And whereas the work done by the greater Wichita, Kansas Chapter one, 20 has benefited which shot through community development and educational programs as well as unseasonably promote it. That employment and advancement of women in the construction industry. And whereas the construction community represented by Greater Wichita, Kansas, Chapter one, 20 has been a driving force in fostering community development renovation and beautification projects promotion of skilled trade careers and a positive vision of the future. And whereas the greater Wichita, Kansas Chapter one, 20 has sought to achieve successful results for Wichita and surrounding areas in a cooperative spirit. With other organizations this year. Whereas on March 22nd 1972, President Nixon signed into law a measure that amended the older Americans Act of 1965. included national nutrition program for individual 60 years and older and whereas for more than 5 decades, this landmark law has helped to fund community-based organizations like Meals on Wheels. And it's still the only federal program designed specifically to meet the nutritional and social needs of older adults. And whereas this year meals on wheels programs from across the country are joining together for the March for Meals. Awareness Campaign to celebrate its success and Garner the support needed to ensure these critical programs can continue to address food, insecurity and malnutrition, combat social isolation, enable independence and improve health for years to come. First, I'd like to say thank you for taking the time to hear me this morning. also like to thank my wife, Emily, for coming here with me and other community leaders that already partner with Wichita to make our city safer. Ultimately, I'm here today to talk about gun safety and why the typical hard party lines stances have unfortunately reflected on the judicial system and let the citizens of Wichita without a common sense solution to adjudicate the accidental discharge of firearms. propose a solution that has the support of several community leaders. But before going into details that like to share a story that will provide us some insight and to my motivation for speaking today. The evening of Friday, January 12th had begun with one thought in mind for Emily and me. Let's Eat Supper. Get our then almost 2 year-old daughter down for bed and have a relaxing night at home. As we anticipated the subzero temperatures to come a slight, you know, we live in a newly constructed 20 homes. So we share the west wall of our home with her neighbor. Around 05:30PM. It scoops and pass into a ball and was headed to heat up in the microwave. One step towards the microwave. I was met with a loud pop and suddenly everything was covered in white ceramic. I looked down at my hands and the ball was still perfect plant act that turned over my left shoulder, looking towards my wife and daughter were they were about 15 feet away and asked if they had broken anything. Has set the ball down and began to scanned the room for the epicenter of a destroyed white ceramic object. Naturally, my eyes went to the floor, but I saw pieces of ceramic everywhere. Some particles were fined like dust. Others may be closer to an almond. After a quick glance of debris made finding the source of the project on possible. I began to think of the actual objects around us. It could have created this disarray. Already ruled out just about all of our personal mobile belongings are backslash. I thought to myself and sure enough behind the fruit basket below the gfc. I'll let to the left of the range and microwave and no more than 5 feet from where I previously stood was a dime sized hole through the backsplash. But the equivalent of a lacrosse eyes ball worth of porcelain tile missing. I honestly thought maybe my neighbors hanging something on the wall and when a little too hard. So that's on my way to the door to ask about it. When my doorbell rang, it was my neighbor and his friend. They asked if we were all right. And we had been until the next sentence out of his mouth. After speaking with the Wichita Police Department and the detective assigned to her case, I quickly learned that there's no good way for this type of incident to be resolved for the existing legal channels. Essentially, if I were to, if I would be present for charges to be filed, the gunman then or evidence in my neighborhood never receives gun back. Alternatively, if I decide to do nothing, he would eventually receive his firearm only suffering the consequence of having it restricted to him for a few months. Neither of these options said particularly well with me for I believe action should have consequences. But the consequences should correct actions. This is where you come in too many times in politics. Things are black and white. Well, the well, the best solution for the majority of your constituents falls into an unexplored gray area. I invite you to venture with me there this morning. For people who receive traffic citations, the defensive driving courses offered his restitution for the infraction. So my proposal is simple for people involved in the accidental discharge of firearms were no serious injury or great bodily harm occurs and the offender is legally able to possess a firearm and act a gun safety course offered as restitution, allow the owner to repossess his firearm after the successful completion of the course. I've already spoken with Ken Graham. It lead instructor and co-owner of Range. 42, the range. 54 here in Wichita. I believe several of you might already be familiar with Ken. He's on board to be a part of this class and offer restitution. For incidents like this. Of course, there's revenue revenue benefit both for the business and the courts. But like consent during our conversation, it isn't about the money to me, but making our community a safer place. I couldn't agree more the task is simple. Passed municipal law offering gun safety courses for people in the situation described today ask is challenging. What will you do? Thank you, sir. >> Get bit. So I'm shares of anybody had mentioned anything like that or if you know of anything like that restriction, no, nobody is mentioning anything like that to I will say during my conversation with Ken. >> He said that he already partners with the city and offering a gun safety class for felons, however, because they're felons are not able to actually handle a gun and learn anything from that I mean, I would think kind of given you the black and white of what my situation here is. If doing absolutely nothing. It's an option. I think that there's probably somewhere in there or there's some flexibility free operate. >> A look into I was just curious that come up because I know there's some things that are police departments look at that and some frustrations with what we can and can't do and regulating. Malls in our own communities. So I appreciate that. The gun had a broken gun locker. And so their kid was able to get that gun out and kill Knowing that. And that story and that mother going to the legislature and all the pain that she faced. They did nothing. And all she wanted was some holding that person accountable who had a broken down marker. It wasn't about taking guns like many of the Legislature said or be an anti Second Amendment. But they just tend to be overly protective of folks times no matter what they're doing with But fortunately, so I'm happy to to share that message. There. If we do have the supportive of doing something. But often times that is up to the legislature and it's hard, especially in an election year to give many of to care about doing something like that because politically, as you said, its dangers and it shouldn't be. >> Karen Cahill, homelessness. I appeared before you before. is a constituent and I love that 15. 36 North Park place. 2% of wichita's population are Muslims. Many of our city's 13,000 Muslims are for medical professionals. Doctors dentists University professors nationally, 5% of all doctors in the United States are Muslims and 10% of American Muslims work in the health care field. Muslims come from many countries and virtually all of them no matter where they are from, like many Christians Hindus behinds etc. ACS are appalled by the ethnic cleansing. Israel is carrying out in Gaza, an area the size of Wichita. 80% of Gaza's population has had to flee for their lives. 80% in the last 5 months, but they cannot flee. They are contained within Israeli walls. Israel's defense tense defense forces bomb them every day. It even bomb see areas. They were told to move to for safety or receive drops of food, airdrops of food, the World Health Organization reports that causes lack of food and clean water and medical supplies. No cause of the worst humanitarian crisis in the world today. More than 70 local governments in the United States have passed resolutions calling for a cease-fire, including San Francisco Chicago Raleigh North Carolina, Cleveland, Ohio. The list goes on and on Providence, Rhode Island, Detroit Michigan Minneapolis, etc. These resolutions are important. And I know some of you have asked why why would this you get involved with something like this? They're important because they're reported and Israel's press. They demonstrate how unpopular Israel's policy of total war against Palestinians in Gaza with growing numbers of Americans. Put a break in the interest on the image discriminate murder and destruction that Israel has leveled on Palestinian people. In Wichita. We have a direct personal reason to pass a resolution calling for a permanent cease-fire in Gaza. The Palestinians, Muslims and Christian who call this city home and watch with Har and disillusionment. Americans silence on this genocide. When I spoke to 2 months ago, 22,000 people have died in Gaza. Now number stands at 30 1500. Thousands more buried under the rubble. Gas and college student who was here to speak to churches in August has lost 3 of his sisters, 2 Israeli bombing in the past 2 months since I spoke to you. Its leader at the Islamic Society of Wichita has lost 37 of his family members. It costs you little to vote for a cease-fire resolution. That silence on this slaughter is costing the United States support all around the world. We in which is Hosp House and study group are eager to meet with each of you and with Mayor Lou to answer your questions and help you find language that you could support that you will support. You may feel that there's little that you can do about this is a national issue. But a cease-fire resolution is something you can do. Local communities past cease-fire, resolutions to express their solidarity with affected populations in their own cities. 2 and 2 there in Gaza and to promote diplomacy and to advocate peaceful solutions to conflicts. A permanent cease-fire resolution will notify our brothers and sisters here in Wichita that we care and it will notify Israelis that the steady stream of U.S. weapons, ammunition, tanks and drones, our government send to them pay by our tax dollars is endangered by their continued war against civilians in Palestine. Specifically. They are looking for individuals just like you to be violence interrupters our community specifically in district district 3. And I know that that process a law right now. The city of is making an investment regarding violence interruption in the city Wichita and targeting 2 specific areas. I know that you would be someone at that innovation at destination vacation. I would appreciate >> if I may speak to that, I was very well aware that I spoke directly to the founders of Cure Violence. I'm not going to speak ill about anything that's down from progress. Good morning, mayor and members of the council. appreciate the opportunity to come and speak about her upcoming. The Fraternal Order of Police contract negotiations. That's it. It's a contract impacts the way citizens interact with place in the way to view place. So so it's a fairly important matter. My name is mentioned as Greg Nicol. I'm and I'm here on behalf of the race. Profiling Advisory board. Professionally. I am a court administrator full-time and part-time municipal judge. I worked extensively with placing those capacities have great respect for the work they do. When he hired the police chief did a fantastic job. And it's not surprise. You had a fantastic processes filled a citizen engagement, a town hall meetings and many efforts soliciting community feedback in priorities. As the chief that you hired follows the union contract. It's important that we use the same process is and get the same quality priorities to that negotiation process. And I want to discuss. Using a citizen good strategy for This approach you know, this approach is reflected well and the job posting you have for the place should the Chiefs are placing a quote here. The next chief place will have an opportunity to advance strategies to reduce crime, to increase transparency. To rebuild trust. To improve public safety relationships and all communities. And we're looking for union contract that reflects those ideas that embeds him in the words of the contract. And cities across the country, they use these these approaches when they. Negotiate their own contracts. And they've done it with great results. Austin, for example. They had a nightmarish mask. Citizen deaths and massive problems. And when they negotiated the contract is down with extensive feedback in the community. They had town hall meetings and they solicited and many ways that that reflect what we did with chief of place. And isn't that process that the city of Austin learned that citizens need better ways to express complaints along with more options to resolve them. Their contract includes a nice clear procedures that people can follow and includes an option of mediation. And this is an option where citizens, if they feel. Discontent with how that speeding ticket transpired with the officer. They can raise a complaint and they can be heard. It gives the officers an opportunity to hear that and respond without a formal disciplinary proceeding. Is done a great job providing a springboard for more positive interactions in the future. asking is that you don't get the same opportunities in our union contract. Wrapping up with a personal story as municipal judge. All right. Yeah. Deal with lots of people who are not happy and have complaints about how things happened. I had one such opportunity is probably my on the bench. A defendant had a dog. 2 dogs are habitually getting out, killing neighbors, dogs and pats. It was tough. Before I wrapped up turn ask you had something he wanted to say to me. And he gave it was a heartbreaking story. But he said, yes, your honor and quoting him, he said, I. I was a pastor child of a promiscuous mother. My dad killed my mom. I was orphaned. I was passed around. had never had a family. He said my dogs. I listen to. Everybody had to say. Had he ever you don't want I could lead key point. But when it was over, he shook my hand on the way out. He thanked me. like I deserved to pit, he thanked me. You know, as you approach these. Union contracts with the place. With this process of hearing what citizens are saying. They will. Thank you. If you embed into the contract opportunities for citizens to be heard, even if the complaints. They Thank you. We're asking is that you? You approach it in this fashion. They can talk through their what they believe happened versus what they see on the video. What's going on with the officer was their process more open than that? >> You I I think there's a lot of parallels there. It's definitely better than the contract and much more clear fashion. Actually, we've got a few things to go topics that we've been you a couple times gone to the district advisory boards as well. So summary of all that information and trying to just present things and of course, all stand for any questions that folks have today. Background again, campaign Finance Act of the state establishes caps on the amount of contributions that any person with certain exceptions may make to a candidate for state or local elections that governs our city is a first class city. A separate act applies to other cities, which is what gives us room to potentially implement other regulations or restrictions on campaign finance contributions. The act requires an appointment of campaign treasurers detailed reporting by candidates for local offices. You all are familiar with for violations of the state law. The Kansas Governmental Ethics Commission's commission is responsible for investigation. We don't have a similar agency at the city level state law caps. The amount of contributions that may be made at $500 for a primary, $500 as well for general elections. Again, with some exceptions, Wichita City ordinance has an additional reporting requirement at campaign finance reports are also to be filed with the city clerk for city elections, though there are no additional rules otherwise for those campaign finance there's some symmetry between those right now on January second and ordinance was that this ordinance was amended to prohibit contributions from corporations and limited liability companies. 2 candidates for city elections. On January 16 council considered an amendment to reverse the action on January second and allow contributions from corporations and limited liability companies. In addition, do an amendment was offered from the bench to include a disclosure requirement for corporations and limited liability companies. Council voted to seek comment from district advisory boards on the proposed Amendment Amendment and return this item today's agenda. The proposed ordinance would reverse the action taken on January. 2nd, allow campaign contributions from foreign and domestic corporations and limited liability companies and city elections. Other entities such as sole proprietorships, professional associations, partnerships, political action committees. They continue to be permitted to make campaign contributions in city of Wichita elections. The amendment from the bench includes reporting requirement for campaign finance reports filed with the city where corporations and LLCs making contributions in city elections would be required to include the name of a managing member officer or director from the LLC or corporation responsible for making the contribution. So a single a managing member officer director, depending on corporate structure, but a single responsible officer listed along with that contribution. The proposed amendments were presented to the district advisory boards for comment over the past months. In those comments were summarized and attached to the attend report for your consideration. The proposed amendment continues to make a violation of the city's ordinance, a misdemeanor offense. also notice some language there in the enforcement kind of violations provision. That does also update our penalties to include a $2,500 a fine and 6 months in jail, which is consistent with state law. This makes all of the penalty provisions in this chapter basically consistent with state law versus the new one, which is kind of how we structured last time. But happy to answer questions on that as well. Our recommendation is for just consideration of the proposed ordinance amendment and again, happy to answer any questions that you all might have. I know that we the rest of the community to get a summary of the 6th district. what was the sentiment regarding Bears audience members? >> I wouldn't say there's a general summary among all of the districts and the districts that I attended. There was a difference of opinion and district one, it seems try not to speak for everybody. There were differences of opinion within the district advisory boards to but seemed a bit more in favor of stricter controls on corporations and limited liability companies. When tend to district 5, it seemed more in favor of the rules that we had prior to January. 2nd and maybe not even a disclosure requirement when I attended other districts were in favor may be in district 2. There was a bit more back and forth. I think in that district, some in favor of kind of the disclosure requirement approach some or in favor of the rules in place on January second. And so there really was at least what I saw a diversity of opinion on the topic and different districts kind of had different opinions as well. That but everything posted online. It's kind of. And it being the same document. It's kind of see almost just satisfied. Naturally, anyway was kind it, too. Yeah, appreciate that information for your district advisory board too. Yeah, no one at risk. said yeah. And it would only come up when there are differences. I think the reporting requirement for the city and the reporting requirement for city County state level and that's what is under consideration from the bench, which is why we might use it. So so if we require a reporting of the member of the LLC or corporation that entailed the city. >> To do more reporting responsibility. And the candidate would have to go to the county to report and they have to go to the city to report. Also, is that correct? >> At the latter, the latter part of the question I think is Craig, the city with not necessarily have more of a responsibility the way that we've structured it is for the information to be reported to the city, to then publicly available to city records are but no real direct enforcement actions such as the Governmental Ethics Commission. There's no analog action but there is a responsibility then to submit the information required, say the responsible officer of an LLC or corporation with the report that comes to the city. So maybe so that the county does not require that. That's That that is correct. Yes, therefore, you would have to come to the city given that information. That is correct. Yes >> Has been around about my apologies, which require a little bit more staff time. >> Yes, but I will say the way that the amendment is structured its not structured in a way that will necessarily require staff to review the reports. It doesn't have a trigger say that the Governmental Ethics Commission to investigate whether this information was properly provided. The idea being that the information disclosed for more public consumption and consideration reviewing that way. A lot like some of campaign marked the cam complaint side of say campaign finance enforcement at the state level still listed downloading that from the county. Exactly. Yeah. They would have to go and you have to. Can UK some way with them who that person is. And I appreciate the opportunity to speak before you this morning. Again. I'm here this morning as co-president of the League of Women Voters, Wichita Metro unit to voice support for the campaign finance ordinance passed by the council under the previous administration. At the national level, the League of Women Voters has published a statement on the topic, a copy of which you should all have. Again, some of your percent received at the Fort. To cover the highlights. It states. We work to ensure that our government serves the people not wealthy special interests by promoting transparent e transparency, limiting super PACs and eliminating dark money. Lbw. We are committed to creating a more transparent and equitable small-dollar funding system for elections. So all the voters are valued no matter how much they can contribute to the candidate of their choice. During this, make sure that candidates are elected on their positions instead of their funds and that communities are empowered organizations. Well, there is currently no state or local league position on this issue. There has been sufficient concern among our members that. We may be doing a study to develop a position and recommendations particular to the election funding. Our catchment area. I would anticipate that we would look into the ownership of contributing elsie's in light of a concern expressed that a single person might set up numerous elsie's. So as to contribute covertly in excess of the permissible limit of $500 at this point. I don't know that that's happening, but it would be a good question to answer. Or if you have the minutes from previous meetings shows that a number of people favor repeal of the ordinance because businesses have an interest in what happens in which time. I don't deny that interest. That businesses do not have the right to vote. Your job as members of the city council and the mayor is to protect and represent the interests and well-being. The citizens of Wichita. A charge that may not always coincide with the best interests of the businesses who contribute your campaigns. Any business person can express their interest in promoting a candidate by contributing in their own name. Allowing for both transparency and participation in the election process. And in that light, I would support the amendment that requires and LLC making a contribution to list a particular managing member. Personally, I see no reason that can be just put in report that goes to the county. So it doesn't have to be anybody's extra job. I mean, there's plenty of room in that space to put. A developer or whatever. And managing partners it. The point was also made in a previous meeting that raising more money doesn't guarantee victory. And while that is the erratically truth, the ability to have one's name in front of the voters more frequently than the opposing candidate can afford. Does influence voters, especially when disparity and finances and resulting exposure. It's great. By making sure that we're not having the same person setting up elsie's. And different under different titles. We can avoid that. Or again having the managing partner for each LLC. Which that. The question has been raised by Wichita should be bound by a more stringent standard. Then the state allows. I would like to remind the council that when standards are set by the state or the federal government. They set the absolute minimum base line. You've got to do at least this. For contact. Municipalities and counties are permitted to act on high higher standard. And as the largest city in Kansas, it seems only appropriate that we should be the flagship example for a higher standard of care and protecting the rights of our citizens to know that their vote matters more than the interests of deep pocket contributors electing our local local representation. It is the request of the League of Women Voters, Wichita Metro unit that this council retain the current ordinance as written or with that amendment that has been suggested requiring the designation of a and managing partner. In order to keep control and financing of our elections in the hands of the constituents represented independent of the influence of big money. I thank you for the opportunity to share these thoughts. Good morning. Mayor and city Council. My name is Janet Johnson. I reside at 5.23, West Carlisle. >> And that is in district 3. Years ago. This body function as it was intended as a nonpartisan entity for many, many years, Elsie's were limited in campaign giving. But unfortunately, as the federal and state governments became more divisive and partisan, this body followed suit and change the city ordinance opening the floodgates for LLC contributions at that time. The council is comprised of 6 Republicans and one Democrat. In a last-minute effort by a more bipartisan city council. They returned the ordinance to its former state limiting donations by else sees. Now, here we are today discussing changing it back. If this ordinance passes it. Another sad day for Wichita. Because influence by fellow season. Corporations leads to corruption. Forms of corruption can vary, including bribery lobbying extortion cronyism, cetera. Influence peddling is what I would like to talk talk about today. Specifically the dimension of quid pro quo. It's not practical to tailor our ordinance after the state. A lot because the state legislature does not award contracts to individual businesses. The city does that. Also the state legislature cannot accept campaign contributions while in session. Well, the council is always in session, so it's not realistic. We're talking apples and oranges. I've also heard the argument that businesses need a voice. But under the proposed ordinance, businesses don't have a voice. They have a megaphone. Last Saturday. I conducted some research and look at the many campaign contributors contributions that mayor we received from Mel essays. And I'm not picking on the mayor. It was just the easiest race to look at. Under the system is available. When family through their LLC, stress funds and individual contributions donated $7,500 to mayor was primary campaign. And another 7,004, her general election. That's $14,500, which seems like a pretty big chunk of change to me. And there could have been more. But it was a pretty exhausting process. But on another note, I was happy to see the numerous Pelosi's the fall under the vantage heading, which will be heard next at this meeting. Only 2 of those elsie's donated the maximum contribution during the general election. Now we're back to the subject of quid pro quo. If you think it doesn't exist, you are an informed. And I'm going to give some examples. The forward contracts for the ice rink and of concessions that century, too. We're negotiating by basically one elected official and laid heavily in favor of very those very well-known business entities. Both of those business entities are known for giving very large campaign contributions. In another instance, an elected official contacted the city fire marshal, not the current one and demanded that he sign off on a fire inspection where violations remain. course, the fire marshal refused. He was then threatened with his job. He retired shortly thereafter and with to another fire into tea and it was a huge loss for the city of Wichita and its citizens. In another instance, proposals would be unsolicited for a major project and one developer's plans, a confidential document were given to a competitor by an elected official. Guess what, that business another large campaign contributor ultimately was awarded the contract. And last but not least let's not forget protect girls, the Adus Stay Protected LLC that was created by a state legislator and a sitting council member to defame Brandon Whipple. So he could not win the election against Jeff Longwell. Guess who caps included and contacted asking them to contribute money to the safari at stake. That's right. The business owners and developers to contribute heavily in local campaigns. Every eligible citizen should be able to run for local office and had a fair shot. changing this ordinance, you are in a billing, the wealthy and people who have access to the wealthy and sending an open invitation for correction to have a seat at the bench. But fortunately and I obviously so I understand I understand your concerns regarding that, we'll see nothing we do today change that situation because it was not doing the candidate because there was an accountability because there wasn't transparency and because 3rd party action that we have no control today. So I just wanted that for the record. I appreciate coming up in sharing your concerns and I appreciate your concerns as well. And, you know, it was an ad Estate LLC in a state there. It is not transparent. And so the names of the contributors were not available. >> But nothing we do today will would have changed that circumstance. By the people and for the people. Because otherwise democracy parishes. Which election last fall in which one candidate range $633,000 largely from businesses to buy many, many, many attractive mailers and many, many, many media spots. Another candidate said he knocked most of the doors in his district meeting. Voters. In this city example, both candidates one, fortunately, the person who got so so much, much, much money appears to be a splendid percent. And so is the person who did the hard work to It is folders. These decision makers. Hopefully both have Ten's best interest in their votes. But it in in the future. It is certain. That big money will get what it wants for its events. Investment, big money candidates except what their funders want them to do. And those future elect. He's. May or may not do that. But it if they do, it will be in secret. This ordinance is about the future. Corporations are not. People. Businesses cannot vote. Businesses get their voice by finance scene campaigns. So for the future, we must all of knowledge that businesses are not people. A business, a success for their own profit. And yes, people need jobs money to. >> But people's goals and needs are different from LL sees profits and corporations. >> Profits. Our taxes should pay for our kids and our frail seniors, safety and street sweeping and clean water and snow removal and police and fire protection public transit. You know, yesterday is Wichita Eagle said the public generally thinks it's unfair to give that proportionate advantage. 2 wealthy donors so that they can dictate the outcome of an election. Abraham land. Can said a long time ago that democracy is of the people for by the people and for the people. I believe that Lincoln would realize that LLC ease and corporate big money over People. If I can find it. So this is the call. For LL Seas. I'd suggest they be required to disclose members who all more than 5% of the company. That would likely make the ordinance legally bulletproof. Because it's the exact same information they already have to give to the secretary of state. A representative from political contributing businesses should suffice for publicly traded corporations owned by stockholders, get 2 groups. But Letting LLC these use a representative as their campaign face. could be too big of a loophole. The actual contributors could hide behind an obscure employee. Even outside for acting as quote, their registered agent, unquote. That was the major hurdle. In ongoing the Caps O'Donnell planned then in conspiracy. But if it's right and is supported by the remaining members of the Old Council who voted to ban business contributions. Brandon Johnson, Michael Jaisol and Maggie Ballard. It's a dundeel, unquote. I'm in districts won and I want to speak on this a bit because it's becoming evident in our political system that the private sector. Has been overly involved in our politics and our policies for a bit too long and it's steering is in a direction that benefits a select few rather than the This city has been making active efforts to get the public involved. We have civic engagement classes. >> Where? >> Putting out the past year. I've been getting very involved and the way that the city functions, I've been learning a lot. About how it all works. And I see a lot of issues that are not going so well. And I see a lot of things that are going well, most recent ordinance that was passed by the last administration, I think is a good first step. In addressing how involved the private sector is in our politics. And the way that our city our usual rate of voter turnout is about 12%. And I think we can all recognize that that's an issue we want the public. We want people to be involved in with the way that our city is run because as more people speak up, we get to see what effects, everybody, what is important to everybody and we can come to a consensus together collectively and that's what we're after I appreciate how Glasscock pointed out that this ordinance does not solve all of the problems that we have with the private private sector being involved in our city. But it's a good first step and we need to be vigilant and the way that we address these problems and starts really investigating from a public and a city level. All of the different levels that go into like I've been so active and still the mechanisms of city government. Our little beyond There are very complicated issues. So I think this ordinance will help the public be more involved. Will encourage more engagement. And that is going to be good for everybody, including the private sector. They've got their own interests and those interests sometimes aligned with the public, but not always. But as one of the other speakers pointed out, democracy is for the people by the people of the people. And that's what I would like to see voted on here today. So I advise the council to support the previous ordinance in place. And then to let's take the next steps to see how we can improve upon Thank you. >> Good morning Council. And then it's just like, well, wait, I'm a retired health care executive. I've talked about my experience with contracts and technically in contract language. And individual person is identified as an individual person as well as natural and legal entities. Soaps. You know, somebody who wants to hang their hat on that, you know, a contribution could be by made by an entity, but still technically it's a person right? So out the window that land. And then it occurred to me that I feel like letting Elsie's make additional contributions to me, in my opinion, that feels like a cheat code. All right. I had I still have 5 kids in my 5 kids and they, you know, did their share of gaming and so forth. And so there was a lot of conversations among them about Chico site, not an expert. And I thought, well, maybe it's not really cheat code, but a cheat. Cheap as Cindy valued. And what is it value? I think it D values the work and individual does in research in candidates and who they want to represent or who they want to contribute to. Right. So one person does research. They decide who gets their hard-earned money and then they make that contribution. Its effort that goes into making those decisions researching staying up on what's going on locally being involved. There's effort that goes into that. When you allow LL Seas. 2 also. But money. And so one person, they do the research. But then through their LL seas, they can make multiple. Contributions right? So that's where I get that kind of cheapens the effort of those who really invest the time to make their decisions. Don't cheapen the efforts individuals investing their hard-earned Hard earned money into your candidacy and supporting your election. Value that. Not allowing Elsie's to contribute to elections. Women for Kansas took in January. We support the ban on corporate money in city elections. Women for Kansas supports elections based on the exchange of ideas on policy debate citizen engagement on candidates listening to community needs. Interestingly, there's a theme here today, women for Kansas also channeled Abraham Lincoln. I actually reside district 2, but I'm here representing that regional Chamber of Commerce. >> On behalf of the chamber and are nearly 1300 members. Thank you for the opportunity to speak to today regarding campaign finance rules for city elections. The chamber supports reversing the ban and restoring the rights of corporations and limited liability companies to contribute to candidates for city elections. The chamber believes the current restrictions violate free speech rights and discourage local businesses from participating in the political process. At the very least, the current ban on these types of contributions does not conform with previous legal decisions and state law, the United States Supreme Court's landmark Citizens. United decision prohibited the government from restricting independent spending for political campaigns by corporations and other businesses. Additionally, Kansas State law authorizes any person to contribute up to $500 to a candidate in city elections per election cycle. And this case, the definition of person includes any individual committee corporation Organization or Association. This ensures consistency and fairness among all stakeholders in Kansas and Wichita. Equally important businesses of all sizes, create jobs and sustain the Wichita economy. They are important stakeholders that should have a voice in the election process. There are already in place contribution limits and transparent reporting requirements that regulate the process. The chamber supports reversing this ban and restoring the rights of corporations and LLCs to participate in the process. Thank you all for your service and for allowing me to speak to today. First of all, I think including the dads and your amazing presentation that you came to all of really opened my eyes as to why Citizens United doesn't have any bearing It was a really great presentation. I know all of you have heard it, but maybe not. All of you have heard it. He explained that the difference between contributions and expenditures. I asked the question, what is this amendment to the ordinance trying to solve and basically the discussion in our kind of revolved around that. But basically in 2015, the ordinance was changed because the city wanted to protect itself from liability from Citizens United. I think they overextended by doing that because expenditures and campaign contributions are different things under the First Amendment. Anyone has the right including elsie's impacts and everyone else to use use, their voice and contribute whatever they want. However, campaign contributions are different than expenditures. So as a natural person speaking for other natural persons, I feel like going back to 2015 and not allowing Elsie's to donate reflects. Houck. Citizens United still protects expenditures and all of us can donate to as many packs is in want, businesses can donate to his many packs as they want for all of you and for anyone else, however, limiting Elsie's, but keep it to natural persons specifically for campaign contributions. So when I look at what this ordinance amendment is trying to solve, it feels like it's administrative burden on anyone running to run doesn't really address the problem that people trying to solve. And I hope that you oppose this amendment and you will consider sticking with the original 2015 slash what the last administration in January. Thank you. >> And some of Glasscock. But every business could form an LLC for every LLC cut 4 point wash. Limited liability companies can form political action committees that have stricter reporting requirements. Forgive me for being a bit and I am educated enough to know that corporations and big money have way too much power in our politics and so I am in favor of keeping it the way that it is. There's no need for additional corporations, too. Donate big amount to many. Be better used to and the schools if they want to donate the money to are schools that are potentially being shut down for the homelessness crisis here in which a tall really anything else. I think. Anybody who is campaigning knows that. So that the money could be used better somewhere else. Marchetti campaigning can really done for free. You can hop on any social media market, your campaign, you can walk around market your campaign. I think it is very telling. On each individual on how and I think it's also very telling that each individual per se who has came up here has all agreed on the same thing. I'm happy to >> all. Just a tax Dozier from district one. Scribble in some notes. Real quick at the last minute to talk to you all. I serve on the DAV but more relevant to I serve on the board. The International political consultants working on campaign finance ballot free and fair elections around the world. And I've worked in multiple states on elections with the way this got pushed at the end of last year, bother me because we've never had a chance to talk about the deaths. I appreciate it. Now going to the deaths. There's often some misunderstandings when it comes to campaign finance and history of that, we're talking about citizens United when the reality of a lot of these restrictions go back many, many decades after all, it was Washington, 17. 55 who lost his first race 20 to 321 and then came back with money from friends to buy 70 gallons abuse and all this other things. That's next election and win. And then in the 20th century, we saw actual quid pro quo for jobs being made called the campaign tax. So a lot of the reforms in the 20th century we're done to tackle those actual levels of corruption and the 20th century we see with that Hill will act and the Taft Hartley Act bans on corporate and Labor Union involvement directly to campaigns. That was in large part with the rise of the industrial state as well as sophisticated marketing campaigns. The incumbent started getting unhappy. And so Tillman outlawed the corporations going direct to campaigns. And then when unions organized in mass in 1944, 45 the powers that be didn't like that. So they've and the involvement, labor unions directly with campaigns as well. And so ever since then, the first PAC was formed in 1946. By a conglomeration of Congress for industrial Organization of Unions. So we've had this issue where even earlier someone talk about the partisanship this el season corporations, the reality is across the states. We have 25 states to allow corporations to give directly to campaigns. 11 states allow unlimited contributions to individual candidates. There's no there's no overlap between parties with that and that 11 states of limited you have Pennsylvania and Texas in those 25 states of allowing corporate donations. You have California and you have New York and you have Florida. So I bring that up because I look at my background working in states where there was unlimited contributions and often it was those states and those areas where we could take and get real change. After 20 years of incumbents on city councils or incumbents who are entrenched with PAC money going to them that individuals can give to a state House candidate in Texas is challenging 5 more than $500 an election cycle that middle-class person can cut that $100 check a month. And that can make the difference. And so I bring that up because right now we're looking at the bigger issue of litigation is not being in compliance with Citizens United because the states have been allowing these contributions before says United that was independent expenditure. we're looking at Kansas for 35 years, not updating their contribution levels, which is an injustice, I think because the emphasis of the 3rd lowest in the nation. And you have to think about inflation, you have to think about the cost of running these campaigns. And I think about how much ballot access is not had because of that. Incumbents write this legislation often. And so as much as I would like to see and I was like it. Breakdown in and go through. Some of the other thing said as much as I would personally like to see no corporate contributions directly and the labor Union contributions directly. I have struggled with that because of the limits that are currently in place. I'm personally I would like the state, the city to look at what the 2024 governmental Ethics Committee recommended. We say didn't vote on it. The state legislature because it's an election year, which is we should be looking more to increase these limits so that that money goes directly to these campaigns to be used by these candidates. Instead of those interests using that money outside under their own direction for their own guises. And so I look at that and a lot of these things right up where a lot are already illegal. Quid pro quo is already illegal legal asked the Mayor and Council of Allentown, Pennsylvania. But I I think about all those folks who have one run and all those that I helped get elected in and took it took the stand going back to folks down ballot, but also even think about Eugene McCarthy who ran to expose the trouble in the Vietnam War was 5 million ares backing him. It was that seed money that then launched a campaign to prevent Johnson adding a second term. So I would ask that and either you keep the elsie's if you keep the elsie's the way to clean that up is instead he's having a director or officer listed. I would recommend more clarifying amendment that would have elsie's list any members, including multiple members and corporations listing the owners or shareholders. And so just a registered agent an officer because those don't have to overlap. If you want that transparency. But I also test the council and hope that maybe you can look at a true future reform. And so the short term discussion we're having right now, ice and questions and I'm happy to talk to later about this for further reform. Thank you. >> Councilmember Thank you, Mayor. Are we allowed to alcohol been sent out with voter registration forms or beer at the polls or anything. Just ask for thank >> My name is Jess Bradley. And I'm in District 6. I was it that I was at the meeting in 2015 when the previous ordinance was changed to allow these Unlimited LLC contributions. And there was quite quite a a large number of people there. As I remember speaking against this and I'm kind of surprised to hear. Your point that this was done. Then. With the idea that they were breaking the rules based on Citizens United. I I did not know. That that was a mistake or and a misunderstanding. But I think we should consider that. I'm real concerned about policies in the state legislature in Kansas and the proposals for continued disenfranchisement. People. The Senate in Kansas just passed ordinance are at. They just passed a bill remove all the remote ballot boxes in Kansas and remove all of the electronic voting machines in Kansas and to count all ballots by hand. I just I can't believe it. So this is another area here that I feel like it on the side of disenfranchising voters. Tim pointed out that the percentage of voters voting and the city elections is that unbelievably low? But I mean, how how are we going vote? I mean, what are we going to do? Powerless when you're standing up to huge sums of money like that. Oh, what's the use? So in order to increase, you know, voter participation. I think it's great idea to 2 leave it at January. 2nd, a change. 2, a and and there were some questions that came up in that discussion about. Foreign and domestic contribution said they were not allowed before, but now they are. I mean, there's still a lot of questions. I would ask because of the discussion here. To even consider for the council to consider postponing this discussion again and to allow more input because that's only going to increase democracy here. So I ask you to go back to the to stay with with the current ordinance. Prohibiting the said country patients. And even possibly a table this for now. And continue the discussion because I think it's great to hear. And I think there's still a lot unanswered questions. Thank you. >> Good morning, Sir. Lester set district 5 native? And I'm familiar with what you're talking about today as Iran and the mayor campaign and benefited from both sides of this issue. My background is I was a chief internal auditor. I was a fraud investigator with the FDIC. So the most important thing I had to do in my professional background was wage truth and transparent, say which was also issue. And the mayor and city council election. 73% of voters don't trust City Hall. So I think the most important thing you all can do, specially the new members that are sitting before standing before me sitting before me today is to bring truth and transparency to city Hall. And what disturbs me about campaign reform and allowing LLC corporations to contribute is all of a sudden money starts influence the elections and there's no way you can deny that if you can pay for door knockers and you can pay for mailings, you're definitely going to get more exposure. Then someone who is running a grassroots campaign. It's just common sense. And when I look back on how safe century to started, we started because we didn't have a voice. The businesses do it. Riverfront master legacy was a plan of businesses that got together and said we need to destroy century to win the former library. Spend 1.2 billion to put an underground parking to swim in the Arkansas River in to do other things that were incredibly not financially sound. But when we tried to speak, when I tried to have a voice at that first July 31st meeting we were told Citizens cannot speak. This is not a discussion open to the public and that stunned me to realize that the citizens of which had no say over 1.2 billion dollars and that's once a century to start it. So here we are today talking about the influence of businesses and I tell you, I don't know how it happened. I grew up here, but businesses an LLC is haven't outgrown influence on everything the city does. Our tax incentives. >> On money spent on the hotel guests tax being given to private developers on the Wichita Ice rink being allowed to be deteriorated and destroyed as a local family who gives campaign contributions moved out. Something's broken in Wichita. And that's why 73% of citizens don't trust City Hall. Now this is not perfect. And Councilman, Glasgow, Ky appreciate your questions. You're showing this analysis of the pros and the cons, but we have to step in the direction that takes special interest and influence of businesses out of city. Paul decisions. And I still see on the agenda where we look at businesses that are asking for an expansion of base. For property tax abatements for things to give them a financial incentive over average taxpayers that may be struggling to pay their bills to pay their mortgage, our school clothes or schools are closing. And I look at the school closings and I realize that's because we have tips the take. Property tax increases away from school districts. It just seems like we need to do it. We can to support citizens and give citizens a voice in elections. When I look campaign and I'm not going to call anybody out. That's not me. I'm not trying to embarrass anybody. But I saw 13 donations from one address. I saw 10 donations from a P o box. I saw 6 donations from address on North Market. And I know that that is a real estate company that financed the campaign. 6 donations up to 13. That's just giving businesses and overstated influence on the decisions you make every day. So I'm asking you, it took 4 years for me to say campaign contributions reversed from the 2015 decision. And yes, it was an emergency ordinance. But I saw former Mayor Hughes the emergency ordinance to get the ball stadium in without a vote. So don't let that sway you. You've given this thought you've presented it to the dabs. I appreciate that. But please do it. You can't to take Out. LLC is and these corporate donations that are sway in local elections. You know? >> I think if someone came to me who had given me, I'm just going to be honest, 13, $500 donations that totaled. Over $6,000. If they call me on the phone. I would probably answer their phone call before an anonymous phone call from someone I didn't know. I do think I'm just being honest. It's our human tendency. They would get my attention first. I want to start by a company on the quality, the meetings that have taken place since the new administration. It's much more pleasant to watch you. Folks less acrimony. Or car. and it's been a pleasant experience for the rest us to watch. Perhaps this is the outcome of electing another pretty face to the council and not just talking about JT Johnson. I'm talking about all I appreciate that. I want to speak last because they want to give an opportunity for the primary beneficiaries. Of ordinance to come forward. And thank you to Janet and 2. So last for Dana find who those folks are. They're not here. The primary beneficiaries did not want to come forward to say why that's such a great deal. Think about that. A couple of folks referenced quoted Abraham Lincoln. I'd like to quote another. Noted leader. In a recent comment. He said. Wichita has made it very clear restoring trust in City Hall. Can't just be a slow. It has to be the way are city leaders live their lives and governor, I know this starts with me. It's a day I will work to make City Hall work for the people. Keep partisan politics. Out of city Hall. Lead with transparency and governor with integrity. Recognize those words, their will well spoken and it certainly gave him courage and all of us. Keep partisan politics out of city Hall. And yet here we are. Considering a change in the statutes that's clearly driven by political agendas. Rhetoric comes so easily on the campaign trail. really difficult to live up to it. Once you get into office. But here's an example of how that works. On the merits is not the status of the individual is sacred cornerstone of American democracy. Corporations are individuals. They don't vote. They don't live and breathe. They don't deserve a seat at the campaign finance table. Corporations are already well represented through the contributions of individuals who own the corporation. They're not denied that access. A corporation can have multiple owners, each of them entitled to make a donation. It's not Why should the corporation itself and non-human entity be entitled to influence an election? That doesn't make any sense. And they also have noted through packs to contribute as well. So why add another layer? Of opportunity to influence an election. So what's next? You artificial intelligence to run the elections. where do where you start to take a stand on behalf the individual? You're headed down a slippery with that I don't account jobs homes caused overhaul has reference to role of hardworking getting elected. That's certainly true. When you pound the pavement to talk to people, you make telephone calls. I councilmember got elected the first time faced other is from Adam in terms of campaign finance. But through individual effort, door-to-door, successful, that can happen. But we know the reality of money talks. That's why we're here. And it's it's not going to change by giving them more opportunities to get more money. So Mayor thank you for that statement on election night. I do hope that you can follow through and take the lead and restore this bat, recognition of the role, the individual in our democracy and not corporations. So one of the folks who posted it made this comment and I believe it was to the speakers or maybe to the council that these people understand that an LLC is owned by a person. I think that's the point that was the point of the January second decision was that Pelosi's are owned by people, even those that are 12 lcsd. Somebody owns it or a group of people. And the argument was that no individual should have more influence. Other folks not to demonize a little sees, you know, we need our local businesses, but the fires, an individual can make 14 contributions to someone through various Pelosi's. I am that person. The LLC is out of living breathing. I am and I get serve more influence than other folks by having little season. I think that was the of the argument. I think to that I'm definitely supportive of the January second action that we took. But if council was going a different direction, I think to the point that elsie's our people that and this came up at our dad as well. But any owner? Of over 5% of company shareholder, whatever you might call them should also be listed. If we do go down that path again, the transparency aspects for people to be able to see who is contributing and while it is a step in the right direction for transparency to have a managing partner that still doesn't answer the question for many people who want to see who is actually contributing to the campaigns, whether they like that or not. But if you see Brandon Johnson show up 14 times on someone's contribution list. At least you know that it is a behind that LLC given 14 different times, whether or not there's anything that you could legally do with the state. That's a different conversation. But at least the public would know that my name has been listed 14 times. It also saddens my heart during all of these meetings, that assumptions are made, that if you are an elected and you receive illegal campaign contribution, it automatically means that you are correct for can be influenced. I have not been influenced nor will I ever I will continue to make my decisions based on what is best for Wichita. So I just want to round out my comments pacing. If people are concerned that people are influenced, money is going to get to candidates no matter what if we keep the current system now, money will just go to packs and then it will be less transparent than it is now. So I believe that if we're striving for the most transparency, we should continue. We should go back and reverse this. So that LLC Hughes, who are a part of our community, can also have a voice. What a business wanted to give me finds out just kind of ran to the rules with myself and said you can only give me 500 in the primary from was enough to get through the primary. You can give me another 500. This is what it has to look just like we educate individuals. You have to give your name address. I think it has for profession or positioning your job. Employers. So we'll just be added to that. And if business didn't want to give that to the candidate and the candidate with no one, they could take their contribution or the fines they would face if they did. ISIS will question for staff. >> There's nothing prohibiting any candidate from doing that already. And I think the idea would be some sort of supplemental form that can provide the information for the city requirements in the way of kind of. have this discussion at least a little bit thinking of it, some like when someone applies for a drinking establishment license, they do so the state and the local level and we have slightly different supplementary forms to provide additional information, including things such as 5% ownership. Of corporate or LLC entities. So it would be additional an additional form we have to put together. But I just don't mean to suggest under what's being proposed that city staff is reviewing those to confirm anything necessarily, but that the information that is publicly available. >> Vice Mayor Ballard. Seems like it has the same sort of test that was kind of are a few it allows at least more a contribution by the LLC in Corporation, then a total prohibition contributions in city elections. >> Remember thank you. So I just don't want to suggest I don't think that information is so confidential that requiring it for campaign finance report would put the city at risk if any liability, because we do ask for it again, especially alcohol licenses. This comes up a whole and there are I believe it's elsie's where you do have to list 5% more or owner of your ownership on your annual reports So yeah, I think this is part do own a corporation, but the seems to be pretty standard kind of reporting requirement face. >> So then my next question, just make sure understand is right now when candidates are filing their campaign finance reports, they filed that they take it to Cedric County Election Office and they finally using state forms that we get from the state Ethics Commission. So a candidate would still complete that documentation. And then create some sort of subliminal documentation that would be given to the city clerk the same as our gift report. I'm guessing. Is that correct? >> I think we could do it anyway. That the council would like to if this is the path that we'd like to go, the city could prepare for him. That candidates the news and fill out and submit to a similar too gifts, for example, if we'd like to leave the onus. More on the reporting entity, if that would seem I think that's an option as well. It's not. I don't think it's specifically stated here, but it's. >> The idea was more that we probably have some sort of document to help with the candidate to fill out and submit the proper information to us, whatever it might be that council would And then with that be housed our city website so that people would go could go look for when they're trying to make their informed decisions and voting. >> It's not stated that it would necessarily be on the Web site because it's not. I think we'd probably say you can ask for the information, but it's not. As written publicly posted, likes a governmental ethic Commission. Campaign finance reports. That's something maybe we could do. I think legally we can. It's more of a technical issue, I guess suppose. But as written, I don't think that's dictated that it would be posted publicly but would be publicly available upon request as an open record. >> And, you know, again, my mind's are swirling people even know they can do that. Action Committee under that deal see does not have to list who. The LCS do it in a political action committee. Just the LLC is listed as the contributor because we can't. Require the disclosure for that. then ever, so one of the 5% owners could donate to candidate through their own separate form political action Committee. Receiving donations from an LLC that we don't have the ability to. Add a disclosure requirement to correct. >> wouldn't say necessarily have the ability. I suppose we could require political action committees like at the federal level to further report when corporations and LLCs contribute to them. That's kind of how that operates for packs at the federal level. But that's not situation here. body does not have the ability make that determination. I think you don't want to live I think you could. I think based on our analysis of state law that would be a more restrictive kind of control on campaign finance. And we think that's the direction that the municipality can take basically here. But that's But that's not really being considered here. And under the amendment that is potentially a way sort of around, I suppose I did want to know before. One thing I didn't say political committees to have to be multiple people. I don't think that necessarily effects here hypothetical, but I did want to at least throw that out there that it's got to just be multiple. That's the whole idea there. So. >> Comment from the bench is. In doing this. There are so many loopholes that people can take advantage of that are not controlled by this body. That reduced the amount of transparency that reduce the amount accountability in the process. And that's what we're all in Happ this board. I believe every single one of us wants transparency, accountability. There are plenty of ways for people that abuses of the system to be able to take advantage of loopholes that we have no control over and by implementing council Johnson's amendment to this. We increase the ability that people are taking advantage of loopholes where we could restore transparency, accountability through us as nations are held to us and we are responsible for the money that we spent. question for staff as well. The original red, approximately 2.3 million in sales tax exemption. The revised reads up to 2.3 million and sales tax exemption. Again, the reason why is just as as a result of the conversation with City Council 2 weeks ago and ongoing ongoing negotiations with the The request has that. These these changes to the lever letter of intent will allow the developer to pursue. Perhaps a smaller project One of the earlier iterations of the project roughly probably about a 258 unit apartment That would not be reliant upon. Leasing parking from the across the street. And however, we still a really, really excited about what this project would bring to the downtown and we will continue to work with the developer to determine if there are ongoing opportunities to to scale that If we can come back with a mutually agreeable terms and conditions of the parking lease agreement. We can get this. These amendments allow us to do that. But at this time again. With the applicant's request and are supporting that request. Our recommendation before you is. Adopt the resolution of intent which references the letter of intent, which has been distributed to you all here but that we request a recommend they recommend that you table. And definitely the. I have is please explain I R be and what is the risk to the city? >> Others, 2 components of an industrial revenue bonds, right? There's the sales tax exemption component. And then there's the potential for a 10 year property tax abatement it's a financing mechanism that allows for the owner developer be exempt from paying the sales for construction commodities furniture fixtures equipment, etc. During my life for the construction project, the 10 year property tax abatement is based on a cost benefit analysis. Right? And so all of that's been conducted. That information is available in the staff report, even at the scaled down version still exceed don't benefit ratio of greater than one to one. And so it's that financing mechanism that allows the property be held in a lease leaseback finance structure to receive that 10 year property tax payment. there is no risk to the you're not. These are not taxpayer dollars that are being put into the project is not taxpayer dollars that or risk this is entirely performance-based. So if the developer does not perform, does not do the project, there's no real as Asian of any tax savings. So this is just a financing mechanism. This is just a tax savings. There are no Is there no public tax dollars that are put being put into the project noticed of the city? >> Will they also alright taxes on that property? >> Yes. So as part of all of these negotiations, we require what we call time pilot payment, a payment in lieu of taxes. So the current tax obligation that is on that actual today will continue to get paid over the course of the next 10 years until doubt property tax abatement is a and them in your 11. All of the tax obligation will be paid. We do this so that existing taxing jurisdictions, just 2, 5, 9, the county, the city continue to be made whole just as if the project didn't occur. It's only the valuation that is being added as a result of the project is realized by owner developer. >> And last question, how does this help address greatest right >> So address is one of our greatest needs related to housing. Right? When we when we talk about housing, we talk about housing crossed. In calm brackets right? It's it's it's variety its options, right? We need housing of all sorts of Ty and types, right? We've given presentations to city council is part of workshops right? That not only is housing across price points, right, but it's also very housing types, right? It's not just single-family or to family or townhouses, but it's also multi-family residence. Our community needs housing and we need housing of all sorts and types right? Folks are in different places and different circumstances in life and what's appropriate for one individual or family might not be appropriate for. >> Another individual or family, right. So much like any financial advisor will give the recommendation will be a but have a diversified portfolio. Right? And so we take the same approach with housing. So across price points and across type. Our community needs housing. And we believe that this begins to achieve that included in staff's report, right? some results from invoke study, right? The talks about absorption rates and the recommendation from outside consultant to know and understand this industry sector have recommended we have the ability and the up particularly with the introduction of some other projects in our downtown that our downtown urban core can absorb this type of. Investment in our downtown and in our community. So we're really excited about whenever we talk about housing, the addition of housing stock to our community. >> And so class 2 for says there precedent for similar tie of tax abatement being offered to a facility. >> Yes, there are a couple of other projects that we 4 we have offered and there has been an as part of the multi-family residential project. Yes, we've used industrial revenue bonds for you public, more popular tax increment financing. But yes, there are examples of multi-family residential projects that have taken advantage of the tools that the city has to offer. Second question of that. There's been a few talking heads that I think incorrectly understand economics. 101. Can you talk about the basics of supply versus demand and how it affects prices? >> Especially for housing. Yes. So our our philosophy is taking that macroeconomic approach, right? That. >> Where there is little supply and greater demand. The result is an increase in cost right? alternative to that is, you know, if we can increase supply. And if you can't have supplies or to outpace demand at the end of the day, demand becomes more competitive supply becomes more competitive rates become more competitive and we can keep rates and prices low. So which again continues to add to the argument of encouraging more and more housing of all types of all price points because housing that we can introduce if we can sort least keep up with demand. Prices will remain low for as low as competitively possible. Right it's where you have low supply and high demand that we start saying the rate. But do you given all of the great news we've had downtown kind in that area that that parking lot site will get developed if it's. Not a parking >> So answer that and maybe 2 ways right? Number one. Could it? And number 2. If it were what would be the implications of race? We went through a little bit of an exercise. Number one. We have not received any interest. By anybody thus far. Right there are some challenges associated with the site, right? It is located right next to a railroad >> which hasn't necessarily deterred other businesses, right? But >> there are some challenges with the site right? At which may be why we haven't seen interest in the site up until now. The second part of that again, we went through a little bit of an exercise kind of. Placing building footprints on the bill on the site. This is a very large parking lot right. Just to give a scale and perspective, you could put Intrust Bank Arena. On this site right and so that's on one end of the spectrum. Again, nobody probably building another interest bank arena, particularly on that side on a smaller version, right? We've we've looked some hotels. We looked some grocery stores right? And for all intensive purposes, we feel confident that if we were presented with a development opportunity that we could support both that future development opportunity as well perhaps a multi-family residential project and still be able to provide sufficient parking for both sweet. We want to take the approach to we do want to pick winners and losers, right? We really want to bowl build up the entire system. And so to answer question, no, we're not have not been presented with any. Interest or proposals that but if we do in the near future. We definitely have room to park. That project as well as others. >> So with the with the last green mat, if remember correctly, I just read this and tried to forget the So the last agreement had some pretty long opportunities for future councils to decide if that state parking lot. And I think the number was 60 years backs. The shortest was what, 10 or 20. And then there could be some consideration of that entire area was developing. The agreement as it's written now. Provides. Right and access to parking. It may not necessarily be the most convenient. I, you know, close in proximity may not be the most of but the way the agreement is Britain, yes, we are committed to providing parking. That's what we want to do. part of that, that's been our conversation over the last year anyway, right? As we the parking mobility plan as we rolled out our This parking as a personable. Good, right? We want. To provide parking and we want folks to utilize parking in our downtown to improve the development opportunities within our urban core rights. We want. So the way the agreements written yes, we would continue to provide that access to that parking. And that's where we kind of gotten into this. Agree to disagree. Perspective, right? We feel like we are going to be able to provide the parking. It may not necessarily be the most. Highly desired, which there's concern from investors and tenants that if it's not readily accessible and available on and within close proximity, etc. >> But impacts ability to to do. To perform. Right. So that's where. >> We'll continue to negotiate with them and see if there are opportunities for mutually agreeable terms and conditions, right? But I based on the language written. We feel as though there's opportunity for both able to park a multi-family residential project as well as future development opportunities and we'll continue to work towards >> but I hope it works out. Thank to to slow friendly pushback with the supply and demand model and scarcity. That is true. The more units can reduce the price because you have more supply, but also government sometimes as a referee can get involved and shift us in that direction. And right now we're not because of perceptions of state law, but I still think that this body should find ways to require affordable housing and that with this project, of since that wasn't negotiating front, but I think that we can and then the free market will see that at least this government more serious about the affordable peace. And look at adding in voluntarily affordable housing units as well as understanding they were to seek incentive from the city of Wichita that there would be some requirement there. Oftentimes it as we look maybe a loss, a fair type of government. We just sit back and watch and hope. That things change. And still always believed that governmental body scan shift us in that direction and we should we can. >> And then hopefully think our actions speak to the fact that we want folks, right. We want all of that as are aware, right? We're We've submitted a low-income housing tax credit. We're trying to add some 260 units of affordable housing to our right. Very impressed and that parking plan try to limit those big surface. Lots. So there's a big surface lot this 100 feet from Intrust Bank Arena it's right for development. Just like the couple. Lots are right across the street to South. Of the of Interest Bank Arena. The point is why should we tied that land up for a long term? They would go back to developer. I'll just speak for me if I have a right to that land. city wants to come. As as a major partner, I might be willing to do that. But if I had best ERs, it's a way to City. You're getting a million dollars that want 500,000 for lot. So it really handcuffs handcuffs to. But because she a process for that hot. So that's my concern. I don't want to tie a city has set up. It's a prime real estate. True or ever tracks there. You can mitigate that by putting that three-story parking garage. The city could partner on that, but hotel above it, put more apartments above it. You know, there's ways to mitigate track. So that's my concern. Time parking. This gives the developer a chance to do. Have an agreement and negotiate with other property owners. Including Cargill. Or for parking space to maybe get to that. But we now have a developer looking at developing that entire corner, which, you know, that's part of the front door in the downtown when folks are going up and down. Kellogg. So they'll be this a nice amenity. And this developers take an interest in the parking lot. I don't know if anybody had before that. So you know that we do have one person. And it's great encourage them. A look at the property adjacent to him. I would just hate to see everything's kill down because they had worked out an opportunity that now. I think because of some. Baby assumptions of future development that have not materialized yet they wouldn't be able to take advantage of part of the park and study show that which that are really needed to shift into open parking lots and kind of build up. The agreement I believe would allow for that and some time. So the rest of downtown develop over 10, 15 years, 20 years, I can't remember actual term about one. And then a conversation could be had with this developer in anyone else who wanted to develop in that parking lot to say the city has this potential renewal coming up? Can we build up for parking and develop over that? And then applicant still would have parking and anybody else would be able to park at a of. But that was just my thought on it. I just wanted to know if we thought it was going to develop pretty soon. So 2 questions I really would like to know how much King Frates panned for the Gander Mountain parking lot that we own that we give to them now freely. And I just want to see when there's a cost benefit analysis. How do I get a copy of that? To just take a look over time? I'm accountant and I just be interested to see how that one to one ratio is calculated. after core, it. All again, I send emails and I don't get responses. But should I email somebody to get a copy of the cost benefit analysis. All right. Thank you. The last thing I want to say about property tax abatement. I'm leery of those because keep in mind once they build these apartments, what's going to happen from an accounting point of use depreciation. So in that tax abatement ends, are they going to pay the initial value of those luxury apartments. Are they going to pay the depreciated value those property tax to follow me on this? Because if they're paying the depreciated value after 10 years, that means the school districts that would have gotten the full value of the property tax aren't going to receive it. They're going to receive a depreciated value. So that's a question I have to. And you do these property tax abatements on luxury apartments which indicate to me the developer should be able to cover it. couple questions. Yeah, we think the last time in 1954, 18. 54. Okay. So it's a project that is currently bringing a status quo minus appraisals of the same tax revenue for those 70 years. So it's not a project that was recently something else or taken off the rolls that is likely to be developed outside of that. So I think there is an exception to the rule in terms of getting us back on the tax rolls 10 more years. So 80 year theoretically the current tax abatement and then it will increase into the tax rolls more long-term after that, correct. >> Could use. So a tenure abatement, correct? thank you. Would put us back on the rules years on One thing I would be interested in this body look at in the and I don't want to pull the rug and are you for this project stair step an approach where you're one, we're at 100% year to or 90% abatement. Your 3.80%, abatement. And we're slowly getting back on the tax rolls. I think developers at all. So, you know, when we get to your tenants on a complete hit of, hey, you're going 14,000 to 5,000. Speaking up, a number and it allows in it adaptation to slowly put something back on the tax roll. So from a body standpoint, I would like to look at that in the future. We talk about how we doing and so we're still I didn't sense a developer, so encouraging people to develop, but it also has more power to public, encourages to be able to develop, but also that we get return on more quickly. So they'll be something I would love a further discussion for. In addition, I'm excited about parking plan. I want a parking plan to happen utilize lot. We have a lot of and utilize lots and so but I do sort of make sure it's fair market value that were not actually profiting off of the that we're not losing for taxpayers as well. And so I really do hope we come back with a parking lot agreement that is fair market value the city can break even on that were also utilizing space instead of creating another park in asset unnecessarily. have tons of other parking assets. How can you lie something that's been underutilized now? So thank you. >> Vice Mayor Ballard. Thank you, Mayor. I see my job as a council member to use incentives wisely and in the best interest of the taxpayers and residents of Wichita. In the past, I have objected to projects that don't fit the neighborhoods in which they sit like the delay, no housing project. They wanted to replace Parkland and historic neighborhood with multifamily housing. In my view, there's no better place to build multifamily housing. Then in downtown. District. 6 is very a very diverse district. And when I ran for council, I promise to represent each part of my district and ensuring that I consider their unique needs. Downtown Wichita, like or so the overall needs more housing. needs housing as quickly as possible because of the new schools that are being built. For the first time in Wichita. In my lifetime, we have a real need for a lot of apartments to be built it very quickly. We have a housing shortage and I want to use our low risk incentives like those proposed here to encourage developers to turn these unused commercial buildings into housing. And to get as much housing downtown as we can because the kind of density is what will support the downtown versus store. So many of us want. So for all those reasons, I will be supporting this project today. And I want to encourage development downtown so we can preserve historic housing in our historic neighborhoods while simultaneously addressing our housing shortage aggressively. >> Councilmember whoa, I still thank you, I struggle one I am okay with the park and I think it's good to work with the private sector in order to utilize our parking spaces and actually as some investment and also K with waiving the taxes on the construction be and the part of this I struggle with is taking a property out of the tax rolls for a decade. And I do appreciate councilmember blast talking. You're suggesting that looking at a stepped approach. That is something I'd like to explore more in the future. So thank you for bringing that up. So I just again, I just with pulling this off. The tax rolls were 10 years and I don't think I'm going to be supportive of for that So I just wanted to explain myself here and if we could negotiate the future and we can come to an agreement on the parking situation more than a open to have that discussion. And Troy said it best at the workshop we had regarding housing a few months ago. There's a difference between affordable housing and housing that's affordable. And we heard a lot in the media and they receive separate email saying we should support this because not affordable housing affordable housing is what is subsidized. We have housing and community service department and that's what they do. They make sure that are most vulnerable have access to housing housing that's affordable. The city can't have a role in and this is an example when we're using are safe and low-risk or no risk incentive tools to be able to encourage more housing to be developed when we have opportunities for zoning changes to go from single-family to multi-family so that we can give different price points in different options. That's also another way that the city can ensure that we have housing that's affordable. So I just want to make sure that the community knows that, you know, this may not fall into the category of affordable housing, but we need all types of housing in Wichita and especially now because we have an amazing opportunity for the biomed center that's just going require us to even more housing. And I take a look at the last time that this property had any type development, Dory move was back in 1954. 70 years ago. I also look at the fact that taxing entities that currently get taxes will continue to be made whole with this kind agreement. It will continue to pay the $14,000 taxes so they will still be paying taxes. Just not the added value of that tax increases that could be generated from Disney property. In addition to I am looking at. Councilmember class has mentioned. We do not want to pull this under the from. All right. green and negotiations that have been ongoing over the past few months. And we've had a robust conversation about one of my greatest concerns which parking and not tying up asset for such a long time that we would not have the flexibility future development. The second viewpoint that I look at one in terms incentives was the second question I asked, which was how does this help address our greatest need? And one of the things that is our greatest need is housing the supply of housing in our community. All of us, what housing affordability for people at all levels and all diverse. >> Opportunities for people who want different types of housing. So when I look at these 2 questions. Will be supportive of an incentive that again is low risk to the community and also provides. Helps address the needs that we currently have become regarding housing. I'm Tim good pastor with the city manager's office Development Services. Before you today is a request for the extension of a tax abatement for Cargill biodiesel on November. 20th of 2018, the city council approved the issuance of industrial revenue bonds IR bees in an amount not to exceed 38 million for real property improvements to Cargill's biodiesel facility. In addition to the 38 million, they invested in real property improvements. Cargill invested an additional 49 million in new machinery and equipment for a total capital investment of 87 million dollars. In the state of Property tax abatements can be granted for a 10 year period. The city of Wichita issues them on what we call a 5 plus 5 year period where the company has 5 years to perform on job creation. We come back at the 5 year period and measure their job creation. And if they meet or exceed the projected requirements, then we come back and request a second five-year Bateman for a total of 10 years. So today we're requesting that second five-year abatement. The company was approved the time for an 81 and a half percent 5 plus 5 year tax abatement. This is the facility here. You can see 13th Street running along the bottom of this aerial and I-135 one. 35 or the canal route on the right hand side, the area outlined in Blue is Cargill's biodiesel facility. At the time they did this project. They had projected that they were going to create a jobs with wages in the range of 80 to $108,000 a year. In fact, they created 9 jobs and they're averaging almost $150,000 a year. A cost benefit analysis was run with the actual creation and wages paid. And the comparison of the projected to the actual it was projected at the time that they would that the city of Wichita would receive an overall ratio benefits to cost of 1.3, 3 to one that actually on the actual numbers is 3.2, 5 to one. The city's general fund was projected to be 1.3, 0, 2, 1, The actual is 2.6, 9 to one. And again, the city's debt service fund was projected to be 1.3, 8 to one. And the actual is 4.0, 5, 3, to one. Therefore, they have exceeded in all areas there for staff's recommendation that the city council approved an extension of the ad valorem tax exemption for Cargill Inc, biodiesel Project representative was here for Cargill but had to leave for an additional meeting. The next item is another Cargill item for their protein headquarters in Old town. Again on 11/20/2018, the city council approved the issuance of industrial revenue bonds in an amount not to exceed 60 million dollars. This was to retain Cargill in Wichita after they did a nationwide search for sites and look for other sites with in Wichita. They chose the site that they're at 25 East Douglas to build their new for story 170,000 square-foot headquarters in an 800 car garage. You can see here, Douglas running along the top of the aerial and Washington Street is just a block east of where the Cargill site is. The area outlined in red is where the Cargill facility was constructed. The company was approved for 100% 5 plus 5 year tax abatement. The company has also been paying a payment in lieu of taxes equal to the taxes that were being generated at the time that this deal was approved. That was 413, almost $414,000 a year that they pay in a pilot payment. So all taxing jurisdictions continue to get what they were getting at the time that this was approved. These are a couple of photos. Obvious. The one on the left is the exterior, the one on the right is the interior of the facility. The company at 750 employees and projected they would add 50 new employees with wages of approximately $67,000 a year they weigh blew out their job projections instead of 50, they created 584 and they're paying approximately $85,000 a year. We ran an updated cost benefit analysis through center for Economic Development and Business Research the projected was to 2.4, one to one for the city. Overall, the actual was 6.4, 4 to one. Again, the city's general fund was projected to be 1.9, 5 to one. The actual was 5.1, one to one and the city's debt service fund was projected to be 3.4, 3, 2, 1, The actual is 9.6, 7, 2, 1, We have not seen ratios like this before on a cost-benefit analysis. Therefore, staff's recommendation that the city Council approved an extension of the ad valorem tax exemption for the Cargill Protein Headquarters project. Again, there was an individual here who want to be express how committed to Wichita Cargill is. I'm not just with this project, but with ongoing volunteerism that they're donations that they make in the community the encouragement of of seeing potential employees reside downtown with this new corporate headquarters, there's a lot of fronts on which Cargill is shown a very substantial commitment. Obviously, today we're proving extension almost 150 million dollars worth of projects. The Cargill has produced in the city of Wichita in 2018. So very substantial. And she wanted to just thank all of you for the commitment that you guys have shown to Cargill. Set a public hearing in April. But the project is re of the development. It's a collaboration. Lot of business leaders in town, the formed development with the interest of investment specially redevelopment around downtown and this We'll update that building Saint Francis and provide new office in ground floor. Retail along that their total investment buildings. Approximately 1.1 million dollars with the sun improvements, including exterior compare premise entrance Wells. The new windows and doors associated with that project. This is an area of the building there. One. 26. And the building as it today the project, they're going to be rehabbing. So with that, this is the breakdown of of how the maximum assessments being set with their project have an eligible expenses of 8,000. That includes a 10% Contingency Inc. Is there any than with the city's administrative fee as well as the financing cost. The maximum assessment been request for this project, the $105,000. So without the way the financing works, special assessments would be levied against the 6 North Saint Francis. But the interest rate would be set by the ball and sell the time of selling those repaid over a 15 year period. I'm the owner will pay the construction cost of the project and then be reimbursed that $80,000 after the project is complete and the special assessments can be levied against the property. Again, the resolution today set a public hearing for April. Second to discuss this project and then following the completion, the a final assessment about would be set if it's less than that maximum assessment. With that, I will stand for questions. So without the tax, those specials are paid with the taxes but we also in the financing with project does include one years with the debt We hold back one years with the debt service just in case there's an issue with that payment which the city's being And then with that, if the absolute worst case scenario happens, which we have never have not seen on the facade program. If that goes tax sale, whoever push that continues to pay the special even if there's a default, we do have reserves in place to make those payments until the new person takes over for that. >> Any further questions have. This again as a petition for innovations for a building using the community Improvement district program. The project is a continued rehabilitation. They were family of been doing this multiple years now. But this is a capital campaign, which they're doing it a half million dollar renovation. So it's it's a major renovation, which they actually will be shutting down for you to accomplish this project. Just example of a lot of improvements that will be happening demolition that is required to make improvements as well as rehabilitation of a lot of the decorative features throughout the building. Lighten audio system upgrades state troopers and wrecking. And one of what I understand to be one of the most popular things for the Orpheum be new seating provided. They will also have additional HPC electric, historic lighting improvements. Your that the parcels here, Dana fight is will be improved inside the district 3 Tonys first. And then I have a few examples of what the building looks like today, including, you know what that seating is. All just kind of clicked through and then we'll end up with some renderings of what they're proposing. Some of those improvements will look like when this project is complete. But this project, the actual project expenses roughly $940,000. And you add in the city's admin fee as well as the financing costs, which do include that one is worth the debt service reserve. The maximum CIA assessment for this project proposed 1 million 95 thousand dollars. So the financing, all the talk for us, the special assessments. So this will is requesting special assessments to be levied against the property. 3 Tonys first with interest again set by the repaid over the 15 year period. The situation in the owner will pay the construction cost be reimbursed that possibly $940,000 after the projects complete the special assessments can be levied against the property. So the first phase of the projects an eight-story building will combine programs from which testing University which testing University a school of medicine school pharmacy construction is expected to begin in the spring of this year and scheduled for completion in 2026. You've probably seen renderings of the and the news media. The site's comprised of approximately 1.9 acres are little more than 70,000 Square feet located in the southwest Corner. She's my southeast corner of South Broadway in East William. This is in properties city had a tempertaures been on since early 1990's. site is currently improved as a surface parking lot. notice the site as well as some of the corridors that we have identified, particularly medical corridors and is strategically located fit from both of those corridors. You'll see the same here illustrated as again, a surface parking lot. So funding regulations require the city to convey the property without in conferences. This is a little different in a number of our other, a transactions. But the reason why is that this donation of the site is the city's contribution to the development by medical campus. The bio medical campus will draw students, educators and research from around the country, attracting talent, resources of the Wichita area. There's a whole host of other reasons. But some of the really exciting ones are these organizations, these institutions have already entered into funding agreements with the Kansas Department of Commerce and the Kansas officer recovery to utilize our funds, grant funding agreements type of fund development of a health science education center and specifically designate switched awesome location for the center funds are required to be encumbered and spend accordance with arpa deadlines. Federal regulations are tied to the acquisition state. That real property will be used for the originally authorized purpose. So despite the transfer agreement, not having and conferences. I'm here today to ask City Council to extend and amend portions of their emergency responder rate or coverage fire code in existing buildings. In April 2021. City Council adopted the 2018 international Fire Code with 68 total amendments. There was an adoption and that option there was an amendment for an existing buildings require installation of. Emergency responder rate or coverage system. The amended code of the emergency responder rate or coverage in existing buildings required the installation of a radio system beginning in January 2021. The proposed revised amendment would not require the installation of a radio system require middle of a radio survey. The Wichita Fire Department is currently reviewing preparing for future presentations and adoption of the 2024 International Fire Code. Wichita Fire Department will recommend a city council to adopt a new language for the emergency responder Radio coverage ordinance. I stand for questions. >> Any questions for staff? But they are quite a number of changes that are benefit in existing buildings for the purpose of the cost, these types of systems in these types of buildings. >> And we think that there will still be secure the alarms will still be heard and this isn't going to impact public safety. >> Well, the system itself, basically what emergency ready to respond in coverage is is the radio frequencies from our handheld radios to be able to communicate in and outside the buildings. You can't always guarantee that we will be able to communicate from the exterior to the interior of the of these types of buildings because of the lack of radio frequencies. That's why the code created this code. Specifically the International Code Council created this coat because of what happened in 9.11, from the firefighters not able to communicate from the exterior versus the interior. So, you know, there's going to public safety is always at risk for us right now with this type requirement of of that coverage for radio frequencies. >> This is something we see quite a bit in our own community or is it more? Mayor City Council members here today to ask for approval for to apply for FEMA's assistant to firefighters. Grant. these these grants are used for primarily top 5 priorities. But the basically for equipment and training to the type of grant. That's what the specific brand is the M 5 priorities that they list as the number 5 priorities that they're looking for when you apply for this particular grant is your training facilities equipment wellness and fitness and protected PPE. They're going to allocate 324 million dollars. They're going to award about excuse me. 2000 awards. It has a 24 month performance and has a 15% local match. The reason why we're asking PPE is and some of our busier stations, of course, they go out more times. They make more their PPE, even though they have a 10 year lifespan gets one quite a bit. The crawl around a lot this secure hands places haven't even services. So they incur quite a bit of damage to their equipment the majority of in low church station stations, in the outskirts of the city. The likelihood of you incurring some kind of damage to equipment. It is very likely. The other thing that happened just a couple different one with the PPE escalating over the last couple years. It's limited. The numbers that we come by with the amount of money that we have and then also when we added 10% to our current staffing through the safer grant. Again, the more people that putting gear the a surprise that you have to restock or when somebody damages. There there particular piece of a PPE to replace them for them. This is what the assembly is. A pair of pants, a coat, a helmet harness, beats gloves and a We're going to ask for what we'd like to apply for if you approve is 1.3 million dollars. We would the fire department's budget would make that 15% local match. But 195,000. So we got from the federal government for a one point 1 million, 105,000 dollars. That would take care of 200 sets of To give you an idea. So what are we We in May of 2020 3, we purchased a commercial grade. So machine we sent 2 of our members to a train on machine and also to be certified on inspection. They currently have. What we refer to when and if he ever first who has basic gear replacement repair, which means that currently 50% of the gear that gets damaged, you know, gets hole in than one of the a class come off of the They can repair those kinds of things what our future is, what we'd like to is there's another opportunity probably it usually within the 1st quarter, sometimes in April to applied for another grant to the fire prevention and safety grant. We'd like to apply for that grant later when it becomes available and send those 2 individuals too additional training which would allow them to get the advance gear replacement it would also require the purchase of 2 different types of machines they can utilize that it would help us then repairing the scenes which we can't do right now. So that's kind of what we have on the horizon today. replaced they've repaired. Excuse me, approximately 21 bunker coat. 26 bunker pants for a total of about 91,000 that they've saved where we don't actually have send those in and actually replace, though. So significant amount of and then what this would do is if we granted, are approved or get the grant it allow us put cash as far as emergency stocks. So when somebody did bring something in that needed significant repair or beyond repair will be able to provide that item And with that since the bailout system, some are part our assembly. It would allow us to purchase new bailout systems. asking today for your authorization to apply for the grant and sauce and questions. A possible plan landscape architect. I'm very excited about this been up there a lot of the dog parks have a lot of talk parks going on in the city right now. So kind something I from from arise myself more than maybe at had originally thought. But, you know, it's always great to have new dog parks. this is definitely one of them he's been a lot of time to try flushed out, make sure that have the right improvements here at this project. So the adopted Twenty-twenty for the top 20 for 2033. Cip includes improvements to pay for improvements and innovations parts with a dog park system. The goal of the project to make long-lasting improvements to the dog park Cessar the needs of the community. So I think the key thing here is to make long-lasting improvements as we're building new ones and trying to get more coverage across the city. I think sometimes you can go in and try to do it quick. And I think with this project would like to make sure that we're doing as much as we can be thoughtful about how we're using a taxpayer money to make sure that these improvements a long lasting. I like to note here, Harrison Dog Park Harrison right now is kind of the crown jewel. I would say probably in the dog parks that we have. There's a shade, shelter, their You see lots of dogs. Also the open spaces of shade as well. So main focus for funding for for 2024 funding is a cane, every dog park and that separate in park. And right now at LAX, lot of shade and contains. There's a collective retain water. And so that makes a little bit challenging to use the dog park, especially having grown up with You know, if there's much anywhere, you know, they like to get into it. One key thing to note about this project of this size that's located on a former landfill. We do another dog park tape and that's also on top of a former landfill. So we're trying to some learn lessons from that project to this project. There are some challenges with that as underneath starts to settle, the ground starts to change, though. At times it's you have to kind of. Track and try to. Fill the holes that are settling as much as you can. That can be a better challenge. So some of the prove that we have planned we think will help address that and help a lesson. The maintenance requirements for this project and staff presented concept 6 in January. Garver, local engineering and design was contacted on call They've done a lot of great work and we're very happy with them. They also on their desires hats, experience with the first phase or the initial design of This dog park. So I'm using them. They have experience with the site and are you're with the ins and outs of the project. Due to the kind of extensive improvements that we're playing for this project. We're planning using 2023 and also 2024 funding to help make the again. The goal is make these long-lasting and I just kind of go in there and do what we can to just get scraped by. But the goal is to make long. long-lasting improvements. Here are the narrow for the existing conditions. You can see that there are no trees out there right now. In part that's due kind of how we need to manage and sits on top of a former landfill. You really have to build up. Burr means to planting trees. There's a couple of things that we have to do to try to make sure that we having tree roots, anything dig down and cause issues within underneath the cap. That's on top of the for landfill. So that makes us a little bit challenging. But we have a great idea on how to move forward, how to make sure that we're providing a amenities that are normal dog parks on every other park in dog park right here with this is a very love dog park. I'm just saw photo posted there's so many people out there having talked to a number of different residents very love Dog Park. So we want to make sure that we all the improvements that we're doing things that they ask for things that will make their make their lives better. One thing to know is there are a park in existing so we'll plan touch and the parking there. There's an entry area. That's number 3 you can see on the screen. That's all playing to remain. I'll get into concept here. So that's all remaining. So most of all the work that we're doing is actually within the pens. The idea is to try to collect the water as much as we can. We have to irrigate the grass right now. We don't have a really great irrigation system out there. So we want to irrigate efficiently trying to find that balance getting the water off the side as well. So it doesn't stay muggy. little of a challenge to try to grow grass, but I keep it on there. So we're still playing with the concept exactly where things where the drainage system will probably be. But we feel confident that having a drainage system in part of each pen having gravel area at the very beginning and usually using a stabilized. Matt to help keep that in place. You know, dogs like to kick up gravel in stuff. So what we can do try make sure that stays in place as much as possible. That reduces maintenance time on the project. And I also just makes life a lot more makes entrance. A lot more enjoyable in life. A lot easier for those residents that used to. You can mentioned earlier that those berms that we have to use to help get those trees help get that shade. You see those kind of depicted that would be the West playing here. kind of tilted. So north is to your left. So those berms along the South or excuse me along the the great news about that is that we get a lot of that afternoon shade by placing those burns along that Western side. So we're Greenlaw shot a lot of cooling for the area that doesn't have that already. There are trees to the south existing that do provide some shade to southern panned. it's not as much as trying to get that that the western side. You can see here in a couple locations and number 7, 8, those are areas where we are installing are having a seeding opportunities right Seen opportunities are fairly limited in each of the penned. So having those areas for people to gather, I and that community input and a lot of them are friends with each other and have their strong group there. So try to make sure that they feel comfortable on actually enjoy being there. having to bring their own chairs with sometimes they do right now. I think a couple other things to know is that you see a number 9. We are playing to install shade in each of the dog park. Similar to that first photo I showed you have Harrison Dog Park that had shade structure. The goal here is to provide those in each of these pens as That one helps make it a help surviving shady. And as the straight start to out, instant shade with the shade structures. It's also a great place in cases it starts to rain. You know, you can, even though it's raining, sometimes are dogs always like to be outside. So I try to make sure that we're providing something for the dogs as well the folks that use the site. So analysis the additions to the park with earth firms with trees for shade, the shade structures. I mentioned seating of course we try. We provide Ada accessibility to some of those park benches hydration stations, hydration stations within the pens. Right now, there fairly dated and they need repaired would also move those farther away from the entrances as a way to kind of help make sure that area doesn't get as muddy right as the entrance. Because all the dogs like together soon as a new dot coms. They like to crash the gate. So try to make that entrance areas as pleased as possible. Again, I mentioned that we had a structure grid that we like to use the whole. The gravel in doesn't migrate again as the site settles a little bit. We're trying to make sure that everything stays in place renovate inefficient irrigation. it's out there right now. Right now we're using heads that for their the water lot farther than they probably need to. So wind starts to move it renovating the irrigation system. We can be more efficient with their water use and also help try to make sure that the grass actually grows as well as the drainage system that I mentioned earlier. So the financial adopt a 2020 for 2033. Cip includes contains 300,000 for park improvements. And this is all a Geo Barnes and staff recommends initiating all that 300 at this time. The record. So we in constructed irrigation a later time. I will note that we are $750,000 for Country Acres, but I think would be probably a comparable. That one is obviously a new dog parts of some of the amenities for that project are not there versus here where we do have some existing amenities such as the the parking lot. Some of the fencing already in place. >> For helping director of Parks Recreation. Haha. So we are SWAT team was talking about guards too. This particular dog park. The issue with the expenses on this is because it's on a landfill. So it's actually a little more challenging for us to put in to irrigation system and some of the other sweats a little bit more expensive. Going back to Harris. that was Hughes funds for that particular project. And we also use a matching funds for the the parking lot. That was was actually installed right next to it. So if I recall, I think that project told that to just over $450,000. Which include the parking lot as well as the dog Park. When we did this dog park over here. So we learned a lot and regards to the turf. Usage from the dogs. So we actually had to go back in make some changes to that dog park to make a little bit more durable. So using those learning experiences for the next 2 dog parks. However, we do spend a lot time in regards to rotating the areas so that there Grasso. If we have 3 areas, 2 areas are being used when areas being. Cordoned off so that they could have the rest to rejuvenate. So those areas and we actually use contract morning for most of those areas. We go back and actually. The pairing of the holes we at there's mud areas. We try to clean those up as much we can. It's very typical to what we do with other areas the parks. So not sure if this actually has a dog park in every single district. pretty much covers the majority of the city in regards to dog parks. You can pry once once we completed at the end this year, you should be able to get to a dog park pretty quickly and easily throughout the city. So years back, we actually upgraded our master plan which really focused on repairing what we have upgrading what we have and from occasion to occasion, we do get some extra projects that come in that there. We question from the community that their support to the council that we've gone through seeing management we get the support to move forward with some of these projects. So I what you're talking about. Regards to all kinds of different amenities. I think it's important for us to go back and actually look at create priorities with community engagement and really can't come up with an opportunity to revise our master plan and create a national plan was revised in 2015 but was actually originally from 2008. Those are already budgeted designed or a moving forward. Klopp will serve the southern portion of the city. We have Harrison, which is out to the so really want to focus on making sure we have something. North South East West. And so I think with definitely take care of that. Again. I think the when the questions that we get all the time is how come we don't have shade at this particular dog Park. I've been here for 9 years. This does park has been on the radar for the past 9 years as to why don't why don't we have shade on this dog park in primarily is because it's on a landfill. A previous administration previous years, the initiative of putting several dog parks was actually put in place and was actually decided that the best place to put on top of landfill. Sounds great. First. But you can't build anything else on top of that landfill. And if you want a dog park, the has shady want benches. You want other activities including irrigation water for the dogs that has an impact and we have to design around. That's that's when the reasons why this cost a little bit more than what you would see if other locations, if we were to do this. Enter at the dog park that is on I do and feel we've had the same kind challenges that that location as well. Just want reiterate that make sure that you can understood that the community has been asking for shade, asking for treason. Here's one thing that we did. That was an Austin. We did. The same thing is we built up these mountains on top of the ground on top of the cap. So whatever you put in there doesn't penetrate the cap of the landfill. The last thing that we need and want to do is can work with state and the guys to penetrating the cap and that that would be a very difficult and disaster situation for you to do that. >> And some of class caught one last comment in the city for future projects. I would be interested in knowing what percentage of the total cip is based on a study or consultation to get to that. Final number is out of the 600,000. How much money was spill spent on the study of the 600,000 for all future projects of the something I would be interested I still expect a lot studies. I will support given counseling or Vice Mayor commitment and interest in this and her involvement in community engagement for this. But in doing so, I will not support any future capital. Resources are finite dollars available for capital projects. As the clerk announce the item before you as a construction agreement for a biological nutrient reduction improvements, that plan to the city's largest wastewater treatment plant located near 57th. And hydraulic with a discharge point into the Arkansas River. This project is necessary in order to clean water regulations for the discharge of and the F what? And may need to be in place by the next permit cycle January 2028. Design of the improvements have been completed and the construction packages they've been broken down into 6 separate packages. Today's item deals with package too package want demolition of existing structures to make room for construction of package to has been completed. Package 3. That includes the main treatment process and disinfection for the affluent that is currently in process. We've had the interviews and we're in the process finalizing the selection for that package package for the Salas de watering a centric treatment. plan to advertise bids later this month on March, 20th package 5, the acquisition of electrical equipment is proceeding at this time. As well as package 6 for the programming of the supervisory control and data acquisition function of the plan. In terms of today's item and includes a pretty much for over control, updated technology for solids. Thickening and then cleaning and rehabilitation of the anaerobic digesters for the breakdown of solids. Take a moment to focus on odor control, which is meant and the neighborhoods. And with this for a while and of the city's design from I'm sorry. CdM we spent a lot of time Sam air around the plant and on the plant to make sure that we fully understood. We're the largest contributor. Schroder was on the plan and also I'm taking air samples out in the neighborhood to understand how the community is impacted. And so the divide, the design firm actually performs. Mathematics built a model and for modeling. And they predict the frequency and intensity of voters will be reduced by more than 90% of these improvements. I slept before you shows the timeline. The the Dark Blue bar on top. There's the package to timeline you see completion in early summer of 2027 with a gray bars representing the other packages. We discussed and showing completion and plenty of time for the new permit requirements and 2028. We took a value based project delivery For this project to get a combination of best pricing and the most qualified firm for this work. Thus the was 80% of the consideration and selection and the remaining 20% was based upon Similar projects the the assigned staff experience local participation, the participation emerging in disadvantaged businesses. The targets for AB Env be a year in alignment with the with funding requirements of a combined percentage of 14.8% of the project. The request for was for package to is advertised October 18th of 2023. The proposals were received December 12th 2023. Unfortunately, we had 2 highly qualified firms submitted construction and Donna linger Wildcat. The Nr 2 LLC. Both firms were interviewed by the steering Committee on December. 15th 2023 and on linger in Wildcats being are 2 LLC was selected as the most qualified firm. The proposed pay for construction of package, too. As 106 million, 188,600 dollars. Staff also recommends including the at alternate bit items totaling 10,285 10 million, 285,000 dollars at this time. And these were improvements that were included in the cip and we can realize significant savings to the benefit of the utility in our ratepayers by these improvements the DNR package, too. This brings the total budget for the be on our program from 377 Million. 161,790 dollars to a total of 387 million, 466,000, $798. The slide in front of you show some details on the at alternate items. to the details here. But it will provide renewal and replacement of critical assets at the head for the role first comes into the plant. It's necessary to screen out large debris and create that can damage the treatment process of us not removed. Those assets are aging and near the end of their useful life. And it will also additional odor control with the great handling facility where currently don't have odor control in place. I will also rehab the primary clarifier mechanisms which include drive motors. Mechanical equipment and works for those mechanisms. This time I'd like recommend that city council approved the contract for being our package to construction, adopt him anywhere solution and authorizing necessary signatures. The second biggest one the history of Wichita and grateful to say that we're going to address a generational issues as well as I'm bringing clean oxygenated water and to the system. We are required by EPA guidelines to actually several of these upgrades as well. So this all ties together. I'm Erin heading with public works and utilities. And today we're seeking your authorization to apply for and accept the award of annual child care licensing grant by the Kansas Department of Health and Environment. >> The Kdhe has a contracted with the city of Wichita for the provision of child care, Licensing and Education Services throughout Sedgwick County. >> For more than 40 years now. >> The payment is made to the city via this grant. >> for which the city must apply annually. Some of the responsibilities under the grant include providing orientation sessions for all prospective providers conducting annual surveys for all licensed providers providing consultations as requested investigating complaints and performing compliance checks is needed and providing professional development training. In fact, just last Saturday, child care licensing staff organized and hosted their 3rd annual training palooza, which is an all-day event for child care providers licensed and the county. I was a huge success again this year with nearly 100 participants receiving 6 hours of ongoing education. And I'd like to extend her reiterate our air with you and councilmember total for attending that morning. It meant a lot to the providers and that meant even more to staff. So the current grant award that. Operations are. Functioning on is that is for the state fiscal year 2024, that would total $412,257. And it is set to expire on June 30th of this year. So they applying for us for state fiscal year 2025. and it's expected to total approximately the same amount. There is no local match required. But the expenditures of the program do exceed the amount of funding that we received through the grant. So there's 2 a little over $215,000 program for additional expenses in the 2024 operating budget. Most of expenditures are actually recovered by fees, but not quite all. And this. Chart speaks to that. The Grant award. Covers about 2 thirds of operational expenses and then the. General fund is reimbursed. Well, revenues cover approximately 75 to 80% of expenditures over that. So the general fund on average, it looks like, you know, expenses, net expenses or $50,000 or less over the last 3 years. Just be remiss if I didn't mention that we are in need of additional childcare providers, both in Wichita and in the county. So if anybody tuning and is interested in being a child care provider and making a lasting positive impact on children. I would encourage them to visit the city's website particular. We've got for more items for you try to keep moving. The I decide in particular item is request for some middle of energy efficiency and conservation block. Grant application DEC the G and they've seen other items like this today. And so we'll try to get to this quickly. The purpose of the ECB's, the programs to assist eligible state. Local governments in implementing strategies to reduce fossil fuel emissions. Total energy use. Improve energy efficiency for more equitable energy economy. The city that which saw was allocated just over $381,000 and from the lip funding through this Grant City Council spring of authorize the PRE Submittal to the Department of Energy. The Sustainability Immigration border proved of the proposed projects which discuss in just a moment. October last year, their desire was his sister, low-income residents and enhancing energy efficiencies for public facilities. The first proposed project is home weatherization. This would be a sub grant and the amount of almost $191,000 with the South Central Kansas Economic Development District to weatherize homes for low-income residents in Wichita. This will help to levy to levy a financial and energy burdens for those same residents. The second item is energy audit energy efficiency upgrades for storm water. Pump stations for just under $116,000 to be a third-party energy audit for our 16 stormwater sewer pump stations assessing the current configurations the audit would recommend upgrades aimed enhancing pumping control, reducing power consumption and they're remaining funds will be used to upgrade at least 5 storm water. Pump mention real quick. We had an issue, one of our storm, water pump stations in the last year. That created an excess energy use. We were about to be a hit with a $500,000 from Evergy. Luckily they worked with us and I want to thank them again for doing that. So that didn't happen so that this is very valuable to continue this effort. The last item is retro commissioning of Wichita Police Department, animal shelter for 7 $75,000 effectively. That's finding a way for the existing building in systems to work together and a smile and staff commissioning the just so, you know, if you haven't heard that word before you learned just like I did the proposed project focuses on the 3rd party for efficiency upgrades at the animal shelter, which has been operating 24 7 since its construction in 22,008 is currently some issues with some large fans and natural gas This effort would be to optimize control strategies to reduce overall utility consumption. Enhancing operational efficiency of the animal shelter. As part of this, too. We are allowed to apply for Department of Energy Fellowship to host a community energy fellow to manage these There's no additional cost for this. No effort, in fact, is no cost for the city at all. To submit for this grant. They the Department of Energy, met to select institutions with the top 3 to 5 fellow candidates in the regions. Interviews will be done to make final selections program is limited to only 25 to 35 host in institution. So there's no guarantee I would think that the capacity to make this happen either way. It applied for that. There's no match requirement for the formula funding. The total allocation of $381,670 be utilized to cover the cost of the identified projects with no need for additional funding. Staff recommends city council. I know it's through because this is a program that they offer every year last year in Wichita, the authorized over 1 million dollars in grants. And they're actually at a point that they're not able to balance that. So this additional funding would be helpful we've got information provide on our website. The item before you the moment approve funding for the purchase of large water meters for the utilities, arts Water Meter replacement program that water meters with that serve a 2 inch and larger service lines serve our higher flow, commercial and industrial customers the older style meters that we have in place now are near the end of their useful life. And as the turnstile meters because they have more of a mechanical function as they age when they begin to fail. The the inner workings turn is fast. And so they tend under Reid is they fail, which means that we're not fully measuring the amount of water that flows through the Mader and so replacement with the latest technology. The best available technologies called ultrasonic Mater not more accuracy and consistency through time, but also does a lot better job of registering smaller folk flows, too. If you can imagine an industrial process where there's a lot of water moving through the facility at once hand saying for a toilet flush or a water fountain might not be picked up by these mechanical style meters. Ultrasonic meters will register those types of flows. 22nd 2022, the program was kicked off and city council authorize funding in the amount of $600,000 to begin the replacement program. Well, you've got a lot accomplished since that time. Are really pleased with the outcomes of the program. we've completed 68% of the 6 inch and larger meters. I want to know here that all of those a larger majors have been purchased and are on the shelf ready to go where the process of carrying forward to completing those all of the 3, 4 inch meters have been replaced. And we're just getting started on the to actually meet at this time of the 19% replacement today, the additional revenue captured by the more accurate readings as exceed half million dollars. And we're really pleased with that because we did a smaller pilot project ahead of this program to test the technology and that pilot out of that. We estimated about $440,000 revenue is performed even better. What we anticipated. The requested funds will be used to purchase 2 men shelter Sonic meters to replace by city crews. The adopted 2024 through 2033, cip includes $100,000 and 2023 in funding in the amount of $100,000 in 2024. for the water distribution Water Meter replacement program. Therefore, the full amount of $200,000 is being recommended at this time. Therefore, staff recommends that the city council approve the project, adopt the resolution and author us the necessary signatures. Public works and utilities for you. this afternoon has a couple of one is a request for approval of the design. Build contract. For one specific part of what we're going to talk about. The other is an overall budget for multiple facets of our. Southwest water. What we used to call Northwest Water facility know which project portfolio, if you will, there's a lot of things happening here and I want to kind of walk you through where we've been and what's a part of this item. So to orient with you with this map, you can see www towards the top left which saw a lot of work, says new water treatment facilities. Such a county park been left to that in the green. several parts of this that are happening today and the need for additional funding. which saw a lot of 98% complete construction. Are beginning to look at early testing and different scenarios for commissioning and start-up plans. So there's a lot happening moving forward. They hope to have this new plan online and by early 2025, part of what we're going to discuss day has to do with that. Timing. Including delaying the start of which we knew originally with the original contract may happen. All explain to you why and the cost implications of that as ever to substation. There was a for a new substation to be built, just to provide power to this planet. You can imagine what it takes to run facility of this size. We had an original cost estimate from evergy early on some few things change. We've exceeded that cost estimate. And so that impacts where we're at today and the need for some additional funding for some of these other things. The orange line that you see the 64 S Taylor pipeline. That's going to be your primary. Way to deliver finished water from the new treatment plan to the help has pump station, which will still be in place for delivery to water to the majority. The community. There's some unexpected things that have come up with a pipeline to go to deals from a regulatory standpoint. That we knew additional funding for its part. The request today. the size of this project having started in 2019, I staff and and everybody involved in a really good job at a time when they came to 30% design developed what was at that point? I'm guaranteed maximum price. But you can imagine and over the course of time coming up on 5 years now, some things that have changed. And really what we're doing today is is a point of hoping to be able to reconcile all the major items that we see at this point should get us through to the end of this project. The main water treatment plant that uses existing water treatment plan and has pump station. there's one particular item to some work that needs to be done. It has and we have a request for approval design, build agreement with that today. This maps pretty busy soul just hit on that real quick upper left is existing water treatment plant. The blue boxes that you see your underground storage reservoir is we have 35 million gallons. Of reservoir storage or water production and pumping on a daily basis that those reservoir is allow us to make fluctuation in daily demands. But there are challenges controlling flows through the House Pump Station Reservoir system that can cause insufficient, mixing and issues with water, aging and quality. So this is a project that we knew would be a again of the overall package. Our finding that point of getting it going, most of the funding is still available within the funding that the councils approved so far. But as we'll show you break down the moment, there's a little bit of additional funding needed for this project. Our planet design modeling efforts indicate that issues these issues can be corrected by installing new pipes and valves to help with the aging issue in July, specific to the House design build contract in July of 2022, the City Council approved the selection criteria for the design. Build contract. Well, Kate Construction was the sole proposer and is confirmed by the selection committee. They're working on several projects around the campus and makes them well suited to handle scheduling. And we construction conflicts. The guaranteed maximum price at this time is 11 million, $980,000. Additional expenses that we're looking at today and the need for the budget incur a request again over the course of time. There are some things that we did early on for some things that we did not trying to be responsible in 2019 recognize potential impacts of inflation. And what happens over the course of time on this going to be a long project. I miss in the 64 inch Some additional pressure testing and disinfection efforts that are needed as required by Kdhe we need to do something with all the water that comes out of that pipe. Not now not just now, but over the course of time to mitigate the risk with the lime residuals disposal. We also need to purchase chemicals for the initial commissioning and start-up and testing of the treatment plant. That's something we've known that we need. If you can imagine again, over the course of 5 years, what's happened to commodity pricing? We felt it was better way to this time. We purchase those chemicals ourselves will avoid the market from the vendor. One of the bigger items here I mentioned just briefly, I'll talk about more substantial completion of the new water treatment plant project itself. The original testing schedule when the guaranteed maximum Price was developed. A 30% design. Was to test at 30 million gallons a day. So just so, you know, the ultimate capacity of this plan is 120 million gallons a day. We had hoped to be able to do at 4th of the capacity from the water saving standpoint from a timing standpoint, from a cost standpoint, as the project is developed, as we gotten further into the complexities of the project, the needs of the project and to ensure we can bring in treatment plant on line that's going to serve our needs. It made the decision that the testing needs to be it twice 60 million gallons a day standard across the industry. We've got folks involved, including guard Garver owners refuse. Look at this with us. They're continuing to evaluate this. I think it's the right thing to do. Also based on some past experience with our a S our surface water plant. tried to do a little bit of the same when that plant came online testing at a lower capacity and have some real issues. When we finally brought it completely online. So we learn from that. This was something that we thought might happen early on. But until we get to this point, we couldn't fully define it. Right now. The estimated delay costs are just under 6 million dollars. We are continuing to look closely at that again, Garver evaluating multiple commissioning and start-up scenarios so that we can find a way to bring that cost back down and be online soon are some hopeful that things might change their. We're looking at as being costs at the moment. So looking at a breakdown of the budget in December of 2019, the City Council approved an initial budget of just over 553 million dollars after expenses. Today we have a remaining balance. 11.3 million dollars. So here's where we're at an additional cost of what's needed above. And beyond that, I talked about the 64 inch pipe connection just over a million dollars. Some of the pressure testing. And near the residual line lines, which is an additional requirement kdhe that we cannot predict. Originally the $700,000, there's multiple a variety of items here and they're related to additional trees at the new treatment plant. Campus. Some things as we've gone along throughout this route at up to almost 1.3 million dollars. And it's in delayed substantial completion. Of 1.3 million, those 4 items of approximately 2.9 million dollars. Welcome back to the council at some point in time for formal approval, by way of a change by being able to get the budget authority approved today, assuming council chooses to do so allows us to move forward and take action on some of these and continue final planning so that we can come back to you later date with the details. And I want to mention real quick because we've talked before about the value of this project and what was done with the progressive dot design. Build. And if you look at the size of this process, are 500 million dollars today. We've had to change orders totaling 1.8 million dollars. That's 0.4% of their original contract even with this 8.9 million dollars added with upcoming change order. Our total of the 10.7 million dollars, which is still less than 2% of the original out. And I can tell you, looking across the industry. And looking at the size of this project is pretty unprecedented of what we've seen for this type of work, the things that can happen over for 5 years. The unexpected issues that come up so we're still proud of where we're at a lot of these things. When you are coming. We just got to the point where we could finalize with some of the cars look like I mentioned before, that the chemicals will be procured directly that we can say the cost of market. And in the final part of this is we just under $600,000 to wrap up House station budget to be able to move forward that that's where the total 16 million dollars comes. For current request. So where does that come from? What does that do to the budget? The proposed 16 million dollars will increase the overall project budget to just over 569 million dollars. This will cover everything that we talked including the has shortfall. The revised budget will not impact the amounts financed by with your sro's loans. Once loan funds are depleted, all remaining expenses will be financed with revenue bonds for water utility Casso. try to make as much of this work with what's remaining within within us are of. The delayed substantial completion will not the terms of either of the loans or when the start dates are. We have a line item in the cip cold water treatment plant, emergency That currently has 29.5 million dollars on it. That was put in place, particularly for 2 reasons. One is to make sure their current water treatment plant stays operational through the point in time that we make a decision. What happens with that in the future? Let us once the new plan is online to And and the second part of the as for added an unexpected expenses for the new water treatment plant. So having said that, there's no rates. This is within the pro forma within the cost of service analysis. There will be no rate impact. And so it's good that we have this in place. And and I think we did a pretty good job of estimating where we might be a. With that and lot of information. So I'm happy to go back and talk anything like. staff recommends city council approved the contract with Wildcat construction. The design build agreement for the House Pump Station improvements, adopt the mending resolution authorize necessary signatures. Again, we don't have change order here in front of you today to approve will come back with a being able to wrap this all into one budget requests say this all a lot of time allows us to do some additional planning before wrap those up that 8.9 million as part of the 69th. Okay. I appreciate that clarification. >> Why is there and almost 6 million dollar. I know you talked about a little bit that. What is that delay cost against nearly 6 Million. >> The so what happens as much as anything several things. So original completion date. Everybody had hoped for was around September of this year. If you look being during our peak water usage time right across the community. Just last September, we were the highest for the year. Probably even past because we had prolonged heat. We had hoped then at that time of year knowing of water demand that we could do our testing at a lower volume, the 30 million gallons a day. Honestly going back in time. It was just never going to We as we developed the the plant as we designed it as we build it, we realized we need more water going to this plant during the testing phase. We need to get a higher level. So then what happens with that? We've got to wait until point in time that we are in not near as much peak demand. Later in the year we've got more water availability for the testing and commissioning. What that does is it leaves the contractor running the plant oversight of the plan. It got a costs of anywhere from 5 to $600,000 a month just to keep the plant going. So if you look at 5 to 6 months to February of 2025, you get a good portion of their. The other part of it is extending warranties and looking is what's considered substantial completion. Because we want to take the facility or until we read it. No, it's ready to take over. And so if you can imagine the number of contractors are involved in a project like this, the warranties that are in place and are protections for the future that starts cost up pretty quick, too. We're looking at this very We've test staff and garbers or owners route to evaluate this to see. I think we're going to find a way to meet somewhere in the middle some of the early testing at lower volumes and hopefully still be able to be online by the end of this year, which will start backing up costs off quite a bit to Yeah, I appreciate There kind of a sudden bumping up that date as much as we We are too. one last >> quoting from the Green shade here where they talk about the line lines. According to Kdhe, this creates a conflict between the lines and could pose a risk for. Rest to the finish water. Should there be a catastrophic failure at the as this happened elsewhere or is this just this is a complete timing issue between the time that it? >> Current treatment plant. We're going to have a period of maybe 6 months depending on where we end up commissioning and start-up that both plants are running. We're going to have water going to the system from both plans for a period of time. That's necessary. We have to do it so we can prove things out at a new plant before we bring plan offline for some period of time. Lime residuals are part of the treatment process and just so happens between the 2 plants. We take our residuals to a location that 29th and West Street. What's now becoming a new Finnish water line. >> Used to be an old Raul water line goes right beside this line line. >> Kdhe has requirements that says if you've got clean water. >> As you've got something like lime residuals that can't be that close to each other. This is only for a temporary period of time. What they've allowed us to do is to meter the lion lines to show that we're not losing anything to do pressure testing to make sure that there's no leagues really got 2 good point with him because initially they want us to relocate this line, which would have been several million dollars potentially for only period of 6 months. So it's a give you a quick example. They do the same thing and timing potable water, even a subdivision and the senator's here that can't be within 10 feet of each other. And I do want to in question kdhe that they like to use words like catastrophic events that we feel comfortable probably never going to happen. We've never seen happen. But in the event public safety, they have to stay with those rules make sense. Appreciate it. >> Councilmember Total, thank you, Kerri, thank you for the presentation. I love to brag about this project. Any time right to live really between water treatment plant and everything we're doing with Bnr. It's a billion dollars worth of infrastructure. This is infrastructure that will last for generations to come thank you for all you're doing. I just want fact check myself and a few things. So when I'm at my break into get it right, where 98% complete with the construction, is that Might even be more than glass. And it's pretty close to UK. >> And up until today, when you brought this to us, we've only had to change orders, correct? Correct. And one of them we initiated because we wanted to make sure that the restaurant were family-friendly in the admin building. Correct. And those totaled 1.8 million dollars together. I think you said yes. Okay. So with the change order that will be coming to us. Can you just remind me what all 3 then changers with the total would a total of the approximately 10.7 million dollars total at over 500 million dollar right That is which is just less than 2%. That's what I going the original contract. And that isn't great know that. That is amazing. And that his story, that's a story that we should be shouting far and wide Thank you to you and your team for all you do that's making if magnificently work. and I know we have and owners rep and we have lots of great partners, but it's great leadership from our city, which public works Department to make that happen. So thank I appreciate that. city Council for their work with us in the past and developing, you know how we approach this project. I would. >> One more quick part of that. This is one of the largest design build. Projects like this going on the country right now. One of the larger in the southern part of the country. Is currently 10 to 15% on change orders. So it gives you some perspective. And that's even I mean, that's 2 billion dollar projects you can imagine from a dollars perspective what that looks like. So I think we've some really good things to viewer. >> Also, last Cup. >> The record. I think that 2% is incredible. I don't know most projects that are within that margin, especially that there's no impact to rates mention of the 29 million, which becoming out of that fundraiser that would leave on the 13 million and that reserve Is there any fear the 13 Million? Would be used up? And you'd mention the 29 million is also this is not a fact as the 29 million also to keep both pickles. it is. So there's 2 parts to that. The reason why that's in the cip. >> First and foremost is to keep current treatment plant operating to the new ones and also to come a day, unexpected costs for the new plant. So there's no fear of us. Liquidating the 13 million at this point. I hope not chain. >> You know, we're we're at a point on the new facility that we shouldn't see much changing such a big project. Anything can happen. The reason why came before you today is because we feel pretty comfortable with where we're at. That doesn't mean there could be some adjustments. You know, are biggest deals. We've got an existing treatment plant. It's 85 years old. And I think staff has done a tremendous job to keep things going. We've utilized capital funding that's been approved by. And operating funds that still doing well. Still doing good shape. That would be the only factor something. What happened there. So it's in our best interest to keep pushing on, trying to get commission in start-up going now. And maybe limit this delay for bringing new plan online. Soon. We're going to that new plant running the sooner we can have as many concerns about the risk associate with the old plant. Item 4 years unified school district to 59 safety improvements. city is responsible for overseeing construction and maintenance of sidewalks, streets and traffic control devices. But tense street right away. And the corporate city limits which tough. City. And yes, the 2, 5, 9, share mutual interest in providing for the general safety and where welfare of students and citizens within the community. The city. And yes, the 2, 5, 9 staff meet monthly at a different school each month to coordinate and develop specific projects to enhance student safety. projects include crosswalk, markings. Changes to existing signage sidewalk installation and other infrastructure improvements. City will be responsible overseeing design and construction and maintenance of each project. That is an And then go through a few examples of what we have done in previous years. slide shows a couple school up near 33rd in Arkansas. The picture on the left showing what what happened that school dismissal times where southbound traffic but park adjacent to to the curb line. It's a 2 lanes street. Therefore, additional southbound vehicle want to travel through the area. They would have crossed the double yellow enter into the northbound lanes. And then go to the next slide. We had worked with the U.S. T 2, 5, and driveway adjacent to the school was off of 33rd Street. So traffic. Now he's up on 33rd Street and our son to the parking lot and picks up students from there. And then the back to the previous slide. The picture the right what is occurring on our Kansas now during dismissal south really cleaned up that made it safer for any students that might be crossing that street. Other safety improvements that we have around schools remarkably existing crosswalk systems that cloud elementary we had quite a few schools last year. And then also some other improvements that we at Horace We had relocated the. Destrehan Signalized pedestrian crosswalk. That was near the intersection of 11th during an onsite meeting during one of the monthly meetings. Staff noticed, you know. Where students were crossing. And this we move through Signalized crosswalk to that location where better utilized. By students and parents. and USD. 2, 5, 9 agree to total annual cost up to $100,000 per calendar year splitting that 50%. Each city will pay for the upkeep. Front cost and be reimbursed by USD 2, 5, 9, for half of the cost any of the projects, the adopt a 2024 through 2033 Capital Improvement program includes $100,000 in 2023, the ongoing projects and $100,000 in 2020 4. Or school district safety improvements funded general obligation, bonds. It's recommended that the city Council. It is recommended the full $200,000 $1000 2023 that was not initiated. And the $100,000 from 2024. for a total budget of $200,000. I was just made aware of one in college Hill over the weekend. hearing parents are preserving the short term rentals for parties for their kids. I would like to bring that back so we address that. And then lastly. Just some for our friends in the Legislature hearing from one state representative that they are considering medical cannabis, which is on our legislative agenda. But there are no inclusionary opportunities for businesses or people of color and getting licenses. As I've been told. I've also been told that they may relinquish licensing ability to kdhe and either way people of color continue to be the majority in prison to arrested targeted for. These things. And it is a highly unfair several steps backwards, too. There are companies of color that cannot take advantage of the license saying. The Legislature is well aware that there are businesses, one of them in particular spoke in favor of this last year. That individual was not aware of conversation until I called them yesterday. So my hope is that the legislature without only go forward legalizing medical cannabis, but also make sure there's an inclusionary opportunity for businesses of color and that they do put so much regulation and stipulation that it boxes. Those who don't have the financial resources out. And lastly, which is not on our agenda and coming for me personally, I would hope that the legislature would vacate a marijuana convictions going back at least to the year 2000.
