foreign good evening ladies and gentlemen it is now 5 30 and I will call this regular meeting of the Burnsville city council to order it is our tradition to stand for a moment of silence followed by indivisible with liberty and justice for all [Applause] tonight's meeting is being conducted both in person and online members of the public May attend in person or watch this meeting online at in the council agenda packet the next item on the agenda is announcements and we have one Proclamation and we have some presentations our announcements have to do with all of our upcoming meetings regular Council meetings are scheduled for Tuesday May 16th at 5 30 pm and Tuesday June 6 at 5 30 PM we have a work session that's scheduled for Tuesday May 9th at 5 30 pm we have a governance meeting on participatory budgeting white paper on Tuesday May 16th at 6 pm and a special work session to interview Commissioners who are interested in our advisory commissions Tuesday May 23rd at 5 30 PM in conference room D unless noted all meetings of the city council are held here in this in the council chambers and this evening we have one Proclamation and that has to do with Jewish American Heritage Month whereas Jewish American Heritage Month is an annual tribute to the generations of Jewish Americans who helped weave the fabric of American history culture and society and to the contributions American Jews continue to make today and whereas the Jewish American story is an essential chapter of the American narrative that has greatly contributed to the religious cultural political economic and intellectual advancement of all people by joining together with all faiths to reject ignorance and intolerance teach empathy and compassion and root out hate wherever it exists whereas we recognize the Jewish communities continue to be challenged by bigotry hostility and discrimination and that our nation's commitment to Religious Freedom obligates us to root out Prejudice and combat anti-semitism and whereas the Jewish American heritage month is a time when the culture and history of Jewish Americans is celebrated and their sacrifices and contributions to this nation are honored and now therefore I Elizabeth Couts mayor of the city of Burnsville on behalf of the city council hereby Proclaim May 23 May 2023 to be Jewish American Heritage Month in the city of Burnsville and encourage all residents to acknowledge and honor Jewish Americans for their notable accomplishments and outstanding service and to observe this month with solemn remembrance Proclaim this second day of May 2023. and this evening we are also very proud to have with us the Burnsville Blaze robotic team presentation and who is doing that please come forward and I think you're going to be presenting from yeah so yeah we're very proud of you all and thank you for all of the work that you do and congratulations thank you yes we are the we're the Brazil Blaze robotics team located at a Burnsville High School not very far from here but essentially we're here to talk a bit about our season this year and how our very successful season this year I know we have a quick video this is essentially just a quick Showcase of what we're what we're doing this year every year we do something different and this year we have a very like a position essentially the alliances are an additional points and balancing on these balanced being things throughout a match you can see there's cones and cubes and essentially they work to score on these poles and shelves throughout a match this year we're presented with a new challenge we have to design program and build an entirely new robot to accomplish charge station that's you can get a very basic idea of essentially placing cones and cubes and then balancing so this year we started the season we had four returning members from last year we gained five new freshmen uh this year at the start of our season to our recruitment efforts at the high school and we basically started this year built our robot and then we traveled for our tournaments we went to one in Kansas and Missouri we went down there and then we won both of those tournaments it was very it was probably the best normal season we've done won both the tournaments and qualified for the World Championships that happened in Houston Texas and then we improved Upon Our robot and then headed there that was two weeks ago now I believe yep yeah two weeks ago in Houston Texas we completed the World Championships there there's eight divisions of about 77 teams each uh we were in the Newton Division and then won our division there on the on the winning Alliance we won that division which qualified US for the Einstein field what they call it's basically all the winners of all divisions play to determine the win or like the world championship yeah we qualify play there we end up we go we get fifth there so we ended up we fifth in the world of oh for our robotics we did it was a very successful year we a lot of fun I know all our students learned a lot and then had are doing our best to try and continue forward with our success to do better even better next year if we can well congratulations and I know that our Burnsville Alliance Club also donated to help sponsor yes their sponsors are very crucial to us I know we've had a lot of local companies and stuff help we've got we know we it's pretty expensive to run robotics but we have a lot of little companies that help and some others but yeah we're always looking for par yeah so I want you to do something before you go on to the next a year of your competition is let us know ahead of time so that we can also contribute yeah absolutely yeah because you used to do that but then this last year I didn't see anything except until we got uh until when I went to my alliance club meeting and saw that you were asking for contributions and I know we've done it in the past and so uh we did another contribution to to sponsor you all so and we want to do that because I've been to your meets when they're here and um you guys do an awesome job and thank you so much for representing um our school and also you guys and so thank you very much for the work that you all do and to all of your coaches because I know it takes a lot of adults to help coach you uh on all of the things that you do so thank you so much and thank you for coming in and telling us about your successes [Music] oh yeah we are we're competing at the state tournament this weekend in about four days oh yeah it is right here and now you're meeting at the high school uh yeah we meet at the high school but all right the state tournament is happening at Williams Arena this is just a video I know this is our this was our first match in on the Einstein field in our robot is 31.84. it's on the right okay you can see it this is a this is one of the matches we played in the World Finals each game starts with a 15 second period of autonomous pre-programmed um instructions and then after that it goes into tele operated uh where two drivers will take the controls and uh Drive the robot through the rest of the next two minutes seconds so is this all is all this autonomous so we're seeing this is driving right now you're driving right it's even more impressive yeah right now our drivers are are driving the robot obviously drivers are driving all the robots have you ever had crashes in the middle uh yeah robots Collide a lot sometimes they'll you run into each other hard enough that someone someone Falls over every once in a while yeah there was one match we our robot got pushed over twice the first time we were able to lower our intake and push ourselves back up but then next time they kept pushing us is this platform is this just at the high school or are you yes this is in Houston this is one of the matches for me I mean is this program just yes we build our robot our shops in it's in the basement of the high school yeah you got started out one a year is there anything in the middle schools that kind of yeah there's another program before that middle schoolers can do where their robots are 18 inches cubed much smaller than these but it's middle schoolers and their teams are a bit smaller but that's a it's another robotics throw it's all under first organizes like different age groups for robotics programs this is the high school and first robotics challenge okay there's a first tech challenge for middle that middle schoolers do which is a very similar like setup every year in FTC yeah their robots are so this weekend you'll be at Williams Arena did you say Williams Arena the Minnesota state tournament yeah is competing against teams from across Minnesota okay great we are currently ranked number one in Minnesota we hope we hope to to take home another win this weekend but we'll see who's your arrival who's number two uh I'm trying to remember number two right now I think is a team from Becker Minnesota okay okay great not eat dinner it's naughty Diner so that matter what we would like to do is yeah we would like to uh take a picture with you so if you guys could all come here and also the coaches and um because we have uh we have Miss Kelly who's going to take our photograph so if you guys can all stand here yeah and all of your coaches if they cannot and teachers yeah that's awesome that would be great thank you thank you sorry yes all right okay yeah yeah yeah yeah yeah yeah so can you can you see us off Kelly hey that's her spot thank you thank you so much um as a parent of one of these guys um I also want to just point out that like this is our next generation of problem solvers yes these These are the guys and um we really appreciate your support uh they went up against kids who were sponsored by NASA who basically writes them a blank check Google Microsoft um we had we played with teams who had a 400 000 a year budget um we don't come anywhere close to that when we went to Worlds we had to scramble to earn the fifteen thousand dollars that would get us there so we're a small team but we got a lot of heart and we got a lot of people good people behind us yeah yeah thank you well let us know when you do the next fundraiser ahead of time yeah okay great thank you thank you for coming in yeah thank you thank you and now it's my pleasure to invite um uh from our burn Haven Library we have Mr Chad yes come forward please and give us your update Madam mayor council members thank you for the opportunity to be here um I just want you to know that is a really tough act to follow and before anybody can ask I have no idea what our library is ranked in the states what about the county oh we're the best in the county hands down I understand by that statement so as I've done in previous years I stopped by the council to give a brief update of what the library has been doing over the course the past year and kind of talked a little bit about the direction we're heading in coming year usage statistics at a glance we had just over 170 000 visitors at the library this past year we checked out over half a million items so our usage numbers continue to climb we're still not to our pre-pandemic levels but we're getting close and then over the uh the stretch of nine different County Libraries we had just over three or excuse me 30 000 individuals attend classes and events in our libraries the Burnsville Library share of that we had about 3 500 to 4 000 people attend classes at our library some of the specific highlights that I was hoping to draw your attention to today and I have to mention this just because they are our neighbors the Burnsville license center was renovated this past year so the library gave up about 10 feet of space which enabled the license center to double its seating capacity um the Burnsville license center is actually the busiest license center in all of Dakota County and up until just recently was also the smallest so the license center now has additional seating so that people are not standing elbow to Elbow throughout their uh their brief weight and they were able to add a service station as well so they could increase capacity to serve our residents also want to talk a little bit about some of the educational supports available at the library this past year including hot spots and Chromebooks the library system in Dakota County loans about 400 hotspot and Chromebook kits out to Residents and we are seeing a huge demand for that we've got about a three week waiting list in any given time for those hot spot and Chromebook devices and we just found out that the funding for that is going to be continued to it's going to continue to be provided over the course of the next year so we will see that service continue at all of our libraries also wanted to mention that we we have regular homework help tutoring services on Wednesday evenings at the library throughout the Academic Year anywhere from four to five different tutors are on site on any given Wednesday and we have a large number of residents who stop by happily we're seeing a lot of residents from underserved populations coming in for support so we're getting a lot of Latino residents we're getting a lot of Somali residents coming in and I anticipate that our numbers are going to be even more robust next year but the word has gotten out and then my personal favorite thing here I just want to say the story time is back after two years of elaborating very very quiet we now have baby story times and toddler story times happening in the building again so Monday or excuse me Tuesday and Wednesday mornings if you don't like kids don't come to the library because for at least two or three hours on each of those mornings we are just swamped with kids we're averaging about 60 people right now at all of our toddler story times that is actually surpassed our pre-pandemic numbers wow and we're probably going to see that grow next year as well two story times in particular I wanted to mention last year I talked briefly about the Somali story times that we were just getting ready to start at the library well Midway through the summer of last year Fox 9 picked up the story and came out and did a nice little news feature on the Somali story times this is still available on their website if you haven't had a chance to view it yet you can certainly visit and take a look at the program overview dequa muhuddin who was our story time teacher for the event did a spectacular job and a lot of families who had never met each other a lot of Somali families in our area actually made connections for the first time and we had people driving from as far away as Richfield and at least one day we had somebody drive in from Minneapolis to come to the event so we're in the process now trying to figure out how to fund Continuing Story Time sessions with our Somali families stay tuned for the months ahead for and then did I see BJ Youngman here this evening Jason Youngman I have to give a shout out here we had asked for some support with our story times we wanted to get a firefighter to come by and talk to the kids and I was secretly hoping that BJ would agree to come out himself but he said he had some great people that he was willing to volunteer and assistant chief Neil Dwyer came by to do a story time program in January so we had about 65 kids excuse me 65 people present for the story time with the firefighter wow and uh Chief Dwyer talked a little bit about personal safety he talked a little bit about what it is that firefighters do because for some of those tiny little kids seeing somebody showing up in their firefighting gear can be kind of a scary thing so he talked about the importance of having firefighters and why we need to have people who are community helpers like firefighters and this really kind of dovetails into the story time sessions that we do at the library because we're constantly talking about how important it is to help people how important it is to have people that you can rely on and how important it is to be safe so this was a natural fit for what we were doing at the library and chief thank you for your support I will be calling you again next year all right a couple of Trends just to mention particularly before I step away here just like the city of Burnsville the library has invested in an Outreach vehicle I think what what's the name is it Eva yeah the vehicle yeah here in Burnsville ours is nowhere near as fancy as that but after meeting with your team we are actually going to be buying a new vehicle sometime within the next year and a half and upgrading so we still may not be quite at Eva's level but we are going to up our game a little bit and you'll see our vehicle out and around the community as well another major Trend that we have and this is kind of in response to just the Aging of our population we are sending Librarians out now to multiple senior residences throughout the city of Burnsville we've currently got five different senior centers that we're visiting we provide materials to individuals who can't make the drive over to the library we bring books to them we take books back from them we also do tech support When we arrive the ostensible reason the apparent reason we do that is because we want to support people who want to do e-books any audio books but what my staff tells me is that this also just turns into a general help session where everybody brings their technology down and says can you help me with this and our I've got a great team they're more than willing to help out with anybody that brings in their Tech questions so those have been fun over the course of the past year and I anticipate we'll probably be growing those sessions as well just because there's such a demand for it one other thing to mention in terms of Senior Services every year the library offers tax preparation services for senior citizens through AARP we do 200 Tax Service slots where we can bring in 200 individuals to get their taxes done at the library right now there are only about a half a dozen different places in Scott County and Dakota County where you can get your taxes done for free so the ARP organization is constantly looking for volunteers who can support these initiatives we would love to see more sites in our area in order to do that though we need volunteers so anybody who is a retired accountant anybody who's a retired math teacher somebody who's just looking for something fun to do with senior citizens look me up early next year I'll get you in touch with our ARP connections they do a really extensive training so that you don't need to be afraid about doing Tax Services with seniors but we want to make sure that we we continue to offer this service and if at all possible we want to help ARP expand it because there is truly a huge demand for this something else that's uh we're seeing an increase in at the library is attendance of our business classes and educational resources that we make available to the public we partner with an organization called Minnesota score if you're not familiar with score it's an organization of retired and business Executives who provide things like mentorship opportunities they also teach classes typically for free at various locations all throughout the Twin Cities we promote the score classes that we offer with all the Chambers of Commerce throughout Dakota County most of the classes that are offered through score are free most are also online which I think is one of the reasons why we're seeing such a market increase in attendance and we anticipate that if the economy truly is starting to slow we're going to see an increase in demand for these kinds of services because what we learned from the Great Recession back in 2009-2010 is that as the economy slows down more and more people make the decision to go into business for themselves they decide they're tired of working for other people and they look into starting up their own business so we're trying to position ourselves to be responsive in that regard to if the economy truly is going to be slowing over the next year and then generally speaking I get asked at least once a week from customers that come through the library you know what direction do you see the library moving in over the next decade or so in very broad Strokes I can with about 99 confidence say the changing patterns and usage we're seeing at the library are not necessarily on our center around the collection so much so we're not getting rid of the books anytime soon what we're seeing is a change in how customers want to use the library space so we have people coming in now who want to be able to do they want to study for college classes they want to work on whatever business organization you know has given them the opportunity to work remotely they want to collaborate with other co-workers or colleagues sometimes in different locations around the state or different locations around the country and sometimes they just need meeting space we've been pushing Library Services pretty heavily to some of the businesses that are located up down Highway 42 and we're getting a large number of businesses they're now coming into the library to do things like staff meetings they're doing trainings they're doing hiring events they're doing performance evaluations and that's great we want the library to be versatile enough to address those needs and to support those different businesses but in the future if we get to a point where the library ends up being remodeled you would anticipate that we will probably see an increase in the number of meeting rooms the number of meeting spaces that we make available to residents council member Keeley had actually stopped by a few weeks ago during the grand reopening of the license center and I had showed him around the library was the first time he'd been in in a long time he was asking about the private study rooms that we have we've got 10 different study rooms that we make available on a rental basis for free to anybody that wants to stop in this past year those rooms were used over five thousand times and we anticipated that we're going to see an increase in those usage numbers as well so the biggest change I think that you can expect in the library is just the way that it's being used in the future we're seeing that demand not necessarily and you'll hear this amongst Library Architects too we're designing our spaces for people not for things so we need to have our space adaptable enough to service and meet those needs I have some time left over here if anybody has questions for me or any ideas that you'd like me to bring forward as well and this also goes to our residents who are watching from home too we are always looking for new ideas and new things to do with the library Mr louvers I have to congratulate you and thank you because I have experienced uh increase of services I believe that you're providing to all community the services that you take out on the go to seniors I believe that's been done only under your leadership and thank you so much for all of that but there are so many things that you have done to improve the Excellence in service uh of library of the library to our residents and to our business Community thank you so much I also want to thank you for your partnership with us because you're always at the events that we have and the library is front and center and it's good to see that children it can also go and touch books and get a love for books again and it's nice to see that you'll have your library on the go van out and about so thank you for everything that you do to make the library a user-friendly amenity to the community the next item on the agenda is Citizens comments and this is the opportunity for anyone in the audience to address the Council on an item that is not on the printed agenda and not an application form that will be coming before us at a future date and I know that Mr McGowan would like to address the council and you may come to this Podium and address us and we only have so much time because we have to attend to the um to the business of uh of the community so so you are not Mr McGowan so you'll have to and give us your name and address for the record absolutely mayor counts and honorable members of the council my name is Sarah mcgrain and I'm an attorney for the McGowan family and you'll see that you're being handed out informational sheets we know that we have limited times we're going to do our best to keep it as fast as possible and in order to do that we thought it would be helpful to have the printed material we are here tonight to share information with you about freeway landfill that we believe is important and decisions that are being made about the future of this key part of the city of Burnsville we are also here as part of the open Forum of the meeting because the legislation that the mpca has has proposed would spend 165 million dollars on something that facts and data show is not an urgent risk to our community there have been questions and concerns about this part of the city of Burnsville for decades as to the conditions of the land what should happen next and who should make those important decisions tonight we are sharing with you copies of my remarks as well as other information about the freeway landfill site important facts that you should be aware of and other information that of the challenges that are being centered by others and unfortunately unfounded assumptions about the property the McGowan family owns approximately 230 acres of land in the city of Burnsville and they've paid well over one million dollars in real estate taxes in the past 10 years the family has been one of the largest landowners in the city of Burnsville since the 1960s this property includes the old freeway landfill site which closed 54 years ago the freeway landfill which was closed 33 years ago and three active businesses including a concrete recycling site the freeway transfer station where waste is collected sorted reloaded onto semis and transferred off the site and a golf driving range the mcgowans have tried to work with the mpca to come up with a solution that would be helpful for everyone for over three decades unfortunately this process has not been cooperative and our concern is that incorrect information about these interactions have created what we believe are some unfounded conclusions the mpca for years has tried to take ownership of the McGowan property in order to quote unquote clean it up despite repeated tests results showing that it is safe and it is not a threat to the area drinking water this is not my opinion but it is findings of the experts who have spent many years making tests reviewing the data and analyzing the data with us tonight are the senior environmental scientists at stantec Mark Olson as well as the senior environmental engineer Carlson McCain John lichter both of these experts have been associated with and testing the freeway landfill for two decades to ensure that the land is safe ironically Michael McGowan became aware that a neighboring property owner Crainer Kramer Mining and materials worked with the city to come up with their own plans to redevelop the McGowan's land without any input from the McGowan family this detailed plan included light Industrial Development park space and more it can only happen if all three of the McGowan current businesses are shut down it is unprecedented and frankly offensive for someone to make plans to develop property that they do not own like the closed Free Will freeway landfill the adjacent Burnsville sanitary landfill also abuts the Kramer mine and borders the Minnesota River but the freeway property is being treated drastically differently by the city than their neighbor we ask simply that you look at the handouts that we brought with us tonight our goal is to provide you with facts that tell a more complete story than what the mpca has been telling in the past it is disappointing that a family-owned business could be treated this way in a city like Burnsville we think you'll agree that it is wrong to take people's property for free we think you will agree that it is wrong to develop properties someone else owns especially when those people have been good citizens and taxpayers of the city of Barnesville the city of Burnsville for decades thank you for your time tonight and Michael and his son Richard and our entire team would welcome an opportunity to meet with you to have a deeper discussion of these issues and to come up with solutions that benefit our entire Community thank you for coming in thank you okay um the next item on the agenda is additions to the final agenda and this is for emergency items only city manager Lindbergh do we have any emergency items to be added to the agenda this evening nothing from staff member members of the council we then will move on the next item on the agenda is the consent agenda this is a grouping of items that's considered to be routine and will be enacted by one motion however an item and the consent agenda can be removed for a separate discussion and vote is there anyone in the audience who wishes an item in a consent agenda to be removed for a separate discussion and vote Mrs Collins only one online okay um city manager Lindbergh not from Staffmark members of the council may I have a motion to adopt the consent agenda please so moved second there's a motion in the second all in favor please say aye aye aye opposing a and the motion carries we now move on to the regular agenda and the item on the regular agenda is a public hearing for a proposed business assistance to Pacifica Square Burnsville LLC and support of allocating Grant of Dakota County Environmental Legacy fund presenting this evening is our assistant community development director Miss Regina Dean Mrs Dean good evening mayor members of the council sidom is very familiar to you I'm sure in 2020 the city received the opportunity to allocate funds through Dakota County and through the Dakota County CDA to support a Redevelopment or economic development project the project that was identified at your April 11th city council work session to receive support was a Pacifica of Burnsville application to remodel and to do a facade remodel onto the former Gordman space at the Burnsville Center additional improvements include some outdoor pedestrian improvements sidewalks and dining space so we've been actively working with the developer with our City attorney on the terms of any future sub-grant agreement and we do have a deadline that we're up against to be before the Dakota County Community Development agency and that date is May 23rd so we're asking tonight of the city council is to that the city council recommend a part of the project to that May 23rd meetings make a motion of support and then we do have a public hearing which we're asking for the council to continue to May 16th to allow for the city council to take official action on the sub-grant agreement and to allow for public comment related to the business subsidy or business assistance okay so you're asking me to open the public hearing and to make a statement of support for this project to the coda County and to continue the public hearing so we're making um a motion to support the project before the public hearing I'm going to defer to our City attorney Mr Shepard mayor and Council um two items you can take them separately so you can open up the public hearing and take a motion to continue the public hearing to the May 16th meeting date and that public hearing will then be continued to that meeting date the second item that staff is asking is the motion for support to the Dakota County to help them Pacifica get the Grant from Dakota County that will then come back with the sub-grant agreement at our next meeting and we'll have a public hearing on that sub-grant agreement okay convoluted but is that support we're supporting the concept of this or yes that's correct you're not the concept we're supporting the process of the concept yeah that that which is it well yeah concept or the project you just said project and he's saying concept well both concept and project I mean this is to to support them to get to get the Grant and and I so this isn't a project I've been working on so Regina might be able to speak a little bit more to it but they will then get approval from Dakota County we'll come back in front of the council for approval of the sub-grant agreement to uh solidify the arrangement and to move fully forward with the project okay I see our city clerk wants to speak and so does our city manager Mrs Collins oh that was you okay a city manager Lindbergh uh Madam mayor this is this item is simply a matter of of action following your April 11th work session in which the council provided Direction both on the concept and project uh it is a matter of administrative timing and negotiation with the developer and timing on the County CDA side for us to take this action um we're the developer is not quite ready through negotiations with us to have a final agreement in place otherwise this would have just been a public hearing on on that agreement so it is purely a matter of administrative process and the County's timing that that the issues come up to essentially continue this public hearing till uh till next week however in order to keep this moving and meet the County's deadlines we need to ensure that that we have our position clearly stated for the for the county to move the grant process along uh council member Schultz so in that meeting agreed to move there were two the process forward so that they could apply for it and we said in general yeah this looks like this looks like something we would want to to go forward with and support um but I am more confused not less confused over what we're being asked to do tonight because project and concept are not the same thing so and if you're asking us to approve a project I do not have it in front of me like I don't have an agreement in front of me I don't approve things that are not in front of me so I don't know I don't know what we're being asked to do and I don't know how to resolve this well for me I look at it this way we're we're this is going to be a public hearing but we're asked to to approve the project before the public hearing and we don't have all of the information when we had the April 11th work session yeah we had Amelia pardon me no if we've received yeah we had we had two projects before us yeah yeah one was this and the other one was a housing project and we said we would go with this so move forward with this so yeah okay uh councilmember Gustafson can we approve the project concept with the caveat as long as they meet the the Deeds or the uh yeah what's in the contract so that we can come back and approve that contract in a an open meeting so we can we're telling the county we want to see this done but it's conditioned on the fact that we are able to come to terms with them to make this happen and have that in that language in there in that way we're approving it but we're all saying as long as they're meeting the terms of what our needs are at the city and after the the and after then we can have the public hearing and uh yeah Mr Thompson thank you mayor and Council um yeah I know so when the county extended you as you recall back in 2022 the county granted us an extension of the elf funds there were two deadlines that the county um required of us one that we identify a project by May 25th and we did and the second is to allocate the funds by the end of November so there's really two steps we were asking the Council of tonight is to identify the project the project has not changed it's the same project that was discussed at the workshop the project is not a dispute that the the Pacifica project that was approved under the under the entitlements that's the project that we're asking the council to just make a motion to support so we can identify that project of the county by that May 25th deadline the allocation of funds which is the later deadline is what the sub-grant agreement will involve that's when we actually allocate the funds to the project under the terms that's what's being negotiated in the sub-grant agreement and that'll be the future subject of the public hearing so you're not allocating funds this evening it's just identifying that project as being consistent with the Grant and requesting that the county approved that not allocating any fund to the project that will happen at your next meeting okay that makes more sense to me because what you're saying is that we're just telling the county we do have a project but I also like the caveat that says conditioned after the public hearing but we identified that this is the project that we would bring before you that we support but I also would like to see that the letter reflects the fact that we have a public hearing that's being continued on the allocation of the funds because to council member Schultz remarks I agree we have we know we said yes we'll go with that and not the housing part but we don't have everything about how the money is going to be spent uh you know what what are all the improvements they're going to do we have nothing of that before us so but I make sense what you're saying because now you're just saying always saying to the county is this is the project that we support group are you okay with that so we're going to just say we support this project but we would make it a condition after the public hearing that Mr Thompson is that okay with you yeah mayor and Council what I'm hearing is that yes the council wants to just reflect in that motion or that letter to the council the county that this does not allocate the funds that that is subject to the sub-grant agreement that we're continuing to negotiate will be approved at a future meeting date so much better than I did yeah but that's I think that makes sense to me then that we can say yes we support this project it's like when we had the work session we support this project over the other and so I can all right then Mrs Dean I will open the public hearing and members at the council I would ask that I we I take a motion to continue the public hearing to a future date it's a motion in a second thank you all in favor all right all right now mayors of the council I also would like a motion uh that we communicate to the CDA that this is the project that we support for the elf Grant conditioned to after the public hearing and getting all of the information about the improvements that the windfall group is going to be using for this space this condition on them meeting the terms what they're going to have to do in the agreement okay I can make that motion yes please do I like to make statements but I'll make a motion on that emotion is really helpful I'll make that motion I
