what do I need to do with that I guess I'm a little confused there certainly Mr chair so if there was something that needed to be added this is where we would do it otherwise we take a motion to business yes Mr chair the first item on our agenda tonight was the Red Barn Pet Retreat we had continued continued the public hearing to this meeting unfortunately we are still working through revised plans with the applicant we're hoping that that will be on the August meeting so for the commission tonight we need a motion and a second to continue the meeting to the August 3rd I'm sorry continue the public hearing to the August 3rd 2023 Planning Commission meeting at 7 pm I'll make that motion all in favor say aye aye all opposed thank you I I do have a question for you yes let's say if it gets on our agenda or next month and uh you know whatever back and forth is still going on do we hear that anyway yeah next month unless the applicant requests an extension due to the deadline for review they can request an extension the city could no longer utilize any more extensions so they have to request it in writing if they were to not do that and we're still not having some of these issues issues the unfortunately the staff recommendation would be to deny deny based on the current information and we would have to go through that process to avoid the deadline okay all right thank you okay and Natalie we are at a public hearing for and I'm sorry how do I pronounce the applicant name High Decker correct yes okay thank you Mr chair so this is a public hearing for it has two components a conditional use permit for an accessory structure that exceeds our sidewall height limitations in the front yard as well as a home occupation interim use permit so the applicant is Tyler hi Decker and specific specifically he wants to place a structure in the front yard where we have a sidewall height limit of 10 feet but a conditional use permit can grant additional height and additionally he would like to use this space for his home remodeling business and that would be considered a conditional home occupation license which is very confusing because it's also granted under an interim use permit so it's an iup and it's specifically because he's looking to do some woodworking potentially in the structure otherwise it would be a special or approve or a permitted home occupation and wouldn't need this license and I'll get more into that as we go the subject property is at 79.85 Eagle Ridge Road and again the accessory structure is prime expected to primarily store business equipment and materials but he'd like the option to do occasional woodworking as a component of his business okay so that's for profit correct yes so the applicant did do some last minute revisions to his building plans and those are on the diocese tonight the changes are he's adding an additional 20 square feet which is still within the allowable footprint for accessory structures on his size of property additionally he wants to add an exterior staircase on the rear elevation that would face North and that would be used to reach the office storage space on the second level of the structure for the cup the application meets all the standards typically that we're looking at so it meets or exceeds all the required setbacks it fits the structure footprint that's allowed on a 2.9 acre parcel the proposed sidewall height is allowed through the cup and the building does not exceed the overall structure height limit of 35 feet for the district Dormers are used to provide architectural interest on the west side of the structure and the proposed materials include architectural shingles and LP siding which are permitted materials so staff went through the cup standards outlined in section 1030 as well as 1070 and we believe all of those have standards have been met with the proposed conditions of approval which include removal of a temporary structure that's currently located in the rear yard the structure cannot the new structure could not be used for living space unless they go through the process to have an accessory dwelling unit approved and the if septic and water are planned to serve the accessory building they must obtain the relevant permits so that was an engineering condition the applicant must also revise their plans slightly the overhangs on the structure must be 24 inches I did not have a chance to confirm whether that's been addressed with the new plans but it's possible they have them and the the plans need to label the proposed building materials and Grading and drainage plan needs to be updated to incorporate the feedback from the engineering memo there were some some small drainage concerns but something tip that we can typically work through with the building permit process for the conditional home occupation license the business is high Decker Home Remodeling which has been operating since 2017. most business operations occur off-site at the homes of his clients but he wants to have again a place to store his equipment and building materials as well as have some space to do woodworking when he does things like cabinet making staff finds that the surrounding neighborhood and environment is unlikely to be negatively affected by the Home occupation with the proposed conditions of approval and those include woodworking or similar activities that must occur within the structure with all windows and doors closed when he's doing anything outside of our construction hours which is we allow construction 7 A.M to 7 PM Monday through Friday and 8 AM to 4 pm on weekends and holidays so during those hours there's less of a concern because we've already identified that those songs are expected during those hours but he needs to mitigate any woodworking sounds that he's doing after those hours by making sure it's completely contained within the structure uh no signage it would currently be allowed without going through a city approval process outside storage of materials will be specifically prohibited outside storage of trailers related to his business would be allowed in the backyard if it's not visible to surrounding Properties or from the visit or from the right of way no temporary structures can be used going forward to store his business items and no employees can report to the home location if he currently he doesn't have any employees but if he would ever have one they'd have to meet him at the site of the client there was no lights shown on the plans but because it's technically we're crossing into an area of residential versus commercial there is a condition that if you were to add lights to the garage they must comply with our lighting standards for commercial uses and then the iup will terminate if the business ceases if the property ownership changes if ownership of the business changes or if he no longer lives at the property and then every three years the iup will be administrative I'm sorry administratively reviewed to confirm compliance with these standards at this time staff recommends the commission to open the public hearing and take any testimony and staff recommends approval of the draft resolution included in your packet okay thank you I'd like to open the public hearing do folks have any comments that you'd like to make this sure form I don't really have any questions or concerns other than you know the value made the statement that this is not intended to be an Adu and it doesn't appear that there's sewing water and I don't know what's intended for each of that kind of situations like that but it's superiorly a storage structure and that's it or is the composer provided any additional information about that nature of the building yes so the application from Mr hydecker said it specifically stresses that the primary use of the structure will be to store his equipment and materials but occasionally he may be doing some woodworking within the building and that's what's triggering the interim use permit so there is no indication on the plans or within his narrative that it would be an accessory dwelling unit however it could be converted to as such in the future so that's why I'm calling out as not that you can't have it we just have to go through a different approval process if that's what it turns into later on yeah structural Vegas it's not even on the boulevard Style commissioner um I did not have any questions for the applicant the only thing I wanted to note is that the engineering memo is typically included in the package and it just wasn't um so not that that was a big deal I'm sure and thorough um but sometimes when it reference conditions it was just difficult to see like if the resolution had covered everything I don't have that okay okay so it's just mine no big deal but there were just a couple times um where you know the compliance with the engineering them all the reference and the resolution verify but then the other thing that was noted was that it was talked about that because he provided additional information um we could perhaps remove a B on the resolution and so I was satisfied that in in terms of as long as staff felt like information was provided after the origin could pass the resolution um and remove the condition AP I'm certainly satisfied with that if the commission is yes and so my recommendation would be the approved resolution removing that condition so if anyone wants to continue discussing that's just fine otherwise we can make a motion commissioner Jacobs question for the staff do you see any concerns in adjusting the plan to buy some of the training needs we see that being a challenge no engineering is very confident it's something they'll be able to handle through the it's some typically when we don't go through this conditional use permit process it's still something that's evaluated with a building permit and it's something they regularly work through with applicants so the nature of the property and where it is on the lot the drainage and you don't see any concerns with that even though it needs to still be considered yeah so they'll have to revise some of their grading a bit but it's they'll be able to do it in a way where it's not going to impact other properties that's one additional question for that the optional stair deck that considered would that be leading to additional storage or would that be more of an office and it goes to kind of the HVAC question which would be the material up a bus maybe heavy you know I more of an office yes so the floor plans which I don't have on the slideshow show that there's an open room on the second level and that's where those stairs are leading again my conversations with Mr hydecker is that this will be primarily used for materials but he does want to also use that space for his workspace um so I don't I believe he's not planning to really use the bottom for the workspace the first level it would mostly be on that second level where he would do some Woodworking and feel free to correct me if I'm wrong Tyler but that that was my understanding all day okay so I was incorrect on that point but so it's primarily for materials on that top level can I get a motion to uh recommend approval of the resolution for the conditional use permit and an interim use permit for a conditional home occupation license I will make that motion uh highlighting the fact that we're removing the requirements under eight B ucks no that's for the materials providing the information regarding the material material with element inside approve the resolution with the removal okay we have a second all in favor say aye aye all at the July 27th meeting and then Natalie other business I do not have any additional business tonight Mr chair planning project update I'm available for any questions if there was anything on the memo okay senior Council report welcome councilman Schultz thank you I'm here for questions as well so we got the same report as I have so happy to answer anything yet I guess my only question is um and I'm not sure when when or if this is being scheduled but I know that there had been discussions with our Police Department about uh traffic cameras traffic light cameras and it's my understanding that there was going to be a discussion or perhaps a presentation by our police chief two city council do you know offhand has that been scheduled or is that not scheduled or I think we asked them for some more information on that okay so all right more things to move forward Council awesome thank you I'm sorry may I back up to the I'm gonna go out of order but I um go back to a planning project question the um the property by caramini and Jensen content plan just a concept plan I know that that property falls like one property off of where the map has actually been drawn for what's in the new sign so concept plan is being considered how what framework is it being considered under in in that as the expansion for the city changes its potential that that doesn't remain rural residential for long so a couple of things with that the um it's possible that it could eventually be part of the Musa but we have so much land in the Musa right now that it's unlikely to happen in the next rendition for the comp plan which will bring us to 2050. so I don't think it would I think it would be a while yet a few decades before you would see that within the Musa unless a specific request came in to move it up okay the um and of course that there's discretion in the city's willingness to do that however they are proposing an open space and preservation plat and part of those plants allows increased density with the idea that that open space can eventually be redeveloped when there is city services so that it will be part of the application they should have a ghost plot for that open space and as we're looking at it we are thinking of connections between some of the road networks that we have within the Musa and how that could extend Westward with what they're currently proposing so it is something that we are keeping in mind as we evaluate it and work with him because it's commercial and makes views up to that like one or two properties it's mixed residential directly east and then it's mixed use by Hope Community Church okay anything else okay so then with the commissioner liaison calendar does anyone anticipate any conflicts and if if you do even if it's a last minute just give me a holler I'd be happy to everyone's still good for their assigned dates that will change um is there anything else I do not have anything further can I get a motion to
