meeting is officially come to order we apologize this evening we're a few minutes late but we were working with TB to be sure we could get everybody on board tonight we know that there are a few folks who may have some cost connection interruptions this evening but our meetings will be available online and available for rebroadcast and those folks can join us a little later when they can so first of all for our roll call this evening all counselors are presently via their resume conference we begin this meeting like every meeting with a moment of silence and we'll begin this evening by asking counts from Busan to lead us legible agents in English followed by our council clerk miss Ortega who will follow and lead us in the Pledge of Allegiance in Spanish and so council Busan I'll turn it over to you for a moment I want to name I pledge allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and appreciate it and we'll rotate those counselors through for our next meeting and maybe even rotate the administration and the timer to chorus while we're doing it this way there's no no press release from our office on Friday was also posted on our website and noticed on the published council agenda meeting has special procedures given the governor's declaration of a public health emergency that limits and imposes a ban on gatherings of more than five people therefore this meeting is being held via zoom video conference members of the public our city staff and the media all have the ability to view this meeting in a number of ways that includes gov TV on Comcast channel 16 on the TV website and now on YouTube live streams can be accessed from most smartphones tablets or computers and for those watching on the live stream we welcome you and thanks for joining the video recording in this and all of our council meetings are always available for viewing at any time on the City Council's website our staff will here and available by telephone anytime monday through friday 8 a.m. to 5 p.m. to assist you if you need to locate information about one of our meeting view one of the meetings you can call 768 3100 for assistance the council accept a general public comment and comment through being specific agenda items in written form via email through 4 o'clock this afternoon those comments were distributed to all councillors earlier today and they've had a chance to review them we're going to begin this evening with proclamations and presentations and we're going to begin first with councillor Simmonds who has a proclamation recognizing asian-american a three month and I believe we have a special guest that we're going to have join us that we've invited into our zoom meeting as well so councillors Thank You mr. president this proclamation is recognizing Asian American Pacific Islander month and we have whom win the Co interim director of the New Mexico Asian Family Center as well as any lemming she's the co-chair of Asian American Association as well as the chapter leader chapter co-leader sorry for national American Pacific woman American Women's Forum and Albuquerque I can only pull up the proclamation whereas there are more than 42,000 asian-americans and Pacific Islanders living in New Mexico and are among the fastest growing and emergent emerging communities of color in New Mexico and whereas asian-americans and Pacific Islanders in New Mexico come from Afghanistan Bangladesh Bhutan Cambodia China India Indonesia Iran Iraq Japan Korea Laos Malaysia Myanmar Pakistan the Philippines Taiwan Thailand Tibet and Vietnam as well as other locations and whereas asian-americans and Pacific Islanders have worked on the railroads and in agriculture in New Mexico since the 19th century and fought bravely in World War 1 World War two the American in Vietnam conflicts the Korean sorry the Korean and Vietnam conflicts the Gulf War and in Afghanistan and Iraq and have received congressional medals of Honor and Purple Hearts and other military commendations and whereas this year presents the 55th anniversary of the passage of the federal Immigration and Nationality Act of 1965 signed into law by president lyndon b johnson at the foot of the statue of liberty on october 3rd 1965 and whereas Asians and Pacific Islanders also were affected by the federal immigration Act of 1917 which designated an Asiatic bar zone of much of eastern Asia and Pacific Islands from which people could not immigrate to the United States and whereas United States Senate resolution 2:01 passed by Unanimous Consent including New Mexico senators jeff Bingaman and tom udall on October 6 2011 acknowledged that the exclusion laws were incompatible with a basic founding principle of the United States that all persons are created equal and whereas United States House of Representatives Resolution 683 expressing the regret of the House of Representatives for the passage of laws that adversely affected the Chinese in the United States including the Chinese Exclusion Act was supported by congressman Martin T Heinrich Steve Kerr's and Ben ray Lujan the resolution was placed on the suspension calendar in passed unanimously by the 112th Congress by voice vote On June 8th 2012 and whereas on October oddest fourth 2016 the City Council the of the City of Albuquerque rather the county of Bernalillo and Albuquerque chinese-american Alliance celebrated and dedicated the Imperial building plaque to commemorate the Albuquerque Chinese pioneers the history the historic Albuquerque tiny Chinatown and the contributions the Chinese have made in New Mexico and whereas on January 11th 2020 the City of Albuquerque the county of Bernalillo and Albuquerque chinese-american Alliance also celebrated the unveiling of the sculpture the view from Gold mountain commemorating the landmark historic Chinese American civil rights case territory of New Mexico versus yishun 1882 and whereas asian-americans and Pacific Islanders are contributing to our local economy with their labor in business and purchasing power and are a strong part of a narrative and historical context of our city and state with their unique culture customs and traditions too are already richly diverse culture and deserve to have their humanity in its shapes and forms be recognized via proclaimed that the council the governing body of the City of Albuquerque hereby recognized me as Asian American and Pacific Islander month Thank You councillor Sena and welcome if you know these sort of did already but if you want to introduce your guests we want to give her a chance to speak on behalf of the group that normally would be accepting this in front of us but we'll do it virtually for them maybe be able to do something in person a little later Thank You mr. president with me is any lemming any would you like to say a few words sorry my dog started barking hi so I'm Annie lemming and I'm here tonight as co-president of the Asian American Association of New Mexico also known as triple annum whose mission is to improve the social well-being of Asian Americans in New Mexico by building community networks and foster a better understanding of asian-american heritage history issues and policy I'm also part I'm also to chapter co-leader for the National Asian Pacific American Women's Forum Albuquerque where an org that works toward reproductive justice as it intersects with immigrant and economic justice I'm proud that triple-a nm is hosting a virtual storytelling exhibition to highlight Asian Pacific American experiences during this pend on it I'm also proud that both orgs I mentioned and I'm part of join forces to facilitate a community mutual aid grocery card project named NM ASAP I thank you once again and it's a privilege to be here and listen to this proclamation of May as Asian Pacific Islander American month and deed Asians and Pacific Islanders have had a long-standing contention with being aggregated into one big cultural group with historical erasure and the ever plating model minority myth but even at the immediate moment I reflect on these trying times of code 19 pandemic where agents have paced being scapegoated for this virus that we have all that we have all much work to do to fight the virus that is racism and we can only do this as a collective this Proclamation could not have come at a better time to uplift the voices visibility and contributions of Asian and Pacific Islanders in every aspect of the development of this nation state and city throughout history thank you Thank You Annie and mr. president I think we have one more guest whom who is the Co interim chair of New Mexico agent family center Thank You Colin Cena and Thank You Pat to do Castle Navy for this opportunity my name is Huan Wien and I'm with New Mexico Asian Family Center and it is such an honor for me to be here in this space to to be you know you know honor as the community definitely as a community we are rapidly growing dynamic and diverse community and we are happy to be a part of you know the City of Albuquerque culture history and we continue to contribute significantly to your community and we definitely would like to have this opportunity to honor our past present and future right as a part of the city and I appreciate this opportunity that you all here and we have WT to select a month with you all and then finally look for what you you know when we can get back to you in person right and do it in a different way but this is you know very interesting time to you know receive this Proclamation via you know virtual you know this is quite interesting for me and I'm sorry I cannot have my face here because this computer doesn't have the camera I say all the barek computer for my kids because they have a lot of online learning so it's again another thing so again thank you and I appreciate you all [Music] thanks and thanks council center for bringing that forward anything else on that and we're moving on to our next proc you just want to thank my fellow councillors and recognizing the special moment for me as also a daughter of two refugees that had fled the Vietnam War being the first Asian American in City elected politics this brings me a lot of joy even though it's recognizing it virtually it's also giving space to invisibility to our communities and I just want to thank you all and thank our community partners for working with me on this Proclamation because it really goes to the community and I just want to say that I know that this month was meant for a lot of celebrations that we always hold near and dear to us and also bringing about that visibility with the Asian festival that we typically hold in May but we hope to have many more celebrations to come once things settle and hopefully we bring more visibility to not just our accomplishments but some of the issues that we face as well so I appreciate our community and having that patience and staying home when they can and doing what they can to to uplift our communities as well so and thank you again mr. president great and thanks to all of our counselors for for making time for this tonight I know it's been a little hard for us to do Proclamation so thanks God for bringing that to that note we're gonna turn it over to Council Pena who is also going to lean on route Proclamation tonight counselors as a reminder with our group proclamation it's available in your iPad and we'll go district by district to help read this but we'll begin counselor Pena would you enter this for us you're the one who brought this to us today Thank You mr. president and congratulations then that was awesome proclamation and this kind of leads into you know May is also a month for a lot of graduating seniors in our community and I just really want to thank the staff and Nancy for helping you put this together the last minute as you know so many tuitions are gonna be happening this month and unfortunately the seniors class of 2020 are really going to have some different type of celebration and we're really proud of them and as a council I wanted to put forth the proclamation just saying that we we are proud of you where we know that you're going to come up creative ways to celebrate and we're 107 behind you so with that if counselors sent up you would go ahead and lead us off Thank You councillor opinion whereas the City of Albuquerque the state of New Mexico and our nation are in the middle of a worldwide coronavirus pandemic and I think I think we lost confidence so I'm gonna pinch-hit here whereas the pandemic has required advanced stay at homeless and the closure of public and private schools to reduce the spread of virus whereas by virtue of an executive order signed by New Mexico Governor michelle lujan-grisham there is currently a ban on all large mass gatherings in New Mexico and councillor beretta I think we lost council for just a minute and so we're gonna say whereas the unprecedented circumstances have prohibited typical year in graduation ceremonies Saiva teas and celebrations during the month of May and whereas during the current situation it is necessary to create opportunities to honor our graduating seniors as it is important and councillor Gibson and the City of Albuquerque recognizes the hard work and dedication that it takes to complete high school and gain a diploma and to pursue their dreams and enjoy the endeavours of each of these individuals choose to pursue in life whereas we ask Albuquerque residents to show your support for the graduating class of 2020 and displayed on your car windows social media and whereas that would be wonderful so honor support the graduating class so congratulations all seniors out there so thank you mr. president I really appreciate that I thought it was important you know I had my daughter just got she was supposed to be in California receiving her master's this weekend so we had to get really creative and I know it's a little challenging so good luck to all those out there who were trying to make this a memorable time for them so congratulations do we lose counselor Davis mm-hmm so I think I think he'll be probably getting back to us here in just a second but it looks like the fourth item is the economic development discussion there being none oh and there is a president welcome back yeah ed we're gonna some technical stuff here cleaned up on our side Humana Bachelor then go ahead and finish that one for us it will pick up on the next one I'm sorry we're just gonna do some technical stuff to get us a little cleaner up here certainly certainly so we'll go to item five administration question and answer period councillor Poisson looks like you have some questions up first I do thank you madam vice president my questions several have number for animal welfare and recently I had a constituent say that they had found a dog and reached animal welfare and was told that they needed to make sure to keep the dog for two to three weeks until an appointment could be made for them to to turn in that pet so the constituent couldn't do that and then they were told to go ahead and release the animal so that it could be found by whomever or whatever again and I I do realize that I've talked to administration about this but I wanted to be fair and make sure that they could publicly announce to the solution and and maybe where the disconnect was so what what is the current policy for when an animal is rescued and if not what's the current policy oh I repeated myself so what's the current policy from when an animal is rescued and I know that that from my understanding changed as of today too so it'd be good for the public to know mister councilor Busan actually the policy did change just in light of the governor's recent change in in the state order but just by background early on in in the as we went into the the coal bed if you will timeline we had to downsize and basically our work at animal welfare due to the social distancing issues etc and so there were some hiccups if you will in the processing of some of these requests coming into the department and for that we've made some changes that I think will will work much better as it relates to services to the community going forward as of today there is a now a full crew of folks at animal welfare they can accept phone calls for example from for animals that have been rescued by citizens they simply just got a call either animal welfare or 3-1-1 we've increased the hours of operation all there now because we've opened up the department if you will with more staff going in and and so the policy right now is the please call animal welfare and they'll either send someone out or they will have you you can take your pet or any rescue animal to the facility and they will accept the animals thank you mister rail and mr. president if I may continue so what would people do if that does not include first surrender by owner because I know for a while they were not accepting any surrender by owners so I want to make sure that we have an alternative as that's but it sounds like that might be included now now with this counselor mr. president and counselor Busan with the Inc now the increased staff at the both facilities the west side in these facilities yes owners can come in and surrender their animals as well thank you so much and that's good news to hear and then did you do I don't know it was we're kind of stumbling sort of with the timeframe between earlier today and now but was there a press release or will there be where can people find the newest policies so that the public can know and we can all make sure that they're they're on the same page with with the opportunities for helping these animals mr. president comes from Bassani members of the council a press release is going out early tomorrow that will describe the hours and the information and give the citizens of the city a the right timelines except to make the calls and and we should have everything in place by tomorrow awesome thank you so much I I'm so glad to hear that it's something that's already being addressed and thank you for clarifying for the public my last question is I have had some constituents reach out and inform me that there have been some stores that you know well non-reusable or I'm sorry reusable bags are not an option right now stores are charging for the plastic bags that are being made available but I'm not sure if that's the way the policy should be since they're being forced to use that or not so if you can clarify mr. president and contrabass on I have both our solid waste director and our environmental health director available to answer the questions or your question specifically as it relates to the green ordinance the mayor suspended the enforcement of the green ordinance I threw his emergency declaration that goes to the middle of till May 15 so as a result of that the stores have been given the green light to use single reuse plastics in during this time and there are specific requirements under the green ordinance they should not be charging for those for those plastic bags but both mr. masked and mr. wit math Whelan are available so I'll turn it over first to to Ryan to describe that issue as it falls under the environmental health department thank you good evening and mr. president thank you for the question as it relates to any charges for that you know Brielle mention there should not be any charges for any of those bags that was part of it included in the order if there are any reports of that happening we do encourage everyone to call 3-1-1 and report that DHD and we can have an inspector go out and check on that right away to make sure that thank you very much I appreciate that because I know of two specific instances that that's happened in this last week so I will next time make sure they refer them for that I appreciate that thank you all thank you and thank you madam vice president for jumping in there in service on is that your final question you had for the administration great counselor Gibson I think you had a question for the administration I do thank you mr. president my question is directed towards family and Community Services Department regarding the housing voucher program my question is how much is left in there I understand [Music] madam vice president and president Davis and I got your question ahead of time I was having a little hard time hearing you but I think I have the answer to your question am I looking here or there there sorry so last year for Motel vouchers we spent two hundred and twenty four thousand dollars and some change and two and this year for FY 2008 actually two hundred and seventy six thousand now I want to clarify a couple things in the two seventy-six thousand for this year there's fifty five thousand that has gone to the county for the resource reentry Center and First Nations is the contractor to have helped people coming out of the resource reentry center to use a motel and my understanding we've spent just only hundreds of dollars on that so this fifty five thousand dollar contract has not been expended so if you take out that fifty five thousand for what is budgeted for this year that's two hundred and twenty one thousand for FY 2008 which i think was your question if we're on track is we've spent a hundred and eighty three thousand so for being here early May we feel like pretty much we're on track I did want to say that Family and Community Services doesn't directly administer the motel vouchers we work with a handful of contractors to connect people through case management with those that need Motel vouchers thank you so a little follow up questions then let me ask a question just a little bit different way does it appear to you that we are about where we were last year with the number of vouchers name that's the same question but I'm just wondering if I guess I'm wondering if have we served more that's the same number of people or at least number of nights per person you know this year as compared to last year council president Davis and madam vice president in terms of the actual numbers of people that have read received motel vouchers financially it appears we're about on track but I would have to do and I'm happy to do this is dig in a little bit to see exactly how many people were served last year with the money we spent and then I can find out where we're at to date so I can actually get those numbers I don't have those on hand but I can get those to you thank you thank you very much you're welcome dr. Gibson Thanks for following up for Harris you had submitted a question and then I believe council Borrego as a follow-up or a different questions councillor Harris I think we'll have to come back to council here so council Borrego you're up Thank You mr. president I don't know why but my audio keeps turning off for some strange reason I have to keep going in and manually adjusting it so I know that Matthew Whelan is in the group somewhere I think Matthew and my question is for solid waste last Saturday I went to the dump at Eagle Eagle Rock and I waited in line in my vehicle for two and a half hours to get in and I had a another friend of mine that actually went to the transfer station I guess that 100 I think it's 118th Street I'm sorry that's great council Borrego is that okay with you and you have a follow-up for any other Department and if not we'll go to councillor Harris and come back to you okay councillor Harris welcome back and believe you had a question for the administration about the public health order yes I do and thank you very much and this kind of goes to a broader concern I have is that the non-essential businesses if they're limited to curbside pickup it really is unfair to them because people can go into the big-box stores and Smiths and so forth and shop and look and and that really does put our local small businesses at a disadvantage I think they should go do the same thing and in particular I believe all of the liquor stores in the City of Albuquerque are locally owned except for total line you know a jubilation Kelly's all those are just local small businesses so in terms of the non-essential business of and assuming that might apply to liquor stores I'm asking the administration can our small businesses our liquor stores who are locally owned can they sell liquor curbside no the governor's new guidelines council president Davis councillor Harris this is one of the first questions we got on Friday so we did speak to the director of the alcohol beverage control division which is part of the regulation and licensing department of the state again we don't control this order as everyone on this call knows so alcohol sales are strictly limited to a business's premises which is usually defined in a drawing that they submit with their liquor license application and so sales may not be conducted outside of whatever they drew on that premises it usually excludes a business's parking lot of course drive up sales have been expressly prohibited in New Mexico for a long time as our deliveries so I believe the answer is unfortunately for most of our smaller liquor stores there is not a curbside option unless they have identified a larger part of their premises that happens to be outdoors now as a side note many breweries have patio areas where alcohol service is allowed and if they drew that as part of their premises when they submitted their liquor license application then they might be able to conduct curbside sales and that would include of course local distilleries that have the curbside as well they can't handle they can't handle liquor over the railing but they can hand it leave it sort of on the premises part of their outdoor patio so again we don't control that particular piece of regulation but that is what we understand from our 'old thank you I'm gonna go to counselor Bosson who raised your hand next and then we'll come back to council Borrego and director Whelan counsellor beside you mr. president I have a follow-up question miss Nair and I've heard the same thing exactly about the footprint of the property and and when you get your license so I totally understand that I've also and I've started researching but haven't found it enough yet but is I've heard that California and Texas have had the governor's have actually made an exception do to do to covet and and all of that for the purposes of this with the footprint is there any way that the administration would consider reaching out and in asking if that's a possibility or even if there's some potential hope I realized that I realized that liquor is not really or it shouldn't be everybody is top priority but this is another one of those small businesses that that you know if we can find a way to help them and find some way to keep them afloat well again they can go to these larger locations to purchase I think that it would be really nice if we could make that make something happen councilor council president Davis and councilor Poisson we'd be happy to make that request we've been regularly forwarding concerns that we hear from the small business community to the small business working group and the mayor also sits on the mayor's Council that has to do with kovin reopening so through both of those channels we will express those concerns I'm grateful thank you very much well it turns out liquor stores are a hot topic amongst counselors tonight I count sir Gibson as a follow-up yes I do Thank You mr. president and I'm just I'm just wondering because I I haven't tried to buy anything since all of this happened but would it be would it be legal to make the purchase over the phone give a credit card and then have them walk it out of this store because the sale would be over the phone you know once we got to the parking lot they would just simply taking out already purchased merchandise is that a is that a potential a solution Council President Davis councillor Gibson innovative strategy we haven't heard of someone trying this oh of course you know in our role we're just following up on an enforcement concerns and we have not heard of anyone giving this a shot again if that parking lot were included in the premises that seems like an easy to resolve question if it were not I think it would be more of a gray area but we would leave it to the state to make that interpretation thank you and before we go to council Rago I want to be sure we close out our liquor conversation councillor Pena I see you have your hand raised is this a liquor follow up or do you want to move to any topic follow up everybody wants to open they're looking for council opinion mmm you know dissimilar concern you know I can understand the concern with alcohol and you know with the footprint but if there's we can just really work towards you know talking to the governor about how we work around this because I think it gives some businesses an unfair disadvantage you know one restaurant that I have in my district is the Monte Carlo which you know everyone really supports in our community and they have a restaurant and there's providing food and then you know there's there's the breweries who are you know they have the alcohol so it seems very similar and it seems though in times of this crisis if we can understand what you know the issues with the footprint and what they applied for but it seems as though maybe we can get creative in terms of helping to open up some of our smaller local businesses like the Montecarlo council president Davis councillor Pena yes we'd be happy to discuss those concerns and then of course there is always the possibility of the legislative session and opening up some additional avenues for small business relief we hear that they might meet sometime this summer thank you first before we exhaust the topic of our package towards any other questions on that topic with the administration seeing none councilor burrito director Whelan is back would you want to pick up on your question about smaller boys I'm sorry I'm sorry council Borrego we have you unmuted but we're not able to hear you so we're gonna let Julian tinker with the knobs a second and see if what we can do here for you just a sec can you hear me now yes ma'am welcome back okay yeah I don't know what's going on with this computer but automatically keeps turning off the audio so I can't hear only part of what you guys are saying so last Saturday I went over to the I did some yard cleaning and just took a load over to Eagle Rock convenience center and I've talked to Waylon a little bit and I have a call scheduled with him but it took me two and a half hours sitting in traffic to get into the convenience center actually took me three and a half hours just to go in drop off a load and sit in traffic I also talked to a friend of mine who had the same experience except it was actually opposite they went to the hundred and eighteen convenience center and it took them a half hour to go in and get out so I just like for somebody to take a look at what is the difference I I know that they were using every other stall which is great for social distancing but you know traffic sitting on Alameda and then the turnoff into the convenience center it was bumper-to-bumper and you know I just I just really want to know why the two convenience centers are so different would one take three and a half hours and one take a half an hour so if there's a way to to look at some you know because of course with our carbon footprint we don't need cars just sitting idling for that length of time where I go there's several issues that are different between the 183 reservoir and evil wrought for one done reservoir is probably 15% besides of evil rot and they are a much much smaller facility and they're also located way up going towards the landfill so a lot of people if I head up that way two majors for the landfill the other part is evil Rockies our busiest facility I doubt we're gonna have to throw our weight on Saturday and Sunday is pretty average it's been like that pre-seed 19 we even have traffic controls in place where we get traffic permits on the weekends to control the flow of traffic a bit more however because of what going on with c19 and with people being home everybody's doing a lot of yard work so we've seen a 46% increase in our traffic and our tonnage at all three more convenience centers so your friend who went to Donna reservoir really had to wait an hour she may cream and win on a great time because the average way to done reservoir just this last Saturday was about an hour and a half we have a traffic plan for that one as well so what we've been trying to do is encouraging people to wait for green waste but was in our mess that you which started today and will go over the next two weeks telling people have you clean your yards they'll take it to our convenience centers because those are already heavily used by businesses by people who do landscaping and then you take into account the extra traffic that's coming because of t19 it's caused us to have the same type of wait times that we have on the weekends during the week we actually have people doing traffic control telling people in their cars you can go to Montana contest very little wait time and but the problem is Bobby foster road but some people just wait in line Eagle Rock and drive all the way to Bobby foster another problem with is that it's centrally located right off of for sale a little more tape and come on up Alameda it's it's a very easy facility to access and having to have social distancing we're all the opening half the stalls to give the required amount of space in between so there's several several things going on there that we're trying to address on a daily basis as as when going through this I'm super a go we're gonna back to you and check your microphone button the button right above your number eight on your people or did see if they'll take you off there me now so yeah keeps turning off I don't know why I I just would like I did see the guy that was standing there telling you kind of directing traffic there were actually two different trucks and two different guys you know it would really be nice for people that are sitting there for two hours that maybe we have some kind of signage that lets people know that it's going to be an extended wait and I'm gonna tell you this because you know some people have their kids with them and you know I mean kids have to go to the bathroom or they need a drink I mean if there's a way that we can let them know that it's going to take that amount of time to get in and out of there especially on a Saturday or Sunday because you know there's not a bathroom close by there's not you know a place to get a drink of water maybe we can hand out some water bottles there's something to somebody that needs it I mean I happen to be in an older model vehicle probably I think I was an 87 truck and you know that truck we were starting to have some problems with our clutch so you know I just if there's the way that we can make that experience a little bit more palatable Matt you and I have talked about it already but I think that it's that that is what you know standing out there if they could just have some water or something because there are people out there that are you know I saw several vehicles turn around and I you know I you know they just got out of line because they weren't going to sit there and wait that long so anyway whatever we can do to make the public a little more aware of the time and just make that experience a little bit more comfortable mr. president and councillor Abrego will will look at getting some signage out there and doing a little bit more interaction with with folks that are in line we know that this is a really high time for folks using the convenience centers and with coalbed 19 it creates even a more difficult situation because of the distancing issues but your points are well-taken let us look into that and see what we can do to communicate better with the public thank you so much Britta thanks for bringing that up and director Whalen just to follow that you mentioned our green waste really quickly and then I want to go to councillors Ben Jones and Hasan who has some follow-ups as well but our curbside green waste pickup is happening this week as well right would you remind us sort of how that works so that folks know how our city can come pick those up at their homes so Greenway started today it'll run for the next two weeks next week people you have to do is on your pickup day will have also if you have any weeds or things that are cut branches we asked as you cut them in three to four foot lengths and bundle them together and then we've already seen a tremendous amount just today of Green Wing so we are encouraging people to just put it out now if you have it great and that's a great reminder thank you I want to go I saw councillor Benton and his hand is gone by now councillor if you had another question we'll throw you back in the rotation all right I'm sorry go ahead oh yeah well sorry I thought I'd been acknowledged yeah director Whelan Hey look under the current circumstances there are a lot of weekend warriors I'm one of them we're out there you know doing our thing our property would it be better for them to come on out with their load in the middle of the week understood mr. president yeah absolutely I really understand that to the extent that people can just hang on for a while with their waste would that be helpful I mean you know obviously we don't want to create a nuisance in anyone's neighborhood but but to be to be totally honest you know for some folks you know this is something to do it's something for that for them to do they're gonna do it during this time they don't have to interact with with people socially and so forth but if it's not an essential dump should folks be encouraged to hang on to their material for a little bit longer if you want to respond or we have as well you sir we're gonna go to counselor John who's named counselor boson and back to counselor barriga counselor Johnson I think I have a little different take on this you know the city was very wise almost a decade ago to start putting in these convenient sites around in different neighborhoods instead of having to travel across the city to do this or worse yet we had more and more dumping on the streets in Arroyo's we had some real issues and and quite frankly we my husband and I are weekend warriors we even love trimming trees I love trimming everything and some of our neighbors and some of many of the people around us and I thought Ernie I've heard people ask each other how long does eternity Halla nuclide has been depending on the time of day two in three hours and they're all willing to go and do it because they understand this is the best way to do this and in reality people are working now anyway so it's kind of a good way to find something to do and you get out the fresh air so I think that of all the issues and we have in the City of Albuquerque and state of New Mexico in the United States right now we should be darn proud if this is the worst thing that we have and the City of Albuquerque and again I commend all of the administration's in the past two three administration's excuse me who worked so hard to find sites and put these in place they are a great asset to our city and I so love singing used appliances dumped their verses on the street earn in health so thank you specially councillor Jones councillor son you mr. president well I had one very simple comment which I'm going to end with but I am concerned about dumping if we were to minimize certain things but I think it would be something I don't even know if it's a possibility but would it be worthwhile for the city to just at least consider maybe doing even like a one way in I wait and I realize that's gonna extend it but wait for the whole thing and then maybe have some porta-potties or I don't know how that would be I imagine it's probably not likely to be easily enforceable for social distancing but I'm throwing it out there to try to be positive and my number one real it's like I just wanted to say thank you for making this two weeks for the green waste because you reminded me about it and I need to get some more done and I thought tomorrow was my deadline so I appreciate it and thank you great and [Music] I'm sorry go ahead thank you that in fact the Eagle Rock station has one way and the people lined up all the way that they can line up but they leave the roads open the streets open toward the local traffic so the city has already done that they are the city is doing a great job suggesting is that possibly they have a sign so that people understand what the weight is going to be so that they know that you know while they're sitting in line because I did see several vehicles turn around and try to get out of line because they just you know threw their hands up in the air another thing and I don't know Matthew if you've thought about this or not but maybe you know all the A's go on a certain day ABC or whatever their last name you know so so that different you know or by zip code or something so that maybe that would help but also the guys that were sitting out there directing traffic as I mentioned if there is a way to have some cup porta-potties or you know at least give somebody a drink of water while they're sitting there because the average person that is cleaning their yard doesn't think to look on the website and say oh you know this is the average weight I mean they get in line and it's like Oh God you know so if there's just some things that we can do to make it a little better for the public so that they know what they're expecting Thank You president look at possibly putting a port-a-potty out there and as far as water we can look into what we would be able to do there but we understand I know it's a long way we'll definitely some sightings out there so that people know what to expect when they get there so thank you and and I see May green waste collection what would that look like is that possible is an extremely huge job for probably two to three hours a day so after two weeks they're pretty exhausted and under these circumstances we've had a lot of staff that we're short on but we do do it twice a year we do it for two weeks now and then we'll do it again in the fall time frame so okay so we'll get the word out all right thank you thank so here is you have the last word on this one and then we'll answer here very briefly I heard the director talk about that it's very crowded on weekends are there times during the week when people might be more advised to go I mean is there any time when it's reasonable or almost low comes with president and commentaries on the average there was normal Tiny's with we have some amendments that would soften this about directing to just ago she able to go home because of the the Supreme Court case regarding the grants mayor so I realized that the governor's order controls however I think that the City of Albuquerque should should have more control over great and I see a show of hands counselor downs I assume that's for the second and so will clear that and for discussion on the motion to suspend the rule 40 on tonight's agenda for final action councilors any questions or discussion on that item and comfortable zone are you wanting to jump in here as well we've seen that the governor is starting to loosen those rules and I'm not I'm not confident yet that we ought to be asking for something different in the City of Albuquerque that we're doing in the rest of New Mexico we understand that we've been fortunate in Bernalillo County that most folks following the rules we've limited our impact to a lot of families here but the rest of New Mexico counts on our health care workers in our health care system and those folks still need a break and so I'm just not sure yet I appreciate that they're making some other ID forward but in terms of time I mean I won't be able to support early for us to begin pressing concerns about whether the City of Albuquerque could move forward contrary I see councillor Benton and then councillor Harris bouncer Benton for coming Thank You mr. president yeah I will not support this motion I certainly would have no issue discussing such matters but not as an immediate action thank you you sure councillor Harris yes thank you and the immediate action is just to immediately start a conversation to immediately have the mayor start working with the governor to look at the needs of the City of Albuquerque just as it's totally inappropriate for the president or would be totally appropriate for the United States to tell the governor what to do I think it's inappropriate for the City of Albuquerque not to exercise more control and we have a very sophisticated professional city government and there are just so many things about this border that I think need to be loosened up now because these people are losing their businesses now if these the small mom-and-pop operations I mean they have a very thin profit margin they probably only have about a month worth of profit margin that they can lose or they're totally out of business forever so I just don't understand why we wouldn't want to just start discussing this because really all it would do is put the mayor in position out the council's direction to to start negotiating with with the governor to recognize that the City of Albuquerque is a unique place the City of Albuquerque and Bernalillo County if you look at the coab it numbers for over a month we've been perfectly flat and one of the things that I think is unfortunate about this is that it does not recognize that private enterprise that our business community are capable of using the same social distancing measures that are used in the big-box stores in fact they could probably even be safer so I think that we should start looking at this and just you know having some pride in our own City having some pride in our own government ability to get involved in this discussion which is really all we're asking for an immediate tax basis a councillor Busan will try you again really quickly and then we'll go to councillor Pena for comment well we're gonna call it we're gonna conference you in by phone so we'll give you a call and we'll be able to put you in that way councillor Pena while we're waiting on councillor Busan I know this is her legislation so we want to give her a chance to comment councillor Pena then councillor Benton and then we'll go to councillor bass on this evening I understand but I did work with councillor Sean to actually stop in the language to really just talk about with the collaboration and to to actually encourage so so that it wasn't a strong of language but so that it kind of creates a pathway but if it's like I said if it's not the will of the council to move this to here this this evening I understand thank you okay ma'am next up we have councillor Benton and then councillor Harris to respond and we're gonna loop Council to sign in through another portal here that's forbidden yeah Thank You mr. president yeah yeah absolutely legitimate issues for us to be discussing so I appreciate people ringing these things forward yeah the executive in this case is in the position of having to make some quick decisions and those are tough decisions it isn't that we should not be discussing this now my personal view is the top issue right now should be protocol protocol protocol that's all that people should be talking about forget all the rest of yeah we all agree that we want our businesses to reopen so what is a protocol by which a small business as opposed to some business or all of them together collectively to have certain expectations in order to reorder and that's in my mind fairly simple Thank You mr. president Thank You counsel then for what it's worth I agree I don't think this is a conversation we shouldn't have and it's not sure it's the time and I'm not sure it's the role of the mayor and negotiate with the governor over public health pieces but having filled that gap I do see backgrounds thank you Thank You mr. president sorry about that uh you know I have to say that this is I feel like the most opportune time to call on the mayor to have these conversations specifically to the governor we all know that in two weeks so many things can change and this is not about backing anyone into a corner this isn't about any kind of demands this is about being proactive and just like what councilor Ben was saying with protocol we're not quite aware of the protocol and and I know that also those for the mayor and the governor too because of the rapidly changing dynamic that we have however that's not to say we can't have a flexible plan and the mayor and the governor you know with with some collaboration can't say all right here's a plan a if this may happen or plan B but that way we can have some expectation as a city and our business owners and the students here can have some kind of plan so that they know all right we're working this out and we should start working for the P P P P E and we should start making sure that if to find out if our employees want to come back you know just different different questions that can really help give some of the the opportunity to these people so that we can have the equity we can have the fairness and we can start being proactive rather than reactive this is not saying just Gold gusto and open up everything this is saying you know let's treat Albuquerque different than Hidalgo County or Mora or you know even McKinley and be aware of our city here and start making some proactive plans for that so I think that timing is of the essence and I really I really do hope that that you will consider that you and as a reminder the motion on the floor will be for suspending the rules for the purpose of creating our can if not I hope they would be able to bring it up in in two weeks and here is the next deal to me I think do you think this is something that we even have come public input and public talk about if this motion fails it gets heard and two weeks is that correct miss Ortega is gonna weigh in here I think normally it would look to the appropriate committee but we practiced surgery musics expertise was for us to just refer all of these meetings to our next sure it's essentially as your stated councillor Davis which is that if a bill is introduced for immediate action and fails to receive the necessary votes to consider it or if it's not moved for immediate action that the bill receives a referral to the appropriate standing committee but as councillor Davis stated we could hold this over if you would be agreeable to that given the current situation and us not holding committees at the moment yeah absolutely and that's been the agreement with all of our councillors is any councillors priority bill that they won't replace we would blur in a regular meeting agenda while our committees are suspended and we've done that in the past so I think we'll continue that at least do our next few meetings until we come back to committee so absolutely if the motion fails tonight for immediate action at your request we would just place it on a hold over for our next week they've done in terms of opening new businesses and some safe and effective ways of opening businesses and basically it's it's a memorial so it's not it's giving guidelines to our community of and there's been quite a bit of research that's gone into this and I give thanks to Jeff Hertz and Susan V Hill and Stephanie and some other folks that have contributed Chris Mullin dress but what it does is it sets out some ideas that they've done in other cities that the American Planning Association there's some policies in there it also looks at the white paper that the governor and the legislature recently passed that talks about safe alternatives for opening businesses and so there's quite a bit of information in here and actually I have a floor substitute that I'm presenting tonight so really I'm asking that the floor substitute be adopted and there is quite a bit of information in your on your iPads or in your computers that describes the governor's or orders and it gives you a chronology of all her orders it gives you an analysis of the white paper from the legislature and then or from the Finance Committee and then also it gives you the the analysis of the different cities in the country and some safe possible alternatives that we could look at not telling us this is not saying that these are in stone it's basically saying here are some alternatives that could be looked at when we do open when it is safe so it's not setting a date for when we would open and there is I would move the floor substitute no get council Borrego and we'll do that as soon as we if we get this Chevy on a stick on Gibson and sandpit San Mateo so there's a lot of projects around the city that are great projects so I did find my notes I'm sorry about that and I wanted to move em 20 - - and what it is is urging the City of Albuquerque to consider alternative and safe methods to reopen non-essential businesses and basically what the memorial does is it provides an overview of risk restrictive safety measures in place as instructed by the New Mexico governor the New Mexico State Department of Health and in Mexico finance department and they are killers declarations on the matter of Copa 19 with the intent of beginning steps toward reopening through creative APA American Planning Association inspired reopening measures and with consideration of all due caution as described by existence state and local government orders declarations and recommendations it also looks at the Albuquerque Code of Ordinances chapter 11 morals and code article 3 human rights section declaration of policy 11 - 3 - to the memorial calls on City of Albuquerque Code of Ordinances that indicates businesses should reopen in an equitable way and it provides the city with direction and expands upon the governor's April 30th update and reopen non-essential businesses by equipping equipping businesses with alternative innovative approaches and program programs for conducting businesses that are based upon what other cities have started doing over the past couple of weeks it urges the following City departments to start considering addressing how to administer it administer implement these programs and the exhibits because there are several exhibits and there's a floor substitute and then there are exhibits that basically talk about the lay of the land and what we could possibly do this is not directing us to do this is the same what we could do we could in terms of phasing and how different types of businesses are phasing it also exhibit to provides models from other cities establishing alternative innovative programs that is an example of that would be some restaurants that are using their parking lots to do the social distancing logistics of administering these alternative innovative programs and then the staff analysis on specific benefits in the floor amendment so I would move that particular bill and then I would like to talk a little bit about the floor amendments and how it changes what it changed in the original bill give me I'm so first up let's take a motion to approve m2 and I see councillor Poisson I think is that you as a second counselor will they're watching you they don't know what they're doing in reality this has no effect other than saying we're going to tell the mayor or something that this does not cause something to happen it does not cause a vote it doesn't cause any legal obligation to do anything it's just pointing out some things that the council would you like to see the mayor in the administration address we don't I just that needs to be made public is sometimes they hear something like this on TV or in a newspaper snippet you think this is something that we have voted to make happen and in fact this is a suggestion public health and safety considerations of the public welfare mandated by the state of New Mexico Public Health Department and I think that's an important distinction that this is still follows those You mr. president so I appreciate the work that's been put into this so Thank You counselor before I go and you know I am a big believer in sharing best practices I have seen that save a lot of money and and really contribute to a either a workplace or or or a you know project that that a group of people have been working on but right now we don't I mean we have some ideas you know and some things that really have proven to be really helpful but I have and I've gone through these well while we've been talking and I don't see it very much here there's there's a couple of examples but other other than that I haven't seen anything that we haven't either done here already or we've considered we've talked about it's under consideration so I'm not so sure how useful this would be when in particularly when we could probably replace it with you know just a conversation with planning for example the the examples that I did see here that I so far I haven't heard anything about it might have been maybe it has been discussed already but the reopening business and parking lots for dining actually we have talked about that this is under additional resources and the flexible zoning which I think he referred to and you talked about this might be a potential way to to extend sales for small liquor stores so I don't mean this to sound like a really strong criticism is just that I think Melendez just asking that if we put this in the Memorial which I don't think it does but just confirmation it doesn't move the resolutions for the next council meeting mr. president councilors know that being a separate bill and having a separate function in the form of a resolution I would not in any way anything you do to this memorial would not in any way any other piece of legislation that you're considering later in the form of a resolution okay thank you well then I would like to move it forward and this kind of just piggy backs on what counsel but I go I really appreciate her Memorial I don't think it's just an email I think it's actually something that helps to provide guidance and it says that this council really supports that type of guidance and and this is actually an amendment that gives a little bit of instruction in terms of how we partner also with the community so before I go on to read the amendment councilor Poisson did you want to add anything to that I think you said it very well I think that you know this is something that we're all trying hard to be sure to represent and do good things for people so I think that it's very important that we do what we can thank you thank you thank you so I will read the amendment into the record on page three strikes line 15 through 17 and replace what the following City of Albuquerque section 1 City Council expressed support for the businesses of the City of Albuquerque and urges the mayor mayor's administration boards and committees to and advisory councils that are addressing the coab in 19 health crisis to on page three after line 25 insert the following section to the City Council requested the mayor to work with local businesses business leaders to establish and distributed standardized health guidelines for businesses to follow in to ensure continued protection of the public health and safety against the spread of cold with 19 once restrictions are lifted on section 3 the council the City Council requests that the mayor establish a program to provide resources to business businesses for the purchase of health screening and other equipment needed to implement reopening protocols which comply with appropriate health regulations and directives so the explanation for this is this amendment adds language to the bill that requested the mayor work with other boards of commission that advisory councils to develop and distribute standardized health guidelines for businesses to follow during the reopening phase if further requests that the mayor establish a program to help fund a purchase of needed items for businesses to effectively implement the health guidelines your council opinion will take that as a motion for floor amendment number one and I take the council to sign I assume yep there's our second and so councillors we're gonna be on the discussion for for amendment number one and for those of you need to follow along I think mr. Moya has made that language available for folks to be able to see here and so I'll ask of TV to try to make a point to share that at some point share mr. Moya screen when they had a chance councilors excuse me I'm gonna go back to the show of hands for debate but give me just a minute because I have to swap screens in order to do that sir Ben go ahead I'm sorry counselor Benton you have your hand raised for a question and then I'm gonna go to counselor Sena and counselor brulee go counselor Benton you're still muted if you could try yourself one more time yeah all right welcome you know it's mean it yeah I just wanted to say that with regard to all of these issues they're important issues in times like these the executive decision is is largely you know the call but I totally agree with the need for protocol for all sorts of businesses and so that means different protocols for different businesses and we do need to listen to the experts who are the folks who are out there in the trenches operating their businesses so for that in that sense I support this but you know sometimes I feel like what we need to do as counselors is really a squash continue to ask questions as we do about about how the administration intends to establish protocols because everyone is different right a liquor store is different for my hardware store etc and going from there so I'm in support of the bill but I think we need to have a broader discussion and I appreciate the pressure the administration is under that doesn't mean they have all the answers so we do we try to broaden the discussion but but yeah I think protocols for every different situation is a big task and we need to get after that thank you Thank You councillor Benton next up I see councillor suna then councillor Borrego and seeing no others I recognize myself after that and then we go to the administration and then come back to the sponsor so first up councillor Center Thank You mr. president just in looking at the amendment and thinking about how to give some directions and suggestions to the mayor and thinking about what we are looking at to open I also would like to have some discussion about how businesses can also tap into federal resources right now to tap into reimbursement for paid sick leave you know we have the family first federal bill that passed that's granting over $5,000 a week for those that have been directly impacted by Co mid-nineteen and I just hope that business is know to tap into that and if we're thinking of guidelines and suggestions how the marry can help businesses supply and look at keeping ease I would hope that we're also making resources available to businesses to know that there's also paid sick leave and family leave due to the emergency that were working so I hope that some of that language would be added more considerations become sorsa counselor Borrego and then I'll go to myself if we don't have any other counselors and then back to the sponsors and we want to give the administration a chance to comment as well so counselor I was gonna say that I think that this is a great amendment and but I do have a question about it does this when you talk about offering assistance to businesses are you are you also referring to like hand sanitizers pee bees wash stations and things like that is that or I mean we don't have a limited list here I'm just asking the question is are those things that you were all considering mr. president go ahead Kyle's opinion okay thank you um yes counselor counselor but angle so just to explain a little bit about even the resolution that I have moving forward it'll be at the next council meeting but adding this to your memorial is just talking to a lot of the business owners out there in the community there's some large employers who are out there who are saying that you know they've been preparing since day one for reopening and they've been able to secure some of the things that are out there right now that are very scarce and hard to get a hold of like masks and thermometers and they were saying that you know it would be great for the City of Albuquerque to be able to partner with them where they have access to some of these items to create and for the lack of a back of a better word I was telling councillor Hasan is that to create some care packages for some of these small businesses to ensure that they're able to open in a timely manner and so that they are able to be able to access some of these items needed to to open and that way everyone's successful and we continue to do great in the City of Albuquerque has been stated time and time again is that the governor's doing a great job the mayor is doing a great job and this is really kind of the business community coming together with us to try to help us do that and just to follow up mr. president I did listen in today on a webinar with the Hispano chamber and they the county mentioned that they're also interested in the same type of assistance to small businesses so I think you know this is really on the right track and I will be supporting this amendment mr. president if you don't mind me saying you know I'm councillor Senna I think her considerations are important as well and she can do that Vienna met yeah an amendment mm-hmm great before we do that I will go to the administration miss Nayar I think you've had a chance to look at the amendment and so I want to give you a chance to comment since there's some language in the amendment that would request the mayor or the administration that take certain action it's not as I read it an actual resolution that will require such but it's an urgent you would like to comment on the proposed demand or Thank You Council President Davis and councilors you know the basic Memorial makes a lot of sense to us again as it engages the larger community through boards and commissions a lot of what is in the amendment are either things that we are already doing or things that may a little concern that they may over promise and I'll give you a couple of examples so in terms of guidelines for business openings we expect the Centers for Disease Control has already put out extensive guidelines on what is going to be required when business is open including sanitation practices contact tracing quarantine and isolation affecting both employees customers and the premises themselves so I just want to be clear that this the city would follow those federal and state guidelines and is not likely to be promulgating a whole bunch of new stuff on our own we also don't have when we have a great team in environmental health that includes an epidemiologist but we just don't have the quite the resources to undertake what we know the federal government the state government are already doing also with regard to the PPE you know absolutely agree this is going to be an issue and love the idea of funding it just want to be really clear that the issue right now is supply chain so the governor has indicated that municipalities in the state would be expected to have 14 days of PPE on hand before the next level of restrictions are relaxed and we are working really hard to get there but we're not there yet and so the idea of us then being able to supply other outside entities other than hospitals and our fellow governments with PPE is is again it's a it's a wonderful concept but don't want to over promise in that regard as far as technical assistance to businesses please do refer them to our small business office we're talking to 1020 businesses a day on how to access the federal money federal program state programs and of course our own programs so that resource exists already and we had a huge volume of calls early on in March in the first half of the vapor but those calls have started to trail out we've done webinars we've done joint webinars with the state but certainly if there's a any segment of the economy or part of town that you don't think has really gotten access to that small business office please do let us know and we'll make sure to connect folks with our small business office and those resources Thank You mr. president Thank You mr. IRA council pana respond and I have a question and then we'll come back to the sponsors again okay so I just want to add to that in terms of the guidelines in my in the resolution that I have for next council meeting it actually talks about that is following and we obviously we can't make up new guidelines are due and make additional guidelines maybe I should have been more clear in terms of putting forth something that was clear about how we how we market the openings for businesses to be successful in terms of how we market what the guidelines are because I've been told by several small businesses is that what's happening is that there's so many guidelines so many restrictions that the City of Albuquerque should be able to have a process as to where it helps the community kind of simplify that and understand it so maybe that should be more along the lines of how we educate the community thank you and I just want to see no other comments let me just ask I think the memorial itself is good I like the floor substitute I think it's right as I said I think it sets the right path that it starts getting our boards and commissions and ensures that we're think couraging them to participate in this process so that it's not a top-down approach and thinking ahead I share that I sure miss Meyer is concerned only that the amendment is written so far it does exactly what we would asked which is asking the mayor to work with local business leaders to establish those protocols and share them but to establish and distribute them for for all of those business I think maybe a little unwieldy at the moment when we don't have that data yet I'm just looking through the budget I was looking and found there's about 5,000 new business registrations just in the city alone last year and I think that might figuring out how to make those adaptable to all of those businesses would be complicated no not on wieldy for perhaps our small business advisory committee and I share a concern that maybe the public doesn't understand the difference between a memorial and a resolution or an ordinance and it does sort of set it it may set an expectation that the city is going to start providing PPE for businesses to provide curbside service for example and so I'm not sure they're there rightly placed here but I would support these as goals for the resolution that the councillors have proposed that we'll be discussing at our next meeting I think those would be rightly placed and I think with a couple with that interim time to work with the administration on how to do that we could figure out what that would look like and so I think they would be better placed there I'm not sure I'd support the amendment is written right now but I do think we can get those goals to the other legislation that the councillors are talking about so I would support it there but maybe not for this one but I'm open to other discussion and so any other discussion from counselors or the sponsors councilor Bretagne I could certainly be persuaded otherwise but I just that's why I'm thinking at the moment going once going twice accounts are paying in a canvas on to close on floor amendment number one to floor sub memorial to are your support everybody it's well said urge your support I think we need to do what we can with any kind of guidelines and being proactive thank you miss Ortega to take the roll on floor amendment number one cancer center no councillor Benton no counter Pena yes councillor Poisson yes councillor Borrego yes councillor Davis no counter Gibson yes councillor Jones yes councillor Harris yes that passes on a 6-3 vote queue and councillor Borrego we're back on your bill as substituted and amended aired your support was any other discussion and I want to throw it back to mr.
