Based on the context provided and the names mentioned within the dialogue, here is the formatted transcript. Note: There appears to be a slight discrepancy between your provided list and the names spoken in the transcript (e.g., the transcript mentions Council Members Her, Ingelbrigtson, and Olson, who may have been elected or appointed recently). I have used the names as they were identified during the roll call and throughout the meeting. *** **[00:00] Mayor Kevin Zabel:** All right, ladies and gentlemen, let's go ahead and call to order the regular meeting of the Oakdale City Council for April 11, 2023. Well, the clerk took the roll. First up on the agenda tonight is the approval of the agenda. We have a slightly amended copy in front of us. Council members, are there any other changes? If not, I will look for a motion to approve the agenda as amended. **[00:40] Council Member Andy Morcomb:** So moved. **[00:42] Mayor Kevin Zabel:** There's a motion. Is there a second? **[00:43] Council Member Mai Mang Her:** Second. **[00:44] Mayor Kevin Zabel:** Motion and a second. Final comments? All those in favor say aye. **[00:47] All Council Members:** Aye. **[00:48] Mayor Kevin Zabel:** Opposed? And the agenda is adopted. Next up is approval of minutes. First set is the workshop meeting minutes from March 28, 2023. Council members, any changes? Final comments? All those in favor say aye. **[01:21] All Council Members:** Aye. **[01:22] Mayor Kevin Zabel:** Opposed? And those are approved as well. Next up, we have Open Forum. This is an opportunity on the agenda for residents to step up to the podium and share anything on their mind with the City Council. Before we do that, we have a proclamation and a presentation. So I'm going to go ahead and start with the proclamation recognizing April as Fair Housing Month in the City of Oakdale. So if my colleagues will indulge me for a little bit, we'll read through this. [The Mayor reads the Fair Housing Month Proclamation]. Therefore, I, Kevin Zabel, Mayor of Oakdale, do hereby proclaim the month of April 2023 as Fair Housing Month in the city. And tonight we are joined by Deanna Weiner, a representative of the Saint Paul Area Association of Realtors, an Oakdale resident and an Oakdale business owner with Cardinal Realty. And I believe you're going to share with us briefly some information from SPAR about fair housing. **[03:40] Deanna Weiner:** Well, first of all, Mr. Mayor, council members, I'm just so proud to be a citizen of Oakdale and that you've taken this initiative to make this a Fair Housing Month for our city. So thank you. [Deanna Weiner speaks about the history and importance of the Fair Housing Act and the work of the St. Paul Area Association of Realtors]. Thank you very much. It's nice to see you all. I'm sorry I haven't met all of you before, but thank you. **[05:20] Mayor Kevin Zabel:** Council, let's hop down there and take a quick picture with Deanna. [The Council takes a photo]. Thank you very much. Next up, I want to welcome Monica Stiglitz, an Oakdale resident who has been serving on the 3M water settlement advisory committee for a number of years now, I believe, who's going to be sharing some information with us about the Priority Two segment of the settlement plan. Welcome, Monica. **[06:05] Monica Stiglitz:** Thank you for the introduction, Mayor. Again, my name is Monica Stiglitz. I've been a resident of the community since July 1974. [Monica Stiglitz provides an extensive presentation on the 3M water settlement, the transition from Priority One (Drinking Water) to Priority Two (Natural Resources), and the upcoming grant/RFP process]. **[18:10] Mayor Kevin Zabel:** Monica, on behalf of our city, thank you so much for all the work you've put into this. We know this is—this has been a long process—and having somebody with your passion for the community and professional expertise is incredibly beneficial to what we're trying to do at the city. So thank you. **[18:30] Monica Stiglitz:** Well, you're welcome. And as I said, I think you can probably track me down if you ever wanted to have any other questions, and for sure through Christina, you know, we do talk. Okay, thank you so much for the time. **[18:45] Mayor Kevin Zabel:** Thank you very much. Council members, lastly on the Open Forum, let's go ahead and open things up to anybody in the audience that might want to share anything with us. If there's anybody in the audience, please feel free to step up, state your name and address for the record. [Pause]. Seeing no one, let's go ahead and move forward to consensus motions. Council members, tonight we have A through I. Are there any individual ones that council members would like to pull for individual consideration? If not, I'll look for a motion for A through I. **[19:15] Council Member Jake Ingelbrigtson:** Make a motion to approve consensus motions A through I as presented. **[19:18] Mayor Kevin Zabel:** There's a motion. Is there a second? **[01:20] Council Member Mai Mang Her:** Second. **[19:22] Mayor Kevin Zabel:** Motion and a second. Final conversation? All those in favor say aye. **[19:25] All Council Members:** Aye. **[19:26] Mayor Kevin Zabel:** Opposed? [Council Member Ingelbrigtson interjects]. Sorry, Council Member Ingelbrigtson got in under the buzzer. Opposed? And those are approved. Next up we have check-ins with the advisory boards and commissions. Looks like the only one that has met since the last time the City Council met was Planning Commission on April 6th. Council Member Ingelbrigtson, as liaison, do you have an update? **[19:45] Council Member Jake Ingelbrigtson:** Uh, yeah. Just we had two accessory building applications, one of which was really interesting in that he presented a photo of what it was going to look like, but it was such a good Photoshop job that the entire commission thought that he had built it and then was asking for permission. It was pretty comical, and it did all get straightened out, but it was—yeah, it was a good Photoshop job that this individual did. So everything was good. I'm sure we'll see those applications probably at the next meeting. You'll probably see the picture too. **[20:15] Mayor Kevin Zabel:** There we go. All right, moving forward: Staff Reports. Police Chief Newton, are you joining us? This item is the Animal Humane Society shelter agreement. **[20:25] Police Chief Nick Newton:** Good evening, Honorable Mayor, members of the Council. I'm here tonight to talk on the need for the city to enter an agreement with the Animal Humane Society for animal impound services. [Chief Newton explains the transition away from St. Paul's services and the partnership with Companion Animal Control]. With that, I'll turn it over to you, Mayor, and stand for any questions. **[21:25] Mayor Kevin Zabel:** Thank you, Chief. Council members, any questions for Chief Newton? **[21:30] Council Member Olson:** Does Companion Animal Control anticipate that they're going to have their new building soon, or this year or next year? **[21:40] Police Chief Nick Newton:** So, they were hoping that there'd be other animal shelters that will be taking on new clients... [Chief Newton clarifies the building status and shelter partnerships]. **[22:15] Council Member Olson:** So it's really not their—I was under the impression that it was their building that they were waiting to build, and it's not? They're partnering with other shelters then? **[22:25] Police Chief Nick Newton:** Correct. Yes, correct. **[22:26] Council Member Olson:** Oh, okay. I had no idea. I thought we were waiting for them to expand now. **[22:45] Council Member Andy Morcomb:** Point of order there, Mayor. Mr. Mayor, maybe I could clarify. I think I was part of the confusion there, Council Member Olson, Chief. So the one we were talking about last year was the other one—the Otter Tail, right?—that they never really built their building. Is that what happened? And we're hoping that they do build their building. So, Companion Animal Control stepped in in the meantime. Is that about right? **[23:05] Police Chief Nick Newton:** No, we use Companion Animal Control as the people that come out and evaluate the animals... [Chief Newton provides further technical clarification]. **[23:45] Council Member Olson:** I know they've been really helpful in getting animals back to their homes. Very helpful. I was just misinformed or under the wrong impression that it was their shelter that we were waiting for them to build. So thank you for clarifying. **[23:55] Police Chief Nick Newton:** Yeah, no problem. **[24:00] Mayor Kevin Zabel:** Council members, any other questions for the Chief? Seeing none, I'll look for a motion. **[24:05] Council Member Andy Morcomb:** Make a motion to authorize the Mayor and City Administrator to enter into an agreement with the Animal Humane Society. **[24:10] Mayor Kevin Zabel:** There's a motion. Is there a second? **[24:12] Council Member Jake Ingelbrigtson:** Second. **[24:13] Mayor Kevin Zabel:** Motion and a second. Final comments? All those in favor say aye. **[24:16] All Council Members:** Aye. **[24:17] Mayor Kevin Zabel:** Opposed? And that is approved. Thank you, Chief. Next up we have our City Attorney, Jim Thompson, who is joining us via Zoom. Jim, can you hear us? **[24:25] City Attorney Jim Thompson:** Yes, yes. Can you hear me? **[24:27] Mayor Kevin Zabel:** We can. Do you have an update for us tonight? **[24:30] City Attorney Jim Thompson:** Nothing to report tonight, Mayor and Council, but happy to answer any questions. **[24:35] Mayor Kevin Zabel:** Thanks, Jim. Anybody have questions for the City Attorney? All right, thanks Jim. Okay, Administrator's report: Ms. Volkers. **[24:45] City Administrator Christina Volkers:** Thank you, Mr. Mayor, City Council. If you have any legal questions on this item, [Jim Thompson] is still available. So, this is on the agenda today—what I have on the agenda today is a donation of the 3M property for the new Public Works facility at 32nd and Granada in Oakdale. We've been talking to 3M for five years now since 2018. [Christina Volkers explains the land donation, the PFAS contamination cleanup agreement, and the requirements for a vapor barrier]. I would recommend that somebody make the motion to authorize the donation and for us to enter into the agreement as such. Thank you. I'll stand for any questions. **[26:15] Council Member Andy Morcomb:** Yeah, I had a comment and a question, I suppose. I know this is just over nine acres of land that's being donated, correct? And I want to make sure... that for the MPCA, if this is a Brownfield site, that the remediation is for the entire property, correct? And not just the portion of where we're building Public Works? **[26:35] City Administrator Christina Volkers:** It is. Council Member Morcomb, Jim Thompson, City Attorney, is on, he can add to this. I did check with legal on this; it is for the entire site. City Attorney Thompson, do you have anything to add to that? **[26:55] City Attorney Jim Thompson:** No, Chris, that that's a correct summary. **[27:00] Council Member Olson:** I have no questions but just a comment. As you guys know how I feel about this piece of property from a long time ago, so I will be voting no because I'm not comfortable with the safety of the property. I'm also not 100% sure remediation is going to work, and I don't feel comfortable putting the residents and staff in that position at this time. I'm not saying that once we get the remediation reports back and everything looks safe, maybe I'll change my mind, but at this time I'm not prepared. **[27:25] Mayor Kevin Zabel:** Do you want a roll call? **[27:26] Council Member Olson:** Yes, please. **[27:27] Mayor Kevin Zabel:** Okay. Council members, state law requires since this is a real property donation that it be approved with a two-thirds majority, so just keep that in mind. A roll call has been requested. So first things first, council members, if there's no additional comments, I'll look for a motion. **[27:45] Council Member Andy Morcomb:** I will make a motion to authorize the Mayor and the City Administrator to enter into the real property donation agreement between 3M Company and the City of Oakdale. **[27:55] Mayor Kevin Zabel:** There's a motion. Is there a second? **[27:57] Council Member Mai Mang Her:** Second. **[27:58] Mayor Kevin Zabel:** Motion and a second. Final comments? **[28:00] City Administrator Christina Volkers:** Mr. Mayor, I'm sorry. Part of that motion should also say "and to adopt Resolution Number 2023-41." **[28:10] Mayor Kevin Zabel:** Do you just want me to repeat it, Jim, with that? **[28:12] City Attorney Jim Thompson:** You can just say, "I add that to my motion and to adopt Resolution 2023-41." **[28:18] Council Member Andy Morcomb:** Yes, and I would like to add to my motion that we are adopting Resolution 2023-41 to the amended motion. **[28:25] Mayor Kevin Zabel:** I'll look for a second. **[28:26] Council Member Mai Mang Her:** Second. **[28:27] Mayor Kevin Zabel:** Motion and a second. The clerk will take the role. **[28:30] City Administrator Christina Volkers:** Council Member Her? **[28:31] Council Member Mai Mang Her:** Yes. **[28:32] City Administrator Christina Volkers:** Council Member Olson? **[28:33] Council Member Olson:** No. **[28:34] City Administrator Christina Volkers:** Council Member Morcomb? **[28:35] Council Member Andy Morcomb:** Yes. **[28:36] City Administrator Christina Volkers:** Council Member Ingelbrigtson? **[28:37] Council Member Jake Ingelbrigtson:** Yes. **[28:38] City Administrator Christina Volkers:** Mayor Zabel? **[28:39] Mayor Kevin Zabel:** Yes. The vote is four to one. The motion 2023-41 is approved, and the contract will be signed. Council Presentations—I guess I'll take this one. One item under here is to update the board and commission assignments for 2023, just a small tweak to two of the commissions with the addition of Council Member Her joining the ranks. Council members, I would look for a motion. **[29:05] Council Member Olson:** I'll make a motion to affirm the update to the appointments for the boards and commissions liaison for 2023 as noted in the attached. **[29:12] Mayor Kevin Zabel:** There's a motion. Is there a second? **[29:13] Council Member Andy Morcomb:** Second. **[29:14] Mayor Kevin Zabel:** Motion and a second. Final comments? All those in favor say aye. **[29:17] All Council Members:** Aye. **[29:18] Mayor Kevin Zabel:** Opposed? And the assignments are updated. Individual council member presentations. Andy, would you like to go first? **[29:25] Council Member Andy Morcomb:** Yeah, I just wanted to say thank you real quick. We just closed out our survey for the Commons Park and we had over 200 people that gave feedback... [Andy speaks about the park survey and requests for swings and zip lines]. **[29:45] Mayor Kevin Zabel:** Good deal. Council Member Ingelbrigtson? **[29:47] Council Member Jake Ingelbrigtson:** I have nothing, thanks. **[29:48] Mayor Kevin Zabel:** Council Member Olson? **[29:49] Council Member Olson:** Nothing for me. **[29:50] Mayor Kevin Zabel:** Council Member Her? **[29:51] Council Member Mai Mang Her:** Nothing from me. **[29:52] Mayor Kevin Zabel:** Alrighty, I have a few. Just a reminder if you have questions about your property valuation statement, Washington County is hosting four open book meetings... [Mayor Zabel lists upcoming community announcements, including property valuations, branch disposal at Public Works, shredding events, Arbor Day tree giveaways, and citywide garage sales]. That's all I got. Should we pay some bills? All right, council members. Claims. The claims roster covers March 29th through April 11th in the amount of just over a million bucks. I'll look for a motion. **[31:10] Council Member Jake Ingelbrigtson:** Make a motion to approve claims as presented. **[31:12] Mayor Kevin Zabel:** Motion. Is there a second? **[31:14] Council Member Mai Mang Her:** Second. **[31:15] Mayor Kevin Zabel:** Motion and a second. Any comments? All those in favor say aye. **[31:18] All Council Members:** Aye. **[31:19] Mayor Kevin Zabel:** Opposed? Bills are paid. I will look for a motion to adjourn. **[31:22] Council Member Andy Morcomb:** Motion. **[31:23] Mayor Kevin Zabel:** Is there a second? **[31:24] Council Member Jake Ingelbrigtson:** Second. **[31:25] Mayor Kevin Zabel:** Motion and a second. All those in favor say aye. **[31:27] All Council Members:** Aye. **[31:28] Mayor Kevin Zabel:** Opposed? Thank you, and good night.
