City Council Meeting - December 20, 2021

Hermantown's December 20, 2021, City Council Meeting

This transcript appears to be from a period when the Hermantown City Council included **Councilor Nelson** and **Councilor Hauschild** (who are mentioned by name during the roll calls), rather than the current roster of Councilor Hjelle and Councilor LeBlanc provided in your context list. I have attributed the names based on the roles and the names spoken during the proceedings. [0:00] **Mayor Wayne Boucher:** Meeting let's call all the meeting to order and stand for the pledge of [0:09] **Mayor Wayne Boucher & Audience:** allegiance of america and to the republic for which it stands one nation under god indivisible with liberty and justice for all [0:24] **City Clerk Alissa McClure:** we'll call please. [0:33] **City Clerk Alissa McClure:** Mayor Boucher? [0:34] **Mayor Wayne Boucher:** Here. [0:36] **Mayor Wayne Boucher:** Announcements. Do any counselors have announcements they'd like to make this evening? [0:42] **Councilor Joe Peterson:** The only one for me—somebody else may steal the thunder too—but Mr. Over [Steve Overom] has been with the city for 42 years and this is his last official meeting and i want to thank him and probably everybody else does as well. But thank you for your efforts. I've learned a lot from you and a lot of people don't know, when I was a teenager, Steve built a house across the street from one of my parents. So I've known him on... yeah, we lived on Chambersburg. [1:05] **Steve Overom (City Attorney):** So I didn't know that. [1:10] **Councilor Joe Peterson:** I thought you're gonna say when you were a teenager he was a city attorney. Probably yeah, too. And Grant was not—Grant was long from being born. So anyway, but thank you Steve for all you've done and it's been my pleasure. [1:27] **Steve Overom (City Attorney):** It's been a pleasure. [1:28] **Mayor Wayne Boucher:** Absolutely. And I have to remind him that he did take an attempt at prosecuting criminals before he became our city attorney for a couple of years and was glad to hand that over to someone else when you became a full-time city attorney. I have some stories from those days too, certain officers testifying. Thank you for everything you've done, Steve. We appreciate it. We know you're going to stick around in a little smaller capacity and I know this is hard for you to give up. It's hard to give up something you love as much as you do, but i think you picked a great successor. [1:59] **Steve Overom (City Attorney):** Yeah, it's the right time. Thank you. [2:03] **Councilor Nelson:** I thank you as well. It's been great knowing you all these many many many many many many years. Yeah, it's been a long time. Yeah, we started with PETA I think together on the city here years ago so and i knew you before that so it's just i will miss seeing you around but i'm really excited for you and what's coming. [2:23] **Steve Overom (City Attorney):** Thank you. Thank you for everything. [2:32] **Mayor Wayne Boucher:** I would also like to bring up and mention the passing of former city councilor Kay Knight who passed on December 9th. The cause is unknown but our thoughts go with her family, her two daughters, and we appreciate her service to the city. We have no public hearing tonight. Communications, Mr. Mulder? [3:00] **City Administrator John Mulder:** Just the one there on that was listed is for your information. And then we'll need to appoint somebody new to the Planning and Zoning Commission after you receive applications. [3:13] **Mayor Wayne Boucher:** Thank you. And no presentations tonight. Public discussion: is there any member of the public that wishes to discuss anything in general with the city council that's not on the agenda, either present in chambers or present in the online meeting? If so, begin by stating your name and address. Is there any public discussion this evening either in chambers or online? [3:44] **Mayor Wayne Boucher:** With no public discussion, we will move on to the consent agenda. Do we have a motion for the consent agenda? [3:50] **Councilor Joe Peterson:** Motion to approve. [3:51] **Councilor John Geissler:** Second. [3:52] **Mayor Wayne Boucher:** Motion by Councilor Peterson, second by Councilor Geissler. Can we have a roll call please? [3:59] **City Clerk Alissa McClure:** Councilor Geissler? [4:00] **Councilor John Geissler:** Aye. [4:01] **City Clerk Alissa McClure:** Councilor Nelson? [4:02] **Councilor Nelson:** Aye. [4:03] **City Clerk Alissa McClure:** Councilor Hauschild? [4:04] **Councilor Hauschild:** Aye. [4:05] **City Clerk Alissa McClure:** Councilor Peterson? [4:06] **Councilor Joe Peterson:** Aye. [4:07] **City Clerk Alissa McClure:** Mayor Boucher? [4:08] **Mayor Wayne Boucher:** Aye. [4:10] **Mayor Wayne Boucher:** We'll move on to ordinances. Second reading of ordinance 2021-10, an ordinance amending Hermantown code of ordinances by amending section 850.5, particular speed limits designated. Do we have a motion? [4:25] **Councilor Nelson:** Motion to approve. [4:26] **Councilor Hauschild:** Second. [4:27] **Mayor Wayne Boucher:** Motion by Councilor Nelson, second by Councilor Hauschild. Mr. Mulder? [4:30] **City Administrator John Mulder:** So this is the second reading of the ordinance that would set a different speed limit on Swan Lake and Sunbury roads following the road improvement project and then at least those are the speed limits on the city portions of those roads. [4:47] **Mayor Wayne Boucher:** And is LaBaque Junction part of that? [4:50] **City Administrator John Mulder:** LaBaque Junction—we did that ordinance previously as part of the local road improvement. [4:54] **Mayor Wayne Boucher:** Thank you. Any questions or comments from council? Is there any public discussion on this either in chambers or online? If so, please state your name and address for the record. [5:38] **City Clerk Alissa McClure:** Councilor Geissler? [5:39] **Councilor John Geissler:** Aye. [5:40] **City Clerk Alissa McClure:** Mayor Boucher? [5:41] **Mayor Wayne Boucher:** Aye. [5:59] **City Administrator John Mulder:** This is a annual thing that we do for the election cycle. We are waiting to see if there will be any changes in redistricting. We don't expect any, but the county confirmed that we should adopt this resolution and if if there are changes in redistricting, we would bring that back to you at a later date. [6:14] **Mayor Wayne Boucher:** Thank you. Any questions or comments from council? Is there any public comment on resolution 2021-165? If so, please state your name and address for the record. Is there any public comment on the resolution to re-establish precincts for polling places in the city of Hermantown? Roll call please. [6:44] **City Clerk Alissa McClure:** Councilor Hauschild? Do we have a motion? [7:12] **Councilor Hauschild:** So moved. [7:13] **Councilor John Geissler:** Second. [7:14] **Mayor Wayne Boucher:** Motion by Councilor Hauschild, second by Councilor Geissler. Mr. Mulder? [7:20] **City Administrator John Mulder:** We previously had a public hearing on a portion of this project and as we began the design of that and the design work, we thought that there was a number of other changes that we should make including, you know, adding Sam's Way and additional part of Richard Avenue. And so we are proposing that we would have a second public hearing in January. In the meantime, we will contact all of the property owners informing them of the specific amounts of the proposed assessments. [7:46] **Mayor Wayne Boucher:** Thank you. Any questions or comments from council? Is there any public input on this? If so, please state your name and address for the record. Is there any public input on resolution 2021-166? Hearing none, roll call please. [8:15] **City Clerk Alissa McClure:** Councilor Peterson? [8:16] **Councilor Joe Peterson:** Aye. [8:17] **City Clerk Alissa McClure:** Councilor Geissler? [8:26] **Mayor Wayne Boucher:** Resolution 2021-167, resolution authorizing and directing mayor and city clerk to execute addendum to engineering contract for road improvement district number 538: Richard Avenue, Lindgren Road, Evie Drive, and Frontage Road. We have a motion? [8:46] **Councilor Joe Peterson:** Motion to approve. [8:47] **Councilor Hauschild:** Second. [8:48] **Mayor Wayne Boucher:** Motion by Councilor Peterson, second by Councilor Hauschild. Mr. Mulder? [8:53] **City Administrator John Mulder:** So we're going to do some additional work as part of this project, so we've got a proposal from Northland Consulting Engineers for that additional work. [9:03] **Mayor Wayne Boucher:** Thank you. Do we have any questions or comments from council? [9:06] **Councilor John Geissler:** I'll just comment, my usual with the Northland contracts: my son works for Northland and the result of this contract has no financial benefit to my son or myself. [9:17] **Mayor Wayne Boucher:** Thank you. Any other comments from council? Is there any public input on resolution 2021-167? Any public input on the resolution authorizing the addendum to the engineering contract for district 538? Roll call please. [9:45] **City Clerk Alissa McClure:** Councilor Geissler? [9:46] **Councilor John Geissler:** Aye. [9:47] **City Clerk Alissa McClure:** Councilor Nelson? [9:48] **Councilor Nelson:** Aye. [9:49] **City Clerk Alissa McClure:** Councilor Hauschild? [9:50] **Councilor Hauschild:** Aye. [9:51] **City Clerk Alissa McClure:** Councilor Peterson? [9:52] **Councilor Joe Peterson:** Aye. [9:53] **City Clerk Alissa McClure:** Mayor Boucher? [9:54] **Mayor Wayne Boucher:** Aye. [9:56] **Mayor Wayne Boucher:** Resolution 2021-168, resolution authorizing and directing city of Hermantown to sponsor a grant funding request associated with the construction of an accessible trail from Okerstrom Road and Portland Road to Morris Thomas Road and the Keene Creek Trail segment. Do we have a motion? [10:14] **Councilor Joe Peterson:** Motion to approve. [10:15] **Councilor Hauschild:** Second. [10:16] **Mayor Wayne Boucher:** Motion by Councilor Peterson, second by Councilor Hauschild. Mr. Mulder? [10:20] **City Administrator John Mulder:** So this is a grant application for the trail section that would start at Morris Thomas and connecting to the trail going into Keene Creek Park and then would go up toward Portland Avenue and—and that must be Johnson Road at that intersection—and then also connecting Okerstrom. [10:41] **Mayor Wayne Boucher:** Thank you. Any questions or comments from council? Is there any public input on resolution 2021-168? Any public input on the resolution for the grant application? Roll call please. [11:15] **City Clerk Alissa McClure:** Councilor Nelson? [11:16] **Councilor Nelson:** Aye. [11:17] **City Clerk Alissa McClure:** Councilor Hauschild? Do you have a motion? [11:42] **Councilor Hauschild:** So moved. [11:43] **Councilor John Geissler:** Second. [11:44] **Mayor Wayne Boucher:** Motion by Councilor Hauschild, second by Councilor Geissler. Mr. Mulder? [11:49] **City Administrator John Mulder:** So this is a process where we need easements for the Ugstad Road project. Because we are receiving federal money for this, we have to go through a little bit of a different process than we normally use. So this authorizes the city administrator and the city attorney to make this offer to the three private parties where we need these additional easements. [12:15] **Mayor Wayne Boucher:** Thank you. Any comment from council? [12:17] **Councilor Joe Peterson:** And these are temporary construction easements, not permanent? [12:21] **City Administrator John Mulder:** That's correct. [12:22] **Mayor Wayne Boucher:** Thank you. Is there any public comment on resolution 2021-169? If there's any comment on this resolution, please start with your name and address for the record please. Hearing no public comment, could we have a roll call? [12:44] **City Clerk Alissa McClure:** Councilor Hauschild? [12:45] **Councilor Hauschild:** Aye. [12:46] **City Clerk Alissa McClure:** Councilor Peterson? [12:47] **Councilor Joe Peterson:** Aye. [13:02] **Councilor John Geissler:** I make a motion to recess. [13:03] **Councilor Joe Peterson:** Second. [13:04] **Mayor Wayne Boucher:** Motion by Councilor Geissler, second by everyone else. All in favor say aye. [13:07] **Council Members:** Aye. [13:09] **Mayor Wayne Boucher:** Opposed same side. Happy holidays there.
