home to your wonderful romantic dates as quickly as possible I'll call us to order I'll turn it back over to Jeanette tonight's invocation will be by Pastor Michael J Moore from the New Bethel complete in Christ Church please rise for the invocation and remain standing for the pledges of Allegiance let's go to the Lord in prayer father we thank you this evening for this time and for the opportunity to come before your presence to lift up our voices and praise to thank you for your mercy and thank you for your grace as we gather as Citizens and the leaders of our city we ask for your grace upon these leaders a mayor all of the representatives who represent the citizens of this city greatness Your Grace lead us with wisdom let the sitting remember the people who are sometimes forgotten people who live in the street people who suffer from mental illness people from all walks of life we know that we're living in times Lord where our hearts are heavy because each and every day we witness the loss of life across our country tonight as we stand in this chamber Lord let us be grateful for your grace and the Lord we pray for our First Responders those who keep watch over the city we pray for your protection over them we pray for the citizens of this city Lord that you will protect them as well now give us the peace that we need that surpasses all understanding that when we gather together in meetings like this whether we're on one side or the other Lord let us be able to come together in love and we ask your blessings on the city of Fort Worth make it a safe Community make it a prosperous Community for all of his citizens and we thank you in Jesus name we pray amen under God indivisible please first item of business will be special presentations with the first one being a presentation of the Fort Worth City sister cities International youth ambassadors oath ceremony and I think I'm going to meet May Ferguson down here at the microphone and mayor wat and City Council Members while uh uh before we get started I have a point of order I want to take to introduce a special group that we were not planning on having tonight but we have the honor of having a group of students from neem France who are visiting us this week so I want all of you if you're from neem stand up please I know everyone please welcome there [Applause] I introduced Rachel Jenkins who is the chairman of our youth and education committee who is going to introduce you to all of our students and teachers mayor and council members thank you for having us here tonight and for recognizing the importance of Global Connections for Fort Worth Fort Worth sister cities is the only non-profit solely dedicated to promoting Fort Worth globally and enriching our local community Through International Education exchange and commerce we are excited to be here this evening to have the oath of Citizen diplomacy administered to the Fort Worth students who will be representing Fort Worth to the world this spring and summer we have 64 student ambassadors traveling to France Germany Hungary Italy Japan and East watini International exchanges give students possibly their first opportunity to travel which is almost always described as life-changing through these experiences students gain important life skills including cultural competency Global problem solving leadership and resilience I would like to present the 2023 youth ambassadors delegation and Associate delegation leaders these participants were selected through a strenuous application process and represent many Fort Worth ISD schools and private schools and we are happy to say that because of the generosity of this community we were able to provide nearly fifteen thousand dollars in scholarships enabling these students and teachers to participate so leaders and students if you'll make your way down myself so as I call your name leaders will you and your students please raise your hands of Fort Worth I know I can speak on behalf of this city council we can all agree on this how proud We Are to have such wonderful young men and women representing our city across the entire Globe when really diplomacy has never been more important um in in the global perspective of what we're experiencing right now so thank you for your families for supporting you and for each of you for for going on this journey I know that you'll find it to be worthwhile so please raise your right hands I please state your name have the opportunity and responsibility to improve relations between the United States and the rest of the world I am a citizen Diplomat appointed by mayor Maddie Parker and the Fort Worth City Council and Fort Worth sister cities program cities program I'm committed to do this for my city my country and my world let this be so congratulations and thank you all for attending this evening so we're gonna we're gonna turn around to Bethany here and I'm going to come to the front that works thank you so much you just bring me that Proclamation mayor while you're making your way back up I just want to say welcome again to the group from neem France I had a chance to see you this last Sunday Saturday and give you a Molly pen and all of y'all going off uh thank you and thank you to your parents up there for making sure this is a priority and I want to give you a big hand the parents making sure that you all understand what you're doing for your kids and I love seeing this in this group representing Fort Worth abroad so thank you all very much [Applause] we'll give them just a second to get out and I know that there may be people in the Overflow room that can now join us in the council chamber so they'd like to do so so our next presentation is a presentation of American Heart month our Hilda and Douglas here somewhere in the crowd we'll wait for you don't go against the grain you're good I'm a regular we have to confirmed um okay we'll keep rolling here to hilden Douglas are making their way down we're going to shut those doors make it a little bit quieter in here thank you thank you so the American Heart Association was founded in 1924 and their work Across the Nation is the oldest and largest voluntary organization dedicated to fighting heart disease and stroke the AHA has invested more than five billion dollars in research making them the largest not-for-profit funding source for cardiovascular and see it's pronounced this for me go huh no the next one you don't know we'll wait for it cerebral vascular yes there we go disease research next to the federal government before I read this Proclamation this Council this this causes especially important to us because of our own mayor Pro tem Gina Bivens who experienced a stroke and we are very thankful for her full recovery to be with us this evening that's right and a few of us are in red or pink that kind of counts right and thank you very much for the pins for us all to be in remembrance this evening we have a wonderful Proclamation but before I read any of this I'd like to invite both of you to come up and say a few words if you'd like to thank you mayor Parker and members of the council um I think just to say thank you for over the years how collaborative and wonderful so wonderfully supportive the city has been um with us in terms of our fight against cardiovascular disease and stroke um from public policy to programmatic efforts to City policies um we're just very very thankful to have a partner like the city of Fort Worth it's a model for the country in terms of our collaboration and our efforts to continue to fight the number one killer in our country so thank you all very very much [Applause] um I'll read a portion of tonight's Proclamation that we're giving here to the American Heart Association to honor American Heart month and as a reminder whereas globally Cardiac Arrest claims more lives and correct or cancel breast cancer prostate cancer influenza pneumonia auto accidents HIV firearms and house fires combined and about 90 of people who experience Cardiac Arrest outside of a hospital will die whereas cardiovascular disease affects men women and children at every age and race in the U.S this disease continues to be the leading cause of death in the U.S accounting for one in three deaths across the United States and the burden of chronic disease is high across North Texas whereas too many of our residents are living with hypertension and diabetes women and minorities have a greater prevalence of risk factors or at a higher risk of death from Cardiac Arrest heart disease stroke and other cardiovascular disease but are less likely to know of the risk have access to Equitable health care or receive bystander help and whereas the American Heart Association is challenging every household to have someone who knows CPR to be the beat for their family friends and Community CPR especially performed immediately could double or triple A Cardiac Arrest victim's chance of survival hands-only CPR is a technique that the American Heart Association recommends increasing the likelihood of people performing CPR in an emergency and now therefore we do celebrate and recognize February 2023 is American Heart month and as I hand this Proclamation over I'm especially thankful to the advocacy work that each of you do on behalf of this amazing organization I've been apart on several policy positions here at the city of Fort Worth and have learned a tremendous amount from not only your people here but across the country and I know in the city each of these statistics is incredibly sobering and we're all doing work in your respective districts and across the city on Health Equity and health outcomes so let us be reminded that these statistics exist across Fort Worth and what we can do to be part of it that's what this Proclamation is really all about today so thank you foreign next will be announcements of items to be withdrawn from the consent agenda there are no items to be withdrawn withdrawn from the consent agenda we have one item it's MNC 23-0002 it will be replaced with the revised MNC with the same number MNC 23-0002 revised Marion Council there were no speakers that registered to speak on the consent agenda so the next item will be the approve approval of the consent agenda items we've got a motion in a second any other discussion Council please vote [Music] motion carries next item will be announcements upcoming and recent events recognition of citizens and approval of ceremonial travel if needed by Council first up is council member Carlos Flores thank you Melissa for getting that up I wanted to bring to everyone's attention and I think maybe some on Council already aware of it the Fort Worth Police Department an effort to improve its public Outreach not just to the public but also to its uh upcoming officers to the new incoming officers recruits that we have we want them to be uh knowledgeable and also uh make sure they dispel any preconceived notions they have over the neighborhoods that they're going to patrol so we have one of our NPO officers there Mr Martinez who's been with a force a long time along with other members of the Northwest division that take these recent recruits around different parts of the city and introduce them their best Representatives the stakeholders in that area they get to know the areas they're going to patrol and again if they have any preconceived notions about these areas in town they're dispelled because they can see firsthand what they're about so appreciate Nestor and uh our commander uh Jason Kim the Northwest division for making this possible collaboration with other uh police officers across the city next slide please and then we have the Fort Worth Stock Show and Rodeo Parade the weather was merciful we weren't uh frigid and and freezing our extremities out so it was a great turnout uh you know thanks to all you know who attended uh it was great to see our fellow council members out there thank you next slide okay here um as council members sometimes we have uh ceremonial duties such as uh welcoming uh foreign dignitaries I had such an occasion to do that during the Fort Worth Stock Show and Rodeo on the day of the best of Mexico Rodeo we had members of the administration from the state of Mexico of Zacatecas they were there they presented what their ideas were they want to see further collaboration between us and their city and state and we look forward to you know strengthening our ties we had representatives there uh State Rep Ramon Romero was there and and also Annette Landeros from the Hispanic chamber of commerce myself uh you know we miss you there mayor I know you were very busy but it did convey your message of Welcome to them thank you next slide okay uh here we have the MLK parade and again very well attended seems every year we get more and more people uh to come out to the parade uh to acknowledge the the message that is still relevant to this day of Martin Luther King Jr and uh also as part of that celebration in the vein of celebrating in our black history uh month you know it was Cowboys of color Rodeo uh you know several of the council members you know wrote in it I had that privilege as well thank you next slide okay and here's just uh some different picks from the Fort Worth Stock Show and Rodeo Grand entry I think all of us got an opportunity to do it uh Michael I think you probably broke a record didn't you or something like that I'll let you talk about that but anyways fun had by all it's it's a privilege to do that to represent the city so next slide or is that it what'd you get ah okay here we go all right uh the homeless count uh that was again a recent effort that we do and this is necessary for us to have an accurate count of you know the homeless in our city so that we can also be able to apportion resources and from a federal standpoint we have to report to the government you know again what resources that we do need and so that was held recently from 8 to 12 midnight uh teams deploy out with mpos from Fort Worth Police Department and uh you know carefully engage with our homeless population to try to get an accurate count of uh of them and also what situation they may be in next slide please all right that's it for me thank you councilmember Blaylock actually as Alan's pulling up Michael go ahead and do ceremonial travel that'd be fun yeah please sorry thanks mayor uh I just want to ask for uh ceremonial travel to uh with so ironic it's tonight with Fort Worth sisters cities International on their trip to Trier Germany June 17th through 25th so I'd ask uh for a vote on that thank you can you pull a vote up for us or do we need to vote hand vote but you can pull that's my question you can pull it up though second okay second got a motion in a second Council please vote motion carries thanks Michael go ahead Alan so we have a short video from the library here tonight I want to thank our library director Miss Mania Shore and we have one of our library board members here tonight Mr Rusty Fuller uh thank you all if you played the video [Music] attacks the wrist should come up and down just like you're doing a tennis racket like your strums from earlier [Music] [Music] thank you Manya to your team that's great I guess we're done Alan's done you're done okay on to me Everton Gina vivens please Gina well just so you know Alan I know Judy Taylor was really excited to see the library make it tonight uh we recently oh I forgot we missed last week we had a new company relocate to District 5 for its Global headquarters it's called skida braider and there I am with the president and a few other execs and you'll see there are big trucks on the highway what they do is pave whenever we have icy conditions and so I can barely pronounce it but it's called skitter breaker and if you have a CDL they're looking for you because they are looking to hire let's see if I remember the next one what did I have next oh I have to say hello to Pastor Kenneth sales and his wife Sally they waged a community cleanup right near their Church in stop six near Cavill and when we first started promoting the sale of tax foreclosed properties this church bought one you can go to the next slide and after they bought the first tax foreclosed property there the community started springing up with new housing and remodeled housing and now it's just a place where people live and no longer David do I have to interrupt people smoking crack in the car people people live there now and so that's the pastor on that green machine and he does that even though that's a city property that we should be bullying he does it because he doesn't want his church to look tacky next oh this happened just this past weekend it was technology awareness day at BNSF that stands for Burlington Northern Santa Fe railroad it is the second largest rail company in America and every year for the past 24 years they have held this event to expose minority kids and kids from different backgrounds to the world of stem that being science technology engineering and Mathematics yes Carlos that would be you and I tell them for the 25th year I'm going to share this this event with the entire mayor and Council so that we can all go there for the 25th year it's a wonderful event you see Jim and Gloria Austin they started this event more than two decades ago so about 24 years ago and they honored Jim and Gloria and that's what I did that's all thank you Gina councilmember Williams thank you mayor this first slide we had the opportunity to work with the Quail Ridge neighborhood association to honor the life of Sarah Elizabeth Hansen whose life was tragically taken too soon we were able to work with the family and with the neighborhoods to establish the Sarah Elizabeth Hanson Memorial Park Bench at Quail Ridge Park so for all of our folks who who know Sarah and for those who attend Quail Ridge Park please take a moment to sit on that new bench and send up prayers for the family in the neighborhood as they continue to heal from that tragic loss next slide please um we kicked off um the next leg of our reinvestment project along the ultimason car Corridor um now known as the Southwest Fort Worth reinvestment and revitalization project it was really exciting to kick it off with a bunch of neighborhood leaders who were who are passionate about creating economic development in the in those two commercial corridors and bringing back the ultimate some McCart corridors to the Old Glory Days that we all remember and so thank you also to Dan Hayes he is our trusted consultant from the East Lancaster pit an amazing word that they've done on the east side and so he shared a lot of knowledge with our residents about all of the economic development steps to establishing a pit and tiffs and all kinds of other stuff so thank you to the residents who are serving if you're interested in this work please reach out to our office at district 6 at Fort Worth texas.gov uh we'd love for you to bring your voice and um and your sleeves to be rolled up there's a lot of work to be done but we can get it done together and I believe that's my last slide thank you mayor thanks Jared councilmember Firestone thank you mayor um this was a really enjoyable day with uh congresswoman woman Granger um we were invited to tour Parker Aerospace the strataflex products division on January 19th and this is really an amazing facility right uh in the middle actually of District Seven that a lot of people don't know about and know what the company does but they produce and manufacture at this location products that are used in uh many different military planes including the F-35 and those products are installed at NAS jrb which of course is also located in District Seven uh and after the tour we met with company officials to discuss their plan to expand the uh the location there and their manufacturing at the same facility which we're very excited about and grateful that they are staying at uh at home so it's an exciting company they're doing wonderful things very Progressive technology uh and it's great to have them here in Fort Worth thank you to Chris councilmember Nettles thank you mayor this first slide is the MLK parade that was actually on the east side it started in District 8 and ended in District Five uh this is one of the parades that Cliff Sparks put together on the east side every year next slide please uh this is the MLK parade downtown that's uh doing taking a selfie with Michael Mayor and a bunch of other people well those are the frads and the uh Jairus people so uh it was a great it was a great day uh next slide I had opportunity to go TCU and talk about um it was the MLK panel we just talked about some real issues that we've been dealing with since Martin Luther King Malcolm X and other issues and so it was a great panel commissioner Brooks um Black Chamber president CEO as well as council member from Arlington uh joined us it was a great panel in TCU next slide had an option I had an opportunity to go to imtura Black History uh month panel when I tell you these children were phenomenal singing dancing all type of uh art they did on this day actually one of the young girls was here with the um uh the sister city since it was great to see her participate and one of the young ladies want to uh be a volunteer here at the city of Fort Worth they're just excited about government they treated me really nice and so we're we're really grateful for that black history discussion next slide had opportunity to go to a breakfast and talk about what we have been doing here at the city talked about the budget this uh the street sweepers talked about uh votes that went up and went down and so it was a great event Jerry Williams joined me as well as Carlos Flores was there next slide today I had opportunity to go to the Community Food Bank it was a love day uh this food bank is doing phenomenal things in Riverside Community that gave away over uh 55 prizes today just to be nice they give away food every other day to the community in Riverside we have supported him since we've been in office as well as my predecessor was a big supporter of the Community Food Bank and I it was just a great event today and I believe those my last slides thank you the councilman back quick we had a sustainability workshop for New City Hall I really appreciate all the residents that came out and gave their feedback I think it's going to be very productive and what we end up doing across downtown next slide am I the opportunity to present some appreciation Awards to some folks that live at the TMP law office that took their time to beautify their particular area of Fort Worth and they did a lot of work in the landscape beds in and around that the right-of-way on Lancaster next slide all right I don't know if y'all have heard um but Texas A M is expanding they are expanding into the southern portion of downtown Fort Worth in District 9 and I had the opportunity to um to go be part of that event and um it's really exciting 350 million dollars worth of investment coming into Fort Worth so um stay tuned and whoop next slide the Tarrant County Homeless Coalition point in time count I joined councilman Flores that evening all they own a different part of town I was in the Hemphill Corridor walking with uh one of one of my really fabulous mpos and some other volunteers it was a really great evening I would highly recommend if you have not taken the opportunity to do that one year to do it next year it's really eye-opening and it really does provide a service to the community because it allows us to get an accurate senses and help some people in the process next slide that's it thank you to Elizabeth um I just have one quick update for our community I was able to visit very briefly and the hospital was one of our officers who was critically injured yesterday after falling from an overpass responding to a traffic accident he has a long road to recovery but his beautiful wife was incredibly strong obviously thankful that her husband is alive so please watch for updates from the fourth Police Department keep that family and and your prayers he'll have a long long road recovery like I said and then probably additional surgeries so she'll need strength and resilience and of course his family at home so just wanted to give those of you that have reached out our radar office without a concern to see how he was doing but he was in good spirits and cracking jokes somehow to see through what he'd been through so thank you for your continued prayers with that we can move to the non-consent agenda mayor the first thing will be the speakers who registered on the non-consent agenda items and we have speakers on two items 230138 and 230181 thank you Jeanette our first speaker will be John Ladd Mr Ladd hello go ahead okay I don't really have anything to say other than I am I'm I'm for short-term rentals I'm regarding them carefully I'm for uh making sure that there's a resident involved that's local and um that's about it really thank you Mr Ladd our next speaker is William shurer followed by Michael Mays hi Bill come on down mayor mayor Parker mayor Pro tem Bivens and members of the council I'm here really just to thank you City staff and the city attorney's office for taking up this very difficult issue and hopefully passing the short-term rental registration ordinance tonight adopting this carefully thought out well-crafted and defensible ordinance will be a significant step forward for the city since I've stated My Views in a lot of Correspondence and speaking before I'll sit down now and yield the floor by the speakers thank you Mr Shore next speaker is Michael Mays followed by Andrew Epps good evening mayor council I am Michael Mays and for the last 40 years I've lived here in Fort Worth I went to high school here went to college here and I love this city and after all these years I'm still amazed at how people can work themselves up into a frenzy over something they claim they don't like and yet the only thing real in their concern is fear and not the facts as a licensed brokerage and someone who manages and services properties here in Fort Worth and elsewhere both long-term and short-term rentals I find these lack of facts to be extensive there are not vacation rentals in this area they're short-term rentals yes some people do show up in Fort Worth for vacation let me share a list of reasons in the last 90 days that people have stayed at our short-term rentals Stock Show which we just mentioned earlier visiting the Stockyards adopting a baby volunteering at a local non-profit concerts at Dickies Arena Christmas home renovations TCU football honeymoons funerals family reunions birthdays working at art shows job interviews and School tours there are many reasons that people come to the area and use short-term rentals what's interesting is opponents of short-term rentals are afraid of quote what could happen and yet in the last 12 years there have been very few incidents that have even occurred let that sink in since 2011 we have had short-term rentals in the city of Fort Worth and yet most people especially opponents are not even aware of that why because there haven't really been that many incidents though there have been some frankly as someone who is in the know there are more problems that exist at long-term rental properties someone that lives there and calls it home as someone in Property Management again the opportunity for me to work with the Fort Worth Police at a property that's a long-term rental and help them discover guns and drugs right near Dickies Arena oh wait did I say a rent house near Dickey's Arena what about the fact that it was an old retired woman and her son that lived there what about domestic abuse that happens children being abused these are problems around people not around short-term rentals also at the root of this is a property rights issue if you guys accept and pass the existing uh bill before you you'll be reducing the amount of money that hard-working Fort Worth people actually make in this time of need and those are people of all colors not not any particular individuals you will also be stepping into perilous territory as the state of Texas this Texas Supreme Court has determined it is not a commercial Venture though you try to declare it to be one if you vote to affirm this you are stepping into a sticky future that will definitely definitely involve litigation thank you thank you Mr Mays our next speaker is Andrew Epps followed by Susan Harper hi good afternoon mayor Parker and the council uh I represent the Fairmount neighborhood association as their president uh we just had we just had a couple questions as an organization uh to the council currently parts of Fairmount are not labeled and zoned for short-term rentals and um from just outcries through the council and meeting uh people at our general assembly there are people that are on Airbnb VRBO that are listed and you know offering short-term rentals so kind of our questions and considerations are as we move forward as a city and allowing short-term rentals where there'll be um you know ways to look through those websites and monitor them and make sure that even though we're passing laws that they are following those those laws and the places that are zoned and making sure that the people that are offering that are following the rules and following the zoning rules of this new ordinance so that's all I have to say thank you Andrew I'll make sure Dana Bergdorf who's here tonight gets with you you after the meeting or before you leave rather okay thank you so much thank you our next speaker is Susan Harper I think I need a box to stand on I remember but that's all I pull those down that's perfect Madam mayor city council persons city manager and assistant manager my name is Susan Harper my address is 2248 Fifth Avenue Fort Worth Texas 76110 the pages I have distributed to you are copies of an opinion piece in the Saturday and the Sunday Dallas Morning News by Lisa Sievers and Vera Elkins titled behind short-term rentals are people I don't know either of these women but they articulate probably better than I can the case for regulating rather than banishing short-term rentals yeah if I may paraphrase short-term rentals fill many needs long-term business travel or Hospital Medical Care guests who wish to experience the city neighborhoods extended families during holidays or personal celebrations families dispossessed by property damage and for many extended hotel stays are simply not in the budget short-term rentals should be considered part of the housing solution in Fort Worth and I think probably is already part of the travel planning process for many Americans are are there bad actors and nuisance properties absolutely but they represent less than 10 percent of our industry ninety percent of us have never had a 9-1-1 or 3-1-1 call and we want them gone just as you do two weeks ago I sent you my story and request for consideration on this issue so I won't Bore You by repeating it instead I will quote from the Seavers Elkins article good policy is patient inclusive data driven and compromising I believe I speak for many of my fellow owners when I urge the city council to appoint a task force which includes all sides of this issue and creates a policy that prohibits new properties funding to support the necessary code enforcement officers and produce an ordinance that swiftly and effectively rids the neighborhoods of Bad actors while allowing responsible owners to continue to operate thank you thank you Miss Harper Jeanette I think we're going to go ahead and vote on item 23-0138 before we move to zero one eight one with Adrian Smith as Speaker if you can move us through that piece so Council this will give you an opportunity um we'll vote on this ordinance pertaining to short-term rentals you're welcome to speak to the item before we vote councilmember Beck um I'll move to approve this particular item first of all Mr Epps congratulations on your recent election to Fairmount neighborhood president let me say that fair amount of all of my neighborhoods is probably the one that was most amenable to to airbnbs and so it's my commitment to you to work with the neighborhood there are still options to have airbnbs win the neighborhood wants them and I think that's a really important and I'm glad that you brought it up because it's what I plan to speak on we're making this decision today to protect our neighborhoods but we're not completely taking out your personal property rights you still have the right to petition this Council like you would any other zoning change if you want to make your home an Airbnb then it becomes incumbent on the neighborhood and what they want to you know to work with Council and so I look forward to working with Fairmount and I'm proud of this particular Council for making sure that we did make sure that we left our communities and our neighborhoods um in a really strong position but still provided an opportunity for um for us to be able to deliberate and do what's best for our city as a whole councilmember Flores thank you mayor Parker I'm going to vote in support of what is being proposed and I'll tell you why neighborhoods are places where people live interact and know one another they tend to have unique identities and that is evident across this city our zoning ordinance provides categories that uh Define how development and Redevelopment are going to occur it is an orderly fashion in which this is done I'm respectful a property owner's rights to use their properties of the fullest extent permissible you know under the law but I'm also very sensitive to the homeowners and traditional renters who enjoy their residence that's what a neighborhood is about converting long-term rentals to short-term rentals shrinks the housing market and that is something that we have a problem with nationally right now it's just not city of Fort Worth that's grappling with that problem uh currently you know it's it's been said that all we need to do is just enforce it have more regulation well that doesn't produce any fruit unless you have the necessary co-compliance staff to enforce it and we do not and to have it to the numbers sufficient to do that it's not foreseeable it becomes a quality of life issue I do acknowledge that scrs provide an Innovative and attractive rental Stay option for visitors we have many to our cities and many are run very responsibly allowing them however into residential areas becomes a matter of habitation versus visitation people live in neighborhoods okay they don't do business in neighborhoods okay and this is an Enterprise a business Enterprise the way I look at it just like a traditional rental is as well another aspect that I looked at short-term rentals how it impacts available apartment units some apartment units can bring up a lease up uh boosts to occupancy there are cons and considerations to that as well apartment Executives have expressed concerns about Str leases taking away available apartment stock for those who need long-term rental options and it causes also fluctuations in the lease rates and this affects also those residents who live in apartments and their quality of life so with that I'm going to support it but I will say also I appreciate all the public input we've gotten a lot individuals who have weighed in and met with us City staff you know for their diligence on this the scr Association and Association of Realtors is that a second Carlos I'll second it okay Council any other discussion on this item anybody else's light letting up nope um just to close to say thank you for everyone and I know there's still a lot of frustration and concern in the community just as a reminder of the Texas legislative session is going on right now and so the city of Fort Worth is of course watching this closely um and I think Mrs Harper did a beautiful job articulating this it is about people we understand that um housing affordability is a crisis across this country and it is also in Fort Worth for many families and so we have to keep that at the foremost concern for this Council but we're not done listening we understand this is an evolving issue not just for Fort Worth but for the entire country when it comes to what the future of strs look like so we'll be vigilance please stay in touch with us and if you have additional questions or concerns our offices now what you all have doing what you have what you all have done is divided communities communities will be divided one way or the or the other regardless of how people look at it communities will be divided now there are pros and cons what are the pros potential votes for some of you who are you know in favor of this which I'm sure everyone voted in favor because I couldn't I couldn't see the votes but you all usually vote the same way the cons are votes your lose votes but again the most important thing is the community is divided other cons that us out there will be will come about with this short-term rental pretty short term renters what about uh what are you putting in place for uh discriminate discriminatory uh practices that some strs um some SDR operators uh use against certain individuals I was I was I heard also that there would be a tax a hotel tax uh possibility uh Levitt against these short-term rental owners my thing is this that's cool that's cool you all are telling them what they can and can't cannot do when it comes to overcrowding when it comes to people coming to communities for Gatherings not parties just gatherings what if a neighbor because of the amount of individuals showing up mistake a potential mistake mistake of attention short-term rental as a party happening what happens then see you all should have put this on a ballot and let the let the citizens make this decision and not you all again I think um it's a lot of self-serving uh interest that's at stake with this vote but the vote is done so for everyone at the sound of my voice whether continuation of an alcohol distance variance that was requested last month this item is a site at 5693 West Creek Drive where there is a restaurant that is wanting to add alcohol back to their restaurant that was discontinued while the restaurant was closed during covid the site is within three within 300 feet of three churches as well as two schools and the case was continued from last month as council member Williams noted that there were two schools within the vicinity we did have a meeting with the affected schools this morning where they did not um mention any specific concerns regarding the request and I'll be available to answer any other questions that you have questions Council councilman I just have a question point of information what is the difference between 23002 and 23002 revised what are we voting on so the revised one has the inclusion of the schools in the MNC whereas the first one did not thank you no other questions we'll move to our speakers I have three speakers listed um the first is Jenna Cannon Gina excuse me I did that last time Gina I'm gonna get it right eventually Gina and Then followed by Ray Malik first time Gina Cannon I'm representing the applicant Joaquin Miranda the owner of the restaurant um last year in March of 22 he requested a alcohol inspection for this location to see if he could apply to have an alcohol permit I have given you a copy today of that report from the city inspection that shows he was within 300 feet of church or school in September of last year he decided to apply for the variance and paid the 500 to the city of Fort Worth um we have obtained a letter of support from the three churches that are within 300 feet from the owner of property from the local homeowners association and made ourselves available to talk with the two school districts or I'm sorry the two schools located close to this restaurant's proximity um they did not have any concerns other we did make sure that they realized there is no late hours being requested that it is just to sell alcohol at their Mexican restaurant it is a family establishment um last year we also um I'm sorry in last month right after this meeting we sent a certified letter to both of the schools so that they would know who they can contact at TABC if they choose to protest this application I received confirmation back from TABC that no protests were filed by the schools like I said we talked with them this morning I also wanted to let you know that I looked up to see if there had been any violations at this address over the last 13 years where TABC was called out to issue any kind of citations and there were not that is prior to our owner taking over um also their [Music] um excuse me also last time we I was here I mentioned that TABC is going to require that the applicant put up a ten thousand dollar bond to ensure they are a good neighbor and will absolutely take that Bond should there be any complaints against the restaurant of any kind dealing with alcohol lastly I mentioned to The District representative that every school uh every church every neighbor has the right to enter a protest either by name or anonymously with TABC before they can renew their permit every two years just as an insurance to the city that they will be a good neighbor thank you thank you Gene our next speaker is Ray Malek followed by Mark Greene hello Council my name is Ray Malik I am actually the one of the owners of the shopping center the shopping center has been our family for over 40 years we've built and developed that shopping center along with other rooms on that street and as well some very other properties um we all know that covert hit so the restaurant that has been there prior to the one we're talking about was one of our original tenants from 40 years ago when covert hit he decided to close shop because he didn't know how long but the restricted were he was up in age so it took us numerous months in time to find a new proper owner to take over the restaurant and we did um and he's been putting up every effort to go forward he's remodeled it substantially he's helped you know Revitalize that little neighborhood um we try hard to maintain good quality tents over there um the tenants love that place the people in Wedgewood love go to eat Mexican food there when it did shut down it was kind of sad and at the same time is a different point Keys blues lounge bark shut down too at the same time so we lost two good tents have been there for 40 years but Joaquin decided he wants to try to take it over um I'm just happy and thrilled that he wants to do this and I'm happy the council's hearing out his proposal for variance um one thing I like to stress is I'm there on site all the time my office is there we do not leave that office we love being there with the tenants we've seen other Tenants come and go we've seen schools and shopping get demolished next door and rise again and at the same point we've had our tenants there stay there as long as we like and that's what we're trying to do here we're trying to build a good family atmosphere I think while Kim's going to be a very wonderful operator and owner of the restaurant I hope you passed the variance for him I think everyone elects to go to a Mexican restaurant and drink some margaritas with their Mexican food so I live in central Meadowbrook which includes part of District Five I'm about to say a naughty word Apartments that's how many in East Fort Worth View Apartments well data can be quite revealing so I searched basically everything from 121 South to 287 and from downtown to the Arlington city limits looking for apartment complexes built over the last 60 years or any time really but I found them dating back to 1962. I was able to locate 82 apartment complexes 88 percent of which are at least 34 years old this particular case nobody will talk to this developer when we're clearly communicating by saying no that if you're looking for a new up-to-date apartment Mr Mrs Young professional you probably need to look elsewhere do you think that developers also understand this message yet uh Greystar has the temerity to think this time will be different this developer has a product where it's at least considering but no audience with which to negotiate the zoning commission didn't even suggest a continuance to encourage dialogue will you miss Bivens new apartment communities are celebrated with Fanfare and stop six but not even a continuance in this case to try to get some negotiations going decisions should be based on the Next Generation not the next election or so y'all were told that the Friday retreat if the denial is upheld rest assured Greystar Will Bill elsewhere and a community somewhere else will benefit developers will again see that East Fort Worth is not receptive to proposals helpful to our long-term economic vitality the real irony is we will continue to protest perpetuate the very thing we want to avoid there will be no fresh competition for declining apartment properties and problem tenants this is the area that I surveyed this is the list this is how it pans out when you actually look at when these apartment complexes were built the little pie slice with all the colors are all the ones that have been built since 1988. it's not a very big chunk and of those 10 six are low-income tax credits properties only for our actual market rate Apartments the most recent being built in 2002. I wonder if those in opposition are really connecting all the dots and understanding the full impact of a denial in this case thank you our next speaker is Nikki Moore followed by Neil Nicholson good evening mayor and Council the purpose and goal of our zoning application was really to bring new quality in a diverse housing option to this part of East Fort Worth I am one of those young professionals that grew up at East Fort Worth I attended Bill J Elliott elementary and when we came back after college there was nothing new for us to rent we weren't in a position to own a home yet and so we ended up having I was working in fourth my husband was working in Arlington and we were trying to split the difference if you will at this location and so we are those young professionals that you you mentioned overall Greystar really prepared a thoughtful site plan taking into consideration the Cross Timber trees and some of the site development challenges of this of this particular site including floodplain topography and some Wetlands that are on the site and um you know we really thought the trees were going to be the most important thing for East Fort worthians in the neighborhoods and so that's where we really focus our attention to the point of saving 53 percent of the trees 22 Acres of the site would be for tree preservation in the ends we heard the neighbors they do not want multi-family on the site they want the site to remain agriculture keeping the site agriculture though does not protect the trees in fact you can buy code you can actually take out 75 percent of the trees in an agricultural zoning district and this agriculture zoning District came about when the property was annexed into Fort Worth in 2009 and which is given that designation because there was nothing built on the property it was not intended to be agricultural in and of itself you know one of the site one of the outcomes that I'd love to like have here today is just direction from leadership as to what you would like to see developers develop on this site you know if it's not multi-family you know we'd love some feedback is it the density do we want to save more trees do we want a different housing product do we want single-family homes would that be supportive anything to just tell us what direction to go in would really be helpful instead of just saying no we don't want this um you have gray star developers here um I think just a few months ago I said before you where they had worked with the neighborhood association and put in two million dollars worth of roadway and um lighted signal infrastructure at the neighborhood request and so I say that to say that you have a quality in um a Cooperative developer at the table that really wants to engage in that conversation and so how can we help each Fort Worth reach their goals of you know getting brochures jobs relocating of jobs sit-down restaurants you know we need new housing options disposable income and some level of of density and so that's just my request here today is just to have some dialogue thank you Miss Moore our next speaker is Neil Nicholson Mr Nicholson here [Music] Mr Nicholson will be followed by Daniel box [Music] good evening everyone um I won't stand up here for three minutes and reiterate everything that uh that Nikki said by any means but um you know so I work for Greystar the developer on the project and um you know we we enjoy working with communities and City representatives and City staff and council members and we what we'd really like as Nikki said is just to find an opportunity to to work with anybody who's currently in opposition to to find a creative and problem-solving kind of solution to allow us to bring you know affordable for rent apartment homes to to East Fort Worth um we certainly think that there's a strong demand for them as was previously shown there's there's not a lot of you know New Quality apartments that have been built um so we we love the opportunity to work with the neighbors to find a solution that works for everybody thank you thank you our next speaker is Daniel box followed by Cameron Pope good evening Madam mayor and members of the council for the record my name is Daniel box and I'm a zoning attorney with Winstead PC with offices located at 300 Throckmorton I want to thank you for your time I won't be too long-winded uh I might be what you would describe in this project as the backstop I certainly think that there are many many good quality Arguments for why what we're proposing is good and should be approved but we also understand that there is uh there's not support has not been support for the project that there is the very real potential that it could be denied with prejudice and so I'm here to kind of explain why we think that that would be inappropriately inappropriate at least from a legal standpoint uh just uh kind of some high level points uh really I just want to zero in on two namely the fact that the property was involuntarily annexed of course that was done in 2009 when this Council knows is perfectly legal and listed to do so but of course if that question were presented before the council today it would it would not be able to it would hold no water as municipalities are no longer able to do precisely that it is legally prohibited my second point is something that Nikki had already kind of touched on and that's the agricultural zoning designation that currently exists for the vast majority of the site I bring that to mine just because by the by Under the text of the zoning ordinance itself that is intended to be a temporary zoning annexation a temporary zoning designation it's not intended to be permanent and so we think that even if the zoning designation that we're pursuing today might not be and so for these two reasons we do think that the uh if it is the intent of this Council to deny the request we think it'd be more legally or appropriate to deny it without prejudice as opposed to denying it with prejudice thank you thank you our next speaker is Judy Taylor Judah will be followed by Dale sommerfeld I'd like for those that are supporting me here and uh tonight against this project to stand please I'm Judy Taylor I reside on Stark Street I'm president of the Hampton neighborhood association City staff suggested denial and the zoning commission Desi denied with prejudice the zoning rezoning of 2500 Dottie Lynn is unacceptable this area is a historic Indian campground with many classes of Wildlife and trees in the 1870s major James Hanley traveled across country by Stagecoach from Washington DC to California he was so impressed with this area that he returned and rebought about 700 acres to establish the community of Hanley which served as a town until 1946 when the city annexed the representative from very Starr told several different stories to leaders of the East Fort Worth leading us to not be sure at all what that we could try trust them in any way or manner the land is owned Agriculture and e-neighborhood Commercial housing many trees and Wildlife we just need the oxygen from these trees we cut all these down and you and I are going to quit breathing Dottie Lynn is a multiple Lane fast moving traffic at uh Street it just takes two vehicles to cause a major accident cars entering and exiting the apartments would cause a major in danger there is a memorial directly across the street from where these apartments would be indicating the death of one of our residents this is a blind curve that will cause quite a danger if nothing else the massive number of buildings multiple stories high do not fit the area there are multiple apartment complexes in East Fort Worth and there are multiple areas that are zoned appropriate for this that Grace Carr could have purchased I personally live in an area that lost our two grocery stores because of the joint mass of Apartments put there thank you please deny this with podiatrists our next speaker is Dale summerfeld followed by Dave fulson good evening mayor Parker city manager cook Universal council members my name is Dale Dale summerfeld I'm a property owner of 8204 Meadowbrook Drive Fort Worth my seven acre property is very adjacent to the proposed gray Star Development I'm not in favor of changing the current zoning of Agriculture and e-neighborhood Commercial this property is correctly zoned I believe and there are many other properties in the area that are Zone multifamily and appropriate for the gray star project we purchased our property with the knowledge of all those development was primarily agriculture one of the advantages for us is the large amount of trees that protect the East Hayes Parkway and the trees also absorb a lot of the water that is currently you know collects on this area and we also get to watch the Abundant Wildlife that runs on this property incidentally I have not been contacted by Greystar in this development and we need to keep our agricultural e-commercial tract of land as it is please vote with no Prejudice deny CZ 22-198 thank you our next speaker is Dale Dave fulson followed by City bowling good evening mayor Parker city manager cook and council members my name my name is Dave fulson and unlock Dan Hayes I actually live in District Five instead of District 8 where this property is being considered I also serve as the Director of the John T white neighborhood association for the record our association has been expressly invited by both the historic Handley neighborhood association and the Bluffs HOA to support their strong opposition of the Zone request as you're aware City staff sent this case in zoning with a recommendation for denial spirited opposition from neighborhood associations the Bloss HOA and concerned neighbors who spoke at zoning wrote letters signed petitions all resulted in a deny with prejudice vote from the zoning commission as you just heard neither Greystar or the developer or their agent seem to understand or even care now that the overwhelming sentiment from Eastsiders who live here is that this property is correctly zoned as it is further that we wish to save it until it can and and will be developed or big or Mr Hayes other development like sorely needed Neighborhood Services abroad is options by a developer more interested in listening to the local residents desires and vision for our area rather than telling us what we need and jamming more multi-family into this area that's already suffering from apartment over saturation I cannot recall a time when John T white or any of our fellow Eastside associations came before you to stop a multi-family development that had purchased land already and correctly zones for multi-family I don't think you can either even though many such developments are not exactly what we want or need our groups understand and more importantly we respect the zoning process in Fort Worth Texas this is just another developer that does not the tidal wave of multi-family developments that buy property on our East Side that are clearly not zoned for their intended purposes then count on rubber stamp zoning changes is increasing each year this forces residents to wage endless fights and zoning and Council to protect our area and to save currently and correctly Zone properties for the type of development our area utterly lacks in but other areas of our city enjoy Eastside residents have carefully studied this development no matter what you've heard we have studied this development we've courteously listened to the developers desires Apartments we then presented the issue to our neighbors through scheduled in-person meetings emails phone calls and even old-fashioned door-to-door conversations and our position became clear with each one of those conversations that this property is correctly zoned as it is if we're to support a zone change in the future it would be for one that needs to deliver any of the development options our area needs and one that our residents would happily support therefore I am joining our neighbors and asking that you protect this valuable property that is appropriately appropriately zoned as it is and support your staff recommendations and your zoning commissions ruling by voting to deny zc198 with prejudice thank Meadowbrook but we are all Eastsiders Mark and I don't live on the border of Dolly Lynn but our home is directly affected by multi-family development and we know the problems on all levels that causes La haciendas across the street from our front yard so when my neighbors say they don't want apartments in their backyards Mark and I stand with them we know their concerns we live their concerns someone not affected by apartments at their front door our back door our next door have no idea what we're talking about or what we go through if a developer wants to build Apartments we say buy land that's already zoned for that purpose please deny this case with prejudice thank y'all our next speaker is Torchy white followed by Mary Kelleher good evening my name is Torchy white and I am a resident of the east side and of District Five historic Carver Heights are concerned because we shop in the East Chase Village Market areas we are opposed to the zoning change regarding the daddy land Parkway as it overlaps the East Chase Park Parkway for the following reasons first because it is a move towards overpopulation and already in an already underserved East Side there are already enough Apartments in the Eastchase Dottie Lynn area 300 plus new apartments in the Eastchester Village Market area will stress the highway system on one on I-30 it increases traffic congestions on the east chase Dieter limp Parkways Cooks Lane John T white and others it will also increase parking problems in the area it will increase the call volume for the police fire and EMS Services which is and will require greater infrastructure support and Safety Services please deny this request with prejudice and we would like to acknowledge Council councilman's crane his support of The Rise program on the west side that addresses the many needs of the apartment complexes there whose expert whose expertise we may need if we too are overrun with apartment complexes we want to thank um our mayor Pro tem last remaining working cattle ranches on the east side of Fort Worth I'm going to give you four very good reasons to deny this zoning request first this is Cowtown Fort Worth became known as countdown during World War one because the Stockyards were the largest livestock market in the world the city's official logo is all over the place it's Molly the cow this is our heritage number two Fort Worth uses AG zoning to preserve agricultural land which impacts Society through providing people with food and habitat for cattle horses and other livestock did you know that one cow provides an average of 430 pounds of meat and can feed about 860 people if people want to eat we need to keep our AG Zone properties once AG zoned is changed it's lost forever number three some of this property is flood plain and wetlands why is floodplain so important floodplain reduces flooding by allowing storm water to spread out and temporarily store storm water it is a well-established fact in the city of Fort Worth that storm water drains haven't been updated since the 1920s and in some places like the east side of Fort Worth are non-existent and can't handle all the new development it is reprehensible to permit additional development knowing full well this development will only add to flash flooding in Fort Worth storm water Management's mission after all is protecting people and property from harmful storm water runoff Fort Worth is failing the people in this mission and last but not least the Fort Worth Stock Show and Rodeo just left town it's been going on in Fort Worth since 1896 and described as legendary in the most authentic Western lifestyle lifestyle experience anywhere mayor Parker and many of council persons um y'all cowboyed up and sat high in your Saddles representing how town you know that for those few minutes while you were on the horseback wearing your cowboy hats and boots you were able to live every child's dream of being a cowboy or a cowgirl please don't take away the dreams of our future Generations by sacrificing AG's own property for development Fort Worth's infrastructure cannot support please follow the zoning commission commission's recommendation to deny this request as our city council it is your responsibility to the people who elected you to make sure you preserve our Cow Town Western lifestyle while also protecting us from thank you Miss Kelleher thank you our next speaker is James Hook followed by Cynthia Manuel hello mayor council my name is James Hook I'm the president of the John T white neighborhood association we were asked by both Handley neighbor Association and the Bluffs HOA to weigh in on this zoning uh change request John T white neighborhood association always tries to support our neighbor our fellow neighborhood association associations and we can we can we can all agree uh several weeks ago at the zoning hearing I Miss Moore representing Greystar stated that no Apartments had been built within a five mile radius since 2005. I checked on that and found Millstone apartments at 8472 Randall Mill to the north were built around 2010. it's only about a mile up the road and as you can see from this map the yellow representative elements already constructed and there are quite a few these are all already existing multi-family and yes there are a lot of older Apartments but many have been updated recently some may need to be torn down and rebuilt but that's a whole other discussion the blue represents land that is available to build on and is already zoned appropriately these are a few of the nearby projects that are in the works and um so listing those at uh at 901 John T White Road there's a multi-family development that's underway and we'll be start be able to start framing soon at uh 1110 Cooks Lane a 70 unit multi-family development is also in pre-development discussions a track of land along I-30 Zone C at 7124 Anderson Boulevard is currently in pre-development this will be an enormous 700 unit apartment complex when both phases are completed along I-30 um across the highways and other track of land at 7921 elderville Road uh this is in the final stages of planning and we'll be breaking grounds soon the land is zoned mu1 so we were pretty disappointed to hear that the developer was granted permission to build approximately 400 apartments here without the requirement to build the mixed-use component that the zoning is is designed for uh point is we have plenty of existing multi-family uh multi-family in the area more to come it is not necessary to give up valuable land to more sea zoning at this time where there is plenty of valuable land already zoned correctly to build on we are still lacking in so many services like pharmacies grocery stores sit-down restaurants and so on please deny the zoning change with Prejudiced and protect this area for future uses thank you our next speaker is Cynthia Manuel followed by Jeff Fincher good evening Madam mayor Parker and city manager cook and city council members I am Cynthia Manuel I'm the president of the Bluffs HOA as a resident of the Bluffs uh since 2006 when it was first developed we're the most effective uh community in this battle and I've heard repeatedly since we met with Miss Moore on September the 29th of last year consistent phone calls emails text messages door-to-door knocking that our community do not want this a lot of our homeowners have expressed to me that there might sell if they are forced to look out their window to um several stories of apartment complexes instead of looking at 100 year old pecan trees and Post Oak Forest this area is currently zoned like it's supposed to Agriculture and E neighborhood and we expect that it stay that way if they want to build Apartments that's fine but there are other areas within Tarrant County that they can find and not allow us to be misplaced by that because by going and messing with the floodplain area it's gonna pull the wildlife into our neighborhoods and that's something that they're very much concerned about thank you our next speaker is Jeff Fincher is Jeff here he's a call Mayor oh sorry thank you Mr Fincher thank you very much can you hear me yes please go ahead thank you for your time council members my name is Jeff Fincher I live at 2717 Gardendale in the bluff HOA in East Fort Worth z22198 development would directly impact my home and I'm opposed for a number of reasons which I have emailed everyone on the council about but the primary of those would be this where their building would essentially be a valley that is surrounded by flood Plains one part of the area would be actually within a flood zone that's the area that's been discussed about there being trees with 53 to be preserved but they'd also be building up what was a natural gas well directly on top of that my other concern is the wildlife and nature preservation the trees coming back up again Fort Worth is very proud of it Heritage trees program but there is not a single Heritage tree marked on the map in all of these four work that I could find this area would be a perfect example to protect the wildlife cited in this area includes Birds whose migratory patterns are protected and south of I-30 and east of 820 there are only three notable Parks one is simply a playground two are sports Hills with no nature trails or nature areas the apartments would be fully visible from our houses and backyard my back patio can actually see the base of this Valley where the trees meet the ground and we're accumulated right ice was recently able to be seen after our lovely storm we recently had I would see the full buildings from roof to Foundation when I stood on my back patio and I'm sure that they would have a simple view right into my backyard or into my windows furthermore a well-lit apartment complex in this area would mean direct lighting Illuminating most of these houses master bedroom windows throughout the night and I mentioned the lack of part south of I-30 and east of 820 and we'll reiterate what others have said there are 20 apartments in that area and I contacted a few by looking at their website and many of them have immediate availability or move-in availability by the end of this month 20 apartment complexes three Parks no nature areas no Heritage trees East Fort Worth has been ignored by the city and these expanding developments as the suburbs on outer city limits are being turned into downtown urban areas Arlington's western border has more parts than Fort Worth efforts in its eastern people moved to the suburbs to be away from Urban environments and enjoy some amount of nature around them I would urge the city council to uphold the zoning committees they accumulation into memory zoning thank you that's the last of our speakers councilmember bibbons thank you mayor I'd like for Miss Moore to come down to the podium have a question for you [Music] I want to thank all of you for coming tonight when I saw red shirts I knew what the deal was more just for the sake of clarification for me you when you spoke to the council you basically said you wanted more time to see what the leadership wanted what did you mean by that so here no Apartments so Greystar is open to you know we picked a low density multi-family to preserve the trees were 11 units per acre which is kind of a town home density with Townhomes be acceptable do you want single family uh do you want A5 zoning I think we're just asking for like what would be supportive I hear the no Apartments um okay I got you yeah so I just want to know what it is that would be supportive because we're willing to go back to the drawing board okay my mic died what I want to do I noticed quite a few people here tonight on this side I Know Dan is over there for those of you who are neighborhood association are HOA presidents vice presidents our directors will you please stand okay okay it's fine thank you thank you very much this is the leadership Miss Moore that I I listened to and what they have been is very clear and what they see as priorities those priorities have been established we've achieved one of them another is on the way but the priorities are table service restaurant full-service car wash signature grocery store I think the rub comes because what you are proposing involves a format of housing and that's not their top three and so I think the zoning commission heard and got it right but I wanted to make sure I understood and also you need to know they really do know what they want uh when it comes to AG zoning if you just drive through there you you'll get it I see Mark Singletary glad the Rodeo's over glad you made it but these these we we've actually I've conducted Uli zoning trainings which means I brought people in from out of state to teach them on zoning now one guy held on to his Lego toys until he lost blood flow trust me they know what they want what I would suggest to you is when you when you're looking for land especially where we have the Cross Timbers and so much special land on the east side if you buy property that's zoned for what you want you'll have no trouble from them but in the meantime I'm elected to represent the voices and these represent several neighborhoods and so with that I'm going to move to uphold the recommendation of the zoning commission but I'm going to add with prejudice so my motion is denying with prejudice got a motion in a second any other discussion from council members um I have one question from staff just for clarity for everyone here and I don't know if Who would know this off the top of their head if anybody I know under the comprehensive plan this is zoned it remains as agriculture which I think is an important delineation here from City staff but my other question is have we identified this particular property as endangered or potentially a candidate for our Open Space Program not not to my knowledge we can get with our open space folks to figure that out okay I appreciate that I can add to that mayor we recently had a self-nominated area on nocilla and so the people on the east side are becoming more aware of open spaces and what that means and so I think the more it gets out you'll hear more people suggesting and this area is perfect it's the area right when you're dottyland and Lancaster yeah I appreciate that I think one thing especially for Miss Moore and Greystone and the representatives here tonight I do appreciate how your presentation this evening and asking for additional feedback and I think mayor Pro tem gave you some good additional information especially in that East Side um but sometimes it's interesting when the neighborhoods actually agree with the comp plan because that's not always the case but in this situation that they do so you have an agreement between the professional staff at the city here today and then also with our neighborhoods I think that's really important reflection and we have a comprehensive plan for a reason we don't always get it right but I know as a as a mayor representing entire city I pay a lot of attention that document I know a lot of the folks on this diet do as well and so that's one thing and then additionally just for those in the audience this city council has made it a priority to try to preserve as much open space in this community as we can and as a reminder David Cook shared with us data to say that we were losing 52 Acres a week in the city to development in a fast-growing space and so this has to be something we are Vigilant about and continue to notify our neighborhoods and each of us on this Council have done that over and over again so I know it's not necessarily to this case but I just think that's a really important point I didn't want to get lost in this evening's conversation and with that we can vote we've got a motion in a second thank you motion carries next item will be zc-22-220 our first speaker on this item is Randall Howard followed by Clara Faulkner mayor council um I'm going to start by asking if after I give a brief uh presentation I'd like to preserve whatever time I have left for after the other three speakers that I have here I'd like to start by um with regard to my case I hereby request that the council send us back to the zoning commission so that we may have the opportunity to sit down with the neighborhood associations that oppose our requests and hopefully work out something mutually acceptable to add a specific time limit to our request tied to the text Dot Southeast connector project as well as a specific youth use within the K industrial zoning and to also be able to address any concerns that the City of Arlington might have that the TxDOT contractor who would be operating the crusher would can and will be able to operate without harming uh Lake Arlington uh if you choose not to send us back to zoning we are otherwise requesting that you deny without prejudiced uh so that we can might be able to do the same things without having to wait a year to reapply I'd like to point out a couple of things before I have the others to come forward the our plan is in in reconciles with the Lake Arlington master plan whereby that property is is cited to be for industrial use uh one other thing we presented more than six community outreach sessions to over 400 people and 90 percent of them were fully in support of what we'll be sharing with you in a few minutes uh at this time I'd like to ask my other speakers to come forward and introduce themselves and then collectively save their time and the rest of them so Mr Herod I hate to do this I can't do that it's just too confusing so I'll just let you continue with your piece and I'll move to the next speaker I appreciate that thank you good deal I've lived in Fort Worth uh all my life my construction company that my dad started uh has been here all 77 years since he returned from World War II we are proud to have worked for companies like um Lockheed Martin Walmart DFW airport all the branches of the military and number of city-state and federal government agencies our proudest moment is actually a team with limback construction doing the new city hall for the city of Fort Worth thank you very much thank you Mr Howard okay thank you our next speaker is Clara Faulkner followed by Alan Tucker good evening mayor Parker and Council I'm here today just standing before you to admonish Mr Randall Howard and the Howard construction business we've been long time friends and co-workers per se and his business as far as he has been we can all attest to the fact that when we give back to the community that's a plus for everybody and I have personally dealt with Mr Howard as he's given back through different entities that I have been involved in from the act so with NAACP and when Dennis duck and did that of the tours for the HBCU where he took the buses to visit the campuses and Mr Howard provided transportation and housing for both those events and the area churches that he's also given back to and he is starting a project with my church for Ada handicap rep and he is giving back to my church as well as he has other area churches and that project Begins the first of March I yield my time thank you Miss Faulkner Alan Tucker is followed by Tammy Pierce hello mayor and Council councilmember my name is Alan Tucker I'm president of Earth Hollows Incorporated and I'm president um my office is located in one one thousand five one eleven thousand five hundred Emoji Valley Road Fort Worth I've known Mr have about 30 30 years plus and we've done projects together uh we've Incorporated on giving back to the community together done numerous Community projects and like baseball games and and baseball teams together softball teams together and and we actually made a project that he's doing in South Fort Worth part about 80 85 86 so he's been a really a killer in the neighborhood so I yield back the rest of my time to Howard thank you Mr Tucker our next speaker is Tammy Pierce followed by Judy Taylor good evening mayor Parker and may approach to Miss Gina Bivens Chris Nettles and other members of the city council I'm going to start out by saying those that God chooses God uses I saw the slides while all of you just celebrated Martin Luther King a black man that had a dream Rhonda Howard has one of economic prosperity in the city of Fort Worth I know that you had 638 murders of black on black crime I know that black males have a 38 unemployment rate in southeast Fort Worth have you read the Howard Hanley plan do you know that plan would bring jobs do you know that plan would be Economic Development do you know that the businesses would flourish Dixie House all the cleaners all the grocery stores all the gas stations I came here today because I was concerned I said well is he on the council agenda to be publicly hanged and lynched because he had a dream because he stood up because he wanted African-Americans I am I chair and I found an organization called United black contractors associations well we stand up for the equity for the disparity of African Americans in construction mayor thank you so much for your help in helping us with the disparity numbers but there still is a problem this plan would help it would give jobs it would give contracts when are we going to see a project coming Southeast Fort Worth that's two billion dollars again we'll never see that in our lifetime however he's been criticized he's been talked about nobody says nothing about the power plant I live over there within walking distance no one says nothing about the emissions no one says nothing about the train no one says nothing about the dirty Arlington lake with dirty diapers and tires in it but all of a sudden when he purchased 50 acres to bring jobs and economic development he's publicly Christian hey a lich mob is has been assembled here today to criticize him and to stop him from bringing Economic Development to the city of Fort Worth I don't like the word prejudice I saw a vision to deny what Prejudice how that sounds when you just celebrated a black man last month with a dream I ask that you hold off these people do not represent Southeast Fort Worth I've been to their meetings four or five people are there whenever they have an agenda they'll symbol and come together and then say they're speaking for Allah I live over there I didn't get an invitation my neighbors didn't get an invitation to these meetings thank you those who God chooses God uses our next speaker is Judy Taylor who will be followed by Torchy White I'm very confused by what I just heard because there were several things that are not in any of the information that I have gotten in my research I'm Judy Taylor I live on Stark Street I'm president Hanley neighborhood association The Rock crushing proposed by Randall Howard is totally unacceptable the property is in Lake Arlington which is the drinking water of the City of Arlington many of us go there to eat and shop and use the water this location is adjacent to the community of Hanley it's they adjacent to the historic Handley Cemetery a major Electric Plant the Lake Arlington recreation activities a funeral home a golf course schools sports Fields churches police training center and an animal control center there are many children involved in groups of activities in this area that would be affected by dust last year Mr Howard claimed to be to have a TxDOT 820 Rock crushing contract this has been proven untrue Mr Howard was controlling and rude at my neighborhood association meeting at this zone change is allowed the south wind will bring into US dust and noise in front of the Rock crushing it will also impact our traffic on 8 20 with many many large 18-wheelers 24 hours seven uh seven days a week fire station 24 is in handling it it's the busiest fire station in the city most months of the year basically because of the traffic on accidents on 8 20. this will increase with many 18 wheelers these vehicles will be heavily loaded it'll pack their ability to stop it will also impact many things as the Rocks brought for these trucks may break windshields and cause damage and dangers Mr Howard uses TxDOT logo at the zoning commission meeting in January is very deceptive and that he did not have a TxDOT uh contract Mr Howard recently requested another meeting with hna members or Hanley members and that was rejected by the members they are not interested in hearing from him he has been disrespectful and rude to us and we do not intend to listen to his project thank you please offer us something we can come down and say thank you we want this I'll wear my purple shirt for that one our next speaker is Torchy white followed by Cindy bowling foreign good evening once again um my name is Torchy white and I'm a resident of historic Carver Heights and we we support the zoning Commissioners and staff's recommendations to deny this request with prejudice and we oppose a young a zoning change for the following reasons first it's too close to our homes in historic Carver Heights in Carver Heights East we are one of the nearest communities that will be affected and we will not contacted this was originally a matter between District Four in the applicant and not District Five since the city has identified the salt Road as a project site for the Rock crushing Lake Arlington should not be endangered the concrete facility near Northeast Mall and 820 may also be a possibility a historic Cemetery could be impacted it is too close to the nearby Oak Ridge school and a golf course noise increased truck traffic damaging Foundation vibrations air deterioration dust allergens and five to seven years of soil Rock piling is Gravely undesirable it's pointless and it's blatantly disrespectful most importantly the city of Arlington's water supply may be at risk a zoning change is inappropriate it is disrespectful to the health and quality of life of this historically black community or any community for financial gain this is environmentally unfriendly please deny this request with prejudice and we thank you our next speaker is Cindy bowling followed by Dave fulson thank you mayor council my name is Cindy bowling and I'm speaking as president of central Meadowbrook neighborhood association our board unanimously voted to ask you to deny this zoning request with prejudice and I'm also speaking personally on behalf of myself and Mark the sending request to change a small six-acre Lake Arlington peninsula from a flood plain to K heavy industrial zoning is probably the most destructive zoning request I have seen as you know K zoning would not only allow the concrete facility Mr Howard is promoting but long into the future this floodplain Peninsula may be used for industrial purposes that will be that will produce nasty byproducts that most certainly will end up in the lake one fact the South South Point project isn't extending Beyond Ramey Street that's my neighborhood to Brentwood stair it's it doesn't have the funding second as Torchy white mentioned the case before you for salt Road and the existing landfill that's the site for this facility not a six acre Peninsula over Lake Arlington I have a lot of concern about the true nature of this application after participating in the January 11 zoning hearing particularly since after the hearing I was the target of verbal abuse and rudeness as I was leaving the hearing that's very concerning please deny this case with prejudiced our next speaker is Dave fulson followed by Leticia Wilburn Dave fulson director of John T white this is just going to be off the top Larry Elder is a syndicated black radio host and I disrespect greatly and he said something last year in an interview and it comes to mind after the Outburst by Mrs Pierce if everything's racism nothing's racism and that seemed really like a a profound fact listening to that I like to go on record that I was asked and John T white neighborhood was asked expressly by Judy Taylor president of Hanley and Torchy white president of Carver Heights to weigh in on this uh to weigh in on this zone change and as we're firmly in support of their opposition it was a pleasure to do so you know I'm an avid fisherman and a local resident I grew up fishing on Lake Arlington and I made a lot of happy memories there including the day I broke the Long Hill Lake record for largemouth bass a fish I caught about 20 yards from the Peninsula point of the property under discussion it's a superstitious fisherman I have never and all the years since failed to fish in that exact same spot again hoping that lady luck might just want to smile on me one more time I'm still waiting but seriously to think of pulling my boat up on this Scenic and prominent piece of Lake Arlington and seeing and hearing and operational concrete recycling facility there is just as distasteful from an aesthetic point of view as it is from a practical and potentially environmental standpoint the request change of flood plain zoning Decay heavy industrial on a six acre Peninsula over Lake Arlington is frankly both bizarre and outrageous in my opinion if this was to happen not only could this small floodplain Peninsula be used for a concrete recycling but K zoning will now allow it to be used with the heaviest industrial uses that the city of Fort Worth zoning allows this is the wrong use for this property for many reasons a conclusion easily reached by the zoning Commission on January 11th when they denied it with prejudice I'm asking our city council to reach the same conclusion this evening and deny this zone change with prejudice this is a personal this is personal at the zoning hearing decision to deny was met with understandable disappointment by Mr Howard and many of his supporters I understand that and I have no issue with that but I do have a huge issue with the unprofessional unprofessional unacceptable threatening tone and accusations of racial discrimination directed at the zoning Commissioners I spoke to two of our commissioners one of who requested to be escorted out by officers such was her level of concern for what awaited her outside unfortunately I did not escort Miss Taylor Miss bowling or Miss White out that evening I wish I had they were confronted by several of Mr Howard's supporters of the headed downstairs their threatening tone and raised voices aimed by Mr Howard's supporters did in fact intimidate the ladies and was even heard by an officer downstairs who was literally running up the stairs after being summoned by zoning commissioner member just so we're on the same page I will be escorting the ladies out tonight and it would be a serious mistake to repeat that performance again this evening thank you our next speaker is Leticia Wilburn good evening and I want to start out by saying Happy Valentine's Day to everyone but uh I want to say I rarely agree with designing commission but I do agree with them too denied this with prejudice it is pretty demeaning to me that he would come in and use the church in MLK as a way to try to get this approved the church nor MLK I mean the God that I serve the church that I go to or MLK would not agree with this this would be an environmental disaster these these particular neighborhoods in this area has been proven to be very highly polluted and I just want to say that I do agree with the zoning commission that it beat the dying with prejudice and as I stated before this is very offensive to me as a Christian that he would come in here and use churches to get something that's destructive as this past this would only kill people harm people and diminish people property value thank you for your time Council that's the last of our speakers I'm going to pick up some notes I asked from our transportation public works department that was very helpful that haven't been mentioned tonight and then I'll turn to my other council members including mayor Pro Tim Bivens um as a reminder that this is a part this this case concerns the southeast connector project which is a TxDOT project currently valued at 1.6 billion and growing for all the obvious reasons and I've confirmed that Mr Howard is not the prime contractor nor a subcontractor with South Point Constructors on this project and that typically as regarding the normal process with tech stock projects of any size if there's an official zoning request that a company is accompanied by a tech and it's a tech stock project to be also be accompanied by a supportive letter or even initiated by TxDOT and their chosen contractor so while I really appreciate all the discussion back and forth we're talking about a project that has not been let by TxDOT and therefore would not happen and I hate that there's so much confusion in the in the city right now but the chosen contractor by TxDOT right now is Southpoint and any subcontractors will be chosen by cell point the city of Fort Worth has no dog in that fight and I think this diocese has been an exemplary body when it comes to nwb Contracting we've all worked incredibly hard it was referenced earlier this evening and so I just didn't want the discussion to go any further and any angst in the community because this project as of right now is no go forward with TxDOT to make that possible so with that I'll turn to council member Gina bibbons to close us out thank you mayor and again thank you all for coming out this evening Miss Wilburn it was good to put the face with the voice and I know people thought we were long last friends I was just so glad to to know who I was talking to this has been a very hard conversation for the Stop six Carver Heights Hanley Middlebrook communities to to be engaged in quite harmful really because the idea has been given that but far this case all this money would flow into the community I think no matter what type of business the applicant secures I'm sure he's going to put that money in the community like he said but I can tell you I've never seen a concrete recycling or concrete crushing application be approved without a fight on the east side and even one that did get through was overturned later on nobody is just begging to see concrete coming and so I know that I see a couple of more council members ready to speak I won't make a motion until I hear them in case they say something that just okay okay with with that I am going to move to uphold the recommendation of the zoning commission to deny this case with prejudice that is my motion I've got a motion on the floor Council I'll second that motion um and I appreciate both of your comments on this I'd like to bring a different perspective to why I'm supporting uh mayor Pro Tim Bivins on this one before in a previous lifetime I worked at the Council of governments as a transportation planner but specifically in the area of environmental justice and so for those of you that don't know the environmental justice movement came about because historically black communities were being polluted at higher rates than their neighbors and since then our EPA city state governments have done a lot to try to protect our communities and make sure that we aren't disproportionately impacting people of color when we choose the locations for some of our most polluting and highly industrial use facilities when I look at the location of this it is on Lake Arlington and I don't know a lot about Rock crushing um but I did do a little bit of Internet research and I welcome any scientific bolstering from the dice but um there are some environmental impacts associated with this type of facility and the one that really there's two that concern me the most and one of them is the leachate or the runoff that comes with this type of facility it's highly alkaline and so having such a highly alkaline material flowing directly into Lake Arlington will surely end your hopes of of catching that that largemouth bass again regardless of where you go um fish that body of water is used for a lot of things in our community drinking and Recreation and we want to make sure that we keep it safe to do so I look at the neighborhoods that are upwind downwind of this site and I see two I see Hanley and I see Carver Heights and what we know is that this type of facility creates a lot of dust and a lot of particulate in the air I don't want to see that blowing over our neighborhoods and I don't want to see it blowing over Lake Arlington so for those reasons I wholeheartedly support mayor Pro Tim and your denial of this particular case any other Council discussion Council Mr Metals yeah thank you mayor uh thank you mayor Pro Tim uh I will first start by saying I am going to be supporting uh mayor Pro tem uh on the denial I do want to say a couple of things I want to uh it's good to see former mayor uh Clara Faulkner in the house from Forest Hill uh thank you for being here I want to say this uh to you uh Rondo I want to give you some encouragement tonight um first I want to appreciate your efforts and your work that you have done in the city of Fort Worth as a a business owner of you have done work for a while you actually do work for the city of Fort Worth and so I want to say as a entrepreneur and a business owner from a black man to a black man that keep doing the work that you're doing this might not go in your favor tonight but this is not the last project that that you have facing and so um when we do anything throughout the city of Fort Worth we have to deal with neighborhoods we have to deal with the council we have to deal with the mayor we have to deal with people and so this project may not move forward but I want to encourage you to keep putting your metal to the pedal keep doing what you can do one of the things that this is love day one of the things that our iconic person the city of Fort Worth always talk about Miss opaly um she said we can be talked to hey we can be taught to love and so I give you love tonight I support you and I encourage you to keep on doing the work that you can do in the city of Fort Worth and I wanted to give you that encouragement I want to give it to you publicly uh for me to you I've been known you for a while as well uh you went to school with my mom and so uh I would send her some regards she said hello uh but thank you sir thank you for what you do that's all I have mayor yeah thank you any other comments from Council well said Chris Randall it's been a paper copies okay good evening mayor Parker and Council thank you for um speaking with us tonight I'm going to come back to this is the last slide if you would um so as if we can move to a page two my name is Jay proskovic I'm the public information manager for Southpoint Constructors we are building the southeast connector project for text Dot as a prime contractor and our office is located at 5354 East South East Loop 820 South in Fort Worth we've heard a lot of discussion about this project I'm going to leave that as it is and just focus on the facts of of what we're bringing to the table today and that we're building an 11.1 mile project for TxDOT and part of the taking down of the old roadway means we've got a lot to recycle and we want to keep that out of landfills and we want to keep that with the shortest amount of of Hall Road and and with the safety of the traveling public in mind and so although we are going to use some portable recycling areas within the project there's just too much volume and so we would like to utilize this portion of um of the southeast landfill for to augment that purpose to give us more space on page three you see um a little bit what this uh operation looks like but this is what it looks like on the smaller spaces that are located within the alignment and so we see a very large pile of rubble which is kind of a visual Hazard or distraction to the traveling public so we'd like to eliminate that as well on the next page we see an aerial view that has that shows where the four acres are located on the very north side of the southeast landfill and we've listened to the community input from Cannondale residents who are concerned about any use of Dick Price rodents so we've revised our plan to strictly use salt road to greatly reduce the amount of traffic on Dick Price but again focusing on that that four acres on the North Corner the next page Zooms in a little bit more on the operation itself and if you I know it's a little bit hard to see but there are um the yellow portion in the center is where the equipment would be located in our intent is to surround the equipment with the rubble piles and the um and the recycled material to reduce the sound and any kind of noise levels with that on the next page we see um just some of our commitments to the operations plan our our goal here is to improve the safety of the on the traveling alignment uh our air quality uh through our TCEQ permit will have no visible dust conveyors will be covered and spray bars on all those um on all those conveyors lastly on the overhead projector we're seeing the yellow circle is 300 feet surrounding the project which is not allowed to be near within 300 feet of any structure which you can see applies here and the red circle according to the tce EQ permit is 440 yards away from any residential structure thank you Jay our next speaker is Leticia Wilburn mm-hmm okay I I know y'all have this uh zone for approval but my concern is the impact of the pollution the areas around this it's already heavily polluted you can smell that trash stump miles and miles away the the trash dump in itself create cancer causing uh emit counts and costs in particular matters this is going to emit more Council costs and matters and they're going to mix so my concern is for the community for the environment I know it is in a landfill but none of those people over there live in any other affected communities and they do make a difference y'all can move this to somewhere else the east side as we were saying in the hallway the east side of town cannot become The Dumping Ground of Fort Worth this and I know y'all spoke uh cancer person Beck spoke about The Zone and demographics but if you look at this chart in its four words you can see how it is very discriminatory towards black and brown communities which will be affected by this it needs to go somewhere else the city I believe from what I studied past this first Zone in deal in 1940 and that was along Jim Crow red lines and nothing has changed your zoning is still Jim Crow it's still a red line it's still just do away with black and brown communities and cause us disruptions and health problems at what point will the city be accountable for all the illnesses the cancers the hair losses the loss of lives the deaths from the council counselors that these things in our communities are causing myself I had a rare brain event almost a million dollars between me and the insurance company the city did not pay for it the companies did not pay for so at what point is the city going to be liable for the damage that you all are doing to these communities it is definitely you can look at this it is definitely discriminatory it is definitely redlining it is definitely Jim Crow and I'm not calling anyone racist I just want to make that clear I'm just saying the policies are thank you thank you councilmember Nettles is the last of our speakers on this item uh thank you mayor um first I want to say I really appreciate you coming and actually staying a lot of things that you said tonight were true and I do want to go back to what the mayor said this is a uh this is the southeast connector project that's going to come to the southeast forward it's a tech stock project uh that's going to bring several billions of dollars to correct some issues that we have with our highways and freeways and so this project is coming to Southeast and one of the ways that we have to make sure that we can eliminate some of the issues is providing a place to do some recycling I have had several meetings with this group uh Southpoint as well as with mayor Pro tem and others involved in this project with assist assistant managers of the city we truly believe after several conversations that this is going to be the best way that we can move this project forward and so tonight um I will say that we're going to approve this motion for approval I will as if you are willing to sit in a meeting we can set up a meeting with uh South Point of South Point is willing because she has some concerns and I think a lot of times it's open lines of communication where she can be able to talk to the community about her concerns as well as you if we can make that happen I'll be greatly appreciative of that so I see head knocked so I'm gonna ask my office to get with you after this vote so that we can make those two happens is that okay uh with you that's been here as well thank you so much for being here that's my motion mayor thank you I've got a motion Council addressing the environmental justice issues particularly because we just addressed them in the previous zoning case um and I'm looking at the location of this particular um proposed facility site and first let me back up and say when I heard Mr uh Pros Quebec did I say that right okay all right um one thing that I picked up on during your presentation was you talked about how the facility was going to operate um and that let me know that there had been some thought into reducing the environmental the potential environmental impacts this site is uniquely different than what we were looking at in Council District Five in Council District Five it was located almost directly on a large body of water and there is no body of water around here in fact what surrounds it currently is a landfill and so if you've already got that type of use surrounding it I don't see harm in adding this particular use the concrete recycling particularly in fact in light of the mitigation of dust and the really the unlikelihood of it leaching into anything because I don't there's not a large body of water around there and it's already got an industrial slash recycling type used to it and so I will second this motion because I think it is a uniquely different site than the previous one kind of motion and a second Council any other discussion please vote motion carries next item is zc-22-161 we zoning change from a75 one family residential to pde Neighborhood commercial the site has been vacant and undeveloped for over 20 years and uh also the side in question is located in a portion of the block that is comprised of a mixture of residential and Commercial uses including auto repair and convenience stores the site is a 0.87 acre tract of land and if approved 60 percent of the site will remain undeveloped at this time the proposed site will have a one-story 3700 square foot building the site will comply with lighting signage landscaping and urban forestry the applicant and I have met with glencrest civic league neighborhood association the meeting was well attended and the membership asked all the right questions about this proposed development the membership made recommendations regarding revisions to the site plans which have been incorporated into the current site plan the membership also made recommendations as to what e-commercial uses will not be permitted at this site additionally glencrest membership also made recommendations of potential e-uses that would benefit the community which we are going to aggressively seek for this property members a letter of support of mailbox to residential I met Mr O'Day by I'm not gonna say by accident but before he bought the property the property faces my home and if they don't cut the alley it gets to be three or four feet tall so if I cut my lot it looked like I didn't cut it so one morning I woke up and I looked out the window and I could actually see Hillside Park and I'm like I could not it hard and I saw Mr day and I had to walk across the street and thank him for cutting the alley and cleaning the fence roll and we formed a a neighborhood friendship the Italian project and the Harvest Food project at a food drive where we gave away fruits and vegetables to about 400 families Mr O'Day his wife and his children came and assisted Us in passing out that food Mr O'Day is the type of neighborhood type of neighbor that I would like to have in my neighborhood he's expressed to me that he's concerned about the neighborhood and wants to see Improvement so that's my neighbor and I want you guys to vote yes name is Alexa Becerra and I'm representing Umberto Becerra which is my father um we on the property located at 4309 Village Creek Road which is part of District Five we would like to ask for approval of us to be allowed to continue to park our personal vehicles and trailers um we're just trying to understand the need for us to resort to Industrial since we do not fabricate anything from our property our only purpose is to park our vehicles instead of going to a job site with more than five vehicles or anything else we took we took into consideration the reasons why we were opposed to this on our last hearing which were due to the nursing homes that are nearby I visited both nursing homes and spoke with both administrators and neither neither or opposed or had a problem with us being there they informed me how they usually receive letters on this behalf but they were not aware of anything the nursing home near 287 had no problem with us being there due to their have due to them having an 18-wheeler business right behind them and a fuel station that was added right next to them the nursing home that's down Village Creek Road also had no problem with this because we are pretty distant from them and we have also had no problem um on causing any accidents or traffic we were able to collect letters from people in our surroundings also agreeing with us with them having no problem with us being there we have been at this property for the past five years and have never caused any issues with nobody in our neighborhood the only violation that we have ever had was due to our events being high but that was quickly fixed another reason that what we were denied was due to us having no sidewalk but we went around our entire neighborhood and no other property has a sidewalk that we could even match or connected to in either the surroundings that are on the intersections nearby another issue we had was that they think that we would be planning on selling our property in the future if you guys do approve for industrial but we have no plan of ever doing that as we're trying to go be of our beyond our point to keep our property in order for us to keep being part there and use it using it for what we use it for um another thing was that we were told that we have 18 wheelers parked on our property but we do not we have storage units um we have storage units that we use them in order to store our material and any other things so that they don't rot in the in the rain um I just hope that you guys are approve of this and if you guys deny this we would just like to know what we can do in order for us uh to be there comfortably and and yeah that's pretty much it but he usually tries to give back to the community and during the snowstorms um we donated our generators to help them be warm thank you so much thank you Alexia I may have the wrong didn't you work for the city no okay I thought you were the Alexia who's my Facebook friend yeah I know I wish I was I I really wish I would let me tell you what I want you to do because I know you talked to Sandy in my office and I think we have a communication problem in terms of procedures I'm their pets will suffered it's noisy and it's pollution they knew what they bought when they bought it and now they want to change it because of the area there's no traffic study there's no sidewalks there's the community center there's the park you have children walking you have that nursing home facility that she spoke of it's just right down the street probably from here to a little past that door not very far from what she's speaking about that nursing home facility is already surrounded by trucking companies and gas companies so I think that really and truly in Village Creek have allowed me to speak on their behalf and I think that this should be denied with prejudice I don't even think they deserve a continuance they've been here before it will create Havoc for the houses around it I know this for a fact because I have to live with it every single day so deny we pray to this don't give them no extra days thank you Miss Wilburn I think there's a motion for continuance on the floor members of our community myself included have showed up tonight in opposition of zc22-218 you will also hear voices of support however regardless of these two facts the one fact we cannot change is that there was a misstep in the handling of this zoning case where there was negligence on behalf of the city of Fort Worth or negligence on behalf of the townside Inc and the owner they represent it does not matter ordinances are set in place by a legislative body in this case city council and I know there is a state statute that does not mention a sign that need to be posted on the premises the fact Still Remains there is a city ordinance which states it does it has been brought to our attention city council plans on passing this zoning case under a state statute however let it be known local ordinances carry the statues and authority and has the same effect as a state statute further state law only preamps and local ordinance if and only if there is a true conflict between the two if the zoning case is still passed then they may be considered exclusionary zoning especially since our local ordinance is set up to protect adjacent Property Owners from this type of action again if city council passes this case there are Property Owners ready to appeal its decision when this happens the burden of proof will fall on the developer and city of Fort Worth to show they followed proper procedures and protocols and they will unfortunately not be able to provide such evidence therefore the city of Fort Worth will waste League spend thousands of residents tax dollars trying to defend its negligent self this will not be a smart move as the current local ordinance will be viewed as valid by the the courts and defense and have difference too due to such we asked city council acknowledge that there was a misstep in the process and moved to denying zoning requests changed with prejudice councilwoman Beck you are elected representative and a lawyer our community asks you please seek denial of his zoning request change and adhere to your responsibility and adequately represent our working class community please remember or been panicked by definition is design and regulation on how space is used from its physical form economic functions and social impacts to the urban environment it simply is termed zoning and urban impact every aspect of our daily lives from the moment we step into the door to take ourselves family and children to work and doctors appointments due to due to such there must be give and take compromise we cannot ignore them for which developers away however we can't control the matter in which they interact with the community due to this public participation in public partnership is necessary our community and city of Fort residents need to feel validated as this is our city and our neighborhoods to have developers come speak to our community only after they have gone to the zoning commission is not enough it is superficial and just as checking the box it makes our community feel violated thank you considerations we're not taking into account thank you our next speaker is Angela blockowitz angel I know I'm butchering your last name please fix it when you come down and she's followed by Juanita Rojas okay well got it right good good evening mayor and council members I am Angela blockowitz I am 36 year old 36 years old I'm a Marine Corps veteran and I am a homeowner a block away from where this development is and process of being re-zoned I am against this rezoning um they did not follow the proper procedure on putting up signs and up until the developers were speaking with our neighborhood saying that there were signs that we had pictures improved that nothing had been done the developers came and spoke to us um as though we did not have any knowledge or any idea what was going to be happening they could not give us a uh the price range of what they wanted these Town Homes to be we are a lower income predominantly Hispanic neighborhood a lot of our homeowners are older a lot of our homeowners make between 30 and 40 000 a year our tax increases were 70 76 percent risen in the last year and that is with no developments nothing new nothing new being done to our neighborhoods nothing new being done to our homes um the amount that this increase would bring in to my neighbors to my family to myself would eventually push us out because it would give Urban residential a foothold into taking more lots and spaces in our neighborhood I am requesting to vote against this so that we are not taxed out you know on top of this would be extreme congestion we live on two major streets of Hemphill and Morningside with two railroad crossings that are regularly stopped for three or more hours at a time every day um this would cause lots more traffic than needed but mostly I'm here in opposition of the tax increase and y'all had noted earlier that we are facing housing and crisis here in Fort Worth that does not mean that we should be bringing in developments that will push residents who own their home and who have owned their homes for 30 plus years out by increasing their taxes on them not being able to afford it and being pushed out the way the other neighborhoods behind Magnolia and North South Main Street have been pushed out as well I've known those kids my whole lives and I watched their parents have to sell their homes because they could not afford the taxes with the money that they made you know homes that they owned and worked hard for most of their lives so again I'm in opposition of this and I hope that you vote as well in opposition with prejudice and we are working as a community to put together a list of what we do want to see in development in this location we hope to have that here within the next month or two and we will be bringing it forward but the developer could work with us on that that would be great but we do not want this zoning change to Urban residential thank you thank you Angela our next speaker is Juanita Rojas good evening migrant councilor Juanita Rojas District nine I am here as a resident who has been active in her neighborhood for the past 28 years and for 10 years they've been involved with the Hemphill development the hempo quarter development collaborative and in 2020 the Hemphill quarter group tried to be proactive and put in place zoning changes that would have protected hempo that stretches from West victory victory to I-20 such rezoning would have prevented the development of multi-family housing and would have placed height restrictions on future developments these rezoning efforts would have prevented everything that Ricardo and his Champion group would argue against for today several online meetings were held in 2020 to help educate residents on zoning which we know is it is not a simple concept to understand at each of those meetings abithi and his group continuously interrupted and b-rated City development staff and members and the board members of the Hemphill quarter group his attendance at these meetings continues to be disruptive and because they have become so unproductive other community members who are live and own businesses on Hemphill no longer attend the meetings to avoid the negative and hostile environment that they create Avidia has undermined the efforts of the Hemphill quarter Development Group and the active neighborhood associations that would have protected Hempfield from everything that he is against for his own personal beliefs he does not speak for the Southside Community he is not the voice for hempo however he does represent one of the most disrespectful and belligerent group of residents that I have been around and that brings shame to the term of Hispanic representation development is going to happen on Hemphill and we need a coordinated plant with neighborhood associations group and what they call defending Hemphill have actually prevented protections for the residents and have put Hemphill at risk for Less desirable and uncontrolled developments the community the current zoning case at hand for development of Tom Townhomes would have not have been an issue today had would have been able to rezone two to three years ago thank you that's the last of our speaker speakers councilmember Beck I I'd first like to have Melinda Ramos come up and just um for the record give a explanation of our serving notification requirements and speak to what Mr abedia mentioned certainly uh Melinda Ramos Deputy City attorney I believe um councilman Beck what we're referring to is there's a statutory notice required for zoning cases and then there's our ordinance requirement for zoning cases under the statutory notice for the zoning commission they're required to provide notice within 200 feet of this the zoning case to Residents that are adjacent to that for the city council we're required to provide 15 days notice in the City newspaper our ordinance required there's no requirement under statutory to post a sign of the property under our ordinance we notice for the zoning commission Property Owners within 300 feet of the zoning case and there's a language in the zoning ordinance that says that the director will have a sign put on the property but there's also language that says that it's not a conditioned precedent in order for the zoning commission or the council to act if that sign is not placed on the property can you define conditionally so a condition precedent is a situation that has to occur before an action can take place and so just by by way of example if the sign is not placed that doesn't mean that the council can't act on the case or the zoning commission can't act on the case and if someone felt um that they didn't have proper notification is the remedy at the zoning commission is it at Council or is it at both it can be at both and so can you please kind of just very briefly describe the interplay between the zoning commission and Council and its Authority so the zoning commission is a recommending body to the city council the zoning commission does not make any final decisions on their own they're required under state law to provide a a report that's done as part of their recommendation and included in the staff report that staff also provides as part of your packet it's the council's legislative authority to make the final determination on the zoning cases that come before you okay thank you I appreciate it uh Juanita are you in your official capacity with Hemphill um okay um I'm a little disappointed that there's no official representation from that organization here tonight it makes this a little more difficult um so we're gonna have to play a tad bit of hearsay here and I'm going to trust that what people have said to me or or truth um um excuse me um so first and foremost let me say that um Mr roles I completely agree with you um that there are some protections that can be put in place for Hemphill to prevent the type of development that would push out so our multi-generational neighborhoods that are along that Corridor and I think that the time is ripe to have that discussion particularly as we're bringing on a second council person to represent that you know half of that that area and so I look forward to working with that person whoever that may be on Council to make sure that we are protecting what I think are some of our most tight-knit neighborhoods in the city but also providing some progress because if we don't progress we rest and what I don't want to see is Hemphill to continue to languish we know that um you know with vacant businesses come crime comes homelessness and someone who walked those camps on the point in time evening it's a problem down on Hemphill and we're not going to fix it by allowing any businesses particularly those that face the street to to remain vacant and so let me say that something will go there if if not this project something will go there the owner of this piece of property um is very interested in selling it to homestever and so what my job my goal here is to um provide a type of development that allows for progress in the community but doesn't destroy the character and the nature of those residential homes that are adjacent to Hemphill I appreciate Mary you going to the Hemphill develop I'm going to call it the task force just because that's how I learned it it's it twists me up to call it anything else I appreciate you presenting that evening I am sorry to both you and Miss Rojas for the way that that meeting transpired after I left you know I know that it got almost physical and so what I'm going to do tonight is I am going to remand this back to zoning for the April 12th zoning hearing and so I want everyone in the room to hear me this case will come before zoning April 12th and what I'm asking you to do is bring that back as a mixed-use zoning application I'm asking you to work with the neighborhood it's my understanding that Mr Peralta assured you that he would help facilitate two Community meetings so that you could have that dialogue and answer the community's questions about about the project it's my clear understanding from those folks that participated in that meeting and were productive in conversation that some sort of mixed use is more desirable and housing is not necessarily completely off the table but there's a lot of questions about affordability and that's a very valid point because what we don't want to see are um the types of town homes that are gonna price change drastically change that neighborhood in the direction of that neighborhood and that's really important to me and I think the members of the community so that means that this vote will come back to Council in our May zoning case so thank you Mary for your willingness to to work with this and my charge to everyone here is to have a civil and productive conversation about what we want to see in that particular spot shouting over people when they speak becoming physically violent with them when they speak is not how the community gets what they want it's how you get something you don't because if the zoning doesn't change what can go there I don't think is what we want to see eventually the the direction of Hemphill going in so I ask everyone to come with an open mind dialogue about what you do want I heard you uh Angela about coming together with a list of what you would like to see there I think that's a great idea I've been asking for one of those for a long time for members of the community around Hemphill you know what do you what do you want to see there so thank you for doing that um I would encourage you to get with um marry and share those I don't know that we have two months but we know that we've got before the April 12th meeting and so I'd like to have a community meeting before the April 12th zoning hearing so that way we can have some dialogue you can talk about what you do what you don't want um whatever that is whether it's some sort of housing or the mixed use will go before the zoning commission and then we will let that play out and I'll come back to council so my motion is to remand this back to zoning to modify the application to a mixed use application there'll be a re-notice correct yes so there uh t-square Investment LLC which is the owner of the subject property we I'm here to ask for your approval for the zoning case from G to A5 we have owned this property for the last six years I've been very familiar and part of ET Square for the last 25 years I was the first one who put 12 800 square feet office building and we occupied it for three years and nothing really transpired in that area so we ended up selling it to a church which is still the one of the few buildings in that area did you build that well I call it the funky kind of buildings it's like no no those are cool no those the the first building that we did was on t-square I think if it was 1731 t-square which we occupied along with our partners uh about 4 000 square feet and we tried to lease the other 8 000 square feet but we were unsuccessful we owned the rest of the area all the way down to Handley from that church all the way to handling and then uh we have tried to do anything and everything with it nothing happened so in 2003 three buildings those buildings that you're speaking of uh were built and since then nothing zero and we start seeing back when DR Horton to the east of our property got rezone uh to a single family we decided to go ahead and acquire another seven acres and uh we applied for rezoning back in 2017 which unfortunately was not approved so we tried to work it out as business office Park anything that will just like move or change that area again no success whatsoever and we tried to sell it later on and we were able to sell only to Mr peoples for three acres of the 6.72 Acres we did reach out to everybody that protested and opposed our zoning change back in 2017 and uh on October 13 I informed everybody including Mr peoples that I am I want to be transparent and we're going to go ahead and apply for reason and if anybody has any options any if they want to sit down and talk about it please do and I have not heard anything that oh that was so long ago your timing is 2017 we've seen more A5 efforts come that way and I think the commission agreed that this request was in sync with what is appropriate there is a housing shortage in this city especially in that area
