February 16, 2021 City Council Meeting

The City of Hermantown's February 16, 2021, City Council Meeting

This transcript appears to be from a Hermantown City Council meeting. Please note that while the provided list of officials includes councilors Geissler, Peterson, Hjelle, and LeBlanc, the transcript explicitly references a **Councilor Nelson** and a **Councilor Hauschild** (phonetically transcribed as "Hostchild") participating in the meeting. I have included them as they are clearly part of the proceedings. [0:00] **Mayor Wayne Boucher:** No public hearings for tonight. Mr. Mulder, would you highlight the communications we need? [0:00] **John Mulder:** We included three of them in your packet. The first one is just information—a grant to Mediacom for broadband in the western part of the city. That grant was awarded to Mediacom, not to the City of Hermantown. We will be working on that to provide a small match for that, and that will come back to the City Council in the future. Next one is just for your information about liquor license fees from the AAD Shrine, and we're going to make a recommendation to you regarding that at the next meeting. And finally, just an update from the Duluth International Airport zoning ordinance from the Department of Transportation. [0:45] **John Mulder:** That's a work in progress and we'll continue to move forward on that, but that's just for your information at this point. [0:45] **Mayor Wayne Boucher:** Thank you. And we have no presentations at this meeting. Public discussion: Is there anyone present at the Zoom meeting that wishes to speak to the Council about any item? If so, state your name and address for the record. Is there anyone present at the online meeting that wishes to discuss anything with the Council at this time? If so, state your name and address. With no public discussion, we will move to the consent agenda. [1:30] **Mayor Wayne Boucher:** Do we have a motion? [1:30] **Councilor Nelson:** So moved. [1:30] **Councilor Joe Peterson:** Second. [1:30] **Mayor Wayne Boucher:** Second. Motion, Nelson. Yep, Councilor Nelson. Roll call please. [1:30] **Alissa McClure (City Clerk):** Councilor Hauschild? **Councilor Hauschild:** Aye. **Alissa McClure:** Nelson? **Councilor Nelson:** Aye. **Alissa McClure:** Peterson? **Councilor Joe Peterson:** Aye. **Alissa McClure:** Geissler? **Councilor John Geissler:** Aye. **Alissa McClure:** Mayor Boucher? **Mayor Wayne Boucher:** Aye. [1:30] **Mayor Wayne Boucher:** Motion—a motion to approve or deny the following liquor license: I-Mart Stores, 4221 Haynes Road, for 3.2 malt liquor. Do we have a motion? [1:30] **Councilor Joe Peterson:** Motion to approve. [1:30] **Councilor John Geissler:** Second. [1:30] **Mayor Wayne Boucher:** Motion by Councilor Peterson, second by Councilor Geissler. Mr. Mulder? [2:17] **John Mulder:** This is a new liquor license for the 3.2 beer at that existing service station or convenience store that has recently changed. [2:17] **Mayor Wayne Boucher:** Thank you. Any questions or comments from Council? Councilor Geissler? **Councilor John Geissler:** No comments. **Mayor Wayne Boucher:** Nelson? **Councilor Nelson:** No. **Mayor Wayne Boucher:** Peterson? **Councilor Joe Peterson:** No. **Mayor Wayne Boucher:** Hauschild? Is there any public input on this matter? Any member of the public wishes to comment? With no comments, we could have a roll call. [3:02] **Alissa McClure (City Clerk):** Councilor Nelson? **Councilor Nelson:** Aye. **Alissa McClure:** Peterson? **Councilor Joe Peterson:** Aye. **Alissa McClure:** Geissler? **Councilor John Geissler:** Aye. **Alissa McClure:** Hauschild? **Councilor Hauschild:** Aye. **Alissa McClure:** Mayor Boucher? **Mayor Wayne Boucher:** Aye. [3:02] **Mayor Wayne Boucher:** Next motion is to approve or deny the following tobacco license of I-Mart Stores, 4221 Haines Road. This is a new license because the business has a new name, a new operator—the business has been there for several years. Do we have a motion? [3:02] **Councilor John Geissler:** Motion to approve. [3:02] **Councilor Joe Peterson:** Second. [3:40] **Joe Wicklund:** Looks like they may be dropped off. I think we lost the Mayor. Yep, hang on, let me do a little bit of work everybody, if you don't mind holding tight. Master control... [4:10] **Councilor John Geissler:** What was supposed to be the model? Be patient and be kind. **Councilor Joe Peterson:** Can do that. **Councilor John Geissler:** Yeah, we can do that. I was having a little technical issue on mine so I'm on my phone because my computer was just turning. So, it's one of those nights. **Councilor Joe Peterson:** Yeah, I think so. One more cold night. Although I went outside—been outside since seven this morning—and I went out, moved my truck out of the ramp to in front of the office and it was like a heat wave. It was eight degrees. **Councilor John Geissler:** I know, we had... I was doing some installations at the airport today and it was melting the roof, everything. I was like... [4:56] **Joe Wicklund:** Well, that's lovely. We had a—we got booted off on the computer that runs all the AV so it should be on shortly. And if it's not, then I'll just move my computer inside and we can kind of make it work that way. **Councilor Joe Peterson:** Okay, we can be patient. **Joe Wicklund:** Thank you. And kind of listen with grace. **Councilor Joe Peterson:** Yeah, it was like 25 below when I came in and now it's eight above. You know, a swing of 30 plus degrees. It was like, wow, we couldn't believe it. I know. Are we back? Eight degrees never felt so good. [5:43] **Mayor Wayne Boucher:** We're going with the motion to approve or deny the tobacco license of I-Mart store. Motioned by Councilor Geissler, second by Councilor Peterson. Is there any Council comment on this? Councilor Geissler? **Councilor John Geissler:** No comments. **Mayor Wayne Boucher:** Councilor Nelson? **Councilor Nelson:** No. **Mayor Wayne Boucher:** Councilor Peterson? **Councilor Joe Peterson:** No comment. **Mayor Wayne Boucher:** Councilor Hauschild? **Councilor Hauschild:** No comment. **Mayor Wayne Boucher:** Is there any public comment on this matter? No comments. Do we have a roll call? [5:43] **Alissa McClure (City Clerk):** Councilor Peterson? **Councilor Joe Peterson:** Aye. **Alissa McClure:** Geissler? **Councilor John Geissler:** Aye. **Alissa McClure:** Hauschild? **Councilor Hauschild:** Aye. **Alissa McClure:** Nelson? **Councilor Nelson:** Aye. **Alissa McClure:** Mayor Boucher? **Mayor Wayne Boucher:** Aye. [5:43] **Mayor Wayne Boucher:** We have no ordinances this evening. Resolutions. Resolution 2021-22: Resolution authorizing and directing Mayor and City Clerk to execute and deliver an agreement for engineering services with a total not to exceed contract amount of $266,927 for Road Improvement District Number 534, Hugstead Road, with MSA Professional Services Incorporated. Do we have a motion? [6:28] **Councilor John Geissler:** Motion to approve. [6:28] **Councilor Hauschild:** Second. [6:28] **Mayor Wayne Boucher:** Motioned by Councilor Geissler, second by Councilor Hauschild. Mr. Mulder? [7:10] **John Mulder:** So this is for the 2022 road project, but we need them to start doing the design work now so that we can be ready for bid in 2022. This is the result of a Request for Proposals where we had five engineering firms present. We interviewed three of them, and this is staff's recommendation in terms of the best value for the city for this project. [7:10] **Mayor Wayne Boucher:** Thank you. Any questions or comments from Council? Councilor Geissler? **Councilor John Geissler:** No comments. **Mayor Wayne Boucher:** Councilor Nelson? **Councilor Nelson:** No. **Mayor Wayne Boucher:** Councilor Peterson? **Councilor Joe Peterson:** No. **Mayor Wayne Boucher:** Councilor Hauschild? Are there any public comments on this motion? Anyone in the public wishes to comment, please state your name and address. Roll call please. [7:51] **Alissa McClure (City Clerk):** Councilor Geissler? **Councilor John Geissler:** Aye. **Alissa McClure:** Hauschild? **Councilor Hauschild:** Aye. **Alissa McClure:** Nelson? **Councilor Nelson:** Aye. **Alissa McClure:** Peterson? **Councilor Joe Peterson:** Aye. **Alissa McClure:** Mayor Boucher? **Mayor Wayne Boucher:** Aye. [7:51] **Mayor Wayne Boucher:** Resolution 2021-23: Resolution approving an extension of the final planned unit development plan for The Pillars of Hermantown. Do we have a motion? [7:51] **Councilor Joe Peterson:** Motion to approve. [7:51] **Councilor Nelson:** Second. [7:51] **Mayor Wayne Boucher:** Motioned by Councilor Peterson, second by Councilor Nelson. Mr. Mulder, should we have Mr. Johnson explain this if he's online? [7:51] **John Mulder:** Yes, please. Eric? [8:37] **Eric Johnson:** Great, thank you very much, Mr. Mayor, members of the Council. Before us is an extension of the planned unit development approval for The Pillars of Hermantown. This project was approved in April of 2020. To date, the applicant has not pulled any building permits on this or taken action on the site as far as the permitting process. The ordinance does allow for the extension of PUD approvals assuming there is a written request by the applicant. We have received that from the applicant; they've indicated that their site due diligence is taking a little bit longer than anticipated as well as just issues associated with COVID as well. So they are requesting a one-year extension to their PUD approval from the City Council this evening. [8:37] **Mayor Wayne Boucher:** Thank you. Do we have any questions or comments from Council? Councilor Geissler? **Councilor John Geissler:** No comments. **Mayor Wayne Boucher:** Councilor Nelson? **Councilor Nelson:** No comment. **Mayor Wayne Boucher:** Councilor Peterson? **Councilor Joe Peterson:** No comment. **Mayor Wayne Boucher:** Councilor Hauschild? Was that a no? **Councilor Hauschild:** All right, no. **Mayor Wayne Boucher:** Oh, thank you. Do we have any public input on this matter? If so, state your name and address for the record. Roll call please. [9:23] **Alissa McClure (City Clerk):** Councilor Hauschild? **Councilor Hauschild:** Aye. **Alissa McClure:** Nelson? **Councilor Nelson:** Aye. **Alissa McClure:** Peterson? **Councilor Joe Peterson:** Aye. **Alissa McClure:** Geissler? **Councilor John Geissler:** Aye. **Alissa McClure:** Mayor Boucher? **Mayor Wayne Boucher:** Aye. Do we have a motion? [10:11] **Councilor Hauschild:** Motion to approve. [10:11] **Councilor Nelson:** Second. [10:11] **Mayor Wayne Boucher:** Motioned by Councilor Hauschild, second by Councilor Nelson. Mr. Mulder? [10:11] **John Mulder:** So the city is purchasing a new front-end loader that we'll add to our fleet for the price of $109,329. But then we're also trading in the motor grader that we replaced two weeks ago, and so that motor grader will then buy down the cost of the front-end loader. [10:56] **Mayor Wayne Boucher:** Thank you. Any questions or comments from Council? Councilor Geissler? **Councilor John Geissler:** Not that I'm hoping for snow, but I'm looking forward to seeing the new equipment in my neighborhood. Thank you. **Mayor Wayne Boucher:** Councilor Nelson? **Councilor Nelson:** No comment. **Mayor Wayne Boucher:** Councilor Peterson? **Councilor Joe Peterson:** Careful what you wish for, Councilor. **Mayor Wayne Boucher:** Councilor Hauschild? **Councilor Hauschild:** No comment. **Mayor Wayne Boucher:** And Mr. Mulder, I had one question: Is the $109,000 figure with the trade-in, or will the trade-in come off that figure? [10:56] **John Mulder:** That's with the trade-in. [11:43] **Mayor Wayne Boucher:** With the trade-in, thank you. Is there any member of the public that wishes to comment on this matter? If so, state your name and address for the record. With no public input, we will move for a roll call. [12:07] **Mayor Wayne Boucher:** Sorry, I don't know if it went... Mayor Boucher's eye—we will move on to Resolution 2021-25: Resolution receiving bids and awarding contract for Road Improvement District Number 537, Levite Junction Road, in the amount of $1,353,290. Do we have a motion? [12:07] **Councilor Joe Peterson:** Motion to approve. [12:07] **Councilor Hauschild:** Second. [12:07] **Mayor Wayne Boucher:** Motion by Councilor Peterson, second by Councilor Hauschild. Mr. Mulder? [12:52] **John Mulder:** So this is for the construction of a junction this summer. [13:25] **Councilor Hauschild:** So moved. [13:25] **Councilor Joe Peterson:** Second. [14:13] **Councilor Joe Peterson:** Oh, i think they didn't wait. Yeah, we lost the Mayor's computer. **Councilor Hauschild:** Went down again. **Councilor Joe Peterson:** Joe's making me dizzy. **Joe Wicklund:** Hand it around... oh yeah. Well, now we're kind of online again. **Councilor Hauschild:** Did my motion of 2021-26 go out? **Joe Wicklund:** Yes, and Peterson second. **Councilor Hauschild:** Yeah, so Hauschild motion, Peterson second? **Joe Wicklund:** Yep. Mr. Mulder? [14:59] **John Mulder:** So this is a joint project with St. Louis County. They're doing all the engineering work and this has included a bigger part of their project as well.
