july the 5th all those in favor although suppose and the meeting has been reconvened at 1 11 pm and mr mayor we have nine members of the public signed up to speak but first the el paso city council is the local government body the local government body charged with serving all of the citizens of the city and meetings must be focused on the meeting at church the city council meetings are public meetings under the texas open meetings act public comment is an accommodation and not a requirement of city council all persons in attendance are expected to display civility and decorum that is respectful to other persons without the use of insulting profane threatening or abusive language public comment will not be used for personal attacks against the person or group's character or him we'll move on oh there he is i saw you earlier good afternoon sir good afternoon i appreciate the chance to talk to you guys today i just want to read something that i because now that i'm not buried in dogs i have time to actually do research the u.s court of appeals for the 8th circuit today agreed to public officials to use social media accounts to further official duties must comply with the first amendment and cannot block people i would appreciate if somebody would let our new director know that he needs to unblock his email address i'm sorry if he's offended by the people that are upset with the way things are going but that's if you're not doing anything you're going to get complaints sir you blocked me on private messages when i was sending copies of complaints screenshots of complaints and i you know those people voted for you i didn't block you on anything i've been on it for like i'll check to see if it's blocked but i have not blocked it i promise i promise you too so and you may not have i mean you may never even seen it i don't know right that's correct that would be correct okay this is a chart a flow chart of how things are supposed to work with the city of el paso at the top it says community and the in in below that it says city council city council reports to the community below that it says city manager reports to the city council now every time i talk to people in the city council i get that they got to get it approved through the city manager are we following policy and procedures or is this just another one of those policies and procedures as guidelines i i'm going to kind of change up my my conversation i saw yesterday your conversation about the abortion and you're going to follow texas law the city of el paso has abandonment clauses that it's against the law the state of texas have abandonment clauses it's against the law and the the city attorney can look this up title vii is for el paso anybody that commits a crime is guilty of this anybody that helps them commit a crime is guilty of culpability in this crime the shelter is telling people to leave dogs where they found them put them back on the streets and they've been doing it for over two years that is against the state law i would appreciate it if you would hold the same thing for state law with the city of el paso because right now you got a memo telling you he was doing this so that now puts you all guilty of allowing this to happen it's animal cruelty it's abandonment we're tired of it it needs to be fixed and now you all have been officially notified that the shelter is doing it i would appreciate it i have given you a solution to the issue we have with the overcrowding and we sit here and still do nothing it's time we change mr palmer your three minutes are up thank you next person is benjamin alva topic is also animal services hello by now everyone knows we have an abundance of loose cats and dogs and let's just say for the moment the reason we have this problem is because of irresponsible pet owners even though my colleagues and i don't agree this is the real reason we have lots of loose cats and dogs but if this is the case why aren't animal control officers out there handing out citations to those irresponsible pet owners now let us also say animal control officers are handing out citations well why is it we keep hearing these irresponsible pet owners are only given a slap on the wrist a 10 fine when they go to court if that's the case everyone is going to start realizing they can get away with letting their dogs out loose letting their dogs keep having litter after litter i'm going to go back to what my colleagues and i know what the real reason is we have this problem animal services was closed to intake for at least one year that i know of at least one year when el paso city residents were were not allowed to take in to take in any stories to animal services do you realize what that does to the population of loose cats and dogs one year without being able to take in cats and dogs think about it let's say that within just one week 10 people wanted to take in four puppies each that's 40 dogs but animal services was not accepting any loose cats and dogs these city residents weren't going to hold on to these animals they're going to release them back out on the streets neighborhoods etc the next week the same thing happens and so on and so on those puppies or kittens are going to become adult dogs or cats and make more puppies or kittens i'm hoping you understand why the problem isn't 100 because of irresponsible pet owners it is because animal services closed for at least one year el paso animal services doesn't even have a full-time veterinarian they don't even have an x-ray machine what happened to the 9 million plus dollars el paso animal services received many dogs ran away from their homes during the 4th of july weekend and you are asking us the public to hang on to any loose dogs or cats we found out on the streets we we can't do that we already have enough on our plates as it is my colleagues and i have solutions to these issues but unfortunately we only have we are only allowed three minutes to speak el paso residents are very frustrated your three minutes are up thank you sir next is miss julia and i hope i don't massacre your last name it's okay if you do cram cramping and also the topic is animal services hello thank you the word shelter means a place giving temporary protection from bad weather or danger and right now animal services isn't living up to that role my name is julia and from 2015 up until a few months ago i had volunteered at animal services i watched it go from a clean safe calm environment with a 50 euthanasia rate to what it is today a packed filthy disease-infested mess unsafe for dogs employees and volunteers dogs come in and are shoved in a barn in small airline or wire crates i've seen them rip out of those crates i've seen them bust into the neighboring crates and maim the other dogs they're stacked on top of one another and sometimes they lose them all together i've seen fights in outside kennels where they house up to five strange dogs and walk away hoping for the best there's little to no supervision out there and those kennels were not built to house five dogs i've watched staff leave a dog that was getting attacked by two kennel mates because of no space and inability to move the dog without getting permission from another staff member the quarantine area that is meant for sick dogs is often filled with nursing moms i've seen them take puppies that tested positive for parvo and placed them in kennels next to puppies that had just tested negative and used lack of space as justification for it i've seen meds microchipping and medical treatments get skipped due to lack of staff i saw a dog get left in the barn for two months when it's only supposed to be there for three days and they use lack of space as an excuse that dog was euthanized for behavior and i asked how well you'd behave if you were stuck in a crate for two months he never even got the chance to be shown to the public a b and c kennels which is what the public sees used to house one dog and now we're desensitized to seeing two in there and those kennels were not built for two dogs animal services is not the humane society and housing dogs inhumanely so they can brag about their euthanasia rate is not acceptable it's inhumane to house dogs for so long in such conditions without proper enrichment and care the word service in animal services is being ignored and they're literally refusing to pick up stray dogs and loose pets using no space as an excuse the overcrowding and foul conditions are a direct reflected reflection of animal services policies they need to stop turning away people that find dogs and need to turn them in stop warehousing dogs long term make the areas for incoming dogs available and inhabitable and pick up the dogs in our streets without making excuses because leaving them out there is making the problem worse really need to find out a way to offer free spain nuner or mandatory spay neuter laws for anyone that fails to contain an intact animal the registration that we have to pay for every year can help manage all this but we need to fix this or it's not going to get better i have video after video of dogs being housed in filth and the excuse is always too full and lack of staff when you have three times the number of dogs you should you should have three times the staff to care for them and we don't but there are things worse than your three minutes are up thank you next member of the public is barbara valencia also topic is animal services actually he's going to be speaking today okay want to say hi to everybody first say hi this is there you go thank you very much for several years up to 2019 animal services would take an average of 25 000 animals a year 75 of these animals taken in were spayed or neutered and adopted out or transferred to other rescues when haz was implemented in 2020 intake dropped to 12 500. so 12 500 animals were left on the streets in the surrounding desert are passed around the city and 75 of those animals are not spayed or neutered how many of these unaltered animals left behind by animal services have bread and head litters i'll tell you lots and lots of them in 2021 animal services took in 15 000 leaving another 10 000 more strays out in our community again 75 of those 10 000 are not spayed or neutered so now you add 10 000 to the other 12 500 from 2020 which many of them are now having their second or third litter as an example so you can wrap your head around the total totality of all of this on average a female dog gives birth to six puppies twice a year and in 2020 if 5 000 of those 12 500 left behind are unaltered breeding females dogs that makes 60 000 puppies in one year the city manager you city council animal services and animal shelter advisory committee knew the consequences of pause you didn't care and you allowed it to happen all of you are responsible for the severe overcrowding at animal services and the massive stray population we now have and you are continuing with portions of this horrendous program the city manager has proven he doesn't care about animal welfare in el paso his track record speaks for itself he is the one to put in place the current director and two previous directors at animal services that have and had no experience or qualifications to even run a shelter and you city council have allowed him to do it you ignored this crisis when it was a snowball and because of that it has now turned into an avalanche the stray population is so out of control the city is now in a catastrophic situation even if half of those sixty thousand a year die from disease starvation or being hit by a vehicle that leaves thirty thousand dogs and puppies the temporary solution involves euthanizing on a massive scale but each one of your city council members should be required to spend one hour to personally watch the murdering of the innocent animals you chose to ignore city council you have caused this you need to fix this now and you need to be held accountable these puppies that are here today and their siblings they are live today in spite of you thanks to our local rescues thank you local rescues but our local rescuers are beyond the breaking point because of you the city manager and animal services continuing to ignore the problem only makes it worse you did this now you fix it thank you thank you next person is kaylee holt also animal services is the topic good afternoon hello let me just pull up my note here okay my name is katie holt i'm one of the directors of a local rescue here called huckleberry hound dog rescue i know you guys won't talk back which i find ridiculous as every city that i've been in they do talk back and they do discuss with the people who are talking um first i want to know how an over city power paid manager has so much power here what does he have over this town to where he's ignoring the big problems you know he doesn't re he's not considering his residence now we don't need a new arena we need more animal shelters we need to take those funds delegate them somewhere else the money that animal services receives every year is not used properly we have so many strays in fact i'm the one that found their mother starving on the road had it not been for me those puppies would be dead i take in so many different cases every year and we have watched this house program take over and over and it gets us nowhere what this town really needs is to find a passionate person to run animal services and get new shelters the hass pros program has to go if you want the truth about it you can look it up there is the truth about the house program not a 90 second little video um you know we say the old saying is babies having babies when we see our children having babies well these puppies are having babies last year i rescued from an abuse neglect case her name was nisa she was turned away after she had been adopted out from my rescue and turned away at animal services door when she was found they told the finder to put her back out on the road had they taken those few little seconds it takes to scan a dog for a microchip she would have not taken up any shelter space because within 15 minutes myself or the fellow director would have been there she was on a property where a gentleman used to put wires around the collars and chain the dogs up and every time those dogs pulled those wires dug into their necks how would you like to wear a collar with a chain on it and then have metal digging into your necks animal services these people have not been qualified they have no idea what they're doing and some of the staff there needs to go besides the director we need somebody who is going to stand up and be responsible yes i'm infuriated and i'm very upset with how the city council has responded the city manager shouldn't be running things you guys are supposed to be standing up and speaking for these animals let alone the rescues we've been pushed out the rescues have been pushed out by animal services and that has program you guys need to fix it and you need to stand up for what's right thank you next person is colette boy good afternoon lisa and city council members my name is colette bauer i'm here today after about a four years absence from speaking at city hall regarding animal rights issues and i wish i could be standing here today talking about all the good things that have happened over the last four years yet we are sadly we are struggling more now than ever before before i begin i have a simple question who has been to animal services who has been who has walked those halls and i know you have because i saw you there yes sir oh okay and it's a it's a i'm amazed that the city manager happened to be is absent right now where'd he go where'd he go amazing this is very important yet he is not here i find it if you haven't been to animal services how can you make decisions about what is happening at animal services how wow go there and you'll know what we're talking about yeah maybe okay so but i have some ideas the candle workers and animal services make about twelve dollars an hour they need a raise they can't keep people for twelve dollars an hour they're constantly training new people that make it one or two weeks and then they leave because it's really hard work and if you go there you would see that our city manager when he was hired in 2018 he made 330 000 a year his current salary is 404 dollars a year wow i guarantee those those workers getting twelve dollars an hour work a lot harder than he does okay so i know he's not here to hear that but let's let's pass that along real quick so you guys need to budget the money to you got the money let's improve the facility in kennel a when it rains the the roof leaks the air conditioner it right now is currently not working um the laundry room is too small there's two washers and one dryer and yet there's hundreds of blankets that need to be washed every day there's dirty blankets stacked out that side that door because they can't get them all done if you walk down that hall the stench is try it go see the barn the barn is not the proper intake building for animals being taken off the street it was never meant for animals why do you think it was called the barn it was meant for livestock not animals yet they stack them like we like we've talked about it's too hot it's too cold it's dirty it's disgusting it's not the proper place for intake of animals that are found off the street you guys need to hire some people animal services that can effectively follow up on abuse and neglect cases there's nothing you guys need to hire people that check craigslist every single day go out to their homes and get those puppies and find those people because they're continuing to sell dogs on craigslist there's a lot more i can say i'm out of time thank unanimously with representative manelo is excused next item on the agenda is item number 15 and that is presentation and discussion on the capital improvement third quarter update for active programmed and completed capital projects good afternoon mayor and council i'm jerry demiro i'm in the capital improvement department i t can you bring up this item please i t can you bring up item 15 please i.t we're on item number 15. nit there is a video that will need to be played on on this as well i was instructed to allow you guys to play it rather than try to play it from the slideshow so again i'm jerry demiro this is the third quarter update for our capital program next slide please so table of contents is what we'll be discussing the covet impacts that we've had on staffing external escalation and material supplies cost impacts recent project developments year-to-date results and accomplishments and highlights next slide so we've shown this to you a couple of times before but covet continues to wreak havoc on the construction market prices are trending anywhere from 25 to 40 percent above what they were last year and there seems to be no end in sight so we're seeing it in terms of the cost of our projects we're seeing it in terms of trying to obtain qualified staff to do our work and not only that but our consultants are also suffering from the same thing next slide please so strategic plan alignment the capital improvement department primarily is here for enhancing el paso's quality of life through recreational cultural and educational environments and to enhance and sustain el paso's infrastructure network next slide we're continually working on uh improvements in from the standpoint of cid's internal controls we have uh trainings three times a month actually every friday morning and we have external dependencies on stakeholders utilities user departments etc and we strive to have continuous communication and deliver high quality next slide please these are our third quarter project developments from march 22 to may 22. next slide and i should mention that there's i'm going to touch on very high level there's detailed slides in the packet that if you want you can see that some of the specifics associated with that but i'm not going to go through all that so in august of 2021 we had a total number of projects at 230 23 18 we're in design it's 18 room pre-designed 67 we're in design 73 we're in bidding 65 in construction as of may we have only 11 in pre-design we have 71 in design we have 54 in bidding and 67 in construction with the total number of projects 203 next slide results next slide please so these are our results for requisitions and conferences um requisitions and encumbrances requisitions in 2018 totaled 111 million dollars encumbrances in 2019 which is funding that is obligated to a specific project was 244 million in fy 20 it was 115 million fy 21 it was 90 million and for fy 22 year-to-date it's 159 million next slide please these are our expenditures um in fy 18 we expended 80 million dollars 1938 39 million 20 137 million 21 111 million and year-to-date 70 million with a total of 539 million spent over that time period next slide please in terms of impacts for the for our spending from september 21 to may 22 we we spend approximately 70.6 million approximately 35 million of that is spent on labor as one million dollars of construction project costs involves roughly 500 000 in labor next slide our spending impact one-time impact for projects the total first to date 113 million employment impact 3499 for fy22 next slide please capital projects since uh 2018 or 2012 have generated 41 323 jobs actually that's from september 11. we've worked with over 216 contractors and subcontractors next slide please and here is our accomplishments next slide please we've 47 projects have been completed in fy 22 to date our nip projects continue to be in progress we have experienced delays and supplies for those projects but we are wrapping them up park equipment we have a number in process and fire station renovations are ongoing and we have major construction going on for the east side regional command center the mexican american cultural center the children's museum and fire station 36. next slide please these are completed projects with the highlighted projects will be completed within the third quarter 57 streets have been reconstructed geared to date and 57 from march of 2016 so next slide please 468 streets have been resurfaced since 2013. you see the distribution of the street resurfacing next slide please [Music] this park was nothing it was only dirt they did a lot the city makes very good parks the kids right now they have the best [Music] prior to this we had no control we didn't know who came in who didn't come in and now that we're here in this office we can get the drivers out on time to go pick up our passengers on time [Music] the city has done a lot and they keep on doing the best they can and i appreciate it like a lot of people next slide please so this is our active project summary we have 11 in pre-design 71 in design 54 in bidding 67 in construction next slide please and that's the high level overview of our capital improvement program for the third quarter does anybody have any questions no sir thank you bear mayor pro tem yeah sure go ahead sir sorry text you i don't know if it got there um one of the the projects that i think is scheduled is the canterbury uh trail uh system i know that there is a large amount of damage in the culvert in the middle of this uh street on canterbury is there any is there any update about when that when that project is going to commence the uh bids just came in and were evaluated and we should be starting a construction this fall my only concern is is that um on this culvert it currently is exposed ripped apart it suffered a lot of damage on the same storm that brought about four inches of of rain uh in central last summer so just concerned about about the timeline on that and the uh the if there was another storm god forbid in that area we share that concern but we didn't need to take the time to do the design properly so that it could could withstand those type of storm events in the future where we expedited uh procurement and are now trying to make sure we get everything in place for council to approve the award that's right thank you the other question i had relating and this is probably more i know that we had an update relating to the paved trails and the you're muted sir you're muted sir we can't hear you i was a self-mute on there so um just had a question relating towards the paved trail program i know that recently there was a presentation and we had to cut back significantly on a lot of um what was promised to the voters as part of the 2012 quality life bond but i'm curious about what sort of strategies we're looking at for alternative sources of funding looking at grant grant opportunities whether from federal state funds relating towards completing those paid trials that were promised to the voters i think as i mentioned to all of you in individual briefings that the projects will be shovel ready and so they're more likely to be able to be awarded grants should they become available what what are what are we currently doing in terms of of researching of these grant opportunities that's being handled by our grants folks who are watching the federal grants very closely thank you thank you representatives hi jerry thank you for the update um question about the lighting on hunter mccombs um it says it's it says it's um in design or pre-design excuse me uh could you could you elaborate on when construction may start uh construction's probably a year away we will bring those contracts the engineering contracts for hunter treywood mccombs as well as wrestler and engimeer at the next council meeting for approval and for example hunter doesn't have a median so if would that the lighting go on to would we propose a meeting or would it go on existing sidewalks i believe it would go on existing sidewalks i'm not familiar with that detail the project but i can look back and let you know for sure well it's in pre-design now just know that i i do want to see closely the design work um on hunter at least that's the only one that i can tell that's in my district um but yeah i would love to see the progress of that um the other question fire um the title 20 zoning code update it says to be determined is there is there a dollar amount tied to the title 20 changes i'd have to let mr hoffman speak to that and i don't think i think he's left the meeting so i will find out okay so the 20 is this 2020 a capital plan i just i'm trying to understand what the scope of that project is um anytime there's any changes to the code um i'd like to to follow that closely especially given the fact that zoning is is a huge issue for our community um so if we can get more details on what the status is of that on all of the proposed reprogramming for any bond renovations can you confirm that you've worked with bond council on any potential changes any concerns about voter approved the uh voter approved for renovations was strictly renovations and they're they're not being necessarily reprogrammed they're programmed for later parts of the funding program and any changes that we have for example if we said we're not going to renovate stations two three four five and six that we would bring that to council for approval right i'm just i'm just so concerned about the ongoing cost drivers added to this i'm just i'm just very concerned that we're not going to be able to fulfill the the request the the mandate really from voters and so i know you give us updates on that but i really do believe that this council needs to have a larger discussion about like what are our next steps we committed to the voters that this was going to cost and what we're going to do is it a matter of coming back with the co package as a matter of just going back to the voters i don't know what how to go about that conversation but just know that i'm getting i'm getting very concerned that all of these changes and cost drivers are taken away from the overall project intent and request and so we need to we need to have a serious conversation council as to what we're going to do what we're going to do with that those bond dollars um is it something that we hold off is this something that we wait and we we we ride the um you know just until it settles the the economy and the large inflation rates so just know that i'm i'm having those hesitations and in the near future we need to to strategize on that and then the other thing is streets and the cost for repaving streets i do again if it's a simple resurfacing i'm going to urge our administration management that we need to look at low bid type of procurements that are being issued out for streets resurfacing streets for reconstruction projects i agree you need to have quality those type of higher best quality type of procurements but for resurfacing that is the standard that the state has as well um it should be low bid so that we can get a bigger bang for a buck um so those those resurfacing contracts are unique price contracts they they are essentially low bid contracts okay and we are also because of the level of sophistication on some streets is not as high for contractors we've gone with some streets that we go a little bit instead just to make sure that we we can get the work done okay i understand anyway thank you for the update um look forward to further conversations about the design work for the lighting okay thank opportunity to be able to speak on this application for property rezoning i have called in to voice my opinion for approval of the rezoning for this property there are provisions set for this property people against in planning a meeting and i do have a petition here of 28 people against it we oppose this due to uncertain what the owner will bring as a business or mixture of permitted uses we opposed this due to safety issues in other words like having bringing in a business that would pollute this great neighborhood we have citizens living nearby in the area and these properties had two houses on it before it was thrown down due to the extension of hawkins okay the sofa that you see in this picture has been removed but there is more accumulations now of tires on the property also the property has had semi trucks parking there that go over the cement if you could see in the picture too where it's the markings of the tire we just had another part another truck just recently parked there we have three commercial properties that are closed in the area just accumulating trash or tires a bar a restaurant bar right a north loop and hawkins we also have a plumbing place that's been closed down please consider leaving the property as a net a2 and foreign to being any need on one of repairs tires places bars we have all of these on north loop already we do have uh like i said council members good afternoon sir thank you for letting me be here my name's scott winton i'm representing the owner as a planning consultant the owner asked me to help him through this mainly because he just wasn't quite sure about how the process was when we started this we asked for a c4 zoning had numerous meetings with various members of the neighborhood association downgraded our request to a c-1 we have also agreed to a number of conditions one of them including a site plan submittal so i think that will should satisfy the opposition's concern about not sure what's going to happen there we've also agreed to a limiting a number of uses so that no automobile related uses to help protect the neighborhood which we agreed with also no neighborhood bars no no nightclubs things like that which again we agreed to and also limit no vehicular access to dale street which we also agreed to so i feel like that we've have done a very effective job dealing with the concerns of the neighborhood and just ask your support on this if you have any questions i'm available thank you sir representative yeah hold on we still have um anymore that's that's it sir thank you representing london followed by representatives i just wanted to i'll say some comments in a minute but i wanted to check in with the staff was there anything else that you wanted to add on this rezoning request uh thank you ma'am roll over step by inspection so the only thing uh would be to read in the recently added conditions into the record and those conditions are that a nightclub bar and cocktail lounge be prohibited on the property and the second recently added condition is the prohibition of vehicular access to and from dale road shall be prohibited that is honor okay so i'm going to make a motion to approved with the revised conditions as is and and so just i wanted to just explain really briefly sure um so initially there was a request to consider um and this and i believe the city plan commission uh denied the initial request um which was to have like a storage of facilities commercial vehicle vehicles and you know in that area very close in proximity to the railroad it just um we did members of the community just did not feel comfortable with having additional idling trucks or or just a very high use industrial purpose for that lot it's a very narrow lot i'm currently as as one of the members of styles garden and neighborhood association mrs viagra thank you for being here the current state of it is just this vacant lot it's not being used there's there are no efforts to put apartments there um i i believe it would be too narrow of a of a lot to have to have apartments maybe you can have one or two but it is along a major or tier state roadway really it's north loop and so you do see other nightclubs in the area and so i know you know having a density of too many nightclubs isn't the best use for that space which is why the the um owners were really um you know cooperative and we appreciate mr winton's support on that he's hosted the members of the community at his office i've met with them one-on-one and so i really appreciate that coordination with the the property owner and with the public this is also my neighborhood in full disclosure so you know what i want for this neighborhood is what's best but also to ensure that we are promoting more responsible development there's several letters of support in your backup as well so i'm comfortable with the proposal today i think that the conditions are really going to protect community members um but you know if it's if i feel comfortable with it in my neighborhood as well so i expect that um the property owner will stay true to the request we're not prohibiting sales of alcohol you know if there's a there's a request for like a restaurant and things of that nature we welcome it we want to see more retail we want to see more you know restaurants and entertainment so i'm i'm comfortable
