thank you and welcome again to the Mesa city council meeting for March the 6th of 2023 our council is all here except for Ms Pillsbury who's ill and his excuse from this meeting we will begin the meeting with an invocation offered by Pastor Jose Luis Amaya from the Iglesia de Cristo had a Bethel Church followed by the Pledge of Allegiance and so please stand for the invocation and remain standing for the Pledge of Allegiance good evening everyone God bless every one of you and mayor thank you and thank you for every one of the council members and we thank you for all you do I was downstairs listening to all the plans for this really really great responsibility and that's what we're going to do pray for the Lord to give your strength to you to your families to keep doing the best for us and we thank you all pray father we thank you we invocate your name we're so thankful for everyone here today and father you know all the plans that they have in mindness in their hearts which is asking for strength asking you for keep him safe for them and their families and also to give him wisdom and every aspect of their responsibilities we thank you once again father in the name of Jesus Christ amen amen thank you thank you Pastor please join me in the Pledge of Allegiance I pledge allegiance of the United States of America and through the Republic for which it stands one nation under God indivisible with liberty and justice for all thank you the first item on our agenda in this meeting is our consent agenda so we'd invite Mr Kevin Christopher forward to read the consent agenda thank you good evening mayor and council members these are the items in the consent of General items listed within asterisk will be considered as a group by the city council and will be enacted with one motion there will be a separate discussion unless a council member or a citizen request in which event the item will be removed from the consent agenda and considered as a separate item item two approval of minutes of previous meetings as written item 3A acting liquor license application for vero's Chicago Pizza West Mesa 2057 South Alma School Road item 4A approving contract for Central Mesa reuse pipeline construction manager at risk guaranteed maximum price number one item 4B approving use of a Cooperative contract for an initial term of 15 months and two years of renewal options for front load refuse and Roll-Off Containers for the solid waste and Water Resources departments item 4C approving three-year term contract with two years of renewal options for residential refuse and recycling containers for the Solid Waste Department item 4D approving purchase of five replacement pumper trucks for the Mesa fire Medical Department this purchase is funded by 2018 Public Safety bonds item 4E approving dollar limit increase to the term contract for biosilos removal and reuse disposal services for the Water Resources Department item 4f approving a one-year term contract with four years of renewal options for pipe repair clamps for the materials and Supply Warehouse for the Water Resources Department item 4G approving use of a Cooperative contract for a 32-month term contract with a two-year renewal option for equipment rental and related services for the energy resources department item 4H approving contract for Transformer maintenance services for Lewis West substation for the energy resources department item 4i approving two-year term contract for video display scoreboard components Event Services for ho cam Park and Fitch practice fields for the parks recreation and Community facilities Department item 5A approving a resolution accepting the American Rescue plan act funding approving the allocation plan for the funding and submitting the plan to HUD for use of the funds item 5B approving a resolution to enter into an advance construction authorization agreement with mag for the Elliott Road East Maricopa floodway to Ellsworth Road arterial Improvement project item 6A introduction of ordinance regarding zoning case 22-1270 for property generally located west of Country Club Drive and or the Baseline Road rezone the bonus intensity Zone overlay Council use permit and slate plan review to allow for Social Service facility item 7A approving ordinance for zoning case 22-1024 located south of McClellan Road and East of Val Vista Drive rezone the new planet area development overlay to allow for a seven lot single residence development and item 8A approving subdivision tech center at Ellsworth for property located south of Pecos Road on the east side of Ellsworth Road mayor and council members these are the items on the consent agenda mostly do we have any requests to speak on an item on the consent agenda no mayor we do not thank you then we have a motion made by Mr Summer seconded by Mr Freeman please vote thank you that passes unanimously with council members Pillsbury absent and excused next item on our agenda is item number nine items from citizens present Ms Mosley I have one card you have any other cards thank you uh David land Pastor land we're happy to have you here with us you have three minutes thank you all right my name is David Land Of A New Life Assembly of God Church 314 West University Drive for three years New Life Assembly of God has used Evergreen Park to host a neighborhood Easter egg hunt for the kids within the vicinity of the church during this event we gave away bicycles scooters gift cards along with other prizes the first couple of years there was never a problem last year we were charged a fee but this year we met a new obstacle we were told that Evergreen Park is a non-reservable part because there are no restrooms there were no restrooms there before but now that's an issue it was suggested that we moved to another Park such as Pioneer but moving that far away from our neighborhood defeats the very purpose of the event we were then given the option to use the park if we agreed to supply a porta-john but it should not be our responsibility to provide Porta-Johns for city property also I received a follow-up email from Parks and in it it says our main concern is having children in the park for more than one hour without restroom access and that is why we're willing to limit the Park rental to one hour without requiring Porta-Johns in the park as one person told me we don't want them to pee behind a tree question why are people allowed to hang out all day in the Gazebo area without restrooms and since they don't have homes across the street to go to where do you think they use the restroom the lack of restrooms were never an issue before but now they are evergreen used to have restrooms but the city removed them why I am told it was because of the amount of negative activity and vandalism in that Park that did not warrant replacing them but I'm bothered by that reasoning because it tells me that our city leaders decided to walk away and let the vandals and the people doing illegal activity take over why are we allowing our city property to become homes to people who do not have the best interest of our residents in mind the homeless the panhandlers others who are allowed to trash our area seem to have free reign you're concerned about kids being there for more than an hour and if you don't want them to pee behind a tree but people can come on our private properties and businesses and defecate all over and leave garbage for the property owners to clean up to me that's not acceptable so I'm challenged and challenging and asking you to protect our city parks make them available for good organizations to use them for the purpose of doing good in our community I'm asking you to give our area the attention that you've given other areas that do not and do not let people ruin it for the good people who live and work here I'm sure there's someone who could figure out a way to either put restrooms back in the park manage them eliminate the vandalism and illegal activity keep our city parks clean and safe and free from the homeless and the illegal activity so we're able to use our park in the future without of hassles maybe restoring our park rangers to full capacity again would be a start if not then excuse me then let us use the park without the restrictions so thank you for the time thank you Pastor land as you know we can't uh respond because it's not on our agenda but thank you we'll follow up I'll take care of it mayor thank you very much that concludes all the items that are on our agenda for this
