okay it's 5:30 and we have a full work session agenda so um I'm going to uh call the meeting to order this is the uh work session U meeting agenda or meeting for inista city council present this evening as uh our chief of police Paul fall Sarah s Sala our um expert in legal issues and uh then we have Brian Grim who's a finance director Jasper kral administr Lisa whan um cath Kathleen rekin an McGregor Peter Vick Claudia Lacy we're all Council people and then we have um had to make this a little fun right and then we have a our um expert in engineering Alis and fski and then our expert in public works we have Gary Peters we have where is where is he where is that and then we have Ali pus director of administration and uh City you're not an expert sorry and then we have an um Myers Meer Hoff thank you all right so we have a budget work session discussion arpa update Barking Dog ordinance um and then copper service education campaign update so we're going to start with budget ran yes mayor and Council so I think uh you probably saw on the work session pack which instead of being duplicative um I just pretty much reference the uh the documents that were in the um Regular meeting packet and um I guess yeah the purpose of this um item on the work session is probably just to uh Council to have any comments suggestions questions and and Talk Amongst uh their fell fellow council members and colleagues as far as what they um thought of the uh budget Levy fee schedule documents I'm sure everyone saw the levy was brought down from the uh preliminary Levy of the 15.1 net Levy okay I'm getting a thumbs up that's good so we like that um to basically 13.8% um that was done through reducing the uh general fund um Levy by 50,000 and the roads Levy by 25,000 and it's still allows us to have a projected 40% general fund balance fund percentage at the end of 2024 because with some now that we're later in the year we can see our our building permit Revenue stayed strong and we should have projecting a $325,000 surplus in the general fund with that includes putting the2 200,000 of the onetime money into the general fund the other 172,000 in the capital fund so that's taken to an account so it's not all 325 just straight Revenue over expenditures it's that money that the state authorized this year um so I think that's the highlights I guess as far as um good job you did a very good job so I have I have um I have a couple suggestions and you're going to like this um so I talked to uh Brian and I talked to Allison and I talked to Jasper today um our road projects are coming in substantially under estimates I mean which is always good we're really happy about that and as you saw in your packet we have 142,000 um under budget for North arm and and Allison you can correct me if I'm wrong you said we're about a 100 right now about 100,000 under for the re Recon project and we're about 200,000 is that correct under for Mill and overlays those are correct okay thank you so with that I talked to Brian now what we need to do is we need to carry a a a fund balance in our debt service okay and so I'm suggesting that we carry at least a $200,000 Debt Service um fund balance for these projects but I'm suggesting that we take a $100,000 and put that towards the levy to reduce the levy and if we do that um it sounds like it would be about a 12% increase now the reason I'm I'm suggesting this is because bring it down it would bring it down right now it's at 13.8 it would make it to around 12% 12% the reason I'm saying this is because um last year you know we said to the um residents metaphorically of course um we're leving this amount for roads because the road projects are estimated to cost this much this is what we're anticipating having to spend and because we didn't have to spend that much I feel that we we're obligated if you will to kind of say okay we didn't have to spend that much so we're going to take some not all of that but some of it to reduce the levy increase for for 2024 having said that we still will have a very nice um fund balance in our road Improvement projects and then next year we'll add we'll have to add to that and and but this way if we do 12% this year we might only have to do eight or % next year or we could do 13.8 this year but then we'd have to maybe and then maybe only do five or 6% next year the following year but I think it's a nicer nicer flow rather than going up and then down and then up and down if we can kind of keep it a little more level that's my Spiel oh I really like that now I have a question when we get those estimates in the mail I have mine with me when we get those estimates in the mail if we are reducing this does that mean that very definitely across the board that the taxes on there for Minista will go down yeah for the city portion yeah basically right now what everyone got was about the 15% increase from the city so if we adopt the final Levy at about 12% fantastic Wonder a 3% reduction on average home is probably you know4 $45 for the year so something it's not much but it's the percentage too that I think people look at and then they go oh that's that's so much and and again I just feel obligated that if we didn't use all that money this year that we should apply it for future but we still need the money we still have to pay off the bonds and the debt and that's included in the 12% increase yeah right but yeah so the only I mean I guess the one thing to make Council just I mean just to be clear on is that so we really I tried to use the metaphor I think earlier here we don't have all the in for the project till next spring so it's sort of like you know the uh Kenny Rogers The Gambler you got to know when the until the deal's done or something the count something like that I used to listen to more country music so um but I would like to I'm okay with probably maybe like the 100,000 I mean the standard way to do it on these projects is we have our capital projects fund we get everything closed up we'll be able to do that next spring once the mill in overlay and the Reconstruction are done done and then we'll be able to say well we've got 300 or 350,000 left over if we're proposing doing three or 350 I would say no way I guess right um but we have 450 right now estimated over um but what if the are wrong well they're not going to be that far off and that's why we're saying well I think I think the 450 some of that I think Allison had some of that included I think the water main so I think the tax levy dollars it was closer I thought to 300 350 or something I I think until we get all the final dollars and that's where we're talking and high level numbers and that's where if we start to go much above 100 I mean the the standard rule of thumb is you close out the capital project fund you send the money to the debt fund because basically there 20e principal and interest payments we have the assessment Revenue going in there we had you know almost more prepayments than we thought so we're going to potentially lose a little investment Revenue so that'll be factored in but the the nice thing about having a balance in The Debt Service fund is it allows in future years our future councils can maybe be we're supposed to Levy 350 maybe we can reduce that debt Levy by 10 20,000 each year or you can maybe pay off the bonds a year too early so there's so there's some should be a balance so that's where if we maybe up to the 100,000 I'd be fine with if we start looking above that and I agree I don't think you need to do more than that um but with a $450,000 let's say projection right now um that would still give us a $350,000 well but he just said some of that as the water so it's not part of the general so of that I think it is mostly May will if I may just provide some um so when I started looking at this today I look at these numbers in engineering standpoint so I I lump everything together and um with with Brian's position under finance that we need to start looking at parsing things out so um I looked at it at as an aggregate um I think what we're looking at from the Reconstruction B budget um as far as where we're at for streets and storms were we're we're trending to be it'll be under $100,000 Delta between um what we budgeted and what we expect to see um I Heard council member refkin ask about like well what about the what about the costs for the remaining cost for the mill and overlay and the Reconstruction project great question so where we're at right now with the mill and overlay project Project's been complete since the summer the reason we haven't closed it out is some of the restoration hasn't taken now um you know as far as are there additional costs that will come to the city from the city to the contractor there might be a little bit um certainly not to the magnitude of you know $200,000 um with the street construction project um and I'll provide an update um under the regular agenda but we've the the contractor completed the majority of the work the work that remains in the spring is planting some trees and some restoration items so not big ticket items like the sewer and the the water and and the um curb and gutter and and the pavement so um there are some expenditures that we're anticipating in 2024 again and so we we kind of took the Reconstruction project if you will out of that conversation um as far as what the the the cost under runs are anticipated for that project so um I think when you look at the Reclamation project which is on the the regular agenda this evening for closing out and we look at where that project ended up um compared to budget um there's some comfort level in in looking at um reduced applying that um cost underrun to the uh to the um to the levy amount well I'm I'm looking at it more um all of those numbers together and so even if you leave the um North arm alone and you leave the Recon alone we still have 200,000 under budget for the mill and overlay and about 95% of that is complete so even if we have more um expenses for that in the spring and we're only going to take a h 100,000 of that we still have 100,000 left and and basically think about this we're going to make history when does government ever give you back any money not giving it back just take because we didn't love you as much but that's okay I mean it never happens okay but so if we do this yes next year if something happens and we have to go to 10% you going to be okay with that yes I will be because basically it never happens that we that you ever see government do this and I think we should set this precedent give some money back didn't said anything well we did we're hoping that the number we were at 15.1 and now we're going to go down for we haven't taken anything to give it back that because we're preliminary we went down that's not word Smith we're taking less we're taking less there you go we're taking less correct but Peter Peter I know you want to say something oh yeah no I um yeah I'd like to get down to the 12% increase and I get what you're saying and I realize it's just shifting things around but to try and keep that as I 12% is a pretty big jump you know just by itself so uh if we can take less that's nicer I mean you're not we're not giving no it's fine I'm just as I said last year when we didn't love you as much for the roads then we did have to go up to 15 this year which came down a little bit but last year when I said no we should keep the road number the same and we didn't we had a huge increase this year so it's the same logic of okay fine but next year this year we only had a $25,000 increase it went from $875 to to 900 this year and the year before it was yeah but we were supposed to go up from 900 last year and we went down instead we went the wrong way we we have been building up to a million for the row we went down from it no I don't I don't think we did did we I think we went we were at 875 last year for the levy just cash for 23 yes and then for 22 I think we were at like 100 at least I thought we were like 125 yeah where we at at 775 well that would have been I think we were at 700,000 right or 3 we were a little over 700,000 7252 we we've been going up when you're Reon and then so the 900 we wanted to be at a million for 2024 so we'll we're going to be less than that so we'll be at a million in 2025 but looks like so okay I just brought up the slide so it looks like we um did um 725 and 21 875 and 22 held at 825 875 and 20 I think the rationale with holding and um at the 875 was um 23 was knowing we were going to have the bonding bonding coming up yeah right I'm just saying we're going the wrong way when the original plan was to get to a million so just just FYI like we're we're going the wrong way on the cost of the roads when the bills are going up that and I'm all for giving not taking as much of my own money I get that but if it just means next year it's going to be even more because we didn't do it this year I don't like that well what is what's going to happen is we can take it now okay and then we're going to have this huge fund balance in our road in our road um Improvement um fund or we can take a little less this year and then we can take a little more next year so that's why I'm talking about the 13.8% we can bring it down to the 12 and then in 2025 rather than having let's say a 6 or 7% it might have to be8 or %. so it's going to be a little more even rather than having up down up down that's so yes eventually you're correct we have to pay the piper we have to then raise it up again and so that's a good point to make and we have to be aware of that but I'd rather have a 12% this year and a eight or 9 % the following this year next year and then 89% the following year versus nearly 14 and then yeah seven yeah I would [Music] to bird in the hand I say right yeah take Les right so when we got to the agenda at the regular meeting then we just basically said a six million 618 we'd be 6 million 5 and then you we just the road maintenance would be the 450 plus we're doing remember the 350 for the the 2023 project so we'd basically be at $ 800 for total rad dollar versus 900 plus whatever we have in our fund that's the other thing is because yeah you probably saw in the budget um that assessment revenues gone in there for those projects we didn't bond for so the the road maintenance fund is up you know around a million million and a half or so so that's the other reason so that's where it's a little more press to redo a few years I mean it's probably yri probably has things to definitely to spend it on it's probably never enough or whatever but um right but yeah so but I a balanced everything but I mean if we we'll be have we have nearly a million in there and next year we're not going to be doing any major project we're going to be Milling overlays and stuff half a million or so so I think I financially I think we're on the right track so okay yeah that's I guess is there any other comments so that so we'll do that one that item comes to the regular meeting obviously we'll make a note that um that's there's consensus to bring that down by 100,000 whoever wants to make that motion or whatever can do that um is there any other comments on the uh budget and or tax lby or or fee schedule even or I guess or anything else while we're talking about it I know you want to talk about the fee schedule now or do you want to talk about it it could be at the regular meeting too that's fine or whatever I just thought just was a to I know there's other items on the work session too or whatever so um obviously the tax Lev is one of the biggest pieces but if there's any fee schedule items or anything else EI either way I guess that's well let's talk about fee schedule at the regular meeting okay because it's not on the agenda for this so um we'll bring it up y okay okay ARA update um yes so this one I guess this um a quick question more for reporting purposes whether the city council is fine with sort of reallocating the dollars that were allocated to the well we had we had allocated about 500,000 to water back then when we did C you know the broadbands the roads and the uh the water and we spent a couple hundred thousand on the test Wells um so I guess what like what staff's recommending is the remaining dollars that's left or allocated to water whether Council would be okay with allocating those towards the water main projects both eligible projects and then being able to final file a final report in March of 2024 or whether Council wanted to still leave that for the wells and then we'd have to just file the the Broadband stuff this year because we've already filed the road dollars last year we did that for the Jennings Road Project basically Brian all it is is a matter of paperwork it doesn't really matter doesn't it yeah so I guess is that okay as far as I mean right just being able to close out our arpa fose out of the arpa funds yeah okay right and yeah that would just be save one last report and and whatever and be able to just tell the feds we've spent it all which I mean we have obviously done a lot of infrastructure projects whether it has been water cable or roads or whatever so um okay as long as everyone's okay with that then I are are you on board I mean do you yeah I'm fine okay all right okay okay and then um our dog ordinance I'll let Jasper yes uh thank you madam mayor Mayers of council or members of council um I think a lot of council members probably have gotten emails from various residents um about some Barking Dog uh citations things like that that we've seen over the last probably six months or so um a property owner came in I believe a couple months ago um and gave an update about the the barking dogs the intent of tonight is just to provide an update to city council about what's going on because it this is taking probably longer than what I think everybody expected to work its way through the legal system and I've been speaking to our prosecuting attorney Kenneth pots who's who's looking at this as well um basically there's been some citations issued those citations are being challenged in henan County uh Court um there's various filings happening um I guess the gist of it is that it's still working its way through the process um there was a brief filed I believe on the the 28th of November from the defendant um our prosecuting attorney has until no uh December 15th to respond to that brief and then the judge has until um I believe January 15th to re respond to both the briefs and make a a ruling on if the cases are going to be dismissed or if it'll go to a trial so we're waiting for that process to happen um I know we're still getting complaints or comments and calls and you know things like that so we just wanted to if there's any questions Sarah's here she kind of is the ordinance Guru Paul is the the the enforcement side who deals with this um his people deal with this so if there's any questions about this we definitely can we can talk about them um but it's more of a hurry up and wait situation let it get through the the legal system and then depending on that outcome we would like to have a conversation about our our ordinance um I think our ordinance from our police enforcement side is is clear and we can enforce it uh but we're going to wait and see um what happens in the court system so I can entertain any questions or and we have uh Sarah and Paul here to also help out if they're specifics I have a question how many how many U neighbors have complained I believe there's been three I believe that's correct I know there's more than one but I don't know I believe there's three I think there's one on the north side of um West Branch one directly adjacent and then one just down the road so I'm not sure if city council you've had multiple people reach out I don't know if you know for sure but I think from a standpoint what I've been under under the understanding of it's been three I've talked to two people okay and uh [Music] and how many citations have been issued I believe seven and uh that was as of probably three weeks ago two weeks ago something like that I don't know if there's been any additionals that sounds correct my the last time I checked it was six or seven since April yes um so I I had a conversation with uh Miss Anderson and I was just wondering there there hasn't been any complaints for many years from what I understand no complaints for many years and then just it's been recent is that correct it's been within the last six months or Claudia could I make a suggestion if you have specific questions about the incidences I would highly recommend that you talk to staff I don't want to discuss the case here because it is um under litigation I'm sorry is that Sarah is that maybe I don't want to hinder you from asking questions but I would highly recommend maybe asking staff questions Sarah is that maybe a good idea or U Madam mayor members of the council um I guess you know the data relating to this specific case would be considered uh criminal investigative data so and that's not public under the data Practices Act and could hinder the the criminal thank you investigation sorry no don't be sorry I I just was under discussion so yeah yeah sorry thought I would ask so we do nothing until it comes back from I would say so I think we'll report back once this kind of works its way through there could be you know it could take longer than January you know if it would go to trial I mean who who knows could be this spring uh by the time we get uh conclusion to it and then at that point we can provide an update and if there's something that we need to do as a city we we will do it we'll make some recommendations if there isn't then we'll just give the update and everybody will kind of understand what's going on and if there's a of any future considerations we'd bring that to council too so right now it's we were anticipating potentially knowing more at this meeting but because of some just delayed Court filing things that you know it's just not it hasn't occurred yet so the original court date was in November that's why we had it on the agenda for December but because of some requests for delays whatever if that if that clarifies it Madame mayor if I can just uh provide a little bit more clarification as to the roles here I think I know that it's frustrating for everybody involved um that this is taking so long um unfortunately our job as the police department is we get the complaint we go out and investigate it and then we take action and then ultimately people have the right to go to court and then the Court decides whether or not they're guilty or not once we issue that citation and it goes to the court we're we're done with it and then it's in the hands of the court so we don't really have any say or control over how long that takes or how quickly that goes through the process so we're kind of in the same boat as everyone else just sitting around waiting to see what happens just so we're clear that there's not much we can do at this point but wait even though I know that's very frustrating for everybody in general not pending this case do we get a lot of dog barking complaints uh I would say we get a fair amount of barking dog complaints but the vast majority of those are resolved very quickly and and are resolved before they get to the point of a citation um and the circumstances certainly vary depending on location certainly we we have some very densely populated areas and then less densely populated areas so it varies quite a bit but we get a lot of complaints [Music] yes all right okay so next update is the um copper education okay Gary um Madame May Council yes that we every 3 years the city is required to by the Minnesota Department of Health to do lead and copper um testing in households we put out on the website um and to previous people that have done testing to ask them if they'd be interested we need 20 households so we did get 20 uh took a little bit we did get 20 the results came back and unfortunately we did not pass copper um the threshold Le is fine um at 15 parts per billion the highest we had on the testing was three um everything else well below um they throw out the high and the low the copper we did come back with um three relatively high so they throw all the two high but we still end up with one so technically we have failed so what that means is uh well I should probably start with the water testing itself how this is done is we contact the homeowner we drop off a sample bottle with a with a letter and a form that they need to fill out which if you see the highlight of thing in this form that's all the stuff they did not fill out for us thank you very much so we had to go back and try to get that but we're also asking them to take samples are these samples collected properly we don't know we're asking a homeowner to do this to turn this in on it's you know it's on it it is on them to do it right we're hoping they are because it's very important the water has to sit um stagnant or stale in the system overnight and basically before they do anything they're asked to go to their kitchen faucet which is normally the cold water which is normally unsoftened hard water that comes from a system take that first leader out of there seal it and give it to us um the next day we have no way of knowing if it was done right um what frustrates me is we can't have these retested before we have to publish this which is really aggravating us but no matter what so we've been told that we have to do a public education um by December 6 which uh a2s has been working with us it's basically just a a brochure that has to get mailed out to everybody um telling us telling everybody what's going on with the system what it is um so and after that we have to make the all these results we mail them out to the homeowners and then as I call it punishment they don't um but we have to take 40 samples every 6 months now we had a hell of a time getting 20 I don't know how we're going to get 40 to me if your house is built before 1986 that's when the EPA said hey no more lead solder being used in homes if your home was built before 86 and you're getting a free test I would take this not so much for the lead but for the copper too I mean lead is definitely important we have one lead service that we know in town um and if does that house have lead piping we don't know but we know we have one lead service you know in the house everything else is copper everything new is copper plastic so we're fine there but to me most of the houses that we've tested um 62 61 65 72 70 uh 1948 uh we have 2003 97 2006 so we've got a you know a nice average in there so what uh we don't understand is is the the two samples came from a neighborhood that had uh 2 four five six samples done in that neighborhood two on one street were extremely high the other four were way way low which and they were built the same time yeah which is very strange to me how you can have such a variant one block over um tells me that there are some sampling issues is what I would think um um I'm positive that we're going to have to with these higher samples to to resample and I'm fine with that we've done this in the past we had some extremely high ones and even though we passed we had the residents ask if they could resample we resample we send them all to Pace the city picks up the cost it's not super expensive I'm assuming we're going to end up doing this again with these guys just to you know find out for sure was it a sampling error or what you know to help them so um but notice will be going out and I'm assuming that once this all hits it's going to really trigger some phone calls so unfortunately um same thing happens when uh the mananes letter goes off from Mound since we're an interconnect they have to send it to our people so right away we get in inate with phone calls is our water safe is our water safe yeah we you know we treat for all that we do add a um a chemical in here to help um you know curtail you know the bleed off of copper um a2s looked at that we may be changing well we most likely will change to a um a little bit more expensive product for the same company um to help better uh do this so I say the first step will be to get this brochure done um and sent off to everybody in it's the entire water system which is so Gary that's the other question because we have basically two separate Water Systems it has to doesn't matter it has to go to everybody even though even though it was on the south end that failed the North End gets it too oh how long you do the testing every six months for till they say we pass it could go for two two to three years wow yeah it's hopefully it doesn't go that long I mean there's you know some caveats to it if we can get um even they we they could let us go on the on the first round if they wanted to but I foresee us probably going you know at least 6 months 6 months and then probably year you know again and maybe even another year before we go back to our threeyear status um this happened in 2017 we sent in 20 samples they failed us cuz they only had 19 we know we sent in 20 the box was full two boxes actually were full so somewhere along the way one got lost we have all the paperwork that shows 20 samples went out but yet they failed us we were not happy so we ended up having do yearly for two years and then we went back you know and everything passed everything was good On th on those years we've always passed this is the first time we've had this so and it's on the copper side which is it's still not good but it's better than if we would have failed lead so but yeah so I mean just want to make you aware of what's going on and the testing procedure and according to the Department of Health they are looking at how it is quote unquote the tests are taken and reevaluating how to do this which they should right cuz I mean you're you're asking people that are not used to taking water sample you know to take a sample so mhm but just wanted to update you because I I guess I you know once this uh gets out to a few neighbors everybody's going to hear it and we're going to get phone calls okay so 40 samples you need are they do they have to be in a certain area or just anywhere they can be anywhere but they can't be from newer homes um the newer the home I mean some of these homes too could have just put a new faucet in so your new faucet would have a higher you know content of copper in or something you know um newer homes all have pecs and all that but with the newer fixtures and stuff like that you can still get some bleed um they're really what they're really looking for is those older homes you know anything especially before 86 but anything especially before 2000 how many homes do we have that were built in the southern system before 86 not very many not too many there I mean basically the County Road 44 area you you're shady um Shady Margaret and um Lake View are really the only ones only ones yeah that are in there you know that are that are before that so M mine was 69 yeah but you're on your own well system you're on your own well system so but yeah I mean we have you know very few I mean that's you know we do have a lot on the North End we have more on the North End a lot more in the north end and they all passed oh so so just take them from the north end and the ones that you know and the two that didn't pass were 2003 built wow so good figure yeah so yeah so I don't know I mean and like I say the the neighboring ones were 2005 2006 2007 and 2004 so I I don't know and they all passed and those all passed yeah and we have one on the North End or one you know one other one on the south end that was high everything else on the North End was you know the highest one I'm just looking here on the North End was um 234 out of seven out of 1300 you know 1300 parts per billion so that was you know the highest one there there was a 1280 but that one gets thrown out because it's the high you know that but okay yeah they're all within so okay huh all right go figure we figure out what we're going to do with it so we may end up having like I talk to Brian we may end up trying to give him a CIT talk to Jasper too you you give them a credit to help you know to you know hey we'll give you a little water credit you know 20 $25 water credit you do it to me like I said if your house is built before 86 it's a free test get it done I mean it's you know there's no sense not to right would you like me to test my water I could give you a sample actually we have a lot of people on the well system when we publish it that did call it wanted to know how they could get that done know do you know what these tests aren't cheap no they're not I mean and that's you know I mean it it's something that we get charged for the first round but now these second ones we will through Pace I mean because it's through the Department of Health and I mean I shouldn't say it's free but I mean we pay for that through our fees to the Department of Health and all that but so all right thank you Gary sorry well ain't much we can do about it so I say a2s will help us you know get the right chemicals and in the brochure can you say it was on the southern system they will give us they they give you the parameters what you have to put in the letter and what you have to put in the brochure okay here's where your space you put your name in your water system in otherwise everything else gets word for word what they say okay so too bad okay thanks it is what it is I mean we can you know we can put the once these get mailed out we can put it on the website and we can kind of explain hey it's the South End you know and we can kind of you know let people know and I'll let the front desk staff know too what to you know cuz they're going to be in with calls you know kind of how to explain it to them and right and what's happening so the brochure can you put this really only applies to older homes so everyone in my neighborhood doesn't yeah really yeah I mean and and we'll let and you know that's a good thing that's a good suggestion too we'll probably should let the um the management companies of the HOAs know especially like for your neighborhood there because yeah the newer homes I mean we had people call and wanted to test your new homes and there's no sense to test new homes I mean like I say there's very little copper in them anymore so it's all pecs so it's all plastic piping so you know the good thing with our system is we have no lead actual trunk lines we have one lead service that we know of um which is the oldest house it was built way way I think it was early um probably the late 19 or early or uh 1900s sir so we have they're on City water and they're on City Water they've been hooked up to it yeah so otherwise everything else is all you know Mainline copper plastic going in so yeah where is that is that home you don't have to get the exact address an idea it's on the North End yeah yeah I know okay so it must be okay anyhow um all right thank you any other sorry I had better news for you yeah questions Council all right um that concludes our agenda I
