Lord, we pray for your continued blessing upon our city, its residents, employees, mayor, and council. Amen. Thank you. All rise while Councilman Luis Rodriguez leads us in the pledge of allegiance. Everybody, please face the flag. I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all. Thank you all. You may be seated. Madam Clerk, can you please read the guidelines for tonight's meeting? All lobbyists must register with the City Clerk. As a courtesy to others, please refrain from using cellular telephones or other similar electronic devices in the Council Chamber. A maximum of three speakers in favor and three speakers in opposition will be allowed to address the Council on any one item. Each speaker's comments will be limited to three minutes. No signs or placards in support of or in opposition to an item or speaker shall be permitted within the Council Chamber. Any person interested in making comments or posing questions on matters of public concern or on any item on the agenda may do so during the meeting. Members of the public may address the City Council on any item pertaining to city business during the comments and questions portion of the meeting. A member of the public is limited to one appearance before the City Council, and the speaker's comments will be limited to three minutes. Individuals should be respectful of the elected officials and staff and make every effort to speak with a moderate tone using appropriate language and avoiding personal attacks. It says uh Mayor Collazo and the City council may present service awards to several students in different high schools located in Hialeah in recognition of volunteer month. I see three different high schools want to be recognized all of them to be recognized by Council Vice President to leave us in the recognition Council Vice President Melinda De La Vega. Thank you and good evening everyone. So April is recognized nationwide as national volunteer month and I think it's a time to celebrate like the spirit and and the individuals who who have given their time to our communities and to making our communities stronger. Tonight is truly an honor to recognize several outstanding students from across our city and from all of our schools. These young leaders have each dedicated several hundred hours um throughout their whole service of of high school. So a mile a milestone that reflects not only their hard work but their compassion and their discipline a genuine love for for our community. So volunteerism is is a heart of a strong city. It teaches responsibility. It builds character and it reminds us that even the smallest act of kindness can make a lasting impression. These students have chosen to spend their time helping others and lifting up our neighbors and giving back to their very own community. I would like please if all of our honorees can please stand for a second. Applause. I would like to say that you know you represent the very best of Hialeah. Your dedication inspires all of us up here and it it it continues to give us a purpose to serve right? You are proof that the future of our city is bright because of young people like you. I would also like to take a moment to recognize the parents and the teachers of all these individuals who encourage and support these students every step of their way especially during volunteering. Your leadership is an example to all of us and to the achievements like this is possible. So on behalf of the mayor mayor Brian Calvo and the city of Hialeah Council up here we thank you for your commitment your leadership and your service to our community. And so I would like to congratulate all of you individually. We're going to start off with Westland High the students from Westland High. The first student um Tibisy Tibisay Metcalf she is a senior and she has 999 plus hours. If you want to come up. Also from Westland we have Melanie Hernandez a senior. You want to come up? Yep. Melanie Hernandez a senior with also 999 plus hours as well as Daniel Martinez a senior with 999 plus hours. So if all three students can please come up we would like to recognize you. We have a couple other students from Jose Marti Mast Academy. So we have Evangelia Evangelina Alburnes a 10th grader with 1900 hours Isabela Flores a senior with 2362 hours and Alexia and I'm sorry Isabela Flores also has a a brother sibling so these are these are siblings Dylan Flores with 1400 hours as a junior and Alexia Laurie 12th grader with 2600 hours. And then lastly from iMater High School we have Dominic De Jesus a senior with 595 hours and Giana Fe Acosta 11th grader with 643 hours. We're done with the presentations? >> Yes. I want to start out I have a resentment with Councilwoman De La Vega you left out Miami Springs. >> Name and address please. Holday Aussie 788 788 Southwest Park Drive. So you left out Miami Springs High School and who has ever acknowledged graduated from Westland High? I don't know anybody. The mayor did that was a joke. Yes. Okay. My joke all right. Yeah mayor I'm going back to service this is so I I saw your message here and this is this reminded me what Julio Robaina what Carlos Hernandez or what Steve Bovo did in our city. I want to compare you to to Raul Martinez that I want you to be remembered somebody like Raul Martinez. I want to go some of the things he did for us right? Raul Martinez he created the modern Hialeah. He expanded Okeechobee Road from two lanes to three lanes. He built the tunnel under the railroad track. He built our courthouse. 30 years Hialeah would not have La Palangana. There was a flooding everywhere. Not only the lighting street all that he did. How did he do it? Going to Tallahassee going to state we get very little money from Tallahassee. I think whatever lobbyists we have we definitely definitely have to replace some of the county. We we're getting very little money from the county. Rebecca Sosa was my commissioner for 12 years east of 21st Street we never got anything. Now that you're obese and Senator Garcia Miami Springs and Miami Lakes get way more money and projects. We rarely see those signs where we're getting millions of dollars. So we need more money coming in and I know you're working on that I heard about that. I want to share what Raul Martinez did in Parks and Recreation. I started in 1990 1982 in in Parks and Recreation Raul Martinez built Goodlet Park Wild Park um Bucky Dent Park Gathof Park and Slade Park. Raul Martinez also built the aquatic center at Slade and at Bucky Dent. When he built that only Tampa was compared to us in Parks and Recreation. So imagine how we went to from that to today I have I visited um Bright Park through the 18 year old managing the park she's a high school student. There's no program there and I went to visit the pool the pool is still closed. The pool at Walker still closed the the pool at at Westland still closed. We we still closed um the the park at Fire and the park at at Hialeah Middle and we used the the recession you know as the reason but no other city in the state of Florida closed parks and pools. So I hope that that's when you you've made your accomplishment. I want to give an example what else you're dealing with mayor that you you got this. The employee turnover is unbelievable. Not just freezing fire but I don't know how department heads are doing it. I don't know how Willie manages parks and recreation with 18 year old. Today I went to risk management because I have a medical procedure there in charge of insurance. Rachel helped me and she's calling back two times. Very competent, very professional. A staff like that is not going to stay with our city, right? We're probably going to lose her and every department is losing people like this and that. The the funding problem and retention of staff, those are major issues. I know you're working on it the hard task but I think you could do it. Thank you. Thank you, sir. Between one property and another. Houses typically obviously have their own space between houses. In those houses. You're permitted to have a boat. As long as the boat is on the side of the house and it's hidden from the street. Hidden from the street. But because the R4 property doesn't have that division, that's why it's prohibited. Because the only way to park it would be in front of the property. And that's what the council decided at that time. So they're simply enforcing that regulation. That was approved two years ago. The boat is the boat is the The ordinance is confusing. Because the warning that they're giving us is because they're giving us the warning because the boat is the It says wrongfully parked. Wrongfully parked. In the property. Yeah. But so I'm going to I'm going to leave anyway. My my first complaint. Second. See how you can help us and third. The document. Because I read the ordinance and and no matter how I read it, I don't understand it. Because it's very simple. But because I'm R4. You're R4 because that's a classification that's given to the property. All properties have a classification. Whether it's R1, R2, R3, R4. R1 is a single family house. R2 is a duplex. R3 is a multi-family where there are multiple units, an apartment building. Apartment building. And R4 is a townhouse. Which is when there's no division between one property and another. Commercial properties also have their zoning classifications. Industrial also. I1, I2, I3. C1, C2, C3. So basically they're zoning classifications. That's existed for 1,000 years. All cities have it. And townhouses in all cities are considered R4. But as I told you. That ordinance was approved two years ago. I was actually against it. But it's the one that's written in the books and it's the one that's being enforced. The only thing that can be done. You can't ignore the ordinance. The ordinance exists. The only thing that can be done is if the council decided to change the ordinance and that's a conversation that we can have. But. At this moment. It's prohibited to have a boat in a townhouse. Just like it's prohibited to have it in an apartment building. R3. It's prohibited to have it in a duplex. The only property that you can have a boat as I told you is a single family R1 and it has to be on the side of the property and hidden from the street. So that's the only one that's approved. Because townhouses are not considered single family homes. No, they're not considered They're not considered in our city or in any other city in the United States. Okay. No. property. In other words. People invent. They force you They force They force the car to park it like this parallel to the house. Which is prohibited by ordinance also. If you don't have space you have to start parking vehicles whether it's a boat, an RV or a car parallel to it has to be by law unless It was all those things, those problems. There wasn't enough space. It was causing problems with the parking. We would have to review it again. Let's see. Let's see how it is. We have to ask the inspectors to give us information. But you're not going to have time until until they gave you the notice. Yeah. You're going to have to You're going to have to take it out. Okay. Unfortunately, yes. Anyway. Of course. You have it? Okay. >> [clears throat] >> It's the first time that I stay here and listen the mayor Uh Okay, you start over all those months and it's for a long year uh checking, not checking, but observing that in the ninth street uh that is the 60 of the east, that is the 62nd of the northwest uh from Okeechobee passing the 10th Avenue of the east that street has been without lines uh neglected but there are many people who don't know or don't know that street like many other streets and avenues of Hialeah the city of Hialeah cannot do anything even if they want to do it, they don't have the budget because the budget is held by the county Miss Camila was guiding me, guiding me until I got specifically to the office of the county and they immediately confirmed and said that they were working and that supposedly in about a month approximately all those lines were going to be there uh painted and the pavement is perfect. The problem are the lines and my concern is that that on a day that it's raining or not raining, since you can't see the the the lines that divide the lane, there could be an accident that won't be the first that I've mentioned. There have been many accidents due to that situation. Okay, let me uh Okay. So, we're done now. With me here today is the president of the Bella Vista Plaza Commercial Condominium Association. On the audience, we have among other business owners in the neighborhood, Mr. Manny Alonso from Professional Plumbing. Mr. Willie Delgado is also here. Over 2 years ago, and unfortunately, it's not on the administration's fault. Even though we had that famous ordinance that one term ends and you got a a period where the new administration is going to get familiar with what was going on. Transition. A transition. Mayor Bovo left and the transition to Jackie was very short and the transition from Jackie to the mayor was as it was supposed to be, but I guess the message got lost in the shuffle. Nevertheless, in the last 2 years, numerous time, me, myself, and I, among other people, have been asking the street department to convey a meeting with those property owners that are going to be affected by this project because we believe that we deserve to know what's going to be done before it's done. And we believe that we had the right, even if it's only the right to throw a tantrum at the end, to voice our opinion that what we would like to have done on the streets. The improvement is much needed because the street flood to the extent that sometimes the flooding is up to 3 ft high. So, we need the improvement. But we wanted to know how many parking spaces are going to be eliminated from the street. We wanted to know where the new trees are going to go. If they're going to put curb and gutter with little grass so people will get and park on top. We wanted to be part of the design before it was finalized. And I was told, "Don't worry, Frank. You'll get to it. Don't worry, Frank. We will let you know." Mr. Alonso came and met with Mayor Bovo on his office. "Don't worry, you guys. Nothing is going to be finalized before we get together with you guys." And here it is, finalized, and we have no clue of what was going to going to go up. We have no clue of the elevations. We have no clue if there's going to be pinching in the road to 16th or 18th Avenue or just into the drainage in the street. I mean, it's going to be sufficient or not. I don't think that those owners that have been on those streets for the with 40 years should not be included. I agree. No surprises. Can I Can Jose Oh, there you go. So, I don't know if any of them want to say something. >> you set up maybe a meeting at the with um The way we feel that if this passed today, then we not going to have the opportunity to do any changes. I hear you. I hear you. I hear you. Makes sense, Frank. And there should be alternatives Yeah. to the design if we don't feel comfortable with it. Jose Sanchez, director of streets, 156th Street. The plans are available. Our offices are open 7:00 to 3:00. They're there. He was provided a copy of one of the locations requested yesterday. He's more than welcome to come. And the fact that there's >> you Can you give us an executive summary of what we're doing on the sign? We're doing a full reconstruction. It's going to include drainage, curb and gutter, shoulder parking, sidewalks, and a few tree removals due to the installation of the drains and the curb. Okay. And to address the specific question about the parking. We're providing parking throughout the whole like shoulder parking everywhere they could fit shoulder parking. There are some areas that were respected. Like I mentioned before, we take a drive while we're doing the design of every street that we're designing, and we observe what's going on in the area. In this case, we provided parking everywhere we saw there was a need. And the only areas that we're not providing parking is where they don't fit or there are some folks that have a lot of trees planted, which obviously are telling, you know, sending a message that they don't want anybody parking in those locations. So, those were respected and we curved those in. For everywhere else where there is cars parked and we're able to fit parking, there's we're providing parking. Okay, cuz I think their their main concern, if I'm hearing them correctly, is, you know, they're afraid that parking will be eliminated to some degree that it would affect their business. Is that something that is accurate not accurate? No, we're providing parking everywhere we can. I mean, we are leaving clear zones next to every approach. That's a safety issue. I mean, if you go there now, there's no curbing, so there's no way to restrict that. And people park as close as almost on top of those approaches. That for for sure is going away cuz we have to provide safety. You got to be able to see what the oncoming vehicles when they're exiting those those driveways. But everywhere else, you know, we're providing parking. And as far as there's no time for changes, that's not accurate. Right now, we start with the drainage. Basically, they have until we start laying down the curb to make modifications if they need to. Yes, there will be commitments that we will require. It's not just we ask for for this and that. So, for example, like when we deal with residential, this is very uncommon cuz this is more of industrial area. But when we deal with residential, if somebody wants to expand their driveway, as long as they do it before we lay down the curb, all we ask for is that they have a permit from the building department and show us what improvements they're planning on doing inside private property, and then we'll accommodate whatever that is on the right-of-way side. So, we apply the same concept to to this area. If they want to do a wider approach or something like that, they have until we start laying down the curb, which is probably going to be a couple of months out. And we're going to do block by block, so they have time to come in, meet with us, and we could walk them through the process and make any changes necessary. Okay, so fair to say you're willing to work with the business owners that are going to be impacted. And you said you're available between 7:00 a.m. and 3:00 p.m. the office hours out in the streets department. You want to give them the address? Correct. 9856 Street, Building 4. You know how to reach them, right, Frank? How to reach Jose, right? He's been there many times. >> Yeah. Okay. If I may through the chair? Yes, ma'am. Um Jose, I I as a business owner, I'm sure their main concern is are they able to, you know, have an entry and an exit? Are they still able to run their business adequately even though all this is going on? Are we going to provide them kind of just when the phase is coming so they could prepare and and make sure that they have sufficient space for their customers to still conduct business or have a, you know, an entry and exit way into their plazas? Absolutely. We'll We'll try our best to accommodate everyone. There's going to be short periods of time that they won't have access to like maybe one driveway, but we'll find a way to get them access to the property. And that will be only during the installation of the drainage cuz, you know, those are 15-ft deep excavation that while we're doing it, I mean, we we got to do the digging, and but for that short period of time, we'll have that section closed, but we'll find another alternative for another entrance or a temporary access for those properties. Okay. I I'm sure that they're they're nervous because recently we saw in downtown that they shut down like an entire street and all those businesses weren't able to conduct business. They didn't have any customer, you know, walking through. So, as long as we do allow and provide them to continue, you know, having access to to the entrance of their location, I think that that will provide them some some relief. How long will this project take start to finish would we assume? Um between 6 and 7 months, weather permitting, of course. Okay. But phases. 6 or 7 months, each block will have a a different It'll be for the whole project, and we're looking at three blocks, maybe 2 and 1/2 months or so uh per block. Okay. Yeah, cuz we're doing 38th, 39th, and 40th. So, those are two avenue segments. So, I would say about 2 and 1/2 months each. Okay. All right, thank you. The only thing that may be a little difficult at the time, but the road's going to be closed for local traffic may be the on-street parking during construction. So, cuz I mean, we're going to have a lot of equipment there and all that, but access to the properties, we'll we'll make you know, everything happen, you know, we'll have access to all the properties. Does that work for you, Frank? Uh Mr. Chairman, I'm sorry that I do know how to reach Mr. Swan Sanchez. I don't know who did they send anything, but definitely was not to me much less yesterday. Nobody has reached out to me in as much as I have and I'm sorry I have to tell you. I I go every time I go there, I see Miguel, "Hey, what's going on?" "Jamil, you you will eventually will get to you." Unfortunately, they're ready to go. Yeah, yeah. At this time, even if I get the set of plans tomorrow and we have a meeting with the neighbors and look at it, there's going to be a cost incurred if we want changes, and the changes are not going to happen. And that's what we are so upset about. I understand. >> The fact that it's final, this is what it is, and we ask very nicely, we want to be consulted. Yeah. And ain't going to happen. So, what is there is what is going to be, so that's why I say we only have the right and that's not But we may be okay. Maybe once you look at it, it'll be close to what you want, right? Give it a chance. Yeah, most likely if I see the plans, they'll be beautiful. But the point is I know, I know. >> that procedure I hear you. should be changed for the future, not only on industrial areas, but also in residential. Because at the end of the day, it's our neighborhood, it's our money, and we it's our life livelihood uh that is being affected. We appreciate the fact that we're going to get new roads and improvement and drainage. It's just the way we went about it. Yeah. And it's not like we are a stranger. He sees me every time I go there, even though he no longer has chocolate on the counter. We cut the budget. Let me clarify something cuz this process has been in place for as long as I've been here, and I've been here almost 20 years. >> Okay. >> We've always provided access to the residents, and it's not that we ask for the improvements to get done. They have 6 months from the time they pull the building permit to perform whatever improvements they are. All we need is a commitment, which what we ask for is a permit. I mean, it can't just say be somebody just come in and say, "Hey, I want to do this and that," and then at the end, they don't do anything. So, the only thing that we ask for is a commitment, and that commitment is providing us a copy of the building permit. They don't have to do the work at that time. They have 6 months to complete that work, probably even longer if they call in an inspection. So, it's not that they have to do the improvements right away. I mean, all we need is the building permit with the plan of whatever they're going to do, and we'll accommodate whatever it is that we need to accommodate in the right-of-way. >> They just don't know what we're building before they can determine what they might need to improve on the inside. He promised Mr. uh Alonso to have a meeting with the department, with staff, discuss the plans, and Never happened. Uh it just it just so happened that I call Mr. Abbas once in a while just to find out how he is uh due to his uh medical conditions and uh he's from the from the old guard, what we call the old guard. And uh he said, "Did you hear about what's going on in the agenda on Tuesday?" And I said, "No." And he's planning it to me and I called Mr. Alonso, explained to him, and we all decided to be here. I like to congratulate all of you. All of you, especially I don't want to say especially, but yes, especially the mayor. I think you have the opportunity to take Hialeah to a different level. Thank you. And I know you will. I know you will. So uh all we are asking and again, he is planning it is to sit with the department before this is approved by the council. With the owners and I think the process should be like it is in every other city, like it is in Miami-Dade County, is that the owners and the condominiums that they're having in that area get notified in writing of that particular meeting. But then when you start putting like I understand on our existing driveways, we're not going to change it, that you have to put curb and gutter for the traffic and the visibility triangle, but then sometimes you start adding trees, you start adding little islands wherein the people end up parking on top of them, and we don't need none of that. This is an industrial area, so we would like to save as much on-street parking as possible Okay. because for example, on the Bella Vista, which is from 16 to 18, from 38 to 39, the whole block of condominiums where you were never there because you never were a member of the FOP, but you know they were I was there all the time. So, you know what I'm talking about, that more than two cars go to each bay, workers come in, and there's no surface parking anywhere close by, so we need as much parking as we can even though we need the improvement. So, our fear is not only the reduction on overall parking linear feet that we're going to have and if the water at the any point on the elevations of the street which is not the city's fault, but if you elevate the the street to the new requirements, some of the property might end up getting flooded, so they have to know which one is going to be, so we can prepare and put berms inside our property so the water doesn't come into our parking lot. Those are things that you cannot plan and do in 1 month. So, that's our fear. Thank you. I just wanted to know and hopefully you guys can meet and uh we can come to a happy medium. Thank you. At the end of the day, this is something that's required whenever um you know, a house is going to be foreclosed on or there's something having to do with the mortgage and that the or the filing for bankruptcy, is that there has to be a check whether or not the property itself has a uh a a lien that's been imposed by the city. So, there's two types of liens. There's utility liens and there's also uh liens that result from code violations that go unpaid. Um so, Ms. Fojo and her staff are the ones that actually gather the information uh to provide in regards to these unpaid um intra interest that the city um has. So, that's kind of like the work that they do. Ms. Fojo, can you can you guide me in that range? So, if it's going to be 375, what qualifies a 375 uh charge in comparison to like a $500 charge? >> So, originally, when we passed this ordinance um that we set the 375, that research was done back in 2018. You know, I don't know how the 375 was determined, but um based on the amount of lien lien search requests that we're receiving and based on the amount of staff we need to have to comply with the requests, we thought that $500 would be appropriate. So, it's not that 375 would be like utilities and then for lien searches for a real estate purpose, that would qualify for 500. Factory Town and a company from New Hampshire, they bought all the land around Factory Town. And now Formula 1 is coming there. So, that's all being done in secret. And then this patchwork in the East Hialeah. We have the opportunity to make like a master plan and and make that bring companies like We want companies like Goya, Coca-Cola, Nabisco. This little like patchwork is not going to work. I I I shared a video with with you with some of you council of a big developer Miami. They're talking about Little River and not a pad of the new area in Hialeah. And they kept saying location, location, location. And I get Hialeah is left out. And we have great location. And that land in that area, we already lost Factory Town because that's all been bought out. And it's been a real big secret. We need to have clarification and have a plan for that. I want to show the image that that we didn't Gabriella, can you show that image? Um that the image I didn't It didn't show last last City Council meeting, which sound I hope some of you guys ran it by Brandy or or some marketing people. Okay, so right now we have fact We have Formula 1 comes to to uh Miami-Dade County. There's billions of dollars coming in. Even Miami Springs, all the hotels, they doubled the price. Everything's sold out this weekend. I hope you check because of the Formula 1, all the millions of dollars. We're not benefiting from that. Yeah, we have uh Factory Town. But the hotels Southeast Hialeah, I live 2 miles from the airport and from New Freedom Park. High Southeast Hialeah has 10 prostitution motels. We don't even have one motel. Imagine Uh if we change the name like Miami Hialeah, a developer recommended Hialeah Miami. But we need to include Miami because there's incredible change happening in in Miami right now. And we're not being part of it. The land by East Hialeah where you're proposing this, we need to do a master plan. And we need to attract the big companies, you know, we we need we need to get away from the like, you know, it's okay to have garages, people to fix their cars, make cabinets. But we need a master plan to bring the big hotels, the the big companies like Coca-Cola. That's what we really need. We're going to be We don't have money to make Yeah, I I showed what what the mayor has done so far. Yeah, this is okay, you know, but if we want to be a great city, we got to do something major. And this area that they're doing the patchwork, this is ideal area for developers, you know, so I hope you consider like the big picture where you're going to be When you're not going to be here, think of what's going to be of Hialeah.
