ladies and gentlemen my prayer today is based on James chapter 1 verse 5 which says but if any of you lack wisdom let him ask of God who gives to all generously and without reproach and it will be given to him let us pray oh Father God we your servants have humbly come before you today to ask for wisdom we hold to your promise to give to all generously and without reproach father to task before this council is vast and we thank you for the wisdom that will come from you as they seek to manage your gifts for your people and with that wisdom we also ask that you grant your servants here knowledge the correct application of that wisdom to the various decisions and issues that lay before them let the work of our hands and the words from our mouths be sweet smelling Aroma before you as meeting for major events this motion is related to events that have more than 30 million dollars in economic impact and have National importance it allows us to establish temporary signage rights and comply with legal guidance the previous major event item helped us move forward with support for the Final Four the great job we do on all of these has earned us the nickname Championship Valley and I GCU for the community Assistance Program do we have a motion move to approve item 42. second we have a motion in a second vice mayor and sorry thank you mayor I'm very supportive of this agreement but I just have a few questions for staff that I wanted to ask Eric vice mayor members of the council Ginger Spencer Deputy city manager along with Dolores Ernst who we also call DC who is the cap program administrator thank you so much I was wondering if there are any specific boundaries where these cap Specialists will be serving so the item before you today item 42 is so that we can enter into lease agreements with two organizations one is Downtown Phoenix Inc so that we can add either a crisis response unit or a behavioral health unit in the district 7 area right now we currently do not have one in D7 so that would be that location and then it's also an agreement with Grand Canyon University so that we can add a crisis response unit or a behavioral health unit in District Four which we currently do not have a location in that District but that would allow that and so by adding these two areas we will now have units Citywide thank you that's great um I know I understand that the downtown Phoenix office will also host Valley Metro and Community Bridges as well as and they obviously also have the downtown Phoenix ambassadors which do really great work in the area how will these organizations be coordinating with cap Personnel to ensure that um every situation is thoughtfully responded to mayor vice mayor members of the council so these Partnerships we are very excited about we have had conversations with devony price and when we mentioned the cap program and what we were doing she definitely was very interested in making sure that we could bring a unit to the downtown area and then specifically working with her organization DC has had the direct conversations Dolores Ernst has had the direct conversations with Miss I'm sorry and I said devony price it's devony Marley Miss Marley sod asked DC to to address that thank you vice mayor mayor council we are in communication with how we will communicate the needs for those who are in need of services downtown we're continuing to have those conversations to develop how we're going to respond and how we're going to support each other and meeting the needs of our community okay and then where do and I I'm not sure if you have this data readily available but where do downtown and the GCU area fall in terms of areas with the highest need or where we've seen data show the highest need for mental or Behavioral Health Services vice mayor and mayor council members currently um we are working on getting the data to show where the calls are at we've been working with our its Department to develop a dashboard to be able to show where those calls are at so unfortunately I'm not able to provide that information at this time but as soon as we have it we'll share it with you okay that would be great and I just want to applaud the work that you've done I think the day that the Phoenix City Council approved 15 million dollars for the crisis assistance program was historic because we know that there are very specific mental and Behavioral Health calls that our Police Department may not be equipped to respond to so it's really great to see this targeted approach and seeing that we're going to have cap presence in strategic areas of the city and I really hope that we can find more Partnerships like this I want to thank Downtown Phoenix Inc they're always very thoughtful in bringing in the right Solutions at the right time and beyond their ambassadors the the work that their you know the Phoenix cares team has done in partnership with them has been really helpful to Residents and businesses in the area so hopefully we can emulate this in the future and I just want to thank you all for the work that's gone into this thank you vice mayor thank you any additional comments we do have Diane Barker to provide testimony to the Phoenix City Council is there you go Mike okay Mike Mike I'm Diane Barker in district 7 and I did contact Daphne in support of this I wanted a little more information so I'm happy to see these cap people here this program my concern is is that the City of Phoenix and in the case of Hance Park I have personal knowledge of this Fields off to third parties for insurance and then says they don't have anything to do with it then when you ask for public records you can't get the agreement well this has got to stop and I'd like to see where the insurances because I understand there's going to be a van and anybody that would be driving that in my perspective with public money is that they need to be trained and they need to keep to the speed limits and they need to not be taking it home for personal use but to be using in a crisis Manner and if they're going up around hence Park my friend was just telling me because she lives in Portland Place when she walks ASU she finds homeless people on the street in the morning all the time and she let you know the neighborhood know last evening that it's very very inappropriate particularly people that are making money off of these programs or people in general to deny homeless people services and I know we're rapidly working to get them sheltered but we need to do a better job and we need to have liability and responsibility at the City of Phoenix under the oath in service to the people thank you Diane for that testimony roll call yes Hajj Washington yes O'Brien yes pastor yes Robinson yes dark yes wearing I'm sorry yes there you go yes that says nine zero item 50 is the public transit Financial advisory Services contract do we have a motion move to approve item 50. we have a second from councilwoman Stark thank you uh we have two speakers on this item we first have Carol uh Carol Steins followed by Jeff Caldwell mayor vice mayor and council members regarding spending money on advisory advisory services for Transit we've seen the City of Phoenix wants to push public transit I'm wondering who would be on this advisory committee that you want to spend our money on I'm certain it would be packed with those who support increasing public transit the council members forget they're reluctant to represent the citizens and not to go along with a failed agenda one that doesn't reduce emissions the people you represent want the autonomy privacy and freedom of cars automobiles have been a net positive for human well-being citizens don't want us to keep wasting money on a plan that doesn't work and is not needed car companies have made changes in gas-fueled cars that have had an impact on our air quality we can keep doing that most of the ozone inner city and county is the result of naturally occurring events or from emissions outside of the country mag has already admitted that removal of all four million internal combustion engines in the metropolitan Phoenix area would not bring the county into compliance with ozone standards stop wasting money instead of spending money on advisory services for the transit public services department spend money on advisory services for Road expansions repairs and that type of thing Jeff is our final speaker good afternoon mayor council members thank you for letting me speak today I am concerned that the contract with this entity will lead to more Road diets restricting our uh traffic Lanes in order to implement more bus Rapid Transit and expansion of the light rail when we did the expansion of or implemented the light rail initially we saw multiple businesses go out of business and uh when it comes to Road diets that also constrains the ability for businesses to be successful as well so with that being said I highly encourage the council to look over the proposals that this entity provides to the council to prevent further constraints on our regular vehicle transportation services and with that thank you very much thank you any comments oh we have Leslie Shepherd as well hello I'm sorry I was able to just get here is there a reason why the mayor's not here is there a reason why we have vacant seats sitting up here right now this is the city council meeting and this is the only time that we the people have the right to come and spend 120 seconds to share with you concerns that we have when I hear people up here came up here and reading I saw you guys doing all different stuff I understand I know how to multitask well I'm not disrespecting that but I think what's happening is there's a lot of hidden agendas underneath what's coming forward this thing that mayor mayor that we brought up last time we were here saying that she's the only American and that's important for everyone in this audience to recognize she is the only American pushing these issues the world economic Forum if you're not familiar with it I encourage you to check it out these are the people who are deciding our future and if anyone's sitting here nodding their head saying no that's not true either you're a liar or you're deceived that's the only two choices this world economic former forum is moving in on our territory they're using some of you some of you are in their pockets I don't think all of you are I think the mayor absolutely is and why is that even when you make a little commercial after the last one we have when somebody made a comment about pouring some cereal into a bowl and bugs being in it she goes and makes a vid a little little cap shot saying you know a little bowl it's got milk in it in an empty box and it said you know we are used to propaganda and we're tired of it when you try to protect yourself with some little Forefront picture or you got your little built-in people who call in and say what can and can't happen you just have to understand you make yourself an enemy of the people I don't know if you guys are aware of the fact that there is a court filing that's happened back on August 18th and that court is in common law court it's not going to be in the administrative Court you know what that means it empowers we the people our voice to have an actual voice when it comes to court administrative courts are built against us constitutional courts are built to empower us I'm I will and we need you guys to be here during the meeting times I would like an opinion from legal uh when an item is off topic um so the the mem could you please yeah the public can only comment on agenda's items if they're not talking about agendized items they need to speak to that at the end of the meeting under the public comment section okay thank you good question thank you councilwoman pastor all right back to our vote with pfm financial roll call yes Dodge Washington clerk read the title item 74 is for ordinance g7162 an ordinance amending a portion of the Phoenix building code specifically the 2018 International building code section 310.4.1 care facilities yes passes 9-0 next we go to item 76 which is related to the southwest corner of 15th Avenue and Jackson Street we'll begin with the staff report thank you mayor item 76 is z-sp-5-23-7 a request to rezone 5.5 Acres site from A1 Capital Mall overlay to a1sp Capital Mall overlay to allow a safe outdoor space and structured Campground the subject property is located at the southwest corner of 15th Avenue and Jackson Street the site is zoned A1 light industrial and Falls within the Capital Mall overlay the proposed site plan for the safe outdoor space will include restrooms for showers indoor space for heat and cold relief and there will be no walk-up Services provided on the site I'll jump ahead to this slide on the slides are photos of the exterior of the building and the canopy structure the Planning Commission a recommended approval with a modification and additional stipulations by a vote of four to one the staff team has continued to coordinate with the council district 7 and 8 offices along with community members as a result of those discussions modifications to stipulations were developed that add restrictions regarding a maximum of 300 individuals on the site creation of a seven-member advisory committee and the requirement for a quarterly email or letter to be sent out to the community these modifications are addressed in the September 18 2023 Memo from the planning and development director staff recommends approval for the for the memo from the director and Adoption of the related ordinance mayor happy to answer any questions thank you do we have any questions on this I do oh sorry please go ahead mayor I wanted to ask staff uh regarding um Bill Moreland uh sent a an email and he is asking uh the council to do one of two things uh the first one is to include a deed restriction and the purpose doc purchase documents that would guarantee the property cannot be used for camping or a shelter without the support of of a group of Neighbors named in the deed or make a public comment commitment to not support the future renewal of a special permit without the clear support of surrounding neighborhoods this would be neighborhoods from I-10 on the North I-17 to the on the west and and South and 7th Avenue on the east is that possible mayor councilwoman Pastor that language is is possible to do staff does not recommend inclusion of a deed restriction at this time the the zoning case has stipulated has language in there requiring that within three years the special permit would be revoked that is allowing the outdoor camping use or the council at that time would have to extend it a a deed restriction is a private form of governance that is typically placed on properties when you have an HOA and other entities that are trying to regulate via that private deed restriction in this case we have the council that's required to have a public hearing and decide what would happen with that parcel in the future or the the special permit would be revoked pursuant to the existing stipulation so uh you know that's what staff would recommend that the council do at this point okay and then um I guess we would have to make a public commitment to not support the future renewal I don't know if it's if he's asking counsel or if it's staff so uh mayor uh councilman Pastor I believe he's asking the the council for the commitment because ultimately it's it's up to the council to decide to extend the special permit or not uh staff on this effort as led by uh Gina Montez has stated an unequivocal desire to have this use moved in in three years and they're working as you all know very diligently to address the issues but we don't know what the the world holds for us in three years and so that's you know something that staff is firmly trying to make happen but it's up to the council to decide if they wish to have a deed restriction or make an individual uh you know Declaration of what they would do three years from now if they're on the council and maybe we should turn to the vice mayor in whose District this is located who's been putting a lot of time into this um and I think who did some work to lead to today's proposal vice mayor thank you mayor um I appreciate the question Alan I just wanted to follow up on that question I understand the the concerns around deed restrictions that's the only other question on that matter that I wanted to ask is we've been having a back and forth back and forth on this and I know it's something that neighbors are asking for is that something that could be considered in the future I mean will there be an opportunity during the process and I'll get into this in my comments but through the advisory Council that there's going to be and through the next three years to look into that option as a possibility um or um and even after the three-year use permit expires mayor vice mayor Ansari the the deed restriction option is a function of the city owning the property and not a function of the zoning case and so in the future uh you know future city council could consider doing a deed restriction at any time that the city owns the property okay so just just I guess I just want to make it very clear that even if it's not part of today's conversation it always could be considered in the future that's correct vice mayor okay thank you and then after approving this use permit what is the timeline for when we will start to see safe outdoor spaces offered to individuals that we engage with uh mayor uh Vice Mayans sorry I'm going to ask Miss Gina Montez and uh their staff to come up and answer that question or they're working diligently on that but I'm going to get the the latest and best information from them thank you thank you mayor Vice members of the council um our we are working to to get the safe outdoor space open as soon as possible there are some improvements that we need to make to make sure that it's um that we have all the amenities and everything in place so um so our desire is for it to be early fall and we'll we'll acquire the property in October and then we'll move as quickly as as possible to to get it open thank you and then I just have a couple of comments um I just wanted to really start off by saying that this was not our first choice and how we choose to respond to the homelessness crisis our city has prioritized indoor shelter and I want to thank Gina you and and Rachel and your team and really working so diligently you know the fact that we brought 600 beds online last year and we have 800 more in the pipeline this year I think is commendable but with competing lawsuits on the table and the fact that we really do absolutely need to show consistent Improvement in the situation around the Zone I think I am looking forward to moving forward with making this safe outdoor space as Humane and as successful as possible many large cities have tried this as well so I hope that we are looking at what's worked and what hasn't worked in other municipalities we do need to get our unsheltered neighbors off of public right-of-ways where they are often preyed on and into more secure shelter and this safe outdoor space one of the things that I think will be um you know hopefully will be very successful with this is that we will be providing wraparound services on the site and it will be you know we will have bathrooms and water access and shade and and access to air conditioning which I think is critical especially during our extreme heat months I do want to again put on the record that I do not agree with the location of where this is going to be I do think that downtown and the surrounding neighborhoods have taken on the the brunt of the responsibility for addressing the homelessness crisis the Human Services campus houses over a thousand individuals and I hope and I really do ask you that knowing that we have three years on this side I do want to make sure that you all are starting early and looking at all possible options across the city of Phoenix knowing that we may need a safe outdoor space in the future so I want to just take this opportunity to please ask that we start working on that immediately because I really do think it's time for other districts and other areas of our city to step up when it comes to Solutions with that I did want to highlight a few stipulation changes that my office worked to add to this item alongside neighbors who we worked hand in hand with to ensure transparency and accountability over the next three years think Josh mentioned these but I just want to highlight them again we will be limiting the space to hold no more than 300 individuals and a total of 200 safe outdoor spaces we will also be creating a seven Min seven member Advisory board that will report back on solutions to staff and recommend operation changes if necessary and quarterly to the public we also made sure that a phase-out plan is clearly named and worked on while this space is being operated and reaching its last year of permitted use and I think that is probably one of the most important parts of this plan that we really do not go into it with the intention of making this something that's long-term it really does need to be temporary our office of homeless solution has made sure that every safe outdoor space will be shaded which is great that we have 24-hour Security on site open lines of communications with neighbors and so much more and for those who may remember Lots by The Zone during covid they were managed by the county and they had their challenges but I feel very confident that we've created a plan for the safe outdoor space that will offer clients safety which I think above all is important comfort and will exceed everyone's expectations and I'm really looking forward to continuing to work with you all on the enhanced engagements and again that 80 percent acceptance rate that we are seeing among our unsheltered residents in the zone is very very impressive I think we need to continue to talk about the fact that 80 percent of the individuals who our teams go out and talk to say yes we would like to take indoor shelter and they go and they get the services they need this safe outdoor space is for that 20 percent who may not be ready yet and will continue to engage with residents there and for the future of this lot I do think that it would potentially be a great site for a cooling center or safe storage facility and I'm hoping that with collaboration with the state and our other partners which we are requiring it from we can propose a good long-term vision for it as well so I thank you for working with us on it and and I really hope that we can make sure to deliver something that is going to be that we go above and beyond to make sure that the neighbors in the area do not get further impacted thank you thank you for your important work and continued work on this one do we have any additional council member comments before we go to public councilman Hodge Washington thank you mayor I just wanted to uh piggyback off of what council vice mayor Ansari had to say about this I I too believe that the saved outdoor space is a necessary part of our solution in addressing on our sheltered population just an option I want also Echo that one neighborhood we we can't expect to have one neighbor neighborhood continue to Bear the brunt or the The Lion's Share of this problem so I too I'm in favor of making sure that we have an active and engaged advisory role by our neighborhood as well as making sure that we do have a phase out plan proximity to Service as I mentioned cannot always be the only criteria we look at and when we determine where to put these we need to make sure that they are distributed throughout our entire city so that all residents can get the services that they need they don't have to travel to our location so I'm in support of the proposal and the changes that were made because I do believe it gives us the accountability to our residents to ensure that we are making sure that they do not continue to Bear it beyond the time that we are approving it for so the three years with a phase-out plan was important for me as well so thank you mayor thank you councilwoman Hodge Washington important comments we also need our regional Partners to step up Maricopa Association of governments put together some data about shelter beds that were cited since the pandemic 78 of them are in Phoenix that is not proportional to our population nor is it proportional to the number of people who are facing eviction or challenges with affordable housing if we are going to get a great solution we need every level of government to step up that includes the state legislature we can do great things with more Partners which is not to say we're not doing incredibly important and valuable work today we do have several members of the public to provide comment I will open the public hearing we will begin with William link followed by Laurel good afternoon Council my name is William I'm within crawling distance of the zone and I prepared a statement because I can't do it in two minutes or less so I'll try to read this no good deed goes unpunished but it's the area of residence that peaceful enjoyment is at stake 24 7 365 suffering the associated trespass begging opportunistic thefts blatant thefts drug activity violence vandalism defecation litter trash shopping carts hoarding to highlight a few my second point is build it and they will come this is emboldening negative behavior free amenities water bathing food travel address phone utilities heat air conditioning Health Care clothing shoes personal storage please remind me where the incentive is to get a job past performance is best indicator of future performance all the promises and Flowery illusions lobbed at the municipality I'm Sorry by the municipality are all promises we've heard for decades I've lived in the area 25 years just look at what a cesspool The Zone became at no fault to the victimized area residents attractive nuisance this Utopia is carefully worded as a campground and my understanding of the ninth circuit ruling there is no is there there will be zero protection from area camping outside the restricted area fences all those attracted to sweetness of the giveaways but refuse to abide by the imposed restrictions that's it thank you Laurel is next followed by Bill thank you my name is Laurel langmaid and I appreciate the time I'm glad that this meeting the theme is wisdom is is that when they did the capital overlay limiting the number of beds there was wisdom because it said 400 when city council had the solution for homeless of not having one neighborhood bear the brunt of the homeless situation that was wisdom there was also wisdom when you when we did the ordinance to increase the beds from 400 to 900 there was wisdom in doing the stipulations for ordinance g6799 and one of those stipulations states that for um separation purposes by operating under the special permit area a agrees to not own operate or participate in the operation of a shelter within one and a half miles of the subjects site if the stipulations were not being met you were to be able to pull the permit that allowed the beds to go from 400 to 900. there's a lot of other stipulations that haven't been met in this so you know what they don't mean the paper they're written on too many times have we been told untruths in regards to cleanups reduction of crime community outreach etc etc and it's all been pushed by the wayside we had an administrative hearing in June where a decision was to come in a few months well he got it he got it XXX there was no decision because it was took under advisement not to provide a decision I suppose the stipulations I mean vice mayor and Sarah you said that there was 80 percent that said they took Services you have to see what the definition of services are services are not to get of shelter some of the services could be taken a post office box you need to get definition from what these individuals are saying it's not always true they told us that there would be a closed campus but it's not to be a closed campus from the thoughts and hearings and the comments that you've made you've already made the decision we're doomed in the zone thank you thank you thank you Bill is next and then Diane Barker is registered to speak if necessary hi my name is Jimmy Christmas hi my name is Bill Marlin I'm the owner of Electric Supply Incorporated down in the area near the Human Services campus so a lot of the things I was going to say have already been addressed because uh you know I've been communicating directly with some of the council people the last few days so thank you councilman Pastor thank you vice mayor I'm sorry for working with me on this so I to some degree Echo some of what my neighbors say this is not the right place for this I wish this wasn't going to be here but for a number of years I have been saying that the city needs a location like this unfortunately at this point I think this is the only place it's going to happen so I am asking the council the reason I asked for the deed restriction was because I know the city wants this to be a short-term thing but the city wants a lot of things to happen stipulations can change different Council people come in staff changes and there is no real way to ensure that a three-year time limit will really happen so a deed restriction was an idea that would put a legal framework in place that would make it stop at the end of the three years that we all agree is the longest that we wanted to operate so um you know barring that a commitment from each one of the council people that when this thing comes back up again for renewal in three years if it does the you will not support it because we are all agreeing including the city staff that three years should be long enough we should be planning for how we're going to shut this down almost immediately as soon as we open it so we want this to be as positive as beneficial as we can for everyone who stays there for the neighborhood that surrounds it but we need to make sure that we have some guard rails and enforcements in place to make sure that happens so um you know so I also want to make sure that because this issue does affect a lot of neighborhoods not just the one directly around the campus that the advisory Council does open up the opportunity for involvement from people from surrounding neighborhoods from as far as story Woodland down to you know 17 on the south so we can get Central City South involved in there so I do think this has to happen I wish it didn't have to happen in my neighborhood I think we've done enough in District Seven already but um I just hope that you guys will do everything possible in order to make it as good as it can be thanks thank you and then we have Diane Barker to speak if necessary mayor Diane is no longer here wonderful I think she did touch on related points in her earlier comments I'll go to councilwoman oh I'm sorry I will close the public hearing and go to councilwoman pestor yes I just heard two testimonies so I'm asking staff um there were stipulations done in the past or earned current and how do you answer uh to those stipulations that were placed um mayor councilman Pastor I think what the speakers were referencing were the stipulations placed on the Human Services campus when the last case came before to increase the number of beds and um and I I can only speak to what our commitment is as the future operators of the safe outdoor space and that on Our intention to um comply with every single stipulation the stipulations that um that are proposed and um hopefully will be in place we have no um hesitation or concern that we will not be able to comply with every single one of those so our desire is to do um is the same as the neighborhood's desire we want it to be operated well we want to help people and they're homelessness and we want to make sure that there is no negative impact to the community and I do do believe that that on balance it will be a positive impact on the community because this is our tool to help us complete the process that we're in right now to get people off of the street out of the right-of-way and in a safer place mayor councilman Pastor if if I could add to that as it relates to uh the zoning case around the Human Services campus which is special permit 2-19-7 that uh zoning case had a number of stipulations associated with it uh and is the one that is currently under review by the hearing officer that was referenced by one of the speakers and that's because one of the stipulations required a two-year review of the operations of that special permit and so that was held in terms of all the other stipulations we believe that those are substantially met there is one that the Human Services campus had proposed to have a a an Outreach team that would go do cleanups that were further away from the campus and so that was something that HSC had proposed and we don't believe that one is is up and operating but we do have the cleanups that HSC is involved along with the city in the immediate area all around the campus brother-wise they're in compliance with their stipulations okay um my second question is the neighborhood Advisory Board I do think you need to expand so um I would like to see an expansion of that um and I don't know who makes that decision um councilman Pastor are you referring to increasing the number of people on the on the board or the the geographic area graphic area I'm asking for the geographic area be further than I believe it's a half a mile or a mile so I would like to expand it out and and we as um as staff were going with the general distance in in Planning and Zoning cases and I believe is that a mile um right now it's at a mile and that would take us to all the way um to I-17 on the west to Central Avenue on the East and down to I-17 on the south as well and almost up to I-10 if you would like to extend it beyond that um where you know we don't have any objection to that we were complying with or kind of going by what generally is accepted in terms of what's required in terms of zoning so if the geographic area I might propose a mile and a half beyond that as opposed to a mild that would then take you further further south of I-10 on the south and all the way out to 27th Avenue on the west up to McDowell on the North and almost to 7th Street on the East so that would be if the council would like to do that I'd propose going to a mile and a half as opposed to I think that captures more more neighborhoods I think it would capture more neighborhoods but I also think it says half a mile for property owner so other property owners within that area not directly across but within that area are affected by it I think of Van Buren in 15th Avenue and all the way down to 19th that I've traveled very a lot and uh to the east so I would like to expand that absolutely councilman Pastor members of the council if it's the council's desire to have um not only neighborhood associations but also Property Owners within that mile and a half free DSP um able to participate we have no objection to that of stuff okay so I would like to see that vice mayor comments and a motion great um I think my only final comment on this I think the the main purpose of the advisory Council what I want to ensure is that it's productive I think we have seen um you know we have quarterly Human Services campus meetings for example that my team and I join regularly and that is for everyone across the city and sometimes they can get a little bit off topic and I think that's why it's important to make sure that we are talking about only neighbors and and property owners who are directly affected by this so I think a mile and a half is fine but I just want to make sure it maintains productivity because we're lacking that somewhat in the other groups that we have so with that I I moved to approve item 76. second perfect end do we need to do it per the memo from September 20th oh I apologize yes and adopt the related ordinance I would just know for the record that we are changing stipulation 14 uh under e where it talks about the notice to set with all property owners and registered neighborhood associations within one and a half miles of the site great motion to approve for the September 18 2023 Memo from the planning and development director and adopt the related ordinance second we have a motion and a second comments councilwoman O'Brien thank you I I just want to further clarify and in that motion it includes the mile and a half right okay um I have a question about item three h uh the code of conduct that will be posted on site I'd like to know more about the code of conduct and who is in charge of enforcement I remember mayor members of the council councilwoman O'Brien so uh are off sorry our office is drafting the code of conduct now and so we we as the operator will be responsible for enforcing it however we will have other partners on site to assist us in that effort um as well as private security to assist us in that effort so we're drafting the code of conduct we're utilizing um not only Co the code of conduct that Maricopa County utilized in its former safe outdoor space but also getting similar codes of conduct from other safe outdoor spaces that have operated in in Across the Nation can you give us some idea of what in is entailed in the Maricopa County Code of Conduct that they had and and where your when will this code of conduct be in its final format or mayor members of the council councilwoman O'Brien so some of the some examples of things that were in the County's code of conduct are absolutely no drugs or alcohol permitted in the property no visitors allowed on the property um all of the rules that are associated with property and then the consequences if those rules are are violated this will be a part of our operational plan so what will be finalized and in place before we open the doors and will um folks who are staying there be required to read sign and date that mayor members of the council we have talked about that it will be posted they will be provided a copy of it we have not determined if we will have everyone Read Sign and data but it will be an expectation that if they wish to maintain their occupancy at the safe outdoor space they follow those rules I would highly recommend that as part of the check-in process they be required to sign and acknowledge that code of conduct to ensure that they can't say I didn't know um I am concerned like one of the speakers about providing I we need to do this because we need to provide form of shelter in the zone however I am concerned about providing a place where the rules I feel like will be somewhat limited based on some discussions we've had we need to while they can't do alcohol and drugs there my understanding is they could leave the facility and partake and come back and without expectations and rules related to that kind of stuff I have concerns about how successful we will be um and what the definition of success and accepting services so I hope that that advisory team will take a hard look at the definition of what accepting Services is um in in my mind that would be getting into some help uh and um and then us tracking you know how often folks are back in their potentially what the recidivism rate is so and I'd like us Council to be briefed on what the final code of conduct ends up looking like mayor councilwoman Pastor I'm sorry is Staff responding or do we do a councilwoman pastor I'm sorry mayor I I couldn't hear what you said did you want us to oh sure councilwoman Pastor go ahead yes um I'm going to follow up on that is this considered a low barrier site mayor councilwoman Pastor members of the council we are this is considered a low barrier site it is not considered a low barrier shelter as it isn't shelter however there will be expectations of clients that wish to stay there not only following the code of conduct but participating in services that are offered at the site okay and if they choose not to participate or if they choose not to follow the code of conduct who does who's the enforcement enforcement in this space America mayor members of the council councilwoman Pastor so ultimately the City of Phoenix is responsible for enforcing the code of conduct together with our partners we might delegate that down to our partners if we aren't there 24 7 but it is the city's responsibility responsibility to enforce that code of conduct and make sure people know the progressive discipline associated with each one of the violations of that code of conduct I guess I'm going to drill down even further I am very going to be very specific I'm glad to know it's this I mean it's great that the City of Phoenix I'm asking what department is going to do the enforcement because and I'm reason why I'm going there is because I sit on Valley Metro and we have on Valley Metro security but they can only enforce so far and we then need police to enforce so I would like to know what the steps are in enforcement I'd like Rachel to address that but before I turn it over to her councilman Pastor I hear what you're saying I think the office of homeless solution is also is responsible with however we'll have security and PD available as needed and so um you know that we do have experience in working with um you know similar situations not not Outdoors but indoors and and so this is something that um that we and in addition to the providers have experience in addressing um so I understand what you're saying we will not hesitate to use security and if we need to have PD involved they we have an excellent partnership with them and I'll have Rachel's um add some more specifics to that mayor members of the council councilman Pastor specifically this the responsibility falls under the office of Homeless Solutions and directly under myself and Scott Hall will be responsible for Drafting and posting that code of conduct and ensuring that our partners are following are if they're assisting and been delegated down that responsibility that they're following it and as Deputy city manager Montes mentioned Security will be on site but definitely the Phoenix Police Department is our partner in any criminal activity which will not be tolerated at the site okay because I don't want what's happening right now on Valley Metro and with the city of Phoenix of pointing the finger to each other and there's no Clarity and then to find out where uh where there is a space that their needs there is criminal activity and we don't have what we need or what is needed in order to remove and enforce so I want to be very clear on that thank you thank you any additional Council comments I had the chance to visit safe safe outdoor space in another community and see some of the Investments that they made to work it make it work um I think there's a lot of progress in designing spaces that work for communities and neighbors and that help people navigate out of homelessness I think this will be very different from some of the spaces that were operated in Maricopa County in the past with that we are ready for roll call yes Dodge Washington O'Brien I'd like to explain my vote thank you mayor I will support this item because we are under a court mandate to bring people in off the streets of the zone and provide them some form of shelter again I cannot understate my concerns about ensuring that these folks get help and are held accountable and um that we have a sound definition of what success looks like so that when we track this data later on we can really take a hard look at what we have done right and and what we need to improve and and I am concerned about lack's rules that we don't fall into that trap because when you look at the research in other places that is their downfall um I look forward to continuing my monthly meetings with the office of Homeless Solutions to discuss what's going on there and and how we continue to improve I know you guys are working so hard to improve things for for our city and this community and those those folks who need assistance so I will vote Yes but I I am doing it with much caution thank you mayor pastor yes Robinson yes dark yes wearing mayor like to briefly explain my vote for this because they're thank you mayor because there isn't really much of an alternative that I see but I will say two points to support what the neighbors are seeing because I definitely understand what they're saying a first-hand basis I have called in the same gentleman to police he works the corner of 7th Avenue and Jefferson and walks around in the street behind your car it's it's a little nerve-wracking to not know where this person is you're getting ready to pull out the light turns there's cars all over I called him in as recently as yesterday I don't know how many times I've called about the same individual um probably at least 10 times but but probably more police are aware of him they knew his name the thing about this is we have not been able to move him off his corner and you can see that corner from police headquarters if you look out the windows of police headquarters that corner's got to be right there so I can understand why the neighbors would be skeptical that we're going to be able to police this the second thing is I called in a uh to one of the residents points about what does accepting Services means I question that as well so I called in a resident sleeping at a bus stop which you're not supposed to do police went out and contacted her she accepted Services there she was again on Monday somewhere in between there just like the other fella picked up a warrant and so on the Monday she was arrested but I thought she took services on Friday and this was the Monday after so I at some point I don't know what taking Services means either but I see the same people on the same Corners I try to call them in um but it just I just don't know that we have the person power to police this adequately and I don't know that that's going to change so to the neighbors we have failed you over decades I understand that I don't know what else to do but to vote for this because at least it's better than the alternative where where Predators play prey on each other down there and make life unlivable hopefully this will help the people who are actually trying to get help so I vote Yes but um I just I don't know what the future holds for this I really don't thank you mayor for indulging me I'm sorry mayor if I could explain my vote as well please do thank you um I just want to also say I will be supporting this as well I um when we originally voted for this item I was the Lone no vote purely because not because I don't think we need a safe outdoor space but because I do believe that district 7 has taken on far more responsibility than it should and I still feel strongly about that I do want to specifically shout out Bill Moreland for working so closely with us over the last couple of months since that first vote and with the office of Homeless Solutions to really be productive and for his service on the task force I think these stipulations are incredibly important and I definitely do not want to let down residents nearby who are rightfully very concerned that we have adjusted stipulations in the past so Gene I do want to say thank you so much for putting yourself on the record and saying we do intend to stick by these stipulations especially the three-year time frame and the phase out plan will be incredibly important so appreciate the neighbors the residents the business owners who who have really really stepped up to tackle homelessness in the city of Phoenix you deserve a lot of praise for that and I really do have faith that this will be a solution that benefits a lot of people and does ultimately I think as Gina said you know on balance show more benefits to the area that outweigh the negatives that we've been seeing with with the zone so look forward to continuing to work with you to make sure we have the best outcome possible yes there you go yes passes nine zero we next go to item 77 which is related to short-term rentals will the city clerk read the title item 77 is for ordinance g7156 an ordinance amending chapter 10 short-term vacation rental article 16 of the Phoenix city code thank you we'll have a brief staff report I will turn to councilwoman Stark for a motion and then we will open the public hearing we'll begin with the staff report mayor members of council uh thank you I'm joined at the table by Mr bednerick again and then Mark Thornton who has been our project manager on the short-term vacation rental ordinance as we walk through and discuss the proposed ordinance today we also uh do have representatives from the police department our neighborhood services department here as well to answer any questions as we we get into this discussion so why are we here this afternoon we're here to discuss uh proposed city code change to allow for additional regulations via permit process for short-term rentals and so this is something that the state permitted additional regulations and a limited permit process it isn't a more traditional permit process where the city is has much greater latitude to establish the parameters of that permit in this case it's very limited and things like requiring the permit to be approved within seven days so we have done the best we can in developing this ordinance to ensure that we're doing everything we can to try and balance the impacts of these short-term rentals within neighborhoods pursuant to to the council's direction but also making sure that we are complying with State Statute with that I'm going to turn over to Mr Thornton who's going to walk us through our proposed ordinance and also compare a little bit with what the state allows so that we can highlight how how much we are doing to comply with the state statute and making sure that we're doing everything we can under it mark thank you Alan mayor council members the state legislature made updates to the short-term rental law last year that requires municipalities to move from a short-term rental registration to now a short-term rental permitting process so as part of the new short-term rental permitting process state law requires City to approve or deny an application within seven business days so as as part of the short-term rental background or excuse me as far as the uh as part of the short-term rental application submittal process the new state law allows us to charge a maximum of 250 dollars per permit with an annual renewal requirement thanks sir as part of the application submittal requirements a short-term rental operator must acquire a TPT license register with the Maricopa County assessor's office send notification to adjacent neighbors notifying them of their intent to operate a short-term rental and to test that they are not a convicted felon or sex offender the owner operator will also be required to display the Str permit number on each advertisement and maintain a minimum half million dollar liability Certificate of Insurance the ordinance also requires background checks for short-term rental operators and or their designee the owner must also have an emergency contact that can respond in person to calls for service within 30 minutes the ordinance will allow us to charge scr operators one thousand dollars for every 30 days they operate without a permit so each Str operator must comply with all applicable laws and city regulations civil penalties range from 500 for a first offense or one night's rental fee and up to 3 500 for a third offense or three nights rental fee whichever is greater an owner may have their permit suspended if they have three court adjudicated offenses within a 12-month time frame the Str state law is very narrowly written so it allows municipalities to address certain things while limiting others the Str state law prohibits municipalities from addressing items such as spacing requirements restricting number of days a short-term rental be may be in use and we cannot limit corporate ownership of Str properties within the City of Phoenix as outlined earlier we can charge a short-term permit application of 250 dollars for each one and again we can only suspend a permit if the property owner has three court adjudicated offenses within a 12-month time frame or a felony or serious crime occurs on site so our interdepartmental team has been a meeting to outline the administration of the short-term Rental process and then enforcement also of strs Planning and Development will continue to manage the submittals approvals denials and the appeal process and also the permit status Neighborhood Services will address permanent enforcement in regards to investigating unlicensed properties and verifying violations and pde will identify calls for service at short-term rentals and share that information with planning and development in Neighborhood Services as well uh for the memo you all received uh September 19th um we have asked for some clarifications and modifications to the verbiage the a lot of Department prosecutor's office that have identified some sections where they wish to clarify strength and modify language within the ordinance the proposed modifications are in the memo in which I just outlined so next steps we're currently reaching out to the registence that we have on file it's about 3 900 that are registered with the city of Phoenix and our shape Phoenix portal will open October 26th for applications that are submitted the ordinance affected date will take place November 6th and enforcement will be of next year January 15th we can start doing that Str enforcement so staff recommends a motion to approve item 77 for the September 19th Memo from planning and development director with the following modifications to sections uh as follows mayor council members we're happy to answer any questions thank you thank you Mark oh sorry mayor I didn't mean to take over the meeting I apologize thank you mayor um I will say while the state has given us some additional Authority I would say a lot of my neighborhoods would say we still need more Authority but I'm grateful for what we have and I thank the staff all the hard work they did on this particular ordinance um my biggest concern is that we still need to work with the legislature and get some more teeth in our short-term rentals we are faced with an affordable housing crisis and when I look at cities like Sedona they just don't have affordable housing because they have so many short-term rentals there's got to be a balance and I I'm not opposed to short-term rentals I've actually stayed them before but I've stayed in places where they have more regulations for example when I was in Tennessee in the city of Nashville they can't have more than three bedrooms for short-term rental so they have a little bit more latitude but I am very happy with this I know you've worked very closely especially with the Arizona neighborhood alliance this group really oversees the issue for the entire State they work with neighborhoods throughout the State of Arizona um their co-founder Kate Bauer actually lives in the city of Phoenix she lives in District 3 as a matter of fact and she has worked well just I I can't praise her enough she has worked so much to really try to assure that we can co-exist with short-term rentals I know she's worked with Paradise Valley and she's worked with Scottsdale so I want to thank her personally for her help and her work on this important issue so I would like to make a motion to approve item 77 per the September 19 2023 Memo from the Planning and Development Department director with the following modifications I think you had them up on the screen so I don't want to have to repeat those do I have to repeat them so everyone's aware of those and those are just some uh technical cleanups to some language nothing substantive uh there but I would like to propose a couple additional Provisions um first an additional provision that will require online online short-term rental advertising platforms to verify that each Str listing located within the City of Phoenix has complied with the short-term rental ordinance requirement of a painting a permit before advertising on their platforms they actually are doing this in other states and other cities like Chicago Boston Denver so I think it's nothing new to the platforms so that additional language would be in section 10-201 C all online lodging operators must require that any short-term rental properties listed or advertised must have a current and unsuspended permit issued under Section 10 197 it must include the current and unsuspended permit number on the advertisement for a violation under the subsection the maximum fine each violation each a shall not exceed 2 500. and I would also like to add and I'm not sure what section it would be in that we notify HOAs obviously a lot of homeowners associations have ccnrs that might preclude short-term rentals so I think it would be wise to at least have them a part of the notification system and I don't think that would go against state law we're just trying to help out with that that would be my motion second but can I ask a question on that one here it's also Navy associations right mayor councilman Stark and Pasteur yes staff could do neighborhood associations that are registered with the city it has to be those ones of restaurant City or or HOAs they're also registered with the city to ensure that we have a easy way to make applicants get that information I I would add for the record that I think that section I would be section 10-199 c and then uh it would be adding a number or in there that would require that as part of the the notice to send notice to all the registered neighborhood associations and HOAs with the city's Neighborhood Services Department as well thank you and that's a good catch especially because I represent Moon Valley neighborhood association thank you that's my motion thank you councilman Waring um there was all due respect there was a lot of uh stuff there that I suspect normal humans who have not had the great honor of being planning directors of the City of Phoenix like the three of you Deb Allen and Josh have had might not have totally processed so I was hoping to ask just a couple basic questions that get kind of yes or no answers or short answers the first is obviously we regulate lots of different businesses that are in neighborhoods you can't just open a hair salon in a house next to other houses so why can't we regulate this one this particular business the way we do other businesses mayor councilman Waring we cannot regulate them like other businesses because state law preempts us from that regulation saying that it's a matter of Statewide concern that short-term rentals be permitted in every residential zoning District throughout the state if I had to truncate your answer even more I'd say it's the legislature's fault that usually finds a receptive audience up here with these guys so maybe this will be no different I don't know can the city prohibit short-term rental uses within neighborhoods mayor councilman Waring no we cannot thank you can the city adopt special requirements that treat a short-term rental use different than typical residence residential uses within neighborhoods mayor council Waring no we cannot you now the state law allows City to permit these uses can we revoke permits if they break the law mayor councilman Waring no we cannot do that in a very direct manner the the statute as Mark outlined requires three verified violations or one major offense and I would have to go all the way through the court system in order to be found guilty before the city could suspend a permit for one year okay that sound is complex and long and I think people are gonna be asking for immediate action and we're not through no fault of our own not trying to make fun we're not going to be able to do what people are probably going to want us to do when there's gunfire or something in a neighborhood as it's acted as it happened in District Two mayor councilman Waring you are correct uh in in this instance it typically takes about four to six months to get through the courts for each uh you know violation and so the fact that you'd have to have three of those in a 12-month period make it very very unlikely that we would ever be able to suspend one of these permits you're crushing my optimism about all this Alan but uh can the city prevent a concentration of short-term rentals within a neighborhood because that's something that's come up in District Two you know even if they're not necessarily causing problems people are like wow what happened to my neighbors now it's different people every day and different cars with different license plates can we limit that mayor councilman Waring no we cannot state law preempts us from that as well um given our challenges with Staffing and so forth we don't have a Army to go out and enforce these rules obviously a lot of the problems that we encounter at two in the morning or something like that obviously we don't have enough police officers to go around either would you say that this is going to solve the short-term rental problems such as it is in the city of Phoenix the way people might expect mayor councilman Waring I would say no that the the constraints put on the permit process are are not likely to result in a number of things that we have heard from residents about their complaints regarding short-term rentals um is this what we're voting on today basically the most we can do you and I have discussed a specific example related to the much more smaller Paradise Valley but are we basically doing everything state law now allows us to do keeping in mind your answers words as it solve these very basic problems that I get calls about most every day and your answers are pretty much no it cannot for everyone but I really at least doing everything that we're legally allowed to do mayor councilman Waring staff please we're doing everything we legally uh can do and that's practically you know something to enforce without setting expectations for neighbors that are things that can't legally or practically be done and finally I I think we've already had the answer I think Deb uh uh amended the original motion to to include this but the verified listing saying you and I discussed it before the meeting that was something that people wrote me about last night I think their needs as I understand them and I forwarded their request to you that's now included correct mayor councilman that is correct the the motion uh that councilman Stark put out included adding that provision uh well thank you I appreciate it thank you mayor I told you I'd try to be brief and have short answers from Alan almost impossible given our history together because we like to go back and forth but I uh I appreciate it I just I wanted to make sure from the outset that people understood this is not going to be a magic Elixir um you know that's going to solve every problem but we're doing what we're legally allowed to do and I thank you for answering my questions here thank you uh I'm so was that councilwoman pet store yep go ahead it was councilwoman O'Brien go ahead councilman O'Brien okay thank you um the section 10 9 10-197 and uh requires proof of insurance at the time of the application who would continue to enforce or ensure that they have maintain a insurance mayor councilman O'Brien is part of the application the property owner is going to have to attest that they are meeting that Insurance liability provision and they'll have to maintain that as a condition of the permit fact what we expect after the application process so if they're six months in how is there any way for us to ensure they still have insurance mayor councilwoman O'Brien we would have to investigate that through uh use of the neighborhood services department if there were complaints or concerns that that was not the case and if we can verify that then we could uh that would be a violation of their permit so we would be able to charge that as it would have offense go through the system to ultimately be found guilty via the courts by hunches they probably would just buy the insurance at that point and avoid it but that's what would happen Alan can I ask could you have them can you have a requirement that they list you as an interested third party like you do on like renters insurance or other Car policies have them list the city as an interested third party so if that insurance lapses or cancels we get it we get a notice saying that it's that that's happened that would be one way to kind of be proactive on that I think we can add that that provision and requirement as part of that we need to add that to the motion or is it just something that staff can take let us look into and see if it's actually something that we could do but that that was just one option that just came off the top of my head I think it's an excellent idea I would love to be proactive as much as possible and especially if it uh takes less work for our staff to do that would be fabulous um and you mentioned that neighborhood services would enforce a violation or do an investigation would Neighborhood Services be the department that would handle all of the comp all or all any complaints that come in mayor councilman O'Brien they would uh handle the the bulk of complaints that are related to short-term rental permits and the uh whether or not they an owner is Meeting those requirements there are things that uh the police department would be the the principal responding entity if there were complaints about drunk and disorderly conduct you know loud noises other things that the police commonly enforce just as they do on any you know call throughout the city and so they would be the primary responding entity and they would would go through and and cite and work on their normal process uh you know and responding to those calls but they also would then uh would be able to note that this is a short-term rental and then the neighborhood services department could follow up if there were any violations related to short-term rental requirements like not displaying the permit uh you know for within the areas you're right at the front door those types of things would be something that the neighborhood services department would enforce and with that and I realized that police would be the first to respond this but when there's criminal activity is does it still take three violations and the court system to suspend because it doesn't sound like we can ever revoke uh permanently mayor councilman O'Brien it would uh take there to be a felony conviction in order to suspend a permit uh one time otherwise anything that wasn't a felony permit would take that three verified violations and going through through the courts okay and I do want to um thank you for being judicious in the fact that we will be requiring short-term rentals to actually conduct sex offender background checks on guests and maintain those records that's incredibly important to our communities since they can't know who is staying there so I appreciate that that was included I thank you for all of your work on this I know that it happened in a somewhat abbreviated period of time so and thank you for answering my questions I know I wasn't quite as brief as councilman wearing thank you mayor thank you mayor councilman Brian if I could just add one other thing when I talk about the three verified violations the the state law specifically and excludes some of the most common complaints like uh for parking violations uh weeds those types of aesthetic concerns they don't count towards the the three violations so even though NSD would go out and as part of enforcing the other things those ones would not count towards any type of three verified violations they're specific to short-term rental types of of uses so I just want to to emphasize that further hurdle that the state legislature has established uh you know for NSD and City to be able to enforce on some of these properties that aren't well managed um thank you very much for that clarification that's good information for our community members to know and as we I guess Move Along farther we might have to have a public information campaign so that folks truly understand where what we are limited to do based on state law thanks to the legislature Fair this is councilwoman Pastor thank you um I would like to know if uh in police when police come comes to home because we have all the research and um I've seen I have seen the research uh as to going to a short-term rental uh in order to pull information on police incidents it takes a a bit or a while for them to pull that information so what I want to know is if we can put in the database area where it's marked that the house or the incident has been done at a short-term rental and it's in and this is done in other cities so mayor councilman Pasteur Jesse Cooper with uh assistant director within the police department is here to address those concerns because we have heard the council's request for that and the police department is working to implement that ability to respond so Jesse mayor members of the council councilman pastor we have worked Planning and Development NSD and the police department have worked together with our I.T folks on a monthly basis we are going to run every call for service against the short-term rental database and every call for service is going to be identified and we're going to share that amongst all three departments officers will also we're implementing a process where officers can notate on a call for service that was related to an Str all of that data is going to be provided monthly against every single address that's registered as an Str if there are addresses that are not registered as an Str the officers will have the option to report that as well so we can we intend to do that on every every end of the month basis so we will identify every call for service that occurs at an Str within the system it can the system be set up so that when somebody registers at the planning department as an Str then it goes into your database that address goes into the database being marked as an Str mayor members of the council we have checked with our CAD vendor we are not able to ingest those 4 000 identify every address what we have done is we have provided all of our Communications operators with the ability to look up the the short-term rentals so if a caller indicates that it's an Str that it's a problem location the dispatchers do have the ability to look up all those addresses and then identify for the officer responding that it is an Str and as well if an officer responds and they're unaware that it's an Str they can ask Communications to provide them that information as well as the emergency contact information that the officer can then indicate you know a 30-minute response time before we have a emergency contact on site so we can't ingest it completely into our current CAD system we checked that with the first version of the ordinance but we have developed a process where we can access the database up to date of where those strs are occurring okay so that basically means the databases don't speak to one another that's how I interpret it you are correct they will not be able to communicate with each other we've tried to implement processes that we can mitigate that the best we can okay and and when I say flag I'm when I say tag I mean flag in the system um the other question that I have is and that's good to know because uh I've been advocating for that for I think three to four years now so I'm glad we got to the space mayor um councilman Pastor one thing that we are doing with our community action officers is if there are locations that we know are problems um that we've gone to repeated uh we are flagging those particular addresses so caos will contact us NSD can contact us and say hey this this address at this location is a problem we will note in that so every officer and dispatcher will get that flag automatically so for the what I'm going to call the frequent flyers the ones that we are constantly going on we are flagging those in CAD we just can't automatically do it but we are doing that for the locations that are causing repeated issues for us thank you um my next question is and actually I'm just going to go back we received a letter and specified Max maximum occupancy per livable room I don't think we have the ability to do that at this moment um mayor councilman Pastor you you are correct uh we don't have the ability to enforce uh something regarding the occupancy that's uh different than what we do for the average use of a single-family home and so we have occupancy requirements that are principally centered around emergency access and those types of things and so we can't treat short-term rentals any differently with a an occupancy standard that's more stringent okay and then we we did Define in our document short-term rental mayor comes and Pastor or that is correct anything less than 30 days right a term less than 30 days the other piece is specify enforcement responsibility responsibilities this one's really key to me I think councilwoman O'Brien was alluding to it and asked I want to know I have an active member and I want to thank Susan Edwards she's very active in this space and so I'm aware of what's happening she's with the Arizona neighborhood alliance she's the president and how they track and and also Advocate at the legislature for change one of the things is who at the end of the day is responsible for this and what I mean by that is once again I'm used to this that there's a collective of departments working together and then uh no I can't it that's that's a different department that's a different department I want to know who I can go to or who the neighborhoods can go to and say we're having a problem with the short-term rental and then know that it's getting getting through kind of like Phoenix cares in a way oh mayor councilman Pastor as as part of this overall effort the Planning Development Department is the lead department and the one that issues the permits and under State Statute would be the one to suspend a permit so ultimately it's the Planning Development Department in that regard however there's a large caveat in there that you all are aware of but for the general public the Planning Development Department doesn't do enforcement that is done you know via Police Department or The Neighborhood Services Department depending on the issues and so we would be working closely with them to ensure that we are getting up-to-date information and and that is why the the answer is that Mr Cooper provided a minute ago here really are about how we capture that information from the police department and then in working with the neighborhood services department to be able to track all of those so that we can ensure we're monitoring any of them for how many violations they may have where are those problem ones so that's Mr Cooper said they can flag those to ensure that we are getting those reports from them about calls for service at those particular ones that are problematic it's not signaling out short-term rentals in general for any additional enforcements those ones that the police get continually call to those are the ones that we are then going to be able to to provide that attention to and ensure that we are tracking through the neighborhood services department and then getting back to the Planning Development Department if they have three verified violations or or one felony within a year planning department then we'll send the neighborhood like when they come to me I will then forward it to you or call the planning department so then it'll get yes ultimately it will be there the the the website and information about the the permitting of it and all of the the processes associated with it is on the Planning Development department's website so it will go through there and they'll be the ones that will then be referring people to a neighborhood services department if it's you know something that they would enforce But ultimately you can refer them to the Planning Development Department okay I just don't want people to get lost in that system that's that's one of my biggest issues and uh I feel like we have to be proactive instead of reactive and So proactivity within us I think is is is needed in the sense of uh as councilwoman O'Brien had stated about the insurance I know that I I actually think it's a good idea if maybe they come back every six months and demonstrate that they have their insurance because I think it's every six months that we get renewed um ADOT yeah ADOT where I get my driver's license if I don't have an insurance uh the insurance company uh notifies them and then next thing I know my driver's license is no longer valid so I think we have to be proactive and come up with the system that works within our organization in order to uh just get ahead of the game I know we're a little bit behind but at least be proactive and I understand it's complaint based but I think we really need to be proactive based and so I I want to see or have a dialogue a bigger Dialogue on what that looks like with strs uh mayor councilman Pastor um I would uh add a couple things uh to that in in response one is that the city is working um uh going to be undertaking a process to work with a third party vendor to help us with enforcement and so one of the the challenges that you bring up and other council members have raised as well as some folks in the public about the the fact that we aren't proactive in enforcement it's dependent upon the neighbors calling and complaining and so what this third party vendor will help us do is mine the various uh platforms where the advertising is taking place and be able to give us that data so that we can compare it to who has a permit and be able to compare that via spreadsheet okay they've got permits these ones don't so that we can work with neighborhood service department to send them notices to get into compliance and not be waiting for uh you know there to be neighborhood complain about someone being a bad operator within the neighborhood and so we do think that will will help substantially you know in that regard and then the other part that I would would add to this is that through um those those efforts as well as having the uh the providers have to or the platforms I should say verify that a short-term rental is legally mating the permit process requirements and them verifying that as as added with your as motion here on the table that will help us be able to uh more quickly get compliance as it relates to the platform and how they are reaching out to get additional residents where it may take some time to uh you know get a property owner in compliance we'd be able to talk to the the platform about them advertising something that doesn't have a permit and we think that will help us get a quicker response from that that owner okay well I'd like to say thank you I know that we push this at the end of May April May because we wanted to see uh some movement so I wanted to thank you for uh following what we wanted to see within our communities uh you did it very quickly and it's here today I want to thank councilwoman Stark for finding yesterday as her and I were speaking about the registry and helping find all the language that we needed in order for that to happen and then I want to thank those that also found language regarding the neighborhood associations and I believe it was councilwoman O'Brien and that space so that we can be able to place it in here and and most importantly thank the community that has been advocating for this and has been at the legislature for the last four or five years wanting to make change so thank you to everybody let's turn to our planning and development director and our Deputy city manager to clarify the motion uh mayor members of council I would like to add one clarification to the additional language regarding the uh the notice for uh registered neighborhood associations and HOAs and that would be they would send notice to uh any of those neighbor associations or HOAs that are uh within 600 feet of the boundaries of a proposed short-term rental so if they're inside it they will get noticed but also any neighborhood association that's boundaries that are within 600 feet will get notice as well and that's consistent with our you know use permit and variance process relative to you know these types of applications and it's probably wise to have consistency with other process we have yeah but mayor councilman Stark I I would agree because that ultimately will help us in in a defense because if necessary because we are um you know making sure that we are letting people know about it but in this particular case it's more an alert that it's going to be there it's not a notice that is come to a hearing or talk to us about uh you know opposing this it's permitted by right and so it's going to get some people upset because most of our notice requirements aren't for permits by uh right they are for elective things and you're inviting the public to come talk about it whether it's before you or a board of adjustment or any other hearing process so in this case having that noticed to help HOAs and others that are right in the area and know that there's one in the neighborhood is much more beneficial than a broader you know one mile notice like we talked about with the safe outdoor space you know a few minutes ago we will now go to the public hearing portion I will open the public hearing we'll begin with Kate Bauer in person and then we will check with Neil Haddad registered to speak if necessary online hi mayor and Council thanks for giving me the opportunity to speak and councilman Stark thank you for the kind words I appreciate it I know that the state's preemption of this issue really put you guys in a bind and I know that a lot of towns you know in the state have already passed some requirements and their own protocol and most of them frankly are having a very difficult time enforcing it I'm glad that you guys considered the verified listings and are going to proceed with this I think it's going to make a huge difference I do apologize for not bringing it Forward earlier we had been so focused on doing this at the state level that it didn't really even occur to us about doing it at the city level but it's being done at multiple cities as you guys mentioned across the country and there really isn't an issue it doesn't interfere with the state law so I guess my only other question as far as moving forward with the verified listing is has there I didn't maybe I missed it but is there going to be uh like as far as carrot and stick is they're going to be are there going to be fines um for platforms if they are found to be listing properties that are not compliant we'll turn to staff to answer okay thank you mayor council members uh to answer the question Kate 2500 would be the fine oh okay great thank you and then as far I I have to reiterate what you guys were saying about they're so this is such a huge project undertaking for the city um there are an estimated 58 online platforms working and you know operating in the in the state on this um so I think it really is imperative that you guys get a third party vendor granica scramble scape whatever it is um to help with this because it's going to be next to impossible for you guys to do all of this the current registration registration that you guys have I believe you have four thousand is that correct four thousand short-term rentals and we estimate they're about 12 000 in Phoenix so that's why we're hoping that this verified listing will force all of them to come out and become compliant and should really help the city again I appreciate it thank you Alan thank you Mark for getting us over the finish line thank you thank you the remainder of our to um kind of echo what councilman Waring mentioned before about that enforcement and you know weekend enforcement remains an issue if Neighborhood Services is not there many of us work to prevent calls for service to PD and then the other thing is is that if neighbors call in is a neighborhood party going to be a priority One Call chances are it won't be so um that Still Remains as an issue overall we want to say thanks we think that a lot of progress has been made in this area and we also want to thank our partners and friends at the Arizona neighborhood alliance so thanks very much for on issues of Interest or concern to them the city comp the city comment section is limited to 30 minutes the Arizona open meeting law permits the city council to listen to the comments or prohibits council members from discussing or acting on the matters presented thank you we will begin with Beatrice Johnson followed by Vicki Anderson mayor it appears that Beatrice is not in the room at this moment she may have stepped out to the restroom uh we'll go to Vicki followed by Eric Nielsen thank you mayor Gallego and Council I just want to bring to your attention the need for low cost or I would argue no cost streamline permitting for curb cutting in the right-of-way in 2010 the city's goal for tree coverage was 25 percent shade by 2030. that same year I applied and got a grant from watershed management adeq we did the first curb cutting planting right-of-way project in Phoenix we are now over a decade and that's a thriving example of what really simple curb Cuts can do to retain water and um takes help with the flooding from the streets because it takes Street water runoff 2022 I received another Grant from The Nature Conservancy and part of that Grant was coming back for curb cutting doing the same thing we did before and I thought at this point there was a process to get through the city for a resident to do that I approached the I guess the department of heat mitigation and they pretty much pushed me off to several different departments within the city so this is over a year I've been working on this luckily I met Trisha bailiff who is your um environmental programs director she has been working alongside many other people to get your departments to come together to come up with a solution to streamline this for residents who want to better a piece of property they don't even own the right of way so after a whole year they are working on a streamlined process but for me my grant is up in November so streets of Transportation comes to us and says we have to sign a street maintenance agreement which says I take responsibility for the right-of-way and I have to ensure the piece of property that I don't even own so that's the first obstacle the next obstacle is the printing process is a Paving process and it is a at the end a concrete permit that I need it's four times the cost of cutting the curb so your residents are trying to better the community and better the space and you're we're charged four times what it'll cost just to put it in so if nothing else the summer has taught us that we're running out of time if we already haven't and I'm just here to ask that we take note of a simple solution so simple it's it's staggering how this hasn't been done throughout the city and through City projects and right-of-ways it'll help he'll help create sustained self-self-sustained trees Harvest water which we're running out of help with flooding in the cities streets during rainstorms also reduce toxins going into the round water and overall reducing the heat island effect thank you mayor could we have somebody thank you and we do have a city process on this so I think we can't get into the substance of this but there is an active stakeholder process that the city has started so if we can get Vicki some information on that no no I know I've been working with Trisha for a year something that we could an obstacle we can't get past and if we can't get past it with a ten thousand dollar Grant I can't imagine that an individual just wanting to do this would ever be able to do this on their own so this city is looking at the process we can't have a debate about the substance here um but we are looking at this issue and just to note my district is just sorry um week eight District eight thank you thank you a video that we have been talked about earlier this this afternoon I was very serious with that mental picture the idea was that when we start talking about changing food outside of the gauge of what our Lord Almighty provided for our sufficient nutritional value I take that kind of serious sometimes the comedian stops laughing and when we stop when that comedian stops laughing we better start getting our feet on the ground and putting our knees next right beside it and lifting up our prayers for that change because I'm telling you right now that idea that I gave with the Bold cereal versus a bowl of creepy crawlies in the bowl and you're looking across the table to your family and trying to explain to them why we have to think about the probabilities that this nation is trying to force upon us on a global basis that we're going to try to have to go and change the nature of a steak or change the nature of a chicken or an egg or Force us to eat things that are crawling around on the ground on 8 or 16 legs ladies and gentlemen when you look across and you have to tell your great your children your grandchildren your wife where's the double standard in this and this idiotic approach to changing something that is substantially life-consuming I find that morally and just I think we need to take a more conscious look at this because we're in a different different time than what we were many years back but I think when we when you stop and think about what is life meaning to you it's definitely if I hear things like that that is not life meaning to me and it shouldn't be introduce the citizens petition that I said this morning to the city manager the city manager intern and the council um it is a request for the creation of an evaluation program to see what the actual outcomes are for uh constituents who have been moved from a Zone and um concerns uh length of stay that people actually uh spend in shelters or even outdoor spaces um reasons for exit as well as the types of facilities that are being used and numbers of people in in each facility um I think these are really important because I think they'll give us a better portrait of the actual success of the program as opposed to just the initial acceptance of um shelter which often leads almost immediately to people leaving the facilities and also um there are a lot more barriers and limitations that I think are currently being acknowledged by the city in making the placements um we have individualized assessments theoretically but I don't see individualized placements especially um in the earlier on periods of the sweeps uh as they restarted and so um it's not a request for information and it doesn't have anything to do with for example our litigation it's uh for the benefit of the understanding of the community and I have to say I do consider this to be my community partially because I grew up for until uh from infant until a 18 in the same zip code as the zone so I may have had a few more experiences to humanize certain people um and I changed my vision but I think that it's important to remember that these are constituents just as much as any other constituents and the if they're receiving um either consensual or semi-non-consensual Services um I think you need to understand uh whether or not they're actually successful as opposed to uh just sort of parading around opportunity to speak I've been authorized by the Rogers Ranch II homeowners association board and its Management Group speak on behalf of that HOA we're also speaking on behalf of the other organizations the other HOAs who were created within the square mile that is the Rogers Branch Community we were in the third decade of the Rogers Ranch Park sitting dormant it is still a dirt lot it has never been developed it is not yet the park that it was supposed to be over the last two months since I last spoke to the city council we've met with the leaders of the Parks and Recreation group the chair of the board and the executive director we've spoken also with the experts in the state who understand the issue of growing Alice in the Brewing owl presents an opportunity for both the city and our community to do something positive at a lower cost to the city than we would anticipate in building a park the expert who we have engaged has identified a third of the property that is now still set aside for the park as a highly opportunistic location for permanent preservation of growing owls acting growing owls is a win-win-win thing for the city for the state for the county of the Rogers Ranch Community when we polled our community the overwhelming majority of the people who live within a mile the community very greatly supported the idea of creating a borrowing All County Colony reduces the capital cost of building a park by a third it reduces the annual maintenance costs by at least a third it eliminates the cost of water because the Brewing owl Colony doesn't have to be irrigated or sprinkler we urge the city council to consider moving the Rogers Ranch Park and the potential for a burrowing owl preserve forward on the five-year Capital Improvement plan we urge you to add this park to the 2024-25 general fund budget and we ask that you engage with us in further Communications with private Enterprise organizations that are interested in supporting this plan because it's in their best interest to be benefactors to be beneficial to the living community and help in the preservation of those outs I look forward to further communication with you and I thank I'm a resident of Goodyear Arizona in the West Valley I'm a retired military pilot and currently an active private and commercial pilot the City of Goodyear owns and operates the Goodyear airport in June 2023 Goodyear airport became the busiest single Runway airport in the United States with over 19 700 takeoffs and Landing Goodyear is just ahead of San Diego International Airport so let's let that sink in little old Goodyear has a busier airport than San Diego California a city of 1.3 million people my call today is to express my displeasure and safety concern about the increased number of training flights being operated out of the Goodyear airport and the noise they produce many of these flights operate from 5 30 a.m to past midnight 7 days a week including most holidays I want to be clear that myself and my neighbors support the airport the flight schools and their contribution to our city in the aviation industry but the rapid growth and extended hours of flying has negatively impacted our quality of life and rights to enjoy our property the largest flight school operates approximately 70 Cirrus Aircraft whereas you might not hear a single-engine Cessna more traditional aircraft training aircraft indoors the noise generated by a serious undeniably penetrates indoor spaces since the beginning of this year we've logged over 4 200 aircraft that are passed over our neighborhood many of these aircraft are below regulatory altitudes and violate minimum safe altitudes in CFR 91-19 paragraph B and paragraph a executing an emergency landing with with undue Hazard to persons or property and careless and Reckless operation 9113 paragraph a over the last nine months myself and my neighbors have proposed several solutions to the flight schools the FAA the City of Goodyear the Phoenix Aviation Advisory board and the City of Phoenix airspace and noise manager and very little has been done we've been we've even been told by your employees that sorry the good the airport was there first a million complaints won't help and the pilots can do whatever they want so to reduce the noise and safety concerns we would like your support in proposing the following procedures to the sponsors and operators of the Goodyear airport implementing Monday through Saturday only scheduled with reduced hours no flying on Sundays or national holidays Implement a policy for piles to fly a short approach to remain south of Interstate 10. during the busiest times space flights so they do not have to fly north of Interstate 10 publish noise sensitive areas in Pilot AIDS on the plane from uh California and um I just wanted to say that it's already been since uh June and the person who killed my sister is not uh charged and the buck stops with the Phoenix City and the prosecutor's office you made an agreement in writing a deal with the County Supervisor office Maricopa County you agree to prosecute him for misdemeanor which is a joke but misdemeanor charges for killing two people we want to see him charge he is not charged it's almost been two years and he is not charged he was charged and then the prosecutor's office uh violated our victims rights so bad that they decide you guys decided to make agreement with the Maricopa County to charge but he is not charged yet and so I will be back and I just want you to know that what what I do for a living I am an activist and I work with families all over the country we unite and we collectively change laws to hold police accountable period And I have been for a year and a half not wanting to bring the weight of what we bring here to Phoenix Arizona but we are forced to so I will do what I was told to do by somebody else who was trying to make sure that everyone in the city and Maricopa County who are part of this cover-up for this Nebraska Pekovic who killed two people while speeding and he has not seen court yet he has had two failures to appear and your Prosecutor Office not only dropped the charges and made an agreement for Maricopa County to take it in June and he's still not charged but your city prosecutor wrote on there to make sure he get his bond back which he may Bond six that five days after he was arrested and he never seen a judge so we're going to find out what happened with that everyone sees a judge when they have two counts of bodily seriously harmed with death and a failure to appear in the first degree and he was able to get out of Maricopa County Jail without seeing a judge when our family having anything to say and he has not been charged or arrested yet for it and kept and held accountable for killing two people so I'll be back and then we'll be back and I will do exactly what I was instructed to do is launch a campaign which is what I did not want to do but we're going to do it because we're never going to stop we're going to be keep doing this until the person the Boston peck of it who killed two people while under the influence in speeding killed two people who were in a marked crosswalk and you guys are protecting him and we will not have it justice for Dorothy and Joseph Gutierrez period Leslie and Jeff will be our final two speakers first Leslie just a quick clarification earlier when it said what I was talking about had nothing to do with the subject actually it does because it is the world economic Forum that's actually pushing for all this new Transportation stuff and even the housing issues so it absolutely ties in maybe it got a little personal for um Kate but that's the deal so district one and I just wanted to thank you for the way that you are concerned about things and when you explain your vote and what your concerns are about your vote I that means a lot to us it really does because when we walk in here and we don't your concerns because it does matter to us it truly does um the lady District Seven you've done a great job conducting this meeting and I appreciated the things that you were saying to them as well and even Laura Pastor when she said she wants some accountability she didn't just wanting the you know pointing fingers thing I actually we actually appreciate that kind of stuff because it seems like you're in the Ivory Tower and you make decisions that affect our lives and when we hear you say things that actually acknowledge our feelings or concerns it means a whole lot to us so I just want you to know that Miss Kate I don't know why your face is not showing on that screen if you can't be here at least let your face be here you are who I'm here to talk to you I have not been able to get an appointment with you I've been able to go through your office today and they help me to be able to hopefully be able to get with you and talk with you because I want to understand and you explain why you are the only American that is working with the world economic forum and why our state our city is considered fast tracked for the smart cities now if you are saying that you are not in alignment with those things I'm saying well then get with us and explain yourself and help us to understand why some of the choices you've made example shows right here that you're working with Miss Kathleen merrigan who's with the ASU and it says it's she's the professor of sustainable Food Systems at ASU what the gentleman was saying about food we were given food by the Creator this other garbage that people are trying to transfer us over to that's ridiculous when you buy into that stuff you're buying into the world economic forum and they are not our friends nothing about them is our friends they consider us goyam is the word that's used we're useless eaters they don't want thinkers they want workers that's what they think of us I don't care what I owe this that you're on Republican Democrat libertarian I don't care what your title is if you're not one of them you're goium and Miss Kate is in agreement with them and she's helping to bring this stuff to our city that should be a concern for you world economic Forum I'm going to say this one thing and allow me to finish it to miss Kate because that one lady went about 20 seconds over there isn't uh a court case I hope everyone checks into it CV 2023-09 3987 that's a constitutional situation that's happening and so it will protect us from what's Happening and Miss Kate we ask you to to explain yourself and to set up a meeting because if you are not doing what you're saying what you're doing then you should have no problem meeting thank you Jeff will be our final speaker mayor council members thank you again for this opportunity so I'm under the impression that it's possible that the reason why you don't see all the members here today is because there is a climate ambition Summit going on in New York right now and um it's today and uh I am curious if our uh council members are there it is interesting that it looked like Kate had a nicer hotel room than the other two um but with that being said Reuters actually released an article today about seven hours ago and it said explainer what is the world doing about climate change and one sentence in there it says to get climate action back on track we will require a dramatic acceleration and it says reducing high polluting plane Journeys and meat consumption Reuters today okay now the United Nations also has on their climate action page under food and climate change healthy diets for healthier planet um they have teamed up with the climate ambition Summit that I believe our members might be at today but I also want to hit on uh miss the mayor's post that she posted after our last city council meeting she posted that she's reducing our energy costs the Federal Reserve actually posted that the average price of electricity in this area is higher today than it has been over the last five years that dates back to 2018. now with that being said I also think it is important to realize that Miss Shepherd did bring up a good point the city has teamed up with ASU and ASU has radical policies that are going to be attempted to be implemented through our policies through our city and one of those policies is the sustainable Food Systems policies that ASU believes that they need to reduce meat consumption it is documented it's in their degrees their bachelor degree actually calls for it to sustain um the the 2030 agenda with the United Nations so um I I am very concerned I do realize that the mayor tried to squash my concerns after her last meeting but um the information that's out there in order for us to understand what is being implemented demonstrates a completely different strategy behind the scenes than being implemented uh through our policies but I also am concerned that the mayor used her official Twitter handle to publish this information because it wasn't 100 accurate and it seemed more like a campaign post than a uh an official post thank you we are adjourned thank you [Music] foreign [Music] [Music] supply store for file trays but you need to reuse them they shouldn't be going to the landfill so we want to reduce first then we want to reuse and then we want to recycle toilet paper rolls paper towels these are the things that teachers look for this is a trumpet they can just put a white sheet inside this and make it as a whiteboard a student can keep a marker and a white cloth we just want people to come and
