something one more second okay okay thank you Debbie welcome everyone to the May 9th uh council meeting the caucus uh W please call the roll here here present here here very good thank you Debbie uh before we get into the uh of the caucus and the legislation uh I'm going to make the motion that we go into executive session and uh I think Greg you'll give us the okay proper wording for that uh the motion would be to consider the sale of property at competitive bidding and premature disclosure of information would give an unfair competitive or bargaining advantage to a person whose personal private interest is adverse to the general public interest I make the motion we have a second second by Chris uh Debbie caldero please yes yes all right yes yes very good so we will be going into executive session hopefully uh uh I mean we'll be back soon and everything to resume then the uh the caucus and the legislation for this evening thank you [Music] for sure that's a good one yeah okay I'll text you for sure I guess yes no Maggie keep it down keep it down thank you God it's too hot sorry my meeting my temperature yes Chris turned it all the way down I'll have you know that I'm sorry foreign thank you that's fine you're you're always good I can always reply everybody understands Nuance before the uh before the crow uh before the crow the crows I will uh and I wake up and look at an email somebody a different place with a new LED yeah got it yeah oh yeah moving don't really give it up hey you okay I think I need a new computer [Applause] okay welcome back everyone and I guess regular uh or back to the caucus they really should we adjourned the uh okay I'll make a motion to get back into a regular session all in favor aye aye opposed hey welcome everyone again uh we will pick up now uh with the agenda on page two the top of page two which is uh we have one piece of legislation that's on second reading it's the ordinance number 2023-41 this ordinance authorizing change order number one to the city's 2022 asphalt road maintenance and repairs contract with thyroniac Paving uh in an amount not to exceed 775 467 dollars uh total amounts of the contract would be 1 856 435 dollars and 15 cents I you know there is a streets of sidewalks meeting on Thursday which I think uh I guess we're going to definitely address is some of the uses for these funds available uh I think uh Daniel would you want to have that approved today and because we're not we're not married to the uh I mean we have a open slate as far as how this money would be used as far as the project I'm sure I thought we could we could do consoles comfortable we're still going to have to go through the details anyway so it's comfortable we it's good to keep his construction season's moving on and on the first and of course a lot of decisions hopefully Dale will be made through your guidance and the committee and everything so you're saying to refer to committee but you're going to pass it before we know we're just passing the money the money part of it right the money part of the country is how we use that money is going to be decided the committee will decide at the committee as far as that goes well we had the same discussion a month ago and we said it was going to be referred to the streets and sidewalk committee so we can determine how much money was needed and how that money would be allocated into what streets because this amount of money until the 523 meeting it was based on these two projects that are identified on here that apparently we're not doing so we can hold it till 5 23 as long as we pass on 523 is that okay chairman of the streets of committee that makes a lot more sense in trying to approve it with these uh question marks and we'll just remove that from the agenda and we'll just move on to that very good 2023-41 is hereby removed we move on now to First reading ordinance number 2023-147 is Orange is accepting the proposal of Norman J Cassini for professional architectural services in connection with the Civic Center kitchen renovation project or revision one Emily uh you gave us a very excellent memo if you want to so you could probably talk about 47 and 40 years right those two people with 47 48 I'll read 48. That's the order is accepting the proposal of Acom for professional mechanical engineering services in connection with the Civic Center kitchen renovation project Emily the floor is yours thank you vice mayor so the two ordinances that you're reviewing are as vice mayor said to allow Community Services to work with an architect and a mechanical engineer for the next phase of the Civic Center kitchen renovation and so on working with jme design which legislation was approved previously there's a need to work with an architect and a mechanical engineer as we work through the actual physical design and look to get bids out to or contractors assuming a bid out on the project and so these proposals will allow us to get the additional information that contractors need in order to bid the full scope of the project we did go out initially with a bid but because this information was not had at the time the quotes came back very high and so I did not feel that it was fiscally responsible to put those before Council so we had all the information to make an accurate bid from a Contracting standpoint and so if this does impact the timeline that I know I discussed in the last meeting while we were hoping originally to have the construction completed at the end of June right now we're looking at potential end date either of mid-july or end of August any questions for Emily from Council just um Vice Merrick 2023-47 that should be in the name of our CU architects in so we want to amend that to RCU the motion to amend it to RCU Architects is that what you're suggesting yes so moved second all in favor aye aye no we have one uh Anthony you um okay yeah just one one oppositions hey Chris did we I thought I was under the assumption Maybe I'm Wrong um but I thought the company that we were buying was the one the one that like the layout some of that design work for the kitchen so the company that we're working with on the design of the jme design we've not yet it's like Jamie designed to serve as the project manager kind of what we're seeing everything getting all the pieces together okay so they do not do the mechanical engineering side of that piece and that's something that we can't do internally so looking for this company to do that part to provide the scope of work the contractor any other questions for me I I just have a comment um in 1995 when RCU did the design work for our church we definitely had some shortcomings we have problems with the roof we have problems with a lack of drainage in bathrooms we had a problem with exterior finish uh that we're called for by the architectural firm so for that reason I'm just calling that to the attention of the council thank you Emily the amounts listed in the I think you said you you got quotes but you're not sharing them but the encumbered balance is just what we have budgeted this is still approximately a 300 000 project or you don't want to say right now so the total amount that we have budgeted for the project is first yes and so based on the initial estimates that we have admittedly by the contractors were significantly High which would put us over the budget and so by obtaining this information from both the architect mechanical engineer they'll be able to provide us within a revised quote that we can then put before Council review and then put before Council to make sure that we're within that project okay gonna get a hundred thousand of that is going to be funded today Grant on the construction correct so we have uh three hundred thousand dollars budgeted internally as part of our capital budget and then a hundred thousand dollar Grant from the Ohio Department for a total bunch of 400 thank you any other questions uh well both of these oranges will put up as far as the second regarding Akim do you have any opposition to there I'm sure do you want to have no I just have opposition to 47. so on 48 could go on the consent agenda if you're if we all agree that's fine the 48 will go on the consent agenda there'll be a vote on 47. okay thank you Council thank you Emily we moved to page three ordinance number 2023-49 it's an ordinance authorizing the disposal of the city Surplus equipment and vehicles through gov deals online auction service Services I think Dennis you provide us an update I think there's a couple more items that were put on the list yes I just have a couple comments on some of the equipment uh the Ford Escape that has a cracked frame and we added into a the dealer and a dealer said it's on safe to drive so we're going to pull that out the uh one box truck that was a Freightliner initially that was being used by the fire department that it's been repurposed and used by the service department you know the hours are low but when you factor in idle time and everything it's it's just not effective to uh you know upkeep and maintain the vehicle because their costs have gone up uh then my final comment would probably be on the uh Taurus police interceptor that is the same situation where it was a police vehicle the vehicle was repurposed into one of the other departments it's got a 96 000 miles but if you factor into the uh idle time and everything it's it's you know we've gotten more than our money's worth out of that and so with the vehicle with the cracked frame how do we dispose of that or what happens that will be uh disposed.gov deal uh and that will be uh you know disclosed just because we had talked about that today during our team meeting okay I thought when you said it was being pulled out I thought it was not going to be sold I'm going to be pulled out of this list but it will be uh it'll be on gov deals with full disclosure three four times a year maybe yeah that's correct and I just spoke with the law director before the meeting this evening um I'm going to find out if there's a certain threshold because we have a lot of uh lower value items that we you know like to get you know all chairs so forth instead of bird eating council with uh you know a list like this uh there's if there's a specific dollar amount that it works that we can disclose it without you know council's approval but the more expensive items will certainly come to council and I just want to be happy so if we could from time to get a get a kind of results what you know how much how much do we actually get from from uh these sales and everything I know the sure I can provide that yeah you can provide that right I was just curious because we've been using gun deals now for a number of years yeah since we've been selling at gut deals I think we've you know we've uh collected almost you know five hundred thousand dollars the proceeds from these sales where does that where do they go do they go back to the Departments or do they go to a general fund no it goes into the general fund thank you and I see we're selling a new Goodyear Tire with our tire contract don't we just receive tires when we need them how did we end up with you know I don't know how that We Came Upon that but it's been uh you know it might have been just something we had uh bought and had on hand but uh you know it's available and it doesn't fit any of our current equipment so a lot a number of trailers why are we do you know why we're selling a trailer uh that trailer will be pulled off I spoke with the rec director chadowitz and he said he has a use for it okay any other questions for Dennis any opposition to putting this on a consent agenda yeah we will put this on the consent agenda I might bet on the tire thank you Dan a little good on a Cadillac one uh ordinance number 20 23-50 uh it's not as accepting the bit of closing materials Inc for the purchase of asphalt paving materials through the joint Municipal Improvement Consortium on an as needed basis for the 2023-2024 uh year and then amount not to exceed 35 000 and then as you you've given us the memo for that yeah that's correct the price of info asphalt has gone up a little bit more than nine percent over last year uh last year uh the service department uh used 200 to a hundred ton uh director McKinley hopes to even increase that uh fifty thousand dollars was budgeted this year and we're losing thirty five thousand any questions for Dennis on this on this uh legislation putting on the consent agenda thank you we moved to ordinance number 2023-51 is owners authorizing the renewal of the contract of Drummond designed for printing and related services for the community Spotlight and Industrial Post in a mountain Optics seed thirty two thousand dollars an hour you're worth the memo force and everything yeah um why not just make a clarification this is not for printing of the spotlight or the independence post questcon has that contract so this is uh for the layout uh and presentation of the two Publications and this is uh renewing last year's contract it's worked out really well for us because we have one graphic artist who lives here her family lives here so she's familiar with all the programs and having one person who's working on both Publications there's a real time efficiency there in terms of being able to get everything out in a timely way as we're still kind of dealing with some of the mail delivery delays mysteries of those so um this allows us also to have continuity between the spotlight we used to have rapid artists that worked on that and we had quescom worked on a different publication I think with a new branding it just brings it together and it really just delivers a stronger product and the the cost is the same as it was it is the same yes yeah any questions I noticed that the last the most recent edition of the city newsletter was extremely late um yes is there reason for this we are still working on this because we I've talked to the post office we're trying to figure out with the postage and trying to get it in even earlier they they say they require 10 mailing days since we're paying a bulk rate to deliver it but we're still having some unusual delivery issues so we're doing our best with everyone that works on the Publications to get them out earlier so that they're delivered sooner I'm hoping by the end of the year also we're going to make it's always available online as a digital copy but people are quite used to that yet and I think with the home days Edition they'd like to have that copy in their hands um but yeah we are working with the post office trying to figure out because we do our best everyone that works on the Publications to get it out refresh my memory when we switched over to this company a year a year ago a year we're still having mailing issues well the mailing issues aren't with the design it's the post office completely yeah and so we're also working on just going through all of our mailing lists as well because we have companies that have moved we have residents that you know aren't in their homes anymore and trying to see how we can eliminate unnecessary Publications but office has made work very closely with Quest com Quest comp does an outstanding job because they actually take the Publications to the orange post office to get the postage put on then drive it back here so they take that extra step to make sure that we you know try to get it delivered as much as possible but some of this is just so the delaysia German doesn't have anything to do with this no she sends it to Quest com and then everything is printed there and then they they take it from there to get the postage on and get it taken to the post office and I just talked to one of the postal managers and they said sometimes it's been where they've had people on vacation and so maybe they are not delivering them as timely away but um again we just keep trying to move up our deadline dates um to try to get it as much additional days for them to be able to deliver it so that we know that the the post is always delivered by the first of the month and the spotlight we like to get delivered by the 15th of the month because people want to be able to sign up other kids and all the other programs and have at least a two-week window on that before the month starts so go ahead one of the things I've noticed though in the post it seems like we continue to have more and more uh other things included in there that normally would have been the spotlight in the past so I guess my question is if the key critical items for example the director reports the council reports of those items which are the focus of the post keeping their residents informed on the government and what's going on in the community but they're being overshadowed by what seems to be a multitude of pages of other things in the front that seem to be better suited for the spotlight I think what we try to be very selective about because the spotlight is every two months and so there's it was 52 Pages the current edition is 52 pages but sometimes things change and so you have the timeliness of being able to put it out in something like home days or the recycling day we don't do a lot of the small programs we do the bigger city-wide programs the city-wide community garage sale that's coming up just so we can had a good cross promotion for people so they've maybe they're not looking at the spotlight maybe they're they're older and they're looking just at certain sections and they're not looking at others so we're very mindful that it's a team discussion that goes into what we don't want to repeat I mean obviously the spotlight as I said was 52 Pages this month and the post which we've tried to add a few more like sustainability stories and some other stories like that just to make it more timely that was 24 or 28 Pages this month so but open to if if you know if you feel that we're adding too much of one rather than the other I just think that it's nice to be able to if people are going to the um Civic Center because they want to make sure that they get their uh Spotlight at beginning of the month so that they don't miss signing up on things so and Emily can speak to that too and before we entered into a contract with this drum and design firm we did not use a graphic design firm for the newsletter it was compiled in the city and handed off to Quest cam so we have an additional expense no questions actually did the post they had their graphic person right they did it in-house right they did it in-house and then sent it to us and and frankly with Drummond design her turn around time on a lot of this is really fantastic for us because when we're trying to get timely things out or if we have a program that's being added at the last minute it's nice to be able to get that into the program especially something like the spotlight which is for 60 days that you're putting it out and you're trying to get it done almost two months in advance so and if I remember correctly when we approved this last year it was because of the rebranding and the new brand and the new formats and this drum and design was going to create new templates and redesign both the spotlight and the newsletter and there would be additional leg work up front but their costs would recede over time because the the majority of the work is done with the reformatting which is done with the first few issues but now we're kind of renewing at the same cost when now they're just filling in no not actually because every month recycling day it's a different format so she knows the different formats that are in there but we're not getting charged again and again for some of the other Design Elements and that's not something that anyone here in-house could do because you have to have someone who has that big picture view and is uninterrupted and is getting all the content from Parks and Rec and community services and all of our outside partners are about town partners or you know Kiwanis and um the Historical Society you know they're thrilled that they're working with us in the schools as well that we can publicize it for them because they don't necessarily have the budget for that so we can put it out and it's a reliable publication for them any other questions yeah so just out of curiosity in the future we bid the entire newsletter package would we include both the design and the and the Printing and Design and mailing into one package or I I would not recommend that because I think questcom is very good at the printing and the postage and and we keep up on the mailing list but then they they do the second layer of verifying everything I think having someone who's just involved with the design on the two Publications um they're getting all the content they're translating it they're making sure the photos are the right colors they're making sure everything matches um we have a lot of people that are contributing content so there's a lot of proofreading that's required too that we don't look silly so you know we just we have a lot of different people different departments and outside organizations that we work with and so it's a very complicated process any other questions then are you vote on this uh not having do we have a consent without a consent agenda or you want to go in here I'd prefer to vote on it okay and then you could remove my name as an introducer as well very good thank you Ella um we'll move to ordinance number 2023-52 it's an ordinance enacting a temporary moratorium on all electric vehicle charging stations within the boundary of the city of Independence for six months and I know Tom you're the introducer this legislation but I know Mike gave us the uh so Mike if you want to comment on this thank you vice mayor um what we're asking for is is just a a hold on any type of uh uh permitting of electrical vehicle charging stations we've been getting a lot of inquiries lately as far as what our rules are what our regulations are how do we uh what restrictions we may or may not have on these so what I've started to do is work with the Fire Department chief Riga Lieutenant Reese in the economic development director Jessica Heiser to develop and an ordinance uh to be able to present at the council presented the Planning Commission get planning commissions approved on it and presented the council to be put into our ordinances uh which would provide guidelines and safety restrictions and things like that so that we have something to work from we're not just shooting in the dark on these uh stations there there have been quite a few uh inquiries there's a couple that have been installed around town and we just want to make sure that we get a handle on them any questions for Mike is there a Ohio Revised Code that dictates how these are not that I'm aware of there's nothing in the building code as of yet there's nothing in the electrical the current electrical code as of yet I'm not sure what the what may be in the the next coming edition of the electrical code NEC ESS I have a question for Jessica Oh by me uh Dale and then Jim uh Jessica do you suppose we might be sending the wrong message economically to delay the ability of people that come to the community and want to be able to utilize electric vehicles the fact that we 've searched a short tutorial on this it's not a long-term delay the idea is that we can get something on the books here in a short period of time so that we aren't in impeding the business Community now does does green have an issue with charging stations I'm sorry does green have an issue with charging stations do they I think we have an issue with charging stations I'm not sure why we're asking about another Community because I just wonder if they indeed have charging stations or they have rules that we could pull from that it would take such a long moratorium I have not looked to see what they're they have created any ordinances if I if I could speak today at the northeast Ohio fire prevention Association has developed and is working on a a developed a white paper and it's provided in that white paper as a sample ordinance to work from the fire Northeast Ohio Fire Protection Agency is the is the the Catalyst behind this request for legislation so Mike if I mean if upon your work with us if two months three months right you you put the piece of legislation we don't have to wait six months we know if this you know it could be as quick as one or two months but at least in the meantime get something you feel comfortable with fire cheese to have something before uh Council before July amen perfect so six months we're not we're looking at the far and Far this point but hopefully within a couple of months we'll have something it all depends on the approval process yeah so what happens if some of the players at the Cavaliers or the executives that work there at the Cleveland Clinic courts have electric vehicles we're going to tell them that they are not allowed to install a charging station and charge their vehicles [Music] so this is this if it's inside an enclosed parking structure then there's no moratorium or they probably I mean whatever there's a few that you have already been building are up and running those that have been built if there's inside uh there's quite a few in residences that aren't even permitted they're just installed uh if they've been installed in a uh inside of a building I'm not aware of any of any uh requests or permits as far as accoline we're talking primarily we're looking at the exterior the zoning the setbacks the Aesthetics that type of thing for where these are located along with the electrical equipment that has to go with them the the dedication of parking spaces how that affects the parking for the the business or the uh the property those types of things like how many how many uh applications do we have pending that this is uh we have none pending right now not we're not we're not putting a stop or a hold on anyone at this time we're just putting this in place so that if one comes up before we get our ordinance in in a line uh what we have the ability to to hold that in our uh future municipally owned parking lot at Sea Biz building will include electric charging stations and those are not installed yet how does that work with this moratorium these are are some of the factors that we're going to look into as far as locations and and proximity to buildings uh those type of things and the the ones at the cbiz lot are within a whack a grant and The Wack is still in the bidding process that has taken um exceptionally long period of time and I'm not sure if and and when that will actually come through at this point in time let's the goal should be to get something to us in the next 60 days for to at least start discussing fair enough yes all right Mike you'll probably introduce that maybe the next Planning Commission meeting or at least within two [Music] good idea I would make a motion to amend the the period of time from six months to a shorter period let's make it four percent or 60 days well remember if it goes into if it goes into chapter 11 we're gonna have to publish a public hearing and then we're gonna have to have a public hearing and then so you might want to factor that into your time frame I don't know where it's going to go in the code but keep in mind it does affect its owning ordinances we'll require to have a puppet hearing hearing I think we're all motivated to get this sooner rather than later do any other municipalities have ordinances governing these charging stations uh I believe Willoughby is discussing it and but I'm not sure of any others that I haven't heard of any others that have put anything in play yet uh Jim thank you Mr Price um there so I I support the legislation as written I just wanted to point a couple things that uh there has been an electric vehicle charging station task force that the public utilities of Commission of Ohio has undergone they have not issued a final report yet but you might find some good information there in the state of California has put some extensive uh guidelines on these stations so things to remember are we do have flood zones in town um how do you uh properly Safeguard uh these stations in a flood situation it's all printed out there so it may not take a long time for us to have to put together some of these things and some of this might be more than we need but I can say this there is certainly a danger and you've got large amounts of electricity flowing through the ground proximity to buildings as well as you know water and we certainly uh should have we have state codes on gas stations but I think it's important that we do do this we might be able to create model legislation that other communities might be able to look at but I do think that there are anything there's something new there's always a danger of the unknown so I don't think there's more of a danger with electric charging than there are with traditional gas stations but there are dangers associated with both so I think it's prudent to do this and I'm happy to send some of the research I've done to you so that you can see what's out there there's extensive information out there and just putting them up willy-nilly is not something I think we wanted to see and obviously from a residential perspective I think we should at least have some type of a permitting process where there is an inspection and some guidelines put together because we've got older housing stock I know in my garage this wouldn't work too well I mean you'd have to really put extra juice in and these are things we just haven't talked about so I'm very in favor of what we're trying to accomplish here and I think we'd appreciate any information you would want to share with us thank you I'll get it to you thanks okay and I just have one last question so the one the the commercial ones that we are aware of have been permitted and inspected uh yes the one in CSA and there were three going on the upper deck of the parking garage at the Cleveland Clinic that have not been energized yet they're in place but there's the electrical service hasn't been given to them yet there's also one across the street at 6801 yeah yeah very good thank you Jessica thank you Mike uh do you want to put this on the consent agenda do you want to have it voted gentlemen I would think you want to vote okay we'll be voting look at that I just want to make give David guidance okay thank you uh ordinance number 2023-53 it's an ordinance uh authorizing the mayor to submit an application from the northeast Ohio area-wide coordinating agency noaca to secure Grant funds for use in connection with the Rockside Road traffic signal upgrade project and declaring emergency uh don if you want to embellish on that a little bit you can give us a time frame that we can expect something like this yeah thank you very much mayor yeah our um traffic engineer at the GPD group clued me into this funding opportunity this particular Grant is through the congestion mitigation and air quality initiative at Milaca they routinely fund traffic optimization projects so this project would involve upgrading approximately 13 traffic signal controllers and Cabinetry at on the Rockside Road Corridor the there's no commitment to the city just to submit the application the grant no outlays five years ahead of time so this grant albeit submitted now wouldn't be eligible for funding until at earliest next year to begin the planning process but construction funding isn't uh isn't scheduled until 2027. so it's out of the ways but we need to start planning now to uh secure the Grant and to submit the commitment of the application well then I got according to Vern's memo I guess we the city would have to at least a budget 221 000 for next year's budget 2024. on this but the balance could be uh not not uh not needed until 2027. correct yeah this specifically covers construction costs which our local share was approximately 828 800 would not be needed until at the earliest 2027. questions further not cheap I've heard that you I I saw that any questions how he is the chief of engineering this is a mandatory upgrade no sorry no it's not that the controllers have been in place for over 20 years technology has gotten better your traffic controllers that are in the cabinets are older now and if we were to replace them we'd have to upgrade to the new they don't I don't believe they're even made any more the controllers the version of controllers that we have they still work they still function I want to give you the wrong impression that our system is in bad shape it's it's not it works pretty well and we've made improvements over the last 10 15 years and optimizing the system that's out there but this would be just to take it to the next level and these controllers will give us an ability to Implement a traffic management system called Centrex it's just the Next Generation it's more sophisticated and is able to be done with a central office monitor here at the city we're not that sophisticated here but we potentially could have Consultants help us with that if we were if we needed it but regardless the controllers are aging and they need to be replaced so the class does is eight hundred thousand dollars correct and that covers our share construction but also that the non-eligible costs of planning preliminary engineering engineering and bidding preparing plans all those costs are not eligible for uh through the noaca Grant and what number of dollars is the the total cost of this it was about 1.7 million total project cost and on the system we have in place now that's when when the road was widened and the Iranian shall saw that was probably about two thousand yeah three um so did he is 20 years exactly and what is the realistic lifespan of those controllers and that signalization system well they're still working good for us but I don't know that's a fair question I think the traffic engineer would not have recommended we pursue the upgrade if he didn't feel it was time to upgrade and I don't think you want to wait till it you know until things start failing I do it on a proactive holistic Global approach and securing mostly half half the money half the cost with grant money we do one other item we thought we would package with this project is to paint all the poles that are out there on Rockside Road either repaint them the same green color or perhaps go to a different color black I know there's a lot of communities are moving too if we're looking to Rebrand a downtown area and so we thought that we would that again that would be local cost on our part what we thought it would make for a more complete project so it sounds like this is definitely an item that Council should add to the five-year Capital plan because if we do not receive this grant there is a limited lifespan on these and we're looking at a potentially two million dollar project here we can put money inside each year for the next past two years too Don how about the 13 signals versus what I guess is that every signal on Rockside or y-13 or why not just four of them yeah because it's that currently all those signals on Rockside from Lombardo all the way to Brecksville and then even a signal or two north and south on Brecksville Road our contained in the traffic system that's out there so everything is sequenced and programmed to move traffic efficiently so that this covers that entire system we also thought about maybe looking at the signals up and down Brecksville Road that's another secondary system and uh I believe the traffic engineer mentioned that two million dollars was kind of a sweet spot that this program like to fund so he thought the best approach would be to take care of the most important system that's out there on rocks that handles the most traffic and knocked that one off first and then maybe follow up with the system up and down Brecksville Road do you think that there's any one Troublesome intersection or light that I mean if there's something causing an issue now rather than wait five years but I don't know can you one-off two signals or or re-sequence just a just that problem areas which I'm not aware that there are any yeah we do a good job of using traffic that our traffic maintenance contractor signal service they they take care of all problems that come up on a routine basis they also do they inspect these cabinets manually and perform maintenance whatever is needed so hope doing it holistically it doesn't it doesn't prevent you from doing things individually if something were to come up we have the ability to do all of those things and the questions are done any opposition to the putting this on the consent agenda we'll put this on a percentage ordinance number 2023-54 is always approving the tax budget for the year 2024 as we've seen in the memo from the finance director the county doesn't need approval of this until July so we usually introduce it in in May and uh keep it on first reading and then approve it in in June and it's pretty much has been the same I think for a number of years it's just kind of like uh tradition that we uh not a whole lot of wiggle room as far as what uh the budget this particular budget incorporates so ordinance 2023-54 will be kept on first reading ordinance number 2023-55 is ordinance authorized in the city to participate in the new National opioid settlements with tiva la gran CVS Walgreens and Walmart and declaring emergency my understanding is that in order to receive any proceeds you have to do this as we did previously these are just new um new businesses that are being added to the lawsuit is that correct yes uh it's a different uh it's not the distributor it's it's the other level Senate yeah the um the retailers copy thank you and any idea of what we anticipate receiving financially you know I looked up to that last time I think it was uh for that last round it was uh all in over the next couple years was a little under 65 000 so I don't know for this but if uh probably use that as an incredibly a good figure it's not it's not gonna be uh significant I'm not anticipating significant but it will last those type of payments will go on for quite a while because the way that's being funded I mean we we can earmark this Toronto for educational purposes with the uh the police department everything too that uses towards because this problem's if anything exploding is not going away and everything that's a fact any opposition of putting this on the consent agenda no but I just I'm looking through it and I realized that uh the finance director had completed and dated all these forms on February 20th is there a reason why such a lag with uh us acting on it yeah the thing is kind of tranches so so paperwork got ahead of I'm not involved in the case of just getting information just like every other law director and uh so uh when we passed the other ordinance I noticed that these retailers had settled just out of the abundance of caution I just thought I could throw this ordinance on as opposed to us relying on the previous order and simply passed a few months back so it's just kind of a preventative measure so that it won't delay any of our funds very good we'll move on to ordinance number 20 23-56 is Orange is declaring the structure at 555 Brecksville Road in the city of Independence to be an unsafe building and therefore a public nuisance as defined in city codified ordinances 1369.01 declaring the structure is 555 brexel Road in the city of Independence to be insecure unsafe or structurally defective under a high Revised Code section 715.26 and authorizing the law direct to notify the owner thereto and declare an emergency and Greg I think the notice went through them already wasn't we yeah Mike uh Michael you want to comment uh this was on the uh Consul agenda of about two and a half years ago at that time it was removed Council wanted to give the owners opportunity to provide their own solution unfortunately they've come up with a presented in it two and a half years they presented a couple ideas none of which was were really viable one was for multi-family housing the other was for a storage facility which that structure was not capable of of functioning as by their own engineer the the property's been in disrepair the the it's been uh deteriorating the door has the rear door has been broken into several times the fire department has requested uh that the the owners secure the building quite frequently over the last four years or a little over the last couple years rather and it's just uh in the condition it's in nothing nothing is is being proactively done for the structure and it time to to uh get it back on the table and move and Jessica are you here I I exactly what Mike said and we've met with them again the the bio the options they've talked to us about are multi-family housing which is not viable right now here in the city of Independence and the other option is you know they've talked about storage units which again they're structural engineer has looked at the property and says that that the structure would not support that from an engineering standpoint so they're kind of left with what other options do they do with this property and obviously they needed some parking for the restaurant next door but we're we still have a dilapidated structure that has issues with it and if you talk to our safety forces you know one of their concerns is as this back door or other doors um are broken into the concern is whether or not they're going to have to access that building and there's so much mold on the inside they hear for their own safety in there as well as for anyone who who goes into that facility there's anything happening because I'd heard that that so many program there's you know drug paraphernalia people inhabited that area I'm I'm not sure again the safety forces um you know it's not a not a structure that they feel safe going into obviously if somebody calls from inside you know they would make a response but you know we just don't go into that structure to to see what's going on all right Chief you wanna we get on this welcome uh no everything Jessica said is correct um some of the officers in the past have uh had to go inside there they fear uh due to uh there was black mold there was other things over there that the structure may not be even hold the officer's weight when they go inside um go through a full floor anything like that so yeah I mean just looking at it from the outside we would attempt to call people out of there anything else of that nature but going inside it would just be a risk to our officers fire department even comes in with more equipment than we do um I don't know if they're on the line now they might be able to speak on this for their own safety to enter into that building but it would not be safe for officers tactically or um any other way it's just an unsafe structure for our officers they've reported this to me even before I got here that when they went in they felt unsafe going in I think it'd be who Council to move on this sooner rather than later because this is not a new situation situation that's been going on for years and before something happens tragically down there I think it's time to to get moving on this issue and moving forward with this uh this ordinance in Chief there is a police report that is attached to this legislation and uh in the last line it said it reads that uh the property will be transferred to a new owner on 827.20 so I'm assuming that this police report is prior to the current ownership have there been other police reports and incidents under this current owner there was nothing else that we had inside the structure um everything else was from the parking lot and stuff like that that was the last police report that we took from inside the building any other questions or comments just the question about the the multi-family housing was that the attempt to see if they could use that as some kind of a dormitory setting for the Podiatry School of Kent State it was something they were considering yes okay so it was more of a dormitory setting it's it would still be multi-family housing I two of you had a question yep I was just wondering if uh you know given that this owner has you know put hundreds of thousand dollars into buying the property and has attempted to work with the city and and uh to come up with something that could work for it if we would be willing to make some type of appropriation to assist them in tearing it down so that they can do that and then uh they can move forward with whatever a new building that they want to put up but um you know they've invested a lot of money into this building I think they're in arrears tax wise to the community since they've never made a dollar on this building and uh it would seem to me that if we're going to be business friendly that maybe we might want to consider doing that well the more council person the more practical approach I think you'll see arise is after the city sends this ordinance and lets the business owner provide a plan I think you'll see that they won't take action then the city will have to take action and we'll be back to you for a contract to tear it down and that that arguably will be very material and Council can approve that if it would like and then the monies the cost of tearing the property down will then be assessed to the property uh and placed as a lien on the property and then the city can either wait for that lien to be paid upon sale or by the owner or more likely again practically speaking the city would file some sort of foreclosure and at the end of the day um given the scenario practically speaking the city would eventually own that property and just so you're aware councilman we've we've also looked at ways to see if we could find some land bank funding to help them raise the building unfortunately we have not been able to secure any type of funding we don't qualify for a lot of that have we received any estimates on the demolition of this structure we reached out to one firm and uh got a quote just so that we know about 300 to 380 000 that's uh saving that the asphalt does not need to come up for that raising I I don't know I've not seen the quote or the price but I think that predates the 70s so I don't know if that quota has any contingency for especially it does when was the last time that that hotel was in operation it's been 20 years RSC yeah they were selling rooms really it was also and that estimate does include removing thank you any opposition to this legislation we put on the consent agenda well done uh let's we'll be voting on this test and thank you Mike you're welcome ordinance number 20 23-57 is ordinance to appropriate a permanent fee for a public roadway property owned by Cleaver 2006 LTD uh limited located at Cleaver Court current personal number 561-11-002 and declaring an emergency and I noticed that the I saw the amount three thousand four hundred five dollars is what the appraised amount was for this correct much mayor all right very good any questions we're done yeah I would suggest this being referred to Thursday's meeting any problem went back down and keep uh live on this little thing but on this uh it's going to hold up the project so we're we're essentially taking someone's land without their consent well this is we've had a consent to use that for 30 years appraisal came back at three thousand or twenty five thousand and has has there been any negotiations back and forth yeah we've been in communication they forgot to push a button and get some information back to us so they realized that recently I'm not saying we can't settle it but this Project's going to start next week trees are coming down so if you want to delay the project then take away our flexibility if you don't then this is not displacing to any person and it's a end of a cul-de-sac that uh actually we've had the permission to use uh from the MR Vinnie gave me permission to use that back in 1980s we were able to fix it use it and we never had a problem for the past uh you know 30 some years and we're formalizing it now and the appraisal came in at uh three thousand dollars their request is five twenty five thousand and uh we're doing this because we want to keep that uh Cleveland Court project on track I understand that I'm just afraid and fearful of the precedent that it sets with this is essentially eminent domain and I understand we're not displacing any person but that's essentially the fear of the residents on Stone Road with the uh the southerly portion of their property with the Concordia land and um you know this is exactly what we're going through right now this is against the will of the property owner it sounds like there was some sort of negotiation I would prefer it to be amicable when we did the cul-de-sac expansion on but is it off a chestnut down there that we just read on Oakwood uh the residents were opposed to uh to losing some of their their Road their yard Frontage for the expansion that called the sac we as a council work with them we modified the size of the cul-de-sac we cut back on the sidewalk so that we didn't infringe on their property we worked out an agreement um and I would like to see this council do the same thing with this property owner yeah I could just uh Council for Sanger to speak I hadn't I have not spoken to the property owner I've seen emails go back and forth and of course the administration asked after this ordinance is to file an appropriation I have every intention of contacting Mr balog and um uh Cleaver 2006 it's just the emails that I've seen as at least I'm going on memory here please it's been a few weeks but the emails from Mr balog suggested that 25 000 was a bargain they felt it was worth more so the city was at three thousand twenty five thousand but you have my word I'm going to if this passes tonight so it doesn't delay the project I'm going to call here tomorrow and say what do you want to do if he provides a reasonable offer I'll turn that over to the mayor he has certain Authority up to a certain amount if the city wants to mobilize and pay more than that uh I'm not saying the city is even entertaining anything higher than the appraised value but certainly understand the uh the value and negotiating a resolution prior to filing a lawsuit right in this Cleaver Project's been on the radar for seven years now and for it to come to this point to the potentially delay the project is it's ridiculous in my mind because we should have planned for it and we should have had these discussions and we should have worked this out rather than letting it delay the project custom can I ask you a question Mr Baylon did Mr Bala call you or he didn't do at all he did not call me because I thought there was correspondence and I just wanted to confirm that he did not call me okay question you said Mr bailock has the property but mayor Mr Mayor did you mention another name thank you I agree with mayor I think we should move forward with this and allow our law director to get an am a couple resolution of this but uh to delay this project over between three and twenty five thousand dollars makes no sense at all it's not a waste of our freaking time we have another meeting on the 23rd that we're acting on another piece of legislation on that gives us a few weeks to work this out and the project doesn't start till the beginning of June correct we are clearing trees maybe next week as early as next week yeah I want to tell the presidents of Cleaver court that we're delaying this right but it's telling the citizens of Independence that we potentially will take your land against your will yeah well I don't know if it's against your will I mean this is again yes your will I Define it as when you have an impasse you find a way to negotiate something that works if not they wouldn't have the mechanism in the codified ordinance of the state of Ohio if it wasn't something that was necessary you wouldn't get half the projects done if you didn't have some flexibility or some latitude so you call it anything you want it but uh I will the fact of the matter is we have a project that we're doing and uh I find it um irresponsible to hold it up for a piece of property that has no dwelling on it and no uh people participating that live there could it be a potential buildable residential lot you know I can't tell you that I don't I didn't see the appraisal but I can tell you this much we are in a position to do this project and uh I'll let the majority of council make that decision I would not hold it up though I can tell you right now would we vote in this evening is that appropriate to talk about it on Thursday you can talk about it but we're going to move forward I think once the order has an opportunity to discuss matters with them then we could entertain you with what negotiations you're going to have you know what some of these projects some of these situations you have to as a leader of the community make tough decisions you can't type rope or walk the line and try to pretend you're going to make everybody happy because there's two sides to every coin and if you pick one you're going to lose the other but in this business over time you build a reputation of of your integrity your directness and you know that uh and your leadership capacity so these are all tough issues I grant you that having said on Console but there's no reason to not exercise your do your job and let the chips fall where they may and the people decide what they want in terms of leadership for their Community long term let me let me respond to your comment it strikes me that this is very late in the game considering when the engineering and everything else was done to me it seems like this should have been pursued earlier on and it shouldn't be something at this particular stage of the game that it is quote as you say delaying the construction is that an unfair statement I think there's so many different Logistics that go into a situation like this that bless your living and breathing through this with the engineering department and the Law Department it's hard to put your I understand it's hard to put your arms around the grass the totality of it but in this case it's pretty simple we got to make a decision and when there's lack of communication on two sides then we have to use the legal mechanism to keep this thing moving okay council person I I fundamentally agree with your your what you're trying to get at but I just looked at my phone at least the emails that were forwarded to me from Jessica these conversations have been going at since the beginning of March and if someone's saying I believe my property is worth twenty five thousand dollars and that's a bargain and a steal and you're saying well we went to we went to the extent of getting a certified license appraiser and they say it's 3 000 and change and they're saying we're not coming off the 25 we're not coming off 3 000. uh then passing an ordinance to appropriate and allowing me to do what now I'm getting involved and I will reach out to the applicant and say we don't believe it's anywhere near 25 000 but there's a cost for us said appropriate what do you think is fair I'll take that to the administration and if they say if they think that's fair and they need to come back to council because of the amount they will if they don't uh it's not like this negotiator is someone new I've been dealing with him for the entire tenure of my yeah you know over 20 years so I it's not like I'm going into a negotiation with uh Mr or Mrs Smith for the first time I know this Nick I was here we all know this negotiator so yeah I uh I would just ask for you and I don't think I've ever done this in my career just give me the leverage to go talk to him uh with the appropriation and I mean I don't think anybody up here is saying that I'm not reasonable and I'll take back whatever he said I don't make the final decision the administration ultimately if we have to given the amount canceled but um you know it it is what it is there sorry and why there are many streets in the city of Independence that dead end and do not have cul-de-sacs some of them have Street or driveways directly off the End of the Street um and in this situation we're pushing for this very large cul-de-sac and we're taking land or having Council approve eminent domain to to take land from a private land owner um is there a modification perhaps that could be made to lessen the impact and still achieve a similar result councilman talk about how do you believe the the actual standard that we hold developers to a new subdivisions is 100 foot cul-de-sac diameter the one we're proposing here is a little over 70 feet so we have tried to keep the footprint more reasonable and something that we would feel as a minimum and I point to cereal and oval are kind of very similar in size they're smaller they're not near as big as anything you'll find in Chestnut woods but so we felt it was something we could live with and try to meet that happy medium there and another note of point to note that we're talking about very small areas of acreage here it's 0.187 Acres permanent take in .03 Acres of temporary it's extremely small it's fractional when you compare it to the overall area of that parcel and also we're making significant improvements with this cul-de-sac in terms of Frontage for this very parcel so I think they're the owner is going to realize a benefit at no cost to them on the physical improvements that we're making so those that I think are important things to keep in mind Don how large is the parcel I I don't have it in front of me I'm looking at the appraisal it's every bit of 18 or 20 acres I thought a lot of it's down over the hill going out towards the river it's a large piece of land so it's a large parcel but the section that we're going to be involved in is the flat area at the top that might be might be more appropriate for a structure potentially but even if a structure was built you wouldn't we wouldn't permit it to be built at the very end of the street oriented if the car would run into it but you'd still have to I think this cul-de-sac actually provides for a more proper Frontage for such a potential House Development if indeed that occurs but we have uh so archwood has a driveway running right off the end of the street so it is what street you live on time Waldorf has the same so we have there's an elevation difference on this too if I remember correctly you could turn the muscle around right and the City of trunks well if we left the thing the way it is then there would be no problem right please do that right now down there now we're just formalizing what we've been doing for the last 40 years I think the issue that the landowner probably has is that uh you know by taking that it's it's not worth the 3 500 3400 it's worth more to them because it devalues the rest of the property that could be buildable for a home actually this would be better actually this will be make it better for him well he doesn't seem to think so so well I don't know if that's the case or not it's his property yeah we'll be voting this evening uh ordinance number 2023-58 is ordinance authorizing a city enter into agreement with vrk Holdings LLC to sell real property owned by the city located at 5469 old Drexel Road and 5572 brexel Road and declaring emergency and I think uh Greg you were going to put some extra verbiage into this ordinance yeah I just want to make sure that um Talk publicly uh so is it fair to say the council would like to have a requirement of an economic development agreement containing a retention of employees for having a minimum payroll of five million dollars situated on the property with the with the five million dollar payroll beyond the property um within the city within a city in the city but also to make that specific that it is a a clear retention of 5 million uh of of from which points that would have left but for this purchase and I think you want to list the name of the company companies that this pertains to we can ask them all the companies may I make a suggestion and say that perhaps it's a retention Grant Subject to the 5 million minus the Precision so that we can we can encapsulate it that way yeah what's precision's full name if they listed it's appropriate I mean yeah okay and do we not want to say that that and there's also an anticipation that there will be further Economic Development activity given this this sale there's now a I don't know anticipation yeah anticipation that there will be a larger uh project coming to the city because of the still facilitating this purchase that'd be fair I agree so so this would amend section one uh at the end and an economic development agreement containing the retention of five million dollars uh Municipal uh payroll within the city but excluding Precision Environmental and we'll have a clause in there in case they do move before the fire that they'll that would uh that that I will I will tell you that uh I will make sure that that agreement has the requirement if they should leave within five years let's say year four they owe the city and required to pay within 30 days a hundred thousand dollars because that's what the five million payroll would a hundred thousand per year I'll make sure that that is in there and that's that's typical of our grant agreement kind of you understand how those flow okay plus that other language correct ly plus that other language just discussed yes and then there's an anticipation of uh any other questions please this evening no I just have to make the comment that um when this was initially discussed as becoming a potential sale of City on property the mayor stated that we're going to do it so we can find out what it's worth and the way that this was sold and advertised was it was listed in the Cleveland Plain Dealer on two days and it was just the permanent parcel numbers that were listed for sale and if any entity public or private were to sell a piece of property I think they would go a little above and beyond just printing the permanent parcel numbers if you truly wanted to find out the value look Amendment emotion uh Debbie call the Rope please yes yes yes very good thank you Jess and we move on to the last that these legislation on the agenda ordinance number 2023-59 this orange is accepting the proposal of Paramount Concrete Construction LLC to provide Concrete Construction Services in connection with phase one of the Maple Shade Cemetery Expansion Project thank you vice mayor we were engineering department has been assisting in working with collaborating with Annie Lynch and Jess Heiser not development City Planning departments and working on this Maple sheet Cemetery columbarium project speak up Dad please we have been working with Anne Lynch and Kaiser on the columbarium project we asked our roadway maintenance contractor concrete contractor Cats Construction for a price to to dig approximately six to dig six Footers for these columbariums and some decorative stamped concrete walkways that was consistent with the plan that was approved and discussed at the buildings and lands committee meetings for that site in that oval area at the cemetery we received a quote under our maintenance contract of fifty eight thousand dollars we wanted to look one other location to see if we could get a better price from a local contractor we've had good success with Paramount concrete did a nice job at the bocce ball courts we asked them for a price and they gave us the price of forty three thousand forty five thousand three hundred for the project so the considerable savings to the quote we had had with our maintenance contractor it's a smaller company less overhead and felt it was a good savings to the city to move forward with the Paramount concrete and down we're going to get the weather cooperates so we can get this project done by the end of the month yeah Paramount is available they're ready to to go to work and they can get this project done quickly for us um hi Jim yeah so um I understand why we went to the first vendor who's an existing vendor the city it's just not something we should can has to bid out it's over fifteen thousand dollars we're saving we've used them in the past I think we're comfortable because we had success with what they did with the recreation department we don't want any it's just more complicated than just having somebody coming off the street and put some mud down we went with somebody that uh to uh that we knew had the experience and the capacity to do it and do it right if we wouldn't have gone out and tried that we wouldn't have saved seventeen thousand dollars so I appreciate that man but I guess I I don't know these they're not our concrete vendor and just because we have a relationship with them don't we have to bid this out it's over fifteen thousand dollars well the maintenance contracts allow us to move forward you know we bid the maintenance contracts out and within that contract we have specific line items for equipment and labor so proceed with this project not fitting it and just asking our contractor for extra work do it on our t m basis time material or lump sum we follow ODOT specifications with our contracts and any time extra work comes up on a contract you're allowed to pursue it in two different ways time and material basis or a lump sum proposal so we did that and felt it was it was it was felt within budget and we could have moved forward the cats was ready and we just reached out to one other vendor to see to check that to check that price and to see if we could do better so Paramount concrete over a bit on um any of our work before and successfully are they currently a vendor of the city they're a licensed registered contractor in the city I understand that their license and registered have they bid a price structure for concrete not I don't believe they've ever been on our city-wide maintenance contracts I think they've been yeah they're pretty big the maintenance contacts are very big I'm sure they're wonderful humans no no I'm saying the maintenance contracts are very big they wouldn't bid on our maintenance contract isn't this the firm that did the bocce courts yeah I think that was under fifteen thousand dollars though they didn't have to bid for it so we we could have just gone with the contract and but you're being asked to save seventeen thousand dollars and you know and by the way the columbarial walls are in and uh I went to a wake on Friday and the first customers waiting for their uh they're going to hold their ashes until the wife sashes until we have them available so the heavy lifting is going to be next month when we have a public Billings and lands committee meeting and we have to finalize the cost for uh Allen burial sites as well as what we're doing in the cemetery so I asked Council to vote for this so that we can stay on track and get this done tonight and uh you know it just we have an opportunity to save some money but doesn't the city's Charter read that any project over fifteen thousand dollars needs to be publicly bid and the council has the authority to accept proposals like this of course and you're correct uh council person you are correct uh public bidding is appropriate if Council wants to render an exception as the mayor said it's certainly within your purview to override that and approve an ordinance such as so the question we have is whether timing do we yeah do we accept this ordinance here or do we uh just go with the main pay 17 000 more again because then that would alleviate Well we'd live in a eliminate the the dislike anything delay having to get it out to go through that whole process because we do want to get that finished this month so if that's the question is right and again we we don't have time but we ordered these columbariums 10 months ago and we we had 10 months to bid this you know and you're right but we had it and we had a vendor lined up within what you've authorized and we just happened to check the Checker said hey just happened to check the charter no we no no I didn't say that I said check the Checker we found out let's try and see if there's a better price out there trying to save money for the city and you know it's your decision so all I ask you do is voter up and down so we can get this thing moving one way or the other so mayor if it's voted down then we'll just use it yes so that's what yeah well then we're going
