Las Vegas and remain standing for the pledge thank you morning rabbi good morning thank you almighty God as the city council convenes we recognize that we are living in unprecedented times in modern history we pray that you give council members the wisdom the strength and resilience to help lead and protect us during these challenging times the talmud teaches us that there were only four people in history who have not sinned these four people were neither famous leaders nor exceptionally prominent personalities they lived relatively quiet lives it is the great leaders who have more openings to make mistakes the import of this teaching for us is that nearly all leaders no matter how great will sin in fact it is expected that people who are in the public eye actively leading and engaging their constituents will at some point error seven times the righteous will fall and get up but the Wicked Will stumble in their sins says the verse in Proverbs the development of righteous people occurs through their ability to take responsibility for and learn from their mistakes however the wicked just blame others for their problems and move on in the words of Theodore Roosevelt the credit belongs to the man who was actually in the arena whose face is marred by dust and sweat and blood who strives valiantly who errors who comes out short again and again because there is no effort without error and shortcoming and so almighty God we pray that you help City Council Members to lead with courage and compassion during these times of crisis help them to withstand the constant criticism and help them to constantly learn lead and nurture all members of our community and let us say amen amen thank you rabbi I pledge allegiance to the flag of the United States thank you okay okay on to agenda item five and because of the large number of communications my office received which were well over well well over a thousand and because as I heard from a variety of groups of people who wanted to communicate with the council this morning I had asked our clerk to make sure the word got out through our public information office that we want to hear from everybody that does want to speak but with the numbers estimated at a minimum of 200 people if I as mayor and chair of the council gave everybody one minute just that one minute would give us over three hours of comments which means our city can I'm talking about non-agendized items just are wanting to hear from everybody and listen to your comments and these are about items that are not listed in our agenda that has been out for several days in the public and so what I have asked and what we're going to try to do we will end the first public comment and I'm going to read that's where we're headed right now we are going to move through as much of our business as we can as rapidly but surely um politely and and on point as we can so that we can have the time to hear from everybody but in the second public comment time which means that we as Council will sit here until the last person has made his or her comments should the crowd grow to an estimated 500 people which is what I was advised that's 8.3 hours at one minute each so please as elected by the whole of the city of Las Vegas and as the person who's the chair of city council and presides over these that has been my decision this morning I have asked our city clerk what might be in trying to judge from the content of the agenda what do you think would be the earliest that comment time could be and looking at the agenda if there's no long dialogue it probably what did we say noon noon and remember too while there's comment coming from you the public who we serve we also now are able to hear from those online who ought to comment as well so I didn't get to welcome this morning Our Ladies Council woman Diaz down there councilwoman CM see men down there and so that's a we're going to proceed let's go forward yes mind if I just make a quick although it is no no I'm going right into this please because if I let you then I have to let everybody here and that's not fair to everybody about whom I've spoken so let's get I think it's unfair though that I we can't just make a statement we've made statements since two years that I've been here in numerous times it's all right this will be fine please I am the chair and this is what I'm going to do today it's a very delicate time and I want to hear from everyone so please public comment during this portion of the agenda must be limited to matters on the agenda for Action the name please yes my name is Paul murud I had it in my notes I'm a small business owner in downtown Las Vegas my comments are in reference to item number 30 on the agenda today appointment of City attorney I'm asking that the mayor and the council members consider changing this position to be an elected position not an appointed one Las Vegas often Compares itself to other major cities and competes with them for business residents and tourists if we want to compete and win against those cities we need to have the same or greater level of transparency efficiency and accountability in our city government elected City attorney has a Latitude to make independent and sound legal decisions without concerns that may get fired by the mayor or the council members who appointed them I'm sure that would be the case in this Council Reno Alexis City attorney so does Sparks Nevada most large cities in California San Francisco at Lake San Diego have elected City attorneys but most smaller cities appoint their City attorneys we don't want to be in that small City category mayor we want to be a world City Maria Mara Elliott who has served as San Diego City attorneys is elected in 16 said in a recent interview that keeping the position elected is crucial there's an elected City attorney can say what I need to say without the fear of being fired she said if the voters don't like the advice I'm giving who would approach my office has taken the voters are going to hold me accountable I personally had a number of bad experiences four seconds left I'm sorry I'm not going to be able to give you time for that one minute I thought the agenda items get two to three minutes no no no not in the front so you've made your comment about that and so we appreciated sub record and if you want to give it to at this point I don't know if Mr jervix here who is our city I actually had specific comments about Mr Urban experiences with the office or give it to right here to Jeff dorcak your I wanted to congratulate Brian Scott for receiving this appointment and I just wanted to touch on the um the many years of Brad jerbick Brad jerbick has been an outstanding City attorney and I just want to put that on the record that Brian Scott has a big shoes to fill thank you so much thank you I think they're trembling shoes wonderful thank you did you hear that Mr Scott okay foreign good the Southern Nevada the list just goes on and former colleague of mine at sap and uh I think you gave me my job once I think I did yes but I came to pay homage to my dear friend Brad dribbett who has done and magnificent job and I don't know if he's here uh today or not but I just wanted to take the time and come and say hey what an excellent job that he has done and the young man came up before when the city is facing the most serious Financial circumstances in its history while I applaud the efforts of the city attorney's office to reduce costs for the this litigation I will Express once again my desire for both sides of the dispute the property owner and the surrounding homeowners to come together compromise and reach a resolution that works for all parties I will continue to do everything in my power as a representative of everyone in Ward 2 to help achieve such an outcome in the meantime I must also do what is best to defend the citizens of Las Vegas and take the actions taken by city council and City staff therefore I will support this additional funding request for outside legal counsel thank you thank you very much are there any items Council wishes to bring item number 38 is resolution r-30-2020 discussion for possible action regarding a resolution declaring the intention to sell city-owned vacant real property located 10051 Moccasin Road this is in ward 6 with councilwoman Fiore note this resolution is supersedes r21 2020. okay and do I read 38 as well okay oh you did okay thank you very much I declare the public hearing an agenda item 27. is Mr Walker here for the record uh I don't see Mr Walker so I can address this this is an item that came before Council previously it was to uh give authorization for us to sell auction off a piece of land in on moccasin at the time of the original appraisal there was a a missed site that there was a utility easement that was on the land that wasn't discovered at the time and so after discovering the easement the property has been reappraised and so it's a great place to lower value so this is to give authorization to proceed forward with the auction at the near revised priced thank you very much agenda item 28. uh this is our report a report by our city manager uh Scott Adams discussion for possible action regarding a new one-year collective bargaining agreement between the City Las Vegas city employees Association lvcea in the city of Las Vegas two million nine hundred thousand dollars various funds and good morning good morning Madam mayor members of city council Scott Adams city manager item number 28 I am obligated to present initially under state law as your city manager is it this item is a report and discussion for possible action regarding a new one-year collective bargaining agreement between the Las Vegas city employees Association the lvcea and the city of Las Vegas the fiscal impact of this item is 2.9 Million Dollars and um should you approve this item this brings our largest group of employees our largest collective bargaining unit under a new agreement and I um I don't know if yandere is here I the herd he was here but I really want to give DeAndre a special acknowledgment of recognition I really appreciate good good so we can all thank you and helping to work not for comments but and then if you'd face the audience so they can see you and identify you and we thank you for working so well representing everyone that you do thank you well good morning Madam mayor and Council yeah I just wanted to recognize uh you know there this was very difficult because it did it just seemed like it was yesterday which was 10 years ago that we went through the painful process that we did in the Great Recession of having to to work with our our collective bargaining associations to reach agreements to balance a very difficult budget then this one was much more difficult and the level of cooperation that we've seen has just been incredible so January I want to thank you on behalf of our team for stepping up to the plate and bringing to the council I an agreement that is going to be very helpful because not only is there a I'm required to indicate what the fiscal impact is we save a lot of money going forward with this agreement so I wanted to make a special note of recognition what I'd like to do is introduce our collective bargaining team I I'm sure yandere may want to say a few words but I will introduce our collective bargaining team who will will present the highlights of this agreement for your consideration thank you thank you Scott mayor council members for the record Vince Samora acting Director of Human Resources as Scott said this um this Association comprises over uh 1 250 employees and members of the of this for the city and of the lvcea the current contract expires on June 30th so we were able to get the contract completed prior to the expiration of the existing contract um we had a total of four negotiation meetings the first meeting was held on February 10 2020 and this meeting was kicked off with a financial and um economic overview by our Chief Financial Officer Gary emeling Gary gave a very concise and detailed report to the negotiation team regarding our current financial status and our economic Outlook based upon our our revenues for sea tax and property tax so we started off the the negotiations with a clear understanding We Believe of what our position was going to be moving forward on April 2nd the city suspended the collective bargaining agreements due to the covid-19 pandemic at which time we were then moved into a situation where our city city manager our chief of Public Safety and our Chief Financial Officer Gary emeling met with all of the executive leaders of the various organized labor groups um we once again at that point in time explain to them what our financial condition was going to be moving forward and our city manager made it very clear that we had to concentrate on protecting our citizens protecting our employees as well as being fiscally responsible Scott Adams Tim hacker and Gary emeling should be commended for their conviction as well as their leadership during these meetings they were they were some very difficult meetings and the union leadership was uh was very forceful in their positions and we were very strong in our positions as well um the fourth con the fourth negotiation meeting was held on May 14th a tentative agreement was reached on May 21st for a one year for a one-year contract and the membership approved the the contract on June 4th so you can see after we met with the executive leaders of the unions that we moved very quickly and as Scott said the cea should be commended for their for their acceptance to the to what we were going through and their responsibilities for us are to us the contract Provisions include a zero cost of living adjustment a 3.3 a 3.23 one-time lump sum amount for all eligible employees there are some minor changes to the language to the language of the contract we cleaned all that up and we included that into the um the tentative agreement as well most of the articles are remaining the same status quo and the projected cost of the agreement as Scott said is 2.9 Million Dollars so with that we look forward to your approval of the contract Scott thanked DeAndre for his his leadership the um the balance of the negotiation for the team for the cea team include Nikki gomelo it was uh welcome to have her back uh Stephanie Stephanie demelius Tammy McCullum Paula Arias Ingrid Friedland Rusty Coleman and the ceas council Jeff Allen all contributed greatly to this process so we were in very good hands I do also want to thank our negotiation team of Sue Brown and Rick hunt they contributed greatly to this process and as with any negotiations having Morgan Davis by our side providing his counsel and his insight to the years of collective bargaining agreements over time has been invaluable so we look forward to approval by Council and I'm open to any questions you may have thank you and Morgan if you would just for a brief moment take your mask down so everybody can see you and thank you very much how many years you've been with us Morgan 25. just a baby thank you very much and thank you how about questions from Council yes please councilman Knutson I thank you mayor and Mr Crothers I just wanted to say that I'm I came back to the city because of city employees and city the city of Las Vegas is not what we see in the media all the time it's the people who are cleaning our parks and street sweeping our streets it's the people who are sitting back there in that window who are making sure this meeting runs smoothly and it is the city employees Association I'm incredibly grateful to be associated with the team members at the city of Las Vegas and thank you for making this happen because this is such a strange and difficult time financially for the city I'm grateful for you and for Ms gomala her husband did my yard I'm grateful for Nikki because I knew her when I was a city employee and she was wonderful to work with some of my favorite memories talking about purchasing and contracts and P cards when I was at the city so I am very grateful for all city employees but for your team in particular for helping make this a reality thank you for everything nicely said so thank you um well let's see who we would need emotion on this is correct yes um yes please councilwoman Diaz Madam mayor I move that we approve agenda item number 28. thank you the entire staff please okay we'll move on now to are you oh do you have more to report next time no you are the next item thank you okay uh report by Scott Adams city manager discussion for possible action regarding new two-year collective bargaining agreements between the International Association of firefighters iaff local 1285 city of Las Vegas three million four hundred twelve thousand dollars general fund and Mr Adams Scott Adams city manager uh Madam mayor members of council this is an item very similar to the last one which is a report and discussion for possible action regarding a new two-year collective bargaining agreement between the International Association of firefighters iaf local 1285 in the city of Las Vegas the fiscal impact of this item is three million four hundred twelve thousand dollars and on this one I really want to make a special note of thanks to toddling inglesby in the iaff they were the first to come to the table during this difficult time and cooperatively work with us to reach agreement and for that I really want to give them a special note of congratulations and thanks because when you get that First Agreement made through their leadership it starts to make the other ones a little bit easier so I really do want to provide that special note of thanks for either of them here Mr I don't know if Todd's here or not but and okay well we have a probably a big line out front and everybody uh uh but I did want to make that special note of thanks so with that I would like to again turn it over to our team to make the presentation of this agreement thank you Scott mayor council again Vince Samora acting Director of Human Resources we're going to handle this in two parts Morgan will take over in just a few the iff unit covers over 700 employees the existing contract is expired June 29th of 2019 we've been negotiating with the iffs starting in January of 2019 we had a total of eight negotiation sessions held between January 2019 and March of 2019 there is a provision within NRS that requires you have a a minimum of six meetings before an impasse can be declared we surpassed that amount and we continue to try to to work on the contract and I think we made a very good Headway in in a lot of the areas where we had language issues of the contract so we cleaned up a lot of those language issues for the contract moving forward impasse was declared on March 29th by both the for both the non-supervisory and supervisory contracts and I'll let Morgan go ahead and take it from here at this point thank you good morning mayor council Morgan Davis assistant City attorney just wanted to highlight a little bit of the process as a government employer we're obligated to negotiate wages and salary we can't just change them or set them even during times of pandemic so with this group is Mr Zamora indicated two bargaining units supervisory and non-supervisory over 700 employees we had been negotiating a contract 1285 contract expired in June of 2019. so they've been working diligently public safety heroes working without a contract for almost a year negotiations began we went through the process we weren't able to resolve the contract again according to state law we proceeded to the impasse proceedings at issue were mostly economic items wages was obviously one of the issues as to traditionally is four other wage items were open medical insurance uniform allowance paramedic certification incentive pay holiday staffing issues those issues were mainly the economic ones but the matter proceeded through the impasse process at the time the city was offering what we felt to be prudent traditional cost of the evening increase of 2.25 percent and fire was asking for three some other items that's about a 650 000 difference the other items that were on the table that we differed on were about another six hundred thousand dollars we're just negotiating a one-year contract at this point we proceeded through the first step of the impasse process we hold hearings with a neutral fact finder we had three days of hearings uh over the course of last summer that's how long it's been at the end of those processes 600 pages of transcripts legal briefs were filed we got a recommendation and uh to settle the contract the fact finder recommended that the marketing unit members receive a three percent cost of living increase uh also recommended that we increase the uniform allowance there was some other items that were still on the table we weren't able to reach an agreement at that point we were scheduled for arbitration in March when covet hit they already had that recommendation in hand almost immediately the revenues just fell off the The Cliff as we're all unfortunately aware of and as Mr Zamora indicated City manager's office met with all of the leaders of our major large bargaining units in some really difficult settings over I think about a month period every week or so with three six meetings giving them real life data as best we have it about our finances our projected shortfalls our possible reductions in in force the crisis as it met after the last of these sessions Management's team said let's go back and give it one more try I need to try to negotiate concessions agreements with all four of these major units fire remember did not have a contract in place they were our first meeting the meeting was was perfectly successful we reached a tentative agreement the agreement that we're bringing forth today and recommending for your approval not only settles that one-year contract that was almost over but put some peace and Tranquility together for the next year the highlights of that contract that we're bringing forth for you which will cover two years most significantly is a zero percent cost of living increase which is very significant the agreement calls for a one-time lump sum payment the amount of 5.5 percent but again remember that's over a two-year period one year that was almost completely done another year going forward if you if you had analyzed that that's about 2.75 per year and again the significant matter is it's a lump sum one-time payment does not recur it does not grow we don't have to adjust base and we don't make pers contribution on that payment given the fact that we were able to avoid reductions in force which would have meant for you reduction in service levels of those vital Public Services we think this is a great deal given the fact that they had already gone through the impasse process and had secured a recommendation from a neutral fact find over a three percent Cola which was consistent with what had been in place with our neighboring entities and they came to the table and willing to forfeit all the other requests they made turn that Cola into zero and accept what was designed as a strategy to get a settlement of a two-year contract and a non-recurring basis we just thought was was phenomenal given how far along they were in the process they really truly did a lot for the city we estimate that compared to what the recommendation would have been it's about a million dollar savings so what they had in hand and what they settled with saves us a substantial amount of money and it helps in next year's budget by not being a recurring cost so we are asking that you approve this contract um and I just want to say that wow I have some things to offer as well um I've been doing this for a long time I appreciate you ask how long I've been here your owner I know my boyish good looks and Youthful demeanor belittled this comment but I've been doing this here at the city for 25 years and I had a five and a half six year student private practice before I came here so I know it's amazing I'm 34 and I've been doing this for 30 years I've done a lot of negotiations over a lot of collective bargaining agreements and this even before when we were at impasse and we didn't have a deal Matt I noticed a significant difference in the spirit of cooperation and the professionalism from the iaf team so I just want to thank their team um Todd inglesby their president and James Suarez the vice president and quarter Whitlock their secretary and the rest of their negotiating team even before we got to the pandemic their their professionalism their cooperation their Spirit of working with us was something I hadn't seen in the 30 years I've been doing that they were just tremendous once covid hit and we were in once again emergency negotiations their cooperation was even awesome more important uh so I want to thank them I also want to thank acting Human Resources Director Vince Samora just from a personal level he and his team have been phenomenal his team primarily Sue Brown and Rick hunt Vince has stepped in and he like Mr Scott in a few minutes had some enormous shoes to fill dantar water left far too early and have been a great leader for us I've been along a long time with a lot of Human Resources directors Dan was fantastic we miss him Vince has jumped in he's filled those shoes admirably it was seamless the transition was not even noticeable he's just been a pleasure to to work with and he represents you very well his team's fantastic Sue Brown's one of my favorite city employees I tell her that all the time and she doesn't believe me Rick hunt also very professional your team has also been just fantastic I I want to acknowledge your city managers team these are difficult times I am proud that they are leading us through this is my second major financial crisis when I've been involved in the city and Scott and his team Gary Tim Jorge Tom Lisa everyone is just amazing they're they're leading us through a pandemic and a crisis and you're lucky to have them um I I think I want Vince to stay forever I want Scott to stay forever you all are lucky to have them um lastly I want to thank you all it is difficult at best to lead and direct during negotiations even during the most difficult period of time you have been consistent in your direction telling us what to do giving us save jobs services [Music] and continue to provide publicly respectful so I I want to thank you today for the direction that you've given us and how to handle these matters um we're asking that you approve this contract uh I wish fire was here to have some comments but if you have any questions or comments for us we're happy to address them here and for the past at least 10 years safety has been the priority and so how this fits in and your team working and Vince and Scott and his whole team um our fire just please extend that praise that Morgan and Vince and Scott I'm sure are trying to get out in thanks of this and I don't know if there are any for possible action regarding the appointment and employment contract of Brian Scott a City Attorney at 215 000 with benefits from the general fund um and uh look who's there and I would love some clarity before we get are you going to represent yourself first I was waiting for Mr Zamora up for the record a senior assistant City attorney Brian Scott always Mr Zamora first okay and uh can you tell me a little bit as I recall in years back and remembering this right well and I'm not sure behind her Doug Selby I thought they were the only ones with actual written contracts even though they the city manager the City attorney and the um audit independent audit individual the only contract was with this with a city manager can you explain good morning mayor council again for the record Vince some more acting Director of Human Resources in the early tenure with the city Mr jerbrick did have a contract over the course of time I believe that contract had expired as we received direction from from Council the the matter before you is to appoint Mr Scott and to approve the contract Brad can probably provide some better historical perspective relatively and I'm sorry to do this I just some clarity because I mean obviously we've put forth this wonderful attorney to become a bee man and I don't understand why things are maybe different turn it or not so a little history if you would please sure the uh Brad Eureka we have the city attorney's office for the last time the uh and first of all I want to congratulate Brian Scott I really can't think of a better person to become your City attorney he has been with the city for 24 years he served as our assistant City attorney for 20 years Brian has always been there in the clutch between night meetings day meetings anything Brian can do he's always volunteered to do it and I really congratulate you on such an excellent choice I really cannot think of a better person to answer your question you can do it any way you want to do it I think the reason you have a contract today is because you directed HR to do a contract I had a contract when I first started the manager had a contract when I started I had a very similar contract to the managers contract they did a classification compensation study a couple of years after I was appointed almost 28 years ago and it kind of was in conflict with the contract so I gave up the contract so it can happen any way you want to do it and in this case we've drafted a contract I've signed off on it personally and it reflects I think our negotiation and what the council wanted yeah okay so I don't know if there are any questions or comments I know on behalf of the full Council the accolades that you were received earlier this morning are just a little grain of salt there in comparison to the great gratitude that we feel for you and everything you've guided us through at least during my 10 years and I know before that with Oscar's 12 years just you've been Stellar you've been loyal you've been inspiring you've been truthful you've made her sad but you always tell us the truth and what the law is so it's a wonderful time for you to have the future that you're looking forward to but you do leave a huge hole and we are so grateful to you for the many things I just want everyone to know that what comes to mind right off the bat aside from all the legal advice that we've had on that tragic week of one October um inspired with you and a team of people that beautiful healing Garden was created and then from there that just grew and became something so special to us all and the families of those that were injured or lost and I think of the days and hours you spent with the buskers and trying to get the Fremont Street Experience so it was enjoyable for everybody but that the freedom of the Busker and performers to be there but to do it in a way that was acceptable to children as well as adults your hard work there which goes beyond hours and I think of so many things and of course our continuing dialogue with the families the Badlands that you've been so I mean the list goes on and on and I think of the hours you never have limited it to a 40-hour work week in the day since I've known you which is probably not as mayor but for 40 years at least so I just in speaking for everybody in the city that has no idea what you've been doing really the Gratitude is so enormous the the pride of of what you've done for this city and as we all go on to different lives at different times you know it is important that the word be out there of what you did and at some point hopefully write a book about those days which I'm sure will be voluminous but to get back to this and the contract that we are discussing so what's the difference of Mr Scott having a contract or not having a contract and do you have a preference on on that issue because obviously I know Miss fretwell and how about Doug Selby did he have a contract is this a collective voice are you asking my opinion about a mayor yes well you know I've already signed the contract so we've already negotiated it so at this point in time it's pretty much a uh waiting for you to ratify it but I've enjoyed my time with Mr gerbick as well as Mr zamura are trying to negotiate my contract um it is what it is it gives me some peace of mind it gives you some peace of mind uh I like like Mr drubick said I've been here for 24 years I've been the assistant for a long time and um I think that a contract always gives us an idea of exactly what our obligations to each other are and what we should be doing and what we shouldn't be doing and so I I'm okay with it I'm comfortable okay it wasn't to cause any problems at all but just for a point of information so if there are any questions or comments I am uh yes councilman Seaman yeah I just want to thank you Brad jerpick for all the hard work that you've done on Badlands in my ward and thank you for educating me on a lot of the issues I appreciate it thank you and so with your number of years his number of years Mr Zamora how many years you got here total with the city seven seven so you're a baby I am going to talk turn to our longest serving council person uh Mr Anthony to make the motion okay well thank you very much uh Brad it's been great working with you you're uh you're a great man and what I love about you is you never wear a suit which is always and I won't again can that be in my contract as well you you look good so uh welcome aboard Brian so I will make a motion to um approve the contract of employment thank you wow thank you [Applause] okay Marion Council for the record my name is Brian Scott and I am the 23rd and first African-American City attorney for the city of Las Vegas and it's 119-year history I'd like to thank all my family and friends who showed up today to support me it's really great seeing everyone here I know they all have busy lives so I'm really happy that they took some time out of their schedule to spend the morning with us I'm overwhelmed by all the support I've received since starting this next stage of my career I receive well wishes from so many family members friends mentors and colleagues that I haven't spoken to in years to my city council I want to thank you for this incredible opportunity to continue serving our community and for your unanimous vote for me as your next City attorney I'd also like to thank city of trading Brad jerbik and the City attorney staff for their overwhelming support I appreciate the council's confidence in me as we transition during these uncertain times I look forward to supporting you in the city in whatever ways I'm able I won't talk for too long but I'd like to say that I greatly appreciate all the additional support I've received from so many of my community and out of state Community friends and out-of-state friends and colleagues from various stages of my life who took the time to write letters of support on my behalf you buried us I I'm sorry they weren't right no thousands I have to tell you all thousands thousands of letters not just a couple of hundred but thank you and I really do thank them for their support uh some of the some of my supporters are in the audience today others are watching on television via and via the Internet I won't call them out by name because I know I'll forget some of them but I just want them to know that I'm very grateful for all their words of support in April of this year my family celebrated our 50th year living in southern Nevada this is my home growing up in North Las Vegas and graduating from Rancho High School home of the Rams I could never have imagined that my life and my career would be as they are today I've been very blessed my parents divorced when I was six years old and my mother mini Scott raised my sister's brother and I single-handedly it wasn't easy for her she worked as a housekeeper Care Union Hospital a daycare manager and finally as the owner of her own in-home daycare center she passed away in 2007 and I great I miss her greatly although we never had much what we did have my mother taught us to share with an open heart and without expecting anything in return she believed in God giving back to one's community and education her education was much different than mine my group mother grew up in rural Texas picking cotton as a child and was educated by a segregated school system my mother's high school diploma which I have here hangs up in my office in my very nice office in City Hall and she graduated from Hopewell colored high school in 1952. it hangs in my nice office amongst my degrees my diplomas and my Awards and my accolades she was only one of two students who graduated from Hopewell colored high school in 1952. when I when I'm having one I consider to be a tough day I look at this diploma and her picture and know that anything is possible we have faith a strong work ethic and perseverance I've practiced law in Nevada for nearly 29 years 24 24 of those years have been right here at the city of Las Vegas working in the city attorney's office I started off my career with the city working on the litigation team defending the city from various cases from various cases ranging from slip and Falls to condemnations for the past 20 years I've sat up here with all of you and advised two Mayors and numerous council members in the areas of marijuana regulation special Improvement districts land usonian planning ethics the open meeting law and many other subject matters for the past 19 years and six months exactly I've advised the Las Vegas city City Planning Commission during numerous late night meetings the longest of which lasted nearly 12 hours and ended at 4 40 AM I'm hopeful that through my work and my advice I've helped you to shape the city of Las Vegas into the world-class city that is today I have dedicated myself not only to public service for the city of Las Vegas but also to my community Through volunteering and serving my colleagues in my profession in a number of ways while working here at the city of Las Vegas I've been honored to have received many accolades from my community service work from various organizations and have served as the president of the Las Vegas chapter of the national Bar Association from 1996 to 1999. in 2005 I was elected as the 50th and first African-American president of the Clark County Bar Association thereafter in 2006 I became the first African-American president of the Clark County law Foundation after being a member of the State Bar Nevada Board of Governors for more than 11 years I was extremely honored to have been elected as the 88th and first African-American president of the State Bar Nevada where I in 2016-17 in that role I was the proud representative of more than 11 000 Nevada attorneys former United States Secretary of State Condoleezza Rice was quoted as saying people who end up first don't actually set out to be first they set out to do something they love I've loved the city and I've Loved practicing the law for more than 29 years I've had a great career so far it's my honor and privilege to be a Nevada attorney it's even a greater privilege to be a Nevada government attorney as my fellow government attorneys can attest it comes with its own unique set of circumstances and challenges give them my background I believe that I bring my own unique talents skill sets experiences and demeanor to the job of City attorney for the city of Las Vegas as I have done for the past 24 years I promised this Council and my city that I will continue to do my very best to guide the city and you lawfully with integrity and will always do what's in the best of the city of Las Vegas again I thank you for this tremendous honor wow yes [Applause] so we are proud and any comments briefly comments that we want to make please come on let's go thank you real brief that was like an Academy Award acceptance thank you councilman congratulations uh thank you for making us proud uh from from one Las Vegas to another uh God bless you I know you're gonna do fantastic and we play tennis against each other yeah Rancho versus Gorman yeah we probably couldn't beat him yes we won what you did win yes but God bless man it's it's you you make us proud thank you councilman I appreciate that I think we're so excited for you and just look forward to every day to work with you and please keep going thank you thank you thank you so much Mr Scott this is going to be amazing I've seen you in action you're tough you take nothing you leave no prisoners and uh so we're very excited for you to defend all of us thank you councilman I appreciate it so our doors are open hopefully you're in all the time as we go through everything we're doing comment uh councilwoman Diaz please thank you first and foremost I'm very proud of a fellow Ram is the next City attorney but I'm more excited for our community and all of our children that will look up to you and and potentially see themselves in the role that you're about to embark on so I think that is so powerful that is so meaningful and I can't wait to continue working with you in this new pain because I know you will guide us very well thank you councilman appreciate that yes thank you mayor and Mr Scott I just want to reiterate our conversation I trust you I have confidence in you and I believe my job is to support you so thank you thank you councilman I appreciate that thank you councilwoman Sam thank mentioned the Planning Commission I think I speak for the Planning Commission when uh when I say they um they needed you there during some very trying times some tough land use issues and those can be very difficult I know they appreciate you being there to help them guide through this process and uh my former planning commissioner Gus flangas who's a tough military guy he called me up and he said you better you you better appoint Brian Scott as the next City attorney and my current one Donna Toussaint called and recommended you also so uh I just want to speak on their behalf that uh you did a great job thank you I really appreciate that and thank their support and again I want to thank you but I'm so thrilled this is done if I get one more email about how wonderful you are keep them coming keep them coming I mean literally I left on a Thursday to clean when I came in the following Monday there were over on that Monday there were over 1100 letters oh geez wow and I'm trying to get back to the constituents I couldn't even find them you had more friends unbelievable could your family yes this is my recently retired brother uh Captain William Scott from Las Vegas Metro Police Department all right my nephew who is a metropolitan police detective Antonio Scott my brother-in-law Walter Walter Foster who was working for wacken Hut which is a federal contractor my sister who's Housing and Urban Development HUD one million 255 no and ninety six dollars in state funds for housing homeless and Community Development activities reference all Awards number 32 discussion for possible action regarding an allocation of one million 929 dollars for nine goodness nine twenty nine four sixty four and FY 202021 housing opportunities for persons with AIDS hopwa funds to the city of Las Vegas by the United States Department of Housing Urban Development HUD to benefit low-income persons living with HIV AIDS and their families all Awards number 33 discussion for possible action regarding the allocation 2 million two five five 102 and home funds by the U.S Department of Housing Urban Development HUD 391-278 in home and 863818 in state housing of 40 affordable housing trust and 2021 Community Development block grant cdbg funds to the city in Las Vegas by the U.S Department of Housing Urban Development HUD for project programs and services to benefit eligible individuals and families wow Laura did you get a lot of good stuff who wrote all those grants applications good morning mayor and Council Kathy Thomas director for the office of community services very very quickly and I'm sorry to interrupt I just wanted to put on the record that prior to becoming elected I worked with many of the organizations that could potentially receive funding from the decisions that are made today and so I will be recusing myself on items 31 34 and 35. 34 35 yes okay did you think it can still work for them the cooling off period would be one year which will end in about three weeks okay good I didn't think you did but I know your passion please go ahead good morning Madam mayor again Kathy Thomas Gibson I'm the director for the office of community services and I'm here with the chair and co-chair of your appointed community development board um Miss Carmen Miller and Ms Terry Jamison I want to thank them in advance for their time uh working on these projects so items 31-36 relate to the annual federal funding that the city receives from HUD and the state and these dollars are ultimately allocated to projects and non-profit agencies throughout the city who provide critical services the city receives these as annual formula grants meaning we actually do not have to compete for them we are because of this population size of our city granted a certain amount but based on a formula developed at the federal level and the funding is used to carry out a wide range of Community Development activities some of those activities are identified in our Consolidated plan and we are required by the federal government to submit a Consolidated plan every five years in order to maintain our eligibility to receive these funds some of the activities uh in our plan is includes affordable housing for seniors and Veterans low-income households we have a huge emphasis on reducing homelessness as directed by you the city council we also support youth programming through educational programs for disadvantaged communities we support programming for senior citizens and we also focus on serving special needs populations with these federal dollars this five-year Consolidated plan gets broken down into annual action plans so that we can have a precise summary of all those activities and identify which not-for-profit Partners will be receiving dollars the requirement from HUD is to push this information out to the community and so we provide a 30-day public comment period on our Consolidated plan which was made available on April 30th we advertise in local newspapers we have printed documents available at every client contact point in the city and we also make this available on the city's website um you read a lot of these mayor I won't go through these because the our two co-chairs are going to cover in detail the allocations of these funds um between the federal and state dollars we will be presenting you recommendations today for the allocation of over 11 million dollars across several categories and so I'm going to turn it over now to Carmen and Terry to present the recommendations for your Community Development recommending board thank you what a great time and thank you Kathy I appreciate it my name is Terry janison for the record I'm the co-chair of the Community Development recommending board I want to thank the mayor and for all the city council members for having us again today it feels like we were just here and it's been a whole year so we're very excited because this is the money that goes back into the community for the nonprofits the cdrb is an appointed Board of 13 community members we are appointed by you mayor Goodman and all of you city council members and for this process we're very fortunate this year to have five new members to add to the discussion this is I think my seventh sixth year and so I think my representative councilman Anthony for appointing me to it so it's always an interesting process this year the CR cdrb is making recommendations for two Grant programs the Community Development brought block grant cdvg and housing opportunities for persons with AIDS Papua we worked with a budget of seven hundred and forty thousand dollars for cdbg allocations and a budget of 1.2 million dollars for the Hapa applications Grant recommendations are being made for a two-year period the second year funding will be based on the first Year's performance and last but the past session was the first time we had done that in the two years and it worked out very very well um also this year new for the cdbg grant was there was an establishment of a minimum of a fifty thousand dollar award request good morning I'm Carmel Sean Miller chairperson of the cdb CD I always get it messed up cdrb a lot of fouls there and uh thank you very much Council for your cooperation and of course thank you mayor Goodman for appointing me this is my 14th year involved in this board uh the board hosted three public meetings two of which included opportunities for the applicants to answer questions of the board and to make presentations to the board award recommendations are based on established city council focuses one being homelessness seniors Youth and special needs the board is recommending four CD cdbg awards that focus on homelessness Services totaling 284 thousand dollars 647 Additionally the board is recommending that two cdbg awards that focus on Senior Services totaling a hundred thousand dollars and we are recommending two cdbg awards that focus on Youth Services totaling 205 353 000 dollars also the board is recommending three cdbg awards that focus on Special Needs totaling a hundred and fifty thousand dollars and five Hoppa awards that focus on Special Needs in the amount of one 1.2 million dollars the emergency Solutions grants dollars that are being allocated to the city will support the expansion of our existing more street-based Outreach teams and that was also a recommendation from your board and we will also have some dollars going towards the courtyard the amount of ESG funding will also support rental and utility assistance programming in response to the core coronavirus pandemic HUD Has Lifted the 15 Public Services cap for cdbg so the city can now augment its Public Services programming by over a million dollars to include emergency rental assistance and additional food distribution services to the community so the total funding as a indicated for 2021 is 11 million one hundred and twenty five thousand one hundred and ninety dollars broken out across four programs Community Development block grant is five million 239 630 emergency Solutions grants are four hundred and forty five thousand eight hundred and ninety eight dollars housing opportunities for persons with AIDS is one million 929 464 dollars and the home program for affordable housing is three million five hundred and ten thousand dollars one hundred and ninety eight these grants include future projects administrative dollars and dedicated dollars for the courtyard uh project in closing we appreciate all the time that the board members served and if there are other board members here probably not because we had a hard time getting in today we'd love to have them stand uh to be acknowledged we do ask a great deal of their time not only in the public meetings but they also [Music] um have to review all of the applications that are submitted electronically and we always have many more applicants than we have dollars to respond to those requests so we really appreciate the time that our board members have put in to review score and comment on all of the applications that get submitted each year at this time if there are any questions we'd be happy to respond want to thank you all I mean I mean but a wonderful job you've done so many years so dedicated I have a quick question before I turn it over to council for questions the last item on the last page said there was a TBD to to be decided you have three million left what are we doing with that we are can anybody apply I know because of this announcement as soon as they hear the word their funds available can people apply I don't mean people groups programs whatever and we are coming back to council with some recommendations we would like to stand up some medical respite to support homeless folks after during and after covid and if directed we can open up another application process for those dollars so how would that is that just Council requesting that you can direct staff to prepare a request for proposals okay I mean to me that sounds wonderful if you have those funds and but only with the concurrence of your major committee here so I would ask that but I'm going to turn now please councilman thank you thank you madam mayor first I want to thank all of you for serving on this board it is vitally important that we have persons of the community and through the community that are allocating These funds and I think it's it takes the politics out of the equation when you have people who are only looking to serve the community and do what's best and put those dollars towards it so thank you all and everyone on the on the on the board who are not here um Kathy my question to you is when we allot these dollars I know there's certain qualifications that need to be maintained in order to receive these Grant to cdbg Grants or what have you what qualifications do they report back to us on those and then we report back to HUD or whomever those grants came from and so correct councilman through the mayor to you yes we do have contracts that get established with each sub-recipient for those dollars we do monitor them we do desk audits every month and we do a full site visit annually and yes we do have to report all of that information back to HUD we have an established risk assessment tool that our internal Auditors utilize to determine if the sub-recipient is complying with Hud's National objectives with your strategic objectives and with the expenditure of those funds great and I love the idea about the respites you know we've talked about that for the past two years and it's vitally needed and I think that not only the city of Las Vegas but I think the county can also play a role in providing dollars for those respirates and even the state because if you aren't familiar with it it's a it's something that is vitally needed right now we're taking persons out of the hospitals and just bringing them over to the courtyard and really putting them on the street where they need to go into some type of other physical care and mental care in a facility that's transitioned to housing so it's a combination of Hospital transitional housing Workforce to get them back and I think that's why they needed I'm going to ask you Larry Mosley is here today with 100 black men I want to ask you to speak with him regarding maybe some opportunities that they can participate in because they are a wonderful organization that is only looking to serve in the community so if you could just take a moment to speak with Mr Mosley that'd be great and two I would like to add that Dr Ben Carson who's the head of HUD in this Administration has been out here of course been to the Courtyard spent time with you a great honor to have him here and so appreciative and I know when you have that personal connection and they actually the people that are on those leadership roles nationally that have the funds available and they can see it for themselves and what you're doing I noticed the autism group has made that clear what a tremendous award that is for them but I look at going into the future and we hear all the time how can you help how can we get in so I just as an aside would ask the team your team to go ahead and move this forward to allow applications and the clarity of what the qualifications are that councilman career was adjusting to and addressing so that they know what their qualifications are because they'll call all of our offices and if in fact we had just a blanket sheet this is what we need for and Schools 18 000 teachers working with over 320 000 students in our Clark County School District any qualifying citation issue issued between June 1st and July 14th the prior end date was to end June 30 would be eligible for the program and donations must be received by Thursday of August 13 2020 this does exclude Public Safety and handicap violations but other parking citations instead of paying develop a new hotel a mixed-use hotel in simply Park this is along Grand Central Parkway adjacent to a parking garage that has been developed by the city of Las Vegas our parking garage as you know is 694 parking spaces we are providing 200 parking spaces for the project in that in that garage and then we are also providing the land so the lands is in agreement with Jackson Shaw we're really excited to introduce Michelle and her design team here today I'll instruct Michelle to be brief because I know we have a large audience waiting at the end of the agenda but just to touch on the scope of the project maybe one shot of the elevation as far as the Finish elevation and rendering we're really excited about this project we think it's going to upgrade the quality of design in simply park in downtown and it's going to be a wonderful amenity for downtown and I wanted to thank Michelle and her team at Jackson Shaw for continuing to work on this project through the downturn in the economy and and to see it through fruition so with that I will turn it over to Michelle welcome thank you thank you mayor Goodman thank you members of council appreciate your time today we're going to present a proposed Marriott AC Element hotel and Symphony Park 441 keys on 2.63 acres of land I have with me today Andrea Schwab with Cooper Carey who is the architect on this project a special thanks again to councilman career and Ward 5 for your continued support very much appreciate it and thank you for Kelly as well working us through I appreciate that at this time I'd like Andrea to provide an overview of the project thank you very much we're so excited thank you good morning as Michelle said my name is Andrea Schaub with Cooper Kerry Architects and in an effort to keep this as brief as possible I'm going to flip through this rather quickly if you have any questions or want to go in any detail just let me know and I'll dive in wherever you'd like as Michelle said this is a 441 room Hotel it's comprised of an AC and element Brands it we have a total net of 19 500 square foot meeting space which includes a 10 000 square foot Ballroom the building as a whole is a total of two approximately 262 000 square feet um if in case you don't know where it is it is in Symphony Park proper in the uh that development Zone just south of the park itself and just east of the Exposition Center kind of sandwich between that and Smith Hall I'm going to flip through these very quickly because these are all just images of either current projects or development projects around our site um so the site plan or the the the ground floor plan itself uh all uh guests will arrive at the main entrance off of Grand Central Parkway that's where we have the main lobby for the hotel and you can see here the two spaces on the flank the main lobby um are the brand specific spaces and food and beverage components for the AC and the element Brands the guests that are coming to both of those hotels can access the tower through the two cores otherwise if you're coming for a conference you can move through the conference Hub and back into the meeting space which you see sort of plan South kind of follows through with that large Ballroom space and all the meeting space those all open out to an outdoor Terrace a long Symphony Park and we also have our outdoor amenities including a pool along that part of the site as well along Symphony Park the rest of the ground floor is basically basically comprised of all of our back of house spaces and this service is proposed to be accessed off of Promenade Place I'm going to flip through these really quickly these are the tower floor plans you can see the dark the dark pink and the light pink designate the sweets versus non-suites room types and again we are four stories above a Podium so five stories total I'm gonna flip through these very quickly to get to the renderings which are the fun part um this is the um the view from Symphony Park and Grand Central uh so the entrance to the main entrance to the um the property is sort of mid-block there we see the break in the in the two towers the ground floor across the entire project has been designed to provide lots of visibility for the food and beverage components the lobby spaces and the meeting spaces and the tower has been designed to sort of create a classic base metal top approach and provide some massing that speaks to some of the other projects around our site this is a view of from Promenade Place and Symphony Park another corner and also I didn't mention this in the plan but a secondary entrance for the conference center back on this corner back to the front door um this is just some some enlarged views of the front entry piece and some of our decorative screen components above the front as well and that's just looking back towards the element space and lastly all of our material components listed here and again it was very very quick so if you have any questions I'm happy delve into them one other thing that I did want to mention we did request and have support of several waivers from the symphony part design standards but SPD spdrc and planning have all we've gone through all of it and they're all support of those waivers I can go through them if you'd like or we can move on unless they're questions but I want to turn over to Mr Summerfield and this is a public hearing so if anybody has comments as well but thank you very much um and then the timeline for this Madam mayor members of council good morning still Yes morning the proposed development is compatible with the development your name sir please oh I'm sorry Robert zimmerfield director planning so the proposed development is compatible with development in the surrounding area and is consistent with the goals and intent of the downtown 2045 downtown master plan as well as the Symphony Park design standards as mentioned by the applicant there are some waivers that have been requested but those waivers have been recommended for approval as they substantially in conformance with the intent of the requirements of the symptom Park design standards therefore staff is in concurrence with the Symphony Park design Review Committee and does recommend the approval of the site development review thank you thank you very much this is a public hearing anyone that wishes to come up and speak to this agenda item 64. anyone online please no all right let's turn it over to council um questions from Council or comments councilman Greer thank you madam mayor timeline could you pursue with when we may yes be groundbreaking most definitely uh you know this is a great project first I want to thank Mrs wheeler and also Mr Shaw back in maybe he's back in Dallas watching us go Cowboys and uh you know this is this rounds out and completes so many projects that are happening at Symphony Park and it actually should be recognized that we are carried out mayor Oscar's vision for this in Symphony Park with the number of apartment units we have with the mixed use with the Smith Center the World Market Center I drove by yesterday and how beautiful it is is coming along and this is really going to add to that so I want to thank you guys for choosing Las Vegas and choosing Ward five and choosing Symphony Park I know that you're going to build a beautiful project you know they also used to manage the Renaissance next to the convention center on Paradise which is a you know beautiful property and so we're very happy to partner with you thank you on this and let's get this up and running and then let's work on the next product uh can you give us a timeline of when of your of what you anticipate yes councilman career and we really appreciate the commitment from everyone with the city of Las Vegas as you can imagine the covid-19 pandemic has really impacted our ability in terms of financing we were on schedule when we launched this in January with debt and equity and now unfortunately until Capital markets come back and the city is fully open and hotels are opening again it you know we will be delayed in being able to start in terms of our commitment we have continued to pursue and promote the pre-development costs and expenditures with making sure that once Capital markets are open we are ready to go so in terms of the entitlement process we are on schedule in terms of the financing and capitalization of this project unfortunately debt and Equity has preliminarily shut down until the hospitality Market comes back so you're with all of us and not knowing a specific timeline anything else Mr art that you wanted to um add to this please uh mayor again for the record Bill aren't economic and Urban Development uh I would just let the council know as well as uh Michelle and Jackson shall know that we value them as a partner we've seen their ability to deliver great projects in Las Vegas so we'll roll up our sleeves and work together on that debt and Equity package we realize that private investment Capital has to come into the project but we can be creative as well as trying to figure out a solution that pushes it forward as quickly as we can they were due to star construction later this year but again it's it depends on the availability of capital too so we are going to work with our partner to figure out a solution that delivers the project as quickly as we can yeah on behalf of Jackson shall we want you to know that we are committed to this development we think that this is an exceptional location it's an exceptional project Symphony Park is an exceptional asset to the city of Las Vegas so we will continue to be dedicated in our pursuit of making this happen when the Market's open wonderful and and I just I know how excited it's so unfair what he has going on every day I come to work I look out the window on Symphony Park and see all this construction knowing that Expo is moving along yeah they are moving along yes how uplifting it's just wonderful so we hope Demarcus back and we hope we get our people back to work and you're a lucky man thank you and I know the lbcba is you know they have conventions scheduled to come back and they're moving forward so one thing about Las Vegas we do bounce back that's right history has shown and we bounce back with full force T5 Ms T5 Main Street T3 and T3 neighborhood the applicant owners city of Las Vegas approximately 40 acres in Las Vegas Medical District generally located south of Charleston Boulevard East of Rancho on both i m is the Planning Commission staff recommend approval they are in Ward one with councilman Knutson or public hearings which I declare open okay Madam mayor I get to act as both the applicant and staff on this one uh this is a city initiated rezoning to complete the Las Vegas Medical District transition to the form-based code is a part of our downtown master plan if I could get the overhead the map that is that we're requesting that you vote on this morning is what you see in the overhead it is what I gave in briefings to members of the council yesterday this map is updated from what was originally submitted to the Planning Commission with some slight adjustments with regard to intensity levels based on an ongoing conversation with the community with the ward office and with property owners with that everything is in order this is the culmination of more than four years of work in the Medical District and I really want to thank the community this has been one of the most engaged communities in terms of coming out to meetings having dialogue with my staff on how we can do this better and I want to make it clear that this isn't the end of the dialogue under the form-based code we do regular every six months we do a check-in on the form-based code we tweak it based on what we're seeing in the development needs of both the property owners as well as the neighbors and so we encourage members of the community continue to reach out to us and work with our team as we continue to do those regular code updates with that I'm available for any questions what is the northernmost Road in this and I'd like to ask and find out why it is is this comprehensively for all the Medical District going to its northernmost or is it just a portion so ma'am we've actually already done all of the northern portion so that the the formbase code has existed for the Medical District um for over a year now however we did it as a pilot because there were still some ongoing conversations that previous uh award representative councilwoman tarkanian wanted to have with the residents on the south side of Charleston who weren't at that time quite ready since councilman Knutson has taken office we've had additional meetings additional dialogue with the members of the community on the south side of Charleston so the the part that you see highlighted that is the only area that is subject to this when we do this rezoning this will complete the Medical District under the form-based code and take it out of its pilot status and and the entire district will now be on under the form-based code zoning treatment so if I might Mr Summerfield including the property that's in ward 5. correct the the area of the Medical District that's in Ward 5 is already under the form-based code okay Andy even that's a new the piece way to the West yes and so the the Shetland yeah the the piece here on the north side of Charleston uh west of Rancho is the only portion of this rezoning that is um that's not south of Charleston so this is the area of the Medical District that was left out of the pilot adoption so that the community would have an opportunity to see how the form-based code was deployed um again like I said have some additional conversations and dialogue as these areas of but um some historic residential neighborhoods that had some ongoing concerns about how that interface would work between Charleston which is a you know formerly a highway is a significant in fact it's maybe one of the most if not the most significant roadways that we have here um and their their neighborhoods so that's what we spent this additional year working on and so if I may uh councilman Knutson before I turn it over to you is there I'm going to go to public comment and is there any comments or any questions from the council okay this is a public comment period on this item agenda item 43 and 44. uh and please come forward state your name for the record and if you're speaking to both 43 and 44 please let us know or is it just one or the other thank you and they see you already took his mask my name is Colin Jacobson I'm actually not really familiar with a whole lot of this but I wanted to point out something important is your residential location where you live is actually very close to this I'm not sure if that affects it I don't know if that makes you if it's like a like a I don't know the word conflict of interest you live right on the border here on Benny and I don't know where the water is it's to the South you're absolutely correct does this does this include your residence no is that weird that it's right next to your your residence like basically the line is right there it's um I'm just trying to think we are south of I just don't know if that's a conflict of interest I'm not like a professional or anything but I just thought it was important to point out the close proximity of your house I do live in that south of that area right on the line that your City attorney will help with that thank you I just want to know if it was no no no no I'm glad you're showing that out I didn't even think of it please um Mr thank you mayor Jeff dork activity City attorney despite your home being near the purple areas because these uh applications affect you no greater or lesser than anybody else you can vote on the item because it benefits you in any way financially the changing of the zone does it affect you does it is it good for your housing costs bad for your housing costs I'm not I'm not a real estate agent I don't know neither of my psychics might it not and we have a lot of boarded up buildings and we are not a gated community so it's um I doubt it but that doesn't mean it's not true so thank you for bringing that thank you if yeah my previous comments would stand you it doesn't affect you any greater less than anybody else around there with respect to the zoning updates so you can feel free to vote thank you very much yeah good point anyone else from public who wish to make comment please come forward I've been in that house for 46 years hard to think who thinks that far I remember when there were horses running um any other I think oh right here online please thank you mayor this is from Carol Lewis councilman Knutson we live on Edgewood Avenue which butts up to the proposed medical Corridor development on Charleston across from UMC we are opposed to this project without irrecon oh my goodness erect irrevocable thank you irrevocable and strict building codes to limit the building Heights to single story a multiple story building would destroy our right to privacy and security of our home Charleston has enough traffic as it is now anyway I'm not sure we need to continue to cram more Vehicles cement and people into the already crowded and smog filled area of UMC when will enough be enough just say no please thanks Carol Lewis of Eaglewood Avenue thank you any other odd ones okay well there are no comments and questions from here I'm closing public comment turning this over to councilman Knutson please uh thank you mayor and I'm going to take just a few minutes because I believe there are far more interested parties that may not have been able to get into the meeting today and are probably watching or we'll re-watch this and so I want to be sure succinct um but clear in my comments first off to Mr Summerfield and Mr Howe and everyone else in the planning department they spent a lot of time thinking about the Medical District and I'm very grateful because I think it's a benefit to not only Ward one but to the city and Southern Nevada as a whole it brings about the opportunity for increasing the access to and quality of Health Care and so for your team I'm very grateful for the Neighbors I've we've I want to talk about some of the issues and challenges that they've addressed over the course of my being in office and prior to me being in office because I think it's fair to put those on the record so for my colleagues we've done about eight meetings so the staff have done eight meetings on this over the course of four years prior to me becoming elected the majority of the Medical District was included within form-based code the south side of Charleston and that Smith's parking lot was left off I think that it provides opportunity now to bring it back to the fold because contrary to the the public comment about me bringing traffic I can't bring traffic to the area traffic is already there and I believe it's my obligation to protect some of the historic neighborhoods there were some comments from Neighbors around the transparency of how form-based code came about I do not benefit in any other way just like you mayor financially by rezoning the area and to be very clear I campaigned on this issue about bringing development into the Medical District because I think it's in the best interest of improving quality and access to health care I also think it's in the best interest of the historic neighborhoods to develop the area from what I can see it over the past 10 Years of Living in that area there has been a significant lack of development and the the open Lots the vacant Lots I think are to the detriment of Ward one and to the medical district form-based code from my experience and time working at the city and now as an elected official is an opportunity to say to the development community that development is possible and with the appropriate restrictions and guidelines it will meet the needs of our community and so that's one reason why I support it some of the neighbors have concerns and I want to kind of talk about those just for a minute one is some of the concerns were raised that Las Vegas is not walkable and we don't want to make it more walkable form-based code does allow for greater walkability as does the construction on Rancho and Charleston that'll be an upcoming discussion items at the council meeting the lack of walkability in Las Vegas I don't believe in and it has been more true now than ever before because during the coronavirus my husband and I have been walking nine to ten miles every Sunday morning we walk up starting up at Rampart Malta in Ward 2 and we walk all the way down to Bonanza Trail and we end up in ward 3 and cross through down downtown in Ward three so three Wards we walk through every Sunday during coronavirus because there's not much else to do and I got to get out of the house so I think Las Vegas is incredibly walkable and making that strip along Charleston between the medical district and the arts district I believe is a priority and something that I am very much focused on there's also concerns about like I said bringing more traffic I can't I can't bring more traffic I believe it's already going to come with the medical school coming in with the expansion of Valley Hospital people are going to be coming into the Medical District and I believe that's a good thing it's my job to protect those historic neighborhoods and form-based code is I believe the city's best effort to do that there is also concern about the height of the buildings I think it's a valid concern at Planning Commission they lowered one area right off of Rancho and Charleston from five stories to three stories I think we did a good job at listening to the community and made adjustments so I that was done at the Planning Commission through commissioner Rogan the height along Charleston is an issue and a concern for many of the residents and I want to specifically talk to the concerns that were raised by Bill and Armenia dropkin who live right there along Edgewood along with Miss Lewis they did an excellent job at representing their neighbors and themselves and my commitment to them was as developers come in and talk about what a five-story building will look like preventing access into their backyards preventing looking into their backyards will be a high priority for me and so working with Mr Summerfield and his team that's something that I will continually be focused on there was another request by resident in mcnilla states to adhere to strict guidelines related to the 15-foot buffer between the residential area and the commercial area while I can't not allow for variances it's my my relationship with you Mr Summerfield to make sure that I don't want to see any variances on the 15-foot buffer and so that to the residents I want to make sure it's very clear that I understand they have a concern about less than 15 feet and what that 15 feet looks like so I'm going to adhere to that as well um mayor I think this is in the very best interest of the Medical District I think it's in the very best interest of the scotch 80s mcnell believe um no it's in uh city of Las Vegas best interest that we do renew this uh non-conforming um a use for the tavern it has been many years that we've been uh applying we reapply every year since that's the requirement since then we've had two leases they both have not succeeded for a Tavern the expense to install a Tavern now uh at least a quarter million dollars so it's very it's a high bar and but we're trying we have a sign out we advertise it and we are trying to um uh realize the dream of having a Tavern there and by the way there is a pizza restaurant it is a functioning business we keep the building maintained it's a bright spot in what could otherwise be a very blighted area of Las Vegas and we keep the flame going we want to continue that and we want to make it a nice property one day thank you very much let me ask a Mr Summerfield please Madam mayor this is the 10th request for an extension of time for a legal non-conforming use of a Tavern establishment or liquor establishment Tavern at this location this location is adjacent to an existing restaurant the existing Tavern license was placed in a non-operational status in April 29th of 2010 the use was legally established prior to the requirement for a special use permit for a liquor establishment Tavern use and it does not meet the subsequently established distance separation requirements from six other taverns and any school the restaurant continues to operate under a valid license as indicated by the applicant staff finds that a decade has passed the area continues to change and adjust and the re-establishment of this use um at this time is is problematic under our current codes so staff is recommending denial is this is the 10th extension of time if approved it is subject to a one-year extension which is all code allows as a one-year kind of uh extension of this type of request thank you a couple of questions being the 10th year does that he said one one a year so that first one came in 10 years ago yes ma'am so they put this in non-operational status in April of 2010 because of the fact that it's alcohol it has a shorter window than some of our other uses to re-establish they completed their first eot this is our 10th one now here in 2020 and that yeah that's where they we are and by code we can only extend these one year at a time because the intent is not to allow non-conformity to perpetuate and continue so we we provide some relief for hardships under the code which is what this one has been filed under since 2010 which was you know towards the end of the Great Recession period however again at a certain point staff can't recommend approval because the area is changing and by the code you couldn't reestablish a Tavern here on your current code are taverns permissible now under the governor's mandate I thought they weren't open yet no no taverns are open they have to adhere to very strict social distancing guidelines the bar itself can't be open unless it's a part of unless someone is sitting there to to to drink or to play a gaming machine they have to have partitions there's a number of requirements but our taverns are back open at this point are eligible to be open at this point not all of them have reopened it as of yet okay and this I see a gentleman's joined you and if your name sir and your relationship did this my name is Dave Bauman I am the real estate broker that's been working with the owner for a couple of years now right welcome in a resident since 95. and did you want to add something to the owner's comments do you want to add why we should maintain uh well you know this this property I've I've actually been actively marketing this thing and we've had it in escrow a couple of different times um during this 10-year period during just the last year or so yeah in fact it just fell out of escrow last week because of covet 100 financing um luckily I've been able to I'm negotiating two sales right now with it as we speak um and the continued use is very important I mean it's a it's a vital part of this this property also we'll help taxes and and everything else but I mean the owners he's done everything he's ever asked of to try and keep this alive we've very diligently been trying to Market this thing I've had it in escrow like I said twice obviously last three or four months have been incredible of where you live you should feel proud of your neighborhood and we should keep things to the gold standard as much as possible I do you know empathize with the fact that we have seen hard times on businesses and um I do want to be clear though out of covid-19 making the economy go in a different direction than where we were projected to be in 2020 I will grant this extension but I I don't I'm not sure if I will get there a second time so I just want to be clear that I'm going to go ahead and approve the year extension I am going to hold my fingers crossed and I hope that something comes want to add to that I just I just wanted to add with a great conversation with councilman Diaz just to make sure we're on the same page and work closely with the word uh in moving this forward in the approval process it was also important for me to reach personally to the two voices on the original plan uh that wanted us to add parking which we did and they're both extremely satisfied with our vision and actually wrote us a letter of support for this project thank you very much Mr Summerfield Madam mayor since the April 14th Planning Commission meeting the applicant has revised their plans to reflect a reduction of two units and increase the available parking on site with the proposed revisions the staff finds that that they are providing at least one space per unit and that is thank you so much okay thank you very much so do you want to start and make your presentation then I do have two public hearing item uh cards first of all we'd just like to thank everyone for their time today we really appreciate it uh we're presenting a project that we think is really valuable to the community we're presenting a 51-unit apartment complex located at Harris and effinger Street currently the community's Fairly underserved in the need for General Apartments we feel this is certainly a use that the market is requesting and we're happy to provide it we think the location is primed for it and we're really excited to actually bring a project to the community that you know really makes a statement is something that the community can be proud of and we're really happy to be able to show the council today and we again respectfully appreciate your time and considering everything that we're going to propose so some of the issues that we have gone through and working through this project one of the major issues we had was the site constraint is very tight we actually had given away about 30 feet of right-of-way or for the right-of-way of our property to the city of Las Vegas along at finger Street which you can see right here in addition there's 15 feet along Harris Avenue that's being widened as well so our property that we had which is already tight was constrained a little bit more but being that as it as maybe we were able to actually get 75 parking spaces out of our site we're actually needing about 90 91 spaces so what we're really asking for here is a relatively small variance of 16 or 17 percent on the parking and we'll show you why we think that's really doable and it makes sense for the area obviously the the area as we understand it really we went through a lot of the ward 3 statistics to understand the parking needs for the neighborhood obviously the parking recommendations from city of Las Vegas the parking recommendations for city of Las Vegas are slightly different than what we feel was really needed in Ward 3. it actually requests as I mentioned about 91 spaces but some of the information that we had gone through from planning data for Ward 3 actually indicates that we need less than that somewhere around 68 or so spaces for the neighborhood and we understand that the neighborhood May in fact need possibly a little bit more than that but wasn't actually the same amount as City Las Vegas was recommending so we really worked closely with councilwoman Diaz and her team to try and come up with a solution that we feel would be achievable for the site and so what we've done is we've been able to get 75 parking spaces I had mentioned I'd like to point out that some of those parking spaces are actually tandem which ordinarily we understand is not it's not usually permitted unless it's part of a town home development one of the things we'd like to point out is that this development is going to have operational agreements that will allow those tandem parking spaces to be assigned per unit to the tenant so that it will in effect operate as if it was a town home type of ownership situation which we think alleviates the problem of those tandem spaces being utilized you know haphazardly we think they'll actually be quite efficient and as a result you know we think of really address the parking constraint that we had we don't think that 16 is anywhere out of line for a project of this sort and you know we've really worked hard to try and you know figure that out on the site and make it work in addition to that you know we really like to point out that solving that large problem which we have within the neighborhood at the elementary school across the street in the parking and we think we've addressed that we've really brought to the table what we believe is is really a solid project a great mix of one bedroom and two bedroom units that are all centered around a courtyard development with a pool in the area which is certainly an amenity that is currently lacking that we're bringing to this development a community Clubhouse a playground space Lounge area outdoor barbecue space all of that that centers around the community of this c-shape development we think it's really thoughtful we're really proud of it we think the community and the residents are going to really you know enjoy this this apartment building in all the amenities that it offers and so you know it it was possible that we could have had you know more units or done other things to the site but we thought it was really important to offer an amenity space that that made it I'm going to ask you if you wouldn't mind I just went down to speak to councilwoman sure want to move this forward because we have so many people were waiting to hear from so don't go away we're going to Mr Summerfield I'm going to public hearing and I have two cards and then we'll go because we really have so many people we want to hear from more than happy to thank you but very beautiful drawings but don't go anywhere I'll be right here okay Mr summer I'm Madame mayor Steph finds the density of the proposed project to be more intense than the surrounding area and the applicant is proposing the odor develop the site as evidenced by the requested variants which is in for a point of clarification as the applicant mentioned um and and I do want to be fair to the applicant they've been working very quickly to understand some councilwoman and staff's concerns and so their proposal does eliminate two units from this development and replace those with under first floor under the second floor parking unfortunately because they are tandem spaces and this is a multi-family dwelling where a townhouse is technically a single family dwelling our code does not allow for Tandem parking to be counted officially towards the the parking requirement so that can be a part of the consideration but in terms of the actual variance the variance would be a 30 deviation from standard um reduction in the number of total units has reduced the density so again that that contributes to addressing some of SAS concerns and is consistent with the surrounding M residential General plan designation and the associated R3 zoning districts again these those are potential conformances to the intent of that area so with that staff is recommending a denial however if approved we do have some amended conditions that we would offer on both the variants and the site development review after conversations with the councilwoman's office thank you thank you very much this is a public hearing I have two cards that doesn't mean that anybody else can't come up but I have George caucus and I also have Nadine Nadine Morton hi still morning good morning and your honor your honor um that's fine mayor Goodman and Council persons um parking matters parking is a substantive matter that profoundly affects the quality of a neighborhood um with adequate parking it can foster Harmony in a neighborhood with inadequate parking it can cause Discord animosity and complaints we submitted the variants requested poses undue hardship the information that we had was that this was at the 53 unit development even though it has now been changed to 51 unit it still poses that same undue hardship this is a multi-family residential development that's being proposed two bedrooms pardon me 39 two bedroom units and 14 one bedroom units at a price point of 1200 for a two bedroom and 900 for one bedroom and why that is relevant is because those people who are in the residence of those apartments they're going to have the relative means to have cars unlike senior developments where they might not be utilizing the cars to the same extent might not be driving these individuals who are going to be occupying this residency are going to have cars they're going to need spaces so we know that and they're asking for a significant variance um where are those individuals going to park when you look at the surrounding neighborhood there's a school on Harris the other side there's absolutely no parking available on that side on Lily is a very small Narrow Street on one side is Cabana apartments that they already have their parking spaces allotted for and on effinger it's a fire lane so there's absolutely no perimeter parking to that um we have offered we have reached out to the applicants haven't received a lot of response we have offered viable options such as Podium parking that is that mimics of Bonanza Pines in Ward 5. the the price to provide Podium parking is 25 dollars square feet so four as applicant asserts that he is a long-term holder that's a nominal fee to be able to provide that parking alternatively they could decrease the number of units they'd increase the number of units by two but we submit that that's still not sufficient um title 19 states that no variance based on personal financial hardship is allowed and an exception is permitted based on unique or extraordinary circumstances and there's no evidence that that exists here we submit that the applicant has failed to meet its burden um we ask that you protect the integrity and infrastructure of the neighborhood we respectfully ask that you either deny the variants outright or obey the item until there's a more viable solution okay thank you for your comments George Juke is 26 55 South Rainbow Boulevard and after the Planning Commission meeting I did reach out to the applicant and as of date I have received nothing from him I want to look at his history his portfolio because he did mention at the Planning Commission that he was a long-term holder and his Council recommends stated that if he's going to hold a property for 20 years spending the money on Podium parking is a win-win situation when you go to sell the property because you are providing parking on site for your residence staff I have worked with this staff for 30 years now different directors have come and gone but I want to tell you the staff works extremely hard with all the applicants and the least they have done with me for the last 30 years and they try to make something work for you I understand the challenges of this applicant because I'm always going into infield pieces councilman Anthony's been to some of my grand openings as well as your husband and we take a lot of pride in what we do and parking is a big issue I don't have a problem with his waivers of landscaping and things like this the only problem I'm having is the parking issue and I have to command your staff for always working with us because uh they they try to make things work for you even though you do have a lot of constraints thank you appreciate your comments and thank you for coming and sharing them and anyone else from the public who wish to make comment here please come down and if there's anyone else on either of these issues please come up to the other microphone so we can move this along please thank you my name is and I live on effinger Street 730 effinger Street and I'm in the in front of the new development totally for my for the whole lengths of my property my situation is I bought my house 10 years ago and I was aware of the school which we have so going back to the parking is twice per day we have approximately 100 cars coming picking up the children who have to park somewhere and they cannot have their children come out and meet the parents they have to go unload the car with two more toddlers pack them up go in the school so each car is there for at least 20 minutes sometimes in half an hour they are parking all along a finger Street on both sides sometimes I don't even get to my property because they drive in and out right now which is very narrow they park on the whole lengths of Harris in front of this new property one after the next all around the corner into McKnight the next School in London school has 600 students the next school next to it which is around the same time coming and going is cambiero and they have the same problem and they go basically into the next side streets there so I cannot even see where how these parents can park or pick up their cars if we get additionally basically 100 cars being in this location they want to put the entrance to the property on my site where my property is and that means I have every day now 100 cars driving in and out the whole length of my property the pollution then the noise and it was told to me by the developer that they have to do this because of the fire department exited entrance the next to this property is McKnight Senior Center but they did they put the entrance on McKnight for the residents and the fire department is on my street that is no nuisance at all because they are not coming that often and they never have the sirens running when they come so that is fine so I proposed to the developers to turn the building around put the parking on the other side on Lily Lane and basically make the fire department on my site that would be fine with me at least I do not have 100 cars in front of my house every day thank you would you be good enough to spell your last name please Zulu Aga z-u-l-o-a-g-a you got it thank you you're welcome and then the other problem is there besides the parking and the interference this is cool that we will basically have the noise the pollution and I have a problem with uh going from low density which we are the whole area there residential that they have to go on high densities why do they have to have 50 if they can go low or medium density that is what I basically would like to propose so I think they are overbuilding the other thing is that a finger is not as through Street it is a dead end little road which was not even paved when I bought my house 10 years ago it was a cent Street and they just basically finished so you have to drive into a finger Street to the end turn around to get out you cannot make any U-turn it will not be wide enough even if they give 34 feet Lily Lane is not even a street that is an alley where one car is driving through right now they have their trash cans there and the residents are parking their overflow parking along the houses this is one lane this is not a through Street Harris is the only through Street okay I think your points are well made I'd like to give the gentleman an opportunity and again sorry to cut you off but we want to keep moving and get through our agenda it was the most I only have three concerns uh one of them one of them is in vandalism the second is drugs and the third one is crime we have plenty of that in that area unfortunately now we have the library in our area that is crime if we can help develop the area more people there they'll be like eyes and ears for crime and help stop it I would believe but please finish your comments if you wouldn't mind okay well that's pretty much uh okay yoga people has already brought in the parking space and the traffic just my concern is vandalism and the crime but what's going on I think we all care about that very away yes good morning what's your name please my name is Gladys Hernandez I live next to my neighbor on 2740 East Harris Avenue I am very concerned like my name my other neighbor said about the crime level going up and also about the um my kids safety I have kids and they're always running around I'm very very um scared well first when I moved in I actually got assaulted on my own property so it very much concerns me and my kids being outside the dogs are always running around I mean the street is too small it's too small to make it an interest it's too close to to to our our houses you know this is what I'm this is my concern thank you very much for coming down thank you okay I don't see anyone else I closed it too fast now I'm closing at councilwoman Diaz Madam mayor do any of my colleagues have questions before I take the mic right okay let's start with councilman D um councilman Knutson first and councilwoman please and I appreciate it and councilman Diaz I'm just curious Mr jakakis has done a lot in Ward one and for the community and he mentioned Podium parking um if if it's okay for the applicant to kind of talk about the podium parking question I think it would be helpful for me okay all right so you might as well come back up at councilwoman uh councilman please go ahead but we have another question what's the ratio between the actual apartments and the parking spaces like is it one to one what's the actual ratio um great question so I'll take that first since it's easy easy answer the ratio is just a little over 1.3 to 1. so we're we're more than meeting the one-to-one that usually makes these at the very least buyable and we're exceeding that to provide guest parking and obviously the Overflow from two car units and two-car households so again we feel that it's it's really well within a smartly developed project uh what was the second question I'm sorry the podium parking was that it so in regards to the podium parking uh unfortunately you know in developing a site it's a very tight site as everyone can appreciate There's a constraint to doing so there's an economy of scale that we're unable to realize by having you know a denser site and in doing so a Podium parking just really produces an economic and feasibility for the site it makes it very difficult to build we've tried to kind of toe the line and find a medium ground that we think produces a high quality project a high functioning project and again with the parking concerns I'd just like to reiterate that the applicant plans to operate and own this project for a long time so they're they're in the position of not wanting to have parking problems for their own interests let alone the community so and Jared could you what Podium parking is so for those that might not understand what the concept is sure so a podium to what it sounds like it raises the units above one unit of parking or one floor of parking uh kind of like a small parking garage if you will and in doing so it's there's a high cost in producing it to raise the units above it compared to the cost of developing the units that you get on the land so the yield goes down for the cost of the project and unfortunately it just creates a new feasibility for our our applicants to be able to develop the project appropriately which I'm sure is you know everyone every developer faces that challenge and that happens to be ours [Music] easy deliberation for the reasons that the neighbors came and expressed and also the developer in working with a little over an acre and a half I do want to address the questions about security when I've been meeting with the owners and the designers and The Architects um ultimately whoever's going to property manage has promised my office that they will stay on top of security they will abide by Metro's training so that they ensure that they're providing the safest um basically residency not only for those renting but for the surrounding areas I also asked them if they were going to incorporate good lighting if they were going to incorporate security cameras and I received a yes that we will go through Metro's training we will put the lighting we will put in the security cameras and all of those elements do deter crime and I've been in heavy communication with the downtown area command captain and she's very supportive of projects that Implement all of those things it's no different than Nevada hand being super Hands-On with their tenants I'm holding them to the same standard of being very involved and on top of what's happening on their property schools and safety was another huge concern and you know my experience from the legislature always taught me that you can't always make everyone happy with your decisions but you have to get as close to the middle as you can I've not you know I I was not happy with the very limited amount of parking that the initial plans showed I pushed back I said that's not enough we need more parking and although we are not accounting for the tandem parking I do believe that those six extra spots especially if they're assigned to one household that's renting the same unit will help decrease that stress in the communities I openly talk to them about Parking Wars and being a good neighbor and how they're going to step up when I get those calls from my community and how they're going to get actively involved in helping me Rectify and remedy what I'm hearing but if we don't develop that lot what the neighbors have brought up is going to continue to happen we're leaving an open space there for vagrancy to kind of be there for elements to jump over property lines and once it's fully developed I think that we might see a decrease in some of the crime issues that we're seeing I don't think that people who come to ward 3 are necessarily one type of people or element that are going to come and terrorize the neighborhood I am more optimistic than that I want to believe that when we bring something of High Caliber that's new that's fresh that's going to help people save money and feel proud of where they live that that's going to elevate the whole community and that we're all going to be better served for it um so I am not a fan of giving anything away on Landscaping so as much as you can help us out in that regard and incorporate it in meaningful ways that make us feel that we're coming to a beautiful neighborhood that we're proud about being Ward 3 residents please help me I know we're granting variances on that or potentially granting variances but I I want to have your promise and I know that we're going to put just to keep an eye on the parking situation Mr Summerfield I believe Mr Lowenstein has provided an alternative where we can go back and do a year review and then I'm thinking in my head there's the Escobedo Plaza on that corner of Harrison Eastern maybe after they're out of there maybe there can could be a way where you say hey when there's events happening at our clubhouse can people park there I don't know how much the parking is being utilized in the senior subdivision that's right there also on Harris and Eastern maybe there's creative ways and Partnerships where you could procure additional parking for guests and other folks that are coming to your site without disproportionately impacting UDA and um Jaime and Gladys so I'm going to let Mr Summerfield speak to that one year review about the parking situation Madam mayor through you so councilwoman yes so in our discussions with your office and with the the attempt to go to that middle that you were referring to we have a condition that we would like to add to the variants if approved that would State an administrative required review shall be conducted one year from the date of issuance of a certificate of occupancy to evaluate the state of parking both on-site and adjacent to the proposed development what this will allow us to do is we will look for calls for service from our parking enforcement division any complaints that have been received about how parking has been administered in that area if we find or substantiate that there has been issues we'll Elevate that up to a city council review but that'll also give the council and staff the ability to work as under condition with the applicant to find other remedies to address to my past reports um I did want to call out a particular group that I haven't really thanked relative to our budget process as you know with today's approval your approval of the collective bargaining agreements with our two largest labor unions and all the actions you've taken over the last 30 days or so we now really accomplished a balanced budget process for July 1. and I I would be remiss in not thanking our federal delegation um we're at not for cares act funding we would be in a very different situation than we are at this moment and so I want to provide heartfelt thanks to our entire Congressional Delegation for the hard work that they did they did and and not only getting the cares act money to us but giving us a direct appropriation as we were able to figure out how to use that effectively meeting the guidelines of the program but also helping us with our fiscal crisis so I do want to thank our delegation the other thing I did want to mention is that we continue to gradually roll out the opening of our facilities I know um I know this personally because I had a granddaughter play lacrosse last night on a sports field that our youth sports have returned to fields for practice and training not for games yet but I know a lot of parents are thrilled with the fact that their kids are returning to more normal life now and so we continue to roll out more of our facilities as as the governor has rolled out additional authorizations in his phase two um and then finally I I think you alluded to this earlier about um the public comment period I I think as I mentioned to you when I called you this weekend I told in anticipation of what we thought was going to be a very large turnout today I indicated to you that I would need to strictly enforce the safety standards the covid-19 safety standards and maintaining capacity limits of these Chambers so we have set up a very uh intricate process here where we will closely communicate between the front door of City Hall and those persons who would like to speak at the public comment period and folks here our employees here in the chamber so that we can facilitate moving people into the chambers to be present and speak at our public comment period where the challenge will exist is if persons who are seated in the chambers now stay seated and wouldn't voluntarily give up their seats to those who come in we're going to need to ask those who come in to speak to leave because we can't continually build up folks and the presence in the chambers and exceed the capacity limits of the chambers so I would ask that those who do come in to speak should that we stay at capacity of this room we're going to ask them to to kind of cycle back out and leave the building that's the only caveat I have will probably try to make more space available on the staff side of the chamber for people to be seated because I a lot of our staff are now leaving because all the business items are done but we'll do our best to seed as many people as possible in the chambers but we are going to have to adhere to those strict limits thank you as you know we've closed every other row and every third we're seating every third seat to maintain the the social distancing standards that we believe are part of the capacity limits of the chamber so staff is aware to keep looking because as new people come in having the new people and we'll probably bring folks in in groups of five or so so that you know if you're gonna for example ran a minute each for each of those persons will keep track of the line and keep that line okay at a fixed length with social distancing standards so that it's a continuous flow of persons coming in to speak thank you very much we really appreciate it because safety is one and health is too uh actually my left is Mr Jay Dapper who is the individual that most of you are already familiar with that has been developing so many wonderful projects in the downtown area and who will be once we close this deal the developer of the hunters theater so I will give you a progress report and then I'll let Jay talk to you about his perspective but tomorrow morning we have a meeting at 11 o'clock with the state historic preservation office the long history of the hundreds I'll summarize in a few sentences in 1997 the roof collapsed alone was given to the Friends of the hunt Ridge that loan has been paid down and reduced and played with over the years but today it's 389 thousand dollars and we're trying to work a deal that will relieve anybody of having to pay the state back under conditions that the hundreds be restored and maintained so in my hands we worked all weekend on this is a settlement agreement that will be before shippo tomorrow and so after that vote hopefully we'll have clear running to close on the hunters theater so with that as you all know there have been a lot of challenges in this new economy both covet and just other things in general and uh so Mr Dapper has extended the uh the closing date on the hunter theater but he's still moving and so let me turn it over to Jay so he can tell you his plans hi madam mayor and members of the council thanks for taking the time to listen to us today we're here to give an update on the hunters theater as Brad said we've made a considerable amount of progress since the last time we were here so first and foremost as Brad said we extended the close date to the end of December we did that because a lot of the reports and due diligence that we've been working on have just taken longer with covid going on and so the current owner gave us the extra time I also agreed to release a substantial amount of earnest money in order to make that extension happen so I'm very committed to the project and so the good news is I believe the chances that we close are extremely high we've got a very important meeting tomorrow with the state to hopefully work out the final covenants of you know how we'll proceed forward with the hundreds theater and as Brad said we're pretty hopeful that the shippo board and the state AG's office agrees to you know what we've put forward in front of them and um I think that there's uh a very good chance that once that meeting takes place tomorrow that that will pretty much give us a green light to to you know get over the finish line um other than that I think that I've got a long list of boring reports all to surveys technical things that we've been doing at the hunters theater pretty much everything is checked out we've certainly discovered a lot of amazing things as we've been poking around the building and going through the long history and we're very excited to move forward and start a new chapter for this very historic building well I can tell you it's exciting my heart fell down to my toes when the whole shutdown came and I thought oh my gosh there goes the hundreds but knowing your passion for our community and how wonderfully you've helped us improve develop change and help us stay the way and now we have deeper holes to get out of and higher mountains to climb but thank heavens you're staying the course and hopefully how you communicate to us let us know what happens after tomorrow's meeting please absolutely absolutely and what I'd like to also share some very positive information I've already shared with councilwoman Diaz and this is uh uh this is a you know big big information or big news for the hunt Ridge Neighborhood but we've been actively working for a very long time to try to get a grocery store back in the hundred shopping center and I'm very glad to report that we are at the finish line and we are very close to signing the lease with a National Grocery chain to move back into the 100 shopping center and bring a grocery store back to downtown that is so we've been working on this for 11 years I mean I can't or more even but I know that for sure that's so exciting because anybody who lives in the downtown area my gosh are you lucky what did you do councilwoman to get this on you prayed extra hard that's wonderful news in the near future yeah so a very near future so we're we're currently in lease negotiations uh with this company um I'm I'm not yet able to say who it is uh once we sign the lease I'll be able to come back and you know give an you know an unofficial update and and tell you all who it is and share renderings and things like that uh they're a great company they are entering the market here in Nevada so they're not currently here and uh they wanted the hunt Ridge Shopping Center to be their first location so we're pretty excited about it and is that the old um grocery store the site correct yeah so it's a 20 000 square foot space they would be so it's not a small little tiny yeah no it's a it's a full-size twenty thousand square foot grocery store it'll have um you know fresh vegetables a meat section the whole thing wonderful yeah well we're just delighting everything that you're doing on Las Vegas Boulevard and what is that at Carson or is that the post office yeah the post office I mean it's so exciting and all I can do and an effort I want to speak for everybody and just say thank you and please keep us informed and no wonder uh Brad is smiling again so thank you he's double smiling but you're still employed until the 30th of June don't go too far no vacations thank you thank you I want to personally thank councilman the uh she called me last week I wanted a personal briefing on all this she spent a great deal of time with me I really appreciate it and we're only just starting so uh things are back on track and I want to thank this Council for 28 great years thanks again thank you and I hope you left let former councilman Bob coffin know because he has been on that Park and that area for so long that oh my gosh I did yeah so I put a call into him I haven't spoken with him personally I expect to speak with them in the next day or two wonderful and I know that that was something that he really he wanted to see a grocery store you know restored in downtown so and I and I just like to say one last thing before I go um Brad jerbeck has truly been a friend not only to me but he has been a very uh staunch supporter of all things downtown since the moment that I I bought my first property the reason that some of these great things are happening me purchasing the Hunter Ridge Theater me being able to bring you know a grocery store you know back to downtown and a lot of the other accomplishments that we've already made you know a lot of it lies with all the help that I've gotten from all of the people at the city of Las Vegas and I just want to say thank you to Brad for all the years of hard work before I knew him and and recently and I just I really think that having people that truly care about our city you know normally a City attorney doesn't get involved in projects like this sometimes people don't like that but thank God for somebody like Brad well all I can tell you is how forward build that thing out and let's have a party for Brad there agreed thank you everybody thank you this is a report only and I'm going to Reckless response to host of blue lives matter rally by former mayor to Pro Tim Michelle Fiore Stavros Anthony and Victoria Seaman in these times is disrespectful as well as a deterrent and agitated to the progression of human and civil rights let's be clear the creation of promotion of an execution of this event was to agitate our community in potentially Insight conflict which could have resulted in violence against our community tourists and police officers who are doing their best to support Las Vegas during this volatile time the protesters would have also been at risk as emotions run high and this event would have increased the divide it is an embarrassment that you councilman starveless Anthony a retired Las Vegas Metropolitan Police Department police captain of this city and now an elected official was so such a lack of leadership and poor judgment in the midst of a worldwide pandemic in civil unrest you are aware of how resources are stretched very thin and being a former officer know the risk officers take day to day and now the risks are even higher with domestic terrorists and I missed agitators have infiltrated these peaceful protesters which you failed to mention yet call us violent thugs that they look more like you than they do us when in fact it's people that look like you we now have an officer fighting for his life so on behalf of the NAACP Community we send our prayers to officer Shea michelonis and his family you spray poor judgment and when you chose to participate in an event that will cause division you did this at the cost of Frontline responders and citizens of all Races this city needs leaders that are trying to move us forward but your actions are setting us back you showed a lack of professionalism for decision making and no sensitivity which are the things that this city wants and needs in our elected officials who are elected to protect this entire city this decision would have been an epic failure I am thankful that you are turned out and will no longer be the councilman for Ward four and as we are concerned citizens we will do all we can to ensure you are not elected as commissioner in District c as you are not inclusive for justice for all this ends your season of Despicable service to this this community justice for all includes blacks Brown Asians Asian Pacific as well as our lgbtq community Pro tem former mayor Pro tem Michelle Fiore we are pleased to know that you have stepped down from your position as mayor Pro tem as it was our plan today to request that you do so mayor former mayor Pro tem Fiore you have shown time and time again through your rhetoric and actions that you don't possess the temperament sensitivity or progressiveness that an elect official must have in order to lead this community into the 21st century you have advocated for cease for citizens to point guns at police officers in law enforcement you have described U.S Marshals and Law Enforcement Officers doing their jobs as thugs you spoke out against affirmative action you have lied and you have been deceitful to the citizens of Clark County and Las Vegas you have failed to protect and serve as minority constituents in your District when our black and brown children were under attack in their schools with racial epithets and intimidation you remain silent and did nothing now in a time when we have police misconduct and Injustice and you have people of color involved you are now a supporter of police but when police are doing their job and enforcing the laws of this land and the citizens are white and armed you stand with the citizens and say it's okay to defy law enforcement and point guns your action show do you not stand for the rights of minority people in this community and you will not stand and protect our children Fair mayor Pro tem former mayor Pro tem for you to use your office and influence in such a reckless and thoughtless manner it is clear to us that you do not possess the ability to make unprejudiced unbiased decisions as it relates to the people of color and our LGBT community here in Las Vegas you have proven yourself to be divisive dishonest and untrustworthy and this makes the people of this community unable to have confidence in your ability to lead and represent the city of Las Vegas and all of its people bottom line is you have shown us who we are and we see you the racism and anti-black agenda that continues to permeate out of this type of distraction is a danger to our democracy livelihood and safety the uprising we are experiencing is sobering and yet not expected not unexpected as a people we are tired of the injustices and the brutality that has disproportionately impacted our community at the hands of police officers and local elected officials in Las Vegas we remain Resolute in our persistence and strategy strategy to see substantive change for our black community mayor Goodman this is a time for True leadership tourism job and support rather than setting back the history and slowing the progression of this city the former mayor pro team was an embarrassment to Las Vegas and has brought unnecessarily unnecessary racially and politically charged attention to our city people come here to feel welcomed and enjoy what Las Vegas has to offer I have received numerous complaints from around the city nationally and internationally surrounding your mayor Pro tem on civil rights and racism people are wondering if Las Vegas is truly Progressive and welcoming a ball the recklessness of former mayor Pro Tim has gone viral and is Painting Las Vegas in a very unfavorable light around the world I work constantly with our police departments across this city and we are attempting to do tremendous work to move Las Vegas into the 21st century the NAACP the black lives matter movement legal observers and the good citizens of this community want Justice progressiveness equality and Leadership and your former mayor pro team has just said back all the work that hundreds of people have been doing to keep Las Vegas on the right path we elect officials to represent all people and we put a trust in them that they are not racist nor biased they should not have a certain political agenda and they should to the best of their ability create an environment where all people matter and all people are represented your leadership has also been brought into question as mayor that has tolerated and accepted this tone and culture mayor you can do something about this and this world in time of accountability for elected officials we're asking each of you of this city council to hold themselves accountable as well as their council members accountable you can immediately you can immediately join me in the NAACP in our Justice matters initiatives we are asking the entire Council representative of our great City to join us at the table to discuss matters of justice and education employment and Public Safety we know that at least one council member has begun the work and I thank you councilman Knudsen for your proactive Outreach to the black community the NAACP and or how LLC came to be a police officer in the first um African-American police officer in Nevada was he actually took his test right to become a police officer one of the white police officers who was sitting next to him said the LC cheated off him and originally Elsie was denied the position in the fourth and it also took Larry I mean sorry Harry Reid our former Senator went to court on behalf of Larry to say to the police that what they had done to him was wrong and that Larry was rightfully should have been on the police force and that's how he became the first African-American I guess sheriff and police officer in Nevada so that goes to say one of two things you cannot ignore the fact that racism has always existed in policing yes we've outgrown it yes everybody has grown thank you slaves because at least they knew how to pick cotton and you madam mayor chose that woman to be your mayor Pro tem this is the same woman whose business was shut down by the state of Nevada and told us that cancer was a fungus that could be cleared with baking soda it is not ironic to me that Michelle fiori wraps herself in The Thin Blue Line claims to be pro-law enforcement but conveniently Michelle Fiore is some masterful politician this is a woman who won with less than 4 000 votes to get the spot that she's in and won her GOP assembly seat because she ran unopposed the first time this is not a masterful powerful politician this is a woman who knows how to suck the oxygen out of the room to divide people and to create haste hate but let us not forget that she also she also at a time of great budgetary crisis when many people of color when many white people when many black people many brown people need the city to be functioning and to have successful coffers she's waiving fees for labor union bosses to have their daughter's weddings it's pretty obvious what is important to councilwoman Fiore and it's not making this an inclusive City it's not making this a city where you can say black lives matter yeah everyone in this room thinks all lives matter but the conversation is different now it is different now I'm a white man I'm just about 40 years old and I understand that I have a privilege I understand that the world is changing but it's clear that councilwoman Fiore does not and you madam mayor your legacy is coming up you will be defined by what you do in these next couple years and you have an opportunity to stand up against someone like councilwoman Fiore who just yesterday you said was doing her great job for the community yet when the community came to speak to councilwoman Fury she walked out of the room I think is absurd and in the spirit of you writing me that letter I wish that perhaps you and I could have a conversation offline we can continue this dialogue it would be very very important because what I saw today was people of color who are willing to give a 40 year old white man their time to speak I believe that we can make progress but Vegas has been a complete embarrassment and struggle for our business on how everybody is conducting themselves on this Council for for the most part and I'm standing here today just to voice my opinion that we need police reform we need to know what's going on within the Union on why these policies are not getting passed and how we can as a businesswoman can get assistance because we depend on Metro to come to our events if I'm producing Urban events and people of color are scared to come to Vegas because we can't get it right up here how is that supposed to help me here being a citizen and so that is my problem today with everything that's going on is that we're I don't feel like we're working together I don't feel like we're we're voicing the right concerns right now for what's you say calm down I don't think you understand what it feels like to have a young black man who you have to make sure the neighbors know that we belong in the neighborhood that way if he's running he's not seen as a threat you don't know what it feels like to have a five-year-old daughter come to you and tell you she wants to change the color of her skin because the kids say they can't play with her but not even that those like to have military members who have to wear a uniform in order for people to show them respect what hurts my heart is to know that you can sit next to Fury who is someone who called black lives matter a terrorist group but in the same breath said that if a police officer pointed a gun at her she would fire back how does she sit up there comfortably and we're told to be quiet and to calm down it's not just about her stepping down she doesn't have a place up there as you as a mayor I know that you know you have a responsibility to hold everybody accountable I appreciate you councilman career for being brave to stand alone to speak up on this next thank you your name please [Applause] my name is George Allen I am a home care worker and when police are injured I take care of them when veterans are injured I take care of them when disabled and seniors are injured I have to take care of them and many have died in my arms yes black lives matter blue lives matter all people matter because I have to take care of them when they're injured and when they are dying and they are dying in my arms they are not thinking about racism when they're dying we must move from protests to progress and from progress to peace thank you sir you know I'd love you to talk all afternoon because your words are beautiful and you're obviously a caring human being because all lives do matter and that you care for people it's beautiful and I'm sorry we can only give you that I'm asking for help I'm asking that you help home care workers because because be in a proud member of the NAACP I would like to bring to your attention two points today number one I'm also a human resources professional and mayor Goodman I do appreciate your communication with regards to the charge that you gave any of the council individuals regarding needing a break regarding being consistent for spending long hours and thereby needing a time to reset I believe that that is a perfect foundation for understanding why we are here today we need a break we need time to be able to reset we have been struggling we have been shouting we have been protesting we have been asking and yet a break has not come with the same consideration that you have ensured that the council people who are here today are being given a break please assist us in giving us a break second and foremost leadership is at the heart of what we are asking but there is no way to lead us if you cannot see us please see us thank you thank you nicely said and the next person on the left please come to the microphone and yes sir please I am William Rigg and uh it's Rigg yes she would like just in case it takes more than a minute uh uh anyway uh two minutes please on this and the lady is that sometimes a little bit difficult uh anyway I'm uh United States Navy uh 22 years retired and uh disabled I wanted to give some praise to uh councilwoman fiori uh she actually helped us out quite a bit uh we had an issue with uh we still have an issue with an HOA uh the uh president and or whatever he wants to call himself now for the association has used a wording towards some of the other homeowners where he will put it the nice way he'll he doesn't like blacks Section 8 or renters he doesn't use the word black he uses the full body he uses the n-word quite frequently anyway to take a long story short I went to every news station out here just about every single politician and uh councilwoman woman fiori was the only person that actually would help us at all through this entire process that we're dealing with we're still dealing with it now so uh with the climate that's going on right now it'll be great if uh somebody would investigate this is still going on right now what's happening so far I've had things go on where uh they they've had me go to a hearing for to remove curtains and to replace them with curtains that's ridiculous but that's exactly what happened but they had this one they wanted me to do this at 11 o'clock at night uh and anyway uh at this point they're they're trying to take my house and it's it's just insane uh and the big reason they're trying to take my house is because I I call them on their behavior and uh so if anybody would investigate this would anybody would help out with this I've already gone through Nevada red Nevada red uh actually uh I went through all the the process of the the four and five thirties and et cetera et cetera I went to the ombudsman's office uh they didn't even answer the the thank you thank you very much thank you for your service yes ma'am all right um I'm Kimberly Bailey Touro I'm the publisher of Las Vegas black image magazine and this is my Gentleman next and that's my husband Charles tarot is he going to give you his minute if I need it okay that's what a good husband does anyway I just my father was The Honorable Bob Bailey William H Bob Bailey uh equal rights commissioner for this state good man uh fought discrimination um did so much for Las Vegas so I have to just say as a publisher as a native of Las Vegas I was very dismayed by Fiori's comment and I also live in her district and so um she will never get any support from me um I think that a real education needs to be had for this Council I I was educated by Spelman College in Atlanta Georgia diversity inclusion all of those things need to be taken very seriously and if no one understands what black lives matter means and the whole world Paris Korea everywhere is saying black lives matter black lives matter because black people are dying black lives matter because of disparities right here in Las Vegas we have economic disparities and I hope that instead of your apology you in place policy that will make it economic inclusive to include black owned businesses to outreach to Black owned contractors subcontractors that's what we need we need a committee to converse with the police department to let them know what is going on with us in our own Community here in Las Vegas and Michelle needs to just step down she's not qualified and if any of you have biases you should step down because we are all a collective took all but 20 seconds of his so if you'll give him 20 seconds please let's start that at 20. well just just ultimately you know I'm a businessman and I have better things to do than sit here and deal with these issues that stem backed 400 years and it's just disappointing that we have to spend this time rather than focusing on moving Vegas ahead and it takes a collective it takes sensitivity to all cultures all pieces of Vegas make Vegas what it is of the police department obviously play a big part but we have racial biases that I think that a lot of you thank you unfortunately your wife took up all your here to basically um request for um accountability and in terms of we need our policy makers we need all politicians we need our business owners we need basically everybody on Deck there's some movement that's happening it's burning inside the heart so both The Young and the old whether you see it or you don't it's happening worldwide it might be a cliche but I solely believe this is a new day it's been happening there has been unfortunately discrimination in terms of opportunity within the Cannabis industry I'm here to speak in terms of that we were the people that moved this whole movement forward with SB 374 did was accomplished was monopolized the Cannabis industry in terms of the patients everybody's got left out sorry that's your minute so sorry sir yes sir hi um my name is Matt Russell Matthew Russell I'm a transplant like a lot of people here in Nevada I grew up in West Virginia and one of the reasons why I escaped and left West Virginia was the unchecked and systematic racism that permeates through the state and then I come here and find out that a councilwoman one of your colleagues this is a quote attributed to your colleague from 2015. the question that I have for you all is how can you look in the mirror and serve beside somebody like this the Syrian refugees what are you kidding me I'm about to fly to Paris and shoot him in the head myself I mean I'm not okay with Syrian refugees I'm not okay with terrorists I'm okay with putting them down blacking them out just a piece of brass in their ocular cavity and in their miserable life I'm good with that that's your colleague look in the mirror and tell yourself that you're comfortable serving besides somebody like that thank you [Applause] yes my name is edulin I'm white I'm 80 years old we moved here in 1943 moved to Boulder City and and have lived in southern Nevada and uh I I love Michelle for fiori I love you because the two of you speak out you speak your mind those are the type of people that we want in office we don't want people that hide and you don't know what they're really thinking um on the uh and I I disagree I don't agree with everything Michelle Fiore says and in thinking back over my life uh since 1943 here in southern Nevada and the Discrimination that existed that I was unconscious of even though I saw West Las Vegas as a Vibrant Community in the 40s and it's been destroyed by the freeway going over the there by other things and uh and this meeting is fabulous you fail to spell your last name for the clerk uh ueh-l-i-n-g thank you very much thank you working continuously for 29 years ever since then and what I'm here to go ahead and propose now on your desk been there since Thursday talking with Stephanie I don't know if she's gotten with you yet there's a proposal for the city of Las Vegas to step up and show its leadership to the World by hosting a co-hosting a 80 year birthday celebration for Pele the greatest soccer player ever to play and the greatest Peacemaker would ever be he not only is a soccer player but he is a world iconic figure yes thank you so what's going to happen he gave it to staff up at my office please make sure okay I League here I came here at first because I was appalled absolutely appalled it as my 90 members were when we read the statement or the alleged statement of Michelle I also came here to support my again uh compliment the councilman career for it took courage to stand up against one of your own in my being in politics and in government and worked by being for 30 years I understand that but there are times you have to stand up the words that you heard from the other sister from the NAACP Roxanne I came to support her also what you heard was the passion that's running through our community here what you heard is black lives matter and I'm sure that all of you remember that slogan I'm mad as hell and I'm not going to take it anymore that's running through not only African Americans but young whites millenniums and what have you we heard all of this stravos you and I have worked together for over 20 years and had a positive relationship we have a two white members three white members of the 100. for since 04 mayor Oscar Goodman deputy chief McHale and Steve Shore but what we are about is Solutions Merit we're doing a program right now looking at working on a program and a proposal that copies and mimics a program that was in the city of Baltimore one was with the city council in terms of you heard one speaker say getting together understanding what are the concerns in the city what are the solutions one way another area that we're looking at is a Public Safety Academy starting with the third grade going through and that's what was talking to your people outside and thank you for that opportunity you've heard from me at business people here we need to sit down and look at where are the opportunities because the cry that you're hearing from all segments of the community the professional segment our teachers we have a general in the 100 we have a commander in the 100 we have teachers and business people and what we do is we give back we Mentor we have professors but what we're all looking at our goal is the same how do we educate our babies and at the same time how do we work together thank you and the gentleman that gave you their minutes did a good job thank five total all right go for it um first uh I don't know if you know my name my name is Tracy light um I was basically raised here in Las Vegas Nevada I want to first uh start off by uh giving my gratitude uh for inviting me to speak today I won't take a my time is limited so I'm going to go ahead and get right into it I'm going to go ahead and read off some data and uh I'm willing to share my speech and my cited references with my data with anybody that may need it um I want to first start off with uh I'm gonna hit three bullet points I'm gonna I'm gonna hit on incarceration of minority citizens minorities in a position of elected higher power in Nevada as well as our constitutional rights continuously getting violated on a daily basis um according to the College of Family Foundation using uh information on the U.S Census Bureau since 2015 and the current population blacks represented more than 29 percent of Nevada's uh populations versus uh Nevada's prison population versus nine percent of our general population Rights Make Up 44 of Prisons versus 50 of the general population and Hispanics represent 21 of our prisoners versus 28 as a general population um basically uh like with that being said then I hit on minorities in position of elected power in Nevada while researching data uh with my my associates and I we were unable to find um a percentage of how many minorities are held in higher elected positions of power within the state of Nevada since Inception as stated in 1864. we classify elected higher power as a mayor Governor Center Representatives what do people believe that this information is integral in tracking our history are in our growth this would provide relevant positions change can and does start at the bottom but it starts with our elected officials um on our uh now I'm on to our constitutional rights unconstitutional rights I could not find data regarding the constitutional rights that have been violated by our police officers in the state of Nevada as well as we were unable to find any data regarding police officers that have been convicted for violating the Constitutional uh our constitutional rights in the state of Nevada we're also unable to find any data regarding schooling and teaching of the constitutional rights to our to our uh to our upbringing so that they can be educated on defending themselves when our constitutional when their constitutional rights are being violated while all this data is important we need reforms when you change tangible viable sustainable change that can be operated from State all all the way down to our community excuse me we need reforms on how to please our on how police are held accountable for their crimes especially when they commit our constitutional rights on a daily basis as well as excuse me we need reforms on our police are held accountable accountable for crimes and violations the constitutional rights as our citizens we need to teach our police how to become part of our community they are policing we need to teach our police how to gain the trust of our communities they are policing we need to teach constitutional rights to our students we need to end mass and cautionary incarceration of minorities in our state we need to reform laws that are allowed that would allow our minorities to um to not be arrested and we need to educate we need to be able to educate our citizens here in the state of Nevada to reform laws that allow minorities to not be held convicted and sentenced for minor offenses to be profiled and arrested arguing with an with an officer when there is no Act of physical aggression a part of the person being confronted by the officer we need we need to by Nature end nature to support our diversity in our elected official as higher levels of the state while there is so much more that can be done I believe that this is a decent start we need to start we must start thank you very nice thank you they gave you good minutes you made a good comment ma'am and your name please hi my name is Sue Ann Cornwell just like it sounds um I've I've been actually calling your office three times a week for three months trying to uh bring the healing Garden to your attention and the damage and stuff that's going on down there and I know my partner Here Eddie he he brought all this up so right what I would like to address is the solutions that we've come up with that we just can't get done that we've tried to get done for over a year like moving the lights from the floor to the top of the walls to where the people can't get to them and damage them and hard wiring in the the water feature down there so we can get rid of that plug so they don't have a reason to go there and plug their phones in and charge them maybe put porta potties across the street at the other section that was built down there by the city so they have a place to go to the bathroom other than and you've left us your card with your phone number I have I have it right here would you be sure to give it here we can either for Mr Cervantes he has it so thank you we appreciate okay thank you or give it to our clerk she can come up here and get it and we'll do it yeah we just it's gotten progressively worse so we just really need to to get on and it's totally between between Eddie and I and I'm a survivor of the shooting one of the 58 people Denise Burdette has passed away in my truck on the way to the hospital that night so I'm emotionally investing in you know we appreciate it all right thank you stay on it be our eyes and ears and help us thank you that's what we want thank you excellent thank you yes ma'am good afternoon my name is Sherry Royster that's r-o-y-s-t-e-r I'm the legal director for the ACLU of Nevada um I want to make two points um one being that I heard the gentleman speak earlier and he made a comment that black people weren't supporting black people because they weren't showing up to help him with um whatever Adventures that he has going so I want to just say black people help black people in a number of ways and it does not have to be that but I also want to say I've been in public service positions majority of my career I've worked alongside of police officers and I've also had to hold them accountable when they did something wrong um recently we had this pandemic happen and I watched how everybody came together and made sure right away we got everything taken care of suddenly magically calendars cleared up the whole nine I don't see how people don't understand that the killing of black people has been a pandemic for years and what we're asking now is for everyone to make the time to have those conversations there's a number of organizations including the ACLU that is asked to sit down with those leaders and have that talk and we're still open to it and certainly please reach out for the continuing conversations with our attorney's office which is Mr Scott now and has been with Mr Jericho as a very good relationship with Todd's story so I'm sure you know that thank you absolutely thank you yes sir okay you want to give our card here is another card two minutes then you thank you wait okay a country built on the backs of slaves and maintained by A system that in and of itself was designed in order to keep up the psychological illness of of white supremacy cannot be changed by making simple revisions and modifications what it needs is courageous leadership when we talk about the police and we talk about an overseer system that is designed to maintain that white supremacy what it means is that people need to be courageous in looking at that police system and looking at the way that it should be reformed not defunded but reformed it means that there needs to be a change in the way that the finances that support that overseer system that police force are distributed we need demilitarization of the police force we need funds going towards education in black and other minority communities we need funds going into health care so that the disparity that becomes so obvious when we have a pandemic like covid9 can be addressed black women who are pregnant and they go in for prenatal care and they're dying as they deliver their babies at rates that are uncomparable to other racial groups these are the things that we need to look at we need to look at how we get into our educational system earlier and getting in touch with our youth so that we can direct them away from the prison system and towards greater opportunities what I'm asking for is the council to step up and provide the leadership that is required bring a commission together and get individuals to become from the community to become part of that commission so that we can work together to make the change that's required but it takes correct courage and it takes leadership and it has to come from the council thank you not to respond but just in general if you'd be willing to get in touch my office we have an entire plan called The 100 Planet which I love to sit down and go through with you which addresses many of your issues I should say many of our issues thank you thank you yes ma'am your name is these I'm Annette Magnus and I'm the executive director of battleborn progress I rise in opposition to the racist and unnecessary backpack band today I was at the protest in Las Vegas two and a half weeks ago I stood between between the police and protesters as they peacefully exercised their first amendment rights and were met with an extremely aggressive and unwarranted response from the police I wore a backpack to the protest it held first aid kits PPE milk to defend from Metro's liberal use of tear gas small blankets to Shield against pepper spray and water our First Amendment right to protest restrictions like these do nothing but encourage more interactions with the police that black and brown folks already do not trust I brought that same backpack with me today and no one said a word to me as I walked in because I'm a white woman but those other protesters I stood in front of the other day do not enjoy that same privilege to go armed mostly white militia men like the Bundy type said Michelle Fiore supports took to the Grand Sawyer Building without a protest permit to advocate for Dangerous reopening of Nevada thank you thank you yes ma'am this excuse me this lady has the extra minute okay thank you your name please my name is Sharia goodlow thank you so much councilman and councilwoman for taking the time out you know I I I'm so sorry and I I don't want you too many mouthful well could you hear me can you are you able to lift it up a little I'm sorry I'm sorry is that better ah all right yes and would you repeat your name please yes ma'am I will my name is Sharia goodlow and that's spelled g-o-o-d-l-o-e I want to thank you councilwoman and councilman for taking the time out to listen to your constituents I am a constituent of 89106 Clark County I am also a former resident housing commissioner where I serve my community greatly I started as a resident council member which I spoke to you many years ago inviting you into our community I'm just here to make this statement on how I do not support the NAACP I do not support the men and women who come in here and call themselves black and colored it shows how here in the state of Clark County how we have not been educated and for me to just quickly explain ourselves is that black is a noun white is a noun meaning it's a color that does not describe a race in a nation of people and I think that that is something that we need to educate our constituents here in Nevada because I believe that that is causing a lot of organized confusion and I'm going to say that again this is organized confusion and I know that uh assembly Mumford when he was in office that time he passed a bill with the school board stating that you guys educate us I stand in the principle of love peace freedom and Justice and I believe in being our server Mr citizen I truly believe that once we all Proclaim our nationality that all of this racism and that you guys call discrimination was cease because then the Constitution law would apply to us I am offended that people are calling themselves black because I'm not a property if anyone do their proper research blacks means property under the confederation of the United States I do understand that the Moorish Empire is entreaty with the United States which is called the peace and friendship Treaty of America and everyone talks about Constitution the one no one talks about where we actually adopted these laws and procedures and I just hope that the men and women and everyone in this room take the time out to do proper research to understand nationality not racism thank you mayor thank you thank you yes ma'am good afternoon everyone my name is Chelsea Faraday that's spelled f-e-r-e-d-a-y I just wanted to let you guys all know that as of 2019 Nevada was ranking 35th in education and we got an overall D plus so I propose that we defund the police and demilitarize them and use the money that we use to buy tanks to educate our children as the last woman said however I do support the NAACP and everything that she said earlier today um I am also calling for accountability of all of our officers and as well as all of our public servants as you guys all are um I ask that we make the officers make a report every time they pull their gun out on on a citizen that will deter officers from pulling their guns out on people and killing people when they don't need to if they have to file a report and that report should also be made public so that everyone can see the reasoning that that officer had behind pulling out his raised I didn't get that make the what your your company make their own Nevada or make the I can't remember that part thank you yeah that's my shirt um I'm a political report and they want to make the world Nevada born and raised here in Las Vegas proud Mexican American um I'm here because I am asking you mayor and council members to repeal the ordinance banding fanny packs backpacks at and essential items at protesters as I have been at almost every single one of these protests and have seen the need of the community and these this ordinance only furthers criminalizes people trying to express their First Amendment right which is not right and I have been there have seen the excess support of police officers as I was walking to my car and being shot at with rubber bullets so I further plea that you are re think about this ordinance and repeal it that's it thank you yes sir hi Matt my name is Michael Corsini q-u-a-r-c-i-n-i yes I'm here today to uh speak from Michelle I happen to be at that meeting Saturday when supposedly Michelle made negative comments unless I was asleep I didn't hear any of that um I grew up in an Italian neighborhood back in the 1950s where we were Italian polish and black and I have thousands of associate black Associates I have hundreds of friends I coach little league Inner City Baseball I go to an inner city church I did not hear Michelle do anything but defend the police same blue lives matter also and I haven't heard one person here today talk about a young man that was shot in the back of the head that's going to be paralyzed for the rest of his life because of somebody that hates the police it's so sad We Are All Made In God's image each and every one of us color means absolutely nothing and what happens is the politics that come into the into this cause dissension amongst God's children thank you sorry how many minutes do I have anything yes sir one minute yes one minute and you're not counting your name please your name sir my name is Cyrus hojati c-y-r-u-s-h-o-j-j-a-t-y I'd like to point out that even though Michelle Fiori's comments in terms of her style of her communication was harsh I just did not really see it as racist because the fact is that she was speaking out against affirmative action and affirmative action believe it or not discriminates not only against whites but against Asians and including people like myself Iranian Americans now I like to say though that I yes I do believe there are problems among certain minorities I was at the marches four times and yes I do believe sometimes the police can be harsh a lot of times we were just marching and they were aggressive for an unnecessary fashion but the question is and despite the fact I have a lot of respect for Metro Police and I am opposed to the backpack ordinance what is facing the black community is the number one issue I believe well the fact is could it be that 70 percent or so of children are born out of wedlock and according and according to some statistics we are minutes up so sorry sir thank you it's not going to be heard I've cut off your mic so thank you very much next next person anyone else country aren't going to be solved by one side winning and one side losing but by both sides coming together that is not going to happen if we focus on the things that divide us to that end I refuse to let anybody dictate the things I can and cannot talk about and the words I can and cannot use I wholeheartedly believe that every life matters let me repeat that every life matters that every person must be treated with dignity and respect that bad cops must be prosecuted and good cops need to be supported I have no hate in my heart and won't let it be placed there by anyone thank you madam mayor and expressing their constitutional right whatever side you were on I think is great that you come out to this public body to express yourself and and don't forget we meet every other Wednesday we're here every every other Wednesday throughout the year so whatever your concerns are we are here to hear them in dot the Nevada Department of Transportation is currently working on a half mile long upgrade of Washington Avenue between a streets and Las Vegas Boulevard and downtown Las Vegas the project costs for a milling and placing new asphalt pavement as well as reconstruction handicap ramps the right traveling in each direction is currently closed and project is expected to be completed by June 30th motorists should use caution while traveling through work zones a heat construction signage and take alternate detour routes if possible indot works with ways to inform the public about planned Highway restrictions but unscheduled construction changes closures and restrictions are this community is that I have been bragging for 10 years at least if not more that I consider ourselves a family a large beautiful diverse family of different religions races cultures ideas thoughts passions everything and I will not be deterred from thinking that and moving forward trying to help everybody accept the good that exists in everybody and stop complaining and fighting and being angry and being accusatory but thinking about what can I do to make something better each one of us does that we're going to be fine since Rodney King that's been 22 years issues are still there and I listened to little children who espouse whatever their parents think their children and they're growing up and we are leaving them this community we have a lot more to do and screaming and yelling and fighting and complaining doesn't help your counsel and I've known them all and I know them now are here to serve you all of you in this glorious community that we're responsible for and it only can last and get better in this very difficult pandemic and shutdown if we all continue to work as one family and somebody mentioned that I said yesterday I don't see color I never saw color I just see people from the time I was a little girl with neighbors from different communities they never saw a difference I saw friends I saw people of value and I am outraged that people dare to accuse anybody on this Council from trying to do their own best every day of their lives no matter where they come from I want to and thank you Marshall I heard your phone go off which was good that was probably my husband saying enough Carolyn stop talking so it didn't have a duck sound though that's I think his sound I want to start off by thanking our staff I want to talk to our city manager and his staff who are so patient and work so hard every day through this crisis of this pandemic and through all the issues that are here so Scott and all your team and our brand new City attorney and his sidekick to his left who reads so beautifully I want to thank our city clerk who really does an outstanding job and her Sidekicks who actually make everything work so well David riggleman and your team at in our public information office wow I just can't thank you enough you just reach out all the time and you just are part of the legs of every table we all sit at as we talk together to make this community stronger and better and get to the truth and don't work negatively in anything and of course our I.T Department that hides behind that mirror over there and over here that does so much for us but I really Beyond everything and all the thanks that goes I want to thank our city Marshals our fire and Rescue every Department but the city Marshals who stand so quietly all the time to take care of each one of us whether it's part of the city hall contingent or its people in our community in all parts of our community you're a beautiful bunch of people the men and women of our city Marshals office and our fire and Rescue Tim hacker Michelle Freeman everybody that works so hard and those who come in here every time we have city council to take care of us to take care of our community we're very lucky every day is very precious and what's wrong is we always blame somebody else for something we can do something about and for anybody who points the finger at anybody else look at yourself first it starts with each of us not everybody's out of order and you throw pins and things at people in your own family and complain about them ask yourself first what am I doing to make it better there's no entitlement this is our world and we're passing it on to the next generation every child that's born every single day deserves to be a wanted child and that demands love and care and education and an equal playing field that means education that means the opportunity to have opportunity and so we together as a group of people all of us that serve as your elected officials don't think for one moment that any one of us is trying any less hard than anybody else so this pandemic and this budget you think we have money coming out of our ears there's no money all you have to do is ask our city manager to get us through this entire problem of the shutdown in our state we alone in Nevada are the only state that's 100 dependent on tourism and so many of you that are calling and even speaking today that you can't get your unemployment all of us are Fielding calls all the time and when you're crying and you're down to your last ten dollars twenty dollars and they won't answer you we wish we had control it wouldn't be this way but we have none this is a state issue and all we can say to you is keep trying we have a lot to do a lot on our plate and be assured that all of us are trying we love our community We Are One family and if anybody in our family hurts anybody look first to yourself what can you do and stop complaining and then reach out to somebody else to find out what they're doing to help and get us all together to continue working together with a plan we shut down we had no plan how do you open up we shut down we had no plan how our people survived with nobody coming into our hotel rooms there was no plan we have been working and there's not a one of us sitting up here including Michelle Fiore who is not here but her chair is here there's goodness in every one of us that's trying so hard and you have elected us to take care and help this city well that's what we're doing so please know we need your help we listen to you all the time it's like raising children together as a family we're the adults and we got a lot better to do we have more that we need to do together the divisiveness in this country is wreaking I didn't grow up in that never I've never seen so much divisiveness and we sat this morning and we have sat through this afternoon I want to thank everybody who gave us the time and the patience to wait because we had business we had to do and they would just be getting started at 2 30 had we reversed this so know that life will be better we are a rainbow of people and we know and will continue to learn to accept each other support each other and help build a stronger well for us we're responsible for Las Vegas the city of Las Vegas is where we work we'd love to embrace the entire State and all of Clark County but we can't affect except with conversation the county the state as you heard people talking about those are not under our control and we don't have home rule but we will keep trying so have a good weekend if you are a person of faith we need a lot of prayers right now and for everybody else and again for those in our law enforcement they don't deserve to be painted with the brush of those who really are evil people whether they're in law enforcement or they're in construction or in the school system there's a lot of evil we have to focus on the good and make it work so have a good weekend
