master plan Awards staff recommends approval good evening commissioners for the record Barca Velata City Las Vegas Planning Department I'm here tonight to present a brief update on the progress on the city Las Vegas 2050 master plan this was a report that was given to City Council on May 1st by Smith group and director Sommerfeld we're sharing this same information to the Commission tonight on where things are at since our last update to this body in April today our team and the Planning Department have done considerable visioning with you the City Council and members of the public and based on what our teams have heard there have been several fitting phrases that helped shape this planning effort this past week we had the annual Helldorado parade and Rodeo we know that Las Vegas has grown considerably and it's defied odds and changed expectations and perceptions and we're no longer that dusty railroad stop on the way to Southern California we're a major metropolitan community that's grown considerably since the city incorporated may 15th 108 years ago we're also a city that's at an inflection point our resources depend on our limited resource our resources are dependent on what we have today and they're limited and they're dwindling and we can't continue growing like beat once did we need new strategies as Las Vegas moves forward into the future we continue to be recognized as a regional national and global leader and will continue to plan for our residents and and we need to continue considering what as the world watches us what we what were what we need to do city leadership has shown that planning and visionary planning can yield results that are transferable for for our community we're also planning a plan that's that's a that's visionary and we look to create something that that will be taken into the into the future and is a framework year to year for both short term and long term so just a brief recap on on our comp where we're at here in our accomplishments we're anticipating continued socio-economic and demographic changes and we're anticipating another quarter million people living in the city of Las Vegas and another million people in our region however as we build off of our previous efforts in the in the city we hope to maintain momentum by developing a clear vision for the future of Las Vegas that provides direction for future development complete with recommendations that are implementation oriented yet adaptable to changing conditions over time we also hope to continue public involvement and build community consensus as we transition into plan writing and development and the long-range planning division so right now we're at the midpoint of this planning effort and we're exploring options based on the input that we've received during the visioning and understanding portions and so far it's the date planning has been out and active in the community we've been to over 43 of 50 scheduled community events and we've received input from more than 2,000 members of the public through various questionnaires and surveys we're also soon to receive some results on a statistically significant survey that's been conducted through Applied analysis will continue to be doing that through June and we'll have public open houses and workshops in the middle of next month at City community centers and with the Smith group consulting team and what we've and this is just shows that we've we've been really out across across the city we have a Citizens Advisory Committee we've done a lot of interviews with with our fellow agencies and we've gone to a lot of public events we've really made a concerted effort to go to people and go to stakeholder organizations and what we've heard so far are shouldn't come as a surprise there's been a lot of concern about the state of education in general whether its public schools or you know education and funding there's been continued concern about public safety and crime from all parts of the all parts of the city homelessness continues to be one of the themes that we hear quite a bit about open space preservation and parks and accessibility to those spaces and of course water and drought being able to sustain another quarter million or million people in the metro area that is something that Southern Nevada Water Authority and the city don't do both share a concern on there are a lot more that we've heard back on a lot of other issues including transportation land use oriented concerns but these have been the ones that have resounded the most over the past over the past couple of months these fits really well into into the the general themes of the plan that Smith group is proposing that you that you consider land use and environmental infrastructure economy and education as we transform these challenges into new opportunities and are guided by principles that they apply to these these core themes and we think that this is the the proper framework for the and make up the of the plan so tonight we'd like to get your general support for these guiding principles that you see on the left of the screen and for this vision statement and we'll continue to wordsmith it with SmithGroup but your thoughts on these tonight will certainly help frame the direction for the plan so in general these help these will help us measure success across each of the themes and help whay recommendations foster community driven implementation then help improve overall quality of life so as far as an equitable las vegas las vegas is an equitable city for all with access to jobs services education resources no matter where people live Las Vegas is a sustainable adaptable flexible city that manages water well has new transportation solutions to support higher densities and set and sound planning for extreme events such as flash flooding extreme heat and drought Las Vegas is a healthy city beyond just clean air and clean water the city is a place to sustain families appeals to senses nurture spirits and as the opportunity to access parks and open space through walkable neighborhoods it's a livable city with that's unique complete enjoyable distinct Vegas style that we've had for the past 100 plus years the city will ensure that we have places to gather and things to do and ensures a high quality of life and finally we attract the best and the brightest planning will ensure the ability to retain our existing residents and make sure that people that that are looking to move to Las Vegas have [Music] opportunities for jobs in education and we need a plan that printer that promotes and supports that so our next steps for the plan overall will continue outreach this month and into June we should soon have our survey comments back from the statistically significant survey and we will share the results of the questionnaires that we've done as well as some follow-up questions that we that we're going to be posing to the public and we should have draft concept by the end of the summer we anticipate having the master plan in front of this body and the City Council in early 2020 and will continue to keep you apprised of updates along the way so with that I'm happy to take any questions that you might have and receive any feedback on the vision statements in the guiding principles thank you very much that was a very nice presentation Commissioner schlattman yes mr. chairman threw you a question for step so when the new master plan comes about the the draft master plan is the draft gonna come to us at the end of the summer or will you'll bring the more completed plan to plan the Commission before it goes the City Council so at the end of the summer we'll have some general concepts on each of those three themes and how those guiding principle is all lined with with them we might have a land-use concept so you know a general framework for goals that apply to the economy and education some things to consider we'll have a more completed version of that of the entire plan towards the end of this year beginning of next year we put a draft out on our website master plan Vegas for public consideration as well and then we would do this the statutory process for adopting a new master plan through the Planning Commission at that time and then and then adoption by City Council a little bit later on in early 2020 okay looking forward to seeing it thank you Thank You mr. chairman will this master plan have a breakout of region ward because I remember sitting to the meeting and it was asked and wants and what we need and what we know we can use in each Ward was has a different vision I'm sure so when you put this together is it gonna be actually broke out in Ward's just like me so you could tell me what is proposed to happen in Ward six to 2050 just kind of like we discussed when we had the little meeting a through Jer to you yes we do intend to take a look at perhaps not necessarily a word by word approach but maybe even splitting up different parts of the city district by district that's that's a concept that we've been talking about with the Smith group team so there might be specific parts of town where we have a have a greater focus such as town center and warrant six those those are already established those are those are land uses that you know that are more or less more or less developed but there might be areas where there's opportunities for for us to take another look at you know either in either in suburban areas like courts six four and two or the or opportunities for infill along corridors and more it's one three and five in which we would look a little bit more at a compact look at at a geography Commission of Tucson who grew up here in las vegas when we really didn't have a plan this is so exciting to me i'm really looking forward to seeing what happens next and to me this is just fabulous it really is I mean it just it's just wonderful to see the city going in this positive direction and thank you very much for all the hard work you put into it Thank You Commissioner Tucson and I will jump in and say you know being downtown now for 15 years and living down here and seeing the changes that we've had and you know you have the Smith Center and the the brain Institute and the Arts District and things that have happened on Fremont and I hope in the master plan there's there's really a good focus on how to connect and keep connected downtown to the rest of the valley through yeah through trails through everything through bus systems that are more efficient and light rail on wheels maybe but I hope it's really a focus and you know I know my friends now when they're bored in the suburbs they talk about coming to downtown so it's really something that's before people just wouldn't come to downtown they wouldn't even consider it and so I hope it's something that we keep as a focus in the master plan and expand out and have good connectivity to all the other wards one question I had on the forum based code and I was talking to director summer field is it's focused downtown right now and it's it's starting in downtown but is there a thought that that could spread out through the rest of the valley and be talked about in the master plan or their transects that work on major arterials that form-based is better as opposed to what's happening now and maybe that's not a discussion now but a comment to think about as we kind of move through the process as well yes mr. chair so that that certainly could be a consideration this is this is a master plan that we envision to have that addresses the the requirements of Nevada Revised Statutes 278 so you know zoning is definitely the the basis off of the off of the general plan we would we would certainly talk to SmithGroup our consultant team about how zoning plays into into that relationship there's certainly some concepts that dovetail with with that of course but any actions would would have to of course come through the Planning Commission great thank you for the presentation very thorough thank you mr. chairman if I might I just want to make sure that we draw the extra attention to for the audience just that master plan Vegas that'll be a great Avenue for the community to continue to interact with this process as we go through we'll have drafts of the documents as we're working on them for people to be able to comment so just before we get off this item want to just draw extra attention to that address that's great thank you Carrie yes yes I'd like to comment also on on this master plan I I am very concerned about the master plan I'm very happy but I also want to know and I'm sure this will develop over time how it's going to affect Ward 5 particularly the West Las Vegas area because often we get left out of the master plan I think at my house I have probably six redos of the master plan and so this I hope that's going to be something that we can all be proud of and I'm sure councilmen career will address that with you thank you yeah through the charity you Commissioner yes we would we would certainly take a look at the entire city inclusive of Ward 5 the guiding principles that that I talked about you know they I think they really do speak to the entire city and we want to make sure that we have an equitable healthy innovative resilient city for all residents no matter where they live and that's something that our consultant team and the long-range planning division planning department in as a whole they certainly espouse and they would they'll definitely make sure that we take a look at that for you and for a councilman career thank you thank you again appreciate it very much okay moving on to items 27 through 30 I'm Restatement of the parks agreement as included within the Fifth Amendment and Restatement of the sky canyon develop an agreement toward 6 staff recommends approval item number 29 dir 7 6 - 9 0 applicant Greystone Nevada LLC owner eastland LLC at all for possible action and request for regarding the First Amendment and Restatement of the Sun stone development agreement on approximately 628 acres at the southwest corner of North Skye Canyon Drive Park Drive in moccasin Road Ward 6 staff recommends approval and related item dir seven six two nine one for posish and request regarding the first amendment Restatement of the sun sun parks agreement ward six staff recommends approval can we get the staff report please Thank You mr. chairman deputy planning director Peter Lowenstein for the record in October of 2018 staff presented the Planning Commission the to development agreements that split the existing sky canyon master development plan into two portions those development agreements were subsequently entered into by the approval of City Council what is before you tonight is the proposed amendment and Restatement of each of the two development agreements before I go into some detail these agreements are the culmination numerous work hours on both sides of the negotiation table and I would like to extend my thanks to all parties involved in those efforts the following major changes have occurred in each of the respective development agreements each of the agreements now includes a two hundred and fifty thousand dollar contribution to the future regional park to be located on approximately one hundred and sixty acres at the northeast corner of North guide Canyon Park Drive in log cabin way each agreement includes new language pertaining to the processing of future modifications requiring land use designation changes to be come before both the Planning Commission and City Council each agreement includes updated exhibits including they're phasing plans land-use plans and conceptual park plans major changes to Sky Canyon development agreement include the fire station is no longer being tied to development trigger and will be constructed within 42 months of the effective date of this agreement furthermore the community will now have an elementary and middle school as part of the community versus that of an elementary in high school due in part to the high school being planned as part of the future Regional Park campus major changes the sunstone development agreement include the adoption of two new development standards for the aged qualified portion of the community as well as on the rest of the community it also in calls includes the incorporation of an amenitized trail system always being called an avid trail system there by linking parks streetscapes and subdivisions throughout the community in addition to those changes staff has an additional modification that is needed to be entered into into the record at this time specifically the inclusion of an exhibit T to the sky canyon development agreement as well as amending section 3.1 three of the sky canyon development agreement to read as follows common area landscaping all common area landscaping abutting village street shall be designed and constructed in accordance with the sky canyon design guidelines sidewalks landscaping and other Ordinances within the common areas abutting village streets shall be maintained by the master HOA master developer and its successor and assigns including the master HOA is hereby granted a perpetual license to plan install operate maintain and replace landscaping irrigation community signing and related appurtenances in the city right away parentheses collectively comma the encroachments and parentheses the encroachment shall be shown on all site improvement plans or other drawings submitted by the master developer to the city for approval the encroachment shall conform to the terms and conditions contained an exhibit t any existing quote room agreements entered into between the parties prior to the effective date of this agreement are hereby terminated and the encroachments contemplated there under are hereby authorized under the terms of this agreement the parties agree that such rights right of encroachment is for the mutual benefit of the city master developer and the master HOA and sub h way the master developer shall have the right to assign such encroachment rights the master HOA and sub HOA and shall obtain approval in writing for the city prior to the transfer of encroachment obligation with the before-mentioned exhibit addition and staff exhibit as well as amendment to section 3.13 staff is recommending approval of both the sky canyon development agreement and parks planned communities with me tonight is Chris Armstrong who's part of the Olympia group and the master developer for Sky Canyon also Dave canoers here with Lennar Homes who is the master developer for Sunstone the new community on the east side of the 95 we very much appreciate staffs efforts we've met with them weekly for many many months leader is Peter Lowenstein of those meetings we appreciate all the hard work Peter has given us as well as Fred Solis from the planning department also Dave Klein and Lucien who are here this evening they have spent hours and hours of time working with us on these agreements as well as Victor and Bart and I'm sure I'm missing some people but there's other folks that were in those meetings your staff is tremendous and we appreciate all the hard work and time that they've put into these agreements these are exciting agreements and future housing for the city of Las Vegas we've got 5200 units in Sky Canyon and 3800 units and Sun stones so this is a lot of housing and really exciting projects I think Peter pretty much covered it so I'm not gonna go into much more than that unless you have questions but we would very much appreciate your approval this see one farther deeper into a neighborhood that's been working to get sidewalks and crosswalks and as a school and on the back side of it and so there was just some concern there and I think rather than us hearing it tonight I'd ask if if you consider that we obey it until your owners are back and maybe we could meet with some of the people that brought up the concerns and there might not be any issue at all but just so they can understand what's going on before this Commission here is something that is asking for a rezoning to a more intense use yes I think that would be acceptable to us we just would need some details as to yeah and we're absolutely and it's something I will reach out to Commissioner Quinn to see if it's something when I know she's been traveling and if it's something if she's back can help facilitate if not I will help facilitate myself just so it's a conversation that keeps moving forward and not spinning and I believe asking the City Attorney for we asked for it has to come back within 30 days and correct chairman correct okay are your owners gonna be back within 30 days yes they'll be back in about five days okay so I have no problem us asking for it's just Ridge Drive war 2 staff recommends denial we get staff court please mr. chairman the Summerlin non-residential design review committee has acknowledged and supports this deviation as the sign will be in support of an existing Clark County operated elementary school however Summerlin development standards specifically prohibit animated signs and staff finds this deviation could potentially have a negative impact on surrounding residential development staff therefore recommends denial the application please note that there are additional letters of protest since publication thank you thank you drop off on an existing planter wall and retaining wall and if I can we go here's what the sign looks like this is a photo sim of it and this is the sign itself the sign is two parts it's a noun school it has a school logo in the school name and then also an LED portion its proposed to be ten by six it has been approved as staff mentioned by the summerlin non-residential development design review committee and one of the things that I'd like to point out is that they put some conditions on it one of them is that it'd be 10 painted tan to match the wall it also has two it can only be on an hour before in an hour after school Monday through Friday those are conditions that the city has also placed on us the city put a condition that says we have to follow some early conditions and virtually parallel to Antelope Ridge it's directly across the street from the school which is the address is in the subdivision of Savona and Summerland we're very well aware in purchasing the home three years ago that there was to be in an elementary school built there however we were totally unaware that the school was going to be a first of its kind be two storeys in addition to the two storeys it was built up on land that was brought in to two level an uneven surface apparently so now the school has the appearance of being three hippy levels high now we are directly across the street from that and we see the third level of school continually it isn't while I hate to use the term eyesore for an elementary school it is an eyesore to us where we didn't expect to see any school we appreciate their being an elementary school in the area I think it's a good thing but the height has made it very difficult to sell properties on that side we have had people looking at our home to buy and they have objected to seeing the school behind us neighbors on both side have tried to sell their house and we have heard from our neighbors that they get the same objection I have actually put in two very tall trees at the cost of $3,000 to try to block that view and hopefully that will help me an animated sign which as you know is in violation of the Summerlin development standards of September 15 2004 would exacerbate this problem and I strongly object to the approval of this request thank you sir thank you for your comments mr. already sits up probably 10 feet of fill before you even got your first level so when that signs adhere to that wall is that considered really at a second-story level or a third storey level where the in yellow you can see in the two so that's the school building right there so approximately about it'll be lower and a feet above you gotta be above it'll be higher than that then then the grade across the street but it will be substantially lower than the school now how is that fall in relation to the wall on the other side of the street from the houses there is that same elevation approximately or is that sign gonna be in view the wall of the people across the street I don't know exactly from their backyard but the way that that part of Summerlin is pretty much like this so everything that you build is higher there's a lot of stepping so it will be it will be higher on anything that was built on that side of the street was gonna be higher than the other side antelopes concerned citizens in and around Bonanza village and if you all just direct your attention to the monitor Virginia City Avenue this is a existing ranch estate it's been there very long time they've helped raise a lot of children and this school their big issue back here is access off of Virginia City they would like to see that go away everyone parks in their driveways and their grass and they've done things over there to mitigate or fortify their front yards which I really commend them for but I think what we need to do is we flip the school over and hugged Tonopah and you see that in the design there to existing buildings that are gonna remain is the admin and a classroom wing and if you notice they're pretty close to the front or a crowded trout Tonopah a few will and what we've done is set our multi-purpose room which is the kitchen as well off a total buffer axis which would also allow the delivery trucks not to come into the ranch estate they would come off at a major street section and access for deliveries that was a big bone of contention for the neighbors so if you look at the site at seven acres usually we stand before your work trying to get in fifteen or twenty acres so this has been a pretty tough one to make work and so that that's where most the variances are coming from the one variant said I would point specifically speak to you tonight is the height the height request is for just for the stair tower and just for a small portion they encloses some AC units so that one and if I can redesign this I'm going to redesign it so we don't have to stand in front of me to ask for this again so we'll work on that but on that that's what these two locations are and if you would indulge me for one more minute in the conditions should you wish to approve us I would like to point out in the conditions item ten public works and ask that these part of this be stricken under item ten construct construct all the half a street improvements on Tonopah Drive and Virginia Avenue to city standards and this is just just the same thing that we were before you last month for was an elementary school any of these schools that we back up again source it in ranch estates where their streets are set for a earlier time for horses you know this is the same issue that we had at Wasden and I find it ironic that were up here argument on behalf of this but it's it's important to the neighbors and I'm I'm defending that this if you look along Virginia that is in the ranch estate so right now that has does not that whole development does not have take this back in front of that that group again will get will be here for a long time arguing about these half street improvements secondly that on Tonopah we do agree with staff on about two-thirds of that improvement but we do ask that the section immediately in front of the existing facility and the existing parking lot down to just before the new commercial approachable proposing would remain in effect and not have to be brought up to city standards it's almost there but it's if we get rid of that or go back to city standards we're gonna kill the whole parking lot again and one of the driving ideas behind this whole site configuration is giving 132 parking stalls on site where 129 are required right now they're grossly under part in all of the parents park for pickup out on in Tonopah so I think in in favor of making the condition better keeping this existing curb line along the front here on Tonopah would be in the public's best interest and with that I will answer any first building which would be the MP room the new MP bit and is that is there so it's just open at that point on that side there's no fencing there's no no no it'll be secured just like a any Clark County School District facility in fact if you if I can clean German to the monitors you can write on your this is the central plant that makes a part of this security then we have a new chain-link fence proposed down and securing the playground and the field so it's just like any school you know security works like an onion we got we've got a perimeter then we got a courtyard security within it I just you know we saw an applicant with the sign before you and I see these beautiful bricks and nice detail coming through and then we see the picture of the existing playground with the chain-link fence that's going kind of sideways and that's why I bring it up I hope it's cleaned up into a much better standard than it was previously oh yeah that that chain-link fence was erected in 1963 number students that need to be housed there I can see you having two stories or increasing the heights because there are two stories across the street there their apartments two storey apartments yes on both sides the West in the East my sister lives directly next to the school on Virginia City and her concern was only that the park the buses didn't come in and park and that if there was two stories that the kids wouldn't be looking into her yard and I said I would definitely express that on her behalf but none of the neighbors have indicated that they don't want this to happen I think it's gonna be great for the community it's gonna be great for the kids and for the parents who have to look for a place to park I I just hope you the school district in in the planning department can heard from the staff the proposed site is suitable as a marijuana dispensary it meets or exceeds all the requirements of the city code in that regard specifically the site exceeds the separation requirement that the code requires it's zoned c2 currently which allows this use if a special use permit is issued it's an area that's already been highly developed with intense commercial uses and therefore it has the infrastructure the that would serve any new customers that are brought to the earth by this use we don't seek any variances or waivers of any kind the site because of these reasons doesn't have a negative impact on neighboring property properties and we would argue that the site is compatible with existing uses the site is not within the buffer area that the city created to protect Fremont Street it's outside of it in addition you should know that the applicant has the expertise to operate in a way that will make the city proud their record as operators is unimpeachable they have as many licenses to operate a dispenser it have been issued as many licenses and have operated as many dispensaries as any other operator in the state of Nevada they had a dispensary in the city on Western they have two that are operating in Clark County another in the city of Reno they have a proven record and they use best practices to ensure the safety of their sunset Road Las Vegas Nevada and I'm here today representing the Fremont Street Experience LLC let me just give you a little background of the Fremont Street Experience LLC and its participants I it seems like yesterday to me because I'm older but in 1992 the city of Las Vegas was looking for a vehicle in which to revitalize downtown and they asked various casino companies that were on Fremont Street what they could do to to bring some kind of excitement and entertainment to that area and after a lot of studies were had they came up with the idea of creating this canopy in this light foot celestial light vault is what they call it and essentially they vacated the street on the strength of that and each of the casino companies contributed a substantial sum of money millions of dollars in order to create this attraction and no one behold 27 years later the attraction is working because out of the 42 million people that visit Las Vegas each year half of them literally 22 million or so come downtown and of those people who come downtown a large percentage of them come specifically to see the Fremont Street Experience the Fremont Street experience isn't just for gamblers and people over 21 they have a lot of special events there that bring miners and family members especially in some of the major attractions like you have for New Year's Eve I really have a high regard in deference to staff on most cases and I apologize for even saying this but I was somewhat perplexed when I saw a conclusory recommendation here that the use achieved the vision of the Resort and Casino district that seeks to reinforce the district's identity as the act as the activity and entertainment anchor for downtown Las Vegas and on that basis that the staff would support approval of the action item the members of the Fremont Street Experience have asked me to submit letters in opposition and I'm talking about the companies that are responsible for what is going on what is about to happen now which would be the the refurbishment of the celestial vault that many many millions of dollars are going to create LED the concepts that's going to increase the excitement and the vibrancy and the brilliance of the of the canopy and also from casino owners who have put a lot of money into their properties and I'm speaking specifically about Derek Stevens and what he plans to do with the Circa property downtown they are doing this on the strength of the continuation of the neutrality that the Fremont Street Experience has you know when the marijuana laws were passed not everybody supported them even though the the laws passed and we want to make sure that we're not offending anyone at the same time that were actually servicing their entertainment needs so I have the letters from the various casino owners and I'm talking about the Golden Nugget the the Fremont Hotel all the Boyd properties Derrick Stevens they're all there the Horseshoe the Four Queens they're all there in opposition and they state pretty clearly that not only do they object to this item coming forward today but back in 2014 they also submitted letters in opposition to a medical marijuana facility which is what well they had that was to be located in in the 200 block north of 3rd Street and the council ultimately rejected that application and in I'm gonna present the letters that were submitted back in 2014 as well so there is a there is really a circumstance where this property is the the the stream on street experience is something's very special and it was it's it's a circumstance that has ideas and concepts and marketing needs that should have great deference in terms of what the the city allows for this location the the nearest dispensary is overing the Paiute Tribe dispensary on Main Street just past Washington which is quite a distance away from the Fremont Street Experience so I look at this as a two-pronged opposition one would be the common sense of giving deference to the Fremont Street Experience and what it sees for its purposes and the money that it has spent versus the also the human nature aspect of what you find in terms of dispensary operations now dispensaries there there's a reason why dispensaries should be on a hundred foot wide right-of-way streets and have internal parking because that means that the the the the persons who frequent those locations are got a byproduct and then they're supposed to take it back to their private residences to consume and this location although staff is indicated it complies with the requirements of the code because it's downtown merely because it's in the c2 or in a downtown area doesn't mean that it meets all of the the other issues that are attendant to a marijuana dispensary operation for example this location with 4400 square feet should have 26 on-site parking spaces so that the people can drive their vehicles up and take the product and take them way the common sense would tell you that it doesn't belong in the area but human nature would also tell you that anyone who purchases a product at this location is going to consume it somewhere that's a Fremont Street Experience where there's light where there's music etc and that's just human nature so what I'm saying to you here today is that even though this special use permit may be appropriate in other circumstances strict adherence to the requirements of the marijuana laws which require the location to be on a larger Street which require the location to have on-site parking I think should be given weight and attention to this group here to the to this Commission now finally I just want to say that the City Council dealt with a an ordinance recently having to do with the consumption lounges I mean that was a major issue that had come before the council and so what did the council say about the location of these consumption lounges well they said that consumption lounges must be at least a thousand feet from any non-restricted gaming property and so what would you say about this location someone is going to go down to downtown to go to this dispensary to buy product and then have to go a thousand feet away a quarter mile away to a consumption lounge to use the product and then what go back to their hotel or do their residence no assuming that that is an important factor and I believe the council felt it was then a dispensary has no business being located on the doorstep to these casinos now I want to also mention that my practice is essentially gaming law and from a gaming perspective marijuana and casinos don't mix in fact there's been a number of studies and governor conferences and policy Commission's that talked about these two types of businesses not intersecting in one way or the other the Fremont Street Experience is the lobby it's the foyer as the word were used in the in the design template for those casinos and that means that if anyone is using drugs creating pungent odors or even overdosing or what-have-you with respect to the product then the casinos now have some responsibility and liability relative to this they're all they're the owners of the Fremont Street Experience LLC so it's a policing action that I think is also a problem so again with all due respect to the applicant here and I'm sure they run a very fine dispensary they just don't belong on the on the doorstep to the Fremont Street Experience and we would seek your denial of that use permit thank you Jeff appreciate that anybody else wish to be heard on item number 22 please state name for the record thank Boulevard Las Vegas Nevada 89 106 with respect to the dispensary I'd like to say that from a public safety perspective we are now my officers who work in downtown who work under the Fremont Street Experience are already receiving a number of complaints every single night the pungent smell the people that are smoking marijuana and as you can imagine usually on the weekends there's thousands of people under the Fremont Street Experience throwing officers I have to sift through the crowd and find these people detained them impound the evidence it's a great burden to us on the police department knowing that of course the evidence needs to be impound to take it to the lab tested and prepared for court that being said you can only imagine that if this dispensary is approved would only magnify the problem make it even worse for the officers and make it worse for the tourists which we're seeing every day more and more families coming down there which is what I think we want Commissioner Williams you mentioned earlier that we should be doing something in the city that makes us proud I don't think that this is one of those things that we should be approving we need to be looking out for the safety of the people that work there as employees people who are working there's police officers and the citizens and of course the tourists that come down Fremont Street this is a magnificent part of our city I think we are responsible for making sure that we put it in the right types of businesses and I don't believe that this is it so I would be in opposition of this Las Vegas metropolitan Police Department is in opposition and prepared to taking questions if you'd like otherwise thank you for your time thank you captain or anybody else wish to be heard on item number have concerns over this special use permit given its location at Fremont Street experiences doorstep and it's very close proximity to gaming resorts on Fremont Street as mr. silver noted marijuana businesses are not compatible with gaming establishments as you may be aware there is a long-standing directive from the game Nevada Gaming Commission and the Gaming Control Board that the gaming industry and the marijuana industry do not meet gaming regulators base this mandate on federal law as the Justice Department continues to list marijuana as a schedule one a legal drug under the controlled substance substance act conflicts between state and local laws and federal laws present unique challenges for gaming licenses and Gaming regulators have been very clear about keeping the two industries separate as long as there are conflicts Nevada's Gaming regulators did not come to the just come to this to say lightly and did so to protect the reputation and integrity of Nevada's largest industry given the regulator's decision the gaming industry is bound to follow federal law or risk disciplinary action from fines to loss of license staying in compliance is paramount for the resort industry particularly given the significant investments the industry is making on Fremont Street right now we believe the special use permit is not compatible with the existing and future surrounding land uses excuse me and we ask that you continue to keep the two industries separated thank you thank you mr. vice chair members of the Commission my name is Erin McMullen here today on behalf of Boyd Gaming Corporation six 465 South rainbow Las Vegas Nevada and I just want to echo many of the comments that have been made by my colleagues and just highlight that we did submit letters for the record on behalf of our three properties downtown the Main Street Station the California and the Fremont and I just want to reiterate that something that mr. silver brought up about the line that was in the staff report that was slightly concerning to us as well about sort of the anchor of downtown and the tourism gaming and Resort district there and highlight that the City Council did recognize that there needs to be some separation between gaming and marijuana and the governor and the legislature I think is following that lead as there was a bill introduced today from the cannabis compliance board Advisory Council that also proposes a 1500 foot separation from marijuana consumption lounges and non-restricted licensees so that obviously is very important to us and we oppose this for all of the reasons that are stated we think it threatens the downtown environment and the tourism and everything that we have going on there a number of our FSC partners are obviously investing a lot downtown to continue its growth and that includes us as you well know and so we just don't think this is a the appropriate time or use for this show use permit so thank you thank you anybody this is you wanna anybody else wish to be heard from the public all right seeing none can I have the applicant please come back up state your name for the record give you a rebuttal Thank You mr. vice chair if I can respond briefly first of all I'll say that we have tremendous respect for the people you heard from for what the Fremont Street Experience has done for our city what these fine operators have done for our economy but I think it's unfair to put the burden to [Music] protect our gaming industry on a single operator that is just requesting to conduct a business that is legal in the city in conformance in complete conformance with your code I also want to say that mr. silver made some comments about parking as I said and as your staff recognized we're not seeking any parking waivers this complies fully with your code in that regard it was said that a dispensary has no business being near a casino we as I said respect the gaming industry but I think you need you need to recognize that in adopting the code that regulates this legal industry the City Council considered this concern and they created a buffer to protect Fremont Street and those that operated operate in that area and this location is outside that buffer so the a code that was adopted to protect this interest we agree with it and are in full compliance the captain from Metro captain you know we to represent respect the job the metro doesn't mean oh it's difficult it is illegal for anyone to consume the product that my client seeks to sell excuse me in this location outside in any public area and while we respect metros concerns it would be unfair I think to put the burden of enforcement on a single operator and to suggest our dozens of dispensaries that are open in this town and to suggest that one additional dispensary will unfairly burden that interest I think is unfair it was suggested that their policies to prevent consumption lounges from being within 1500 feet of the casino that's true this is not a consumption lounge and this applicant does not intend to put a consumption lounge in this location and finally I think this entire discussion if this is not an appropriate location for a dispensary a location that's as I've said several times it fully complies with your code if this is not an appropriate location it begs the question where the opponents of this application would consider an appropriate location to be in the city and I think from my clients perspective all they could do is look at your code to determine what your policies are and and follow an application that fully complies and is outside the buffer area that was adopted to protect the industry so again we're happy to answer any of your questions but we request that you follow your staffs recommendation and can consider this application favorably thank you and thank you at this time I will turn it over to the commissioners Commissioner yes mr. chairman through you I've gone back and forth on this one several times of traditionally support it in most applications to come before us if they met all the city requirements with the exception of some in the past it didn't have the required parking or so on and so forth which we won't get into those items however there is a I mean there is a role that no dispensary can be located within 1,000 feet up in school 300 feet of any of the following uses City Park Church house of worship individual care facility community community recreational facility or in use whose primary functions provide recreational opportunities of minors so there are areas where this where dispensaries should be located in areas where they're not where they shouldn't be located do I have all the correct answers no but I think when we look at a lot of the locations on the outside in town or on industrial or wherever we we have to look at each one of these on a case-by-case basis this one being right one block off or on that same block as as Fremont in a question for staff one talking is how far away from Fremont just a dispensary have to be or it just can't have a preeminent address or can it be located on Fremont because I think at one point this was none could be located on Fremont however that ordinance might have might have changed at some point three vice-chair yeah so it shall not be located at any property which abuts Fremont Street west of 8th Street that is the only okay anyways we have to look at the the use of how it's going to have a greater impact on the neighborhood or the Fremont Street Experience and what's generally within that area I noticed when I went to Seattle Washington a few years ago with the Planning Department and and they passed recreational cannabis use before Las Vegas did and it seemed like on every corner there was somebody smoking cannabis product and it actually become kind of annoying after after about three or four days of being at the the conference and I smell it going up and down Las Vegas Boulevard and I felt smelled on Fremont it's already there so to say that all the issues is going to come from one dispensary we all know that people go to dispensaries they bring it back to the hotels and when they're coming here to visit however I think just when you give them that much or you give them that a dispensary that is some close proximity to Fremont Street Experience it it just allows access or people to have greater access and they ordinarily would if it was further away where they're drinking intoxicated and then night they might not decide to go up to Main Street or down Las Vegas Boulevard her and to industrial but if it's just a few few steps away they might be more encouraged then the day I'm a little bit concerned about the and I won't I won't talk about this topic too much because we're not voting on this tonight but it kind of goes into what I'm the point that I'm making here tonight is the consumption lungis I'm concerned about what what that's gonna gonna do to Fremont and so I have a lot of concerns once we get consumption lodges and dispensaries that are located adjacent to Fremont it's kind of hard to reverse that so I think we need a when we're approving these items close to Fremont we won't even think about it and make sure that whatever we're approving does fit with what the people at Fremont Street Experience are looking for Thank You commissioner anybody else wish New York three years mr. vice chair boy I tell ya after you lost some sleep over this if this were a consumption lounge I wouldn't have a problem with it but I believe that yes you do fit within the parameters and that's why staff has a you know recommended approval but the problem is people are going to go into here and they are going to get marijuana and they are going to they have to smoke it somewhere and they're just gonna walk outside and smoke and I know if I'm not on Fremont Street Experience and I've got my grandkids it's really uncomfortable smelling that smell constantly it really it really is and as mr. silver said I don't personally I don't have a problem that being close to a to a casino because I don't think that there are and would you call it a yes yes that what he just said so I don't have a problem with that I don't think that I think the casinos are very well can take care of themselves I've worked at casinos for a very very long time and I don't think they have a problem I do have a problem with people leaving and listening to what the caption now has said when people are purchasing this and then there were they gonna go they have to smoke it somewhere we have allowed people to purchase marijuana what in the hell they do after that where do they go they go on Fremont Street and like I said you know one night we might pick my grandkids downtown and show them that the Fremont Street Experience I don't like smelling marijuana gives me headache so I don't know what I'm gonna do yet I I can tell you that I am just completely I could probably argue either side of this issue but I would like to hear from Commissioner Williams you want to hear from me okay very good you know I think we're talking about consumption when that's not the issue the issue it's whether or not we should grant this variance is it a variance and I'm voting on special use permit and there is no distance separation requirement as it relates to dispensaries so that has nothing to do with the consumption issue so let's not get it all confused and I think it would be an assumption to say that somebody's gonna smoke it there just because they purchased it there where then are the people who are smoking at on Fremont Street obtaining it it's not fair and when we talk about Fremont Street I don't take my grandkids there anymore because what they see not what they smell okay and so I am not opposed to this item I think we need to give the gentleman an opportunity to do business as we would anyone else and because he meets the requirements of the law I see no reason for us to do otherwise and if you would like would you go right here thank you defer back to you I just have I got a little heartburn over that you know like I just remember the package like a situation we're the city allowed it they thought it'd be a good thing they were gonna limit the licen if I'm wrong staff let me know they were gonna limited amount of licenses for package liquor and it got out of control and it wound up being a problem a major problem to the point where it took a long time to kind of reel that back in again and I'm afraid this is like Pandora's box yes they're within the law that's been written I get it but I treat special use permits as a common-sense thing and that's exactly what they are especially used from it to me it's no different in a short-term rental they either have a fit or they don't and I just me person I'm looking at this map I want to say just looks like maybe 300 feet away 340 feet if I'm guessing right off this aerial shot of the front entrance as it was eloquently stated that that's my rub and you know for Metro to have a concern that's that's another big rub for me I mean these guys are out there on the front lines every day trying to protect the interests of the revenue source of this state it's that strip that supports basically everything we do and we got to take I believe we got to take their consideration into account I mean it's it's hard for me I just remember what the package liquor did and now we have a situation where we can put this out there and and we're gonna have greater access is it going to deter it stop people from you know getting their hands on and going down there and smoking it no but I do believe that it would definitely enhance the situation now my personal belief is is really not your problem but I do have to take into consideration it is especially use permit and it's gonna have it's gonna have effects down there and then I guess my other question would be and it might be for Council at this point in time is there any way shape or form that that location even though the owner stated that he'd never desires to do it but is there any way shape or form because the application was in Prior the the law that was just passed do they have an opportunity to turn into a consumption lounge at any point in time mister mister vice sure they do not the the the consumption lounge ordinance that the Council passed specifically requires you to have been license or to have had an approved special use permit as of the date that ordinance was passed okay so you know no dispensary that's approved here on forward will be eligible at least not for that first year of the the kind of the pilot program I think is how councilman Fury's described it that first proving year for just the dispensaries that are currently approved ok currently I mean as of the date they prove that ordinance thank you and then whether question for staff is how did they get around the parking is because the knee innopolis parking garage is right across the street and there's a revenue stream for the city there I'm just trying to put this all together vice-chair in that particular part Las Vegas we do not automatically apply parking standards so well we have kind of guidelines based another place in town there's really no standard parking requirement in downtown is it excuse me is it just for that particular street because I know there's other businesses that's come before us with they've had to have a parking variance within blocks away from that mr. vice chair if I'm right so anywhere in the downtown master plan area what we call area one is what used to be the old Centennial plan and under the old Centennial plan we do not automatically apply the parking standards we take on a case-by-case basis based on what the applicant is able to provide on-site and any additional amenities again given that it's in an urban area so this location because they do have immediate access to public parking facilities well let me be very clear it's not because there's a revenue stream for the city there but they do have public parking amenities within that area this business or any other business that would request the the requested parking would be recommend for approval for that parking because there are ample opportunities for parking in the vicinity of this retail location thank you for that clarification and just for clarity so I know there's no distance separations from dispensary to dispensary but at this point in time is you're saying there's zero distance separation form a non-restrictive gaming license mr. Vyse yes so there is no distance separation to gaming under any state or local jurisdiction requirements we do have as was pointed out by the applicant we do have the carve out for the Fremont Street west of 8 where we do not allow anything that abuts Fremont Street to make application for a marijuana use but that is the only limitation and that's not based on gaming that's based on the fact that it's the pedestrian mall and the tourist area there so but that's not a gaming specific restriction that's just because of the nature of Fremont Street in that area I really AM common sense just tells me it's just not the right fit for the location just because of the intensity that it's gonna bring under that canopy that they're spending you know millions of dollars as we speak I think they just literally broke ground the other day to revitalize that and I just I'd hate to be the contributing factor guy of that you know that's just it's my I don't know what you want to call it but karma maybe I don't know I just think it's bad juju man so I'm just gonna leave it right there and see what these commissioners Thank You vice chair I'm ready to make a motion please do okay I want to say first primarily on sports and neuromuscular massage therapy I have also been an educator for two local massage schools spent four years doing that the last 16 years I have worked alongside a chiropractor and in that experience I have primarily worked with professional - novice athletes of all ages children through adults including four-time mr. Sheree Sanders chiropractor she did note that she is in full support of the practice she is not against it in any way as a matter of fact in her email she also offered me a job she says if they didn't work out she wanted to offer from me to rent space she was very pleasant to speak with we looked forward to working with each other because we do offer complimentary care I also wanted to show you very quickly this is an updated schematic of the office as we've been very optimistic about it and looking to place furniture as you can see it is being designed as a medical office there are no showers there are there is nothing in there there's cabinetry the massage tables are the only thing missing here we didn't put those in because we were working with uh with new furniture there's an entrance check-in desk place for the client to change in the kitchen we've set up I know this looks just like a place for the therapists to sit and eat but it's actually going to be a desk for them to do their documentation as well as in the offices themselves where they will sit and assess the clients the other way where I am requesting is a zero foot distance from the doc Romero park where for injure feet I know is required here you can see the red the red marks our current proposed location the doc Romero Park I understand is located directly on the opposite side of the property wall however as you can see there is a huge detention basin which allows for unusable and unaccessible space for any of the public to to play to play in or be around so there is a significant distance between us and the actual playground so I'd like to just say that I am looking to basically start a medical massage establishment again I've done this for 22 years I would like to share the work that I have done with these therapists trained them you keep them encourage them to continue with the same work and I'd like to set the standard for what a medical massage practice should be any questions thank you very much this was noticed as a public hearing anyone from the public like to be heard see one person coming up if I could get your name and address for the record and you're for or against the application good evening chairperson and commissioners my name is Bianca Smith I am the compliance inspector for the Southern Nevada area of the Nevada State Board of massage we are located at 1621 East Flamingo Road Las Vegas eight nine one one nine I am here to support miss hammering and her application and her request for the public land use as the inspector I have visited and inspected her location where it is currently in addition to the other locations that are also within the six hundred feet and every location really in Southern have had in the five counties honestly I've been the inspector here for two years now actually this is my second year so we have about five hundred thirty I'm sorry five hundred eighty one locations in the five counties that I cover I've never had any issues with missus hammerings business or nicola chiropractic or any other chiropractic office the medical massage standard has been set so much so that the Nevada State Board of Massage Therapy has also initiated a new license type which is structural integration which is along the same lines of medical massage so historically her locations her staff her therapists have never had any issues with the massage therapy board we have not had any complaints or disciplinary action for mrs. hammering or any of her staff and we are in support given the history and the previous inspections that have been completed in the years past since the inception of the board thank you good thank you for coming anyone else have any comments we have three microphones if you could all come up we can get through the comments and get to the Commission I'll need your name and address please records good evening chairman and commissioners I'm dr. expanding I can tell you the 16 years I've never seen anything from her other than professionalism her patients love her her clients love her I absolutely it's a joy to refer clients to her and I can tell you there's a lot of physicians in town that do the same as I do and refer their clients to her for treatment so I certainly understand to the Commission's trepidation when it comes to a massage establishment I just wanted to come in here and say that in 16 years I would really as much as I could and try to impress upon you that that's not what this is this is a medical establishment this is medical massage and this is doing quite a bit of good for the citizens of Las Vegas thank you very much very nice of you to come out name and address please the record chairman and commissioners my currently referring patients to her she's one of the few therapists in town that does TMJ massage therapy which is an amazing amazing treatment for patients with TMJ who don't get any other relief she will be beneficial to the to my practice and she'll certainly be beneficial to the other practices in the building and I would like to point out that there are several chiropractic businesses in the same building which you this council has already approved them being together including the massage license that's already granted there they're within feet of each other and angels requests I think about two years now I've always known her to be an exceptional business woman and just a wonderful person overall I am an injury attorney I've had occasion to refer my clients to angel for assessment and treatment her ability to do that and the manner in which she documents those interactions is different in my experience with any other massage clinic in the valley when I talk about assessment what's already been said about you know what angel does has no spa element to it at all most massage services that you get in a spa environment there is no real medical assessment of value that's very different with angels practice hopefully you approve her application for variance will be a resource to a far larger percentage of my client base that currently is just too far to drive to her in with other people that don't do what she does because the word massage is in the title I am one of those people that had TMJ and I went to my dentist and if you've ever had that or maybe you have a friend or a family member that has you know you get this this grinding action you you give this locking in this popping of your jaw and you know the dentist did some you know diagnostics and they found all these micro fractures in my teeth and started running through all the things that I had was going to have to go through namely a $3,000 surgery until I saw Angela and when I went to see her after two sessions with a move and a procedure that I had never seen before she went and released these muscles like right in my jaw and it's gone is absolutely gone so if she can do that and broaden her practice and do that for more people I think that that would be tremendous tremendous asset to to our city so I just wanted to again say that I'm here to support angel and that's it thank you medical massage we we're similar to physical therapists we go in we do structural work we do rehab on your shoulder on your hip on your whatever you've broken or a fat replaced we do it and we help you have a better quality of life without these pain meds you guys know the climate we have clients that come in it's taken five six payments a day now they're down to maybe one or none Lauria it's not that I don't want to hear your comments say no but I do need to kind of get through quickly so we can get back to a vote so if there's anything more you want to add to the application-specific of why it should or shouldn't go there we love to hear that we've heard well because well the thing is the point I'm trying to make is that we're helping Las Vegas where it comes to these pain meds we're helping people get off of pain meds whereas you know the climate where they're prescribing I just I need to get to the boat if gentlemen if you wanted to come up and say you're for against please
