e e e e e e e e e MO m p it's 400 PM yes sir good afternoon this is a special meeting of the Paso city council for Wednesday November 13th 2024 it is 4:00 p.m. mayor liser is present and presiding in council chambers along with mayor protim Kennedy representative aavo mayor alternate mayor protim molinar representative Fierro representative Rivera and representative Canales representative salido has requested to be excused this afternoon and representative ernandez was going to join virtually however I don't see she's joined yet mayor we have a quorum thank you Miss nean Miss P yes sir the first item on the agenda is discussion and action to approve a resolution to canas the votes cast in the November 5th 2024 city of Al Paso General and special elections and declaring the results and I will have to read the entire resolution into the record thank you which states whereas the city council of the city of Al Pasa ordered a general and special elections to be held in said City on November 5th 2024 for the purposes of filling the expired terms in the office of the mayor four District representatives from single member district numbers 234 and 7 and the judges for The mun ipal Court numbers 1 2 3 45 and the judge of the Municipal Court of Appeals and the vacancies in the office of District representatives from single member districts number one and five for the terms as established by in accordance with the charter of the city of Al Paso and the laws of the State of Texas and whereas the election officers who held said General and special elections have duly made returns of the results thereof and said returns have been duly delivered to said city council now therefore be it resolved by the city council of city of Al Paso that number one that the city council officially finds and determines that said General and special elections were duly given that proper notice of set General and special elections were duly given that proper election officers were duly appointed prior to set General and special elections that said General and special elections were duly held that due returns of the results of said General and special elections have been duly made and delivered that the election returns have been properly made out and fully certified by the officers of said General and special elections in the different voting precincts of the city and that the city council had duly canvas said returns all in accordance with law and the resolution and there to calling said General and special elections number two that the city council officially finds a determin that the following votes were cast at set General and special elections for the following officers by the resident qualified electors of set City who voted at the general and special accordingly no one for the these offices is declared elective and a runoff election is to be called by the city council in accordance with the Texas election code and the number of votes cast for each person who was a candidate for such offices according to the returns is shown in paragraph two hereof number four that in the case of the following offices the following persons who receive more than a 50% majority of the votes cast for candidates for such offices are hereby declared elected to such offices for the ensuing terms or until the elections and qualification of their successors subject to the proper issuance of certificates of Elections by the presiding officer and that the number of votes cast for each person who is a candidate for such offices according to the returns is shown in 2 3 4 5 and the judge of the Municipal Court of Appeals showing the number of votes cast in each precinct for each candidate number six that this resolution is adopted subject to the right of any candidate to contest such elections in any way provided by law number seven that this resolution was acted upon in accordance with the law by the presiding officer in the city council and were deemed by said city council that upon passage of the resolution it shall take effect immediately number eight that this resolution be spread upon the minutes of the city council and the city clerk shall good afternoon my vote is yes yes thank you in the voting session and that motion passes unanimously item number two is discussion and action to approve a resolution canvasing the returns and declaring the results of a bond revocation election held on November 5th 2024 and other matters in connection therewith again I will need to read the resolution into the record which states whereas a city council the Council of the city of Al Paso Texas The City previously ordered an election to be held on November 5th 2024 for the purpose of determining whether the resident qualified voters of the city were revoke the city's authority to issue the remaining 128 mil4 $5 5,636 in general obligation bonds approved by the voters in the city's November 6 2012 election for the multipurpose performing arts and entertainment facility to be located in downtown El Paso whereas it is hereby found and determined that notice of the election was duly given in the form Manner and time required by law and such election was in all respects legally held and conducted in accordance with applicable laws of the State of Texas and the proceedings calling and governing the holding of such election and whereas a council hereby by canvases the returns of this election at which there were submitted to all Resident qualified voters of the city for their action upon the following proposition city of Al Paso Texas Proposition a to cancel the city's authority to issue the remaining 128,50 5,636 in general obligation bonds for the multi-purpose performing arts and entertainment facility to be located in downtown Al Paso which was approved by the voters cities November 6 202 2012 election resulting in the revocation of the bonds whereas the council has diligently inquired into the poist and the official election returns which were duly and lawfully provided to the council by the judges clerks and administrator holding and conducting such election the poll list and the official election returns showing separately the votes cast in the election and whereas from these returns the council hereby finds that the following votes were cast in the election by voters who were resident qualified voters of the city city of Al Paso proposition a to cancel the city's authority to issue the remaining 28,45 5,636 in general obligation bonds for the multi-purpose performing arci entertainment facility to be located in downtown El Paso which was approved by the voters in the city's November 6 2012 election resulting in the revocation of the bonds early voting votes including mail ballot ballots for the measure 74,2 votes against the measure of 57,187 votes early day El early day votes for the measure 23,48119 7,610 votes and against the measure 78,500 ially finds determines and declares that the election was duly and properly ordered their proper legal notice of such election was duly given their proper election officers were duly appointed prior to the election that the election was duly and legally held that all Resident qualified voters of the city were permitted to vote at the election that due returns of the results of the election have been made and delivered that the council has duly canvased such returns all in accordance with the laws of the State of Texas and the United States of America and the order calling the election section two a majority of the resident qualified voters of the city voting in such election having voted for the revocation of the issuance of the remaining bonds as provided in proposition a the council here hereby finds and determines that proposition a carried at the election that the election was duly called that proper notice was du was given that the election was held in all aspects in Conformity with the law and that the authority to issue the remaining 128 million4 $4 55,66984 adopted as a part of the judgment and findings of the council section four it is officially found determined and declared that the meeting at which the resolution is adopted was open to the public and the public notice of the time place and subject matter of the public business to be considered at such meeting including this resolution was given all as required by chapter 551 as amended Texas government code section 5 this resolution shall be in full force and effect from and after its final passage and is so resolved pass adopted and approved on November 13th 2024 move to approve thank you there's a motion made by representative Riva there is a motion made by representative Canales seconded by alternate mayor po Molin and this is to approve the resolution on item two on that motion call for the vote representative ernandez yes thank you and the voting session and that motion passes unanimously and the last item on the agenda is discussion and action on a resolution of the city council of the city of Al Paso Texas calling for a runoff election to be held on no December 14 2024 from the 2024 General and special City elections and making Provisions for the conduct of the election and authorizing a contract with Al Paso County to furnish election services and equipment do we not we don't call out the early voting on it no sir no okay representative I I just wanted to say that I'm happy to see Memorial Park Senior Center included in the early voting for the runoff in the general election this was a huge issue in central Al Paso the people that live basically in Central right um upas between Alabama copia the closest location that they had to vote was Basset place and I think what I've seen over the years in many different elections is that sometimes we have Grand View and then Grand View was closed because of the construction and and then we started getting voters out to Memorial to vote and then this time they were trained to to think okay we're going to go to Memorial and then it was kind of saying well no you can't go to Memorial during early voting you have to go to Basset sometimes the other thing that also happens is that oh yes I'm going to Basset but no Basset is not a location this time so I think that as we move forward with City elections in the future we really have to consider where we're going to put these early voting locations to make sure that voting is going to be accessible I don't think that's part of what you're kind of going off of topic so if we could just stay on we're calling for an election not for voting pre this is the the runoff yeah but there's back no no that's what I'm saying we need to stay on topic and this is not what the topic is but there's there's back up with all the no I understand that but we we need the we can't change the voting precincts or anything moving that's not what the item is on the agenda I'm not asking to change the that's not what the item is the item we did request that they add Memorial Park for the for the runoff election because we didn't notice that it was there was not a place in District 2 and so we did request that Memorial Park be added for the runoff election so what I'm saying is absolutely pertinent to what we're discussing and so that's why I'm saying what I'm saying because we just need to be cognizant as we call City elections to make sure that we are making voting accessible that's what I'm saying we understand that but that's not the item on the agenda for we can put it on there but she just said it is because they noticed that it wasn't there in District 2 well we did we did at the and you added it for the for the early time it's absolutely pertinent to the agenda is what I'm trying to say thank you do we have a motion on a second yet approve representative Riva made the motion second seconded by representative Gales and this is to approve I item number three ordering the runoff election on December 14th 2024 the early voting period will be from December 2 to December 10th and the city is sharing cost with the city of Soro for the runoff election on that motion call for the vote representative ad nandes yes thank you and the voting session and that motion passes unanimously that brings us to the end of the agenda thank you and special city council meeting for Wednesday November 13 2024 is adjourned at 4:19 p.m. and Council the runoff election will be December 14th and we'll need a council to Canvas the results we're hoping
