good afternoon we'd like to welcome everyone uh here and online uh to our city council meeting for the afternoon of june the 20th all of our council is present because mr thompson is with us by a zoom are you with us mr thompson allow him to unmute maybe mr thompson are you with us via zoom do we know if he's on the zoom line about five minutes ago okay well we'll we'll see if he's going to join us uh we'll proceed forward with uh the beginning our meeting with a moment of silence followed by the pledge of allegiance so please stand for the moment of silence followed by the pledge thank you please join me in the pledge of allegiance i pledge allegiance to the flag of the united states of america and to the republic for which it stands one nation under god indivisible with liberty and justice for all thank you first item on our agenda today is awards and recognitions and we have one item under that agenda item uh that is to recognize juneteenth on friday night vice mayor jenn duff and i participated in the zen knights juneteenth block party i was delighted that that event to present a proclamation recognizing yesterday june 19 2022 as juneteenth celebration day in the city of mesa i think you've heard this but it's 157 years ago yesterday that texas was the last state to be officially notified of the emancipation proclamation where all slaves enslaved people were freed it's important that we mark this monumental date in our country's history and that we continue to celebrate diversity in our city so happy juneteenth everyone uh next item on our agenda is the consent agenda we'll invite mr kevin christopher forward to read that agenda good evening mayor and council members these are the items on the consent agenda all items listed with an asterisk will be considered as a group by the city council and will be enacted with one motion there will be no separate discussion unless a council member or citizen request in which event the item will be removed from the consent agenda and considered as a separate item item two approval of minutes of previous meetings is written the judicial advisory board has recommended the reappointments for all the magistrates up for reappointment item 3a reappointing presiding city magistrate john tats to a two-year term beginning july 1st 2022 and ending june 30th 2024 item 3b reappointing city magistrate elizabeth ariova to a four-year term beginning july 1st 2022 and ending june 30th 2026. item 3c reappointing city magistrate alicia lawrence a four-year term beginning july 1st 2022 and ending june 30 of 2026. item 3d reappointing city magistrate raymond schumacher to a two-year term beginning july 1st 2022 and ending june 30th 2024. item 4a act on liquor license application for hawks nest 140 north country club drive item 4b act on liquor license application for el haradero carniceria e restaurante 10 839 east main street item 5a approving contract to purchase stage curtains for the mesa arts center aikida and piper theaters as requested by the arts and culture department item 5b approving three-year term contract with two years of renewal options for asphalt equipment repairs and services for the fleet services department item 5c approving dollar limit increase to the term contracts for custodial services zones 5 6 and 7 to the parks recreation and community facilities department item 5-d approving 3-year term contract with 2 years renewal options for bird control and removal services for the parks recreation and community facilities department item 5e approving three year term contract with two years of renewal options for controlled substance screening for the mesa police department item five f approving one year term contract with two years renewal options purchase is funded by the highway user revenue fund item 5j approving three-year term contract with two years of renewal options for pavement preservation services for the transportation department item 5k approving three-year term contract with two years of renewal options for fire hydrant rehabilitation and replacement services for the water resources department item 5-l approving the central mesa reuse pipeline pre-construction services and construction manager at risk contract item 6a approving a resolution authorizing the city manager to execute an individual job order for the amis cool road arterial reconstruct mill and overlay improvements project item 6b approving a resolution to increase the maximum dollar amount for individual job orders under existing job order master contracts and authorizing a city manager to approve future job orders under job order master contracts item 6c approving a resolution for an intergovernmental agreement with the queen creek unified school district for reimbursement of the salary and benefits of a mesa police officer perform school resource officer duties item 6d approving a resolution authorizing the city manager and the city attorney to purchase insurance for the city and authorizing additional insurance purchases and renewals item 6e approving resolution designating the chief fiscal officer with the authority to submit the city's 2022 2023 fiscal year expenditure limitation report to the arizona auditor general on behalf of the city council as required by state statute item 6f approving a resolution allowing the amount to be collected by a secondary property tax and the rate upon each 100 of assessed valuation of property subject to taxation within the city of mesa for the fiscal year ending june 30th 2023 item 7a introduction ordinance amending title 2 chapter 3 of the mesa city code pretending to the judicial advisory board to include an additional process for appointing city magistrates item a is for a continuance to the july 5th 2022 city council meeting this is for an ordinance regarding zeon 21-0 940 pertaining to a rezone and site plan review for property located east of lindsay road on the south side of southern avenue again this item is for continuance to the july 5th 2022 city council meeting item 8b approving an ordinance regarding zon21-01285 for property located north of ray road on the east side of power road site plan modification to allow for development of a hotel item 8c approving an ordinance regarding zeoln 22-093 for property located along the south side of warner road east of sussman road and west of haas road rezoned with planned area development overlay and site plan review to allow for an industrial development and item 8-d approving an ordinance regarding zon22-00160 for property generally located south of brown road on the west side of country club drive this is for a reason and site plan review to allow for development of new headquarters for child crisis arizona mayor and council members these are the items on the consent agenda thank you mr christopher uh ms mosley i think we had one request to speak on an item on the consent agenda is that right item 4b she's just a representative and she does not need to speak okay she she does not ask him to be removed from the consent agenda correct okay great thank you we have a motion and a second in favor of the consent agenda please cast your vote uh mr thompson do we are you present he's not joining us okay thank you that passes unanimously uh with mr thompson absent uh next item on our agenda well before the judges run out i just want to know thank you that uh we've just reappointed some of our great uh city magistrates we're very proud of our court we very much appreciate your service and um being on the consent agenda is a good thing when you're being reappointed so i that that reflects uh our our trust in you and our community support for you so thank you for being here today uh next item on our agenda then is item 9a to avoid the appearance of a conflict i have declared a conflict of interest on this item so i'll ask the vice mayor to take care of it thank you mayor item 9a is to take action on the construction services contract for the signal butte water treatment plan expansion construction manager at risk do i have any council members that would like to discuss this item now is there a motion to approve a we have a motion to approve by council member freeman and seconded by council member spielsberry please cast your votes and then mayor abstains and councilmember thompson is absent and the um item passes unanimously thank you thank you madam vice mayor next item on our agent is items from citizens present uh we've received uh four cards i'm sorry the as our agenda indicates we we hear from three speakers so i'm gonna take and it's all on the same topic i've noticed so i'll just apologize to uh mrs murphy i'm sorry your neighbors beat you to it so come first next time and you'll be ahead of them okay great so uh we'll begin with uh i'd like to say three speakers when you come up please state your name and you have three minutes to speak on the topic uh we'll begin with jerry barron followed by ivy koppel followed by ron trout do you want to shift that hello mayor and council uh i wanted to speak on the subject of ghost writer been here before i've been arrested at mesa for 60 years and that's 60 years i've paid my taxes every year i bought some land which you already know the story about which was in ghost rider you were supposed to help us especially mr luna was supposed to help us to get that in working order that happened 15 years ago nothing has happened in 15 years i would like to know if there's any way possible to have a meeting with the mayor other parties involved to discuss how we're going to fix this problem i think the problem's been long enough after 15 years it should be fixed i know the growth of the city is growing i know it's growing towards eastmark and that area i know we've involved money with the airport as well i know that's growing as well in that area i don't understand why we're not letting it grow in the area where we have already bought paid for the land and yet you won't give us the right of way to build our houses i don't understand that i don't get it uh we we paid the taxes we paid for the land and yet you guys keep tending to kind of just not help us in that area i was under the understanding that that's what you do is to help the public i've been under that setting since i've been a small child i still believe in that system but i don't see it working in this city i would like to have a discussion with you and some other parties to discuss these issues how we can move forward and fix this thing has been broken for 15 years i think it's long enough some of the people that i know that was in that area have already passed away okay i don't want to leave a burden on my children or my grandchildren on paying taxes for another 20 or 30 years for something that they can't build on they can't sell i would like to come to some kind of conclusion we'll be able to either build or at least make it available where we can sell for somebody else to build on either way that's kind of my subject for today i appreciate your time and i really would like a meeting with you so thank you for the day thank you mr barron ivy couple while ms koppel is coming up i think just to remind you what i think you already know items from citizens president are not on our eye on our agenda for action so unfortunately we can't engage in a conversation with you and discuss the merits of this but uh so that's why we're not responding to the comments but please proceed hello it's good to see you i think there's a couple new faces around here so um ghostwriter in case for you that don't know it's a well am i allowed to say we think it's an illegal subdivision that took place annexed in it has no water no sewer no fire hydrants no roads no easements and there's about eight homeowners in there a couple of them do have city water and city sewer the rest of us have not been given that opportunity um we're stuck we've tried to write real estate laws we've tried to de-annex back to county we've proposed special tax districts we've talked about eminent domain we have literally exhausted this for years trying to fix not only our private lots that we're not allowed to build on but helping the city and the safety of the people that live there if a fire happens we all have a problem and that's in the city of mesa one of those houses burned we don't even have fire hydrants around to help them and i think that's unfortunate that's not what we're supposed to do there there are real estate laws that protect professional development and we have standards to uphold and i recently had a meeting a couple days ago that was probably one of my toughest meetings i've had recently i'm someone who's been trying to help i've come up with every creative idea you could ever imagine and i got talked to like i'm literally a piece of dirt and i i can't even imagine that this is coming from all we're doing is trying to help let's write a new law let's go back and fight against county this took place in county city of mesa inherited a problem i also believe they're part of the problem we shouldn't be doing annexations without development agreements and bonds in place providing proper infrastructure for over 10 years we have laws that talk about all this stuff so we're here again to ask we want to be put on the formal agenda we've never even been given that opportunity that seems odd to us i don't know why we would have to beg for help i own my land i pay my taxes on it i want the right to build on it and i want the right to sell it trevor whichever way i want to do that um and i think we've earned that this this new letter that's been outlined from the city of mesa i got asked how i got it i'm the reason it's here i worked with mr speaker bowers president fan we've been down at the senate in the house and rallying for years and we can't achieve this letter we have denials from los santos they're not going to give us drainage and greeting and drainage they're not they've already put in writing they won't you guys asked us to get 51 of the owners to get septic approved i brought you 65 do you know how hard that is i can't even get counsel to vote on it they never even gave us the respect after we hit the benchmark to get septic we never even were allowed to talk about it with you guys so we're asking again we need to modify the letter we have to come up with the solution there's landowners that want to build in there we want to be released if you guys want to help us let's all talk about deannexation again and go back to county if we stay in the city give us rights to build on our with basically county rules we're going to have septics and wells and dirt roads i don't have eminent domain power i'll donate the 20 feet on my land and give you the easement that you're asking for on my piece i can't force the homeowner who already got city water and sewer to donate their 20 feet you guys have eminent domain power if you want a final plot help us with it so a lot of the landowners will help but we're sick of being held hostage by the homeowners that live in there that already got services they have thank you miss cochran your time is up thank you very much ron trout thank you for your time and your service and this is my first time speaking on this topic in front of you i want to thank ivy who has really done a yeoman's job and trying to resolve this issue if we had one other person in the city that worked half as hard as she did this problem would be resolved but we don't have that we've been to meetings we've had discussions we've got letters and we go nowhere i bought the property that i have in 1993 it was in the county i'm the only original property owner left in this development i didn't want to be in the development but the city of mesa required that 100 percent of the people agree so as a good citizen i agreed to be annexed into the city probably the worst decision i ever made in my life i've been a resident of mesa since 1988 and pay my taxes and i'm taxed on that property two and a half acres as if it was a two and a half acre lot in lesendis ready to be built on it's not draw dirt i can't even park a camp trailer on it according to your rules i would like before i pass away to be able to resolve this i'm not giving it up i'm not donating it to the city which the gentleman to the south of me did he got so tired of it he just gave it to the city okay i'm not going to do that i want to resolve the issue there are people in there that want to resolve the issue there are people in there that have homes that were illegally built nobody's done anything to rectify the problem they've let them live in those homes they've given them city services they've allowed them to kind of dictate what goes on out there and this is a problem has been on the back burner for the time period of covet but it's past that and the letter we have is from 2019 it's time to meet again and resolve these issues so that people can build on their property sell their property and move the city forward thank you for your time thank you mr trout again i apologize we can't engage in a a discussion on the merits of this given that it's not on the agenda but uh i i know i i mr luna and i would be happy to have a meeting with you uh ms randazzo would you raise your hand that's my chief of staff please connect with her either electronically or tonight before you leave the building and we'll make an appointment to visit with you and and include the appropriate city staff and just make sure that we're all clear on on where we're at on this issue thank you that include that concludes all the items
