missing one of the proclamations just Ser is not here my apologies for not having the  proclamation for just serve um we will   bring okay thank you I can read that okay  thank you very much the proclamation reads   the city of witto Kansas founded in 1870 whereas  we acknowledg the profound impact that can be   achieved when we extend a helping hand to our  neighbors especially those of diverse backgrounds   and lifting them up and collectively working  to improve lives whereas we nurture a culture   of giving within our cities emphasizing that  volunteerism is not just a duty but a source   of personal fulfillment and and Community  strength and as we work side by side with   and learn from each other Mutual understanding  increases misconceptions can be corrected and   new friendships can be built whereas we urge all  citizens to care for one another volunteer and   engage in Acts of service and kindness that  contribute to our City's betterment and its   inhabitants well-being regardless of background  or belief whereas witcha has joined a growing   list of supports including the president of  the National League of cities and hundreds   of leaders to date in making a commitment to  volunteerism now therefore be it resolved that   I Lily woo mayor of the city of Witchita Kansas  along with the Witchita city council commit to   promoting volunteerism leveraging justserve.org  to make it easier for residents to find and engage   in volunteer opportunities and will regularly  acknowledge and celebrate the contributions of volunteers uh first of all thank you mayor woo and  the members of the city Council appreciate uh this   opportunity um really on behalf of just serve  organization we want to uh present the city of   witto with his award and recognize them as a just  served City and just want to thank and appreciate   uh the mayor and city council and our city leaders  efforts to promote volunteerism in the city of   witto it's through that support for volunteerism  that helps build our city and community   into the wonderful place it is to live and  work and raise our families the just serve   City program in conjunction with the free just  serve volunteer platform links individuals from   every Walk of Life to local service projects so  it is our hope that many of the good charitable   organizations here in witto will utilize this  platform to reach out uh to let the members of   our community know of those service projects that  are available and that the many good citizens of   the city that do spend so much time volunteering  this is a resource for them to be able to find   those opportunities to serve in our Comm in  our community it's through this service one   to another that we lift one another uh the  community uh organizations that reach out to   those in need to fulfill those needs and us as  individuals and citizens that we can serve our   neighbors to lift them in times of need and to  strengthen our community and to strengthen our city this just serve award is a recognition  designed to honor cities that demonstrate an   exceptional commitment to volunteering  and have made a significant impact in   their communities through these efforts  again thank you mayor thank you city   council members for your support and  we want to present this to you today than it's not often the we the city City uh  council members get a just served city   award so thank you this is a reminder  that there are great organizations here   in our community that you can volunteer and  tomorrow on September 11th it is a day of   service and it's a great reminder that you  can also volunteer your time your treasures   and your talent uh in our community and we  greatly appreciate all those city  of witcha Kansas founded in 1870 whereas the   Constitution of the United States of America  the guardian of our liberties embodies the   principles of limited government in a republic  dedicated to rule by law whereas September 17th   2024 marks the 237th anniversary of the  framing of the Constitution of the United   States of America by the the Constitutional  Convention whereas it's fitting and proper to   Accord official recognition to This Magnificent  document and its memorable anniversary and to the   Patriotic celebrations which will commemorate it  and whereas Public Law 915 guarantees the issuing   of a proclamation each year by the president  of the United States of America designating   September 17th through 23rd as Constitution  week now therefore be it resolved that I Lily   woo mayor of the city of Witchita Kansas along  with the Witchita city council do hereby proclaim   the week of September 17th through 23rd 2024  as Constitution week in the city of Witchita   and encourage all citizens to reaffirm the  ideals the framers of the Constitution had   in 1787 by vigilantly protecting the freedoms  guaranteed to us through this guardian of our Li lities mayor woo on behalf of the  National Society Daughters of the   American Revolution I would like to thank  you and the Witchita city council for this   proclamation to recognize September  17th through 23rd as Constitution week   in September 1887 the US was a nation on the brink  it had won the war of independence from England   but it was losing the peace the national  treasury was virtually empty the economy   was faltering and National and state debts went  unpaid 13 independent states had to find a way   to come together under one government it was  against this backdrop that the constitution   was written during the long sweltering summer of  1787 behind locked doors and windows the men of   the Continental Congress devised a plan based on  three co-equal branches to lead our new Republic   into the future this form of government had never  been tried before and no one knew if it would work   this year we celebrate the 237th anniversary of  our Nations founding document the US Constitution   although it has been amended 27 times since its  ratification the Constitution still stands as   the supreme law of the land the Daughters of the  American Revolution celebrate the work of American   Patriots who sacrificed so much for our freedom  and way of life during Constitution week local   DAR members will be participating in activities  and sharing Shing the story of the Constitution   and the beginning of this great nation with  the Future Leaders of Tomorrow thank you thank you may I please ask the srin Lis group  to please come forward at this time you know me uh I live in District  5 my name is Bill Stout I I started playing public   golf in Witchita in the early 1980s I have  to tell you the last couple years I've been   absolutely mortified by the conditions of the  courses and I think a lot of that has to do   with the fact that our parks department doesn't  seem to Value the golf courses for what they are   and maybe because we' forgotten the history in  1955 the city acquired the golf course we call   or used to call LW clamp at that time it was  called metal art golf course and we named it   for a gentleman who had been the mayor the city  manager and a council member well in 2019 under   a questionable leadership of Troy hman we closed  the course and a Master Plan was introduced to   spend 28 million from an out of state agency  by the way and that fell flat the idea was   to completely redo the course into a park jump  forward almost two years early 2021 once again   a sole decision from Troy hatman a deal was made  to lease the clubhouse for $300 a month that works   out to just over 10 cents a square foot for a  public asset with a dedicated parking lot that   was furnished I challenge any of you to find a  3,000 sqt building with a dedicated parking lot   that's furnished for 10 cents a square foot the  average going rate in witch TI right now $18.38 but it gets worse the contract provided that  the rent would increase 30% per year that never   happened was never put out to bid we never  raised the rate it's absurd it's incompetent   it's borderline corrupt it's another shining  example of why taxpayers don't trust government   but at least we're told the bathrooms are  nice and clean so I guess there's that   and I want to know how this extension 10 years on  this contract just miraculously showed up on the   consent agenda and why we wanted to lower the rent  from what it should be it was stated last week by   one council member that quote if it ain't broke  don't fix it well I assure you it's broken because   since the rent was never increased the total  loss in Revenue to the City without an RFP mind   you since the beginning of the contract based on  my math $ 5,241 30 now I've owned businesses many   of you do or have as well how many of us would  allow an employee to just not collect $ 5,241   30 and what would we do with that employee I know  what I would do they wouldn't work for me anymore   last week the mayor thank you by the way asked who  would be held accountable I ask who will be fired   and when we have to have accountability in our  government we deserve that as taxpayers and not   properly invoicing a client and undervaluing  an asset is not being good stewards of the   taxpayers so we kicked the can down the road  for another year I see I ask this is it just   me or is there a serious problem at the parks  department does it need an audit does it need   an overhaul see I have no problem with who the  client is who the tenant is that's not the issue   it's the sleaziness of the deal how it was how it  came to be and the real irony in all of this LW   clap Golf Course was named after the man who  created the witch parks department how do   you think he feels about that if he was still  alive not a very good stewardship of his name   either thank you mayor thank you Mr Glascock for  standing up against this deal last week like you   I truly hope there'll be some accountability but  I'm not holding my breath thank you for your time thank you Mr Stout Madame  clerk can you please call   the next individual Bobby Harland Park Elementary purchase is Bobby Harland in the audience today I don't see Mr harling so we now  have time for anyone who would like to   speak during public agenda to come forward  and speak to the council you will have up   to five minutes and anyone can share any  topic or concern is there anyone from the public hello um my name is Aaliyah Bernard I  live behind Park Elementary um I walk my dog   behind there every day um I was a little confused  last week when I watched the city council meeting   and there was something mentioned about building  directly west of it um I'm confused directly west   of that property is the historic Midtown walkway  um and even west of that goes into Riverside goes   into Warz goes into other local businesses over  there but I guess my question was does witto only   have a dollar to offer for Park Elementary I saw  that you weren't in the business of uh helping   or not helping the wrong terminology um making a  business for the homeless Community I know that   you're taking it you want to help us out help  out the people winter time I very much want the   same thing I see the people around there I want to  help them I see the struggles however I just don't   see how we have bulldozed over five buildings in  witch yet we are taking or it seems to be taking   occupied space and I think that we could just do  more with it I think that there are other options   and uh other spaces that are already vacant for to  build a new complex if that is what is happening thanks vice mayor Ballard thank  you thank you so much for coming   I do have a quick question for you for  the speaker I have a quick question for you no that's okay I just wasn't sure I just  want to make sure that we can address your   question are you talking about the potential  um transitional housing that we were talking   about for this for the project three yeah  uh it just said something building directly   west of it and I was confused if it was like a  new development or not yeah try could you help   address that question thank you so much yeah  sorry I I don't have a map here in front of me   but we'll be more than happy to get together  with you and show what we're talking there   is land between Park Elementary School and the  the walkway that you're talking about sufficient   to build a new housing project and we have some  illustrations that kind of show that I'd be more   than happy to get together with you after and kind  of show you what we're what we're thinking about   I know the space okay all right council member  Johnston thank you mayor I just want to address   something that Bill said Bill Stout um it was  10 cents a square foot uh square footage is   the uh square footage of the building is 2,880  square ft the rent is $3,600 a year so it's 300   a month 3600 a year and it comes to 80 cents a  square foot so uh that's how you figure square   footage but anyway to your point it's it's not  much but uh just want to correct the record to   make sure that that is corrected thank you council  member Glascock thank you Aaliyah for coming and   speaking as well you don't have to come back up  here um I just wanted to address the um dollar   purchase price and why is dollar purchase price  uh the justification from this board um and from   the school board is that taxpayers had already  paid uh for the construction of the building once   um we're transitioning it from one government  entity to another government entity and for us   and for the school board it didn't make sense the  taxpayers would be paying for the building twice   um and hopefully establishes a good partnership  between us and the school district and so that was   the dollar purchase price and the justification  from this board um and so I think it was a good   use of taxpayer dollars and a good partnership um  also with the school district as well so I just   wanted to address that because I know that was  one of your concerns thank you for speaking today would anyone else from the audience like to speak  I see none we'll bring it back here for our next item consent agenda items 1 through 13 are there consent Incorporated in the amount of 1,848 addition for roson Construction LLC in the  amount of $ 42,46 this is uh negotiated to   the engineers's estimate we have the witch  multimodal facility rebid for Don linger and   Suns Construction Company Incorporated  for an aggregate bid total of1 19 m738 58112 we have eight Police Package motor  motorcycles for twister City motorcycles   LLC for an aggregate bid total of $279,800  and 80 we have the GPS alerting solution   system for wit fire department recommended  for H Incorporated in the amount of $ 68,276 $ 4,359 79 and we have the  facilities decision support tool   for public works for brightly software  Incorporated in the amount of $3,666   64 um with one year with four onee options  to renew uh this is how to become a vendor   with the city uh these are open public  opportunities out on the street today and I'd be happy to try to answer your questions  and recommend your approval council member ho   Heisel thank you mayor uh can we go back to slide  five sure now this was a rebid correct correct the   first time we bidded uh exceeded the engineer's  estimate we worked with our engineering department   retooled the specs put it back out so the reason  it says Dash rebid is we we put it out twice okay   um what was the previous bid uh or the previous  low bid I suppose there there's only one bid it   was non linger um and I'm sorry I don't have  that on top of my head but I but I know it was   I want to say 40 million but but don't quote me on  that I can get you that okay appreciate it thank you can we um go back to that slide number five  did you just say 40 million I don't know on top   of my head I need to get clarification I'm  sorry it was over the engineer's estimate yeah I think maybe 24 was about I am Paul guns one Public Works and   utilities as I recall it was  just over 18 million um let me sorry the base bid previously was 21 million   191,000 when we open bids the first time okay  thank you and at that time there was only one   bidder correct that is correct there was only one  bidder at that time um it was also donlinger who   bid that okay thank you any further consideration the  petitions on the the signatures on the petitions   represent 100% of the improvement district and  the petitions are valid per Kansas statute me   second edition located in District 5 the  project will provide water improvements   storm water sewer sanitary sewer and Paving  improvements for multiple phases required for   a new residential development the developer  will also construct the improvements under   private contract to comply with State Statute  regarding the use of special assessment funding   the city must acquire the completed projects me second addition again in  District 5 on August 22nd 2023 and   July 2nd 2024 the city council approved water  sewer drainage and Paving improvements to serve   me second edition developer has submitted  revised petitions with revised budgets to   meet current market conditions and cover the  cost of private bids again for multiple phas   es it is recommended that the city council  approve the new and revised petitions and   budgets adopt the new and amending resolutions  and authorizing necessary signatures and I will   stand for questions any questions for staff I see  none I move to approve the status report honorable mayor members of  Council Troy Anderson assistant city manager a little bit of background um  parking is important to our community   because allows relatively direct vehicular  access to residences businesses and other   destinations because parking is a limited  resource however it's important to manage   public parking effectively using a variety  of tools effective parking management allows   people to find Convenient parking spaces reduces  congestion helps accommodate new developments and   growth and enables consumer Choice over the last  15 years and probably longer than that uh which   has continued to try and balance the cost  associated with operational maintenance and   effective parking management unfortunately  the city struggled to achieve that balance   included in uh staff's report is a little bit  of History uh dating back to at least as far   back as it 2018 on revenues and expenses as it  directly relates to the parking fund um note   the lack of capital outlay that has been  committed or expended each year into the budget assuming an industry standard best  practice $200 per space per year capital   outlay a 6,800 space system would  require approximately $1.3 million   in annual maintenance expenses unfortunately  the current fund balance is insufficient to   provide that ongoing uh repair and maintenance  in fact enhancements to the system including   things such as safety security uh cleanliness  beautification would only compound the system   deficit today we estimate those expenses  deferred uh expenses no less than about   $8.3 million that was based on a 2017 2018 asset  evaluation of parking structures so that does not   include issues that have presented themselves  since that study or parking lots or on Street   on August 13th 2024 city council delayed  the implementation of the parking plan until   additional Community engagement could be conducted  so since then and and really in advance of that um   City staff has either hosted or participated in  the following community events on August 10th um   City staff participated in the farm and Art Market  on August 12th there was a meeting at the greater   witch to partnership August 12th a meeting at  the veil August 15th a meeting at kmuw August   21st a meeting at senior services August 21st a  meeting at Key Centric August 22nd a meeting at   senior services August 26th staff presented to the  witchta area Metropolitan planning organizational   technical advisory committee meeting um on August  26th there was a meeting at Norton's on August   28th uh staff presented to the access Advisory  board at their regularly scheduled meeting and   on August 29th um there was a meeting that was  uh hosted by the Chamber of Commerce at the   Kansas Leadership Center additionally there are  tentatively two more opportunities to engage the   community um other meetings have been held with  individual stakeholders uh as well uh in order   to obtain their feedback uh from the meetings  we have heard the following themes paid parking   could discourage downtown retail activity the  existing system is working businesses cannot   afford to pay for parking employees would be  penalized by paid parking and maintenance and   security for the system needs to be enhanced  but not solely through increased rates then   this is just a sampling not inclusive not all  inclusive here are some of the options we're   exploring to address the goals of the plan and  the needs of the public continuation of existing   parking agreements with rate adjustments to meet  operating and maintenance needs installation of   meters with one hour of free parking and 75 cents  an hour for the remaining time discounted daily   rates for downtown employees sponsorships of on  street parking spaces availability of discounted   parking passes I.E daily monthly and funding of  ongoing maintenance and operating costs by users   and capital Improvement projects by the property  tax again these were just some themes that we had   heard this is not all inclusive just some of  the sampling of things that we are evaluating   so Financial consideration so according to the  plan the parking fund generated revenues about   $227 per space in 2018 So based on a 6,800 space  system that's approximately $1.5 million annually   however industry standard best practice tells  us that we should be charging about $400 per   space per year for operation and maintenance  that would be an estimated of about $2.7   million for that same 6,800 space system and an  addition of $200 per space per year for Capital   outlay again that's the number we provided  previously estimated at about 1.36 million   for a total of about $4 million annually legal  considerations before you today there are none   as the recommendation at this point is simply to  receive and file and with that I will stand for questions council member hoisel thank you mayor uh  thank you Troy for all your work on this um kind   of a thankless project right did you draw the  short St straw when you took this one on uh um   can we go back to slide 26 real quick all right  thank you um how much of that $8 million um in   deferred maintenance as parking garages is in  relation to parking garages all of them all of   them all it yeah in fact uh we continue to dig  into this and uh that number is probably north   of 9 million at this point what's uh the price  for spot um between parking garages and open Lots   what's the difference there between how much it  cost to annually keep it up yeah so uh that's a   good question we actually went back and pulled  uh some numbers from um a previous study from   a 2009 from the 2009 study and at the time the  2009 study recommended about $60 per space per   year for surface and when we look at Surf  surface the difference in cost associated   with an on Street versus an off Street surface  lot are probably about the same uh there's a   little bit of nuance between the two but for all  intense purposes an unstructured space at that   point in time was around $60 per space per year  structured was around $200 per space per year   those were $29 today those are probably equate  to probably twice that based on uh inflation and   other metrics that that we've looked at uh that's  probably twice that today so about three times as   much for a structured as it is for a open lot yeah  absolutely the cost of maintaining structures are   are obviously more expensive than surface yep  hey um when was the last time we made a profit   from our parking grounds so included in the staff  report um if you go back to um 2018 there was a a   a difference of $200,000 in 2018 between revenues  and expenditures in 2019 there was a loss 2020   there was a loss 21 there was a loss 22 there  was a loss and then in 2023 there was about a   $53,000 difference okay um excuse me if I can ju I  I think it's important to emphasize what Troy did   earlier in the state in his presentation and that  is that's only on basic operations and maintenance   not on any capital outlay or improvements so  if we had been making any uh investments in our   facilities we would have been at a deficit more  the deficit appreciate that um do we know what   percentage of the parking garage the revenue that  we make from the parking garage comes from people   like parking in the parking garage as opposed to  contracts that we have with businesses to park in   the parking garage I don't have a percentage  for you but I can tell you that the bulk   of charges for services and sales come from  contract agreements yeah that's what it seems   like like not too many people even know which are  the city garages and um whether or not to pull in   there and whatnot right um so I I don't think that  there's a whole lot of people the public using our   um parking garages uh what parking garages do we  have to keep I know we have an agreement with the   U the biomed Center to provide some parking there  uh what other garages around this City do we have   uh contracts with or agreements with um other  businesses or corporations to provide parking   outside of just a regular you can contract out  for some parking spots so I can tell you that   currently we have eight parking structures um  there's two in Oldtown they're sort of three   in and around the downtown the Emporia Street  Garage the William Street garage The Market   Street Garage we have a parking garage um along  Kellogg in the waterwalk district um that's the   open garage there next to the former Gander  Mountain the now uh king of freight facility   um there is a city hall garage obviously here at  City Hall and then uh technically the city owns   the garage across the street from the Drury Hotel  but there's a an agreement with the Drury that   they lease they operate and maintain that Garage  on behalf of the city so technically we own eight   parking structures in addition to that uh  yes there is a parking garage um as part of   the development agreement with EPC next to the  ballpark um that will break ground here shortly   and there is uh a former commitment to your point  uh with regard to the biomedical Center in regards   to providing parking associated with that yes okay  I I my thoughts are it appears that most of the   cost from parking is um being generated by these  parking maintenance and whatnot into the parking   garages have we given any thought to just selling  the parking garages to some of these businesses   and taking the profit from that and maybe putting  that into um the parking fund for the next couple   of years and funding the parking fund that way cuz  I I think most people's concerns are the on street   parking that seems like what most people use in  in regards to shopping in any place downtown or   going any place downtown and some surface Lots  here and there but we have an abundance of the   the surface lot so um have we given any thought to  anything along those lines so I will tell you that   selling parking garages and selling parking assets  would be sort of contrary to any professional   advice any industry standard best practice right  it's because of parking garages that cities are   able to achieve the density and the vibrancy  that um the downtowns are always striving for   right it's because of that that density  and parking that unlocks the development   potential of the surrounding real estate if we  simply Park on Surface parking associated with   business businesses well that's exactly what  takes place in Suburbia right and so downtowns   are different and in order to again kind of  unlock the density uh and and the vibrancy   and the development that we all know and  understand is is there in downtown which   selling parking garages and parking accet assets  would actually be detrimental to those goals and   objectives and and again would be contrary to  either the 2019 study the 2009 study and and   anything else any of our Pure cities are doing  well I can appreciate that um I don't think   Den city is necessarily a concern right now in  downtown which I think there's ample opportunity   to sell off some of our Lots as well I think you  said 39% is about the highest that we get as far   as occupancy of the open open Lots um and if we  look into it maybe they have to keep the garages   it's just more can we offload us that way we're  offloading some of our cost people can adjust you   know again working it out with businesses because  it doesn't seem like it would affect most witchet   who just go downtown to shop or to pay a bill  or something like that so um I'm just throwing   my two cents out there I I it again it just seems  like the lots are what's causing the issues here   and um just trying to figure out the best way out  so again I appreciate all your work on this try   council member Glascock thank you mayor um it  looks like the whole board's lit so you might   have a few questions up here today um first off  to go in uh councilman Ho's Direction regarding   parking I know you had said we want the garages  for density aspect um I think that could be done   with a deed restriction for parking garages if  that was the intention for Private Industry to   manage it and the intention was to keep it that  way and then in that way theoretically you have   different private Industries competing for lower  prices they want people to park in their garages   so just an extension I think there's a way you  could probably get parking garages to work so   I'd be interested in seeing if there's a deed  restriction aspect that we could operate so it's   still being used as what the asset we want it's  being managed by somebody who's probably better   at managing it government um I also agree that  we must recoup user fees um and it should not   be on the general taxpayer I think I've made it  clear from the bench that my disagreements with   this are not necessarily for that but for the  enforcement side and that we're privatizing the   enforcement to a third party and not enh housing  it to government Trier function have we looked   at any possibility I know in conversations with  the community of US inh housing it instead of a   third party that has a profit incentive uh when  it comes to parking where the government shouldn't   have a profit incentive to improve law yeah so  um with regards to deed restrictions right um   I can tell you and maybe this responds to your  comment about eers there are a number of parking   garages uh in Witchita that um that the city  has a deed restriction per se on uh you have   the cargil garage is an example right where it's  a private garage and there is a requirement that   a certain percentage of it be made available  to the public on nights and weekends there is   um the River Vista garage which similarly is  a private garage but the requirement is that   they provide a certain percentage of parking  available to the public and I can tell you that again in these scenarios well yes the operation  and maintenance expenses are passed along to the   private property owner parking management is not  achieved in the context that while that parking is   made available to the public it's outside of the  control of the public public in the city right so   in those parking garages for example we can't or  the it's up to the property owner to enter into   any other parking agreement to provide parking  for any other business right and so what generally   happens in those instances is the available  parking in those garages becomes available   for transient users but that's only part of the  usage as we talked a little bit a while ago right   the largest percentage of the revenue that comes  in comes from contract agreements well if we don't   have sort of ownership control of the asset  we can't enter into those contract agreements   right and those property owners are also not  beholden to enter into those contract agreements   and so we're not achieving the occupancy that is  necessary for the entire system but that it's a   conversation that would be willing to continue  to to have um with regards to the question um   your second question I apolog could you rephrase  that it was regarding the enforcement aspect oh   yeah right now we're Outsourcing that to car  park the intention is to enter into a long   agreement with car park with that has there been  conversations about having um staff in the city   of wiah proceed our laws so we we've already  started digging into that and Pro so a cursory   look at just the enforcement on Street Maintenance  and customer service the cost for the car park   providing that labor um is about 495,000 and on a  low rate for the city of Witchita to provide the   same it would be $555,000 a year on the highend it  would be7 84,000 a year again that doesn't include   management that is just labor associated ated with  enforcement on Street Maintenance and customer   service a cursory review tells us that it would be  it would be cheaper for the car park to hire those   individuals and manage those individuals rather  than the city just based on wages benefit Etc   in addition to that um there is a duplication of  efforts right that if the city were just enforcing   then there are there's labor associated with just  enforcing versus the labor that's necessary to go   out and maintain the system right and so  there's economies of scale by having one   contractor do both because you can have the same  individual doing multiple roles and geographically   there's there's only one equipment piece of  equipment that's necessary versus two right   and so there's economies in scale and economies of  efficiency by having a subcontractor provide both   Services because they're out in the field there's  only sort of one vehicle necessary per individual   there's they're already out there at the meter  doing the maintenance and otherwise right and so   enforcement comes along with that cursory review  those are some of the original uh numbers we've   just come up with right but we're prepared to  we're actually working on a more comprehensive   sort of more thorough evaluation yeah I'll be look  forward to seeing that breakdown I think I have a   concern that the justification is to Outsource  it so we can pay people less and not offer as   good of benefits that we the city so I don't  know if that's the justification that I would   want um you had mentioned Cargill I know that the  mayor had expressed concerns when we attended the   Norton's event I was not aware uh that Cargill was  a lot that I could park in I imagine the general   public is not aware and the mayor had expressed  at Norton's that they actually keep the barrier   down and even so for all extensive purposes it's  not accessible the public has that been addressed   with Cargill as well so I can tell you since  that conversation we have reached out to Cargill   we have been in conversation with Cargill and  we're trying to address the situation yeah okay   thank you I have three more brief questions  um hopefully maybe brief questions um I met   with the student body president of the do school  downtown um they have concerns for student parking   specifically the cost of student parking I know  that we're building um we're looking at building   the uh parking garage for the biomed campus with  witto State have there been conversations about   students all at the do school also being able to  use that facility with more student facility um   instead of just the do school students having  a different um Collegiate Experience downtown   students have we had conversations yeah so um so  to answer that question yes we're open to that   as we contemplate investments in the future into  new parking structures right the the the idea is   to design the size uh and scale of that parking  structure to support a multitude of users right   and so if in the future we are building a new  parking structure if uh a student of the do school   or if a student of the biomed campus wants to  lease parking within that parking structure we   have those options available right um something  else that we talk to people about is not every   student necessarily need the parking space  either right in the context that uh there are   some students that will simply commute downtown  and back right uh there we've been in conversation   with the university around a c circulator and a  and a bus system that can get folks back and forth   to campus so there may be students that are coming  downtown to who may not drive at all there are a   number of students who who live downtown on sort  of the other end of the spectrum right and they're   parking in a parking structure whether public or  private in conjunction with their um apartment   lease right and so they're not going to move their  vehicle so to speak just to go to class right and   so that's why when we talk about Downtown parking  as an ecosystem those are the things that we're   taking into consideration we're balancing the  usage and the occupancy amongst the entire system   so to your point yes there would be we anticipate  parking for a number of users within any one asset   we're talking about employee discounts I think  students should maybe considered in that as well   well we probably do need to discuss that more  we've had multiple discussions with witas State   officials who currently charge for parking on  Camp and so they said their students know that   there's a price for parking and are willing to pay  that and that's why they've been supportive of us   with the plan that's gone forward recognizing uh  they actually are probably a little more concerned   about staff than they are students because  they know the students pay an annual fee for   their parking yeah as long as we include the Dos  students conversation so I think would be helpful   um two last things on street parking versus  parking lot I know there's been considerations of   uh um the on street parking theoretically being  covered by the property tax dollars that are   already existing because it's Street Maintenance  Street Maintenance and then parking lots and   parking garages being considered separately so one  have we considered that separation and then two   I'll just combine this question the separation of  Oldtown being very different than downtown being   very different than deleno that all three have  unique needs um my con my concern is particularly   deleno which I represent and that the motti the  multi Hub is going to change how parking is done   in that area uh one upon completion so any parking  plan is going to have to be adapted at some point   yeah if I could jump in for a second we've had  productive conversations with Delo representatives   and I do think that we're going to bring a plan  to some of their businesses be between now and the   next time that the council discusses that um we've  also had I think pretty productive discussions   with Oldtown in all likelihood what we're trying  to achiev through the parking plan can be done in   deleno um their key is to have turnover parking  and uh and but to have some free experience and   right now that's one of the reasons we're kicking  around that idea of an hour free parking and the   75 cents after that predictability but it  also allows for that In-N-Out parking that's   so important to the Delano businesses but we're  that's still a work in progress um looking at a   couple of different options in Oldtown and  trying to get to judge business support for   that and I would say Oldtown because because they  have long-term agreements that have been in place   since the90s uh we recognize that we probably  just don't want to turn that upside down so we   probably will have something that's more flexible  or actually will recognize the way they've been   paying for parking in the past okay awesome  that's all the question thank you TR thank you   Bob council member Johnston thank you mayor first  I want to correct I have a question for you Troy   but I want to correct something I said earlier  it might have been my first mistake today but   won't be my last um square footage is is based  on an annual rate I said 80 cents for clap Park   it's actually a125 is the correct rate and I'm  sure Bill Stout was correcting was quoting it   by month 10 cents a month but it is you did  quote $17 a square foot so I think we need to   keep apples with apples so $125 versus uh uh 17  so apologize for that like I say it won't be my   last mistake that's all right um Troy I do have  a question for you uh can you go back to slide 25 please under all other revenues we look at 2018  you know $423,000 2019 $360,000 then it dropped   significantly with with covid 6,074 th000 it  hasn't rebounded near to where it was previously   at 100,000 and 102,000 for uh 2023 what is  included in that number and why has it not   rebounded to pre previous pre preco levels right  so uh good question so in all other revenues there   are two categories there is rental income and  there is other revenues so as part of the rental   income there are some um there are some rents that  we receive that are part of of units within our   parking structure so there's some rental income  and then there's some other Revenue um other   Revenue also includes things like uh citation  Revenue right and so uh I was in conversation   with our our finance director this morning um Mark  Manning and we talked through a number of these   things obviously in sort of covid years right  there was a huge decline in just mobile usage   people were confined to homes and so we saw a  huge downturn in uh not only rents as you can see   charges for service and sales um in those years  you'll see in 2022 2023 that has has returned   but since 2020 there have been a number of uh  of users that have just just not continued to   come downtown right one of the suggestions was we  have an agreement for example with an office user   who um who postco is not returning to the office  right and so therefore there's some downturn in   usage and in rents associated with that um another  is just parking citations in general we've been   in touch with our courts this morning because of a  lack of enforcement right we've seen a downturn in   parking citation Revenue um we've also seen  over the years a number of again it's it's a   nominal number but meter heads that have become  um jammed or inoperable and subsequently enable   to be repaired and so they are simply removed  right and so you can kind of see that downward   trend of other revenues that you would generally  think about a system receiving despite the tick in   charges for services and sales yes there we are  seeing a downturn in other Revenue particularly   we look at things like citation numbers and other  way Sobe we can expect that to maybe rise a little   bit as we concentrate on citations and things  depending on how we impro approach enforcement   absolutely yes so um what we what we've been  talking to folks about right are there there's   two different conversations that are taking  place there's paying for that parking deferred   maintenance right the repair and maintenance  who's paying for that but then you're right   there's a parking management side of it depending  how we approach the parking management side of the   conversation yes there will be obviously an impact  to enforcement and to revenue associated with with   parking management thank you vice mayor Ballard  thank you mayor thank you Troy um I just have a   couple comments um council member hois mentioned  maybe selling some of the um parking garages I   think the only thing that makes me nervous  about that is if we sell them then the city   loses control of what they could potentially um  rent it out for or so that part makes me a little   bit nervous I understand the reasoning behind  it um I just think it's a shortterm solution   for maybe a long-term goal that we're still  looking for so sorry um also just some um over   overwhelming comments that we've heard is to keep  the enforcement local which I know you addressed   a little bit um I'm a big fan of that I also think  we need more than one um meter attendant anyway um   I can only imagine how much money we're leaving  on the table by not enforcing what we have now   um that was um a comment that we kept hearing over  and over and over in deleno that if only we could   enforce the 2hour parking that we have now so that  people don't park in front of those businesses all   day every day um whether they live there or work  there it's not fair to some of the storefronts so   um that was another comment and then um I still  think it's incredibly important that we whatever   we decide to do we still have some type of hybrid  that um allows you to feed the meter um with coins   or paper money um the QR code in the app because  that kind of addresses um something for everybody   I've had a lot of questions about um what the  parking plan would potentially mean for um Ada   if you had um a handicapped license plate or the  um window hanger and then um I also appreciate   that we have eliminated from the conversation  for at least for now the tiered parking I think   it's really overwhelming for everybody all at  once and um if we just do the flat fee of 75   cents or whatever that might look like I just  appreciate that um we removed that from the   conversation for now just so that um whatever we  decide to do can be as maybe easy as possible so   appreciate all your work on this I know it's been  really really difficult um but appreciate all that conversation thank you Troy several questions can  we start off with um I'm hearing obviously from   this bench uh the confusion so I believe that  Community might also not know all the public   garages that we actually have so eight of them  according to you are city-owned garages then there   are garages that are public private uh in some  way uh for instance yesterday I asked you these   questions um but I think that Community should  know so can you please list off the eight public   garages owned by the city of witcha maintained by  the city of WIA and then the private garages that   the community is allowed to use because it's  still public parking During certain times um   and I'll list a couple of them and you can tell  me if these are correct or wrong Carill River   Vista water walk Spaghetti Works Exchange Place  SL renew garage so those are five and I'd like   to let Community know that they can currently  use those spaces and if not um they should be   clearly marked so that Community does know that  they are public spaces so can you go over first   and for for most the parking garages public and  then the ones that are public private yeah so uh   I'll reiterate uh there are two parking structures  in Oldtown there's one next to the hotel and one   next to uh the former Cinema uh there's the three  downtown that we call the Emporia Street Garage uh   the William Street garage and the Market Street  Garage uh the Emporia Street Garage located at   121 South Emporia the William Street Garage  located at 360 East williamss and the Market   Street Garage located at 2115 South Market um  there is there is a city-owned garage along   Water Street in water walk that is a city-owned  parking garage uh there's the parking garage   here at City Hall and now we'll sort of start to  transition to those public private there's the   garage across the street from the Drury that is  owned by the city but through a lease agreement is   uh lease to the Dual Hotel uh for their operation  and maintenance um as part of that agreement   they're required to provide a certain percentage  of public parking or parking for surrounding users   um and then there are a number of to your point  public private excuse me private garages that are   required to provide some element of public parking  so you talked about the water walk garage there's   two GES at waterwalk there's the one uh adjacent  to uh The Gander Mountain now king of freight   facility but then there's a a garage associated  with the Condominiums inside the building uh that   is a private garage uh and they are required to  Ser provide a percentage of public parking at   certain times and hours um there is uh the River  Vista garage as you pointed out uh there's the   Cargill garage uh as been pointed out there's also  a garage located next uh to The Exchange Place   part of the renew Apartments it's a private garage  they're required to provide a a certain number of   public parking spaces um and there may be others  to your point but specifically I know about those   in fact there's a garage um I don't know exactly  what it's called but I think it's referred to as   the Spaghetti Works and it's really only a parking  deck behind some of those businesses back there   um that there were public dollars associated  with it that then now they have to provide a   certain element of public parking so my followup  to that will be can you please clearly show that   to communities so that they can currently utilize  those spaces I have driven by many of these   garages and the signs are this small and I don't  think people knew that these were public spaces   for instance this past Sunday we had a shooting at  River Vista garage and it was in the public deck   and the bottom is private I guess that's for for  the residents so there's a confusion for a lot of   folks that that is actually public parking so I  believe that it's prudent on us to make sure that   Community knows these are current spaces that are  for the public so I would like to direct staff to   provide opportunities to share with community that  these are truly public spaces mayor that's a good   point and that's actually part of the parking  plan is to better show um what's available to   the public and in a perfect world we'd have a  demand system that would show how many spaces   are available that's a little more sophisticated  and a little further down the road but those are   the types of things if we're managing the parking  system that we make it easy for the public to be   able to know what's available and when there are  not spaces available in the facilities as well   my follow-up question to the garages  is are they currently being managed   if so who is managing those garages  in terms of paid parking for these garages um are are you talking about the city  owned garages are you talking okay so let me go   through that list um so Oldtown the two garages in  Oldtown are available to the public as part of the Oldtown in lie of parking agreement structure  right I'll just call it that there I'm not a I   take that back in the garage associated with the  hotel there is a a specific arrangement for um   guests of the hotel if you go to the top I think  it's top two decks of that garage in the old town   there's actually a uh a control arm that if I'm  staying at the hotel I can swipe my room card   and gain access to the top two decks I think it is  in that one garage there's a specific arrangement   with the hotel for the adjoining garage but  in Oldtown that's simply managed as part of   the Oldtown in Li of parking agreements um in the  three Emporia William and Market Street garages   yes we have a number of agreements with various  businesses in the vicinity um specifically do   school is part of that um Ambassador Hotel is  part of that um I know Hilton the Hilton Hotel   there on Douglas there there's an arrangement with  Hilton so there are a key Centric uh has access   to the so there's a number of private agreements  with businesses in the in the vicinity to access   those parking garages um water walk the public  parking garage in waterwalk um waterw walk is   a little bit nuanced and uh kind of the way  that waterwalk was a lot of the development   agreements behind that but I know for example  like king of freight and others out there pay   into a similar type of parking fund um as part of  their utilization um for use of the parking garage   in waterwalk um city hall is primarily for our uh  city employees um The Drury as I mentioned uh has   been leased over to the hotel so yes there are um  users of the hotel that use that garage and they   they are also providing a certain number of spaces  for businesses with the within the area I'd have   to go back I don't have the numbers in front of  me as far as exactly who's utilizing what in that   garage um but again that's a a public garage that  they're managing and there are some contracts for   other businesses in the area to use it but um okay  and then walking through the private garages um   again you you mentioned the waterwalk condominium  garage yes there are um condominium owners who   are utilizing the private side of that garage and  then there are some public spaces that I know um   if you've attended any of the events at activities  at like visit visit witchta you can park in that   parking garage in the public parking area um they  do not charge a fee for public parking um and so   they are ultimately then like I said responsible  for the ongoing operation and maintenance um   and we're constantly in conversation with them  about kind of what that looks like uh so there's   the waterwalk garage cargo G garage same thing  Cargill that garage is closed uh to the public   during business hours um Monday through Friday  and then again on Saturday and then evenings and   weekends outside of those non- business hours it's  available to the public but during business hours   it's closed to just Cargill employees visitors Etc  um the River Vista garage as you described most of   the River Vista garage is is uh for the benefit of  their tenants I don't know whether those tenants   pay for parking or not I assume they do uh and  then to your point that there is a provision to   provide public parking there is not a charge for  public parking as part of that we don't again it's   a private garage we don't control that um what  am I missing the renew exchange and garage um we   have been in contact with those owners um they  have struggled to provide that public parking   uh that if you may recall there were some some  Tiff dollars that were used as part of that   project and there was a development agreement and  uh they went in and they installed a a number of   lifts so that they could maximize parking within  that building and within that building footprint   um as it's been told to us the new owners were  unaware of having to provide the public parking so   as they acquired the parking structure as part of  the asset uh acquisition um they sort of shut down   the operation of those lifts it's a it's a very  expensive operation um I think the number we've   been told is somewhere around $30,000 a month  to operate those lifts and and provide parking   for those lifts and so they shut it down we've  since been in contact with them and let them know   whether they operate the lifts or not they're  required to provide a certain number of public   parking spaces and so we're having conversation  with them to try to get them uh to come up with   some sort of game plan to provide that public  parking in accordance with that development   agreement um did I miss any I think that's  everything I hope that was what you were looking   for kind of okay um my next question really is  more about car park um does car park currently   have a relationship with the city of which CH of  so what type of relationship so that community   members understand what has been happening that  led up to this position um as a follow-up question   I'd like to know um a lot of individuals have  asked me um they used to come downtown they're   over the age of 50 60 and they remember seeing  a lot of meter heads all around downtown and I   wanted to know when were they removed in masses  there were still a few as recently as earlier   this year um so how much do the those meter heads  cost the ones that only allow you to put coins in   versus the new meters that you're speaking of  from car park that will allow you to use coins   bills and credit cards so can you give us a cost  so that we can understand what those costs versus   what these from car park costs and then what's the  relationship of car park to the city of which to   over the last 10 years okay there was a lot in  there so let me try to dissect that um first and   foremost uh the relationship with car park so car  park has had uh various agreements with the city   over the last several years uh I'm turning back  to uh the Agenda Report from June of 2024 where   we entered into the new amended and restated  parking agreement with the car park uh which   is the one that's sort of in effect today but if I  go back to um that report in 2010 city of which on   the car park entered into an agreement for parking  management so we've had agreements with car park   since 2010 uh in February 2016 City and car park  entered into a second contract for management of   the City Hall Parking complex three other parking  garages and various city-owned surface Lots the   2016 contract called for a one-year term and four  one-year extensions with one Amendment for an   additional year of service the inventory managed  under the 2016 contract included four garage and   four surface Lots totaling approximately 2,800  spaces in addition for garages sorry uh man I'd   have to go back to that 2016 contract and um so  again that 2016 contract was replaced in June   of this year it was that amended and restated  and so um when we so I can tell you that I know   the Oldtown garages were part of that original  agreement if I'm not mistaken you know what I I   don't want to misrepresent I need to go back that  2016 contract and tell you exactly what was part   of that 2016 cont but again that's the one that's  been replaced uh in June of this year for now the   more comprehensive All City parking garages and  All City parking lots and all on street parking   so you can see how their their scope has sort  of grown over the years as we've asked them to   operate and manage more and more facilities so  that that's the relationship with the car part   you had asked about the history so um yes the city  of witchta paid parking is nothing new to the city   of Witchita it's we've had parking meters in in  Witchita for decades right um there has been some   commentary over the last couple of weeks about  there there were a number of parking met meters   throughout the years and then over the last there  meters have been removed so we came AC cross this   is kind of one of the oldest references we can  come up with but we're still digging into this so   according to a draft staff report dated December  22nd 1998 uh we emphas we emphasize the term   draft because it appears that the staff report was  never actually presented to city council this is a   paragraph that comes right out of that draft staff  report that was um going to get presented to City   Council on December 22nd 1999 199 8 but never  did says several years ago at the request of a   Downtown parking committee a significant number of  I'm going to pause there for just a second which   is why at the beginning of my presentation earlier  I said we've been using this 15-year number right   to talk about um we know specifically back to the  2007 and 2009 Downtown parking plans but if I'm   looking at a date of 1998 we've really been having  this conversation for probably 25 plus years right   okay so several years ago at the request of  Downtown parking committee a significant number   of on street parking meters were eliminated this  action was taken with the belief that it would   increase the amount of convenient street  parking for persons doing business in the   downtown experience has shown however that this  parking was generally consumed by employees of   downtown businesses and that longterm Parkers and  long-term Parkers defeating the original purpose   of the metered removal in some cases this all day  parking has been a detriment to certain businesses   that rely on more rapid turnover of parking the  primary objective of parking meters if meters are   reinstalled all revenue from such meters would  be earmarked for Downtown parking improvements   and enforcement new technologies currently exist  to allow on street parking excuse me on Street   Parkers an opportunity to purchase parking credits  without the inconvenience of not having coins for   a parking meter so again just kind of a sampling  of we also have been in conversation with our   engineering public works department there was a  period of time several years ago where um again   a number of these meters as part of an evaluation  R and review uh number of them were inoperable   jammed not working and we're not generating the  revenue because of a lack the anticipation is   because of a lack of enforcement associated with  it right um that they were ultimately removed   because they were not generating enough Revenue  to to pay for the enforcement uh and to pay for   the ongoing maintenance of those meter heads  so periodically over the last two or three   decades meters have just continually been removed  throughout the system so would it be accurate to   say that prior to 1998 there were lots of meter  heads and then they were then removed over time   and so for now 20 plus years we've had the luxury  of thinking that there is free parking or someone   doesn't have to pay for parking even though there  were some meters here and there or parking garages   that did pay ask you to pay um and now we're  having this conversation where it's parking all   downtown whicha that would then be paid is that  an accurate timeline of Witchita Downtown parking   I I think that's a fairly reasonable  representation of it yes in fact to   your point we still have a number of those meter  heads out there today in operation in operation   in the context that if somebody walked up and  it were operable they could plug a meter um so   included uh in a presentation in the monitors in  front of you right uh there's a North downtown   illustration and a South downtown illustration  that shows in green all of the locations where   on Street meters currently exist today um those  surface Lots where we are charging for parking   arguably today and those parking garages as we  have kind of been talking through of where we   charge for the utilization and usage today and  again we can make these available uh these are   part of the slide deck so these are public these  are these are available we more than happy to   share this information the cost of meters cost of  meters um so I can tell you generally speaking I   and we have the hard numbers right I just don't  have them with me here today so um I can tell   you generally speaking uh a new meter head using  today's new technology that accepts things like   in addition to coins credit cards um or or and  connected to um um an enforcement database and   system they generally around about $600 to $800  per meter head um and then the next iteration   of a meter device is what we call a multi-bay  or multispace meter keyos those generally run   between five and $6,000 so again we run the the  math and you might see on a block face rather   than a proliferation of meter heads if I said that  there were 10 spaces along a block face and it was   going to cost six to8 th000 to put a meter head  in front of every single one of those spaces it   would be more economical to buy one kiosk that  then represents all of those spaces uh that   a user could then use to go up and uh those  kiosks also offer the ability to accept bills   uh whereas obviously the the meter head the  ability to accept bills in a meter head just   isn't generally feasible and so these kiosks offer  more payment options in addition to mobile app Etc   so but those generally run about five to $6  thousand for a multi Bay meos and those can   handle parking lots right you could put one or two  of those kiosks associated with a parking lot or   a parking structure and those can handle several  thousand individual metered spaces so to speak and   the meters that only accept coins the back in  the day meters how much are they are they even   produced uh you know honestly we're looking into  it I don't even know if anybody manufactures them   anymore um we're looking into it to see if there's  anybody that even manufactures or maintains parts   to any of this equipment um I can tell you um  my experience is that these parts and pieces are   impossible to come across so they're obsolete  thank you for those um responses I know that   you guys are still trying to figure out the exact  cost of um street parking lot parking uh garage   parking and the actual cost of each of those spots  um I think I asked that question the breakdown and   you said you were still figuring that out yeah  we're we're kind of sharpen and our pencils   that one as I responded to uh councilman hole's  question earlier going back to a 19 uh excuse me   the 2009 study the 2009 study references about  $60 per surface space and approximately $200 per   structured space again making the differentiation  between what's a an off Street Surface versus an   on Street surface uh the nuances are are just  slightly different in the context of there's   costs associated with on street parking lots  and lighting and otherwise that is not born   by on street I mean there's just a slight Nuance  but generally speaking those were $209 uh we ran   some metrics and if I had to compare those to  2024 they've basically doubled so what is that   $120 for per space per year maintenance costs  for an unstructured spot and probably $400 per   space per year for a structured space generally  speaking but again we're continuing to sharpen our   pencils on that any further questions for staff  I see none we will now open it up for public comment all right good morning um it's uh Andrew  crane hey I just wanted to uh let you know that   there is not a lot of ADA uh parking downtown  um I hopefully you guys are looking at that um   I know the access Advisory Board did uh comment  and uh we we made some recommendations for you   guys so hopefully you guys will take a look at  that and also the uh the kios needs to be voice   activated for the blind community that uh has  drivers that uh are dropping folks off in case   they need to park um and that needs to be voice  activation guys and that is uh under the the Ada   law and wanted to make sure that that gets get  gets to you guys um any questions that I can answer come on hle thank you Andrew you're welcome uh my name is Doug Ballard I live in  Riverside uh and I might be able to help you   with a reference point on on what happened uh not  that I have any credentials but I'm I'm old and   we had a uh an antique shop at 519 East Douglas  which was uh in the late 60s early 70s was the   eaten coffee shop we took over that space which  had been Nancy Castle bomb's Campaign Headquarters   and the place had been vacant for 17 years and so  we were actually in the uh the eaten hotel as you   look at there's a Archway that went over our space  but we started working on that place at 92 and um   I can't tell you I can just tell you a few pieces  which will give you an idea what what was going on   there was some movement to change the parking on  St Francis to regular parking to diagonal parking   so and I'm I'm going to say that that was about  93 so when we opened up our business actually   Sheldon Cayman came downtown and he went came  into our store and walked Walked around and we   got into a conversation which you know it's not  too hard to get in conversation with me and he   was complaining and this might tell you what  how the sequence of events he didn't want to   buy the meters because I can't remember the cost  but it was way more than he wanted to spend on   those meters to move them and and to change that  parking to diagonal because he had looked into it   and he said between buying the meters monitoring  them with a a meter made and collecting the the   money when everybody was putting in dimes it  wasn't worth it so he just he really and he was   a strong character he pushed hard and I think  that's what happened they just started taking   them out because there was hardly anything going  on downtown and yet we were trying to monitor all   that so that might give you an idea uh and I'm  going to say that we opened in late 92 and it   was pretty not very long after we opened I would  say probably about 93 that's when that started to   happen of course once it starts then um it goes  on anyway I just and I'm for uh even though I'm   not really good on my phone I'm for I would trade  expensive not expensive parking for cheap Transit   so I think you need to bring Transit alongside  in making your parking decision to supplement   that because I think when you guys were talking  about the Belmont the guys started off his speech   with which do doesn't have a parking problem it  has a walking problem so anyway all right that's all hello I'm Alan Banta longtime  res lifelong resident and a longtime   property owner downtown um first of all I want  to thank councel and staff for waiting into what   surprisingly contentious issue um I started  officing downtown in 1979 and there was abundant   meters meter enforcement as those meters went  away the economy of downtown changed there was   a impetus to try to have more free parking  to attract people to the core had the exact   opposite effect and I see it every day today you  have people that will will take the free parking   spaces that work in an office and will utilize  them all day long really hard to get retail if   you don't have turnover and we've tried at  our building at Centerpoint Centerpoint has   no dedicated parking of its own we're 90% full but  we have to coach the tenants as they come in where   they can park we give them the options we explain  you know how they should and can park now we have   the interest parking garage right across the  street from our building very well-maintained   privately owned obviously by the bank very  secure cameras a guard walks it I pay and my   staff pay $25 more a month to park there versus  the garage on Market that the city has simply   it's security and maintenance so you have to  maintain parking is not free you're going to   have to maintain a make these parking garages  secure you've got large areas of surface lot   that are very underutilized I was anecdotally I  was in Breen Ridge a couple weeks ago I went to   a concert the parking lot that is very close to  the venue was completely full but I pulled out my   phone and it showed me an adjacent lot that was a  little bit hard to access when I pulled into that   lot the parking in that lot was free so if you  have a system that can be run on the phone and   it's data driven you can hopefully move people  around and you'll learn people's parking Trends   you've got 3,000 young people that are going to  be coming downtown and the associated Economic   Development with that that's a tsunami that  we have to be ready for and you can't have all   those free parking spaces usurped by students or  and and what I'm is we redevelop our area in the   arena South you we're talking to people uh retail  entities from out of town that are wondering you   know what the opportunities are for them to have  space in the vicinity of the biomed and they want   to know what the parking plan is you know and  obviously deleno other areas you know parking   plan maybe you know it's not a silver bullet that  fits everything but there's got to be a plan and   and really as you think about young people today I  mean is this part of the plan seriously I mean it   it just can't work that way and and like Andrew  brought up our Ada situation is pathetic I I   get complaints on that routinely from visitors to  our building so I'd encourage you to move forward   the plan I think that um you know obviously not  everyone's going to be happy with it some people   are going to be very very mad about it but the  downtown owners users and people who regularly   come downtown I think will appreciate being able  to move into the 21st century and and be able to   find a place to park and pay without carrying  a sack of quarters in your pocket so thank you council member ho Heisel thank you mayor  uh just one or two quick points um I appreciate   appreciate you know when you're talking about  the younger crowd and the things that they'd   like to use and apps and whatnot um we do  have a sizable elderly crowd as well who   we have to look out for as well and they are  less um likely to download apps less likely   to have a smartphone or use a smartphone in  the ways that uh many of us other people not   me I mean personally I'm like a 80y old and a  41y old body because I don't like to download   anything extra as well but um so it is trying  to find the correct balance between what works   for certain demographics and we certainly  um when the um the app started up around   Century 2 uh we got a considerable amount of  um push back in emails because again elderly   people coming in they don't necessarily want  to download an app or have the capability of   doing it so it's just it's difficult to find the  the balance to make sure that everybody has the   opportunity to access parking in wichon  so again I appreciate you coming up and speaking uh Twilight Purity um where do I live  Polo Club Polo Club in East wiah so to tack on   to what council member hoisel was saying there's  another demographic that I don't want you to   lose sight of and that's the the poor they may  not have cell phones or they may not have bank   accounts or credit cards so again that kind  of goes with other demographics to consider   I have u in my typical neurode Divergent mind  I've got all sorts of disparate agreements or   comments here one of them is car park and the city  parking lot I understand that car park is running   that parking lot and it's been frustrating for me  and one of the more recent frustrations is as more   people come to meetings you can the uh meter will  let you come in but there's no parking places and   I don't know if you're even if the city is getting  that feedback look you're filling up with folks   there's no place to park and um then either folks  are circling or one time I had to go over to the   meter and I couldn't go back and forth I just  hoped I didn't get a ticket but so there could   be some issues with car park operations that  you may not be aware of um when I think of car   park and this big agreement um where was an not  looking for an answer but were rfps sent out to   other parking organizations if you're going to do  a whole revamp then maybe other folks should be   considered and another thing so the agreement came  in June and you all signed it now there's been so   much amazing conversation around it this isn't  directed my next comment well I'll just go ahead   and say it sometimes it feels like you have the  tail wagon the dog here the folks with the city   they have their projects their pet projects  I have no doubt they are looking out for the   best interest but I don't feel like you're getting  all the details you need to make really informed   decisions when you talk about maintenance first  of all question number one deferred maintenance   why the heck is it deferred um there's probably  really good reasons but I don't know if you guys   know that why is there $9 million in deferred  maintenance but what EX exactly is deferred is   this deferred maintenance going to take it from  acceptable parking to some I don't know luxury   thing I mean what's in those details um so there's  that great question then on um maintenance per   space per year council member hoisel you asked  some really great pointed questions that got   to the heart of that but one thing that came up  when it cost about $60 per space on the surface   for maintenance $60 a year per space what's  included in that is that are you including   street sweeping and where that would be done  anyway you the devil is always in the details   the other revenues question from council  member Johnston great catch so postco you're   only collecting 25% of preco maybe it's time  you know we've seen that there are uh problems   with enforcing contracts or maybe invoicing  contracts is that part of it on the other revenues and why is there a lack of enforcement  now um so to finish up here you know the details   the devils in the details the overall success  of anything is in the details um the contract I   haven't had a chance to look at it yet because  my guess is perhaps it's going to be revised   but there's real concerns about what's going to  happen with parking prices when you turn it over   to someone else are you going to have control or  some sort of transparency with that at some levels   are they going to have to come to the council  and say hey get approval you know what are the   built-in annual increases and I think that wraps  up my just desparate comments thank you for your time vice mayor Ballard thank you mayor um Bob or   Troy if there were any increases in pricing  through car park would that come through US yes thank you uh city manager one uh comment regarding  the last uh speaker is there any way you can   help us find um information regarding um the  specific uh not only the specific contract to   the June one but I think Troy was trying to  tell us the car park agreement was back in   2010 the original one can we look at that also  sure those are all public documents 2010 I think   2016 if I remember right and then is that  right 2016 and then the most recent one yes we'll continue with public comment hi uh thank you for having me uh I'm Jack  Anderson uh I live a little south of College Hill   I'm also a graduate student at witcha State  University so my financial situation is not   great um so I wanted to I heard wit State students  brought UPS brought up in the parking plan um   there was mention about the dean possibly saying  that we were willing to pay for more parking I'm   not sure if that's necessarily the case we already  pay upwards of $150 for oncampus parking um so I   wonder within the parking CL plan if there's  if there could possibly be an agreement um   to for student discounted parking um you know we  contribute to the local economy downtown we plan   bands play at Barley corns and Nortons we  make pilgrimages to picassos eat the pizza   there uh we study at milk float Etc so uh uh  I would urge you to take into consideration   the students who uh go downtown and contribute to  the economy uh down there so thank you very much yes my name is harlon basam I live at 5514 South  Santa Fe uh I've talked on this subject before   uh it was the management of the City Hall  Parking Garage uh or parking lot uh today   when I came in it took me 20 minutes to find  a parking spot while I was there I counted   30 or 43 vehicles that were city or county  vehicles they could be parked somewhere else   as I've suggested before they could be parked  at rounds and Porter the other issue is there   were 89 empty spots inside the parking lot  uh or the parking garage where those City   Vehicles could have been parked at that would  have freed up a lot of parking for the general   public to be able to come to this meeting or  to do other business within the city rather   than trying to have to find on street parking  two or three blocks away away and try to walk   here or just not come to any meetings at all  and just another quick comment about the W Shu   student the uh uh comment was that the students  are willing to pay no they are required to pay   if they want to park on campus it's not a  choice thank you youall have a great day hi my name is Nicholas Lightner Goddard um I  work at 125 North St Francis at Norton buring   company um first off I just wanted to thank um  you guys that came to the town hall meeting uh   a week or two ago um I thought that was  very productive um and we were happy to   offer a venue where we could have a dialogue  um I saw that um after the August 13 18th uh   city council meeting that they had added some  dates to talk about um the parking plan and   there was there was notes on there that they um  the public wouldn't be allowed to ask questions   um so uh Dan and I both thought it was imperative  that we offer a uh a scenario where we can really   kind of have a dialogue with um a lot of people  at once rather than kind of um individually go   and and having these these talks um that not  everybody gets a chance to hear or listen to   too um during that meeting uh we did uh we there  was a couple things on my list of talking points   that we didn't quite get to um and so I came here  today with those but um we've addressed most of   those today um so I'm just kind of echoing echoing  some some sentiments that have already been um   uh stated today um I do like I heard that we're  doing something different with the deleno district   um when I was canvasing around the districts and  talking to small business owners um I thought it   was strange for Delo to be lumped in um with the  other two districts in this plan um just because   it is a much different kind of District it's a  lot more um kind of mom and pop shops and consumer   facing um businesses um and there's not a lot of  City parking there available to to my knowledge it   seems like it's just those the on street parking  going down the street there is all that the city   has um something else I thought was interesting  about Delano's parking situation was that in 2019   um the city owned that parking lot adjacent  in between the Monarch and the stadium and   they sold it for a dollar an acre to the company  that um owns the the witcha wind Surge and then   earlier this year in May that company sold it to  uh another holding company that's based out of   Delaware um that was formed the day before the  sale for $2.2 million um so I I'm just kind of   just kind of curious what the logic is with that  I know we were talking about they sold uh that   school building or that plot of land or whatever  for a dollar um and it made sense because it was   something that was already paid for but this was  a uh you know a city- held property that went to   a private company that went to another private  company and it's like well um if half of that   parking lot was worth $2.2 million um that seems  like something maybe the city should have thought   about before they sold it to a private company for  a dollar um otherwise my big uh my real big issue   I guess is with the car park um I think that  uh I think that sending $12 million over the   course of six years to Boise Idaho is um maybe  something we should reconsider um I understand   that you know there is you know that $2.1 million  a year that um about a half a million of that is   for the equipment itself and the other 1.2 or so  million is going to management and enforcement   fees um I think that it would be better to leave  wiah money in wiah um I think I have faith in the   people in wit to be able to um to make something  like that work um and like uh city manager Robert   Leighton was saying just a moment ago um or  I'm sorry it was Troy Anderson saying it that   uh you know he was comparing you know what we  would it would cost on a yearly basis to uh for   us to be able to do that and it sounds like you  know about a half a million bucks um is a lot   better than sending you know that $1.2 million  in management and enforcement to Idaho um I'm   also curious what enforcement will look like  um with this kind of digitized you know with   the app and the card and stuff it's not going to  be I mean I'm I'm curious to see what uh like the   meter made kind of situation would be like as as  far as you know are we are we just paying on the   card are we prepaying are we pre-loading um will  there be I mean is it are there going to be late   fees on it because you know it's like you you  pre-authorize your card and then you know you're   there for three hours and then you leave and it  just charges you that three hours of time um or   is it going to be you know the the meter tickets  and the you know little red expired thing and like   that so okay thank you very much for your time  thank you again for coming to anoint the other day city manager may I ask that question regarding   um the selling of that parking lot  this was prior to me being on this Council trying to think how to give a brief  response it's the prop that was the original   development agreement for the baseball stadium  in order to get a team to Witchita it was not   just the construction of the stadium but it  was also uh for Associated development around   the ballpark and actually that was to be the  public payback and not just to have a baseball   team but also to have tax base generated uh from  the property the city owned and wasn't producing   any Revenue around the stadium um so that was the  deal that was struck with the baseball team as we   moved forward with the development agreement  for the associated development uh we ran into   difficulty with the owners of the baseball team  their inability to develop and then potential for   litigation between the city and the developer  in order to get the project moving forward   uh we finally got into a settlement where  much of the land was returned to the city   and then we uh the city moved forward with another  developer however as part of that settlement a few   of the parcels remained with the team for their  development um either for the sale of the property   for development or the development by them alone  the parking lot that was being reference was part   of that settlement and that remained with the  team who then sold the property for redevelopment and that is anticipated at this point to  be a mixed juice development uh that land   that's located uh adjacent to the Monarch  that he referenced and that lot currently   is public parking for individuals or not  public parking individual uh yes right   now it's available for parking it's not  part of our system but it's available for parking we'll continue with public comments good morning my name is Heather Schroeder and  I'm the executive director of downtown Witchita   I haven't had uh the pleasure of meeting all of  you individually but I look forward to that and   I want to reiterate everyone's gratitude for your  work on this issue um councelor hoisel something   that you said really resonated with me you said  that density is not a concern now in downtown   I respectfully disagree downtown uh downtown's  growth Redevelopment and infi development is   what drew me to this work in Witchita uh it's  working it's multiplying and uh we see the effect   of that daily in our in our work downtown um to  to quote from our uh our statistics at downtown   Wichita since 2010 we've seen 1.7 billion  dollar of investment we've seen over 110   properties redeveloped we've pipeline of more  than $760 million in new development including   more than 400 new housing units already announced  we have the $400 million biomed Center bringing   3,000 new unit new users to downtown including  uh not including the recent announcement of a   Suburban Pediatric Center relocating to the  site next door to biomed it's working we are   densifying our downtown and in order to deal  with that time is of the essence to accommodate   this growth with a parking management plan  currently there's a confusing lack of parking   infrastructure uh when visitors arrive to our  downtown um it's difficult to understand where   to park because there's a lack of signage as  mayor Wu noted um we as a community can do a   better job directing users to existing parking  facilities uh but one clear way to demarcate   where where users can park um is to is to build  out that infrastructure let people know uh that   they have 2 hours of parking uh let people  know what the cost of that parking will be   um through the new uh implemented system um  I just wanted to note that all of our Pure   cities in the midwest have accomplished this we  looked at the top 100 US cities 22 are located in   the midwest which has the only one that has not  yet implemented a parking management system um   and it's it's time that we um use that Revenue  to our advantage um um I encourage you to take   timely action so that when we host events such  as the US figure skating national championships   in our downtown the NCAA tournament we are  reserving parking for those who need it thank you hi there Dan with Norton Bing company um um  hope you're all having a good afternoon sorry   this thing is turning into such a Ruckus um  again I would like to thank you guys very much   for keeping this discussion open keeping um you  know new ideas flowing in um it became apparent   to us with the first two public meetings that a  lot of the questions that we had and concerns we   had didn't have answers yet and so I'm glad  we put this on pause so I thank you guys for   your hard work um I know it's not easy I'm  worn out and I you know I'm I'm nowhere near   uh the workload you guys have um I just want to  you know reiterate that um we did come downtown   because of all the growth and For the Love of  the city and trying to help grow downtown it's   why we we picked our location and and things  were a certain way maybe I'm old and I'm not   akin to change uh but I know that when when Road  obstacles come in my way and present challenges   for us to run our business you know we have  to rise to the occasion um that being said I   I keep coming back to I feel like for me this  is a a budget issue um the graphic that was on   display earlier showing the um sorry I left  my phone over there um the graphic that you   had up showing the um revenue generated by the  parking lots it was missing the bottom line of   that which showed the balance um and it showed  that we were um positive in 2023 5,000 some OD   dollars if I recall something like that um so we  had we had negative uh income from the parking   lots and then last year we had a positive income  and is that the parking fund I guess that is the   parking fund that we need for maintenance so  just to pick on the arts for a second I'm all   in support of the Arts I'm in support of um of  all of that I just think that like um you know   maybe we need to look at the budget and readjust  some things to help out with the parking fund   like the art at the uh water treatment center we  had to put our dog down the other night it was   really sad um so I got to drive right by that to  the emergency vet uh the other the other evening   um we did see that art it was nice uh I don't  know who else is going to see it besides people   going to the emergency vet or people that work  at the wood at the water treatment facility um   but that 128,000 that could help help out with  the parking fund like I'm just saying like look   can we look at the budget a little more is what  I'm kind of getting at see if we can move some   things around to help out with the parking fund  um and just leave us out of it would be my vote   um but I am open to hearing your ideas and I  do appreciate your hard work and diligence to   have this discussion have this discussion and  have ideas um so I appreciate you thank you we'll continue with public comment back again Bill Stout District 5  um I just have a couple of things that as   I'm sitting here listening that kind of stuck  in my mind uh council member ho Heisel I love   the idea of selling property I think sometimes  we have to be realistic about what assets are   worth and whether they serve a purpose but  I did think it was interesting that I heard   a common word three times after it was brought  up the word was control and that's a scary word   when said by government and it's ironic that  it's brought up on the same day that we have   a proclamation for constitution week so then the  other one is this I I attended one of the early   parking meeting sessions and I got to tell  you as somebody who didn't have skin in the   game just interested in what was going to be said  the one-hour meeting that was supposed to be 30   minutes of information followed by 30 minutes of  Q&A at 53 minutes of information people were tired   of sitting and listening because we had heard way  too much double talk and absolutely nothing any   anybody wanted to hear no answers and then when  questions were asked they were avoided we got   more double talk and it was insulting and that's  why everybody walked out so I'm not blaming any of   you I just want you to know why people responded  that way and last but not least and this is just   me being me I I always find it interesting when  there's a public private partnership and where   the lines are drawn and this downtown witch  organization ation it really bothers me when   you go on social media and you see their their  page and there's a whole bunch of pictures of   public employees that's really weird that makes  people uncomfortable with the government that's it any just wanted to make sure you were ready Vince  Hancock from deleno one of the groups that I   work with a lot is called deleno United I do want  to thank you guys for uh hitting the brakes as it   were on this one siiz fit-all implementation of  the parking plan in the interest of time I have   narrowed down the scope of my comments down to  just three topics one why are we even doing this   it is one of the clearly stated goals for the  parking and multimodal fund to become Revenue   neutral self- sustaining or more simply just to  increase the income to match the expenses most   of us in this room do understand the concept  of a budget this thing's been running in the   red for 15 years that's not responsible we've  been told that these are data drived decisions   but the data is being misrepresented we've been  told that current income is 227 per space per year for clarity I'm redone those calculations  into how much it costs to park in a space per   month according to the parking plan data for  the one time that it's been published the it's   deceptive because that 227 only applies to the  garages it's not accurate for the other types   of parking and as an overview public maintained  parking spaces have three cost levels as lowly   mentioned on street parking meters service  parking lots and structured parking garages   but here's the the numbers for those according  to the city's data that was published in 2019   we have 484 me meters which cost the city zero to  maintain that generate a monthly income of 30 per   space the Lots there are 3,26 spaces that cost  us $12 a month for operations and maintenance   with a monthly income of $26 per space for the  garages there are 2442 spaces at a monthly onm   cost of 40 with a monthly income of 19 anybody  can who can understand a budget can understand   where the problems are at if they get look  at the actual numbers today's staff report   sets an annual revenue goal of 00 to $200 for  all spaces treating them equally and I believe   that's a mistake we need to have smart goals each  of you know what that means that include a Target   monthly Revenue per each of those three types of  spaces on public engagement despite the mayor's   clear instructions there was only one parking  meeting hosted by the city after 5:00 p.m. how   many city council members were there you all know  that number attendees were repeatedly told that   free parking isn't free but the city's own data  shows that isn't true for on Street spaces many   neighbors have a shared view that their property  taxes primarily paid for public education Public   Safety and public streets it's also became clear  that that the three study areas had very distinct   needs and couldn't be solved with the same  Formula One presenter at the senior center   even asked or one neighbor asked the presenter  are you a capitalist or a communist deleno has   been misrepresented in this on the 30th slide  of the presentation we're told that the parking   study shows 30% 34% of parking spots were occupied  during weekdays that's by lumping the entire thing   together I have never seen a more obvious misuse  of statistics to arrived at predetermined outcome   and I took stats a long time ago the flawed  analysis for that parking Behavior watched   four times over six days when no sporting events  were occurred it was skewed by including private   restricted use parking lots which made up 62% of  the the count our city has no control of those   private Lots the city maintains no obligation to  maintain them or authorities to install parking   meters on private property to arrive at that 51%  weekday parking occupancy figure for de deleno   slide 29 showed that they had to include the  residential streets from the river to Kellogg   from senica to the river that's three4 residential  and you can imagine what's going to happen on a   residential street at 9:30 in the morning on a  weekday how many people are going to be parked   there so the truth of the matter is 98% of ours  are being used and that's what their stuff shows if we have a stated goal that regulated parking  ensures access to availability don't let the   office of Economic Development redefine parking  management as a way to shift parking cloths from   developers to drivers the deleno neighborhood  plan in 2019 has our parking strategy on page   nine the word parking is mentioned 15 times  in there let deleno manage its own parking   strategy as we get our new multimo facility  in there you guys have any questions thank you we'll continue with public comment my name is Christopher Paro I'm president  of Delo United um a number of the topics that   I wanted to come and speak today have already  been addressed by other people so I'm going to   try and focus my comments down as much as I can  to things that I think need to be elaborated on   a little bit the biggest one would be parking  enforcement would be parking enforcement um   since the stadium opened the Delena neighborhood  association has documented hundreds of examples   each year of people parking illegally around  the stadium in the side streets just to avoid   the $5 fee of parking in the gravel lot some of  these have been documented with pictures on their   Facebook page um when the neighborhood association  reached out to WPD in the city to try and get some   resolution as far as parking enforcement because  they're parking thing parking in front of things   like private driveways sidewalk access um fire  Lanes fire hydrants and private parking lots   as well or grass fields that are privately owned  the city and WPD basically said well those issues   will be addressed when we build the new parking  garage that was four years ago we still haven't   broke down on that parking garage and the issues  continue to happen to this day um with regard to   parking garages the City Hall Parking Garage is  not public it hasn't been for years when it was   first built it was sold to the public as being  expanded public parking because the surface lot   was not sufficient for the business that City Hall  was doing within a couple of years that garage   got shut down for security reasons and the public  parking went from a large lot and garage to a tiny   little postage stamp siiz lot um if Cargill  is not effectively um running their parking   garage and making it public when it needs to  be sell it to them not for a dollar but for   what it's worth make some money off the deal and  take that item off the table as far as what the   city is trying to do um I would also like to Echo  Mr Stout's comments and some of the concerns that   the mayor had that she expressed four weeks ago  when we all spoke on this um with regard to the   consent agenda and some vague and confusing  items on the agenda that's almost common if   not status quo for the city to put stuff on the  consent agenda or put it in the agenda in a way   that makes it hard for the public to understand  what's being discussed and talked about until   the day of and if it's hard for the public to  understand it how can new incoming members to   the city council and the mayor understand  it as well um as far as deleno goes who in   deleno is being spoke to it's been four weeks  we haven't been spoke to and according to the   revitalization plan deleno United is the contact  for the city nobody's reached out that is all we'll continue with public comment I see none we will bring it back to  the bench thank you to the 12 individuals   who spoke up during um the public comment this  is an opportunity that every Community member   has whenever there's an agenda item um and so  we highly encourage people to come and voice   their opinions and uh one side note city manager  can you please address uh the city vehicles that   are in the parking lot so that individuals who  would like to come to our City Council meetings   can actually have a spot mayor I made a note of of  that comment we've tried to restrict the number of   vehicles that are on in that lot for that reason  so there's availability for the public apparently   we've got maybe a few more vehicles that are on  out on that lot so we're GNA I'm talk to staff I   actually have a staff meeting tomorrow that we'll  talk about it council member Johnson thanks mayor   uh appreciate everybody coming today and all the  comments and always a presentation Troy um I think   I know the answer to this but just to bring it up  Troy um the young man who was a student um brought   up the fact that WSU students pay for parking  already is there a way with a new system that   that that person can have some form of identifier  that would allow a discounted rate or like maybe   an hour of free parking and then a discounted  rate yeah I think we're open to having that   conversation okay um other than that just some  comments again I appreciate the the conversation   um what continues to happen is more public  engagement the things that we continue to hear are   things that we can talk about like we just heard  Troy say when I asked that question as we get to a   final version of uh a plan I would uh disagree  that this was presented as a completely done   thing we were always talking to different folks  the folks who had contracts when we look at the   meters the engagement that we've been having that  was why we had those public engagement meetings   and why there's two more um I'm also happy to  to do another one but I think the point of this   that got lost was the management of parking and  we continue to hear it in different ways um the   folks who are concerned about folks being in their  front of their business all day when you need that   type of turnover to get your customer base in um  as we talk about widall loving to drive loving   to park close um what helps that is management of  the timed parking and some of the challenges that   we've talked about as far as enforcement um even  the folks who are concerned about 75 cent if you   stay past the time that you paid for you might  have a $20 parking ticket it's cheaper to do the   paid parking and have that type of parking ticket  so I'm glad that we're continuing this discussion   I do think that given all the investment that's  coming downtown and what we've already seen we   need to get out in front of this I do fear that  if at any point we tried to stop this it will be   more costly to those that we represent later um  and if that's something that those to vote for   us really want um I don't think that is the right  decision but it would be more costly at that point   Point than to have a plan now that we can adjust  as more development comes what I have learned   about the partnership um is that they know about  way more of the potential plans and investment   coming than than we do they we find out once a  lot of that stuff is finalized and we hear about   awesome projects like the biom med center people  are reaching out to them every day so they have   more of a sense of what's going to be more parking  challenges in future and where um and the reason   that it's not always public it's not every you  know plan always materializes we all hear about   stuff that folks want to build but they end up  not building but as those things come into um   reality it's better to have some plan that you can  adjust than to start from square one and hope that   you can figure it out while everything else is  being built and while you have those challenges   I think we're in a spot like that now um with  everything coming and hopefully know multimotor   will help with some of that hopefully some of the  garages we've talked about will help with some   that but I think we're in a good space to continue  working through with the plan as we've been   talking to business owners and as we will continue  to do so um but I feel that if we were to Halt at   this point and not proceed and not modernize our  parking and not have machines that can use an app   and change or a kiosk that can take cash as well  we'll find oursel in a a worse off situation and   as we talked about earlier enforcement and keeping  that um within the city I'm always supportive of   having city employees um do that work it's  probably my favorite method but my concern   is as we also talk about deficits going forward  what's going to be the priority of council is it   going to be making sure that we have enough people  to enforce parking or is it going to be the other   things that we've been talking about this year um  I personally don't think parking will rise to that   occasion and so the contract that we currently  have with car park this is a company that's going   to ensure that they do enforcement management and  it's not something that you know we're going to   look at do we feel these positions or these other  ones that part will be taken care of so those are   my thoughts on it just wanted to share that as we  continue on with this discussion council member   Tuttle thank you um just just a few comments  since council member Johnson still most of mine   you got my notes again this morning um thank you  Troy for all of your work on this I know you have   many many things in your job jar and this has been  something that I'm sure has been quite timely in   your schedule lately much appreciated also thank  you to our Communications team I know that they've   been essential in um planning the the community  Gatherings that we've had and just making sure   that information gets out and people have an  opportunity to be heard and thank you to all   the community members the 12 that came here today  the community members Who provided feedback at the   Gatherings that we had but also for the last five  years since we've been gathering information from   our community to develop develop a a parking plan  I know it's been to our district advisory boards   we had open houses we've done social media so  thank you to everyone over really five years who   have been involved in this project um during the  last couple weeks since the August 13th meeting   I've had um individual meetings with several folks  and I started every meeting with them by saying   one thing we all have to agree that something  has to happen something absolutely has to happen   we're taking being an opportunity to pause but as  council member Johnson said I don't think we can   stop we have gathered more information we've heard  more thoughts but I do believe that we need to   maintain our current parking and further enhance  the the parking that we have for the livability   of our downtown we have so much time and energy  invested in our downtown and this to me just seems   like the next phase um as Heather mentioned and  Heather welcome to witch glad that you're here um   we have to to compete with other communities and  if we want to stay competitive we have to have   a parking management system in place I had the  opportunity to um step out of town for a little   bit this weekend and I went to three different  communities every one of them were smaller than   the city of witcha but every one of them had a  modernized parking plan in their downtown one   of them the town was less than 1500 people and it  really resonated with me that this is something   that which needs to be able to do as I mentioned  to stay relevant and and to stay Forward Thinking   um the biomed Setter has been mentioned many  times I mentioned it during the August 13th   meeting we have to be prepared for growth and  progress in our downtown I've been thinking a   lot about the long-term success of Witchita and  what's happened and I always go back to the city   of Witchita Mission and our mission is to be  an exceptionally well-run City and we have four   pillars and all four of the pillars of our mission  align with a parking plan is to keep witw safe we   need to make sure that our parking lots and our  parking structures are safe and well-maintained   to grow our economy as our downtown grows we need  to make sure that our patrons that are employees   that our visitors to our community have the  opportunity to come downtown and help it Thrive   building and maintaining Dependable infrastructure  that's a given and then also providing conditions   for living well as we have have more amenities  downtown in our core that bring people to our   core but also bring people to our city they need  to be able to have a place that they can park   and be able to get to and from safely and easily  one last thought again as I've been reflecting on   this a lot and talking to many people modernizing  our parking system to me seems like what we need   to do to move forward and I was thinking about  the other departments within our city and Troy   made reference to a parking plan that was 1998  I think you said correct we don't make water the   way we made water in 1998 we don't check out  books and materials in our libraries the way   we did a decade ago if you've been to the opport  had the opportunity to go to our airport we have   a modernized system every Department I could  go through and I could mention the progress   that we've made and the modernization that we've  done and so I think having a parking plan with   that goal in mind is something that I'm going  to continue to push for again I appreciate the   opportunity that we've paused but I am going to  really emphasize the that we don't stop thank you I see no further comments from the bench at  this time uh we will vote on just receiving and   filing this information with the intention that  staff will return with within 30 to 60 days to   provide options for the council to consider in  addition to I heard that there are going to be   more uh Community meetings and I will Challenge  and ask that we have at least one more evening   time meeting as um it would be beneficial for our  community members to also attend I know that the   one at Norton's was well attended because it was  an evening meeting um I would also uh consider   uh we do have our last evening city  council meeting uh this was something   that was passed by this Council to have  four evening time Council meetings the   next one that is the last evening meeting is  November 19th would that give enough time for   staff to prepare some options continue  doing followup with um business owners   um and do at least two more Community meet  meetings if not more um regarding parking options I see a head knot  from city manager Leighton   so I will move to file uh to receive and file this information second Motion in a second any further  discussion I see none Madame clerk please open the rooll motion passes 70   Madame clerk please call the next item  replace Council policy 39 with ethics ordinance morning mayor and Council Kathy  seon with wiah State University's public   policy management center to not talk about  parking um uh thank you for having me here   it's been a year or so since I've been before  you and um we have more updates to your ethics   uh policy last year when we were here here we  made some updates and you all uh asked hey come   back again and change it into an ordinance so  that's what we have been working on this past   year uh combining and and uh making sure it's  clear the old ordinance that's on your books   from 2008 that now will jive with the policy 39  becoming an ordinance here and not having any   more conflict or concerns between those two so you  all know that uh this policy's been in effect that   you currently have a code of ethics for 3  years 2021 you hired us the end of 2022 to   help enforce interpret act as the ethics officer  advise people as everybody transitions everybody   being not only you all but all the boards that  you have all the volunteer board members on   many City boards all have concerns and are are  affected by this code as well as City staff so   it's been our pleasure to do that and we've  learned a lot of things as we've gone along   what you have in front of you on page 103 and  10 uh page 103 of your packet there is the first   updates that we suggest in addition to converting  the code that is currently in a policy to an   ordinance we have a few substantive uh changes to  recommend one is the definition of a gift what we   found is that the policy as written was just wordy  and it had a lot of words around defining gift on   several different pages and different parts so we  simplified fight it for clarity and to understand   that a gift is anything that's accepted if it  doesn't matter what it is if it's given and   accepted then it's a gift and um that of course  does not include campaign contributions as you   all know you are subject to other laws regarding  campaign contributions and they are not affected   by this ethics policy at all but what Remains the  Same in the current policy and in the proposed   ordinance is that it would prohibit ibit uh City  officials from taking from accepting a gift that   is $150 thou $150 valued or more than that  and just simply require that if if you accept   something that's worth $50 or more that it would  be reported on the year-end report that that does   not change so we did not fiddle with those numbers  at all mostly just clarify the definitions to make   it easier for people to understand um and you'll  note that on the ordinance in your packet we   did do some yellow highlights to follow along  here today so it's easy to see where where the   substantive changes are recommended we do have in  sections K and L that the in the policy statements   that simply a new thing would require the city  officials take reasonable steps to inform their   relatives of the policy um the requirements for  the ethics code so in other words there are things   in this policy now and in the ordinance that you  would adopt adopt today that effect whether your   spouse or your relatives as defined in the policy  can accept gifts and as you know that's it would   be a workaround for someone so you thought of  that when you wrote the policy but what isn't   in there is the obligation for the city official  to inform their relatives of this of this uh need   so we wrote that in so that is a substantive  recommendation that we're making today also the   another thing we added is the ability for the  city council to vote to approve a gift that's not   otherwise addressed in the policy so for example  if if one of you were going to travel somewhere   on somebody else's dime you think oh that's good  because the city taxpayers aren't paying for this   but then it raises the ethical thought of well  is that good who who is who's paying for this and   what's the deal there so if it's not addressed in  the policy clearly then you all always have that   opportunity to bring to City Council for a vote at  a regular public meeting that you all would talk   about and you you pretty much have that Tradition  now at the end of every meeting even though it's   not on the agenda it's that blanket set thing that  says a council member can bring something up so as   long as your peers approve it then it is um okay  with the policy and some of you have called me in   the past and said does this fall under this policy  and you know the policy is not going to cover   everything so that's why we put this new phrase  in the ordinance that we're recommending today to   make it clear that it may not something may come  up that is not in words addressed in the policy so   this gives you the ability to deal with that at  the time um another recommendation we're making   um is that you remove you change the name of your  board you named it uh when it started three years   ago as the ethics Advisory Board and most of your  city boards are advisory a few are decisionmaking   and uh quasi judicial and certainly this board  falls under that we found some confusion um as   we adjudicated some seven com uh cases over the  past year and a half as you can imagine anybody   who complains about something like this there's  going to be a winner and a loser it's kind of   like a football game somebody's got to lose right  so in any case that we that the board adjudicates   somebody's not going to be happy so we did have  a couple times come up people say well we don't   like the decision the ethics board made so who  do we appeal it to and so we had to explain well   we're really not an Advisory board we're really  a decision-making board this the buck does stop   there with the board so you set up the board  and empowered them to make the decisions based   on public complaints and based on the code so  removing the advisory name is just a way of   saying it's not advisory it's we're going to name  it what we really meant for it to be which was a   way to take away from city council and City staff  these sensitive decisions about very important   ethical issues issues and and put that power with  that board so we're just recommending you call   it the ethics board we also have a recommendation  that it's really kind of technical but to say that   the background check for new members appointed  to the ethics board would be actually completed   and the old language the current language in  your policy says that a person would submit   to a background check you know I'm sure it seemed  like the right words at the time I didn't catch it   before but as we use it over time we realized  well yeah submitting to it doesn't mean it's   actually completed and passed through so we just  rewarded that a bit public censure is another area   included in the current ethics code um that  is a little vague and that question came up   as well so currently public censure is available  if a person does not pay the fine that the ethics   board said they should pay well you know a lot of  times the cases are not going to be a fine it's   also it's going to be like an education hey you  didn't understand what you were doing but go take   this ethics class or that kind of thing well the  question came up well what if they don't take that   ethics class well good question the policy didn't  really say so now what we're recommending is that   if um whatever you know the board says you need  to take a class you need to pay a fine whatever   it is if you don't do that then you're subject to  a public censure and then the current the proposed   policy also says what is a public censur or who  I mean we didn't even know who who does that and   so my understanding is there is no provision  that city council is able to make a public   censor there's no definition of public censor in  current city codes so what we're suggesting here   is that the ethics board be required to be the  one deciding if a public censor is warranted if   a person does not pay their fine or undergo the  training and education that they were um told   they needed to and the way the board would do  that once they decide on it in the meeting that   then would come here either a member of the board  or myself acting as their representative would   then at this Podium come to you at a regular city  council meeting and present that and that would   be the public nature of the censure instead of  just doing it at the public ethics board meeting   and putting it on the website which is what we  do now and if if um no one's aware if you just   go to wichita.gov from the homepage you just  click on boards and commissions you go right   to the ethics e for ethics it's all in Alpha order  and the web page for the ethics board is pretty   robust and if you just curse her down you can see  all the complaints that have been filed with the   uh timelines and the report and just a link to  the report and the reports you know speak for   themselves explaining the nature of each case and  how it was uh determined so that's public but we   felt like okay if the council said public censure  you wanted more than that so we thought best is   is to uh put that to a city council meeting and  I do want to thank council members um some of you   met with me individually a couple months ago  as we were working through the drafts of this   and some of you had some really good feedback  and you can see now today that a couple things   have changed based on your feedback and and I do  appreciate your help as we worked through all the   nuances of this uh project so in summary this uh  recommendation you have before you will enhance   the clarity of uh what you have now on the books  as a code of ethics in a policy getting rid of the   policy makes it an ordinance but also you have  the old 2008 ordinance getting rid of that and   putting it all into one ordinance so there's less  confusion interpreting the policy and certainly   more transparency so um request your approval and  am available for questions questions for Cathy   beginning with council member ho Heisel thank you  mayor um and I don't know that this is necessarily   for Kathy um I'm just curious about the changes  to the appointment process do we submit the   appointments to Jamie early on and then they go  through the criminal background check and then we   appoint From the Bench or do we appoint from the  bench and then eventually uh second appointment   or you hit the nail on the head what we recommend  is that when you feel like you and when you have   a vacancy will let you know either either Maddie  or Jamie or myself one of us will let you know hey   so and so has or or maybe your appointee will tell  you they're resigning but as soon as you know you   have an appointment if you think of someone you  want to appoint our recommendation is you bring   that to staff you bring it to Jamie or bring it to  Maddie Maddie Campbell's the staff person on this   they will start the background check and do that  all and and there's also like documents for them   to fill out because sometimes when you want to  appoint somebody um the staff needs to make sure   that that person has read the ethics ordinance  and understands the requirements for this board   it's they're different from your other boards  and so we want to make sure they understand all   those before you make an appointment in public  because of course you or no one would want to   embarrass someone when they realize oh I don't  qualify because of number seven or what have you   um and they just weren't aware of those so yes  if you would make your appointments um desires   known to the staff then they'll get the paperwork  to the person and get the background check going   and then come back to you and say hey this person  actually decided they don't want to do this or   hey the background check is cleared whatever and  then you would make the appointment in the public   meeting okay thank you council member Glasco  thank you mayor and thank you Kathy um this is   I think a good example of thoughtful process and  crafting policy and doing it right as well um I   have a quick question so it is Page n it's item F5  says that ensure that City staff should provide a   copy complete of the code of ethics prior to the  newly elected council member taking office or in   the case of Advisory board members within 30  days of the member's appointment it looks like   based on the notations that this should already be  implemented I don't necessar remember I reviewed   the ethics policy and was familiar with it but I  don't remember receiving it as a document prior   to taking office um I also am not aware that any  of my Advisory board members have received within   30 days appointment I know they can sign up for a  training but I don't think they actually receive   a physical document so I don't know if that  comes from you all or legal or somewhere else   I just want to make sure that's being enforced  because that looks like it's already in policy   that now will transition to the ordinance we'll  check and make sure that it is but you're right   when we say copy we're not talking about paper so  my understanding is there's emails that go out to   all new board appointees and they're told hey this  policy applies to you and if you follow this link   you can see the copy which is on that web page I  referenced and then also that you are required to   do the training which is watch the video and the  and the PowerPoint so that that would suffice for   we think we're doing it but we'll make sure okay  I'm confident in uh Jamie and sending out those   emails so thank you for that um I do have one  maybe suggestion uh so I'm on the website right   now um it's ethics advisory or pyen advisory.  board um so it lists the name the date file   the complaintant the review the investigation the  appeals and the penalty there it says complaintant   and it has the list of the individual's name of  who made the complaint but it doesn't have who the   complaint is against and so just from Quick Glance  it looks like the complaintant is the person that   the violation is actually hit it actually doesn't  list the person that the violation was toward   so I would just ask maybe a recommendation  that we add maybe another like complaintant   and I don't know what the other word would  be right now but another title that actually   lists who the complaintant lodged the complaint  against okay let me look into that thank you for that thank you for the presentation Kathy  I have several questions um of these seven   complaints which are online um I see two  receive penalties so does that mean that   two were substantiated and in those cases  can you tell me about those two cases yes on the uh website in that table and and I hope  I'm sure you appreciate that some of these are   very lengthy and complex but they do all link to  a report that explains what was alleged what the   party complained against you know alleged in their  defense and then what the uh investigation yielded   in terms of facts and then the report of the board  and and their decision so yes the um the two were   that actually two different people pretty much  filed about one issue that was uh ruled um here   let me find that here yeah that was the May 11th  report from the ethics board and that was when a   couple different people um alleged that mayor  Brendan Whipple attempted to use the power and   Prestige of his office to seek favor for private  gain on September 24th 2022 when he attempted to   prevent a police officer from carrying out his  duties at a neighborhood cleanup event and again   this is four pages long so I'm highly summarizing  um but there were a couple different sections of   the code that were alleged but the finding was  that the mayor used his office to seek favor and   private gain by the manner in which he sought to  dump his trash instead of waiting in line he also   used unique direct access to the city manager  when he called him during an encounter with a   police officer on a Saturday to make a complaint  about the officer so in in essence that is the   issue two different people complained about the  same event so it was that one event does that   make sense does so when it says penalty what was  the penalty is that in the actual report then yes   yes I'm sorry it it is the um it is in the report  and it was the um to to take ethics training to   understand I think a lot of times we try to write  these reports to where it walks people through   and helps them understand what was wrong or what  should have been done differently so certainly   that but then yes taking the training and doing  some effort making an effort to brush up on the   ethics was the what the EAB recommended at that  time thank you uh then my question I have council   member on on the board so I'll ask my question  after council member Glascock just have a quick   question I was again reviewing the website thank  you our staff our website's great visit it wi.gov   um a couple of the reports have to do so there's  a couple that could be replicated you know in the   future so one of them had to do with a previous  council member blocking an individual on Facebook   um because of comments the ethics board ruled that  it was um allowed and so does that set precedent   from this board or is it each individual account  is taken its own report not saying rightly or   wrongly if I agree with the decision of the ethics  board but is each account taken individually or is   precedent established when a decision is made by  the ethics Advisory Board regardless of what the   case the Cil yeah it's a great question um and  I would say that one of the best things about   this whole process is that you as a city as an  organization whether it be electeds appointed   and staff everybody learns right and so we really  try to write the reports to where it goes through   and walks through a lot of the issues and  sometimes um I think when staff and and all   you all probably read these reports when I send  them to you um you can learn from these things   and so sometimes there are very specific like the  one you're noting there were Supreme Court rulings   and case law and it was really more of a Judicial  issue than it was a judgment call um oftentimes   they're judgment calls but um but we also try to  go by the words of the document and and sometimes   people feel like a wrong has been done and they  don't really feel like they have any other way to   complain rather than this and so sometimes you  all have to as an organization just read those   reports and decide hey should we update a policy  hey should we update a procedure should we train   staff differently or do something differently  so I think that's part of the organizational   learning I hope that's helpful ype that's a  great answer thank you K Kathy I have another   question more specific uh to page number five l  um you mentioned any gift not authorized by the   subsection may be authorized by the city council  by majority vote in a meeting of the city council   so as you can see even in our agenda today we have  travel that is coming up um by council members and   myself and would that suffice for that or does it  need to be a new agenda item um for instance I did   receive an award uh to go to Seattle to accept a  national award for Asian-American women so would   that situation suffice because I did put it in  the council member travel uh section does that   suffice and then my followup then is do I have to  put that on the spread sheet or does it suffice   that it already came on the bench yeah great  questions and and yes uh it's not enough to just   tell the council hey I'm doing this there has to  be a vote so your peers have to vote and say yes   yes we agree that this is an ethical this  is okay and then once that's done no that   does not need to be on the year end report thank  you for that clarification any further questions   for Kathy I see none thank you again for the  presentation we will open it up for public comment I promise this the last time I'm coming  up here at least today Bill Stout District 5 the   reason I'm up here most of you probably know if  you look at that website my name is listed twice I   filed one complaint I was actually the very first  person person to file one and they decided to   break it into two complaints which I still think  was absurd but that's neither here nor there uh   I I want to tell you about and there's not enough  time in five minutes for me to tell you what you   put citizens through with this policy and I hope  you fix it because what I went through is absurd   and if any of you want to discuss it I'll sit down  with you individually and tell you the whole thing   you it it'll blow your mind but let me Begin by  telling you it's far too complicated it requires   me to come to City Hall on my time pay to park and  swear a notary to my complaint then the so-called   ethics board you know and dton referenced this  ignored a Supreme Court ruling they figured they   could just decide against the law didn't matter  my personal information was disseminated to   third Parties by the city of Witchita without my  consent that's a violation of the Privacy Act in 1974 the entire process was a sham   I've communicated with Kathy multiple times  about all the problems then I was attacked   on social media by city employees repeatedly  for months including the former mayor and then   I was attacked by the media in print it it was  absolutely ludicrous it got to the point I almost   had to disconnect my phone because I was getting  so many calls after the city published my phone number I hope this ordinance you're putting in  place I hope I truly hope you remember that every   American has a First Amendment right to redress  their government for grievance it's not supposed   to be we the people versus the government and it  also is not supposed to be an opportunity for the   government to attack citizens but that's what it's  been utilized for Kathy mentioned seven cases two   findings in favor and they were both on the same  case they just happened to be two different people   and she left out something the former mayor  threatened a police officer threatened his job   it's on film on a phone call but nobody cared yeah  it it's just ridiculous and like I said I there's   not enough time for me to tell you everything  I went through I would love to sit down with   any one of you and explain it because I really  genuinely believe there is an opportunity here   to do something good but we have to know what  we've done poorly so we can correct it that's all I will ask one question of Kathy H sorry pH  numbers of individuals who are complainants are   they released and if so is that customary I wrote  that down when Bill said that because I I don't   recall that but I don't think we put those out  there but Jamie am I missing something because   I don't think we put in the table on the website  the actual complaint we just put the report do we   put the complaint on there we'll look into it  because I agree we don't need phone numbers on   the website but but let me take a look at that  thank you we will continue with public comment Twilight Purity um Polo Club weird enjoyment  in Reading contracts so I read the um ethics   um ordinance here and just a little background  I've read contracts for uh as part of my job   for 35 years so it's a weird hobby of mine um  that seven cases have been adjudicated keep in   mind my comments are just about to make this  as tight as possible because every contract   what you want to do is not leave anything open  for interpretation make it as tight as possible   to avoid litigation and I'm particularly lit uh  interested in litigation particularly at the city   level because there's hasn't been transparency  on what it's cost um taxpayers in litigation and   settling suits and the version I worked from was  I I hope it's the most current version um so I'll   just go through some of these I sent it to council  member Johnson but it was really late last night   he probably hasn't had a chance to go over it and  I'm happy to send my annotated PDF to other folks   um there was a typo on page three under patronage  influence is mistyped um let's see file a yearly   report so now I'm on page five J is that report  mandatory like will every one of you get the form   or everybody on the board get the form and you  have to file it whether there's anything on it   or not what's the consequence if the forb isn't  filed um coming down ethics board page seven now   the ethics board membership is just two years  without an opportunity to renew so maybe you   want the opportunity to do uh two near two-year  renewals when it comes to the ethics officer   it's documented in there it's a two-year term  with an option for one renewal the other thing   that's missing from here is kind of what that date  is I don't know if you'd want to put it in the   ordinance but what I was on the citizens review  board everybody's term kind of came up on the   same day so it made it cleaner documenting that  date might be helpful and tighten up the agreement   um number four on page eight may not be elected  or appointed member of any local state government   nor be an active member of a of a political party  so when there's things like that aren't defined   what's an active member of a political party is  it because I stuff envelopes for a candidate am I   active and then no longer able then to qualify for  the board the fear here is if that's used against   me because I stuffed envelopes but not against  somebody else who maybe knocked on doors then   you get into the opportunity of treating people  differently and that there could be lawsuits   related to that um number eight on the same page  number eight just not really about the contract so   much but be representative of the demographics  of the city a lot of the boards I see are just   old white people not that they don't have a lot  to contribute but there are our city is a little   more diverse than that and I fall into that term  that category old white people that's me uh ensure   periodic training so what's Peri periodic is it  going to be annual is it going to be quarterly   every five years every 10 years if you don't  Define it then you can't measure it for compliance um see I'm scrolling scrolling Education and  Training I'm down to page 12 I'm just hitting   the higher but the higher level ones page  12 6B required education training intended   to prevent future violation who pays for  that typically that would be defined in the contract okay and that's that's most  of it but just My overall point is um   there's a benefit to tightening it up  and also our meals part of something   you would receive breakfast lunch dinner  um if it's anything then maybe you could   say meals aren't included just to  give further Clarity thanks for your time council member Glascock thank you I just um  want to address one thing um that twia had said   regarding active member of a political party there  is a definition listed it means an individual   who's being paid to work for a political party or  campaign or they're currently serving serving as   a present Committee Member or currently serving  in County state or national party leadership so   I think that's a pretty clear definition where  stuffing envelopes wouldn't apply unless you're   stu in envelopes as chair of either any party um  so I feel comfortable with that language regarding   political party because I had a concern about that  um I do have a question for Kathy real fast as a   continuation of that there's a um regarding  the fine it says that it can't be paid by the   individual or can't be paid by the city coffers  both great things however it also it I think it   leaves the door open for somebody to pay it by  their Campaign which I don't necessarily feel   comfortable I don't know if we're able to restrict  that that their campaign can also not pay for that   needs to come from the individual I don't know  if we're allowed to legally that might be more   of a legal question um but I would feel more  comfortable if it was paid for the individual   rather than campaign I don't know if we're  able to restrict that more a g question I guess I'm trying to find the right specific  go ahead council member I don't know   that we could restrict that  but I'll look into it thank you we'll continue with public comment I see none we'll  bring it back to the bench would anyone like to speak regarding this ordinance council member Glascock thank you um  I'm supportive of turning this from a policy   at ordinance I think um as the policy said  uh ethics is one of the primary functions   of local government you have to entrust who's  serving at this bench and serving on all boards   and committee so I'm very very supportive  of strengthening this um uh to Mr uh St   comments um I do support uh the individual having  to make this in writing uh doing it under oath and   notorized um I believe that if an individual is  um accusing somebody uh that serves on one of our   boards or somebody from this bench they should  also put their name behind it but I do think we   should protect your private information and I  know that Cathy's Express will look into that   so thank you for uh bringing that up um again my  only addition that I would like to make and we   don't have to do it today I think we passed the  ordinance as is and then if legal gets back um   with the understanding that we could restrict it  from campaign funds we could add as an amendment   later on but I'm supportive of this if there's no  other comments I would make the motion that um we   approve the proposed ethic ordinance amendments  and repeal the city council policy 39 on the date   uh the ordinance becomes effective and authorize  the necessary clerk please open uh call the   next item CA share agreement with sedu County  for post incident analysis and system Improvement Services good afternoon mayor wo members of the  witcho city council um assistant city manager   Dante Martin here to present a proposed cost share  agreement with sedal County um in October 2023   there was a fatal apartment building fire at the  Brook Hollow Apartments and E witto in response   to that incident the witto SED County emergency  communications Advisory Board The Advisory Board   voted to recommend the board of County  Commissioners and the witto city council   conduct a comprehensive review of the incident  emergency communications and fire department   operations um important to note The Advisory Board  is composed of area first responder agencies as   well as EMS on December 6 2023 the board of  County Commissioners approved The Advisory   Board recommendation and authorized the county  manager to work closely with the city of witto to   initiate a RFP process uh to proc a neutral third  party to conduct a comprehensive post-incident analysis following the board of County  Commissioners action I work closely with assistant   County Manager Rusty Leeds as well as purchasing  staff from each entity to developing RFP and   uh to administer the evaluation process so in  February 2024 Cedric County and the City of witto   jointly released an RFP seeking a firm or firms to  provide fire and emergency communications Post in   analysis of four firms responded to the RFP uh  a screening and selection committee composed of   Industry professionals uh a representative of  witch State University and the city and county   evaluated the four proposals um shortlisted  to two so we conducted interviews with two   of the four and ultimately recommended Jensen  Hughes be selected based on its experience and   expertise with similar projects and its ability  to provide a comprehensive evaluation that met   the requirements of the RFP on May 30th 2024  Cedric County entered an agreement with Jensen   Hughes to provide the services outlined in  the RFP and detailed in the Jensen Hughes proposal just a quick summary of the work  that uh Jensen Hughes proposed to provide   and the services has provided since the May  30th contract was entered um it agreed to   compare current practices of each agency so SED  County city of witto fire emergency communic   ations uh to Industry standards and best  practices identify gaps in services and Inter   agency communication and provide recommendations  to improve system outcomes as a part of that there   was a significant discussion around maintaining  rebuilding public trust that uh that may have   been fra fractured out of that incident so that  was a huge part of the conversations we've had   with Jensen Hughes uh since May 30th Jensen  Hughes has conducted site visits toward the   apartment complex and reviewed staff directly  involved in the incident additionally Jensen   Hughes has reviewed incident reports  training curricula standing standard   operating procedures and guidelines as well  as state and local regulatory requirements   uh Jensen Hughes anticipates submitting  a draft report to the county within 60 days the fixed fee for the review and Analysis  is $190,000 uh the county agreed to pay the   total upfront cost uh and to be reimbursed by the  city the city man manager's office is recommending   the city pay 50% of the fixed fee um that fee  would be uh expended within the fire department budget it's the recommended action of City  manager's office that the city council approved   the contract any necessary budget adjustments and  authorize necessary signatures I'm available for   any questions you may have thank you Dante council  member hois thank you mayor um so Dante appreciate   your work on this are they already doing work  since the county um paid the cost up front correct   so County entered a contract on May 30th I believe  Jensen Hughes first visited witto in late June   early July had a second site visit in early toid  August met with First Responders uh met with staff   from both the city and county and is close to  beginning work on its draft report okay so within   60 days I think I heard you say I said 60 days  and as soon as I said it I wish I had said 45 days   since the contract expires at the end of October  so between now and the end October okay appreciate   it any further questions for staff I see none  thank you Dante we will now open it up for public comment I see none police department there were  54 different recommendations in seven categories   that really gave our witcha Police Department  a you know a guide of where to go um and we've   seen great results for housing fund RFP  allocation for groups 2 AI and 2 AI good afternoon mayor members of council  Sally Stang with the Housing and Community   Services Department for the record the item I  have for you today is the affordable housing   fund conditional commitments gonna take back  a little bit of History here so in 2017 uh the   Housing Authority board approved an application  to HUD to convert it all of its public housing   under rad uh rad was advantageous because it  re uh removed the restrictions for being able   to incur debt on the property in order to do  Rehabilitation the portfolio was divided into   two projects the multif family senior buildings in  one project and the 352 single family homes in the   other the rad financing and multif family senior  units closed financing in October of 20121 and   construction began shortly thereafter three of the  four projects are complete and fully occupied The   witcha hous Authority was not successful however  in securing financing for the single family homes   so in May of 21 HUD convened a focus group um  and Eva and uh technical assistance contract   and evaluated that the restri red runs under rad  uh were made it impossible to support the level   of dutt service needed to complete the repairs  and they recommended us to dis uh dispose of   the properties under different disposition models  and then um out of those 352 single family homes   66 particular units in two neighborhoods were  designated as pilot areas for the affordable   housing fund arpa funding reinvestment and those  two pilot pilot areas include 43 units in the   Northeast that's at uh 25th in Minnesota  Ash Patt area the the value of that group   is just over $1.9 million averaging just over  $44,000 a unit and 41 of those properties were   made available under this RFP the second group  is a cluster of 23 single family homes down in   the southwest wiah near Meridian and pony uh  most of them are at along hasell in St Clair   value of just over $11.8 million an average  unit value of just over 880,000 a unit and 16   of those units were made available under this  RFP this uh really was an effort to be able to   evaluate if we had a concentrated um investment  of funding in these neighborhoods what type of of   uh overall neighborhood Improvement and growth  would we see so when the city established the   $5 million affordable housing fund out of their  arpa funding to provide Strategic investment in   affordable housing opportunities in the ECA  and according to the affordable housing fund   planned it would allow developers to request  up to $40,000 per unit for rehabilitation of   eligible units within these areas and um those  units listed in this um request for proposal   that we did just finalize $2.7 million was made  available for this project phase all of the units   purchased and rehabilitated through this pilot  program and the affordable housing funds must be   utilized as affordable housing upon completion  of The Rehabilitation and subject to Huds um   applicable affordability periods so as part of the  RFP process developers were required to prevent   their to present their Vision on how the proposed  project will provide overall neighborhood and   Community benefit including how those proposals  assist in developing a a healthy neighborhood mix   of both homeowner and Rental opportunities so in  these clusters we had whole neighborhoods of of   of affordable rentals and the Hope really was to  get a better mix of homeowner units and rental   units uh proposals were evaluated on a unit byun  basis and the developers were encouraged to submit   proposals for all units they believed they could  reasonably complete within a year of a contract   being awarded project proposals were received um  from six uh on six or more public housing units   received an additional bonus bump in their scoring  um to show economies of scale the selection uh and   recommendation of proposals was made by the city's  affordable housing review board they base their   decisions on several factors including development  plans their expertise Financial condition records   uh historical record of uh activities like this  their marketing plans as well as uh emerging   business Enterprise in disadvantaged business  Enterprise and Hud's requirement of minority   owned business Enterprise and women owned business  Enterprise participation I call that eie DB web me   the RFP can uh received 45 qualified proposals on  33 of the properties we did receive proposals from   two other developers that were substantially  incomplete and disqualified um although those   those uh proposers were given an opport Unity  to cure the deficiency and did not do so in the   time frame so that left us with uh 44 qualified um  proposals that covered only 33 of the properties   so several of the properties had more than one  proposal upon review and scoring of the proposals   the affordable housing review board um voted to  approve the sale of an award of funding on all 33   properties that received qualified proposals  these consisted of 29 units in group 2 AI   so those ones that are up at 25th in Minnesota Ash  payatt and four down at the hasal in St Clair area   the uh final affordable housing disposition of  these properties includes 22 for a rehabilitation   and sale for a affordable home ownership and 11  for affordable rentals um that will be monitored   through a project-based voucher contract the total  affordable housing fund Award of 1, 320,000 would   be granted to uh witto Habitat for Humanity in  the amount of $640,000 for renovation and sale   of 16 properties residential Housing Solutions for  $240,000 for renovation and sale of six properties   and large Enterprises in the amount of 440,000  for renovation and Rental of 11 properties the   affordable housing fund program funding agreement  is conditioned on Final underwriting subsidy   layering review and environmental clearance the  RFP and subsequent funding agreements provided   that developers may earn no more than 12% of the  development costs less acquisition cost as their   developer fee so any proceeds in excess of 12%  would come back to the affordable housing fund   at closing with the with the final buyer of  properties that are for home ownership and I   provided a simplified example we have many more  line items on a on a development proforma but   obviously we have an acquisition of cost of 50,000  soft costs site improvements and Rehab cost of a   total cost of $110,000 and 40,000 and affordable  housing funds invested and the developer invest   $70,000 when they sell that property after the  renovations for estimated $85,000 and subtract   the closing costs reimburse the developer for  their cash in and their developer fee we have   $5,300 coming back to the affordable housing Fund  in this in this example if the house were to sell   for $95,000 we'd have another $10,000 coming  back to the affordable housing fund this was   very specifically set up this way so this was  not meant to be a project where developers were   getting rich they are absolutely capped at 12%  of the development costs less the acquisition   cost individual purchase agreements and Project  based voucher contracts will be brought to the   Witchita Housing Authority Board of Commissioners  and individual affordable housing fund and Home   Ownership down payment funding agreements will  be brought back to the city council for final   approval all on consent there is no impact to  the general fund the total affordable housing   expenditure would be in the amount of $1,320 th000  at this time uh the law department has reviewed   and approved the resolution and it is recommended  that the council approve the conditional   commitment of the affordable housing fund program  up to the amount of $1,320 th000 640 000 for witch   Habitat for Humanity 240,000 for residential  Housing Solutions and 440 for large Enterprises   and authorized the necessary signatures we've  learned a lot from round one of the RFP taken   back feedback from both proposers as well as the  affordable housing review board and we'll be uh   proposing the next round of RFP to come out very  soon hopefully by the end of the month and I stand   for any questions thank you Sally we'll start with  council member Glascock hey Sally thank you for   this I'm very glad that we SE a lot of so thank  you for your leadership one quick question so   I know out of it was only four out of the 23  properties in Southwest wiah in RFP which is   only 177% 29 of the 43 in North West wi 67% why  do we think people are choosing the Northeast   properties over the Southwest properties honestly  I think it's because of the uh the appraised value   of the properties averaged $45,000 a unit in the  Northeast and over $880,000 a unit in the south in   the southwest and so our developers that means  more money up front for acquisition makes it a   little bit more challenging okay answer thank  you council member ho Heisel thank you mayor   I appreciate all your work on this Sally the  12% cap on what developers can make is that hug   guidelines or is that our own that we put in that  is our own um we tend to do about 10% on regular   Home applications this one is a little bit more  complicated because of the multiple funding source   and most tax credit projects are about 15%  so we felt that was a happy medium okay thank you I see no sorry Madame   clerk please call the next item 2024  to 2025 special liquor tax allocation   good afternoon mayor uh councel Nathan  Emme uh Municipal Court Administrator what I have for you today is uh a special liquor  tax allocation for uh the inpatient portion of   the Continuum of Care at the December 14th 1999  count city council meeting uh policy guidelines   were developed for the use and administration  of special liquor tax dollars uh those policies   were reviewed and reaffirmed in May of 20 2005  and those policy guidelines and the Kansas State   statutes provide the framework for the allocation  of these dollars uh on December 31st our provider   for outpatient the Outpatient Treatment portion  of our Continuum of Care opted to not uh renew   their their contract and so this would normally  come to you with a a tranch of other uh grants   and continu of care items however because they  opted uh to not continue uh we're bringing we   we put this out for RFP again uh we requested  services for up to 60 particip participants as   part of the Continuum of Care the Continuum of  Care uh starts with uh screen scening uh moves   people to inpatient treatment then to outpatient  treatment with case management running through   the whole thing uh the Municipal Court uh  is is kind of the recipient I say recipient   but the you know the people getting those  services are really the recipient but we're   the customer and so one of the things we've  been doing with the this particular group of   contracts the continuing of care contracts it's  moving away from from a grant kind of structure   to a fee for service structure and we looked to  expand it from what had been 30 people in the in   the previous contract uh to 60 based on what  we'd seen in the community uh and what we've   experienced over the past couple of years and that  matches what uh the council did on the impatient   treatment portion as well three uh licensed  treatment providers responded and a selection   committee uh reviewed and evaluated those  proposals and selected comare as the treatment   provider uh we've got an ongoing relationship with  comare and they provide similar uh services to   the drug court um additionally uh the perform  there are performance requirements as part of   this contract and those are managed by the the um  which to State uh ppmc and then um evaluated on   a uh quarterly basis by the liquor tax Coalition  and that's a multidisiplinary multi-organizational   group that uh that meets to look at all the  performance measures across the liquor tax program as far as Financial considerations this  is uh in this these dollars are in the budget   for funding special liquor tax dollars uh and  special alcohol and drug programs uh it's been   reviewed and approved as to the agreements and  as to form and it's recommended that the city   council approve the contract and approve the  necessary budget adjustments and authorize the   necessary signatures and I will stand for any  questions questions for staff thank you for the   presentation I just had one question why did the  provider op not to Ren is there a reason um there   were a couple there were just some struggles uh  both with communication and performance and so   uh they made the decision that that they uh were  just didn't want to provide that service anymore   and I know that earlier this year we approved the  inpatient portion of this um has that program been   working well yeah I've I've heard no negatives  about it um We've Got U an ongoing relationship   with Deca for that as well as uh for a couple  other programs uh so it seems to be working   well you we now open it up for public comments  any individuals who would like to speak on amendment in the city to dp-62l residence General on parcel 12b generally located   on the southwest corner of East 21st  Street North and North Broadmore Street good afternoon Scott wle from the  planning department so for this case the   applicant is requesting to amend a community unit  plan in order to allow for Correctional placement   residents General at the subject site this item is  being heard today because an appeal was submitted   by the owner of a property in the same Community  unit plan in terms of the request the applicant   has indicated that they're requesting the  amendment so that they can use the existing   housing complex for an alcohol and substance  abuse treatment facility the applicant has also   indicated that they would like the opportunity  for individuals involved in the court system   to reside at the subject site while they are  being treated in order for that to be allowed   with the number of residents the applicant is  requesting the community unit plan would need   to be amended in order to allow Correctional  placement residence General the definition   in the united Zone in the unified zoning code for  Correctional placement residents means a facility   that provides residential and or rehabilitation  services for those that reside there generally   because they're involved again with the court  system or legal system in this case residents   is determined by whether they are living there on  a regular basis in terms of the property as you   can see here on the aerial the site is generally  located to the south and west of 21st Street and   Rock Road the address is 2115 through 2123 North  Broadmore Street the subject site consists of two   property Parcels is approximately 1.6 acres in  size zone go general office and located again   within a community unit plan which overlies the  base zoning the existing Community unit plan is   generally one quter section and extends from  21st Street to the North Rock Road to the east   the red bud path to the South and the existing  Tree Road to the West the community unit plan   includes multiple properties and a variety of  land uses including commercial residential office   and more the community unit plan has multiple  zoning Parcels within it the subject site is on   community unit parcel 12b which only contains the  subject site the community unit plan list the the   allowed uses for parcel 12b it currently does not  include or allow Correctional placement residents   General in terms of context all of the properties  adjacent to the subject site are within the same   cup properties to the north south and west or zone  go general office properties to the north and west   of the subject site are developed with commercial  Office Buildings and a daycare center the property   to the South is developed with a multif family  residential complex property to the West   across North Broadmore street is zoned  mf18 and is developed with multif family housing in terms of the staff report the  staff report provides information about   the definition of Correctional placement  residents the review process for this type   of zoning change and parking requirements  and licing requ licensing requirements I   would note that the licensing requirements for  a correctional placement residence are separate   from the unified zoning code requirement ments  the licensing requirements address many items   including the following criminal background checks  inspections spacing requirements standards for   facilities with sex offender prop populations  licensing procedures for handling absconders   supervision of Resident movement and penalties for  violation of any of these Provisions in terms of   review on August 8th 2024 the metropolitan area  Planning Commission considered the cup Amendment   request and recommended approval the vote was 7  to three subject to the conditions listed in the   staff report two members of the public spoke in  opposition to the request with concerns for safety   and concerns about the location in relation  to the nature nature of the project on August   12th the district Advisory Board considered  the cup Amendment request and recommended   approval that vote was 5 to1 subject to the same  conditions as the mapc recommended two members of   the public spoke in opposition to the request  with concerns for safety and again about the   location and nature of the request in addition  two members of the public expressed support for   the request citing the need for their services  no protest petitions were received against this   application on August 21st an appeal was submitted  to the planning department as a result this item   is being presented on the non-consent agenda in  addition because the appeal was filed by a non   applicant owner within the same Community unit  plan a 34s majority vote is required to approve   the application that is six out of seven votes and  my apologies for sharing different information at   the agenda review on Friday this pretty unique  circumstance because the appeal was filed by   another property owner in the same cup it  requires six out of seven votes to approve   the CH the amendment in terms of recommendation it  is recommended that the city council adopt the fin   of the mapc and approve the cup Amendment adopt  the resolution authorize necessary signatures and   instruct the city clerk to publish the resolution  after approval again that would require six out of   seven votes to approve Alternatives include  the following you can override the Planning   Commission adopt alternative findings and deny  the cup Amendment request that would require   five of seven votes because it's an override or  is always you can return the case to the Planning   Commission for additional consideration that  would require just a simple majority of four   of seven votes quick note about the process that  city council policy is at the public hearing for   planning agenda items occurs at the Planning  Commission meeting according to the policy the   city council does not typically receive public  comments on zoning making sure that I had all my information  correctly correct um I did want to just make the   statement that I have had expar communication with  the applicant I have not had experte communication   um with uh community members since the dab meeting  um I I I know for some this is challenging but in   our community there's a need for facilities that  can help people who are both facing addiction   and have involved in the legal system and also in  this situation this is a very unique facility that   might otherwise find it difficult for reuse  um it does have fencing and other security   features already in place that was something  that we discussed at length at my DB um and in   addition any operator of a correctional placement  resident is required to have a license and that   license adds additional operation requirements so  with that in mind I would like to make a motion   to adopt the finding of the MPC and approve the  cup agreement adopt the resolution on   the Southeast corner of West 29th Street North  in North Sal Avenue 961 West 29th Street North   good afternoon Scott wle again in this case the  applicant is requesting approval approval of   a zoning change a zone change from sf5 to single  family to LC limited commercial District this item   is being heard today because the district Advisory  board and the Planning Commission recommendations   are different and about the request the applicant  has indicated their requesting the zone change in   order to match the zoning of nearby properties  and to expand options for development of the   subject site in terms of the property the site  is generally located to the south and west of   the intersection of Woodland Avenue and and 29th  Street North it is approximately 0.4 acres in size   and currently developed with a vacant church  or office building and the related parking in   terms of context properties to the north across  29th Street are zoned LC and sf5 developed with   a vacant commercial building in a single family  house the commercial property is owned by the   applicants for this application property to  the South is owned sf5 and developed with a   single family house property to the east is is  owned sf5 and is currently undeveloped property   to the West is owned LC and developed with  restaurant in terms of the staff report staff   report provides information about development  standards and Landscaping requirements in terms   of review on August 8th the Planning Commission  reviewed the request and recommended approval   of the zone change that vote was 9 to one no  members of the public spoke on this item on   August 12th the dab reviewed the request  and recommended denial of the application   6:1 in the motion to deny the request one of  the dab members cited the golden factor that   the requested zoning would detrimentally affect  the character of the neighborhood the rep the   representative for the new property owner was  not present at the dab meeting no members of   the public spoke on this item at that meeting no  protests were received against the case therefore   the zone change can be approved by a simple  majority vote four out of seven in terms of   recommendation it is recommended the city  council adopt the findings of the Planning   Commission and improve the requested zone change  authorize the necessary signatures and instruct   the city clerk to publish the ordinance after  approval again that would require four out of   seven votes Alternatives include the following  you can override the Planning Commission adopt   alternative findings and deny the requested zone  change that would require five out of seven votes   you can override the mapc adopt alternative  findings and approve uh the staff recommended   zone change to just neighborhood retail District  neighborhood retail District that would require   five out of seven votes because it's an override  or as always you can return the case to the mapc   for additional consideration that would require  four out of seven votes and again the note about   uh the process at City council's policy is at the  public but about kind   of all three cases holistically today and it's  probably all other zoning cases I wasn't familiar   so when we so when we list mapc the names of the  individuals in mapc are mentioned and this might   actually be more a question a question for the  manager's office but when we go to dab uh I've   noticed in all three of these cases it doesn't  list the dab member speaking uh it just lists   a um whether it's a question or whether it's a  comment uh or whether it's an answer and so for   the sake of you know transparency if we're at  listing mapc individuals and and this may not   be a planning this may be more commanders offices  is there a reason we don't list the names of dab   members as well oh sir what I could offer is  that um we look to the dabl aison to provide   the minute so we just attach them as they're  provided to us in terms of that practice about   listing the individual who's speaking I'm not  sure how I'll follow up with Bob outside of   this then um I just had a question it was the  first time I noticed when I was reading um all   of the comments that there was just a difference  between how mapc reported things and how d report   so thank and I'll tell you uh Mandy Hebert in our  office will tell you it is not always the easiest   thing to identify who's speaking in a three hour  long meeting so there's also staff limitations   for our dab for the the neighborhood um or  the csrs okay and so for a long time we were   months behind in our dab minutes so I think  it's a little bit of a compromise on workload   okay thank you I appreciate that any further  questions for staff I see none this resides in   count vice mayor Ballard's District thank you  mayor um I move to defer this case to November   5th city council meeting this would provide  an opportunity for uh the case to be reheard   at the dab 6 the next dab meeting is scheduled  for October 14th the applicant was not present   when this was heard by the dab in August and clerk please call the next item   z22 24-35 zone change request in the city from Li  limited industrial district to be multif family   residential district for a single family dwelling  or duplex development generally located on the   west side of North Wellington Place and within  330 ft South of West 29th Street North Scott   we again again from the planning department  for this case the applicant is requesting   as you heard a zone change from Li limited  industrial to B multifamily this item is being   heard today because the district Advisory board  and the Planning Commission recommendations for   approval are different so they both recommended  approval but slightly different ways in terms of   the request the applicant has indicated they are  requesting the zone change in order to allow for   a single family house or duplex to be constructed  at the site in terms of the property the site is   generally located to the north and west of the  intersection of Wellington Place and 28 Street   North a subject site is approximately 0.14 acres  in size and currently is undeveloped in terms of   context property to the north zoned Li is owned  by the applicant and is undeveloped properties   further to the north and Northwest are zoned  Li and developed with warehouses property to   the Northeast is Zone GC General commercial and  developed with a warehouse property to the east   is Zone B and veled with a single family  dwelling properties to the South and West   are zoned Li and developed with single family  dwellings in terms of the staff report staff   report provides information about development  standards in terms of review on August 8th the   Planning Commission reviewed the request and  recommended approval of the zone change that   vote was 11 to zero there were no public  comments on the request on August 12th the   district Advisory Board reviewed the application  and recommended approval of the zone change   but this was slightly different than the  mapc because they recommended approval   with a protective overlay there were no public  comments on the request at that meeting uh the   dab recommended the protective overlay and that  would require that any duplex developed at the   site would be developed and constructed with a hip  or gabled roof no protests were received against   this application therefore the zone change can be  approved by a simple majority four of seven votes   in terms of the recommendation it is recommended  city council adopt the findings of the Planning   Commission and approve the requested zone change  authorized the necessary signatures and instruct   the city clerk to publish the ordinance after  approval again that would require four of seven   votes Alternatives include the following you can  override the Planning Commission adopt alternative   findings and approve the zone change with a  protective overlay as recommended by the dab that   would require five of seven votes because it's an  override another option is that you can override   the Planning Commission adopt alternative findings  and deny the zone change request again that would   require five votes out trying to get for   two years the closest airport we've been able to  get it at was in San Diego and Houston New York   New Jersey so to have it come to witchta once  a month is a huge thing and uh there's a lot of   happy people that were getting their interviews  so I appreciate it very much compliment Jesse   and his team at the which airport it's very much  appreciated council member ho Heisel thank you   mayor I just had a quick question um consent items  uh seven and eight today are we just putting those   off until a further council meeting uh yes we're  staff's got a little more work to do on them okay   appreciate it vice mayor Ballard thank you mayor  I just like to thank um council member glasscock   and everyone else that was able to make it out  to the river cleanup we um collected a lot of   trash uh that was in and near the river so uh  we will probably be doing that again maybe once   a month um weather permitting so appreciate that  I know there was a lot of things going on um so   congratulations to the new Temple and thank you  for being able to to go there um when I wasn't   able to um also uh this Saturday from uh 10:00  a.m. to noon we're having the district 6 unity   in the community at Evergreen Park so looking  forward to to that and would encourage um anyone   and everyone that is need something to do uh  to come out and join us thank you for
