all right Madam chair we are recording at 7 o'cl right thanks for your patience we're going to call to order the meeting Planning Commission meeting for January 4th 2024 we're going to take roll call commissioner horn here commissioner Vanden here and commissioner brummond is here and lanterman and Lind are absent and we're going to go ahead and stand and say the Pledge ofing in progress I pledge of allegiance to the pledge of the United States of America and to the repic for it stands one nation God indivisible with liberty and justice for all all right and then I'm going to ask the Commissioners and staff if they have any amendments to tonight's agenda and if there are none then I will go ahead and take a motion to approve tonight's agenda here all motion to approve the agenda second all right so moved all those in favor say I I all those opposed say nay okay then we're going to go ahead and O open up the open forum and this is an opportunity for members of the public to comment on anything that is not on the agenda for tonight so if you have anything that you would like to bring before the commission um you may step up to the podium and do so and then natal Natalie will give directions to those who are online if anyone's there um I do a that might be an old agenda that you're reading off of chair bremond oh you want to do agenda approval no no no just to be clear we are we are no there's a policy that's been set up in place that we're no longer taking comments over Zoom um so Zoom is just for viewing at this time uh but anyone that's here in person is able to attend or to step up to the podium for comment okay excellent thank you okay and if there's no one here who has a comment then we will go ahead and move on to approving tonight's agenda uh minutes minutes oh you know we didn't yes that's right we did okay thank you so is there anyone who has anything to say about the minutes from December 5th 2023 otherwise if not we'll entertain a motion to approve the minutes I'll make a motion to approve all second all right so moved all those in favor say I I all those opposed say a okay and that takes us to our only new business tonight which is a public hearing for the minks preliminary plat and variance and we're going to start with the staff report thank you madam chair this is the public hearing for a preliminary plat called minks Edition and it also includes a variance next slide uh lynon minks is the applicant and he is with us tonight um he's requesting to essentially adjust a shared lot line [Applause] between these two lots he's proposing to adjust the Western lot line of the Southern lot so the addresses involved are 7005 Old Settlers Road that's lot one on the new plat it's the northern lot and then 6925 Old Settlers road which is lot two on the new plot which is the southern lot the request also includes a variance to allow a reduced lot width as measured at the front lot line for lot two a little bit of background the applicant does own currently own both properties the properties were originally subdivided by the applicant in 1987 but it was not handled through a formal plat or registered land survey uh the so the division allowed the applicant to carve off roughly six acres at that time for a single family home which is now 6925 Old Settlers Road next slide this is the new plat uh so again it's pretty much just making a lot to little bit bigger um extending that lot line out further west for the preliminary plat The Proposal mostly complies with our standards uh again lot with for lot two is only 26 feet where 200 feet is required so a variance must be approved to allow that um some additional changes that will need to be addressed as the application moves forward a 40 foot half rway is required for old Settler's Road and that needs to be is not currently shown on the plat the driveway to serve Lot 2 crosses the shared property line lot line which is the north property lot line for lot two and starts to encroach a bit onto lot one so the applicant is given one of three options to address this they can either adjust the northern lot line for lot two to entirely Encompass the driveway uh they can prepare and record a private easement between lot one and lot two so that that carries forward with any change in ownership in the future and then or they can correct the driveway so that it is entirely within lot to as proposed regardless of which option he chooses a formal encroachment agreement will be required with the city as it is within our dmu easement much more than what we typically allow for for a driveway so it's just agreement to understand what will happen if we need to access that area for some reason additionally we'll have to uh apply the Wetland buffers and Monument signs currently required by code so that would be something that'll need to be established as this moves forward for the variance uh staff believes the application meets the standards and practical difficulty standard for variances uh essentially because there is not enough Frontage between the two lots for each lot to have 200 feet at the lot width the Lots were subdivided per the zoning ordinance in place in the 1980s and so it was not foreseeable to the property owner at that time that our rules would change to prohibit the creation of flag Lots so staff does not propose any conditions of approval for the variants in the draft resolution theoretically the Planning Commission could choose to recommend that the northern property line of lot two be adjusted a bit further north to fully Encompass the driveway as a way to minimize the permanent protection granted by granted to this non-conformity through the approval of a variants however again staff's not recommending that we make that change because I think there's a couple other options you could choose as well uh so staff recommendation for the commission is to open the public hearing and take testimony staff recommends approval of the plat and the variant with conditions of approval as outlined in our resolution and the Planning Commission can approve the draft resolution without changes uh or propose desired language to be used um or can recommend denial I will note if the commission feels that the variant standards have not been met then the preliminary plat must be denied as well with under that law prict and again that's recommendation of denial okay thank you at this time we'll open up the public hearing and so that means that anyone who's here and wants to make public comment regarding this specific issue is welcome to um come up to the podium and state your name and address and then your comments if anyone is interested okay and if not um I would take a motion to close the public public hearing a motion to close the public hearing I'll second okay and all those in favor say I I I and all those opposed say nay okay and then now we're going to go ahead and open it up for commission discussion and recommendation is there somebody who would' like to ask questions or share their comments first yeah I I was um I mean so the 26 feet is is what it is today yeah that's no change um and I I know we it mentioned somewhere in here that you we don't like flag Lots mhm I was curious from your guys' perspective like had is there a is it just curious like why not just push it all the way to the back like so then it's no not even a flag lot anymore I just like um I I own all the land also Brown's old land to West all the way to uh por I 115 Acres too I see so that adjoins and I bring I can bring my equipment through there for farming back through there and it would all adjoin through that back area there I see I kind of wanted to keep it that way I now have just a shed on the one p number yeah that's it um there my daughter that lives in the house and her husband for the last three years just right now the back line goes almost to the swimming pool on the back of it so I fig before I'm dead I better figure this out for we do sell it to him and it's two different ownership it's going to be a mess yeah and I really didn't know it would be this much complication I should have known when I said the Kindra word but you know we over the years um back in 2003 we started the process and it was probably up to $3,500 to do it and I just gave up at then well I was in with Ken streer going through the preliminary of buying the other said properties the 115 acres and I saw Kendra and I said hey have they streamlined this yet with this oh yeah yeah it's really yeah really good well she didn't realize with the driveway and neither did I until I got deep into it that that was a problem you know she had just said yeah it's dreamline I said great that was a good time to do it you know then I got into it and I'm like oh boy here we go again super streamlined I was Cur that was one of my other questions what do you guys want to do with the driveway uh I don't know this is kind of the first I heard about the driveway should I have known about the driveway before I provided the staff report to on the 22nd and I probably didn't read it so um cuz I'm guessing if you moved it in it looks like just based on this map and there's trees my neighbor planted and they're not they would basically have to rip those trees out to well and that's my neighbor's trees and now which are on your line technically line I know he saw where the steak was when it was surveyed and didn't I mean I get along everyone but I'm like oh man they put some trees in back then when they you know now and I think the may I mean the so again there's three options he can either adjust the bump the lot line just a little bit out so it's fully encompassed or he can can do a private easement to kind of keep things where they are it's just a formal agreement between the two lots should ownership ever change should his daughter there's a well I was I wasn't sure how close that does the line get too close if you were to bump it up does that get too close to looks like there's a well by the shed there that service cuz all a sudden that'll be the next thing oh there's a well you got to you know I can just imagine far from the lot line known I don't believe so because the where the encroachment is it would be far enough from the well um so but yeah I think um that that is one option if he doesn't like that option then they can do a private easement permanent the private easement because he owns both he just get done and if should there ever be a Cell between either any of the Lots then that would carry forward until both properties agree to get rid of it usually those easements provide the conditions as to how it would be handled in the future should someone want to vacate it or he corrects the driveway so I think even if he doesn't if the lot line is not feasible to be changed then there still is an easement even if there's um really no desire to correct the driveway and I understand that was probably the most intensive option but it is still an option yeah yeah so um I there that this point it would I don't I'm not concerned about his ability to meet one of those and still be in compliance with the resolution okay I think that's and then just to clarify commissioner vanon if we could put I have been Q Power so the flag isn't this isn't lot one flag lot is lot two down here because you have this little bit of Frontage oh and that's considered the flag L yes y just just just for clarification no I appreciate it yeah I guess yeah I was assuming the other one was lot one yes you have this teeny tiny flag pole with a big FL pole okay so that so the so the L is fine the L is L is fine a flag lot is when there's a skinny and it doesn't meet the minimum Frontage so technically have something shaped like a flag if it meets the 200 ft but we call it a flag lot when it doesn't meet the I see now thank you that was it for me I didn't have any comments at all make sense as logical to me it's just a process you need to go through to accomplish this so yeah um that shared access he even private shared access even probably cheapest and easiest way to accomplish that driveway thing so just be pretty easy to put that together but I didn't have any comments and the only question that I had was the Wetland buffer Monument signs is that triggered simply because of the preliminary pla because of the plat okay and is it just around that main Wetland that's in the front it's around all Wetlands on the property you have to do the bu everyone that is considered like cuz there were some that were mentioned as like potential medium quality no so it's just that there's different setbacks I think there we were saying all of them are medium quality there is a process if if the land owner disagrees with that to go through the state to get the low quality otherwise it is assumed to be medium quality um and the so with medium quality Wetlands there's a specific like high medium low there's different buffer requirements okay so um but all of these would be treated as medium at this point and it requires private signage yes yes so um okay we can't release it until we see the signs and then and then what happens after that point happens and that's any Wetland as a part of any plat in the city correct correct yes yeah okay that was my only question otherwise again I felt like it was uh straightforward and and um made a lot of sense so I don't feel like we need to tell you which of the three options that you can do in order to approve the variance um because I think you'll uh you should have as much uh choice in the matter uh doing what makes sense for you um so with that being said I would make a motion to recommend approval um of the preliminary plat and variance I will second it right all those in favor say I I and all those oppos say nay okay we will the recommendation will go to the Council next and then they will give you the final approval now yeah thanks for coming out tonight um and then we will just move on to any other business that we might have is there any planning project update that staff has for us um so the only thing I have for you tonight is the mayor wanted me to touch base with you as a group to understand if you were interested to doing a joint work session with Council I know there was a work session last night to discuss goals and I haven't quite um been caught up to speed with that discussion but I think at one point the idea was in addition to the one that's coming up for our commercial District update also having one where we're discussing goals potentially having some training that's not necessar what the mayor was saying but um me and the new city administrator thinking maybe just to maximize it maybe that include some training too um wanting to know what your availability is over the next few months if that would be something that you're interested in essentially I would be interested in it um I know yesterday's meeting was a Wednesday and it sounds like that's probably not going to be the you I don't know I think there was there was just something with the cleaning crew and think it was cuz it was at like 5: so it it might still be doable on a Wednesday night if it's a bit later and it it might be that we just need to reschedule the cleaning crew okay okay but if Wednesdays are the preferred date I can uh Wednesdays are actually not the preferred date that's why it's like like jumping on that band wi um but I know in the past we've done Tuesdays and Thursdays I mean those seem to work really well but I obviously I'm one of a slew of many and so um I would be flexible in making it a priority and yeah I mean Wednesdays I I'm a youth group leader at my church so Wednesdays are I can get out of it if I need to but I prefer if I don't if there's a different way day I'm more open Mondays and Tuesdays and Thursdays yeah I'm supportive of it and fine okay which evening of the week doesn't really matter that much to me okay all right I'll go back that Tuesdays and Thursdays would be preferred for something like that um because I think that sounds like the day that you would all be able to make it and I'll touch base with our commissioners who going to make it as well f and so it sounds like that is looking we'd have an opportunity to hear what council has identified as the goals for the upcoming year that I believe so I think that was the idea again this was just from the mayor it wasn't wasn't really based on last night's discuss I apologize for the that's okay delay in getting that information okay and then uh we were all anticipating hope a preliminary PL being on it and so it looks like based on the um planning project update that will be next month that is the plan at this point they need to do a resub Bittle and I haven't received those plans quite yet the public hearing notice if it's going to move forward in February needs to get out by this upcoming Friday the 12th not tomorrow but the 12th okay um so it's po there's if we don't get the Rea mle there's a potential it could get pushed off to March um at this point March is looking really heavy so I'm hoping we can stand track for that February date and any chance we're just going to leave the sign up dur the duration of time I feel like it's been up since November because we put it up you guys and so anyway that's well now I can say we didn't exactly they've all had Fair notice okay anything else I I don't have anything else for you no thank you and then counselor Schultz thanks for being here do you have any update for us I mean what's in the packet if you got any questions we did have a goal session where we drafted some goals um last night one question I was going to have for staff is in years past you guys used to present like a summary of what you've accomplished did you guys present a goal for a Planning Commission um I provided the annual the Planning Commission annual report to J in December I thought that was part of the conversation so I don't know how like didn't get for normally normally it's presented in a council meeting right what what you accomplished for the year and then what your goals are for the Planning Commission so I think because of all the turnover and Leadership the last couple years it's been handled differently every year that I've been here okay we could certainly do a presentation we would have to uh but we there is an annual report floating out there that Dwight put together um and we could certainly share that because it did have the commission's um priorities on there so I'm not quite certain what I didn't get to forwarded maybe maybe we should talk to and see that can get submitted to council members as part of the packet cuz I think we're going to our goals on next Thursday okay be nice to know what the planning commission's goals are what parks and rec goals were too yes both all of that should have been forwarded including the parks and wck ones included so we could have in our conversation I will reach out to jadden see what we can do to get that too but there's we have a few planning things that are on the on our goals for next year so we're looking at various things with I can't from remember last night to be honest a lot of it had to do with stuff that's come up in the past you know we looking at things in that nature and then John bot I had a comment uh that they got some feedback from met Council on density so that's something we'll start looking at to there's probably a change in the rule of how we can view density yeah hun an acre something probably lower oh got anything else questions do guys have any questions I I got to C I just it was neat seeing the new city logo or the new uh City logo so what you guys has it been officially approved close right yeah okay I was like I thought there was a committee working on the like ones that had risen to the top and I guarantee it won't cost as much as the change in the state level that's good to hear that's right that's right um what is the process for wrapping up that change I think we were going to do some tweaking and then I was going to go back to the subcommittee for design ideas on what we actually want to put on the Water Tower yeah because the bowl of the water tower will go up painted so the logo would be painted on it at that time before it gets installed so we want to make sure we get that hammer down and that's anticipated to be in Springs sometime that that would happen so the decision would be made by then I can't I don't remember the exact time frame but it's got to be done pretty soon yeah because it looks like it's getting up there in height yeah okay great all right uh for the fellow Commissioners that are here does anybody have anything that they want to bring up regarding the upcoming calendar for the aison meetings NOP okay I'm up next so and then I trust that the rest of you can just view those calendars and reach out if you have any scheduling conflict and with that
