One nation under God, indivisible, with liberty and justice for all. >> Please remain standing. Thank you, Council Member Begley. I first wanted to start with some reflections um that I originally put on a Facebook post in regard to the current climate of our nation. Uh this morning during our time of worship, my husband Dan Goodwin and I prayed for justice for the people who recently lost their lives at the hands of ICE agents. We prayed for their families and children left behind. We ask for the wisdom to know how to act as individuals and for others with the responsibility to lead. We ask for protection for our city and other cities across the nation as we attempt to digest the current state of our national and global political climate. Since the inception of our nation, during all points of political and social unrest, people have looked to God for the wisdom to act, divine intervention, and justice for the oppressed. God is the God who executes righteousness and justice to all who are oppressed. Psalm 103:6. That must be God chiming in. Turn your devices off. [laughter] >> Thank you, Mr. President. Please pray with me. At this moment, I urge everyone to take a posture of prayer for our nation. It may not be the only action that you take, but it can lead to the right actions with an outcome that is far beyond our own abilities. Thank you. And with that, I'd like to move in a information if I can and invite the Goodwin family down to the podium. As many of you know, Dan Goodwin, senior uh a local civil rights activist and businessman passed on January 4th, 2026. And so this is a proclamation uh to my husband, my daughter, my daughter-in-law and niece, and many of our family members who are listening uh abroad and online, including my mother-in-law, Andre Goodwin. Whereas Daniel Mark and Goodwin Senior lived an extraordinary life and leaves an enduring legacy as a visionary entrepreneur, a steadfast civil rights leader and a devoted family man who passed away on January 4th, 2026 at the age of 93. And whereas after serving honorably for four years in United States Navy, Daniel Goodwin senior utilized the GI Bill to mastered the craft of barbering, opening the iconic Goodwin Spencer Street Barber Shop in 1955 alongside his beloved wife of over 70 years, Andre, and good friend Ernie Chambers. And whereas for nearly seven decades, Goodwin Spencer Street Barberhop served as more than a place of business, becoming known as the black city hall, where community members could gather and advocate for social progress and was immortalized in the 1966 Oscar nominated documentary, A Time for Bernie. And whereas Goodwin Senior was a passionate advocate for justice, participating in the historic 1963 March on Washington for jobs and freedom and hosted Malcolm X in the in Omaha as a member of the Citizens Coordinating Committee for Civil Liberties 4CL in 1964. And whereas Goodwin Senior was known for his generosity and willingness to help his neighbors and community members in need for mentoring generations of young people in the values of education, hard work, and self-respect. And whereas Goodwin Senior will be remembered for his love of the community with his legacy of perseverance, dedication, and good trouble, living on through his four children, 60 grand great grand and great great grandchildren who carry his memory and life's work forward on ensuring that North Omaha remains a vibrant and blackowned community. [clears throat] Now, therefore, be it resolved that the city council of the city of Omaha celebrates his lifelong service to the Omaha community honors his memory as a testament of individual who truly believe it is bigger than us and officially designates Tuesday, January 27th, 2026 as Daniel Mark and M. Goodwin Senior Day in Omaha, Nebraska. It witnessed thereof. And witnessed thereof, we have set our hands and caused the official seal of the city to be affixed on this 27th day of January, 2026. Thank you. [applause] >> And Dan, I didn't know if you maybe had a moment of words. >> Sure. First of all, I'd like to thank everyone um in the community, but also the mayor who was in attendance at his memorial service, Council President Danny Begley, and also Pete Fester and other dignitaries that attended. I think it's noteworthy to say that my father did the right things for the right reasons. He was never one that sought after attention or accolades, but he wanted what was best for the people, not only of his community, but of his city. He was a lover of people, and he always taught us to treat people the way you want to be treated. And so, I think it's very important that the legacy he left was to show people, no matter what your vocation in life, that you can make a difference. And I think it's very important to not forget that. So sometimes we think we're not big enough. We're not we don't have the right title, but if we make a difference where we live, it it it is impactful. Thank you. >> Thank you, Cler. We have time. You may be seated. I knew about him from afar, but as I had a nice chat for for a minute to talk to you after being at that service, I know your father and I think all the lives that he touched with the barbering he did for was it seven decades and the hall of fame, the longest serving in history. What a great legacy. And I know council member Goodwin said that when your dad passed it was you were trying to find the words and I and I told her I said he'll find the strength and boy did you that was moving and and your dad's on his birthday was proud looking down on you and all of us are as well. Uh, Charlie Sullivan, the the developer is in the audience as well to answer any questions um that I am not not able to. Um, the piece of property that we are looking at is located in the southwest corner of 156th and uh Potter Street. Uh to the north uh is an R4 zone neighborhood. To the west R5, to the south is the West View High School, which is also zoned R5 and then R5 to the to the east as well. Uh to give a little history on this site. Um we have had um I think two neighborhood meetings over the last couple of years. Uh we've had a prelim plat uh go before planning board and city council that were both approved for um this is that plat with an R5 zoning over the whole property. Um, we are currently looking to have the property zoned R4 for everything in the light yellow. And then there's a 2acre, this lot 22 um on the west end uh to be zoned R six. These are going to be single family homes. Lots one through uh 21 and then lot 22. uh we haven't really nailed down exactly what that product type is going to look like, but gives us the opportunity to have a little bit more uh a denser product uh for that for that piece. As far as density on the overall site, um we did have an option where we looked at what we could fit on that that piece. Let's see if I can find it. Um along that edge that R six um there is a uh sound attituation easement along 156 street and then we have a 35 ft set back along this side. So that 2 acres of the R six zoning really gets shrunk down. Uh with this layout here um we ended up with a total of 19 units. So, with the 21 single family homes and then what we think that we could fit possibly on that site, we're at 40 homes total. Uh, with an 11.7 acre um, a piece of property, that leaves our overall zoning at 3.4. So, at 3.4 acre or DU per acre fits in with the surrounding neighborhoods. Um I know the as an example the property to the west this R5 zoning uh they're at 37 per acre and we're at 3.4. So of an overall zoning perspective and number of units I think we fit well within the neighborhood as well. When Mr. Lippo was our teacher who developed Benson and we've noticed uh the streets and the cement and we've noticed he said you can't set foundations in the winter. So are these houses going to last 10 years, 15 years or is the cement they're using today is going to keep their buildings for 100 years like Benson development. That's all we're concerned about. the cheap material. Is it going to be good material or like the streets are when they put the asphalt or not asphalt but the the snow removal? Um and uh I've attended some uh well a uh community uh informational and uh I got to meet the developers and ask some questions and I think that uh it's there's going to be a lot of uh concrete being poured in this space. It's going to be a lot of impurable uh surface with a building with base uh and uh there you know there's talk about cement actually when I was in the uh county commissioners meeting earlier today I meant to say concrete but I said cement but uh the main thing is the the hard surface that everybody body knows. And sometimes it just the concrete depending on who's pouring it just just disintegrates especially in the cracks and where the divide and I don't think that this is that's going to be a problem with this project. I think that this is a quality project coming to the area. Uh even before construction begins. They've demonstrated a uh commitment uh to the neighborhood which is uh exciting and it's going to transform the area. Thank you. >> Thank you. Are there any other proponents? My recollection is town hall meeting was fairly well attended and um I walked away with the feeling that the neighbors around there fully supported you and I personally seen you talk to practically everybody in the room that had a question or concern and uh for that I want to thank you. You have taken probably the worst dilapidated site in South Omaha and turning it around to what truly will be a gem in the crown of South Omaha. I I made a phone call last week to uh Sheen who's one of our fire marshals and I just wanted to ask you know what kind of an impact did this update from the 2012 to the 2024 uh code for the fire code and she got right back to me with all the information that I needed and it's it all looks good. There's a little bit of a increase in fees but they haven't been increased since 2012. So I think they're appropriate and it's not a a significant amount. So I just want to give her a shout out. I was on a roll there for a little while. >> Item 60, Jud's Brothers Construction appeals the rejection of their bid from December 17th, 2025 for OPW54670 Oakills lift station replacement. >> This is not a public hearing. If anybody wants to speak for the company, then the city. Are you from Jud Brothers? >> Judge Brothers Construction. >> You can come and speak. >> Good afternoon, Kevin Steel. Jud Brothers Construction, 3835 North 68th Street, Lincoln, Nebraska. Uh on December 16th, Jud submitted a bid for the Oak Hills lift station. Uh Juds had the low bid. That project had a small emerging business uh limit of 1.5%. On the 9th of December, Jud solicited 30 SEB contractors in the city of Omaha to provide quotes on that project. Uh I also made a personal comment to Bam Bam Construction who is uh seated in the back uh subcontractor that Juds has used in the past. In fact, they currently are a subcontractor uh SEB subcontractor on City of Omaha OPW53538 Giles Road Siphon Project. They're we've worked with them uh in the past many times. A very quality uh contractor, does good work for the city, does good work for the contractors they work with. We went ahead and submitted their name on the uh forms for the SEB contractors and it was found out that they uh that their SEB certification had lapsed. They had forgotten to uh resubmit the paperwork which they did immediately once they knew that they had lapsed. Um our bid on that project was rejected since they were not currently certified. Uh I believe the intent of the SEB participation is for contractors to use qualified uh small emerging businesses. It is Jud's intent to use BAM Bam on this project uh as soon as they are reertified. We feel that for the city to wave this irregularity and to allow Jud Brothers uh to be awarded the project would help the city by taking the lowest cost on the project using a quality contractor Juds who you used on many contract uh contracts in the past and you would also be giving uh Jud would be subcontracting work to Bam Bam Construction, a qualified small emerging business. Uh like I said, although they their certification had lapsed, they're definitely uh re re uh submitted the applications to get resubmit reertified, which they were told would take approximately 3 weeks. That's been about a week or so. So hopefully within the next week to two weeks, they should be reertified. Uh this would save money, help the taxpayers, and I think in the long run, they would be giving us subcontracts. So, uh, it's following the intent of the law, which is to help small emerging businesses. I thank you for your consideration. Uh, I'd like to introduce uh Heather Tippy Pierce from the public works department to explain as far as on uh why this bid was rejected and a little bit of the history as far as on why uh uh the situation was. >> Do you want to go down? >> I want to recognize council member Hardy. >> Heather, before you um give the particulars of why it was rejected, um is is it the intent that this is going to be rebid anyway? Heather Tippy Pierce Public Works. Um after this rejection happened um purchasing um additionally rejected the two other biders under consideration. So yes, this project um has now had all biders um rejected and we will be rebidding the project. >> Okay. So I the reason I interrupted was I don't know if you want to continue on with the reason for it. um for the the reject why it was rejected. But knowing that all the biders were being rejected and it's going to be rebid >> um it maybe it's premature to do this but I would think to place it's on file >> would be an appropriate motion. >> No it does. Okay. >> All right. So I've been informed for those who couldn't hear. So I can't I can't make the motion to place it on file SB um agreed to or denied or or referred back. So if if you want to continue on otherwise uh I will at least put a motion on the floor to deny the the bid or as the legal department has just told me I could refer back to the department that uh so that they can rebet it. That's probably the appropriate action. >> Okay. >> Which is which is my motion. So, Judge Brothers in their appeal asked us to wave this as an irregularity. And unfortunately, um, just so everybody's clear, this section of the code specifies that the documentation for contractors and subcontractors, um, must be completed and approved by the human rights and relations department prior to the date of bid opening. So, you know, we recognize that um Juds Brothers and Bam Bam Construction do have a working relationship with the department based on the code itself, the department and um in in looking at this and in precedent of previous city council division decisions felt it was appropriate uh to reject this bid and urges the council to deny the appeal and refer the project back to the department. >> Mr. Bloom, did you want to add anything else to that then? >> Um, Jeffrey Bloom, City of Omaha Department. Uh, I I don't have much to add. I mean, uh, essentially, uh, uh, what, uh, Judge Brothers does describe as accurate. Uh, BAM construction has applied and is currently under consideration. has not been approved as far as to be an SEB program yet uh to be an SEB participant, excuse me. And uh they were not uh an um a registered SEB participant at the time in which this bid was submitted. So uh you know at this point uh uh my recommendation would be to the deny the appeal and since uh all biders have been rejected they will get an opportunity to bid again as far as once it is put out for rebid. Is that correct? >> Is that terminology acceptable? Mr. >> Yes, that is. >> So, just so if I can get clarification, uh, Mr. Kuzzi, if if this is referred for rebidding, do we have to reject or deny the appeal in order for them to rebid? >> Referring it back, sorry, Makuzi Law Department, referring it back to the public works department is also an acceptable action that the council can take on a bid rejection. As a clerk, and I agreed, you can approve the appeal, you can deny the appeal, or refer back to the department. Given the statements made by Miss Tippy Pierce today and Mr. Bloom. I think the best course of action um is what council member Harding said in terms of referring it back to the department for them to do a rebid, which they're going to do. Um it's the stated intent to do that anyways. >> And that's open to everybody to rebid as well. Correct. >> Correct.
