[4:27] **John Caven (Assistant City Engineer):** in two phases part one and part two part one deals with identifying surface water and groundwater contribution areas two deals with management strategies the process was started in the fall of 2018 and will be completed by the march of 2021 we're here today to fulfill the public hearing requirement upon completion of part two of the plan and to expand more we have um mayor like you had mentioned John Greer senior hydrologist with bar engineering he has been helping us prepare the plan since the outset and has been a very valuable resource and with that if I may uh turn it over to John for a brief summary of the plan

[7:02] **John Greer (Barr Engineering):** can everybody see that I hope yes okay thank you so thank you mayor and council members as Mr Cav said I'll give a brief overview of the well protection plan and then be happy to answer any question that you might have um as Mr Cavin mentioned the we protection plan has two parts you may remember from um the public meeting in September on part part one of the plan that uh that part of the part plan included the delineations of the water protection area and the drinking water supply Management Area knocker for vulnerability tonight I'm going to focus mainly on part two which um includes an inventory of potential contaminant sources and also talks about the
[7:48] **John Greer (Barr Engineering):** associated issues and opportunities and the management activities related to those potential contaminant sources your previous plan was approved in in 2010 and they need to be updated every 10 years which is why doing this now um again as you remember from uh the back in in September um this was well protection area that was delineated had two parts a groundwater capture area and a surface water contribution area because some of your wells do capture water from the Vermillion River U Aqua for vulnerability and the surface water catchment area vulnerability Al all classified as I and the health department approved part one of the plan back in February of this
[8:35] **John Greer (Barr Engineering):** year two uh we talk about the the data elements that the health department identified that are applicable to your uh Management Area uh did an inventory of potential contamined sources uh we discussed the changes in the drinking water supply management area that are planned for the future uh also issues problems and opportunities related to the potential contaminant sources and identify management strategies for dealing with those potential contaminant sources and it also includes a well protection PL evaluation program and identifying your alternative uh water supply contingency now as you know nitrate is a
[9:22] **John Greer (Barr Engineering):** a big issue for the Hastings water supply that goes into the potential contaminant Source inventory there were a total of 16 categories of potential contaminant sources that were identified within the this area some of them uh while they had to be inventory They Don't Really uh POS much of a risk relative to your water supply the potential contaminant sources that are associated with with nitrates for example land application of fertilizers on uh agricultural land that's a that that's really one of your your biggest issues ues and the well protection plan also identifies the the goals of your well
[10:07] **John Greer (Barr Engineering):** Protection Program which are to maintain or improve the quality of your the city's water supply to work with the applicable state agencies and the local units of government as you can to help uh reduce nitrate concentrations in in groundwater uh to provide information and promote activities that protect the aquifer that's used by the city's well Wells and to compile data to support future updates to your well protection plan that's a very brief overview um and the identified the categories of the management actions Vol to well management information for property owners uh maintaining your potential contaminant Source inventory database
[10:53] **John Greer (Barr Engineering):** making sure it's up to date so you know what's in your management area uh providing information on where the drinking water supply management area is to the emergency responders for example there are um where there are Transportation Crossings you know highways that cross over the rilion river Upstream of that portion of the Vermilion that loses water into the aquifer that then gets captured by some of your wells if there was say a a tanker that truck that would roll over on one of those Crossings and dump it the contents of the tank into the river that could ultimately potentially affect your your water supply so it's important to let the emergency responders know about the
[11:40] **John Greer (Barr Engineering):** details of your your management area and what your issues are uh also PL land use planting for example um there's agricultural parcels within the city limits and you know how that land is is used could be important to protecting your water Supply educating the public and then collecting data as as it becomes available from other sources or through City projects to help inform future updates of the plan and that's as I said brief summary and I'm happy to um answer any questions you might have thank you John

[12:28] **Jenna Vaughan (Councilmember):** thank your honor um John this might be you or um even John G too are we making progress I mean I remember 10 years ago when we approved this and we got the same stuff that we had education and work our way but are our nitrate levels are we doing better I mean we're kind of at the very end of this and and do we need to have a new approach to this do we need to have soil and water or a local a local plan regionally um that helps fun something different or I just want to make sure we're making Headway and not just stay status quo
[13:10] **John Caven (Assistant City Engineer):** yeah I think we are um staying ahead of the curve I mean the nitrate level is not increasing um the wells where it had reached the level of eight are not going up and that's very important um as we know once it reaches 10 then um a new treatment plant would need to be installed and that's very expensive so um we are monitoring very Qui uh very thoroughly and um I believe we are have seen a it tapered off and and it's not on the increase with the support of the plan here I mean some of these action steps um have helped um over the last 10 years some small Parcels of Farmland real close to um a well where we took it out production um where um cornfield where
[13:57] **John Caven (Assistant City Engineer):** you're injecting nitrate in there really close to a well that was removed so there has been some success stories over the last 10 years and and we will continue to make progress on that thank you

[19:43] **John Hinzman (Community Development Director):** thank you mayor City Council Members I will share my screen here and explain the actions that we're looking at tonight for Vermillion Acres so this is the site that we're looking at here at uh 1090 it was the site there it is here 1090 County Road 47 three actions available tonight or three actions requested tonight I should say related to this development here and we are looking at uh preliminary plat approval of Vermillion Acres which would just be a one lot subdivision and then we're also looking at uh site plan approval for the construction of a 75 unit three story senior housing facility this would consist of 60 units of Assisted Living 15 units of memory care and then also a variance to a section of city code that requires a 15% roof pitch for
[20:42] **John Hinzman (Community Development Director):** residential care facilities so each of these has its own uh separate resolution and separate action by the city council tonight I will note that with these actions a simple majority is necessary for the preliminary plat in sight plan how however the variance to city code will require a vote of six of seven of the council members and so little background information you may recall that we've looked at this before in a conceptual plan as part of a comprehensive plan Amendment resoning back in April of this year which was approved to accommodate the site uh the advisory committee planning committee commission did vote 70 to recommend approval of the request at last Monday's meeting there was a public hearing aspect as part of that where not
[21:28] **John Hinzman (Community Development Director):** ification went out to Residents within 350 ft of the site uh we did not have anyone from the public speak during the public hearing at that time the Commissioners did discuss traffic future Dakota County plans for County Road 47 and parking the only person to address the commission was the developer at that time prior to the meeting there was a neighborhood meeting held by the developer on November 5th at that neighborhood meeting we did have two people that attended uh similar types of questions that came up dealing with traffic and storm water we did have uh one email from the public uh that was forwarded to the council related to ensuring that the trail that's there at existing along the Vermillion River
[22:14] **John Hinzman (Community Development Director):** would stay in place which there are no changes to that and concern over traffic especially at the intersection of County Road 47 and Village Trail which is a little bit West of the site here so let's take a look at what we're uh we're looking at here tonight this is the preliminary plat itself very simple one lot subdivision the the development of the site is interesting from the fact that it's an 11 acres site but only about three of it which is down here is actually buildable the rest is within the flood plane the area within the flood plane would not be graded or developed by this development it would stay as is when you take a look at the the site plan itself this is what we're looking at here three-story Building located in here this location it would have at grade parking in this Wing here
[23:00] **John Hinzman (Community Development Director):** a singular entrance coming off of Cony Road 47 at uh at Riverwood Drive and then guest parking towards the east here a drop off area at main entrance at this location resident parking on the outside resident parking in the inside of the garage here this is a turnaround area for delivery vehicles uh at this location and you can note here towards the West that there is plans for a potential connection of this development to the West upon development of that property in the future to the north here you can see a trail system this would be a private system that would connect to the Vermilion River Trail for the enjoyment of the residents there and uh all of the development again would be limited to
[23:46] **John Hinzman (Community Development Director):** the areas outside of the 100-year flood plan area take a look at what the building would be on the inside first floor parking area you've got some of your memory care units to the East some of the the dining and other amenities for the development on the first floor and going up on the next two floors about 29 units of Assisted Living units community room Therapy Room patio so some nice amenities that are brought forward by this development this is what it would look like here it definitely meets our architectural standards for development three-story building as you see around down here you can see the ACG grade parking all sides of the of the building are similarly treated and uh look nice from a landscape plan perspective
[24:33] **John Hinzman (Community Development Director):** landscape plan provides for a lot of new planting separation of parking areas towards County Road 47 so a nice job that's been done there and uh that's what we have for the development here uh we do have within the audience the developer Mike Colberg and Rob bar if you have any questions for them I can stand for any questions as well thank you okay

[25:34] **John Hinzman (Community Development Director):** sure council member uh yeah the answer to that would be no the the existing Trail that's along the Vermillion river which is to the north of this site and on the east side of it there would be no effects from this development uh to it it would still be open to the public in in the same way that it is today thank you

[26:06] **Trevor Lund (Councilmember):** council member L thank you your honor um I think you know must have been oh man like 10 months ago or something when we all met at the golf golf course and and um talked about this and there were quite a few people there and um asking about um traffic concerns and so forth now you brought that up um and maybe you could just kind of recap what what the general plan is and you know maybe ease some concerns about um how this will impact traffic um and I'll lead into it a little bit I mean again not every not
[26:51] **Trevor Lund (Councilmember):** every resident's going to have a car um you know that's just kind of the general thought um based on their experience um they're not typically traveling at the same times correct of the day as as other people might you know during the busier times and so forth so um the the concerns are um you know is this going to have a big impact on on on the on the roadway so John if you could just kind of fill that in a little bit
[27:26] **John Hinzman (Community Development Director):** as your council member is part of the site plan application the developer did conduct a third-party traffic review of the site they contracted with a firm called srf who's experienced in developing these type of traffic analysis uh so a couple of conclusions that came out of there based upon their analysis they they concluded that there are no significant Transportation impacts expected as a result of the senior living facility what they did note is they estimated about 195 trips per day that would be in out of the facility key about this is when Traffic Engineers look at traffic they're really looking most specifically at peak hour times so what happens during peak hour in the AM during rush hour and consequently in the PM in this circumstance they estimate only 14 trips during am peak hour and 19 trips during PM so during the busiest times there's not much impact that comes out of here uh when you take a look at the the
[28:25] **John Hinzman (Community Development Director):** residents of this facility there will be many residents that will not have cars and those that do have cars are not going to be traveling during Peak periods of time when you look at the overall volume estimated it's it's going to be less than a regular apartment building so for example the Vermillion Shores a building across the street which has UH 60 units even though that's less units the traffic generation out of there is more than what would be expected from here so uh by the traffic study uh looks like they estimate that the roadway will accommodate the proposed use

[30:28] **John Hinzman (Community Development Director):** sure mayor uh with the the variance being requested tonight it's a little bit of an unusual circumstance we do have a requirement under city code that requires Residential Care Facilities to have a 15% riff roof pitch this is a a flat roof situation here in researching why that provision is in there uh I I believe it was there so that uh it would give more of a residential look to these type of buildings because most of them were located in adjacent to residential areas this provision has only been implemented in a couple of different instances throughout the city because these aren't for necessarily senior apartments but more for the care facility so when you take a look at Augustana uh facility and uh that's really the one that I can think of in which this would have been applicable to them the other senior facilities that we have in town right now would be uh
[31:22] **John Hinzman (Community Development Director):** General General senior facilities so when we take a look at the requirement we take a look at the the provisions for why we would be looking at a variance uh primarily looking at storm water drainage on the site having a flat roof would provide you better a better management system for storm water it also minimizes the height of the structure as well which was a concern that came up earlier within the residents at earlier meetings so I can stand for any questions related to that

[33:30] **John Hinzman (Community Development Director):** thank you mayor City Council Members I will put my screen back up here and show the columbarium site that we'll be reviewing tonight and so St Philip's Church 14th in Pleasant looking to construct a colum barium a colum barium is essentially a Niche Wall area for the storage of cremated remains and so this is most closely associated with the cemetery and uh cemeteries are by special use permit within this residential district so we are asking for a a use permit today special use permit for the consideration of this construction uh will note that any action on a special use permit does require six of seven council members so the columbarium site would be located here just directly east of the sanctuary area off Pleasant Drive uh it would have 80 Niche compartments for the storage of cremated remains the Planning Commission did review this and held a public
[34:26] **John Hinzman (Community Development Director):** hearing on November 9th during the public hearing we had no one address the item uh we did have one comment prior to the meeting uh with an individual with concerns that the proposal is not appropriate for a residential neighborhood and should be located in a cemetery so they did they did vote to recommend approval of this on a 6-0 vote with one exstension take a look at the site itself a better view of where it would be located at here and then what it would look like it's essentially a curved wall with with the remains interned within the wall itself so we do have a resolution attached for your consideration here and I can stand for any questions that the

[36:31] **John Hinzman (Community Development Director):** member it's a very good point is part of the the conditions for approval of the special use permit we're requiring that there be a signed agreement with the city identifying the Perpetual maintenance care and funding at the facility along with the process for potential future removal and restoration if if the use terminates so we are looking for them to provide us a plan and for us to approve approve the plan for how this would happen so in case the the church for at some point down the road discontinues operation or moves to a different site that there is a way to handle the the remains that are here oh wonderful thanks you're on top of it then thank you any other discussion okay then

[38:22] **Chris Jenkins (Parks Director):** thank you mayor uh mayor what we have tonight is uh one a presentation by Mitch Workman of isg Inc the Consultants that we hired to complete the master plan for Lake Isabel Park uh what we're asking Council to do after the presentation here is to refer this uh presented master plan to the park and wreck Committee of council to identify some priority elements and development of an uh an action plan for for implementation of those um through the extensive planning process uh the multiple public meetings
[39:06] **Chris Jenkins (Parks Director):** and the social uh social pinpoint and and online um feedback tools that were used to gather uh information from the neighborhood and the community uh it it was pretty clear that um the desire for for new and expanded development of this park were uh they were wanted and of course that adds up to a quite a big price tag and staff recognize that the the price tag here that's that's put on this proposed master plan at this point uh is at the far upper end or or even exceeding what our 2030 and 2040 comp plans suggest for
[39:54] **Chris Jenkins (Parks Director):** neighborhood parks um there is important piece to note there that uh Lake Isabel Park is kind of a combination of two different types of parks one it is a neighborhood park and two it is also a lake access uh with some really unique features that aren't found anywhere else here in Hastings so uh a little bit of a justification there for for the the higher price tag U but again it is higher and Staff feel that uh we need some additional additional guidance from the park and wre Committee of council to try and refine it and um get some stuff going and and get uh get some Redevelopment happening um as early as next year so with that uh we've got
[40:42] **Chris Jenkins (Parks Director):** Mitch Workman here and hopefully he can share his screen and he's going to give a a presentation and then the both of us can stand for questions at the end perfect
[40:48] **Mitch Workman (ISG Inc.):** thanks Chris hello mayor members at the council um I'm glad to be here to be able to present this tonight I'll go ahead and uh share my screen here um bear with me just a moment can everybody uh see my screen maybe a head knot or a thumbs up or something okay looks perfect um so what I'm going to talk about is um the public engagement process that we went through the master plan self the cost estimate and just a a touch on some funding opportunities that we looked at um for the public engagement we we kind of had a three-phase approach um and it all started with the project website um which is what you're looking at here on the screen which included um an intro video a description goals um some 360 cam R views of the site uh especially for those who maybe weren't able to make it out there or wanted take a closer look uh at a later time and then also um
[42:01] **Mitch Workman (ISG Inc.):** an interactive map uh a short survey so we could um capture some thoughts and then eventually as we gathered this information um we started to put some Concepts up up on the website um summarizing the website comments from a from a mapping standpoint um we had a lot of of feedback about liming up the trees you know we want to see the lake that's that's your primary asset um some boat ramp or boat dock issues um a picnic shelter we know that the neighborhood and the community really is looking um at adding some type of Pavilion or picnic shelter for shade um and that's something I think that um we kind of knew going into this some wayfinding issues especially getting to
[42:47] **Mitch Workman (ISG Inc.):** that lower tier and then some potential additions um that the community might like to see which were various um items such as you know you know maybe just skat park or Community Garden or those other things so we collected everything as well as the survey results um the survey results um we have a summary sheet here um just kind of getting a gauge you know how often are people visiting um so you know once a month 30% once a week 26% and daily 11% so over half you know are going to visit this once a month um looked at the current amenities um and how and also we looked at how people are getting to the site so most by vehicle or walking
[43:34] **Mitch Workman (ISG Inc.):** um took a look at you know do we think there's enough parking most people feel that there is enough parking now um and I think this is this is this is an important question and kind of helps um tee up you know that this is more than just your typic difficult neighborhood park is what current amenities draw you to visit to Lake Isabel Park and the fishing pier is is um kind of on the top of that list um so that was something important to note um and then we also you know asked what what things are most need of replacement or renovation um that would improve your enjoyment at the site the fishing pier was one of them um playground equipment those were kind of the top two but you know a lot of other
[44:20] **Mitch Workman (ISG Inc.):** pieces you know the boat launch and you know basketball court and you so various things that folks wanted to to see um get improved here and then looking at the playground or ranking the amenities um based on you know what kind of maybe an order order of magnitude and you know showing that the equipment and the boat launch and then you trickle all the way down seems like parking lot and the open space for the fields are in pretty good shape um we felt pretty good about getting um the website hits we had over 4,000 hits um with 960 individual people uh and then of those people we had 83 uh unique stakeholders and Survey
[45:06] **Mitch Workman (ISG Inc.):** responders that actually made comments on the website um this is right about when covid started so this was a great tool to to help get public input um it was a great um you know one of these prongs of the three-prong approach um we we still did have some insight or on site um Community meetings where we had some boards and people wore masks and we went around and looked at Concepts so we also got some feedback from that and then we also had a little sidewalk chalk kit that we um passed out to to direct people to the website and to get their feedback um and as well as the city did some social media posts to make people aware of this project so um I think we
[45:53] **Mitch Workman (ISG Inc.):** did a we did a good job uh working with the city to to get the word out out there and we got a lot of good feedback um so moving on to the uh plan itself um talk about you know what the community wanted and then how we put that into the plan as well as from a design professional standpoint some issues that we saw um in the site so I'll go ahead and zoom in here a little bit you won't be able to see the uh the key on the side but I can I'm going to point things out so kind of the main piece that we started about from a design standpoint was this this walk right now the walk to get from the two tiers whether it's the upper tier to the lower vice versa is not
[46:39] **Mitch Workman (ISG Inc.):** accessible U there's a turn or curve in there and it's it's it doesn't do a great job of connecting the site so we started with this main connection Point um to help help tie everything together and kind of worked off of that um ultimately we took the accessible parking that exists today which uh is kind of an awkward transition for people that are trying to get on to the the boat or in onto the dock and we move that to more centralized a little bit north in the site and providing a an opportunity a gathering space or more of an entry sequence into the dock um from this this big trans this you know change here of taking out part of the retaining
[47:25] **Mitch Workman (ISG Inc.):** wall and adding a um straightening it out and making this accessible that's where we worked on our access point from the north so adding this Loop and then currently today the um sidewalk here on the East just stopped so we have a a nice spoing connection that kind of brings together the whole site whether you're entering from the parking lot from the neighborhoods to the North or to the east you can get to where you're going um with that kind of entry point um the entry point things that we looked at we also looked relocating the main sign uh kind of the front and center here versus kind of being tucked back a little bit and also based on some public feedback adding some type of wayfinding sign over here um to the west to help
[48:13] **Mitch Workman (ISG Inc.):** people know that there's an an entry to the to the lake down here or an access drive we had many comments from residents that said for the longest time they they didn't actually know how to get down to that lower tier um so that you know in terms of site access we we thought that'd be a a simple solution to add some wayfinding there and um to help direct people a little bit better um so moving on from access now we're going to kind of move to the the nucleus of the site um the the picnic shelter is like you said it's something we knew that the community wanted um the neighborhood uh has discussed having saved up some money to help potentially pitch in for part of that um and so we were trying to figure out the best spot on the site and we landed right here in
[49:00] **Mitch Workman (ISG Inc.):** the center as it you'd have great access if you were parked below or coming from one of the um side streets um you have views to the lake it it doesn't appear that way but when we're out there we noticed that you know you can actually see the lake here um and what we're also looking at is we we didn't want it too close to the street um for some of the noise but we also heard comments about we don't want to tuck it way into the site um we'd kind of like the neighborhood to have eyes on the shelter if you will um it's not a place that's monitored and also to have it lit at night so it could be used at night and also so no undesirable activity um could happen being kind of
[50:06] **Mitch Workman (ISG Inc.):** work together so seating opportunities new playground equipment and um only proposing a half court basketball at this point it sounds like the full court is not quite used as much um and save a little bit of money um so we have the half court basketball and then still providing these two large open lawn spaces um for pickup games of or picnics or whatever is desired some these two larger spaces um just to note the and the playground area is about 4500 square feet um from kind of that Center focus of the site there some of these little nodes um there's a big focus on viewing the lake the lake is your biggest asset um so
[50:54] **Mitch Workman (ISG Inc.):** we've we've identified in the the C estimate of of trimming up or limbing up a lot of these trees to provide those views out right now you it's very challenging to see the lake um so with with that and trimming up the trees we also have three little seating nodes up here kind of tucked back um that would provide uh different views and different seating opportunities um with maybe some benches or some different kind of rock outcroppings for seating um so you could have smaller gathering places um nothing you know nearly as big as like a a shelter but you know for smaller groups um and the next piece that you know we talked about viewing the lake and then the community also talked about interacting with the lake and people
[51:40] **Mitch Workman (ISG Inc.):** like to fish and people like to bring their boats here um so how how can we help people get down to the water more easily so uh here we have proposed a couple Rock uh terracing if you will um from the upper level to the water so folks can sit and enjoy lake views at a lower level here or have a more stable place to uh to fish or even if they're just looking for some more unique opportunities um to kind of climb up and down and and interact with the water that way um and the the second piece that was brought up um was having an informal boat docking area in here so we've we've got this kind of tucked back in here where if someone is out on the
[52:27] **Mitch Workman (ISG Inc.):** water and they want to just pull up and just kind of hang out for the afternoon there really wasn't a place to do that um very well so we have that included in there uh the last piece I wanted to talk about um didn't want to forget is the restrooms um portable restrooms are what we were planning but to kind of locate them more centralized up here where folks on the lower Terrace have quick access to them they're very close to the accessible parking stalls but if you're um kind of at the Upper Terrace areas there's you know with the shelter and playground it's a real quick right down the path and you have access to that as well um so that that's a summary of the master plan of um where we've landed and um we've also got the estimate with that
[53:13] **Mitch Workman (ISG Inc.):** and as Chris mentioned um it's you know it's a little more than the we were hoping for but seeing as all these improvements um the two Terraces and knowing that the the big accessibility issue that we want to get all these items fixed it was expected that we would have a little bit um higher price tag on that so and we broke it down into a couple different buckets phase one being the bulk of the work um and the Upper Terrace and making sure to get those accessibility improvements um phase two we focused on the lak front and the lower Terrace area so mostly the the rock outcroppings or the the steps down to the water and then
[53:58] **Mitch Workman (ISG Inc.):** the boat area um so most of the work would happen in phase one but the this could be happen later if budget becomes an issue um and because we were very pinched we also looked at items that staff could do themselves on this um and then we also to you know to help with cost and then also we had a large list of alternate items we had a great a great list um of improvements for the project and as you can see we had $336,000 of items that will probably need to be replaced removed or added as an alternate in case bids come back uh great when the time comes so the wood fiber surfacing for or Porton place and um you know concrete versus bituminous
[54:44] **Mitch Workman (ISG Inc.):** walks restroom screen enclosure and those types of items so lots of lots of good stuff that um the design came came up with and that the public wanted to see um wrapping up um knowing that this this project had a little bit of a higher price tag than um the comp plan would suggest we looked at different um funding or different opportunities to reach out for you know some of them up to 50% matching grants for the cost of the the project um so we provided these to to Chris and team to take a look at and and potentially help maybe get all the the work done at once or even add some of those um those
[55:30] **Mitch Workman (ISG Inc.):** alternate items back into the project as well that is um that is the summary for me and Chris if you wanted to jump in or add anything thanks

[56:22] **Trevor Lund (Councilmember):** okay I guess you know when when trying to understand what maybe a priority or or whatever or or maybe might be a phase one two three or whatever um it might be good just to know just have an easy way to be a able to go through all that and see what what goes together and what can't be separated too does that make sense Chris so that we can have an efficient meeting you know um because otherwise there's just there's so many things going on we want to make sure that we can understand what you know what things are reliant on each other and you know what phasing makes sense and and and how much each thing is as well
[57:24] **Chris Jenkins (Parks Director):** yeah council member I'm sure that myself and the team can work together to to pull those items together as best as possible

[57:54] **Tina Folch (Councilmember):** so Chris could you please uh just talk a little bit more about this phased approach and what do you necessarily mean about that are you um are you envisioning like the first year you're doing phase one and phase two is a subsequent year or um and then there's all of these uh you have removal and Improvement items by City staff then alternate items and items to be removed so um can you just talk that through a little what are you what are you proposing here how it's broken up up and and working through um how to tackle this
[58:24] **Chris Jenkins (Parks Director):** uh council member I I'll do my best here at get into each of those um what I'm proposing here is is to refer this to the park and wreck Committee of council to really kind of go through it with a fine tooth comb and develop an implementation plan um and the goal of that being in 2021 I think it's very important that uh that the after this planning process with the community input that there is some actions that are taken in 2021 um perhaps all of it can be done perhaps half of it can be done and staff are looking for that guidance from Park and wreck Committee of council help us to narrow down uh what the priorities are for this park Redevelopment and uh and go from there so phase one phase two the way that um Mitch and team have broken that out is basically in the geographic locations phase one being the main part of the park the Upper Park phase two being the the lower part of the park the uh the Water Access fishing dock access Etc that was the the most reasonable reasonable way to break out individual phases was by geographic area
[59:57] **Tina Folch (Councilmember):** oh okay well thank thank you for expanding on that a little bit and then um when we're looking at the map it's kind of hard to tell uh we're the trees are denoted which you know there's uh two shades of trees if you look in the lower right hand uh key it says yeah right there it says proposed trees and existing trees and so I I had gone to the open house and uh and I was there for a couple hours and talked to a lot of residents because W Cow Town W one Cowtown area is um my uh one of my neighborhoods and so um I I I heard as well this resounding theme of they really want to be able to see the lake and enjoy the lake and all of that and so it it looks like it's still really um tree heavy and so um could you just speak to that a little bit um what what are your what are the plans there with the trees it's kind of hard to tell um what's going to happen moving moving forward with those along the shoreline
[1:00:54] **Chris Jenkins (Parks Director):** sure and I think I can speak to that a little bit the the trees that are along the shoreline that are shown as as existing um not intending to remove a bunch of those trees one we have some concerns with bank stabilization there um but two we want to be and we don't want a clearcut view of the lake where all of those trees are removed but we do want to limb some of those up thin out some of the the smaller nonmature trees um that that aren't really going to grow and and uh be dominant shade trees in there so limming up existing trees and uh removal of some of the smaller you know three four five inch trees uh to provide a view from the lake it's not going to be a completely unobstructed view there will be trees there but you will be able to have lake views from from the upper area of the park as well
[1:01:42] **Tina Folch (Councilmember):** okay thank you for that and then in regards to the shelter The Pavilion which is number four um could you uh talk about that a little bit as well because I know that it's super important to that neighborhood um to having the shelter put in place but it looks like it's actually an alternate item or items to be removed on your list there um number 11 and so could you speak about the the thought process about moving ahead with that piece
[1:02:16] **Chris Jenkins (Parks Director):** sure we know absolutely that is a a very desirable component and in the way that it shown on that breakdown um it was it was shown as not a City cost because the East Side Home Owners Association has indicated that they have funding to contribute to that I don't know what that dollar amount is U but you can see through isg's estimate that it's about $38,000 for a a pre-manufactured um shelter the costs that were left in for the city to pay would be the concrete foundation or the floor as well as the footings for that preab
[1:02:40] **Tina Folch (Councilmember):** okay so were you planning to talk to the um H the association's uh chair it's no longer um Harold Christensen it's now um oh I'm forgetting the gentleman's name but it's transitioned um to someone else

[1:04:00] **Chris Jenkins (Parks Director):** correct y a referral to the park and wreck Committee of of council to uh to set a meeting and and as Trevor or as council member lond has indicated uh we can do a little bit more to refine uh the lumpsum costs for some items um if the goal there is to to reduce the overall costs that this would be better suited to send to parks to the parks and and Rec committee let you know let us dig deeper and look into it I think this is a topic we could probably sit around as a group collectively and talk about for hours um in this environment right now

[1:06:17] **Joe Balsanek (Councilmember):** Cil m b Sonic thank you your honor uh could you uh could you put that slide up that shows the items that would probably you're probably suggesting would be done by Park staff okay thank you because when this goes back to committee assuming we're going to vote on this to to send it on to the council committee um I think you need to take a look and see what other items are on the list that the part department needs to take care of uh there are items that I have requested going back three years uh that have not been taken care of and are obviously in need of repair care maintenance and so forth to the extent that I have gone by myself to Wilson Park and another Park uh to do some some maintenance because it was becoming an iord uh if the parks department can't keep up with what they have right now I am firmly opposed to uh City staff being uh put upon to uh do these other things for the new park so I I I hope when the council committee looks at this that we get a summary uh from the parks department of what else needs to be done in addition to adding these eight items onto their list it's been very frustrating the last two three years I've had constituents all over my my case saying why can't we get some of these things taken care of and I finally went and did some of them myself and I'm probably going to do a couple more of them even after I'm off the council because they're very simple to take care of thank you your honor thank you

[1:08:45] **Jenna Vaughan (Councilmember):** thank your honor and um to Echo cons bonic um comments there I I I brought it up earlier in our budget me I'm worried about our bandwidth how much space do we have to say that we're going to do it but we we have other things we have to do I would ask when we get into committee and I believe I'm on there and I ask committee chair c London watch maybe we made it that's a large amount of money and I I'm seeing five phases I'm not seeing two I'm being realistic here that I do not see I just don't want to get hopes up of everybody like oh look at this Great Park that's coming and and our budget for the parks is not that big and we have a capital project in there and I see a grant was applied for hopefully we have some more data of when we're going to find out about that but I want to be awful realistic to the community that this is not going to happen overnight and this is really going to be more of a five phased approach in my opinion that number is really high for a one park in our system so I just bring it up as a FY because when I come to that committee meeting uh I hope that we have a little more detail instead of just Phase One versus phase two I don't think we'll make it thank you thank you
[1:09:59] **Mary Fasbender (Mayor):** council member V I appreciate that comment because we do know our we have many parks 36 parks and I think there's going to be a little more need in all of them in the future so

[1:12:35] **Dan Wietecha (City Administrator):** okay I I I was expecting it was going to be uh Julie but I I can pick it up um this is consistent with uh actions that the council took back in March in April at the start of covid uh we have uh um businesses that um have been uh regulatory restricted on their operations um uh limitations on occupancy um uh limitations on uh hours of operation um specifically uh your your restaurants and bars uh and reason focusing on those uh isn't to single them out because we all of our businesses are important but those are ones that we have license city issued licenses in place and and some ability to um directly um uh have have some some impact some say on on their finances uh so uh consistent with the actions taken by Council this spring uh and and subsequently discussed um proposed waving those uh next half years's uh uh on premises uh license fee liquor license fees so uh it affects three or four different types of licenses but the the emphasis is that it's uh the the ones that are for consumption on site your restaurants and your bars not your um uh liquor stores your package stores but the ones that are actually on site uh I think Julie helped me out I think the total comes to around 43 $44,000 in in fees um but uh that that's the simple version of it it's a continuation or repeat of of what you guys have done earlier this year uh because the fees are by ordinance and because we're not going through the the two reading process uh it is an emergency ordinance that's in front of you um absent this action um our our schedule would be to send out uh renewal uh invoices first part of of December so this is your only meeting prior to to that that timing okay

[1:15:52] **Julie Flatten (City Clerk):** the total license fees throughout the year would be 86,000 and then we did 26,000 when we did the partial refunds for when they were um forced to be closed earlier in the year and
[1:16:03] **Dan Wietecha (City Administrator):** go ahead Dan if you had something to add to that or well I just wanted to add that the um both the the partial refund and then the first halfe refund was all reimbursed through the cares act so um although the the total um benefit to the businesses adds up uh the financial hit to the city is just this $44,000 increment
[1:16:25] **Jenna Vaughan (Councilmember):** appreciate that and I can support it because I think the hospitality industry um through Co has has um taken some restrictions that it's affecting them but I'm uh I want to make sure that we because this money we is part of our budget system and and I'm concerned that it's not a continuation of that because there's a lot of other businesses in here that not only hospitality industry pay fees to the community and that's how we balance our budget um I can support it because I think they're regulated I appreciate the cares funding offs said at the first first time but um going into the future I think we need to kind of in my opinion set the stage to say this isn't going to happen often um and I don't know what the restrictions will be going into uh 2021 but sooner or later we need to worry about our own budget or if so how are we going offset those fees um into our budget thank you thank you

[1:17:23] **Trevor Lund (Councilmember):** yeah thank your honor yeah I agree I I think everybody hopes that this is the last time we have to talk about something like this too right um uh it it it is apparent that they're not going to be able to leverage the uh the business that this is a fee for right so um as we you know go into this this next you know handful of months uh the the indications are that you know the the amount of use is not going to be High um and I think you know Dan put it pretty pry well you know there there are um other businesses obviously in this town um but we're not imposing a fee um on them in this manner um and and especially one that they're not going to be able to utiliz to its full advantage so um I I do think we we need to you know in this meeting if we do decide to go forward with this waiver um acknowledge that um there needs to be a a stopping point too um and like I said hopefully this is the last stretch where this is something that's going to be a topic of discussion for for bars and restaurants but I do support it I'd like to make a motion um in support of waving these fees
