THE FIRST IS SHARON OVERALL. >> I AM OFTEN ASKED WHY I'M SO PASSIONATE ABOUT SMOKING BANS. THE ANSWER IS THAT I NEARLY DIED BECAUSE OF SECOND HAND SMOKE. I WAS ABOUT 9 YEARS OLD, AND I ENDED UP WITH BRONCHIAL PNEUMONIA. I MISSED MY GRANDMOTHER'S 70th BIRTHDAY PARTY AND FAMILY REUNION. S I LAID THERE IN BED FOR TWO WEEKS, I VOWED THAT I WOULD SOMEWHERE MAKE IT WHERE NO ONE WAS EXPOSED TO SECOND HAND SMOKE WITHOUT THEIR CONSENT. I REALIZE NOW THAT IT'S THE SMOKERS' RIGHTS THAT BEING INFRINGED UPON BY SMOKING BANS HAS BEEN THE NONSMOKER'S RIGHTS THAT HAVE BEEN TRAMPLED ON FOR OVER A CENTURY. I CANNOT UNDERSTAND WHY A 9-YEAR-OLD CAN UNDERSTAND THIS AND ADULTS CANADA. WHY SHOULD NONSMOKERS BE EXPOSED TO CANCER-CAUSING CHEMICALS AND SPIT IN THE SECOND HAND SMOKE WITHOUT THEIR CONSENT? THE ASSOCIATED PRESS STATED IN 2020 THAT BE BEING ABLE TO SMELL SMOKE MIGHT BE A RED FLAG, THAT YOU'RE TOO CLOSE TO THE SMOKER. THE SMOKER EXHALES RESPIRATORY DROPLETS WHEN SMOKING AND VAPING THAT CAN CARRY THE CORONAVIRUS. REMEMBER THAT WIND CAN BLOW SMOKE FOR OVER 100 FEET. WHY SHOULD 40,000 NONSMOKERS DIE EACH YEAR? EVEN BRIEF EXPOSURE CAN TRIRG A HEART ATTACK OR AN ASTHMA ATTACK. THE ANSWER IS BECAUSE THAT IS THEAYT'S ALWAYS BEEN REALIZE THAT WE HAVE TO GO BACK TO THE BASICS AND CHANGE THE MINDSET OF THE PEOPLE AND MAKE THEM REALIZE THAT THE RIGHTS OF THE NONSMOKER TO NOT BE EXPOSED ANYWHERE ARE MORE IMPORTANT THAN THE RIGHTS OF THE SMOKER. I SERIOUSLY DOUBT THERE'S ANYONE IN THE ROOM THAT BELIEVES THAT TODAY. I REMEMBER WHEN YOU COULD SMOKE AIRPLANES AND IN HOSPITALS. CAN YOU IMAGINE SMOKING INSIDE OF A HOSPITAL TODAY? CAN YOU IMAGINE BEING ON AN AIRPLANE WITH SMOKERS? WE ARE REALIZING THAT SMOKERS NEED TO KEEP THEIR SMOKE FROM OTHERS, BUT THE 25 FEET FROM THE DOOR IS A JOKE. VESTIBULES AT THE MALL ARE FILLED WITH SMOKE, AND HAVE YOU TO GET THROUGH THE SMOKERS' ALLEY JUST TO GET INSIDE. MANY CITIES ARE BANNING IT FROM ALL SIDEWALKS, STREETS, AND PARKS. SMOKERS HAVE NO RIGHT TO SMOKE ON CITY-OWNED PROPERTY. WE NEED TO TAKE THE NEXT STEP. THAT PERSON IS TOUCHING ANOTHER PERSON WITHOUT THEIR CONSENT. THE CITY OF -- HAS THE FOLLOWING ORDINANCE. THE NON-CONSENSUAL EXPOSURE TO SECOND HAND SMOKE AND THE UNINVITED PRESENCE OF SECOND HAND SMOKE ON PROPERTY AND VIOLATION OF THIS CHAPTER SHALL CONSTITUTE A NUISANCE IS PROHIBITED AND IS MADE UNLAWFUL. IT VERY CLEARLY SAYS THAT THE LAND MUST BE USED TO THE FULLEST OF ITS ABILITY AND TO THE DEGREE OF INTENSITY. NOW, IF WE'RE HAVING TO MOW 250 FEET OFF THE BACK OF THE CURB, WE CAN'T MEET THE QUALIFICATIONS JUST IN THAT ONE SECTION OF THE LAW, WHICH THAT'S A STATE LAW OVER CITY LAW. THE OTHER THING I'M GOING TO BRING TO YOUR ATTENTION, EVERY CITY MAINTAINS THE CITY WITH A PROPERTY TAX, AND TO KEEP THE CITY RUNNING EFFICIENTLY. NOW, THERE'S USUALLY A ROAD ON IT OR AN EASEMENT OR A RIGHT OF WAY FOR THE ROADWAY, WHICH IS IF THE CITY IS COLLECTING TAXES TO MAINTAIN THE CITY AND TO KEEP IT UP AND RUNNING, ACCORDING TO THE ATTORNEY GENERAL, YOU CAN'T CHARGE US FOR THAT. THAT IS MAINTAINED BY THE CITY. THE SEWERS THAT ARE YELLOW ON THE MAP ARE LESS THAN 10 YEARS OLD, AND IT GOES ALL THE WAY TO DOWN, WHICH IS MORE THAN 50 YEARS OLD. THE AVERAGE AGE OF SEWER IN THE CITY OF PLANO IS 26 YEARS. WE HAVE OVER 1,000 MILES OF PIPE, AND WE HAVE OVER 15,000 MANHOLES AND EIGHT LIFT STATIONS. IT'S A LOT TO MAINTAIN. THEN WE DO MANHOLE AND SEWER INSPECTIONS. THE OVERFLOW INITIATIVE VOLUNTARY PROGRAM, AND THAT FOCUSES ON TROUBLE SPOTS THAT HAVE FATS, OTHERWISE, AND GREASE OR FOG. WHEN THAT STUFF COOLS, IT CLOGS UP THE SEWER CLINE LINE, AND YOU CAN NEVER STOP IT. THIS IS ANOTHER SLIDE SHOWING WHAT OUR CREWS ARE DOING. THE AVERAGE AGE OF OUR STREETS IS 38 YEARS. ALMOST ALL OF THEM ARE CONCRETE, EVEN THE ONES THAT ARE OVER LAID ARE STILL CONCRETE STREETS. IT'S ABOUT A THREE-QUARTER INCH THIN SEAL ON TOP OF THE PAVEMENT. WE HAVE ABOUT 1,200 LANE MILES OF MAJOR DIVIDED STREETS, AND THE COST TO REPLACE THOSE TODAY WOULD BE $1.8 BILLION. WE HAVE ABOUT 1,500 MILES OF TWO OF HAD LANE RANTAL STREETS, AND THE COST TO REPLACE THOSE WOU BE .2 BILLION. YOU'RE LOOKING AT $4 BILLION OF ROADWAY INFRASTRUCTURE, AND THAT NUMBER KEEPS GOING UP EVERY YEAR. WHEN YOU TALK ABOUT A PAVEMENT MANAGEMENT PLAN IT ALL STARTS HERE AT MARK'S FAVORITE GRAPH. WE'VE IMPROVED OUR FUNDING FOR THIS, AND NOW WE'RE ABLE TO DO PREVENTIVE MAINTENANCE ON STREETS THAT ARE A AND B CATEGORY THAT HELPS THE PAVEMENT LIFE, AND AS THE STREETS GO DOWN TO THE B, C, AND D CATEGORY, WE CAN DO A REHAB. YOU SEE THE COST. IT'S 100,000 MILES. IT'S ABOUT 2 MILLION A MILE TO DO A CONCRETE REPAIR AND OVERLAY ON A MAJOR STREET, AND IT'S ABOUT 12 MILLION DOLLARS A MILE. WE HAVE TO KEEP IT OPEN TO TRAFFIC. IT TAKES A LOT LONGER AND IS MORE COSTLY TO DO THAT. R PAYMENT PROGRAM EXTENDS THE LIFE OF THE PAYMENT SYSTEM WELL BEYOND THAT 30-YEAR DESIGN LIFE. H POTHOLES, WE DID OUR FIRST EVER PRO ACTIVE SURVEY WITH WHERE OUR INSPECTORS ON RAINY DAYS WHERE CONTRACTORS AREN'T WORKING WE MADE AN APP FOR THE PASSENGER TO GO AND TAP THEIR PHONE EVERY TIME THEY SAW A POTHOLE. WE HAD 3,400 POTHOLES WE FOUND AND HAD TO REPAIR IN THREE MONTHS. IN 2020 WE HAD LESS THAN 1,000 AND NOW UNDER 500 POTLES. RY HAPPY WITH THIS PROGRAM. OUR RESPONSE TEAM HAS GONE FROM 20 DAYS ON AVERAGE TO LESS THAN FIVE. I CAN TELL YOU THE MAJORITY OF OUR POTHOLES ARE ADDRESSED WITHIN 24 TO 48 HOURS. WE HAVE MINOR ONES THAT WE KIND OF HANG OUT THERE UNTIL CREWS ARE IN THE AREA TO FIX IT. IT'S PART OF THE AVERAGE. BRIDGES. I'M SURE YOU HAVE HEARD ABOUT SOME BRIDGE COLLAPSES HERE. I THINK WE HAD ONE IN PENNSYLVANIA AND A WHILE BACK IN MINNESOTA. WE HAVE A PRETTY ROBUST BRIDGE PROGRAM WHERE TX DOT IS REQUIRED TO INSPECT ALL OF ARE OUR BRIDGES AND BRIDGE CULVERTS EVERY TWO YEARS. WE GET REPORTS FROM THEM, AND THE ENGINEERING DEPARTMENT TAKES THOSE REPORTSND HIRA STRUCTURAL CONSULTANT TO LOOK AT THAT, TAKE THE TOP 20 OR 30 BRIDGES AND GO DOWN REAL INSPECTIONS THERE. WE HAVE PICTURES AND EVERYTHING ELSE. THEY TAKE THAT INFORMATION, DESIGN PLANS FOR REPAIR AND THEN MAKE THE REPAIRS. I CAN TELL YOU, THIS IS VERY HELPFUL WHEN WE HAD A WATER MAIN BREAK ON SPRING CREEK. IT WAS AT A BRIDGE, AND THERE WAS CRACKING THAT I SAW THERE, AND I CALLED ENGINEERING AND SAID, HEY, THIS IS ONE OF THE BRIDGES THEY LOOKED AT. YES. WERE THESE CRACKS HERE, AND ARE THEY A BIG DEAL?
