[00:01] **Mayor Jim Michalski:** I'd like to welcome all our guests here tonight. Thanks for coming. Next item is the agenda. We have two additions to make. This would be under new business number six, K and L. The first one is the triathlon, the moose triathlon committee. And the second one is the aga days committee. and one addition to make on the agenda a deletion under number six new business G strike that the city administrators taking care of that one do I have any other changes or additions to the agenda do you none to have a motion to accept the agenda

[00:02] **Mayor Jim Michalski:** Opposed? Motion carried. Thank you. But to introduce Ed Zimney give a presentation on what we're here talking about tonight.
[00:03] **Ed Zimney (CMHP):** Thank you Mayor and Council my name is Ed Zimney with Central Minnesota Housing Partnership currently administering the small cities grant for the city and with the request of expanding the target area for owner occupied requirement from deed was that we have this public hearing and just basically give the public an opportunity to speak out on behalf of the expansion request. Just a brief kind of rundown. The owner-occupied has a $20,000 maximum rehab loan. there's a owner match requirement it's based on income levels of either 10 or 15 percent would be owner match however at this time we do have an additional grant program through the federal home loan bank that covers that amount So it's been used on three projects here in the community, but we're trying to expand that target area for owner occupied. There is about $140,000 remaining in the owner occupied portion of the grant. And this deadline is for December 31st of this year. So we did send out surveys. I do have, I believe we received eight surveys back and we're just looking for a little bit more input that we can get to bolster that request when we send it to Deed. So my hope is to by the end of this month I'll put in that request and we'll see if we get approval on it. But that's kind of the brief description of what we're asking here tonight is just for public input.
[00:04] **Mayor Jim Michalski:** And just to get the information out there what what kind of projects can a homeowner sure do with this money?
[00:04] **Ed Zimney:** Improvements include windows siding roofing insulation furnace work any type of plumbing electrical issues that they're not code compliant that they want to bring up the compliance Also, if the home is built prior to 1979, there is a lead-based paint requirement that we have an assessment done. If there are any lead paint hazards in the house, those would need to be addressed with program funds. But it's basically kind of any type of structural issue on the home and any type of exterior improvement.
[00:05] **City Administrator Ellissa Owens:** I know that you talked about it a little bit, but just to make it very clear, with the grant funds as well as the secondary grant program, a homeowner could go up to $20,000, you said, correct?
[00:05] **Ed Zimney:** Correct.
[00:05] **City Administrator Ellissa Owens:** And none of that would necessarily have to come out of their pocket up front?
[00:05] **Ed Zimney:** Correct. It's basically called a deferred loan. there's a lien put on the property for the small cities portion it's a seven-year lien it's forgiven at a rate of 1/7 per year for that seven-year period the federal home loan bank is a $3,000 maximum grant and it's it's always $3,000 it's not you know a portion or a percentage it's just a flat grant of $3,000 that has a five-year term and it's forgiven on a monthly rate you know every month 150 of it 50 50 if it's 60th of it comes off yeah 60th so it's a it's a monthly forgiveness so but in those situations where the homeowner qualifies then the only out of pocket expense is the fee for recording which is $46 for each so $92 is what would be required.
[00:06] **Council Member:** Great opportunity. I know there was a deadline on the original information sent out. Will there be a new deadline? Can people still apply within the area?
[00:06] **Ed Zimney:** Designated area well in the designated area that we already have the target areas is established for that area and we can take applications up until typically June 30th okay because then it takes so long for it to get processed and the work to get completed so certainly if we can get word out to people in the original target area there's still those funds are still available and this this that includes the expanded area if we get the expansion approved it would include that as well it's all the same timeline.
[00:07] **Mayor Jim Michalski:** Okay. Yep. Eddie you got that I felt it have it in the paper again yeah.
[00:07] **City Administrator Ellissa Owens:** When the public hearing concludes you would like the City Council to make a motion to expand the target area for owner-occupied program programming correct?
[00:07] **Ed Zimney:** Correct. Yep.
[00:07] **Mayor Jim Michalski:** Okay would be you know request to expand sure do we have a map that has everybody seen that on the council?
[00:07] **Ed Zimney:** It's from 73 from Hickory Douglas the see that would be and let's see first Street he's coming out there yep yes yes.
[00:08] **Council Member:** Question so the public know who would they get a hold of if they're interested in this?
[00:08] **City Administrator Ellissa Owens:** So we have a they would get a hold of basically but we on our website we have information about this there's been flyers that have that have gone out if anybody is interested they can contact City Hall and we can pass their information along as well absolutely yeah absolutely added this huh with this so the one with the yellow border is the one that we're adding for requesting to add you can see that on the stevie be switched around there you go but it is highway 73 it's fur growth and hickory and and extends up right up to the trail and the homes right right next to the bypass trail yeah fifth and sixth Street are included there yeah fifth and sixth Street correct thank you.

[00:09] **Council Member:** I gotta run. Did that, you said something about, um, lead paint?
[00:09] **Ed Zimney:** Correct.
[00:09] **Council Member:** If they have lead paint do they have to have that cleaned up before they'll come in and work?
[00:09] **Ed Zimney:** No no that's actually part of the program so the lead paint assessment is done if the home was built prior to 1979 that and that comes yep that comes out of the out of the program funds so it's no cost to the homeowner.
[00:10] **Council Member:** Okay and then when the assessment is done it'll have in there if there's areas where there's lead paint hazards mean some homes have lead paint in them but they're in good shape and it doesn't have to be addressed.
[00:10] **Ed Zimney:** Okay.
[00:10] **Council Member:** But it's just those areas that they consider a hazard that it would need to be addressed yeah I think of that because I live in a house that was built in 28 so I know that there's lead paint.
[00:10] **Ed Zimney:** Sure. Yep.
[00:11] **Mayor Jim Michalski:** Any other questions thank you Ed much when you put that information at paper could you leave phone numbers and you know all that stuff to go it will go to the city right?

[00:14] **City Administrator Ellissa Owens:** Yeah we will amend that one.

[00:15] **Council Member:** I had a question here on page 13 is this one number one mm-hmm okay page 13 on the see it's I can't see a very good seven and eight that's four zero seven four zero eight so is that like credit card people pay in credit cards what's it's a 13 of the checking summary Oh merchant okay credit card transaction fees.
[00:15] **City Administrator Ellissa Owens:** Transaction fees yes those are so for each transaction that we receive has a credit card transaction fee associated with it yes transaction fees within the bank or yeah it's those fees.
[00:16] **Council Member:** Okay thank you it could come from several different areas I suppose a liquor store also the park anywhere that takes credit card okay yeah about a couple on page nine first comment would be Friends and Animals, 41806, we paid $4,000. I understand that's our contract. And then we had a pickup of a cat on Elmwood, which is 41818. Are we, that $4,000 doesn't cover the pickups?
[00:16] **City Administrator Ellissa Owens:** It does not.
[00:16] **Council Member:** So that was my question, was what does $4,000 get us?
[00:16] **City Administrator Ellissa Owens:** $4,000 gets us if we drop off the animal. then it's free if they have to come pick up the animal then they charge us.
[00:17] **Council Member:** We shouldn't have paid is that a resident calling to have it come pick up?
[00:17] **City Administrator Ellissa Owens:** I believe those are most of the instances, yes.
[00:17] **Council Member:** That was in a cat in an abandoned home, correct?
[00:17] **City Administrator Ellissa Owens:** Yeah, the home was abandoned. They left the cat abandoned with the house.
[00:17] **Council Member:** Didn't we last year, though, on record, didn't we have a record of one animal being picked up and they had a plethora of records that we didn't have?
[00:17] **City Administrator Ellissa Owens:** Two.
[00:18] **Council Member:** The last couple of years, very few. we might want to revisit that and just I just want to make sure that we are getting records every time this happens I know we requested it in the past but I think for us to spend four thousand dollars for one or two animals that we have record of and they have record of a hundred I think there's some disparity there sure and then the other one I had was the credit for the Wellness Center just below the animal control that I brought up 41 808 are we clear on that now or no?
[00:18] **City Administrator Ellissa Owens:** That is that one is just for and it lists the the Wellness Center that that one is actually for the hospital so we have two issues with mercy one is for the hospital and and this clears that one up that was their irrigation line that they thought that they had but they didn't really have so that one cleans that up we still owe them forty one thousand dollars or somewhere there about for the Wellness Center I think right now we're going to work with them to figure out if we can stretch some of those payments out over whether it be quarters or years or or something along those lines so no we are not cleared up but with one of them we are faulty meters.

[00:19] **Mayor Jim Michalski:** We also have under the congenital consent agenda financial report number two city financial statements for January 2017 and number two liquor store profit-loss statement for January 2017 any questions discussion hearing under that motion to accept the consent agenda to be.

Please keep comments to three minutes. Hearing none, we will move on to number four. Department reports. 4A, the police chief.
[00:21] **Police Chief Kelly Lake:** Here, counsel. Counsel. Pretty busy month. Had a couple of pretty extensive investigations. It took quite a bit of time. But just wanted to touch on one thing we're doing the... and hugs again this year. We've done it for the last several years. It's just a good way for the kids to come and meet the police and the fire and see the fire trucks and police cars. We also have a partnership with Salmon's Masonic Lodge to do Operation ID for the kids where they photograph them, videotape them, audio tape them and do a DNA vocal swab. And that's going to be on February 25th at Marketplace Foods from 10 to 1. So we just want to welcome anybody with kids to come, or if you don't have kids, come and check it out. It's a nice event.
[00:22] **Mayor Jim Michalski:** Great. Thank you. see how many we've got quite a few pages of total calls 135 calls for the month a lot of activities greatly appreciated thank you please pass it on number four b public works superintendent report
[00:22] **Public Works Superintendent Phil Entner:** Mr mayor council um month of uh january is pretty busy for us actually we um not a whole lot of snow, but we definitely did have some snow and ice events that we did have to take care of. We'll start in the sewer department. We treated 10.5 million gallons of wastewater last month. The new lift station is working very, very well. The remaining parts of the SCADA system, as far as the outlying areas like the other smaller lift stations that we have, will be poured onto the entire system. It's scheduled for next week, so the week of the 13th. That work will take place on the cleaning and televising of approximately 33,000 feet of 24 and 21 inch clay pipelines that run from right here to the lights all the way to the lift station. It's at a standstill right now. It's about 30% completed. We're having a lot of a tough time getting through there. To my knowledge, I think I've told this to you before, that the line has never been cleaned. They're having a hard time getting a jet back through there, which is the modern way of cleaning sewer lines today. They're actually going to resort to what's called bucket cleaning. And I looked it up on YouTube actually and that's really something. It's going to be an experience and it's going to be good for me and my guys and the crew to see how this takes place. And another good reason why the maintenance program that we put in place last year is huge for the city of Moose Lake because It's it's a it's a it's going to be a learning curve for everybody so it's very exciting Great Lakes pipe which was a contractor they got hired to clean this line is Honoring their price for this so if this gets done and for that price It's going to be where it we're going to come out ahead on this tremendously on the water side we We pumped 3.7 million gallons of fresh drinking water in the last month into the distribution system. The water service to the school was pressure tested and passed, bug tested and passed. The water meter was installed and the service was turned on last week. The streets, the week of the 23rd, January, we went through and filled potholes. Frost steps in the city streets right now, I checked today, about 36 inches, which is about a foot less than where we normally are this time of year. So we're actually... ahead of the game. We're looking pretty good. I'd say we're not going to have any issues, but we are looking good. Other than that, we've been routinely snowing ice. The new V-plow was put on the truck the 13th of January. It's working really, really well. The new skid steer showed up today. We have training on it tomorrow. The guys had a blast today getting to learn how to use that, so they're excited, and that's going to be a huge asset to our department.

[00:23] **Steve (SEH City Engineer):** Mr. Mayor and members of the council were about 80% done with the plans for the local road improvement we did have to have Ben Anderson go out and pick up a few more shots and we're waiting on that to get some drainage concerns by the hospital figured out. So as soon as we get those in, I'll sit down with Tim and Phil and go through the plans on what we're proposing and then it will come back to council next month for approval and then we would start the advertising process bidding it and then my schedule is toward it at the meeting in April to keep us on track remember we have to be under contract by the end of June to keep our funds encumbered but there's no problem there once we awarded in April and we wait till the frost goes out and the contractor can work so it's really pretty good schedule.
[00:24] **Mayor Jim Michalski:** So do you know if the state picked a contractor for 73 yet?
[00:24] **Steve (SEH City Engineer):** I don't believe they've let that contract yet. I'm not positive about that, though. Has Roberto... I haven't heard that. I can check on that tomorrow if you want, Tim.
[00:24] **Mayor Jim Michalski:** I think we should follow their bid with our bid, but we can talk about that tomorrow.
[00:24] **Steve (SEH City Engineer):** I'll talk to you tomorrow. That is a good idea. Very good.
[00:24] **City Administrator Ellissa Owens:** One of the... Can... know that Brian was working with Windermere's centers who are districts engineer on correcting the quarterly billing the payments that we were receiving we received another quarterly payment which I mean they'll have to once they get one updated they'll just apply it to the rest of them but can we check on that to see where the quarterly billing is that?
[00:24] **Steve (SEH City Engineer):** Yes that would be perfect.
[00:25] **Mayor Jim Michalski:** Any questions from the council thank you Steve before the Chamber of Commerce updates Thank You mayor and council members.
[00:25] **Deputy Clerk Taylor Hansberry:** They just have a couple of things it's kind of a slow time with the chamber right now but we're planning our Easter egg hunt on April 15th at the school and we're working with Kiwanis this year to do that and hoping to turn that kind of over to them next year hopefully and then also on April 22nd we're going to be having a business expo at the arena. We're looking for volunteers to help with that and kind of to get the word out to the community members too. So there's about space for 60 tables at the expo and it's about half full at this point so there's room for businesses both chamber members and non-chamber members it will be free admission to the public they're going to try to have some things out there for families to kind of get families coming to I know they're having a shredder truck so if you have documents that you need shredder that'll be out there for people to do with a limited five boxes per person and then girls hockey will be running concessions too so that's coming up on the 22nd of April so that's about it thank you.

[00:26] **City Administrator Ellissa Owens:** Gene, myself, and Ted, along with Steve and Joe, all met to discuss the payment requests that we had submitted and the projects from 2012. I think they're still working on just kind of putting together the final email back to Homeland Security to hopefully work on closing out that process. Questions?

Funny we got a comment that is still up in the air that's what hopefully Steve will that's people to help us with that we will come back to you with yeah we on 5b that now WSSD contract negotiations still on hold see most like school site plan the school board met discussed the site plan or the kind of mini comprehensive plan that we had met and discussed they agreed to go along with the city and match funds for for that plan we're working with a RDC now to find a time to to start that process great Moving on to D, resolution 17-02-01, MnDOT easement offers.
[00:27] **City Administrator Ellissa Owens:** This is the exact same thing that we did last meeting, just in resolution form. The state requested that it be put in resolution form for their records. So nothing at all has changed. All the dollar amounts are the same.

[00:30] **City Administrator Ellissa Owens:** I was speaking with Marguerite and she has decided to, and she had told me when we first met as well, but she's decided that she's going to retire this spring. So I would like to start looking for a new city attorney.
[00:30] **Mayor Jim Michalski:** Just for consensus correct.
[00:30] **City Administrator Ellissa Owens:** Just to let you guys know and to let you know that that we will start that process and it's not without her knowing she's she is retiring.

[00:31] **City Administrator Ellissa Owens:** One of the things that we talked at the last meeting was the hockey association in the city kind of partnering to fix up the outside, the exterior of the building. Um, doing some gardening work around the building as well but one of the things that needs to be addressed prior to some of that work is an emergency exit coming out of the second floor of the back of the arena we did budget to to do this project this year we are in the process of getting bids for an emergency exit doorway we met with the engineer out there as well to start the process of figuring all that out. So we'll probably have something, hopefully at the next meeting, if not the one following that.

[00:32] **City Administrator Ellissa Owens:** This is something that the city has done for many years, is pay for the entire Hinkley Convention and Visitors Bureau advertisement for the chamber and the campground. I think it's two full pages colored pages I think we've had the books here before but I we don't I don't think we have here tonight I think it's it's a very good advertisement for the city of Moose Lake I know that it's it lists the chamber but I think it's a pretty good advertisement for for the community as a whole yes chamber he's still approve of this so I saw move then that we advertised to the Hinkley Convention and Visitor Bureau for a total of $1,330.

In this case, I think that this is this is a nice advertisement for the community you're right it's a nice it's in color it's it's multiple pages it goes out to a pretty wide array of people I think this is a wise way to spend spend our money showcases different communities right.

[00:35] **City Administrator Ellissa Owens:** All of the language in this is either already in our current one or comes directly from the state and the arbor day foundation The reason behind it is when we applied to be part of the Tree City USA, one of the requirements is an updated shade tree ordinance. Ours was not updated so we took the language straight from them and updated our ordinance.
[00:35] **Mayor Jim Michalski:** So the second meeting will be next correct City Council this is for your information and for your reading pleasure um can I just point out one thing yes under 2.1 the third to last paragraph there's a table 2.1 periodic reports says taught a City Council oh okay question there was highlights in this?
[00:36] **City Administrator Ellissa Owens:** No no this one this one replaces the foot.
[00:36] **Council Member:** So what were the initial changes?
[00:36] **City Administrator Ellissa Owens:** The initial changes is it takes it a little bit further with most all of this but inspection and investigation is more in-depth damage to trees on public property is more in-depth and the regulations for planting trees on boulevards and utility corridors all of those things they they put more emphasis on on guidelines for planting and all of those things.
[00:37] **Council Member:** So the mayor appointing three members of the board is that's the same is that new?
[00:37] **City Administrator Ellissa Owens:** I'm not sure if that one's new I guess I don't care for that members 42 2.1 because enough to be a form that part I don't believe is new when that's there have to be City Council because the mayor's the tree official tree couldn't the gardener be on there and another individual thinking yeah you wouldn't you wouldn't do three council members probably the newest member of the council or something normally.
[00:38] **Mayor Jim Michalski:** Okay sounds good with me do you want a green tree is I think that I don't think it indicates confirmation my thanks yeah we wouldn't do the three City Council members it wouldn't make sense to do that so we could just have it right by the three members appointed by the mayor or whatever.

[00:39] **City Administrator Ellissa Owens:** We need to update the corporate resolution with the bank. Previously, Councilor Michalski was on there. We need to remove him and add a new check signer. Just wondering who you would like that to be. I think Councilor Michalski was on there as the Deputy Mayor. However, Councilor Husso would... already a check signer and is now the deputy mayor so I'm not sure if we want an additional person on there just to make it easier I think we did just in case there was people missing you know vacation or whatever is there somebody that would volunteer?

[00:40] **City Administrator Ellissa Owens:** Very good. I think what I'm going to do is I'm going to get all of this filled out and then just have everybody come sign it. I'll give everyone a call and have everyone come in and sign it.
[00:40] **Mayor Jim Michalski:** Very good. Gene has been taken care of, or will be taken care of by the administrator. 6-inch deputy clerk, treasurer position.
[00:40] **City Administrator Ellissa Owens:** Gene has decided to retire, as most everybody knows. With her retirement, one of the things that we looked at was how the office is currently staffed. if we if we are to just hire an office staff for the city one of the things that that I am requesting is that there be one full-time position and one additional part-time position the full-time position would be a deputy clerk treasurer or any other title that the City Council likes that is more of a financial position the second position would be as it says on here an administrative assistant the the first job description on here is just a current posting that's from the city of Watertown it is for a clerk treasurer and I've just highlighted a couple sections that don't apply the wage that's listed at the top is the range that Watertown had listed the population is of Watertown just as kind of a reference point of what I would be looking for the the pay range that that I would suggest would be quite similar to what Watertown has listed here but uh... like i said uh... as you're going through it they did things that are highlighted in yellow or are things that do not apply the rest of it though the job description would pretty much follow what i would be looking for uh... religious get into the next one to venture the next one is for administrative assistant There are a couple postings in here. One of them is from the city of Hinkley. That one is currently posted. One of them is a previous posting that was from the city of Chisholm. The pay scale at the top is... right around 15, 16, 17 dollars an hour right around there. This would be, my suggestion would be to be a part-time position. This one we would not need to hire right away. It's not as time dependent as hiring the financial position. It would be nice to get this person on sooner rather than later. But basically the reasoning for this is I think I think Gene's experience has been something that the city of Moose Lake has been able to rely on for a very, very long time. I think it will be unfair for the new person coming in to be expected to know as much and fill that role the way that Gene has in the past. I think hiring a second person will be quite necessary. I think it's been thought about before, but with Jean retiring, I think it's certainly something that we will need to look at doing.

[00:41] **City Administrator Ellissa Owens:** So the last one on there is combining the administrative service or function of the City of Moose Lake and the Water and Lake Commission. I think most people, I've had conversations with most of you about many of the administrative functions are duplicated within the city of Moose Lake and the utility commission so we have two people doing payroll two people doing accounts payable two people doing accounts receivable two people doing everything we have the same auditing firm we use the same accounting system we have the same phone system we have the same server everything is duplicated I think that combining the administrative function of the commission in the city of Moose Lake is more efficient, is more cost effective, and is just in general a better way of doing business in the city of Moose Lake. What I am requesting right now is that the city and the utility commission have a joint meeting on Monday my request is is that the City Council make a motion to add this to as a discussion in that joint meeting.

HE HAD BEGUN LOOKING INTO THAT, AND THEN REPRESENTATIVE SUNDEAN HAD ALSO STARTED LOOKING INTO IT TODAY AS WELL. SO BOTH THE HOUSE AND THE SENATE ARE MOVING FORWARD WITH THE SALES TAX BILL AS WELL AS INVESTIGATING THE PROPERTY ALONG HIGHWAY 73.

[00:47] **City Administrator Ellissa Owens:** They are they are actually kicking around the idea of one of the senators is possibly going to author a bill for having the sales tax no longer be a state government issue. they are considering even taking away the election part of it and just having it be handled by local governments. I think that that will probably fail hard, but it would be nice for the local units of government to be able to handle sales tax issues just amongst themselves. I think the election is a great way to do it, still leaving it up to the voters, but the duplication of having the state's government look at it would, it causes a lot of problems for communities like Moose Lake. So that will be one of the things that I've already volunteered to talk to anybody that is even remotely interested in that, but that will be one of the things that we will probably try to push while we're down there as well.
