[1:33] **Jensen (Planning Staff):** Thank you Chair Marovich. Yes, you have two handouts for you tonight. One is a revised engineering report for our agenda item this evening, the Air Lake DEA Second Edition. There was some revised language regarding the future construction of 222nd Street that was added to the report. And then you also have a preliminary plat for Air Lake DEA Second Edition. We grabbed the wrong preliminary plat when we posted it to the council or the city website, so we just included the correct preliminary plat there that we were referring to. And then if tonight's item isn't tabled, it should move forward to the March 3rd City Council meeting. That's it for announcements.
[2:23] **Chair Marovich:** Next agenda item is a public hearing. So anyone wishing to speak for the public hearing, they can print their name on the back sheet. Agenda item number five, this is a public hearing for Air Lake DEA Second Edition. It's a public hearing to consider the application of Dakota Electric Association for a preliminary plot for one lot, one outlot subdivision to be known as Air Lake DEA Second Edition, located east of Cedar Avenue and north of 225th Street. And here to give a brief overview is Jeff Shener.
[3:08] **Jeff Shener (Dakota Electric Association):** Good evening Madam Chair, Commissioners. My name is Jeff Shener, I'm the Vice President of Utility Services at Dakota Electric Association. This project represents the development of a future headquarters for Dakota Electric. Our hope is that as this goes through the process, that we could start construction yet late spring or summer, and then it's a two-year build. So by summer of 2027, we would be moving into a new headquarters facility. We've been working with Lakeville staff; we're really excited about the move and kind of working through the details of the project. But with that, I would stand for any questions you'd have about the project. Thank you.
[4:02] **Heather Boton (Senior Planner):** Good evening Chair, commission members. I'm Heather Boton, the Senior Planner with the city. As mentioned, tonight what is in front of you is the preliminary plat for an Air Lake DEA Second Edition. The land and area is located east of Cedar Avenue, north of 225th Street and south of the future roadway of 222nd Street or the dedication of that right-of-way. The property is zoned and guided industrial, and the plat that is in front of you tonight is this area south of the 222nd Street right-of-way. There's one lot and one outlot to be known as Air Lake DEA Second Edition. So the lots proposed meet and exceed the minimum requirements for the I-2 General Industrial District.
As Jeff mentioned, Dakota Electric has submitted plans to construct their headquarters on Lot 1. Outlot A to the east would be vacant for now and then planned for future expansion from DEA. So the proposed building is about 176,500 square feet in size. It is a multi-use building with their office, warehouse, and storage. Other site improvements include a parking lot, outdoor storage, and then the storm water improvements. There are no significant trees on the site or wetlands within the proposed plat.
Staff has met and corresponded with the Township Board regarding the proposed project and the future construction of 222nd Street. Employee and guest access would be from 225th to the south, and then construction and fleet vehicles would access the site from the north on 222nd Street. The initial proposal just shows a little bump that kind of crosses the westerly property line with a temporary cul-de-sac at this time. So the proposed DEA site complies with setback requirements for the parking lot and building. Landscaping on the site shows foundation plantings around the building and then parking lot landscaping and screening. Storm water runoff will be collected on the north in a private system; it's a private infiltration basin located along the 222nd Street right-of-way. The proposed building is a mixture of building materials and the building height at the tallest point is 40 feet, and both of those meet and comply with our zoning code requirements.
And on the site, you may have noticed that there were fuel storage tanks located along the westerly boundary. Those tanks would be approved with an administrative permit done and reviewed by Fire and Building once that permit is submitted. So staff believes that the proposed plans and subdivision plat are consistent with the goals and policies of the Comprehensive Plan, and the plans will conform with the performance standard of the city code. So staff is recommending approval of the preliminary plat that's in front of you tonight for Air Lake DEA Second Edition with the stipulations listed in this engineering and planning report. Any questions?

[8:03] **Commissioner:** Madam Chair? Yes, I'm just a little curious with the orientation of the site. Taking the employee and visitor access coming off 225th with that being a gravel road, I'm just kind of curious why the direction to bring people in that way?
[8:29] **Jeff Shener:** Madam Chair, Commissioners, our intention was to use 222nd as a truck entrance and then 225th to be deliveries and members and employees of Dakota Electric. Now, with what's going to happen potentially at the Air Lake Airport site, we're hesitant to make any road improvements till we know what's going to happen there because there could be some shared cost opportunities for us. But I think our long-term intention is to actually improve 225th Street as well through that parcel.
[9:06] **Chair Marovich:** And my understanding is you've been at least meeting with the township to talk a little bit about that future of that roadway, is that correct?
[9:13] **Heather Boton:** Thank you Chair, members of the Commission. Yes, actually this morning we met with a couple of board members and the Township Clerk. We did share the plans—we had previously provided the plans—and then we shared with them the alignment for the right-of-way dedication and how that's going to potentially impact their adjacent parcel to the east. We also talked about that southern roadway. It's not currently in their CIP to update it; I think it's within the next couple of years. We also have a Joint Powers Agreement for maintenance of that road, and when this property was annexed back in 2021, that Joint Powers Agreement was extended to include this property. So through City, Township, and possibly Dakota Electric, this will get paved at some point in the future. We just don't have a definitive timeline right now.
[10:14] **Commissioner:** Thank you for that explanation. I just, as I was looking at this and kind of considering this proposal, that was something that was kind of sticking out of my mind in terms of being good neighbors with the township and that type of thing. So I'm glad to hear that those conversations are happening ongoing and that there's agreements in place etc. to further that. So thank you.
[10:33] **Commissioner:** Madam Chair? I'd like to say I think it's a great project and happy to have you guys moving here to Lakeville. I think we're ready for a motion.
