The first one is um, from the Minnesota Employment Economic Development Department regarding uh, the Essential Wellness Center grant. Um, that grant has been uh, paid in full to us. Um, they will do some additional checking um, next summer and I imagine that we'll have some additional paperwork that we'll need to fill out and to document expenses and things like that, but that's for your information. The second one is from uh, Director of Finance and Administration Kevin Orme. This is just an update on our CARES report and the items that we have submitted to the state. We have until November 15th to spend the [1:56] money for un-CARES money and the rest of that will go back to the county. That's it.

This includes all of the assessed parcels including these deferrals which will then—they'll only have the deferral payment that they'll make if they're approved. And then finally, there are two parties that objected. Um, they will have their objection hearing next week on November 9th, and then we will take action on those two items on the 16th. So this is kind of the final action that the Council needs to take on this road improvement assessment process.

There's a process that we follow um, where they need to apply and provide certain data in to us. Um, we review that, and in each case, these four applicants uh, met the criteria under our policy. So they will um, be set—if approved—they will have to pay the average interest until such time that they do not meet those criteria, and then [7:48] the assessment will have to be paid in full.

**Eric Johnson (Community Development Director):** Great. Thank you very much, Mr. Mayor and members of the Council. Tonight before us is a final Planned Unit Development for a 26 single-family unit lot development on 8.7 acres. The property is located in an R3 zoning district. This property is located at the north portion of the existing Engwalls development. Engwalls lies between Anderson Road and Hermantown Road; address is 4747 Hermantown Road. As I had mentioned, this is a redevelopment of the northern 8.7 acres; the existing Engwalls facility will continue to function as it exists currently today at the south part of the site.
[13:23] This project came before the Planning Commission as well as City Council last year for preliminary PUD. At that time, the project had a number of comments. The project before us this evening is substantially the same as what we had seen previously. The only change is that the ponding for the project, which originally had been proposed on the east side of the property, is now located on the south portion of the property. This actually is a better scenario where it's able to collect all the storm water from the site into one central location and keep it on the south part of the site and away from Keene Creek.
[14:10] This project was heard in October for the Planning and Zoning Commission. At that time, there were approximately 10 residents in attendance. Some comments that were received at Planning and Zoning were concerned about the traffic conditions along Anderson Road as well as the ability of the city to permit smaller lot sizes in an R3 zoning, as well as a relationship of this project to other single-family homes and lastly, potential environmental issues associated with Keene Creek. Planning and Zoning did recommend unanimously to move the project onto the City Council.
This project this evening is 26 lots. These lot sizes are approximately 4,000 [14:56] square feet in size. This type of development is generally known as a "New Urbanism" in the fact that it utilizes shared green space throughout the development. This project would utilize a central north-south public roadway which would provide access onto Anderson Road and have a temporary turnaround at the south part of that. The properties then would take access off of private alleyways that run east-west on the property. These private alleyways are approximately 24 feet in width; they'll be maintained by the HOA associated with this development as far as maintenance, snow removal, etc.
The public right-of-way which runs north-south, that is going to be on a 60-foot roadway [15:43] easement that will be maintained by the city, but it will be built by the developer and built to city standards. That 60-foot roadway easement is a different dimension than we typically have—the city typically has a 66-foot right-of-way easement—but in this case, there's an underlying 60-foot sanitary sewer easement that exists. It makes sense at least from the staff standpoint that the roadway mirrors that easement as it exists today.
Some other aspects associated with this project: as I mentioned, these are approximately 4,000 square foot lots; each lot has the ability to front onto some common green space. They're upwards of 10 to 12,000 square feet in size; [16:30] these green spaces typically run east-west on the property with a number of these homes fronting on that. Also, the city's Munger Trail spur is located on the east side of the site which provides access to the greater trail system that the city is currently constructing. The project proposes an internal sidewalk system that homeowners can access by way of this common green to be able to move onto our trail system as well as onto a public sidewalk located on that north-south roadway.
The applicant and the property owner have proposed a potential HOA and design covenants associated with this project. What they're envisioning is a unified type of development with similar housing styles, [17:16] setbacks, etc. They're once again looking at this New Urbanism type of design with the idea of front porches, homes fronting onto common green spaces, with driveways and garages being at the rear of the property being accessed by way of alleyways. As I had mentioned previously, the stormwater is going to be located on the south portion of this site. This project did receive the Technical Evaluation Panel approval as far as the wetlands go. All the utilities on the site will have public utilities; there will be easements on top of the utilities where they lie within the alleyways. The applicant is also proposing 12 off-street parking spaces throughout this development in [18:02] addition to that each individual lot will have two parking spaces associated with it.
As part of the city's process and the ordinance, PUD or Planned Unit Development is allowed within an R3 zoning district. The city's zoning regulations govern the PUDs and require that each receive a preliminary and final approval. As part of the PUD, the city is able to work with different design guidelines. In a typical R3 zoning, there's a minimum lot width of 100 feet; this project is proposing a 45-foot width. [18:47] Minimum front yard setbacks—this property is different in the fact that the front yards actually face onto the common green, so it's a little different than we traditionally see. The roadways for this are going to be in the rear yard of the property, so these homes will front onto the common greenway with anywhere from a 5 to 10-foot setback off that common greenway. Each greenway is approximately 40 or 50 feet in width. Lastly, the side yard setback would be a minimum of 6 feet with an aggregate of 14. [19:30] Under the R3 zoning we have a 10-foot and a 25-foot aggregate, so it'd be a smaller setback. Lastly, we're looking at a 30-foot minimum rear yard setback from the main structure. At this time, the applicant is looking at detached garages; if indeed some of these homes do come in with attached garages, the applicant would work with staff on the clarification on these setbacks. I do believe that the applicant is in the audience this evening as well if there's any questions.

**Councilor John Geissler:** Mr. Mayor, I have a quite a few questions, so I'm going to take my mask off. I did have some questions during the pre-agenda that I asked and Eric helped me out with that. I'm all in favor of this; I like the product being available for people like me that might be looking for a little bit of a downsize. Just a couple of concerns that I've heard from some other residents and neighbors:
So, the parking—understanding is two spaces. What if a person has [21:04] three cars? Are they supposed to park in one of those other little parking spurs? [Addressing the Mayor] Do you want the applicant to come up?
**Mayor Wayne Boucher:** Why don't you list the items that you have and then they can do a presentation. We can allow them comment when there's public discussion.
**Councilor John Geissler:** Okay. Parking—just about if the person has one or two vehicles. Fences—would you allow fences? Let's say they don't get along with their neighbor all of a sudden. What about sheds? [21:49] Eric mentioned a 45-foot minimum lot width. In my simple math, that gets us down to about a 31-foot wide home maybe. Speaking to tiny homes—are you expecting tiny homes there? And I guess a question that I would have for Eric is: does our current zoning on building a home still apply? Currently, we don't allow tiny homes on a lot now, correct?
**Eric Johnson (Community Development Director):** That is correct. We have a minimum of a 792 square feet and then we also have a minimum width [22:36] I believe of 14 feet.
**Councilor John Geissler:** So do those standards apply to this PUD?
**Eric Johnson (Community Development Director):** The PUD allows the city to set basically different requirements. The applicant’s initial thoughts were a minimum house size of 1500 square feet.
**Councilor John Geissler:** Okay, that'd be good. Yeah, so just address that tiny home situation, parking, fences, sheds, and tiny homes are my questions.
**Mayor Wayne Boucher:** [23:32] We'll move to Councilor Nelson for any questions.
**Councilor Gloria Nelson:** Those are all my questions as well as—are they allowing pets?
**Mayor Wayne Boucher:** Councilor Peterson, do you have any questions?
**Councilor Joe Peterson:** I'm good, thank you.
**Mayor Wayne Boucher:** And I have one question that maybe Mr. Johnson can answer. My concern is on the public roadway that's going to run north and south. Although the right-of-way is less than our standard right-of-way, is the roadway width still standard?
**Eric Johnson (Community Development Director):** That is correct. It will still be standard of a 28-foot width with curb and gutter on it. [24:17]
**Mayor Wayne Boucher:** Thank you. We are done with Council questions at this time. Before we move to public questions, I would invite the developer to take advantage of public discussion. If you would like to address any of those questions at the podium?
[25:13] **Luke Seidel (Developer, SAS Associates):** Thank you for that. I am Luke Seidel from SAS Associates, 219 West First Street, Duluth, Minnesota. Thank you guys for the opportunity to speak.
Parking spaces: if more than two, we're anticipating that you know, they would use the ancillary extra parking spaces. We'll probably work with an HOA to define term limits or time limits on those additional spaces. We understand there's no overnight parking in the winter for snow events and that type of thing.
Fences: [25:58] We would allow fencing, but not the typical eight-foot fencing you would see. Our intent is to have an HOA and an architectural review for all construction. We obviously don't want fences that are 10 feet high or 8 feet high in such a small tight-knit community.
Sheds: Sheds would be done through the architectural review committee as well. Probably not allowed because the sites are too small. [26:44]
Lot widths: 45 is the narrowest one, but they're typically around 50 feet. Some of them narrow down because of the curve in the road.
Tiny homes: No, that's not the intent. The intent is a full foundation, 12 to 1500 square foot home.
Pets: I don't see any reason why we would limit pets as long as they meet the city's requirements.
[27:30] The last question was the public road roadway, and I think we've already answered that. There was some question about the side yard setbacks and the aggregate; that comes back down to the architectural review. When we did a similar project in Breckenridge, Colorado, we used the architecture to slide one building to the west and the other to the east to create that space. We shifted some buildings north and south to allow more air movement and light.

[29:08] **Paul Johnson (Resident):** I would like to make a comment. My name is Paul Johnson, I'm at 3884 Anderson Road. Why does the city have Hermantown ordinances to satisfy developers' needs? I thought the ordinances are in place to protect the residents, wetlands, and in this case, Keene Creek. This project wants to change its setbacks from 150 feet to 50 feet from Keene Creek so they can add three more houses and four more garages. They also want to change the R3 single-family lot size from a half acre to about a third of an acre. It's just too congested to prevent contamination in Keene Creek, which people still fish in. [29:54] Why is it when you put a PUD on an R3 property, the city can change any ordinance which is there to protect our city, wetlands, and residents?
**Mayor Wayne Boucher:** Is that it, Mr. Johnson?
**Paul Johnson:** Yes, it is.
**Mayor Wayne Boucher:** Okay. Just one point on the Planned Unit Developments: PUDs are part of the city ordinance and are part of zoning. That's why there are public hearings associated with them to give the public a chance to comment. We are not violating or breaking any of our own regulations; it is part of our regulations to allow PUDs. Mr. Overom, is there anything else you could add to that?
**Steve Overom (City Attorney):** [30:41] No, I think that was well stated. Um, and uh, we've also looked at all of the provisions of the ordinances. I've reviewed the resolution and it was drafted totally in conformance with the provisions of the city's ordinance.

[33:01] **Eric Johnson (Community Development Director):** Thank you again, Mr. Mayor and Council members. This is a special use permit to grade, fill, and construct homes within the Shoreland zoning overlay associated with Keene Creek. On top of Keene Creek, there is a natural environment shoreland area which covers 300 feet on both sides of the ordinary high water level. This project is proposing to work within 3.72 acres of that shoreland area. Approximately 15 structures would be located within the shoreland area as well as the associated grading and filling for that.
As part of the process, the applicant will be required to work extensively with the city's engineer from a stormwater standpoint as well as protection of the existing [33:47] ground surface. The special use permit has stricter conditions when it comes to land disturbance; bare soil can only be left for a certain time period and the water needs to be directed away from the natural feature. Any side yard swales would be running towards that southerly storm water basin and not towards Keene Creek.
