfied any concerns as far as whether this money is you know legitimately received of any sort um I'd just like to say that my clients are serious legitimate business owners they've already invested approximately fifty thousand dollars into the location the equipment they've already bought a bunch of materials I know like the stones for the massages they've got all this all bought and prepared um as again the Mary has stated there has been no history at this location itself it's not one of the problem locations in town and in addition the applicants themselves don't have any criminal history um they have familiar familiarize themselves with the Las Vegas city ordinances involving these massage establishments as well as Nevada laws they've done that with the help of my Law Firm we've gone through all the ordinances made sure they're aware of what the law requires and that the the high standard they're held to so they do understand that this is a privileged license and they just asked to be given an opportunity to prove themselves with the understanding that any slip UPS any issues whatsoever the rub could be pulled out from underneath them and this license could be revoked so they understand that and if there are any further questions they're here and we are here to answer any any questions or concerns thank you very much a couple that I have and I'll certainly pass it on to council for any of their us what are the major cross streets of the spa the massage parlor I believe it's Charleston and Torrey Pines okay hours of operation as of right now they're gonna they're allowed to be till 10 I think they're planning to be open till 10. they're still in the process of hiring the actual massage therapists as well so depending on the availability of them that'll determine the hours of operation as well how many days a week I believe it's going to be reduced seven days seven days a week seven days a week until ten at night correct okay I got it it's all been submitted in this part of the record Madame mayor yes this establishment is allowed to operate between 6 a.m and 10 p.m unless you would impose additional restrictive hours okay and um does the family or rep the owners own any other establishments in Nevada anywhere in the unincorporated Clark County anywhere in Nevada mayor Goodman they do not miss Tang emigrated to the United States in April of 2016. she did hold a job for a period of time here in southern Nevada in Miss wulu immigrated in 1998 so she's been here for a while but she does not have any work history I believe thank you very much um any questions comment before I turn this over to councilman Knudsen if I may miss Tang I believe wants to make a statement please absolutely welcome good morning mayor good morning councilman and councilwoman I'm so sorry because my English is no good but I want to try to speak English let you know we spend it so much money we 've been so long time they tried too hard we need to discharge yeah I will I will open some Spanish mark I wish to passed customer service please trust me please give me give me a chance to put ourselves thank you thank you so much well we know your heart's in this so councilman Knutson if you could bear to be not affected by this please yeah thank you mayor and thank you for the presentation and to the city staff Ms mcorn who who was able to sit down and spend time with me so I can familiarize myself with your operation we met a few days ago and I appreciate what I believe to be positive intentions in bringing business into the ward and so I'm I'm thankful that you're willing to take a chance on us and you speak much better English than I speak Chinese and so with that being said there are some concerns that we have talked about at the guidance of City staff and so what I would do is hold you accountable for your good intentions going into business and for Mr Bisson you made a commitment to make sure that their the owners are very familiar with the city's codes and ordinances the state laws and I will hold you accountable for that as well and like I told you I will remember you yeah so please make sure that everyone is familiar with what the rules and guidelines are and with that I would make recommendation for approval of a temporary massage establishment license with the authority of the director or designee to issue a permanent license if there are no compliance concerns for the first 12 months from the date of issuance of the temporary license thank you very much there's a motion to approve six months temporary and followed up if there are no issues for licensing but they will come back at the end excuse me Madam mayor I I think the motion was for for 12 months even though Mr Bisson had mentioned six months and just to clarify we can do two six-month licenses through city council I would recommend the 12 months that we leave them on as a temporary for at least 12 months rather than just the six if you just want to do the six we can bring them back in six months but that is certainly council's decision and I I would move forward with the motion as I made it with 12 months with the regular inspections from this from the city's staff with any issues giving the authority of the director to change that thank you and that is the motion so that America I just have one comment style for my colleague and yes um and I'm not telling you what the just the point of um uh we can ask for a one-year review as well you can either have a staff review who can say that they reviewed it after the Year this would happen or you can have a council review where they actually come back in front of Council in order to say this has been good and then we can extend it or what have you just um it's your your decision is your emotion but many times we do do that especially since we've had some issues with um with with new massage establishments thank you mayor Pro tem wanted to make a comment also please thank you so I'm very excited about your business and I know my staff is listening so I'm going to if you can give me your phone number once this gets approved I'm going to have my secretary Felicia make an appointment and I'm going to come and get a massage to support your business because I believe your heart is in it it's going to come and thank you I really appreciate it thank you so much congratulations good okay we'll move is sweet we will move on to agenda item 54. resolutions are 32 2019 public hearing and discussion possible action regarding a resolution establishing an environmental surcharge pertaining to the collection of solid waste and recyclables residential recyclables this is a public hearing which I declare open and Ms Donaldson is this this is your last hurray it is oh my goodness okay please go forward thank you your honor as you stated before you today is a resolution established an environmental surcharge for the collection of solid waste and recyclables within the city of Las Vegas in 2017 the city council entered into a new franchise agreement with Republic Services for the collection of trash and recyclables it's a 15-year agreement in implemented single stream recycling which was accomplished in October of 2018 and this agreement also provides for the adoption and implementation of environmental fee and an option an optional franchise fees um specifically it allows the city council to impose a surcharge of up to five percent of the franchisees gross receipts for the following purposes remedial action removal or related activities at a solid waste disposal site environmentally sound solid waste collection and Disposal other environmental programs and activities as May benefit the public health safety and Welfare of this community we've spent time with each of you as city council as you know across the city we are seeing increasing environmental and health cleanup issues we're seeing them on our streets vacant Lots I mean public rights of way including Parks storm drains trails and alleys it's not isolated to one part of the city we're seeing it across all areas of the city those these are a particular impact on our neighborhoods the debris on streets create conflicts for pedestrians and Hazards for vehicles accumulation of debris on open lots and in parks are creating vector control issues fire hazards and general safety concerns in our storm drain the debris places our clean water Municipal storm water permit and in our public at risk debris and public infrastructure poses a risk to the Public's investment in flood and infrastructure improvements and environmental health issues impact the people using these affected areas those of your staff that are trying to address the cleanup of these areas and the general public health and safety's issues issues of encampments accumulation of debris and dumping impact our alleys Trails Public Lands and the environment as well as our adjacent neighborhoods this shows you the response that in 10 years ago we were picking up 300 tons of trash and debris five years ago with 600 tons and this year it was over 3 000 tons in your staff time it's gone in 2009 from 3 000 hours five years ago four thousand hours and this year over 28 000 hours and with the additional cost of 250 000 in materials and private contractors so the rate at which this increase is increasing over the past 10 years is of great concern the new Revenue to the city would be implemented as as proposed in this resolution would be implemented October 1st 2019 in FY 2020 with a nine-month implementation it would raise a little over three million dollars for a full year in 2021 it would raise a little over four million dollars the resolution is specific that this would be placed in a special Revenue fund for my environmental programs and activities that benefit the public health safety and Welfare is determined by the city council the impact to our residents on a residential rate that this would go on your your trash and garbage pickup rate quarterly increase is about two dollars and 28 cents a quarter and what that equates to is about 78 cents per month um the fees that are generated from this that special Revenue fund could be considered by the city council for clean and safe City programs and I've listed some of those that you may want to consider in the future as you work through if you adopt this resolution today anything from the courtyard sanitation enhanced services to reduce encampments cleaning and abatement activities on your Trails Parks streets andalities alleys coordination with the state or other entities on right-of-way areas private private property support program to actually go in and increase the livability in our neighborhoods by Clean proactively cleaning up lots mitigation efforts to reduce the debris that's entering our streets and infrastructure and security upgrades to that infrastructure into our parks to prevent the debris from entering our systems with that staff's here to answer any questions and I know this is a public hearing your honor right so I'll step aside so looking at staff or input questions that you might have but let's go ahead and open it up as a public hearing is there anyone who wishes to make comment or ask questions regarding agenda item 54. okay I will then close this item and turn it to council any comments questions here I do yes please councilman thank you uh Madam mayor I just want to reiterate from this video you saw uh the amount of waste that we pick up the amount of uh just things and as you drive around the city and you know you many of us have seen in encampments and a lot of debris that is left behind you know if you look at what is happening our ward in Ward 5 every single day uh our our guys are out our team is out our operation maintenance team is out just picking up debris my office gets calls daily regarding uh debris that is left on sidewalks that's left in storm drains if you look at what we what happened over at Orange and B in that area with a huge encampment and it was just so dirty and so much debris right in the middle of the the flood culverts that's there that we came in and and we did our F Street Corridor um you know the list goes on and on in our downtown area and so this is not something that um I think anybody wants to try to pass on an excise tax or anything but is needed we have to do something we have to continue we have to push forward with this and so I am in you know full full support of it and we actually need to find ways to to find more Innovative creative ways to find ways to to enhance this and so this is a public safety issue it is a is a it is a public safety hazard uh you know we haven't had a major outbreak of hepatitis or anything like some other cities have that's because we've been trying to keep up as best as possible on this but if we do not believe me we will have outbreaks we've had issues of our Metro officers excuse me in in LA for the you know La has a skid row task force which is located in downtown L.A 0.6 square miles of the area and they have 66 officers that are dedicated towards working towards nothing but the uh on this on this task force in skid row and they've had their offices have had all types of Health outbreaks and things that are going on we cannot get there so we have to do something and this is a way to move forward thank you thank you um yes councilwoman dance please thank you mayor and I too see a lot of what my colleague councilman career sees in his Ward as we are very close in proximity and we do deal with the day-to-day encampment issues and um tons of remains after the encampments are are moved and I do see the public safety issues the health concerns and the city is in dire need of a source of Revenue to ensure that we when we hear from our constituents our neighbors that we can expedite resolution of those complaints if we don't have the bandwidth if we don't have the capacity I can get the calls but we won't have the ability to respond or to bring resolution to much needed help in in our communities and for this reason I am also in support of the resolution thank you yes councilman Knudsen I thank you mayor I wanted to comment on I think it's incredibly creative of what the staff did and while I'm very supportive of this effort I would comment as I do many many times um at the city and when I was on the campaign and before working with the nonprofits that this is a temporary solution to cleaning up some really hard issues within our community and my hope is is that as a city we spend quite a bit more time looking at the systemic issues and challenges that plague our community that result in homelessness and so while I recognize this funding is necessary to clean up some Immediate Solutions it's a long-term strategies that I would like to spend more time focusing on and I'm uh thankful for republic for being that Avenue for finding some additional revenue for this incredibly intractable problem that our community faces thank you Council was assuming yes thank you so my comfort level in supporting this is just knowing that it's going into a special fund specifically for the cleanup your honor if I might the resolution is is specific that it goes into a special Revenue fund for health safety programs those would be determined by the city council thank you and councilman Anthony thank you mayor um first of all there there's no doubt that there's a problem out there we need to clean places up it's in all the wards it's up in the Northwest there's encampments up there we need to clean these places up the the issue I have is um is first of all the actual agenda item the way it's written it says public hearing discuss possible action regarding a resolution establishing and environmental surcharge pertaining to the collection of soluation residential recyclables so I mean when I first saw that I had no idea what that meant until we had our briefing yesterday what what it should say is a public hearing and discussion for possible action on raising people's residential and Commercial trash bill by five percent in order to do X so Scott when we do these agenda items we need to be a little bit more transparent when people just read this I know it's probably in the backup material but we need to be real clear on what the agenda item is so when people read it they have an understanding of what we're talking about so this is basically the the first hearing that we're having talking about taking a a person's um trash bill which is about 45 bucks a month or something like that for or every three months and uh every three months 41 42 dollars and uh um we want to increase that Republic's not increasing it the city of Las Vegas wants to increase it in order to generate Revenue that technically has nothing to do with their residential pickup it's generating Revenue to clean up other places and you make a good argument in the franchise agreement that this is kind of a public safety issue but um I I can't support this today I need we need to do some Outreach to Residents to let them know that we're interested in raising their trash bill by three or four bucks a month and this is what we're specifically going to spend it on and be very clear on that before I can vote on this so if we do public Outreach and everybody says great I'm willing to pay a couple extra bucks for this then I'm all in but if people are saying I don't wanna pay attachment to my bill to do this you should be getting the money elsewhere then I need to take that into consideration so this is a great public hearing today to discuss it but I I'm not going to be able to support it until we get some public input and David you're probably going to have to help us with that I mean I need to know what people in Desert Shores are thinking of up in Sun City paying a desert you know the other Wards is this something that they're interested in doing or is it no way I don't want to do this and uh so I think we need to have a pretty solid discussion about this before I'm ready to move forward on it thank you um thank you madam mayor um as I concur with my um colleague councilman Stavros Anthony and I always always have a really tough time increasing any fees or taxes I think when I look at my garbage bill and this environmental need that we desperately need as the city and I look at my garbage bill and we as a whole as a whole city it's our responsibility to keep our whole city clean and safe and I will tell you that my garbage bill will go up approximately 68 cents a month which is less than ten dollars a year to help pick up 600 tons of human matter debris things that are going into our water systems that we haven't touched on and I'm in full support and I'm going to make a motion for approval on item 54. um okay any other comments here one of the things I'd like to ask before we vote on this I know in China they have they have been the repository of recyclables and I know they are pushing back now to say we're reducing dramatically all of the recyclable this is only in reference to recyclables and only for residents not for business no this does not address recyclables this is on there on the gross revenue of your franchisee so um this your your trash bill is for trash pickup and recyclable pickup and the percentage increase will go on to that so it's not directly related to recyclables even though this um mentions the collection of something the friend the franchise is for solid waste and recyclables it's a it's the title of your agreement okay what is to preclude this coming back for another increase within is this five percent over the next what how many years when we if I may when we approve the extension of the um Republic contract with us for the 20 years we extended and we having lived in the Heart of the City for over 40 years to see the modest amount we do pay for this um pickup just wondering is this something now going forward that the city's going to ask of are contracted pickup will that change is this for a period are you suggesting this in perpetuity at five percent or increasing incrementally over a period of years or what under the contract um the environmental fee can only be up to five percent so it would run the length of this contract so that's is that the 20 years that we've extended 15 years from 2017 so it goes to 2031 I believe when you would renegotiate um Republic Services does have built into that a CPI increase annually comes on the first of July they also have Clauses in there if they have unforeseen economic situation that they can come back before the city council and prove that they've had an economic change in circumstances and discuss their base rates with you so there are mechanisms for them to come back and have that discussion with you but on the environmental fee it would run the length of the agreement five percent for the next 20 years correct unless the city council chose to do a new resolution if they did not need it at some point in time Henderson currently is at 4.2 percent July 1st 2020 they have already adopted a resolution they will be at five percent environmental fee as well what what about uh Clark County in North Las Vegas I do not believe that Clark County and North Las Vegas have that fee in their agreement with the franchisee it is something that actually the environmental fee when we were working to negotiate that it was actually brought to the table as an opportunity by the franchisee in those discussions I do not know if they have it for sure in those other two entities as an option for their councils to consider so if this passes the the city of Las Vegas trash bill would be higher if you lived in the city than if you lived in the county um I would have to check those rates uh in exactly where they are in those rates and what kind of CPI rates that they have but we can certainly get you that information but theoretically yeah it would because they don't have the surcharge and we do right yeah and Henderson does and they have implemented it their rates are currently higher than ours thank you there is no more con comment on this there is a motion on the floor and just from my way of looking at this issue I think councilman Anthony has really spoken clearly to Residents about uh really wanting to hear from the the constituency which I agree with philosophically but in actuality knowing that we have to attend to it it is a responsibility of our city government I would imagine the county will follow suit if Henderson is there and moving forward to do this next by next 2020. I I see it only as something that we absolutely have to do what do you do with those mounding pounds and pounds of cleanup that have to be taken care of so I had been thinking that maybe we needed some more input and some more data but in listening to your comments and the questions um and statements from the council I will be in support of this I just want to make sure that next year the council isn't coming back and saying well that we were wrong in our assessment and I I really would be very much opposed to a return to this same concept because something else has occurred and that we are going to add another one or two percent next year the year after so just making sure this is at this point unless it is locked in to us for the next 17 years at this point with either Republic or the city coming back to the board here with good reason for any change correct that is that the contract allows the city council the surcharge for environmental purposes up to five percent which is what your resolution implements today any other rate increases would have to be justified by Public Services Under the clause in the contract and in your ordinance and they would bring those back to you or they would request to go back to the negotiating table but this is us the city asking for this this is not Republic asking us to do this this in fact is the city saying we want to we want to respond to keeping a healthy safe Community is what we're doing here and that any other from the company that they would have additionally is their business that is correct okay all right so as long as we're clear on that there is a motion and uh any comment um any other comments down here okay please vote and please post okay thank you very much uh that does pass and I think it's clear that this is something we do need but I want to make sure it's clear this is a city initiative not a republic coming to us to ask for this so let's go on to agenda item 55. and this is our 332019 discussion for possible action regarding a resolution opposing the 24. seven enforcement of high occupancy vehicle Lanes on Interstate 15 and U.S Route 95 and supporting the return to peak hour enforcement in reference to all Awards and um someone from our attorney's office is going to make comment here before I turn it over to a big proponent of this Jeff dorcake Deputy City attorney no comment really necessary from our office the resolutions in order and ready to go um I believe councilman Anthony's gonna do most of the comments and if there's anything needed we I can come in well I would ask you to explain to the viewing public and anybody here including myself what is a resolution the what is a resolution what is the impact of it and is it enforceable or just a support comment sure well this resolution just expresses if passed the opinion of the city council that they are in opposition of 24 7 enforcement of the HOV lanes and would like to see a return to peak hour traffic enforcement that's 6 to 10 a.m and two to seven as we discussed a couple months ago with a presentation by our office and Public Works the city does not have much control over HOV lanes over the highways and this is one option that the city can take which is to offer a policy resolution to the State Transportation board and let them know what the city council as the elected representatives thinks of the current situation and as a result the resolution was requested by councilman Anthony and we'll Express opposition as I said and support for a return to pre 24 7 enforcement and if it passes we will send the resolution off to the State Transportation board and let them know that the elected representatives of Las Vegas think that the current situation isn't good thank you very much and as I turn this over to councilman Anthony I ask you how how wide a range is this is just the city Border in your comments because I know you'll make comments how far does it extend Etc so please councilman Anthony uh all right thank you um first of all I I first of all want to commend the Nevada Department of Transportation for this project Neon that they've been working on for I don't know the last four or five years um there's definitely been inconveniences but that's normal that's part of uh this is the largest public trans or public project in the state of Nevada so we're coming to the end of it it's actually coming in under budget and I had a schedule which is uh accommodation for the Nevada Department of Transportation and all their partners and uh they've done a wonderful job adding lanes and uh pavement and exits and entrances and they've done a lot of road work not just on freeways but in the arterials um in the city of Las Vegas they've done actual wonderful job and it's going to have an improvement on traffic the one problem though is the HOV lanes when these were first put in place uh people became very upset because uh these lanes were paid for by taxpayers and they were frustrated because they couldn't use them only a certain group of people could use them and uh it was really being created to uh to try to get people to carpool to try to change their driving habits in fact that's what people say about their carpool lanes the reason they put in there is to try to get them to change their driving habits that's not going to happen in Las Vegas people like to drive in their own cars by themselves to get where they are then they created these uh these massive flyovers which are absolutely wonderful um fly the uh there's a Summerlin flyover there's the spaghetti Bowl fly over these are massive structures but they're HOV lanes so only a few people can use them and if you look at them during the day during rush hour traffic they're pretty much empty they're they're just not being used they're they're kind of a waste of a lane and again uh people got a little ticked off about that so what ended up happening was people were just using these roadways um as a single driver I'm hoping they didn't get caught and were creating people that are violating the law because they got to get somewhere and these lanes are open and they want to get to work and they want to get to school so they do the risk and reward factor and the risk of getting caught is a lot smaller than the reward of getting somewhere faster so people are using these Lanes primarily are single drivers they're not they're not carpool drivers so we're creating this kind of this uh this group of people that are violating the law but when the HOV lanes were eventually created with a a certain time period that they were HOV lanes they were restricted to the morning and they're restricted to the afternoon Monday through Friday which meant that the rest of the time people could use them uh people could use them on weekends and that seemed to be kind of a happy medium it didn't really have a lot of folks that were upset about that as long as they could use them sometimes and again if people want to take a chance of not getting caught then they would do that um then the HOV lanes were changed to 24 7. completely restricted 24 7. and some heavy enforcement happen and that's when the bear was poked that's when people got really ticked off that these lanes were not available to them as taxpayers and that's why we're here today the bear got poked very badly and I have seen nothing but frustration and people upset on Facebook on Twitter on emails on letters I've received people don't like this situation and uh they don't like the way you get in out of these Lanes I mean they're they're a double stripe White Lane and there's only certain way to get in there's the only certain way to get out and then if you're getting out you got to try to get over to the right lane so you can exit it's very it's very confusing and uh I I think I think what would really help people and would kind of calm things down a little bit is if we just went back to the restricted times where they're restricted in the morning they're restricted in the afternoon and the rest of the time these HOV lanes are available and you know we can get into the the science and the experts I can pull up all kinds of studies I say HOV lanes are a waste of time they don't um they don't deal with congestion and there's studies that say they do but we're not really going to get into that I'm not going to this is strictly the people in the city of Las Vegas especially up in the Northwest part of the valley because this is really what this primarily deals with it deals with the city of Las Vegas it deals with 95 from the northwest to the Spaghetti Bowl and then the spaghetti Bowl to on I-15 to Sahara that's what this resolution is asking is that those roadways go back to the limited times for HOV um uh for HOV enforcement and I think people would would be happy with that I think that would be a good start if it was up to me personally um I would get rid of them completely but I think this kind of compromise is something that um I I think the Nevada Board of Transportation would seriously take into consideration because they were like that before they were changed to 24 7 without our input I mean we weren't asked whether or not they should be 24 7 in the city of Las Vegas it was just changed and we were informed of it and I I just want the uh the Nevada Board of Transportation who are made up of some good people they they need to understand that the residents of Las Vegas especially the ones I represent um want the restrictions limited and I'm hoping that the city council sends a message uh to the board of transportation that we as a city as a whole are interested in doing that within the city limits and you know we heard from the uh the president of the PPA I'll tell you I talked to police officers all the time because I'm retired and they have um no interest in enforcing HOV lanes they are interested in in going to places where accidents are occurring where people are getting killed and injured and doing speeding enforcement and right-of-way enforcement HOV enforcement doesn't save lives it doesn't have any safety issue at all it's just basically enforcing a public policy that somebody came up with that they wanted 24 7 HOV lane so um our City attorney explained the resolution very quick pretty pretty clear that's exactly what it says so uh when you're ready mayor I will make a motion to support the resolution and we'll see what happens and I'll be quiet councilwoman Seaman please thank you madam mayor so during my campaign I heard so much opposition about the 24 7 lanes that I actually made HOV lanes part of my campaign and I agree with my colleague councilman Anthony that all taxpayers pay for our freeways and they should be able to use them and I also agree with the lvpa that Enforcement 24 7 of HOV lanes will not really help the environment but rather create a necessary enforcement in citations so for that I do support that we go back to the the hours and take away the 24 7 on the HOV lanes thank you very much the councilman career or anything no matter I'm good thank you thank you and mayor Pro Tem thank you madam mayor I'm I support this wholeheartedly when I when I look especially from the Northwest and I urge my colleagues to to support this as well um we have a very long drive into the City and we generally don't leave here council chambers I mean the three of us girls left here after six o'clock last night so a councilwoman Diaz and councilwoman Seaman and myself so I know we rode down the elevator together and you know you know when it when it's late I I think that we should be able to use those Lanes um it's very frustrating not to have those open and some of the written goals uh when they change those Lanes to HOV I disagree wholeheartedly with they want it to create congestion to make it uncomfortable for us so we might be able to carpool and I would say if anyone wants to wake up at 5 30 in the morning and come to my house or I can come to your house and pick you up at 5 30 6 o'clock because that's when I start my day and if you want to ride downtown with me I'm totally willing but I just haven't found a friend to do that with yet so I would urge you to support this resolution so we can go back to the way it was thank you very much with the councilman is not here and that councilwoman is okay certainly those of us who live in one three and five I mean I live in one I never am on the freeways unless I'm going elsewhere one of the things that I can see as I come back and forth to work or drive around town certainly in certain areas and further out it may make um data collection easier to see how it works and ndot has to work through that and see if it pays off I would tend to agree with councilman Anthony here that in the long run were these um you know through traffic all the way back and forth to La if we can ever get more Lanes added to the Barstow to State Line which we've been screaming for for years with Caltech and and ndot's working with Caltech trying to get them to do it so we can get traffic moving faster that's the whole purpose is to get it flowing more easily but for anybody who is outside the city or going into the City and then going back out from the city into the county it is it's really shows how difficult this has become I'm sure they're collecting data I sit on the RTC commission and I don't see it at this point it is a learning experience for all of us but you exactly is kind councilman Anthony said you just sit there in the packed Lanes watching nothing happening except a motorcycle is allowed a single person on a motorcycle is allowed in the HOV lanes and of course trucks are allowed in the HOV lanes so I think as people who live here and have lived here for any length of time I think we could design a better way to get around but it does I do believe that ndot is working with the best data they have to do the right thing but I have to support this inside the city whether you're coming and going back and forth to Henderson on the 5 15 95 or whether it's out to the west and to the Northwest I tend to agree that this is something to return to the working hours and the most congested but for one three and five we all live so close to the heart of downtown where we're working or for others going back and forth if they're working in the Inner City communities and Wards they probably are using anything but the freeways so there is a motion made by councilman Anthony on this resolution which of course our attorney has explained so let's vote and move on all in favor of the resolution please um vote and please post and unanimously wrong councilman is okay mayor I just want I just want to thank the city council for supporting this resolution you're you're you're speaking for the people here so thank you very much thank you and thank you for bringing this forward to us so now we are an agenda item number 56. and that's our 34 2019 discussion for possible action regarding a resolution adopting the downtown Las Vegas open space and trails plans and this is the fabulous Awards one three and five and uh hello Mr summer yeah good morning Madam mayor members of the council this morning I have the pleasure with this resolution to bring forward one of the key implementation items of the 2045 Downtown Vision plan with me is from my staff is Sydney noitz and joining us is our consultant Steve Knowles from a design workshop and they're going to run through a real quick presentation on what the new downtown Civic space and trails plan does and I do want to point out we do have a new name and so uh with whomever makes that motion I imagine it may be one of our downtown Wards maybe mayor Pro 10 since it crosses multiple Awards I would just like to incorporate in that mode ocean that approval of the resolution subject to changing the name but we can get to that at the end so with that I'd like to turn it over to Sydney from my office and he will give a brief introduction and then we'll let our consultant walk us through the planning process on this thank you thank you thank you Mr Summerfield back mayor city council good morning Sydney noyce with the Department of planning this plan is really an outgrowth as Robert said of the vision 2045 downtown master plan and after engaging in envisioning workshops with city council our department took on this project in the vision 2045 plan it states the need to establish a green infrastructure Network that more than doubles the current amount of parks trails and open space in the downtown area in order to strategically address this need our department would like to propose adopting this downtown Civic space and trails plan and now we'll turn it over to Stephen Quang from design Workshop good morning is this working uh Steve Knoll design Workshop mayor Goodman council members City staff those the audience as well as you know virtual that you described earlier today I'm the principal design Workshop where landscape architecture land planning firm based out of state line Nevada we've actually worked with you before on your Las Vegas North planned previously Quang Shin my colleague here have been very fortunate to work with the staff with the community stakeholders to come forward with this close 100 page documents which I'm sure you've read every page correct and I'm going to go one by one page no just heating today is a there's a high level overview for you to get acquainted to it keep in mind this has been posted on the um what the city website for close to four to six months so there's been opportunity for people to comment on it's a fact we're coming forward to have this adopted is um based on the fact there's public input throughout and that has been available for common oh you have to remember this yeah so over like I said over the last 18 months we've been working with a A large group of conscious contingency groups I always have a hard time with that word um to kind of help and shape this plan and what it is a framework for you to make decisions to move forward nothing to this plan is cast in stone it's just more saying these are ideas and with each idea that is out there there's some opportunities for each within the wards that are affected by the downtown area to have some ideas moving forward um early in the process some overall goals were set things such have attractive and comfortable spaces came to the Forefront environmentally cultural and economic value brought to these uh Park and Civic space improvements as well as establishing safe and welcoming environment for not just those who live but also visit this area and to support those goals there was a number of objectives that were established and really again economic value is important art and culture came front and center many times as uh every year this uh this community becomes more rich in in that aspect the identifying opportunities for public and private Partnerships which is something you've already done here and it's really one of the methods across the country that some of these public spaces or are built and managed as well as in uh in enhancing the outdoor environment also very important was the connectivity between this area and the broader community so a focus on trail connectivity regionally and within each one of the districts simply the process was to collect and review existing data documents uh this existing facilities Parks those type of things again had a very uh robust public Outreach process and then through that establishing criteria in some design recommendations with that we drafted a series of reports and that went back and forth and today we have a final for you consideration so this diagram really represents uh what was called the planning districts in the 2045 Vision plan and we Consolidated some of them because they had some like kind characters and made it much more simpler to identify these in broader perspective than in each individual planning area so this kind of shows you that for instance downtown core include what was described as a Civic and business Symphony part Market quarter and Resort and Casino corridors in the plant in the 2045 Vision plan so we're going to kind of quickly go through each one of those um the downtown what we call the downtown core is really the the majority of the of the employment base when it comes to Civic Center of Civic venues the resort element and those kind of support businesses that really are actively on a daily a nine to five effort you are starting to see a big increase in potential residential but because their cost of value and land it's going to be more than likely be high high density type of development the value land here is quite a bit more obviously so recognizing the opportunity for public private Investments as well as as you do move forward with some sort of improvements uh you'll probably see a higher cost abilities but recognize it brings up bigger value in different ways because it is for larger group Gatherings more urban context rather than Civic plazas that you see in other communities that the downtown area does not have right now of course I'm just talking really high level recommendations right now the next one we call is the Downtown North in contrast this is uh the you know the the historic West Side District has a lot of available land that's uh that is available is there for future investment as well as potential Park improvements or Recreation improvements because of the land it has a in the layout it has historically been a neighborhood type thing families that type of thing so the types of parks and Facilities that you'd probably see that would occur in here would be a little bit different than the downtown area the downtown core area in addition Cashman Field which is a big commodity for the city there's some opportunities to start to create some of the more Regional aspects that might support whatever reinvestment that happens though whether it's City driven or public-private investment opportunities mm-hmm downtown South is kind of an interesting industrial area that's evolving into the Art District you can see that on a regular basis and the opportunities here is again recognizing that right now if a snapshot there's not a whole lot of population people living there so it's more of a day use type of urban environment plazas Open Spaces but as the community starts to grow then have to revisit that to see what type of improvements those type of residents and dwelling units would need for to support those improvements for Park facilities downtown east of course is a historic entrance into the city you're all aware of the Fremont Improvement project going on so that's really trying is going to be a kind of a spark to reinvestment along that Corridor so this plan recognizes that and says there's opportunities to to embrace that there's been mention about you know different parades and things that currently go down there so recognize as these more events become popular that this this Corridor in this area could really Embrace that in a broader capacity and then finally the Medical District pretty straightforward there's a lot of uh professional build offices and and businesses occurring there you know UNLV has some uh presence there again uh not a whole lot of population initially but you're starting to see more of those uh residential property projects come forward and with each one of those there's some opportunities to provide some outdoor space and amenities that would embrace the whole District itself so the next steps after this document there will be a prioritization of the recommendations and then of course always the tough one allocating funding but as I mentioned earlier there's always the opportunity to look at the private sector to assist the public in some of these Endeavors because it is a win-win in many communities and you've experienced here as well in any case as you have done in the past and I encourage you to continue his public engagement throughout the Improvement so as a project comes forward of course a republican engagement for each specific area which really then Nails fine-tunes those kind of recommendations to what the specifics would be needed for each one of those new facilities then of course maintenance operations isn't addressed in this document but the city is well aware that these are issues and ideas that have to be flushed out as Things become forward so just to recognize that this wasn't left out the table recognizing that's some of the next steps as well and with that I hope I didn't leave too much out just open for questions Mr Summerfield how would you like us to proceed on this I'm not sure Mr Georgia is this a public hearing item is it a public hearing item it is not a public hearing but obviously you can open up for public comment okay is there anyone here from public would like to comment on this of course this is ongoing it's a project in Forever in planning and moving forward and changing but anyone okay I'll close the public comment portion thank you back to you Mr Summerfield so Madam mayor we are of course are here to answer any questions however if there are no questions then I would just ask that you approve this resolution as a part of the motion I would just request that the the plan be identified going forward as the downtown Civic space and trails plan and we will make on the published version of the document we'll make the necessary changes to incorporate that title change with that myself the consultant we're available for any questions thank you very much I mean we're just this looks wonderful and the updated front page because I told my staff it looked like somebody spilled water on it and you couldn't see it we're already looking at it okay we're looking at Alternatives now so before we do the final publish Vegas right okay yeah thank you councilman please can you send please uh thank you for the presentation I've been aware of a lot of these planning systems over the last 10 years and I've been as a resident appreciative of the city thinking forward one of the opportunities that I saw especially connecting the Medical District to the arts district the demographics in that area have shifted dramatically and I think the the folks moving in including myself want to be able to walk from the Medical District to the to the arts district it's only a couple of miles away when you go into the Charleston overpass the welcome into downtown Las Vegas says bump because it's a traffic indicator and I know that has nothing to do with this particular item but I think it's important to comment on how great we're making it for tourists to come into the downtown by beautifying the the Las Vegas Boulevard and entry into downtown for Taurus but as we think about parks and open space and trails I think connecting our districts for locals is equally as important so I'm I'm grateful for this and would like to start my advocacy for more of a Welcome to our locals into the downtown more than a bump sign so thank you thank you very much okay yes councilwoman Diaz please thank you mayor and I too have heard from many of my residents that they want to see more open Civic areas I'm trying to refrain my own vocabulary to the new new way we're referring to it but they're craving these spaces they want to be in their Hometown being able to walk so that our carbon footprint is not as heavy or intense when we're only within you know under a couple of miles of distance and I think that a lot of people are thinking about the overall benefits to their health sometimes we're we're kind of in our own spaces for long periods of times and and how beneficial walking is you know just to our overall health and well-being so from that perspective and then not to mention the beauty that it adds to have more Naturals Landscapes where we we can kind of peruse through and admire the beauty of our city that's just like a little cherry on top but I'm so excited and I hope we can get more of these public-private Partnerships going so we see it coming together in a faster way because if we've been talking for over 10 years we need to make sure that we're able to implement it as quickly as possible thank you councilwoman um there are a couple of things I know that we've been chatting about are just what the definition of civic space is what's a space I know your predecessor was very big on pocket parks and how that integrates into the whole I know for myself who drives around this community all of it the unincorporated area as well all the time I think one of the advantages and and I looked to Mike Jansen who's the head of public works for us now is the traffic flow and synchronization of Lights to get us to move around and I don't know if that's a small piece any piece or becoming a piece of the future because I choose Charleston specifically if you stay on the speed limit you will just keep going and not stopping whereas Sahara because it's half City and half County run and maybe it's somewhat coordinated but the reality is how anything that's going to be be a plus figures into this overall moving document to help us promote how great it is to be in the city and I know I've been texting our city manager that this plan and it looks I mean having seen a paper copy a hard copy looks really just a wonderful job in the works and the photography excellent and it looks you know like we are becoming world class it's taken a long time for us even to get to where we are today with a combined effort of the staff in the various departments so I'm very excited about it and so it as a motion I'm going to ask mayor prayer Tim to make the motion but are we able legally to include the name change is that or do we have to put that on another council meeting yeah that's fine we can do the name changes right now as an as amended to what director Summerfield suggested thank you so if item before you today is a public hearing for a request of fees and civil penalties at the request of Realty data Group LLC owner for the property at 4550 East Van Buren Avenue which is located in Ward 3. the city of Las Vegas had to complete five abatements from 2013 to 2018. several of these abatements required the property to be secured and cleaned and another abatement required us to demolish the damage structure on site and to reclaim the property several times the total outstanding for heart costs is 47 851.10 which is not a waveable amount and outstanding daily civil penalties of 97 500 for a total of outstanding of 145 351.10 this item was previously heard at City Council on June 19 2019 but due to the property being out of compliance the item was held in advance the property is vacant and currently in a state of compliance staff requests that you denied this request of waiver thank you and Sir if you'd announce your name and your address for us and then make any comments you wish good afternoon Madam mayor and Council my name is Danny Garcia I am a principal for Realty data group and the address is 4550 East Van Buren Avenue um Mr Summerfield anything to add here no ma'am uh just as mentioned in briefings yesterday the applicant on this item did address the concerns that were raised at the last meeting and has gone out and cleaned up the property in order to get their active case closed thank you very much this is a public hearing anyone wishing you could be heard on agenda item 71 please come forward state your name for the record okay hearing and seeing no one oh close public hearing and I will turn this over to councilwoman Diaz thank you mayor I just wanted to know what is the Future Vision for 4550 East Van Buren Avenue um the reason of the request for waiver would be because we are planning uh in the next uh year of 2020 to build a residential single-family the house basically and uh having the High abatement fees and things like that just doesn't allow us to pencil in you know an actual building of the house so requesting a waiver um would be very helpful for us to uh actually commence tax plannings and things like that and uh at we would be gladly covering the hard cost you know to repay the city and uh just requesting that the 97 000 can get reduced whatever uh the council and The Madam mayor um can agree to thank you um you know there's a lot of time and effort that the city staff do have to put in an upkeeping property that is sometimes vacant or the property owners are not taking care of I want to hear on the record your commitment to be maintaining this property moving forward every week so making sure you're going out there doing your due diligence to ensure there's no encampments there's no trash that is kept up to code because the reason why it's accrued all of these fees is because it's not been checked in on periodically so before we agree on anything about reduction I do want to hear from you or the Realty data groups commitment to maintaining this piece of property that's in Ward 3. yes and we agreed to do that we actually have been cleaning the property numerous times even after the June 19th meeting that we had we had already cleaned it previous to that and then even two days three days ago they had already dumped the mattresses and things like that so it's difficult to keep it clean but we will try and maintain it you know as a weekly thing to be driving by it and keeping it clean for for the for the rest of this uh a year and then following the uh our plans it's great I know that the community and the residents near there will be so grateful for upkeep and so will miss Ozuna and her team so thank you for that I know woman can I hand a rub massive questions go ahead mayor please thank you um you purchased this property in June of 19 2019. no no I I mentioned that when we were here this last right this last uh to remember yeah um when did you purchase the property um I think it's uh I forget the exact date uh missification do you have I I do have the day that's February 21st 2019. February 21st February so these penalties that were on it when you purchased the property correct they were from were you aware that these penalties were on the property uh we were aware of summon at all yes okay so going forward knowing we've been discussing this um how how are we going to go on with um having all that knowledge and those liens taken care of before sales takes place are we moving forward with some type of Staff review and access before the finalization of a purchase carrying all these penalties unfortunately property owners are not required to check back with us so that we can sign off in many cases title companies they know if they see a notice and Order recorded on a property or they see our liens they know that they need to get payoffs demands from us but that's only if people are going through escrow I don't believe they went through escrow in this situation and so a lot of times properties get quick claim to each other to different people and that does not go through any official process so uh my sense is how do we get in front of this instead of behind it going forward I think I recall over the past eight years just these continuums and this isn't correct um we'll have to look into um maybe possible changes to the legislature or something that's going to require owners to check somehow with the city before they purchase something even if they'd only go through uh quickly I don't know what the possibilities of that is but we can look into it and there might be best practices in other cities and states that we could look to that we could Implement here at the city because it seems amazing to me that these lines these lanes and penalties exist and you just best way to get rid of them work them all up don't pay for the cleanup and keeping everything a proper for the neighborhood and then we end up losing money but not the hard costs of course so let me turn it back to you councilwoman I just want to know what what we can be doing thank you councilwoman Diaz so Miss izuna are you saying that this this didn't go through like a regular escrow it was just quick claimed correct so was this quick claimed by a family member yeah that is correct yes it was it wasn't through escrow it was quick claimed directly from so is this a is it a family member of yours that quick claimed it to you no just a friend it was a business another business partner so your business partner quick claimed you this address yes knowing that you had all of these fees on it I I knew that it had liens I just didn't know the exact amounts but if he's your business partner that kind of seems a little shady a business party ing this with right he has all these liens well let's get rid of the liens let me quick claim you the property Mr business partner because you know your business partners it's like your wife your business partners there's no secrets yeah I don't like this deal the thing is it's uh it's it's the type of uh investment there were property that's basically uh like like I mentioned last time it's one of the dilemmos here in Las Vegas uh we have it's not a dilemma it's Shady not the actual process uh the problem is that we have over 30 000 of these properties and uh staff councilwoman Diaz it's all yours thank you thank you mayor Pro tem and Mr sunai wanted to ask you to weigh in um since you've been obviously the one that's been dealing with this property I do understand like I know keeping the lot vacant is not going to be helpful moving forward right and I'm looking for the best solution for Ward 3 and for our city staff I don't want you guys having to go out there every single moment to check up on it so obviously I do want to keep an open mind to making sure that we move forward with getting a property there hopefully you know someone can call that home and then it'll move forward but I want to hear your input as far as I know what the we can't budge on hard costs that's money that the city has invested on keeping up that property that we don't have any responsibility to keep up but what do you what are your thoughts about the Civil penalty on the Civil penalties the reason why they were instituted the council back in 2000 I believe it was 2007 when they agreed to um ad by ordinance you know that would allow us to do civil penalties the reasoning was is um the fees that we get uh for doing abatements and stuff it doesn't cover all of our staff costs it doesn't cover um you know it's hard to penalize somebody criminally when they're not around so we utilize them to you know hopefully catch somebody's interest in taking care of their property and um in 2014 we actually um ended up doing a revising their civil penalty process or our policy by capping our penalties at 39 days if we were a perfect machine and from beginning to end with noticing the property owner we would have everything taken care of in 39 days so we we curtail those penalties anything past 39 days for abatement items um they do they have a purpose in keeping property owners responsible and in this situation the property went from Charles Bambi Compton who they own the property they bought it back in 2001 and then Smith Parker LLC purchased it in 2017 aware of penalties and the costs that were on the property and then for whatever reason they signed it over to these gentlemen today um and Smith and Parker they were an irresponsible property owner too I believe one of the abatements took place while they owned it so in this case while I want to see something positive happen with this property um you know I do believe that the city uh would remiss in not collecting some of the Civil penalties back and you know maybe that'll also make them be a better property owner as a councilwoman councilwoman Seaman has a comment or question please thank you madam Mary just have a quick question because I did a little research and didn't you go through a national title insurance company the same one on all three properties wfg national title and if you did you knew exactly what the um what what the liens were is that correct we only used the title company for the reason of uh acquiring a title approved notary to do the transfer from the previous owners till now that's the only reason that it if he goes into title title would obviously will notify the the city and then they would request payouts and say that but because of the fact that most of these properties are let's say worth 150 to 200 000 and then some of those abatements reached over 200 000 there is no actual way to close title without having those liens paid off and nobody's gonna pay the 200 000 lean on a 200 000 house that still needs sixty thousand dollars in repairs um through you to councilwoman Seaman um in this case wfg title is not I don't know that they're involved it's in the next three cases that they are involved oh oh okay so there's three more okay okay math really quick here um let's just make sure um I I know that you have more costs and I hope you keep your word to us the council today on keeping the property up but two also making sure you're going to revitalize that piece of property by making sure you build yes so I will be this is the only time I'm gonna because I see the amount the total is pretty much what you would pretty much be investing all of this um and I don't know how much your return would be on your final product so I'm keeping that in mind so just this is the only I think exception moving forward where you're going to pay all of the on on item 71 paying all of the um hard costs 47 851.10 and I'm going to reduce the Civil penalties um to 25 of that 97 500. and are you reducing it and if you would just a timeline when you expect payment as you consider in your motion or I guess legals wanting me to clarify so reducing it by 75 percent so he would have to pay 25 of that 97. okay thank you so that amount would be 24 375 dollars plus the in ward 5. a notice an order was issued May 10 2017 and recorded May 25th 2017 on the property that was owned that's on that was owned by Teresa Sanchez William Richardson purchased the property on 621 2017 for 175 thousand dollars at a trustee sale on June 15 2017 code enforcement supervisor Tony Guarino spoke with Mr Richardson who advised he would have the property secured and cleaned within a week on 621 2017 supervisor Greenough verified that no cleanup activity or securing of the property had taken place due to the request of assistance to get this property secured as soon as soon as possible for Metro as this property's vacant open status was creating nuisance issues for the neighborhood it was determined that the abatement would move forward and due to non-compliance of Mr Richardson the owner at the time of the abatement uh we went ahead and had the property abated the city of Las Vegas had to Abate violations due on the property being vacant open accessible on July 18 2017 and was completed August 8 2017 by contractor the abatements abated were securing the property removal of refuse some waste from all areas pumping of a polluted infested pool and removal of stored materials a letter was sent to Mr Richardson on 9 14 2007 advising of a hearing being conducted to approve the liens of the out-of-pocket costs to the city of six thousand five hundred and one dollar and fifty cents and I'm sorry and the daily civil penalties of 16 500. both of these were liens were recorded uh the out-of-pocket costs were recorded October 10 2017 and these civil penalties were recorded June 18 2018. Mr Richardson did not attend the hearing which was the appropriate time for him to have argued or protested against the daily civil penalties code enforcement received a request of waiver on March 13 2018 from Mr Richardson and his attorney at the time Bob Olson the hearing was scheduled for April 25th 2018 staff verified ownership information before the hearing and it was determined the property had been sold on April 13 2018 to the current property owner the hearing was conducted as scheduled and denied by The designee Who ruled that Mr Richardson no longer had legal standing to request a waiver Mr Richardson could have filed for judicial review in District Court if he disagreed with this determination staff is requesting that you deny this request a waiver thank you very much this is a public hearing is there anyone from the public that wishes to be heard on the agenda item 72. yes John Sullivan 1980 Festival Plaza Drive representing both the current owner and Mr Richardson um on this matter so am I being loud no no no no I saw the push down um so this was filed by my partner Bob grunauer who's out of the country so I have the honor of uh um being before you today on this um so here as opposed to what you just listened to we have a bad actor for which the property ended up getting leaned we have somebody who bought the property and entirely rehabilitated it the the property and then sold it to the current owner um the the expense just for the rehabilitation on this property was 71 600 just in construction and closing costs um to get this done so it's not like you see in many including the last where you just saw somebody just cleaning up brush I mean this house has Granite counters in it now floors change repainted cleaned I have pictures of what it looks like before at the time it was bought of auction um and we'll replace those with pictures that show what it looks like now cover up that one so what you do have is a is a timing issue and we've had a discussion in councilman career's office with mrsuna there's no question the contractor owner the middle party of this bad actor contractor owner current owner had timing issues and getting this thing filed and could have done it earlier and could have dealt with it and so they acknowledge that but at the end of the day the Civil penalties are really charges against the bad actor I mean you put it onto the property because same as homeowners that's all you can really attach to somebody who's not behaving but Mr Richardson's not the bad actor the current owner's not the bad actor we now have a property that's back on the tax rolls is proper within its Community it was sold for a price that you know raises the values of properties around it because it was entirely rehabilitated and so what we're asking for is clearly to pay the the hard cost fees and to have the Civil penalty fees removed be heard on this agenda item 72 how close public hearing and turn it over to you councilman career thank you madam mayor I'm not sure if anybody has any comments but I have been hearing about this much longer than I want to be talking about it with with these guys and I just want to make a recommendation to keep the hard cost of six thousand five hundred one dollars and fifty cents and then uh waive 50 off of the Civil penalties to make it eight thousand two hundred sixty one dollars was issued on April 20th two thousand and uh down here Deputy City attorney mayor if you don't mind I just we have a question about this item before we proceed with the whole presentation so we don't possibly waste time um we have an email from June 3rd from an Anthony Mann dick Who We Believe owns the property he wrote is this I think you're familiar with the email he wrote suggesting that he's not represented by Mr gronauer to it can we find out if this is true because if Mr manindic doesn't want any uh appeal that's kind of the issue that legal has right now yes that is true and he even emailed me last week to find out thank you if he needed to be here today I told him that was up to him as he did not request his hearing if he chose not to to attend his prerogative okay so so who's appealing that the property owner doesn't want to be involved um the party standing before us miss and Mr Richardson okay and what's his connection to the property then he previously owned it before it's it's that situation okay all right um our belief down here mayor is that um if the property owner is not appealing obviously um there's no standing for a request from someone who doesn't own the property so we would advise you rejecting any requests for a waiver for this gentleman and to an effect I believe you could probably strike the item okay councilman career this is in your award um motion to strike then is that the appropriate I think it would be appropriate as the owner did not request this hearing great but I make a motion to strike thank you very much motion just to strike here I don't know if you want to make a comment on that Mr Sullivan or not for sure so so the current owner did sign off on having this appealed in September of last year and so there isn't an act of appeal it was filed by Mr grunauer with that signature and we went through a process of discussing it so we have we have an appeal signed by him moving forward and it was allowed to move forward on on this basis after being discussed so I'm not sure why now that that appeal sign that was filed no longer would be valid maybe maybe we can do this if you it'd be better to strike it than to obey it until the August 21st meeting if that's possible so you can straighten this out before we strike it yeah we we can hold it we can have a motion to hold it in advance um I would say response to that the only thing would be the city's aware via email that the property owner has no interest in an appeal an appeal now happening whatever the gentleman's agreement is with the property owner that's their situation what we know is that the property owner does not want to appeal the the uh fines and that's what we can go off of and like Mrs Luna said therefore we a strike would be appropriate and I'd like to point out too that the property owner is extremely concerned because this property has already been sent to tax roll and at some point it could come up for auction in December with Clark County treasures for these liens he really just wants the liens paid and as he is expressed to me in prayer emails you know he was unaware of these liens when he closed they came to him afterwards and he was not happy to find out that there was Nineteen thousand five hundred dollars outstanding on his property so I think you need to take that under consideration and if you want to speak with the owner I'll tell him to reach out to you but it's okay but the reason why it's here and is understand my understanding is that there was um that the owner was in compliance and that they wanted to move forward with this that's my understanding okay so the application uh that the law firm provided to us included a copy from a waiver request that was signed back in September 2018 but it was never submitted at that time to our um to my department my division and so it was not processed it didn't show up until they submitted uh the their three requests to our division and we processed the other two we I contacted all the property owners to verify if they were being represented by this attorney and he very clearly told me he was not being represented by them on June 3rd so what's the letter though even though it wasn't submitted when it was submitted what is that the what the attorney apparently he had signed at one point but they told him that they would get this taken care of really quickly and but but at one point but at one point he did sign off on it we can't we can't deny that and now he's saying he's not being ripped so he went so he sort of gone back and so my my just concern would be to say look he signed it at one point he told you something different but he do have a signed document that says he does represented he sent an email to legal counsel I guess uh no I I forwarded on the email that he sent me that's the one you're talking about the one he said he was not represented okay correct and then but but he right and I open this up I mean to come back and say look maybe he's on the the the applicants on an impression that he has a letter signed by this person saying he's good you have an email saying that he's not good is that not the case well how do you know that how can you validate the emails really from him and right that's all I'm saying is that maybe there's a way to go about and get it notarized or something to say yes I'm on board and then you come back I have an opportunity to do that and his interest by the way as part of that sale Mr Richardson has agreed to pay whatever your ultimate result is so so the current homeowner doesn't have an economic interest in the battle anymore because Mr Richardson's going to pay it I understand that but also at the time of the purchase but in order for us to discuss this property it has to be the the owner has to give us rights to discuss this property correct and that's where the issue is so if if like we shouldn't even really be discussing this if we don't have clear understanding if the owner hasn't given anything nice and we can obey it then that's what I'm saying why don't they go back and work it out and then come back on the 21st right go out and strike it obey it yes to the 21st yes did you have a comment yes yes so um councilman career if you obey it um Mrs Zuna I I'll wait for Mrs Zuna to come back to the podium sorry thank you no worries it's all good um so there was a few questions on these three items because I believe that they use the same title company as councilwoman Seaman had corrected out so could you just give us the real history because as I keep seeing these properties changing hands it's very very questionable um and it was very surprising to me and my staff because in our past history we're dealing with waiver requests we have literally had to beg title companies to sit on escrow funds for maybe 90 days while a certain part was taken care of during a rehab or something it wasn't quite ready and but the property needed to change hands and I mean I had to like sign my life away that you know we are agreeing to do this so in this instance when these applications came in and I started researching it and found that there was one Title Company all involved when I reached out to them I was advised well they're friends of the uh Mr Richardson so they just work with him on these type of things and I don't know how that's uh legal legal but that's something I guess we'll have to work on down the road well I think they've finished the issue it's going to be a day just clarification for just clarification for your concern uh mayor Pro Tem they're not friends Mr Richardson uses this title company and is in this business of rehabilitating homes so he's in front of you here for three because this civil penalty rule is only enforced in Las Vegas right everybody else has the hard cost North Las Vegas and even within the city of Las Vegas it's only a certain percentage of homes that ever fall into this and so even though he does dozens of homes a year in this business only sees these things ever so often okay let's hear from Mr Adam but I just want to let him know the title company was never is not at risk there's money sitting in escrow at the title company to pay for these things as part of that closing so it's not a friendship it's a normal business Arrangement that allowed for an escrow to be set up so that it could be resolved okay thank you Mr Adams I the thing that that I've scratched my head over on this um and I think something worth exploring and I aside from how you handle it these three items is how somebody could get to a closed real estate without satisfaction of liens and the funds sitting in escrow without coming back to the city in my opinion isn't a satisfaction of lean until we've actually received the funds and released the lien I don't know how you could get to a closing on a piece of real estate I know in my own personal situation I couldn't even get the keys until we're recorded and closed and everything and escrow was dispersed so there's an issue here that we brought up in briefing that I think maybe our attorneys can explore so that we don't continue to repeat this same thing over and over again and get down to the end wire where is this undue pressures placed on us you as a council at the last minute where we're perceived to be standing in the way of an owner having full title to the property when in fact this should have been handled a long time ago at the very beginning of the transfer of the property so I think that wise let's turn it to legal to get back into it and and make an assessment and inform us that on this particular motion this particular item number 73 the Motions to obey it which gives you time to come back with some cogent comment right the motion to obey is probably a good motion as a councilman crew kind of Hit the issue on the head which is it's not that there's necessarily anything sorted with a request for a waiver by this gentleman but it becomes an issue when we find out the current homeowner doesn't even care about the waiver happening then it becomes a standing issue legally we don't have to have a hearing when the homeowner property owner doesn't want a waiver to happen and I think that's essentially what uh manager Ozuna also concurred with so on the legal basis of standing unless the property owners want the waiver we're not obligated to hold hearings for the owner two times ago or one time ago and let's sort out as councilman Critter pointed out what the current property owner wants so we can do hold it in the bands and then we can come back and deal with it and so we don't get in this situation again I think that's what Mr Adams was saying so illegal if you'll do that meanwhile I did open a public hearing Madam mayor city council Vicky Ozuna code enforcement section manager the item before you today is a public hearing for a request to waiver fees and civil penalties for the property at 49.95 Irene Avenue notice an order was issued October 5th 2016 to the owner Louise Jose Luis Mayra Magna code enforcement hired a contractor to perform the abatement due to non-compliance on January 5th 2017. the abatement included securing all open doors and windows removal of high weeds removal of refuse waste graffiti and a dilapidated shed that was in the rear yard the abatement lien and civil penalties were approved on March 29 2017. the out-of-pocket costs were five thousand sixty four dollars and were recorded on the property April 13 2017. civil penalties were approved of nineteen thousand five hundred dollars and recorded on the property September 21st 2017. Mr Richardson purchased the property and on August 28 2017 for 205 000 and this property was sold to the current owners Xavier ceballos on May 1st 2018 for 365 thousand dollars code enforcement received a request of waiver on April 25th 2019 from Mr Richardson and his uh his attorney John Sullivan the current property owner did request this hearing and staff requests that do you denied this request to waiver thank you very much um public hearing anyone wishing to be heard on this property or this agendaized item down here mayor Deputy City attorney Jeff Georgia just to emphasize what uh manager Ozuna said the property owner on this item is interested in the waiver hearing okay thank you very much all right so thank you very much the ball any comment you want to make on this John Sullivan 1980 uh Festival Plaza Drive again um just again pictures of the of the work that's been done the spend the spend on this home was uh almost 125 000 between uh construction carry and closing costs um incorporating the hard cost liens that are obviously not to be waived in any way shape or form uh would ask for a waiver of the 19 500 in civil penalty fees um again this is somebody who's coming in entirely renovated a a house it's a pillar of its community at this point in time did exactly what anybody would want of this he's somebody who's in this industry the the prior owner again as I represent both of them um and I just think discouraging this kind of work by by not rewarding the removal of those fees which are really against a bad actor that owned the home prior um is unfair but right would ask for them so we've got to figure that one out a member of council and so councilwoman yes thank you mayor and while I do appreciate a blighted property being you know you made into a beautiful home for residents of Ward 3. we are seeing a pattern here and I don't know like it started with a couple of homes and um or properties in my colleagues Ward five and there's one in Ward three so we want to be educated about why aren't these liens being put to rest before we transfer the property ownership because I I'm pretty sure you're aware or the person who purchased these properties was aware that they had the liens but why aren't they being satisfied before so when they first buy the house at foreclosure they're not always aware of those liens particularly farther back in time there's a certain time where they become aware of them and in this case we've Now set up a process obviously we had this meeting my firm had a conversation and I've made the representation to councilman career I made it I've made it to yourself and to councilman coffin before that we would never bring anybody that didn't currently own the property after this they just have a long history I've done it this would not be the first time that the council has acted on a home that they were involved in that had already been sold and moved forward and so they've just been used to that this process worked so they had hired a different Law Firm they had hired a different consultant and they were working in a path the same way I would ask my clients do trust me that we'll work you through the process the right way and so they've been put in this situation so what we've done is they've come to us has made a commitment can we deal with these three properties and can we move forward and you have an absolute commitment from our client and from us that you won't be seeing us when they don't own the property again on this so wonderful well it looks beautiful the pictures look beautiful this one's a tough one um but I guess I'll be consistent today as well I don't want to be you know more lenient of a parent with one child than with another so you're gonna pay the 5064 and out of pocket costs and we'll go ahead and reduce those civil penalties by 75 percent and that's your emotion that's my emotion for me okay thank you there's a motion please vote and also started just for point of clarification I know that there have been some amendment to some changes from a neighborhood meeting that has been had and staff has taken their denial recommendation to to thank councilman career for his suggestion to have a neighborhood meeting um we I think Chava and I were a little bit both surprised though there's a lot of misinformation and but we we feel we had we had a nice neighborhood meeting where we garnered some support for our project and and uh and that is good as and in communication with the neighbors we were able to uh put to rest one of the misinformation items that we are not building three-story units at 35 feet we are certainly doing two-story units at less than 26 feet I think that was a major issue of contention the other item that that we did uh commit to in this neighborhood meeting in order in order to uh uh bring concerns of privacy down was to eliminate our rear balconies so the rear balconies I saw the exhibit flash on the screen here that was an incorrect one planning does have a updated elevation exhibit to show that the rear balconies have been removed another item of interest is that many of the neighbors we're not aware that we were building a redundancy wall adjacent to the existing wall that is only six feet there is an elevation difference where their site is generally variable but on average maybe three feet lower than our site so that six existing six foot wall would only give us a three foot screen hole for our site so many were unaware that we are building another redundancy wall adjacent to that one to further um without a gap between yes there will be like a four inch Gap that's typical usually the four inch Gap and then you would put a cap between the two walls to prevent debris and and other well just a debris going in between so and then also to make further uh to further address the privacy concerns we've we are making the offer of having a nine foot wall so that's what we would like to have on our site is a three foot wall with a six foot screen wall on top so as it stands now we are compliant with uh all zoning requirements and except for the item of the variants on our security gates which in my opinion I do not recollect opposition on our gates I because the major issue was privacy if I'm mistaken I do apologize but I do know that some residents received our gates well the uh because it will further add protection from others trespassing through our site over the rear wall into their uh to their private backyards so in in order to do that the variance that we are asking for it well first we're asking for the variance application 75819 and 75820 to be withdrawn as they are not applicable and we are requesting approval for a for our Gata Community where 50 feet width is required but our lot's only 47 and a half feet wide and then to accommodate our first response fire prevention when you consider that we need a minimum 20 foot width and then you have the little landscape Island for the Bell box another 20 feet it was to make that work was to eliminate sidewalk on just one side of the street actually it's not the complete elimination I have a site plan what it is is that we will have sidewalk on both sides of the street in this exhibit on both sides except for that the sidewalk will the sidewalk will come down one end and then down on the other end over here so we do have continuity to the public right-of-way for for Public Access so with that being said we're we're respectfully asking for approval of our variance application and approval of can see on the overhead and the which does impede the proper configuration for a gate they can't address connectivity because of the existing development patterns around them so with that staff can support the variance request for the gate and the connectivity ratio as such staff is recommending approval of the site development review and tentative map and this remaining variants staff would like to make one amendment to condition number three on the SDR at the time of the motion if there is a motion to approve that thank you thank you very much this is public hearing on these items so that most of the community had agreed with this uh building being built and we had a meeting in the middle of the street it was Walkers wheelchairs everybody was in the street last night I'm trying to find this uh where's this where does Cisco I wanted them to see this one no I want them to move that so yeah oh I see so yesterday I collected signatures I went from door to door personally because most of the residents are either seniors or they're working people I have all the signatures from yeah Mr Napoleon got the signatures from his house all the way down to the end of his Block No One agreed I got the signatures from where he left off all the way to the end of my block no one agreed Mr Franklin bought over a hundred signatures in this morning and dropped them off because he was early dropped the signatures off everyone disagreed with this building once again I have told everyone that this is a safety issue if you understand this is one way in and this will be one way out which we will have to deal with with the people on the wall which is the retainer wall they're talking about we have a wall now I'm 5'5 I can look straight over the wall so if you build another wall which is nine feet or 12 feet then we will be closed in it's like we're going to be closed in because there's a different elevation also we will have to have even thought about the um they say they need 50 feet to come in on the on the emergency vehicles well they won't have 50 feet if they put up the wall which takes away six inches if they put up the walkway was taste another 12 inches so a fire truck will not be able to get in there it will only be one-way traffic so every time if someone calls the ambulance we have to hear the ambulance come through the back of our door we have to hear the trash truck which is uh 80 tons no 80 000 pounds and a fire truck it's which is 52 000 pounds eventually the ground will go uneven because it's only one way in and one way out the driveway will eventually shift which our backyards will then have cracks and they will decrease because of the weight of the emergency vehicles also if we allow them to build behind our homes every time they have company we have to deal with their company coming in or out also there's no privacy it's two-way so also they were talking about building two walls on each side of the entrance which is very it is a blind spot because if you build two walls coming down to block against the church and out things some type of crime could happen between the driveway and them coming back so it's a very bad idea say if you have a child walking home who knows who's between the beginning of the driveway until they get to the end of the complex anybody can just hide out there if you have two people that are in that blind spot that they have I could actually take my foot and push somebody over and Hutch them over the wall awesome I have the signatures here and no one no one we even went inside the greens no one agreed to it I don't understand every time they come they say oh we have the community's response to um that they're with it I don't see nobody here nobody see everybody that came this morning most of them had to return to work they didn't agree with it I have their signatures and their phone numbers also um if y'all submit those to our city clerk for the record yes I can thank you and Mr Franklin turned in some this morning okay yes bam Binghamton bam bank right so once again if they build the sidewalker and a retain the wall it would take away from the 50 inch open and they say they have for uh fire trucks and emergency vehicles that won't be true so they have a space on Decatur why don't you go up over Decatur whereas there's a Big Lot over there my suggestion to you is return it's not it's not safe it's not sufficient enough return the property back to the church let them build a Vocational Center or a playground for the kids this is a bit too much I think it's just not conducive and it's not safe for our community and then it will also downgrade our property value as I said because if you told me that you I have to pass Eight houses if you count from the driveway Eight houses all the way back to get to my house who wants to buy or live in a complex where you have to pass Eight houses to get to your own and disturb your neighbors because it's going to be a noise effective and it's really going to be uh it's going to downgrade my property value which I'm concerned about so I'm asking everyone to please vote against this okay thank you thank you and um sir are you John uh Napoleon Mr Napoleon wonderful did you want to add anything to Mr Jones comments uh not very much but I do want to uh not step on anything at all that Kim Jones said only repeating like her I've spoken to every one of my neighbors and I couldn't find one that was supportive those that are not working or can find the time in their day to be here was here some of them had to leave eventually because they couldn't wait any longer uh more than the physical technicalities that need to be addressed there are a bunch of emotional realities the Privacy thing in my opinion is still not solved because a two-story house in back of my swimming pool looks over even a nine wall fence or a nine foot wall uh into my backyard I must admit that okay I've got a couple of grandkids that are 26 and 30 and occasionally they'd like to have their friends come over and and uh they they do not see the need for having bathing suits [Laughter] I I really don't need to be worried about the Privacy even without the balconies somebody could look out their back window and uh you know when I was 19 years old that is exactly where I would be if I knew the neighbors were swimming thank you so there's a privacy issue that's a very big one for me there's also the kids that are using the streets out at the school there's only 19 units assuming that there's as many as two cars per unit or it's 18 units I think there's a safety problem thank you so I strongly recommend that it not receive approval because we are real neighbors we're not hypothetical that oh maybe this will happen or maybe something you're going to do I'm I'm very familiar with the property okay so you know what we're talking about then of course you're talking about the high school in front in the Mormon church now what they propose are houses or homes you're going to buy them he's going to live in what now when you hit when you buy something you take responsibility to maintain it and from what I hear he's going to use quality merchandise it's going to landscape it and I feel comfortable with him getting permission to do it because mayor I know you want to go home and have a cocktail with Oscar but uh you know my happy hour time not till four o'clock but it's it's important that uh you let people have a vision and he's going to live there he's building quality he's he's got the experience I know the people are probably going to kill me because I but if he doesn't do it somebody else will earlier I was here at eight o'clock this morning so I've heard all day long that how big Vegas is going how it's a chance to do something this man who owns it not neonopolis what a beautiful story did he give up this is what America is about thanks I I think you should reconsider and let them go ahead and do their and I appreciate I appreciate the effort for the owners to change the project from three story to two story building but still is going to is going to affect us first of all these notices that we received for the previous meeting we're the only one that we received and nobody in older neighbors were not aware about this meeting they got confused and when I talked to them they didn't know where the meeting is going to be when and they were waiting for another card so to participate on this meeting um so my also [Music] my my concern is also that if you allow if you allowed this to be built this community [Music] there's going to be a big traffic of building material with building materials through this gate also because of the elevation maybe this is going to damage the foundation of our houses which are on the right side in there and they are at least five feet below is a difference between the elevation we definitely if you agree we definitely have to have a higher wall but the the owners propose to side walk to be on the site on the right side and it's so easy to um jump no matter how high is the wall so if if you ever approve this project they they we're not supposed to have a sidewalk close to the close to the wall on the right side because anybody can jump and we are not protected Arrow [Music] also um as I said maybe um we um we we have to receive another another cards and another meeting so we can so all the people can really participate because most of them wasn't aware at all um the on the previous meeting people mentioned the traffic no privacy in all the stuff that you know the the other neighbors already discussed me I'm very concerned and I haven't sleep last night you can see by the way I look and by the way I talk I'm really concerned and I really hope you're not going to approve this project because it's against um you know against this tight steep pad has no way to be control and to be um to be watched even if they will built two walls nine feet high as they said um it's still high hard to um to be um [Music] how can I say to be monetarized in um anybody plus that all these 18 18 Apartments um we we're going to have so many um people that we have no idea they can jump they can they can they can watch from our from their Apartments our backyards and it's really really Our concern you know and thank you that's all I can add to this maybe we need to have again hearing from the rest of the neighbors who wasn't aware at all and you have signatures of the other people from the year of 2014 with this short notice they didn't nobody was able to check what the people thinking about this thank you for coming and staying with us um and is there anyone else wishing to be heard from the public I will close the public comment at this point did you want me to respond to any of those comments um is there anything that you feel is pertinent yes okay please come forward just briefly we are not proposing extensions of wall within the pole of this lot is the nine foot wall is along the rear not along these sides I think I had heard that there was a concern about extending these walls here and then the prior gentle lady here had had referred to uh the sidewalk that's a code requirement we're asking out actually asking for a waiver of the sidewalk so okay okay so that's just clarification thank you appreciate it and anything else you wanted I just like to I'm sorry I just like to add to it that prior to doing these plans and drawings we had a meeting with the city officials with the the fire department before we put everything on the map thank you thank you unless it's something new because we don't want to get in an argument okay so you're telling me that you're not going to put a retainer wall down here so you're not going to build the wall well there's an existing wall there no no so the existing wall that's there I can stand and look over okay so that means you could just walk past and do this because that's how Apartments these are being mapped as single-family residents obviously they're attached but these will be owner occupied per the the tentative map that's before you today now let's go and uh Council anybody accounts on him to have a little input here no desire okay all right there you go councilman thank you madam mayor I'm not sure how we want to uh from a housekeeping item if you want to strike 78 and 79 to start this off and then go into the conversation for other ones that would be proper right I believe so yes three amount of Mayor yes if you want to strike those two and I think you can do that together because it's just a strike and then go into a discussion on the other uh three items okay now one of the things is that um we're going to have a discussion I'm not sure if the other items are going to get approved or not um and so I was wondering if if they don't get approved well we get rid of 70 yeah I'm saying that just get rid of them let's do that right then you're winning that would be my suggestion however if you have any concern that this needs to continue to be a package um because of any changes that might be coming out of your discussion where a variance may still need to be required maybe you have your discussion and then dispose of the applications as appropriate after that that's that's what I was wondering because there might be an opportunity to table something in well and two if I might add councilman if you go back to see if you can have more meetings with residents and get something done and then I would definitely hold those two too because yeah that's that's what I was saying so so guys um I really appreciate you guys coming in and meeting with me number one you seem like a very upstanding uh gentlemen who are trying to build a great project and do something good and I can really respect that the challenge is that in and other challenges that you have a very unique lot unique lot in size unique light to where in proximity it is you know this neighborhood's been there a long time ever since I was a kid I'll be 50 tomorrow and I know a lot of people that live in the neighborhood you know from not just who live around the bordering area but along Washington along Valley View you know all throughout there and I've grown up with them and there is a general consensus that the community does not want this project and so you know one of the challenges that you have is is the two stories I think is really daunting I had asked through staff if there was a way to repurpose the buildings that go along uh the backside of it the two stories and move it towards the car dealership the car dealership and also the two stories towards the church and then make the one stories around the backside and I was told that that was not possible based off of your design is is that valid because one of the main issues is that the two stories you would have to look at the square footages yeah and things like that yeah so I was under an impression that I was told by my staff that you were reached out and that was the case that you guys couldn't do that no we're not interested in single story because this is a tough site as it is yep yeah so and so it's very typical I get you but to come in and infringe on those homes that have been there for such a long time um I can I can respect that and I if you know look I've lived in my house since 1970 since I was born and if someone came in and wanted to build looking out over us I know that my neighbors my parents would have gone ballistic and and I would as well and so um I want you to build something and I want you to do something there but I don't think that with this particular project that we can improve the SDR for the two stories that's there because it's it's just it is um it's infringing on the others property that's there right now and so I I want to kind of give you an option to either you can table this to another date maybe you can figure out something else so you don't have to if we deny it then you won't be able to come back and you have to reapply within a year and you wouldn't have to be able to reply in a year to to come back in front of this this this Council if we tabled it then you can go back and come back at a later date to figure out if you've worked something out is that accurate Mr Summerfield yes sir if we table these items then they if they need to make adjustments that will give us an opportunity if there's a re-notification that we need to do because the project changes significantly from what was published that'll give us an opportunity to re-notice it it would not generate any new application fees and because it would still be a live application there's no concerns with the cool off period right if an application is denied so I'm going to give you that option I know it's not what you want to hear but that that is an option do you understand yes I I would take that option sir the table yes okay so that to to redesign maybe the site uh do single stories where you you feel that single story needed yeah and look in in I apologize to interrupting you that's that's my fault uh no sir okay go ahead I apologize I just think that um there's a way to work I'm I'm hopeful there's a way to work with the neighbors to find a solution to your to your to to this issue uh and plus look you got to make it you know you got to understand something too neighbors I'm going to say this to you is that look this piece of Lane property has been abandoned for a long time as far back as I've ever known it's been abandoned uh you know we need to get more uh residents in our community and I think that if you've got some people that are that seem like good upstanding people that want to build something nice and there has to be some compromise there and so I urge you to work with these gentlemen in order to find something that that would be a good solution for that land and so why don't we make a recommend to table this for a little bit and they will bring it back once we have the ability what's the time frame we can table this Mr Summerfield sir so typically we don't table more than six months so we don't do a Time certain here right but that would be the ask is that the applicant work with my staff and work with the neighbors and then once they feel comfortable that they've reached to compromise it's in line with what your what you've discussed today then we will work with them to get the items reagendized in any re-notification that needs to occur because it's tabled we will have to re-notice period even if it stayed the exact same way it is now but we'll work to make sure that we have proper notification to everybody as well that's fine then I'm not going to strike 78 or 79 just leave it as it is so can I do this all in one motion or do I have to do it individually okay great um and you're fine with that probably within six months you go back and work and figure see if you can come back with a sorry I haven't been advised by Council as boring as this is every time we bring up anything to do with marijuana I will abstain from voting on any issue to do with any part of medical marijuana recreational marijuana marijuana at large because one of my sons involved in the industry so back to you well God please pardon my Interruption thank you madam mayor okay so um the applicant yes uh mayor Pro tem and mayor I assume that includes cannabis as well probably right George Garcia 1055 Whitney Ranch Drive Suite 210 and along with me here is Dr batty if you will for the record finish Monday there's one Betty 2700 South Las Vegas Boulevard Suite 2709 I'm sorry sir can you spell your name for the record p-e-j-m-a-n -e-a-d-y so uh so with that let me continue then and basically say that first off we stand before you today with a typical special use permit application for an existing dispensary licenses that are already on Third Street that the doctor already has and we'll basically relocate the recreational license here but this is a special use permit case and so to the extent that you're all familiar I think with the special use permit requirements of the code and particularly for uh the dispensaries and so there are a number of requirements that are spelled out in the code and statutes that basically where you were required to comply with those 12 requirements are have been provided to you by staff and finding that we meet all those the Planning Commission also recommended that we meet those unanimously of those able to vote so we stand here before you ready with the having met all the requirements of the city and I understand there are probably some people here to speak on the matter and then if you will would be like to come back and address the issues that are raised because at this point as far as as far as We Know in full compliance with all the cities and state requirements thank you Mr Summerfield Madam mayor Pro tem the subject site complies with all minimum distance separations as set forth in title 1912 and therefore the use can be conducted in a compatible and harmonious manner within the surrounding existing uses located within the shopping center as such staff recommends approval of the proposed use subject to conditions there was some questions at briefings yesterday so at this time I will hand this presentation over to Deputy planning director McElhone who has some additional information for you uh in legislative changes the only license that can exist at this site right now is for retail recreational marijuana medical marijuana may not exist at this site because of the 1500 foot on distance separation from gaming I should note that the applicant has an existing location which is medical and Retail so he could only move the retail marijuana portion of his license I also should note that in the recent legislative change that he is only allowed to do that up until the November deadline so we'd have to move that retail recreational license I believe it's before November 23rd of 2019. thank you okay so just to clarify you're saying on the new legislation the medical marijuana portion what was the effective date per the state the effective date I believe it was effective immediately or it was July 1st of 2019. the reason why the retail or recreational is not in effect yet it is because of the ballot initiative the ballot initiative could not be changed until it had been voted on for three years so that three years is up in November that's why it doesn't affect the recreational portion with the recent legislative change okay as we're discussing this just please check that it's not July 1st 2020. you mean for medical yep okay okay so um so this is open um for the public hearing are you Pastor Jerry page oh you are yes okay I have your card okay thank you hi I'm pastor Jerry o page and I'm from a greater Faith Baptist Church I just want to come on their behalf when they first moved into the neighborhood and they actually came in and sat down with the community and we had several different meetings and they actually supported us and not only did they support us they actually came in and did some work in the community that we're in to show their support even though they were setting up a marijuana expensive but um I really appreciate all the work that they have done and how they helped us so I just wanted to come on their behalf and give them my support and let you know that they did come in and they stood on their word and they did an outstanding job yeah thank you Pastor thank you madam Pro tem members of the council my name is Jeff silver I'm an attorney with the Dickinson ride law firm and I'm counsel today for the Nevada Resort Association I would just like to acknowledge the presence in the audience today of Virginia Valentine the president of the association and there are obviously other members of the association that wish to individually address you so I'm going to try and keep my remarks very brief the map that you see before you is essentially the original map but I have colored it in and the reason I colored it in is because these drawings here demonstrate the location of non-restricted Gaming facilities this is a the Sahara Hotel SLS and of course this is the stratosphere and the pink location is the festival rounds the concert grounds for owned by MGM so essentially we have members of the Nevada Resort Association that have a great interest in this location now as I understand it from the previous comments there's going to be a movement of the the location the retail recreational location only so therefore there will there will still be a canopy location on 3rd Street that will service the medical marijuana clientele I was not aware of the fact that they were not moving both but in the having that clarified it doesn't really make a difference in terms of the presentation today because the yellow road that goes through this location through this site is Las Vegas Boulevard Las Vegas strip as we refer to it and I know that the city in the county have always had some disagreement as to how long the strip is but the strip to me is any place where non-restricted gaming is located and that means that it's taking it all the way past the Stratosphere Hotel and then split up to head downtown this is what we're trying to protect the resort Association is also trying to protect the Integrity of ab533 which was intended to affirm and reaffirm the 1500 foot separation between medical and recreational facilities and the resort industry and they have very good reasons for doing that because obviously it's still a federal crime the important thing is that you know when Mr Garcia referred to this as as being a typical special use permit application It Is by no means a typical application and a special use permit is not something that you should take lightning and I know you don't but it is a situation where you review the particular circumstances of any location and you decide whether or not those circumstances and the surrounding businesses and the surrounding nature of the area is compatible to issue that special use permit if it were not a special permit then it would just be a mail it in and be done with it in this particular case the special circumstances are this we don't want a cannabis Corridor on the yellow brick road heading downtown and we already have what looks like to me to be a pretty heavy concentration of marijuana establishments the items in green are the proposed applicant and and then of course you have the essence dispensary and the relief dispensary located in close proximity this is a concentration which would give the wrong impression I believe to the tourists that visit here and especially those who Traverse the the Bonanza Gift Shop these are the people who are going to be walking into this location and then potentially using the the products as they as they walk out and Captain Chavez from the Metropolitan Police Department will be here in a moment to address those kinds of concerns so this is what we have here on the property it's a sign that says dispensary 200 feet away this is there referring to the relief dispensary located at Sahara in Paradise so obviously if someone comes to this location all they have to do is walk across the street 200 feet and they can get to another dispensary this is another shot of the Bonanza Gift Shop area and I pointed out the location of the essence dispensary which is right directly across the street from this proposed location and you know when you have a a medical marijuana facility if you're in an industrial area or someplace like that people drive to it they get the goods that they need for their pain uh or the other purposes that they they use that for medically and then they drive home uh or wherever when you go to a recreational location this is what we found downtown what we found is that when you open up a package liquor store downtown they immediately take the liquor and use it under the canopy at the Fremont Street Experience and that and that's the kind of concern that we have here with this location somebody's going to buy it here walk out use it in the parking lot or head over to the SLS Sahara or to the stratosphere and use the product because that's the intent of having it there and when you get to the festival grounds with the MGM you know that this is going to be a prime location so for business purposes this applicant has decided to separate their two licenses and move them to this location one of them to this location finally I would just like to say you know when you saw the pictures in the file they were cut off right here showing where the location is I went over there and took this picture and one of the main products of this gift shop is kids goods and within 10 feet of that door into the entrance of the kids area shop would be the door to the marijuana shop and so it seems to me that the the nature of the neighborhood the uh the existence of the concentration of marijuana facilities nearby that are capable of serving the need we don't need another there were 94 protest letters that were sent in on this application and uh one of them I thought was very poignant it just said one word really thank you good afternoon mayor mayor Pro tem council members Sean Higgins Chief legal officer for Gold entertainment operator of the Strat 65-95 South Jones I appreciate you giving us the opportunity to speak here uh I'm I will first off I want to say something both personally and as a company we're not opposed to medical or recreational marijuana they were passed I was involved in both I was involved in numerous applications before going back into the private sector and into the gaming world what we're opposed to is this location this location regardless of what staff will say as to the compatibility and appropriateness that's because this is zoned appropriately that's what that means that's all it means the fact is we are 718 feet away from this the Strat we have already put over 65 million dollars since we purchased it a year and a half ago into it we have another 100 million to put into it we are trying to revitalize this whole Corridor we are working with the city with the new city Archway right on our property which is going to be the grand entrance to the city of Las Vegas we're doing all those things and we are vehemently opposed to putting a marijuana establishment especially recreational at the Gateway to the city of Las Vegas additionally we've been working with the city uh talked with City County and with RTC you're going to have a pedestrian bridge at the corner there going all the way around well guess where it's going to drop you down right into a medical marijuana facility um state law section 2.16.3 took effect immediately upon passage and approval and that was you can't move a medical marijuana license and I want the this counselor here that's the only reason the entire law didn't take effect and we wouldn't need to be standing here today is because you can't change an Initiative for a three-year period we would not be standing here today having this discussion if the legislature had had the opportunity to change that law before the three years so please take that into consideration the state legislator looked just said you shouldn't have marijuana uses within 1500 feet of a non-restricted licensee additionally when the city was handing out lices one of their main criteria was concentration of licenses and this goes back to what Mr Silver said we've got one two three I was there at the hearings when the city said we want to make sure these are equally distributed amongst the city well I guess that no longer would apply if we put it here because this will be the fourth one within less than 100 a thousand feet from us and the 11th one in less than a mile from our Strat location the neighborhood around the Strat and right here is a challenging neighborhood I I invite you all come over the street with me one day and come walk back in the Naked City with me and I'll tell you what you see you're going to see homeless problems you're going to see vagrant problems you're going to see it being a property problems and I'll tell you what you're going to smell because I will take you with my chief security Al Salinas you're going to smell marijuana everywhere including our building we have to eject double-digit people every day why because they're smoking marijuana inside of our property which is illegal and the fact is this is a tourist Corridor and every one of those tourists especially we build the bridge who's trying to walk from the South Strip to the north strip trying to reconnect us with the rest trip is going to have to walk through that Gauntlet you may not think that's correct I'm telling you right now we deal with it every single day at that property this neighborhood is adequately served and I would hope you would listen to listen to the businesses around there we're going to largest employers in this in this neighborhood we are a tourist destination we're bringing dollars in I hope this Council takes that into consideration when they vote on this matter and I would hope you would vote no uh with regard to this it is not the appropriate place and it's not necessary thank you thank you madam mayor Madam mayor Pro tem and council members for the record Andrew just vice president government Affairs for Morello gaming which owns and operates the SLS soon to be Sahara again later this year uh we too are opposed to this new Dispensary going into this location it's kitty corner across the street from us and as Mr Higgins alluded to before me we are investing a substantial amount of capital into our property as well to revitalize the area within the past year we've put in 120 million dollars you can see that for yourself when you walk the main floor we're redoing all the rooms right now it's a substantial investment on our part and in a few years when the pedestrian bridge grows it goes in if it's a circular design which RTC is contemplating right now it could connect all four corners of Sahara and Las Vegas Boulevard and one of those Corners would connect directly into our property and to have direct access from our property to this newly proposed marijuana dispense three it makes us very uncomfortable based off of the fact that we are federally regulated we're regulated by the Nevada gaming commission it's it's of great concern to us so [Music] um the the other thing is the festival grounds and all the attendees that are going to be going to shows and concerts there it's it's already a very busy and dangerous intersection for pedestrians um since 2018 two people have actually died at that intersection and dozens of others have been hit and survived and if people are going into a dispensary the concern is that they would be using the product and then crossing the street unsafely and putting themselves at risk and other drivers so with that I I will just end my comments by saying you know when you go on the website when you go online and you look at canopy one of the things that they have listed there is in big letters is they say our downtown Las Vegas dispensary is ready to give you the best possible cannabis shopping experience without dealing with the hassle of the strip they have that right there big bold letters right on their website so I would ask why are you asking to move on to Las Vegas Boulevard if you don't want to deal with the hassle of the strip thank you thank you mayor Pro tem and and Council Russell Rojo on behalf of board Gaming Corporation and as you know board game has three properties uh downtown around Fremont Street on and around Fremont Street and although we don't have a property in proximity to this location of this application it is of concern to us as as a member of The Gaming Community we worked very hard at the legislature to get legislation passed supported by the dispensary Association by the way that included the 1500 foot separation requirement in the legislation and we've needed that because we've noticed that what was intended to occur which was as Mr Higgins noted the distribution of these facilities around the city of Las Vegas is not occurring they're congregating understandably from a monetary perspective around the resort Corridor but that is a problem for the industry and we'd hope it'd be a concern for the city of Las Vegas particularly at the Gateway to downtown we would in support of the resort Association and our gaming Partners ask that you deny this application thank you is there anyone else pushing to be heard on this item good afternoon I'm captain Chavez Las Vegas Metropolitan Police Department I am the bureau Commander for the downtown area command so I am the captain for the the great city of Las Vegas address 621 North 9th Street for the record Las Vegas Nevada 89101 first off welcome to all the new council members I look forward to working with you and for those of you that I work with in the past I thank you for all your help coming up so far in the last two years that I've been in downtown and I'm here today to speak in opposition of this new dispensary we've talked a lot about the Gateway of Las Vegas that's what what that is at that intersection and I have spent a great deal of my life working for the police department to keep this neighborhood safe the naked cities what we're talking about the Gateway and you've seen a lot of those pictures I don't have them with me now but I was looking at them the thing that they aren't showing is the neighborhoods that are right behind there the stupak community center that I spent a lot of time at with the mayor for Easter for holidays there's a neighborhood back there that is poverty stricken we know that and we are looking at placing another dispensary so I think they said now this is going to be number six that's troubling to me my officers spent a great deal of time making that neighborhood safe and when we encounter people who are undesirables that come from some of these dispensaries it creates an enormous amount of work I ask you all to please take in consideration of families that live behind there and live around that neighborhood some of which are the silent minority maybe Hispanics that are working very very hard to improve their lives and now here we are yet again shoving another dispensary right in front of their face and it is the Gateway we have and I say we all of us the city of Las Vegas I've worked very hard to make this the crown jewel as you go into Las Vegas this is the first thing you're going to see and I don't want that to be what people remember as they come driving into the city of Las Vegas we shouldn't play second fiddle to anyone this is a great City we have done some amazing improvements along our Corridor Main Street up and coming would be Fremont Street Las Vegas Boulevard why do this there's no need for this I ask you all to please take all this into consideration this is uh this is something personal for me I have spent a great deal of my life working for the police department and now here I am as a bureau commander of downtown I take great pride in that and so please take all this into consideration we've had some amazing partners that have come forward the stratosphere has done so much to help us golden entertainment they are great people more importantly are the people who have to live with this every day the rest of us go home they have to sit there and smell this and live with it and deal with the problems so with that I I thank you for your time and I hope to continue to work with all of you in the in the coming future here thank you very much hi I'm Margaret Presley I'm going to read two letters on behalf of this dispensary being approved are the special use permit thank you my address 4006 cottonseed Court to the board my name is Dan shinifen I was a county commissioner here in Nye County for eight years I served on the Planning Commission for two years prior to that and I've had the pleasure of working with Dr batty on many items while serving my community he was instrumental in bringing us an urgent care facility and in building a very large sixty thousand square foot complex for hcp which continues to offer urgent care and much needed Medical Services Dr batty has always been a man of his word and has worked with our board in the past to improve our community when we started to write medical marijuana zoning and Licensing codes we met many times to discuss how best to locate and regulate them I have faith based on past experience at Dr batty in whatever Endeavor he is involved with will prove to be an asset to your community as well thank you for taking the time to consider my letter and I hope that you will also find him a valuable Community partner as I have sincerely Dan shinhafen former Nye County Commissioner and planning commissioner to the members of city council I apologize for not being here in person but I am attending a meeting at the National Cancer Institute nevertheless I would like to say to you that Dr batty is one of the few remaining Physicians involved in the Cannabis industry and it is so important that he be allowed to move to the most advantageous locations in order to stay competitive thus enabling him to continue to conduct the important research needed to be undertaken in this field the landscape of the Cannabis industry has changed dramatically with large corporate ownership that have so many locations it is and will become even more so impossible for smaller local businesses to survive in this case it would be disastrous to his business for Dr Batty's dedication to the medicinal aspects of this industry and research to continue this absolutely means he must succeed financially his competitors who speak about the big corporations not being anti-competitive are just that and their efforts and others might prevent Dr batty from moving his business to a more successful location are misguided I would encourage those council members to support this move so he can continue to be competitive somewhere along the line as a community we lost focus on what the basis was to bring to the Cannabis industry in Nevada that was for medicinal cannabis and treatment of I used to live in that area it is like yeah Captain said it's a bad area it's real bad and it will not make it it will plus you have first Friday the traffic it would be it would be absolutely I would deny it what's your name Sir Anthony Casa Bianca thank you so much yeah my address is Here There and everyone I'd like you said for the moment thank you but I'm not opposed to the marijuana with help but uh it is a bad area believe me trust me you had like the captain say you have Naked City you have it's just it's just a thank you is there anyone else wishing to be heard on the item Molly good Bay 2400 Las Vegas Boulevard South I'm here today to represent the landlord uh thank you for the opportunity to do business in the city of Las Vegas um our family has been doing business since 1997 and we'd like to continue doing business and investing in the city for years to come in 2015 we were able to lease Bonanza Gift Shop and in 2016 we're able to buy it for we invested most of our money 50 million dollars to buy this property we didn't know what we were getting into when we first took over the corner was full of Riff Raff and a bunch of sketchy characters um at first we had to regain control we had to secure the law we had to get rid of those people and um and we were luckily we were able to do so to make everybody feel safe and make the area appealing for customers to come in we replaced the Naughty Town section with kids world and put 24-hour security as well as upgraded the signs to have LED lights which brighten the entire Shopping Center um as far as the property goes it has the land use for dispensary and it is not located within a distance any distance restrictions and it fulfills all requirements as planning has approved the entire building is over 36 000 square feet in which the proposed space is actually less than 10 percent of that we had many different people many different dispensary owners approach us and they wanted to lease the space um and when Dr batty approached us we liked him a lot because he was more involved with the health care aspect of cannabis which we agree with and just so you can see the um the look of the the look of the management company is called Urban leaf and that's how they look it's very professional it's clean it's seamless and it goes kind of right in with our property as well um and so just a little bit about Dr batty just so you can understand uh his care about the health care aspect he developed a patented technology called vesosorb which allows for the CBD benefits to be five times more absorbed into the system so he's not just about selling cannabis and making a quick Buck like the rest of a lot of cannabis dispensary owners are he's actually there caring for the people and that's what we liked about him and why we chose to work with him as owner and operator we're on property every day our Shopping Center's success is our livelihood and we would like the special use permit approved for our property as everyone else with the that has been approved and has had the same requirements that we meet were approved and just to address some things that were said um for instance about the consumption in Naked City I mean there were supposed to be consumption lounges and that was struck down you know that was that striking down was backed by casinos and so if you do if you want people to be able to consume properly in abidance with law I mean it's kind of it's kind of a tough situation for them so I you know I suggest you know working with the community and of course keeping tourists educated with proper consumption and what the laws are which of course I'm sure Dr batty will be doing okay any questions that you have for me thank you thank you no I think but you know one of the things that um I think is a really big valid point is you are not in any uh your zoning is correct for this particular store and plus you are within the right amount of feet from from everything I think that's very important to consider thank you so if I can make your pro tem absolutely absolutely thank you first let me Begin by saying that it it you heard staff say and you also heard some of the protesters basically indicate essentially that the law says it doesn't change till November 23rd the reason the law isn't changing is because voters approved the way the law sits today right which is we're permissible we're allowable and to basically try to thwart the voters intent but the legislature couldn't do they're asking you to do today what the voters said they don't want they're asking you to do today basically to undermine the voters that will and basically require something which is not required by state or local law until November 23rd I have a letter here from Amanda Connor basically spelling out what your own director Mary McElhone deputy director said which is the amendment will take effect on November 23rd 2019 that's regarding ab533 and the amended sections of NRS and also provide that for the record we'd also ask that the Planning Commission and all the application materials for the record be included as well the interestingly enough you know one of the things that special use permit you always look at it and you had before I'm in councilman career he wanted to hear what the neighbors had to say that's certainly important to you as a deliberating body what do the neighbors say we have petitions here that I will provide you there's over 330 signatures in the in the neighborhood Dr Baddie went out and got many of these themselves so he talked to them directly I'll provide these copies of these to the city council what the petition says is basically we the underside support or do not oppose the proposed new business tenant at the corner of the Las Vegas Boulevard and Sarah for Amer marijuana dispensary this location will serve tourists as well as the local community the dispensary will begin the revitalization of the Gateway Shopping Center this dispensary will boost the local economy with new customers increase property values creation of construction and permanent jobs and add a source of increased tax base for the city and state so I think that's the will of the neighbors that are in the whether it's a naked City or more appropriately part of your your city and we think there are immediate neighbors and so we think actually the property owner will be helping to improve the property Dr Batty's operation will certainly invest heavily into the property and it'll bring tourism to the end of the city that are there and those tourists that are there and again we heard this is a tourist location one of the things tourists come to seek along with gaming drinking entertainment is marijuana recreational marijuana which is available to them so that's another reason for them to be there why does the business want to be here now instead of on Third Street the recreational needs to move as was said didn't be more competitive but also because there is a huge population of tourists that travel this area every day there is more than ample tourism to support all of the businesses we have on on the Strip we area we have multiple businesses of every type of variety there's not just one Casino there's not just one Tavern there's not just one anything there are multiple in fact there are multiples of the same businesses that are National businesses and so we think that that's consistent with the actually the makeup of the drawing towards the end of the area and making it successful and helping to invest into what is going to be the Gateway into the City and be part of that to the issue of this being sort of a you know I think Mr Silver said this is a not a typical uh sup well in in this respect it's not the requirements for a marijuana dispensary are actually much greater than a typical special use permit the findings and requirements of the code are much greater and in the staff's analysis and the planning commission's recommendation as well those 12 requirements have been completely met they've been vetted and met and we think that's that's really what you should be deciding is based upon that the things they want you to do is not just compatibility zoning in those 12. there are many factors besides just mere zoning compatibility that was mentioned by Mr Higgins so there's quite a bit more than that when you talk about 12 requirements that are greater than the typical Space special use permit in other instances the pedestrian bridge issue certainly you know when the future holds but I don't know how one can tell that is this marijuana dispensary versus all the others that were mentioned if there's 11 in a mile let alone throughout the valley how do you know which dispensary or whether it's even legal marijuana that somebody's smoking and how do you deal with that that's an Enforcement issue how do you stop people from speeding their people are going to speed you have to have you know diligent law enforcement you have to have education programs and those sort of things and certainly lounges would help give people an opportunity a place to legally smoke and that day will come but the but the gaming control board and the casinos are stuck with the Federal Regulations they have so I understand that they have to almost be here to defend their compliance issues that they're obligated to attend but the state has separated itself from the federal requirements and the then the basically the community all of those who voted said this is appropriate and desirable in our community and so we have that two two pieces of Mind once at the federal level which they have to live with but the community is elected and we think you're following what the voters have said they want so that that issue is not an issue of concentration we have plenty of tourists it's not an issue of following the law the law is very clear as it exists today not what it's going to be on November 23rd and we think there's an opportunity for us in our dispensary and all the other dispensaries essentially in this immediate area and just to give you a sense of what that looks like yeah because Mr Silvers I think my exhibit's a little better in his umpires though but if we can go to the overhead we can you can see here that what we what we have is just in this immediate location very close here's the stratosphere of property here 452 feet to the north is Blackjack Collective that's dispensary we already have Essence number which is number one on the map here and that's uh right on Las Vegas Boulevard a dispensary there we have relief number two here and and actually just go back Essence is actually closer than we are there are only 550 feet blackjack's 452 relief number three or 723 and we're 795 feet away from the closest point to stratosphere's property if there was this city doesn't have a rule against concentration they didn't adopt those rules that was there was discussion but the city didn't adopt an anti-concentration they didn't do like Clark County and say no you can't we're not going to have these on the Strip so again we're in compliance with the rules as they exist today we think it would be unfair and unequitable to approve having proved all those others plus the 11 that are out there that were referred to and and find that somehow we're uniquely different so I'll leave that this exhibit for the record as well but let me give you a sense of what the those one of those properties that faces of the strip looks like here's essence and very visible not discrete whatsoever I mean you can't be more any more impactful than that and you can see here you can see Essence close up in the stratosphere looming in the background and here's a nighttime shop and this is from their own website showing again Essence lit up at night about his brightly and in your face as you possibly could get so there's nothing about being discreet that has occurred to date other dispensary locations here in these other and we're looking at this Essence from in other locations here we provided to give some sense of that and I'll leave those as well I guess the point is we're not we're not while we're on the strip and one since we're facing Sahara but more importantly we intend to be discreet so we've offered the councilwoman's office that as far as the signage which is not before you as far as the Aesthetics of the design which we've Illustrated what that intends to look like we would be glad to come back worked with staff in her office on what that design would be and so we would certainly offer that that condition or concession to come back before her office or whichever way she would want to do that we'd offer also willing to work with the other dispensaries in the city to create a with Metro be a partner be a partner and let's find a way if if in fact enforcement which is the issue is a problem let us find a way to participate in funding an officer is appropriate and proportionate as that may be to help fund whatever efforts are necessary it's everybody's the landowners it's our benefit to keep these in a good standing in good form you don't want to chase away customers it's to me it's like I have heard a you know convenience store well we don't want people drinking liquor they'll chase away all the customers you don't want them sitting out in front of your store or in front of your Tavern or anything else you don't want them in a grocery store having drinking out of your group from after they walk out of the grocery store you have to enforce as a property manager and operator so we will have security there both from property owner as well as the dispensary there'll be lots of there's required security so we can work with the city and Metro but to enhance that off property Metro is the best capable to do that and we could assist in providing some Financial mechanism and be glad to participate in doing so so we think that's that's an important issue as well so to the extent that this is actually going to help what was called The Naked City and try to make the property improve try to make it bring more tax dollars into the city in the state serve the community and the tourism better we think this is totally appropriate consistent with the voters will existing state law existing city codes and we'd ask for your approval and I know Peds would like to say a few words mayor Goodman mayor Pro attempt and the rest of the city council members and the new members I'm glad to be in front of you guys again I was here five years ago I think five six and um since then we've been very active in keeping um cannabis has clean and is available for our patients as possible I got into this for medicinal reasons I will continue being involved in this for medicinal reasons however in order to be effective we need to be able to support ourselves financially I don't have a hundred million dollars I don't have 140 million dollars to ask help from the sheriff's department to come and speak on my behalf I don't have that but I do have a one and a half year old that we live with my wife and we live less than half a mile away from the proposed location I've been in this town for 23 years and I've seen the city grow and I've been part of it of it we intend to be good neighbors and we intend to help that area my neighborhood to to thrive and we've offered it with clinics around to help people with whatever needs that they have support with law enforcement locally and around the dispensaries in that area and I'm I'm so glad that we're here I love our city I'm committed to our city and I'm asking you for your vote thank you I'd just like to add a few things you reminded me when he showed the photos so in response to the billboard that was brought up by one of the attorneys that's a third party billboard you know operated by Lamar it's not something we have control of what's advertised up there and as well as in regards to the kids World seeing that the dispensary is right by it we plan to move that stuff around merchandise doesn't stay in the same place so just wanted to clarify those couple items that were addressed earlier thank you okay thank you is there anyone else wishing to be heard on this item seeing none I'll close the public hearing Mr Anthony already spoke thank you thank you oh thank you have a great time um any council members before I turn it over to councilwoman Diaz councilwoman yes thank you mayor Pro Tem um I'm going to start with misca Bay Miss Gabe um can you you're you're currently the best you're the owner of or corner you help your father manage that area there what has been the effects of the two dispensaries that are near by your current establishment and can you give me a just um honest honest uh you know honestly um armin's Essence since it came over there we didn't really have any negative effect and that's kind of also why we considered leasing the space because as I mentioned earlier we had quite a few people some of which who opposed in writing they wanted to lease the space so after a couple you know a couple offers we were we started to get interested we paid closer attention across the street we've even went you know visited those around in the area we stayed in the lot watched how everything kind of worked and um we had no issues with it and that's when we started to actually consider leasing it and just to the points that were made here by several individuals do you smell it non-stop around you since there are a couple of the marijuana establishments there no honestly we don't smell it I do also own a property a little further up IHOP it used to be formerly IHOP and sometimes around that area in the back where the Living Spaces sometimes you smell it in that area okay but I'm not sure that those people are consumers of dispensary bought marijuana I don't think they have the means to to purchase you know it's more expensive and stuff like that so naked city is a really rough um part of the ward I know that growing up that's always been there and it has continued to be a challenge for us how do you see that um affecting a potential marijuana dispensary now being right there really close to to that neighborhood well the particular particular clientele especially like in our lease with with page they have to Market more to tourists it's not going to be to any locals or any local specials for people that live around the area um the owner of the Aztec and and us we're actually talking about selling that IHOP property and theirs in conjunction and as you know they have like a whole back area of Residential Properties so that whole thing might get sold and bought to be redevelop so I think that area slowly but surely will be you know start to get cleaned up and people are investing in that and also what are the hours of operation we're thinking about for that location um so we're open from 8 A.M to midnight sometimes 11 30 but whatever are your hours I think um we will be equivalent at the beginning with the existing hours I do expect that to increase however we will have 24-hour security we currently have 24 hours we have two secure history our security plan is a little more aggressive than most marijuana security plants currently on our third street we have two guards at all times during operational hours and then we have one floating between back and forth during non-operational hours in that facility our commitment has been to is going to be has been to have not only 24-hour coverage but increased coverage in that area because the surrounding areas are we don't want people smoking or having issues in in in our area so it'd be it'll be it'll be 24 hour security dollars of operation will be probably from 8 to 12 and most likely would increase okay um this is a really hard agenda item to face on your second council meeting um oh who has a question you have oh then councilman uh Knutson I was gonna W the birthday boy uh to Mr Summerfield and this staff I'm just curious if the city has ever considered um any restrictions on the concentration of cannabis dispensaries uh through you madam mayor Pro tem so that is a policy decision of the city council and at this time there is no distance separation between like uses I think that was a part of the conversation when we began working on our marijuana regulations but that did not end up being a part of the distant separations that this Council has adopted to take that part into account at least not at the zoning control obviously that is completely at the discretion of the council if they feel that there's a particular area that's over saturated then they can indicate that that's just not compatible for another such use I I thank you and councilman Diaz if you're comfortable I I just wanted to say that this is a very complicated issue and in all of my time as a city council member the most complicated I would have to say but I wanted to say that um if it's okay I wish you were coming to Ward one and I know there's a few items in the coming agendas that um that'll be up and equally they'll be controversial because there's always people that have very strong feelings on this particular issue um I think that the city in my perspective it sounds like you followed all the rules that the city has has offered um the guidelines that have been set forth and um given the presentation we heard earlier in the RDA meeting which is not relevant but it was it was discussing about the vacancy rate in downtown and how many Office Buildings we have empty and the fact that you're willing to come into the downtown to me is um is something to consider and so I'm grateful for that opportunity that being said this is a very complicated issue and the issues that may come out of whatever the decision of our councilwoman Diaz I think it's important that I want to put on the record that I've been very clear and transparent because this is a very controversial issue and my my feeling is that um that it's important to be transparent and so in every conversation I've said the same thing is that I support councilwoman Diaz in her decision and what she makes today and I don't know what decisions she'll make but I support the decision that she'll make and and also that from a city perspective I think it's important that we think through how challenging it is to to do business if we're different than the county in North Las Vegas and Henderson and if there was interest from the the Nevada Resorts Association or from the Cannabis industry that is something that I would really like to work on is establishing some some level of consistency in how we regulate from jurisdiction to jurisdiction and obviously there'll be changes with the Cannabis board but I think there's there's some level of of importance in setting the record trade around what's what's appropriate within the city of Las Vegas as it relates to being right next to the county as well so like I said I wish you were coming into Ward one over and over again in in my in my efforts to learn about the ward I heard incredible support for the Cannabis industry I also heard requests over and over again for jobs and the fact that we're creating more jobs is is important to me so if I could recruit you to come into Ward one I would I would do that thank you councilman Knutson um before I turn it over I will say that depending upon you know the council women's decision um I will support your decision we have councilwoman Seaman and councilman Anthony did you want to say thank you um uh first of all uh councilman Diaz this is the I mean there's good arguments on both sides but I'm let me tell you what what I'm thinking of and what what I'm hearing and kind of how I I think I'm going to vote on this is uh first of all um I'm I I'm pretty well known for taking into consideration the neighbors first they were there first I need to listen to what they have to say and um with all due respect and your your petition here um and I like you George you're a good man but I just look at the first couple of pages and we got 3 900 Mount Vista 3201 South Mojave um East Bonanza 8th Street so these aren't neighbors I don't know who filled these out I don't know where these were located but these aren't the people that live in the neighborhood they're just somehow they got filled out and they're they're not representative of the people that are in that area so the people that the people that are in that area are are the uh is the gaming industry they're our number one industry in southern Nevada they are our number one employer and whenever they come up and say that they're worried about something affecting their business I have to listen to that because it affects a lot of people so they're the neighbors and they're against this project second of all Captain Chavez in the back I worked with him when I was at Metro he's a man of integrity and he's a pretty smart guy and if he comes up here and says that having another dispensary in that particular area when there's already three or four of them and that's going to cause him issues when it comes to policing I have to listen to that that's very important and third of all I mean the we want to make marijuana places available for people it's already available there I mean if somebody wants to buy marijuana at the corner of Sahara in the boulevard they can buy it so it's not like we need to put another dispensary in order to provide because there's a lack of locations for the people that live in that particular area um and then I can go on on a couple other ones but I I just uh I don't think this is an appropriate level it's a special use permits are a big deal um we just don't hand them out um I just not sure if this is the best location for this for a dispensary based on what I just said so hopefully that's helpful councilwoman Seaman yes so first of all um I believe that Dr Bradley has complied with everything that's legal in the ordinances is that correct I'm going to defer to staff through Madame mayor Pro tem yes ma'am the at under current codes and current requirements this application is fully compliant okay we'll see us in whatever she decides I believe it's her award I understand the concerns about being close to the casinos however you have dispensaries that are closer than what he's bringing in so I'm not sure I can agree with that argument so again I'm going to defer to councilwoman Diaz thank you madam airport temp you know I'm a Believer in that cannabis is here and actually in our society uh you know you've heard me say that the barn the cart has left the barn and we have to figure out a way to deal with it yet I do not think that this is an appropriate spot for a dispensary uh you know it's it is the gateway to the city uh I think that to be bombarded with uh dispensaries is not really the the look that we want going into the downtown Corridor I do find it interesting that uh it was mentioned that a number of gaming properties have issues of people smoking in their properties which we know that is true yet I was a big proponent of the social use being used because of the fact that it's going to keep honest people honest and people should have a place to go smoke yet a law was passing A legislature supported by Gaming that has sort of put a squash on that so it's somewhat contradictory yet I do think that I do think that um at a different location it'd be just fine I just don't believe that this is the right spot and I and I and I can't support it thank you thank you would you like to say something may I okay one more minute okay uh councilman Anthony I went around and collected signatures myself from the that entire neighborhood from business owners and also again I live maybe a three minute walking distance myself to that corner people in my building as I live at Sky signed as a good number of those I can't tell you what percentage we're out of the vicinity or within the vicinity but I collected a good number of those in the immediate area yes and then one one more quick thing I I respect having the casinos here I got here 23 years ago and I started working for MGM that's how I got hired as a ER Trauma doctor here and I did Orthopedics but um but we're becoming a big city we have hospitals families doctors lawyers and we are no longer a casino State and it's nice to try to follow what the casinos want us to do all the time but I'm the public and I've been here for 23 years that's all I have to say sorry thank you councilwoman Diaz thank you mayor Pro tem and I appreciate the um first and foremost the interest in moving to Ward three I know that is a very difficult part of my ward that we need to give a lot of love and a lot of work into as my colleague councilman Knutson has pointed to it's it is increasingly difficult to rent any kind of space and you kind of drive by different shopping malls and you see more and more of the store Front space vacant it's because as we evolve as a society a lot of goods aren't being purchased inside square footage and so how are we going to ensure that we're creating a different economy Diversified diversifying the source of employment ensuring that there is safety in in our communities and I mean it's incredibly I understand the Gaming's perspective I I completely understand ever since cannabis was legalized I smell it in my neighborhood and it's you know one of those things that happened because it was the will of the voters to make sure that we were able to use it in our state and so you know I keep thinking about the security issues I keep thinking about I think it's actually a pretty um good location in terms of egress and Ingress egress like I'm sure you don't have any problems with parking right what's goodbye and there's so many other dispensaries that are just strapped for space too um so it's it's an incredibly I'm torn I feel like I I love the people that are invested in this project and I also love my downtown area command and the gaming and I kind of feel like right now we're we're a family that's at odds um and so I think right now I need to really make sure I do my homework and my due diligence I think I need to take a field trip out there so I would like to obey this item until I can really make sure that the the decision that I'm going to make is one that I feel 100 comfortable making so with that what motion do I have to make uh you're looking a motion to hold it in advance we just need a Time certain councilwoman a month uh next council meeting let's do let me can I if I could counsel them through and so we will have an entertainment venue with in with the entire theme of being from Africa the Proprietors of the ownership is Chris and his wife favor usigby they Hill from Nigeria Africa they have they and their family have large businesses throughout the continent of Africa and they have a variety of businesses right here in southern Nevada and they are very pleased and elated to be in the downtown community specifically without with all of the activity taking place in and around the Fremont Street Experience we see what Derek Stevens is doing of course the downtown Grand and the refurbishing and the repurposing of the Fremont Street Experience as far as the entertainment venue this location that we're speaking of will be directly above Denny's just to put this into perspective and so we will have an opportunity to overlook Fremont Street as well as 4th Street and as you all very well know mayor as I understand you and councilman career have been invited to the grand opening of the cat's meow which will be our neighbor and I know that grand opening is tomorrow so I look forward to seeing you all there and of course I understand your husband my friend Oscar is turning 80. yeah and there's going to be 80 toasts downtown tomorrow as well so we're looking forward to be a part of all of that Center G and activity taking place in the downtown community and so I really want to thank councilwoman um fee uh councilman Fiore for a lot of guidance that she has also provided in regards to you know some of the ideas that should go into this facility and so I do want to recognize that as well so thank you for your comments as well and of course councilman career and his entire staff as well as Mary mcelhorn and Minerva who have basically walked us through and a school right behind it yes and so there there was some concern expressed around how you would use that space um and I am not sure why you're asking for the the the change and so if you could kind of clarify for me what your intention is for that entire space and how it's consistent or inconsistent with the existing use now well we're not looking to change the vacant land in building anything further on the building um the building exists now and meets all the requirements for C1 we're interested in just leasing that building to someone that would be compatible with the neighborhood so um because I'm a new a newbie and I apologize for that it's not yours so am I okay well let's be new together um so I'm going to ask for some advice from our our staff on on what to do I I feel um like I I don't know you um and I understand the need to lease out the building and maybe a little a quick tutorial on how changing the Zone would be helpful to leasing out that space would be helpful for me Madame mayor three councilman so with the zone change um any use that is permitted either by right or condition or applicable for a special use permit in a C1 Zone could be requested at this location this is an existing building so there's a number of uses the pr zoning district is meant to be a transitional zone between single-family residential and Commercial it's typically not something where you'd see an office building of this uh structural stature it really is the conversion kind of of a single-family home into an office you have quite a few of these on Jones and um Maryland Parkway and in areas like that where you kind of have some large Street frontages this property with the rezoning could be again become any of those things so it would not be um it would not be inappropriate if you have any questions or concerns and want to better understand what the potential future tenant on this is to possibly hold it for two weeks or until the next meeting to meet with the the property owner again when you do rezone this it will be eligible for any C1 permitted use conditional use or special use permit and it doesn't sound as if you have someone ready to lease the space we do you do can you we we have two potential customers right now that are looking at bringing in Architects to make it interior changes that are ready to make an offer and Lease this but they are not willing to do that until we have the c one um zoning it creates a large hardship for me personally to continue to obey this I would like to if possible answer any questions you have now so that we could continue on with the zoning since it has been approved by staff and the Planning Commission we operated a business out of there for 24 years we are business owners we had a medical equipment it was MBI X-ray and medical supply we've always complied with everything that the state county EPA all regulations that have been put before us I've was born and raised here I'm 55 years old I've been a member of this community for that length of time and I would never put anything in that neighborhood that I wouldn't want in my neighborhood um I I would like to answer any questions you have so hopefully we can proceed forward and I appreciate that my intention is not to obey um it simply was to better understand the potential use so you're negotiating with potentially two um different clients I just I from my own Comfort level because of the the school behind it I just want to make sure that it's compatible and I've talked with the rabbi the rabbi and I have talked several times we try to be good neighbors with them because they are at the back of our property and of course um considering it's a school and some of the security issues they have we really feel it would be advantageous also to get someone in that building so it's not consistently vacant because I think that creates more of a security problem for them with the building continuing to be vacant and Madam mayor if I made I just would point out because I believe councilman you did have this question uh on the back part of the lot where it is vacant if they were to propose to do anything back there they would have to come through with the new site development review to get approval for any additional Construction in that rear portion of the property so there would be subsequent applications that they would need to come forward with if they were to try to develop anything beyond the current building that is built on the site thank you totally up to you but when you meet with them to discuss maybe just get copies of the Lois the letters of intent of the people that want to leave so you can see what kind of business wants to be placed there in order for you to make a decision on zone change yeah um and I appreciate that so I think you said some very important things to me especially regarding the the rabbi who I'm familiar with in that area so so given that my request would be is that if I prove because I don't want to make an undue hardship on you if you're able to meet with me um following this I I would move for approval I would like to talk about who you plan on going into that space so that I can just be informed if that's okay certainly okay and I would like that if I might councilman the it's not you that's in question obviously with your previous life and the involvement with the property and everything else it's just the ability that we have through the city to vet some issues that might help you in making your selection if they're choices that you might have made so I think just the courtesy to councilman Knutson would be great and so you're going to move for approval but subject any conditions I just want one comment down and I'm just trying to understand are you are you looking to obey this no okay so uh you know one of the issues is that when you go from professional office to a C1 limited commercial it opens up a lot of opportunities for a lot of businesses that could come in there it could be you know there's a list of on the categories of C1 which you could do and um and so that's one of the concerns is that your business it's not like your business was an office that you ran hence professional office now you're going to have a commercial business of people coming in and out there's a lot more issues associated with that do you do you know what type of businesses is it what type of business is going to go in there did I miss that yes um okay they said they didn't know they were just going to lease it but I think councilman Knutson were asked that they would stay involved with him just they can sort of help the fact that's coming through the the challenge is that once the zoning goes through and right you don't have to come back and I can appreciate your um concern about that the building itself doesn't lend itself to a commercial building that has a lot of traffic we only have 22 parking spaces and so it's not like it would lend itself to have a heavy retail presence also the building has quite a bit of warehouse space so it's it's not like you're good you would that it would even work for someone that would have a large like retail presence but you you said you have two people that you're talking to are you willing to let let us know one of them is a medical laboratory that would um not have any traffic per se just their employees and any particular like samples or stuff they picked up so they'd have a courier so they would have no retail presence of coming and going out of the building and then the other one is um right a pottery um Ceramics and pottery and they want to put a kiln in and it's I don't believe it's a is it retail or it's not really a retail type business well of course there would be things that our Planning Commission would have to go or be aware of because if you have a kiln you have a whole different and they are currently going to meet with the fire department and run all that through to make sure that that's acceptable for the edification of this Council I I do I'm familiar with the building I've driven by multiple times I I there's not a whole lot that can go in that type of space with that parking in that area and so I'm I'm confident that as as long as I think what you're asking for is the permission to change because it makes your ability to lease much easier and as long as as long as if we can work together on just making me aware of who you're at least to it'll make me much more comfortable sure thank you with no it was actually Chef Andre were shot so it was uh French food yeah all right so tell us about your um item please okay so the the project I'm working on it's on the corner of 18th and Ogden um I'm happy to see I had unanimous unanimous approval from the Planning Commission on June 11th um as you know there's been a significant investment on Freeman Street heading up towards 11th Street but nothing really much past Maryland um the parcel I bought is it's been vacant land for about 50 years now and um I'm hoping that what I'm trying to do here is it could be maybe a catalyst for future investment in the future or further further east excuse me um I'm going to build this as my home it's going to be made out of shipping containers a little bit outside the box um I've been kind of obsessed with it and researching this for many years now it will be a green design incorporating solar panels I'm looking to make it a net zero energy consumption I will be living there contemporary design with an open interior Courtyard um the challenge that I have is that uh being on the corner of of 18th and Ogden on the corner on the Ogden side normally there'd be a five foot setback but now it's going to be 15 feet because it's on the corner there so it's actually making me having to make my my structure a bit longer which is pushing me into the variance territory I'm trying to have it so that this interior Courtyard is kind of a lush I have a pool Koi pond Cabana everything's not looking interior um the exterior of the of the of the structure I want to actually kind of dedicate to local artists for beautiful murals that they can really decorate and have it change a few times a year so it can actually maybe turn into somewhat of a an attraction for that area um you know that can be dedicated as a homage to um to downtown Las Vegas Vegas strong it could be golden knights artwork local soccer teams to the neighborhood um I did want to mention that uh there is a right-of-way on 18th Street as well on Ogden on 18th Street there's an 18 foot right-of-way I spoke to Mr Steve gabecki from the planting supervisor and he mentioned that he didn't see any reason for 18th Street that had to be widened so I'm hoping with my variance which is the five foot in the front and the front yard we still have 23 feet to the curb and then on the side curb for Ogden I would still have 19 feet with the right of way that's already there have we if I might ask you know our widening streets on Fremont East is that potential for looking to the Future having to widen and amount of Mayor I will defer to Mr Anderson on that one Barn Anderson Public Works um the city has an interest in complete streets and landscape byways and and things of that nature so it is entirely conceivable that at some point we might want to put in Street trees and such but that would be within the existing right-of-way he's not asking to vacate that right right away he's just saying that right now it's it's that much extra distance as a means to justify his reduced on-site setbacks but he's not asking to encroach or vacate our right-of-way and I suspect any future widening that we may do and I'm not saying we will but if we do would be contained within our existing right-of-way and so you just need to consider that it would still be uh right of way and uh so his on-site setbacks do they make sense to you because he won't be using our right-of-way for himself I mean because we are winding much as we have done on Commerce and Main Street where we haven't changed setbacks but we've claimed the streets to be able to streetscape landscape widen them to make them more comfortable for the community yeah I mean I'm I'm not going over it I'm not as he said I'm not taking it but I I am planning on um you know doing Lush landscaping and making it beautiful and making it you know something I think that would add to the community and since you're using I'm sure since you've been here for a while you know Arnold stock Dr Arnold stock s-t-a-l-k I don't know he's been in town for about 20 years and he is a PhD in architecture who back at least 20 years ago brought the first concept of using cargo containers in Long Beach California they're all over the world in ports making them into housing in fact he developed one specifically during the days of Katrina to be able to airlift them and ship them down into that area so he's with veterans Village if you go ahead and Google Dr Arnold stock s-t-a-l-k he's been working with cargo containers all these years so he you know he may be of no value to you at all but it may be of great interest and as you run through your Concepts and he'll have shortcuts whatever I have no idea any any information would be helpful absolutely and it's it's all new to me I've built a I built traditional houses but I have not built uh it's a mess it really is a must that you talk with him and he's just really become an expert especially when it comes to veteran housing and what we're able to do and does have them on now on a couple of the veteran sites one at goodness where's that it's down at the three corners four corners but you can find that information out there and we'd be happy to introduce you whatever so this is very exciting I don't know if I asked public if you have any comment on Number 96 please come forward make comment I half report you have Madam mayor the so the proposed development as indicated does not mean Channel 19 setback requirements no evidence of a unique or extraordinary circumstance has been presented and so staff has concluded that the applicant's hardship is preferential in nature staff is therefore recommending denial of the variance request I do just want to make sure that we're clear for the record the applicant did mention that he may wish to do landscaping Lush Landscaping within the right-of-way if at some future date he does choose to want to do that he does need to come back to the city work with the Land Development section of the building and safety department because that will require an encroachment agreement because technically that is city right of way and he will need approval before he can do any work within that space with that Madam mayor if there's any questions otherwise thank you thank you okay Council and does anybody I heard a breathing I have a question um when you say you're going to build containers there are some architectural renderings in our backup material but there's nothing to show what it's actually going to look like and the last picture that's on here is a stack of containers with I don't know who that is if that's Zeus David or some Greek god of like one two three four five six containers seven containers stacked up together that's not what it's going to look like not at all no sir it's pretty cool that's fine but I'm not sure if the neighbors would like that no no absolutely not I just I just wanted to give an example of how how uh how some people have decorated the shipping containers making it instead of a typical eyesore it's turned into an actual work of art that's the only reason I yeah but it's not my neighborhood but I'm just saying that if it was coming to my neighborhood I would have an issue with it um but you don't have anything of what is these architecture drawings are more sketches of what the video is you have something that what it's going to look like I have some this one right here if yeah overhead on yeah nope okay so I have this one here um the design has changed since um I really can't see it I don't know if you can zoom in on it or oh so design has changed this this top section here is is no longer I'm just going to have one it's going to be an out a cabana which is going to be on the actual north side and it'll be a rooftop deck but it's going to be basically a single story uh off to the east side there'll be a carport that goes under and then on the western side of it there's going to be a double container which would be more of a kind of a studio Department and if you've spoken to the neighbors about what that might look like because it's not a very it's not traditional home not a traditional home now I spoke to um I spoke to a couple of the gentlemen that were off to the uh there's a kind of a Apartments apartments that are off to the left that you'll see I guess you can say it would be west of 18th Street there's a more higher density I've spoken to a few people there they're pretty they're pretty excited about it the gentleman the people that are actually directly across from me on Ogden um they're also excited about it they actually offered to do the drywall I haven't had any opposition [Music] okay well I'll be interested here what my colleagues have to say and I'm assuming that you've seen the SketchUp the drawing yeah okay what's that answer enough to answer what you asked for yeah I I think it's interesting um like I said I'd be interested to hear my colleagues have to say because it's very untraditional and in a very established older neighborhood that might be a little bit of a culture shock for a lot of people it would be for my neighborhood sure I understood I mean I think that the you know it's really just been a unfortunately a vacant lot it's been a blight there's there's been you know trash and everything that's it's never been used I'm just trying to actually add to the community in my own sense as well as um you know I'm actually hoping this project moves forward I plan on living there I also plan on hopefully getting some positive recognition from it and possibly you know contributing and trying to offer you know lowering lower income housing and and you know student housing and try to help the rent situation that's in this town if I can move forward and have something to actually uh say is my well I'm sure councilwoman Diaz will ask you about things of meetings with neighborhood you know and residents and so she'll put you through it okay yours thank you mayor and we did have a meeting in my office and I did ask at that time if you had reached out to all of um the neighbors that would have your very unique comb um next door to them and so did you I I went on I went on Monday for the people behind me as well as the the one directly next to me and there was no luck I mean I guess my timing may be off I was there around 11 o'clock 11 A.M okay so you haven't been successful in reaching them have you had any attempts of like having any meetings with the community there just to kind of get their feel I have not no I mean I guess I'm kind of relying on the fact that the the proposals being you know there's a big sign on there saying what I'm trying to do there's a proposal that's sent out to everyone and they have a they have an opportunity to say approve or denial and yeah okay and then yeah I'm just saying the you know the I guess when I spoke with uh with the building department as far as the the actual building itself you know as long as I'm within the parameters of what the building code is I know that it's outside of the box being the shipping container they did not have an issue with it being a shipping container as well as I built it to their to their standards and Mr Summerfield have those standards been satisfied Madame mayor through you so he has not yet submitted his building permit package he actually needs the variance in order to do that so once he goes through building permits that is the next step for him is to get all his various approvals building and safety will review all of his um his documentation he will have to show that he's meeting structural and electrical energy code all those various components as a part of his building permit submittal package okay but we do not have that yet because he needs this approval before he can really move forward with that next step understood it is quite close in proximity to Hollingsworth Elementary so we did talk about how the exterior needed to be done Tastefully and G-rated because we will have little ones walking by his home and so we want to make sure that we are making sure that the exterior is is inspirational and motivational for the for the community and not something that as a parent I would be terrified for my eight-year-old to see so there'll be no new to no nude paintings on the containers did you have something else I councilman DS through the mayor question for Mr Summerfield a little bit ago we had a an issue in the mayor's neighborhood and Scott Shady where a person had built a garage and then they didn't have a structure a home structure they were storing it as a garage I'm not sure if this ties into the same thing because they built a structure that was just there but there was no dwelling associated with it and I don't remember what happened from that um but I don't know if they would fall into the same category you know and then also just for note in Council men's knutson's award you know there's that Shangri-La house a Shangri-La Shangri-La house which is red painted with believe it they change it to Louis Vuitton painting and then they change it to put some type of um Marvel Comics all over the house or so and uh I don't think the neighbors have much recourse of it it is a definite it stands out I don't live with my brother lives in the neighborhood but so I can't tell you if it's blight or not because I don't live there yet um you know that's something to be concerned about not to say that you will but it's just an example of understanding something that could just be anything that neighbors are stuck with it I think that um I have a question for him first that's a question about that garage is that without a fall in this category since it's a container or it would not um Madame mayor through you so no because he's designating this as his primary residence it will satisfy the requirement that you must have a resident a primary residence before an accessory structure that's it and to your point about the Shangri-La and some others we do not have aesthetic controls on residential structures HOAs various HOAs May and even some neighborhood associations may have some questions there but unfortunately not unfortunately fortunately in our community we have not gone to that level of aesthetic control outside of our HOA communities and so provided that he is using the appropriate materials does not include any commercial messaging on his home if he were to do murals or artwork he can he can do that under our current codes and if I may I mean the artwork is kind of congruent with what's going on downtown I mean if you go down Fremont you see a lot of you know beautiful murals along the walls I think it kind of adds to the art and then kind of eclectic area and hopefully I would think to continue that moving East in this more investment so kind of just what I'm going for yeah all right um I think all my questions are answered I would like to get your word on making sure that we do as much to Garner Community meetings around what the physical Aesthetics will look like I think that when you have buy-in from the community about what you're going to be painting onto your containers before it's done would save you money and grief and at least kind of get the pulse of what your neighbors are comfortable with so if I could have your word that you will ensure that that type of you know due diligence is done you're gonna have to go door by door leave a hanger saying Hey I want you guys to reach out to me maybe you have a concept in mind that you want to leave behind but I think it does you know I think respect towards those that are there and getting some buy-in from them is goes a long way so I think that that would be great absolutely okay absolutely so um what's the motion I need to make because I'm not sure Mr Summerfield Madam mayor through you so it sounds like you're in support of this item so it would be a motion to approve subject to con if approved conditions correct so moved so on agenda I'm 96 motion to approve subject to conditions that will come about I'm sure of my son is in that industry for business so mayor Pro tem the ball Sears thank you madam mayor var76344 applicant Ben silito owner 1800 Industrial LLC for possible action on a request for a variance to allow a zero foot setback where five feet is required for two proposed Monument signs at 1800 Industrial Road M industrial Zone it's in councilwoman Diaz's board the Planning Commission and staff recommend denial this is a public hearing I now declare it open as the applicant president there you go yes hi Ben solito representing Oasis cannabis dispensary 1800 Industrial Road so I'm here with the property owner 1800 Industrial Road um he's here in support of it we have a situation where Oasis cannabis has grown in its business and we're seeing you know 600 plus customers a day which is fantastic there are 40 other tenants in our building and so the traffic has grown to a point where it's affecting their patrons and our customers and we're coming up with some traffic choke points that we're seeing if I will on the uh on the screen below I'd love to to show this diagram here there's no signage indicating the proper Ingress and egress points for this property and the way that the traffic flows the current parking lot configuration in the front of the building has the lots of the spaces are designed for a north to south flow and then we have Oasis customers that are entering through this part here to get to the Oasis front door in the back we have Oasis customers also exiting this way and then the rest of the tenants that are in the front of this building are also exiting this way so we have a kind of a triple traffic jam right there occurring at point B so what we would like to do is to add a signage that would indicate kind of the proper entrance point which would be point a on the north side of the parking lot and then direct traffic to flow South to access Oasis and then to exit at point B and we believe that this would alleviate some of the traffic congestion that we've had and so we have looked at adding signage at these points that are indicated as you can see here there are Landscaping trees inside of the the points where we would put the signage and uh so you know a five foot setback would not really be appropriate because it would be kind of in the driveway and so we are requesting a variance to have a zero foot setback so that the entrance and exit signs can be seen from the road at Planning Commission we received some feedback that they would like to keep the trees in place in The Limited Landscaping that we have on the property already we are in support of that condition and so we we are asking for approval for this variance so that we can help improve the public safety for both the tenants and their patrons and Oasis customers thank you Mr Summerfield or Mr Lowenstein thank you mayor Pro Town Jeff if you put back the rendering on the um implementation I appreciate that the applicant is proposing to install two double-sided Monument solid Monument signs at the existing marijuana dispensary the proposed Monument signs are positioned over two landscape Islands containing trees that's requiring the removal of the existing planting material while moving the proposed Monument signs five feet from the property line would allow for conformance with title 19 requirements this would result in the encroachment over the existing dry vials however an existing wall sign for the Maryland dispensary is contained on the subject site Additionally the use is advertising on a billboard located adjacent to the subject site facing Industrial Road as such staff has determined that the proposed signage is inconsistent with the intent of the title 19 commercial and Industrial District sign development standards and therefore staff recommends denial this project thank you thank you is there anyone else wishing to be heard on this item Charles Fox I'm the landlord 1800 Industrial Road these guys have been a great tenant everything they do is in great days of course so um I'm I'm excited that they could do that because like Ben has said the traffic is a little bit uh you know discombobulated because of their success and this would definitely help with that that traffic flow thank you okay so this is a public hearing does anyone else want to speak on this item seeing none I'll close the public hearing anyone up here want to have a comment before I turn it over to councilwoman Diaz councilmania thank you man mayor Pro tem and Mr Lowenstein based on the new rendering of the signs coming in and out now the Landscaping is staying put the signers are much smaller is would that be something that is acceptable to help manage traffic in the area uh for the code we have incidental signage which is limited in its square footage and what can also be displayed on it the renderings that he was just showing I haven't seen until the moment he just showed it so I um I'd I'd hedge to say that it still fails to meet the minimum setback requirements and the variance would still be required but I wouldn't have the elevations in the backup materials so when it went and if a permit came we'd have something to hold it against this is a multi-tenant building the traffic flow from the southern Ingress egress Point can go directly back to the dispensary the other tenants in the front are relying on that one-way traffic from the north Ingress down to the South so their revised rendering would you know show their where the traffic could go but it also contains their commercial logo on it in a multi-tenant building so in in summary the variants would still be required but I would need those elevations submitted to us so that when a permit is submitted we could review it against that okay I recently visited it and there were many folks who were parking who had a hard time locating where they were at so I do get the confusion of where to turn in where to go how to navigate it and if you're looking especially for the dispensary um you might kind of run into everybody else is trying to get into the other spaces so I do see kind of the convenience of um the signage for those folks because I think it has augmented the volume of folks visiting the shopping center and if it can expedite and it can make sure that traffic flows in a way that it should I think that you know hopefully it will meet the standards but I did hear from Mr Salito that if for some reason the logo is a no-go then he would just do an enter exit um you know but to just make sure that you know there's that signage there for folks who are navigating trying to find the location so you tell me how to go on this one um it would be my suggestion if the intent is to have directional signage there then I would move to approve the the variants to allow the setback requirement but then have the signage be reviewed by planning staff or um you know the directional signage so if the intentions to retain the Landscaping at that point to work with staff in the permitting process to main the maintain the landscaping and an appropriate sign Mr salato are you willing to work with our staff on that and making sure that the the signage can be installed per the needs of the tenants and and the landlord mayor Pro 10 through you absolutely councilwoman Diaz uh it's a pleasure to work with the planning staff at the city of Las Vegas and I'll be happy to continue to do so Mr lowen seemed to answer your question the uh the new elevations show about a four foot height and I'd be happy to so great and then we are we are missing a juvenile she is a 15 year old um and her name is Nikki Marie Nikki Marie uh Dugan she's 15 she's a female she's 5'4 she's 120 pounds she's got hazel eyes and nickname is Bella and as you can see she's beautiful it means beautiful in Italian she's a 15 year old female she's 5'4 she's 130 pounds brown eyes brown hair African-American beautiful girl please if quickie uh for Saturday July 27th at 7 30 pm at Cashman our Las Vegas lights will be playing it's a great event so well supported by our community and those from out of town who love the number one sport in the world and of course as you know we continue to pursue our own franchise hopefully from the MLS and I want to thank our staff who've been so supportive and stays with us through it all and everybody on Tech that works through this so the David briggleman can get us started on time and we can get off a break so there they are it's hard to see but we thank you and we thank you and our Marshals and all of our staff and certainly it's wonderful to have our seated Council persons here now in their second meeting our next council meeting will be August 7th at nine o'clock here in these
