invocation this evening will be delivered by Pastor Michael spotsville of the meow wood church if everyone would please stand we will follow the invocation with the Pledge of Allegiance I praise you and thank you oh God for your presence in this city council meeting tonight I ask that you give your guidance to this public body entrusted with making the laws for the city of Aurora I pray that you would bestow upon them the full Riches of complete understanding wisdom and knowledge it is in Jesus name I pray amen amen I pled alce to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible liberty and justice for all thank you Pastor next is approv approval of the minutes of the meeting of April 14th 2014 mayor council mayor broom move to approve the minutes second move by council member broom seconded by council member leair to approve the minutes are there any additions or Corrections see none call a question on the approval of the minutes and the minutes are approved unanimously we have two ceremonies this evening I will come down front and first one will be uh mental health month we do have this uh Proclamation this evening and joining me up front are uh Randy Stith Aurora mental health and several members of the Aurora Mental Health Board after I finished the proclamation I will uh turn the microphone over to you all and ask you to introduce yourselves and say anything that you'd like to say right whereas millions of Americans may experience a mental health disorder at some point in their lives and may suffer devastating consequences as a result and whereas addressing the complex mental health needs of children youth and families today is fundamental to the future of Aurora Colorado and places Upon Our Community a critical responsibility and whereas persons with mental health disorders who have access to local community- based prevention intervention and treatment services are much less likely to require more expensive Alternatives of Hospital hospitalization or incarceration and their chances of becoming homeless are greatly reduced and whereas for over 41 years nonprofit community health centers and Clinics have provided Comprehensive Mental Health Services to Indigent and underinsured citizens of the state of Colorado by partnering to best utilize available local state and federal funding and whereas an integrated care model is success demonstrated throughout the state through collaborations between Community Mental Health Centers and the community health centers to meet the needs of individuals in their communities and whereas the city of Aurora has made a commitment to community-based mental health care for all residents the year 2014 celebrates Aurora Mental Health Center's 39th anniversary and we wish to unite and recognize May 8th 20 2014 as National Children's Mental Health Awareness Day now therefore I Steven D Hogan mayor of the city of Aurora Colorado do hereby proclaim the month of May 2014 as mental health month and witness whereof I have here and to set my hand and caused the Seal of the city of Aurora Colorado to be affixed this 20day 28th day of April 2014 Randy very much thank you Mr Mayor I'm Randy Stith executive director of Aurora Mental Health Center and uh mostly I want to say 39 years ago because Ellen marachek member of this community approached the Aurora city council the city council committed itself to supporting a mental health center in Aurora that was the first time in the state of Colorado any City got its own Mental Health Center and it was because of the city's council's commitment 39 years ago so thank you and thank the council Peter sucal I'm the president of the board of the re Mental Health Center and once again thank you Mr Mayor and all the counsel for everything that you've done we appreciate that you have recognized uh all right yeah it's an important call we we thank you for recognizing that may is mental health month but also that uh everything that our staff as well as our case workers everyone who is involved in it does to help each person and each person of our community to live a better life and live a more structured and contributing life so we thank you very much I'm Gigi dalala and I'm a board member of both Aurora Mental Health Center and asian-pacific Development Center thank you mayor thank you Council for please look around this room and think one in five one in five Americans or one in five in this room experience some sort of mental illness each year it does not discriminate and certainly my family has been impacted by it I don't know if you're just like me who ask after each tragedy in the news and will'll say how can I help where do I start may I offer you a place to start please take Mental Health First Aid training ask your Community leaders your schools your church your work um your friends and your family to take that training it is nationally recognized and it will not teach you how to diagnose or to provide therapy and counseling instead it will teach you the risk factors and warning signs and build understanding of their impacts as well as know Common support systems please know that your knowledge might help prevent a crisis and your help might prevent a tragedy thank you I'm Terry Todd a board member for orental health and I can't say it any better than that so I'm not going to try to top it so that was very good GG thank you mayor thank you Council for this distinguished Proclamation thank you Gigi um my name is Marcia bins and I have had the privilege of sitting on the board of directors um this is my second term so it's been several years so I I love working with uh Dr Randy sth and his group and the rest of the board members so thank you very much thank you I'm Nancy Jackson rapo County Commissioner and I've been a board member of Aur mental health off and on for probably something like 25 years I uh trust and really um think that this is an excellent organization and as Gigi said all of us all of us have been affected one way or the other either ourselves or with our families um from mental health issues issues so uh we need your support and we thank you very much for this honor thank you thank you all and just as a side note I I am privileged and honored to represent um Adams County on the Aurora Mental Health Board so GG you did say it about as well as anybody could say it so thank you um next is um Proclamation and Holocaust awareness week so we have also have a number of folks here if you could come forward please just come over here next to me and look out at the audience um we'll get your bright and Shining faces on television and I will do the same thing I will read the proclamation and then I will hand the microphone over and uh encourage you all to say anything that you would like to say whereas from 1933 to 1945 6 million were murdered in the Nazi Holocaust as part of a systematic persecution and annihilation of European jewelry gypsies poles and millions more suffered Grievous oppression and perished as victims of Nazi tyranny and whereas the theme for this year's observance confronting the Holocaust American responses is in honor of the victims survivors Rescuers and liberators targeted for Destruction and decimation and whereas the people of the city of Aurora should always remember the terrible events of the Holocaust and should actively rededicate ourselves to the principles of individual freedom in a just society and whereas the people of the city of Aurora should remain Vigilant against all hatred persecution and tyranny and whereas it is appropriate for the residents of Aurora to join with the United States Holocaust Memorial Council and the governor's Holocaust remembrance program in a week of remembrance and observation in our community now therefore I Steven D Hogan mayor of the city of Aurora to hereby proclaim the week of April 27th through May 4th 2014 as Holocaust awareness week in the city of Aurora in memory of the victims of the Holocaust and in the hope that we will strive always to overcome Prejudice and inhumanity through education vigilance and resistance and witness where of I have heing to set my hand and cause the Seal of the city of Aurora Colorado to be fixed this 28th day of April 2014 Bill Murray Sheriff of Sand Creek and I think this is just something that we as a community are very honored to be able to uh remember what did happen the worst of the 20th century good evening my name is David halman and I represent the Anti-Defamation League as a board member and past chair of the governor's Holocaust remembrance program our 100 year old 101 year old mission is to stop the defamation of the Jewish people and to secure Justice and fair treatment to all we so appreciate the city and the mayor of Aurora recognizing and remembering the Holocaust in this public way and for joining the ADL and imagining a world without hate we also invite you all to join us this Thursday night at Temple Emanuel at 6 o'cl for the 33rd annual governance Holocaust remembrance program thank you I'm Joyce spell I'm the president of the cwell council for community and Justice and I want to thank the mayor and the city council and the city of Aurora for again having the whole CL Proclamation it's my been my privilege to join you um for many years I'd like to share very quickly um a book and I always do this every year a book that I just read I finished a few months ago I should say The Book Thief and in the book Dave when I started reading it I really wasn't as familiar with the story of what it was about but Marcus Zac wrote a story about a little girl in Germany 1939 not a Jewish girl but in her story is weaved the Holocaust that her foster parents put their lives on the line in her life to save to help a young Jewish man survive the Holocaust and how he weaves it into the story and how you feel their need to save this man and to really understand him as a human being and to respect who he is it starts to take over the story rather than just be a part of the story and so I would encourage you if you're not familiar with it to read the book and to see the movie as well because again it talks about the righteous Gentiles which is part of what the Holocaust Proclamation is about that all of us have to be vigilant all of us have to be aware of the prejudice and discrimination that is present our communities and speak up and help others thank you I'm Rabbi Steven Rubenstein I'm the spiritual care director of Shalom cares which is a Jewish nursing home and indep independent living facility here in Aurora and on behalf of the greater Jewish community of Aurora as well as all Faith communities I'd like to thank the mayor and the councel for helping us to remember not only the past but to remind us what it means not to stand idly by as others are being persecuted not only in our own Community but around the world and what it means to stand up for justice and for the Dignity of all human beings thank you I'm Ros Duman founder and director of the Colorado Coalition for genocide awareness at action and thank you mayor and city council members for once again having this Proclamation the organization was founded because never again became yet again after the world proclaimed that this will not happen again it has happened over and over and so our organization um try to make people aware of what's going on and to teach people what they can do to help stop this hor horrific genocide going on and on so again thank you there is an exhibit in uh the Holocaust Museum that says that it's it's um the title is from memory we must remember those who died during the Holocaust but we also must take action to help those who are suffering today thank you again my name is IET lman I'm the rabbi at benar I'm here on behalf of the Rocky Mountain rabinal Council and on behalf of the rabbis we are very grateful that the city of Aurora has made this Proclamation is dedicating this week to Holocaust Education if for nothing more than the importance of standing up and reinforcing that with our kids thank you my name is Janet Sherman I'm the director of the Jewish community relations Council a program of Jewish Colorado formerly Allied Jewish Federation of Colorado in behalf of all of us we would like to thank you mayor and city council for dedicating this week to Holocaust awareness and education and wanted to let you know your timing is impeccable as today is Holocaust Memorial Day in Israel as you've probably seen on the news and as you know they have a siren that goes off and people all at 11 o'cl in the morning everybody stands at attention at throughout the whole country it's quite quite experience so thank you so much I wanted to read a uh a quote from a local Holocaust Survivor who lives here named Jack wellner he says you have to look forward because life is beautiful life has taught me that you never know what the future may bring you have to live life to the fullest and try and make it better thank you my name is jacqulyn Stern Bellow I'm here with my husband Howard Bellow we're representing the center for jtic study Holocaust awareness Institute which is part of University of Denver which helps perpetuate Holocaust Education for me personally I'm a I'm a child of survivors um a father who survived Bergen bellson um and a mother who survived Germany and who was that 11-year-old making her way out on Christ alak from The Book Thief um and uh and who also had lost numerous family members to aitz and to Bergen bellson so this is near and dear to my my heart and to my community and I'm very proud of Aurora commemorating it in its importance thank you I'm Howard Bellow and again I'm involved with the Holocaust awareness Institute and I just want to expand on what Janet was talking about in Israel today uh if you look at some of the photographs they were quite moving uh there were people on the beach in swimsuits just standing still for 2 minutes and then there was there there was a scene in in downtown with with people at offices and there was there was another scene on a highway where everyone had gotten out of their car and stopped right on the highway during this two-minute period thank you very much just want to say that our mayor is one of the host of the event a lucky child and um we you need tickets to go to that and if you'd like to have tickets I have some that I can distribute but I wanted to make sure that you knew that Su Parker Gerson said it is particularly meaningful that you all went to Great ly to ensure that the date did not conflict with the Passover holiday and we really appreciate the opportunity to participate thank you mayor and thank you councel thank you all thank you all right thank you all hi Nancy next we um have public invited to be heard on non agenda items I have several requests to speak three um I will call these individuals in in the the order in which these were received and uh the next three minutes for each person is yours first is Senator Nancy Todd followed by Sheila Moser Senator Todd welcome thank you thank you it's a delight to be here with you Mr Mayor city manager council members and I am very proud to present to Aurora tonight um a an um a proclamation from the state of Colorado the Senate and House of Representatives convened in the second regular session of the 69th General Assembly hereby extends heartiest appreciation and proud to honor the city of Aurora Colorado on its 123rd birthday known as the gateway to the Rockies and the sunrise to Colorado Aurora formerly the town of Fletcher was incorporated in 1929 Aurora eventually became the home of the US Army hospital later known as Fitz Simmons the Buckley Naval Air Station Lowry Air Force Base and was the inim site for the US Air Academy it is now the home of the Fitz Simmons and Sh School of Medicine children's hospital and the VA Hospital Aurora continues to grow plan and evolve with projects like the Denver International airport solar Tac a renewable energy research facility Prairie Waters purification and recycling system fast tracks and the Gaylord Hotel Conference Center project in 2008 Aurora was designated in All-American City by the national civic league on request of Senator Nancy Todd Senator Linda Newell president Morgan Caroll senator Pat Stedman representative Sue Ryden representative John Buckner representative Javon Melton representative Ronda fields and representative Kevin priola given this excuse me 29th day I'm a day ahead of the Proclamation day of April 2014 state capital Denver Colorado signed by Morgan Carroll president of the Senate and Mark fandino Speaker of the House of Representatives we bring good wishes to you we will be down at the Capal and not able to attend the birthday party on Wednesday and so we bring our greetings happy birthday Aurora so proud to be a member of this great City so thank you very much thank you much very much Senator Todd appreciate you coming down and bringing that Sheila Moser and Lynn siml my name is Sheila Moser I'm a resident of Aurora and I come before you again to implore you to retain the ban on pitbulls you will recall a little patient of my sons who's a pediatrician was fatally Torn to Pieces while playing in his grandma's backyard by her neighbors to Pitbull which until that day had a zero History of Violence and were disc described as sweet dogs by the neighbors some may say mine is an emotional plea in fact it is a rational plea N9 years ago an aurora child was mauled by a pitbull that precipitated the ban don't forget that child child since there have been no fatal dog attacks in Aurora over these eight years the ban is working that is a fact some folks who want to remove the ban say it impedes folks from moving to Aurora there is no shortage of families who are now moving to Aurora some say it impedes folks from shopping with their pitbulls in Aurora rest assured if people were bringing their pitbulls into Kohl's Macy's Safeway or any other of our stores it would chase away far more customers than it would bring in they could shop in Denver where they wouldn't have to worry about seeing a pitbull while shopping some folks say it isn't the dog breed it's the owners that are the problem problem can you promise the C citizens of Aurora that not one bad owner would move in bringing his or her pitpull to our town what if one of them did and a tragic attack took place wouldn't $100,000 in liability insur insurance payment be a drop in the bucket to try to repair the damage in in fact would any amount of insurance money atone for the loss of a child could attendance at a doggy obedience school guarantee that a supposedly rehabbed Pitbull would never attack another dog child senior or person can you really in good conscience guarantee that oh and by the way if you do lift the ban on pit bulls you better enlarge your budget to cover disability payments to the Aurora police and firemen who might be attacked by a pitbull while entering a home in the line of duty what is the plus to our community of lifting this breed specific band it might make a few insecure people happy to have a macho dog drug dealers would love it to H to attack officers during a drug raid responsible Pitbull owners they are a rare breed indeed and they are playing with fire the silent major majority of res you to to okay finish up please would be very unhappy if you lift the ban before you vote on the issue look deep into your own heart would you welcome someone moving in next door to you or to your grandchild with a the Pitbull would you feel more secure or uneasy while you Garden in your backyard as a matter of public safety don't place the citizens of Aurora into a danger you wouldn't welcome yourself I do have some additional uh petitions that I'd like to turn in and thank you for your consideration yes if you'd leave those with the city clerk please thank you next is Lynn simol hello um I also have concerns about Pit Bulls and the one thing I I think we've pretty well covered it but the one thing that um I'm an animal lover I've had a German Shepherd I have friends that have had uh Rottweilers that is the second most dangerous um animal the thing that is different about pitbulls is they don't give a warning before they attack they don't growl they don't bristle um so you don't know uh when they are getting angry or upset um I also have a concern if the band is lifted and that is found to be a mistake it's a lot harder to go back the other way thank you thank you I have no other request to speak at this time Mr Mayor mayor protim Roth um I had uh somebody hand me something that they were a little bit nervous talking in on camera so they handed me this information and ask me if I would just address it I'm not going to read the whole thing I will uh submit this tomorrow morning as a council request but basically it's the concern about uh open campus status at Smokey Hill High School and the specific areas of concern are vandalism disrespect Lo loitering littering underage smoking drug trafficking and use and a dangerous environment um for the elementary schools uh students that that actually walk in that area as well so there's there's quite a bit of detail that goes into those bullet points that I'll be submitting tomorrow morning as a council request but I just wanted to acknowledge that um it's a concern about the open campus status of Smoky Hill High School and thank you for bringing that to my attention thank you next is the adoption of the agenda the agenda will be adopted as presented consent calendar 9 a through F A through e can be taken in one motion if there are no requests to to remove any items May Council mayor mclen move to approve nine a b and of the cityor Colorado adopting an urban renewal plan for the Redevelopment and Rehabilitation of the is of station urban renewal area 11a is public hearing I will open the public hearing and ask for a motion on the resolution Council mayor marker thank you Mr Mayor move approval of item 118 second moved by council member marker seconded by council member Hunter Holland to approve the resolution item 11a um I would assume that since this is urban renewal plan and this relates to a letter which the city received from the rapo County Commissioners today that we ought to uh read we ought to have presentation from staff to go under the record so please sure I have a map here of the urban renewal area the area that we're talking about is a 33 33 acre area under single ownership with the exception of an RTD parcel for park and ride can you make sure your mic's on it's it is I'll speak louder this is under single ownership with the exception of RTD this area is identified here in the map you can see that it's on the east side of i225 in the new Aurora line the history of this this planning process began in 2009 with the station area plan in 2013 there was a blight study of the area and the council found the area blighted and appropriate verb and renewal then we went on to do the urban rural plan that's before you tonight this plan articulates the physical Vision that was set forth in the station area plan it's for a compact M mixed use Community with ground floor retail great public spaces and high design standards the plan also includes some Financial mechanisms to help achieve the vision um the primary mechanism that we'd like to talk about tonight is Tiff tax increment financing there are two Tiff districts in this plan the first area is in the northern portion of the plan it's closest to the station platforms we think that area would probably develop first so that Tiff would begin with adoption of the plan the second area is to the South it is more distant from the station that Tiff could begin up to three years later after the adoption of the plan there has been a significant amount of public interest in this planning process we had a l a well attended neighborhood meeting back in February hosted by council members Roth and maret we had um I would say a generally positive response to planning along this Corridor a lot of people are excited about what the Aurora line means for the city with respect to the II station in particular we have heard numerous comments at that meeting and then after that meeting via email I've received three different letters that I'll be entering into the record tonight um numerous comments about Conor connectivity for this station in particular there are quite a few residents uh that have spoken up about connectivity to neighborhoods on the west side of i225 and there are serious concerns about safety for pedestrians who might want to come to the station along iff they would have to cross over um the egress and and entrance Lanes from the highway and um and it would extend their walk versus you know as the crow flies as it shows in this diagram from the station area plan you can see that pedestrian connectivity is labeled here as something that came up in the station area process in 2009 and it remains a priority in this plan as this diagram is part of our plan we have also added language to our plan based on public comment that addresses the importance of connectivity and we believe that Tiff tax increment financing is one of many tools that we'll be able to employ to hopefully help address these concerns um I have one other letter that I'll be entering into the record it's from the Planning Commission they met last week and they did find this plan in conformance with the comprehensive plan so I'll also be giving that to the clerk and I'm happy to take any questions thank you uh Miss amck is there anything you'd like to add um yes uh just that um the plan has been the plan has been distributed as required in the statute to both the county an impact report was provided to Arapaho County in which this area is I believe that the county has submitted a letter for your consideration uh I believe that uh the county is going to be making some comments based on that letter to provide their input into the plan but other than that we will enter that letter into the record as well as a response to our notifications questions of Staff council member broom yes could staff comment on the parking that's going to be available at this particular uh station I know that the uh 9em station parking's been very tight and that's one of the complaints that I've gotten the city is in the in an RFP process for the construction of the parking garage we have um three RFP submittals that we received last week the city is reviewing those and scoring those and selecting the preferred partner for that the the um qualifications for the RFP are for a minimum of 600 spaces at this station um with the Proviso that we could expand as needed so um in answer to your question there will be a minimum of 600 spaces and we hope to be able to expand in the future as needed thank you and I would also add that that the money for that is coming from both RTD as well as the city's general fund Capital right I have several requests to speak I will call these in the order order in which they were uh presented to me first is Amanda mil milstein I think it is or Milstead followed by Van Lewis and again um once you come up uh and and start your comments the next three minutes are yours and if I screwed up the name say so it's fine I'm Amanda Milstead with the president's Council from heatherridge Metro District and we have concerns about the parking structure that's at 225 in iff it's a blighted area we would like to see a storage facility put in there I think it would benefit the community and there'd be limited uh traffic that would be in the area so that wouldn't be a big issue and they would also like to see um the walkway from the West up 2 25 to the ISA station really put in front of the plan because we don't want to see anybody get hurt or anything trying to get across over there thank you thank you any questions Van Lewis followed by Larry ransford thank you very much for allowing me to speak tonight my name is Van Lewis I'm the vice president of the heatheridge Metro District uh thank you for your support over the years we couldn't uh come into existence without it so we came here tonight to to voice our support for 11a we want to appreciate end our appreciation the city and all those that have dedicated time and effort to this we think it's a great project we'd like to also be of record that the storage facility which is under consideration for rezoning be seriously considered for other usage than now Zone they're looking at putting a storage facility where the three level is and also as Amanda mentioned we have strong concerns about pedestrian access from the west side to the east side of 225 over there it's a tough problem so we look forward to hearing some of the ideas you've got any questions questions thank you very much thank you Larry ransford followed by Barry McConnell good evening my name's Larry ransford I'm the business manager for the golf course at Heather Ridge I'm also a resident of Cobblestone Crossing I'm here to support the uh Heather Ridge station working on that anyway the other thing is I'd really like to see something done for the pedestrians now being the manager of the golf course I really don't expect a whole lot of people to get on light rail with their clubs just don't see that happening I don't think that's going to happen but what I do see is the number of people living in the area in the apartments that are looking for transportation to their jobs to art recre ation to other areas I'm also looking for a pedestrian bridge that helps bring my employees to the golf course the other thing is I'm a part-time painter my painting experience has been covering graffiti on the billboard that's also referred to as the parking garage trying to get rid of that so if that was an opportunity to make that a storage facility the golf course would be in full support of that thank you for your time M thank you any questions uh mayor proam Roth not a question just a comment as the representative for w five I'm sure what you meant was Heather Gardens Station I you know I still think it's Ridge but we can work on that thank you heather uh council member marker as the ultimate one to find compromise and Congeniality in every opportunity how about just Heather we can deal with that the Heathers the Heather the hether there you go Connell followed by Michael shelan thank you um I also am a resident of Heather Ridge and um am here to speak regarding the ISA station at heatheridge um and the access issues presented to people who live on the west side of i225 uh the I'd first like to compliment uh urban renewal and uh Council for the outstanding job done in terms of planning and design on the east side uh shows considerable thought and I think uh a lot of promise for the area however um if we still had the map up the identification of the tax increment financing district one ends at abalene and therefore does not include the area does ated by the dotted line for pedestrian access uh pedestrian access is referenced several times in the urban renewals uh draft document dated January 27th the need for Access is mentioned on page 12 page 18 page 19 page 26 uh there so there are several references to the need to complete that pedestrian access on that dotted line but unfortunately the TIF district does not include that area so I have some concerns about how that's going to be done when it's not a part of the TIF district we might ask you to support a ballot issue to make that possible council member Markus for that PL but I think so um the the connectivity that's there the urban renewal statute provides for public improvements that allow for the benefit of the area this is inclusive of the area and so that public Improvement which we feel specifically the developers of the of the two Parcels within the urban renewal area would not be um they would not otherwise be incentivized to build any of those connections because it doesn't directly impact their property therefore it's a legitimate public Improvement that could be financed with tax Improvement financing I I guess my concern is that we we'll have a station operational in about another year and a half residents from the west side of 225 will have to cross two onramps and a multi-lane abalene off-ramp to get to the East side and then walk another block down isff which is going to have an additional 20,000 cars a day to get to the new Isa at Heather Ridge station so so it's it's going to be a tough walk for seniors like myself women with strollers uh disabled folks it's a it's a challenge and we've got high density multif family dwellings on the west side of I25 with no provision for those people to get to the station safely other than crossing highway on and off rants on foot thank you thank you question Council May Brew you have a question yes thank you mayor this this is a question I guess for staff if you drive down 25 South you see a lot of overhead pedestrian bridges that cost 25 to RTD stations what does one of those bridges cost the the only thing that I could compare it to off the top of my head is there is a bridge over kfax the that we had the pedestrian bridge um from the hospital that cost of that bridge which is a straight across is $3 million this is a larger span it would be an excess of that thank you next uh Michael Sheldon followed by Christine streski good evening mayor members of council I'm here with Diana real for a recent update about our support of this is of station Ur just this afternoon we came with our clients our clients are the fashion bar ownership group Marshall Abrams and Lisa Levy personally came to meet with a half a dozen of your senior staff to look at the highest possible quality multifam that could be built at the is of station we all went together to see new product built in Northfield Stapleton which is generating very high rents and the issue of the AA availability of tax increment financing is vital and important to achieve the goals that your staff is looking to achieve and we are trying to accommodate we are trying to religiously adhere to the station area plan that you saw that was adopted by you and to do that will require in our opinion uh the tools uh in the tax increment financing area now Andrea amck shared with us today uh the comments made by uh the Appo County Commissioners and we do have some meetings scheduled uh to give them the input and feedback I saw Bill hulland here today I think wants to address you but we have some specific data that can be utilized in this discussion and we intend to stay active in this communication thank you thank you any questions thank you Christine streski followed by commissioner holand mayor city council thank you for the opportunity to speak with you this evening my name is Christine streski and I'm an assistant County attorney with arapo County as already has been stated the letter is part of the record so I won't belabor too much what is found in the letter but want to emphasize a few points from the County's perspective the plan does not provide enough specificity as to what projects will be put into the Tiff areas for us to make a determination of whether or not we can object to the Tiff area and can object to the plan so as it stands now the county does have to object to the plan for two main reasons first because it doesn't provide the specificity the county impact report isn't giving the county enough information to determine the county impacts to both revenue and the possible impacts to infrastructure and services should there be more specificity onto the produ projects then the assumptions made by your staff in those reports can give us a better idea of whether or not those estimations and those assumptions are valid second we object to the plan on the basis that it does not give a statement as required by the statute setting forth the method under which The Authority or municipality will finance the projects or a statement that Agreements are in place to finance the projects rather what the report does what the plan does is it provides a statement that you're going to create two Tiff areas and then goes on to list and state that the authority will follow Colorado law as to agreements and other possible financing mechanisms available to it it doesn't give us the specificity with which the statute contemplates you are supposed to be providing to the county with your plan um and finally and and this is in the letter as well we question the need for the use of tip financing and certainly the use of Tiff financing for the um full amount of 25 years your great staff by the way we really appreciate their willingness to come and talk to the county and talk to the County Commissioners each and every time that you have one of these plans that is going to implement tax Tiff financing explained to us at our last meeting that you employ The Authority employs a but four test when determining whether or not Tiff is necessary to incentiv I for development and under the butt four test we don't believe that this Tiff area both one and two meet the criteria that you're supposed to be utilizing per your own policy that is but for the Tiff would development occur a light rail station's being built here and we understand this has been vacant property for many many years but it hasn't been vacant property with the Light Rail station being built we believe that the Light Rail station as most Light Rail stations if not all Light Rail stations that have recently come on it draws in development and we don't feel that a tiff and certainly a tiff encumbering County property taxes for 25 years is necessary to bring in development we look forward to speaking with the speaker before me but we would ask that at this point in time you wait until those discussions are made till projects are in place that we can determine whether or not there is going to be an impact to the County's revenues as well as the County's infrastructure and you hold off and just see what happens prior to adopting this plan along with the two Tiff areas thank you thank you are there any questions mayor council member CL um in in your statement you asked um that the services that arapo County provides um what would you say are the services in this area that arapo County provides right now because it's vacant land not much but once it becomes developed certainly should there be residential as the plan says there may be residential or should there be commercial as the plan says there may be commercial our assessor even though we're not every every year that we do revaluation the assessor still has to revalue those properties and he can give you the number better than I but a great majority of commercial properties seek to have their valuation reviewed so so there's a lot of there's a lot of County attorney time involved in that as well as assessor time we've got the coroner's office that provides services we've got the clerk and reporter's office that provides services when you have residential as well as commercial because of our recording duties as well as our voting um possibility that the sheriff may be called in on certain calls for certain just the sheriff does come called in not necessarily the first respond but we do have agreements with the city of Aurora to come in when there are emergency situations that need more Personnel than your City Police Department can provide so there's a myriad of services that the county provides that Human Services as well especially if you're going to have residential again the plan isn't specific if you're going to for sure have residential but our Department of Human Services um provides services to city of Aurora residents those are just a few that I can think off the top of my head thank you I appreciate that thank you any other questions at this time thank you thank you very much for your time um commissioner Holland not often we have a state senator and two County Commissioners present at a meeting welcome well I may be sleeping in my car tonight but uh I'm Bill Holland County Commissioner for District 5 in Aurora um I'm not going to go into into a lot of detail that Christine handled one one one other area that we do provide services uh to the county uh and and provide funding for its operation is a tri count Health Department which has a a large number of services that provides Aurora including inspections of restaurants and such um from from my my standpoint I am I've always been a strong supporter of the development of the of the light rail system and it's and the benefit economic benefit that's going to Pro be be provided to Aurora and the uh and the the uh metropolitan area however U as Christine mentioned uh there is a statutory requirement that you bring um you seek approval from the county uh for these for these plans and um uh so we would have an opportunity to analyze uh the fiscal impact that these uh uh the that the loss of Tiff funding would have uh the the the real question is that we want to be partners as a county in your development Pro in development process so that we can understand and comprehend uh how we budget our our annual budget to ensure that we have sufficient funds to provide the services needed uh I think the uh the statute is very clear on that uh and the the problem we have as as a County Commission is that we we can't um we can't analyze a plan that has that lacks the uh the true specificity that that's necessary for us to evaluate those requirements uh we're not opposed to providing tiffs we just think that we should have an opportunity or voice in in the development of that and determination the length of the Tiff uh because we're the ones that take the uh take the economic hit in loss of particularly commercial uh assessed valuations any I'll answer any questions questions thank you thank you commissioner M amck before I close the public hearing is there anything you'd like to anything else you'd like to put in the record uh yes um I just wanted to note that with the initiation of Tiff one Redevelopment activity will be occurring the city is investing as you heard on the parking garage and so that is a Redevelopment activity that will be creating value within that increment area and so that is a a certainty a pro a project that we will be doing and that is part of the reason for initiating that Tiff at this time any other questions of staff I will close the public hearing on 11a we have a motion and a second Is there further discussion Mr mayor council mayor marker I would just encourage my peers to consider this favorably we have put a ton of time and effort into getting a plan um that is workable for everyone we know what the concerns are and we've been working on them for years and we'll continue to do so um now that we've recovered from the biggest um disappointment which was for years seeing the fashion bar name on that property and hoping that we would get a fashion Bar store now that we've all recovered from the disappoint M of not getting a fashion Bar store we're delighted to have the development that has been proposed instead so thank you very much mayor proam Roth I have to apologize a little bit to the rapo county uh Representatives because I should have thought of this before but I'm curious why the county is opposed to this particular Tiff and has not come uh and expressed opposition to other Tiff projects we've had in the past is it because of the specificity and and I is it okay to invite them to answer that question Mr Mayor or I know the public hearing is over and I apologize if I didn't think of it hold on one second if we're going to have an answer to that question should I reopen the public hearing I think you would have to all right I will reopen the public hearing on 11a for the purposes of the question from mayor proam Roth to county commissioner Holland a as you recall we we raised some ejections uh to the uh to the development of the land across from uh the U the initial 25-year Tiff that was uh authorized and and the extension that was required um we found um we question question that uh the issue is is primarily that we don't oppose the tiffs we just feel that it's appropriate for us to have a hand in a seat of the T table as it were in looking at in the development of the plans and and then when you present a uh a report to define those e uh efforts as is required by the statute that uh you have a little more specificity as to what kind of uh uh what kind of development you plan to have mixed use uh uh and and Commercial development so we have an opportunity as a county to assess uh the fisical impact of the loss of those uh of those assess valuations o over the years and the other issue is do we really does the county does the city really require the necessity of having a 25-year um uh Tiff uh our view is that that this uh development uh will certainly attract U outside uh developer development interests as as um was just mentioned earlier and um uh would they come in uh even if a shorter period of time was was uh required for the for the Tiff allowing the county to recover some of its the assess valuation in those in those later Years thank you any other the paper um the same page number okay it's page two on retaining walls it's D um it's uh a word was changed and I don't know why there's no no definition of that word you changed uh it says walls higher than 4 feet shall be designed by a licensed engineer and you cross that out and put professional engineer what's the difference isn't a licensed person a professional person if it says professional if if license was crossed out and professionals was put in it needs to be reversed and we'll get that corrected because it's a licensed engineer in the state of Colorado okay yes license was crossed out and professional was put in that is a a I think a typo okay if I may answer that if I may answer that Mr City attorney uh actually I kind of like to point out something in the ordinance uh uh oh the term professional engineer is defined uh as a change to the ordinance and it does mean someone authorized to practice as a professional engineer by the state of Colorado so in essence that's why we have a a new defined term throughout professional engineer so in effect it means someone who's licensed by the state uh just a way of same thing then well pretty much but uh uh apparently when uh uh the the the staff my staff and Bill staff work together on putting this together uh we wanted to just have a clear defined term that could be used throughout these uh various code sections okay thank you that's that's confusing for a licensed contractor or licensed to know that he's not a professional you know you know what I mean well terminologies yeah it's just it's just a a matter of how you what defined term you want to use I'm certainly we could use something different if you like that's all I had mayor council member marker thank you and I found one now that I had missed when I had seen this before section 146 you're removing the criteria for those dastardly sight triangles um I can think of several in original part of Aurora that are beautifully landscaped with whatnot and we come along and tell them that they have to maintain a site triangle does this say those are going away no oh darn okay no they're still there they're just putting in a different section we're taking it out of city code so that gives uh staff the ability to uh create variances without having to come back to you to uh get those variances approved uh because basically would if I remember right uh I think the one of the city attorneys told me that it would have to be a code change to grant that and that's a very long process that most developers do want do not want for my reference could we have a motion on the ordinance first sorry yes uh move for approval of uh ordinance or introduction of ordinance 12C second move by council member r second by council member or mayor pram Roth second by council member berson cland it's going to be a long night mayor proam Roth council member cland to introduce 12C now council member Ro that's the second time I've jumped the gun tonight um so I have a number of things that I want to work through and what I've done is used the draft ordinance to uh make my notes and work off of the draft ordinance um the first several items I think are uh fairly innocuous but maybe not so starting on page seven of the ordinance uh paragraph excuse me while you're looking council member mayor Pro Roth we do have several people who have signed up to speak would you like to hear the speakers before we take on amendments way either way I have um three three requests to speak um Ed Tower followed by Meg Collins welcome mayor good evening mayor and council members how are you this evening um I'm here this evening with several uh Industry Group representatives and representatives of individual industry members and we wanted to take just a couple of minutes to make a few comments about this issue uh the the first thing we wanted to say was thank you you know this has been a pretty tough issue there's a lot of emotion in the community about if and how things should be implemented and at times we know this seemed like a thankless and endless task and the good news is tonight you're pretty close to the end so uh we wanted to start by saying uh very sincere thank you for working so hard on this both to all of you and to the city staff um along this process the city council has made a couple of really important decisions and the first one was to limit the number of licenses that would be in Aurora and we think that was very very smart with 24 licenses on a per population basis Aurora would have about one sixth as many licenses as Denver has and about a third as many as Colorado Springs has per person we think that's smart as counil members have said you can always expand but it's hard to contract so we think that was a great decision but along with with that is the decision of how do you choose when you have a limited number of licenses and a lot of people who are interested and something we heard over and over from Council was we want the best operators in the state of Colorado to be working here in Aurora and we couldn't agree with you more that's a great idea if you're the best you should get a license and if you're not then you came in second and you need to understand that so we really think that idea is not just smart it's also leadership and we think you're to be commended for that so tonight what we're asking for you to think about is how to really follow through with that idea of having the best operate in Aurora and having the best means that you have to make decisions sometimes difficult decisions you don't really get the best by leaving things to chance we think you get the best by creating a process that highlights the differences between applicants and Che uses and helps you pick who really does rise above the standard who really is better than the others we think that's part of the spirit of having Aurora be the best that this Council often talks about and so we want you to know that the industry members are used to being judged every single day and not always by the easiest or most objective criteria we're used to that we have that happens with our customers and we would welcome the opportunity to have you do the same thing so again thank you very much we think that adding criteria is the best way to choose those best operators and so we would support ideas of bringing additional criteria on to really pick who's the best applicants for Aurora thank you very much are there questions thank you Meg Collins followed by Bruce Granger good evening I'm Meg Collins executive director of the Cannabis business Alliance I'm here this evening representing an industry Coalition I have emailed Council today expressing the views of several CBA members who are urging that Council support incorporating the diff differentiator points that Council that was included in uh your packet as enhancements to the Baseline requirements these points incorporate many of the suggestions proferred by councilman Bob Roth and staff as objective criteria for consideration of applications these include additional points for a business plan that documents an operators's Financial ability for at least one year of operation which shows that the applicant can adequately address the the first year of operating expenses additional points for an operation operational plan that includes a strategy for employee training and continuing continuing education for employees regarding uh potency dosages and Municipal regulations as well as a list of best practices and additional points for Community involvement which asks for evidence of participation in the community in which they currently operate uh such as their Chamber of Commerce trade organizations and or local charitable organizations th this provision advances the goal of active engage active Civic engagement by the retail marijuana operator thank you for your time and I urge that you support these amendments to the Aurora scorecard and thank you for all your hard work any questions thank you very much thank you Bruce uh good evening mayor and city council members uh first I want to thank you for allowing me to speak here tonight my name is Bruce Granger I am managing partner of kind love we operate a single store in Glendale Colorado with two growth facilities in Denver um I would like to operate I would like to open an adult use Marijuana store here in a a as Aurora was my first home when I moved here to Colorado uh back in 1978 um I was a actually uh had a house in heatheridge since everybody's talking about heatheridge come back um um I would first like to talk a little bit about the 24 point point criteria um if you have been in business as I have since the passing of amendment 1284 basically I think we all as good operators would meet all of those 24 points and then we it would become a lottery for who you would choose um it's interesting that Meg just mentioned a bunch of things that I am here to mention as well and I would I would like to ask that you create um some differentiating points and those would include in my mind a comprehensive business plan maybe a security plan for the store as well as the neighborhood a training for employees that would include a a proper business plan uh uh business practices as well as human relationship training and management training health care for employees best practices at both the dispensary and the grows uh Community involvement membership and trade organizations involvement with state and local governments I thank you very much for your time and if you have any questions I'd be happy to answer them questions council member Markus thanks and you really are welcome to come back to either of the he Heathers at any time um I have a question you now have a shop that you've been operating yes so you'd be eligible to apply in Aurora um what is your shop currently doing for community service kind of involvement if you're suggesting that as a criteria yes I mean quite honestly we support um three different nonprofit organizations uh including uh Ms uh the MS Association uh as well as um a uh organization that helps children with toys um we're also involved with both the uh Glendale Chamber of Commerce as well as the Cherry Creek chamber of commas okay thanks appreciate it thank you any other questions thank you very much is there any desire to have U any kind of a staff presentation before we start offering amendments I don't see anybody jumping up and down um are there any questions that anyone wants to ask of Staff before we start offering amendments um council member Clen council member Pierce council member Market um I would like to to ask um Mike Heyman we are on a time frame here and we if we wanted to take some time to look at this say this Sunday or Saturday then this would not then be ready for the July 1st um to be able to start doing taking applications basically tonight is our drop dead date me yes uh I I think uh council member clown you are correct uh the way that our Council calendar is uh uh set up we have a meeting here which we we would introduce the ordinance April 28th uh we'd bring it back for final approval um as amended if if amendments are adopted tonight uh on May 12th uh the ordinance would take effect by my rough math that I'm doing the head in my head on uh June 14th because that's 30 days after final publication once the uh uh second reading has occurred the problem is not necessarily that uh uh you know there there there would not be time to have a council meeting in may just very simply there's none scheduled until June uh if we were able if we introduce the ordinance for example on the 12th then by coming back in June we will have missed that June 1st deadline uh so uh we are at the drop dead date for adopting an ordinance and having an ordinance effective and in place for the July 1st State deadline so okay okay and another question if there are um minor amendments that um and and I don't want to speak for council member marker but you had mentioned earlier that there were some misspellings a bunch of different things in here that how could we handle that so that that those are taken care of because you obviously do don't want an an ordinance that has a lot of misspellings different minor and I I I'm I don't again I don't want to speak for you but minor things in there that that need to be fixed okay I I'll give you three options uh I always like giving my client options uh how about one to make it easier yeah please three means we have to have a debate and a discussion how about the best option okay the best option is if we are truly talking about about crossing the tees and dawing the eyes on the ordinance uh and I mean by that non-substantive changes things that don't change the character of this ordinance the regulatory practice of the ordinance we're truly fixing just language issues I think we can do that and have that uh ready for uh publication on uh Thursday when we need to uh if we are talking about substantive changes however you can only make those changes to the ordinance by another ordinance now I would say that during this interim period before July 1st we could introduce a cleanup ordinance another option would be if it's something we can explain by regulation let's have the uh uh division manager who acts as a local licensing Authority uh adopt a series of regulations this is really much what the state has done uh in uh administering their code we have the same power in this ordinance and we give it to our uh Chief licensing official Robin Peterson over there who I believe is already working on those regulations nod your head yes Robin thank you they follow Q so well I but that I I do believe that is one solid option that uh uh we could employ to take care of some of these changes and uh would would get the ball rolling we could have those regulations effective by jly 1 very easily council member Pierce yeah had a couple questions about some sections of the ordinance for example on page eight of the ordinance page 466 of our backup at the top it's um it's talking about the $22,000 Bond I guess that's um that's provided to the the state of Colorado if I read that right or is that D it's D yeah D at the very top of the page talking about charity Bond yeah with and that's filed that's paid for to the state or to the city it be to the city okay because the and then and then on the next page where you talk about the fees so we've also and I just want to clarify so there's a bond that's paid and a and a uh license fee that's paid as well right on top of the 20 that's on page nine of the ordinance page 467 of our backup where it says section 6- 315 fees the applicant um shall pay to the city a non-refundable operating fee that's on top of the bond well is that correct um yes it is but the bond you wouldn't pay the $20,000 you go to a a Bonding Company and so that you have an agreement with those but the fees would be directly to the city yes okay and that is on top of it and then um back here on page uh 12 of the ordinance and Page 470 of our backup about maybe in the middle of the page is talking about section 36.2 of the IBC I think that's the international building code or what does IBC stand for that's correct okay I think that ought to be spelled out in one of these dotting the eyes and crossing the te's thing and then the same thing later on there's another abbreviation I'm not familiar with it's on page 14 of the ordinance and Page 472 of our backup and it's talking about section 43.1 and of the IMC adopted and I don't know what IMC stands for you know okay International Mechanical Code mechanical so I think that ought to be spelled out in one of these tweaks that might happen so um and I have an amendment I want to propose at some point but those are all my technical questions about the wordage in the ordinance so thank you council member marker you had questions I did you're lucky you got all your questions answered I have 21 and Mike and I made it through about three in half an hour this afternoon so despite having been on this committee from the beginning um I sat down and read every single word and I too found lots of questions um I think the regulatory scheme is probably the only way to address the detail that's needed the problem with the regulatory scheme is that there's no method for public input so we trust you and we hope you kind of get the drift of what we need to do um but there's some pretty major decisions that are going to be delegated to the regulatory process and I just think we need to be alerted to that because it's not something that we'll be discussing and debating which might be good maybe we should have sent the whole thing off to regulation instead of ordinance but fact is there's not going to be an opportunity for public input um but if we could um starting on page two um might be Petty might be um annoying but section g I don't think we have to refer Robin is the joint marijuana enforcement division it is a unified division across City departments there's no question about that but I think you can be the marijuana enforcement division without the word joint and I'm going to move to strike that um just Petty if I if I might I'm we're not doing amendments I know but I'm just I'm these are the ones we got Mike and I got through three um I think section um 63 307a on page four where we talk about unlawful for the person to operate the establishment in the city without obtaining a local license and holding a good license and good standing from the state I think we need to clarify that that's concurrently simultaneously at the same time you can't can't have had a state license last year and be getting a City License this year they have to both be held at the same time so I think that's a technical Amendment concept that doesn't need um a lot of it's not a just not a big deal but it needs to be clarified whipping along up to page five Mike had to draw me a picture of in section one there on the very top why is it taking us 45 days to figure out whether or not they're in Conformity with the planning limitations so maybe Jason you can help me better not that Mike didn't do nice job but I still don't get why it takes us 45 days to figure out if they're in the ward or not and I think this is intended to try and mirror up with the state's uh timing so at the state level the state says that they have to announce the decision no earlier than 45 days and no later than 45 days and so our intent there by saying you know within 45 days on us is that we've worked within the first part of when the state would announce their decision so the intent on that is so that we're mered up with the state's process so the state will not issue their license earlier than 45 days but they also have to process that application within 90 days so again the intent of this is to marrow up with that process outlined by the state because my understanding if I might Mr Mayor is that the first hoop for our process is the location that this section and then come all the other criteria so for 45 days they're kind of in suspense while they get their state license and figure out where in the ward and again I think the intent of this is it says no later than 45 days we're hoping to do that much sooner than that we're just trying to make sure that we certainly let the state know within their first window of when they have to make a decision so that's how that's the interpretation okay okay um I don't know do we want to go on I mean well I I think what we heard from City attorney was that if they are U minor drafting amendments they can be um repaired quickly and be ready for and the ordinance can be ready for fining um if they are um more substantial amendments but are not the kind that fully change the intent of the ordinance that they can be handled by a second ordinance that would follow so um I guess it my suggestion would be um if they're minor drafting or even if they are larger but don't change the intent you could address those offline with staff and with the city attorney but if you've got something that is more substantial like I've got a question that I later on that I want to ask that I don't I'm not clear on uh that um then I'd say go ahead and ask those okay okay thank you um the next in on that same page five lure of the applicant will have a harmful or damaging impact on the public health safety or general welfare of the city or the neighborhood the way I think this is going to come out for those of us that that interact with our constituents is standing in front of our electorate and say and answering questions about why is this particular business in some place and we're going to want to be able from our viewpoint to say that the business passed the criteria and met the requirements the city imposed so that they could be a good business at this location that harmful or damaging impact on the public health thata needs further definition because I need to be able to tell my people yeah we looked and we checked and we you know looked at these certain things I don't know what they are I don't want to figure out tonight what they are but it's one of those in that category of further defined by rules and regulations that would mirror other sections of I mean we have other businesses that we pay attention to that are nuisances or whatever so but that would be an example of something that I think needs Clarity from the applicant standpoint and defensibility for us as electives um uh let me see what else we can get done that away um I'm worried on page seven number before the applicant and the applicants principal officers and Executives were in compliance with state and local laws um in the criteria this is one of your point criteria Bob I need some kind of legal proof that that's a binding relationship because I can buddy up with my good partner over here and drop her from my paperwork at some you know there's nothing here that says they have an ongoing relationship it's just that they are in compliance and have experience um the same thing on six certifies that you're not going to employ a manager or employee with felony convictions well you certify that and then two months later you hire someone who lies on their application is a felon you've now what forfeited your points um what what there's no sanction for it it's something you certify promise I'll be good Boy Scout honor but then something goes array and then there's no sanctions too late so how how do we're going to handle that so um another one that I thought needed oh the back to your shity bond question is that $220,000 part of the 400,000 available liquid cash or is it considered not liquid because it's not liquid because it's an assur the bond is worth 20,000 they W have put up $220,000 for that Bond uh so at this point we're not envisioning that as part of the operating Capital requirement it's good to know that because that would be how I interpreted that as well um I did find finally find where the fees are set and I appreciate that and Mike if you would clarify for everybody on page 10 item C we talk about what's unlawful to display transfer distribute Ser serve sell giveaway or dispose of um we don't talk about using or consuming and Mike was good enough to find for me that we refer to that in section 994-2133 the rest no and I appr that I just think for clarity the using and consuming needs to also be referenced here in that we didn't mean to leave it out and nobody else but Mike would know where that was referenced so um it's not a big deal but I think it would be important um I'm wondering on page 117 item s why you're taking 20 days to notify a leny of a violation why they have 20 days to correct the violation if it's a violation that's worth notifying somebody of I think 20 days is way too long sometimes council member Brin and I don't last 20 minutes on a violation certainly not 20 days so um I worry about that um on item eight I worry about um things like graffiti and litter and um what what the meaning of that section is and would like it spelled out here in and not in another section 6226 da da um IBC is good and on page 13 where we talk about additional criteria uh the section what's it the section that is what applies to the business the um grow operations for manufacturing and processing we talk about plans for extracting reports from hygienists and descriptions of extracting if that's proprietary how are we going to I mean I I think it should be proprietary to their industry or business but how are we going to know if it's good or bad and how are we going to guarantee the lensey that we are we're going to have to ask somebody that knows more about this than us and how do we assure that the formulas or the distilling distilling or whatever that that that's kept proprietary to protect the different um folks involved and I'm on the last one guys um I can't read my own writing I'm sorry it has to do with the ventilation system though we describe it but I'm not sure oh but we we won't know that and I don't know about this is probably more a construction question will a system of ventilation system work the same when the building is occupied as when it's designed I mean when it's full of people and hot and cold and whatnot it should they're they're designed specifically for a certain occupant load so they anticip what that load will be okay so because it seems like it's kind of after the fact but that's some examples if nobody gets like excited about any of those and they can be covered in the other process that Mike refers to I'm fine with it um but those were the small ones that I was concerned about thank you I think you had some good some good points there other thank you other questions that anyone wants to ask no uh Bob broom thank you mayor I have a question for the City attorney um under federal law is it legal to uh sell or possess marijuana under federal law the sale or possession of marijuana is a crime thank you I I just don't see uh and I'm going to not be supporting this ordinance how we can put in place a system that's illegal it just seems like we're aiding in AED illegal activities um I just pulled up The Denver Post and one of their lead stories uh today is uh the headline says feds four men diverted Colombian cash to Colorado marijuana business I mean this 400,000 stuff that's that were B batting around I wonder where that 400,000 is coming from uh is it is it all coming from legal funds or are we aiding and ab betting an illegal uh operation thank you other questions um I I had a couple uh I'm in um section 6-39 which is the licensing requirements and uh for retail marijuana stores and in different places and I'll just use for example under um a four there's a terminology of um licensed marijuana business in Colorado and you're this is getting points and you've got to have two years experience but if you go over to B3 the terminology is marijuana business in another state doesn't say anything about licensed um or or anything like that is there any particular reason why in one place we're saying a licensed marijuana business in Colorado and um citing it as a minimum but in but in getting giving extra points if you run a marijuana business in another state licensed or not you can you can get a point that's a good point is there any explanation for that or is that just terminology I think it's a terminology I think we would look to uh make sure that that's obviously a licensed and legal in in another state and so we would uh and that's fine with me I just want to make sure we're covered there I could suggest using the term lawfully operated and that probably would take care of everything okay and I I'm assuming that another or or a business in another state that would give an applicant a point would be in all likelihood a medical marijuana business yes or If This Were if this ordinance is in place in three years from now five other states have have uh made recreational marijuana legal and somebody's operated there for a year then this would apply yes okay yeah okay any other questions if not I will go back to Mayor protm Roth for his amendments thank you um starting at the bottom of page six and spilling over to page seven uh items one and items two there is um an additional point for up to three points for uh somebody who had has had a marijuana business for five or more years and it's my understanding that prior to 2010 uh business licenses that were issued in the state of Colorado were either plant husbandry permits Wholesale Food licenses or retail sales licenses they were not designated as medical marijuana licenses or medical marijuana businesses at that time so I guess I'm wondering you know we didn't when when we put this together as a committee we thought that you know the longer you had experience the better but I'm I'm questioning whether or not uh five years of lure in the state of Colorado is even possible and if it's not possible I would recommend that we drop that third point for five years because I don't think that somebody could have had a license for five years I on this subject council member Peterson council member Peters well I just suggest that you make it four and we have we have yeah uh an additional point if they what page are you on Ro we have additional points for uh three years and for four years and then this is an additional point for a fifth year right and and my point is that I don't think that that third point should be awarded just based on the fact that I don't think it's possible somebody had a license for 5 years right I think I might I think that's probably correct at the time of adoption I guess I'd go back to the mayor's point about you know maybe potentially a year from now you know that would have been so going into the future it's a possibility but if if council's more comfortable with striking that fifth year we can certainly strike that mayor council members since we're looking for people that have been in the business we could keep that but add um three words after um I'm on page 61 um B1 same same place um if the applicant has five or more years of experience operating a licensed marijuana business in Colorado or other states then they can be awarded an additional point cuz that that shows that they've been in business I don't think there's I'm not I'm not comfortable with that change uh only because I am going to suggest that we consider the other state portion of this as well so and maybe maybe it could be a matter of changing it to say five years of experience as of a date certain because that that could be established as uh as of whatever date that is that uh when it would have been possible for them to have a license to your point Mr bachelor of of anticipating a future license applic applicant that um they would have possibly had a license for 5 years so maybe maybe that's the answer to this is to so I'll I'll change my amendment to say that and I don't know what that date certain is but that the the additional point is only applicable for 5 years of experience at a date certain at which point it's possible to have had a license for five years is there second to that Amendment second moved by mayor proam Roth seconded by council member Clen to add language in uh section 6309 B be one that allows for the potential of 5 years per uh of experience points for five years of experience accred after a date certain that date certain would have to be identified based on uh practical experience in Colorado is that essentially it and just to clarify it's items one and two correct one and two because it mentions five years in item two as well item one is for experience and item two is for uh the clean um regulatory regulatory comp administrative history right so the amendment would occur in both one and two correct all right every is there any discussion on that Amendment seeing none call question on amendment number one and amendment number one is approved on a vote of nine to one with council member broom voting no council or mayor Pro Tim Roth the uh second item I have is item is number three on page seven um I know that again I chaed this committee but I just would like to maybe have another member of the committee jog my memory why we said operated a marijuana business in another state for Award of a point um if we don't know what the rules and regulations are in that state um and if if there's not a good reason for us to keep this in here as operating in another state for a point I would suggest dropping it mayor is that your motion I I would I'd like second the motion yeah okay let's get a motion before we start talking I I'll move then that we uh drop the additional point for item three on page seven second moved by mayor proam Roth seconded by council member marker yeah to delete uh number three under um section 6 309 uh council member leir mayor well I'm sorry I had council member CL I thought you were just second trying to Second the mo he was asking since I sat on the committee why and I believe in relation to that I think it's fine to delete it because it was in relationship to getting to the four or five years is what I think our discussion was all about so that if if someone else so that you had the time but but I think especially with the change there absolutely okay council member leer I I'll pass mayor any further discussion seeing none call a question on amendment number two two deleting number three and amendment number two is adopted on a vote of nine to one with council member berson's voting no mayor protim Ro my Amendment Three is um and I don't know how we frame this precisely but I think that we should have uh the opportunity for somebody to get a preference Point based on uh a security clearance a governmen issued security clearance we talk a lot about uh businesses that that are highly regulated we talk about uh specifically marijuana businesses and I think that having uh some sort of security clearance through the federal government would be something that would show that you have passed the scrutiny that's above and beyond what's normal uh could could you reference a place where you're you're adding that I'm assuming I would be adding that I guess in in my notes here I've got it uh between well I've got it basically as a replacement for number three okay a replacement for all right so that would be um a security clearance would add one point that's what your that's correct that's what I'm after would you um would you offer a motion please I would move that we add a single point value to the base criteria for um an operator that has a federal federally issued security clearance and I see staff cringing yeah Jason's looking pain I'm thinking about the verification process of this and I'm worried about calling let's worry about whether or not there's a second to the motion first I don't have one yet okay motion dies for lack of a second mayor proam Roth and the um the last three items um I think I prefer to take separately these are the items that I uh I originally addressed and handed out at the meeting last Monday the 21st these were items um one two and five on my criteria dated April 15th and handed out April 21st um items three and four I dropped because they were obviously overwhelmingly disapproved by my colleagues but items one two and three or excuse me one two and five I've made some slight modifications to uh I sent to my colleagues the amendment that I'm the Amendments that I'm Pro proposing tonight as well as what I handed out last week so that they could look at both of those and compare them so the first amendment that I have relative and this is relative to the items that are uh bonus points in our RFP system um is it appropriate for me to just read the entire Amendment Mr Mayor please okay uh an applicant May also submit an operating plan that shall be worth between 1 and 10 points the operating plan may include a staffing plan that will provide and ensure adequate Staffing and experience for all accessible business hours and adequate security and theft prevention an operations man manual that demonstrates compliance with City retail marijuana laws proactive consumer education practices a description of an employee training program and a list of best best operational practices moved by mayor proam Roth seconded by council member cland uh to approve uh the a read uh amendment number three um discussion council member leer yes um I just wanted to say council member Roth that you actually earn my support on one of three of these because I didn't support any of them when we talked about them previously I do believe that the uh operating plan has some value and some uh worth in in analyzing the overall application um so I will support this I I'm not going to support the other two because I think they're somewhat subjective C council member Hunter holand would we want to add an city and state retail marijuana laws or is it understood that state is also being followed uh I'm I'm fine with that change okay you consider that a friendly Amendment I'm yeah I'm fine with that for state state that again City and city and state marijuana laws city and state was City retail and State marijuana laws the city and state retail marijuana lot yeah all right thank you that's been added as a friendly Amendment further discuss council member marker thank you Mr Mayor um is again this is one of those that we're going to need to hire somebody to analyze you can get these templates off um any place online where you pull up operating plan and you insert name of business or insert um number of employees and outcomes your plan um if it's something that someone puts some thought into um is that information going to be proprietary because it would be in a sense their secret sauce to success for their business and whether or not it is proprietary how are our staff supposed to judge whether it's a onepoint plan or a 10-point plan you know if it was me it would be based on typos and and grammatical errors but there's probably content that's more important and how is Robin going to know whether or not the plan is describing an adequate security plan and a proactive consumer education practice and how's she going to know how to apply those adjectives to those objects and how is she supposed to rate them and rank them in terms of points I'll address that mayor protim Roth as I've said all along through this process um the the city staff and I know that there's difference differences in different rfps there's different ways to evaluate and and look at R the RFP process but City staff I have full confidence is is familiar with looking at rfps and familiar with judging rfps on the on the merits that they uh that they provide we use criteria subjective criteria for a lot of other things that we do in the city uh we just recently uh selected A A head hunter firm for lack of a better term an executive Placement Firm to uh look for a new City attorney uh in that search for us and that was subjective criteria it was not objective criteria we do it all the time the other thing that I would suggest is that um as we move forward we consider the the idea of forming a panel to assist in this process and uh the the couple of things that I jotted down is maybe it's a liaison from the business Advisory Board uh liaison from building code contractors in the appeals board uh CABC an industry expert I think that if there's a a lack of comfort by my colleagues to have staff adequately look at a subjective criteria and evaluate it based on its merits that we can we can beef that up by having other a panel form to uh to sit down and and evaluate the criteria as a group so I'm not I'm I guess I'm not concerned about the staff's ability to to perform this function and if there is some squeamishness about that I think we can form a panel to assist in that further discussion mayor council mayor M CL um I think one of the things that is unique um because I know I keep this word subjective keeps getting thrown around um so if it is somewhat suggestive what is the problem with that it's not like they're going to probably sue us since there's only two states in Union that um Do What I Call retail marijuana um I I'm not sure there would be a court that would accept it um so I I truly really have no problem if there are some that feel it is subjective because I I agree with everything that Bob Roth said that the staff has been dealing with this for a year or so and I have every confidence in the staff mayor council member Pierce yeah I think if I'm not mistaken council member Ro the intent of this amendment and maybe the others as well is to um form some s some set of differentiators with a point system that will kind of bring the best companies to the top of the list so to speak are the top of the points the point total so I think you know I'm going to support this particular Amendment because we need to have some differentiators to get the best companies cuz that's really what we're after I mean if we don't have any differentiators it's not going to work you know this is just another way of trying to get the cream of the crop for the uh for the retail mayor proam Roth if I could just tag on to that you know I mentioned this before but um we're in a very unique situation we're in a very unique setting we truly have an opportunity to make sure sure that Aurora does it right we have the opportunity to make sure that we set it up for success of the best possible operators in the city of Aurora and that any headlines or any media attention that we get is for positive things rather than negative and uh to tag on to council member Pierce's comments that's exactly what I'm attempting to do through these bonus points is to set up differentiators that make it make it uh very clear that we want to have the best possible operators in our city further discussion seeing none call the question on amendment number three and amendment number three is approved on a vote of 8-2 with council members broom and marker voting no mayor Pro Roth thank you Mr Mayor my next amendment is as follows I propose that we amend the city retail marijuana ordinance to read an applicant may also submit a business plan that shall be worth between 1 and 10 points the business plan shall clearly demonstrate the applicant's ability to operate in a highly regulated industry and may include a scope of work for the planning and development of the proposed business may include a scope of work for Capital Improvements for the proposed business an estimated an estimate of firste revenues an estimate of first year operating expenses and evidence that the applicant will have the resources necessary to pay for those expenses and a description of the applicant's history of compliance in another highly regulated industry second moved by mayor proam Roth seconded by council member cland uh the uh Amendment as read discussion council member bur I have a question I have a question on the Capital Improvements is that the same as you're saying they take a rundown office space or rundown building and um fix it up we we talked about that in study session too U so but would that be the same as um paying more for a business that is not so run down mayor protim Roth uh thank you for the question and and actually what I had at a study session last week was uh actually to identify a monetary value and I've changed that to be a scope of work so I think it's important that we understand what they're doing to improve the property or that scope of work could very well say that this is the condition that I'm taking the property in so that we understand that it is in good condition so I eliminated the portion of it that had to do with dollar value and talked about scope of work instead okay so will staff understand that and they'll they'll be able to compare that because that's not Apples to Apples I don't know staff question question for City attorney this discussion will be a matter of record I would assume absolutely so staff if this amendment passed uh passes would have the ability at least check the record at the meeting to gauge the intent of the sponsor correct I agree with that comment mayor they would thank you mayor mayor Pro is it council member CL possible that I ask Robin are you understanding what he's saying and do you have a problem with this I understand what he's saying yes okay and and do you think do you think that that what is in here that that the group that's going to be looking at this can can work with this the group yes or whomever is going to be making these decisions we'll do the best we can okay can we make sure that you all have your microphones on down there we're not you're you're not coming through very clearly I guess if we're I'd ask a question a clarifying question for the for the record here which is if if we're talking about a scope of work is a bigger scope of work better than a smaller scope of work I would ask that of the sponsor I guess my answer would be again referring to my experience a a lot of words as compared to a little bit of words is not the point it's the content it's the completeness um again in my world and I know it's different worlds but in my world they will ask me how I plan to build their building what's my plan to build their building and mine may be a page and my my competition might put out 10 pages but it's it's the content of what that includes that is important not the number of words city manager noi I think as we as we've looked at that the this provision part of the challenge becomes that this is a plan and there's no the plan is only good as as as it's executed ution so there's no mechanism to say we're going to monitor or somehow enforce the implementation of a plan um so it's one thing to to to have a document that looks good and has all the right words and all the right numbers uh but if they're not following that plan if that's not what moves forward then it's just a piece of paper that got an evaluation and I don't think that's really what your intent is you want this to be something that truly uh we can rely on as a plan for operation for this business but at this point that's now this not how this is structured it's structured as we're evaluating the plan itself and there's no hook that says if they don't follow the plan here's what happens if that makes sense well I see your hand but the what the conversation here is with the sponsor let's deal with the sponsor first I have a I have a way to help and then I'll make sure you get called and council member Leary gets called she and and I guess I would respond to that by saying that I understand if there's 200 applications the initial process of evaluating these is going to be a little daunting but as far as the followup I'd be more than happy to to put something in here that addresses followup but we're not following up on 200 we're following up on 24 so I think that's very manageable no I understand I'm not saying that that's that it's not manageable I'm saying but that's not written in here that these plans become a condition of their license and their failure to file their plan become something that could keep them from having their license uh renewed you know which which in essence makes this something with some teeth you're right not for the 200 but for the 24 that get licensed mayor protro uh I acknowledge the city manager's concern there and I and I understand what you're saying better now I would be more than happy to let staff put the wording in here but I would agree that at least on on an annual basis if they've not followed through that that this is a uh that their ability to renew their license is subject to that the fact that they did follow up on their plan they did follow through with their plan and that would give the the teeth that you're looking for is that acceptable to the secondary of the motion okay now council member Market thanks I'm wondering I'm thinking when you talk about your Prof question and I'm thinking well I respond to rfps all the time I mean they're writing them are responding to them different industry again but the same process what's helps is that there's a number of pages you know that section shall not be more than blah blah and then the criteria for evaluating it are part of in my world the RFP so I know that I need to be stressing whatever um but that these are the criteria that I will be judged on so I do my planning and my thinking and my designing based on the criteria I'm meeting these are State Awards so um maybe back to the rules and regulations that you can do outside of this process would be a place to have the criteria that you're looking for at least spell out in the beginning so that you're protected we're protected by having what we're looking for more wordy than just points you know it's um more specific than just a point value um but but useful because actually then I might not be quite so cons object I might not object so strongly to the subjectivity of it if the criteria were included in the actual request for this item proposals will be judged on da da da da da da and council member leer yes um I I'm going to just make a a comment on this because I think that when I read this and I I look at an estimate of the first year revenues and an estimate of the first year operating expenses and evidence that the applicant will have resources necessary to pay for those expenses it it just seems that there's so much subjectivity in this and then I I would also ask what what's really the value of those um things I think somewhere there's a repository of excellent business plans for companies that don't exist anymore because they went out of business and it just it just seems to me that this is I don't know it just seems Seems like we should rely on the fact that these investors are investing 400,000 to a million dollars and let that be the business plan further the comment all right the motion is um um essentially number nine on the handout from mayor proam Roth with an addition that uh creates some kind of um enforcement uh uh mechanism uh for U Future evaluation and perhaps the non-renewal of a license that language would have to be settled upon but that's additional language in this motion so with no further discussion I will call the question on amendment number four and amendment number four fails on a vote of five to six with council members broom Monier Peterson marker leer and Hogan voting no since I don't engage in much of the discussion and don't have an opportunity to um get involved with the debate and only vote if there's a tie um I think I owe it to explain my no vote I essentially agree with council member leir um I understand the requests here but the world is full of all kinds of wonderful business plans that failed and um didn't fail because it was a badly or poorly written plan uh things just didn't go right and to um I was actually more interested in the amendment as written than the amendment with the the hook in it because uh I was not comfortable with the idea that if somebody just if something happened and somebody just got a little bit away from what the business plan said that can suddenly be used um as a basis to uh take away their license so um I'm just wasn't comfortable with it and voted no mayor protim Roth I would like to Repose that Amendment then without that wording in it taking out the wording of the applicants ability to lose their license if they don't follow through is there a second to the motion moved by mayor proam Roth seconded by council member cland to offer the um am Amendment it would now be amendment number five that would be as originally read and in his handout discussion could I have council member Monier could I have it reread as it would exist as we're going to be voting on please an applicant may also submit a business plan that shall be worth between one and 10 points the business plan shall council member mark thank you Mr Mayor I don't know if the um proposer would consider this a friendly or a hostile Amendment but I would like that I don't mind that section but only if it's treated the same as the others and that is that it's worth between one and 10 points um I don't see how we can do that and here's my rationale when I'm standing in front of my constituents and they're here tonight they're going to ask me what's in all that for me because that's what constituents should do and I'm going to say uh nothing I can think of or I'm going to say Well thank goodness council member Roth thought that they ought to have some kind of involvement in local charitable organizations or functions so when your Destination Imagination team needs to go to Nationals or when your softball team needs a sponsor that's who you would go to to ask and I think it should be valued the same as the other things which actually I don't support as much because they can be faked but this is real I either to get a yes or a no out of them when you go and ask them to pay for the pizza for the party for the girls gymnastics program so the either deliver or not you know so this one you can prove you can demonstrate you can judge you can put a value to it and you can approve it and it's not subjective so but I don't think it should be treated less importantly than the ones that are worth 10 points mayor mayor I'm not anymore um it is getting late and I do understand I hear what you're saying council member marker I truly do and and and I agree with the concept of it but I'm trying to figure out we don't ask Walgreens to do that kind of stuff or we we have asked in the past um the the um the water people that that came in that you need to be a part of the community but to put a value on it and and that much here is my concern if if it's 1 to 10 points if they give to the Girls Scouts Pizza Club whatever it is is that worth one point or is that worth two points and if they give to Ms which Ms as as one of the the speakers spoke to it's call it's it's Aurora but it's also the state but it's also National So within MS get more points because and and that one to me could be a little dicey because I'm not sure I could maybe not 10 points maybe one to five because I'm I'm just having a hard time an applicant could give to the Boy Scout Four Boy Scout clubs or five Boy Scout clubs is that worth one point is it worth two points so I'm just trying to figure it out if I could council member marker we don't ask any other business to do anything else that we've asked these people to do either so that doesn't work but the point the point to the the value we don't do that for the other two that you approved either I mean is a accessible business hours and adequate security two points or five points I mean we didn't you're going to in the criteria if you do criteria as part of The Proposal ahead of time that this much is worth this many points so you could spell it out in advance you can put a dollar value to the community service or the staff time I mean they can Comcast just at a huge service day I mean you can put dollar values to it it it's the only way I would support it so it doesn't matter one way or the other but to me it's the only one you can quantify and actually make it of value to the constituents council member brim thank you mayor a question for staff I guess when you evaluate the applications for the licenses that come in will you go through each application and score each point and then you score it and then you put it aside and then you pick up the next one and you go through it or do you look at all the applications and you weigh each one of these Point by point to decide who gets one points two points three points or four points based on their application versus all the other applications that have been submitted I I think the the first thing we'll do is go through each of the applications ations make sure that they are complete in their materials make sure that all the minimum criteria have been met anybody that has not met any of the minimum criteria will be set aside not move on to the uh additional bonus Point criteria beyond that I think uh that was part of our goal in uh keeping criteria objective now that we have some subjective criteria I think staff is going to have to sit down and figure out an approach to this so that um we can continue to be fair and as objective as possible in the scoring of these applications thank you and good luck mayor mclen would it be appropriate that maybe and I'm just trying to come up with with an idea that maybe the marijuana committee or the amendment 64 committee would get together one or two more times to help staff um come up with some of those I don't know I'm just trying guys um I don't see anybody ideas but I'm trying I think we Mr manager We Will We Will Follow council's policy and we will figure out a way to evaluate these these these proposals we don't know exactly how we're doing it sitting here today but as you said we we are we're a professional Creative Group and we'll come up with a way to to do this in a way that's fair and and U um and respectful of the process I would be fun I guess then I my my last question would be is that that when you do come up with that criteria I would appreciate you letting us see what that criteria is in case we feel there is some tweaking that may be needs to be done council member leir yes I would I would like to ask uh our staff how how will you evaluate these how will you know if someone in this business has been a good Community uh contributor is it they give you a letter that says these people have been great Community contributors um they show you receipts from the American Heart Association that they donated $20,000 what what definitive information will you look for that you will know is factual and not you know just created I don't know I don't know at this point okay thank marijuana license pursuant to this article and I think I have explained that I do not feel that we we should get into monopolies in the city of Aurora because Through The Years you could end up that one um um owner could end up owning all of all of the since we're having only 24 could end up owning all of the marijuana facilities in Aurora and I don't believe in monopolies and I don't think we should ever set up a situation where that could happen I'm looking for a second to the mo I'll second second moved by council member Clen second seconded by mayor protm Roth council member leer yes uh council member cland would you clarify are you intending that this is six stores in Aurora yes thank you mayor proo uh I just wanted to ask the it's six - 3116 unlawful acts that's where it would be under I just wanted to clarify okay yes thank you item e okay thank you I have a question council member Bens okay um did the did you mean to say one per Ward or just six total I'm doing just six total six total okay any further discussion and the amendment is as read it shall be unlawful for any person to hold an ownership interest in more than six retail marijuana stores licensed pursuant to this article I'm seeing a lot of movement out there is this indicative of something staff would like to uh I I just so Council Knows by clarification I was just checking with Council um with an e um in terms of uh we're going to allow unlimited applications but you can only be awarded six license or did Council wish to limit it to six applications no I'm saying licenses it's a it's a minor just yeah but but since we have the ward jurisdiction you know they could theoretically apply for four in each Ward and then then take their pick of the six if they were to win all those I'm saying six in the city of okay council member Le yes mayor I just want to clarify do do we need to add amend this to include the word Aurora to make sure that's clear yeah or is it understood Mr attorney oh I would uh state that when uh the language says pursu to this article so that automatically incorporates the fact that it's going to be in Aurora and it's licensed under our opes Mr mayor council member mon I'd like to ask council member Cleland um if you could describe ownership is that 51% 100% or I guess in my mind it is anyone that has an interest um even if it's 5% okay thank you further discussion with seeing none call the question on amendment number seven good question and amendment number seven is adopted on a vote of 8-2 with council member Hunter holen and council member marker voting no there Council mayor Peterson I would like to offer a another amendment uh under under the point system to fall under uh Roth's uh proposal and what I would like to offer is that uh if any any um companies that come would buy a property in the Enterprise Zone or in in a blighted area and make improvements that they get extra two points I'll second that moved by council member Peterson seconded by council member Monier uh and in essence a company that if they were to come and they were to to purchase a property purchases purchase the property in an Enterprise Zone or in a blighted area and make improvements to that building they'd get an extra two points mayor council member CLA then if it if it is so I'm trying to understand read if it is blighted we have declared it blighted for a tiff usually my assumption so if it is declared blighted and there is a tiff would they then be available to partake of that Tiff no okay don't think so okay well that's what I'm trying to understand yeah if they're in an Enterprise Zone would they be able to I don't remember all the the different um um positive things you get from being in an Enterprise Zone um would they be able to partake in the decrease of taxes uhhuh I'm not sure I would assume so yeah Mr Noy in fact this would this would basically be an incentive for the businesses to locate in any number of the of The Well of all all the urban renewal areas we have created and all these locations it would be an incentive for them to locate in those areas by giving them two extra points by being there so from a public policy standpoint are you are you working to incent those businesses to buy property and locate in those locations and that's really kind of a question yeah mayor I I guess council member CL I I I understand what you're saying council member Peterson I do um one of my concerns is I don't it is something that possibly could happen in the future but I don't believe that it would happen now because if they're buying a property and building a building we're talking six months to a year and a half okay to two years that it has to go I'm not talking about buy building a building I'm talking about purchasing a a building in an Enterprise Zone and making improvements to it would it then have to go and I don't see how they could possibly qualify for urban renewal do dollars being said that those come from the federal government I don't see how that could possibly happen but it doesn't come from the feds it comes from us count yeah cuz on a tiff those are our dollars not federal dollars so those would be our dollars that would be going I mean I I if have to refer if I could make a friendly suggestion this sounds like one of those issues um that may or may not have um a lot to it similar to the issues that that council member marker was talking about earlier this evening um it it sounds as though people might be interested in it but they don't know because they don't know what all the implications are would it be appropriate take it off the table well we can certainly added into consideration of the other the other uh amend ments that that may well be coming forward either in a follow-up ordinance or in a clarification to this ordinance that would be you know we can certainly get some answers yeah would that be acceptable to the motion maker in the seconder I certainly think it would make sense to offer some extra points for an improvement in an entprise Zone where we know we have a lot of buildings that need improvements and you know why not let them go into that area and make those improvements and give them extra points so that was my point so I don't think anyone's suggesting that's a bad idea I think what's being suggested is we don't know enough about it all right so all I'm suggesting is if it's okay with you as the motion maker and council member Mon Mon as a second that we add this into the list of things that needs a little bit more work okay and then it'll come back either um as part of the clarifications to this ordinance or it will come back um as a part of a follow-up ordinance that is also for clarification or in the meantime if it's not workable you could just send an email out to all of the council that my Amendment doesn't work may just another thought I I mean I I think what reie has suggested on the Enterprise Zone could be kind of interesting could we at least see if there's the votes since there's been a second for that I'd rather I'd rather put it into the ordinance and then we find out it shouldn't be there and it can be taken out before we final it then not put it in there and we could have and it would delay the fining of the ordinance is that log iCal oh yes yes it's logical but my assumption is there's going to be a follow-up ordinance anyhow and that this could be part of a follow-up ordinance just based on what I've heard from other issues that this could probably be I going to be a followup council member leer we can do it either way I don't care yes i' mayor I'd like to ask for some clarification on this item um is it I I thought that I heard or read that the applicant must identify a location before they can make an application is that correct or incorrect that's correct they have to identify an address yes they do prior to making application yes so this this suggested Amendment would only assist an applicant that already owned a building in the Enterprise zone is that correct at least for this first wave of applicants right it would you'd have to purchase it or buy one they'd have to either buy it on a speculative basis not knowing whether they're going to get a license or they already own it they could have it under contract contingent upon something so that's that's again theyd have to have a specific license with some type of binding contract that that's so they could option they could option to buy the property for two points so thank you well I will ask you council member Peterson and and council member Monier if you want to have a a vote to put the idea in it's Rob no it was it was me second or you want to set it aside I I want to vote all right okay the request has been made to have a vote the purpose would be to in essence um insert the concept with an understanding that um if it can't work it'll come out and if it can work that coun needs more of an explanation of what it is and how it can work so that there can be cleanup if necessary does that adequately describe where we are that's good all right any further discussion see none called a question on amendment number eight and amendment number eight is adopted on a vote of 7 to3 with council members broom marker and leir voting no okay mayor council mayor Pierce I have an amendment and I move to amend the city's marijuana ordinance to include the following language it's in section 146-153 marijuana establishments to add the language distance between marijuana let me start over distance between retail marijuana stores no retail marijuana store shall be licensed if located within 1,000 ft of any other retail marijuana store licensed pursuant to this article and if I get a second I will explain second move right now we have seconded by council member marker yeah right now we have no distance requirements between stores which means that they could be right next to each other or on the same Corner especially in the parts of town that were two uh Wards touch each other um and under that scenario would be the the stores could be kind of clustered together which I don't think is the image that we want to present to the public if we're trying to do this right and people may model um their ordinance after ours I think a th000 ft is appropriate between stores and uh a couple of marijuana folks that I talked to about this 1,000 foot distance between stores are seem to be okay with it I'm not saying all of them are but the ones I talked to a couple of them are okay so I would just like to propose a thousand feet distance between stores further discussion council member buron um you know I I understand where where council member Pierce is coming from but I do understand that also that it's difficult to find um retail spaces because of all the restrictions um that we put in and Federal Federal um Tang entanglements or whatever um I personally had rather let the market dictate where they can go um if for some reason two of them get close to each other you know I say so be it um I don't think that they will hinder each other's businesses um but if they will the market will will straighten that out so I am not going to be going along with with the thousand feet council member Monier yes thank you I will be voting no on this also I frankly don't care in W one if I have all four stores one on each corner like this that's a per that's a business decision for the business to make that is shouldn't be the decision that we're making and quite frankly if we did 1,000 ft in Ward one I'm not I don't think I there's space for a th foot barrier in Ward one so I'll be voting no thank you any further discussion see none call the question on amendment number n 1,000 ft distance oh I voted wrong I'm sorry you still got time to change and amendment number nine is defeated on a vote of three to7 with council members Pierce Brom and marker voting yes Mr mayor council member marker thank you Mr Mayor I wanted to also offer an amendment if I could get a a second just for the record that um the distance between speaking of distance um whoops where am I do I have I don't have the right Mr attorney I don't have the right one there way there we go that we strike the um City shall issue no more than four retail marijuana store licenses for each Ward that would leave us with 24 retail operations in the city but we won't be using the four per W formula to figure out where they are um if I could get a second I'll explain why I would like us to vote on that I'll second that thanks moveed by Council mber marker seconded by Council mber leir to remove the uh no more than four for each W language council member marker and thank you and my reason for wanting us to have a vote on the record for this is twofold one is because if this comes back in any other industry in our lifetimes I want there to be a record of a conversation about why the majority of you chose this procedure for spacing and allowing a business um we don't do it for any other Walgreens or any other business in the city and so I think it's important to have a permanent record of why we're doing it for this particular operation second I don't think to the point about the distance that there's enough locations in the city to allow a disperse to be quite as as surgically exact as we're wishing it would be with this application so um in an Ideal World maybe but I don't think that's going to be the case I think if these are businesses that submit operating plans and business plans and know what they're doing they're going to go where the consumers are and they're going to go where the business is um and that might not necessarily be dispersed across the wards so I'd like us to have a formal vote on this um con cep that is applied only to this business mayor prro um could I just ask council member marker to reread that please it's actually a deletion so I'm on I what I'm sorry about is I can't find what page I fit in on um but it's section 6- 310 and it's the limitation on the number of retail marijuana licenses and what it says now is there shall be no more than 24 retail marijuana store licenses issued in the city and then what it says now the sentence that I'm striking that I'd like to strike says the city shall issue no more than four retail marijuana store licenses for each board that's for those who have a paper copy it's on page eight of the ordinance page 466 of the backup section 6- 310 perfect yeah there it is and so I'm keeping the first sentence that says there shall be no more than 24 oh I see but I'm taking out the four retail per W okay I don't think it's doable and I don't think it would ever ask any other industry to do that thank you well I represent a Ward and I I believe that no there is no other business like this um this is a very unique business and I don't expect them to follow the same rules as Walgreens um but I since I represent a ward believe that they should be evenly spaced out in the city um so I will not be supporting this I believe that the four per Ward is is um should be agreeable to all the all the wards that way they're spaced out and no one will have five or six or seven or eight in their Ward uh I think this is is a better way to do this but that's just my opinion member Peterson um that was basically my my reasoning also being a w counselor um my uh constituents that I represent they don't want them all in in their uh neighborhoods and uh you know we're embarking on something we never have encountered before and this is a new um area that we don't all know yet I mean uh so we're I think the best way to do this is to spread it out equally and divide it up among the whole city council M broom thank you mayor I have a question for staff um we redistrict our Wards I think a couple times every 10 years what happens if uh uh we assign licenses and a license ends up being uh like particularly between my ward and Bob Roth being moved into Bob Ross Ward and then I've got three left and he's got five what happens in that situation I believe they would be probably grandfathered in may we call that one area since this was my idea um yes they would be grandfathered in and you would have three and Bob would have five but um if one close closed in Bob's Ward another one could not open up because then it would take it down to four so you could not put another one in his Ward until the numbers were equal C I'm comfortable with that if if the record reflects that and that's what the staff will end up doing okay any further discussion see none call the question on amendment number 10 eliminating the no more than four for each word and amendment number 10 comments um first of all I want to thank all of council and and particularly the staff and and Doug fed Nash and those that the industry everybody that's been a part of this because this has not been an easy um trying to get this all figured out and get it done um so I think everyone that's been involved everyone that's been involved um um deserves a pat on the back and I also I want to publicly say thank you to my colleagues um that we worked on the on the amendment 64 committee together in that we didn't always agree but I think as you have seen tonight I think that's where you come out with much better rules and much better ordinances when you can have that discussion um among ourselves so I app appreciate all the comments tonight whether I agreed or disagreed and lastly I think I believe I truly believe that Aurora is in the Forefront when it comes to retail marijuana there's only two states in the US that do retail marijuana as we all know it's Colorado and Washington State and I know council member broom brought up the fact that um the feds say that it's illegal we have a letter from from the uh Deputy attorney general that basically has said that the state of Colorado can can sell marijuana it outlines but basically it is telling us we will be watching you we will be watching this industry um to see how it works and how it happens and lastly one of the things that I truly think is very unique about the state of Colorado our citizens voted to allow retail marijuana and this goes back to one of my beliefs in states rights so I commend the state of Colorado I commend my colleagues for allowing it to happen in in Aurora because it is truly one of my beliefs that the states have a right to decide for themselves mayor Council mayor leer yes mayor I wanted to take a moment to specifically thank the amendment 64 committee um the council members that spent so many hours on that I know it might seem like we ripped all of your recommendations to shreds but it to me it was very valuable all of the work that was done and to be able to read the minutes and and make decisions based on all of the questions that you had asked so I really do appreciate all of the work that went into that mayor Pro rth uh not to pile on but I just wanted to say the same thing that uh council members Clin and Li GFF said I want to um thank all of council for their uh time spent on this and specifically the uh the other my other two colleagues council member claen and marker that were on the amendment 64 committee this was this was a lot of work and it was interesting because the number of times that I had people ask me well when is Aurora going to start talking about the marijuana issues and I'm like um well last February we've been working on it for over a year people weren't aware of that because our our neighbors to the West were getting all the headlines and trust me I am more than happy to be in the shadows and not in the spotlight on this one I was happy to let our neighbors to the West get all the headlines and and all the you know uh uh attention on this particular issue so that we could just work on it quietly but this was really um every time we came to a committee meeting there was more to learn um I I thank the council members for uh council member leer and other people have mentioned it in the past that you know they appreciate the work that we did and I I uh thank them for those sentiments but um my uh other Council colleagues that were on this committee it was it was fun it was frustrating at times but I think that we we did something that was pretty special council member marker I got a lot of knitting done thanks um I just had a separate an unrelated question for people that are curious about the taxing structure that will go along with the retail operations which I assume because of all our hard work will pass what's the um timeline on the taxing structure when do they get money we can spend Mr B currently the city would intend to uh Levy its general sales tax of 3.75% on retail sales uh we can uh do that when we uh issue retail licenses this fall uh council is potentially considering any additional special taxes that they would wish to do those would have to go to voters in the fall uh in November and once approved by voters that they would have to be uh adopted and and implemented in addition to the city's um general sales ta tax rate of 3.75% we would get our share of the state excise tax the state currently levies 15% excise tax on cultivation we would get 10% of that or 1.5% additional so uh we would get our our share of the excise tax in 3.75% when we open for retail sales and at this point we're intending all revenues to go into the general fund not in an earmark capacity correct okay thank you thank your comments and it was all well worthwhile so that's my report for this evening Council uh council member Hunter hola thank you mayor um in honor of the Holocaust awareness week I pulled up three quotes as Freedom loving people across the globe hope for an end to tyranny we will never forget the enormous suffering of the Holocaust and that's Bob Bo pre it is deeply shocking and incomprehensible to me that volumes of documentation and living Witnesses who can attest to the horrors of the holocost there are still those who would deny it Mark Udall is Discord going to show itself why we while we are still fighting is the Jew once again worth less than another oh it is sad very sad that once more for for the eenth time the old truth is confirmed what one Christian does in his own responsibility what one Jew does is thrown back at all Jews and Frank thank you catp bur thank you mayor I have a couple of things tonight uh first of all we um there was a Dr Cog awards banquet this week um downtown and Dr Cog stands for Denver Regional Council of governments um it's from all the um Metro cities and Aurora won two Awards so I would like to give uh kudos to the on Havana Street group they won a Gold Award for planning Economic Development and then um our um planner Mr Bob Watkins won the distinguished service award uh so he's been with the city for several years years and he's done a magnificent job so the two of them won awards and I want to say thank you very much um my next one is this coming Thursday May the 1st um there will be is what's called a National Day of Prayer this this has been going on since 1952 um and Aurora has um we have um at the uh let's see right now it's called the Faith Church it used to be called First Presbyterian Church it's on Alam and Molen so if you just go to that corner it's that big church right there on the corner uh Alam and Molen and we will be having um a lunch uh that starts at 11:15 if you have the time to come eat lunch with us we're having a baked potato and a salad bar catered by mallister Deli if you don't have that much time uh the program starts at 12: um and it goes to 1:5 and we are very prompt in getting out what we're excited about is the guest speaker this year is Chip Simmons he's the chaplain for the Denver Broncos he's a young fella and he's just full of energy and some great ideas and I guarantee you will love to hear him talk um and hear how he fell into this job of being the Chapin for the Broncos it's it's pretty remarkable so um just want you to know this is non- denom n inational we have pastors from um all across the board coming um and it is non-political whatsoever that doesn't play into it but it's it's a freedom of speech thing and so if you can come that would be wonderful um if you want to make a reservation that's great but you don't need to just come and uh enjoy lunch if you can it's $5 if you can't stay just come for the program and hear chip speak thank you C Pi thank you mayor um recently I had the opportunity with a group of folks to go up to the Aurora strong resilience Center this is a center that was opened up last year about a year ago kind of to help people with the um feelings they had on the Aurora shooting but Grace zosi is the manager of the Aurora strong resilience Center and she gave a great presentation about all the things that they offer at the resilience Center taiichi yoga massages and just conversation between people and a and one of the major things I learned from that from her presentation was that a lot of the families from the Coline shooting 15 years ago are coming to our Center and talking about their experience and then the families of our victims also of course go to the center it's open to everyone it's not just uh available to victim's families of the um of the shooting and AAR it's just open to everybody so I encourage everyone if they have to want to talk or want to get a massage or Tai Chi or talk about their struggles they can go to the uh to the res resilience Center the the website is auror strong.org and they're up in the old hoffen Heights Library at about 13th in Poria so I just want to put that out there for people who may have a need to go up there thanks Council mayor brim thank you mayor um since we don't have a city council meeting next Monday night I've scheduled my ward six town meeting for that evening at 7:00 it's going to be at a new location it's at the tolgate Crossing Community Center which is located at 24625 East Bellwood Drive um and the subject matter for the for that particular meeting is going to be the city's budget for 2015 and we'll also have a an update on the Gaylord Hotel project please come thank you Council M CLA um the only thing I thank you to report is says if anyone is interested Ro mental health is having its annual lunch um this Friday and uh they have the water coolers from Chicago that will be there so if anyone is watch watching um every year the city of Aurora honors the best and brightest from each class um in each school private and public and parochial um and that event is occurring Tuesday and Wednesday tomorrow and Wednesday um all the council is invited to be there we get lots of sore hands we um all the little kids come up and get their Awards and a key to the city and um it's the coolest thing so Tuesday tomorrow is at hinley and Wednesday is at Grand View the kids has the city has so many kids that we can't fit them all into one place in one night so um I'd also highly recommend this is your last weekend to see spam a lot at the fox positively hysterical and I'm not a Monty Python fan but I'm singing along and tapping my toes it's positively the most professional thing we've done yet um Monday night because there's no council meeting everybody up and Adam um over in my ward at Dora's Mexican restaurant is a very affordable fundraiser for $15 to benefit at the youth for Success program which is a summer learning program for kids um that Senator Todd and her husband have organized and run for the last several years and just on a point of personal privilege my daughter will be here next weekend for a job interview and I hope you'll all join me in crossing your fingers and toes that she doesn't get too scared and does well in the interview and gets the job good deal good good council member Peterson um I just want to announce that Aurora is having his birthday at we talked about it earlier and that's this Wednesday it's Aurora's 123rd birthday and there will be cake out in the lobby from 11: to 1 and everybody is welcome to join us for birthday cake for Aurora mayor protim Roth three quick items uh first of all if you were not aware of it there will be a game seven the ABS lost yeah secondly um had the opportunity to represent council at two events on Saturday the first one was at juwel elementary school for Comcast cares there was uh over 700 volunteers just a fantastic event Comcast does a really good job of reaching out to the community and and their partnership with uh with Aurora Public Schools has really been a strong one and then in the afternoon I went and read a proclamation at the Aurora Lions Club um their new member induction ceremony so th those were both good events that I was able to uh attend and then the last item I have is my next Ward town hall meeting it's a couple weeks away but on May 13th Tuesday May 13th starting at 6:30 we'll be meeting at the meadow Hills Golf Clubhouse I won't be in ward 6 this this month Bob so don't worry but we'll be in the uh Meadow Hills Golf Clubhouse and our prank primary presenter will be the pros Department Parks rep Recreation and open space and they will specifically be talking because of the Season specifically be talking about uh golf pools and the Forestry Department so I encourage you to be there thank you council member Monet thank you Mr Mayor very quickly say it to Sally first Wednesday of the month in May uh 3:30 to 6 Martin Luther K Library um I'd like to read something to you last week restoration Outreach programs which is in Ward one um partnered with the Denver Rescue Mission Refugee Department to hold a refugee celebrate Easter celebration the celebration included food Beverages and an Easter related craft for the children and gifts for the children for many of the kids it was their first Easter celebration it was a joyous and intimate celebration attended by 75 to 100 refugees from our community men women and children from Burma Nepal Ethiopia and Egypt it was a great opportunity to connect our Refugee population with churches Believers in our community for fellowship and discipleship and then uh lastly I am pleased to report that this grandmother of 12 is going to be a great grandmother in December of this year my first great yeah thank you fantastic thank you congratulations thank you all right that's great is there anyone
