First of all, congratulations on your newly elected and appointed rules and thank you to those continuing to serve. >> On the council city staff, we look forward to partnering together to continue to see our city grow and improve. My name is Jennifer White men, the executive director of ICT Eso Es, anti-trafficking nonprofit proudly serving our city since 2011. As you're aware, January is human trafficking Prevention and Awareness Month with me today are members of our community who work diligently every day to create a safer, for all who live here and their various roles. They also serve the needs of survivors, which ties fortunate to have a multidisciplinary team of organizations dedicated to the prevention intervention and restoration as survivors of trafficking abuse and explore exploitation. This team consists consists of local, state and federal law enforcement agencies, medical partners from clinics and hospitals, social workers, therapists and advocates from child and adult serving agencies, board members, volunteers and donors from every walk of life. I speak on on behalf of the group to extend our gratitude to the City Council for recognizing Human Trafficking Prevention and Awareness Month. And I implore you to connect with these organizations to learn more about how they are serving, where the gaps are and how we can come together as a city to see an end to the exploitation of our neighbors. Well, you may not realize it yet. Many of the issues that come across your desk are also anti trafficking work. When you're asked to consider the need for more safe and affordable housing, the fight against fentanyl. Workforce development and even quality of life projects like public art and parks. You are helping to design a city that is safe, welcoming and provides opportunities for all the best way to fight trafficking is to prevent it from happening. Thank you for the work you're doing. Thank you to my colleagues both here with us today. And those who weren't able to join us because this work never takes a break. Can we please have Ted Bush come forward? The proclamation reads, whereas exposure to carcinogens as a firefighter may seem inevitable and insurmountable. Every effort regardless of its scale is necessary to reduce firefighters, exposure. And aspects of their lives within our control. Whereas those efforts in awareness and education and preventative measures make a difference in the overall accumulation of carcinogenic exposure and reduce her risk of developing occupational cancer. Whereas firefighter Cancer Awareness Month takes place in January. But these efforts must be accounted for year-round. Whereas it takes all of us as firefighters and city leadership to make sure we continue this fight against firefighter cancer, what they're serving the community and after the alarms are over now, therefore, be it resolved that I Lily Wu, mayor of the city of which Todd long with the witch Cha City Council do hereby proclaim the month of January as firefighter cancer Awareness Month. Good morning. >> On behalf of the members of local one, 35 their families especially those members and families are affected by cancer. One of who is with me now, Amanda Lawsky daughter of Captain Chris or Laski who lost his life to cancer. In May of 2020. I want to thank the mayor and city Council for this recognition and proclamation proclaiming January as firefighter cancer Awareness Month. In 2013 firefighter Cancer Support Network published a white paper about cancer in the fire service. They were working research group, including firefighters, fire cheese physicians. Researchers and other experts. The white paper addressed the scope of cancer of the cancer problem in the fire service and the causes behind the problem. According to the research group by this group, cancer is the most dangerous under-recognized threat to the health and safety of our nation's firefighters. Is the number one cause of line duty deaths in the fire service. Past discussions around occupation. Exposure has centered around blood and body fluids. Now we know that occupational exposure include more than just that. And most occupations, you can control exposure through engineering and controls the firefighters work in uncontrolled atmospheres and are exposed to high level hazards. Virtually every shift. The firebrand has changed in the last 40 years. Modern residential fires have more in common with hazmat incidents than older residential fires. Older buildings were built primarily of natural material like wood. Modern buildings, materials include thermal plastics, manmade synthetics laminated veneer. Lightweight foam and gesture, polymer and how the generated flame retardants and other manmade materials that include chemicals. Homes, businesses, and even our fire stations. Usually some materials. We have around 84,000 chemicals used commercially today and that is what our fires are flashing sooner harder and quicker. We've basically swim in a toxic soup of chemicals. And we as firefighters need to reduce our exposure. There are over 200 unknown chemicals and the makeup of smoke on the fire ground. The occupation of firefighter just the occupation is now considered a class. One carcinogen. Not only chemical dangerous are faced on the fire ground through intensive research and study. We find that we face a carcinogen exposure even before we get to the fire. Our gear contains P fast. All fire gear contains P fast. Not just in Wichita. fast as a chemical used for durable water repellent finishes to provide water and oil repellents E. They're strong. Long-lasting carbon flooring bonds make them a different, make it difficult to degrade. Hans P faster often referred to forever chemicals. Studies linked P fast exposure to the development of cancer and other health effects related to behavior of development. But Apple the Serb territory. And I and doctor e n logical and reproductive systems. Local fire leadership city, leadership and the community must come together to encourage prevention health initiatives and education to protect firefighters from exposure to cancer, causing chemicals as much as possible. We must continue to fight together and can it continue to serve our community and the best way possible? Working together. We can make a difference in the lives of these firefighters. They're there for us. Let's be there for them. And to all the members who are fighting this dreaded disease. And to those we have lost lost their lives to cancer. Can we please teacher Lindsay Ralston and her students to come forward. >> Good morning. My name is Allison I'm a history and geography teacher. The independence school and so have some of my students here with me this morning. We are excited just to see what happens behind these tools and we are really encouraging students in all classes to be part a cause and local government. And we know that voting council members is that is is a nationally is low. And as a teacher, I'm always encouraging since that these AU the people who make a difference in our lives and so knowing who they are, knowing what they stand for and being part take is in that process is really important. And show you all did too. people after sleeping and there's people out there. They have to sleep outside in this. And there's a lot of things that people have house. All the lies don't understand about being homeless. And one of them is that the life expectancy for someone that is and how says 48 years old? I'm 57. I don't see how city can put away 5 million dollars. Defend themselves and they go battles and we have people literally sleeping outside in the middle of winter. And the shelters here say how will they just don't obey the rules or one of the rules is you have 30 days. You have 30 days. 02:00AM. Develop a housing program, plant yourself and find a way to house your cells. And then you have to be out of shelter. If there's anybody after you. And it wants to get you, if you like X or something. I have to do is look at the shelters where it cold outside. And yesterday new 13 day they shut down the libraries which is in place. People especially on the couch, keep warm. And there are no buses running. So I don't know how they were able to take a bus to the homeless shelter. And northeast Wichita. There is a list of agencies they're supposed to help the homeless. Let's go through list with you. Okay. First of all, the family crisis center. Which is great, but it's only for families. The Union rescue mission that's from and only they have to ride between 4 and 08:00PM. And they get kicked out during the day and they'll have 30 days. Open door. That's only for the daytime. Humankind and the new shelter. 21st in honor of those are shelters. And now Catholic Charities listed as a resource for the homeless. They are saying Anthony Family Shelter, which is great, has actually wonderful if you're accepted. And I wish there more faces like this. do not assist with rapid rehousing unless you're a resident. If you're trying to get rapid rehousing in the city of Wichita, you have to be in a shelter to be able to get that. Okay through the open door. And we have been able to get into the shelters is not always as easy as you think it would And when I miss my flight back to Hawaii after coming back here to there, stretching back to health after and COVID and be unable to. And I sitting at the side of the street. officer tried to get me and you the Salvation Army, homeless shelter. I think should be able to have passed the raise. Okay. Why didn't that shelter before? And I've never failed You raise. And as you right the officer or don't you think that she should be medication before he comes in here? And I'm like. also just just hang up. I went a draft text. Make up your mind I can get a shelter. The National Alliance to end homelessness. I'm not sure what they do, but they don't provide direct services and will tell you to call 2, Some sections of use and mental health services. Their spat sore, healthy transitions children's Mental Health Alliance and transfer the benefits of homeless and individuals. Minority HIV. It's fun for and sheltered as well as and so communities. However, Kansas is not listed as being one of the people. Our state. For any of these programs. Have Asian Army closed due to lack of funding? Well, the city has got this 5.5 million dollars that they say is a set aside for home helping the homeless for now, that is not money. They set aside as many that they got from the American rescue plan that they had no other choice but spend on the homeless. permanently closed. You know, I read the prize just 1, 1, As rapid rehousing that you have shelter to good health. Cedric County am sick. That's calm here. Housing first. This is what not sure of it. We were never able to access it when we need it. The VA is just for vets. The children's Yeah. take your children away from you and the police department. So really just sheer shelters and you have 30 days. And at the end 30 days are expected to leave. And think there's some of that money that this huge surplus that we have should be set aside to pay rent for some of these homeless people get them off the street. Because of those are programs that work guarantee income direct payments to the homeless are programs that proven to work in other communities. And and thank you for allowing me to speak today. And I hope that we can help some of these homeless people because it's really cold outside. And their life expectancy is only 48 years old. I didn't hurt. Please call the next. There are. Councilmember Johnson. >> Thank you, this. Karen, appreciate you coming here to talk to us. Just want to give you a few answers to what you said. So the but this body makes the decision on where the 5.5 million will be spent. The former council had allocated 20 million dollars toward to commit community out of the 74 million that we received in Arpa funds. 5 of that went towards what you're talking about. But this body would make those decisions to your concerns about the shelter, the shelter on 21st Street is actually open. 24 7, there is no 30 day requirement. They will be in there until the end of March. So if someone needed that shelter until the end of March, they can be there humankind also has provided transportation opportunities outside of the city transit options that they have as well. Unfortunately, we we all received a report that there are now is people who did not want to go to the shelter for a number of reasons. And that is this at truly. We also know that in this not enough is being There are plans in the works. But right now the situation isn't the best. Some of that money that you are talking about are all of it is actually going towards broader plan that's been talked about in the public and the media. place called a multi agency center, which will provide more services foreign house and those with mental health challenges. Hopefully we can see that in the next 3 years. That's the plan. There's a homeless task force that meets regularly on that. If you are interested in that that is open to the public so you can see what's going on there. Our hope. This body, the county, the state is that we can get that going and serve people better. What we are right now, some of that stuff takes time. The Legislature has allocated some funds towards that as well. But I think I'm not wrong, that 80 million dollar project, so you look at this 5, it's do we put money towards static, the direct payment. You're talking about. Many of us believe in speaking for myself. I believe that center will actually be better because all of those agencies will be in the space to help navigate. I know that there have historically been some concerns about calling 2, 1, one, but they're working really hard. If you find a way to make the clc continuum of care work, they have a lot of agencies at the table to help out as well. And while not every agency has a perfect fit for those in need, there are agencies will and the help and they're continuing to work on improvement. So I would encourage you to check that out as well and follow the homeless task force. >> I'm the next item. Doctor, Gretchen Castel Eric cease-fire in Gaza. >> It's possible turn the mic up. I have laryngitis and it's very hard for you to hear me otherwise. It's actually Gretchen Castle. Good morning. Thank you for allowing me to come and speak to you. I hate you today as a concerned citizen who has watched with horror what the destruction Gaza, area roughly the size of Wichita. One of the most densely populated areas in the world. 2.2 million people. Well, where 20 3,000 people have no known to have been killed by Israeli Defense Forces. Bombs, tanks, artillery shells and soldiers since beginning of October. It's in since since October 7th in 3 months 100 case. At least 7,000 more lie dead beneath the rubble. Most of the dead are women and children. My congregation, Lorain Avenue Mennonite Church has written to President Biden calling for a cease-fire. And no more locks funding for his rules were a vengeance. Letter we received back did not even mention a cease-fire. And we have been upset to watch our government again. Time and refused to support a cease-fire resolution at the United Nations standing virtually alone among the nations of the world. Of course, condemn. Hamas is brutal. The killing of 1200 Israelis on October, 7th. But Israel's retaliation is so excessive. It violates international standards, but the streets of Seville of civilian populations. And has been called a genocide. I F cleansing by Amnesty International UN agencies over 100 international organizations and nations. American Jews who are part of organizations like Jewish Voice for Peace. Jewish voice for peace is live demonstrations. Across United States and even taken over congressional offices to try to make legislators hear the evidence take from the Israeli defense forces themselves. And from courageous reporters in Gaza. To condemn Israel's war on Gaza is not being Anti-Semitic. It is being pro human. Our government is denying the facts. Israel has built a wall in closing Gaza and has laid siege to Gaza and bombing in 2007 2014. But this past 3 months is unique in his level of destruction and killing. As a Holocaust scholar wrote in Jewish Currents magazine. At the start of this assault on Gaza and civilians in Gaza. And I quote. Under international law, the crime of genocide just to find by the intent to destroy whole or in part. And national ethnic. Racial or religious group. As such. That's from the UN Declaration and the Prevention and punishment of the crime of Genocide. Adoption to in 1948. In his murderous attack this Holocaust scholar wrote. Israel has loudly proclaimed this Israeli Defense Minister Yoav Gallant declared in no uncertain terms. On October 9th. We are imposing a complete siege on Gaza. No electricity, no food, no water, no fuel. Everything is closed. We are fighting human animals. He said. And we will act accordingly. Israel tall guys and must leave the area in the north and moved to the South. And then attacked all. For example, The New York Times had a long story about a lawsuit by Harvard students. Again, Sir University calling it a bastion of Anti-Semitism. And what is the evidence last September? A Harvard Harvard Divinity School student group show the film Israel Israel is a documentary about the generational Jewish divide over Israel directed by Cho, young Jews. Some of the filmmakers were students of my of one of my best friends. The complaint said that the screening caused is student. To suffer, quote, anxiety and crow grossed, just comfort. The politicians like to quote the Anti-Defamation League. But Simone Zimmermann, co-founder of and if not now explains, quote, There's no doubt that Anti-Semitism America has increased since October 7th. What is dubious? She says as the reliability of data published by the ADL who repeatedly makes clear that they care more about criminalizing pro-Palestinian speech, then fighting real Anti-Semitism. Even a group that rarely criticizes Israel, J Street. Criticize the ADL report. They said we must confront Anti-Semitism from all corners and those who use it to further political goals. But just as it is wrong to hold Jews responsible for the actions of Israel's government. So too, is it wrong to count on criticism of Israel as Anti-Semitic? Another important voices from burning Steinberg, who was the executive director of Harvard Hillel from 1993 2, 2010. is a faith community, Jewish educational resource and social network. Heres what Bernie Steinberg said. During my long career as a Jewish educator and later, including searching years, living in Jerusalem. I have seen and lived through my community struggles now as an elder leader with the benefit of hindsight, I feel compelled to speak to what I see as a disturbing trend grouping our campus and many others. The weaponization of Anti-Semitism by powerful forces who seek to intimidate and ultimately silence legitimate criticism of Israel and of American policy on Israel. Steinberg continues. In most cases, it takes the form of bullying pro-Palestinian organizers in others. These campaigns persecuted anyone who simply does not show due deference to the bullies. Strindberg continues. What makes this trend particularly disturbing is the power differential billionaire donors and the politically connected, not Jews and Jews alike. On one side. Targeting disproportionately people of all populations on the other, including students, a tenured faculty, persons of color, Muslims and especially Palestinian activists. And in Israel, Meyer, but Roach and I history and civics teacher was held in solitary confinement because he posted on Facebook a message opposing the war in Gaza. He said. I'm quoting my approach and now most Israelis don't know much about Palestinians. They think their cherished, all of them were vague images with no names, no faces, no family, no homes, no hopes. Mayor members city Mark older with the city manager's development services before you today is a petition to renovate the building to this is actually a request to have a public hearing in February this building renovation, the overall project is the rehab of a 11 0, one west us, which is on the southwest corner of Douglas and Seneca the overall project up in that building and become the offices of Lang real estate. Their total estimated investment and the building to move industry million dollars the facade investment project would include the exterior brickwork approve Missy entrance, new windows and as well as any other premier 16 and up have rendered Slater show you what's going on. So this is a map of the bone on the southeast corner. includes 3 addresses, but primarily addresses 11. 0, 1, So this is what the building looks like today. This is the north facade of of the building and in the east side. When the project is done, this is what the exterior look like on the north side. And this is a rendering of the corner of the updates that they would make to the building to update that intersection. The side It's going to be at the maximum assessment is proposed to be $395,000. And that includes 341,000 the actual facade project. And the rest includes administrative fee as well as a financing costs. This financing costs to include one year's debt service reserve that the city holds back. As security for the project. The maximum assessment on this project has been set based on 395,000 being. 25% of the has built value of the building, which is just under 1.6 million dollars. So in the project is the way the finance work on this, a special assessments would be levied against the parcels there at 11 one West Douglas. But the interest rate would be set at the ball and also one of the interest rate. Once we go to issue bonds, it is repaid over 15 year period. And then the how this works is that the owner would pay the construction cost front. Then when the when the facade project is complete, they'll be reimbursed for the project and then we would levy the special assessments against that property. So then following that, the action today, which would set the public hearing for September 24th for consideration Air September. out. I'm sorry, February 6 of 2024 for this project to consider and at the public hearing at that time. And then again, once the project is complete with that final assessments amount will be said and then. The project comes less than that 3.95. We would come back to set a final. These people are working poor. What is the minimum wage in Kansas? $7.25 an hour. People can't afford insurance on that. But I think it's incumbent upon us as the largest city and the state of Kansas to have that on our agenda, not just monitor, but advocating for such which it since tax dollars continue to leave and go to the federal government to support the health care expansion and other states while we continue So, you know, there's over 100,000 people who could have benefits of Medicaid expansion yet we will not do it. And I think that the legislature, whether they can choose to listen to us on this one issue or not, that would be on them. But I think for us it's good to advocate for people. Many of us travel through and Saint Joe. know that the impact the Medicaid expansion would have on some of the folks who need help there. There's nothing negative from Medicaid expansion and I would hope we can add that to one of the items that we're advocating for. Again, our city benefits. Medicaid is expanded. And if you look at what was proposed prior, if there is some form of marijuana, legalization weather again, medical or completely. Then there is a revenue generator to pay. So for those who are concerned about the cost Kansas again, although if we would have expanded when it first came out, there have been less money. There. There is a revenue source to pay for Medicaid expansion and really truly help people. For example, I know that a lot of the funding from the state is going to go to law enforcement agencies which there is a place for that. But perhaps we could get it to where we can services and in jail and in prison for people who are still addicted. I talked to time sometimes a different providers. The talk about how important this is not only to the 150,000 cans is that Kansans can qualify as it is, but it also allows us to. Be reimbursed for some of the services which allows us be more competitive in paying staff. The is real and we know that they don't get paid as much as they probably should especially the case loads that many people have been the not patients and they're willing to see, they have to see. But there's only 4 organizations in Wichita that take uninsured patients as it is. And you only imagine what a burden that they are caring for the rest of the state. So I appreciate everyone else in that has spoken so far to move this up. I think this is something that we can't just sit and watch anymore. No matter what they say in Topeka, we don't ask for it. We don't keep pushing for it. It's definitely going to be So it's important for us to keep pushing and pushing and pushing not to mention we're leaving 7 billion dollars PE on the table. I'm here today to present to the recommendation for multi function, devices. multifunction printer devices are Fps didn't exactly roll off the tongue. Most people refer to these as copiers are printers. So I may use that in this presentation. So we utilize about 150 of these devices throughout the city. Again, they perform perform a variety of services for us. They copy Pratt. They facts. They scan. So that's weather. Consider multi function. Our current provider is Konica Minolta and they've been our provider for the last contract which was initially initially initiated in 2019 and will expire in February of 2024, they were actually provider for the contract before that as well. So we've been with Konica Minolta for about 10 years. So whenever we look at what our copy or needs would be for the we had several objectives. So we wanted to look at first. We want identify the number of these devices that we would need and we looked at office efficiency. But we also looked at the numbers that we would need to adequately serve our customers. We're also wanted to align the imaging needs of the devices with the imaging needs of the various divisions and units of our organization. We also wanted to identify any special features that we might need and identify if there are devices that could accommodate special needs for us. And finally, we wanted to visit with our departments, the users of these devices and get their good and bad as what they liked about our devices and what they would seek future device. So upper to process for copiers. Wasn't we identified competitively bid intergovernmental cooperate contract for these services. These intergovernmental cooperate contracts are useful for us because it allows take advantage of large-scale purchasing power and they are permitted under city code to 0.6, 4. So staff is recommending Konica Minolta for our multi function, print arrangement into the future. Several reasons why that recommendation was made. They offer a out of a device options to meet our needs I mentioned that we want to line some of our special needs with some devices identify couple for you. The police department has a need for printing very high resolution, high-quality in their business and Conoco has a model that will accommodate that and allowed police department do that. We and finance occasionally Pratt, a lot of bond, bond material for a bomb sales. Typically we have to print at the last minute and its vote. Voluminous. So it was advantageous for us to have copper that had that capacity. And again, there is model that serves that purpose as well. These devices also have remote monitoring and diagnostic kept up the capabilities, which is very useful. They also have a variety of usage analytics, which will be helpful for us. And finally, they have a large and experienced staff with local office. So as far as what this will cost us, the monthly expenditures will be 24,924 $1892 a That's actually lower than what we're paying now. Now, our fee has a very little bit of a variable component. So it's somewhere between $505,000 a month lower than what we're paying now. depending on our usage. Second, the ordinance was amended to prohibit contributions from corporations and LLCs. The Supreme Court ruling maintain the political speech is indispensable to a democracy. Which is no less true because the speech comes from a corporation or LLC. A thriving community cannot achieve its schools by silencing the voices of the very businesses it relies upon for its success. The emergency ordinance passed 2 weeks ago took control of our community away from the people that have invested in our city and at the heart of Wichita and has the control over to outside influencers, special interest groups and packs his donors are hidden from view with no transparency. That's where the money is going to have to go. This corporations that have been making donations before publicly to make it through packs. And that's going to be hidden. But in contrast to contributions directly to candidates and the Supreme Court in that case didn't really touch the contributions question and some court since then have said that means we still continue to follow the law that was there before where there can be bans on corporations making direct contributions to candidates. But that is not a statement on whether political committees can do that. And I think the court specifically recognize that was an option that there are these multiple conduit sometimes for corporate entities such as political committees. That's why there there's a difference then between corporations and expenditures, which was important in Citizens United. But then also the focus on corporations it sell for, says other things like political committees. So so with that. >> But I'd be on the line and saying that mostly it dealt with. LLC, ease that had many voices, many, voices, according to the Wichita Eagle today, it's excruciatingly difficult to find out owns all these LL Seas. It's filed with the secretary of state, but the website is cumbersome takes searching document after document. To find the real owners and then so that indicates that that's that's a difficulty. That's not Democratic real. Yes, it's legal. But boy. Is it hidden those hidden voices have many voices for says, will people for we each just have one. We have one vote. And and Asking you today to respect those real people. Voices for says those buried voices. So hidden voices. Are expressed their shrill and their noisy and they are considerably more. And so I don't think that this issue is so much about trying to take away corporations ability for speech. I think it's just about leveling the playing field. It's just about having equity because what makes a democracy work is having more people involved in it. And when you disenfranchise voters, when you disenfranchise citizens, you disable their ability to contribute to the process. So I think corporations, we all have something to gain here by empowering individual citizens. I can't donate $500 to a campaign. That's too much for me. And there are a lot of people like me who can't do that either. You know, we have our actual voice that we can come here and speak with to the city council members. We can reach out to them. We can call them. We can get involved in the city. That's our way of having our voice. But if somebody else can just donate a lot to a cause and then their voices heard louder than ours. It disables our ability to contribute in effective way and a helpful way. And so, you know, maybe if we had a system that was more equitable, all the donations went into a pool and then they were just equally distributed among the members. And you've got a volunteers to contribute to your campaigns. You know, that would allow more community involvement. I very much support local businesses. I think they are the backbone of our city and I in no way and trying to take their voice away from them. And I don't support that either. I I support quite the opposite of just getting more people involved were all on the same side here. You know, we all want the same thing. So we're just kind of pointing out how these systems affect us. And when we saw the election where one candidate got 200,000 and they won by a margin. It was just like, well, I think a little alarming liked. Do we not have an impact on this like I can't can can't compete with that. You know, so it's like it's nothing against any of the candidates for getting these large, you know, contributions together. It's just keep in mind that there are people that don't have money that still need to have a voice and how the city is run, especially when those powerful systems are affecting them. So drastically. I didn't ever expected to be in politics. Through some. Prayer side to get I went file. And then the basement of the courthouse and I ran into Councilman we had very nice discussion start off. I think I think a good friendship. He said JB. He says that. The person ran against me out out. Raise money, raise more lot more might that I did. But I went knocked on doors. That's how I got elected. And time and time again. People tell me you want to get elected, you got to knock on doors. they saying about raising money knock on doors? And so we did. We knocked on 7,000 over 7,700 doors. Our team did. I personally knocked out 2,432 doors. 104 degrees. Skaters by me. Still got some bug spray. and all kinds of weather. And I got to really it was a wonderful experience. I'd read every night. not doing that. For 5 nights a week. But once I got out there, I loved it because I loved talking to people. And get to see where they're at and what's important to them. That that's how you get elected is not by raising money. I will tell you that that my campaign, if you pull my reporting courage, you do. It's mostly individuals. Almost all individuals. The ARL sees maybe a corporation or 2. That contribute it. Some of those are from people. We're a gift from their business and personally, some of gave both. I will tell you that Justin's clothiers. Now this 2 years ago, after 107 years. That was a corporation. It's not a big mean corporation. It's a little local company. There's a lot of companies have different structures and town here. All of minor local. They're not from out of state, all local people that want to voice. I will. I appreciate comments about packs. If these people, if you take away people's voice business, people's voice, they'll go underground. Councilman Glass Point point we're going to packs which are legal right now, even after ordinance backs are legal. Dark money is legal. It just pushed underground. I know who it is. I'm I'm I just think what we need to have. Everyone haven't had voice, including businesses. Just to let you know that how you get elected, just knocking on doors and talking to people, which is the way it should be. Which is the way it should be, because then, you know, but the people are thinking and know what they want. thank you. >> Good morning. Celeste are set which China native born and raised here, graduate of local public schools with an accounting degree from KU in an MBA from Debbie issue. I'm against any change that was finally passed. Former vice Mayor Jaisol last election cycle. We need to restrict businesses to your comment. Councilmember Johnston, because when you're over a 6 to one and you're a grassroots campaign with volunteers working the streets and, you know, I knocked on doors too. You cannot compete against nearly a million dollars being spent on TV ads. Millers Flyers paid staff campaign strategists it just possible it's really not. I used work for the FBI say you may not know this as a fraud investigator and I went against big payday lenders and corrupt individuals and they had one thing in common. They wanted money and they wanted to continue to get money through any means possible. Money is a great character. And truly, I feel like businesses have a voice here. I've seen it in the failed West Bank development where we give subsidy after subsidy after subsidy to those businessmen who got her land for a dollar, an acre and we still don't have that development on the West Bank. So do businesses have a voice here in Wichita? They have an outsized voice and I hate to stand up here and speak against this new council, but I'm going to do that today because I've been a chief internal auditor and I've always tried to stand for integrity and fairness. And we have got to take money out of elections. We truly do. But let me step back and say I sincerely wish you all well. I'm glad to see that you're up here representing Wichita's. So let me just start by saying you made promises and all of your campaigns. That was the easy part. He promised transparency and trust to be restored. And city hall. And the hard part now is in front of you. You've got to live up to those promises. 73% of which times don't trust City Hall. You've got to restore that trust. You've got to be transparent. You've got to be held accountable. Don't start this by changing campaign reform. That was finally passed. I waited on it for 4 years. There are so many problems facing Wichita. We've got homelessness. We've got aircraft industry problems with Boeing and spirit. They're going to shake our economy. We've got Louis City financial deficit facing us in 2 years with the dead on the ball stadium. Are you aware of that that but it's going to drop out of the ball stadium and it's going to come out of the general fund. My gosh, you guys have so many things you need to do. So I'm puzzled. Why is your first order of business and doing this campaign were for it really be finals. Me. Which it has never allow businesses. An LLC is to give money to political campaigns. Only individual citizens could contribute money. But then in 2015, the former mayor and city council voted unanimously to overturn those restrictions. And now elections have turned into a money game. It is difficult. I'm speaking from the heart for grassroots candidates to campaign and compete business insider's remain anonymous Snare LLC. I KM LLC up in NL all see Broken Hill to Broken Hill. Surrey, numerous campaign contributions from one 50 north market and you that are business people know who that is. We had a speaker. Those are real estate developer coming over and over again. That adds up to thousands and thousands of dollars. So here's my request. Take your time to evaluate this new ordinance. Put some thought into it. There's a lot of questions going back and forth to legal that show. You really don't understand the full ramifications of this on January. First of this year, the corporate Transparency Act. Are you aware this was passed by the federal government? And I used to work with fence financial. I I will go into the detail. That fence concerned about corruption of businesses and this took effect this year on January. 1st. This information behind LL season businesses as part of this new act. And it's to require transparency and accountability from individuals. I want to see that change to this legislation. I want to see you make it transparent and I want you to honor your promise. Ease your legacy has started. Don't let it be marred by special interest groups hiding behind LL Cesar business entities. Please be accountable. Your legacy has started now. Councilmember title. >> Thank you very much. we had this discussion just a few weeks ago. I'm going make some comments that are going to be redundant. But my opinion hasn't changed from then. >> My first point is to make that I do believe the January second, but was not an emergency. So folks mentioned that and we're in agreement. I question if the emergency of it and but I said I appreciated the discussion. My next thought, sir, that I really do believe that going reversing this will increase transparency. I stated last last time we discuss this that in this way elsie's and individuals all have to list their camp. We have to list their contributions on our campaign. I think there's going to be some steps to make it even more transparent, which interested in hearing more about. I mentioned last time we discuss this as well is that there is state law. And we have an ethics policy. We worked really hard here within the city of Wichita to have an ethics policy. Those are appropriate guardrails. If someone feels that a candidate is being unduly influenced because of a campaign contribution that is legal. According to our state law, then they have a mechanism to be able to report it to our ethics advisory board and go through the proper channels. I do have little. Issue with the fact that people are assuming if you receive illegal campaign contribution that you are being unduly influenced. And and that you're doing backroom deals are that you're suffering from corruption. I've never seen a backroom deal. I've done a back room deal and no amount of money and the individual or corporation would give me would ever lead me to that. So I just want to caution people from assuming campaign contributions make people correct? I don't think that's the case and I haven't seen it. And if I had I would report it to the appropriate authorities. One of our speakers today and I appreciate everyone who has been here today said that's his voice would be drowned out. And again, that's just making some assumptions. There are, you know, candidates who may be. Have influence, but not all. And I just I don't want us 2 taint the entire system. And I listen to every voice and I give anyone who wants to talk to me any time. I probably don't even know he contributed to my campaign or not. But I just want to make sure that we understand we have state law. We have an ethics policy. I feel those are the appropriate guardrails and I don't think we need an additional layer of government to make sure that we're following the rules. Finally, I just want to mentioned and businesses. I do believe they have a said this last time. So again and being redundant, businesses pay property, tax businesses, pay sales tax and they should have a decision in the way that our community moves forward. Businesses are job creators and they help grow our economy, which is good for everyone. So again, I will be supportive of allowing Elysees to be able to make beagle campaign contributions following the state law. Thank you. >> Councilmember Glasscock first off, I want to say this is democracy and this is what can happen when we don't declare something an emergency and we go through the normal process of democracy because people can have the chance to come and speak before this body. And that is part of our Thank you for being here today. Thank you for your comments and thank you for your comments that you Facebook the email via calls in every form of communication. It was great to see this room packed. I want to see that more often as well, because that's how our system of government should work. We all want every single person of bench, every single person in this room once accountability and transparency. That's why we're here. That's why I propose ordinance so we can have more transparency and more accountability as evident by one of the speakers presenting mailers. Only 3 of those mailers were sent from a candidate's committee. Every single other one of those mailers was sent by Political Action committee or an organization. And this will not change that. And if anything, this will allow more accountability for the candidates and more transparency of who is contributing to those candidates for this process. That is the goal. That is why we're here today. And that's why does restore more transparency, accountability because cannot control the political action committee. Does. We cannot control someone the sun's out a mailer that is not on our behalf. And so the more money that goes to a candidate's committee and said a political action committee or LLC actually restores more accountable accountability and transparency and you can hold us accountable through this process. In addition, there's really no classification has asked legal counsel between a political act of committing LLC. If any LLC can also for political act. Action committee starting tomorrow, they're still able to do this process. And so I know some people espresso. They had concerns of Citizens United and that they feel there's too many in the political process. We also can not supersede the Supreme Court change that decision. The Supreme Court's ruled on that and we're held to those standards. And so I understand your concerns about that. But that is not for this body to make or change that decision as well. In addition, I just want to articulate that we're doing this because of transparency, accountability and to I think furthers this discussion. I'm going to make a motion so we can also talk about this as a body as well. And this is to restore more transparency accountability because I understand that you can access who donates to from an LLC who are the managing partners. But I will make a motion to amend section 2.0. 56 point '02, by adding the following sentences as well. Such report shall also include the names of the managing member or officer responsible for making a contribution from LLC and the names of officers directors, any one of the financial interests the corporation making a contribution. This information is public through the secretary of state's. This does not require additional burden for businesses donating, but it does require work and accountability from us to be able to make sure that we're doing the work of what do you know who's donating and that there's a point of contact for a business. You can also reach out to you if you have concerns. So again, no additional a requirement for a business, but it does put a another burden on candidates be able to offer more transparency and accountability the process. So with all those comments, I think that motion's we can have a discussion about transparency. Council Jaisol. >> I popped up a little first off, I'd like to just say thank you to everybody who showed up today on both sides of the aisle I see a lot of the people I love and respect on my side and I see a lot of people I love and respect on the opposite side as well. So I do want to put that out there. Thank you all for showing up in expressing your your opinion on this just a couple of quick point. I'd like to make Citizens United and the case staff have followed since. Does acknowledge that we have the option of limiting Elsie's any of our elections. PACs that that is a difficult one. That is one that we have gone back and forth with with illegal. I have 4 or 5 ordinances that we've drawn up and for some reason or another they would fall off because of some concerns the legality. If you study citizens United, you would see some packs are limited and have the ability to be limited. Some Paxton, not so that one pretty difficult issue to pass parse through also. And I brought this up earlier, sole proprietorships and partnerships are protected under citizens. United. That again is also why the last ordinance look the way it and that is because of Elysees I do appreciate The changes were transparency here. I really do. But according to my feedback that I hear from the people out on the street. It's just the presence of money to begin with that they have the problem with. I don't have any issue with individual businesses. The mom and the pops expressing their freedom of speech. That's not what this was designed for. The issue that I see coming up is multiple elsie's that are controlled by the same person, essentially we we've talked about it up here. Members of our community who have 30 elsie's and this is something that we see in particular areas of employment, areas of business there there certain types of businesses who have to have multiple elsie's too guard against holdings? So the people who are involved in that have a natural through the process of their own businesses and natural pathway to be able to donate time and time and time and time again. So it's not a matter in my mind anyway, as a matter of $500, a matter of of the $1000. It's a matter of people who could theoretically donate. $10,000 to a campaign. And that is a very real possibility out there right now. So that was the attempt to obviously want to stick with what we have currently. But I do appreciate the debate up here. with that see the floor to my colleagues. >> Councilmember Ballard. Thank you, Mayor. >> My biggest concern is this is the first. This is the first priority of the new Council. >> For what it's worth, it's not businesses be allowed to give to campaigns. That bothers It's the way it's used to avoid the campaign finance limits. I took money from some businesses during my campaign. And I appreciate the support. In campaigns. You have to play by the rules on the board. But I also did not take multiple contributions from the same person hiding behind different business names. This creates an unfair advantage for Some people over others. And I want to create a level playing field as much as possible for city elections. I'm concerned that the new council is focused doing the work we've already done to create a more level playing field instead of wanting to work things that could make our elections more fair. During my time on council, I've had good meetings and build relationships with a lot of developers and business owners and that and come up with things that work for everyone. Most importantly, these deals work for the people of Wichita in District 6. The bottom line is my vote is not for sale and we should maintain the value councils going forward thinking. Council member John that. >> Thanks, My comments home be too much of a surprise. First, I want to thank everybody who came here today to speak to us on your view on this. Also want to thank council member Glasscock the amendment, the transparency and acknowledging that many of us would like to see more of that. Also would like to clear up a few some on line and some of the emails I've received regarding process as was mentioned at the January second meeting council member Ohio brought this up more than a year Just never made it to the bench. There were members, former members of this body, one in particular that continue to encourage us not to bring this up during an election cycle, although would not have a pet impact of the 2023 election. Therefore, you saw the come up at the end of 2023 and think that pushed to the beginning of 2024. That process was one in which we talked about and there was a public meeting and I'm still looking for to give you the date time and part of that meeting in which a former council member, I actually said that and the public that the shouldn't be talked about again, it was talked but we did not have the meeting about that many folks will want. Earlier today. It was mentioned that this is democracy and this is public engagement. This actually happened on January second because it was a council meeting and it was item. The difference was the emergency declaration, which would have meant that instead of this ban on consent agenda at the next council meeting. It could have been pool at that point. Again, the council members don't pull of gender item on consent. It's not talked about publicly. So there's one opportunity to discuss like we're having today. I won't get too much into Citizens United, but I did not agree with that when it was done. Also did not agree with this council that this council, former council and 2015 when they allowed a little sees to give and I'll give you a different approach. I'm not demonizing any business. Any business leader. I just think it's better if a candidate has to talk to humans get money for him full transparency. I received money from Mel C's, I believe in playing within the rules. That means if this does pass, I hope every candidate place within the rules. If you choose not to take money from Elsie's that is on you. If this does pass and that means you have to go back to the days of talking to humans. It's interesting. This comes up after MLK weekend. I had the opportunity and mayor and council member class copper there as well to attend the Brewer Insta too kind of gathering, talking about what we were doing. 4 supporting former Mayor Carl Brewer. And there were some folks talking about how loved he was. He was so loved businesses that could not give. There are a lot of people within these businesses that gate the difference between his finance report and maybe some of mine, even with the LLC contributions were you saw the names so addresses and you saw the company that these folks work for. Those were humans. When you have LLC is again, not demonizing. Sometimes you have trails of LL season. You don't know that person We've seen that with housing. I want to take us to house and but there's places in Wichita where there's 13 different ll season. There's a trail to get there. So there's a challenge sometimes of actually knowing behind those elsie's. But at the end of the day, every business owner is a human. And those humans can contribute and they can vote. What's not fair in the situation? Is that if I owned a business, I can get $1500. Why is that? Well, me and my wife can give 1000 and our business can give 500 if you don't have a business, you can't do that. So I have an unfair advantage. Also legally nonprofits can given the money. And I don't know if we've talked about that, but there's more than 3,000 nonprofits in the city of Wichita. And as we talk about collaboration and working together, those voices will not be heard. But the board members and executive directors can contribute up to $500. I don't see where there should be a difference. And it's not again, about one business giving $500 having some undue 2 time candidate can tell you, $500 will not me. I'm pretty sure won't sway anybody on this bench. But if you have somebody who has 34 elsie's that can raise you $500 from each of those that person may influence. You may pick up the phone faster, but that person calls because, you know, they also can organize those 34 elsie's against you in the future. I do believe the best way to win races, to talk to people. You can for contributions, knocking those doors and those phones money helps because you got to pay people to help out with that. Sometimes. But argument for me is that we should have never done that in 2015, which is why council member brought this up to me. I was supportive for nonprofits can contribute. Then I think the for-profit elsie's should not be able to as well. But I do appreciate this last amendment that would offer some form of transparency. And again, if if it does pass, when you look at finance reports, you might be surprised to see one particular name multiple times. And the question then systems. Business is not a human humans behind the business have the ability to get much more money than any single individual. I'll stop there. And you will see if there's if there's 30, I don't think there going to get 30 donations. But if there's 2 or 3 donations from the same person will be able to see that. So I I appreciate that. I think that we should be transparent that. I appreciate. I shows that when we have genuine debate up here, we can build consensus and we can figure out a way to make our ordinances better overwhelmingly on the last point. But all say again, this is putting on a behind it. This is putting more accountability and transparency than the current process because as the example counter Johnson said we're ahead his wife. They have 2 businesses. They could donate up to $1500. They could still under the previous ordinance passed January. Second, donate to political Action Committee. I have no accountability or transparency to a candidate. Now, if they do it to a candidate, there will be more transparency and accountability than previously. And so I'm appreciative of the work of this body to make it a better process and thankful for the public as well to help engage in democracy to make this more transparent and accountable process. So we had that conversation that it didn't seem like that was a priority. The previous council do so. It just seems disingenuous to have not done that when we have the ability to do that previously. Council member. Councilmember Johnson. Police between myself, a council member who a we did want to see that >> Either right before or right after the election, there were some internal questions from. Other former council members that kind of continue to push that. And I believe we were supposed to originally maybe have the first hearing of that December 19th. I think. But there were some more questions and again got pushed to January 2nd. Or the question from Vice Mayor Ballard, I wouldn't mind this coming to district advisory board. I think to councilmember Glass car. I know one councilmember first that that was the plan to get all of that engagement But sometimes some of us continue to. Bush on staff, too, at different things. Look at different banks gets delayed. Some of that timeline had one out of the window. But again, think it was a year and a half that this had been been talked about. We talked about it in a public setting at a workshop. Unless this body changes process. We don't always go to the district advisory board. Oftentimes there's a proposal to. Have an ordinance or repeal. The last thing we had manager Anderson. And I think we amended. 20 different things and different ordinances that did not go to district Advisory Board of workshop. So we talk about in a public setting. But the public cares to email us or talk to us. They will and they will vote on it as a council. So I in this case it really wasn't a disingenuous thing is since we have multiple ways to process ordinances and that was not one of the time. But given what we've heard today and at least to emails I've received in support of what happened on January second, it would make sense to have a broader community discussion about why we would go back to that wind up until 2015. It individuals 2015 action. And we're back to look. I think it was. Generated from Citizens United and maybe some members of that body to try to align with that. But up until 2015, humans contribute it. I think I think it's a great suggestion by the vice mayor to go to have broader conversation about that. >> Council member John stunt. Thank you, Mayor. But the non-profit boards and I have shared in the past the data. past any council person can bring an agenda item forward during the meeting. Is that true or not true that this council? >> That's correct. Councilmember, it can bring off agenda item with a vote of the majority of the council. >> Okay. I certainly member couple council members could not block. For bringing something up to the council. But what he's and I don't believe so. No, okay. just want to clarify that. It could be brought up and that 2 month period that could have been a debate that the dabs there could have been debate public debate and there there wasn't. So maybe help us with a breakdown of how that happened in 2015. I believe we were looking at changes to the charter. If staff then has a bunch of questions of what type of leather is there a parent? Councilmember whole Weisel said I want to have a West High logo in the middle of it. All of those things would have to talked about at some point, maybe some research that would take time. So while a member can bring an members also can request additional information at 2. Question. Even in the public, like a former council member do it. Why are we doing this now? And staff has to navigate all of those things. So it may not happen exactly when you are. As a council member, whatever that item might be sofas again, leather seats. West Harlow goes, that's how things can slow down sometimes. And it's not a it's not a bad thing. It's just gathering information, making sure there are some idea of what a final product would be when it comes to campaign finance. I will tell you Misha Lee. I disagree with Councilmember whole well because I said if we Banned LLC is we should packs and everything else we needed to get clarification. Jennifer and others and legal want to see if that was even possible given Citizens United and all of that research. So sometimes it just takes a while. It's not you want to do something. I say no. And it stops its getting all the background information, making sure it's there making sure he's ready for public consumption. But just please keep that in mind. So here's a We've additional graphics that will help explain this. But essentially what is happening is that the property owner has been able to acquire some additional properties. The and it's multiple properties and those properties are in existing see up See up is an additional layer of zoning on a property. And so what they would like to do is remove those properties from those existing see up consolidate them into one existing, see up and then modify that existing see up and all walk you through the slides to help show that. But first just a brief overview and then we'll get to that. So in terms of this as I indicated, also asking to rezone their properties. 2 general commercial. They're and they're currently LC. They're requesting remove their properties from other community unit plans to consolidate them into an existing. As we call it see up and to update the provisions of that see up. So this item is being heard today because the dab in the planning commission recommendations are different. And protests have also been received against the application will show you the location of where those are. So again, please note there's is a single staff report, but is for 4 different but related cases. And so you're you see in the recommendation section of the staff report that there are 4 different motions and staff are recommending. But the council make 4 separate motions. One for each case. In terms of the request, the applicant has indicated they're requesting zoning actions in order to allow for future development and that these actions will greatly simplify the zoning for the subject site. In terms of the property. The subjects site is generally located to the north and west of Kellogg and Web. It consists of 10 parcels is just shy of 40 acres in size. The properties are currently zoned LC Limited commercial district and some portions are vacant. Summer developed with hotels. Properties to the north. The subject site Zone General Office Ngc the G O zone property of of flip to that later is developed with an office complex and the GC Zone Properties dealt with and athletics facility. The GC Zone Properties within a C up. Properties to the south Callan are zone GCL Si. L I limited industrial. The GC Properties are within ABC up and dealt with car dealerships. The L I zoned properties developed right of way for the highway. Properties to the east are lie and located within unincorporated Cedric County and the city which time. The property that is in the unincorporated Cedric counties dealt with a private airport complex. The property in the city which has developed with the Wholesale retail store. Properties to the West across Jim Creek are zoned 5 and M F 29 multi-family. portion is developed with the commercial building that is currently vacant. properties are developed single-family residences in the N F 29 properties are developed with duplexes. Terms of the staff report the staff report provides information about what is being requested the different development standards that are recommended and also requested. So that covers land use structure heights landscaping screening, setbacks and signage. In terms of review and December 14th, the Planning Commission held a public hearing for all of these applications and recommended approval of all for 10 to 0 subject to staff's recommendation. For individuals from the public spoke in opposition to the request with concerns about opening access from Bonnie Brae subdivision, closing access to land to the north from the Marriott Hotel. The intensity of uses allowed the GC zoning drainage from the development drainage from the development into the gym creek and the size and location of off-site signs. On December. 11th, the District Advisory board consider the items the dab took the following actions. They made no recommendation for see up 2023 dash. 41. They made no. And that was because but I vote. I mean, no recommendation for see up 2023 dash. 42 again. That was a tight vote. They recommended approval of the see up 2023. 43 5 to one on the condition of the screening in landscaping requirements. Be per the unified zoning Code and recommended denial of the zoning case. 2023. 67, that vote was 42. Now because of the intricacies of this case by recommending denial of the zoning and recommending approval of this up. Those are actually in conflict because the sea up was written with the intention that the property would be zone GC. And that is not advisable to approve one. And tonight tonight, especially not to deny the zoning with approving that see up just because the complexities involved in that. 4 members of the public at the debt meeting spoke in opposition with concerns about access. And Bonnie Brae subdivision drainage into the gym creek and intensity of uses allow the GC zoning in size and location of the on-site signs. In terms of protest. 5 protests were received for the request. A zone change which equaled just over one percent of the total protest area. And I'll show you a map that illustrates says it does not meet the 20% threshold. All for the requests can be approved with a simple majority vote of 4 of 7 votes. In terms of recommendation. And again, a note here that this is a single staff report, but 4 different cases. So it's recommended you make 4 separate actions, one for each case. And the recommended actions are identified at the bottom of the staff report, as is typical. So for all 4 applications, though, it is recommended city council adopt the findings of the Planning Commission approve the requested zoning change place. The ordinances on the first reading authorizing necessary signatures and struck the city clerk to publish ordinance after approval on the second meeting. Again, that would acquire 4 of 7 votes. A simple majority. As always, you can return You can override him. A PC provide alternative findings that I want to warn the applications This would require 5, 7, votes. 4, you know, we turn one or more of the cases to the planning Commission for additional consideration. They require 4 of 7 votes. And again, just a quick note about the process. public comments typically happened at the Planning Commission meeting. So here are the graphics of try and work through these. I think they'll be very helpful for explaining what's going on. So this is the black outline that you see on the screen. Here is a current boundaries. See up DP Dash 1, 1, 6, And a what the applicant again is requesting is to remove their properties from this up. They have some properties that are in this up. They want to consolidate into a different piece. What they're proposing as a result. What would happen by removing him properties at the orange boundaries are under yellowish boundaries is what would result from that removal. this is an existing see you PDP 15. What they're proposing to do is to consolidate their properties into this, see up. And they've got some modifications to the language for this up about what it allows and does not allow, but its boundaries would expand to take in all the applicant's property, which is outlined in the Orange hair. The next one then is another existing see up in the area again, if as the applicant proposes, they cut out their properties, remove it from this up. You can see that would shrink in size to the area that outlined in Orange. All right. This is the zoning There's a lot going on here. Just know that lot of the area, zoned commercial either general commercial or limited commercial. There's industrial to the east and there's a number of different see up overlay this base owning in play. we've talked about the ones that specifically referenced in this case before. Says the map from the comprehensive plan. It shows a employment. What's recommended in this area. This is the a map that shows notification area and the protest area. In this case, you'll see that the protests area actually expands quite a bit. When you get to the east. That is because it it's running into the unincorporated county and extends 1000 feet into the unincorporated county. You'll see the red and yellow and blue on the west side of the subject site. That is where the protests petitions were submitted some of them were invalid because we are missing the necessary signatures of all the owners and the ones that were in red were in the protest area. The port blue portions were outside. Again, the protest calculation was less than 20% so you can improve with a simple majority. Here are photos from the site. And surrounding properties. And then last know that I'd like to address is that some of the public comments that came in during the planning Commission during the dab. members of the public expressed concerns about a bridge over that Ship Creek and a connection to the Bonnie Brae a neighborhood. I can I can tell you that is not being proposed. There's not funding in the city cip for that. They were comments that were received. there's nothing that that I can say this time.
