Well, good afternoon y'all. Thank you for your patience. Um, city council will now hold an executive session today for the purpose of consulting with the city staff regarding pending or contemplated litigation or settlement agreement and to hold consultation with attorney under section 551.071 of the Texas Government Code. Okay, we'll now go do that. Good afternoon everybody. I now open the regular city council meeting of the LC city council for June 10th, 2025. The city council will now re I'm sorry, we are not in executive session. We are actually opening. Sorry, got a little bit off there. The city council is now re reconvening. That is an open session and we're going to take up ceremonial items. I call on Tim Collins. We have now appointed him as our pastor today and he's going to lead us in our invocation followed by uh Councilman Harris who will lead us in the US and Texas pledge of allegiance. Will you please stand? If you would bow with me, please. Heavenly Father, we come to you today. We are so thankful. We are thankful for the men and women who sit on this das who who give of their time and efforts to serve our community. Father, we're thankful for the 2500 plus men and women who are our staff who do nothing but work for the betterment of our community. Father, we're thankful for the citizens who live in our city. We're thankful that we all come together and we work to be better for each other and make a better place for us all to live, Father. But mostly, we're thankful that you're here with us. You are with us today. You are with us every day. You give us guidance. You give us wisdom. You give us discernment. and we thank you for that. We pray that you would be with us during this meeting. Help us to do and make good decisions that are in the best interest for everyone. It's in your son's name we pray. Amen. Amen. I aliance to the Texas one state one and indivisible. Thank you. [Music] As you can see, we're a few council members short today, but we're still very functional. And so with that, we will now call the meeting to order and take up citizens co comments, which there are none today. But according to the public city council rules, any citizen wishing to appear in person before regular meeting of the city council regarding any matter on posted on the city council agenda shall complete the sign up form and they have three minutes to make their comments and a warning bell will sound. But again, we do not have any comments today. So, we're going to go ahead and move on to the minutes. And we now take up agenda item 4.1, the minutes for the May 13, 2025 regular city council meeting. Is there a a motion to approve 4.1? Motion by Councilman Glashin. Second. Second by Councilman Harris. All those in favor say I. I. All oppose, same sign. The motion to approve carries on a unanimous vote. And we now move on to the consent agenda. Items to be pardon me. We will now take up item five that is of the consent agenda. There have been no requests to pull any items from the consent agenda. So I will entertain a motion to approve the consent agenda as presented. Is there a motion? Motion by Councilman Glashin. May I have a second? Second by Councilman Collins. All those in favor say I. I. All oppose, same sign. The motion to approve carries on a unanimous vote. And we will now move to our regular agenda. And the council will take up regular agenda and start with item 6.1. And then I'll call um well, there she is, Kristen Sager, to provide a briefing on this item. Thank you, Kristen. Good afternoon, Mayor and Council. This is a resolution request to vary the required separation for a property seeking to obtain a TABC license. This is for Pub 55 to locate at 313534th Street. They are within 300 ft of Mrs. O's Daycare at Tech. The permits they are requesting are mixed beverage and mixed beverage late hours. On this property at 3135, the location Pub 55 is requesting to locate in. In 2019, Woody's Brick Oven Pizza and Grill received a variance to the separation requirement for a wine and beer retail dealers permit. Next door at 3131. In 2022, Visos's African Bar and Restaurant received a variance for a mixed beverage wine and beer retailers and retail deal dealers on li on on premise late hours permit at their location. And then in 2022 at 3121, Frost Brew House also received approval for a variance to have a wine and beer retailers and brew pub license on this property. And I'd be pleased to answer any questions. Okay. Do we have any questions? If not, let me entertain a motion. You do have a question. Sorry, Tim. Miss Sager, do we know when the um daycare center was opened? Um I do not, but it was prior to 2019 because all three of these businesses required the separation variance. Thank you. Okay, Councilman Glashing. under the excuse me under the ordinance what is the standard uh for when a variance is uh uh the the elements that need to be met to approve a variance? So the what are the requirements the council has to consider when approving a variance? The the council has wide discretion when looking at these variances. Um, typically you're looking at health, safety, and welfare of the community and especially whether or not the um hospital, church, school, or daycare is in objection to it. We have not received any response from Mrs. O's, they were notified of this of this request. And Mr. Wade, if you have anything to add. Um, I thought that there were some additional considerations like uh hardship or or other elements. Am I wrong about that? So this is a little bit different than a variance that you would get from zoning, right? A variance from zoning. It has specific criteria that it can't be impose a financial hardship. It that it can't be based on a financial hardship. Has to be something unique about the property itself. Can't be self-imposed. This is a variance from a distance requirement. Once you're within that distance of 300 ft and if you want to take the variance from the distance requirement, that's when you have to. So, the same term variance, different criteria for those two different types of things. I see. Thank you. Thank you, Kristen. I have one more question. Do we have any representatives um from the proposed application? Yep. Okay. Wonderful. And can I ask him some questions? Just a real quick question. I just want to know if you communicated with uh Mrs. those or any of the folks in the area. And you can come up to the mic, please. Uh, we typed a letter to Mrs. O. Did you get a response? Uh my other question is and and I'm didn't go by. Are are these three locations uh still in operation? Woody's of course is not because that's where Pep 55 will locate. Visas is Frost I I don't believe they still are. They aren't. Okay. And that's more um hardship related I believe for the others. Okay.
