One nation under God, indivisible,  with liberty and justice for all. City Manager Le to be turned out. All right. Uh  September 2nd, we have a few proclamations and   an award and two people on the public agenda.  Uh new council business. Um first item would   approve an increase in the IRB amount for market  center apartment uh project and this is to help   them meet their LITC credit uh requirements and  they have received lit sales tax only. Uh yes. Number two, next page would approve $150,000  budget adjustment for playground repairs.   Number three would approve a $200,000  grant for K from KDH for air quality   planning. Number four would approve uh $19.1  million for water and sewer main improvements. Number five would approve $270,000  in home funds for the construction   of three affordable single  family homes by Menanite. Next page, we have two planning agenda items.  The first one would approve a conditional use   in district 6. Uh there's a difference between  the DAB and MAPC recommendations. And the second   one would approve a reszoning in district 3. Same  thing in terms of difference between DAB and MAPC.   Sorry. Next page. Um actually I have a question  really quick. Uh, Council Member Glascock and I   both attended the Witchah Independent Neighborhood  Association meeting on Saturday and they asked a   question that I didn't know an answer to, which  was when these proposals come before MAPC,   can they come before DAB instead? And what  was the reasoning be in the past of why it   didn't come to DAB first? The timing. Yes,  we that we've had that discussion before. And no one from planning is here. We'll  get an answer to you in that regard. Okay. I will say our dad prefers they come to us before  they come in to MBC. My dad does as well. Yeah.   Yeah. I I think if I remember correctly, what they  had said was just trying to be more efficient with   the timing as far as getting it through the  process. I don't think they'd be opposed to   trying to do that. I think sometimes my um dad  actually likes to hear it after MPD because then   they can hear different recommendations that might  be coming down the pipe. So I I again I think from   what I remember whenever we have asked about this  in the past, it was just more trying to get it   through an efficient timeline. I vaguely remember  that. I think it what does slow the process down   a little bit I think because of the infrequency  of the damage but I'll I'll and how they fit with   the CP but I I'll we'll double check that and get  back to you. Um on the next page um council will   need to select a panel uh among the seven of you  to hear a drinking establishment license appeal.   It's not in district two. Yes. And then it looks  like it's four and five. Yeah, I uh I won't be   on that one. Okay. So, two, four, five. I'm not  I'm not an expert on drinking, so neither am I,   Jamie. Okay. So, uh and number two, uh would  approve travel for council member Tull. Next page,   uh 2A would approve the installation of safety  barriers in the city's bus fleet. 4 A would   approve a change order for the fire storage and  department operations center project to address uh   soil issues. Next page number seven would approve  an overestimate bid for the Mount Vernon Vernon   improvement project. Number eight would approve  the purchase of 350 replacement handguns for the   Wishful Police Department. Number nine would  approve budget adjustment for the way to work   program. Number 10 would approve a second 5-year  property tax exemption for textron aviation. And then on the next page, next two pages just   uh uh highlight there's approval of the  sale of four public housing authority homes. Pre4 September 9th. Wait, I have a question. Yes.  Uh so item number 14 looks like the property was   valued at 24,000, but we're about to receive  a sale of 80,000. Why such a big discrepancy?   Steve, can you address that? Um, I believe  that's one of the properties that we have   spent money improving on since the um  assessment was done, the appraisal. Because we're really effective salespeople,  that's why. I don't mind seeing that. I just   was curious if it was um it looks like it was  improvements by the city. Thank you very much.   Okay, September 9th, got a few items that are  a little out of the ordinary on new business.   Number one would allow municipal court judges to  restrict access to Oldtown for persons committing   criminal offenses um while they're on diversion  or deferred judgment. You already allow this for   those who are not on diversion and deferred  judgment. This gives the police department   another tool to try to control activ illegal  activities in Oldtown. So even though they're   on a diversion or deferred judgment, they  would um be prohibited from going into the   Oldtown area. Would what they got in trouble for  originally be related to Oldtown? Uh Jennifer,   um I'm going to have to get back with you on that  one. I actually haven't seen that. Okay, thank   you. And can you explain the types of offenses?  Um we have a variety of diversions. Uh so it   could be for battery or um any any misdemeanor.  I will check and make sure the list is specific. So one other question on that. Would it be a the  judge has the ability to ban any time of day or   in the evening? And I was just thinking like  Oldtown Farmers Market if they wanted to go to   that or is it just like after 5:00 for evening  activities? We could work with the judge and   ask for exceptions. I'm sure I don't know if  these are your typical farmers market people. Number two, um I'm really proud of the staff  work that was done on this that we've had a   staff committee uh working for a little while on  illegal dumping and trying to come up with some   creative solutions. One of the things they're  recommending is a change in our ordinance to   um have uh to enhance the penalties for  illegal dumping. And so we'll be bringing   that to you in terms of an ordinance. And then  we'll also outline some other initiatives that   we're taking that they're recommending that we  put in place some on a pilot basis to test out   and then there'll be some permanent changes if  those pilot changes work. So my thanks to the   staff done a great job on that. Go ahead. Are  you able to quantify um the amount of time and   resources in cleaning up these illegal dumping  sites? I'll go back and look at the report. I   can't. The report's somewhat detailed, but I don't  remember if um if we've got that information. Is   this a Dr. Nathan thing over here? Um does it  does any of this make it easier to prosecute   illegal dumping? Uh holistically, the  approach will should provide us more   evidence to be able to okay pro to prosecute.  Okay, that's my recollection of what was done. All right. And the next one uh would approve  an amendment to the city code to recognize uh   the departments that are now responsible for  noise nuisance enforcement. And it would allow   for exceptions to the ordinance for under  the community event process. The ordinance   right now points to the health department. The  health department doesn't exist any longer in   city of Witchaw. So, police and MABCD  are responsible for noise enforcement. Uh, number four would approve allocations  of Hyatt sale proceeds in district three and   would also amend the loan loan repayment  schedule for the uh Starlight Drive-In. How much more do they owe? Six. Oh, how much? Uh,  they paid 61,000 I believe. I don't remember what   the outstanding balance is. About 140. Yeah,  about 140. And they're asking for a six-month   extension. We do that previously. Did we  go on that earlier this year? Yeah. Um,   we did that uh a year ago. This one has to  do with the extensive storm damage that they   received out there at the the drive in. So, it  was just giving them a little bit of leeway to   uh get that fixed up as well. down  trays, down fences, and whatnot. So, next item number five would approve the  2025 park signage uh upgrade program. Um,   nothing in the next few pages.  4A would approve an agreement   with Cedric County for the joint budgeting  and allocation of opioid settlement funds. Um, and I believe, mayor, that's all  I have as a preview for the night. Thank you very much. Willing us, please. Any uh  comments from council members? I see none.
