update uh uh during executive session we discussed three items involving litigation and negotiation um approval of the minutes for February 27 2023 a motion is in order mayor I moved to approve the minutes moved by Manpower Tim Gardner and seconded by that was Sunday oh yeah I'll second him here okay move by council member Steinberg second by mayor Tim Gardner to approve the minutes for February with you an experience some community members and I went through this past February 21st during a RLC resident Leadership Council community meeting the resident Leadership Council hosted and facilitated community meeting that included council members Cristal Murillo and Ruben Medina the medians the meeting started at 4 30 and took place at the at the Martin Luther King Library the meeting ended at 4 5 45 and the ROC members started to clean up and pick up uh and put tables and chairs back to its place at that moment I asked one of the security one of the library security guards who was waiting for us and rushing us out the building to let me use the restroom due to a medical condition I I have I needed access to the restrooms I a medical condition I have where I need to have access to to restroom he responded Yes and I and to go through the back and that's what I did then I encounter another security guard who questioned what was I doing I explained in a rude way he told me that the restrooms were close without being able to use the restroom I went back to finish up cleaning the conference room um and because it was late and the security guard was rushing us and they told us that we should be out of the building as soon as possible because they would not get uh overtime paid stained after six at the at the at the building I felt frustrated as our goal as community members is to respect respect between us community community and represent Municipal Representatives I participate actively in my community to establish relation respectful relationships um but it seems like this is not the goal from the security guard and the director of the the library the Martin Luther King Library the the gentleman had a hundred a hundred percent turned of attitude from positive to negative and did not let me use the restroom um and started to complain due to our our delay on getting out of the building well that he knew and he saw is that we were cleaning up at a certain point I felt intimidated with his attitude we ended up at 6 10 put all the materials in its place from uh by Rhonda fields pasado foreign amigo result [Music] [Music] Amigos abilida foreign Fuego is in Aurora Como party occupations de marso Cabo una reunion community in modern Recreation Center is attention good evening my name is Marina Rojas my family and I lived in a lived in have lived in Aurora for the last 25 years I have six kids three adults who have already married two of whom graduated from Hinckley high school and later graduated from Pekin's College Technical College I also have a high school senior at Hinckley and my youngest four-year-old son it is very important to me as a mother to share with you the challenges we Face due to gun violence affecting our youth um in November 2021 my family and I went through the worst experience of Our Lives my son at the at the time was 16 years old attended a party with some high school friends there was a young man at the party carrying a gun which supposedly went off by mistake injuring my son time completely changed for our family since my son resulted severely wounded often I question how is it that this happened my son just went to a party looking to have fun with his friends and now we we need to suffer the consequences because of an immature young boy was carrying a gun my family is now suffering the consequences because a gun ended up in wrong hands and I know there are many families in my community battling the same issues our son is now part of the statistics of violence due to the fight due to firearms because it isn't it is interfering in the schools streets and homes of Aurora as a member of the resident Leadership Council we've met with various representatives to address the concerns on gun violence but we receive less than satisfactory answers on September I'm sorry on Saturday March 25th The ROC will host the Community Action meeting where we will address various very we will address our issues with various Representatives like yourself searching for solutions to the issues we face all of you are invited and we appreciate council member Cristal Murillo Ruben Medina and the mayor for confirming their attendance thank you for your for your attention Rhonda Fields followed by Zach Heaton good evening my name is Rhonda Fields state senator hello there mayor Kaufman city manager councilman judge day law enforcement members that are here and Welcome to our new fire chief I'm here to talk about Community gun violence you know there is a sense of Burden that's on our city right now as it relates to this constant hearing of gunfire I've lived in the city for over 30 years my kids went to school here I served this community and I'm getting far too many notices on phones about hearing gunfire and so I'm in I'm in my home and I get these alerts saying did you hear these shots fire D and I do hear them and they always say that there's somewhere that's not close to my home it could be maybe on Smoky Hill it may be on Chambers it may be on Peoria it could be a lot of places but it's still the community that I love to serve the reason I'm saying that is because I can no longer um say that it's not happening near my home because on Friday of this week the Aurora Police Department came to my home with their crime unit and they pulled out a bullet that had come through my window in my living room window went through the bay window through my shears through my china cabinet and then it lodged itself on the wall the window was shattered my faith in my security of being feeling safe at home has been shattered of course when it happened I I called the police chief and he was very very responsive he sent out the appropriate people to investigate and and take the report and later came out and and pulled the um the bullet out because they couldn't do it because it had traveled that far I live on a corner house and um my house is kind of elevated so it happened they say it was a drive-by shooting I don't know if you saw the reports this weekend but there were several incidents of um gunfire let's see I have it one was um on Smoky Hill and Chambers and uh there was another one okay there was two wounded in a shooting on Sunday the both of these three wounded in a shooting on Sunday and then I mean there's just a lot of gun violence and I'm here to let you know that I don't feel safe in my own home and I'm quite sure I'm not the only one that feels this way I don't know what needs to be done but I don't want to have to leave living in the city of Aurora because I no longer feel safe because everyone gets so comfortable with hearing gunshots I don't want to live that way I love my community I love my neighbors I love this city but we have to address gun violence our kids are feeling unsafe in their schools we live what I would want to say in a community that there should be Peaks but there's no peace and I don't know what the answers are I just know that we need to take the blinders off if they're on and we need to make sure that our law enforcement officers have the the appropriate resources our teachers and our schools have the appropriate Manpower to deal with the violence that people are seeing and our kids are just traumatized by so much so I'm just here to say that I'm Overexposed as it relates to hearing gunshot fire luckily in my home no one was hurt but my family is shaken because we could have been in the living room we could have been watching the Oscars or just watching TV just hanging out like we normally do it happened around 5 30 so it wasn't like it happened late at night Senator Felton I'm sorry I've reached your three minutes so mayor I'm asking you and the Civil council members to do what you can at your level to address the level of gun violence and the number of gunshot um firings the shootings that we're hearing in our neighborhood we're frightened and we're looking for leadership thank you thank you senator Zach Heaton followed by Tanya tabachek good evening everyone uh before I get to what I normally wrote I'll definitely back both the speakers up on the gun violence yeah we uh my family we can definitely identify a muffler versus a nine millimeter versus a heavier weapon so um my father-in-law jokes all the time man it's like back home in Baghdad so uh you guys got an issue with that one um we all have an issue with that one excuse us let's put it on you anyway I'll start with what I uh came to talk about so I wanted to share with you guys an expression that I picked up from one of my mentors the it's not what you say but what the other person hears that's important uh the point is that you can have the best intent in the world but if you're not able to communicate and they're not able to hear what you're saying it's going to add up to absolutely nothing uh the last meeting as a resident I saw a reconsideration on the plan um that unfortunately did not take place uh the fact that you can all vote to scrap an agenda item like 16a regarding the East Colfax Community Collective reconsideration is uh while simultaneously signing uh 523 thousand dollars for golf carts blows my brains away now I know there's some golf fans so I won't hate on golf it's certainly important but there are people who can't pay their rent and put food on the table we also spent 130 000 on portable bathrooms so I'm sure that the intent was to say that you're being wise and responsible with taxpayer money I see that as a resident I can promise you what I and many other people heard is don't be poor so please if you could ever reconsider that without being shot down by Robert's Rules of Order Because unless we're gonna get out the textbook again anyway moving on uh while I would like to dedicate more time to EC3 I would also like to talk about some ships that have not yet sailed I've spoken before about the Aurora History Museum I've had a number of conversations uh in the role of the museum plays in the community excuse me I'm losing my spot on the thing before the timer gets me um I'm just gonna give up on this so the aura History Museum what we're working on is it's going to play an integral part of the community that we're shooting for and what we're in need of right now is storage space so I don't know how much you guys of this are aware do you know where a history museum is allocated to the old police building it's time to exhibit it's an amazing exhibit it tells you tons about Aurora but one of the biggest things is the archives the archives are actually pretty deep you get to see some really cool stuff that like you had no idea came from Aurora and one of the things is in the old police building water leaks are an issue and some of that stuff actually got damaged uh we're running out of space there we're looking for spaces to put it I do have a number of conversations going on with a couple of you for civic engagement and plans to do some more things in the future the Aurora history museum is a critical part of those plans and I'm hoping to ask you guys anywhere I know we got a couple of schools that have been decommissioned I don't know if you can just reacquisition re-acquisition a gymnasium somewhere basically need a climate control room that you can store stuff in um if we could allocate some time and resources to that that'd be great I would keep talking about the uh I'm going to come back up later stuff and there you go so peace Tanya tabachek um good evening mayor Kaufman and council members um my main point of view tonight is to talk about xeroscape and the water program and so forth I know that we're going to be in Phase One program beginning May um I have looked into my family has applied for the grip rebate program have it approved on that note I did do research and for like for a thousand dollars it'll pay for labor and stuff but they won't pay at the rest is like 3 000 and that will come until after two years and the our yard itself is like 1200 feet and that cost is between eight ten thousand to seventeen thousand dollars for a Zero Escape so I don't know I know that we're very cautious about water but the rebate to me doesn't even come close to what is the cost is for the square feet to get zeroscape so it's like okay you're pushing it you're pushing it and pushing it but then the citizens are like going well I can't afford seventeen thousand dollars and you only give me four thousand and that's after only the one thousand and two years later three thousand so right now we're doing the research I've talked to two other counselors I've talked to council members regarding this my father's gonna look at three different bids but right now unless I get a loan from my 401k or something like that I can't we can't afford it and we're just gonna have to figure out what to do with the water system so thank you okay that was the last individual um motion is an order for adoption of the agenda mayor uh Milford him uh motion to approve the agenda with removing item 17A and reopening the Civil Service Commission application process is there a second to that motion second come here um councilmember McConnell I second that I'm sorry okay council member Chronos II okay that's been moved by manpretem second by uh councilmember McConnell uh for the adoption of the agenda everything um but so you would do a continuance on 17A open up the application yeah continue that item indefinitely and reopen the application process okay um councilmember comes mayor so I think we have to if we're if it's indefinite we have to table if it's a continuance that has to be to a date certain but that actually is not my main point which is we had the opportunity to in to interview more candidates and we chose not to do so I'm going to support this because I think we do need to interview more people but we actually could already have done that further discussion uh seeing none then the question is the adoption of the agenda with the exception of item number 17A table be the appropriate word that that is is tabled for the purpose of conducting more interviews um great night Charles Richardson mayor and Council and attorney can't even introduce themselves in just three minutes so I'm going to go pretty quick here Charlie Richardson iaff general counsel for 1290 when one door closes another trap door opens so that's the way it goes um thank you for your service to the community thank you staff especially and uh it's um I know yeah you have a lot of work I'm going to summarize my comments um and you'll know why 1290 is going to support the institution of the Civil Service Commission now you've been called worse so hold on the council is transient the Attorney General is transient the Commissioners are transient local 1290 is going to fight no matter how long it takes no matter what the methods are we will spend the resources to protect the Aurora Civil Service Commission in 1975 firefighters sponsored the creation of the Aurora Civil Service Commission firefighters walked all through Aurora Gathering signatures to create a Civil Service Commission in 1987 the voters voted on a ballot issue that revised sections 316 and 317 extensively and there they give gave plenary total exclusive authority to the Aurora Civil Service Commission on hiring and promotions now in 2006 coincidentally right after chief oats joined this there were some ballot issues and two of them passed and two of them failed the one that failed is what you're doing now now staff poo-poos it and says oh no it's it's not anywhere close to what the voters voted on I hope one of you asked me to read the ballot language of that 2006 vote um the Civil Service Commission has been a historical Fall Guy scapegoat pinata Whipping Boy by the way whipping boys it comes from medieval Europe where if the king made a mistake guess guess what happened the the boy got whipped so I think that's very apropos uh they are a perfect Whipping Boy they have no political power they can't really fight back and so that's why for decades the Civil Service Commission has been blamed for everything um the seminal rule in government is elected bodies never admit blame or fault and certainly the staff can never blame that then because then the electives jump on the staff and blame the staff for making a mistake so there's no responsibility in the end there are 10 reasons why the city of Aurora is not a top pick to be a police officer and that's not the fault of the Civil Service Commission and I have the ten I hope you don't ask me to read them because it wouldn't be very pleasant but I came up with 10 reasons why you don't want to be an Aurora police officer pretty quick I just wrote them down the consent decree secret negotiations rushed to the agenda waiver of reconsideration you know if you Google government transparency if you could wrap up your okay you're not going to find it there real quick um I want to real quick want to talk to you about the lateral program has been a disaster the resolution is a direct intimidation and threat to the Commissioners we made a good faith proposal it was rejected councilmember Lawson we want to talk to you about CML and the home rule City issue because if the Attorney General can attack Aurora they can attack somebody else I want to pot lastly I want to apologize to the Civil Service Commission for disrupting their meeting because I laughed out loud when Mr bachelor asked Chief Rob net do you prefer the 1290 proposal or my proposal well thank you there's nobody else okay further discussion on the consent calendar adoption of the production Center mayor mayor Tim I'd like to remove 1185. from the consent calendar uh with code now please read the title to item number 1185. mayor we still have to vote on the consent calendar first oh I'm sorry so council member Coombs council member Coombs council member Coombs are you comfortable with mayor Pro Tim Gardner's um Amendment okay to remove item 1185 thank you um okay well then adoption of the accounts consent calendar with the with item 11a5 removed Luke now please read the top item number 1185 item 1185 is resolution 202330 a resolution of the city council of the city of Aurora Colorado directing the city manager to move all background investigator positions from the Civil Service Commission to the Department of Human Resources utilizing the spring budget supplemental ordinance and to reiterate the council's direction to the Civil Service Commission for the commission to amend the commission's rules and regulations to comply with the mandates of the consent decree motion is an ore mayor motion to approve it's been moved by councilmember seconded by Arcana um I'm sorry councilmember McConnell um discussion mayor uh um council member thank you um could could staff talk about the consent decree and and the Nexus to this resolution and on the hiring part of it why were why we're contemplating moving hiring to Human Resources yes ma'am Pete Schulte Public Safety client group manager of the city attorney's office um very involved in the in the negotiating of the consent decree back now it's been more than a year the concern was is that no other city that was known in the state of Colorado and frankly across the United States has the hiring of Basic Police and Fire Inside the Civil Service Commission the concern was is that when the police and fire departments don't get to meet their employees until they've reached the academy that was a problem that could be leading to some of the issues that the Attorney General said was being faced by the fire department by the police department here at Aurora so all the consent decree did was they didn't tell us how to do it but they required there would be two elements that be met under the consent decree to be in compliance one is is that HR be a lot more involved in the process that went back to more oversight of the process to be able to have accountability on who was actually doing the process and the second thing was is my gosh have the Departments having the final say on which candidates are hired to be a firefighter or a police officer in the city of Aurora how we got there it was not mandated by the decree as we've said numerous times the decree was not prescriptive in other words it allowed the council as the governing body of the city of Aurora to give that direction and to make those decisions and that's where we are today and follow-up mayor uh councilman please and then um just from a legal perspective the language that is in our Charter is that does that allow us to to do what is being proposed yes ma'am and I'll talk briefly about what Mr Richardson said from 2006 the ballot initiative that failed was actually removing the Civil Service Commission from actually doing anything involving hiring we are still believing and even City management has said that Civil Service Commission is an important oversight Board of the process they're volunteers their their Commissioners they're doing the the duty of what in human resources department would be doing there's one sentence in the charter that goes to direct hiring a basic fire and police and it says quote the Civil Service Commission shall be responsible for examination and certification of all applicants to positions in the Civil Service in other words they start the process they take the politics out of it they administer what's called a civil service examination whether that is a the front line exam that they use now or something else that the fire department uses they do a rank list and then they begin to hire from whoever's at the top of that list or in that first band and then they go through until the spots are filled they didn't change the charter back in the early 2000s when they took over hiring Charter change is not required now to give it back to HR in the Departments so to be clear the only thing you're changing is they will still do the very very upfront part of it and then then the background checks and and the hiring goes to HR but but the depart or APD and AFR would still be part of the hiring decision yes well they would be making the final hiring decision now the Civil Service Commission uh will be overseeing the process in other words if a candidate gets disqualified through the process the Civil Service Commission will still hear the appeal about whether or not somebody was disqualified for what we call a protected class or for some other reason uh arbitrary and capricious reason they could actually put that person back into the hiring process but once they develop the list they get to oversee the process and I'll let Mr Batcher talk in detail about the city's proposal which is what's outlined in the resolution thank you thank you yes I just want to be clear what the in front of you tonight the resolution is directing that background investigators moved back to HR background investigators are one part of the process and under the city Charter uh council is able to approve employees and and background investigators are contract employees of the city and so uh it is with council's approval that the Civil Service Commission is able to have employees other than the Civil Service administrator under the charter they are allowed to hire the Civil Service administrator other employees are with the approval of council so this resolution tonight is if it's approved is direction from Council to move those employees back to HR so that HR is overseeing background investigators so that's what is in the resolution tonight this would give us a little bit of time we would bring an item forward in the spring budget supplemental to actually affect that change and make it happen and then everything else that uh Mr Schulte was talking about is a matter of ongoing negotiations with the Civil Service Commission because it is their rules that set their remainder of that process and so I think what this resolution does is clearly outline what Mr Schulte talked about and I think what is in line with what the charter excuse me the consent decree requires and City management Management's proposal to change that process to do exactly what the charter requires which is give HR a much larger input into that process and then have the Departments make the final say while after the initial phase of meeting their Charter requirement to certify a list of qualified applicants it then has the Civil Service Commission moving to an oversight role further discussion our mayor for Tim so I have a couple of questions and I'm hoping we can have the council for 1290 come up if that's all right because they're questions based upon some comments that he made but my first question is that the comment was made that a proposal was made by local 1290 to staff and or management and then that proposal was rejected can we get a little bit of explanation as to what that was and I I I'd like to see if we could get the council for 1290 to come up because he was the one who made that comment very well uh was your question your question was to Mr Richardson yes sir Mr Richardson thank you thank you yes a proposal was made a good faith proposal and um we had been working with Integra assure for a year and we're mindful that when they were interviewed all we heard about was communication cooperation um so we decided to float a proposal that meets whole person meets final say to the department enhances the role of HR retain some meaningful role for the Civil Service Commission it was rejected out of hand just just had apparently no value and the way the city still got final say as we proposed their beef at the end of the pro near the end of the process there'd be three Commissioners three police representatives and if there was ever a 3-3 tie on a higher decision which we think is going to be very rare the police Representatives or fire Representatives would always win the tie so even if the three police Representatives said yes and the Commissioners all said no boom Going to be a police officer if the Commissioners if the um three police Representatives said no and the three Commissioners said yes the department gets the no the person's not going to move on so that was a great way to retain that final say language and and this was rejected and that's really sad because um we think it adopts whole person and it's just a shame we wouldn't be here making life miserable for you guys and we thought this day was just it was just rejected out of hand mayor can ask one follow-up please proceed uh so the other question I had is the statement was made that a very similar question went to voters in 2006 and you know I'm hearkening back to a conversation that this Council had in 2021 over pit bulls and several of my colleagues were very very concerned that we were not sending that question back to the voters uh because they had weighed in on it and you're making the contention that the voters have weighed in on this so I'm curious how what we're doing tonight Compares with what the voters were asked in 2006. yes the people of the city of Aurora have weighed in three times they want a vigorous independent Civil Service Commission so I'm going to read just real quick the ballot language in 2006 effective April 1st 2007 shall the Aurora City Charter be amended to transfer all Provisions relating to recruiting and hiring to the new uh of the new firefighters and police officers from the Civil Service Commission to the city's human resources department working in cooperation with the fire and police departments for the purpose of efficiently and effectively hiring qualified public safety personnel that was rejected so here comes the consent decree the perfect opportunity to accomplish this when Mr bachelor makes references to Civil Service Commission oversight that gives a bad name to lipstick going on a certain four-legged animal because that that means it's like saying you have oversight of your teenagers and so that language come on everybody we know what's going on here thank you Mr Richardson mayor customer comes um um so I guess understand more about the proposal that Mr Richardson put for stated was brought forward and what the reasons were for not accepting that proposal for opposing that proposal okay um yeah okay you're asking okay thank you Mr Richardson staff response sure um so they did bring forward a proposal that proposal is pretty much essentially uh the same thing it is now so essentially HR uh the backgrounds remain in HR excuse me in civil service and then uh the final decision as you said goes to sort of a 3-3 with a tiebreaker but other than that the Civil Service Commission retains all its current roles uh his involvement of HRS having them essentially oversee a process to pick some outside vendors but the Civil Service Commission remains entirely in control of the process until that 3-3 vote and so we rejected it because we think the uh intent of this is again to have the Department's far more integrated and involved in the process not just sort of um sideline observers uh watching the Civil Service administer their process further discussion um can I hear councilmember Cruz uh from our not City attorney but attorney Pete Schultz thank you council member Coombs so I want to be clear about why we would not why you know we recommend it from the legal city attorney's position not to have the Civil Service Commissioners involved in that process we believe under the charter that their appeals of hearing of disqualifications is important you only have up to five Civil Service Commissioners at any given time if you have less than that you have to have a quorum so if you have three every time hearing the entire file you have three individuals out of the five that already have some knowledge of this applicant the importance was when they started we have not I mean the rationale of this is when you have somebody doing the hiring and doing the appeals over the last years that we've been doing this not one applicant that has been disqualified under the process has appealed the decision back to the same people who disqualified them that was the same thing we're trying to prevent here is that if you're going to have Civil Service Commissioners we would say have a civil service commission appoint up to two or three citizens to sit in the file review again going back to oversight but not have them involved in the process because it limits the ability of the applicant to have a full commission to hear their complaints of why they were disqualified that was the reason for that and I again I I have a lot of respect for Mr Richardson but I'm going to go back to the 2006 ballot initiative he put some extra language in what it says it actually struck the position of 3-17 where it says Civil Service would have nothing to do with taking the applications of the candidates doing a test and doing a list so I just want to make sure you guys are clear I have no dog in this fight I'm just letting you know that is not what the 2006 ballot initiative stated further discussion just a follow-up councilman of course I'm hand this to the clerk to give it to uh Coombs very well sure um or sorry yeah I would like to see it certainly um so Mr Schulte um with respect to that kind of citizen oversight would there be a concern about whether or not the folks that are on that panel the citizens on that background reviewing panel are able to access all of the relevant background data would there be any kind of confidentiality or other reasons why the complete background information wouldn't be available to those folks I think there's a concern that the Civil Service Commission provides citizen oversight of those backgrounds and make sure that there's nothing that we that the citizens are not able to address in a background that may be completed so what I would say is is that that part of the process is still negotiating right this is not what we're dealing with today is not going to get into what happens later on it's just giving you a direction of how the process should look like overall moving forward as far as I know Mr bachelor's had conversations with the monitor about what citizen involvement will be in the process but it goes back to the Civil Service Commission as the volunteers on the commission giving an applicant the full board to be able to appeal back to that wouldn't have any say and whether or not somebody was hired was important to the city further discussion I've seen none the question before says the adoption of item number 11a5 uh call for the question council member Coombs and sunberg the motion passes with nine yes votes and one no vote from council member Coombs okay with a question please do the top title number 12a he is ordinance 2020 306 Aurora Colorado rezoning two Parcels of land measuring 33 Acres more or less located north of E-470 and Cottonwood Drive city of Aurora County of Douglas state of Colorado from medium density residential Zone District R2 to low density single-family Zone District R1 and amending the zoning map accordingly King's Point Kings Point South pa14 zoning map Amendment public hearing is now open our presentation by the applicant great thank you council member I'm sorry presentation by staff thank you my name is Eric Gates I'm a planner with the planning and development services and before you is a request for the rezoning of approximately 33 Acres from the R2 medium density residential Zone District to the R1 low density single-family residential Zone District this piece of land is located between E-470 unincorporated Douglas County in the town of Parker and the future Aurora Parkway to the north the site is currently vacant as you can see here currently the site is bordered by R2 zoning to the north and east and by Douglas County to the South and West the entire areas within the established Neighborhood Place type of the Aurora comp plan and can support the residential uses anticipated and allowed in both R1 and R2 zoning and then here's the site should the zoning change be approved this rezone has been proposed in anticipation of a site plan that is currently under review for single-family detached homes the updated R1 boundary is drawn in such a way to avoid splitting any individual Lots between two different Zone districts which the existing zoning would do this item has been heard and unanimously recommended approval from the Planning Commission on febru on their February 8th hearing and staff also recommends approval based on the review criteria of section 146-5.41c313 thank you and I'm happy to answer any questions you have I believe we also have Julie from the applicants team here if you have any questions for them thank you presentation by the applicant I don't believe they have a presentation uh does there any is there anyone wishes to be heard on this issue no questions uh uh to staff I'm here councilmember McConnell thank you sir so um I would like to know a little more as to what the and I guess the rationale for lowering the density for this parcel is um so what is on being proposed and currently under review um is at a low enough density to meet the R1 standards um I don't know the exact rationale behind it but I would imagine uh the proposal to lower the density is generally a little more palatable and like I said it the zoning works with what is being proposed there anyway further further questions of staff we're seeing none the hearing is now closed motion is in order councilmember bargain motion to prove 12a the move by customer Bergen second by second second by mayor Pro attempt to approve item number 12a discussion mayor councilmember Oregon I know it's unusual for us to go lower density from R2 to R1 Ward 6 residents like that though but I think part of the reason is just the adjacent properties to it was one of the reasons further discussion I've seen councilmember comes so I'm just be to have kind of more mixed-use walkability or because of its kind of being adjacent to primarily R1 zoning it's really already an area that's primarily that type of use and wouldn't wouldn't have other types of kind of planning happen there yeah so for the Mixed use I will say neither R1 or R2 really allow for that um in the first place so to get mixed use you'd need to rezone to something like mixed-use Corridor or something like that the place type as well the established neighborhood it does allow for a little bit of commercial but I don't know if it's specifically aimed at mixed use yeah it I mean if you've been to that area it is very open space and and really you would not have any walkability to any retail nearby and as you stated the commercial would be limited off of E470 but there would literally not be any um any pedestrian walkability further discussion I see none the question before it says adoption Obama number 12a call for the questions the motion passes to dub ordinance 20 2306 according to not pleasure to talk to item number 12b item 12b is ordinance 2020 307 a public hearing and consideration of an ordinance of the city council of the city of Aurora Colorado amending the 2018 comprehensive plan to enlarge the planning and annexation boundary located in the Northeast section of the city and designating a place type of industrial Hub to the area public hearing is now open uh presentation by staff okay thank you mayor Daniel krasinowski with the city planning department we have very brief presentation tonight I know Council was briefed on this in more detail at our previous study session that information is also provided in your packet this ordinance tonight is proposed an expansion of the planning annexation boundary amendment to comprehensive plan just for the benefit of the public listening um briefly what the planning annexation boundary does is serve really three purposes it is contained within the comprehensive plan to meet the state's requirement for what's called a three mile plan that is the city looking Beyond its boundaries to areas that may be annexed in the future um it identifies areas that the city um does long-range planning for some of its utilities and transportation infrastructure outside of its City boundaries in areas that may be annexed in the future and it identifies properties that are would become eligible to petition the city for annexation in the future properties that fall outside of the planet annexation boundary could not submit an application to Annex into the city just to note that this is the this only allows for an opportunity to petition the city for annexation does not require the city to Annex does not require the property owner to Annex into the city any applications I would go through the city's traditional annexation review in action by Council the area in question tonight is about a 12 square mile area in the far Northeast portion of Ward 2. it's north of 56th Avenue south of 72nd Avenue West of Schumacher Road and East of the city limit you can see that outlined in red on the map in your packet in the previous uh briefing of council is a fiscal impact analysis this is a a study that was completed by the city and consultant assistance to look at some of the potential costs and revenues of annexation of this area and eventual build out of this area based on a land use plan that was developed by staff the report itself gets into a lot of detail including some of the ongoing costs and revenues on an annual basis as well as one-time and capital costs at that time staff and the consultant provided some reasons to potentially favor the boundary change those are listed on the screen here among those are potential Economic Development opportunities in this area spin-off from Denver International Airport and the Colorado Aerospace Port which is adjacent to the area also the city's interest in minimizing unincorporated developments not to build City standards outside of our city limits uh we also provided a few potential concerns for expansion of this one is capital costs there are some capital costs of Roads fire station and other transportation and utility that would be required to be built to serve this area if and when it becomes Incorporated also the question of Market need there's a lot of undeveloped industrial property in Northeast Aurora if properties in this area were to Annex that would increase the the property Incorporated properties for this type of development and I think you can see some of the other ones some of the notes about oil and gas Wells that if we if annexed would become in the city of Aurora and that concludes after presentation I did want to note that the Planning and Zoning commission voted six to one to recommend approval of the ordinance as shown here on the screen and that ordinance is to amend the comprehensive plan to expand the planning annexation boundary and designating the area as an industrial Hub Place type within the plan staff is happy to answer your questions mayor um let me uh go through the process first is there anybody who wishes to be heard on this issue in person at Connolly I'm sorry um representing the applicant okay no this is for members public and this is okay okay good evening mayor good evening City Council Members my name is Rita Connolly I'm with the law firm of Fairfield and woods 1801 California Street Suite 2600 Denver Colorado 80202 I'm here today representing Chelsea Investments Inc Chelsea Investments Inc owns US quarters a section of land 656 Acres at the northwest corner of emboden Road and 56th Avenue and they support the adoption of the comp plan Amendment um a couple points that I don't think came out in the staff report that I'd like to bring forward is one you might recall that the city of Aurora actually entered into a cashier agreement with the county of Adams and the Sheck Corporation to build 56th Avenue 56th Avenue is located on the southern boundary of your this Urban growth area boundary so you built in a cost sharing Arrangement 56th Avenue to connect Colorado Air and Spaceport to Denver International Airport so you could have a corridor that could take persons and goods back and forth to realize the economic opportunities that both generated and spun off you also participate in the construction and maintenance of in Bowden Road what the problem is is we can't bring prospects to you for you to evaluate whether or not it's a good Prospect for the city of Aurora it's an economic opportunity that brings good jobs and good tax base to you and recover your investment in 56th Avenue in imboden because the property that Chelsea owns particularly is not within your Urban growth area boundaries so we can't present to you and an application for annexation and this property currently has is under contract with a prospective purchaser but we can't present that to you so it would have to develop an unincorporated Adams County we brought an annexation petition to the city back in 2019 it's now 2023 and the city has encouraged us not to go into unincorporated Adams County because it will develop look at different standards than the city of Aurora has so one other point of business is 1988 intergovernmental agreement the city of Aurora entered into with the City and County of Denver and Adams county is that Aurora would preserve an Eastern Access Road out of Denver International Airport it was roughly at that time around 96th Avenue but really it can be anywhere along the Eastern Corridor of Denver International Airport so that Aurora in 1988 because it anticipated Urban growth eventually being between at least Spaceport Colorado and den preserve that access corridor so that it could have Economic Development opportunity Please wrap up your comments I we're these past three minutes and spin off of Denver International Airport I think there's immeasurable opportunities in this area for economic growth and we look forward look forward to your support for this application so that those opportunities can be brought to you thank you thank you is there anybody else who wishes to be heard no um questions of Staff or the applicant well there's an applicant is not here staff uh councilmember Bergen thank you mayor um so you said earlier and and it was reiterated um just now that if we don't approve the growth boundary then no annexation can come before us right that's correct those all of those properties would fall outside of the Bill Clinton could not bring forward an annexation and we would have at that time whenever an annexation petition came to us we would have the information and the opportunity to decide whether to approve that or not approve that correct if someone wanted to bring forward an annexation petition for that area we would have to go through this process to amend the conference a plan to incorporate that into the planning annexation and then go through the the typical annexation review and process okay and I do understand that this is um obviously a corridor of Economic Development potential for us so thank you further questions to staff mayor councilman Combs um so I have a couple questions the first is so I just want to clarify what you just said we do have a mechanism via comp plan amendments to Annex if we felt that a particular project or site um did Merit annexation if the city wanted to accept an annexation petition for any of this land or any land outside the planning area boundary we'd have to amend the conference a plan to bring it within that boundary and then we could process the annexation okay so we do have a mechanism there um my other questions are about the annual general fund impact section it looks like it would be four million dollars does that include any assumptions about incentives that may be given to entities that want to develop within this expanded planning and annexation boundary no the the study doesn't include any potential incentives like that so there wasn't like for example an analysis of incentives that we historically have given in similar situations it's completely absent the discussion we didn't make any of those assumptions for any property within the area okay thank you and then does expanding this planning Ann annexation boundary impact the property values or real estate sales cost of properties within that boundary if it expands does that increase the property values prior to the annexation and zoning that wasn't uh studied as part of the as part of the city study with the consultant I I don't know that I could speak to um you know your hypothetical um uh real estate economics like that okay um and then finally the uh the section on fiscal impacts or Capital impacts is that it would have a deficit of a hundred and twenty million dollars is that correct that's the result of the study yes okay thank you further questions the staff mayor councilman McConnell thank you sir that um 120 million or 121 million dollar deficit also factor in potential cost sharings from Adams County it does not that was not included in the in the study are you familiar with how much we could potentially save uh we'd have to look at the the details of that and what what could be agreed with Adams County but it wasn't incorporated into the the mathematics of the study all right great and are there any other petitioners that you're aware of I'm currently look asking for this uh the city is uh really has only the one petitioner that's a potential petitioner known to us um the one that they asked representative I just spoke thank you for other questions the staff mayor councilman councilmember Lawson thank you I have a question so what councilmember morecano was talking about the the 102 deficit if that's going to be an economic driver then that impact can actually be decreased is that correct because we'll have if they if it's about to have commercial then the economic impact could basically be decreased correct um the study made assumptions about the future development of that area it is based on assumptions of land use and density and so forth if the area were to develop out differently than the study envisioned with perhaps more density or different types of uses that could change the the calculus around that okay thank you and let me just say I've asked staff for to look at a range of proposals on Commercial impact fees further uh discussion further questions to staff come here uh councilman McConnell thank you sir so that projection that you gave us in here did not incorporate the potential of LeapFrog development which I know was identified as a risk for this so I guess the optimistic side is if there is no if it's fully built out and there is no leap product development meeting at all gets built out in a way that actually makes sense with contiguous infrastructure development and growth it would be a benefit from your projections that said if it doesn't which we've seen a lot of LeapFrog development take place there could actually be even more risk basically to our bottom line correct um yeah the the um study assumes a build out now it's really difficult to Envision uh which of those properties builds out there might be LeapFrog it may be more contiguous it's really just hard to say and we didn't try to assume uh any sequencing of that so that is definitely a risk and certainly a consideration when looking at what capital costs might be needed at what point I appreciate that mayor please pursue thank you sir and then water so I remember reading in the backup that we currently don't have enough water supply for our existing uh boundaries if they were to actually fully develop this will be no exception to that correct um I might defer to somebody from a water department on that specific comment I believe we did provide some information about water being an Enterprise fund and being paid for by right right payers but I don't defer to the expertise on additional detail Marshall Brown foreign Council Marshall Brown general manager of Aurora water that is correct we do not currently have enough water supply to meet the growth demands within the current uh city of Aurora we're only about halfway built out we do have significant volumes of Supply to address some of that growth but not that growth in its entirety so to address the about half of the additional available area to grow within City Limits we would have to acquire Supply and to accommodate growth outside those current city limits we would also have to acquire additional water supply for other questions mayor mayor councilman Grooms um would any of the uses that are currently anticipated increase over kind of our current water needs for our developer developable area like would this require even more water depending on those uses so like the Aerospace and those types of uses do they have any higher water use needs than other industries that were already developing um hard to predict some of the for example within the Aerospace industry like you said some of the uses are are relatively reasonable or lower uses depending on the the types of of space some are a little bit higher so it really depends on the exact um type of development we have established criteria to look at volumes of water required for specific land uses and then criteria associated with reusability or our ability to recapture and reuse water and so from my understanding which is a little bit Limited in in Aerospace but there are uses across all of those ranges that I'm more of further questions of Staff mayor councilmember so in terms of the LeapFrog discussion if we if we approve this comprehensive plan again we would have the opportunity at that at the point that someone comes forward with an annexation petition to look at the impact the fiscal impact we would have that information right at that point each of those would be reviewed individually with the specifics of that of that land and that configuration and so forth okay and if a development came to us and they were not able to pay for their what pay their way we could then reject that application could we go through the standard annexation process which goes through Council to make a final decision on that um staff would review it and bring it Forward just like all all other annexations okay and I I understand the the concern on water as well um I I think in the backup it did also talk about um the opposite is that if we if if we didn't have the comp boundary and we'd and somebody did not Annex in then there's a potential that they do aquifer Drilling and I guess that would possibly be a negative as well so um but we could consider all that at that time thank you and let me just say uh remind the members again that this is not this only allows us to look at this area any proposal coming forward will require an annexation will require a voting and of itself of further questions of Staff seeing none emotion is in order mayor uh councilmembergerinsky motion to approve item 12b moved by council member seconded by second a second by mayor Pro trim to approve item 12 B uh further discussion mayor uh council member Combs um yeah so just looking at this I think that four million dollars a year especially given the types of incentives that we often give to developers that have given to developers in the city's history um really is not enough of an annual cost impact to offset the 120 million dollar infrastructure deficit and additionally the cost of more water keeps going up the water we're acquiring is not getting cheaper so that cost could potentially not be able to be offset by the rates that we have and we already don't have enough water so to me it looks like we're signing up for a lot of costs with what will likely end up being negligible benefit and we already have a mechanism right if individual sites on the edge of our current boundary say I have a really good plan that's going to work with your water use needs that's going to work with your fiscal needs if they want to be annexed we can have that comp plan Amendment discussion without expanding the entire planning and annexation boundary and that would also help us to limit that potential for Leap Frog development if we just adopt those per proposal instead of just expanding this boundary which we've been expanding and expanding and expanding and every time we do it there's LeapFrog development so to say oh but this time is going to be different to me feels a little naive and again without understanding incentives that we may give I really question whether we would have much economic benefit to the city much revenue coming in at all plus having that 120 million dollar deficit so I am a now further discussion uh mayor councilman McConnell and then councilman Bergen thank you mayor so first I want to start with saying that I do see the potential in this region but I don't really think we're there yet to move this forward I want to see some real changes to our impact fee structure I know it's been talked about but I want to actually see some proposals and I also want to see us begin to aggressively cut back on our existing water use because that's mentioned we don't have enough water for the boundary as it is and this is not the only part of town that would continue to grow without having specific plans for what to do with this area I also fear that this would just fuel land speculation which is going to make the cost of any future development out there more expensive just because someone's looking for a Payday so that's something that I can't support and I also do want to see the infrastructure estimate updated with that potential cost sharing for Adams County but I do want to thank you all for the work you put into that background information as well I think it's very valuable councilmember Bergen yeah I was going to say this doesn't cost us one single penny right now so the fiscal impact that that is something to consider when an annexation comes forward this doesn't cost us a single penny it it extends the the boundary and rather than than having one by one come forward we may lose out the potential for a really great Economic Development because we we did it one by one versus the in the entire um whatever how many acres this is of a comp plan further discussion I've seen that um question before this is the adoption of odd number 12 e with clerk please call the rule or call for the question the emotion passes with six yes votes for no votes from councilmember Medina Marcano Combs and Mario great now please read the top dollar number 17A mayor city was able to submit their four projects for the congressionally direct expending to our federal elected which consist of the Aurora water line replacement project pressure regulating valve improvements project Nine Mile pedestrian bridge the Aurora Public Library Central Library remodel project we are halfway through the Colorado legislative session and so far the city has taken priorities on 26 bills we are expecting housing and Zoning related legislation to be released by the end of March and lastly Senate Bill 23097 motor vehicle theft and unauthorized use has passed through the Colorado Senate and will move to the house this is in relation to council members of Onyx resolution to the city council passed earlier this year that's all I have mayor thank you mayor a couple of things first I just wanted to mention um I've gotten a lot of feedback from residents and I'm sure my colleagues have as well about some of the changes that we've had related to water and some of the things that this body has implemented you know first we implemented an ordinance uh limiting and or Banning grass at homes and we were told if we didn't do that we were going to have to increase rates and then of course we had a proposal to increase rates we were told if we didn't increase rates we were going to be in a drought and then sure enough a proposal came forward to put us in a drought and you know I think why I'm most frustrated is um my question is why is Denver Water not in the same situation either they have better storage or they have different science you know it should follow that if we're in a drought they should be in a drought unless one of those two things are true um you know my understanding is the water director is working on some information and you know I intend to post that uh but but I'm just as frustrated as our residents are as to why Aurora which represents a drop in the bucket no pun intended in terms of total water usage for the Colorado River why we are in a drought with these other communities or not um and and I suspect it might be due to better storage which if it's due to better storage then then we need to do a better job here at the city um but but you know I'm just really frustrated that we continue to pile on requirement after requirement on our residents that's going to cost them more money related to water and so you know once we get that information I intend to post that and I'll keep asking questions and I hope my my colleagues will as well councilman honestly just want to mention um last week had an opportunity to to read to a fifth grade class at Arkansas Elementary for leaders or readers are leaders week got to read The Lorax if anyone has never read that book it is quite the tongue twister but it was it was fun and the kids asked a lot of really good questions so enjoyed that a lot thanks councilmember Johnson thank you I also would like to Echo council member Gardner's sentiments I think for those of you out there that saw the effort that he and I put up to fight against putting us in a drought fight against raising your water rates fight against all these things he and I have been inundated with emails and phone calls next door messages social media messages um I'm sorry that our efforts fell short I know that we are told a whole bunch of things and given all these presentations by City staff also too I am also trying to follow the science and cannot figure out why our neighbors are not in a drought and it is just us in a drought so please when you all notice this hike in your water bill and it is coming and it is coming at you very fast when you notice it speak out speak up and know that council member Gardner and I valiantly tried to fight against all of this I also got to read to several different classrooms over this past week and had a great time I read I read a ton of different books and it was just amazing to see the kiddos you know in Aurora interact like that and also the at-large town hall is coming up very fast March what is it March 29th Wednesday March 29th council members no report councilman Memorial thanks mayor um just that my town hall will be the fourth Thursday which is March 23rd it'll be a hybrid meeting in the in-person portion will be held at the Moorhead Recreation Center I hope to see you all there we'll be talking about small businesses I also have someone from Excel Energy that will be there to do a very brief presentation on how you can save um your energy costs and then I will have a couple reports from Fox Theater and then the library and then my general updates on the snow the drought stage one drought that was just mentioned and um and then also the surcharges a there is a memo that's going out I are I received it from um from Marshall Brown and there was a lot of factors that go into that in terms of the basins that we get our water from so we we have water from 50 from the South Platte 25 from the Colorado 25 from the Arkansas and then within those basins we don't have um the ability to draw water from all of those basins either so it's kind of complicated it's called snork snortel sites but we'll have a memo on that to give you more information but it's not what the news is purporting to say that um you know yes a lot of the state of Colorado has above average but the way we are able to get the water down from the mountains into our reservoirs doesn't really give you that full picture so hopefully we'll get you some more information so that you can understand the conditions that we're in with our reservoirs being below our our necessary standard and I know it's a it is an impact to everyone to have have us go into a stage one but we are trying to be very responsible so thank you I see no uh further business before the Aurora city council the meeting is a germ [Music] thank you [Music] foreign [Music] [Music] [Music] [Music] baby it's time [Music]
