so okay it is 8 30. um okay well I'll go ahead and we have council member sunberg I think councilmember Lawson is maybe just joining us she's going to be a couple minutes late I think um just to make sure I answer her okay well good morning everyone and welcome to the planning and economic development committee um I just want to thank um councilmember jorinsky for uh being the chair of the PED committee last year and I want to welcome our new members of council member sunberg um welcome to ped thank you and then um as soon as I see council member Lawson will give her a welcome um but I'm happy to be here as you know many of you know I've served on this committee for a number of years so it's really good to be back with all of you um and um I know Janine before we get into the agenda um are we going to talk about possibly having um an in-person meeting sometime this year or is that is that to be discussed later we can do that as part of the PED recap but at the end I have the potential topics and we can discuss the dates that you and I discussed okay perfect all right well I will call the meeting to order um on January 11 2023 and uh first thing on the agenda is the approval of the minutes from December 7th now this is always interesting since we have a new committee so um Angela was the only one that was on the committee I think last year Angela are you on yet don't see her um I wasn't there but I'm fine with the minutes me too when you have new members and do we go ahead and have the authority to approve the minutes Jason somebody do we have legal counsel on my suggestion would be go ahead and and forward them to all of council obviously with just the note that um you know your new committee members and and obviously if any of the old committee members have exceptions with the minutes they will let us know and we will get them corrected sounds good okay let's go ahead and move them forward to the um council meeting um okay so first thing on General business we have the development review update and I'm really happy because this is a new new position in our city so um uh who's welcoming Stephen Jason good morning uh councilmember Bergen uh Laura Perry Deputy city manager uh as part we we would like to compare the introduction with an overarching overview of the progress we're making on red tape recommendations and what we can expect to see in 2023 and of course and as you're aware we do provide quarterly in-depth updates to ped on our progress and our metrics on development review so I'd like to end the the quick overview with when we connect you all can expect us to come back um so with that um since the red tape recommendations were finalized City departments have continued to make progress in implementing recommendations improve the city's overall performance in the development review process some of these changes do take time and we're working expeditiously departments are to work through these recommendations and 2023 we're hoping to be a big year for us a workload does remain high within development review and we do have some key vacancies and departments but we've had some success in filling our positions as of late so that's some good news so I'm going to share my screen quickly what I'm about to pull up is what we call our focus of performance slide and so what this is is it essentially shows the areas in which we are focusing and have categorized our areas of improvement and so I'm going to quickly touch on each one and provide some highlights of some areas that we're focusing on so the first management and Leadership oversight we continue to hold a development review governance committee it's an internal Committee of City management and key department leaders to review and discuss progress on the red tape recommendations as well as other city-wide process improvements on development review that will obviously continue into 2023 for culture and customer service a big focal point for us in the city we're going to be instituting quarterly multi-departmental staff meetings with development review Personnel to provide ideas sharing training and information to better build Bridges across every Department that touches development review we are going to be providing Citywide customer service training in 2023 we have already begun that within the public works department and have been working through each team within that department all in the framework of building a culture of performance across the organization and within that we've started regular monthly performance metric reporting where Department directors and leaders are sharing and reviewing those performance metrics with staff for Public Works in particular we have been instituting a reorganization for the last several months and as part of that we've done a very intentional change initiative over the last couple of months and within that we have gotten down into each team and we've instituted various phases of reviewing staff rules responsibilities looking at I mentioned customer service earlier standardizing plan review processes across all work work groups with the goal of improving review times and predictability for our staff and our customers and so with that now I'd like to introduce um Cindy collop who I believe is on who's going to be providing more information on some of the Public Works efforts as well as introducing Steve durian our new Deputy of uh development review within Public Works I have Cindy hi this is Crystal I don't show Cindy on oh okay thank you Crystal all right either sorry no worries um so I will I will introduce Steve she's sitting with Steve durian so maybe they were just having an audio problem Cindy we still can't hear you can you all hear me now yes okay thank you we're having audio issues and I don't have Network this morning so it's been quite the adventure so here we are oh I'm very very excited to introduce Pete Marion uh this is just this week now at the city um he is our new deputy director of the development review division as we were reviewing workload and processes and um review times and and how the development review was working we came to the realization that we needed to um commit a deputy director to development review so that we can really consolidate and improve our customer service to the development community and our customers and with that we went through a recruiting process for uh development review deputy director and I'm really pleased to introduce Steve durian who has joined us from Jefferson County um and with that I also wanted to say thank you this reorganization is is definitely taking a village so I really appreciate all of the help that has come from the city manager's office from Todd councilman and process improvements and also the support from city council so with that I'm going to pass this to Steve and he'll introduce himself thanks very much Cindy um as Cindy and Laura mentioned I'm Steve durian and I am uh formerly from Jefferson County where I was overseeing the uh a lot of the Public Works functions there including transportation and supportive development review and our Pub and our Planning and Development Services Department in that of County uh part of my land use experience is I was the chair of the Dr Cog Transportation advisory committee which of course relates transportation to land use region-wide prior to that I had worked at Prime West development in support of development uh on the private sector side as a project manager there so I have to have experience in the public and the private sector related to development uh part of my uh goals uh working for Aurora are to work closely with the building division uh you know Public Works uh has the billing division in it as well as many of the traditional Public Works functions and so the building Division and uh and myself and my team will be working very closely uh trying to build Bridges between our groups and make more efficiency uh in the development process uh as Laura mentioned we're creating a culture of culture of performance and customer service at our core we're improving predictability and consistency for plan reviews and approvals within the Public Works group uh we are enhancing customer service through improved communication and solutions oriented collaboration with our customers and we're identifying and implementing solutions to streamline and standardize the plan review process while providing uh employees the tools and training that they need to be successful um so those are really what we're trying to achieve here in 2023 and um and I really happy to be part of the Aurora team can we open it up for questions or do you have more a couple more things really quick if you don't mind chair Bergen Crystal can I have sharing ability one more time yes thank you of course okay all right just to wrap up quickly the last two areas so process improvements in technology we are looking at making updates um to our checklist we have teams that are actively working on this so here over the next couple of months we'll be updating some of our technology to facilitate our better plan review and submittals and we are going to be revamping our website to make sure that we have a One-Stop shop for tools and documents and information that the development Community needs with obviously sufficient links to other areas of the organization that have a Nexus to development review and then the last area but not least process documentation teaching and training uh planning has engaged a consultant to review processes and practices including opportunities for reducing permit processing times and any unnecessarily and duplicate steps in the permitting process this includes looking at Master plans and Associated application threshold preliminary plots and plan developments and other procedures so more to come from that from Janine's team we kicked off with jtf a presentation at their last meeting last year around our manuals update so the drainage manual the roadway manual and the Udo all of that will be moving in sync updates to those throughout 2023 we're looking at quality control for submittals on our intake process elimination of license agreements and then obviously continuing to look at unnecessary and redundant processes across the organization to streamline the process and ensure we're providing enhanced review times and excellent customer service to the development community and with that I'm going to ask quickly Jacob Cox to talk a little bit about ways we are engaging the development community and some some plans there Jacob yeah thanks Laura good morning council members so yeah to Laura's point you know as we work through these initiatives and fixes it's extremely important for us that we have opportunities to consult the development Community as these are quite impactful so we've obviously had jtf for for years now and so that's been a bi-monthly meeting we meet every couple months and it usually gets a pretty good group of of development from a broad selection of of residential developers the hbas represented at that meeting some of the industrial developers in the city and I'd say in the last couple years it's become more of a venue to roll out kind of broad policy initiatives that the city's working on so one thing that we're focused on for 2023 as we move forward is to kind of hone in that strategy and have maybe a a closer knit group to check in with in terms of engaging with more focused strategy um with that broad selection of the development community so we're working through that right now I anticipate having some further more detailed updates as we as we come to the next PD meeting to Laura's point but this would be where we would bet things such as the license agreements um if we were working on the street light standards um we realized that the engagement wasn't what we would like it to be and so we're looking just to refine that moving forward and with that um in terms of when you'll see us again for more detailed updates so our quarterly plan for 2023 uh we're looking at a q1 update in April a Q2 update in August Q3 in October and then Q4 in January of 2024 with of course um ped we'll see any Council related approvals and and various updates on specific matters throughout the way foreign well thank you for the presentations um uh council member uh sunberg and councilmember Lawson I don't know if he's done yet but do you have any uh questions uh I have a question it might this is a broad question is it too soon to tell if developers are noticing uh Improvement in the system getting some positive feedback or we we are um we've made of course digital mylars we've made some you know I'd say smaller improvements that have been pretty impactful that's been a big shift for us some of the larger improvements are taking a bit of time um we're working you know expeditiously through that the Public Works reorg um and some of the various measures that I talked through um Jason anything to add to that no other than I think you touched on it uh we have some progress uh something we talk about at that uh development review how do we make sure we're getting this word out there uh but I guess going to hard harder your question uh we are not moving fast enough for the development Community they want this changed yesterday uh but as Laura said it takes time so we we know that that's something we continue to try and address um but yeah I think to the heart of your question you know uh some of the feedback we're getting is move faster and we hear that thank you okay well I have a couple questions um one welcome Steve we're really happy to have you on board um would um Steve would you are you going to be able to basically be over all you know water as well as um roadway and and traffic and so forth when it goes to submittals for all those different areas reorganization um uh tactics we're taking is to uh divide up uh uh our duties here in traditional Public Works which is roadways uh and more surface uh improvements uh from what Aurora Water overseas so Aurora Water will have a separate but parallel uh development review process uh that would include utilities of drainage uh all the other um kind of a subsurface and uh storm variation quality kind of improvements okay so and me I don't know if this is for Cindy or for Steve but or Laura but I know we had the consultant we hired three four years ago that that recommended that kind of I think it was this position that was recommended but um part of it was what we heard from developers is you know some inconsistencies um between departments on submittal so or or even redundancies on on submittals so is is Steve's role to be able to I guess uh Rectify any misunderstandings or you know to speed it up instead of like okay well this department had a submittal and then they had these comments and now it goes it's it's taking forever versus somebody you're maybe your position being able to come in and be like hey no that's that's not correct I'm looking at your Authority I guess so I think there's a few things going on there um so let's start with kind of the drainage piece which was uh that was an example where by moving uh the drainage review over to water um we're hoping to sort of align uh that because previously we kind of had a split roll where both water and Public Works were looking at drainage because um I think it was initially in public works because it was viewed more as an engineering matter but then water needed to review it because once they accepted the pond it became an operational requirement and so you sort of had um both departments having a role in that we looked at that and said you know what we need to move this over to water so we've only got one Department setting standards you know that if they're going to be responsible operationally once they accept the pawn we don't want to have this this sort of um divided uh review so let's let's move this over so we move that over so that's one of those areas where we're trying to identify things where we've got um split responsibilities assigned one set of responsibilities for that review so that we've got it so that's sort of on a micro scale on a macro scale you then probably step out to the next level I think that's when we get to the public works reorg where we kind of had within Public Works um kind of some fractured um reviews and organizational structure so by reviewing that aligning that under Steve with that position we think that's going to help within public work so that uh we're making sure that traffic and real property and engineering and and you know the roadways they're all talking and doing that and then from The Next Level there when we step out when we talk about um the the development review governance that's where then we we come into play that's where we are reviewing these things to make sure that we're not getting these issues uh between departments and we are giving one consistent answer one consistent set of standards and so um that's that's the effort there that we think is addressing the issue that's been identified is that we have to make sure that we have a a structure in place that is not providing mixed messaging and we know that that's a concern we've continued to hear from the development community and it's something that we think by updating our technical submittal manuals and having that governance in place is really going to get us to we want to speak with one voice and make sure that the developers understand what's required of them and they can move through our process as quickly and efficiently as possible okay great and then um the other thing was and I'm happy that um Jacob is also looking at having some more in-depth or maybe more focused meetings um because that'll probably give you feedback then that you can work on um tweaking things um lastly the roadway manual um can somebody tell me when it was last um updated yeah it was last updated in 2016. and we have been working off some draft standards in the interim and the plan we are doing a phase one update which will address many of the issues that the development Community has expressed concern on uh street light standards will be finalized and a few other items we also have some details related to Ada that need to be updated for for fhwa and the plan is to bring that to the February uh focus group as well and get that approved in February is our plan right now uh Laura or Jason and Jacob I don't know if you want to add anything no I mean that seems like a long time ago it is it is and there's some other examples with that and that's one of those where again going back to as you heard from Jacob we're looking at this as to um how do we get meaningful feedback on the front end because what we don't want to do is roll out uh we're putting a lot of effort to update these things and then if we kind of roll it out and it lands with a thud we've we've um that's a missed opportunity so we need to figure out how to revamp that process so we're getting good feedback on the front end uh and then that we can kind of move through some of these updates more expeditiously so uh Jacob Laura Cindy anything dad on that front no absolutely yeah okay I would also maybe just add as part of the reorganization our city engineer is going to be very very focused moving forward on the manuals on that broader look and to make sure that we're moving forward consistently and efficiently um so that it that will be a redefined role that is very focused to for that customer service piece okay and then I recently recently learned that we have still not and and I'm I was kind of a bit surprised um that we and you know my drainage um issues um in southeast Aurora but um I thought and I had been telling people that we have eliminated the requirement for tree Lawns with developers and then I was told that that never did actually occur in code do you know if that if what's the standard for tree lawns within um the current information from Aurora Water my understanding is tree Lawns are not required there's different options that Aurora water has put together including some cobbles and xeriscape options I will let me check on that okay yeah that would be great let me check on that and go ahead Jason I'm sorry and it might be that they have the option but maybe that I just don't know if they really know they have the option if it's my face Well I obviously I I hope they do so I'd say there's twofold here so there was the issue as you noted I think um from probably a couple years ago where we're seeing some issues with the drainage off of um you know particularly as we get into some of the smaller lot properties and just you know sort of making sure we're getting good drainage across sidewalks and I think we've identified that certainly on North facing sidewalks sometimes I can result in some issues uh so I thought I thought we'd addressed it a couple years ago I don't know on that one but what I can tell you is with uh Aurora with the new standards we've done from a water conservation standpoint remember where we have moved to to essentially say we don't so I I'm I'm almost positive because of that the turf ordinance that came in associated with water conservation it is um it is no longer required and so I'm going to look at Janine put Janine on the spot a little bit from a landscaping standard have we I know there were some just discussion as to what what that looks like certainly we can broadly talk about um Zurich landscape and some of the other things but I still think that you know one of the issues we identified in removing um uh irrigated Turf we just want to make sure that developers understand what that what that area needs to look like um and so you know when we're moving grass do they know what the Landscaping looks like one of the issues we've identified is there has to be a Hardscape to allow folks to get from the curb to the sidewalk to their front door so uh is that something we've done or is in progress Janine it's a double check because I know there have been a lot of conversations because we did not want to do away with the detached sidewalk so that was conversation number one but giving those Alternatives whether it's trade the xerxcape so we can bring an update on this so that's different than what the discussion was three years ago the discussion was that we were going to eliminate the the requirement for tree laws meaning they could have them or they and then I guess go to xeriscape but then or if they didn't want if the problem is it dams up and so the thought back then of eliminating them was then you your lawn would be well now there won't be grass but would be up to the curb and gutter and then water would efficiently run down like it's supposed to but anyway you guys can check on that we'll get you an update yeah okay um any other questions okay well thank you we really appreciate that update um I think you know you guys are making good progress so really happy about that and next is the recap so Crystal can you share the presentation please thank you of course all right so this will be a recap of what the committee did in 2022 and then end with a preview of what we so far have planned for 2023 I want to start first because this was my first year so they uh last year's committee thank Andrea aminick for kicking us off and really getting me trained up uh to take this over and of course Kathy dewolfe and now Crystal v hill for being in the background and really the ones that make this work and finally all our presenters there were a lot as you saw in your backup so next slide please and what I've done is taken what's in your backup and broken these down into categories so you get a picture of the success that this committee has had and the first big success was we had three Udo amendments the first was a multi-family building length we were seeing a lot of adjustments come through and the building length was 150 to 200 feet 50 feet for multi-family and mixed use and we increased that to 600 feet this was a great Endeavor by staff they did a lot of research to see what was done around the area around the region what we were getting so that passed and I don't think we have seen any adjustments since uh I may be wrong but I I don't recall seeing any come across the next one again in response to Market is allowing data centers in the apz which is a very restricted Zone these are a good use because they're they're low intensity we also took the opportunity in making that change to change the parking we had huge parking lots for data centers when they may need only a handful of parking spaces so that just passed uh recently and then finally there was a Udo amendment to eliminate the permit requirements and time limitations for pennant and streamer signs and that was at the request of uh council member zobonic we also had two resolutions passed out of this committee one was a transfer of title of an existing ozone medical waste processing facility so that that facility could continue in operations with a new owner and the second one uh at the request of our chair now chair Bergen was enhanced guidelines for installation of Chase drains as part of new developments finally we've had three projects that have been initiated or in the process of being initiated the first is the business Advisory Board they asked for a request for a study of a large Performing Arts venue we had a lot of discussion internally and then went to council and got approval to do a two-phased approach on this study the first phase which we'll figure out working with our community what that venue should look like and what our community can support and then from there we'll go into a phase two which is where and how uh where we would build it how we would fund it next uh the Northeast Aurora fiscal impact analysis this is to potentially expand our growth area that is going we have the analysis complete and it is going to study session on January 23rd so stay tuned for that one and then finally this committee approved moving forward with an economic development strategy that strategy was called out in Aurora places so it's it's finally time as a city that we get this moving that is going forward to the winter workshop on February 4th so again more to come on this and we anticipate that there'll be uh many of these will come back to PED in the new year so next slide please of course a big part of our year was the planning the thank you the development review process and red tape uh as you know there was an ad hoc red tape reduction committee that kicked off in early 2022 to listen to developers about improvements that could be made to the development review process you've heard from Laura and Jacob and Jason at the beginning of this meeting of many of uh the wins we've had and what you'll see going forward just to recap again very quickly we had the public works reorganization and the new hire of the Deputy the director Steve durian who you just met and I can tell you planning and economic development is very excited to work with him and really get that common face between Public Works planning and economic development and water to the development community uh We've also updated our customer service standards we're continually working on improving making sure that even as we're updating we have that communication Loop uh processes and manuals are currently under view um we've moved uh to make sure that at request of developers we can meet in person we can meet in hybrid hybrid format or virtually whatever is convenient and works for them we've enhanced the development review process for large-scale process and then Aurora water has updated its Master drainage and preliminary drainage report checklists so as Laura indicated there is a lot more to come on these in 2023 with development services presentations uh 2022 saws opening up a lot more and it was very exciting to be part of that process starting off icsc was live it was a smaller version and we're looking forward to more success this year with that our sbdc continues to be extraordinarily active I was talking to their director just this week and she said after the pandemic she was hoping that things might start to cool off just a little get back to the pre-pandemic normal it's not they are still Full Speed Ahead finishing up small business grants this past year they lost launched the business boost program which was in partnership with Community College of Aurora and Arapahoe Douglas Works they offered eight modules in both English and Spanish to help small business owners build this skills that they need to be successful finally we ended 2022 or sbdc ended 2022 with a computer giveaway that is still we're giving away the last few ones and I got to be at the front desk when one was handed off and just the appreciation of these small business owners to get these computers is phenomenal and then lastly there was the 15th annual veteran small business conference and the good news is that is going live in 2023 I know this is very near and dear to our new chair's heart but we have filled one of the two retail positions and are actively recruiting for that second so we look forward to uh hitting the ground and and revamping our retail policies and and getting out there in the community and then finally with regard to retail the council did update uh the Redevelopment retail policy and approved the first incentive at its January 9th bit uh meeting so again another big success uh coming out of this committee next slide so we also had many planning presentations five of them we will continue these some of these overlap with Taps but uh as Steve durian hinted that there is this connection between land use and transportation so more to come on those long-range planning is working on its work program for the year and we will update uh future presentations that you'll see next but we also had some general presentations both from our partners as well as uh to update on what was going on around the state including uh Statewide rulemaking one of my favorite was uh last month the who is Aurora which gives us the picture of who we are today where we anticipate being in the next 20 10 20 years and helps us inform our decisions so that we're planning appropriately both for today's uh citizens and residents as well as tomorrows so finally next slide ending with potential presentations for the coming year some of these and I put you'll see under development review we have those uh in the annual reports which we have targeted for March but I need to coordinate with Todd and others Laura just gave you the dates for the quarterly uh process Improvement updates and we're trying to coordinate those so that we time presentations when we're giving them to multiple uh bodies such as yourself retail is going to be another busy year as I mentioned icsc hopefully bigger and better this year uh at the request of chair Bergen we are going to come in March with a look forward of what the retail division is going to do and then come back either December or January to see how we aligned because we can set goals but we are at the mercy of property owners and landlords um project updates will continue and then we want our partners who are here on ped to report so please contact myself or Crystal if you have a date in mind that you'd like to report because we'd like to start to schedule out the year and come back next month with a more definitive schedule uh some of the specific projects that we're coming forward with a next month data centers as infrastructures when I came here data centers were a big question for me I came from Hillsboro Oregon where they didn't want them they've changed a lot in how they operate that they're no longer necessarily the big water users and sitting down with Erie from aedc he explained to me that with Industries such as our defense they are very crucial in infrastructure so we're going to partner to make sure we're right sizing this infrastructure just as we right size our roads and our pipes we have at the request of council member jorinsky uh Bill Bird's Monument signs a specific provider but staff will give you an overview and then you'll hear from the provider uh we also are looking forward to our office Market statistics update because office has changed in the past year and we need to know where that's heading and then finally uh you will be seeing Udo amendments many of those coming out of the red tape committee we are still in our current planning division trying to hire two supervisors once we get them on board our hope is to break down the Udo into sections so that we are continually looking ahead on what we can change to be more efficient versus always reacting um I'd like to open it up I think we'll leave it here uh Crystal on this slide if there's questions on any of the past suggestions or questions on what we have going for forward so that we can make this a very productive committee or continue to maintain it as a productive committee chair Bergen yes go ahead I'm sorry I'm having problems with my video it was sound and now it's video um just a question Janine um I know that last year and I just wanted to know underneath project updates underneath the economic development strategy I know I had requested the future of development and growth you know as it pertains I think we were looking at maybe 50 to 100 years and so I just wanted to see if that is going to be part of the conversation too as things change that could change the projection of how we're looking at things in the future and that is something that I did bring up but it wasn't mentioned um so and that includes a lot of things the grid which was which I was very concerned about with transportation and I know that's kind of the transportation committee but it also has a lot to impact with how we're dealing with growth um so I don't see that mentioned in here that was something that I had requested and I hope that it's part of one of these conversations in ped this year if the chair would allow and absolutely I should mention that one of the big projects in partnership with planning and economic development and Public Works is a multi-modal transportation system plan we have received a grant for that and that is going to look out at least 20 years and look at all modes so that we are planning for the future and hopefully laying the groundwork for plans for all ages I know that is a huge concern for you but all modes of transportation not just the single occupancy vehicle okay and I hope you start a chair Bergen can I just follow um so that's great to know I I just don't really see it kind of emphasized in here so to me it's important um and so I'm hoping that it could be in one of these sections I just don't really see it as what you explained so that's one thing and then another thing that I wanted to ask is there any way that we can get a real update on these grants for the businesses I've heard many complaints and I know I've heard from at least five businesses um regarding the time frame to get the business grant and a lot of individuals that I've talked to business owners they basically said it say that they filed for the business grant in July and they're they call every probably every month and they're saying oh it's going to be delayed it's going to be delayed in fact one business business owner thinks we should get the The Firm that we hired audited because they feel like there's some issues with that so I I just would like to maybe have more of an update on that why it has taken so long for businesses to get these grants who have applied for them in July and they continue to get delayed is that under sbdc um lose grants well I think we've had a number of different business grants we've had the Safety and Security Grant we've had some of the other business grants and so uh if councilmember Lawson's okay the arpa grants that we set aside funding for businesses um so this is the arpa ones not not from cares this is the arpa dollars ones that we said you see Andrea's hand up so I think Andrea may have some updates but uh absolutely something we can look into and get you all the status on but that includes the security one is that right no those are two different ones and I think what she's asking about is specifically the arpa business grants not the Safety and Security grants that's what I just heard and I think Andrea has her hand up so if Andrea you have any updates but then yes I can give an update really briefly um yes council member it is taking a little bit longer what we have found is we are doing individual reviews of every single application that has come in there were over 300 applications that came in in fact we went back to city council asking for more money because there were more than we could afford to give out with the original allocation of money that's not through the SD BDC this is a city program the sbdc is the state program so um this these grants we individually are reviewing the businesses and the problem we are finding as we review each individual one is that the information that was submitted with the application needs to be updated by the grantee to verify that they are eligible for the funds we have already given out more than half the money um and a lot of I think at this point we're at like a million five of the three million dollars that's been allocated and um we continue to press forward and do application review every single week and try to get it out as quickly but some of that is business following up when they're notified that they've been approved and making sure we have the information we could need to make the award and document the spending in case there's an audit thank you here uh so is there is a language issue on them not getting their application information it's a variety of it's a variety of problems like we need some people submitted for example their tax returns but they weren't signed right so they have to we have to send it back and say we need a signed copy of your filing um we have English and Spanish um speakers working with the clients both our staff our business staff as well as the um the consultant that we hired to help manage the applications so um and as I said um with over 300 applications they're checking everything that they have their business license they have their um good standing from the state their art and their tax filings for 2021. chair Bergen can I just um can I just say one more thing about this before we move forward I'm sorry if I'm taking up a lot of time um Andrea thank you so much for that update I think it would be important because of some of the complaints that I've heard just about the process in general even before you they even are getting what you're referring to I think that you should probably what the city should consider is sending out some type of survey or something to these businesses to get their issues that they had so when if we decide to do this again that we can maybe make the process a little bit more efficient so um because I have heard complaints about the process not just the time but just the process in general where you have to get another email address to even sign on the website isn't updated the website is hardly difficult to navigate so people can understand the instructions so these are some of the complaints that I'm hearing um so I just think it would be important to make the process a little bit more efficient to get more information from these businesses about what some of the pros and cons and the challenges that they have yeah council member if you wouldn't mind I'd like to sit down with you and make sure because um there were systemic issues in terms of the website that the consultant used to take the applications and things like that and I'd really like to hear the feedback that you've received so so that you're right we can we've done you know we had several Grant programs with cares money as well and each each iteration we've tried to do it better but we can always move to improve okay so YouTube will have a separate medium okay um I will um I'll send you an email and schedule some time with you okay thank you Andrea just a quick clarification councilmember Lawson and maybe um you know somebody from staff the multimodal transportation plan so it's going through the Taps committee and then does it go to study session or or are you looking for more um not just what's going through Taps but a a different presentation I I wasn't clear we are just working on the scope of work for that we have not gone out with an RFP uh so Cindy and I and our teams will coordinate and we can come back and and give an update of how that will look at the very least we will be bringing information here um and there may be some questions we have for the committee as well and this will be probably a several year council member sunberg and Lawson if I can interject before they chime in that we would pick a room where we could do a hybrid version at the city so that those who can't make it will and we do have better facilities at the City versus when we try to go out in the community councilmember Lawson and sunberg do you have any uh thoughts on on on that having it one of them or two of them in person um I don't have a problem with that I mean if they want to if you want to have a couple of them in person that would be great but if they also want to have it hybrid that's also a good thing as well yeah uh this this remote thing is convenient but be good to see everyone's smiling face in person once or twice a year yeah I mean that was the thought behind that from from me and from my perspective was and we could you know those that can't make it could still do hybrid but um you know it's a different feel when you're together and I just think it'd be nice um to see see us um at least a couple times a year so we'll try to work that out then okay very good um all right well we'll move on to the next topic which is the top code enforcements uh violations is that Sandra are you presenting yes go ahead and share then and I've already given you sharing privileges thank you thank you here we go are we seeing it not yet is it there yet no share our content is it there no yeah no no well let me do Crystal it is in backup can you share from there I'm pulling it now as we speak oh thank you I'm not sure why this isn't working is that working is it there now no no okay this is so weird let me close out okay maybe just go ahead with the presentation while she pulls that up okay um thank you let me well I close my PowerPoint okay there's Jessica okay so um so in in uh uh November there we go we've got it up Sandra perfect thank you um in uh next so these are just uh so this is Code Enforcement uh in November uh 2022 council member jorinski asked for some additional information on that top 10 code violations over the last five years for Aurora businesses and additionally she requested some information on fines assessed to Aurora businesses can you go to the next slide please uh so in this presentation the short presentation I'm going to talk about the top 10 code violations break down the abatement costs that occurred with businesses who do not come into compliance and I broke that out by from 2018 to 2022 and then just a few examples of enforcement violations that we're enforcing um when we're out there in the field enforcing the Udo next slide so the top 10 in ranking order weeds trash and debris when we're dealing with business as well as uh graffiti outdoor storage which is items that would be shouldn't be normally outside for example couches um washer dryers those kinds of things refrigerators that may be left out are unlawful vehicles on the property which would be vehicles that aren't licensed properly or that have been damaged and are sitting on in the parking lot for an extensive period of time we do site plan enforcement which is where we take a look at the site plan for that particular property and we enforce different things within the site plan for example a parking lot parking lot striping handicap signage trash enclosures Landscaping which I have some photos of as well again we do the next one would be parking surface maintenance which you'll see some photographs of where some of the businesses or Property Owners aren't taking care of the parking lot where we have these huge potholes and then we have cars driving through and then hitting the potholes signage which would be banners window signage requirements square footage of the signs that are in the Udo and the time frames that are allowed according to the Udo and then the Landscaping Maintenance was the seventh highest one where we're dealing with maintenance of the landscaping and the site plan the dead trees removal of those kinds of things also we deal with fences within the area if they're damaged or if they're there the improper type of fence and then also snow removal we get complaints on snow removal those are the top 10 in ranking order next slide I broke it out by the last five years and you can see in 2018 we did 41 abatements from businesses and our large Property Owners those might be those in 2019 we did 51 abatements and the dollar amount is there in 2020 we did 88 abatements 2021 57 abatements and 2022 35 year to date is in November and those average uh between you know 700 and 800 per business and that does include the abatement fees that are attached to those and the abatements Really center around um uh mowing weeds trash and debris removal if they're not taking care of their trash enclosure and it's overflowing we may go ahead and Abate those items there and this is after we have given you know the notice and extensive amount of time to come into compliance with the request next slide so these are just some examples just a few examples for um on the left there you can see the weeds that are growing and haven't been maintained in the bottom we went and invaded it updated the property we had it cleaned up by our city contractor so that's the before and after picture of that property and you can see the difference that it makes next slide here you can see some different maintenance and outdoor storage and trash interview that we're dealing with so for example outside of this particular business they've thrown a couch out and it looks like they've thrown some other items out uh the fence on the photo on the right is damaged and is is falling inside uh you can see the parking lot maintenance is not being maintained within that particular parking lot next slide again this one on the left is Landscaping so they've cut the tree down but on the site plan it designates they're supposed to be a tree planted there so we would issue the notice to replant the tree and bring it into compliance the one on the right for me is a dead tree that's been sitting there hasn't been taken care of and again the bottom photograph is of a parking parking lot in the curb and gutters not being taken care of with that in that parking lot and we're also missing Landscaping within that designated area next slide uh trash can and trash enclosures so here we have some trash can enclosures that actually are damaged and uh items can be seen from the the alley or the street and um so when those trash can enclosures are completed it's actually keeping the uh the trash and debris from the visibility of the adjoining streets or the adjoining properties in the neighborhood next slide uh this is a this is a actually a trash can enclosure and you can see when everything's put back in place and it's being maintained you don't see any of that trash there's no visibility of trash and debris or overflowing items within the property much better uh view for anybody driving through a better view for um how the city looks next slide we also do sign maintenance so this is a sign over there off of um it's actually Abilene and um a Blackhawk area where the sign needs to be maintained make sure the lights are all working that it's not damaged or deteriorated and the one on the right is the same thing they're responsible for maintaining the sidewalk along the street make sure the the the grass and the weeds or whatever are are removed from the sidewalk and move back for so people have the ability to walk on the sidewalk next slide this is an example of our parking lot maintenance that we've talked about so here you see there's the huge hole and people are driving through the hole we take measurements of the um the depth and the length of the hole for our enforcement process as well as the other one on the right hand side is the same thing people are the parking lot maintenance next slide uh this is the park a picture of parking lot striping so it's important that striping is there the handicap slots are designated correctly and that the signage on which way to go is important in some of these parking lots as well so we make sure that the striping is in place and um and visible if it's not we would issue a notice to go ahead and restripe the parking lot next slide enforcement on Windows signage so the ordinance does require uh no more than 50 window scientists per window pane so this is what we'd be enforcing here we have windows that are completely covered in signage it's difficult to see in um kind of really overwhelming for anybody walking by next slide we also do banners and signage so the one on the left is a banner which is out but we if they're out and posted they need to be me excuse me be maintained properly that they're not flapping and they're in good shape and the one on the bottom is actually square footage is permitted per business um and make sure they're maintained as well next slide uh ground signs are what we also enforce this is an older picture obviously but sometimes we have a lot of these ground signs on one corner so we talk about the location and the length of time they're out and the condition they're in as well next slide uh graffiti so here we have examples of graffiti that is one of our our top ten um so we would issue a notice to the business owner to take care of the graffiti different areas next slide here's an example of before and after this is a property up on East Colfax so you can see the graffiti on top of the building and then it's been removed the one on the right next slide and those are all just the brief pictures and a brief presentation of the top 10 and Associated costs thank you for the presentation we'll open it up for questions council member sunberg well I know this was council member jorinsky's item so maybe um I'll open it up to her first um just if you want to say anything before we open it up for questions with the other council members I mean I don't know how you want to do it uh hereberg and I have a lot to say um and I actually would like to go back to the first slide and I want to clarify also I didn't ask just for the top ten I asked for every single code violation that would affect uh businesses I asked for every single one of them I did want to know what the top 10 in being used were but ask for every single one that could potentially affect the businesses but I have I have a lot to say and this presentation just saddened me more than any presentation I've seen thus far being on Council so chair Burger you can tell me where we would like how you would like me to proceed okay well let's okay why don't we go ahead and go with questions first and then we'll come back is that okay can I just insert uh that actually we can't hear you council member drinski very well for some reason when it comes to when it comes to your timing them Okay so questions from council member Law Center Sundberg not yet for Megan not yet for me either just yet okay so I I have I have a couple um first of all on um on the graffiti um so the business I mean I get it they have to to clean up the graffiti do we um if we ever catch the person that has done the graffiti um are they required to I don't know community service are they required or to remove it well if if we were able to issue a summons they would go to court and the judge would we would process it through the court system okay and that's quite rare that they're caught it's very difficult to uh catch anybody doing graffiti correct okay and then on the um oh I I here was my other question on what kind of notice is given you said you know they're they're given a notice first before um before they would be fined and they're fine because we have to do the abatement is that correct so there's different so um with the trash and debris on a property we've given 10-day notice to the property owner of the business asking them to clean up the property at that point in time so they've been getting noticed at that point in time we would reinspect um and then if it's not completed we would complete a city abatement on the property and get it cleaned up okay there's other notices if we're doing site plan enforcement uh where we're talking about striping we're talking about Landscaping depending on what the issue it could be a 30 or 45 or 60 day notice to come into compliance I understand the fact that you can't get Landscaping planted in two weeks or 30 days we understand that you can't get trees planted that's required on a site plan we understand that the parking lot if it's damaged we understand that it does take time to get those things completed which we give them time it gets to the if it gets to the point where they're just not doing anything then we will issue a summons to court and they can go to court and talk to the judge okay so like a pothole I mean I and I that actually drives me crazy going through shopping centers with big huge potholes sure um but obviously they have to get that lined up to get somebody to come out and fill it and so forth so it's not necessarily just the 10 days uncertain no it would be a 30 45 day and then we will work with those Property Owners or the businesses in order to bring them into compliance if we know they're moving forward trying to get it you know construction people are trying to get those parking lot votes to come in and take care of things we're working with them and then uh thirdly are are these mostly complaint driven or is it you know code enforcement we do both complaint driven as well as proactive I've asked my code officer to do site plan inspections because that those site plans are what the people are seeing when they're driving down 225 they're seeing properties along 225 of what's presenting the city what are they seeing that's presented by the city so we do both proactive and complaint and do this do these kind of I mean some of them are obviously very much business related but other ones like weeds and trash and so forth I mean those apply to residential um homes as well or right so yes so the weeds trash and debris we enforce with residential as well as in uh the business side of things and the complexes yes okay thank you all right um council member jerinski do you want the first slide or the second slide council member jurinsky okay yeah we can't hear you very well I turned my volume up too wait can we go to the next slide this one has the top 10 on it yeah so so something that and I'm just gonna try and talk as loud as possible because I don't know what is going I mean I always seem to have audio issues so um I on here when we're talking about parking surfaces and maintenance when we're talking about graffiti when we're talking about um Landscaping are you guys are you guys aware of every property owner in town are you guys aware of the landlords because when you guys are coming after the businesses for this businesses are usually responsible for what's within their four walls so this would be the property owners this would be the property owners so how do you go after the property owners on that we researched through the uh the assessor's office and contact them that way we have our ways to contact people we use the water billing if there's information if we're having tracking down for having trouble tracking down a property owner so we can go through the assessor's office we have different ways to contact the business the parking lot let's say the property owner so yes there is a difference between the property owner as well as businesses interesting because uh I I received a notice of violations that would have actually been on the property owner so nobody took the time to to research that so I hear what you're saying that in theory you guys do but I know for a fact uh from myself firsthand and other business owners in town that that's not true that in fact responsibility of the landlord responsibility of property owners you guys are putting on small businesses you guys are putting on business owners in town so I know that to be a fact first and foremost second of all uh the graffiti and when we talk about trash these are the other things that are mounting on small businesses um in Aurora we all know that our crime rate is out of control I have pulled up to some of my businesses and I have a couch sticking out of my dumpster I I pulled up one day I had seven mattresses stacked up in my back parking lot so you you you pile all of this on these businesses you pile all of this on businesses and you start writing violations for for mattresses and and couches and then you want to add graffiti and and all these things uh snow removal also would be on the property owner not the business owner but but but this compounds this compounds right here and in a city where we can't control our crime rate right now and all of these things I got graffiti everywhere I got graffiti everywhere so I think I think we need to talk about changing some of these things and how we address these with the businesses and and until we can clean up our own house in the city uh I have a hard time with some of these but we can move on to the next slide so these abatements when you're talking about abatements you're talking about when you have to go out and and and uh the city has to clean up graffiti or the city has to take care of weeds is that what you're talking about yes okay can we go to the next slide uh then the next slide so this is what I'm talking about this is what I'm talking about here and this is all over the city this is all over the city so I don't know if as a city we need to look at uh something a dump site something to take this off the backs of small business owners because I can tell you the cost what I've had to pay what I had to pay to have the seven mattresses removed to have the couch I have to pay that and then if there to be a fine uh from code enforcement on top of that and with these trash companies this isn't something that happens overnight you have to you have to schedule it with them and we all recently saw the debacle with Waste Management it doesn't always happen uh quickly so yeah there are times business owners have couches and mattresses and things like this furniture sitting in our parking lots to no fault of our own to no fault of our own and at some point this has to be taken off the backs of the businesses next slide please um I mean I guess my issue with with this slide you you look at this curve I mean you you're gonna go violate a business for this little chunk of cement curb missing on the butt this is what the entire city of Aurora looks like so I would ask who's policing the government then who's writing violations to the government if we're going after businesses for something like that and that's the city's picture not mine next slide in again with the trash my point with the trash next slide next slide this this slide upsets me so much this is two restaurants that no longer even exist in this city both have gone out of business both and maybe if we didn't have code enforcement harassing our businesses you know if you see if you see a burnt down sign and two restaurants an ant coming out of covet maybe we need to have an outreach program maybe we need to have a business oversight committee that is going in and talking to these businesses hey I noticed you have some weeds hey I noticed your sign is in great shape we're here the city's a partner are you guys doing okay is there anything that we can do because because now that that's uh that picture neither restaurant is in existence neither so we have vacancies so instead of worrying about a sign that looks like this and I don't even know how how bad that looks now we have now we have vacancies this sign is this slide is very upsetting to me very upsetting to me next slide again with the potholes you're going after the businesses you you're saying you oh we researched property records and and this and that code enforcement reaches proper but but you talk about the businesses you talk about the businesses so all parking lot maintenance I mean when you're talking about strip malls and and stuff like this uh this is on this is on the property owners not the business owners this is on the property owners and again until government gets their Affairs in order now I know council members the Monarch just came up with a plan to to take care of our very much our backlogged uh property issues but you mean to tell me we're finding somebody over a pothole or a pothole like this when we've got gaping holes that are blowing out tires in the city and this is how we're treating our businesses next slide next slide so with these signs with these signs I have recently talked to some business owners and and sometimes signage in Windows is also for security it's also for security blinds can get very expensive and with the recent ATM thefts and everything again because we don't have our house in order uh with all the crime um in Aurora sometimes this signage is also for security purposes and can be for security purposes and at the end of the day it's for overall marketing so so this business about Windows signage is I mean I don't know what type of business this is I can't it looks like it may be a convenience store or something like that but there's a lot to advertise and I'll tell you the biggest downfall for for businesses especially small businesses that this is the only you know budget that they have for marketing and stuff like that is putting signage in their window we need to rethink this next slide oh banners Banners are used for for everything so I want to know what these banners was this the same thing as the Penance that we have to apply for a permit no so you don't have to apply for a permit so anybody can put up a banner at any time is there a time requirement or the time there's a Time requirement a size requirement and they have to be maintained I like the maintained part and what is the time requirement well I I'd have to double check that really quickly for you um my guess is it's probably the 30 days which is what the pennants were um let me look I also remember jorinsky do you have a lot more on this I have every single slide I have something to say that's why I was hoping to get this on the agenda while I was still the chair uh but but I I guess my my uh question is I mean we're getting um no pun intended into the weeds but um Can can there be I mean do you have excuse me I'm losing my voice do you have suggestions on because some of I I understand some of your concerns about property owner versus the business and then also you know obviously people dump they're dumping Furniture in a business's um receptacle and and it it then we can't find the person so we can't can't go after them it uh is there are there maybe I should ask this to staff do you try to work with the business like for example if the business says hey I'm not I'm not the owner of the the parking lot or I'm not the owner do you I mean you don't find them right right no if we have a property owner which councilmembergerinski is talking about then we will address it with the property owner we have different businesses within a parking area right so we look at each individual address and we address if that's an individual address with an individual owner that's who we would issue the notice to if it's a large parking area parking you know shopping area and it belongs to the the issues belong to the parking the property owner for example the parking lot the striping the potholes we'll give that to the property owner okay the businesses for example with their signage in their Windows those kinds of things specifically to their business so I guess I'm looking for you know what areas can we I I get what you're saying like you know businesses are struggling and so forth but we also want to keep our city looking clean because we we expect that of our our residents and their their homes and so forth so I'm just trying to figure out is there a way to um I don't know if it's we just want to have better communication when an incident happens so that we do understand the business if they're you know if they have a challenge that we have some leniency and give them some extra time I know we have these grants that we offer sometimes to businesses and for example when you um mention the um signage on the windows and maybe they need blinds or whatever would they be eligible for the security grants does that fall into that category so I'm just looking at how how can we take care of our businesses show them that we care but then also make sure that we don't that we have our city looking you know nice and that we also don't have a I mean these are a lot of them are complaint driven so what do you tell the the resident that filed the complaint you know we're not going to do anything about it I guess I'm just those are my questions so when we are issuing a notice we go in and contact the business owner and talk about the notice what it's for what it's about and let them know they have X amount of time and then we have a conversation with them give them a sign brochure possibly depending on what else is going on in the property our sign enforcement brochure and talk about and give try to educate them on what the sign ordinances are within the Udo so we're we're enforced in the unified development ordinance we are the enforcement factor of that so if they give us an explanation of what's going on we will work with them on time obviously it's not like we you know we have time frames for them to come in compliance for example some band we have banners that can't be in excess of a 200 square feet so let's take a look at the banner you can't you know this is permitted or not permitted and x amount of time to come into compliance I also just wanted to add as well on the obviously it is burdensome on uh properties when there is dumping it's similar to when we have um homeless encampment sometimes where it's not their fault it's just happened and so we try to be really empathetic with them we'll also take a look at the property um and say you know make sure you have the proper signage up and is there any better lighting we can provide um to that Safety and Security sometimes cameras will help deter um we have this situation all over the city where this happens sometimes they're vacant pieces of property sometimes they're used properties and things like this get dumped so we try to work with them and also you know walk the property with them and try to offer suggestions um but we do right now like our current abatement ordinance is only on public property so the private property is all handled through code enforcement when it comes to sort of The Dumping or other issues that are not obviously their own they just they just happen and understand that's super frustrating for people we've had a vacant lot further out east where it's just like a Dumping Ground and they keep getting hit and so we've been trying to work with them um and we've um we've we've come to some conclusions on what could help just from sort of that environmental aspect of what you can do to to work on your property can I please understand what the length of time is for a banner to be up uh so you're allowed for uh six events of let me look because there's all different ones so the temporary Fabric or wall sign uh 15 calendar days up to six times per year so 90 days and those so typically like if it's a St Patrick's Day holiday Christmas holiday type of thing Fourth of July is that the intent I guess I'm a party I I guess I'm not understanding your question your question when you're saying you said uh the thick I thought you said six events a year or six so we call it events so it's nine days and then you can have six different events for up to 90 days so you can have it up six nine days I'm sorry nine days and then you can take it down and then you'll have another event of nine days and you can take it down or you can just do the whole entire time at one time frame what are you looking for in terms of resolution I'm I'm going to bring all that forward councilmember Bergen I'm going to bring all of that forward uh but can I just can we go to the next slide I mean this picture is just so funny because it has re-elect Brad Pierce how old are you old are your pictures next I was I was I was pulling older pictures for the presentation so excellent again the graffiti we are getting destroyed our businesses are getting destroyed we are getting covered in graffiti and and um you know with the lack of police and our crime rate and everything else going on I I I I would be very upset to find out that one code violation was written to any business about graffiti next slide same same next slide okay put on the graffiti on the graffiti we certainly don't want graffiti all over our city no we don't no we don't but but to put that burden on on small businesses when we're literally getting destroyed I mean we there's no car there's barely any cops we we have we have below critical Staffing levels of police and and and we come up my dumpsters covered in graffiti I've got my back door is covered in everything's covered in graffiti right and this keeps happening over and over and over and I'm not saying that it doesn't need to be cleaned up it needs to be cleaned up but if this burden is solely on the businesses and you want to top on couches and mattresses and and then yell at them about banners and and everything else oh I have a problem with it okay so at this point I don't know staff if if you have do we have any programs that do help businesses in like on the graffiti for example I don't know if other cities do or how they handle it our graffiti team handles uh graffiti on uh private prop uh with residents residential graffiti but nothing for the businesses we do not do anything for the businesses but that might be something to look at yeah I uh chair Bergen I I'm gonna bring forward a whole bunch of stuff regarding this so it's not that I needed answers or needed anything to be solved right now I wanted this all publicly stated how our businesses um are treated and point out that one sign one one slide that they used neither business is even in existence okay um and just council member drinsky we were trying to not use examples of current businesses or current violations just to protect the businesses so that was part of the intention there was to use some older pictures not exactly current uh cases that we have just to be mindful of that I understand that that further proves that government overreach helps Drive businesses out of business you're a Bergen yes um so council member turansky understand your concerns of I mean maybe you could bring up something that we could do a pot of money for these businesses to kind of help with these issues um you know we're having a workshop coming up and that might be something for your consideration I know you have other things but I'm just bringing that up all right yeah I appreciate that a lot I agree and I appreciate that okay very good well thank you and we'll go ahead and um move on in the meeting and the next item are the miscellaneous matters I don't see reports um I know we have oil and gas was in the backup um Brad do you want to um do you want to say anything or or is your report sufficient yeah sorry I had to turn on my camera yeah just real briefly so the report's in your backup what I do is that as chair of the oil and gas advisory committee um at the end of every quarter summarize our activities of the previous quarter submit that report that was in your packet today and I'll do that ongoing you know for the new members of the committee and so if we just want to let you know how I work it with the uh trying to get my quarterly great day thank you chance okay any anybody else ever I've showed no reports but I just want to give an opportunity if there was anyone from any of the other um uh committees that wanted to give a report aedc or anybody yes council member Bergen may I speak Marcia mcgilly from the Small Business Center I wanted to give a little bit more detail about our computer giveaway program we were asked to partner with um human-it or humanity and visa to do a digital empowerment program it was geared for small businesses and entrepreneurs and adult Learners they uh gave us 92 uh refurbished Chromebooks laptops and we were able to offer those to clients who have had sbdc Consulting with us and done some of our adult learning uh webinars or or workshops we we targeted it towards those that took the Child Care Program and Spanish language programming of the 92 we've already we have 67 allocated to individuals if they don't all come by Friday we will offer it again to the next sort of group of clients next week but we will be giving all of those out by the end of January and we just wanted to let you know that it was a digital empowerment program and that the clients have been very happy to be getting free refurbished computers thank you for your time thank you okay anyone else okay well I want to thank everyone for being on the meeting and uh does anyone have the date for the
