hmm good afternoon Miss Prine we do have a quorum here and it's two o'clock on the dot good afternoon mayor good afternoon this is a meeting of the El Paso city council for Wednesday November 16 2022 present and presiding inside council chambers are this mayor Lisa along with representative manilo representative Molina representative Rodriguez representative Rivera and representative lizarga representative schwarzfein and Hernandez requested to be excused from this meeting are we ready can we stand for the pledge as we do all meetings yes sir please Mr molinar IES you were slow yeah I know go ahead Miss Prine thank you that brings us to item number one on the agenda and this is discussion in action to approve a resolution to Canvas the votes cast in the November 8th 2022 city of El Paso general election and declaring the results Council I will have to read the resolution into the record and it states whereas the city council of the city of El Paso called for the 2022 general election to be held in set City on November 8th 2022 to fill the expired terms of four District representatives from single member districts number one five six and eight and municipal court judge for court number four for the terms as established by in accordance with the charter of the city of El Paso and the laws of the State of Texas and whereas the election officers who helped said election have duly made returns of the results thereof and said returns have been duly delivered to said city council now therefore be it resolved by the city council of the city of El Paso that number one that the city council officially finds and determines that said election was duly given that proper notice subset election was duly given that proper election officers were duly appointed prior to said election that said election was duly held that returns that due returns of the results of said election have been duly made and delivered that the election returns have properly been made out and fully certified by the officers of said election in the different voting precincts of the city and that the city council had duly canvas set results all in accordance with law in the resolution and amendments their two calling said election number two that the city council officially finds and determines that the following votes were cast at said election for the following officers by the resident qualified electors of said City who voted at the election for District 1 Dave Jones 1356 votes Brian Kennedy 8760 Analisa Cordova Silverstein 5389 Freddie Clio Avalos 1211. tilleris Montana's Berrios DMV 994 Lauren Paris 2614 air intake 903 for District 5 Isabel Salcido 7080 votes Richard haneda 2097 Felix J Munoz 1886 district 6 Claudia Lisa Rodriguez 7194 votes Benjamin J Leyva 1405 Christian botejo 3089 artferro 5096 for District 8 Betina Olivares 5707 votes Chris Canales 4947 Richard Wright 3698 Brighton candidate Cruz Morales Jr 73 right in not assigned 76 judge for Municipal Court number four Enrique Olguin 94 795 votes number three that in the case of the offices of Representative District's number 168 no person received more than 50 percent of majority of all votes cast for the candidates of such offices and accordingly no one on for these offices is declared elected and a run-up election is to be called by the city council in accordance with the Texas election code and that the number of votes cast for each person who is a candidate of such offices according to the returns is shown in paragraph two here of number four that in the case of the following offices the following persons who receive more than a fifty percent majority of the votes cast for candidates for such offices are hereby declared elected to such offices for the ensuing terms or until the election and qualification of their successors subject to the proper issuance of certificates of election by the presiding officer and that the number of votes cast for each person who was a candidate for such offices according to the returns is shown in paragraph two here of District representative number five Isabel Salcido and judge Municipal Court number four Enrique Olguin number five that I'm filed in the city clerk's office I made part hereof by reference are copies of the mechanical Precinct tabulations of the votes cast at the 2022 City general election showing the number of votes cast in each precinct for each candidate number six that this resolution is adopted subject to the right of any candidate to contest such election in any way provided by law number seven that this resolution was acted upon in accordance with the law by the presiding officer and the city council and was deemed by said city council that upon passage of the resolution it should take effect immediately and number eight this resolution shall be spread upon the minutes of the city council and the city clerk shall record the Amendments so adopted in the separate book kept in her office for such purpose is there a motion to a motion to approve second there's a motion made by representative Rivera secondary by representative Molina to approve the resolution for item number one on that motion call for the vote yes ma'am some of us were not here in a timely manner to sign in I apologize representative Manilow aye thank you representative Salcido is not present representative Rodriguez thank you in the voting session and the motion passes unanimously it can't be no child I'm sorry go ahead that brings us to item number two and this is discussion in action to approve a resolution chemistry that returns and declaring the results of the November 8th 2022 bond election and other other matters in connection there with and please bear with me I will have to read this resolution as well and it reads whereas the city council the Council of a city of El Paso Texas The City previously ordered an election to be held on November 8th 2022 for the purpose of determining whether the resident qualified voters of the city would authorize the issuance of General obligation bonds by the city and whereas it is hereby found to determine that notice of the election was duly given in the foreign Manner and time required by law and such election was in all respects legally held and conducted in accordance with applicable laws of the State of Texas and the proceedings calling and governing the holding of such election and whereas the council hereby campuses the returns of this election at which there was submitted to all Resident qualified voters of the city for their action thereupon the following proposition city of El Paso Texas Proposition a shall the city council of city of El Paso Texas be authorized to issue General obligation bonds of the city in the principal amount of 246 million 480 000 for permanent public improvements and public purposes to wit designing acquiring constructing improving resurfacing repairing extending expanding and enhancing streets thoroughfares alleys sidewalks Bridges streetscapes screening walls and other Public Waste participation in joint projects with federal state and local public entities and agencies computerized signalization and monitoring equipment and other traffic controls great separation Street lighting necessary or incidental utility relocation Associated drainage improvements in acquiring land Eastman rights of way and other real property interests necessary therefore such bonds to mature serially or otherwise over a period not to exceed 40 years from their date to be issued and sold in one or more series at any price or prices and to Bear interest at any rate or rates fixed floating variable or otherwise as determined shall be determined within the discretion of the city council at the time of issuance or sale of the bonds and whether ad valorem taxes shall be levied upon all tax flexible property in the city sufficient to pay the annual interest and provide a sinking fund to pay the bonds and maturity and the cost of any credit agreements executed in connection with the bonds city of El Paso Texas Proposition B shall the city of El Paso City Council of the city of El Paso Texas be authorized to issue General obligation bonds of the city and the principal amount of 20 million eight hundred thousand dollars for permanent public improvements and public purposes to it designing acquiring constructing improving renovating repairing extending expanding enhancing Furnishing and equipping Park and recreational facilities including all abilities playgrounds shade structures and open spaces and acquiring land easements rights of way and other real property interests necessary there up such bonds to mature serially or otherwise over a period not to exceed 40 years from their date to be issued and sold in one or more series at any price or prices and to Bear interest at any rate or rates fixed floating variable or otherwise as shall be determined within the discretion of the city at the time of issuance or sale of the bonds and whether ad valorem Texas shall be levied upon all taxable property in the city sufficient to pay the annual interest in providing a sinking fund to pay the bonds and maturity and the cost of any credit agreements executed in connection with the bonds city of El Paso Texas Proposition C shall the city council of city of El Paso Texas be authorized to issue General obligation bonds of the city in the principal amount of 5 million two hundred thousand dollars for permanent public improvements and public purposes to it designing constructing improving renovating expanding and enhancing and equipping and existing efficient facilities for renewable energy and resource use efficiency improvements and planning including photovoltaic and solar panel installations Urban heat mobility and climate action planning and modernizations to existing City facilities to meet Green Building standards and in connection with a foregoing acquiring land he spent rights away another real property interest necessary thereof such bonds to mature serially or otherwise over a period not to exceed 40 years from their date to be issued and sold in one or more series at any price or prices and to Bear interest at any rate or rates this floating variable or otherwise as shall be determined within the discretion of the city council at the time a vision wins or sale of the bonds and whether ad valorem taxes shall be levied upon all taxable property in the city sufficient to pay the annual interest in providing a sinking fund to pay the bonds at maturity and the cost of any credit agreements executed in connection with the bonds and whereas the council has diligently inquired into the polis and the official election returns were which were duly and lawfully provided to the council by the judge's clerks and an administrator holding and conducting such election the police and the official election returns showing separately the votes cast in the election and whereas from these returns the council hereby finds that the following votes were cast in the election by voters who were resident qualified voters of the city state of El Paso Texas Proposition a the issuance of 246 million 480 000 General obligation bonds for Street improvements including sidewalks Street escapes and traffic controls and planning and the imposition of a tax efficient to pay the principle of an interest on the bonds in early voting early votes including mail ball ballots for the measured 51 103 votes against 33 811 votes on Election Day votes for the measure 29 532 votes against 11 17 119 votes the total votes for proposition a for the measure 80 635 against the measure fifty thousand nine hundred and thirty city of El Paso Texas Proposition B the issuance of 20 million eight hundred thousand General obligation bonds for parks and recreation facility sending a position of a tax efficient to pay the principal of an interest on the bonds early voting including mailbox ballots for the measure forty three thousand four hundred forty two votes against the measure of 41 173 on Election Day voting was four the measure 25 929 against were twenty thousand four hundred and forty two the total votes for proposition B for proposition B 69 371 against proposition B 61 615 state of El Paso Texas Proposition C the issuance of five million two hundred thousand General obligation bonds for renewable energy and resource use efficiency improvements and planning on the imposition of a tax efficient to pay the principal of an interest on the bonds on early voting including mail ballots four Proposition C were 42 131 votes against 42 563 on Election Day the votes were for the measure twenty four thousand two hundred and fifteen against proposition or twenty two thousand one hundred and twenty nine total votes for Proposition C for Proposition C 66 346 and against where sixty four thousand six hundred and ninety two now therefore the city Council of the city of El Paso Texas hereby finds and declares and results at Section 1 the council officially finds determinants and declares that the election was duly improperly ordered the proper legal notice of such election was duly given that proper election officers were duly appointed prior to the election that the election was duly illegally held at all Resident qualified voters of the city were permitted to vote at the election that due returns of the results of the election have been made and delivered and that the council has dueled campus and such returns all in accordance with the laws of the State of Texas and the United States of America and the order calling the election section 2 a majority of the resident qualified voters of the city voting in such election having voted for the authorization and issuance of the bonds and the levy and Pledge of the tax and payment thereof as provided in proposition a the council hereby finds and determines that proposition a carried out the election that the election was duly called the proper notice was given that the election was held in all aspects in Conformity with a law and that the council is hereby according mainly authorized to issue the bonds and to Levy the tax in accordance with the authority granted in the proposition and applicable law Section 3 a majority of Resident qualified voters of the city voting in such election having voted for the authorization and issuance of the bonds and the levy and Pledge of the tax and payment thereof as provided in proposition B the council hereby finds and determines that proposition be carried at the election that the election was duly called their proper notice was given that the election was held in all aspects in Conformity with the law and that the council is hereby accordingly authorized to issue the bonds and to Levy the tax in accordance with the authority granted in their proposition and applicable law section 4 a majority of the resident qualified voters of the city voting in such election have been voted for the authorization and issuance of the bonds and Levy and Pledge of the tax and payment thereof has provided in Proposition C the council hereby finds and determines their Proposition C carried at the election that the election was duly called their proper notice was given that the election was held in all aspects in Conformity with the law and that the council is hereby authorized accordingly to issue the bonds and to Levy the tax in accordance with the authority granted in the proposition and applicable law Section 5 the recitals contained in the Preamble hereby are hereby found to be true and such recitals are hereby made a part of this resolution for all purposes and are adopted as part of the judgment and findings of the council section 6 it is officially found determined and declared that the meeting at which this resolution is adopted was open to the public and public notice of the time place and subject matter of the public business to be considered at such meeting including this resolution was given all as required by chapter 551 as amended Texas government code section 7 this resolution shall be enforced in effect from after its final passage and it is so resolved Council promotion second thank you there's a motion made by representative Rivera seconded by representative Molina to approve the resolution for item number two on that motion call for the vote representative aye thank you in the voting session and the motion passes unanimously item number three is discussion in action on a resolution calling for a runoff election to be held on December 17 2022 with early voting from November 30th through December 13th from the city's general election and making Provisions for the conduct of the election and authorizing a contract with El Paso County to furnish election Services equipment and for polling places is there a motion there's a motion made by representative anello seconded by representative Molina to approve the resolution on item 3 calling for the runoff election representative uh Rodriguez Rodriguez has a question thank you mayor um do I need to recuse myself from this one no ma'am okay no you don't need to recuse yourself or abstain or anything right yeah no no okay just making sure so this is calling for the runoff election to be held on December 17 2022 with early voting from November 30th through December 13th from the city's Journal election yes sir on that motion call for the vote representative Ray thank you and the voting session and the motion passes unanimously Miss Prine I'd like to thank all the members that ran for public office I know it takes a lot to run for public office and I do want to thank everyone that put their name out there and campaigned and ran out there and I'd like to congratulate uh representative Salcido for winning her election and the rest of the the races are that are in a runoff I'd like to congratulate every one of them and good luck to every one of them with that we have motion to adjourn Contour during the special city council meeting
