e for for for for e good morning everyone and uh welcome to the uh City of Fort Worth plan Commission meeting open hearing for March 20th 204 2024 not 10 years earlier 2014 thank you for your patience with us um this is early for us also so uh without any further Ado I'll turn it over to uh Lynn to uh read announcements thank you he thank you chair good morning and welcome to the March 20 2024 inperson and teleconference meeting of the fort wor City plan commission the commission meets monthly in Open Session to conduct public hearings on advertised cases we are meeting using WebEx software application which allows two-way communic for members of the public although members are not gathered in a central physical location we do have a quorum in attendance at this meeting specific rules and procedures governing these hearings include the city subdivision ordinance City plan commission's rules regulations and bylaws and related provisions of Texas state law the commission's primary responsibilities are to review and act upon subdivision plans and plats Street and Alley rideway vacations and closures annexations comprehensive planning and other Land Development issues affecting the city in ex territorial jurisdiction area the commission is made up of 11 for Citizens each of whom is appointed by the city council a quorum of six of the 11 members must be present in order to conduct the commission's business 11 members are present therefore the hearing May proceed seated at the center of the table is Mr Don Borman chairman of the plan commission other commissioners present include Mr Jim Tidwell Mr Lee Henderson Mr Jeff Davis Mr Maas melor Mr Efron Caren Miss Denise Turner Miss Torchy white Mr Andrew Scott Mr Matthew Graham and Miss Caroline CR assisting staff members today are Alex Parks Arvin viswanathan Barbara soltero and Rebecca Valdez my name is Lyn Jordan senior planning and development services department and facilitator of today's meeting copies of the meeting agenda and staff reports are included in the commissioner's docket and are available on the city's website the staff reports have been compiled from the city's development Review Committee to inform the commission and applicants of city code requirements and technical issues associated with the cases to be heard today's public hearing are hearings are being documented by cable television and streamed on the internet to achieve an orderly And Timely hearing we requested You observe the following rules of procedure all teleconference participants will be muted when not speaking in order to Evo any potential background noise all cases are called applicants and others in support of the case will be asked to present their testimony first for a total of five minutes opposing testimony will follow and will be given a total of 7 Minutes the applicant will be allowed two minutes for rebuttal each side will be allowed a collective total of 7 minutes for initial presentations clearly state your name and City prior to addressing the commission all dialogue will only occur between the speaker and the commission upon the Chairman's official closure of the case the commission will remain an open session to discuss and vote upon the case no further public testimony or commentary will be allowed be advised that the commission's decision on plotting matters is final action on the other docket items constitutes a recommendation to the city council if you need additional information about a particular case please call the development services department at Council District 5 understand the applicant has requested withdrawal of this case is there anyone here to speak in support or opposition to this case or the applicants of request for withdrawal I see one um the DRC recommendation would be for a denial of the subdivision ordinance waiver to permit a lot lot 16 R2 to be a flag lot and conditional approval of the final plat upon meeting the plating comments in the staff report and revising the plat so that it does not create a flag lot is the applicant present okay okay hello my name is Teresa McGee I'm here with Texas surveying representing the O owner Juan granados um do you guys have any questions for me on this oh yes has pardon me so much have uh has staff talked to you about what the situation is they have okay and the and the subdivision ordinance is very specific in not allowing the commission to authorize a a uh more than 100 feet correct and we just spoke on that so I will withdraw this and uh move forward with asking south of proposed White Settlement Road applicant requests approval of the fero panther Island plinary plat DRC recommends disapproval of the panther Island plary plat for the following reasons failure for all Property Owners to sign the plat application or give permission for the plat failure to provide an improved traffic impact study analysis drainage study and water and wastewater study the additional reasons are identified in the staff report welcome yes sir good morning Mr chairman commissioners and uh City staff my name is Cody Brewer at kimley Horn uh 801 Cherry Street forward Texas 76102 uh we understand the comments that have been received to date and in order to process the various studies and clear the comments we'd like to request a 120-day extension or continuance okay happy to answer any questions you only have thank you very much Cody if you'll fill out a green form and turn it in for our all important public record thank thank you very much sir any questions for Mr Brewer okay thank you sir thank you okay uh at this point I would uh call on our I understand um attorney to I have a question is that appro up for the delay the request for the 120 day delay I would recommend you just do 30 days in accordance with two chapter 212 local government code so that would set them up for the next month okay Mr Brewer uh would that be acceptable sir yeah thank you um I think the hesitation I would have with that is that I don't think that we would have the studies uh approved by that point in time nor the comments um and so I think we would end up being on multiple agendas and continuing to be on City plan commission so I if it's within the rights of the city I think it would make sense to do 120 day extension or continuance okay okay thank you very very much sir chairman can I ask a question yes um could the applicant alternatively withdraw and just resubmit um I think the applicant uh I think there are other issues involved but I'll have the applicant answer that uh would you consider withdrawing and resubmitting I I think the hesitation on that would again be probably going through the application process again and the fees that are associated with that okay I don't believe we have the authority to give a 120-day continuance to an agenda item is that correct uh okay so so the request cannot be granted as stated so a withdrawal or a 30-day continuing seem to be our only options other than the staff recommendation that we simply deny the request yeah I exactly I don't think we're allowed to do 120 days that's understandable then I think a 30-day 30-day continuance can okay be an option yeah and I understand they can't get the the stud's done in 30 days that makes no sense um of course you can also conditionally approve or disapprove and they're still in the same position they've got they can come back whenever they choose and we've got 15 days to act on that uh revision or additional information they've provided okay that is another option sir is for us to conditionally disapprove the plat okay based on the comments and you to proceed with staff I think that's an acceptable alternative okay okay thank you very much yeah thank you thank you I believe we have some more speakers involved so please okay hey uh bo Kon I'm a property owner within the uh 300 ft of this request and we are just asking to deny the request um for various reasons uh number one being it doesn't include any rideways from throck Morton Fourth Street is encumbrance that's an existing rideway it takes away that doesn't include the h& report recommendations that have yet to even be voted on by the city uh it from what our what we understand it includes land owned by Union Pacific and trwd currently I don't even know if that's changed hands what was the process for that changing hands was there a public request for proposal on the trwd land for development so there's lots of questions that we have with what's going on here and we just kind of want to say deny it and then figure out after all those things are worked out where we go from there so this is going to get tied up and tied up and tied up we need this development to move forward Bo as a whole on Panther Island and this just kind of seems very strange to us so thank you oh you have just echoed I I think exactly what every commission member has said what appreciate it that there's a lot of questions that have to be answered down the line that's all we have thank you okay thank you very much sir and thank you for being here and expressing your uh information okay is there anyone else that would like to speak okay uh that being said I'm going to go ahead and close the public hearing and you've heard the uh uh recommendation uh I'll entertain discussion at this point okay it's a very very unusual case Okay chairman if it's timely I'd recommend disapproval of the Panther and preliminary plat for for the recent set forth by staff on PP 24009 and South of West Point Boulevard the application request in DRC recommends approval of a recommendation to city council for the vacation of a portion of an 80 foot rway easement being a remainder in section one block one Western Hills phase three okay is the applicant present yes sir how are youall doing this morning good yes sir uh name and city for the record please sir and if you'll fill out a Green Sheet y my name's Cody Watson sh engineering uh in Fort Worth okay Cody I I'm sure there's not a lot you can say about this except cleaning up this old right of way that doesn't exist right that is correct exactly okay uh Commissioners do we have any uh questions from Cody about this uh I got one on the ownership yes uh does the applicant own both sides around that right away yes sir okay that's not a plat yet I can't tell from what's submitted on right yeah they own both sides and so they're just trying to clean it up on their end and for staff I just want to ask on the record we I
