just asked you bless our efforts this evening allow us to be exemplary examples for the citizens of greenwood as well as the city of greenwood employees continue to bless our leadership we thank you for all that you've done for us thank you for what you're doing and thank you for what we know you're going to do we just love you we praise you in jesus mighty name we pray amen of the united states of america and to the republic for which it stands one nation under god indivisible all right in accordance with the freedom of information act chapter 4 title 30 code laws of south carolina 1976. an agenda has been posted on the front door of city hall the notification of this meeting has been given to the news media looks like i can confirm we've got it for is that correct thank you all right what do we have up first uh first is approval consent event all right if you have reviewed the consent agenda i will entertain a promotion come on a second promotion by miss polls second by mr bass any further discussion regarding the consent agenda all right all in favor of approval of the consent agenda that motion appears unanimously with six votes all right uh first item on the agenda is public hearing to consider ordinance number 22-09 amending the city of greenwood's official zoning map by resigning a 0.38 acre portion of land located at 1414 calhoun road from medium density residential to general commercial the second reading public hearing this is the part the the triangular partial presbyterian surface it's located in ward 5. um this is calhoun running i've got to get my handy little pointer that trip showed me this is calhoun road here this is hospitality boulevard this is the movie theater parking lot this is the church and this is the this is the portion that needs to be rezoned is there anyone that wishes to speak in favor of proposed ordinance number 22-009 yes sir if you could just state your name for the record and and what name and address is that we need to i'm ed horn uh president here of greenwood county 104 line the purchaser of this property could not be here this evening so i'm speaking in on his behalf two locks known as the the official hospitality boulevard as many of you know this you've been in this area when you're ride by it looks like a nice open green area and it's been on the market for probably in excess of 10 years i'm sure and one of the problems with the two lots was that if you look toward the movie theater parking lot the depth in that area of the hospitality lot was over 90 feet so this kind of prohibited development of that property greenwood presbyterian church agreed to sell off this wedge-shaped piece of property filled basically almost doubled in depth next to the movie theater parking lot and this will allow development to take place on that property it's currently zone r3 everything around it is already zoned commercial with the reception of the greenville presbyterian church which is r3 and they're the sellers of the waste ship piece of property and they have no objection to it being resolved uh if you have any other questions i'll be glad to answer the best i can thank you and you said you're here on behalf of greenwood presbyterian no i'm here on behalf of the parkinson's purchaser green creek green creek uh 2022 llc anybody have any questions for mr horn let me see exactly what he's going to be putting on this property what time what he's putting on the property he is still kind of tumbling that over in his mind if you ever been to kindergarten restaurant he is he and his father own that restaurant they have i think uh maybe about two years left on that lease and i know they desire to have a drive up window uh especially you know what happened during covert and dinner a lot of restaurants had to disclose the doors and didn't do much business because they couldn't allow people to come into the restaurant they had to shut down so drive-up windows have become pretty important in today's climate so i know he's thinking of when they get out of that lease to build our own restaurant have a drop up window and he has to decide what else he'd like to do in a lot uh because it was two lots and he definitely wants to put more than just one improvement on to get a better rate of return i can tell you what won't will not go on because it's restricted by covenants in the deed uh those angles when they purchased their property and built their restaurant had covenants placed on that property that would not allow another fast food drive up window chicken to biscuit type restaurant and they named certain fast food restaurants and a lot mcdonald's and uh hardies and zaxby's and chick-fil-a and that sort of thing so it won't be a repeat of that that's for sure a lot of people in greenwood all say well it seems like every time we get a restaurant it's always something we already got uh but it won't be one of those i can tell you that much but what other thing he may be entertaining he has not decided upon that thank you thank you any other questions for mr horn thank you mr horn appreciate it is there anyone anyone else that wishes to speak in favor there or not all right now this is the second reading uh i'll entertain any motions unless you to approve a second any further discussion regarding ordinance number 22.009 [Music] all right all in favor of ordinance number 22-009 that motion carries unanimously to six months we have two public appearances on the agenda tonight first i'd like to recognize miss flicker from gleam's community services department for a quick presentation same here as mentioned and as you already know my name is jacquez cooker with wings i'm the assistant community services program director and may is community action month as i've said the number of years that i've been before you gleams is one of a thousand community action agencies across the country and i know it's easy to get kind of routine because i'm always up here like every year asking for a proclamation but i want to impress upon you that your support is very important um on the state level our state association colombia every year they seek to get a proclamation for communities to learn from the governor and with the efforts that i do here because i actually started doing this uh some years ago when it was former mayor well warren adams and just been doing this every year since it really just helps us because as a network it helps us to amplify our message of being a voice for opportunity the underlying theme of community action is that every individual or family they should have access to opportunities and president lyndon b johnson who was the one who actually declared the war on poverty in 1964 he said it best when he stated we must open the doors of opportunity but we must also equip our people to walk through those doors and that's why it's important to raise the awareness of the impact of community action where we believe in the power of partnership we identify the importance of engagement so that people not only just have a seat at the table but they're being heard we're listening to them they're becoming a part of the solution and having said all that i could just say my spill every year that i normally say to you but i just want to say that your support really does matter when we reach out for the proclamation and just to do this quick 30-second um commercial speaking of communication month blings will be having community action today on may the 20th which is on a friday um i sent the flyer and um hopefully we can get the word out a bit more because normally i'm here before you guys in may but we're just trying to get an early push but it is may the 20th i believe that's on a friday between the hours of 11 to 2. and this year normally due to the pandemic we would have it outside drive through style we're going to be having a piedmont tech at the james medford family event center and this is really going to give the community an option or a human opportunity to see the resources that are out there um a lot of people don't know about what gleam does they think that glenda's head started so we're more than head start um there are other agencies and partners out there we're hopefully going to have the food bank there um have a couple of employers there for those seeking job employment opportunities um have some senior options available even regarding with our youth housing services there as well so just try to see if we can just look at different aspects of the community and see how we can plant a seed or bring someone together that may not have known this particular service was out there this is really what this day is all about and i will say normally we do deliver food to our vendors or partners but since we're going to be having it in the house so to speak we're asking our community partners and vendors to come to us if you're not already there as an exhibitor i remember the last time when we did have communicating community action day um at the the broad community complex um you were able to read the mayor the proclamation from the mayor and it's really interesting seeing the public actually hear the support from the mayor's office so we may try to invite you guys to see if you make this swing by but other than that again it's pretty much just an information session for our community to see what's out there and also just to see about the work of community action so thank you well miss flipping thank you for what you do and and i'm certainly interested in the community action day i guess it's almost a month from now it sounds like it's a wide range of services and agencies that are going to be represented there something for everybody i guess and i know we we have you've got support and council we've got a board member from gleams uh here and so we're we're always very interested in what y'all are doing over there and grateful for for all your efforts so so thank you um and i will i'll go ahead and read this proclamation for community action month unless there's anything else you wanted to share with us no that's fine because i'm sure these people would love to hear well good it's always a good venue to share what what community action month is about so whereas community action puts a human face on poverty by advocating for limited income citizens without a voice so that they may enter the middle class and reach for the american dream replacing their despair with opportunity and whereas community action serves 99 of america's counties in rural suburban and urban communities connecting millions of children and families to approaches that help them succeed and whereas gleams human resources commission inc is the community action agency in greenwood county working to help communities in 15 counties including greenwood lawrence edgefield abbeville mccormick newberry and saluda by providing services and opportunities such as energy assistance emergency rental and mortgage assistance head start weatherization workforce development services and many others and whereas community action insists on community participation and involvement ensuring that all sectors of the community have a voice and will be heard and whereas community action changes people's lives embodies the spirit of hope improves communities and makes america a better place to live now therefore i brandon smith mayor of the city of greenwood do hereby proclaim may 2022 as community action month in recognition of the hard work and dedication of gleams human resources commission inc and all community action agencies i absolutely she's wearing flats thank you our second public appearance is uh our police chief tj shidowan he's going to present several awards to our two of our our officers all right good afternoon chief good afternoon sir thank you mr mayor ladies and gentlemen of council's honor to be here tonight to present these awards first of all if i could just ask captain matt kaufman and his family to come up yep the whole family that's right and i tell people often ask me why why i asked family to come up because if you've never been the uh the family of a police officer yeah you're fine if you've never been the family of a police officer then then it's kind of hard to understand a lot of times what you go through and uh and for that i've asked the families to come up and be with with matt during this time on may 21 2012 captain kaufman responded to an active domestic violence call where the person was armed with a handgun he got to the scene he was the only officer on scene ends up during this incident he actually gets struck in the chest by one round fired from a suspect the round actually hit him in the upper chest area captain kaufman was wearing body armor at the time of the incident which stopped the suspect's bullet preventing from him from receiving significant injury or death so before i go any further than that i just want to thank council because part of our budget is the approval for all of our officers to have body armor and because of your approved budget we're able to outfit all of our officers with body armor and there's no doubt in my mind that officer kaufman is here tonight getting this award because he was wearing his body armor the two awards for breach percentage tonight is the medal of valor its law enforcement's most prestigious award is presented to those select law enforcement officials who bravely placed their lives at risk to protect the citizens in the city of greenwood the purple heart presented to those law enforcement officers who receive or could have received severe life-threatening or deadly injuries caused by another sustained in the line of duty it is my honor and my privilege to present you matthew kaufman with the medal of valor and the purple heart [Applause] [Laughter] thank you [Applause] we appreciate y'all being here i remember certainly remember that day and prayers went out for everyone involved of course that day but knowing that one of our one of our team members was involved certainly certainly i know a lot of prayers went towards the kauffman family so thank you all for supporting uh captain goffman and and for everything and dr kaufman we appreciate all your we appreciate it too thank you sir all right if i could get uh officer dan carrell and his family come up please mr mayor ladies and gentlemen jury our ladies and gentlemen on march 8 2022 sergeant keller sergeant carver responded to um to a senior reference to a one-year-old child that was unresponsive and not breathing sergeant carter raleigh immediately started life-saving cpr on the child for several minutes until paramedics arrived on the scene the child was transported to greenville moore hospital for treatment it was determined that the child had a lethal dose of opium in her system dr siegler with the greenville moore hospital advised us that the cpr administered by sergeant carterelli not only saved the child's life but provide the option necessary to avoid any long-term medical complications our mission at the greenwood city police department is to serve to protect and most importantly to care sergeant dan carrey's actions not only saved the life of this one-year-old child because of the speed of those actions he prevented the long-term medical damage that could have been received from the lack of oxygen in the child the standards he represent are the standards of the greenwood city police department he did not hesitate to serve to protect and to care when i asked sergeant dan carelli about him receiving this award he said simple words were i did exactly what any other member of the greenwood police department would have done sergeant cartarelli it's my pleasure and honor to serve you to give you the life saving award for this incident [Applause] foreign [Applause] thank you and sergeant uh guard rally we appreciate all your efforts and keeping greenwood safe and my goodness that's uh that two-year-old will have you to thank for the rest of that child's life so uh and and and chief chido and i again i appreciate your idea of bringing family members up because it is it is certainly uh something that that they when they come home at night that they you know sometimes they take it with them so it's i appreciate you recognizing family members also thank you we're going to move on to new business so i was just going to offer this as an opportunity for anybody who didn't want to stay that you could leave sure oh yeah pass for collin it did pass okay [Music] [Music] good well public recognitions are always something that probably the the best part of the job i would say so now on to the morph morning but certainly important thank you it's amazing under a new business item number one is to consider ordinance number 22-01-0 amending the city of greenwood's zoning map by rezoning approximately 0.35 acres of acre portion of a 0.95 parcel of land located at 612 seaboard avenue from neighborhood commercial to r7 high density residential uh c draper is here so if you want to come on up if council has any questions this is located in ward 3. again the current zoning is neighborhood commercial i will point out that while the applicant has requested r7 planning commission is recommending approval of our m7 for this particular parcel planning commission that's right but where does staff come down on that staff's recommendation on this was denial of the request just because the property is it's currently his own neighborhood commercial the future land use plan here is for a commercial development district and so rezoning it to either r7 or rm7 would not fit the vision of the comprehensive plan okay i guess that was my next question is what was y'all's position so you do have um all of rm-7 back here this all this white is rm7 and the blue is neighborhood commercials because this is one parcel right now right hasn't been subdivided yet or will it be subdivided that's the plan is that this rezoning is granted and if i will say that if you were to depart from the comprehensive plan and decide to rezone this property we staff would recommend you go to rn7 just so it matches the surrounding neighborhoods but that's that is the plan is that once this is rezoned it would be split off and a townhome ultimately would be built here that would house the applicant's employees that's a different go ahead it isn't r and the seven more less restrictive than r7 i guess a yes in that it allows mobile home yeah in manufactured homes the standards are the same for plot size and so forth again our position recommending rm7 if the property is rezoned is that it would match the existing zoning of this running here it actually allows for manufacturing right right manufactured our mobile our mobile is our modular marginalism is not mobile but manufacturer is mobile right so the manufacturing home would be the modern mobile home right the trailer under the zoning code a modular home would be one that's like a stick built house it's built to the same standards but it's built at a top side is there can be also in this r7 home yes but not the trailer no a trailer no the manufactured mobile home would not be allowed in r7 but a modular home would be because it has to be the same standards as a stick build house built on site our m7 would allow for those uses in addition to the manufacturing both right both yeah right the proposal here is not for a mobile home but that's again not guaranteed by just granting the resounding so if it just wants to be a duplex to me if the property owner just wants duplex but then it would be spot zoning would to do what an r seven seven would be duplex discipline old r7 that's right you can do again you can do duplexes in rm7 but you're right it would be more of a spot zone to do completely unique is there any close r7s uh zoning nearby i don't see anything not not in so everything else is uh hd yeah what but the other the the light the gray or the right there light blue is all rm7 correct that's right but there are no actual mobile homes on any of those not that i'm aware in the immediate vicinity they are permitted they are permitted but they're permitted don't they have to fit the architectural or did they have there was some talk about being double stacked or it couldn't be single y i i don't remember i don't know that this section talks to that i don't know that i have it handy on me it says something that probably we might want to revisit the rm7 and where it is i can definitely bring that to the next i mean just just simply because is rm7 really what we want just in general in general in terms of what you want in classification within the city limits and under what what are you saying that all the ones in gray or are m7s now this would be considered an rm7 what are the okay you said are these two separate duplex requesting or is it just a connecting there'd just be two units attached to each other so one duplex two units one building and how many is there a required size that says number bedrooms or not a number of bedrooms they would have to have a minimum of 12 000 square feet for the lot in order to to construct the two units there the way the law is proposed currently be about fifteen thousand square feet right so it would be seven fifty each each each unit would be seven hundred fifty square feet what about parking parking they would need to have at least two spaces per unit so four total um i know parking was raised as concern in a planning commission with cars backing in and out and because that's a dead end yeah but all of that is rm-7 any of that could be do exactly exactly that any of those could put a duplex on it with parking and they could every any one of those lots that's why i know botus inquired about this particular one if the i guess the point is if the resulting were granted planning commission not the commission sorry planning staff and the building department would work with the applicant to make sure that those aspects of the code parking so forth were met before spring permits are constructed is there a future land use for that area that is that with the parcels in gray or blue uh that involves something other than r7 or rm7 so the parcels in blue the neighborhood commercial if you did change the slide you can see it too so the dark red the crimson that is the neighborhood commercial that's what's in blue on the zoning slide that's commercial development that's what the comprehensive plan envisions here so any business really or any zone that supports a commercial endeavor the pink the high density residential would be equivalent to the gray what's currently known rm7 in this area but high density residential wouldn't be limited to rm70b r7 r10 r12 r15 any of those zones would meet the definition of the comprehensive plan of high density residential here would the m part of it drop out then in the future is that the uh oh so no so the request is to go to r7 which is a high density i just meant like the paint is the future land use does it involve dropping the no no rm7 would still be a high density district it would still meet the comprehensive plan here however if you notice a little white box on the triangular piece the subject parcel it's in commercial development so it it doesn't fall under the high density residential area it would match what's next to it but it's and that's the parts of that issue yeah exactly yeah but that back parcel when it doesn't have any road frontage if they i mean if you really look at it the commercial entity needs road frontage to be commercial and that doesn't have road frontage on the main drive that back piece but technically that is one part yeah it's one part yeah it still does but ideally so it's going to attach to the actual building no no no no okay separate all right a separate parcel that fronts along oakland street that's where it has frontage could be a separate building no they did they take it off they'd have an entrance they probably have entrance to their parking lot off of oakland street no well accessed into the parking lot for the existing business is already off of seaboard right but i'm talking about the duplex if they built the duplex where would their access be oakland street street that's what i'm saying it's beautiful they have to go they'll have to turn around and go back is there any there's still no no chances of that on that road opening i have not heard any discussion of that i don't know if there are plans to open it in the future i did check with d.o.t and they said no sorry you never yeah if he's into cambridge i can't i can't i can't see how to to a duplex in there would accept the the problem because you already got high density everywhere it's just surrounding it it's just one more it's a across the street is high density residential behind it is high density residential at the planning commission meeting did anyone from the neighborhood speak against this we had one individual speak against it i believe they may be here today um their remain well i don't want to speak for them but what i recall is that their concerns with with parking and and traffic and damage to vehicles issues in the past their vehicles have been damaged by individuals backing out onto oakland street from that property well and we'll have we'll have next time i know we'll have a public hearing where y'all can voice any concerns you may have i don't know whether that would be different from if it's i mean as it's currently known as commercials but but certainly look forward to hearing your thoughts next time anybody else have any other questions for draper let's ask one quick question for clarity the only difference between r7 and rm7 is the allowance of the manufactured housing that's correct okay otherwise they're exactly the same that's right okay this may not be something you can answer but how many are in seven areas do we have in the city quite a few i know we have some actual mobile homes that are exist and some that are grandfathered in whether they're rn-7 or not but i just didn't know if someone wanted to bring it in how many are in seven zones off the top of my head i couldn't give you a definite answer how many different areas i would have to look that up again i'm happy to bring that yeah the next next hearing this would be one of the areas in the city where you could do mobile homes mostly other in fact all pretty much all the other residential districts preclude them so and just just to be clear so rn7 provides a really clear definition of what a manufactured home is i was trying to jot down a couple it has to be at least 22 feet it has to be a minimum 900 square feet has to have a 412 roof pitch minimum you have to take off all the wheels and hitches you have to put it on a foundation so it's not a mobile home in the sense that you're thinking and that there are a lot of more strict requirements on it mobile homes are not permitted in the city anymore in the form that you're thinking after the adoption of the zoning ordinance which was august of 2004 so just it's laid out pretty clearly and we can email this to everybody so you'll have like the requirements for if it was rm7 it's not a mobile home in the sense that you're thinking it's it's defined as a manufactured home um and there's a lot of caveats in here i see at least 10. so how how would you define a mobile home so it would be probab i can't i can't work that fast the mobile on my phone okay here let's see it is a mobile home but it is you have to put it on permanent foundation there are restrictions as far as how that is placed on property and the pitch of the roof is extremely important because not all mobile homes have that kind of pitch okay so it is still considered mobile manufacturer because it comes on steel beams completely together it also has a minimum square footage allowance so it has criteria but is it is a manufactured home a mobile home yes a modular home is a modular is like built to it's built just like a stick built only it's built under factory and it's assembled in parts on site this does a mobile home as defined in the zoning ordinance a transportable factory-built structure that was manufactured prior to the enactment of the federal manufactured housing construction and safety standards act june 15 1976 and that is designed to be a single to be used as a single dwelling unit this term does not include prefab modular or unit unitized dwellings i don't even know what that is on permanent foundations travel trailers camper campers or simple recreational units and then modular home is defined and then manufactured home which is allowed is defined as it has to be in accordance with the federal manufactured housing construction as the safety standards via the hud code and then it talks about all the requirements the pitch of the roof the size the minimum footage it has to have vinyl or aluminum lap siding wood masonite or other materials similar to the existing siding commonly used in standard residential construction and all the towing devices have to be removed thank you my only concern would be the the traffic because one way in and when you have to go in i don't even know how the trash trucks get in there i even call sanitation to find out how do your trucks get in that street to pick up trash because it's not an extremely wide street and they have to take those trucks up and make again make a four wheel turn and come back out how are they doing it they they pick it up on the red dot route so they're not sending a normal car so they don't put it so they put a they sent a pickup okay unless the property owner is is that a requirement that those bars be on this property like that if the dlt did that or did the copy only do that to prohibit anyone entering accident in and out of his property that's not a planning requirement i can't speak to um the applicant is here like that no but it's not a public hearing that was just another way of getting in and out if he was pulling the figure's hearts down and allow um some of the traffic off of oak street to exit in and out of that story from this property it probably would be going to cut through them well if there's really if that's so tight down oakland street then probably all of that zoning is incorrect [Music] i mean if if because if all that pink is r7 multi-family let's say a house burns down they could go ahead and build duplex in there lickety-split okay so if there's concern about zoning in the air i mean traffic in the area then then all that zoning doesn't make sense it is council's progress to include other lots and with the resonant request essentially you talking about the pink part yes that still have to be approved i mean it would happen you have to go back to planning and go through yeah everything consented back to finding commission but it is still attending council's right to consider that i consider the bank for every zoning from one to one seven to r7 yeah from rm7 to another district that you felt was more appropriate for them well if you if you did r7 you're still looking at multi-family you're still looking at high density if you if you wanted to change the density because you think it's too congested you'd have to go down lower to like an r four that would be the next step this would be the next step down but that one change the regulations for d.o.t to kept open that road up no i will also say that if you decided to do a zoning district aside from r7 or rm7 lower density district it would also eliminate the possibility of the afghan doing a duplex here just because r7 or rm7 is the first zoning districts where they're allowed so something else to consider this general area we've talked a lot about infield housing and how um that there's plenty of opportunity in this specific area mm-hmm i'm being totally honest is um i didn't know oakland street even existed i didn't know that i just i didn't i've never i've never been down that road i've been down shipley avenue but i've never gone down oakland street i have to be completely honest with that until this came about i understand that there is a dead end and i remember growing up that that intersection there was changed but as we continue to talk about infield housing i think that every single time that we are talking about this and every single resulting request every single um time that we've had someone come in and talk about um annexing into the city um we we get the traffic um we hear people talking about traffic and what that is and and how much that's gonna impact their property and and so uh in this case it's just a little bit different because everybody bagging up right so if you don't have a red something to say it's it's kind of hard to not i i can't imagine cars not banging each other do you have any street view pictures i can try to pull it up that's the only thing you want like a google street view or you just want to see some photos just some photos of what it looks like yeah i've got it i've got it right here this is oakland this is the it's kind of wooded but you get the idea this is is a bit incorrect because it actually shows oakland connecting to dangerous east cambridge which is not incorrect okay right in here there's pictures up now these are adjacent views so the north view would be seabourn cooking onto cambridge where it connects um standing on the on the subject property kind of a peek of it the top of the the triangular piece there this eastern shot is from it's on open street is standing back by the entrance into the back part of the parcel where the duplex is proposed so that's actually housing on this picture that is the actual housing structures that are on oakland now that's correct so seaboard is down here that's right okay so this is where the road is closed further down this way that's right it's not in the bench but it's just down there the south pitcher is of the property that's immediately south of the parcel so i believe it's a triplex and then um that's the triflex i believe okay and then to the west is a couple of restaurants that's that process and the road you're seeing in the western is the street you see in the southern picture is oakland street that's oakland this is right across the street okay across the street from the lot which is already a triplex i mean if it was to be subdivided for commercial use though and the only entrance or exit is on to oakland i don't know that we could in good conscience approve that but right now they could build a commercial business they don't need our approval but if let's say they did they came before us i would say that it would not make any sense to allow let's say that those two partials were one of them mr comparison the north end parcel and then sold the other one and it's zoned commercial it really wouldn't make any sense because the only ingress egress is on oakland so while they could expand their existing business it's hard for me to to [Music] think of a if you're going to subdivide it what a better use would be for it um if you never subdivided it it could potentially expand its commercial operations with with the idea that hey you can reach whatever we put back there likely from from seaboard but if you cut it off and you make it essentially land locked from seaboard then i don't i'd again they wouldn't have to come for us because it's already zoned commercial but you're going to have to go down oakland to get there which is not i mean that if they thought there were parking problems with the residential i can't imagine what the parking problems would be commercial but don't minimum watt side neighborhood commercial would it even fit as a minimum size neighborhood commercial it would work minimum lot size is 10 000 square feet okay so you could so yeah it would so they would have to work out the issues of access and and parking but they could subdivide it so there's no yeah they could say or wouldn't need anybody's permission okay can any housing be built in every commercial i believe potentially apartment complex good right uh-huh in neighborhood commercial no you know ip yeah i don't i don't believe in yeah so you can build any type of [Music] he could if it was institutional yeah you could do a single-family house so you could subdivide it for a commercial purposes yes i just make a recommendation that maybe we um since they can't speak that um we postponed the zoning tonight well we're gonna they're gonna have an opportunity i mean i don't want to delay the process they're gonna have an opportunity to speak we're not trying to silence you we'd love to hear from y'all between now and what may 2nd 16th may 16th meeting okay if you if you wanted to miss balls um just from a point of order you could take some kind of vote tonight but of course if the zoning was denied then it's dead right it doesn't go to second reading um you could you know make a motion and if it passed favorably to second reading and you still felt uncomfortable about you know taking a final vote you could then at that point late on the table until a future date if you wanted to do that um just yeah i mean i think that's what you guys want to do i'm having multiple readings does anybody have any further questions for draper thank but i think if we vote against it it's dead and they've got to go back through planning commission so particular information you'd like for us to get from the applicant if you just want to let us know after the meeting and we can have draper he disappeared we can have draper get any answer any questions in the interim before the public hearing on the 16th and we can bring that information back to you guys on the work session on may 2nd or even prior to that via email it'll give me a better opportunity maybe go over some stuff with the property owners whereas the residents who live in the neighborhood so we can just kind of get a feel of what's going on and how we can eliminate the parking problem it's just a matter of a whole lot it's just courtesy but you know you can't always be there for people to be curtis but thank you okay new business item number two is consider ordinance number 22-011 amending the city's uh zoning map by reasoning one parcel of land approximately 1.07 acres located at 108 webb avenue from gc to r-12 high-density residential um i sent you guys several emails about this so just to recap um these parcels in green are in the county they're zoned c2 currently zones is c2 which is commercial zoning in the county this armed parcel is 108 webb is in the city the applicant is asking to rezone this parcel from gc to r12 to accommodate phase portion of phase two of the development of a um apartment complex so this is phase one it has already been approved in its own county property uh they don't have to they don't have to seek any rezoning here because apartments are allowed in c2 in the county they've received a low income housing tax credits from sc housing to construct this affordable you know i believe it's um [Music] how many units is it 48 53 48 okay 48 units so phase one has already oh it's right there all right um phase one has already been approved and will be constructed i don't know timeline in a couple it's going to be constructed phase two portions in the county of portions in the city again they can already do portion of phase two on the c2 property in the county because apartments are allowed so in the city's gc apartments are not allowed and so in order to completely construct phase one and phase two you they need this to be rezoned to city r12 and they will be applying for the same tax credit that they've applied for here i believe the application is due in may and i don't know if it will be constructed regardless of if it's approved or not but in order to effectively construct phase two they need the city's parcel zone to r12 now obviously um from a zoning standpoint let me get to the zoning um this is the spot zoning because you have gc all around and then you have c2 here which all this is commercial but because the city and the county zoning doesn't align here essentially what you're going to have is an apartment complex here already which makes the rezoning of this parcel in my opinion makes sense because it's the build out of something that can already be done here planning staff is recommending denial because it doesn't keep the comprehensive plan and it's obviously spot zoning but i think a logical look at this is to consider that the full construction is apartments which are already allowed here i hope i explained that okay and this is this is havenwood mathis phase one and two right there's a completely separate one even with montague that's not uh contiguous to this right so there's three kind of in the works there's dogwood haven wood mathis and havenwood montague hey my montague is on between fats and the old kmart that's in the county is it dogwood that's right isn't it dogwood is further down mathis road um on the left side of the road across the street from cpw's substation there so it's adjacent to the city but it's in the county so all of these developments are in the county except for this one small section which is in the city um and i don't have any of the that stuff in here about all the other developments i only wanted you guys to address just the simple rezoning here tonight approval or denial i imagine if this is denied they'll just rework their design probably i haven't discussed it with the developer but that's that would be my guess because it's only a small portion of this development that's in the city well i know you wanted just to consider the one in the city yeah i was just saying i didn't put all those other slides in here dogwood or either the dogwood phase one or two or havenwood montague looking to annex so the developer has requested that potentially they would like to develop all of these um affordable developments but there's a lot of caveats in that if they're not approved for the tax credits they may not want to annex there are incentives so to speak i don't know if sin is not the right word but as they're submitting their applications their leveraging points in the application process it says if you can get a lot of support from the city if you can if you have certain zoning things you know there's all these little tidbits that you can um they earn points right they earn points to make them more more desirable to get the funding but they've indicated that they probably will not in annex if they don't get the funding so dogwood phase one has already been approved for the low income housing tax credits this phase one has already been approved phase two of this phase two of dogwood which is senior living and then the one behind fats are all in the application phase for 2022 um but only two projects can be approved in each county every year so all three of those okay so what i know cannot the reason i was i just was curious as to how many more potentially coming down the fight that may be seeking the annex so i i understand there's a lot of contingencies there so i mean i guess the answer i believe there's so we get emails periodically from sc housing and i the last one i looked at believe there were six applications for this this specific tax credit for 2022 or like pre-applications but they only approved two per county so all six of those will not be approved [Music] it's a lot of information to absorb at one time so before you tonight just to recap is the rezoning of this portion this parcel here from seat from gc to r12 to accommodate the build out of phase two which is here um i think everybody generally knows what i believe this is there as well that's not good any further discussion regarding proposed ordinance number 22-0-1-1 all in favor of ordinance number 22-011 that motion carried unanimously with seven votes there's been a request for sidewalks well there's been i don't think there's been a request or anything i'll i can cover it with you after the meeting if you want ms paul oh okay so you know the answer well it's just it's in and out of the city and the county it's a d.o.t road but it'll be annexed just a lot of factors okay under new business item number three is to consider approval of the proposed 2022 greenwood county transportation committee paving list as presented by staff what you thought bruce promotion by mr pass a second second by mr miller i didn't have any i didn't see any changes from from ward 4 that i felt were necessary i don't know if anybody else did yeah and if if there are if there's anybody that hasn't had a chance to review this ryan and eric leary and i went before the cpc on thursday i believe it was and um the ctc i should say has roughly 1.6 million after after you deduct all some of these other requests uh to award to the county and the municipalities the five municipalities throughout greenwood county the county requested one nearly two million so if you do the math that doesn't leave any any municipalities but um but we're hopeful that they'll look at it and proportion to the and the the the usage and the heavy heavier traffic in the urban areas specifically the city of greenwood um but uh any further discussion regarding regarding the proposed 2022 greenwood county transportation committee paving list as presented by staff is this less than those when the one on the computer different should be the same if they're different it's just they're sorted there's one that didn't have wards on there this one got words and it's in north creek boulevard ward 3. that's right and it says ward 5 on this one say 5 on this one let's see that's not right because why is what circle and all that that's not good honestly i wonder if it just got unfiltered yeah and it wasn't right yeah i think the hard copy is the one is the legitimate one because lodge drive isn't in ward one either this one there's not a word three on here and we do have representation from all six awards on that paving list it's this list that's here on the screen right now okay this is my least favorite time of year really there's always some little thing that gets changed and there's so many versions of the list so one line can just throw it off all right any further discussion all in favor of approval of the proposed 2022 greenwood county transportation committee paving list as presented by staff the motion varies unanimously with seven votes and to my lodge ground neighbor here we we got some some paving done and all of lodge drive at least will be done will begin i guess about this time next year couple things i wanted to mention uh for the benefit of the record if you all will recall in june 2021 council uh unanimously unanimously approved the npr zoning for for the um the alpine ridge subdivision off florida avenue and at that time we held off on phase two because the issue of access had not been addressed so since that time the developer has received the easement from district 50 to use the road to access phase two so we're going to go ahead and proceed through planning as any other subdivision would and just wanted that for clarity on the record you may have any questions about that do you all recall that we don't have to we approved it you guys approved it and just said we want to know what happens with the road basically we want that information brought back to us before it proceeds through any permitting so that that access issue has been addressed through the easement draper has a copy of the easement and so now we will allow them to go through the permitting process i also wanted to mention that some of you may be familiar with a tree at 1310 bunch avenue this tree is on city right away it's come up many many times in the 12 years that i've been here with the city it's it's a tree that that the resident is concerned about it's now it's leaning across towards the road it's it's now concerning i think the neighbor across the street as well there's some power lines involved and so um we've decided as a staff that we think it would be best to take some bids to remove the tree um before it becomes more of an issue um we're taking bids i believe the lowest bid right now is a little little shop twenty two hundred dollars to remove it um which is a pretty good price for tree removal from what we've seen that's that's not something y'all can be asking us to vote on no we're just making you aware because i know that a lot of members of council have have received complaints about the tree over the years um and i just want to make sure council's comfortable with that moving forward in that direction okay i had not heard about what kind of tree would you drink i have a picture of it but i didn't uh i didn't include it here i apologize i can show it to you afterwards if you want to see it right away don't know that i would be able to identify the type of tree if you show me a picture my dad would but he said your dad has sent me talents we have released the uh grants that you all approved with the 2022 budget the small business grants i've provided you all copies of the applications so there's a facade grant program 10 grants for small businesses for five thousand dollars and then there's a digital marketing grant 10 grants for 2500 uh we started accepting applications on april the 25th and we'll close on may the 9th but we've already started advertising for those grants we're going to push down our social media so we'll be on our website we would like for you all to let your constituents know i believe laurel is going to talk to chamber about trying to isolate city businesses to push that information out that's a little bit harder city versus county um so not sure if we'll be able to accomplish that um laura i know it's going to be on the radio just for the city though right correct just that's why i was saying it might be difficult for the chamber to blast anything out because their list is going to include all county businesses and these are just specific to the city so if you know a small business owner that needs a facade grant you know that could be anything from new awnings new doors windows um there's a lot of options for that and then digital marketing i think during covid we learned that a lot of our small businesses were reaching out to us saying you know we don't have a platform where we can sell merchandise online we don't have an online presence and so these grants would assist with helping a business uh develop an online presence so the applications i put them in your dropbox and uh if you have any questions about those i believe i included them in your packets yeah kind of a dumb question but if we're helping with digital marketing and someone's in greenwood is selling something to someone in north dakota we still are able to recognize that sales tax um let me think about your question really quick um it would the sale would occur so i think you have to have it if it's shipped to your house then the sale is recognized in the place where you live but if it's shipped to say like kohl's for example i remember us having this conversation a while back if you buy something online from kohl's and shipped to your house then it wouldn't originate the sales tax would not originate in the city because you live in the county for example but if it was shipped to kohl's and you picked it up there then it would apply to their gross receipts because it was shipped to the store i'm pretty sure that's that works i'm just curious yeah that's a good question though yeah i mean i don't know that i mean i don't think i don't know that i have any opposition to it if the answer is no i'm just i'm pretty confident in that answer but somewhere somebody's listening and they're going to say she got it so wrong i'll just wait for someone to text me police chief with a little synopsis there some upcoming dates here and then also we got this information from amber the city county litter coordinator today about an earth day county vibe cleanup event so it's kind of small but we did provide you with a printed copy so you can see where all those are occurring all right and is there well i guess specifically with regard to earth day i know it this this stuff is all this week um amber has some plans to do some board specific cleanups and we can yeah right and we can partner with crash down with thera or that's correct she's gonna be working on that and what did i think we kind of zipped through some of the the dates yeah we got a joint meeting on monday want to remind everybody last day of the month it's a saturday next saturday not this coming saturday got our big up down spring concert please come on out make a plan we are opening up for mr brandon hour very excited about that not being paid surrender cover is not at least all right thank you um all right any anybody else have anything for the good of greenwood can we just touch on the um mike muffler situation sure did you have some specific questions um exactly where are these vehicles apart that's on city property in the parking lot that's adjacent to main street um it's a little triangular a lot directly across main street from the entrance that's a city a lot right there you walk through to go to first citizens or the library from uptown okay and then there's also if you're coming away from the courthouse at the courthouse is behind you before you get to the red light you can bear off to the right there so there was a lot of parking along the street that was blocking the road um many times blocking the road so those would be the two areas that would be owned by the city this is not a from what my understanding is in my limited time account so this is this is not an issue that this is the first time this happens this correct first time what has happened that we've had parking issues in that specific parking lot right you know over the years you know we've asked them not to use all of the parking um in that triangular lot you know hey why don't you guys use half of it and it would get a it would get better for a couple of days or maybe a couple weeks but then over time the parking spaces would fill up again um there's it's starting to double park so they're parking cars now behind cars that are in parking spaces if cars like this then there's cars parking they're parking cars behind there they're spilling out closer and closer to main street blocking egress along that turn right before the stop light there's also cars in the adjacent parking lot owned by the law firm there nicholson meredith anderson which is not allowed there for for how he's zoned um so there's several things going on that's word one downtown is worth two or three okay i think it's two it's not you is it you miss folks please don't let it be me i'm just kidding yes it's me okay because you have some of uptown right but i've complained about it before because i can get through you it may not be you now but i mean to mrs point at the city it's in the time that i've been the city manager i i would say we probably received 50 complaints and you know and they they run the gamut of business owners visitors council members county council members i mean and you know i think it was just we needed to address it and you know um i think that oftentimes it's important for council to understand that code enforcement things we don't have enough staff to be overly aggressive a lot of what we address comes from complaint volume um and so this one was all right any other city all in favor thank you
