thank you and welcome to the Mesa city council meeting for February 24th 2025 and all our members of our counselor present it's nice to see the sun shining through the building here this evening it's great we'll begin our meeting with an invocation by Pastor Richard Coro and with the Victory Outreach in Mesa and followed by the Pledge of Allegiance Pastor K come forward please stand on thank you mayor and thank you all the council members let's go before the Lord Heavenly Father we come before you and we thank you God for this beautiful day that you've given us and we kind an honor and a privilege Lord God to be able to help serve our community we're just asking God for an outpouring of your spirit Lord God upon all our family members our loved ones God upon our city God we praying God for your hedge of protection Lord not only just Upon Our Community but also those that serve and for our law enforcement that You' protect them as well and we're praying God for wisdom and guidance here today Lord as our council members make decisions upon items that are discussed today we ask that you lead us and guide us and direct us father as we thank you in Jesus name amen God written item 3A approving contract for State Route 202 Red Mountain shared use path the majority of this Project's funding will be reimbursed by a Federal grant item 3B approving contract for police Department headquarters building renovation construction manager at risk guaranteed maximum price number one of one this project is funded by 2022 Public Safety ponds and Public Safety sales tax item 3 C approving contract for SL Park women's locker room and performance lab construction manager at risk guaranteed maximum price 10 of one item 3D approving three-year term contract with 2-year renewal options for Water Reclamation polymer for the Water Resources Department item 3E approving three-year term contract with 2-year renewal options for APG neuros airation blower parts and service for the Water Resources Department item 3F approving 10-month use of a Cooperative contract for water and wastewater industrial plumbing supplies for the Water Resources Department item 3G approving three-year term contract with eight one-year renewal options for one total trih halothane online analyzer with annual maintenance and support for the Water Resources Department item 3A is approving dollar limit increase to the term contract for lubricant oils incase for the water resources and fet services departments item 3i approving four-month term use of a Cooperative contract cont for General Motors original manufacturer Auto and light duty truck parts for the Fleet Services Department item 3j approving 28-month term use of a Cooperative contract with renewal options for Bridgestone and Goodyear tires for the material supply warehouse for Fleet Services and the Mesa fire medical departments item 3K approving use of Cooperative contract for one replacement aircraft rescue and firefighting vehicle and one replacement platform AAL liner truck for the Mesa fire Medical Department this purchase is funded by the 2022 Public Safety bonds item 3L approving one-year term contract with four-year renewal ions for industrial building Plumbing electrical and HVAC materials for the material and supplies warehouse for Citywide departments item 3M approving 9mth ter use of a Cooperative contract with renewal options for locks door hardware and related par and services for the facilities management department item 3n approving three-year term contract with 2-year renewal options for payment preservation materials for the transportation department item 3 approving 13-month term use of a Cooperative contract for replacement shade structures canopies and partson services for shade sculptures for the parks recreation and Community facilities Department item 4A approving resolution for the Mesa Police Department to submit Grant applications the Arizona governor's office of Highway Safety for Grant funds item 4B approving resolution to extend a natural gas transportation service agreement with El Paso natural gas company for a 50-year supply period item 4 C approving resolution extinguishing a portion of two 20 foot public utility and Facilities easements and a portion of a 15t public utilities easement located at 1 39 North Dobson Road to accommodate a new multif family development item 5A approving ordinance was zoning case 24891 for property located east of the southeast corner of Lindsay Road and Cano street reone with plan area development overlay for single resident subdivision item 5B approving ordinance for zoning case 24469 for property located east of the southeast corner of Recker Road in Main Street reson with plan area development overlay sight plan review for multiple residence development item 5 C approving ordinance for zoning case 24818 for property located east of the northeast corner of sasman road and posos road reson from employment opportunity to General industrial to allow outdoor storage yards and item 5D approving ordinance amending table one and mesa city code Title 5 chapter 17 to remove the water impact fee category column to confirm discontinuation of this fee mayor and council members these are the items on the consent agenda thank you Mr Christopher okay we have a motion by Miss billsberry second by Miss Duff if you will cast your vote okay our voting is unanimous thank you next is uh item six introduction of a zoning ordinance the proposed lofs of 121 and 129 North Beverly and uh I think we decided that I will ask for a motion to continue the introduction to the March 17th 2025 city council meeting if so is there a motion to make that happen have a motion by vice mayor summer second by council member Duff please vote okay we're unanimous on 6a thank you next we have uh item seven is uh from citizens present and we have uh three people to speak I'll start with Mr David winstanley Mr winstanley if you'd come up please and obviously I've said your name but your address would be help too thank [Applause] you excuse me for reading my comments but I'll try to be precise as a result uh mayor Freeman members of the council and staff members thank you for letting me speak tonight my name is David winstanley I live at 100060 East topaz in district 6 in southeast Mesa I've lived in Mesa for 25 of my 45 years in Arizona this city is a great place to live and a great place to raise a family I plan to live here for as many more years as the Lord will permit me and I speak to you only to maintain or improve the quality of life here in Mesa the federal government is currently going through a rather significant examination of scope and cost of government we The Usual Suspects who you often see speaking at this time would like to have a similar discussion regarding the city of Mesa government the federal government process is rapid and chaotic we do not see the need for that but we are requesting an open and honest discussion of the necessity of function and the costs of city government in a calm and rational manner I do bring to you first the 12-step process that the city has published for budget development and approval specifically steps 10 and 11 which are for public input and final adoption of the budget respectively and these steps are performed if these steps are performed in this similar manner as was done for the utility rate increases in which public vote um sorry is in the same meeting as the um vote for the sorry if the public input is in the same meeting as the vote for the um budget it gives the perception that there is no chance to change and if you remember the December 12th meeting The Interchange between Council and staff it was pretty clear there was resistance to change resistance to making a difference it looks like it's a done deal I would ask you to examine the process and consider such changes that would permit at least the appearance of consideration of public inputs without requiring the structure of twoe notices and other things that make it looks like there isn't time to give consideration to Public's input one option could be a study session special in which the public input is permitted with or without Council comment the second thing I would like to ask you to consider is other costs that the city puts on its citizens especially when you review the summary that is in the pfr document um it shows that Mesa is in the middle of Arizona City for total cost to its citizens but Does it include everything for example councilman Summers and I must pay an additional $1,250 a year in East Mark cfd and other special East Mark taxes the city council acting as the cfd board has decided to make this tax permanent by authorizing bonds for the cfd purposes some of you may have been on the council for that decision some not but it is uniquely bad idea do other parts of the city have to pay special continuing taxes for their infrastructure the East Mark and its nearby facilities did not get a chance to vote on those bonds David you just have a few more seconds all right thank you thank you there's another uh cost that we have on street lights and street signs that we have to pay for in East Mark that I've confirmed with the city attorney these are just examples of things which are important to us as Citizens and why we're we're asking to look more closely at the budget thank you for your time and thank you for the extra few seconds you're welcome sir thank you well next here from Michael Peron thank you mayor council members my name is Michael parin district 6 7235 East Hampton Avenue sweet 1115 green Farms Mesa I'm here to speak about the same thing I've been here a couple times about adult use delivery ordinance 5601 um I was here back at that meeting uh where you guys were talking about the tax increase and all and I've been back since um again uh 5601 created a Prohibition of marijuana for recreational marijuana and since the last time I was here I've done a little bit more research that um the prop 207 passed uh November 3rd in 2020 and was certified November 30th uh 5601 wasn't passed until December 8th um part of prop 207 created um Arizona ARS 362857 which gave the city the ability to create your own ordinances rules regulations regarding adult use marijuana however it does have an actual limitation on your Authority that a locality may not enact an ordinance regulation or rule that is more restrictive than a comparable organ uh ordinance regulation or rule that applied to medical marijuana thus be it delivery originally delivery was not allowed um in 2018 stakeholders with the help of city council and the mayor was able to pass the text amendment to allow for medical marijuana delivery I don't see that 5601 aligns with that stat statute um be it that the actual prohibition on delivery is a greater restriction than for medical marijuana I've been encouraging the council to take this seriously I've reached out to the attorney's office to the manager's office to um Scott Summers I I have received responses back but all the responses is that this is going to take time um this is a process I I was aware and participated in the 2018 text Amendment goes through uh discussion like we're having right now then Planning and Zoning study session and Zoning public hearing city council study session city council hearing um 20 5601 passed in like two months from November 3rd when 26 uh prop 207 passed to December 8th so I'm I'm just encouraging to to start the process we've had the dialogue the discussion when looking at the ordinance it's two sections of the city code that would need uh 12 letters or 12 words excuse me six of them being the same and it would be or dual lie or adult consumer in three different sections I think it's fairly simple change um I don't think it asks for a lot it would have a net positive benefit on Public Safety as delivering marijuana from the business rather than having the consumer drive to pick it up reduces traffic on the roads makes things safer there's already regulations for the businesses to the do these deliveries we're tracked we're gpsed we have to be accounted for we can't sell out of the car all of these regul have been in place since November 1st of 2024 and other cities are starting to deliver this prohibition only excludes the city from any of these revenues so I again urge the city council mayor attorney to push forward on a text Amendment and allow for adult use deliveries in the city of Mesa thank you thank you Michael appreciate that next hear from Scott olette Scott if you'll come forward and go Council thank you so much for uh allow me to speak with you today public speaking is not my forte so if I stutter or get out a get out of sentence I apologize my name is Scott wette I'm 1338 South Oracle in Mesa I'm under uh Miss Duff's District district 4 um I just wanted to talk about a couple of things that I saw in the January 13th meeting um two subjects up bipartisanship and Dei and you know these these are two things that are very heated right now within our our our atmosphere and climate around the nation um just a quick background you know I moved here in 99 I've been a resident of Mesa since 09 where I bought my first house and we we know my family is Mesa my wife graduated from Mesa High my kids are at Mesa High you know my my nieces and nephews you know they're all graduates of mesah high so we truly are part of Mesa and when Miss spillsbury mentioned by partnership that's where I'm going to start with first that meant a lot to me because there's a lot of tip fortat there's a lot of of stuff going back and forth where people just don't get along and to hear that that that got brought up that brought a little bit of Hope to to uh to Mesa for me um to to kind of put my my thoughts into perspective with by partnership I've seen a lot of town hall meetings and citizen meetings get out of hand because people just don't get along so I really hope that what Julie said you guys hold to and we're all watching you know you're seeing a lot of people stand up now out of the blue out of out of the woodwork speaking their minds because we are tired of the fighting we're tired of people not getting along and we need our local government to stand up and do what's right and not fight you know we we got a dictator in our in our in our federal government that is pushing everything to the side when it comes to legal matters and and is driving a lot of us crazy you know and and unfortunately my trust for that particular party has waned significantly and there's it's it's hard it's very hard because I was once a republican my dad was a Republican and and it's just to see where that party has gone it's gone downhill it it's it's it's truly concerning from from a citizen standpoint so I really want Mesa to stand up and and truly show that you guys can work together and this kind of side side steps to the D portion that Citi and made you know from my understanding there really isn't a DI policy at Mesa because Mesa is very diverse you know and even that video that you played at the beginning talking about the uh the indigenous um culture here that's that that meant a lot to me to see that and if we can continue to be diverse we can continue to have a strong organization and a strong government so I would like to you know that's all I got to say and I really do appreciate you taking time to listen to me today thank you scottt thanks for taking the time to talk to us just on the Note uh because these are not agenda items we can't respond to you but sometimes the staff or council member may follow you and for those watching on Channel 11 uh we can perhaps get some information and we can respond back to you that way so with that uh Council uh I'll entertain a motion to
