other day when there was an accident uh with injury uh and pictures and how they they shut down the dandini and with the police officers at the bottom of the hill and the accident right where they're planning on putting the main access point uh that happens quite frequently cars drive into the ditch but the accidents aren AR always reported because they're not always injury accidents I did talk with the Sheriff's Department and ask them about all the closures that happen every winter and they say those don't always aren't always reported uh because those are officer decided decisions that happen at night so almost every time there's snow dandini does get closed at the Sheriff's Department's uh whim when it's just too snowy so the idea of uh bringing in uh 400 units that will be generating 2,800 uh traffic uh things um on a hill get closed all the time uh I don't think it's a good idea thank you thank you for your comments sir go ahead didn't state your name for the record but please uh fill out a request to speak for him and turn it in you did okay I'm Mony Turner I'm sorry could you please come up to the microphone before you start speaking thank you I'm Montgomery Turner and I've got the same questions he has the problem I have is one is traffic the blind Corner bad weather and then crime we have a huge problem up there with crime we do it's bad really bad nothing is safe you can't bolt it down bad enough it'll it'll be torn out my mailbox is on Springs that's how bad it's been hit so many times um flooding issues down there at the corner of dandini and lenio they all get flooded every year right there and I mean bad floods 4 to five feet deep down there close I mean you guys can't um do that the wash going through there is just bad on the side you guys are putting your roads in was it right out the other thing I have is fire I mean we got all kinds of stuff going on around there right now that's ready to burn and everything else we're just terrified of fire right now real bad and then the other one I have is noise I mean where we live we have a lot of noise from dandini and everything else but but this would create a lot more people going to start their cars in Middle night they're going to be up there arguing slamming things it's going to be noisy up there the other thing the shooting range from waso County that shooting range when they shoot at night when the officers are qual ifying we thought we were invaded a few times when they're running flashbangs the SWAT teams are running flashbangs up there we thought we were being invaded we really did that's going to be a problem for you guys not us but you guys now let's talk about the highway they're going to put through there anybody talk about that yet treated since 1960 I didn't know it when I put my new home in but they told me when they decide to come through Adit domain they're going to pound right through there so there's a freeway going through there just item four approval of minutes for possible action approval of the minutes from the regular city of reeno Planning Commission meeting on September 4th 2024 are there any questions abstentions or discussion items from the commission on this commissioner dracul I was not president at the meeting I will be upating uh just for the record I also was not present for the meeting and will be abstaining I on the other hand will make a motion to approve the meeting minutes okay we have a motion and a second oh sorry we can go ahead have a vote sorry about that I had a lapse uh all those in favor I I I oh motion passes unanimously uh the record just strike that I voted I was supposed to abstain so apologies for that okay closing item four and moving on to item five public hearings uh any person who has chosen to provide his or her public comment when a public hearing is heard will need to so indicate on a request of speak form provided to the secretary alternatively you may provide your comment when item three public comment is heard at the beginning of the meeting we'll begin with item 5.1 LDC C 25-1 apartments at dandini and we will take a presentation from staff good evening members of the Planning Commission waiting for my presentation there we go uh Jeff Foster associate planner for the record uh bringing you tonight the first case uh LDC 25001 apartments at dandini this uh undeveloped 60 and a half acre parcel is on the north side of dandini Boulevard about 860 ft west of its intersection with Sun Valley Boulevard and this is east of the trucky Meadows Community College and the desert Research Institute the request is a major site plan review that would allow Hillside development Cuts grer sorry yeah grading resulting in Cuts uh greater than 20 feet and fills greater than 10 feet and disturbance of a major drainage way the immediate surrounding uh land uses include undeveloped Parcels to the north south and west to the east you have single family residences also to the north you have Lois Allen Elementary School and the aforementioned TMCC and drri to the West the key issues are compatibility with surrounding land uses site design Hillside develop vment and Grading major drainage way disturbance sewer and traffic and access the zoning district is mixed use Suburban which is intended to accommodate a mix of low intensity Auto oriented uses while supporting the gradual transition of the city's Suburban corridors to a mix of higher intensity residential retail commercial and other employment and service auto service oriented uses the master plan land use designation is Suburban mixed use and here are a hand full of goals and policies that are supported by and support the proposed project regarding the first issue that staff looked at is compatibility with surrounding land uses the surrounding land uses are mostly undeveloped as well as residential and educational facilities including the aforementioned Lois alen Elementary School indicated here primary schools are typically located near residential uses because they are considered complimentary land uses in fact students could walk to the school via the sidewalk connecting to Sunflower Drive shown here the proposed buildings are generally located as significant distance from residential property lines indicated here and uh condition number five requires restricted construction hours uh to further uh reduce impacts on those single family homes given all of the above the proposed use is generally compatible with the existing land uses in the area in terms of site design the project proposes 402 units in 14 buildings on about 27 Acres three distinct areas a b and c uh which are situated to work with the topography the buildings are clustered on portions of the site to promote fire safety protect drainage ways and avoid ridg lines and other visually PR visually prominent areas including the rock outcropping between areas A and B indicated here and shown in the picture at the bottom condition number six is included to protect the outcropping as it is close to the grading limits for area B uh the project uh sorry potential visual impacts have been minimized through site design structure location and Architectural treatment including height limitations and colors consistent with the surrounding environment continuing with site design the final site Improvement plans will include a 10-ft wide multi-use path along the project Frontage between the entrances for areas a and C there's a school bus shelter proposed for areas A and B indicated here a school bus pull out in front of area C is also proposed as indicated there the was County school district has collaborated with the applicants representative on these proposed bus uh pickup and drop off locations the proposed plan and location routes locations and routes are adequate for the school district's ability to provide School transportation services to the development as indicated ated by School District staff um staff is proposing a new condition number 14 to formalize these requirements or sorry these items and that memo was uh provided to Planning Commission yesterday describing that regarding Hillside development and Grading uh per code Pro the project is considered a hillside development as slopes exceed 15% on over 25% of the site many of the steeper slopes on the parcel are within the northern portion of the site and are not proposed for development the development areas are mostly within the 0 to 20% range which are the green and yellow areas primarily on the southern half of the site uh the project is required to have a minimum amount of open space of about 19.3 Acres RMC also requires additional open space to be provided at a rate of 2 to1 for development on slopes 30% or greater since the project proposes to disturb about 79 Acres of those slopes and additional 1.5 Acres of Open Spaces required bringing the total to about 20.8 Acres of open space the project proposes to uh about 34 Acres of open space which is about 56% of the site uh would remain undisturbed and preserved regarding Hillside development and Grading uh the grading plan depicts four primary areas shown in blue where Phil is anticipated to exceed 10 ft in height and two areas shown in red where Cuts deeper than 20 ft are proposed the deepest cuts are about 35 ft and the maximum fills are about 25 ft and it should be noted that those areas as you can see are proportionally relatively small Disturbed areas will be designed to reduce overall scarring and retain a natural appearance through contouring revation and landscaping retaining walls will be utilized where necessary to further minimize grading grading practices uh have been grading practices appropriated in hillsides have been Incorporated and include Hillside adaptive architecture such as stepped buildings in a few areas that would follow existing slopes and reduce the amount of required earth work um all areas disturbed by grading and developed the developed core that will not be formally landscaped or developed with walls will be receded with a mixture of grasses and shrubs consistent with the existing on-site vegetation to provide a transition to native plant species staff is recommending conditions 7 to9 to further address enhanced grading techniques including treatment of slopes rip wrap and noxious weeds to further improve the hillside development in terms of the major drainage way disturbance there is one drainage way on the parcel that crosses from west to east in the northern portion of the site and drains approximately 153 Acres you you can see it uh here the it is a natural drainage way except for disturbance from an existing box covert shown here the natural drainage way is essentially in a stable condition there is a new box cul that is proposed for the required secondary access road all disturbance associated with the installation of the Box Culvert will be stabilized and revegetated with Native and drought tolerant species adapted to the project area the applic materials indicate a portion of the off-site flows are proposed to be routed to a detention Basin within the drainage way that is created by fill necessary to construct the secondary access road though code does not specifically prohibit location of detention basins within a major drainage way RMC States no gradient shall occur within a natural drainage way except for what is required for construction of bicycle and pedestrain paths or necessary roadway or utility Crossings condition number 10 is included to require the applicant to investigate and analyze other methods for required flow mitigation that do not rely on further disturbance to the major drainage way regarding traffic and access the Sun Valley Boulevard Clear Acre Lane and dandini Boulevard El Rancho Drive intersection is projected to operate at an unacceptable level of service e under the PM peak hour cumulative and cumulative plus project conditions optimizing the signal splits at that intersection would allow it to operate an acceptable level of service and that's condition number 12 you heard a few minutes ago uh regarding the RTC uh project RTC has identified that phases three and six of the US 395 pyramid connection project include elements that run directly through the parcel subject sorry pursuant to the applicant subsequent con conversations with RTC staff the intent of their comment is informational for the applicant in the City of Reno RTC has not not initiated a right of-way acquisition process to secure land rights for the alignment and there is no Nexus for the connection project to be uh to prohibit approval of the current entitlement application here is the first set of major site plan review recommended findings staff can make all recommended findings there is another set of mspr findings for projects of 10 acres or more these are listed here and again staff can make all recommended findings here's the recommended motion um you did receive a memo yesterday outlining two proposed condition changes condition number two is proposed to be changed from 18 months to 24 months to allow the project more time to work on the uh sewer improvements that are required and the aforementioned condition number 14 to formalize the school district's uh improvements um and I'm available for questions thank you do we have a presentation from the applicant good evening Stacy Huggins for the record yes I have a presentation although it Mires Jeff's so much um he did a great job summarizing this project so um forgive me for some of the duplicity in my presentation I will try to um not repeat everything he said because he he really did summarize this very very well um I'm going to just skip forward around a little bit Jeff mentioned the zoning on this property mixed use Suburban multif Family Apartments are a permitted by right use so um I mention that because really if this site were flat um we would probably be able to go straight to building permit for these 402 apartment units on this property um it's not though as Jeff mentioned uh we do trigger Hillside development as you can see on the image on the right the buildings um have been located on this property within the areas that are primarily green that's the lowest slope category you can be in area a area B directly north of that and then area C is down in the Southeast corner of the parcel um in the Little Triangle part so um we really did take a lot of sensitivity to locating the building and keeping the project within those flatter slope areas so that we were not impacting steeper slopes on this property uh we're also looking um at the major site plan review as jefff mentioned for cuts and fills uh and he talked about that and you can see those that same imagery in the bottom leand corner of this and then the major drainage way disturbance um which is also um was touched on by staff the emergency access crosses the drainage also an area um of fill so those those are the three primary requests for this project um that we're asking for tonight uh I don't know that there's anything on here uh the density on this project again with 402 units we're at 14.8 the mixed use Suburban doesn't have a density limit on it so um again I mentioned the density we did not maximize the density on this site we were sensitive to what was happening uh topographically and environmentally on this site and that's why you see the project that you do in front of you tonight uh Jeff mentioned oops sorry Jeff mentioned uh 27 Acres of the parcel are Disturbed 34 Acres undisturbed native 56% that's um more than half of the site that we are not touching for development um this project will include a clubhouse with a fitness room and a pool and a playground area and really I want to just mention that these apartment units are intended to serve the surrounding um drri and TMCC in terms of uh Workforce housing or student housing so um the goal is that you know students going to TMCC could live here and have quick easy access to school or the same thing for the drri employees um so this is a good location there's not a lot of um apartment housing uh in this general area so we believe this is an appropriate location for this uh the access to this site uh we mentioned or it's been discussed that dandini is the primary access to the project area uh there are two different access points the one on the west to the main comp uh main parts of the project area A and B uh will come in off of dandini there will be a roundabout that roundabout at the entrance has been sized to accomodate a school bus so the school bus you can see there that's a school bus stop um we'll be able to pull into the site it will go through the roundabout and then it will be able to come back out and go either down dandini or up dandini um depending on you know its direction um at the area C there will be another um improved bus stop that'll actually be a pulloff with benches um as we agreed upon with the school district early on we worked very closely with the school district before we finalized the site plan to make sure that they were comfortable with with what we were doing on this site for schools um students going to the elementary school will have the ability to walk to the north up um on the emergency access road and connect to Sunflower will they were where they will be able to go north and get to the um Elementary School directly north of there the school district um was satisfied with these improvements and felt like they could um move forward with this project from a school district perspective uh as part of the um connecting the two sites we will be installing uh a new 10 foot wide multi-use path on the north side of dandini that's that blue dashed line between the two bus stops um that will not only help you know students going up or down that area but also provide connec ity between the two areas since really these are two projects are uh one project we wanted to provide that pedestrian connectivity that little road you see in the middle is a utility Access Road um it's there for Tuma um should they need it for uh utility access um we talked a little bit about traffic I want to just mention you know for the 400 units uh this project our traffic study was done in April of 2024 so it was done during school school time um that during the study um numbers or the the study approach the numbers estimated 283 ADT would be added to this road dandini is a minor arterial uh the current numbers from par Boulevard the counts estimate about 7,000 average daily trips on this seg on this portion of the road so our 2,000 trips that we're adding to it at build out with this project uh are well below What a minor arterial could accommodate um so I just wanted to mention that uh I also want to mention that um I know that Peak trips are very important and we look at them in terms of um the intersections so this project again at buildout is estimated to generate 205 PM Peak trips um we know and have acknowledged that there are some um of service issues at the Sun Valley dandini intersection uh in the um cumulative and cumulative plus project time period and we are working with endot and RTC to identify a solution and mitigation for those problems so we don't have that solved yet um but we are working to have a solution for that and our Traffic Engineers here tonight if you have additional questions he can certainly get up and talk a little more about the traffic study um the other thing I wanted to mention is that we are required um and have agreed to provide a deceleration Lane for turns into the areas A and B so um when this uh when dandini is um improved for this project it will include a diesel Lane coming from the East turning right into the project we have also agreed that um we will install a an eastbound left turn lane off of dandini um to further mitigate for traffic concerns on dandini and traffic coming down that road uh this just points out the area to the north that we are not touching you can see it's shaded back a little bit uh I don't need to repeat that I think staff did a great job talking about the cuts and fills um just very quickly so you can see what we expect these buildings to look like uh these are three story buildings they're approximately 34 feet in height um we're going to see a range of unit sizes two three and four bedroom units which is um uh usually not something you see four bedroom units usually bumps people up into a single family house so um we're looking to offer a unique opportunity here with these units this is just an example of what the clubhouse will look like I mentioned that's up in the front at the main entrance of area a that concludes my presentation uh we have reviewed all the conditions and we agree with them including uh the two um that the one that was amended uh and we appreciate you considering the additional time um for that and then also the one that was added um to accommodate Washo County School District so if you have any other questions I'm happy to answer them our team is here we can answer them great thank you uh we'll bring it back to the Commissioners for disclosures commissioner Basera sure um let's see I spoke with the adjacent stakeholders the was County Sheriff's Office TMCC a few residents I read and reviewed materials and uh spoke with the applicants representative and the applicant as well or yes that's it commissioner Dracula CH familiar with the site R and received emails and the applicant reached out briefly and we didn't communicate beyond that commissioner warm yes I read and reviewed um emails I received a text message from the applicant representative but we didn't have follow-up communication very familiar with the site um and I am working for TMCC thank you commissioner lvr Christina dropped off the call so she's not currently in the meeting okay uh we can maybe just circle back uh when she's back on commissioner Armstrong I read and reviewed emails uh familiar with the site no further disclosures um just move uh we'll go ahead and move back to public comment um I don't have any requests to speak forms no request to speak forms no correspondence for this item anyone on Zoom no one in the zoom anyone in the Chambers wishing to speak on this item um go ahead you can do public comment on this item we just ask that you fill out another request to speak for him absolutely great thank you you'll have three minutes again Sean McGrath for the record uh as you notice these are three-story buildings there is nothing in the area anywhere near Sun Valley that has three stories so that of course doesn't match but it definitely needed for student housing I'm not against this project at all what uh my problems are of of course is with the traffic we are adding 25% more traffic to the road and supposedly that small arterial can assume it but again this does gets closed in the winter uh I would like to see as RTC has proposed uh extending rajio away North and maybe having the developer help extend that out and have the exits move out towards that way a safer Direction so it's not on the main arter arterial um I also uh am am concerned about the the development of that 21 AC uh as for when we do have snow uh that snow is going to have to run off somewhere and I'm not sure the Sun Valley Storm dreams are prepared to take that all of a sudden that extra uh water that's not going to be absorbed into the ground and be pushed into that uh natural drainage way uh I am concerned about that um I think it's great that the development is going to go in for teamcc and drri but I do believe that that primarily that's on that side of the valley and that's where they should exit is up towards Ward that direction so maybe we should put a road up there and and not D come directly out into the arterial but come out onto a side road I think that would be great thank you thank you Mr chair before we take more public comment I believe uh commissioner Del Lear is back on if you want to ask if she has any disclosures great thanks right commissioner noar did you have any disclosures uh for this item this is commissioner W I do not have any Turner again again I'm a little worried about the drainage I'm really worried about the traffic because I'm going to tell you I've lived there since 1978 there's been times it's taken me hours to get home hours and it doesn't it it's been happening a lot more lately than than not somebody has an acccident on clearer it's done game over dandini's hit when the freeways are shut down dandini has been the main through through Fair it's been pretty rough up there and then again with with the with the problems we're having it up there with people's backyards what about their privacy and stuff anybody think about that yet because there's a lot of homes up there that that their windows and everything are turned that way so they have privacy and stuff so there's a lot of things about that so that's Staff or the applicant commissioner dracul thank you chair uh question for Jeff please just help clue me in a little bit more so 422 units 2,800 trips I guess I see maybe my first question we feel like these are going to be affordable housing you know uh lower income families is this what we're seeing out of this project most likely I would Reserve that answer for the applicants representative to speak on that okay it I I'll I'll have her up in a second and so I'm just wondering how much traffic is going to go West on dandini and then obviously my question would be we've got Allen Elementary is that sunflowers well I'm just I don't know the elementaries that much so just north of us which two schools are there so Lois Allen is directly north and then I'm not sure if what the other she mentioned sunflower and I guess that was sunflower is the street that the thank you that the uh connection to the the fire Access Lane shown on this picture uh would connect to Sunflower and the students could walk there to then go to Lois Allen thank you very much and then the middle school which one would that which which zoning would that I do not remember I do not remember what the Stacy do you know the schools you guys can TCT team sorry to do it to you like that what's that I know they you guys she can come up if she wants an answer because what I'm really just trying to understand is traffic flow which direction where are a lot of these families going to be headed whether on school buses or driving um obviously parents or anybody working might choose to go West on dandini it sure feels like a lot will go east and get down Clear Acre yeah the applicants uh traffic Consulting could probably speak to the splits the directional splits where they would be heading on that um and Mike Michelle is here from engineering as well if we want to get further into those questions Mike let's rock it brother love bringing you up go Stacy please yeah go ahead and just let me know middle school and just just really quick and then I I'll I'll turn it over Stacy Huggins for the record so um the middle school is desert skies and I do not off the top of my head recall exactly where it is in relation to the school or to the project site um and I do want to tell you that yes this is intended to be more on the affordable housing project side ultimately okay yeah that's what I assume and obviously if we have some TMCC students there'll probably be a mix in there if it's affordable for them but and that and so Mike can come on up and just help me understand the splits Mike Michelle engineering manager for the record of the total project uh traffic generation only 5% had West on dandini the others the yeah the others are using uh Sun Valley and Clear Acre okay that that's a lot lower than I thought okay and I and I'm respecting the public comment because I don't travel dandini almost ever um and if you know winter time or whatever it is or even just the trip's going that way so we are going to see a lot heading east and then more or less heading south on Clear Acre correct uh and for my fellow Commissioners Desert Sky per Googles is the very North End of Sun Valley so they'd be going directly at some Valley Boulevard I think you answer my question appreciate it thank you thank you commissioner B sure thank you chair um oh you know what do you want to answer in on some of that do you mind for the record Brian G with wood Rogers please um in addition to the 5% heading west on dandini there's another 10% projected to Head West on rajio Parkway so that's a total of 15% heading in the General West Direction so just wanted to clarify that thank you appreciate it all right sorry chair my apologies good thank you uh commissioner Basera round two thank you um I think for Jeff um would do you mind bringing up slide 12 uh please on my slides or um if you can bring up my presentation 12 you said if my eyes aren't deceiving me all right money um okay the last bullet optimizing signal splits would allow it to operate at an acceptable losos um I'm a little confused by that only because there was a letter from RTC dated July 31st 2024 about a little over a month ago that seemed to disagree with that and they had concerns so I was wondering um was that resolved with RTC since then so the RTC letter that I'm familiar with uh focuses on the connection between the US 395 pyramid connection uh that I mentioned earlier um if it did disagree with that um staff staff uh is in agreement with the uh traffic study recommending the the optimized signal splits at that intersection so um even though RTC May dis agree um if that is the case and I apologize that I don't recall that traffic letter do you guys have that letter did they address the concern that commissioner Basera is talking about do you want me to address that if you wouldn't mind I would defer to the applicants traffic consultant on that but but I would say just in general again that even though RTC or OT or some other agency might have a a concern um you know on various things ultimately the city is the you know is the Arbiter of this and and our staff vetted the traffic Consultants uh report and agreed with it as proposed so sure like fellow commissioner dracul mentioned let's this tag team come on up again for the record Brian Gant with wood Rogers so the uh I guess to parse things down a little bit in the comment from RTC it wasn't uh it wasn't a comment suggesting that the optimization for the signal at that location wouldn't work on its own it was a clarification that this signal is in coordination with signals north and south of it and therefore uh would have to be looked at as a unit across all three of those signals um so I it's kind of a Nuance um and that further investigation is required and that uh from an RTC perspective and um that uh a mitigation of optimizing this signal from their point of view um needs to be further expanded to the signals on either side because there's that communication element between those signals okay great thank you so much and chair if I may just have a follow up here yeah of course um just going to kind of continue on this because we had we did have some good uh public comment or feedback uh for consideration from Mr Turner and McGrath so appreciate that um and our lusterous administrator might be able to clarify something here but uh I guess um for staff maybe for Jeff I'm sorry to kind of pull you back up when we're talking about traffic and congestion do do we look at this solely like in an isolated view with this project or do we consider other potential projects coming online in the vicinity and and I and I pitch it that way because I'm aware and this is where Mike might be able to clarify of a project at the entrance of Sun Valley that was just greenlighted by city council about two weeks ago that would also add to the congestion and um probably concerns and safety factors sure fair question commissioner Basera what I would point out is as you see at the end of this first bullet it says that it would operate at unacceptable losos in the cumulative and cumulative plus project so cumulative is the key word there okay um other projects are of course factored into the uh the the analysis so exactly what those other projects are um in specifically whether or not the one that you're referring to was included I would defer to the traffic consultant but yes uh other projects are considered um in in the overall scope okay great thank you and uh and one last one I'll pass Theon yeah sure thank um this one's going to Pivot a little bit might be for the repres the applicants representative if not the sure I guess Stacy if you don't mind I think you'll know this one's coming do you want to just ask it first and then we'll just Rambo to see just kidding we can do that um I I heard a few times that this is kind of geared towards affordable housing which is which is fantastic um that it's also kind of geared towards students and staff or like employees of TMCC drri and so forth and um I know they haven't been engaged because I engaged them today and so what is the plan there to ensure that there's an actual plan there to engage with them and make this an option for students and staff and so forth I think um Stacy Huggins for the record I you know we I we appreciate that you've reached out to them um I think that you know if if this project gets approved then we can um engage them in additional conversations as we continue to move forward with the development project um we obviously want to be good neighbors right we the the developer wants to have those folks living in his project that's the purpose of it so I think um you know we can make a a a verbal commitment I don't think it's a condition worthy type of situation but I think we can verbally commit to working with them and reaching out to them um I don't personally have that contact information but I'm certain that you know we can ask staff if they can help us um get in touch with those folks and I would be happy to share it with the developer and then um you know as they proceed with this project I'm sure they'll reach out to them great thank you commissioner Ro Meer do you have any questions um I do I I'll hold for discussion thanks though sure thing thank you and commissioner delr do you have any questions at this time uh yeah this is commissioner delvar and I had a question about um basically I understand that some of the schools in W 4 where I am are a bit impa Ed and so I'm just kind of curious as to and again if it is sort of slated for um not necessarily lower income but um I'm just trying to understand sort of what the enrollment impacts might be around that and if there's thought around that um and I understand that obviously there's the busing as well that's that's incorporated into the plan but just kind of curious as to if that's been taken into consideration the the impact on that Jeff Foster associate planner for the record um the the school district does a very good job when they provide feedback on development applications of identifying uh impacts on enrollment and most of the projects that I've seen lately have said no concerns with regarding to with regard to enrollment uh impacts um and they did not identify any specific enrollment impacts for this project thank you that that was all I had for now everybody else has asked similar question thank you thank you any further questions from the commission commissioner bisera thank you so thank you so much Jeff this one's for you or the applicant I guess we'll see um oftentimes we get even for the next item before is for like the storage unit for instance we'll get um some input on safety sometimes RPD chimes in that things are going to be okay or not or they recommend security and so forth does a project like this also require a similar um Factor where uh we consult RPD or the sheriffs to indicate hey what's this going to do to the to the uh potential crime increase or decrease so um RPD and the Sheriff's Office may be invited to provide input um there is no requirement to uh ask them and I what I would submit that you're referring to in general are seped reviews that RPD provides but they provide that at the request of generally the Planner on the project um so if I had contacted RPD and asked for a seped review or if I could have contacted code enforcemen and asked for a seed review they could have provided that but as a matter of course a matter of course um that's essentially at the invitation of the of the planner based on whether or not we think that there's a a concern so that was not done at in this case um but that may be something that you want to chew on there as far as the the sheriff's office um if a project was directly um kind of adjacent to the Sheriff's Office um much like the uh soccer stadium project was last year that I worked on um this body may remember that project um the we did consult with the sheriff's office because of the adjacency and the potential impacts from the the game day traffic control operations on the sheriff's access there um but as far as just kind of a general you know input from the sheriff's office um they would have had an opportunity to provide comment when the DRM was sent out um because the the Washo County planning and other Washo County uh folks are on that list so uh essentially they would have had an opportunity to provide comment and they did not okay um and just for uh simple folks like myself and those maybe listing what's a DRM uh sorry development review memo okay yeah um yeah so that's at the very beginning when a project is brought in uh sorry when a a project is is submitted an application is submitted um we send out a memo at the end of that week to a long list of folks um on the DRM uh that gives them an opportunity notifies them about the project much like uh when RTC or OT or any other agency submits comments it's a result as a result of seeing the DRM great and and and I mentioned sherff because I believe like you mentioned with the soccer field at TMCC right that's kind of their their jurisdiction that's their main artery especially since they're the ones patrolling Sun Valley um and I imagine they would be the ones uh patrolling these proposed Apartments uh correct well it's in the city's jurisdiction but I I mean as as far as a plan from the planning perspective as far as the actual Patrol um I I couldn't speak to that issue I'm sorry oh it's okay I just uh depending on how this goes this evening if it does move forward or not but if hypothetically it did I would just uh ask that um staff proactively reach out to the sheriffs because I spoke to them today and they were not aware and it's easy for those drms to get lost in the shuffle TMCC stated the same thing and they would have loved to chimed in as well but they didn't know so just kind of thrown out that out there for staff to youan as well and and the last thing too is that uh some of the public input we got tonight was that uh there was concern about the design um and I agree the the design of the apartments look pretty nice but there's nothing like that there right now too so when staff says uh the the design the proposed design fits with the surrounding environment what is it used to assess that or make that statement so that characterization was based on a couple of things one where the apartments are located on the site um respecting the topography uh you know not standing out on ridg lines they're they're trying to tuck them in in areas where they will be the height will be masked keep in mind that the MS uh district has an unlimited height allowance as well as an unlimited uh stories allowance so the the applicant is proposing three-story apartment buildings approximately 34 ft in height they could propose a lot taller buildings theoretically right it's what's allowed in the zone so but keeping them at three stories you respecting the topography using the color pallet that is similar to the surrounding area um the distance from the adjacent residential uses in general the distance from them between the proposed project and and the existing residences to the east um those are the the characteris iscs that uh that why I characterize it as being consistent with the area um also understand that the MS Zone again because of the height allowance I mean it is zoned Ms so again they could have done a lot more so they just they they they were I I think um respect respected the surrounding area okay and just one last one on that the gift that KS keeps on giving to you Jeff the soccer field since it is kitty corner uh from this parcel um does do the proposed Apartments take into account for the soccer stadium lights no the the the soccer Stadium's on the other side of the freeway so it wouldn't be no it's not it's just Kitty quarter the soccer stadium yeah Street Jeff I believe he's referring to the the TMCC talk soccer St not the the one on the other side thank you for the clarification I'm talking about the the battleborne soccer complex on the other side of the freeway um so you're asking about the the soccer stadium across the street literally like pebbl Strow and it has large lights like pretty much Friday night light style right and so and and since it is a little higher I imagine those lights would probably be shining down on these apartments and I was just wondering if the design takes into consideration that uh that potential kind of like uh uh bright light honestly commissioner Basera that's a great question and I don't have an answer for it so perhaps the applicants representative does um but it's an existing use you I would also say that um well yeah no I that would be in terms of a proposed soccer project so I'll I'll keep that sure did Stacy do you have any I don't no haven't looked into it that's okay all right maybe something that you want as well so okay just commissioner berer just if I can clarify one point um you had asked about whether this project would be patrolled by the sheriff or the Reno Police Department it's in the City of Reno it would be patrolled by the City of Reno the Reno Police not the sheriff yeah okay great thank [Music] you uh no further questions it looks like for those of us here in person anyone attending online have follow-up questions not hearing any follow-up question should we move into discussion commissioner dracul commissioner dracul yeah I'll I'll keep it short and sweet I I like to see this project um I feel like my concerns about traffic it's never perfect we're a growing city um it looks like we're probably going to have some curve balls here and there as we continue to grow um knowing that we're not pushing West often helped me obviously knowing that a lot of it's going to be going into that major intersection going to trust uh traffic in the staff to have looked at looked at that closely enough I'm sure that was top on their list um and I guess my understanding coming into it too I mean really we're looking at a project that is only being triggered because we have Hillside development grading uh and cuts and fills um and disturbance of a major drainage we looks like we've solved those problems um I've never been one to get too disturbed by Hillside development when they have taken care of what they're doing we've got a need for what is hopefully going to be affordable housing um I've driven through some Valley 100 times in my life being from here and I feel like it's a good project so I will be supporting this um and hope it goes through thank you commissioner jaish uh commissioner roer you had indicated during uh questions that you wanted to save uh your item for discussion do you still have a item for discussion um I can make it pretty brief I also um along the lines of commissioner feel that you know density near an institution higher education institution specifically is a really good neighborly fit um I understand and hear the concerns of the Neighbors about traffic I think there are mitigations that are possible and happy to hear that time is going to be spent to invest more time into this I for one just for I can't condition it obviously but it seems to me that especially if it's going to be more affordable units that there's a real win by a developer here by offering things like Transit passes to tenants and other incentives to get people out of their cars especially if they're employees or students um and so that kind of thinking I think would go a long way deal with the extra generation of trips uh especially in the morning or the afternoon in in terms of height and in terms of compatibility I actually can't think of a better thing than having pretty dense multif family next to a higher education institution that currently does not have housing I might add so appreciate the consideration thank and commissioner commissioner Biser sure unless you'd like to go first sure no go ahead okay thank you um I agree with my uh fellow Commissioners great you know the intention here seems pretty uh good um at the moment I can't find I can't make the finding for the the traffic um it's not always a deal breaker because I believe we can find Solutions um but it doesn't seem like there's something viable so far with the um Los that would be going from the current D which is not okay if anyone ever goes through there which I I travel that all the time um and I'm very familiar with the site and I would have appreciated I think a more sound solution being brought forth to us tonight and again like commissioner drich mentioned nothing's ever perfect I'm not looking and I'm not looking for that I'm looking for excellence and I don't think we've been presented with that just yet um and I think that what commissioner rmar mentioned about uh density I agree with that too and it'd be great if there can be Partnerships and the developers can maybe issue passes and so forth but I think I think we all know that if it's not written down it's probably not going to happen so if that's something that the developer wants to commit to let's put it into a conditional as part of the conditions and and you know that way uh it doesn't get lost in translation because I also understand that um there's a for salees sign on the property right now so I'm not sure who we're selling to uh entirely and so who we sell to tonight or support tonight may not be who's doing the project 6 months from now so as of now I'll be a no thank you commissioner M commissioner delvar did you have any items for discussion um yeah just sorted to pigb off of what commissioner rer and commissioner Basera said um I do think it's important to partner with some of these organizations um you know the uh obviously TMCC uh and and even if you think about the transport itself and transportation passes like how is that potentially going to impact some of the um the busing um and so I along with commissioner um bassera at this point I would probably um not approve um until as he mentioned there are some other conditions put in place around the uh the transportation issues and traffic issues thank you commissioner lvr um I'll be brief I largely uh concur with commissioner julich commissioner rer um I think with respect to the major drainage or sorry the major site plan review um items that we're supposed to consider it does comply with that I appreciate the additional conditions uh that have been reflected in the staff report as well as the um Amendment and the additional condition put forward that we were we would con that we would consider outside of the staff report I think these are good mitigations uh to commissioner B's P point I do think it is important to write these things down and make sure that um you know we have additional kind of mitigations for when this moves into construction and the like so I'll be supporting the project um and with that I don't have any further discussion before we move uh into a motion is there any further discussion on this okay seeing none I am happy to entertain OT commissioner dracul I'm ready to make a motion sure in the matter of LDC 25-1 based on compliance with the applicable findings I move to approve the major site plan review subject to the conditions listed in the staff Report with the inclusion of condition two or the change to condition two and the uh addition of condition 14 and I can make all the findings thank you we have a motion do we have a second M second yeah we have a Motion in a second uh I think for like to read the appeal process into the record any final action not including recommendations or failure to take action by the Planning Commission may be appealed to the Reno city council by the applicant the mayor or a city council member or any person who is grieved by the action or inaction an appeal together with fees must be filed with the city clerk within 10 business days starting on the day after written notice of the action is filed with the city clerk that we will close item 5.1 and move to item 5.2 LDC 2 4-32 Cold Springs RV storage and we will take a presentation from staff good evening again planning Commissioners Jeff Foster associate planner for the record the second case I'm bringing you tonight is LDC 2432 which is the Cold Springs RV storage project this undeveloped uh uh site is about 7 and A2 acres and that is on the south side of Village Parkway about 570 ft east of its intersection with Cold Springs Drive which is east of Highway 395 um I will note at this point in time that the current roughly 3 and a half acre project area is approximately half of what was originally proposed and we'll touch on that later uh the request is a conditional use permit to allow a mini storage or mini warehouse and storage facility as well as non-residential development adjacent to residentially zoned owned property the adjacent properties to the north south east and west of the site are currently undeveloped the south side of the site borders White Lake um there are limited residential uses to the north with property lines as close as 100 ft from the subject site and the parcel I'm speaking about is shown here the key issues are compatibility with surrounding uses project design ecological issues and hydrology the zoning district is a mixture of two zones General commercial and un unincorporated transition 40 acres I should note that no development is proposed on the UT 40 portion the GC district is intended to accommodate a mix of established low intensity Auto oriented uses while supporting the gradual transition of the city's Suburban corridors to a mix of higher density residential retail commercial and other employment and service oriented uses the master plan land use designation is Suburban mixed use and here are some goals and policies that support and are supported by the proposed project in terms of compatibility with surrounding uses there is residential zoning in the county adjacent to the site so residential adjacency standards do apply the proposed use is limited to the eastern half of the site as you can see here and that's away from the County residential zoning uh the project is proposing standard hours of operation and staff felt it was important to actually formalize that and that's condition number five and also with standard restricted construction hours uh due to residential adjacency condition number six um that should help to reduce potential impacts on the residences in the area in terms of the project design there are two buildings with 41 storage units totaling roughly 23,000 square feet 102 covered RV spaces and 14 uncovered storage spaces interior to the site shown here there is no RV dump station or sanitary sewage collection proposed and staff felt it was important to formalize that in condition number seven the project proposes a sensitive lighting design approach light fixtures will be shielded and no lights will be allowed to shine toward adjacent properties the interior security and directional lighting will be placed on the buildings no light poles are proposed the entry and exit areas will be lit for security and safe vehicle movement with light fixtures directed into the site most nearby houses sit at an elevation comparable to or slightly above the finished project the nearest house is about 370 ft from the subject property line with a peak height of approximately 19 ft for the buildings which is comparable to a single family Residential Building these buildings will be visible from the houses but will not obstruct the skyline uh solid fencing uh and Landscape screening is required for the covered RV storage spaces not screened by the building per condition number nine shown in the area here and uh given the proximity of the site to residential uses and Zoning the applicant has agreed to comply with a more restrictive neighborhood commercial signage regulations and that's condition number 10 in terms of ecological issues the US Fish and Wild life service National Wetlands inventory has identified the southern portion of the subject site effectively all of White Lake as a wetland area code says that there shall be no net loss of wetlands stream environment suppliers stream fed riparian and non 404 Wetlands condition number 12 requires a wetland delineation study to actually determine whether or not there are any wetlands in the area and preclude impacts to those Wetlands um also in order to avoid impacts on the White Lake pet and to define the limits of the proposed development the project proposes to not encroach within 50 ft of the ordinary high water mark shown here and the 50ft buffer is shown by the dash line there and that's condition number 13 in terms of hydrology FEMA has designated this area as flood zone AE which is a highrisk flood Hazard a 1% annual chance of flooding final plans shall demonstrate that there is no decrease in the flood storage capacity in White Lake as is typical in the North Valleys the project is subject to a 1.3 to1 cut fill storm water mitigation ratio storm water retention will be provided through excavation and expansion of the existing White Lake Pia limits and uh FEMA a sorry a FEMA approved application for a conditional letter of map rision is required condition 14 and a subsequent letter of map provision condition number 15 to remove these portions of the site from the a AE flood zone designation here are the recommended uh findings for a conditional use permit staff can make all the recommended findings and here's the recommended motion I'm available for questions thank you do we have a presentation from the applicant good evening uh Dereck Wilson on behalf of the applicant um I have a presentation coming up but uh Jeff as usual did a very thorough job so I think a lot of my stuff's going to be redundant so I'll do my best to keep it moving um there we go uh so there you see the site as Jeff mentioned we're only going to be using uh slightly less than half of the site um and then uh there are no houses directly adjacent to this site there is some County zoning as you mentioned it's unoccupied uh so we're not going to be impacting any existing houses um that's a brief summary of the project uh uh a fairly straightforward um storage facility uh with the standard Landscaping screening uh secure fencing Etc uh low intensity use of the site 47% of the total parcel area is going to be used for this project uh no change to the master plan needed uh the master Planning and Zoning has been in place on this site for some time uh no change needed for it uh for this project so we're complying with the existing uh master plan and Zoning uh that's a quick view of the site plan we've got a um clearly defined entrance and exit uh two buildings and then some covered storage in the middle the central area of the site uh there'll also be um we worked at the city to to uh uh condition extensive screening uh of of the site uh from Village Parkway so they'll be fencing and Landscaping uh around all the visible sections of the site uh we've worked we spent quite a bit of time with revisions uh the city uh made some requests and and we complied with them uh to ensure that there are no environmental impacts from the project um so significant reductions to both the footprint and the and the unit count uh and an increase in the storm water detention area uh I should also mention that our project engineer is here he can give specifics on any questions that anyone might have then again Jeff already gave you this but that's the the the dark line is the is the high water line of the lake and then we have a substantial setback from that high water Mark um that's the project area now um so some of the I I spoke to some of the neighbors the city uh received a few comments uh from Neighbors uh and I responded to each one of those individually um I don't believe there's anyone here right now um uh so I'm I'm hoping that I answer those questions there were no follow-ups after I responded uh but a lot of the questions were about View impacts and I I got the sense that people were envisioning a very substantial Amazon warehouse type project uh so once people heard that it's limited to roughly 19 ft uh I think that I think that alleviated a lot of that concern uh and it's worth noting you can see in the background uh the freeway there you can see the the freeway on ramp from Village Parkway uh the height of the project is is well below the height of the freeway and Virginia Street in the in in the view towards the mountains so uh we're we're not going to alter anybody's view of the skyline this is an exhibit showing building Mass uh we we understand the buildings going to have to look substantially different from this there there are requirements on that and we're going to comply uh but this shows you the the building mass that we're talking about so so not uh not tall buildings uh and these are the sort of uh embellishments that you can add to these buildings to comply with city code for the residential adjacency standard and and the the building details standards um and I'd say one last important point is um there's a need for storage facilities in the area project like this uh allows people to store RVs near where they're going to be used there's a lot of recreational use going north on 395 this location is near the freeway it's easy access you don't have to go through a neighborhood to get there uh and it's on the way to where people want to recreate anyway so I think it's a a compatible layout in terms of that sort of use uh so that's all I've got I'll be happy to elaborate and again our Engineers here if there are specific questions great thank you we will bring it back to the Commissioners for disclosures commissioner dracul please start us off I familiar with the site uh no other disclosures uh commissioner Basera same disclosure as commissioner drich commissioner RoR no disclosures commissioner delvar no disclosures uh commissioner Armstrong no disclosures we'll now move on to public comment I have one request to speak form uh but before getting to that do we have anyone wishing to speak via Zoom no one in Zoom thank you have a request to speak for from daa Gibson hello uh my name is dla Gibson I'm a 45 year resident of Cold Springs I'm in opposition of this project uh I appreciate some of the mitigating factors that they've taken for blight uh we are one of the few or really were the last um Valley that has any sort of Dark Skies at all uh and this would definitely bring in uh uh it will hinder the dark skies in that area with um light pollution the White Lake is a focal point of our Valley unlike some of the other valleys that have water um water masses it really is a focal point and this would I think be a blight uh and I also um I also have concerns about how it was um how the public was notified in in the area I only just yesterday saw the public notice posted uh and the notice doesn't seem to have been up very long so I'm not sure if people who are really impacted by it um with the view have been not notified about it um so that is a concern I have and while I understand a statement was just made that there aren't storage facilities there is RV for uh storage facilities within five miles of that site so it's not like it is a desert of storage facilities there are plethora of storage facilities in the North Valleys um and I I also just want to say just because something could be worse and isn't doesn't mean it's good so um that was I just really want to make sure that that is is stated and I just kind of feel that um as with a lot of things that happen in the North Valleys it's always a concern for me that the decisions are being made from people who don't live in that Community uh and don't understand the a Aesthetics of the valley for those of us who have been residents and are residents uh and that's important so thank you for your time thank you do we have anyone else in the Chambers wishing to speak on this item seeing none we'll close public comment and bring it back to the Commissioners for questions of Staff or the applicant commissioner Armstrong just for reference we did receive public comment that was forwarded to the commission and entered into the record understood thank you commissioner bisera sure thank you chair um I guess for yeah staff I guess Jeff the Jeff show tonight um probably about six months ago or so sometime in the last year uh we we had a project before us um directly across from this parcel um we I think it was a a an a Zone Amendment and part of that project um committed to doing like a walkway if you recall as part of the design and is there something like that it for the public to access to kind of have continuity uh around this region um or is that separate and not related are you speaking about the White Lake zone change applicant application that Grace uh brought forward yes okay um my understanding I'm not intimately familiar with that project but from what I recall in general that there is a proposed path along the White Lake Frontage or in in the rear of the project effectively don't think that was right across from this though I think that was further around White Lake maybe okay yeah okay I'm just trying to think of continuity and the design yeah this is not directly contiguous to that um though I will point out that there is sidewalk proposed along the front edge correct yes so okay yeah um I think that's it for now I just wanted to Echo the um public input that we got that we I don't want to disagree agree but I do want to just uh I guess uh Elevate that uh one thing we do see before us quite regularly is storage units um so there's there's a lot and agree that dark skies are important and uh we should do all we can to try to preserve that and so I was wondering what consideration was given to that if any uh in this region for that so um the consideration that was given um really is reflective of the proposed site lighting um so one again the residential adjacency standards do apply uh when the application was originally submitted um it was suggested that residential adjacency standards don't apply but they do and and even though the residential zoning is kind of away from the project area because of the adjacency of the zoning those standards do apply and one of the provisions in the residential adjacency uh section of code is severe limitations on the height of allowed lighting and things like that combine that with the standard code Provisions in terms of cut off Optics and other types of limitations on lighting combine that with what they proposed in terms of lighting being directed interior to the site being a fix to buildings versus being on poles things like that um kind of minimal security lighting or the yeah minimal security lighting all of that together um is what we based our our conclusion on that it was appropriate in terms of the lighting oh okay and and so just in relation to dark skies and the impact to it are the lights facing downward or are they allowed to face up no code does not allow lighting to face Upward at all anywhere um so um no it would they would definitely be directed down and interior to the site okay and just the last one no concern with flooding or anything of that sort since it's right next to the weapons no no and in fact the applicants engineer can speak to that further but they are proposing way more storage mitigation uh storm water storage mitigation than they are required to have okay thank you Jee thank you commissioner uh commissioner RM commissioner delard do you have any questions at this time um again kind of more of a discussion but I can maybe make it into a question for Jeff uh sorry Jeff um just from the staff perspective and I I did just check the property ownership around Whites Lake CU that zone change uh was a large request and I remember Lifestyle homes stating that they owned Whit's Lake and that open space Parcels if it's found that there can be a path or just even doesn't have to be a paved path but on the Lakeside it can be below the floodline can we please condition this project to include so there would be continuity for that neighborhood to have full access around the lake that's her real amenity for a community is that something staff can look into we certainly can um Derek it looks like there some discussion behind me commissioner rer that may reflect that but um yeah that is C something that that we could certainly condition if if it is found that do you do you guys have any sure we don't have any difficulty with that from a design standpoint um I know uh some Property Owners um have sleepless nights over liability issues about that but I would say if if Lifestyle homes can work out something that works for them we'd be happy to go along with that thank you both I think that would be a a really good amenity to see thank you commissioner delard did you have any questions uh not at this time thank you sure thank you commissioner dracul kind of discussion and off of Carrie Carrie helped me out too and I just maybe I wasn't visualizing so Lakeside we're talking about that pathway not on the highway side but around what's on the side of the residential sorry if I I didn't catch that I was thank you I'm just trying to see if yeah that's the furthest out we zoomed so that's fine I get the gist from there if you want to show me and I'm sorry so which way is the pathway for the connection Mike do you remember it would be on the lake side not on the street front side oh okay yeah I understand okay thank you but it's further around White Lake correct the the White Lake Commerce Center project was on the east side of the lake um kind of over where the existing commercial areas within Cold Springs are that's where that project was located and again that would be a pathway with connection to that I don't think they they aren't capable of doing that that project had it so in theory as as Mr Wilson stated if the adjoining property owners were able to you know agree to put a a a path on their property in theory it could ultimately connect and that's what I was thinking was being discussed I just wanted Clarity so thank you okay yes and lifestyle did um on on record St that they were willing to do that they showed that in their conceptual design on the par that they owned and made the claim that they owned all of the open space property as well so and that seems to be confirmed by the Washo parcel mapping software any further questions or should we move into discussion seeing no further questions I I'll move it into discussion Comm draulic I'm I'm in support of the project and ultimately I agree that my first thought was with what public comment stated Cold Springs is a unique area I've been there I can't even count how many times um and really all you really have is Bordertown to the west and the rest is residential with differ Siz lots and new homes being built but then I also remembered that Community is changing i' I've heard from members in there being on this commission that they would like more services and I I do like storage units if there's a demand for that I think a lot of people who live in that area will probably fill that demand so it's a great service so they're not traveling further then also I remembered that project and helped me with my memory 6 months ago or maybe it was a year ago with the projecting on the other side of the lake that's commercial so that Community is changing um and so I guess I can see this as being compatible because of that there there is some Evolution happening there and I understand there's a mixed bag of emotions on that with the residences but I know quite a few homeowners up there is always wanting you know something like a grocery store restaurants office space and I kind of see storage units as being something complimentary as a service out there so I'll be in support of the project and I will uh Grace commissioner roor Meer with adding that condition I with that thank you commissioner commissioner Basera uh sure uh pretty much just Echo uh commissioner dracul's uh sentiments there it's always it's a hard one to balance um and I'm sometimes surprised what I remember from six months ago to a year ago uh but this one was a particular special project that uh involved a lot of discussion a lot of public input and sometimes I just want to make sure that um there's continuity with uh related or surrounding projects so we can ensure that we make a project as good as it can be kind of like what I mentioned at the last agenda item just doesn't have to be perfect but just excellent as much as possible and as long as there's mitigation efforts around you know addressing night sky concerns with the lighting which it sounds like there is uh the best thing we can do is be good Shepherds and hopefully uh this is one and um for the record I don't ever want to hear that we don't have enough storage units so because there's a lot thank you commissioner Basera uh commissioner rier did you have any followup for discussion no no extra questions uh commissioner DVR did you have anything to add to discussion yeah sort of along with uh what commissioner Basher is saying it's it is it is hard you know when when we think about and and to some of the other conversations about some of the services I I don't hear people say we need storage units I do hear them saying we want some restaurants or we want a sit down restaurant that's open in the evening or we want some other services um and also you know I would hate to sort of see um you know the land around that Lake destroyed I think there's some other things that that could be um done done with it so I'm I'm just I'm very conflicted about what um what this what this means I I definitely agree that like if they can mitigate some of the dark sky issues um and and to um the the uh the gentleman who spoke earlier if he spoken to some of the residents who uh had stated they were concerned about losing some visibility to peine and that that was not going to be necessarily a concern going forward um so but I'm still I'm still not sure how I feel about this but I do appreciate the condition being put in for having some um some ability to have a trail along the lake I think that would be um one way to help um with with some of the issues that we're seeing here that's all thank you commissioner DVR and I'll just briefly contribute I largely Echo commissioner warm commissioner Dracula commissioner basser's points uh the only other thing i' like to point out with respect to I guess how the project fits in with the environment I just would again want to point back to the master plan and Title 18 conformance this is something that is not requiring a zone change it's allowed by wri and I think that's just an important thing to to consider for these kind of discussions so with that I do intend to support the project and uh if there's no further discussion I am happy to entertain a motion commissioner B sure I just wanted to just uh be clear that I'm in support with the uh proposed amendment soon to come from commissioner RM so thank you in advance uh I will Dido that and uh commissioner RM would you like to make a motion I would love to I can't see the recommendation and so if somebody could I think they just put it on the screen can you see it now I cannot um here we go in the matter of case LDC 24-32 based upon compliance with the applicable findings I move to approve the conditional use permit subject to the conditions listed in the staff Report with the addition of a condition requiring a pedestrian path on the lake side of the property we have a oh Jeff Jeff Foster associate planner for the record I thought the discussion was regarding the path if it could be worked out with the other property owners ability to put the path also was that the intent because in other words if they put a path in that doesn't go anywhere or to anywhere kind of pointless so makes it fun Jeff wrote to Nowhere Jeff no um you're you're correct in your understanding okay so just to clarify that it would be that there would be a contingency on in in the condition correct so I can amend the um what I just said if that helps yep please do can you put that back up my memory is right I suppose or do I just restate the last sentence you can just restate the last sentence thank you commissioner with the addition of a condition requiring a pedestrian path on the lake side if it can be worked with neighboring Property Owners to have a continuous path around Whit's Lake thank final action not including recommendations or a failure to take action by the Planning Commission may be appealed to the city the Reno City C Council by the applicant the mayor or a city council member or any person who is aggrieved by the action or inaction an appeal together with fees must be filed with the city clerk within 10 business days starting on the day after written notice of the action is filed with the city clerk with that we will close item 5.2 and move to item six trucky Meadows Regional planning liais on report um I think that would be me on this one it's the same report as I think two weeks ago um since we meet once a month at Regional uh the update at that time was that um we were presented with a updated na natural resource plan and um a draft anyways and that is slated to come before city council I believe tomorrow in Chambers is that correct Mike that's correct yeah that's correct so and the regional staff is doing kind of a road show so it's City of Reno tomorrow with Sparks I believe next week and so forth and their whole goal is to get final approval from all regional stakeholders by October so they can begin to implement the the the plan um and tribal planning efforts that they have underway um in terms of uh city council action on previous um Planning Commission items as uh commissioner Basera mentioned last week's council meeting was canceled due to the Davis uh fire that meeting is been rescheduled for tomorrow um the only item uh relative to this board is the um other than the plan Regional um update is the um second reading of
