I WAS HERE A COUPLE OF WEEKS AGO ON THIS DEVELOPMENT AND I APPRECIATE YOUR TIME TONIGHT TO DISCUSS THE PROPOSED DEVELOPMENT ON THE CORNER OF LEGACY AND CUSTER FOR HIGH DENSITY APARTMENT COMPLEX THAT IS IN NO CONCEIVABLE WAY COMPLEMENTING THE SURROUNDING NEIGHBORHOODS. WHEN THE ZONING FOR THIS PROPERTY WAS PUT IN PLACE OVER 27 YEARS AGO THERE WASN'T A SINGLE THREE-STORY APARTMENT IN PLANO AND THE TYPICAL GARDEN APARTMENTS WERE TWO STORIES WITH LOTS OF GREEN SPACE SURROUNDING THEM. THIS PLAT HAS ALL THE ARCHITECTURAL DESIGN OF A SHOE BOX AND COMES NOTHING NEAR THE REQUIREMENTS THAT PLANO HAS FOR USABLE OPEN SPACE. THE PLANNG AND ZONING COMMISSION WAS GIVEN INCORRECT INFORMATION FROM THE PLANO ATTORNEY TWO WEEKS AGO AND THEY VOTED ON THAT BAD INFORMATION. MY SUSPICION IS THE DEVELOPER MAY HAVE MISLED CITY STAFF OR MODIFIED THEIR INITIAL PLAT HOPING IT WOULD NOT BE NOTICED. THE OPEN SPACE PLAT DATED JUNE 1 ONLY SHOWED 359 APARTMENTS INCLUDING 45 THREE-BEDROOM APARTMENTS. NOW, LOOK AT THE AUGUST PLAT FOR STREETAND SEMENTS THAT YO CONSER. IT HAS FOUR MORE APARTMENT HOMES FOR A NEW TOTAL OF 363. AND NOW INCLUDES 96 THREE MORE THAN 50 ADDITIONAL BEDROOMS OVER WHAT WAS INITIALLY PROPOSED. IF WE TAKE THE INCREASED DENSITY AND DO NEW OPEN SPACE CALCULATIONS, WE SEE THAT THIS DEVELOPMENT NOW REQUIRES 229,000 SQUARE FEET OF USABLE OPEN SPACE, NOT THE 215 SHOWN ON THE PLAT. 215,000, PARDON ME, SHOWN ON THE PLAT. WE QUESTIONED THE DEVELOPER'S INITIAL FIGURES SHOWING THEY GENEROUSLY INCLUDED A SURPLUS OF 2,051 SQUARE FOOT OF OPEN SPACE BUT SINCE THE ACTUAL REQUIREMENT IS 14,000 SQUARE FEET LARGER THEY COME UP SHORT BY AT LEAST 12,000 FEET BASED ON THEIR OWN REVISED PLAT. THIS MUST BE REJECTED. ADDITIONALLY, ACCORDING TO ZONING REGULATIONS, THE PROJECT IS REQUIRED TO HAVE 229,000 FEET OF USABLE OPEN SPACE. USABLE OPEN SPACE DOES NOT INCLUDE SMALL PIECES OF LAND, STREETS DRIVEWAY OVERHEAD ELECTRIC EASEMENTS, AND DRAINAGE AREAS. THIS PROJECT DOES NOT APPEAR TO BE CLOSE TO THE REQUIRED USABLE OPEN SPACE. THESE ARE THE STREETS IN THE PROJECT. FAE STANDS FOR FIRE ACCESS EASEMENTS. IN ADDITION TO THE DISCUSSION ABOUT THE REQUIRED USABLE OPEN SPACE THERE ARE SUBSTANTIVE QUESTIONS ABOUT WHETHER THE SETBACK REQUIREMENTS ARE MET. FOR INSTANCE, IF A MINIMUM 100-FOOT FRONT YARD IS REQUIRED FOR A THREE-STORY BUILDG HOW N TH BE MET BY PUTTING A SINGLE STORY AND A TWO-STORY BUILDING BEFORE THE THREE-STORY BUILDING. THAT'S HARDLY A FRONT YARD. I DRAW YOUR ATTENTION TO THE TWO DRIVEWAYS ON LEGACY AND CUSTER. WHEN THE ZONING WAS APPROVED, BOTH LEGACY AND CUSTER WERE FOUR LANES AND NOW THEY ARE SIX. TRAFFIC SURVEY SURELY WOULD SHOW THEY ARE VERY BUSY, ESPECIALLY DURING RUSH HOUR. I ALSO THINK THE DEVELOPER TAKES EXCESSIVE CREDIT FOR AREAS LIKE THE POOLS AND PLAYGROUND. HE'S OVERSTATED THE DIMENSIONS AND THEN TAKEN FOUR TIMES THE CREDIT, RATHER THAN THE THREE TIMES THE CREDIT THAT'S ALLOWED. THEY DID THIS BY SUBTRACTING THREE TIMES THE AMENITY SPACE FOR THE REQUIRED SPACE AND THEN AGAIN TAKING CREDIT FOR THE AMENITY SPACE AS OPEN SPACE. FIXING THIS WOULD RESULT IN 12,000 SQUARE FEET REDUCTION NOW MAKING HIS APPLICATION DEFICIENT BY OVER 24,000 SQUARE FEET. SOME MISCELLANEOUS SCRAPS OF LAND ARE COUNTED. I'M SORRY. SUCH AS THIS AND THIS THAT SHOULDN'T BE CONSIDERED USABLE SPACE AT ALL. FOR INSTANCE, A SMALL PIECE OF LAND NEXT TO THE MAILBOXES AND PARKING CURB. IT'S REALLY JUST LEFTOVER BETWEEN THE TWO AND WILL PROBABLY HOLD GARBAGE CANS FOR PEOPLE TO THROW AWAY THEIR JUNK MAIL. I DON'T CALL THAT USABLE OPEN SPACE. FINALLY THESE 363 APARTMENTS WILL HAVE ALMOST 800 PARKING SPACES YET THE EGRESS AND INGRESS TO THIS COMPLEX IS ONLY 24-FEET WIDE. >> SIR, YOU HAVE 30 SECONDS. >> THANK YOU. JUST BRIEFLY, DUE TO THE COVID PANDEMIC, THE CITY BEGAN TO HOLD MEETINGS VIA ZOOM IN SING 2020. AND THIS WAS ALLOWABLE DUE TO THE GOVERNOR'S ORDER WAIVING SPECIFIC OPEN MEETINGS AND TECHNOLOGICAL REQUIREMENTS. HOWEVER, WHEN THIS ORDER WAS RESCINDED SEPTEMBER 1ST, 2021, WE REMOVED THIS OPTION FOR MEETING ACCESS. BUT WE HAVE HAD REQUESTS FROM THE PUBLIC AND WE HAVE HAD DIRECTION FROM CITY MANAGEMENT AND OTHER STAFF THAT ARE WORKING TO REALLY ANALYZE AND FORMULATE A SUCCESSFUL REIMPLEMENTATION FOR VIDEOCONFERENCING FOR P&Z MEETINGS. WE DEVELOPED AN ONLINE REGISTRATION SYSTEM, HOWEVER, THERE WERE SOME CHALLENGES WITH THE REGISTRATIONS DUE TO SOME TECHNOLOGICAL DIFFICULTIES SO WE'VE PUT THAT ON HOLD, BUT WE ARE WORKING TO REINSTITUTE THAT AS WELL. WE STILL DO OBVIOUSLY ALLOW THE TRADITIONAL METHOD OF REGISTERING SPEAKERS, INCLUDING PAPER CORDS AND ONLINE RESPONSES AND THINGS LIKE THAT. SO IN ORDER TO ENSURE A SMOOTH TRANSITION BACK TO VIDEOCONFERENCING WE'RE LOOKING FOR REINSTITUTING THIS AT THE JANUARY 4TH MEETING.
