Moving on to number four, departmental reports. Police chief report for November 2022.
[4:01] **Kelly Lake (Police Chief)**: Mayor, Council, Administrator Owens. In your packet, you'll have the pie chart for the police department along with our Council report and the catalog. This month we had 173 calls for service: 51 for extra patrol, 23 traffic stops, 35 community engagement, seven assists to other agencies, 55 calls for service, and two medicals. We finished up all of our annual training with defensive tactics, firearms, and all that, so everybody's got through all the OSHA mandated stuff. Everybody's ready to go. Our toy drive was another huge success, so thanks to everybody that donated, whether it's a business or personal, for toys or money to fund the stuff. We've got most of the presence out to the kids and the families. We also had one of our officers participate in "Shop with a Cop" up at Walmart, so we had hopefully one from every agency in the county. Other than that, it's just been some of the routine stuff: a few minor traffic accidents with the weather and stuff like that. But otherwise, kudos to Phil and his crew and the Water and Light and everything; there's been a lot of people without power, including myself, for several days. So yeah, it's relatively quiet in the city here. Good job by everybody.
[5:35] **Mayor Jim Michalski**: You know, I'd like to do a special thank you to you for covering shifts. I mean, during this time period, I think you spent a lot of extra time working while you're almost out of power. I appreciate it.
[5:45] **Kelly Lake (Police Chief)**: Thanks, well, appreciate it very much.
[5:48] **Mayor Jim Michalski**: And thank you. Yeah, thank you, appreciate it. City Superintendent... but we're walking out, close the door so...
[5:59] **Phil Entner (City Superintendent)**: Let's just keep going here. Water department: month of November, distributed 5.7 million gallons of drinking water. We did have a couple small leaks we took care of earlier in November, got them pretty much done and out of the way. We get some restorations to do. GIS mapping stuff is in International Engineering minutes a little bit.
[6:22] **Phil Entner (City Superintendent)**: Sewer department collected 10.2 million gallons of wastewater in the month of November. Did our November discharge at the wastewater facility; that went all good. We had a couple of hot samples but nothing spectacular; this is the time of the year the way the pH comes on in the fall, it happens, but we're all in good shape. We're good to go there. Currently, we're doing some random wastewater testing.
[6:45] **Phil Entner (City Superintendent)**: I mentioned this at last month's meeting and it's going to touch on some of our significant user agreement things we're going to be talking about coming up in the future. We're just looking at certain areas of town; we're not pinpointing anything quite yet but it's some conversations we need to have coming up here. The Street Department is always busy. The road project: we have two stockings left on, but other than that, it's nice; it plows nice and smooth, everybody likes it. It's a little narrow but that's the way it is. Snow removal: everybody knows we've been busy, but that's also our job and that's what we do. Cemeteries: believe it or not, Wednesday the columbarium is showing up. I don't have a clue what we're going to do with it yet, but we're going to get it so we'll have it here. We'll get it set when we get time. We do have a couple burials scheduled here beginning of January I believe, so we're still doing stuff out there too. We're moving right along to the arenas; if I heard them, they're on all cylinders. There's games, practices, tournaments; it seems like every time we turn around they want that lot plowed and there's something going on and they're busy. So I'm going to keep it short.
[8:02] **Council Member**: And for me on the billing, you have $57,000 for this... it was on one of the bills. Did you discuss it that with insurance or not?
[8:08] **Phil Entner (City Superintendent)**: We have, yes.
[8:11] **Mayor Jim Michalski**: Thank you very much. Thanks for the good job through another storm and the crew, appreciate it. 4C, Minnesota Liquor Store.
[8:24] **Ellissa Owens (City Administrator)**: Thank you members of the Council, Mayor. Elaine's not able to make it; she's playing catch up like a lot of us. I will say she was able to find some credits through her vendors, so she's been working with them so we'll be able to apply that to some upcoming invoices. It's really nice. They, too, were closed about a day and a half. They were really busy that day when I drove by, so I'm sure they're busy now. That's all I have.
[8:58] **Mayor Jim Michalski**: Good, thank you. Under 4D, Technology/Library Department monthly update.
[9:44] **Taylor Hansberry (Deputy Clerk)**: Man, let's give it a minute... that was almost embarrassing. [Shows website update]. We have a white and blue color scheme, which I'm super excited about. I feel like just that small change made the world of difference on our website. So, a couple of things on our home page: if we scroll down, we have a calendar. You can click on this and it'll go to a larger calendar, but it just gives you the upcoming events. So all of our committee meetings, board meetings, City Council meetings are scheduled on this calendar. Over here in the news: just updates that pertain to office closings or new things that are offered like open skate.
[10:47] **Taylor Hansberry (Deputy Clerk)**: All of our city Facebook pages are linked here on the home page. One new page that was added: Public Works page. It has all the contact information and then we've got the photos of different Public Works areas of the city. We also added Inflow and Infiltration point of sale as an extension to the Public Works page. We have the ability to make payments for things like building permits or other fees online, so there's a link to that here. And then on the City Council page, this is kind of a base for all of the other committee pages. I have the members of the Council or the committee over on the side with a link to their email and when their term ends, as well as meeting information.

Everything has been updated and contact information refreshed. Like she said, overall the aesthetic of the page has been modified as well and it is a huge upgrade. We are very thankful. Thank you, Taylor. It's been a long time since it's been updated; it's appreciated. Paula, could you hit the light switch? Thank you.
[13:42] **Ellissa Owens (City Administrator)**: Just a few Library updates for you guys: the winter reading program is in full effect. Look for it in the Star Gazette; they're calling it "Yeti to Read." It's on the ALS system, they have posters at the school, goes through the end of January. Lots of cool prizes: gift cards, stuffed animals, mugs, etc. They have some other events coming up: on the 21st of December, a winter craft day, which also happens to be winter solstice. January 19th is Bingo and that's for everyone. And then the 24th they have rock painting coming back. Their next meeting will be February 13th. Library questions?
[14:41] **Mayor Jim Michalski**: That's good, thank you. Thank you. Moving on to 4E, the City Engineering report for December 7th. Did you start it? Mike, I can't remember... you can go ahead.
[15:10] **Ellissa Owens (City Administrator)**: All right, so a couple of things. There's a lot in the notes but we're only going to touch on a few things here. Forestry Road Project was talked about already. The I&I (Inflow and Infiltration) reduction on capacity memo: we'll share a little bit about that later. Regarding the Wastewater permit: Mercury minimization plan, the phosphorus management plan—that's all some of that random wastewater testing Phil mentioned. We are looking for spikes in those effluent and influent flows to see where targeted areas are. You will have a lot more information on that coming soon.
[16:13] **Ellissa Owens (City Administrator)**: Yes, we wanted to share that we have been collaborating with the District Sewer Board. We've continued to meet with them. We actually had a loan calibration that we invited them to attend. Lots of good progress with open dialogue. We've also discussed establishing a significant user agreement with them as well. You can look forward to a joint meeting here coming soon. In addition, we did meet with MSOP (Minnesota Sex Offender Program) and DOC (Department of Corrections) regarding some opportunities to collaborate on potential wastewater projects moving forward. We are planning to meet with them again in January here where we will be talking about how we want to approach the state regarding funding for a lining project between the city, DOC, and MSOP.
[17:59] **Phil Entner (City Superintendent)**: Doing a couple things with the GIS mapping system. Verify some locations for converting some maps to do more than new data into them so they can get a bid down here by the lights and in a couple boxes next year. We have to keep that going. No matter how much we argue later about sewer rates and stuff, the City of Moose Lake needs to do that.
[18:27] **Mayor Jim Michalski**: Absolutely. The permits we talked about... that was in the note for Wells. Community, do you have any word on that for the wellhead protection programs?
[18:37] **Ellissa Owens (City Administrator)**: I have not heard anything back on that. Have you?
[18:39] **Phil Entner (City Superintendent)**: No. So we've had some communications with the state. Their testing was done prior to some projects that we've accomplished as far as lining in the campground. We are actually requesting that before we would be mandated to start a whole new plan, if we can retest and utilize our current one and update it. There's a lot of things at the state level they're looking at.
[18:57] **Phil Entner (City Superintendent)**: In order to update, you have to move your wells, I believe, less than 500 feet from the existing location. That's why we're pushing this. Last time we did this... yeah, we're going to push very hard to update this.
[19:33] **Ellissa Owens (City Administrator)**: We did receive a communication from them that they wanted to start a new plan. We're just revisiting with them to make sure that they understand the proximity from our old wells to our new wells.
[19:44] **Phil Entner (City Superintendent)**: Yeah, there were I think five or six major sources of contamination that they were concerned about and we've mitigated those. Next year will be the second lift station, which I'm going to apply for that same grant I got last March. If we can do it without any cost of our body, because we all know money is going to be tight...
[20:19] **Mayor Jim Michalski**: Good questions, thank you. Thank you. Under 4F, Chamber of Commerce updates. I know there's Christmas events coming up.
[20:30] **Ellissa Owens (City Administrator)**: Oh yes, and they have hired a new Executive Director. So with that, we're just expecting to see the rollout of the new candidate hire and some update on events coming soon.
[21:02] **Council Member (Kris Huso)**: Question for the Chief: did somebody drag their snowmobile over all those blow-up things in our Christmas stuff?
[21:06] **Kelly Lake (Police Chief)**: I haven't heard of anything. I know the snow had knocked most of them right down to the ground and maybe some of the trees landed on a few, but I have not heard that. Most of them were flattened pretty much by the snow.
[21:54] **Mayor Jim Michalski**: Moving on to number five, the Truth and Taxation public hearing. Under 5A, the 2023 Truth and Taxation public hearing will be at 6:00 PM. We have to wait actually one minute after six to open that because of the laws of the state. Is there any questions on number five? So after our regular meeting, if we get done before six, we'll have to stay in the area.
[22:52] **Mayor Jim Michalski**: Moving on to number six, old business. 6A, the Moose Lake Campground seasonal camper property liability discussion.
[23:05] **Ellissa Owens (City Administrator)**: I included pictures back in here as well so that we could all understand the magnitude of the issue at hand. It has been established that the city could potentially be liable for the personal property that's left in the campground. From an attorney perspective, many cities do not allow people to leave their personal property on city-owned property outside of the camping season. In addition, there could be liability for injury if someone were to be injured on any of those items. We have received a few recommendations from the City Attorney.
[24:57] **Ellissa Owens (City Administrator)**: I wanted to have discussion about how the Council feels about letting properties stay down there. It was recommended that we contact the seasonal campers and give them a reasonable time period for removal. I just wanted to start to have dialogue on that.
[25:15] **Mayor Jim Michalski**: I think with this last storm, it's pretty much there until spring. I think Chris, you probably remember this... didn't we recommend... well, we didn't recommend, we demanded everything be taken out.
[25:25] **Council Member Kris Huso**: That's what I was just going to say, because of, I think it was the 2012 flood. We made everybody take everything out at some point. It has slipped through the years.
[26:05] **Mayor Jim Michalski**: Yeah, it's started to slip again and people are leaving all kinds of stuff. I don't think we even as a Council, we don't have to wait for an ordinance. We'll notify them at the end of this next season. That should probably go out in January when people sign up, that they have to get everything out of there at the end of this next season. I just want to make sure we get consensus here.
[26:40] **Council Member**: Some of these pictures, they have like gazebos and things like that which have cement foundations. What looks like... did they put their own cement down?
[27:06] **Phil Entner (City Superintendent)**: It's got to be blocks. I'm looking for that picture... page 71. That looks like a slab, might be pavers. I think the last director... I would definitely say we just let this slip, so it's a mess and it's a shame.
[27:54] **Ellissa Owens (City Administrator)**: Yeah, we do send out a communication to all seasonal campers here in the next couple of months. We could utilize that as an opportunity to make a statement about the upcoming season end.
[28:21] **Mayor Jim Michalski**: Tell them whatever's left will be brought to the dump.
[28:24] **Council Member Kris Huso**: I don't think we should say that unless we say they're going to be charged, because otherwise people are just going to pack up, leave, and leave the mess for us to pay for.
[28:35] **Ellissa Owens (City Administrator)**: Very good. It was also called to our attention that some of the items here would have required a building permit and the city did not receive such. If there's consensus, I will draft a letter and make sure that it's available for review.
[29:52] **Mayor Jim Michalski**: Great. Doug? Yes? We have consensus. Moving on to 6B, Riverside Arena operations update.
[30:20] **Ellissa Owens (City Administrator)**: We were notified that our Arena Supervisor will be retiring here in March. What we've done is we are looking to have a shadow to kind of learn from him in the coming weeks. Doug Wolf is somebody that applied for an arena attendant position. He holds a similar role for the school district as far as facilities management. So we are looking to essentially have Doug follow Mike and just kind of move him into Mike's role as he retires.
[31:26] **Ryan McKeon (Finance Director)**: I have a couple of updates for the arena. As you know, we've been working with the Hockey Association. The key component to take away from the new release agreement is it's $11,000 more than what it was previously, and that's intended to go towards salary for people at the arena. In addition to that, we've also had a couple of conversations with St. Luke's. You'll see this letter of intent; basically, what this states is that they are intending to enter a contract with us for $15,000 per year. What they would ask for is naming rights of the Arena. This is I believe a 10-year contract.
[32:42] **Ellissa Owens (City Administrator)**: Through negotiations with the Hockey Association, we've established a need to utilize additional monies for part-time employees down there. $11,000 annually is an increase to their contract, which is very helpful. As far as the letter of intent from St. Luke's, we will have future meetings with them. Was there at some point... Essentia approached us about doing the same thing?
[33:45] **Ellissa Owens (City Administrator)**: Thank you for asking. Those discussions also happened and thus far it's kind of been hit or miss with communication since. Upon receiving this, we have reached back out to them to see what their interest is.
[33:55] **Council Member Kris Huso**: Just a quick question going back to Mike retiring. He worked for us in the summer also. Now are we looking to make a motion tonight to hire the individual to shadow Mike?
[34:10] **Ellissa Owens (City Administrator)**: Yep, we absolutely can if the Council would like to approve Doug Wolf's hire.
[34:16] **Mayor Jim Michalski**: I would think we get him going as soon as possible. Mike's done a great job; he's been there since 2012. Can I have a motion from the Council?
[35:12] **Council Member**: I'll make a motion to hire Doug Wolf as an arena supervisor to replace Mike when he leaves but to shadow him in the meantime.

[35:32] **Council Member Douglas Juntunen**: I'll second. I do have a question—has this person gone through the background process with the city? I think that would be a good idea when we're dealing with the public.

[37:20] **Ellissa Owens (City Administrator)**: This went to the Planning Commission. The permit request is asking to facilitate an art gallery. The lot in question is currently zoned as R1 residential. A principal permitted use of R1 zoning is an art gallery. The Planning Commission did make a motion to recommend approval of the conditional use permit. One modification is the reduction of the size to 30 by 38. The Planning Commission did have discussions with them regarding making sure the aesthetic fit the residential neighborhood.

[39:30] **Ellissa Owens (City Administrator)**: We did receive one letter from Sandra Carlson. Some of those concerns were parking and visibility. That is why the Planning Commission made sure that off-street parking is something that's going to be available.
[40:15] **Council Member Walter Lower III**: 315 Lakeside Drive, is that the property being... that's currently for sale on the corner? Yes, it is. There's no way I could argue with that to encourage business.
[42:24] **Ellissa Owens (City Administrator)**: And just as a reminder, the conditional use permit does stick with the requester. If they went to sell the property, the new owners would either have to reapply or the property would continue to be R1.

Ellissa and I did have a conversation with the city attorneys and they assured us they have no concerns. Essentially, it's just an agreement that they'll provide healthcare to indigent, uninsured, and underinsured residents. All is good. I believe this also needs a signature.

[48:19] **Ellissa Owens (City Administrator)**: I received this request from Dave Arneson. As it stands currently, the city has a park dedication limitation imposed on this particular lot. What David's requesting is that we remove the park dedication.
[49:10] **Mayor Jim Michalski**: I can give it a little history. Remember when this was done, Chris? When we did this addition, we thought there may be more families with children in that area, so we designated a small park area. However, families did not come into the area like we thought, so we never built the park. I have no problem myself that we take that designation off.
[50:01] **Council Member**: What's the point if it can be built on with a home?
[50:10] **Mayor Jim Michalski**: We can't do anything else with it unless we come up with an extra $50,000 to build a park. If we take it off, they can build on it. The city does not own that property; it's just the designation.

[51:10] **Ellissa Owens (City Administrator)**: It's been determined that modifications to the building and grounds need to be approved by Council. It's been agreed upon by the Historical Society to give one of these storage closets to the Masons. They'll be essentially just connecting in the center with one wall and one door. The Historical Society will be covering the cost of that.
[53:04] **Council Member Douglas Juntunen**: In the letter provided on page 101, it states "we will honor the requests of the Masons with your assurance that the new release will be written. If a new lease isn't approved by all parties, this will not take place." Is that my understanding?
[53:15] **Ellissa Owens (City Administrator)**: The new contract does have to be established, but the modification can be done immediately. I was informed from the Historical Society that their board did approve it.
[54:37] **Council Member Douglas Juntunen**: I guess to me, as a member of Solomon's Lodge, I don't feel comfortable with this letter even being part of any discussion. I would make a motion that the building modification be approved.

[58:05] **Ellissa Owens (City Administrator)**: Under 7I, sewer fund balance discussion. We did know as of the last audit that the current sewer fund balance was right around a million dollars. Phil and I have been working on establishing a threshold. We are looking at an $800,000 threshold.
[59:40] **Mayor Jim Michalski**: Just for information, I can't remember what year we did this, Chris, probably in 2010 we set it at $500,000. It's time to do it because we've been spending down since then.
