blocks before you begin your comments please state your name and thank you morning and welcome to your for city council meeting today is Tuesday August 27th I'll call a meeting to order today's invocation will be by Dr Cody McQueen from Christ Chapel Baptist Church please rise for the invocation and remain standing for the pledges of Allegiance first thank you for serving and so many selfless and unseen ways appreciate you guys honor to be here uh would you pray with me Lord I Thank you for this city and I thank you for these leaders Proverbs 1:7 says that the fear of the Lord is the beginning of knowledge and wisdom so I pray that as uh they make decisions today and they hear from uh many uh citizens that you would give them wisdom that you would give them knowledge and discernment but that would begin with a fear a reverence and an awe for the responsibility that you have given them to represent not only the citizens of Fort Worth But ultimately you we ask it in Jesus name amen amen of the United States of America to repblic for which it stands one nation under God indivisible with li jce for all for all flag mayor and Council our first item will be a special presentation with a presentation of recognition for Miss Texas Latina April Rodriguez mayor pretend Bivens I believe this one is yours I am very excited and I had the pleasure of meeting Miss Latina Ford worth Miss Latina Texas just recently and the fact that I didn't know her made me want to make sure everybody knew her and so welcome to city hall now April they give me the old person's version of your plaque so in pageant form I'm going to get you to stand right here and just hold your plaque and just I'm going to read it to you guys okay where as April Rodriguez was born and reared in Fort Worth Texas she grew up as a first generation Mexican American extremely proud of her culture and Heritage she graduated from the University of North Texas with a ba in business and political science with a minor in real estate smart lady here and a certificate in professional Spanish as a first generation college student and whereas April was selected as as Miss Fort Worth Latina in 2022 and went on to serve as Miss Texas Latina in 2023 receiving Miss community service and competing in the 2024 miss us Latina pageant and whereas she gives back to the community listen to this by helping Feed the Homeless with under thebridge Ministries organizing events to help raise money and donations for women's shelters in Texas mentoring young latinas through Latinas in progress and serving on the development committee for the Hispanic women's network of Texas and she's of course with the Fort Worth chapter now therefore the city of Fort Worth is proud of April Rodriguez for her achievements dedication to community service and outstanding representation of both Fort Worth and our state and we wish her success in all of her future endeavors thank you for letting me do this and now you may applaud this fantastic young lady come on down come [Applause] on May don't you have something to say yeah I will I I think you got therapies coming down wait come on come on down like was it mon awesome I want one just two of yall together Janette Janette take one real quick Just the Two of y'all together we're gonna move out of your way as Janette is taking this picture I wanted to make note that Janette is our first Hispanic female ever elected to the fort city council and I thought it was just fitting that we recognized the two of them together and we have several students audience April congratulations on your honors but more importantly what a great human being you are to represent the city of for aren't we fortunate um and you're going to fool a lot of people with your beautiful looks but you've obviously got an incredible brain um that you're going to serve the community so please let us know how we can be of service and what an honor it is to have you in our forward City Hall chamber so God bless thank you so much of course of course if you'd like to speak you can April if you want to say anything you're welcome um I would like to thank the mayor it was so lovely meeting you and I would like i' like to thank Gina bivans um for making this possible it took a little while to get here but we're finally here and it's truly been an honor to serve the community of Fort Worth as Miss Fort Worth Latina and then later receiving the title as Miss Texas Latina I can't wait to see what else I do in the community in the future and thank you so much for your support thank you I'm gonna stay down here because I think councilman Martinez has our next um Proclamation or resolution um on behalf of Cook Children's specifically gun safety awareness month over to Janette thank you yes our next presentation will be recognition of gun safety awareness month can you hear me okay sorry good morning um this morning we have with us Eric Gonzalez he's the program coordinator uh for the center for Community Health with Cook Children's and we are recognizing the month of August as gun safety awareness month and so just cook children's aims for safety initiative is dedicated to educating the community and providing essential resources on the safe handling and storage of firearms uh this initiative creates safer homes and neighborhoods throughout the city state and County it's an impactful way to reduce the risk of accidents and ensure the well-being of all residents so as we know you know gun safety is an issue everywhere and so we have these groups that will help educate um our parents and our community on safe ways to store their firearms but let me read this um special recognition Eric if you're here and and those you brought with you could come down to the podium while I we read this so the city of Fort W special recognition whereas unsecured guns pose clear safety risks particularly to children and when guns are not stored safely or securely and they are accessible to unsupervised minors the risk of death or injury significantly increases and whereas in the the United States 350 children a year get access to loaded firearm and accidentally shoot themselves or someone else and between 2020 and 2023 there were 208 gun related injuries seen at Cook Children's Hospital the majority occurring at home and unintentional and whereas when children unintentionally shoot another person the victim is most often a sibling or a friend and whereas in 2022 firearm related injuries were among the fifth leading causes of death for people aging is went through 44 in the United States and currently about 132 people die from a firearm injury every day and whereas 4.6 million miners in the United States live in homes with at least one loaded unlocked firearm and studies show that between 70 and 90% of guns used used in youth suicides unintentional shootings among children and school shootings perpetrated by Shooters under the age of 18 are required from the home or the homes of relatives or friends and whereas estimates suggests that even modest increases in the number of American homes safely storing Farms could prevent almost a third of youth gun deaths due to suicide and unintentional firearm injury and whereas educating and resourcing communities to practice safe gun handling and storage is an actionable meaningful way to create sa homes and neighborhoods across our city state and County now therefore the city forward does hereby recognize and Proclaim August 2024 as gun safety Awareness Month Eric can you say a few words while while I come down sure excuse me thank you councilwoman Martinez Council and mayor Parker we appreciate yall taking this on for us um at Cook Children's we take this non-political approach to gun safety and that really helps us reach all community members and so in addition to that education being able to provide resources like gun cable locks and gun saves to the community and having these proclamations really helps us get our education and just the word out to the community and keep us all safe so we appreciate all that y'all do for us thank good to you good to see you thank you our next presentation will be a recognition for blood can cancer awareness month councilman merraine thank you mayor council it's my honor today to recognize September as blood cancer awareness month um I've recently went onto the board of uh L LS society and it's been a great experience open my eyes to um how many people actually die of blood cancer each year um also um it especially affects a lot of our um brown and black communities too more than you actually realize and what they do is a lot of information you go to your doctor you're told you're diagnosed with it but you don't know what to do next so they've got a Navigators program and other things and I'll let Christina talk a little bit here in a second and I also want to do this in honor of a good friend Meg lizenby who is fighting her own fight right now uh with leukemia says whereas an estimated almost two million people in the United States are living with or in remission from Leukemia Lymphoma Myoma MDS and M MPN I'm going to let Christina tell you what to say those words whereas Leukemia Lymphoma and Myoma are expected to cause the deaths of an estimated 58,000 people in the US in 2024 whereas the Leukemia Lymphoma Society funds life-saving blood cancer research around the world provides free information education and support services and Advocates on behalf of and with blood cancer patients their families and volunteers for Meaningful policy changes LS funding has contributed to almost every major blood cancer breakthrough to date and whereas LL LLS enhanced efforts to expand equal access to care including clinical trials for all blood cancer patients making inroads in communities that have been traditionally overlooked and whereas Fort Worth is committed to the eradication of blood cancer and support the treatment and support of all blood cancer patients for their families and whereas Fort Worth encourages private efforts to enhance research funding and education programs that are saving lives now therefore the city of for worth does hereby proclaim the month of September 2024 blood cancer awareness month Christine You' like to say a few words yes thank you Council for allowing me to be here today the Leukemia and Lymphoma Society is truly doing the good work in blood cancer research and we're definitely impacting local Fort worthan through our local patient financial assistance program as well as those in our community through our Myoma link program that targets people of color so I'm so incredibly grateful for you having us here and acknowledging this we do believe that blood cancer research is going to lend itself to other cancer research um and really you know our goal is to find this the answer and we know that it's in someone's um garage right now so we just need to fund and located it so thank you so much for having us here we appreciate your continued support um and a huge thanks to Michael crane for joining our board this year we're so grateful to have him thank you so much thank you I think we'll take a if anybody want from colleagues want to join happy to have you down here you want me to gra this yeah on in not with anymore no i' left and just join Lon last year have lunch thank you very much good to see you thank you mayor and Council as a note our recognition for Community involvement is being rescheduled for a later date next will be items to be withdrawn from the consent agenda there are no items items to be withdrawn from the consent agenda items to be cons continued or withdrawn by other discussion not please vote motion carries next will be present presentations and announcements by the city council members including ceremonial travel if needed Council M Flores thanks mayor Parker all right first slide uh on Saturday August 10th we had a transform 1012 North Main uh Community conversation and again that alludes to the building there at the aforementioned 1012 North Main uh site uh that conversation we held was AR El Roo brought in some community members to discuss the ongoing planning involved for literally transforming that building into something substantive and uh very contributing to the community next slide please August 17th uh another Community conversation this one was about Panther Island so we had a community engagement Town Hall at Northside Community Center involved residents and gather their input and their perspectives on the upcoming and always Dynamic plans for Panther Island so my thanks to the spanic Chamber of Commerce to uh helping us organize that and the volunteers that were there uh to help people you know connect with these projects and how it impacts their lives next slide please Thursday August 22 this first district 2 and district 7 planning and budget open house we had had that in tandem with my colleague Macy Hill at the eag mount sag administration building so lots of good input received and you know we're we're getting more clarity on what priorities are important to our residents as far as our budgets are concerned uh Friday August 23rd the governor of uh Kila Mexico came by and he visited with us Governor Salen and talked about Partnerships and ongoing uh economic ties and tourism ties uh with our country so appreciate him coming there hearing what uh was important to him and it's always I think beneficial to uh to strengthen those economic ties with our neighbors next slide please Saturday August 24th Urban Land Institute uh with a grant presented a mock exercise rosemarine theater again that soliciting input from residents uh as to what development we'll have you know on our you know City and this is City this is a Citywide initiative where we're trying to draw in that Community input and use that Grant so that we can give an understanding to the residents of what our processes are like um next let's see what do I have okay couple of announcements Trinity Metro new orange line we've heard about that connecting downtown Fort Worth of the Stockyards it is coming uh Saturday September 14 we have that kickoff in the Stockyards from 11:00 to 5:00 p.m. live music armadillo races like to see that line dancing uh roller roping face painting games and more and then uh another announcement for his patrias parade and Hispanic heritage kickoff celebration save the state Sunday September 15th at 11:00 a.m. forward Stockyards be there and enjoy the cultural uh performance through the parade that's all I have thank you counil Lar dworf quick uh we have our budget meeting coming up on Thursday our open house um we will also have burritos because there's nothing that goes better with the budget meeting than burritos from JJ's Taco so uh come listen to the uh the budget presentation from from City staff provide your input uh because trust me that input it matters it's valuable um and the burritos are they're fire so we hope to see you there oh sorry Gina I missed you on the list thank you mayor I first want to say hello to the students from Everman ISD I had a chance to visit with them this morning and let them know that they'll get a chance to see government in action so welcome to you all here we have students of all ages who come to the daytime meetings and we have these daytime meetings thanks to the flexibility of our mayor Maddie Parker who adults children of adors children of all ages if you look at that picture you see two chiefs you see the fire chief and you see the police chief I had a chance to attend a luncheon hosted by the East Fort Worth Business Association recently where the two chiefs were invited to speak I did not hecko them they were warmly received by the audience and I just want to applaud them both for getting out in the community as they do whenever requested next slide recent recently we celebrated the 50th anniversary of the Region's Regional Transportation Council uh whenever you see construction on highways and trails and bridges and things like that usually that money flows from Washington to a group called the RTC I'm a member of the RTC and got a chance to welcome the attendees and had a chance to see former mayor Betsy price in the green there it was great to see her uh you should also know if you you've been trying to pay your water bill and you show up at the old parking lot like I saw about five people this morning you now have to go to the 9th floor of the new city hall to pay your water bill and we've gotten the word out but I know people are just too busy to read every bit of mail but if you come to the old place to pay it there's nobody home uh we're going to have a meeting Friday at 6:00 to address construction along Trinity Boulevard it's not the usual construction we have a new phase of construction and for those of you who know about the big water main break yesterday we're having that meeting anyway and we'll be at what's known as the Baptist Church on Precinct light Road Friday at 6 o'clock even though it's about the new project if you have questions unrelated to the project if you email those questions to me by close of business day tomorrow we will answer all questions you have and we do have a bud meeting in District V mayor but I forget what it is I'll announce it later okay sounds good thank you councilor Williams thanks mayor um this weekend I was invited uh to join a conversation um with steer Fort Worth um along with two of our amazing um city employees Juliet Moses and Corey Beck um we got the chance to um just share with um um folks who were participating in this discussion about major plans and projects that um reshape um the future of for worth over the next few decades um and continue to ensure that we're growing in a way that is intentional meaningful and sustainable um it's a if you have never been to a steer forth event or if you're not a part of it I highly encourage you to um our office has the privilege of sponsoring um several memberships throughout the year so um if you have uh the interest but may not be able to um you know make that uh annual dues payment um please reach out to our office we really want more and more folks to get engaged with steer forward um as they continue to engage um folks in the Civics process um next slide um just two announcements for our district six residents um we want to make sure that um all of our district six residents join us for um our open houses um we have um uh two coming up one on Thursday September 5th um at 6m at the KOMO Community Center um and that begins at at the open house begins at 600 and the presentations will begin at 6:30 and then the second one is Saturday September 14th at 10:00 a.m. um at the Chisum Trail Community Center um and that um and presentation start at 10:30 for that um come be a part of the budget conversation and also um help us um you know continue to build upon the successes of the past few years uh by sharing your input about how you would like to see forward contining to grow I'm so looking forward to seeing you at both of those events thanks mayor I think I'm up next the first is uh a congratulations the community our kids read 4.5 million minutes over the summer for the mayor summer reading challenge I was reminded how difficult it is to read to toddlers um at my um home library in in ridgley but it was still qu quite a lot of fun we had some kids that liked me more than others the ones that aren't pictured thought I was very scary that day cuz I put me in a Dr Seuss hat so I'm going to say that was their fault not my fault um but in all sincerity this is because of our amazing Library staff that make this possible our libraries are incredibly welcoming and fun and educational they pour into the families that come in those doors so I just wanted to say thank you to madori Clark and your entire team especially your Communications team led by Teresa that really been over backs this is the historic number of people we've ever had participate this summer and we're going to meet that challenge next year as well next up for our cat lovers Kitty Hall is coming to you Fort Worth City Hall on September 13th will turn into Kitty Hall made possible by for worth animal care and control I will not bring my dog because the dog would eat a cat and I think that defeats the purpose of trying to promote people to adopt cats however um I do encourage you to come and learn more about the importance of adoption and fostering um we have a wonderful staff at our Animal Care and Control Center and we do have a need to adopt more pets specifically cats right now so we're trying to have a little fun with this at kitty Hall it's also a chance to come and see your new Fort Worth City Hall located at 100 Fort Worth Trail uh I think that's the last of my announcements and I'll move to council member Hill okay as councilman Flora as mentioned last week we had District 2 and seven um budget open house in the Northwest Fort Worth it was well attended and thank you to the city staff that showed up and helped answer questions to Residents um on September 9th next slide thank you um we have the second district 7 budget open house at Blue Hay Elementary um in Far West Fort Worth 601 blue Hayes drive from 6 p.m. to 7:30 p.m. and I encourage all that who can I encourage all who can attend to come and hear the city manager's presentation on the 2025 budget next slide and then please join me on Saturday um we are having our an opening of the Clifford Crossing Library branch the opening will take place at 10:00 a.m. at Clifford the Big Red Dog is supposedly going to be there um have lots of fun inside outside and I'm look forward to checking out books and seeing the new space thank you council member nles yes I just have a couple announcements I didn't get a chance to do my slides I know you guys were looking forward to them um but it came back too fast so I do want to thank Everyman ISD for being here and the teachers for coming out being a part of the process uh so young people you he from every is you weigh your hands so everybody can see you there they are and I I want to tell you we're on page 10 I kept seeing you guys turning trying to figure where we are we're on page 10 uh we the first vote we voted for like a 100 consent items so we moved over 10 pages so and how boring are we so far no one's asleep we're okay right doing okay great so um Everman is special to me is in District 8 I'm also a product of Everman ISD I told the story once before uh with the mayor and I'll tell it with you guys I attended ever I mean I'm sorry attended eray Elementary school but at some point 6 weeks out of that I attended huml and that's when it was the alternative school but nevertheless I still made it here to city council uh due to my community support and so no matter how you start okay you can end at a better place so I encourage all of you to get involved be a part of process you too can sit up here uh like me and uh talk uh with y'all and all the rest of us this is a better place this is a better place uh secondly second announcement is um we will have the state of the uh District 8 address uh September the 26 at the Union Gospel Mission at the new uh Community Center and so we had our budget meeting yesterday but we'll probably have our final budget by then and so we just talk about what's happening in our district those are my announcements thank you thank you Chris our next up is council member block thank you mayor so first I just want to invite everybody up to our district 10 Town Hall which will be Thursday September 12th at the speedway Club at Texas Motor Speedway it'll be from 6:30 to 8:30 p.m. we have a great list of speakers to talk all things Fort Worth uh specifically in the north and and encourage you all to come and be there next slide so I signed up I think I'm being a little crazy here but I signed up for the big wing challenge for big brothers and big sisters so if you want to see me eat some really hot wings and and sweat to death and and and be on fire hey come out and support give we appreciate it's for a great cause next okay I've got one other quick thing I want to give a big shout out to Phyllis grisom Phyllis has been a wonderful leader from the library Advisory Board during her tenure I just want to thank her publicly she has served Fortworth and represented the far north in this role for a long long time and she promises that she's going to continue advocating for the library and plans to remain remain active in the north Fort Worth Alliance so I just want to say thank you Phyllis and just recognize her for her time and service Alan thank you mayor um just wanted to share some pictures from our Citywide job fair uh in collab collaboration with Goodwill we had over 200 attendees there you'll see that there were some breakout sessions as well and we had uh a little over 40 employers so it was a really great event um and just hopefully we can do this again next year next slide please uh please join us for the echo height special event litter cleanup we will be meeting at prairie dog park on September 7th from 88: to 12 uh that day is going to be a little be it's going to be a little bit busy because we'll start our day at the litter cleanup and the next slide and we'll go to our budget open house that's going to be uh that same day at 10:00 a.m. at the business Assistance Center so hopefully you can join give your input and uh hear about you know what we're proposing in the 2025 budget thank you thank you and I think Gina you wanted to talk about your budget meeting really quickly and I forgot my budget date but it's going to be on September 14th that's a Saturday afternoon from 1: to 3: and we'll be at the Handley metal Brook Recreation Center I encourage you to look online so that you can see what's being proposed in the budget by City staff because I promise you you will have an even better idea as a citizen I did not know Chris nles was in alternative school so glad to see you turn your life around and the wire department told me they're on the fifth floor not the ninth but thank you for letting me at that end mayor and Council next will be speakers on non-consent agenda items and mayor I believe we have one thank you Adrienne Smith Adrian Smith I am one with the people I'm here to speak as a reference to the upcurrent proposed uh tax increase by the city now let's revisit the past so we can understand where we are in the present for Worth City Council approves 2024 budget with higher effective tax rate expanded city services the city of for worth went against prevailing local political wins and voted to approve a tax rate that will bring and more Revenue than last year sounds sounds like familiar familiar familiarity that I'm uh that we all used to the city lowered this tax rate by 4 Cent but that's not enough to lower most residents tax bill the city would collect more tax revenue this year than last year a fact that the concerned residents who spoke at the budget meeting September 19th council member Alan bellock whose District represents for North for worth made a motion to resist the uh to reduce the city's tax rate to the no new Revenue rate that's the that's the tax rate that will collect the same amount of Revenue that the city collected last year council members Charles Charles L and Michael crane supported to propose but It ultimately fa 8 to3 mayor Parker defended the staff proposed tax rate uh in budget fast forward we had residents who spoke out against this particular tax increase of uh a year ago uh Mr Block said his constituents consistently expressed concerns for Public Safety and infrastructure uh uh property Texas I'm proud of the amazing progress being made on public safety and infrastructure block said I regularly hear from constituents that they feel over taxed and underserved so we let just a little about the past tax uh rate that you all did on did a year ago you know you increased it a year ago and here we are again you all a proposing to increase it again so as a taxpayer and a resident of this city I would be the first to say that I am against it I am against it and I am against it I do believe we have the votes on this di uh that can uh end this potential tax rate increase that's due to happen this year I do believe we do have the vote um before we do something that we can't undo consider consider what the County Commissioners have already done in continuing to do in providing relief for families consider the city manager and assistant city manager will no longer be serving this city why not give the new city manager the opportunity to make his or her recommendation as it relates to a new tax rate consider you've already used taxpayer money without regard regard for projects not necessary considering the impact those decisions will have on the broader spectrum of things we the taxpayers are left with the burden of bailing you out yet again we don't want this and again Mr Block L Crane Williams Martinez Beck and nles I believe we had a votes that we could uh see this thing not to go through thank you mayor that's the last of our consent speakers Council non-consent excuse me uh not next will be changes in memberships for boards and commissions with the first one being 24- 4521 uh board appointments from District 2 mayor and Council request your consideration toint the following individual to the respective board with the term effect of August 27th this year ending October 1st of 2026 that would be Sergio Gara first term Board of adjustment residential additionally I request your consideration to reappoint the following had a booth in elado there and so just have known him throughout the years he's very active at the his Chamber of Commerce and just gives back willingly to the community in very various capacities I'm sure there's boards I don't even know you serve on but um just uh with that mayor I request your consideration to appoint the following individual below with a partial term effective August 27th 2024 all the years have you've been coming to city council but I'm very excited about this first of all thanks to my Council last week on Friday we sent a unanimous letter from this entire body to city manager cook and his team at Fort Worth lab and the CMO office to really articulate our concerns about affordability and need of property tax relief for the citizens of the city of Fort Worth um this is not something that's easy for us we grapple with a lot of um competing desires and needs across the city and this year is no different the reality reality is revenues are down in the city and furthermore um we also hear from constituents on all sides of the aisle um that they need to see more prop property tax relase and affordability is a concern fortunately for us at the city we have an amazing City staff and budget office and City management team and department heads um that have really rolled up this Rel leaves in the budget that was proposed and also in our request our request included several things but really we'll save that for September the most important thing to note today is we requested that our property tax lat stay below the no new Revenue rate that means this rate will stay flat um and also maintain critical city services including Public Safety and the much needed Street maintenance fee that Lauren prier really would like to have for her tpw team um you can clap for that okay Tara thank you Tara do want to be stressed anymore she's like we got to get past this um but the last L I'll close and I'm going to turn over to Macy to Macy Hill for our our motion um I do think it's worth noting that despite a lot of divisiveness and fighting you see at State and National level this entire Council unanimously signed this letter and I want to personally thank my council members um for taking my calls last week looking over the language working with me on some other things that are quite important in including a compromise at $18 level 18 entry wage that will be discussed today in budget hearings our street maintenance fee and the other things that are critically important including Public Safety that is a difficult feat um but this body really recognized the importance of working together to get us to this place thank you very much to each of you council member hill I'll turn it over to you to make a motion I just want to reiterate what our mayor said it's imperative that we provide much needed property tax or La by but also keep providing essential services and prioritizing Public Safety and infrastructure so with that I'd like to make a motion to amend resolution 2 44516 to reduce the recommended rate from 7 6773 per $100 in valuation for fiscal year 2025 to 6725 per $100 in valuation for fiscal year 2025 which means there will be City Council adopt the resolution authorizing use of the power of imminent domain to acquire 0.0062 acres in the RightWay easement and 0105 acres in temporary construction easement from real property owned by Ronald Benderson Randall Benderson and David H balol as trustees under a trust agreement dated October 14th 1985 known as the Benderson 85 Tac one trust the property interest is needed for a public use the nor harant Parkway and North Beach Street intersection Improvement project for easements to construct a dedicated right turn lane and pedestrian sidewalk facilities improvements for improved traffic capacity and safety of intersection operation the property rights in the subject property are needed for the construction operation maintenance replacement upgrade and repair of the permanent dedicated right turn lane and sidewalk facility as needed the property is located at 4464 North tant Parkway and the Benderson Edition block a lot one tarant County Texas the property interest to be acquired is described by meets and Bounds depicted by survey exhibits attached to this mayor and Council communication so Council lorf it was beautiful it was just on the wrong MNC so what we're going to do is actually we're good we're good we're going to use we're going to use that statement and apply it to mnc2 24- 0754 and actually make a motion on that MNC first so I can entertain a second and then we'll come back to the other one don't worry you're good motion a second so on this one mayor you have to know we're super excited about this because we need these name is Derek Hall and I'm a planning manager in the development services division or Department I'm here today to to present to you on the second public hearing for this annexation 24-4 Dale arer way um this is a city initiated annexation in future Council district 10 how do we move the slide sorry sorry got it this is my first time up here so you're doing great Derek just bear with me as was stated before this is a city initiated annexation second public hearing we had a previous public hearing on August 13 202 24 this is for purposes of anex annexing a ride of way that we call Dale nhart way this is a standalone application meaning that there is no additional land use application that's tied to it um as is presented it complies with Texas local government code section 43. 0672 we did publish the notice in the Star Telegram on August 16th this is for purpose of understanding the annexation of full purpose annexation and council's actions is scheduled on September 17th by way of regional context we provided a slide to show that this location is North of Highway 114 West of Interstate 35 this is in the far north planning sector in Denton County um some adjacent uses include Texas Motor Speedway and some additional commercial uses as a result of the development in the area we've seen increased traffic and therefore um we are looking at at annexing this particular RightWay in the city the particular acreage is 9.79 Acres uh again this is a RightWay adjacent properties uh for mayor and council's consideration has have already been annexed into the city um and upon approval of the annexation the city will maintain the road to City standards with that may and Council this concludes staff's presentation and we're respectfully asking for you to close the public the operating pits and published in the Star Telegram on August 16th 2024 the notice included information on the proposed budgets and service plans staff contact information to answer any questions in this morning's public hearing and the benefit hearing scheduled for September City staff provided each pit manager with estimated Revenue figures based on preliminary property assessment data from the following receipt of any public comment staff recommends that the city council close today's public hearing approve filing the proposed assessment rolls on file with the city secretary for public 24- 0726 and MNC 24- 0728 with report by Lacy R um so this the purpose of today's public hearing for mnc's 24- 0726 is to receive comments regarding the proposed plan of service and budget for fiscal year 24 and 25 along with the proposed assessment for the tourism pit or the T pit and for mnc's 24- 0728 to receive comments from the public on the advisability of expanding the boundaries of the tpit to include one additional Hotel property in preparation for this morning's public hearing and the upcoming benefit Hearing in September City staff provided the tpit manager with estimated revenues figures on preliminary property assessments from the tan Appraisal District throughout July and August City staff and the tpid manager worked together to finalize recommended budgets which were then shared with the T Advisory board and the property owners notification of today's public hearing and the subsequent one to be held on September 17th were mailed to all Property Owners liable for assessment within the tourism pit and Publishing a Star Telegram on August 9th 20124 as required by chapter 372 of the Texas local government code the notice included information on the proposed budgets and service plan staff contact information to answer any questions and the time and place of today's public hearing and the public Hearing in September 17 to provide opportunities to address the city council with any issues or concerns they may have section 372 um 0121 of the code allows the city council to include additional properties in the tpit so long as they meet the requirements of the code the property owners of their D or their duly authorized representatives for the avot hotel Trinity Uptown located on 320 Samuels Avenue Fort wor Texas 76102 have signed a petition requesting inclusion within the tourism pit this results in the increase from 80.5 4% to 8 3.25 of the appraised value of taxable real property liable for assessment and from 69.6 3% to 7.32 of the area of taxable real property liable for assessment and from 66.67 to 67.2 4 of the record owners liable for assessment because the percentages are all still above the 60% threshold the Avid Hotel meets the above stated elements and therefore may be considered by the city council for inclusion in the tourism pit the total estimated cost for the proposed services and improvements for the life of the tpit which is approximately 3 years will be 23, 330,000 which includes an estimated cost of 7,400 th000 for the fiscal year 2024 2025 budget assessments will begin October 1st 2024 following receipt of any public comment staff recommends that the city council close today's public hearing approv filing of the proposed assessment on file with the city secretary for public inspection approve MNC 24- 0728 declaring the petition to expand tpit to be sufficient and set September 17 2024 as a date for Final budget hearing to consider and approve the pit 18 tourism plan of service budget assessment rate and expansion the proposed assessment rate for tpit tourism is 2% of the consideration received from occupancy of any sleeping room furnished by hotels within the pit the estimated revenue for the tourism pit is $7,400 for fiscal year 2025 so a representative from visit for worth is here if you have any questions awesome thank you see questions from council members do we want Bob to sing a song guess I should I'm sorry to back up I am the senior warden for St Andrews anglian Church which is across the street from the federal building so that that's why I'm speaking today as as its representative so we are directly impacted by the pit what it does and what it doesn't do uh the money it spends um and we um the parking lot that's across the street from us of course we own and it serves the courthouse and and a lot of visitors so we want downtown to be nice and we want to we're not certainly against participating and in helping that but we I would like very much to see more detail than what I'm seeing I don't know where the money is being spent and how it is U I have been visited with ambassadors before I've had interactions uh with those folks um and so if we could just see more detail of what's where that's going um because it seems like there's a lot of money being spent and I'm not sure where it is so that's really one I wanted to add and I'd like to see that before y'all vote on it if that's possible thank you Warren well we actually did already vote on that item however there are several representatives from our downtown pit including Andy Taft to represents downtown for think that they're going to reach out to you separately um lucky for you they have a lot of detail about how they're spending that money and I'm sure they would love more input from from both you and your church parishioners there that that are frequent downtown and you're um of course we encourage more involvement I will mention that our Central business district has done a tremendous job you know coming back from covid um but there are several things we all need to work on not just downtown but across the city so we appreciate your interest and your tenacity to hang on you uh excuse mayor Parker council members thank you for allowing me the opportunity to speak on this matter I represent pretty Hospitality LLC it owns a motel that is purportedly affected by this proposed zoning change u a few concerns first anytime zoning changes are made and it brings a business into non-conformance legal or otherwise it has a dramatic impact upon the value of the business as well as the ability to resell it and in my experience the industry in effects disproportionately would be the lodging industry so at the Planning and Zoning commission hearing uh I Wasing a presentation I was shocked to learn that out of the entire city of Fort Worth only five or six motels will be impacted by this zoning change uh I have requested information from uh City staff member step Murray the information is going to take some time for him to compile he reached out to me this morning I haven't been provided it yet I need to have that information available to me in order to make a full presentation to uh mayor and counsel so that you can understand what it is you're being asked to vote upon what I see is the exceptions or exemptions in the proposed ordinance that is the areas where this text Amendment will not have effect swallow the areas that it does affect so I mean we all know there are many hotels motels lodging facilities the city of full work how is it possible that only five are impacted by this I noticed in the proposed ordinance and I asked Mr Murray to provide some rationale for why it was acceptable to single out five or six lodging facilities to be impacted by this proposed ordinance due to the enumerated exemptions that exempt most of the city's hotels it's not in the ordinance there's no rationale there's no reasoning and as we all know well the city council has broad discretion in passing zoning ordinances it can be arbitrary or capricious it does need to have some reasoning and that's just not present in the proposed ordinance that we see today and I don't think it can be present until Mr thank you Lance I apologize your time has expired thank you thank you thank you very much Council that's the conclusion of our speakers on this item I can entertain a motion mayor go ahead please yeah before we get to that point um I had talked to zoning staff early this morning and had asked whether or not um U Mr bashara had been contacted okay they did speak with him him and he did appear before the zoning commission I don't know what five hotels he's referring to that would be impacted and I don't want to belabor the point here I'm open-minded you know do the approach here but I do want to say that there is precedence for it when you look at our ordinances as they apply to uh alcohol permits right from uh similar you know uses uh this does not and I'm looking at the address here that he cites as a a 221 West Exchange Avenue and as far as the Stockyards is concerned the base owning Is mu and because form-based code is there this does not apply in form-based code because of obvious reasons the requirements under form based code take care of that so I just wanted to notate that you know I'm open to a suggestion I mean we can continue it further if staff thinks that there is uh you know further information to share I don't know if if Steven's available or someone there's a Shandra great I don't know if she wants to speak to that if that'd be okay may good morning mayor and city council um I definitely concur with council member flues um we don't have any other information that would um trigger this code Amendment needing to be um continue till staff would um request that it it move forward thank you you have anything else um I don't have anything else you can speak on Charlie if you're ready good yes so this one um I did ask the staff to look into um this amendment for me back with the bass Elementary Hotel debacle that happened um we can all point I know I can certainly point fingers we can all point fingers but at the end of the day what came of that uh Falls squarely on my shoulders and I will take full responsibility for how all that went down thankfully it all ended um it ended in a in a good spot but like the the promise I made to the parents and the staff there at that school is I will continue to take steps to prevent something like that from happening in other areas um I think it's key to note here that this is not restricting a hotel it's just requiring a plan development District which means they have to go through the same process um as others would need to if it's within a th000 feet of that school um I think that you know the the goal wasn't to affect any current businesses in fact they're they can continue to operate as usual um they can even resell their business and continue to operate as usual so it's not going to affect them the main concern here is affecting the current um infill lot that we have very few of these days especially in District 4 and where we see people just throwing a business just to throw a business there and trying to protect the Integrity of our neighborhoods uh protect our our students our our faculty our staff uh there at that particular school so again this isn't restricting that I mean if anything you'll find that I'm all about private property rights this just gives an additional layer to our city uh and then to our residents to have a voice uh in what gets built right next to their schools so again I will take full responsibility and that'll bear on my shoulders but this is is just one of the steps that we're taking uh to improve how we do things in Fort Worth especially as we develop uh more and more and we start getting into smaller and smaller Lots uh and just protecting the Integrity of our communi so
