[0:00] **Clint Hooppaw (Mayor):** [Music] and we're on good evening we'll call this meeting to order for the July 25th 2024 Apple Valley city council meeting uh welcome everyone this evening for any members who would like to in the audience who would like to speak as your name is called please come forward to the podium to address the council with that the first item on our agenda is the Pledge of Allegiance and I would ask everyone to rise and join us in the pledge I pledge allegiance to the flag of the United States of America and to the republic for which it stands one Nation under God indivisible with liberty and justice for all you're getting pretty casual the next item on our agenda is to approve the agenda and Tom do we have any changes? [1:32] **Tom Lawell (City Administrator):** Good evening Mr. Mayor members of the council uh just one update this is your calendar of upcoming events you should have that before you tonight that is item number seven on your agenda. The next item is our audience participation portion of the meeting this is for items not on the agenda and we have a total of 10 minutes reserved for this section would anyone in the audience like to speak? All right seeing none we will move on to the consent agenda these items are considered routine and will be enacted with a single motion unless the council member or citizen requests to pull an item we'll start with the council members any items you'd like to pull from consent? Don't see any. Citizens any items to pull? All right with that we have a motion to approve the consent agenda. Thank you that consent items all carry and we will move on to the regular agenda and we will start with item 5A which is a key—which is a number of Kelly Park related items so Alex? [2:50] **Alex (Staff/Planner):** Thank you mayor and council I do want to note this is also the public hearing for the vacation so this evening uh the city is actually the applicant and requester on this we were requesting three different actions one holding the public hearing two closing the public hearing and uh adopt the resolution completing the vacation and then three adopt a resolution approving Kelly Park final plat traditionally final plats are on consent with city council so you don't review these as often or have a presentation I should say uh but when they have to occur after the vacations is when you will see a final plat come forward so the site uh as noted is 6855 Forino it's the Kelly Park site you've seen rezonings and other actions that have come through on this this is part of the Parks Board referendum as we are cleaning things up to bring forward a final plan for Kelly Park we will likely have uh some additional actions in the future that will go before Planning Commission and the city council with site plan building permit authorization being the primary one there could be variances based upon setbacks and things like that as well once we have a more final set of plans one of the key things that I want to linger on uh on this slide is the vacation is primarily over Fontana Trail here and the drainage utility easements created around each of these individual Lots so the next slide it is an exhibit of those uh but they don't show it quite as well as maybe the aerial does we've got standard perimeter easements around all of the Kelly Park plat or uh Parcels except for the main Kelly Park parcel that was always intended to be Parkland if you recall the adjacent Parcels were actually set up to be for Town Home Development and ended up going tax forfeit in the city acquired those because they were set up to be a private development they were established with those private easements around the uh perimeter of them and what the city is looking to do is essentially vacate those and then with the final plat put in new perimeter easements around the exterior Kelly Park the other item of note is that Fontana Trail we are saying that it's just a portion of Fontana Trail though I do believe that it will be the final portion of Fontana Trail left within the city the other two portions were vacated previously this is the new Kelly Park plat uh sorry it's washed out a little bit but you can see that it's now combined all into the one lot one block one for majority of Kelly Park and then lot one block two for the small area that is in the street just to the south of Kelly Park with a planter and a fountain Yep this is a preliminary plan of what the parks department is looking to do at Kelly Park this I believe is still going to be somewhat in the works Eric can elaborate on that a little bit more uh our Parks director but essentially we need to vacate that section of uh Fontana in order for this to function properly um as it is set up right now we don't need RightWay running through the site one item of note uh is we do have a storm water pipe running through uh that street area we are retaining an easement over the top of that section on the plat specifically for drainage so that that is always marked going forward into the future uh we will be the only user of that because it is just a drainage easement for us with that if there are not public comments uh staff would recommend that we bring forward and hold the public hearing close the public hearing adopt the resolution completing the vacation and adopt the resolution approving Kelly Park plat if there are comments from the public or concerns that are uh cannot be addressed we would uh hold the public hearing but not act on items two and three. All right seeing none we'll open the public hearing for the vacation of the drainage and utility easements on blocks four five and six the legacy of Apple Valley North and a portion of Fontana Trail anyone who would like to speak to this item? Alex I think we're done thank you I know she didn't invite Eric up to speak uh just in case right it's usually good to not talk when right the approvals go in your direction so all right staff and Council Communications I know we've got a Night to Unite update from our police chief we're hoping that that's like the dry evening of the summer right when we get there this year we've had great luck. [8:03] **Nick Francis (Police Chief):** Good evening Mr. Mayor members of the council my personal favorite night of the year Night to Unite is right around the corner here uh Tuesday August 6th we have celebrated it in Apple Valley for decades and decades and look forward to many more opportunities uh neighborhood parties are kind of the highlight um and for Night to Unite it is the largest um crime prevention opportunity that our city gets through the entire year um so it's important for us to get out to those neighborhoods and um and network with all of you with us with our city staff and uh in our neighborhoods um so there's online registration we get usually right around 100 110 uh registered parties each year the registration deadline is tomorrow so I got a couple emails today blasted through uh Pam Walter and our crime prevention um team that hey you still have time here till tomorrow to uh to register so we invite the public to do that uh and we will have City Council um police fire department heads and uh some other folks out with us at the parties um we again are doing a school supply drive uh neighborhoods are encouraged to collect school supplies and then they deliver those to uh direct to the school so uh in the past we have had those and we've taken them and then brought them here and then uh transported them but they have it down now pretty good where the the neighborhoods are um are taking that responsibility themselves so we invite folks to um to give a little bit bring as you go to your parties uh bring a little bit that can help some of our school kids get the year off to a good start so looking forward to having everybody we also have a chalk art contest um part of the um part of the materials that uh the families get is a ton of chalk for each uh for each neighborhood and so um we go through and um photos are submitted to crime prevention they're sent out to the police department and we have uh votes so hint hint I mean if they do a fire themed thing they may win a prize but if they do a police themed chalk art more likely they they may uh get some votes from the police department. [10:14] **Clint Hooppaw (Mayor):** We're not going to have fire out there using the hoses to wash off the driveways are we? [10:17] **Nick Francis (Police Chief):** Yeah so uh it's become a good tradition and a great way for uh for some of the kids to get out there and do some uh some decorating in in driveways and uh wherever the parties are at so um um that's all I have we look forward to having everybody um in a couple weeks on Tuesday and 5:00 we'll meet here uh just right outside this room and and go out party hopping so. [10:40] **Clint Hooppaw (Mayor):** Okay sounds great super thanks thank you I think we also had an update from uh park director Eric to talk about uh a meeting or two he's been attending lately so. [10:55] **Eric Carlson (Parks and Recreation Director):** Mr. Mayor members of the council um as a part of the successful uh November 23 Parks referendum we've been working on the five large projects which are the Aquatic Center, Hayes Arena, the youth baseball softball complex, Redwood Park um Kelly Park and the Apple Valley Community Center/Senior Center but we also are doing a lot of improvements and planning a lot of improvements across the entire park system well over a 100 projects and to try to get some neighborhood feedback um we're going to be meeting in every single Park in town um over the course of basically the month of August um in the evenings and so we're inviting people to come out we sent out about 13,800 emails to folks alerting them of that we put a sign with a QR code in every single playground in town so that people um could hopefully scan the code go to our website and I'll just quickly show you on our website how you'd get there you'd click on Department Services click on Park projects and that brings you right to the page and if you want to see when you're meeting there's the list of meetings dates locations etc. um that we'll be there now we're only going to be there for about 30 minutes um but we'll share some information we'll we'll certainly whoops I didn't want to do that uh we'll answer questions um and people can email us information or email us their thoughts their comments uh they can call us they can come to the parks advisory committee meeting um as they go to refine what we're suggesting because we're really looking for people's feedback about what do they like about what we're suggesting and what maybe do they want to see changed about what we're suggesting so nothing that we're doing so far is etched in stone it's all just a draft and we'll be uh seeking people's feedback that's all I've got thanks. [12:41] **Clint Hooppaw (Mayor):** Eric ton of meetings again we did a ton going into this and you continue to do them so thank you I know it's a lot of evening and weekend time you're consuming. [12:49] **Eric Carlson (Parks and Recreation Director):** Yep no problem thank you. [12:51] **Clint Hooppaw (Mayor):** Thank you Tom any other staff updates? [12:52] **Tom Lawell (City Administrator):** Mr. Mayor after the comments of our police chief Francis I think we should at least give a little extra time to our fire chief and I'll even make the comment that uh fire station number two is nearing completion as people go by it is actually taking shape very nicely they were doing some final concrete pouring here today finishing up on the exterior materials uh talking to the chief here earlier today it looks like probably early September we'll be ready for a public open house and be able to show our citizens the final product there so uh look for more details on that as it comes together but probably that first second week of September is what we're looking at at this point. [13:30] **Clint Hooppaw (Mayor):** Great thank you uh council member Goodwin? [13:32] **Councilmember Goodwin:** I just want to remind the fire chief and the police chief these fancy new buildings you are getting you can't have a bar in there okay no [Music] booze. [13:42] **John Bergman (Councilmember):** Like in the old days. [13:43] **Councilmember Goodwin:** Like in the old days all right. [13:45] **John Bergman (Councilmember):** Like in the old days where they all drank beer at the fire station thanks I have two I'm going to only discuss one of them which is more important than the other one but the other one was addressed by staff today but the the comment I'd like to make in the last week a lot of you and there's some of you that live close to the runway that where we're getting all the airplanes coming in because of construction uh when I was out and about and I've been out and about for the last couple weeks it has progressively gotten worse so at that point in time I decided to take a little observation of what went on and on Monday I made a call to the person in charge of the noise oversight committee at MAC and stated that in the time frame that I was out going for a walk that I had seen 14 airplanes and out of those 14 airplanes 13 of them had their wheels down wheels down for 17/35 where there's some people in this room that live by it um is at 35E so the wheels have to be down nautical miles out at 3 to 3.2 miles away when the landing gears all have to be down there was 13 out of those 14 that had their wheels down at 145 or earlier um than 147 excuse me in earlier um of those aircraft the conversation was made I had dialogue with the person in charge of the noise and they got back to me today and said some of those at that time frame were out their wheels were down at 8 nautical miles um down so a lot of it has to do with the size of the airplane when the wheels come down and a lot of in between of how close an airplane can be and how heavy the airplane is coming in but it's been going on for the last week and they are investigating it but it's um pretty I I get why we have to be the wheels have to be down at 3.2 miles it's different than what Minneapolis and St Paul is when their airplanes come in their wheels are down still a distance away but there's a lot of houses our concern later is we do not want if a new program goes into place that this is what's going to happen it's going to be straight line with the wheels down all the time so that's the uh noise abatement stuff for now. [16:03] **Clint Hooppaw (Mayor):** John I appreciate you serving there and putting time into it representing not only Apple Valley right but all of our all the other communities as well so thank you. Councilmember Melander? [16:11] **Tom Melander (Councilmember):** Question for Councilmember Bergman maybe I should know this but when the wheels get on does that make more noise? [16:19] **John Bergman (Councilmember):** Yeah is that—wheels dropped on an airplane produces more drag and that's what makes it—makes the airplane louder yes airplanes are quieter now than what they were five to 20 years ago um but drag is drag and still loud right quieter y so it's still— [16:41] **Tom Melander (Councilmember):** Maybe should have known that clarification. [16:43] **Councilmember Goodwin:** A question I have uh before this mess started with them taking redoing the runways up there I was satisfied with the amount of time that traffic was coming over Apple Valley I know we have to share with the rest of the metro area I hope when this goes back to the having those those um two runways completed that we continue that we can go back to where we were where we just get this tremendous traffic just a few hours a week. [17:15] **John Bergman (Councilmember):** May I? [17:16] **Clint Hooppaw (Mayor):** Yeah I was just waiting for you sorry I hit the light. [17:18] **John Bergman (Councilmember):** Councilmember Goodwin um the plan right now that there's there's three things that are going on at the airport right now you got road construction where people can't get in in and out of the airport just by driving number two you have um the runways that are being um dug up and after 15 years and later you'll have something in next year that'll have to pertain to it there the noise that you are talking about right now will end September 21st it's still on schedule and it's a project that has not been done in 15 years which I'm sure you're aware of the uh next round will be next year in in in 20 what are we 24 25 the runways will—a different portion of the runway will be um worked on from April to May for 6 weeks then the noise then the construction goes away till August of next year till September that'll be another six-week project it won't be as in as what we have right now but I'm rest assuring and I've said to other people that live close to you where you live that have had dialogue with me right over to my house um that have a dialogue that's what their concern is is it going away or is it going to be forever and it is going to go away it will um— [18:55] **Clint Hooppaw (Mayor):** It's good news it's a shorter duration next summer but it's it's a two-year project this is the worst year of it thanks again thank you any other comments all right with that we'll move on to our calendar of upcoming events our next informal city council meeting is Thursday August 8th at 5:30 and our next regular city council meeting is—excuse me Thursday August 8th at 7 do I have a motion to approve the calendar?
