We just thank you, Lord, for being alive and well on planet Earth. We pray right now, God, for our city. We pray for our county. We pray for our mayor, his staff. We pray for our city manager, her staff. We pray right now, God, for the citizen of the city. God, we ask right now, God, that you would solidify us and unify us. I got it covered. We're gonna stay less than that. Um, so let me start by saying my appearances here are never to be disrespectful, but I don't make apologies by being persistent and consistent. Um, I will always consider myself as a voice for the vulnerable population. That's just what I do. Um, and I I don't make apologies for that. And when there are things that I think needs to be brought to the attention, I bring it in a way that I hope can get it addressed. So, I'm back again for the same thing that I was here for on two other appearances. Um, and I just got a couple of questions. So, this should go fast. So, Mayor Smith, tell me how you want me to do the questions so that I stay within the time frame. You want me to ask all five of them at one time or do you want me to and then get the answer at the end or do you want me to ask and then answer? >> Well, this is your question answer situation. If you have questions, that's my that's my purpose. >> If you want to if you want to ask those time, we can get back with you. But we're not we're not answering questions directly from my >> Okay. So, my questions are not regarding the bill. It's about procedures. Okay. So the first question is since I have been here on two occurrences um that we've already established we won't get an answer for but I'm curious to know which or how many of the council people have formalize a survey a Google form or use text to send a survey to allow their constituent in their ward to reach out and give their opinion or if they even feel that there is a need to have this discussion and if so the part of that question would have And how much feedback did you get back from that documented experience? I'm not concerned about a phone call because those aren't documented. I'm wondering if we have any formalized surveys that went out to test the atmosphere for the constituents in each ward. That was question number one. Uh, question number two was before the letter was written by our city attorney to the attorney general to ask um about the const potential constitutional violation. How many constitutional attorneys did the city consult with before it was confirmed that it was a constitutional violation or a potential constitutional violation? That's question number two. Okay. Um question number three. When the letter was written to the attorney general who has since responded and I've read that document um it's very thorough. So, if you haven't had a chance to read it, pull it down and read it because he gave a good response back to it. Um, but when that letter was written, my question becomes to the author of the letter, was it written in a position that was in support of developing some type of structured ordinance for this potential topic and not violate the Constitution? or was it written to gain confirmation that it was a direct violation of the constitution? When you write, you write for an intent and I'm asking the author of that letter to tell me what was the intent to gain expert advice or to gain confirmation in what was seen at the local level. Next question. Are there any other Greenwood ordinances that are currently in place that are not supported by an existing law in the state of South Carolina? Again, you don't have to get an answer, but those are things that I'm thinking. And then the last one that I'm going to give you is one that I definitely don't want to answer to because I'm just my my doctorate in policies and procedures. So I analyze everything from an analytical standpoint. So when I'm thinking about policies, I look for things that relate things that can be um associated with there's a correlation. So my question becomes that I don't want to answer from why is it that I know that everything I say can and will be used against me in the court of law and every other crime except for a hate crime. When we talk about hate crime, we supported with freedom of speech and everyone says that's coming against their constitutional right because it's freed of speech. But in any other way, if I was to commit murder and I ran down the street yelling, "I'm going to kill him." When I was tried and convicted of murder, they would play back how many people heard me say, "I'm going to kill him." And that phrase would be used to solidify malice and intent. And so my only question was, how is it that it works for everything else and not for this? These are just questions of a person who needs policy. I stand before you as a person who will fight every day for the vulnerable population of all people. I don't just pick one. Thank you. >> Appreciate your interest in this especially attorney general's recent discussing our options. Okay, we have several unfinished business items. They're all planning items. So, the first one is going to be ordinance 25-010, which is amending our zoning maps by reszoning 2.7 acres of land located at 701 Chase Avenue from R4 to R7. This is one that city council um actually remanded back to planning commission because there was a an issue with the future land use. No, ma'am. This is um in the middle of the Matthew Mill Village. So, um this is the um >> I don't know how to get Oh, here we go. So, hold on. They they gave me a new um new technology 10 minutes before the meeting. So, um it's this parcel here. This is Cross Street. This is Edgefield Street. This is the lake. This is the Is this the old school? This is the old Matthew school. This is our church here. That gives you a little >> um so the request here is to resone this property from R4 to R7. The uh requester wants to build single family homes here on this site. Um, I know we talked about it a couple times, so I'm gonna click through these slides and then I'm going to let you guys, if y'all have any questions of Carol, the future land use does show um medium density residential. Um, R seven is considered high density residential at R4 right now, which would be in line with the future land use. R seven would not be um Planning staff recommends approval. Planning Commission regularly approved. >> You recall there was some discussion too on this on this particular request about some properties that are nearby over in this area over here. I believe that extremely small lots. Um we did a lot of research staff level. I know Carol did. I know I did. There was a lot of research done at the south level to try to determine how the properties were zoned with such small or how they were approved with such small lots and we none of us were able to determine I didn't find anything in writing but I suspect that they asked for development and they were able to it's been a number of years I believe it was even before I worked here I think it was before cluster was That's the only thing I could figure. >> I couldn't find any I couldn't find anything that that explained why. But I know that's come up a couple times. So I just want to point that out. And then you do have R seven obviously in the purple. >> Carol, can you answer any questions? >> And staff. The reason we went with recommending approval is that originally we recommended approval because before we amended future ladies maps that parcel um one future lidentity future ladies map that was in the system was public land that we changed. Okay. Commission recommended approval because >> I say they did. >> So what about the current not just That may be why the two boats were there. But I think what we were looking at is the fact that they came through in good faith and something caused it to go south because because of an error. So they had they came back you remanded it back to us to look at again. that we maintain the same level, the same the same recommendations and we did have I think I mentioned we did have some people that came out of that meeting and not just on this case but another case where some inappropriate things were said and we felt like they deserved the gentleman deserved another remind me what are they 2.7 acres they're looking to do what single family so they got they have one plant they turned into a which I got which is actually done by this They have a backup plan where they just sketched out on the maximum number of you might be able to get I don't think you can get 13 months out of it. These are all 13,000 ft. >> All right. Any other questions? >> What's the minimum size in R4? 10,000. >> 10,000. >> Why does he need R4 then? Why does he need our seven? >> I think he can do what he wants. >> I don't know that he can do what he wants. That's just an example. They're still going to have they're just going to be loaded on one side and they're still going to have a separation between >> a patio single family, >> right? is single family attached. >> I mean, some people will tell you it's a two family unit, but it's two single families. The next item also on our unfinished business is going to be 25-017 amending our zoning map resing approximately 105 acres of land located at 1900 East Cambridge from LIW and R3 to R4. We've talked about this one several times. This is one of the ones that you guys um opted to um put on hold and so we had an opportunity to hear from the Department of Environmental Services. So this is the parcel here. This is on East Cambridge. will be familiar with it. This is um this is triangle hardware. So this is Gateway and this is 96. This is that new subdivision um W station. This is the um existing. Thank you that teamwork here helping me finish my sentences. I appreciate y'all. Um keep in mind too that the next item coming up right after this one is going to be the reasoning of this corner here uh to our seven. So, this is a this large parcel here and then this corner here to R seven. This over here is R4. Um, this also ties in with the subdivision that's going in down here off of Marshall Road. Um, >> is that right? Not >> B. >> This is just off the four corners development as we headed towards Lester Commons on the left. So, this ties in back here. This property here is being developed at R3 cluster. Um, but they want to connect to development. So, I'm gonna I feel like y'all are pretty familiar with this one. So, I'm going to click through these slides and if you have questions as I'm clicking and everything to the south of that the wet area, the flood area including it are off this request and then just the triangular piece at the top of the solar farm. Um, so like I mentioned, station up here across from Charle Hardware behind Walmart. Bronson Bridge kind of like past Jerry's produce on the left and the right Landing the one we just talked about off of um Marshall Road. Kimberly Place is the four corners developments do have Brighton Farm and Emerald Village across from the um Wesley Commons rehab hospital. Kirky Forest Base 2. I don't know the status of that got a developer working on it now. >> Okay. And then this is this is on church road county right this is a big $400. >> So just we can click on that but I wanted to include that. Well, he says that what they're proposing is because they partnered up and they're the same developer is going to be doing Baldin Lake and this one, they can do a more organic type development where they have all different types of housing. So, they're going to have larger homes. They're going to have um homes on smaller lots. Um but they'll have a mix of everything that they'll have town houses up at the top that corner lot and that way you'll have more flexibility, more choice. But they want to have a full range of price points. Um they did pull out a good bit. Now if you go back to the map that shows the play area, you can see that area that they can't build in. So they did pull out a good bit of open space um to address concerns that were there because that's supposed to be part of the Kiwi Trail. Um we don't know exactly where it falls, but it does follow a creek line back to 96. So it could be pretty important from a department standpoint. >> Will the portion with the um solar farm remain LW? >> Yes. >> I don't know where the delineating line is for the rebuilding. Obviously they're capturing part of this that LW. >> So is it just on the other side of the water? >> I think it's right the green here. >> Yes. This way. All that will be >> that would be R4 and then the top corner would be R7 >> in the middle would say L >> assuming they all request you have R seven in the corner L where the solar farm is and all of this would be R4 and I do have this month on the 28y going forward >> when you It's different. Put a little bit of everything. You talking about four or seven like some larger lots, larger homes, some larger homes on slightly smaller lots. And then, you know, just a range of housing styles. So, not everything could be better. Everything's not just a lot. They're talking about almost like having kind of multiple subdivisions within one big subdivision. So, in one area, I've seen this before. These lots might be 10,000 square feet. These lots might be 8,000 square feet. These lots might be 14,000 square feet. They're kind of market driven, but they want to build in the flexibility. And I think when they when they bought in or partnered with the falls and landing, that was part of their desire to create that opportunity. That's the wrong We're still in first public. Yeah. The density. That's the right one. The density was about three and a half units per. So that's part of the reason staff supported it because um it was medium density residential and we felt like they were holding the medium density right there based on the future land use. That's what I was talking about the future land use. I think there should be We have another clarity map was updated last year. So the old one might All right. Do we have a motion? >> Mr. Any further discuss provided us with a document several weeks ago really outlined a lot and um with respect to our responsibilities with um how we're meant to be growing Greenwood responsibly. has taken that very much to heart and I think that we have to be more direct and taking time to make some recommendations to make sure that we're not overcrowding portions of our community. >> Yeah, I agree. Ideally, I would love to hear public comments on that. My only my only concern is It's not going from any further discussion. All in favor of the motion to deny ordinance. The next item, which we've already touched on, is ordinance number 25-018, which is to amend the zoning map by 12 acres of land located at 1600 East Cambridge from LW to R7. And that's going to be this corner up here as denoted in this graphic in this graphic. So right here above the um solar recommended approval planning commission recommended recommended approval. It fell within the >> land use high density. >> Well, they're asking for high density, but their proposal what they could put on the property of it go within future land use. Um, >> but the future you chose as high density. >> No. So, we also felt like there was we had a lot of single family developments going forward. Um, we didn't have as many options like for town homes or other ownership patterns. So that was one of the reasons that we felt there was a good support for us. >> Okay. I guess I was just a little The big one of the things we discussed too quite a bit at planning commission was the fact that um the traffic count under as it develops under LIW which also allows GCP general commercial would be more intense than the proposed number of town homes. So we felt like the possibility of doing single family attached or single, you know, town homes on it would reduce the number of trips per day than they could currently work on from that they can do by right through industrial warehous. One question is being proposed in the four corners development between >> not the other one at one time. Yeah. It was different levels of single family. Some had larger lots, some had smaller lots, some were higher price, some were lower price, but we're getting that kind of flavor in that development. As well as the four corners, we're getting a mixed use of am I correct in that assumption? You are. And there seems to be kind of a trend that we're seeing in more places than just development. one other. So there's enough going on and fully occupied as well as other as we are on the course as well. It's going to be a ghost because these houses I'm not in I look at it I work very personally $60,000 they can't afford mortgage. So unless I can see something that's less than $200,000 that's worth it that a single family can really appreciate. I want to make sure we have a motion. Do we make a motion? to ordinance number 2518 amended city official land located at 1600 east by Edwards by Mr. any further discuss I really appreciate your hard work. I really do and and I I know I know that you work really hard and I know commissioned all of these. However, I I still very seriously but and I we hear a lot this is what developers going to do. I appreciate that information. However, it doesn't matter to me. what matters to me is what they could do. And so that's what that's the kind of strain that I'm applying to everything. And I think when Robert was saying while he was cooking and I have teenage kids, um I think that uh I think that we we need to make sure that we're being very intentional to make sure that pretty much going I agree with Mr. P. Great point for this specifically though I think issue is looking forward to the compensated so that certain are not designated or higher. Um my guess I sympathize with the statement you made earlier is that by additionally allowing R7 you can have less traffic on the road. this developed industrial commercial that's what makes sense to me I agree with and if I may that's that's exactly the reason why I put together this When we started seeing things come in proposal after proposal after proposal and multiple at a time I realized that it was a trend and we were going to we haven't seen the end of it yet and the other thing is different levels of value and we do need some more. Um so if you're joining from Columbia, Columbia, South Carolina, born raised shaving. So this presentation of the 2024 audit. So we had engagement team. was myself um Jack Woods and one of our managers and they used far one of our directors for up three we came in we did the audit um you know roughly started in the spring got through and finished audit here in the fall we're going to talk about financial trends comments other matters stuff that will go on next year um and then any questions you have next slide so a little bit about us um you know we're pretty sizable firm um one top 100 firms. Uh we cover a lot of this side of the coast, South Carolina, Georgia, Florida, and North Carolina. Next slide. All right. SP everyone likes results of the 24 audit. So our responsibility under the auditing standards generally accepted in the United States and government audit standards. Our audit was performed in accordance with gasing and um in accordance with gas. Um we're required in considering internal control structure performance express their opinion to see financial statements and not for the person that's providing insurance control structure. Our objective is to provide reasonable but not absolute insurance and basic financial statements are free from material misstatements. Financial statements are responsibility management for 2024. We have an unmodified or clean opinion for the financial statements. They present fairly in accordance with the academy principles um generally accepting the United States of America and our responsibility does not extend beyond financial information contained in our report. >> Um the audit went um pretty well. Um, you know, we had a little bit of a delay, but um, other than that, um, it was really just due to just different grants that y'all had to give away throughout through the year and also switch over updating an accounting software. Um, you know, other than that, it's pretty usual stuff we see governmentwide. I personally knew a lot of South Carolina clients and had multiple clients at county softwares midway through the years and come into delays but other than that um it was a clean opinion with financial work you guys >> do you want me else >> okay yeah I'm just going to go through the uh required communications Just let me read it off and then we'll I'll be out of here. All right. County policy county policies used by city described a note fund is required to implement GP 101 for year end of December 31st 2024. The standard change how accounting is earned but unused and approved in consideration. We know that in accordance with generally accepted accounting principles authorizations there's no significant new policy or quantity of aspects of it polic. the state is not involved in any controversial or emerging institution for which guidance is not available. Um you'll have various management judgments over capital assets uh pension and other post-employment obligations management estimates are prepared financial statements were reasonable in relation to financial statements taken as a whole. We consider the information quantitative aspects of management calculations and evaluation of students significant policies. Disclosures are in the footnote. Um to American we cooperation from management. There's no disagreement. There's no posted audit adjustments or pass no pass adjustments and in representation of management. We uh requested written uh representation of manager relating to the accuracy of information including financial statements and the completeness of accuracy of various information requested by us during the audit and provided written cases without problem. There was no uh need for them to consult with any other towns and we did not face any issues. The significant issues discussed with there's no issues information documents contain financial statements. Our responsibility for other information is in the supplemental information section of the audit. The CMS provides for a copy of final reproduced material for our approval before distribution which they have and then bar independence in accordance with AICP for breakfast. It's independent regards to city and reporting process. There's no paper changes for management services. Um, and then you said you have already reviewed the financial highlight slides. Um, and then just for uh for next year, so Gatsby 1.5, we've already communicated with Sarah those requirements to include any new GP announcements that we'll see coming up through the following years. Um and then our free and continued education that we do with our firm that just keeping our clients up to date. Any questions? I guess just to confirm no which we need to be aware of any questions. And the new business number two will be our fourth funding item of the evening which is to amend ordinance number 25-019 which amends the city zoning map by reasonably approximately.59 acres of land located at 1428 East Cambridge from R3 to GC. East Cambridge is is hot tonight. Um, so this is this property is located just up the street from the the solar farm that we were just discussing which is the his solar farm is here. This is partial here. It's basically right at the red light here at Triangle Hardware. Um, he's requesting to move from R3 to GC. I believe Carol mentioned previously that he is hoping to operate some type of business there. This is a view of the property and then this is a view looking away from the property off pretty close. So meet the property owner and he lives the way that he thinks that this would be a good location for commercial development. Um you can see the future land use map is on the left there. Um and you can see the the corners there are basically commercial and other things and then that section is still residential being density residential. Now um our biggest concern of course was when we talk about spot zoning this is a great example. So it may be one day that it would be feasible. But if you go back to the zoning map, you can see that the um the corner there has already started the commercial has already started bleeding into the residential area, but it's just not that far down and it's not as far as it is from the future land. So that was our biggest concern. Um if you have any questions, I'll be glad to address I don't think he lives here now. I know he I know he lived in New York for years and years, but I'm not sure that he lives here now. >> He doesn't live on this side. >> I would not staff and planning commission recommend. Would you mind just pull your microphone down just a little bit? Well, some have a hard time hearing one. >> He's done commercial. And there's the guy that has a food truck. >> You see how far commercial the GC comes down the block. >> Is he up here? if he could get the neighbors to come in. But it makes sense. >> We might be able and and I don't I don't doubt that at some point, you know, with traffic and everything else, more of those might go towards commercial, but just putting a single commercial in the middle of the residential right there counterintuitive for us by Mr. Green by Mr. trend in that area grocery store in one of those places and this is there's there's been folks that have seen opportunity there but I know it's so close but it's the neighbor >> perhaps an area to keep in mind as we're looking at the new new comprehensive certainly spoken. I think it's premature. >> I actually suggested that he may want to talk to the neighbors to see if they might want to come in. commercial. >> Could you do a neighborhood commercial something that where there would remind me of the options? Um, we could do neighborhood commercial. Um, I'm trying to think of what it allows exactly. Um, but even that I think he's trying to use it as it is now. And that was my biggest concern with supporting it was that He did. I don't think he realized he would have to do a commercial development. And we run into that a lot when someone has a piece of property and they think they could just convert the use and then when they come in to the building department, they're shocked at how much goes into converting something from one type of use that was approved for in terms of the building code to another. And it can be quite expensive. [Music] >> Yes. accessibility issues, >> drainage, everything, >> right? >> Yeah. Professional neighborhood not allow the res. So the best way for that gentleman to get commercials together in favor of deny ordinance number else. >> I don't think so, but she's welcome to stay. >> Okay. Well, moving right along. Uh, new business plan number three is consider resolution number 25-005 to express the intent of the city to um cause the city to be reimbured for the proceed proceeds of tax exempt obligations. Um, this is one that we had discussed at the work session. Um if we intend to u move forward with improvements to the city shop or to fire station one or to this building here um the um bond attorney has recommended that we pass this resolution so that we can be reimbursed for any funds that we expend prior to floating bonds or um however the financing of those projects comes to be. This gives us the opportunity to reimburse ourselves for engineering and other things that might um be spent through the course of this process. >> Any questions come through resolution? Moving to item number four is to consider resolution number 25006 which approves the distribution of 2025 2026 accommodations tax is going to reduce herself. Um this uh these are funds that will be included in your 2026 budget to be distributed in the 2026 budget year. The recommendations of the accommodations tax committee is here for your review. We have a just a little history that's the the work session. Uh this is money that comes from state a tax collection. We also have local a tax placement. This is actually state money. It's dictated by state law how it can be distributed. So you'll see that state law, this was our starting balance at the top. State law requires that the first 25% goes to the city as well as 5% of the balance for a total of 3723928. That will go to the city's general fund. Discover Greenwood, which is our primary um destination marketing organization, receives 30% of the balance, which is that 69,763. The majority of it, what remains 166 66283 is what goes before the accommodations tax committee for their consideration of the grant applications that we've received. So on the left hand side you'll see the agencies that applied, what they requested and what the committee is recommending. >> Yes. Not here. She was with the committee when they were deliberating. If you have questions for hers, you can answer those. Otherwise, look for recommendation from council. Mr. >> I think the only point to mention was that um the committee decided to um fund Benjamin Es fully. Um everybody else did not receive um they didn't recommend their full ask based off of um history of continued ask from the other organizations and in the immediate previous year Benjamin May had not requested funds. Um but otherwise I think that's request >> not in 2024 but they I think they have >> any questions asked for because he's bringing the hotel. >> Yeah. So he the way he explained um his presentation that evening was that they would have an alumni reunion um from Bates College here um with he anticipated 69 folks stay in hotels. Um so that came into play in the committee's decision. Um and that would be for an event that he's hosting for um the site. question by clarity. The only question I have is we have triangle that I feel like we have responsibility for created triangle. Um they're not a state they're not but um typically all of the three arts organizations have centered $75,000 for it. So I feel like continue with this with this recommendation hospitality tax they want to reconsider maybe catching up that balance outside tax it's not about fairness thing it's about expectation these organizations rely on this money every single year for sustainability and we've made an obligation in the past to support these folks tourism related functions. So that's just further discussion. All in favor of the motion carries. >> So the next item is going to be to consider resolution number 25.007 which has been approved. distribution of the hospitality. >> Sorry. >> Um, so you can see here the request the 2025 request and the 2024 amount that they actually received. Um, just tagging on to what um, Mr. Bass said, if you were inclined to um, You would need to make a motion if you wanted to to add $10,000 for funding here for the art center 2025 request. What is the proposal? >> So we have a committee of council members that's Mr. Ables Mr. Bass Mr. Dean who met and reviewed these applications. So they would need to recommendations. I will um like to approve resolution 25-007 with an amendment. Is that correct Tiffany? New business item number six is to consider resolution number 258008 which authorizes Christmas gifts for city employees. Uh even though Miss Balden is not here, I'd like to clarify that council members do not receive these bonuses. Uh they are postponely [Music] about $8,900 annually. Um if you have worked for the city for more than a year and you're full-time, you get $50. And if you if you are parttime or you work here less than a year, then you get $25. We typically give them a gift card from Walmart because you can do whatever your heart desires. They almost further discussion >> and this is already in your 25 budget. We just have council approve it annually. >> I think the history on that is that one time somebody confirmed Mr. Brown because he was proven by the All right, new business item number seven. This is going to be a little little bit uh different than typical um new business items, but I'm going to cover it anyway. This is going to be to consider approval of design build contract with Cosman Construction for Phoenix Improvements. We've been talking about this project for a long time. We've been back and forth and back and forth um about what items we want to include in this contract. uh we went ahead and approved the um them to go ahead and engage with an engineer to look at the storm water issues here and what we have found is um the other thing I want to say is we're also simultaneously doing this um storm water study Davis and Floyd are doing both of these things and so it was a good marriage of parallel projects because it highlighted some things that I think are important to this particular um project here. Um so right now Estimated cost of this full project is going to be $2 million. Um, this is for storm water, field improvements, lighting, fencing, parking, bathrooms. We do have the option to remove the new building which will be concessions and bathrooms and the site work associated with that and reduce the budget to about 1.4 million. This is this will come from hospitality tax. the issues that I want to highlight for you because we had a a long meeting today with Davis employee in South because I said you guys got to help me understand this. So the storm water improvements only are coming up to just shy of a million dollars. The reason is because this particular pipe that runs under the field um it carries a bunch of water from uptown in the main street area. So it also this line also runs under Phoenix. And even though we're not going to do any improvements to the piece that runs under Phoenix, uh Davis employed is going to recommend coming out of the storm water study that we do make some improvements to the storm water upstream from this pipe in the future. >> And because of that, if you cross under a DOT road perpendicular, they require you to um design to put a 25 year um storm event and that requires this pipe to be 60 inches. I mean, I I could almost walk through this without squatting down. It's a really thick pipe. Um, so we talked a lot about, okay, we they're still doing the storm water studies. So, they're they're evaluating it one watershed at a time. The wershed that includes Phoenix just happened to be the one they did first. So, they know the most about this one. My question to them was what where's the work on main street um in the uptown area where is that going to fall in order of priority because if we don't touch that pipe running under Phoenix we don't have to design right now to the 25 we have to design 10 years um and so the answer is we don't know because we haven't finished this study yet um my feeling on it is that even if we know this is going to be a recommendation that they said to us, do you guys see a lot of flooding in Main Street? I said, no. Do you see a lot of flooding on Phoenix Street? No, not really. Sometimes if you have a hard hard rain, you're going to see flooding in those areas, but that's pretty much with anywhere. Their feeling is that the recommendation for the work in this area is going to be further down the line, that we're going to have much higher priority projects that we need to deal with relative to storm water. And that by the time we get to this a lot of other things may have changed, right? So, we said, "Okay, how about if you take a step back and let us know what it would cost to design to the 10year storm event so that we could compare some some pricing." They know for sure they've already done a take off early takeoff on a um a uh 48 inch pipe which they feel like is probably going to be the minimum that we would need for the um to to accommodate the 10 year event. Um and that's going to be um we already know that's going to be somewhere in like the $620,000 range. It's going to be a little less than that. Um, but going the 10 year versus the 25 is about $350,000 in savings. Um, so you do have some options here. This was already on the agenda, so I at least wanted to discuss it while we were already here. Um, in my opinion, your options, and we'll come back to some of those slides. In my opinion, your options tonight are you could go ahead and approve a not to exceed contract in ML2 million and hopefully it doesn't go any higher than that, right? We we can once we get the additional information back, we can negotiate a lower price if the 10ear storm makes more sense. Um, you can also wait on the info regarding the the pricing on designing to the 10ear storm and then approve the contract amount. We did go ahead and decide to go ahead and permits have already been permitted. because that was going to be a hold up if we don't keep moving. They feel like if we drop back from the 25 to the 10 year, it's not going to require any type of amendment. So, it's not going to hold up the process. I mean, they're just going to say that's fine if you need to drop your pipes down. The biggest I think the biggest thing that we learned is that a lot of water is coming, a lot of city water is going under this field and this pipe is in really, really bad shape. um and it cannot be lined. They've been very clear about that has to be replaced. Um it's just a question of do we want to go ahead and design it for the 25 year event knowing that in the future we'll probably have to tie in order to do it anyway. Uh in which case >> well in which case you would either have to put in a parallel pipe or take this pipe out. I mean there'd be a lot of questions that would come up about that in the future. Thing is we're not going to really know where where that street work might fall in terms of priority until the whole entire storm water study is completed. Um, you know, where we landed at the end is the end of our call today with them was I was leaning more toward probably just designing it for the 10 year because given that we don't have a lot of flooding issues right now that we feel like are pressing and we have a lot of problems in the in the uptown area or the surrounding areas with flooding. Um, I don't think that project's going to be an extremely high priority for the city. You also could see that there's probably going to be a lot of change in the you know even just 10 years from the time you have to make those changes from now a lot could change in 10 years and so are you overd designing this not knowing what you might need in the future I don't know I'm not an engineer um do you have any other thoughts >> that was really kind of what focus was on today focus on now Um we just don't know whether or not we need a bigger pipe. So what size bigger pipe we would need? If you wait 50 years from now, the whole downtown may be completely different. need a bigger and even a larger pipe or it could be rerouted somewhere else and it might not impact it at all. because there's so much unknown about what's coming into this in the future. So I guess our focus I think most people just go down. >> So I have a couple courses. >> So when you talk about the water is whatever goes to a creek or water. So there is a creek at the end of this pipe that runs beside the public works facilities >> and so it's basically every all the water that runs to that creek includes part of downtown and I think he said 13 water in the city and they're based so they're evaluating them one at a time and they just happen to do this one first and so they know the most about this one which was helpful in this convers about Phoenix. I mean, I, you know, as the number just kept growing and growing and growing in the storm water, I said, I just need to understand this a little bit better. And now understanding that basically a lot of that water from downtown uptown is um it's is running down, it's getting in that pipe. It's going under Phoenix. It's running under the field and it's going out the back side of the field and it's getting in that open concrete culbert that runs but through the gauge fruit area and around a lot of water in there. Um and so that explains I mean they said look if you weren't catching any water like if you were just focused on this site only we wouldn't be having this larger conversation about storm water. It will be a sight specific storm water plan and you wouldn't be looking at such a large price tag. Um, but unfortunately this pipe is is in really bad shape. I mean, they said it's really bad. I said, you know, give me give me an idea. He said these were eight foot runs and every eight feet there's a separation. I mean, he said some of them are so significant like a 4 inch drop from where the pipe is separated. >> That's where you're seeing the same. So, um I guess what it comes down to tonight. >> So, if we don't do anything back up, >> we're going to have to do >> we're gonna have to No, this is storm water. >> Yeah, we're gonna have to do something otherwise this site is going to become obsolete. You're not going to be able to use it. Um I just I mean I was shocked at the the amount the cost associated with it. Um but um hopefully I explained it better. Um again, you can back this building out if you want to. Um and the site work that's associated with this. The only challenge there is that right now the site's bathrooms are not very functional. We try to take quarter zones out there multiple times. Um so seemingly if you're going to make improvements, this will be the time to do that. But I'll leave it up to council. Like I said, you could back that piece out and be closer to about 1.4. Um, and maybe with the 10year flood, it'll be even lower than that. We just need council to help us drive some decisions on how this contract is going to look. Um, I will commend Mr. Bass with um lighting services and they were able to do lighting. They gave us a cost on the lighting for 80 80,000 versus I don't even big And um so and then there's a little bit of work across the street that we need to do as well. Um >> be able to help with that. >> Great. >> And we and we'll continue to to look for grants um help us with some of this work. We we're always looking. But um we can wait if you guys want to wait. Davidson Floyd, the the guy that's been working on this project had done all the storm water calculations was in Europe on vacation and they said they just couldn't even get in touch with him, but he would be back on Monday and they felt like by Wednesday they could have us not do a number on the storm water and we could bring this back to you at a special call meeting on the 3. Um, or you guys could approve tonight and not to exceed amount. Um, and then we can just keep you informed and I will leave that up to you guys as to how you want to approach things. Well, we substant not to exceed 2 million. >> So, you're authorizing the city manager in your contract not to exceed. >> Correct. Um, as this is a design build contract, it it does create a lot more flexibility for us to work with the contractor to save money. Um, the Grace Street project was the first design bill contract that I had done personally and it just happened to also do with Syman. Um and they were really excellent to work with. We did go a little bit over budget there. But it was things that we needed that we determined in the field like, oh hey, you know, we need to expand or we need to move this over here. We need a little bit of storm water work over here. And so they're designed to keep you within budget. Um, and you have a lot, you being the administration has a lot of flexibility to keep that number low or push it up high if you're in the field and you see a challenge. There's a there's a pretty big contingency built in to the storm water piece because what's underground is a little bit scary sometimes. But if we get in there and we see that the storm water is going to be even more, you have the flexibility to just say, "Hey, we don't want to do the we don't want to do the fence because it's going to push us over budget." So there's a lot of flexibility there. >> They're still on the timeline that we discussed which will be very end of December, beginning of January. And that's why we want to keep push pushing the DDS permit through. >> And so with the not to contract 2 million that was that still involve 10 years. >> I think a 10year pipe will be consider it will be less. I don't want to say considerably less but I think it will be less. But that's assuming that the pipe will be 48 in 54 in. Don't know the 10 year may may require a 60 in we don't know the logical side of me the non-engineer logical city of me says that it'll be less >> I don't think any further discussion All in favor? >> All right. A couple that I just want to highlight for you quickly is the um office of resilience. We talked about this previously. They will have a mobile intake at the United Way on the 21st and the 23rd from 10 to 4. This is for anybody that's still struggling with anything hurricane related, storm damage, anything that might be, you can go here, meet with the case manager from the office of resiliency and they will help you determine whether or not um they have services available, resources that can assist. So, please push that out as much as you can. The county's pushed it out. We pushed it out. Um United Way's pushing it out. Um, we have a new event coming up this this weekend. It's the for the love of event. This is an uptown Greenwood sponsored event. I know their board has been very active in um making this event successful. Uh it's uh 6 to 10 on Friday and then all day on Saturday they're going to have street musicians. Um, and it's just a celebration of whatever you love about Uptown Greenwood. So, this band, Congress, the band is apparently very popular with the young folks. Um, they're from Charleston, I think. Is that correct? They're from Charleston. Um, and they do have a pretty good following. I think of college age kids. So, um, they're looking for volunteers. If you want to volunteer, you talk to Gibson now. A number of our management council members Okay, good. >> All right. Um, and then we do have the grand opening of G Street Park, which is Thursday, November 6 at 4 o'clock. Following this, we will have a movie, which is How to Train Your Dragon 2, and I believe that will start around 5:30. So, I look for that to be a pretty nice Um I did and and also the mayor is working on an inaugural um pickle ball uh tournament >> invitation only I believe >> that that will be uh a week from today the 27th at 5:30. I just got four things for the three courts pickle ball. I wanted to get that invest. >> We're waiting on benches to come in. They were supposed to come in today. It's not necessary, but it will be nice. Um and then we need according to we need some rain so they can get the grass to take a stand. We're going to put a couple signs just grass.
