[0:45] **Justin Fortney (City Staff):** Thank you commissioner Moes um the applicant purchased the vacant lot to construct the twin home the parcel is 10,000 890 Square ft in size uh that includes a 2,000 square ft for roadway ement for Eddie Street this is located on um the south end of Eddy Street near the intersection of County Road 46 in Vermillion Street it backs up to vacant commercial property the property is zoned R3 which is medium high density residential both the R3 and the R2 zoning districts would allow for the construction of a duplex on the property today without uh with just a building permit. [1:30] **Justin Fortney:** um both would also allow the parcel to be split for construction of a twin home with approval of the minor subdivision the main difference between the two types of homes is a duplex can only have one owner but each side of a twin home can be owned separately The Proposal is to split the existing lot down the center um a twin home would have separate utilities from each other including its service lines to the mains the splitting of the lot for a twin home requires payment of development fees for creating a new lot uh which would include a park land dedication fee and Sewer Interceptor. [2:16] **Justin Fortney:** fee in 1997 the former home that was on this lot was demolished after damage uh from a fire the applicant proposes to construct a slab on grade handicap accessible twin home about between 1,00 and 1200 square foot uh in size for each side kitty corner from the home across Eddie street from the property across Eddie street is a existing twin home um it was built in 1982 um it's currently zoned R2 the properties are the same total width of 66 ft wide those lots are nearly uh uh 300 ft. [3:01] **Justin Fortney:** long which is which is um fairly abnormal there's a few properties in that block that are that deep also that existing uh twin home is behind two detached garages uh which are not allowed in front yards today they have to be located on uh the side or rear of the home or they have to be attached and built as part of the main structure um staff sent out notification of the split to Property Owners within 300 ft of the property and um put a notice in the public of a public Hearing. [3:48] **Justin Fortney:** in the paper we did receive two uh phone calls one was a voicemail of uh from people um let's see here um Randy ficker at 1923 Eddy Street which is I believe two Parcels to the South um is opposed to the lot split for the following reasons it's too small to split he's concerned with potential lwi income home and it should be one lot we also received a Anonymous voicemail stating that they're opposed to the duplex staff recommends approval of the request subject to the conditions listed in the staff report um the Parkland dedication fee currently is $3,200 per unit um per per lot new lot. [4:36] **Justin Fortney:** and uh sewer Interceptor fee of 485 so as there's currently one lot there a minor subdivision would be making one additional lot so that'd be one charge for Park dedication and one charge for the sewer Interceptor fee there's also other fees associated with uh development of the lot but those are standard and come with payment of a building permit so with that um I can stand for any questions or we can open up the public hearing. [5:39] **Missy McGrath (Commissioner):** thank you chair um I think I understand but I just wanted a little bit of clarification around the fees currently as it is one lot there's a $485 sewer fee and the park dedication fee and does that double then because now there are two lots. [6:00] **Justin Fortney:** um there yeah there there's one lot today assumably any fees that were required for development were paid long ago for that one lot and so splitting that lot in half would be adding one new lot to the city of Hastings so any development fees that are required for New Lots would have to be paid for that one new lot so only charges for a new lot being created or needed so just just one charge for sewer Interceptor fee and one charge for Park dedication fee. [6:57] **Justin Fortney:** yes correct they're 100 they're uh 66 ft wide um before the split and after the split they'd be 33 feet wide each. [7:10] **Jennifer Silber:** okay I just the one that's currently built has the garages in front I just question whether you could fit the garage and the town home all on one side with that WID okay thank you. [7:42] **John Moes (Acting Chair):** okay um just reference uh just like people to acknowledge when they submit comments that we do read them you know and then they're part of the decision process the um one regarding the lot is too small to split obviously it's not because we've already done that it's it meets the requirements um and then with the potential use of the property it's not something we can even even take into consideration otherwise we could come up with the bazillion reasons why things should never be done um so do appreciate though the public comments and so forth um regarding the garages I think it's if I if I'm thinking correctly of all the other slab on grade Twin Homes when they're built they it's like a garage and then there's that little sidewalk that goes up next to it and then an entrance and then the bulk of the house is behind it so I think that takes care of the in front part problem wouldn't be in front it's part of the front that's how most uh twin home slab on great homes appear to look from the front so and their garages are attached to the actual unit pretty that's pretty narrow yeah it's pretty narrow so they're probably going to be deeper I'm guessing most of the the living space is going to be down further into the lot so with that any other questions no if not I'll entertain a motion if we are ready commissioner McGrath. [9:56] **Justin Fortney:** um another item for uh the December 2nd council meeting is there'll be a a workshop between the city council and the Planning Commission for the the Highway 55 uh area plan um and then past actions the city council had first reading of the Cannabis ordinance and they did have take it off uh consent and did some discussion on it and they reviewed um some of that ordinance language and they um are going to be hearing that for final approval on uh December 2nd the changes that they had discussed at that meeting was to reduce the park buffers from a, to 500 ft and stopping them at highways the buffer so they wouldn't go over a highway and uh remove the commercial daycare buffers um okay.
