good evening ladies and gentlemen we have a delayed start as we wait on our third council member who is not ill or not out of town councilmember Gustafson is going to join us shortly until then we will pause the meeting and I'll officially start and open the meeting once he has arrived engineer room can you pause us you good evening ladies and gentlemen it is now 5:35 and I call this a regular meeting of the Burnsville City Council to order we will begin our meeting with a moment of silence followed by the Pledge of Allegiance and we ask that you all join us I pledge allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and justice for all the city clerk will note for the record that mayor counts and councilmember workman are absent tonight councilmember workman is a little under the weather and we do appreciate him not coming in tonight and spreading his bug we do wishes quick recovery I'm sure he might be watching from home miracles along with our city manager Melanie Lee and two of our economic development staff are attending the International shopping centers oceans associations recount event it's a retail convention this is the largest convention in the country that brings together developers and every type of retail store imaginal and with our new redevelopment vision planned for a region of all encounter about 42 and that vicinity it's a timely event for us to attend and have the opportunity to be face to face with developers retail chains groceries restaurant entertainment venues and more bring a focus of attention to our vast opportunities as a result of our Rita village redevelopment plan this plan brings together the mall owners CBL properties and the major department store orders especially Seraph its growth which owns the closed Sears store JC Penney's and Macy's all of which owned their buildings and adjacent parking lots we're reinventing this aging mall area and this will set the table for decades of prosperity last but not least I want to thank my fellow council members and mayor counts for supporting the funding to send this team to this event we have never been there before as a city and the ICSC recon is something I've advocated for last few years and thrilled that we were there this year at a time when our mall redevelopment vision plan is complete and we have a great story to tell great opportunities for developers to come build in Burnsville well what is now mostly paved parking lot with that hopefully mayor cow as an opportunity to watch and I believe that we've given a great investment on in the future of a major redevelopment area item one on our agenda tonight is announcements and presentations the upcoming meetings are our regular council meetings Tuesday June 4th at 5:30 and Tuesday June 18th work session will be Tuesday June 11th at 5:30 and we do have a special work session Tuesday May 28th at 4:00 p.m. that special working the work session is to interview candidates for Advisory Commission's and it'll be held in conference room D across the hall from where wrap all other meetings are of course held here in the council chambers I'm also honored to let you know that we have a special recognition tonight Mike Huddleston and the Burnsville yellow ribbon have a special presentation honoring students who are entering the military we're all we also have special guests with us tonight for this recognition I'm not sure if I saw her come in Mayor Janet Williams are you here thank you please chief from savage Rodney sewer did I spell it or pronounce that correctly Sawyer sorry Abigail alt chair of our school district 191 board she's here tonight and be healthy principal of Burnsville high school is here as well along with our Burnsville police chief our new chief about to be sworn in chief Tanya Schwartz you are here there she's in the back Fire Chief BJ gentleman I saw him here and police captain bacon it are you here thank you along with other members of our police and fire leadership team in support of these students I also see that we have some veterans from our local VFW is up the savage the cracker trail Burnsville VFW thank you appreciate the correction it is an honor to have you here tonight thank you very much for your service to our country I will read a proclamation in honor of this occasion and when I finish I will invite Mike Huddleston to come up and present them recognize our high school students choosing to go into military service Burnsville yellow ribbon recognition of students entering the military whereas the United States military supports the freedoms upon which our country was founded and whereas entering in the military is a noble and important career choice almost 2.5 million people served in the active and Reserve branches of the military and whereas the Burnsville beyond the really ribbon organization is a non-profit volunteer organization dedicated to supporting our nation's military which includes the local active duty Guard Reserve and military veteran communities and whereas Burnsville yellow ribbon Burnsville beyond the yellow ribbons volunteer forces assist active-duty military members veterans and their families with household chores ranging from babysitting cleaning to household maintenance and whereas Burnsville beyond the yellow ribbon also connects veterans with state local and federal organizations who provide assistance to veterans who are looking to enter the workforce upon completion of military service and whereas the Burnsville and savage communities join with the Burnsville beyond the yellow ribbon organization to honor students who choose to enter the military and whereas the United States Congress in 2004 passed a resolution proclaiming May as National Military Appreciation Month a special month to honor both those in and out of the military now therefore I dan Keely acting mayor on behalf of the City Council proclaim May 20th through the 26th 2019 as a Military Appreciation Week with a special emphasis on students who have selected careers in the military I urge my fellow citizens to observe this period by thanking young people in our community who have chosen to enter the military profession in support of our freedoms health safety comfort and quality of life thank you now it's an honor to invite mr. Mike Huddleston to come up for the presentation and just one note before he starts after Mike is done I would like all of our special guests from savage the school district along with our police and fire and would be an honor to have the veterans come up and be a part of a large group photo with these new young recruits Mike take her away well thank you sir we just want to make sure everyone at home can hear you yeah right Ron camera began so thank you on behalf of the Burnsville beyond the Yellow Ribbon Program I would like to extend our sincere congratulations to each of you for your commitment to serve as members of our military forces this is a very honorable endeavor that we feel should be acknowledged and celebrated before you leave to begin your military training as a small gesture of our gratitude for your career choice to serve our nation Burnsville beyond yellow ribbon is presenting each of you with a Target gift card that we hope will help you purchase needed items at your next duty station you'll also find a few other items in the gift bag to include you'll like this a chocolate bar to remind you of those who came before you and got the John Wayne bars from Bravo's John Wayne bars that we used to get and then in the MREs and a protein bar and fruit snack which serves as the no military these gift bags were made possible through the very generous support of the Burnsville Lions which are back there and the purple the Burnsville VFW these gentlemen here and the Burnsville American Legion and the two eagles marine detachment that is a present as well and so what I'd like to do is Mayor if you would we we acknowledged all those so I won't say it again and so thank you for taking some time out of your busy schedule we have nine this year that were recognizing but some weren't able to attend and so we'll make sure that we get them to Marsha up at high school and and make sure that they receive their gift bag and recognition as well so the first one is Cody Anderson are you here going once going twice okay Vincent Strasse did I say that right yeah [Laughter] we'll make sure that drill sergeant so Vincent is going into the army right and and what and when do you leave June 24 so that's coming up so Vincent thanks a lot so the next one is Maura miss Shelley I was gonna say helpful bet but the Laura's going into the army and she's gonna be Tanya and MP Casey Johnson Oh some of my favorites okay so if it moves to shoot it so I think these are the only ones that we got right yeah oh we got one more oh oh here oh Jacob come on oh my goodness somebody going in the Marine Corps oh good take a pointer you August 19th that's good that's good so and that was one of the reasons why we did this so early because I think you're going win so June 3rd so that's coming right around the corner and and so they're shipping out right away and so what we wanted to do is make sure that we do this early so that we can catch them and recognize them okay yep I can do that the other students that are not here Brandon mcrainey Isaac whirring Caleb Palmquist oh come here I got a fire my PR first get boots where are you going the Marine Corps oh good all right so good I'm glad I'm sorry yeah we didn't see ya slip in there but that must be the Marine Corps things so then then Cody Anderson we hide said and then the other one this is a first I think for for us doing this for the last few years Eden Roloff relaf going into the Navy and I'm sorry Councilwoman we don't have somebody going in the Air Force she was in the Air Force so it's my fault yeah so students family members recruiters Burnsville and Savage City Council members and mayor's school district representatives and the service organizations that are helping Burnsville beyond urban recogniz students are invited to join us downstairs in the Nicollet room immediately after this program for a reception which includes food and beverages we'd like to thank Brianna's and Egan Valley News live and Egan Costco and Burnsville for the general generous donations and also Lois and Jim fighting for the foot she made ten pounds of Pudge down there so it's down there and so try some of that the students were also receiving an American flag print from the local artist Andy Young and that's down there we'll also have flags so Howard if you wanna as Howard you want to help me present the flags to them yep who could not be an Danny young who could not be here tonight because of her birthday the print is titled unbeatable determination and resembles what the US flag looked like at the time when Minnesota became a state and then what I wanted to do was one final thank you to the parents that are here tonight and so you know I we're in this together as a community as your child is going off to the service and I want to say personally thank you for letting us have them go to to their services they'll be in good hands and we as a nation are grateful on gratitude as his immense for you they're going into the service I think that I think I went to jump school in 1978 jumping out of airplanes and so I I was there let's give them a break yes would you like a photograph with the new recruits and their families first and then a group with everybody else's yeah that's not that be good sir whatever you want them up right in front of the council family members of the new recruits if you'd come up stand behind your enlisted or next to right if your thank you with another yeah with that police and fire and our veterans come join us so we could get a larger group shot with everyone thank you and the school district sorry I didn't mean to forget you everybody one thank you okay so we'll head downstairs and I got some other things for everybody thank you Mike Huddleston appreciate thank you to the Lions for your support of our yellow ribbon and armed forces and all the high school grads who are entering the military services as a brain dad I appreciate what you're doing my son was here three years ago and accepted the bag and was shipped off a few months later and the council member hschultz a veteran of the Air Force whose son was also is also in the Air Force and a veteran next to me council member gets us in until all the veterans is there any others on staff that served in the military thank you for what you've done for our country and we honor and respect all of you and best wishes thank you very much there we go well that was wonderful item number two tonight is citizens comments this is an opportunity for anyone in the audience to address the council on an item that is not on our printed agenda and not coming before us at a future meeting does anyone wish to yes sir come up to the podium and give us your name and address and sure if you have some handouts you bet thank you my name is Paul Bryant and I am homeless and I have to say I'm very sorry to see everybody leave the room just for the record for those on TV there's three people left now and I get about two minutes to speak something where the city of Burnsville was booked my life at very serious risk and they got about 15 minutes so I apologize I'm a little shattered by that I was here a few years ago about two and a half years ago praising your Police Department which is of course wonderful police department one of the best I've ever seen um still and some other things but at that time I was I had no money I had nothing left I was just I honestly thought I was just gonna drive out into the wilderness and what nature take its course because there was nothing left to do the state of Minnesota the cities the people the churches had done absolutely nothing for me for a year and a half up to that point a family of all things that I met a few days later out of the clear blue sky took me in within about a week and a half two weeks I had a job which I still have today more than two years later they got me back on my feet by just giving me what I actually needed instead of giving me what a government program thinks that I need as I said I've worked there for two years now I just had my two-year performance review I don't know how many of you have ever had a five-star review I've had a couple of them mouth including perfect attendance which the irony doesn't escape me that not everyone's here tonight but I have managed to get to my job every single day as my employer expects me to this morning I woke up on some days I do sleep at the Walmart parking lot which Walmart's across the nation are known for allowing RV parking truck parking car parking brings in a lot of business brings in a lot of tourists into the read into that community and it's a wonderful courtesy it's a life-saving courtesy for people like myself there is a row of cars that park at Walmart maybe five or six on a given night people who work for a living like I do honest hard work responsible work and all they want to do is be left alone and sleep so that they can go work another day and hopefully work their way out of this this morning I woke up and I have this humiliating pink thing taped on my car and it was not that I can tell from the city it was from Walmart it says second time car is towed no overnight parking and it's an incomplete frankly incomprehensible I'm sorry but I'm a better writer than this whoever wrote this to Walmart should be a little more clear about what's going on appears to be cut off so I don't know if it was responsible for it from the city apparently because of their proximity that a highway there's some kind of a zoning ordinance before I believe highway commercial that does not allow truck parking car parking such as I'm doing so out of the clear blue sky after finishing my 40-hour workweek last night staying up working on the book that I've been writing about my experience being homeless in Minnesota for the last several years I went to get two hours of sleep before I was gonna go do my laundry and I wake up after two hours this thing's on my car I now have absolutely nowhere to sleep that was the last place I had the reason I'm homeless in the first place go back for years my neighbors were tremendously violent the neighbors who moved in after I had been there for several years in a wonderful place it was taken over by people who were incredibly rude most of them did not work for a living they lived off welfare while I went to a responsible corporate job they made so much noise boom Bam Bam pow scream and shouting boom boom boom cars outside I could not function as a human being I learned what sleep deprivation was they're the reason I'm homeless is because of sleep deprivation one of the things I did when I became homeless was I created a website which is not now-defunct because when I lost everything I couldn't even afford to renew something that that cheap that was probably one of the premier websites collating scientific research on sleep deprivation and particularly the weaponization of sleep deprivation what's gonna happen to me over the next several hours is I'm going to deteriorate I'm gonna lose function I'm gonna be tired I'm gonna start being drowsy I live in a car so I Drive if you could see my website which no longer exists you would see how many of the largest industrial accidents have been caused by sleep deprivation Chernobyl was linked to that the plane crashes many of the plane crashes pilot error had been linked to sleep deprivation thousands of people some of by some estimates more people have been killed by that than in the Vietnam War the city of Burnsville just required that I now cannot sleep anymore I will lose my job I will lose my faculties I will lose everything I've worked for the last two years when I came here today to try to investigate what this is about this wasn't very clear again as a writer I would have been more clear about this I'm gonna want to sleep to my car whoever wrote this does not I spoke to someone who works in the zoning I'm not gonna say their name I'm not here to bust people's jobs I'm here to get some help but I was not just disappointed by the experience I was horrified by it and I would dare say I was terrified by it and from what I've seen those who do those who engage in terrorism Isis what have you al Qaeda they at least take responsibility for what they're doing they claim responsibility I would like to know who is responsible for this who is responsible for ending what I have built for the last two years by forcing me to just become a vegetable over the next several days because there is not any place I can sleep anymore if you can identify that person I would like the opportunity to debate them publicly on television in front of 60,000 people in Burnsville because the argument that I was given was not a good argument it was an argument that blames the victim it was an argument that that it reminded me of Melville's Billy Budd now it's not in the book but it's in the Peter Ustinov version of the film anyway the book is wonderful you must read it it's about the difference between justice and law and while Billy Budd was being sentenced to hang for what most people would say was not a crime because it was the law that he had to be hanged he had to die even though he was the best person on that ship and everyone admitted it the lieutenant charger said that we are not concerned with justice but with the law there's a difference you sent the Pledge of Allegiance okay and that that is a pledge not to a fly Act that's that's a that's a rag you're pledging to the spirit of what this country is in the Constitution it's my recollection we the people of the United States in order to form a more perfect union establish justice not the law ensure domestic tranquility not domestic terror which is what I'm experienced provide for the common defense not to leave me defenseless promote the general welfare general welfare I work for a living I'm not asking for a lot and secure the blessings of liberty instead of enslavement to these laws and these ordinances and these regulations to ourselves and our posterity they are the ones who are doing the Constitution United States of America please if that pledge man anything to you do something about this and do it fast because I don't have much time the human body cannot survive without sleep and how a city of people who claim to care could possibly do something like this and then be that tell us when I come in and talk about it it disturbs me I mean so much progress that works so hard I did such a good job and this is what I get for it the last thing I'd like to say is that while I'm in these parking lots over the last several years sleeping I get to know who the homeless people are and who or not I see things and if you go to my video blog I reference before I mean if you don't mind I'm gonna put videos about this on here with more information for your benefit as well as everyone if you just go to human stupidity calm apologize for the name but that's all I have left I lost about 20 URLs that I owned as well on my intellectual property human stupidity calm you will see that the people who come into these Walmart's they come barreling in at 50 miles an hour breaking the law including city vehicles government and vehicles on the clock I see people meeting with prostitutes these are presumably married people doing it off the radar I see a drug dealer selling drugs to the high school kids down there I've spoken to the high school kids and ask them how what's going on here and they've told me how they beat the experts to get their drugs from doctors there's a whole world out here that isn't on television that you people don't know about and it Frank I'll be honest with you I didn't know either four years ago but it exists and they have someone out there who doesn't know anything about anything oblivious to the reality of this world telling me it's my fault that I'm sleeping in that lie he called it camping he doesn't understand what homelessness it is that's not camping that's not fun I'm sitting on a seat having my circulation cut out for 40 years straight it's not a party for me it's me doing what my body requires by nature so that I can go do what you all tell me to do work for a living which is all I've ever asked to do please I'll end this to respect your time please determine who is responsible for this put an end to a gift for the freedom back to Walmart and I spoke to the Walmart management and they said we're perfectly happy to have these people here it's the city won't allow us so I want it to happen the customers at Walmart haven't had a complaint the Walmart people want who is it who doesn't want it who just put my life at risk who just ended everything I built I don't know their name my name is paul matthew bryant the son of Jerry and Jacky Bryant the city of Burnsville is gonna kill me if you don't do something about this thank you for your time thank you mr. Bryant yeah ask a question recognize council member hschultz Mr Bryan Mr Bryan what type of vehicle do you have that you're parking in Walmart small sedan two-door sedan so it's very rusty so it's not a semi no and I did not see any reference to vehicles but it appears to be missing I think there was more they just put this in for reference okay yes is there is there any anything in our ordinance that talks about that his car could not be parked in Walmart parking lot I'm acting acting mr. mayor and members of the council there are certain land-use provisions certainly that he referenced camping outdoor storage you know there's there's definitions and practicalities that go with all of those there are provisions that allow parking and parking overnight that make this possible primarily it starts with the property owner and so that's where that part starts there's a distinct difference between parking in a parking lot versus living in a parking lot so there's there's different areas of land-use that this could affect I would suggest that mr. Bryant have a discussion with our investigator clingfish from our Police Department that's here and he can help give him some guidance as to where he where he can park and overnight so as of right now there is no ordinance in Burnsville that would bar him from parking his car overnight in the Walmart parking lot and sleeping overnight which Walmart's do allow across the country so there's no orden there's no city ordinance barring that councilmember people certainly can park in parking lots that's what they're built for we don't have time limits on that but if it gets to a living situation where people are cooking and using out making outdoor use for bathrooms and those sites those that big fat transitions to living or maybe camping but parking people are allowed to park in parking lots public and private for certain durations up to the property owner could we send clarification of that to Walmart so they understand what our ordinance does and does not say sure we can make that communication I would appreciate that thank you council member gissy well I look at this this letter appears to come from us I don't smoke I just saw a copy that I didn't see a date on it I'm not sure when it went out it did appear to reflect I'm we had dealt with some complaints in the past regarding semi truck parking where it was almost turning into a truck terminal a trucks that were there I believe that's what this is related to I don't believe this is related to people living or camping out of their cars those trucks are coming in to make deliveries in the morning from out state and they get here and they can unload council member I don't have that specific information I believe that has resolved itself again there's not a I didn't see a date on here that's pretty standard in the industry that sure so you just parking lot certainly we enforce reasonableness I would say I would just presume that they were there much longer than that and we we we were there multiple times at different days and times and saw the same thing so we do have an ordinance on us I'd like us to at least have a talk about and work session about this and what we can do about if I could get clarification what we do about well what are we are we are we chasing the homeless out of the city were they may have a place to sleep that night I mean that's what I'm trying to figure out I'm reading this and it's like where are we going with us councilmember Gustafson this I believe relates to something different than what mr. Bryant is referring to this is a land use issue a semi trucks truck terminal type issue not someone sleeping in their personal vehicle in a parking lot they're two very different land-use issues I don't believe we have any land use issues that prohibit mr. Bryant from doing what he wants to do I'd like to recognize our city of journey the mayor and council are going kind of far afield on our citizen comments usually we have the citizen comments for individuals to apprise the council of an issue and then council can direct staff to follow up and provide a report to the council on that issue nobody on staff here has had an opportunity to this afternoon at least we haven't to research what what happened and what the rules are and why it was provided we'll get that information to the council then you can make a policy decision based on that information but right now we're just shooting in the dark as far as what what the issues are here as if there's indicated Walmart generally allows that that would not qualify for watering but we'll go through that list and figure out if there is something that there's a violation if there is we'll bring it to your attention if you want to change the rules again I know they have that good neighbor Sam where are these they're all over and they're literally camping in their parking lot council member schultz i i do understand what our attorney is advising i will still ask if staff could appraise wal-mart of what our current ordinance does and does not say regarding persons like our citizen parking their car and sleeping overnight or other people who are just traveling through and they want to just hit the mall Mart parking lot for overnight because it appears perhaps they're misunderstanding the fire ordinance agreed I do remember when Walmart came in and that application came before us and they said we we addressed this discussion point of generally semis coming in and Walmart's across the country is noted by councillor augustus initials welcome folks to come in and and if they're traveling on the road to park the vehicle and spend the night campers RVs generally sometimes cars and so I think it's a good idea to get clarification on exactly what our ordinance does state and what we allowed in that particular case and then just to to Mr Bryan thank you for bringing this forward we certainly are a compassionate City we certainly do care we do we do have ordinances and laws for reasons you're certainly not a risk of the types of behavior that some of these laws are there to prevent and it sounds like you've even witnessed firsthand some of those interactions which our law enforcement is always looking out for and trying to stop from happening right and and so you like the block captain of the of the parking lot they're coming in and letting us know but anyway I appreciate it I mean - that's just the courtesy I get back I think in most part of the years that I've spoken to they feel the same sense responsibility but there's a bad egg and every fair mother asked it and there are stuff I will see an army one small job a big pile of garbage on that but the thing is over time over four years what I've witnessed its how as to people who are jumping all this stuff isn't homeless people they're the ones speeding they go out and have tailgate parties at the edge they're drinking beer there's there's a lot of legal activity offensive the defense me but you know I just but those are house people the the homeless people I'm familiar with I'll be honest with you I've seen one who engaged in public urination overnight in the know like the NOLA night he was trying to be discreet about it but sometimes you have to go I've seen it far more times from people who were presumably housed you know it's it's not one class of citizen who's causing trouble there and I I think in the balance it works out because people like myself and many of the our fears in particular like to pick up and help out give something back to Walmart sure and you know present our area that we're in you know in a positive light well just to let you know we hear you we are going to have some staff work to get some clarification and we'll have a discussion about this at a future council meeting that doesn't necessarily provide any immediate support relief etc for your situation that sounds like and and so we'll try and get something in the works at least clarification and yes please go see the officer in the back of the room oh thank you thank you again all right let's face you all on your job yeah congratulations on your job I do remember when you were here speaking before us before so and for the record let me say nothing's changed I should mention the reason I went to Walmart was I was recommended to do so by a Burnsville police officer so there's there's a bit of a catch-22 from my perspective what happened when I first heard it as you see the video it looks like racketeering it's like one end and he tells me to go here they create the problem and then they say we're gonna find Walmart because you did exactly what the police officer told you to do it the fellow out there told me well the police officer never should have told you that and it's like look I don't have time to sort out with what whether the left hand knows what the right hand is doing I have a life I need to live all I can do is present to you what's going on and I just want to say that Burnsville police departments still is up there as one of the best I've ever seen in my life I love them to pieces and I gotta say I'm more impressed with this particular City Council than any other one I've dealt with so thank you appreciate that and that's this wonderful woman here was so helpful to me today - I just want to clerk very helpful thank you sure I guess it we're not necessarily best equipped as a city to help someone who is homeless that is generally in Dakota County handled by the county I understand from a conversation that there is a a shelter for men but it's a long way away in Hastings and that doesn't help you working in Burnsville so there's a lot of there out what years I think it as obviously vanity and hopefully just short term transition right to get what even you but you've got a job so you're you've got a foundation and you know that I actually spend more money now that I did when I had my corporate job I pay more I do get a hotel on my two days off that's one and a half day a week I spent more there than I did for rent for the entire month previously I have a lot of bills I have storage here I have storage in California I had my car insurance I I mean I make less money now than I did when I was housed I saved less money now and I had several thousand dollars saved up at the beginning of the year the Minnesota Department of Health shut down a motel in Burnsville the only one I could really afford and so many others and it wasn't a threat to anybody I'm a former hotelier I was in charge of revenue management one of the largest hotel companies in the country that that place wasn't a threat to anyone's life or limb or illness it was it was an absolute paradise it was a life-saving place it's the law of supply and demand that's why it costs less but the Department of Health shut it down and for what reason I don't know apparently they need to justify the resistance but that significantly increased the cost for me to do something like that for myself the others couldn't do it at all I hope I pray that they're okay thanks for coming forward mr.
