Good evening and welcome to our Glendel City Council meeting. If you would like to speak on any of the items that are on the agenda, please fill out a gold card and hand it to the police officer in the back of the room. The mayor will call your name and when it's your turn to speak, you can make your way to the podium. All speakers have 3 minutes. If you would like to talk about an item that's not on the agenda, please complete a blue speaker card and give that one to the officer in the back of the room. Items that are not on the agenda are heard at the end of the voting meeting. Glendel has seven city council members. Mayor Jerry Wyers, Vice Mayor Lauren Tomachoff of the Choya District, Council Member Diana Guzman of the Yucka District, Council Member Leandro Baldengro of the Aato District, Council Member Bart Turner of the Barrel District, Council Member Ray Melnner of the Sorro District, and Council Member Lupe Konchas of the Cactus District. This meeting is streaming live on Glendel's Facebook and YouTube pages, as well as the city's cable television station, Glendel Channel 11. Thank you for joining us. All right. Good evening. Uh we're going to present uh 2025 Ruth Burn Historic Preservation Award. This award was created in 1996 to honor people and organizations that help protect and celebrate Glendel's history and its culture. Martha Cole probably know why you're here. I'm guessing. If you don't, surprise. Come on up. So, if you if you'll stand right here, I'm going to go ahead and read this and then and then we'll we'll go. So, u Martha she knows goes by Marty Cole will be accepting the award. Marty was selected by the Historic Preservation Commission for her work with the Glendel, Arizona Historical Society, serving as treasure for 10 years. Marty's an active member of the Glendel Women's Club, the Glendel Ambassadors, the Glendel Sister Cities, and formerly the Glendel Chamber of Commerce. Truly, she is a role model for community involvement. Marty was born and raised in Glendel and has lived here nearly her entire life, 16 years. She attended That was a joke. I'm kidding. She attended 17 years, right? Yeah. She attended Landmark Elementary School, Glendel High School, and then ASU during the 60s and 70s. And into her 80s, she is she and her I'm sorry. And into the 80s, she and her first husband owned and operated Glendel Floral, a business in the heart of downtown Glendel. She has two adult children, six grandchildren, and six greatg grandandchildren. So, I'm going to come around the other side and I'm also going to ask uh that everybody that is here to uh welcome her from uh this organization if you'll come up also to get a picture too, please. Ruth Burn was a fantastic lady. She loved Glendale and she loved to share the history of Glendel. Item 24, resolution number R25-93, a resolution of the council of the city of Glendel, Maricopa County, Arizona, accepting the 2025 grant award for Proposition 202 grant on behalf of Glendel Police Department in the amount of $20,000 for reusable LED flares, Glendel Community College in the amount of $54,633 for Glendel Grabandgo Fighter Country Foundation in the amount of 25,000 for FCP Top Three programs. Maricopa County Community College Foundation in the amount of $75,000 for student emergency assistance fund. Midwestern University in the amount of $30,000 for community dental assistance programs program from the Hila River Indian Community. Item 25, resolution number R25-94, a resolution of the council of the city of Glendel, Maricopa County, Arizona, authorizing and directing the entering into of an agreement with the state of Arizona, office of the attorney general, and authorizing the acceptance and expenditure of the fiscal year 2026 victim's right program award AG number 2026-044 in the approximate amount of $64,300 on behalf of the Glendel Police Department. Item 26, resolution number R 259-95, a resolution of the council of the city of Glendel, Maricopa County, Arizona, authorizing and directing the entering into of an intergovernmental agreement with the city of Phoenix, amending and reinstating Phoenix agreement number 114154, Glendale Agreement number C-5239 as amended pertaining to treated sewer service to an area located in Phoenix and also terminating the city of Phoenix agreement number 1141. 155/ Glendel agreement number C-5238. At the June 24th, 2025 city council workshop, council provided consensus to proceed forward with the annexation a-269. subject property is approximately 39 acres in size and is located south of the southwest corner of Poria Avenue and Serville Avenue. The property is currently in Maricopa County with a zoning classification of RU43 which allows for single family residential dwellings. Should the property be annexed into the city limits, the most compatible like zoning applied to the property will be the RR45 which also allows for single family residential dwelling units. Once incorporated, the applicant intends to reszone the property to planned area development permitting for uh industrial land uses. Before you is an annexation map. Uh the properties depicted in the hatched area with a red arrow. The property to the north, west, and south are currently within the city of Glendale municipal limits. Properties to the east are in unincorporated area. Through the project development plan, site access is proposed along Sarville Avenue. Serville Avenue is maintained by the city of Glendale. The subject area contains a detached single family residential dwelling unit and an accessory structure which will be removed for future non-residential development. The property to the north, west, and south are currently vacant and identified with a planned area development zoning classification and are designated for industrial development. The property to the east outside of the municipal limits are currently being used as low density single family residential. Mayor Council, this concludes my presentation. Ordinance number 025-40, an ordinance of the council of the city of Glendel, Maricopa County, Arizona, extending and increasing the corporate limits of the city of Glendale, Maricopa County, state of Arizona, pursuant to the provisions of Title 9, Chapter 4, Section 9-471, Arizona Revised Statutes and its amendments by annexing certain territory located at the southeast corner of Myrtle Avenue and 81st Avenue in the city of Glendel, consisting of approximately 0.5 acres to be known as annexation area number 270. Go ahead. >> Good evening, Mayor and Council. Uh, this is the final action required for AN270. The item item received consensus from council on June 24th, 2025 to proceed with the application. And on August 26th, the blank petition was brought before you and there were no speakers. In summary of this request, this is a half acre of vacant land proposed to be utilized for open space for a multif family development for the property directly south in the county. The property is currently zoned R5 and that is considered for multif family residential developments while the equivalent city zoning is R4 which is also for multif family residential developments. This development does not require a reszoning action. So upon approval the R4 zoning would be applied. This annexation map shows the subject property bordered by the city of Glendale to the north, east, and south, and bordered by Maricopa County to the west. And this aerial map shows the vacant piece of land directly to the south intended to be incorporated into the multif family townhouse development. And with that, that concludes my presentation. The applicant is proposing a resoning from C1 Neighborhood Commercial District to P A Planned Area Development for approximately 6 acres. The subject property is located at the northeast corner of North Citrus Road and West Olive Avenue. The surrounding area surrounding area is predominantly within unincorporated Maropa County with the exception of the Sanuro Pass subdivision and the subject property which are both in the Glendale city limits. The property directly across North Citrus Road is zone County C2 intermediate commercial zoning district. With this county's own commercial property in addition to the subject property, this configuration creates a commercial node at the intersection of two arterial roads. Before you is a slide depicting the subject property in a scan highlight. In addition, one will find the previously mentioned San Gerald Pass subdivision that is east adjacent of the subject property along with the previously mentioned county's own commercial parcel and other residential communities within the vicinity. The proposed PA AD is consistent with the existing general plan designation general commercial and said PAD furthers the goals and objectives with the general plan. Furthermore, the PAD proposes development standards that are compatible with the surrounding area and this PAD is intended to improve the economic viability of the subject parcel and to enhance the surrounding area including the nearby residential communities. Section 35.4.310, 4.310 site signs providing for severability setting forth an effective date and ordering that a certified copy of the ordinance is recorded. Good evening, mayor and councel. At the August 28th Planning Commission public hearing, the zoning text amendment ZTA 25 tax 01. The motion was split. The remaining motion recommended to council or the digital billboard provisions now being presented. This is a request to amend the unified development code section 35.4.310 specifically for digital billboards along the 303. Purpose of the amendment is to clarify UDC requirements and provide enforceable standards. The proposed amendment delineates the number placement and frontage requirements for digital billboards only along the loop 303 corridor. Key points include along this corridor, PADs approved prior to December 31st, 2023 are permitted one digital billboard. Administrative review is available for uh PA ADS that do not meet the frontage requirements. And finally, the proposed amendment does not impact other billboard regulations uh such as the designated scenic corridor along loop 101. All public involvement requirements were met. One speaker expressed support at the planning commission public hearing. Pending your questions. Mayor, members of the council, here provide staff report on both items number 31 and 32 on your agenda is Jim Brown, director of human source, human resources and risk management. Thank you, city manager. Good evening, mayor and council. This is a request for the council to consider and take action on the initial appointment of Chad Haywood to a two-year term as city judge. The effective appointment date will be October 16th, 2025. The city council conducted a process to select a new city judge. At the conclusion of that process, Chad Haywood was selected by the city ca council for the appointment. The appointment and reappointment of city judges is outlined in both city charter and the Glendel city code. I'd be happy to answer any questions. Questions? Seeing none. Thank you, Jim. Are you going to start the three minutes now? >> Please go ahead. >> Don't mean to be technical, but before you start my three minutes, I do want to thank the gentleman that just spoke. He did allow me to see his agenda because there you guys had ran out of agendas. Um, so I do appreciate that. So starting now, um first I want to congratulate Judge uh Hayward for the uh appointment and I just want to say um good evening to mayor you mayor and the council members here. Uh I want to thank you for the opportunity to speak um on this agenda regarding your selection of your next court uh next city court judge. It seems like the selection has already been made, but thank you. Um again, I'm an attorney for um nearly 30 years. I'm licensed in both Michigan and Arizona. Earned a bachelor's degree from University of Michigan and Arbor and um law degree from Emory University. I appear before you this evening for a public service um to remind governing bodies you of the strategic agenda set forth by um our Arizona Supreme Court Chief Justice Anne Timber. That agenda emphasizes transparency, integrity, public and public trust in the judiciary. Your decision and vote tonight impacts not only the city of Glendale, but the integrity of the Arizona's um judiciary as a whole. I heard Mr. Brown say you guys conducted a process to get your judges. We'll talk about that. Um it is my understanding that Judge um Haywood um is who is being considered for appointment graduated from law school about eight years ago, dedicated about 25% of his practice to criminal law. In contrast, your prior city court judge Washington um gradu graduated about 30 years ago and had a 100% um criminal law background. That gap in level um experience is significant. My concern is that I didn't see any advertisements for this position and I have diligently looked numerous times a day every day since I didn't get an appointment for the Supreme Court justice. And I I'm really happy Justice Cruz got that amazing um choice um by our governor, but every day, several times a day, and I did not see anything. What I did see was an advertisement on your website for a judge pro Tim position. I applied for that. I believe it was August 28th crickets. Again, someone with 30 years of experience. Mine is probably 90% background in um uh criminal law. So, I'm just asking you to consider the comparisons and it's not something that we can delve into in a threem minute um speech that I have here. You know, I I know that it's going to be in another form dealing with section 1981 issues. However, I just wanted to let you know it's concerning. I'm asking you to consider that um the disparity um of and whether or not there's any fairness and equity in the process that you've implemented here. Um, so I want you to know you're not alone. Uh, I was in courtsite a couple of weeks ago because again, as a public service, I'm just making my voice heard. A couple of weeks ago, courtsite, I saw them pick a white candidate with a high school degree as a magistrate judge over someone that was black with a college degree with honors with sign. Both of them had legal backgrounds. So, I thought that was interesting. But that's, you know, something we'll have to deal with in a separate form. >> Okay. I need I need you to wrap it up, please. >> I will. Thank you. I will. My request is simple. I just want you to consider your hiring practices. I encourage you all to sit down and talk with our Supreme Court justices. They're very approachable. They're wonderful. In fact, they have a um public um forum that they're going to this week. Uh council makes the opportunity available to our citizens to bring information and businesses business business before the council that's not on our printed agenda. Uh okay. They want they want me to slow down for them. Okay. Okay, we're we're going to go ahead and do council comments first and then we'll we'll get to what I just read. Um, last week I had the privilege of attending my first meeting of the Maricopa Association of Government's Community Initiatives Coordinating Committee. It's a very long title. Um, one of the highlights was passing a resolution to recognize domestic violence prevention and awareness. a reminder of the work that we must continue to do to keep our residents safe across the region. I was also uh joined my first civic craft cohort event um where they had us reflect on our leadership styles. So if you uh know what ENFP means, that's my leadership style. It was really interesting to be introspective and they also asked me to come up with my why. So this is what I came up with. I lead because I believe every family in Glendale deserves to be safe, supported, and proud of our community. and I work to make that real by listening, building trust, and turning compassion into action that creates lasting safety, well-being, and opportunity. In addition, I had the privilege of speaking to the Maroba County Community Colleges Chancellor, all of the college presidents and leadership teams across the system. We talked about unique needs in the community of Glendale and community leadership and how that intersects. And it was really good to uh connect with the Glendale Community College President Tiffany Hernandez about their up andcoming advocacy center. And in the consent agenda today, we accepted a grant on behalf of GCC for their graband-go. On the community side, last week we celebrated Oktoberfest with our sister cities. We had Broughtworth and um it was a great opportunity. I learned how to make a pretzel necklace and uh I attended the um ribbon cutting for the next phase of the Arizona Automotive Automotive Institute with council members Guzman and Baldenegro. Thank you so much. Um and I do want to mention that unfortunately we had to cancel our town hall our last on the 17th. And I want to thank uh Rick St. John um Sergeant Conno and all of the Glendel Police Department staff who worked with us on building a comprehensive security plan before the cancellation. and we will be discussing next steps tomorrow at our citizens advisory council meeting. I want to send congratulations to Crayion Turner on your appointment to the commission on diverse cultures representing the cactus district. I first met Mr. Turner and his at his doorstep in the Manaste Ranch community and it's been great to see his leadership and commitment to Glendel um recognized in this way. This week we also celebrated the dedication this week we will be next week we'll be celebrating the dedication of Al McCoy Park. Uh this includes new LED lighting, basketball court, a plaque to honor Al's legacy, and I want to send a special thank you to former Vice Mayor uh Ian Hugh for his leadership on this effort. Although I will not be able to attend in person, I recorded a video message, and I've also invited uh Mr. Hugh to attend. And I want to thank our staff, community partners, and everybody who made this improvement possible. I also want to take a moment to thank the city staff for their work on Sunday's memorial event in the Westgate area for the um for Charlie Kirks Memorial. Uh your efforts kept everyone safe and truly made our city shine on the national and world stage. Glendale continues to show that we can host important events with dignity and care. Thank you to everybody who kept everyone safe. Finally, on tonight um consent agenda, we approve liquor licenses for Viarta Supermarkets and we'll be celebrating the ribbon cutting ceremony this Thursday at 59th Avenue in Camelback uh in 10:30 in the morning. And I want to extend a warm welcome to a business owner here who and um who owns Starlight Lounge on 43rd Avenue in Olive. I spoke to him before this meeting. Uh sorry for my long comments today. Thank you, mayor, and thank you, councel. >> Council member Guzman. Yes, mayor. I have uh four items, so mine will be long, too. >> Uh first, I want to announce that the Yucka District meeting will be on Thursday, October the 2nd from uh 6:00 to 8:00 p.m. and we will be holding it at the system of care location, which is uh located at 7677 West Bethany Home Road. We will be discussing the water rates, water conservation and a presentation will be done on water history in Arizona by CAP who is uh the central Arizona project corporation. Uh also I wanted to uh let everyone know that on November 15th we will be holding uh the mayor and I will be sponsoring a Glendel Shred event. It is free. Uh it will be from 8 to 11:00. also held at the Glendel system of care, 7677 West Bethany. Uh we will also uh be accepting uh canned donations for the hope for hunger food drive and also if you have any flags that need um the proper disposal, we will have uh the ability to do that there at the shred event also. So I wanted to invite everyone out to do that. Um, I also would like to recognize that uh we are in the National Hispanic Heritage Month, which started on September 15th and goes to October 15th. Uh, you can go to parks and recreation website and find several events taking place around the city celebrating Hispanic Heritage Month. I would also like to thank Mayor Wyers for presenting a proclamation for the Hispanic Heritage Month at the Glendel Community Center last Monday. Uh, as you know, Glendel has a very large Hispanic population and on this very council sit three Hispanics. Council member Leandro Baldenegro, Council Member Lupe Concus, and myself. And we proudly serve every residents of Glendel. So, I encourage everyone to find an event in the city to attend and celebrate this very beautiful culture. Uh lastly, I want to thank the men and women of our Glendel City Emergency Services and our transportation department for the professionalism and dedication they performed in managing over a 100,000 plus attendees at the State Farm Stadium and all around the Westgate Entertainment Center on Sunday for the memorial service for Charlie Kirk, the founder of Turning Point USA, who was violently assassinated on September 10th. Uh I was there at the service and I personally witnessed the amazing feat it took to manage so many people. Um I was really concerned on how this whole event was going to impact the residents in the area since this is my district and I will report that I have not received any complaints so so far. So thank you again. This was a monumentous job and you all performed it exemplary. Thank you. Thank you, Council Member Milner. >> Uh, thank you, Mayor. I had a very long speech as well, but it's already been covered, I guess. So, u, but I do have a couple of items. Um, uh, let the residents remind the residents that game night is coming up, uh, on October 18th. And if your neighborhood is interested in having a great fun and educational experience, uh there's a meeting being held on October 4th at the downtown police uh center on 6835 North 57th Drive. So you need to be there as a planner to get this organized so that the police department know where they need to be uh and the fire departments and everybody else for this game night. It's going to be really a great event for the city and I hope you can uh participate. Um also I just want to congratulate uh the city the manager and uh construction crews as well as the city department of police department for the new opening of the uh new evidence building that was uh we had a ribbon cutting on that uh and it was it's really absolutely incredible. I think the public would be very very pleased with what's what we have now in the city of Glendel for our evidence locker. Um, also congratulations as was stated uh the great event that happened uh over the weekend and the extreme amount of time and effort that went into into that by our police department uh other cities police departments, the state and everyone else uh really uh pulled it off and and did something that was really difficult to accomplish. Uh thank you mayor. >> Thank you vice mayor. >> Thank you. you uh I'd like to congratulate uh uh Judge Haywood and Judge Prit, congratulations on your uh Judge Prit, your reappointment and Judge Hwood on congratulations on your appointment. You have a beautiful family and it looks like you've got your hands full. Uh um I also wanted to mention the uh ribbon cutting this morning of our police evidence and storage facility. um something that has been in the works for quite some time came to fruition today that um really really kind of moves us into the 21st century as far as our police evidence lab. It's really important part of police work. Um, we're I think very proud of it. And one of the things that I was really, really proud of was listening and talking to the employees that work there and are so passionate about the work they're doing for Glendale and how much they care and what they're pouring into their job. And what was just as uh great for me to hear was that our leadership at our police department is also pouring into the employees. They sent two young women to Mississippi, I believe it was, for five months for additional training for uh forensics. And I mean that what is happening is incredible. And uh so we're and we're not done yet. We're going to keep moving forward. We're going to get our forensics lab. I keep saying that over and over again, but uh you know, it really is important for it's a very important piece of police work to have, you know, we were literally out of space for evidence. So, um, and the building's beautiful. Thank you to Core Construction. It was really, really an impressive, uh, facility or is an impressive facility. Um, and lastly, I do want to say thank you to all of our public safety staff, our transportation staff. I mean, we and all city staff. We are we have staff that has become very accustomed to holding big events, but never, I think, anything quite this big with so many high-profile people and on such short notice. I mean, you literally made us all proud. I mean, the the work that it was literally a drop everything and all hands on deck for eight, nine days and the you show you showed who Glendale is. So, thank you from the bottom of my heart for really really making us all proud. I know how hard it was and we really appreciate you. Thank you, mayor. >> Thank you. And I've got uh a couple things. Uh, I'd like to clarify on the flag when council member Guzman was talking about a shred event and then she mentioned the flag. We're not going to shred the flags. Just want to make sure because I don't I don't need any veterans coming down here angry. Uh, there will be properly retired and that's in an incinerator uh the proper way. So, if you have an American flag that uh is tattered, torn, filthy, dirty, needs to be retired properly, please, please, please bring it to us. will make sure that that gets retired properly. Uh it's the very least we can do to show respect. Uh and then secondly, the event on Sunday morning. Uh just a quick question in the audience, how many of you had a chance to go to the event and witness the event? So I I know of three people in this room total. Uh it was it was one of the most incredible things I've ever intended. Uh, but I also heard that there was people that were saying things about all the trash that was outside. But what people don't know is the city took the the the direction that we're going to make this as good as we possibly can. And so all the trash that was left out from the people that got there at 3:00 in the morning basically camped out pretty much uh left stuff out there as they left the building that afternoon. That trash was gone. it was gone. The city went in there as they were inside the building and cleaned it up. And and I I can't be more proud of of of our staff. Uh where the public safety gets 99% of the of the credit for everything that happened, which they did incredible amounts of work. I can I can assure you it wasn't just public safety. It was streets, transport. I think everybody that works for the city had multiple things that they were doing. But more importantly, I I hope that everybody stops and thinks about this for just a second. It's real easy to complain and and say, "Well, why don't they do this and why don't they do that?" But but think about this. We put on an event that was larger than a Super Bowl. Typically, we have about a year and a half to plan it. Our staff pulled that off in 10 days. And then if you stop and think, we still have 200 and close to 60,000 people in the city that still expect and absolutely deserve the same level of service that they get each and every day. And they did that. They did it without a hiccup, without a hitch. I could not be more proud of the staff, uh, the management team from the person that was picking up the garbage to the person that was up on the roof as a SWAT person waving at people to assure them, you're safe. Don't worry about it. We got it covered. It was incredible. It was absolutely incredible. I don't think there's a mayor in the United States more proud of their city than I am currently right at this moment. Uh, with that said, um, I've already talked way too long. I want to thank all of you for attending tonight. We do have to get to our citizens comments and so we're going to do that next and then and then we can go home. I would like to congratulate Marty Cole for receiving the Ruth Burn Historic Preservation Award. She has worked hard for such a long time to preserve the history of Glendale, and I'm grateful to have volunteered with her for the last 12 years. Thank you to Council Member Bart Turner, who unfortunately isn't here this evening, for checking on the progress of this award, and I'm glad that it's back after several years of absence. I retired June 30th from the Glendel Elementary School District after serving 13 years as a family service advocate and as the wellness program specialist. During that time, I was able to develop great relations with many of the city of Glendel staff members to bring outstanding programs to our employees and I would like to thank those who helped with those programs. First, uh, retired fire educator Dr. Dr. Janet Bullberg, who offered many wellness classes, community engagement staff members with whom we did numerous community garden activities and adopt a street cleanups, director Michelle Yates, Stephanie Fenderson Gonzalez, and Armandra Paratig Library Director Greg Kinder and his staff who each year welcomes the new teachers to let them know about the services that are offered. Wellness coordinator Ally Wetel Brooks, who coordinated quarterly meetings for all other wellness specialists throughout the valley, crimerevention specialist Dorene Anderson, who set up drug takeback sessions and attended our wellness fair on a regular basis, along with numerous departments who do the same. And finally, the parks and recreation department for sponsoring softball and basketball seasons and the staff at the Glendale Adult Center who helped us with registration. This has been a valuable partnership, one I hope continues as we shepherd in a new wellness program specialist. Thank you. >> Thank you, Mr. Dler. You're up, sir. You know, you know the drill. Hi, my name is James Dler. I live in Phoenix, Arizona. Today I am speaking to you regarding renaming the Glendale Public Library to honor former conservative activist Charlie Kirk. He was a conservative media personality and co-founder of Torp Point USA, but he was best known for his deep date with college students on campus. His favorite thing to do was to engage these who disagree with him. A couple weeks ago, he was for shot at Utah Valley University. Miracle suffered a symmet. It was very sad to hear of Char passing. In the future, the library would be known as the Glenn Public Library. Charis may brand. Thank you for taking the time and considering this matter. >> Thank you, James. Uh, and last up, Helena Johnson. >> Again, I'm sure you remember your name and district, please. >> Greetings. Greetings, mayor, council. My name is Helena Johnson. I live in the Choya district. I decided to speak tonight because I believe Glendale is top-notch, especially our staff and our first responders. I believe they deserve positive and public recognition. I was one of the well, it felt like I was one of hundreds of thousands of people with my husband well before sunrise on Sunday morning at State Farm Stadium to attend the memorial for Charlie Kirk. There were miles of people and cars still coming while we were heading back after realizing that we were not going to get in. Though being in line by 4:00 a.m. did not get us inside like many determined people, we observed Glendale at its finest because of the hard work from Glendale's finest. Sunday, September 21st, 2025 was quite a feat for Glendale to prepare for with an overwhelming volume of attendees surpassing the size of a Super Bowl. And to be ready to go in only 7 to 10 days, incredible. Heavy traffic was expected, both with cars and people on foot. It was absolutely something you wanted to see. However, we experienced no issues at all with it. Glendale handled it with command. I don't recall even being worried about the safety while we were there. So, thank you to our fire, our police, our transportation, and all of the Glendale staff. As always, job well done. >> Thank you. >> Thank you.
