Portland Lake Hugo Lial streets with all work to be performed in the right of way Mr chair I may I think 5 C2 should be removed from the consent agenda I have a few comments I'd like to make on that that's the kayak Pol storage policy think we need some additional language there actually too that's part of our supplement package here so but I I you I presume that because it's listed is 5 C2 in the supplemental package it's still part of the consent agenda okay all right uh we will we just delete that item for now yes or table it I would say all right so noted uh with that do I have a motion yeah they're fine with that uh we'll have that review ready uh they sent an email waving the 60-day review to that February 4th date again so recommendation tonight is continuation till February 4th all right Tom just a point of interest if if they've waved it how long can we we keep continuing this as long as they keep waving it unless Chad actually it's it's an definite waiver when they voluntarily wave it it's indefinite okay so they don't have to keep coming back to us to no no it's when you elect to continue it which you have the right to then you're subject to 60 days okay so but when they wave it it's indefinite yeah and I think they technically they waved it until tonight so I asked them to continue that waiver just in case probably get to clarify clarify the waiver with them make sure they they understand it's waving till the next next town board meeting all right so uh what was the date on that February 4th so I would need a motion for continuance till February 4th amendment to consider amending section three and Section 8 of ordinance number 35 uh relating to vegetation clearing Tom that's also yours that's also mine been working with the Planning Commission over the past several months uh to uh in discussions on the uh Lake Shore properties clearing of vegetation is seems to be an issue [Music] uh hang on Tom I'm a little technical difficulty here I moved I'll second that motion been made and second in all in favor say I I I okay Tom sorry okay so what's happening here is a Planning Commission has made a recommendation to modify the zoning ordinance specifically the Shoreland management section of the zoning ordinance uh uh dealing with properties anywhere from a th000 ft or closer to a lake the current uh we've been struggling a little bit with the definition of clear cutting clear cutting is not allowed around the lake but it's not defined well enough where we were happy with it so the Planning Commission staff been working together to come up with some modifications to the ordinance uh the current ordinance wording prohibits intensive vegetation clearing but it's poorly defined um what it uh what it means is the complete removal the current definition means the complete removal of trees or shrubs in a continuous patch strip row or block we found that a little bit vague and decided to review other community ordinances and talk about modification of that section to come up with a better n better definition and that's what we did we invented a definition um and recommended several zoning ordinance amendments as a result uh first one is to Define what what Legacy trees are and uh that's a new definition that would go under 3-35 of the ordinance Legacy tree would be defined as a a tree that has been spared or has survived stand replacing disturbances a Legacy tree is any live tree greater than or equal to 21 in dbh which is diameter at breast heght and greater than 150 years old located in an old a non Old Forest stand so we're defining those trees and then we're also defining significant trees another new definition those would be defined as a significant tree as an aspen quaking or Big Tooth honey locust Butternut mountain ash blue Beach tamarak Hickory Oaks Birch Pine Spruce Basswood Hackberry Walnut and maple except silver maple fruit trees such as Apple cherry and other native fruit bearing trees and trees exceeding 15 in in diameter uh measured 4 and 1/2 ft above the ground so ad recommend from the Planning Commission to adopt those two uh definitions and then the new amendments that they're recommending would be 8 a new section 8- 6.5a and uh would allow limited clearing of trees and shrubs cutting and pruning and trimming of trees to accommodate the placement of stairways Landings picnic areas access paths Beach Watercraft areas access areas and permitted water oriented access structure accessory structures or facilities as well as providing A View to the water from the principal dwelling site Ure and Bluff impact zones and on steep slopes is allowed provided that the screening was structures vehicles or other facilities as viewed from the water assuming some Rel leaf on conditions is not substantially reduced that's existing word then we're talking about modifying the second section there which currently says the above Provisions are not applicable to the removal of trees limbs or branches that are dead diseased or pose safety hazards eliminating that section and replacing with it with the following the above provisions are not applicable to the removal of vegetation that is dead diseased or hazardous must be removed to prevent the spread of disease or insect pests as diagnosed and recommended by a licensed arborist removal of invasive non-native species restoration and erosion control activities consistent with a plan approved by the town board The Rice Creek Watershed District or Volo next section is recommended to be added section section three tree removal in the shore Impact Zone is limited to 10% of the existing significant trees section four a new addition Legacy trees shall not be removed unless they are dead diseased dying or hazardous is defined by town setaf or a licensed arborist and then the final section recommended to be added is the town May approve removal of existing significant trees on a lot exceeding 10 % of the Shor Shore Impact Zone limitation when a Rel Landscaping plan is approved by the town board so there is an opportunity to remove some of those trees but they have to provide a landscaping plan and has to be approved by the town board so those are uh re have been reviewed by the Planning Commission are recommended to be added to the zoning ordinance um this was somewhat initiated by uh um residence clear cutting shorelines yeah that was the impetus uh we've seen some pretty significant tree removal so we're trying to protect the erosion off the banks that's one of the reasons why you want those there yeah the ice issues um you know they move all those trees that that ice or the tree roots help stabilize the shoreline and so we want to make sure that we're not allowing that to happen so it push back unnecessarily the shoreline after ice out mhm so Tom is there a reason um this Legacy tree definition says uh it must be diameter breast height but yet the significant tree says 4 and 12 Ines above the ground yeah you caught that too I caught it when I was reading it they should be consistent yeah and it should say should it say above grade instead of above ground yes so we can make which do you prefer as long as as long as they're both consistent is the standard I'd stick with that is it it's not is it how about the greater ground all at from because I you got a foot of leaves on the ground is that the ground a grade is is the actual dirt so I it might just be a a technical thing but but either way both of them should be I would think consistent matter what if we go with one or the other I guess it doesn't matter yes got anything else I leared something new do you can I make another suggestion maybe so on that the above peris are not appal the removal of the vegetation is dead diseased hazardous or storm damaged which uh which number you on there uh B the two is that right that that page 74 the two is that correct number Roman number two yep at the first sentence just I don't know if it provide more clarity but storm damage is a you know it does happen it has happened in the township so so how do you want that to read Dale well I just suggestion that um the above Provisions are not applicable to the removal of vegetation that is dead diseased hazardous or storm damaged okay because technically storm damage doesn't mean it's hazardous either but that work for you Tom yeah we can add that all right Steve you got anything else no I just to point the last in that part two that approved by the town board and Rice Creek Watershed oral that covered both of the agencies that also have some oversight but we want to make sure the town board was in the loop the Planning Commission so it's clear that it's a town board item and either or are those other two so it reads and Rice Creek or that would be a technical thing for the attorney does it does it have to be and and and or just obviously one of them be one of the other so that reading I think the way it reads right now is preferable and does that Vol have to be spelled out technically or probably should because I mean we understand what the acronym means but uh I can remember one time when I forgot it in case in case it modifies it some point down the road yeah that's a good point yeah it would be the vness lake area water management organization actually what now you bring that up it should probably should say Town board and Rice Creek Watershed district and and or V or vness Lake Area ad Lake area water management organization their successors or their successors that's probably good point and we don't want to bring it back getting all these drone and Mr chair I hate to oh bog things down a little bit further here but since specific to Dale's comment in an addition that seems to be acceptable to the board and staff uh has or wasn't added under the the offices of the Planning Commission do we have to bring this back to the Planning Commission before there before it's approved here tonight I we'll refer to the attorney but I got to believe it's recommended you know the the plan commission simp be recommend so even with the changes even with the changes okay um Mr chair I'd say it probably doesn't my opinion is that it it will have no significant impact to bring it back because in theory they're getting what they think is appropriate we're just cleaning up a couple words their intent is their intent is there I don't think it needs to be delayed it'd be different if you're radically changing their intent but you're not you're again you're cleaning things up so can I add one more comment oh now you have to bring it back well just to for consistency is under Roman number four the Legacy tree probably just add you uh either personal injury or property damage due to use of it and that um that we should probably also verify with our insurance the insurance trust that this is covered I assume it would be but we should make sure of that as well my whole point being is you know this is creating a potential liability on on the township and whoever uses it uses it at their own risk right we're looking to with your uh suggested modifications you want to continue this till we can verify this with the insurance company yeah we should I think we should besides you know we have a month or two before it's yeah so Chad I a question for you would would it be better to take care of that also in the is there an application process that they have that should be part of the application fact should be I would suggest it be a notice you know and notice bold notice saying you know this is ADD you know the township takes no responsibility for personal injury or property damage resulting from use of this uh of the rack and that uh it's this is being done at your own risk I think we already have that in uh in our policy when they when you uh rent if we do a Park rental it's already in there as well so same take that one sure this is uh grant funding was received from the state legislature to help us plan portions of the around the lake whitee Lake Trail specifically this section deals with the highway 96 section on the North End of the lake it's split between the township and the City of White Bear Lake uh been working with Toby Muse an engineer at se who does Trail planning to put together a proposal that would be jointly funded by the city and the town again from with legislative funding to plan the corridor uh or a trail couple of Trail options along that Highway 96 Corridor and it's $222,000 available able split between the city and the town uh the SE proposal defines the following activities to be performed as part of their service uh meetings as necessary review plans with Ramsey County and mindat since that's a m. RightWay collect data from aerial photos reports Etc on the site uh delineate the wetlands review utility locations identify Trail alignment and additional RightWay needs based on the trail alignment and identify two separate Trail options along the corridor and then also analyze two Crossing options or configurations at the intersection of Portland and 96 which is a concern raised by the neighbors there and members of the white bear Beach Community Club proposal goes on to provide cost estimates crosssections and a geometric layout and identif ify storm water drainage uh the timing for this proposal would be uh have an alignment within 3 weeks and then completion of the project within six weeks of approval they'd also provide multiple copies of the plan so it's a it's a two-step uh process here uh one we want to put together and approve a joint Powers agreement with the city of white bear to split the cost differences and then also approve a contract with SE for the Design Services as defined um who takes the lead on this under the joint par the town does okay so are the funds coming to the town first first to the city good question I think we'll have to request the funding so if the town's in charge we would do that okay Chad made Chad made a couple changes to uh The Joint Powers agreement specifically to um who's answering to who and how um which makes us the primary puts us in the primary position so right exactly and it was agreed to upon by the white bear so they've seen the changes that we've got here yeah yeah they were sent to their town to the City attorney City attorney okay so we request the 22,000 split equally I mean they don't have to request 11 and US 11 do they I say we request the 22 and see what happens that's it sounds like if we're in the lead we we're in the lead we would request the funding provideed the funding to the city when they requested it from or when we get the bill from from well it may not be a bad idea to Simply add language to the jpa to the Joint pars grp and simply saying that the uh City will cooperate any funding requests made by the town I I think that's a fair addition so that there's no confusion down the line that well we didn't get our say so it's I I think we should add that personally this it's a good point I mean it's protection for everybody no disagreement then so is the amount that um SE is going to be billing coming out of the 22 correct all right we not to exceed that amount yeah basically it's split to tell us satisfied it's about half the trails in the town half's in the city but it's clarified but Chad that something we can still move forward and you can add that yes okay that's not a problem all right any other questions comments then I would be looking for break this down into two motions one the approval of the joint Powers agreement all right I'll make a motion based on the Planning Commission Town attorney and staff review and recommendation approve the amended joint Powers agreement between the town of Whitebear and the City of of White Bear Lake as discussed tonight with attorneys Chang with noted attorney changes yes uh do I have a second on the motion I'll second that motion's been made in second and all in favor I I all opposed and then the second part part of this would be approval of the agreement for Professional Services I'll make a motion to approve the agreement for Professional Services for SE for consulting services in the amount not to exceed $22,000 uh second on the motion I'll second that all in favor say I I I opposed and motion also carries okay Mr chair that just so it's clear that's for design work regarding the lak links Trail highway 96 section north of Whitebear lake with funding received from the legislative funding section grant funding source so not all right uh moving on we have item 8B it's the 2018 Street Improvement projects um are you going to take this one or yes thank you Mr chair and board members we have three items for you tonight regarding the 2019 Street Improvement projects the first is to authorize tkda to prepare a feasibility report the second is to adopt a resolution of intent to reimburse and the third is a assessment policy discussion I'll take these in in order so the first one is a authorization for the feasibility report um at the last Town board meeting um we had a pavement management discussion and we are directed to provide a a quote for engineering services to prepare a feasibility report for um the recommended areas for 2019 and they included Park the Park viw area including Parkview Drive Park viw Court and Fenway Court Weston Woods area Weston Woods Way moonlake Court gilen Court Whitebear Parkway from Oak me Lane to Otter Lake Road Fourth and Fifth Street East of Highway 61 and hobby Lane area including hobby Lane West hobby court and North hobby Court um we've have we have prepared a a quote for the work for a price of 37,000 $400 to uh prepare the feasibility report and this includes uh the soil borings necessary to study the area um those are uh 9,000 that's included in the 374 um so tonight we're just looking for authorization to proceed with the feasability report which will give us better information on um the project including um better definition of the cost we've prepared a preliminary cost estimate of just over um $1.7 million for the project but uh this would provide better detail on the costs um assess computation as well um so I if you want to take that one in order otherwise I can proceed to the next uh let's just let's go ahead and discuss that one while we've got it up uh first off Dale is that those streets that we just listed that um fairly good summary of what we're looking at yeah yep and these would be Mill and overlay type projects um White Bear Parkway would be more of a Reclamation type project where we're removing all the pavement and replacing d didn't we have a a while back some residents looking to have the Arbor Lane area down there by car F yes and then that's still on the uh plan in the plan but for next year i0 it's going to be phased out over three years correct so it be 2020 21 and 22 okay yes so specifically recommended in the report was a Southeast area it was next in line after these um Mill and overlay projects again kind of going back to last meeting we want to try to catch these streets before they get to a point where they are more costly to repair um and then we shift gears and go toward the southeast area including those folks that um had come in uh last fall um looking for improvements to that area either Dale or Larry the these areas the five areas that we've picked out um they're scattered they are and with that you don't get we're not going to get the best bidding process with scattered projects are we is there is there any areas that so we can do uh selected areas all pretty much at the same time or is not well that's possible do you want to answer yeah I'd just like to say that you know these they are a bit scattered this for this year um um but again we want to try to catch those streets um before they get to that more costly repair and so it in in some cases in some years we might have more scattered type of improvements especially for Mill and overlay where um some of the the timing of their initial construction is a bit different okay now does ask Dale or Larry the only reason I asked that is the area up North uh that one little section off of Meadow View up there that is a all Standalone it's it's been is that would that be included in the sa type of repair or is that going to be a Reclamation that'll be a re that be a reation because the argument there is that while it's a small isolated area it costs more money to do to to to do a funding program well we're we violated our own thoughts on because this one is all scattered anyway so um but if it's a different process we'll let it ride but I I was just curious if it seems odd we always talk about projects in a similar location and this one seems to be spread unfortunately was just by Like Larry said the original construction date and stuff and the town didn't develop you know there's a little bit here a little bit there it wasn't all congruent like maybe the Northeast area know was more but de doesn't it also matter when we're doing Mill and overlays it's not quite as constraining on the contractors if they're doing full reclamations yeah I would me it's easier for them to bounce around yeah to these smaller projects than the full-fledged redo the road the other streets upcoming after this kind of year of maybe the scattered work are more um localized localized all right right any other questions on the the feasibility report uh when do you think you'll have that done Larry um we have to we we have included you know in our process uh time for um sending out questionnaires with the our recommendation in the uh pavement management booklet is to um have more dialogue with the public so we have a questionnaire um kind of we'll send out to the residents so there's time involved in that um neighborhood meetings and then we have um the 429 process which requires um notice for the public hearing so there's some steps that we need to take so but what's your timeline right as as as of tonight yeah so I I would say it it'd be April before we come back before we would uh accept or have the public hearing and accept the uh feasibility report and then go move on to completing plans and specifications and it construction would be in likely in July or August and that's a a fair amount of time to if this all works to complete all those streets if we start in July yeah with the a Mill and overlay project all right like like these um you know and and some of the streets have concrete curban gutters that we'd be looking at replacing those sections that are cracked or settled but some of the streets do not have concrete curban gutter so those for sure would be a quicker process to repair all right any other questions Let's uh I'll be looking for a motion to authorize dkda to prepare the feasibility report I will make that motion do have a second um just for clarification because it that's it the the written material says 36400 their report is 37400 I'll second the motion at 37400 is that right there it is okay 37 his his his statement tonight and the letter that tkda said it's 37400 okay and I want to I'll second it at 37400 not 36 no we're only get 36 no no that's up to him what do you want so I'll second it's for the require that if we are to use tax exempt bonds that we uh um pass a resolution declaring the official intent to to reimburse expenditures um the resolution is in the packet um um yes just again it's you're following the the Minnesota statutes 429 process and and this is a a part of that process and Chad have you had a chance to look that over yes any comments or concerns f with it all right any questions of the board no all right so I would need a motion to approve that resolution I'll make a motion to adopt the resolution declaring official intent to to reimburse expenditures do I have a second on the motion I'll second that all in favor say I I I I'll opposed uh that motion carries uh Larry the third item the assessment policy discussion I think we had some kind of discussion that we'd like to maybe take this to the executive board because there going to be a little bit involved and Tom Kelly's going to have to be uh involved in this along with the rest of the staff so essentially Mr chair your attachments are for homework purposes in advance of our Friday meeting um we would like or we did get a good opportunity with um some pretty open-ended language in our assessment policy that I didn't realize existed I thought it was tied specifically speically to being 100% so you got some flexibility in the language the thing that really does need some evaluation is impact at various stages of um assessment and I and I really do think that is I don't think I know that is essentially the gist of the entire conversation is uh how you want to proceed under the opes of affecting um your Levy your residence through assessments and other fund use so we we would like to have a more extensive discussion specific to that am I am I right Larry that's correct um as um Patrick indicated that that language is doesn't give a percentage um in the um in the language of the assessment policy itself but as a matter of practice um we should have that discussion on the overall fundings other funding sources and then what percentage should be applied moving forward so we're start off right and we um remain consistent as we do other Street Improvement projects year to year to year Well I ideally I mean obviously the board would love to get to that 50% but this is not going to be a one-year deal it's I think it's going to take some time to graduate and scale it to as as we find funding and if we can secure some other means of Revenue then we maybe it's 90% next year maybe it's 85% the following year but maybe it takes 10 years to get to that 50% but I think that's a kind of a work in progress too that we're just going to have to sit down and and hash this out so that is a philosophical discussion for sure no don't ever call me a philosopher that is a financial discussion for sure all right so uh obviously uh we don't need an action on that we'll just uh refer that to the exact board meeting yes all right uh item number 8 C the Hammond Road water tower painting thank you Mr chair and board members um the Hammond Road water tower was uh built in 1982 and the pain on the structure has um reached its typical lifespan it's it's up for um repainting in 2019 um the uh overall cost of of a undertaking the painting is uh ex is in our CIP our our Capital Improvement plan for a million dollars um in order to um prepare for that uh that work um specifications plans and specifications need to be prepared so it can and go out for bid for repainting and we've prepared a a estimate a not to exceed cost of $229,400 for um preparing the plans and specifications for that work and the the goal is to have plans and specifications complete uh here for spring bidding and uh getting a Contractor on board to um paint the water tower and this is the Hammond um Hammond Road water tower that's uh near this the town offices um the water tower painting is uh is the temperature for painting the water tow is is critical so trying to get the the plans out for bid and and getting a Contractor on board so they can hit the right windows for painting um the water tower in the in the correct temperatures um we're estimating that the water tie would be taken out of service for a three or more 3 to four month time frame to allow for the the work to occur and proper cure time for the paint itself um there are other minor um improvements to the water tower including um a concrete floor slab to the structure um some lighting improvements valve improvements and improvements to the service door um so but tonight we're looking at uh um authorizing us to prepare plans specifications for the work and when those are are are are done we would bid the project and you would have a um a more uh firm price on on the the actual cost of the cost of the job job but tonight is just for the U plans and specifications out of curiosity um I know with the other water tower that was painted there were some um transmitters on the top that had to be taken out of service for a period of time is that the same case here there's one carrier and I believe that uh Jim's working with them I don't know the details yet I know Chad the contract on this the carrier for this is different than the contract uh for the otherw tower and it's much more fa though not say much more but it's more favorable to the township this time than the last time we had to pay last time oh yes we did so we this is uh I don't remember I can't I don't remember the exact language but I know that there's much more of a the the carrier has to cooperate more with the township this time around than last time okay I believe last time we had to actually pay for them to relocate on the ground and and still and run their service yes it was rather expensive quite expensive well other than that fact that million that's about what we did on the last one isn't it isn't that what the other one ran just a little bit over a million 1.1 or 1.2 when I got was all said done or no actually I'm take that back it came under just a million when it was all a sudden done so Dale as part estimated at that as as part of uh this 29,400 the last sentence and you didn't mention this but both the Hammond Tower and the Northeast Tower will have the pipe in the below grade pit sand blasted and painted that wasn't the tower that just got painted right was there some reason it didn't get done that roll around I we just missed it in oh it was just an oversight okay so we're pick it up this time to pick it up this time good news we we got the same similar work going on so and it was uh part of it would have been it would have been a challenge because there's a lot of sand blasting material on top of that whole area when they were prepping the rest of the upper Tower so I would have it work better I think the with the project itself so yeah was there any interruption or concerns or issues with residents from the last time we didn't have any issues uh we were able to keep production up you know we have the four Wells going um explain to me how this works they obious have to drain the thing yep so I mean is that just water distributed to the township until it's low enough that they can work on it well we have to so when we do drain it we take it down as low as we safely can and then isolate it and then we end up draining the remainder out the tower so they don't have any water in the tower because they do but has all that water gone out to the residence or is some of it like uh flushing hydrant it's some of it is like flushing hydrants you get down to to I'll say in the 750 you get down to 200,000 all right and so we keep track of that for our uh yep on C water yep we did it last year y so all right Steve got anything else nope Scot nope all right then I'm looking for a motion to uh approve the water tower repainting oh I'm sorry it just be for plants in specs So based on the town engineer and Public Works director review and recommendation I motion to authorize tkda to prepare plans and specifications to remove the existing paint coating to Reco the interior and exterior surface of the water tower and perform bidding Lift Station number nine Rehabilitation that you deal actually I think there could to but thank you Mr chair and board members the uh the township has 10 lift stations in town and over the course of the last few years um the town has been picking away and at uh upgrading those lift stations to uh get them up to current standards get the controls the pumps and uh pump rails all up to uh current day standards um lift station number nine is the last that needs uh to be rehabilitated um it was installed in 1979 and it just has reached that point where um it needs some um replacement of parts to make it function reliably um we've prepared a a quote to prepare plans and specifications uh for a cost of not to exceed of $41,800 to uh prepare plans and specifications and and and like the last item is is trying to get those plans specifications done here over winter for um a spring um spring bid and get get that work completed here over the summer or into fall again the improvements would be the control panel the um access uh improvements to the access to the lift station as well as pumps um valves um antenna pole power supply and valve Vault improvements is that gravel access right now or is that it is paved it's yeah it's but it's it's almost at its end of its life and it's a good time are we upgrading it to concrete then yes like the others yes Dale does this just curious this is the one that's just past our pump house right yep just in the north here yeah north of pump house so it's it's backs up right on on a wetland does this require any kind of more approval process than our other ones I don't believe so it's not in the in the Wetland per se so it's uh it's fine and we're going to only make it better we're going to be sealing the entire wet well uh only yeah so it wouldn't be any additional pering necess so the goal it will look like the the ones we've rehabbed before that's correct yep uh no issues with um setbacks on it I know some of these have been a little tight but yeah but it's not a big area but we've got yeah it'll be fine for the staging all right got anything no ST nope all right do I have a motion on the uh lift station I'll make a motion based on Town engineer and Public Work Director review and recommendation authorized tkda to prepare plans and specifications for the rehabilitation of Lift Station number nine in an amount not to Public Works director item 8e this is a probationary period for Timothy Cunningham of the public works department yes so Tim has uh been with us since July 9th and is prob six-month prob perod ended here in early January just a little over a couple couple weeks ago and uh of course we've been monitoring his performance in this six-month period and he's uh it says it in the memo it's you know he meets or exceeds all the uh expectations in the job description he's uh passed his class acdl uh driver the both the written and the driver's test that is required within that six-month uh probationary period uh Tim's uh he just enhances the public works department R personal Dynamics and another team player he's willing to tackle any job that we give him uh and task and he's also willing to ask questions if he doesn't know so that's a good thing he um he so he openly communicates with his supervisor and the other uh Public Works employees so we are very pleased with Tim's performance today and look forward to working with him further his with his career goals with the township um so we Pete and I are recomend commending the town Board app point and the public arest Marin or the public work staff uh rep Point point1 C Timothy C Cunningham boy you think it'd be easier to say to Township Service as a full-time Public Works employee yeah is there any other um continuing education that he would require or we don't require but we have options they can uh educational incentive has he ins showed any incentive to to pursue any more he has an interest and you know he's he's going to look at getting licensing you know the water and sewer and there are some uh Public Work certificate programs he could look uh he's considering so I I just when you see that just that just a motivation that they're willing to improve their job situation which means hopefully they'll stick around we've already got him doing some going some training so yeah you got anything nope happy to he a wa your Township resident wow yes he is I be to mention it he is a resident also all right I need a motion on the public works well I'm happy to make a motion based on the Public Works staff review and recommendation to appoint Timothy Cunningham Township Service as a full-time employee in our public works department do I have a second on the motion no second motion's been made in second and all in favor say I I I all opposed that motion carried okay item number F another public Public Works is on the service store canopies at udale yep so we had uh these Public Works uh building canopies it's been an ongoing project we um got the TQ was developed the plans and specs for the uh modifications to or additions of these canopies over the doors modifications to the building to accommodate them uh we did uh send it out for uh uh quotes here uh early in September and uh unfortunately it was I think it was just a timing thing it was busy time of the year and we only got one one quote b or bid quote back and it was for 30 39,6 A6 I had recommended that we uh reject the one quote and that we'd go out for rebid uh again and then Now's the Time where early January again so uh I have a outline here of what we do is you know we uh tqd has made some uh suggested changes to our uh plans and specs it's mostly uh language or notes and uh I could share with those just briefly so they would um some of the suggestions where we just uh allow the contractor to use the township dumpster redu some of the costs for the demo it's not much demo but what that amounts to wave the building permit fee which we do if it's a town project we just wave that fee and have them do the work we uh delete some spray foam uh and leave the existing uh exterior insulation system in place and only patch up where the uh these plates will be mounted to that secure the canopy to the block wall and then uh the look at possibly the tone chip painting the uh steel uh ey beams that would be on the interior of the building and versus having come already uh primered and then uh there's some structural changes we just we can use utilize the existing floor as the base we don't have to cut the floor open and put pudding underneath so hopefully while these are all changes that may lead to a reduction it we we'll see how the bids come in and hopefully it will um and hopefully we have more this time so the quotes So the plan is um that I would get advertised in the wiper press a couple two times after approval by the Tom board to go forward and um the quotes would be due February 25th at 4:30 p.m. administration building um and they will be presented to Tom board on March 4th for acceptance and approval of the L quote so board my recommendation is to bo uh approve the revised plans of specs and authorized staff to request quotes for the canopies over the two service stores at the Public Works building Dale you want to review again why we're doing this yeah and yeah I should have had that um so the at these doors you know we have the slope metal rofs and in the winter months the snow can pile up but then it melts and freeze but everyone just large sheets will fall off and with the GU accessing on the U south side of the building sometimes that's kind of a hazard when they come out that service door so they're in order to prove the safety of the U staff these canopies would protect them from any ice sheets that would fall if they happen to be going out and it falls right there so that was the purpose this driven this whole project I know tkda is the engineer that Drew up the specs but is this our only option there's no you can't put a diverter or a this is the only course of action to repair this well that's the to to really truly protect them yes some the diverters they just they can you know divert some but it doesn't guarantee that there's still not going to be some form of ice or snow fall we could just issue heart hats that's the kind of problem solving you want from your P here yeah that was my outside voice all right so you got any questions no I think we've discussed this a number of times it's just um The Hope is that we'll get more than one quote um I guess the fact it's a good time of year so the fact that we've not had a whole lot of snow this winter is not been a problem then for delaying construction yes no it hasn't but it when we've had normal snowfalls it it is there is a need I've seen it I like you had question you need but well you you see this around a lot of uh industrial buildings that signs even say in the building don't park too close to the building because they do have you know sliding ice coming off of them so I wish all the roof was sloped to the back then it wouldn't be a problem because then but unfortunately there's a I'd say a third of that roof that's caned towards the front South End there's a safety issue and if that's what we need to do this will address the safety concerns all right any other questions or comments hearing none we'll probably take these as two action items first one would be approve the revised plans I'll make a motion based on public work director's review life of the payment this is an integral part of that program um so I this year it's um I'm using the same specification I used for the past several years um the only thing has really changed are the dates and the areas that are going to be seal coded I did have uh I think six pages of maps attached I can just briefly go over the areas and so there's we're finishing up the otter Hills area there was a portion that was not completed on otterview trail from otterview Ridge Road to the out to Otter Lake and then otterview Circle in the last year's project and then uh then we'll be doing the Birch Pond uh Town Home Association that area also then up uh I can't remember the name of the development but that area east of 61 North of Buffalo and up to Silver Fox um that development that includes Franklin Wen Susan Circle Christine Court then we'll also be doing uh Bloom Road Morgan Trail and border of Pine Court and then liel street liel street we um reclaimed here a couple of year it'll be 5 years ago so we're looking to put a seal code application on that this year and then the other area remaining area is the the area south of Still Water between uh Dylan Street and Otter Lake Road to the tracks so so the what I'm requesting from the town board is just to uh approve the plans and specs author and authorize advertisement for bids with an my estimate for this year's project is 100 I'm sorry back to um um 114 thou just under 115,000 and that leaves an amount of like just over 35,000 for crack sealing which is another component of seal coating Larry I mean he would agree with that so that I'm on to I would come back with a a quote for crack ceiling for those areas at a later meeting and so I have the bids due on February 28th for the seal code and it's a the timing this time of year is perfect to get out now because we'll be getting on that one of the first bids they go after and they usually and then if they get depending on the contractor if they get one in the area they'll try to aggressively seek the others other communities in the same area Odell you said there was some carryover from last year or there won't be well there is there's that area an UT viw Trail that's a carryover that did not get complet last year there was was that uh an excess of our last year's lotted amount or uh there was a truth be told I was out of the office for a while and I did leave we had a person in charge but they missed it it was between the it was on the map it was just communication error between staff and the okay contractor so they end up doing some other Street sings that would have had done this year instead so was a it was going to happen it just it was a little communication error so it's did so it the it didn't come in under budget then it just did different streets rather than what had been planned right it uh it actually we had the bid came in we added Street sections and that but then it was all mapped but unfortunately I don't know how it got missed I even they had the maps and they uh they skipped over it that portion went to other sections that I had removed so but they were going to be done this year and now so it worked out um I I discussed the 2018 project with you I know you were out of the office uh somewhere in whoever we put this off for bid they need to understand that they cannot do this at before normal people would be out of bed in the morning such I I think I told you on Fourth of July they were out there before 7:00 in the morning and I got phone calls from people being very irritated because it it's a holiday and they're and they're out there making incredible racket before 7:00 a.m. in the morning so uh I think they need to understand that they got to be reasonable we have to be reasonable on our hours no and I I'll and I know you weren't around I I'll make sure that it's very clear to the contractors that I give the information for quots too when I do the get Courts for the uh crack cing as it's a follow up till last year so it doesn't if the same vendor gets to project we don't have the same issue yeah it it's happened before in a lot of different projects they want to get ahead of the game and the when it's light out at 6 they want to get going well they always they always push the en at 10 to seven they'll fire up everything or whatever yeah there's always had a curiosity can you add add anything into a contract that says if you don't do exactly as we say there's a penalty or something like that well you can you can't have penalties in contracts per se but you can have you can call it a material breach and at that point you can you can you can call you can set a liquidated damage amount don't call it a penalty but you say liquidated damage amount usually comes at the end of the contract when negotiating maybe extras and you go uh in the seal code yeah on on Page in the and this on page 136 of the packet no excuse me um it does have a liquidated excuse me it's 135 liquidated damages $200 a day will be assessed if it isn't completed by a certain date it doesn't talk about hours but that's similar to what you're talking about yes exactly yeah we've had this discussion before all it is is a bargaining or negotiating yes point at the end of the contract yep nope I think it's I'll just make it very clear with the quotes for the crackl it especially you should point out this little um piece down here where there's liquidated damages just yeah as a reminder yeah yes yep especially if you said that this has been an issue before yeah and it's not just seal coating it's uh house building it's uh Road improvements that it it does happen yeah all right any other questions no we have two action items here first is uh approve the 2019 seal coat specs I'll move based on the staff review and recommendation to approve the 2019 seal coat specifications noting the public work director's estimate of $4,743 for seal coating and $35,200 in the scope of 28th 2019 at 10: a.m. in the township administrative offices Mo has been made do I have a second second all in favor say I I I all opposed that motion also carries moving on uh item 8h is the West Avenue handicap access Tom you going to take that one here this is a picture of the West Avenue project two-phase project the first phase was completed in 201 2017 and uh this is consisted of a rain Garden this is West Avenue West Bald Eagle Boulevard Bald Eagle Lake is right here West Avenue extends this way and this is an old ride of way that was never developed down to the lake so the rain Garden was constructed again in 20 oh sorry 2017 phase one upon completion of that uh which included a large or rock wall along here staff was contacted by some of the Neighbors in the areas uh with comments that's basically were you know we used to be able to walk down to the lake from there but kind of difficult now with this Boulder wall and parkboard had been considering an access but uh uh deleted it from the project in 2017 because of the uh expense thought it was going to be a little bit higher up there and also the difficulty of making it a handicapped accessible uh area so you can see this is the trail that's proposed here it's at a 21 to slope 20 to1 slope so it is considered handicapped accessible but because of the grade change we're doing a couple of funky uh uh back and forth there but that will work uh or that meets accessibility requirements will'll provide the access to the lake as requested by the neighbors now this was a project that we contracted with the uh uh Ramsey Conservation District now part of Ramsey County parks to do the design work uh construction management and uh we also asked them to do a phase two plan which would show the access to the lake they put together that plan was reviewed recommended for approval by the park board they also bid the project out or requested quotes in uh fall of 2017 first quote first time they put that out for quotes they got no bids at all projects re rebid later in the month or later in the year going into this year they did get a quote this time and it came in at a fairly reasonable price of $22,995 the engineers estimate on that was just a little over $30,000 so uh recommended for approval by the park board funding would be recommended from the park acquisition and Development Fund since this is a new project in a what's considered a town park and the action requested is to receive the quote and award the work to field Outdoor Services field outdoor spaces Who provided the uh the one quote for this particular project now is this a first is this our first handicap accessible down to the lake yeah I don't remember ever seeing one before in Bald Eagle Lake it's difficult to get accessibility because you have got Bluffs I believe the Ramsey County Park which is not a town park but a county park that's accessible to the pier and to the boat ramp but of all the and I believe there's a dozen of these little accesses to the lake most of them have a drop off so this was the one why the park board considered this making this access uh because we figured we could get it to serve the handicapped also so yeah this is the first one and other ones around the lake most of those two also on private property or between two private properties typically they are you wouldn't have the room to do that obviously no yeah I mean there's a couple more east of here but less land uh you you get around the around the lake up to Buffalo Street that's a drop off you get North there it's it's actually a bluff uh it's more than 25 ft separation H2 there's been an access to Bald Eagle Lake there with some old steps but that's a drop off so this is really the only site we felt was reasonable to make it accessible to the handicapped as well as everybody else would there be any signage that goes along with this then or did they talk about that uh you know we did did not talk about signage we did get a bench donated Boy Scouts no it's uh the Sedin family is uh paying for the bench in a slab they've donated basically $1,000 for that bench okay I can add uh a little bit to the bench and that so this quote that we did get this contractor did not include the concrete pad for the and stuff so that will there but the bid came in really good so I'm not too you know we just just would add that to the scope of the work as an ad and then they have a line item for concrete in there the um the other thing is the I don't know if you mentioned Tom the subst substantial completion would be by May 31st of this year so it's um it's I think the reason we didn't get any bids early last year it was a November completion date and we approved in October I think maybe September and or would and we didn't have any biders so they just they just have time but least we got one here um so yeah will this include any uh uh Public Works involvement or not to a a minimal amount well definitely my time because I'll be working with the contractor and the r um Ramsey County Parks and Soil and Water members that are doing the construction oversight make sure they don't get started too early W be for seven this uh this piece of the project you know it's a culmination culmination of the work that's been DB to upgrade uh that area of the lake you know the rain Garden was was a nice enhancement and now this allows for a little better Public Access including people with disabilities and it it it's a small area and so the design had to had to fit within that space the neighbors were were satisfied and it it still allows uh for people to sit and view the lake that aren't residents of the lake without impacting it too much so you worked pretty closely with the neighbor to the west there when the pro the rain Garden project was completed again the access was kind of difficult with those rock walls so people kind of got steered over to his property and uh he made us aware of that he actually cleaned up the border of the property really nicely and it's kind of take an adoption of this one too well I think that's something they should look at though because this is something to be kind of proud of have a sign there it says it's some actual handicap access to the lake well the sign I was going to just mention there is a sign that was going to be more about the rain Garden forun that uh vam or Rice Creek is working with us to they have it done and we just got finalize accept it and then turn it up but we could look at adding information I think because a lot of times I mean locals know about it but unless you somehow advertise it no one else would know about it so you certain put it in the website well there's you're right though there's plenty of signs that say no trespassing yeah this one it's like hey come take a look look yeah well we could put a handicap sign access sign at the beginning of the access from the road I mean that would if you drove by you'd see it yeah it's good to put a sign if we if there's some way to do it and pay credit for that we've done what we should for accessibility so sure all right any other questions or comments are we going to have to worry about parking it's just street parking there it's mainly a neighborhood access people can come in from the outside there is on street parking but there's no parking lot around all right uh we have two action items here one of them is to receive the quote make a motion based on staff review and recommendation to receive the quote for the West Avenue handicap access I have a second for the recommendation to award the qut two field outdoor spaces in the amount of $2,955 with funding from the park acquisition and Development Fund I have a second on the motion I'll second that motion been made in second all in favor I I that motion carries all right item 8 I we have Township Administrative Office upgrades I'm it so Township's falling apart here on no well actually being proactive we're dealing with things before they get too far so uh this year there has been uh money set aside in the capap approximately $95,000 to uh do some renovative work uh up renovative updating updating work on the interior of the administration building which includes carpet painting and the front doors um some tiling as well and some tile yes some tile flooring in the uh what is now the lunch room at the admin building so uh what we're looking for you know we'll advertise in the wiper press twice and we'll um it'll be sent to a area of Painting and Decorating contractors in the metro area to uh provide quotes or bids probably bids because depending on what bid come in at so uh staff has prepared an invitation to bid that is on page 156 so they would be uh the project consist of bidder uh visiting the administrative building it just kind of outlines what it would do and what they're what we requiring them to include in their uh bid would be to uh you know color kind of color match the existing Cabinetry um or mill work and then um so that would include the cabin by the cop machine kitchen file cab colors you know we got a lot of office furniture it's cream color again kind of work with what we have and then um also the office and conference room chairs that include repairing any U damaged drywall there are some structural uh cracks and some uh water damage in some of the areas in the administration building that would take care of that um they would paint the interior interior of the building including the ceiling and then uh remove all and install new carpeting and using a 2X two commercial grade carpet that it could be easily um but removed and if we were to do some future remodeling would accommodate that without having to get into uh remov the uh roll carpet um so and then would be uh which require moving all the non-fixed furniture Etc too which requires so that everything's addressed and install kitchen tile so everything's addressed in this uh invitation to bid so staff is looking to have the board approve this invitation for bid and um we'll be opening bids on February 26th at 11:30 a.m. in an admin building so is it customary Dale or would you for them to do the moving or is that us to do the moving no well no we it would be it is good for them because of the coordination effort um obviously you get out and then the painter would come in and the carpet so one of the two either the carpet supplier or the painter who I or the general would be the or the uh coordinator for all that work where the bid process would include for them is to stage and move as needed the furniture they'll they'll decide how they do that you know we don't want to limit to what they you know do I've got ideas but I'm want to let them suggest suggest and see and if we can always if we don't agree as staff when we review it we can always have it is this the first time this building has been renovated since it was built I would say yes as far as I I I've been here Tom could answer better probably so when was this inst when was this originally installed what year 996 96 so yes it's it's run its course 23 years without any improvements uh yeah carpet has held up well but it is due for replacement well obviously this is probably a bit more of a general contractor because of all the subs involved yeah and then uh Patrick would be the interior designer well I'm I'm sorry it does have uh the bitter is to present two color pallettes for paint carpet and kitchen tile which match incorporate those structures I skipped over that but they're required to this is part of their bid process come up with some ideas yeah we pretty comfortable able that the roof's not going to leak after we go ahead and do all this nice new there was a lengthy discussion at a staff meeting on the roof I think we got it covered I did get the roofer out to repair there was a leak that uh happened over the summer uh he was on the west end then that work was completed last week there is some he's going to send me a quote there is some deck damage roof deck damage that needs to be replaced and um but the shingles they'll last a couple more years and there's Mike Johnson was building official was comfortable with that that there's no problem I hate to see that go we go through this and then we still have a leak oh I I I'm with you I have another question at the same time you know in the in the day of days of heightened security is there any security issues that we should address at the same time before we do our renovation that came up in Steph too I was I was about asked a lot of questions when I was going through initiating this project to get it going and so the decision would that we'd look at uh that's why the the 2 by two tiles there carpet tiles would I think what and Patrick KK if wrong we're going to look at having tkaa maybe do some Design Concepts to provide a more secure area so people can't just walk right into the office areas uh and even the front desk so there's more security so the and also the space just in general is going to be re-evaluated too and redesigned so there's a lot of open space there so having said that is it premature to be talk doing the bidding process if we haven't got the other pieces resolved as to or will it not affect it I'm I'm I mean I'm in favor of updating the image of the of the building is it's one is life but I'm talking about sequencing of of of things if if we need to do some security improvements is it something we should talk about further well I think the what this what the staff meeting arrived or our staff discussion arrived at was a couple things was that um the two that are now in the front had requested specifically some security as you've alluded to um what we'd like to do and I think Dale was uh was starting to get to it was the function of upgrading or updating uh the carpet the tile the painting and everything we are going to think in advance of reevaluating in our space with that so we kind of we looked through what cost is going to be at least on the outset and what we want to do is we want to see how much of the the 95,000 that was set aside in the CIP specific for Town Hall is going to be needed for this painting carpets tile doors um and if we've got some left over we're going to piggy back this year if not we want to make it available to do the following year though I mean are we talking like a glass enclosure around the front counter or what are we talking here well that's that's what kind of we'd have uh TKA offer us up architect some options for that to provide that security that they you know that's something that could be added even after the carpet's done it just attaches to the front counter or so you're not teing carpet back up to do these improvements we also want to talk about um some handicap access uh as well the desks are going to be yeah L the counter right now needs to accommodate do that first I mean so there maybe some new mill work in that area there just to to accommodate those requirements TK you said tkda is working on this first no that's what we would probably we like to have them work on that design architectural division than Steve brought up a good point though I mean if we're even considering this I think we should maybe evaluate that a little closer before we jump into the rest of this I I I it seems like you'd want to coordinate any remodel before you start replacing carpet and paint and Larry do you guys perform that space evaluation and security upgrades for yeah we have we have Architects that can review all right those measures I I well I recommend that Larry if if he has those to go back and and get some concept idea how long it would take for to get that stuff together before we move forward I'm I'm I'm not trying to put off doing this because I think it's important that it needs to be done but I don't want to re redo the effort after and realize we put money into it and we got to tear it out and do it over um so I I prefer to have the answers beforehand uh meeting safety needs and then looking what we can do and if it means doing it in a two-phase project this year or next well then we might have to do that um we also had a presentation from Rams County Sheriff's Department was it last year the active Shooters issues and maybe it's also worth a call to Rams County Sheriff to have somebody involved maybe with the architect to voice our concerns so off is a little bit safer too if the board's willing to do that I'm we'd be happy to perform that for sure I I Larry I don't know what their timelines are but I I got to believe it it shouldn't take too long to coordinate this to at least get this done this year but maybe just delay it till we can get some uh preliminary stuff you're looking for um some general guidance at this point safety improvements I'd work with Dale and Mike Johnson whoever uh to see what you know what we can do to make our employees feel safer at the same time knowing we want to do some internal REM internal remodel like it it might turn out that maybe the front counter can just be remodeled and it's not going to affect what we're doing right now but y that'd be great but then again they may want to modify that front counter and now we're back into tearing up carpet and repainting y might as well find out yeah yeah I think you brought up disability too didn't shoot disability as well yeah we had to look at 8 requirements yeah so we're it's more about the service counter counter accomidation for Access but I think when you do when you do remodeling you have to take into account a Ada changes too so especially restrooms yes so it's probably not a bad a of security and Ada yeah well that'll also maybe have that's a good time to also look at that uh that Atrium that Flint that air lock system that may be something else that I don't know do you have to be buzzed to get in or there's a number of options that are out there so okay and now we don't have security cameras here do we in town hall no got them out just little ways from there yeah not there's nothing inside the oh but is there a is there a privacy issue with that shed no not really it's a public area it's a public building I think those are all considerations that that might be included in a safety review is um you know do we need some kind of security cameras or or changing of the front entry itself and and I think if they can do that they can give us some advice which might put our dollars in the right direction overall sure we'd be happy to do it all right
