[1:49] Good evening. Welcome to the city council regular meeting for the city of Rosemont on Tuesday, July 1st, 2025. Please rise and join me in the pledge of allegiance. I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all.
[2:18] Good evening and welcome to those online. Uh we will first look is there any additions or corrections to the agenda? Uh no sir. Seeing none, I'll move the agenda. Is there a second? Second. We have an agenda and we will move on to presentations, proclamations, and acknowledgements, which we do not have this evening. On to number four, response to public comment.
[2:50] I believe we have a response uh to last meetings uh public comment. Mr. Martin, thank you, Mayor. Yeah, just an update for uh any any folks listening at home. We've been in touch with the uh resident and the family um from last week's conversation about the development and the storm water fees on their property and they received some official correspondence from the city and continue to discuss and and negotiate that situation with that with that family. So, just wanted to give that quick update there and conversation continues to evolve. So, all right. Y thank you very much. That'll complete item four. We'll move on to public comment. Item five, individuals wishing to address the council on subjects that are not part of this meeting's agenda may do so. Please come to the podium, state your name and address,
[3:38] and let's see. Name, address. There we go. And podium's open. Hey, good evening. My name is John Weber. I own the residence 4218 158th Street West. I've owned that for about 15 years. And just a quick thing, you I've been a resident of Rosemount for almost 30 years. And in that time, I've think I've contributed to this city.
[4:04] I've volunteered with RAA at least 12 years coaching. I've uh volunteered for the last 20 years with the Dakota County Master Gardeners. I've when Rosemount started the public gardens at the parks, I was I worked with Tom in setting those things up, educating people on the gardening uh basics of gardening. I've taught classes over at the Rose Mount Resource Center um before it became uh 360 communities, had gardens set up there, teaching children over there. And so it isn't that I haven't been a asset to this community, but in the last 5 years at the property at 4218, I've converted the front lawn to more of
[4:51] pollinator friendly vegetable gardens and this and that. And I've had complaints from individ I don't know from individuals and the city has come over and it's gotten to the point where it's almost seems like I have been singled out and it's become more of a harassment now with the city. Every time they've uh said that I've had a violation I've talked to the reached out to the city and every those things have been corrected. Recently, I received a letter with multiple uh multiple issues on there. Number one, one of the uh permit issues. I did not know that Rosemont required a permit.
[5:32] I've had chickens for seven, eight years. No one informed me that I needed to have a permit, which was brand new. Bee permit. I've had bees before I got bees. I checked with the city there. They said there was no issue with getting bees and now I find out there is a permit requirement and today I tried to apply for that permit. Apparently it's not in motion yet. So how I don't know how I got cited for not having a permit when there is no uh nothing is in place right now. The other thing with the uh rental some of those uh uh infringement yes it's all my fault and I have no problem.
[6:12] All the other things that has been brought up has been corrected, but now I'm getting this letter saying that there are other infractions that I need to take care of. Every time I've contacted the city, I have corrected those things. And some of the things that has been pointed out like last year, they said I needed to move a pallet.
[6:33] Seriously, this is what the code is. and everything times that I have asked the city what things I needed to do. I did not receive any specifics. It's and I've had to call them multiple times. And I'm sure you guys have read on the Rose Mount Neighbors. And one of the reasons that I have actually posted those things on there is that seems to be when I get a response from the city cuz I've posted it and within hours I have a response from the city within I have left messages with the code people. I do not hear anything. I've emailed them. I finally did get uh response from uh the code enforcement people about what things but they have never been very specific. Okay. Uh, one of the infr um
[7:20] infractions was that my front yard I had dead uh flowers on there where I didn't realize that I needed to clean up everything. This was photos were taken on May 17th and I had not cleaned up my front yard yet from uh dead purple cone flowers and a lot of the other pollinators and perennials that's out there because that is one of the things I think the state is trying to promote.
[7:43] the city is trying to promote those things and when the city is telling me that I should have been cutting those things off and things like that, I think it's getting to the point where it's a little bit excessive and I have been singled out. I've had multiple comments from people that I've see I've had vehicles stopping and com uh complimenting on what I've done to the yard. Yes, at times it does get a little messy at springtime especially because I have not cleaned things up yet. But those that should not be that a infraction on me. Okay. The city promotes, you know, no mo. Do I need to have signs all posted all over my yard so that those things I don't get notifications for those things? Uh things like I've had where someone complained because I had a vehicle
[8:28] parked in front and I've had vehicles parked there. I see down the street vehicles parked there. I've seen commercial vehicles parked there further down the street. Nothing is said any about those things there because it's parked there. But I believe city has a ordinance about commercial vehicles being parked on city streets and this and that. Okay. So I'm feeling getting to the point where it's the city if they want me to do something that's fine. I have no problem. I have no problem getting permits and this and that. But it's gotten to the point where it's like I said, it I feel like I'm being harassed here. Okay. And the times that I've had city inspectors come out, I've asked them specifically what is the issue. I've had an inspector two years ago come out to measure this from the
[9:14] sidewalk to the distance on the garden. And right across the street there's a uh is a gu a garden that is encroaching right on the sidewalk. There's nothing. I don't have that sidewalk blocked off. I don't have anything encroaching on the sidewalk. And so those little petty little things that they've uh the city has been saying that I'm infringing on.
[9:36] It makes absolutely no sense. And so I would like to, you know, I would really, you know, I think it'd be nice if you guys can come out and check out the yard. You know, I've had uh small groups. I've had gardening groups. I've had children uh groups come over there and tour the yard and things like that. And I think look at it as more of an educational um u piece. And yes, it may not be the best land uh yard in the neighborhood and whatnot. And unfortunately, it's in the corner so it stands out so everyone can see it, you know, so it's fully visible, but there is nothing there that should be against ordinances and whatnot, you know. So I would like to really get down to that I don't I don't so that I don't get a notice from the
[10:22] city every time. Now, as far as other things, you know, that's, you know, things that are need to be cleaned up and this and that, I have no problem doing that. I, you know, I pull permits when I need to do and and whatnot, you know, but it's tough to do certain things like for permits and whatnot when you don't even know that there is a permit requirement, you know, because I think the when I talked to the city clerk for like the chickens, it was like you guys placed it online and people I don't think people even knew about that requirement, you know. So, I would just like to for the council members to know that, you know, I would like to meet all the requirements and and I think I've, like I said, I've been here for a very long time. I haven't had any issues. And all these started when I converted that front lawn about 5 years ago. Prior to

They include bill listings, minutes for the June 17th regular meeting of council, donation acceptance from Dakota Electric of $500 for safety camp, amendment to the 2025 schedule of rates and fees, our on sale license on a public premises. Uh, this is for the little piggy catering.
[12:51] Temporary on sale liquor license for the American Legion related to leprechaun days. application to conduct off-site gambling. The Rosemont area hockey association related to leprechaun days. Amending the city code tobacco products and tobacco related devices in response to this uh state of Minnesota recent legislation.
[13:13] Donation acceptance of encrypted radios from Henipin County to our police department. donation acceptance from American Legion Post 65 uh for PD community related activities including kicks for kids safety camp and uh was this uh shop with a cop. So that donation was $3,000.
[13:37] The approval of a right-of-way easement for Amber Fields Commercial Road and the approval of an encroaching agreement at 181 150th Street. with that uh reading. Any council member wishing to pull an item for further discussion or comment?

I just wanted to pull this and just kind of it's just an update to the the the adoption of um uh the schedule of rates and fees. And I just wanted to see if staff could could speak a little bit more to the changes that are happening. Just another example of just being clear with what is changing and what is staying I mean most of it's staying the same but if Yeah Nick you can yeah thanks council member mayor council members the the amendment to the fees that's highlighted
[15:00] for um this round here happens to be uh pertaining to watering restrictions irrigation restrictions violations um we're bringing clarity to what those fines are with this amendment. Uh previously, uh there was a a bit of a confusion in the numbers that were published on our website versus what are actually implemented. So this change brings the fine echelons directly in line with other administrative citation fine values there. So that is to say a first violation is $50, second violation 100, and then third and subsequent violations are 250.
[15:46] And uh if I could just take a moment on um the matter of watering restrictions. This is something as as the summer heats up here and we see a lot more lawn irrigating that puts quite a stress not only on our water system to deliver more uh water into the uh to to all the residents and businesses but also stresses the aquifers and uh and our water resources. And uh the Minnesota DNR does expect us to implement and enforce watering restrictions. So this is coupled with uh those expectations and the permits that we have through the DNR to be able to operate a public watering or water supply system. Um, so
[16:32] folks are going to see an enhanced effort to uh call attention to that and of course uh then uh enforcing violations when we see um irrigation happening between noon and 6:00 p.m. or uh contrary to the odd even schedule that we have in town. These are regulations or ordinances that have been on the books in Rosemont for quite some time. Um we're just simply trying to bring more attention towards that because it is all in the spirit of water conservation and uh things that we're already expected to be doing. Yeah.
[17:07] Well, and and I appreciate this and just to be transparent with everything when I when I when we were going through the the meeting notes, I it was one of the things that I wanted to pull because just to be completely honest, this is something that I've probably made some mistakes in the past before and just knowing the why behind it, you know what I that we're really trying to just do what the DNR is suggesting for water conservation and also just watering at the most efficient times too for your individual lawn. So, it's just something I wanted to call out. I think you did a good job of just telling us the why behind it. So, if you do have a a fine or a violation, you know, you know, we set it up, I think, or you guys set it up very strategically to say that, you know, the first one is $50, the second one, you know what I mean? Just to be aware. So it's bringing awareness to the the value and the importance of water
[17:52] conservation especially heading into the warm heated months. So that was my only rationale for pulling this. So thank you. Could you could you share the magnitude of what we see as what would be considered normal and then when we hit those hot humid August days uh what kind of variation that we see in our water uh need and that how that affects our capacity. Sure. A couple things on that mayor. Uh just for one, seasonally we have a u an escalation in use that can top out at three to four times what we would see for use in the wintertime when there isn't any irrigation taking place. And it's not unusual that on the hottest of days, uh we'll pump 8 to 9 million gallons a day of water versus
[18:40] between two and three in the w excuse me in the winter time. um for just indoor domestic uses. So there is quite a a level of magnitude impact there. And I think while we address capacity issues, uh clearly the the biggest concern is is if we're maxing out that we have issues that may pop up if we have a fire in town or something like that. Correct.
[19:05] Yes. Uh if if we're asking the water system to deliver uh all of this volume towards irrigating, that uh can can put us at a little bit enhanced risk to be able to combat large fires and other types of emergencies that would require a lot of water delivery. And and then just to add to that that just a public service kind of announcement like literally I went online and looked there's all kinds of options now with smart technology to use different systems to actually monitor and do it accordingly when it's needed as well as we were just talking about. But um yeah, thank you for that insight. You're welcome. So So with that, I'll make a motion to adopt a resolution to amend the 2025 schedule of rates and fees.

And then that approve is approved. 50 item 6D and completes all of the consent agenda items. Next item up is our public hearings this evening. And we have a request by Mazaros Construction LLC for the vacation of a portion of a drainage easement at 2200 126 Street West.
[20:26] Mr. Keaneberger. Great. Thank you, Mr. Mayor, members of the council. Um before you, we have an Eastman vacation request for 2200 126 Street West. So to orient everybody, um the request is for a vacation of a portion of an existing drainage easement at the property uh located at the northwestern portion of the city in a rural residential area just west of Bikardi and east of Biscane area um part of the White Lake acre subdivision platted back in 1984.
[20:59] So a couple exhibits just showing the boundary and then I'll get into a little bit of the why this um consideration is before you this evening. Um, so this is stemming from and a lot of times when we have actions that come before you, it's based on an action that a property owner or an applicant is looking to make. So in this case, it was a building permit um for a detached garage to be um constructed where there's an existing shed. So upon that application, it was determined that the proposed detached garage would be in an existing uh drainage easement. Um upon review by staff it was discovered that there was a discrepancy between the recorded plat and then the survey that the city had on file from that time. Um recorded plat showed that the drainage easement area in the site was larger than what was actually depicted on the survey and it
[21:45] showed that the existing shed on the site where the proposed detached garage to be located was located within that easement area. Um so the in conversation with the applicant um it was determined that they could do a wetland delineation which is a process that's in place to um hire a a qualified engineering firm to make a determination where the wetlands actually are and then any necessary buffers and boundaries that would be required um as a part of that. So here you could see where the proposed easement vacation is on this exhibit and we'll get to the recommendation here in just a second. So upon that um new wetland delineation um the the boundary that was determined where a drainage easement was needed was actually shifted and it was determined that that was then
[22:31] going to be outside of where the proposed detached garage um was planning to be constructed. So as a part of that um the request then would be to vacate the existing easement that's on their recorded plat so they can move ahead with their building permit for that detached garage as proposed. So, this one's a little different than some of the other easement vacations that we sometimes bring before you, but in this case, it was a cleanup of some old information. The uh property owner went through a process to verify and remedy that and then brought that back and um staff agreed that that easement on their property was no longer needed um to maintain that that boundary. So, the motion that's being recommended tonight is a motion to adopt a resolution approving the vacation of a portion of an existing drainage easement at 22000

The applicant withdrew that application on 6:27 at 4:21 p.m. With that, I would turn it over to staff to make any comments or um items that uh council should be interested in. Yep. Thank you, Mr. uh mayor, members of the council. So, a little context. So, throughout um any
[25:17] type of an application process, it's always at the uh uh an applicant always has the right to withdraw their application at any time. So, this was for a comprehensive land use amendment on the east side of Rosemount for roughly 420 acres um uh applied for by Kimley Horn on behalf of tracted. uh Miss Demick here this uh at the meeting here earlier um acknowledged um that and just uh wanted to make the council aware and that's why it's kind of published in the packet the way it was that once the packet goes out um staff notifies any and all applicants that their item is on that meeting and here's the packet agenda and then subsequently later that afternoon we did receive an official request from them uh to withdraw their application. So that's why it's noted as such in the packet and we can certainly take any questions.
[26:04] open up uh for any questions or comments to council. I look to my left and yeah, I was just going to make a comment that I appreciate staff's time and attention. Um you know, when the applicant came in, I know you guys spent a lot of man-hour and a lot of time um working with this particular applicant. Um, also from a planning perspective, the planning commission I thought did a a great job of taking the recommendation for the proposed amendment and and um and their decision to amend the the comprehensive land use. Um, and then following that legislative process, then it was supposed to come to us. Um, we had a work session about it. We gave some feedback. I think that feedback is probably why the applicant pulled the application, but just knowing that um we appreciated our colleagues in the
[26:50] planning commission doing their job, doing their due diligence, the staff working with it, and at this time it just wasn't something that some of us felt comfortable moving forward with. And um and I I guess I just uh I I really appreciate the process because this was the first time that I've experienced anything like this. And you know, this is why the systems are in place and and it worked in my opinion.
[27:11] up here. Speak. Um I did did want to just take some time to acknowledge tract as well for seeing in Rosemount what we see which is a thriving community worthy of investment. Um you know this at this moment in time it's not working out but uh I totally understand why they came our way and thank you to city staff. I know you guys have spent a lot of time and effort um dealing with this inquiry and others and um obviously being that this was going to culminate in a land use amendment and a comp plan change uh we take those really really seriously here and um here on council we're really trying to work with our residents on what our shared vision is for this town and this hometown that we call home and um I certainly I know I had reservations and that certainly came up at the June 3rd one. So, um, just so residents know,
[27:57] we do think these things through very thoughtfully. It does go through the processes they need to go through and, um, we do really appreciate the time and effort, um, that's been done on this to date, but you know, and and, uh, we'll move forward. Anything else? Um, no. All right. So, with that, uh, considered the item 9A is, uh, no action is being taken as it's been withdrawn. And that'll complete item 9A.
[28:26] We'll move on to 10 for announcements. We'll look to city staff. Any updates? Uh, mayor, nothing major for me tonight. I just wanted to flag one of the donations that you uh accepted on the consent agenda was a really impactful one to our police department from our partners in Henipin County. Um, providing a number of encrypted radios.
[28:45] And so, it's pretty high value. This I think about a $30,000 donation. and greatly appreciate Sergeant uh Josh Swenson led the led the call to to research how to acquire some access radios from Henipin County and encrypted radios are just a critical part of our process and this kind of the post 911 was the big change to go encrypted and and and things of that nature and so uh a significant cost savings to the city and a nice partnership uh we appreciate from Henipin County who we don't always get to directly uh interact with and partner with obviously on public safety events but in a donation type situation was was really neat to see and we appreciate that from them. So, just wanted to flag that one and that was all from from me at this moment. So, thank you. Great. Thank you. And with that, uh we'll move on to 10B, the upcoming community calendar uh on July 4th, uh celebrating our
[29:33] Independence Day. City Hall will be uh closed on Friday. Our port authority will be meeting on July 15th from 6:00 to 7:00 p.m. here at city hall, followed by the city council meeting July 15th, 7 to 8:00 p.m. And just looking a little bit ahead on July 17th, the uh youth commission will be working uh with our youth in a splash pad celebration July 17th, 11th to 12th at Central Park.
